[8:03] pipe. Now the pipe filling up is if
[8:05] there's a rain event at the same time.
[8:08] So this is if there is a title event
[8:11] with a rain event and there's not enough
[8:13] pressure from the roadway to push that
[8:16] gasket open, it is then going to cause
[8:19] some minor issues on the roadway with
[8:21] flooding. But once once that tide goes
[8:25] down, you'll see that that valve opened
[8:27] up and was allowed able to empty the
[8:30] roadway. So I just thought it was really
[8:32] important for you all to see how that
[8:33] works. Obviously
[8:36] issues that we have had in the past
[8:39] would be if there is any type of debris
[8:41] that gets stuck within that gasket. We
[8:44] have had issues in certain areas. We do
[8:46] have these in Boca. We have them in
[8:49] 137th Avenue Circle. And then we did
[8:52] have one on Puit Drive, but we upsized
[8:54] that pipe. So, this project would put
[8:57] another valve in that location because
[8:59] it is extremely low.
[9:02] At the beginning, whenever we first
[9:04] received these valves back in 2017, we
[9:06] had a big education push that we did
[9:09] that helped tremendously with the
[9:11] residents. So residents that don't hold
[9:13] their landscaping debris in their yards
[9:17] and ones that are particularly right at
[9:19] the inlets typically are the issue. But
[9:23] with the landscape ordinance that Joe is
[9:25] working on and Marcy's team, that'll
[9:27] help tremendously. But what you've all
[9:30] seen, and I'm not sure if anyone has
[9:31] driven around, that the title events
[9:33] that we've had in the last couple weeks
[9:35] in the areas where we do have the
[9:37] valves, the water did not did not
[9:40] overtake the roadway. Was it in the curb
[9:42] line? Probably because water will find
[9:44] the path of least resistance. It's not
[9:46] going to 100% stop the water, but it
[9:49] will slow it down enough to where it
[9:50] will not cover the roadway. So this is
[9:53] an option that the residents have asked
[9:55] us to re to try to you know alleviate.
[9:59] This is the best solution for what we
[10:02] currently have in place until we start
[10:04] being more resilient and raising
[10:06] roadways.

[17:34] around that valve is a big big big
[17:37] proponent. So, we that's why we're going
[17:39] through this project the way that we
[17:41] are.

[32:03] think that uh Commissioner Dylan is
[32:05] referring to Senate Bill 180. There's a
[32:08] requirement under that Senate Bill 180
[32:10] that we cannot adopt regulations that
[32:14] are more restrictive than what we
[32:16] currently have for uh the period of time
[32:19] listed in the in in the law. But these
[32:22] are making it less restrictive. And so,
[32:25] the Senate Bill 180 would not apply. it
[32:28] it doesn't prohibit us from adopting
[32:30] this ordinance because it's less
[32:32] restrictive.
[32:34] So, in other words, you're letting more
[32:36] things happen than what the code
[32:38] currently allows.
[32:40] So,
[32:40] >> and and one thing I think that comes

[32:48] emailed attorney Tras a while ago to
[32:50] confirm well if the deadline passes say

[33:02] pulled the permits. Can we take some
[33:06] code enforcement action to like force
[33:08] demolition?
[33:09] And the attorney's interpretation of the
[33:12] current code is no. There would need to
[33:14] be some kind of other violation of the
[33:17] code, whether it's a nuisance or they're
[33:19] caught doing work without a permit. So
[33:22] essentially what that means is if the
[33:24] deadline wasn't extended
[33:27] then it would just result in anyone that
[33:30] submits a remodel permit after the
[33:32] deadline the remodel permit would just
[33:34] get denied and then it would potentially
[33:38] have the opposite effect that we're
[33:39] wanting and the property would sit
[33:41] abandoned for even longer because it
[33:43] takes longer to get new builds plans
[33:46] prepared than a remodel.

[33:53] me do we just kick it down the road 6
[33:55] months as opposed to a year I mean and
[33:58] I'm asking you people for your advice.

