meeting will be held in a hybrid manner

where members of council, staff, and the

This meeting is being livereamed and
recorded and will be available on the

township website. Notice is hereby
provided that under the authority of the
[6:41]
municipal act 2001 and in accordance
with the municipal freedom of
[6:46]
information and protection of privacy
act that all information attained is
[6:51]
considered part of the public record.
All rules apply to the meeting is if
[6:55]
everyone was attending in person and if
there is a problem with the technology
[7:00]
impacting the proceeding of the meeting
the meeting may be recessed. So I would

ask everyone that can to rise for the
playing of the national anthem.

We acknowledge that we are being hosted
on ancestrial lands of the Hodon noani,

acknowledge and welcome the presence of

today are recognized in the two row
wampom dish with one spoon treaty treaty

We uh actually started our council

meeting at 5:30. We did our opening and
uh then we went into close session for
[36:48]
half an hour. So we're coming back out
into open. So we won't be doing the the
[36:53]
actual opening over again. We'll just be
reconvening um where we left off. So
[36:59]
after being in close session, I will
bring the rising report forward that uh
[37:04]
council did meet in close session to
consider personal matters about an
[37:09]
identifiable individual pursuant to
section 239 2B of the municipal act.

So with that we're our first uh other
item is presentation. So, uh, we would
[37:23]
ask the OP detachment board annual
report presentation, please come on

members of council. Thank you for having
me here this evening. Uh for those who
[37:49]
of you who don't know me, my name is
Jessica Jones and I serve as the
[37:52]
community representative for Loyalist
Township and the town of Greater Napony
[37:56]
on the East Lennox Nington OP Detachment
Board. Um it's a pleasure to be here on
[38:02]
behalf of the board. This is my second
time I think presenting to this council.
[38:06]
Um, and uh, we're just here to present
the actual 2025 board report and police
[38:13]
activities and to provide council with
uh, an overview of the work the board's
[38:17]
been doing over the last year.
I'd like to begin by thanking uh,
[38:22]
Loyalist Township for its continued
support of the board. uh Loyalist
[38:26]
currently provides administrative
support to us through the municipal
[38:29]
clerk's office and that support they
receive uh from Jacob uh is extremely
[38:34]
valuable and we've worked um really hard
to establish and develop the new
[38:38]
attachment board. Uh so thank you Jacob.
Um and also although she's not here,
[38:43]
special thank you to Ann who was very
integral in helping us get our board
[38:46]
going which as we've been told by other
boards were quite ahead. So we uh have
[38:53]
to thank her as well.
Um just a little bit about the
[38:56]
detachment board. So in terms of
background, the East Lennox Nadington OP
[39:02]
Detachment Board represents the four
municipalities served by our OP
[39:05]
detachment. Addington Highlands
Township, the town of Greater Napony,
[39:09]
Loyalist Township, and Stone Mills
Township. Uh our role is one of civilian
[39:14]
governance and community representation.
We work collaboratively with the OP
[39:20]
detachment commander to provide guidance
and advice regarding policing services
[39:24]
and to help ensure that policing
priorities and initiatives reflect the
[39:27]
needs of the communities we represent.
An important part of that role is
[39:31]
supporting community safety while also
promoting transparency and
[39:34]
accountability and helping to maintain a
positive relationship between the OP and
[39:38]
the communities that it serves.
Under the Community Safety and Policing
[39:44]
Act, the OP detachment boards are also
required to provide an annual report to
[39:49]
the municipalities that they serve. And
the report that we have before council
[39:53]
fulfills that requirement and gives us
an opportunity to report back both on
[39:57]
the work the board does as well as um
what the OP does in policing our
[40:01]
communities.
Um, everyone should have a or council
[40:05]
should have a copy of the report. Great.
So, I'd have you turn to page three.

Um, so our actual board, so our board is
made up of six members, um, providing
[40:19]
both municipal and community
representation across those four
[40:23]
municipalities.
So, here in Loyalist, um, Mayor Hegedorn
[40:28]
serves as our council's representative,
and I have the privilege of serving as
[40:32]
the joint community representative for
Loyalist Township and Greater Napony.
[40:36]
Our other members include councelor Bob
Nory representing
[40:40]
Greater Napony, uh councelor Sher
Milligan representing Stone Mills, Tina
[40:45]
Marie Chamberlain as the community
representative for Addington Highlands
[40:48]
and Stone Mills, and Tony Fr who's now
representing the Addington Highlands
[40:53]
Council. Um before I continue, I would
just like to take a moment to recognize
[40:58]
the late uh Reeve Henry Hog. He
represented Addington Highlands on our
[41:03]
board from its formation in June of 2024
until his passing in October of 2025. Uh
[41:09]
Henry demonstrated a tremendous
commitment to public service and a
[41:12]
genuine dedication to his community. His
thoughtful contributions, hard work, and
[41:17]
commitment to both Addington Highlands
and the work of our board were very much
[41:21]
valued, and we are extremely grateful
for the time, knowledge, and dedication
[41:24]
he shared with us. His contributions
will be remembered, and he is certainly
[41:28]
missed. Tony Fr has since been appointed
to the Addington Highlands Council
[41:33]
representative and we are very pleased
to have him on the board as well.

Okay. And turning to page four.
[41:47]
Um because this is still a relatively
new board under the Community Safety and
[41:52]
Policing Act, a significant portion of
our work has involved establishing the
[41:57]
governance structure necessary for the
board to operate effectively. Um which
[42:03]
includes a lot of bylaws and policies
that are just the foundational work for
[42:07]
the board moving forward. Um that's
included developing and adopting our
[42:11]
bylaws and policies in areas such as
renumeration, misconduct, and conflict
[42:16]
of interest as well as communications
and information sharing. And you can see
[42:20]
on that page four, we have listed all of
the bylaws and policies that have been
[42:25]
established since um June of 2024.
Um, all six board members have also
[42:32]
completed prescribed training developed
by the Ministry of the Solicitor General
[42:37]
and it covered areas including police
governance, policing in Ontario, the
[42:41]
roles and responsibilities of the
detachment boards and requirements
[42:45]
relating to board appointments,
training, codes of conflict, uh, code
[42:48]
codes of conduct, apologies, and
conflicts of interest.
[42:52]
Um, while some of that work is not
necessarily the most visible part of
[42:56]
what we do, it has been an important
part of establishing a strong foundation
[43:00]
for the board and ensuring that we can
carry out our responsibilities
[43:03]
appropriately and effectively.
Um, you'll see further down on page
[43:08]
four, we highlight our meetings. Um, our
inaugural meeting was held on November
[43:14]
14th, 2024, and our our meeting records
are publicly available. We've also made
[43:20]
the decision to rotate our meetings
amongst the four municipalities
[43:24]
represented by the board. Um, which we
think is very important. Uh, although we
[43:29]
operate as one detachment board, uh, we
represent four distinct municipalities
[43:33]
and each with its own community,
geography, priorities, and policing
[43:36]
needs.
Um, moving on to page five is our board
[43:43]
budget.
[43:47]
Oh, I apologize. because I missed our
board support. I think I already
[43:50]
acknowledged that we uh do receive
support from the Louis Township
[43:53]
municipal clerk Jacob this time and
we're always very extremely grateful for
[43:58]
his guidance and assistance and
camaraderie. Uh board budget
[44:04]
uh under the community safety and
policing act, those estimates are
[44:08]
provided to each of the municipalities
receiving policing through the
[44:11]
detachment board along with their
respective share of the costs. In July
[44:15]
of 2025, the board approved its 2026
budget, which is included as appendix A
[44:21]
to this report.
Um, I won't spend too much time on the
[44:26]
budget just given that it's that it's
there um and available for the council
[44:30]
to read.
Uh, but it is one of our our statutory
[44:34]
responsibilities is to provide that.
Um, moving forward,
[44:40]
uh, we have resources on the page as
well if anyone wants to read more on the
[44:47]
community safety and policing act, the
Ontario provincial police, um, or the
[44:52]
inspector of policing who mandates a lot
of what we're responsible for.
[44:57]
Uh, overall 2025 was an important year
for East Lanx and Addington OP
[45:02]
detachment board. Uh much of our work
has been about establishing the board,
[45:07]
putting the necessary governance pieces
in place, completing our training and
[45:11]
developing the processes and
relationships that will allow us to
[45:14]
effectively represent our municipalities
and communities going forward. And while
[45:19]
governance is an important part of our
mandate, ultimately our work comes back
[45:22]
to community safety and policing. uh our
role is to ensure that there's a strong
[45:27]
connection between the communities we
represent and the OP providing policing
[45:32]
services to them and that community
needs and priorities continue to be a
[45:36]
part of those conversations.
Uh the second part of the report
[45:41]
actually focuses on the policing
activities during 2025 including their
[45:46]
calls for service statistics,
complaints, and the detachment board
[45:50]
action plan moving forward. Those are
identified as the primary areas of the
[45:54]
policing portion of the annual report
and I believe that should be attached as
[45:58]
appendix B.
[46:02]
And of course uh that's a little bit
lengthier so I won't go through that.
[46:07]
Um just to wrap it up I just want to
again thank Mayor Hegedorn and the
[46:11]
members of council for the opportunity
to be here uh this evening and provide
[46:16]
the update on behalf of the East Lennox
Nington OP Detachment Board. I'd also
[46:21]
like to thank Loyalist Township uh for
the ongoing support of the board as well
[46:26]
as our fellow uh board members who are
not here today. Um as well as our
[46:31]
municipal partners and uh detachment
commander uh Tvel for all of uh his help
[46:38]
and guidance and working with us to
accomplish as much as we have. uh we
[46:42]
really do have like a wonderful
wonderful relationship with the OP and
[46:47]
the synchrony we've had in creating the
board and establishing it and
[46:50]
accomplishing things has been
almost too lucky. So I want to thank
[46:56]
them as well. And as we continue to
develop, our focus will remain on
[47:00]
ensuring that the communities we
represent have a meaningful voice in
[47:04]
policing priorities and that we continue
to foster a strong collaborative
[47:08]
relationship between our municipalities,
our residents, and the OP. Um, so thank
[47:14]
you very much and uh happy to answer any
questions you might have that I'm
[47:19]
capable of answering.