[34:46] to whether or not all of those homes are
[34:48] just sitting vacant, you know,
[34:50] rodentinfested.
[34:52] And that's kind of my concern. and many
[34:56] of the other people that were here in
[34:58] the original discussion, the real estate
[35:01] people, if you're trying to sell your
[35:03] house and you're going by all these
[35:05] places that are abandoned or look to be
[35:08] abandoned, it's not a very good look.
[35:11] So, that was my concern about kicking it
[35:13] down the line.
[35:15] I think that the better conversation for
[35:17] us would be to add to our next workshop
[35:20] code enforcement because the issue you
[35:25] the issue of the abandoned homes and the
[35:28] overgrown grass we've talked about we've
[35:31] been talking about for over two years

[35:36] years now because we're in August about
[35:39] the houses and the the issues and code
[35:42] enforcement and getting our deputies
[35:45] um a clear definition of what it is
[35:48] we're looking for that they are
[35:49] responsible for doing and then a better
[35:53] definition for our our code enforcers
[35:55] that are internal for what we're looking
[35:58] for for the community and having some
[36:00] sort of reporting system to be able to
[36:03] at least once a month provide to the
[36:04] community how many properties have been
[36:06] code enforced, what happened with them,
[36:09] where they're at, not the specific
[36:11] properties, but the number. and what
[36:13] we're doing and also to educate the
[36:15] community and ourselves as well on what
[36:18] that looks like. What can we do? What
[36:20] can we not do? Part of this conversation
[36:23] was there are many people who own
[36:26] properties in MadiRaa who are still
[36:28] waiting to find out if they're going to
[36:30] be approved. There are many people who
[36:32] are still waiting on their insurance to
[36:34] pay. And so by not extending it for
[36:39] another year, then we're telling them
[36:42] that, you know what, it doesn't matter.
[36:44] Time's up for you. You're done. But we
[36:46] still can't make them do anything, you
[36:48] know? So, we're giving them a year so
[36:50] that they can breathe. They have the
[36:52] opportunity um to be able to find out
[36:55] whether or not they're going to qualify
[36:56] for a program that's going to help them
[36:58] with whatever the program is. There's
[37:00] there's several different programs out
[37:02] there people have applied for. And then
[37:04] in the meantime, I think it would be
[37:06] best for us in my view that we our next
[37:10] workshop doesn't have very much on it
[37:12] and that we spend some really good hard
[37:14] conversation on what our ordinances says
[37:18] we can do with code enforcement and give
[37:21] the direction to the people who are
[37:23] responsible for enforcing it in what we
[37:25] want to see done and that would make a

[39:18] there were three abandoned homes and
[39:20] they weren't cutting their grass, I

[49:02] neighborhood. Number two, the extent to
[49:04] which traffic generated as a result of
[49:06] the location of the proposed al
[49:08] alcoholic beverage request will create
[49:10] congestion or present a safety hazard.

[49:15] proposed use is compatible with the
[49:17] particular location for which is which
[49:19] it is proposed. Number four, whether or
[49:22] not the proposed use will adversely
[49:24] affect the public safety. And number
[49:27] five, no application for review under
[49:30] this section shall be considered until
[49:32] the applicant is paid in full any
[49:35] outstanding charges, fees, interest,
[49:36] fines, or penalties owed by the
[49:38] applicant to the city under any section
[49:41] of the code.
[49:43] Uh the burden of proof in this case is
[49:45] set forth in section 2-10A of your um
[49:49] code of ordinances and it reads as
[49:51] follows. The applicant shall have the
[49:53] burden of proof at the hearing to show
[49:55] by a greater weight of the evidence that
[49:56] the application is consistent with the
[49:59] city's comprehensive plan and complies
[50:01] with all procedural requirements of law.
[50:04] Conditions may be suggested by the
[50:06] applicant, the city or any party or may
[50:08] be imposed by the board which are
[50:10] intended to assure consistency.

[55:46] a churbo boat would not uh adversely
[55:49] affect public safety. The proposed
[55:50] alcoholic beverage license would be
[55:51] replacing an existing alcohol alcoholic
[55:54] beverage license because of a change in
[55:56] ownership. The vessels are licensed and
[55:58] registered with the US Coast Guard. The
[56:00] dock where the vessel is located is more
[56:01] than 500 ft away from any established
[56:04] church, synagogue, temple, or place of
[56:06] religious worship, public or private
[56:07] school operating for the instruction of
[56:10] minors or youth recreation center. No
[56:12] application for the review under this
[56:14] section shall be considered until the
[56:15] applicant has paid in full any
[56:18] outstanding charges, fees, interest,

[1:01:29] data that we want. And what that does is
[1:01:32] that this will turn into the fee
[1:01:35] schedule that you all approved earlier
[1:01:37] because now we per Florida state
[1:01:40] statute, they have to have a life safety
[1:01:41] fire inspection and we charge for that,
[1:01:44] you know, and then it will also help
[1:01:46] community development. I'll let Marcy
[1:01:48] speak on that. And we are looking to
[1:01:50] split this down the middle between both
[1:01:52] departments.
[1:01:54] The the benefit that community
[1:01:57] development will see from this is
[1:01:58] through the code enforcement and finding

[1:02:02] to provide the data to us in a lat long
[1:02:04] format which will then feed into
[1:02:06] 4Erunner and it'll interact with our map
[1:02:10] that shows where short terminals are
[1:02:11] allowed and where they're not and help
[1:02:13] flush out the ones that are being
[1:02:16] advertised at locations where they're
[1:02:17] not legally allowed to operate. So that
[1:02:20] would help code enforcement. and they'll
[1:02:21] also identify ones that are operating
[1:02:23] legally but maybe didn't know they
[1:02:24] needed a BTR and stuff like that. So, we
[1:02:26] would then be able to contact them. Um,
[1:02:28] we would be able to do our rental
[1:02:29] inspections as well. So, that would be
[1:02:31] helpful in identifying that too.