So, open forum. There are 15 minutes of
[48:19]
the meeting that's been set aside for
open forum.

Any individual may address council
regarding an item on the agenda,
[48:26]
excluding matters under the statutory
public meeting section, which we didn't
[48:30]
have any this evening. Uh, each person
has three minutes to speak and uh we do
[48:36]
have four that are registered at this
time. Um, so we will go through them. Um
[48:43]
and then I will open it up in chambers
if someone has uh something they wish to
[48:49]
speak on um with that's on the agenda
and then I will open it up to the
[48:56]
virtual audience as well and just for
the ver virtual audience um I will be
[49:02]
asking when it comes time for you to use
the raised hand feature uh so that you
[49:08]
can uh we will know that you want to
speak and we will be able to bring you
[49:11]
into the meeting. So, I will just go
through the list of uh the ones that are
[49:19]
signed up to speak. And first, Bill
Lowry, did you want to speak this this

Um, it was kind of I don't know if I
want to say ironic. Uh, but when I got
[49:44]
the call to uh see if I wanted to
volunteer to serve in the chair of
[49:50]
deputy, um, it was the same way that I
got into politics. Um, my next door
[49:56]
neighbor back in what was it 1999 came
to me and said, "Did you ever think
[50:02]
about getting into politics?" And I just
looked at him and thought he was in
[50:07]
space somewhere. But uh I went home and
thought about it and I was thinking
[50:12]
about retiring and that road was going
to come and I wanted something to do. So
[50:18]
because I was appointed, it was only a
two-year term in a three-year election.
[50:23]
uh the deputy mayor at that time, Arnold
Adams, uh left for health reasons and uh
[50:30]
his position was filled as chair uh or
um was filled from the counselors of the
[50:36]
of the day which was Clayton Mchuan. So
that left a halling council. So it just
[50:41]
was all an immediate flashback when I
got to call friendly municipality to see
[50:45]
if I wanted to put my name forward and
uh for I I just immediately felt that I
[50:52]
did. There was no hesitation, you know,
it was just yes, they're asking me to do
[50:56]
something and I'd like to do it.
So, if there's anything on the page that
[51:04]
I wrote down in my history, uh, I'd be
more than happy to answer any questions.

council. Uh, as you saw in my

application, I was quite brief.
uh I would I have time
[51:52]
and I believe I have enough
uh background to fill the position
[52:01]
and uh
I was surprised to be remembered from
[52:06]
that far back and would like to thank
the person who put my name forward.
[52:13]
Uh when I read the minutes yesterday or
the agenda yesterday,
[52:18]
uh I looked at the the other candidates
and they're very high level people and
[52:25]
we were part of a team and uh
if I'm on or one of the who advances
[52:35]
it would be as part of a team. You have

Good evening. I wish to speak briefly
[53:14]
regarding agenda item 1110, the
appointment to fill the vacant position
[53:19]
of deputy mayor for Loyalist Township.
Thank you for this opportunity to
[53:23]
express my appreciation to council for
nominating me as a candidate for the
[53:28]
position of deputy mayor. It is truly an
honor. As you know, my 39-year career in
[53:34]
municipal government was on the
administration side, not the council
[53:38]
side. I never expected to give a can
campaign speech. So, this is the closest
[53:43]
I ever have or ever will uh do so or
ever will come close to doing so. That
[53:52]
fact differentiates me from the other
nominees whom I respect for their
[53:56]
lengthy political service to the
township and who I whom I respect as
[54:00]
individuals and former colleagues. They
are worthy candidates.
[54:05]
Election speeches focus on why one
candidate should be selected over
[54:09]
another. We, my former co nominees and
I, my fellow nominees and I, have all
[54:15]
served the township in our time and made
a me meaningful contribution in our own
[54:20]
sphere of operation and influence. Now,
however, I would ask council to consider
[54:26]
the ongoing involvement I have had in
township matters since my retirement as
[54:31]
a fundraiser, as a witness for the
township before the Ontario Land
[54:35]
Tribunal, and more extensively as an
active member of an advisory member
[54:41]
advisory committee to council for
several years. As deputy mayor, even for
[54:46]
this temporary appointment, I would take
my role seriously as the position
[54:50]
deserves, and I would dedicate my time
and talents fully. Once again, thank
[54:54]
you, council, for honoring me with this
nomination, and thank you for your
[54:59]
consideration tonight.

thank all three of you for being here

I'll say more later, but uh I've worked
[55:17]
so much with all three of you that uh
it's it's awesome to see you here this
[55:21]

Good evening, mayor, members of council.
I'm here today uh this evening regarding
[55:46]
item 111,
mitigation for Sherwood Avenue bus stop
[55:50]
alteration and the staff report SR 3252
as this directly affects my property. Uh
[55:58]
I appreciate uh the township's efforts
to find a practical solution and I
[56:02]
support option one which is the proposed
18 m of fencing the change to the bylaw
[56:09]
to increase the height to 8 ft. I
believe that this will address privacy
[56:14]
and change sighteline issues. However, I
have two significant concerns with the
[56:20]
conditions that you have attached to
option one. First is the financial
[56:24]
arrangement. Option one requires my
family to obtain quotations, arrange and
[56:30]
pay for the work in advance, up to
$10,000.
[56:35]
This is the year in which I retire. I
had no plans to have a family
[56:39]
expenditure of up to $10,000 this year.
I do not believe that I should be held
[56:46]
personally to finance what is the
township's responsibility to mitigate.
[56:51]
Township created this issue. If option
one is approved, I would ask that
[56:56]
township pay the contractor, whomever
that would be, directly or establish
[57:00]
another arrangement for payment
and not require me to fund this project
[57:06]
upfront. My second concern is the
proposed release of claims.
[57:12]
In the staff report on page eight, the
report report refers to release by the
[57:17]
resident of any future claims. On page
nine, it states, "Any compensation
[57:24]
provided to this property owner would
require a full release of all claims. My
[57:31]
concern is that the staff report does
not provide me a copy of the release,
[57:36]
what the language is in that release,
and what it will state. It also does not
[57:42]
identify what rights I would be required
to give up as part of the claim. I
[57:48]
cannot agree to release claims when I
have not been provided with the
[57:52]
documentation or the language defining
that release. The fence addresses
[57:58]
privacy issues, but the report also
identifies concerns with drainage,
[58:02]
weeds, and grading which remain
unsolved. I'm willing to accept defense
[58:07]
as mitigation for the loss of privacy,
but I am not willing to accept the
[58:10]
blanket release of all claims arising
from this project, particularly when the
[58:15]
scope of this project has not been fully
understood. It's not yet complete. I
[58:22]
also want to preserve my family's
position regarding injurious affection
[58:26]
under Ontario's expropriation act. I am
asking council to make not I'm not
[58:32]
asking council to make any legal
determinations. I am simply asking that
[58:36]
you ac that having me accept one
mitigation measure to surrender rights
[58:41]
to any other issues that may arise from
this project is not acceptable. So my
[58:47]
request to council is straightforward.
One, I ask that that option one be
[58:52]
amended to address these concerns, that
I not be required to personally finance
[58:56]
the project upfront, and that and that
the release of claims will be restricted
[59:01]
to issues related to privacy only. I
present that to you for your respectful
[59:07]
consideration as you make a decision on
that item tonight. Thank you.