[1:02:50] AirDNA DNA contract on the agenda and as
[1:02:54] both the real estate broker and owner of
[1:02:56] multiple short-term rental properties, I
[1:02:58] wanted to offer some perspective for the
[1:03:00] commission's consideration. In reviewing
[1:03:02] the memorandum, I understand the primary
[1:03:04] purpose of software is to help identify
[1:03:06] illegal or unregistered short-term
[1:03:08] rentals. I fully support that goal. um
[1:03:11] those operating outside the rules can
[1:03:13] negatively impact those of us who have
[1:03:15] taken the necessary steps to operate
[1:03:16] legally and comply with city
[1:03:18] requirements. My concern however is with
[1:03:21] the accuracy and uh and reliability of
[1:03:24] the ARDNA data. In my experience
[1:03:27] reviewing ARDNA data, I found it to be
[1:03:29] questionable at best. Um for instance,
[1:03:33] um the main use of their software is to
[1:03:35] project what you will make it as far as
[1:03:38] rental income.
[1:03:40] it's horribly often from my use cases.
[1:03:45] Um, so if their main use is
[1:03:50] that poor, it I I'd kind of question
[1:03:53] some of the other secondary data they
[1:03:55] provide. Um, so more relevant to the
[1:03:57] city's proposed use. I'm also aware of
[1:04:00] properties that continue to appear in
[1:04:02] AirDNA's system even though they've been
[1:04:04] dormant and have not operated as
[1:04:06] short-term rental for extended periods
[1:04:08] of time. sometimes even years because
[1:04:11] one of my old properties show up that
[1:04:12] way. Um, before the city relies on this
[1:04:15] data, I identify potential violations or
[1:04:17] send notifications to property owners. I
[1:04:19] would encourage commission to make sure
[1:04:20] there's additional checks and balances
[1:04:22] in place to independently verify the
[1:04:24] information. AirDNA may be useful as an
[1:04:27] initial screening tool, but I'd caution
[1:04:29] against treating its data as definitive
[1:04:31] evidence that a property is currently
[1:04:33] operating as a legal short-term rental.
[1:04:36] Um, is a weird coincidence today. I've
[1:04:38] actually received an email from a
[1:04:40] property management group um, just
[1:04:42] forwarding to me the AirDNA software
[1:04:45] telling me how much I can make with one
[1:04:47] of my properties as a short-term rental.
[1:04:49] The only problem there are projections
[1:04:51] for this property. It's not legally
[1:04:52] zoned to be a short-term rental.
[1:04:55] So, just again, there's some some
[1:04:58] challenges. Ultimately, I support the
[1:05:00] city's efforts to identify and address
[1:05:03] um, illegal short-term rentals. I simply
[1:05:05] want to make sure the city's getting
[1:05:07] reliable value for the approximately
[1:05:10] $22,000 being spent and that property
[1:05:12] owners are not being unnecessarily
[1:05:14] contacted or subjected to enforcement
[1:05:16] efforts because it's inaccurate or
[1:05:18] outdated third party data. Thank you for

[1:07:25] to us to do what we want with it. You

[1:07:29] access to the zoning or if they do,
[1:07:31] they're not going to dig that deep into

[1:15:56] environmental issue, would we be able to
[1:15:58] negotiate the price?

[1:16:22] assessment, it's in the contract that
[1:16:24] says we have um up to 60 days to get a a
[1:16:29] phase two. Phase two is sampling and
[1:16:32] things of that effect. as we were I was
[1:16:35] going through the um the environmental
[1:16:38] um I think it's called a supplemental
[1:16:40] site assessment that was done that was
[1:16:42] the um that's in the um
[1:16:48] in your package. Uh it states that that
[1:16:52] the contamination was just in the soil
[1:16:56] and not in the groundwater. Therefore,
[1:16:59] most likely we would not have to proceed