the opportunity to come and talk to you.
My name is David Lazel. My wife is
[1:00:39]
Katherine Win Edwards and we're the
owners of the 9600 Southshore Road that
[1:00:44]
is on Ammerst Island and uh and we're
part of the fishing village in Ammerst
[1:00:48]
Island. It was created about 100 years
ago as you probably know uh to be the
[1:00:52]
Eastern Lake Ontario commercial fishery.
Uh today there's about eight there's
[1:00:57]
eight homes on Ammerst Island and in the
fishing village. Um we're one of the two
[1:01:01]
that are cottages. Six of the eight are
actually uh year- round residences and
[1:01:06]
as shown in here. What I want to show,
what I want to highlight here is that uh
[1:01:11]
the township has two public rightways
through this area. One public rightway
[1:01:15]
goes right through the middle of the
properties and it's actually being used
[1:01:18]
today. There's another public rightway,
this was created a couple years later
[1:01:22]
that goes around the properties uh as
you can show on the line. It's actually
[1:01:25]
not being used right now. And a lot of
the issues that we're talking about are
[1:01:29]
about the public rightway that goes
through the properties that was uh
[1:01:32]
started in about 1964, 1965.
Um this uh what we are looking at is we
[1:01:40]
bought 9600 social road about 20 years
ago and it's been used as a family
[1:01:44]
cottage and and this is in 20 2006.
In 2008 we moved to Calgary. We then
[1:01:51]
moved back again, retired, moved back to
Kingston area and uh uh and in 2023 we
[1:01:58]
really wanted to invest in the cottage
and and fix it up. And we've been doing
[1:02:01]
a lot of work as you can see in the
list. I won't take you through all the
[1:02:04]
uh horrifying details, but nonetheless,
um the one of the projects we really
[1:02:09]
wanted to do was to put in a septic
system and get us into the 20th century
[1:02:13]
with, you know, things like flush
toilets and running water. And um and so
[1:02:17]
we had to move the boat house in order
to do that. And I think some of you I've
[1:02:20]
talked to uh as as we went through a
bylaw amendment and permit uh to move
[1:02:25]
the boat house. We obviously wanted to
put electricity in the new boat house
[1:02:28]
and we wanted to bring water for for use
around the workshop boat house. uh uh
[1:02:33]
but we were told not to add that into
the amendment request because it was a
[1:02:37]
straightforward simple process to move
power and electricity electricity and
[1:02:42]
water under the road uh when we needed
it. It turns out that that's not the
[1:02:46]
case. Um so what we're here today to
talk about, we've been working for five
[1:02:50]
or six months now with the township to
try to get uh requests to reconnect the
[1:02:54]
water and electricity uh to our the boat
house which has now been moved uh at
[1:03:00]
that considerable expense, I might add.
So our request is um in this property we
[1:03:05]
own the land under the road and there's
a rightway municipal rightway of of the
[1:03:09]
road. So um in our understanding and
talking to our lawyers etc. We own the
[1:03:14]
bedrock and the township owns the road
that sits on the bedrock. What we are
[1:03:18]
asking permission to do is to uh
temporarily for a few hours in one day
[1:03:23]
remove the road, close the road, remove
the uh gravel on the top of the road,
[1:03:29]
jackhammer into the bedrock, lay down
power and water and conduits under the
[1:03:34]
road, then recovered up and then put the
township road back in place and all is
[1:03:38]
done and good. And of course, this is
done all the time in the township as you
[1:03:42]
people move uh uh water from say shore
wells across roads etc. Um, so that's
[1:03:48]
what we're asking to be done. Township
staff has told us that we must apply for
[1:03:53]
uh in under the bylaw that's being
talked about, a 10-year encroachment
[1:03:57]
permit. And part of the rules in this
10-year encroachment permit and in the
[1:04:02]
bylaw is we have to must have a plan of
survey that's uh uh prepared by an
[1:04:07]
Ontario land surveyor. Uh the the
encroachment permit is only 25 bucks or
[1:04:11]
35 absolutely fine. Uh the problem is is
that the land survey to get them out is
[1:04:16]
to do this is about $3500 to $4,000
which seems uh crazy and we were we were
[1:04:22]
told that this is unusual but
everybody's talked to about who put
[1:04:25]
services on the roads. We also need an
excavation permit which is ability to
[1:04:29]
excavate the road. We have serious
concerns about uh the encroachment per
[1:04:33]
excavation permit no problem. Um first
of all the cost of the survey. Second,
[1:04:38]
the really lack of justification for why
we need a 10-year encroachment permit
[1:04:42]
when we actually own the land. We're not
encroaching on we're only encroaching on
[1:04:46]
the municipal land for a few hours,
right? As to be open up the road and
[1:04:50]
then we close it up, put it back again,
all is done. The potential that this
[1:04:54]
encroachment permit will be registered
on a title because encroachment permits,
[1:04:58]
long-term encroachment permits like this
are typically registered on titles and
[1:05:02]
they're going to decrease the value of
our property. And then third, the
[1:05:05]
potential that the township was only
given a 10-year engrossment permit could
[1:05:08]
actually turn around in 10 years and
say, "Oh, wait. No, we we now you got to
[1:05:11]
take the services back out again."
Again, that's going to uh damage uh the
[1:05:15]
value of the property and our ability to
enjoy it. We therefore ask council to
[1:05:20]
consider, we're really asking, we've got
a three-stage consideration because we
[1:05:23]
don't we've never really understood why
we're being asked to do this. Our
[1:05:27]
priority one request is that the is just
basically remove the requirement for the
[1:05:32]
encroachment permit and and we'll still
do the excavation permit and our
[1:05:36]
justification is that the private
utilities will be placed and maintained
[1:05:40]
by us within our property lines within
our property under the the road and it's
[1:05:45]
in the it's in the breadro. Uh and
certainly there's lots of evidence we
[1:05:49]
have that other recent permits the
township has given to move water and
[1:05:53]
electricity across roads on Ammerst uh
for example shore wheels have not
[1:05:56]
required encroachment permits like this
with tenure. Uh third is despite
[1:06:01]
numerous requests to the township and to
be honest I don't think the township
[1:06:05]
staff really understand why there is
just a bylaw that they're following and
[1:06:09]
they can't really they never saying why
is this exist it doesn't make sense. Um,
[1:06:14]
if you can't do our permit request,
priority request one, we ask you then to
[1:06:21]
reduce the encroachment permit request
from a 10-year request to a one-day
[1:06:25]
request. If you go into Ontario property
law, there's encroachment permits can
[1:06:29]
have be a temporary permit. They is
under a year. We're only going to
[1:06:33]
disturb public land for under a year or
under a day, under a few hours actually.
[1:06:37]
Or for permanent or long-term, and
that's more than a year. I would argue
[1:06:42]
that clearly if there is an encroachment
on talent's property at all and I would
[1:06:47]
argue it's not really an encroachment
it's just a disturbance of the property
[1:06:50]
it would only be for a few hours why a
10-year permit and why all this need for
[1:06:55]
for u adjustments etc and also signing a
10-year permit would imply that the
[1:07:01]
township has rights to our land that we
own under the road and I would say the
[1:07:05]
township total rights to the road not
the land under the road if you can't do
[1:07:10]
one by one or number two, this is kind
of the third one is please provide us a
[1:07:14]
rationale for why you require a 10-year
permit and then eliminate the need for
[1:07:20]
the survey. It's an incredibly expensive
survey for the little bit we're asking
[1:07:23]
for. we've already spent lots of money
moving things and doing doing other
[1:07:27]
things with the township and it's been
good working with the township and other
[1:07:30]
projects and and second to um do not
require the registration of this
[1:07:36]
encroachment theoretical encroachment on
property because it's going to affect
[1:07:40]
the value of our property. Uh and uh we
just high cost for sure. Most long-term
[1:07:47]
permits are for ex are for existing
structures. you know, somebody's got a
[1:07:51]
building on public land and you have to
have a long-term encroachment. This is a
[1:07:55]
temporary disturbance, very different
from most uh encroachments uh that the
[1:07:59]
township must have with other land
owners. And the township has already
[1:08:03]
said that they, you know, that the
actual location, you know, they're not
[1:08:07]
actually not going to use the permit. If
we went and did a survey, I'm sorry,
[1:08:11]
they're not actually going to use that
survey because they're going to come out
[1:08:14]
and do their own where where the actual
lines are going to be put. and the
[1:08:19]
survey which is only a theoretical
survey where we talking about putting
[1:08:22]
them not where they're actually going to
be putting it to be honest it doesn't
[1:08:26]
make sense the whole the whole thing um
and registration of this beautiful encro
[1:08:30]
this puditive encroachment on our
property uh would actually reduce the
[1:08:35]
value of our property and we think
that's that's not reasonable in what
[1:08:38]
we're asking for. So we have actually
proposed three motions. We'd say you
[1:08:42]
know if you accept one great we're done
and gone. Uh if you really want to go to
[1:08:46]
two, okay, you really want to go to
three, please. Uh um that these are the
[1:08:52]
the essentially staged uh motions that
we would propose, but I'm happy to
[1:08:57]
answer any questions and I'm sure

Um I'm just uh the question I have uh
[1:11:58]
and again um I don't know if this is
ahead of the head of the horse to put it
[1:12:03]
easy but um um the applicant uh has made
some very good points and uh the concern
[1:12:10]
I think the concern um I would look at
is
[1:12:15]
is it policy of the township to ask
people to pay things upfront? Um, is
[1:12:20]
there some kind of uh
um what's the word? I won't some kind of
[1:12:27]
uh benefit from the township uh doing
the work in terms of they have suppliers
[1:12:32]
etc etc. Um I'm concerned about the
wording of the um the um recommendation
[1:12:39]
in the sense that uh um it's asking for
a blanket release I believe were Mr.
[1:12:44]
cost his words and with drainage and
other things I can understand a uh you
[1:12:50]
know a release from future work on the
fence that's totally legit um a and you
[1:12:56]
know I guess progress has unintended
consequences and this may be one of them
[1:13:01]
it's nobody's fault but it it happens
and um I think uh we need to make it
[1:13:07]
right as a township because I've been
there I've talked to Mr. cost a couple
[1:13:11]
times and um there's nothing
unreasonable from my point of view that
[1:13:15]
has been made here. Just leave it at
that.
[1:13:21]
» Do are there any answers to that? There
was procurement and then couple other
[1:13:26]
» I can speak to that. That was not
necessarily a public works portion of
[1:13:29]
the staff report was put in from a risk
management perspective. Uh this is
[1:13:33]
actually a claim that would usually go
through insurance and in terms of a
[1:13:37]
claim for damages to their property. Um
and that process in writing the response
[1:13:43]
to how we mitigate this. Um essentially
we're bypassing that project that
[1:13:48]
process for you know getting it claimed
in terms of what gets paid here. Um, I
[1:13:53]
think council wanted to know how this
gets mitigated and you asked about the
[1:13:57]
township doing the work is we don't want
to do work on private property ever and
[1:14:02]
there's there will be mitigating
circumstances and other things that come
[1:14:05]
with erecting this fence. So, we want to
agree to what the work's done and we'll
[1:14:09]
pay for a certain amount. We can pay the
contractor directly certainly, but if
[1:14:13]
the bill is $10,500,
we're still only, you know, our
[1:14:17]
recommendation is to pay$10,000. So um
it wouldn't be the the township going on
[1:14:23]
private property and doing you know the
private property work usually in this
[1:14:27]
case and the the ask for the release is
as I said this is normally would be
[1:14:31]
going through a claim process if we
can't sort of work out the issues are in
[1:14:35]
terms of whether the property owner
continues to think that there's a claim
[1:14:39]
for damages because of drainage or
anything else with respect to this
[1:14:43]
project. it should really be going
through insurance and thus that's why
[1:14:47]
the release was for once the project's
done and any mitigation that staff can
[1:14:52]
do to mitigate any sort of drainage
concerns or once the final grading is
[1:14:56]
done and whatnot. Uh I know there's
issue with weeds and things like that,
[1:15:00]
but those those claims um the request is
that that would all be done and then
[1:15:05]
we'd know what the total claim would be
for this project and it should all be
[1:15:09]
done in one f that's the recommendation
from staff is that it would be dealt
[1:15:13]
with altogether and the release would be
for any other damages resulting from
[1:15:18]
this construction project.
[1:15:22]

an insurance issue. Is that what you're
saying in a in a short version?

» Uh, the property owner is requesting a
claim essentially for damages
[1:15:37]
to their property from the township,
lack of privacy for damages. So um when

claims are made usually they go through
the insurance project the process in
[1:15:49]
terms of what is what is paid or not
paid in this sense council um and staff
[1:15:53]
have agreed there is an impact um
but usually it doesn't just go through
[1:16:00]
it it we've often asked for it to go
through insurance for these kinds of
[1:16:04]
claims from constructions if there's
damages to a property because of
[1:16:07]
drainage or loss of privacy
that would usually go through the claims
[1:16:12]
process.
[1:16:14]

without lumping in the the weeds or the

this case, you know, I I'm not sure that
we would be held negligent with respect
[1:17:11]
to the the damages for a privacy issue,
but certainly we can do the release
[1:17:16]
however council directs. And if you wish
it just to be for the fence, that can be
[1:17:19]
done.

I'm just thinking an entrepreneurial
person might sell that permit to

day while they're working. So, will we

have a control for that? And what's the
plan for enforcement of the uh parking?

Uh the intention would be to link those
permits to a license plate and uh don't
[1:31:07]
necessarily think they'll be written
right on the tag, but but they will they
[1:31:10]
will have some sort of ident identifying
number and that will be linked back to
[1:31:16]
the to the license plate.

mayor vacancy and the clerk's department

process that will take place as council
moves ahead to fill the appointment for
[1:32:10]
the deputy mayor position for the
remainder of the 2022 to 2026 council
[1:32:14]
term.
The report attached to the agenda
[1:32:18]
provides a comprehensive overview of the
background of the vacancy, the
[1:32:21]
legislative requirements set out by the
municipal act that relate to the
[1:32:24]
vacancy, and the direction given by
council during the June 23rd council
[1:32:29]
meeting as to how the vacancy will be
filled. In short, council directed staff
[1:32:34]
to reach out to select individuals who
formerly served served as members of
[1:32:38]
council or as the township township's
CEO. Of the names provided, three
[1:32:43]
confirmed they that they would be
willing to fill the role and are
[1:32:46]
eligible to do so. Tonight, council will
have the opportunity to nominate one of
[1:32:51]
those three candidates to fill the
deputy mayor role through resolution,
[1:32:54]
which will be voted on as a regular
motion. Should the motion fail, council
[1:32:58]
will have the opportunity to continue
nominating candidates until an
[1:33:02]
nomination passes.
Following the successful motion to
[1:33:06]
appoint a candidate, the candidate will
swear and sign the declaration of office
[1:33:10]
prior to taking their seat as the deputy
mayor for the remainder of the meeting.

motion, I'd like to just go a little bit
of out of order and thank all three
[1:33:39]
candidates for allowing your name to
stand. Um, as I started to mention
[1:33:44]
before, I've worked with all three of
you. um Bill, my first mayor
[1:33:50]
and uh mentored me more than I thought
you did at the time and uh and uh
[1:33:58]
left left an impression and so I'm
grateful that you were let your name
[1:34:03]
stand. And John, as I'd mentioned
before, I sat beside you down here for
[1:34:08]
two terms, and I think it was the second
meeting where you started mentoring me
[1:34:13]
and uh helped me along, got me uh um
basically gave me my confidence to be
[1:34:20]
able to do the job and it was amazing
and I really appreciate it. And the one
[1:34:26]
thing your wife said to my wife when I
started was
[1:34:31]
learn to do things without them. get a
hobby and get go on your own vacations
[1:34:35]
because you won't see them anymore.
Well, this month I think I've seen her
[1:34:39]
one weekend. So, she listened to Pat
very well. [laughter]
[1:34:44]
And and Diane, um CEO, I started working
with you in 2000, I think it was when I
[1:34:51]
became on went on the police services
board and then throughout being on
[1:34:54]
council while you're here. um great
leadership, great knowledge and a great
[1:35:00]
understanding of of all processes as
well. So, I just wanted to thank all
[1:35:04]
three of you. The quality and
qualifications of the people sitting
[1:35:09]
here is amazing. Um it's outstanding
that a municipality has uh the brain
[1:35:16]
trust, the experience, and uh the
willingness to step up and help when the
[1:35:21]
time is needed. and the township is very
blessed to have all three of you here
[1:35:26]
this evening. So uh unfortunately only
one is going to be successful but uh I
[1:35:33]
think all of you in your comments uh
made it very clear that uh you're
[1:35:38]
looking at this in a very mature way and
knowing that one one is successful and
[1:35:44]
uh but I wanted to thank all of you in
advance for taking the time to actually
[1:35:49]
let your name stand. So with that, it's
time for a resolution, right? Okay, it's
[1:35:56]
on the screen here. So I would open it
up for a motion. And the there's three

That would all be for the person that is

uh uh becomes deputy mayor because those
are the the positions that the past
[1:36:18]
deputy mayor held. and you're just
filling in for the rest of the term for
[1:36:22]
all of his what Nathan used to do. So

three very good candidates and there is

still going to be some council seats
available, but I know that you people

have moved on to better things in life,
but I do sincerely want to thank
[1:37:40]
everybody. This is one of the toughest
decisions for me in the three years and
[1:37:45]
a bit, but you've all added to the
township in your own special ways and uh
[1:37:50]
um, as the mayor said, your willingness
to step forward is greatly appreciated.

politician to a staff role that we now
invite a former staff person to the dark

the privilege of attending the

dedication of the uh new Bar Homes uh
aquatic center and recognizing uh Bar

Homes Laam Pools, the Savage family
[1:44:10]
and Cunningham Swan for uh their
contributions to what is a beautiful
[1:44:15]
facility and I'm hearing such good
feedback in the community already. So
[1:44:19]
very grateful to have that project

behalf of a family in Ammerst, I want to
thank the community grant fund. Um they
[1:44:35]
received uh a donation from the mayor's
discret discretionary fund and the uh
[1:44:42]
purpose was to go to the world wrestling
championships. One of the people, a
[1:44:47]
resident of Loy, of Ammerst and Loyalist
was competing in Kazakhstan, I think it
[1:44:52]
was called, and they appreciate that.
And I had a chance to go to the island
[1:44:55]
for the rock and roll show or whatever
it was last.
[1:44:59]

really well attended and it was a great

time.

I'm just going to

congratulate the agricultural society,
Odessa Agricultural Society on a very
[1:45:16]
success successful fair. Um it uh it's
great to have all the community events
[1:45:23]
for uh all of the residents and and
outside the township to come in to enjoy
[1:45:30]
what we have here. And the fair was
another one. And I just am very pleased
[1:45:37]
that the township still has two
agriculture societies now as well as a a
[1:45:44]
fair within the township. So well done.