[1:19:53] give the city the full 10 acres. I
[1:19:56] believe it's right at 10 acres all of
[1:19:57] it. And um we had a meeting where we
[1:20:01] gave the city manager's office the
[1:20:03] authorization to pursue purchasing the
[1:20:06] property. And so what he's done is he's
[1:20:10] gone out and negotiated a contract. and
[1:20:13] he has to bring that contract to us to
[1:20:16] approve it so that he can do the next
[1:20:18] steps which is to get the appraisals, do
[1:20:22] the um due diligence on the
[1:20:24] environmental testing and then it would
[1:20:26] come back to us with all of that
[1:20:28] information. I think what Mike is saying
[1:20:30] is that we received the contract today
[1:20:32] at like 6:20 signed and so the meeting
[1:20:35] had already started. he did not have the
[1:20:38] opportunity to share the contract with
[1:20:40] everyone so that everyone here could
[1:20:42] read the contract and see what it says
[1:20:45] and the purchase price and all of that.
[1:20:47] That's what he was giving the
[1:20:49] information on. Um, as far as the
[1:20:52] purchasing of it, four of us did give
[1:20:55] authorization to move forward. Um, but I
[1:20:58] any questions that you have about the
[1:21:00] property, whether it's the the what
[1:21:03] we've already purchased or this, we can

[1:22:54] site had a 2,000galon underground
[1:22:57] storage tank and part of the state
[1:23:00] wanting to come in and aband and wanted
[1:23:02] those abandoned tanks to be removed. So
[1:23:05] the state um paid for the removal of the
[1:23:10] 2,000galon underground storage tank and
[1:23:12] then they also paid for a an assessment
[1:23:17] afterwards to see what type of
[1:23:20] contamination was left behind. Part of
[1:23:23] that was to take soil samples and also
[1:23:26] take groundwater samples of that area.
[1:23:28] So there's probably and I I counted them
[1:23:30] up but I can't remember. I think there's
[1:23:32] five environmental um monitoring wells
[1:23:35] out there and over the years they've
[1:23:38] been sampling those and they do not have
[1:23:40] any contamination. However, when they
[1:23:42] did the removal of the tank, there was
[1:23:44] some leftover um soil contamination.
[1:23:49] It wasn't to the point, it wasn't in a
[1:23:51] an amount that the state says, okay,
[1:23:53] this is an environmental hazard. It's
[1:23:55] just that there's traces of petroleum in
[1:23:59] the soil. Um, the only time that that
[1:24:03] would be of hazard is if we were to tear
[1:24:05] the building down, pull up the the
[1:24:08] foundation, uh, and start to try to
[1:24:10] build something on that. this program
[1:24:13] that the state has uh if we do go that
[1:24:17] route ter you know to to remove the
[1:24:20] building and the foundations the state
[1:24:24] would come in and for their at their
[1:24:27] cost remove the top 2 feet of soil um so
[1:24:31] that's the program that that site is
[1:24:33] under and it gets transferred over to
[1:24:35] the city so I see it as a very small
[1:24:38] risk of that contamination again we have
[1:24:42] to do our due diligence on the envir
[1:24:44] environmental site assessment phase one.
[1:24:47] That phase one will then direct us if we
[1:24:51] need to do a uh a phase two.

[1:42:22] basketball and volleyball specialty camp
[1:42:24] um in conjunction with OciOla High
[1:42:26] School, we utilize their indoor gym with
[1:42:28] our joint use agreement. We had over 100
[1:42:30] kids participate in that uh that
[1:42:32] specialty camp program. It's the first
[1:42:33] year we've done this. So, um we're
[1:42:35] really looking at expanding our athletic
[1:42:37] programming uh in that aspect. So, um
[1:42:40] right now we have fall youth soccer. Uh
[1:42:43] registration is open. Um and then we're
[1:42:47] also planning and looking forward at our
[1:42:49] our winter programming. Um last year we
[1:42:51] instituted the the volleyball the indoor
[1:42:54] volleyball uh co-ed uh big big big hit.
[1:42:57] So, we're looking to expand that even
[1:42:59] more uh this coming uh winter spring
[1:43:03] season. Um senior programming. So, our
[1:43:05] Madira Beach Social Club is still on its
[1:43:07] summer break. Um staff, we are
[1:43:09] finalizing the schedule and programming
[1:43:11] for the upcoming season. Um which our
[1:43:14] first uh get together for the season
[1:43:16] takes place September 14th.
[1:43:19] Uh child care, we just recently wrapped
[1:43:21] up another successful summer camp
[1:43:22] serving approximately 70 children each
[1:43:25] day. Um that program included daily
[1:43:27] field trips and larger weekly trips uh
[1:43:30] to places like the zoo, the aquarium,
[1:43:32] educational outings. Um our after school
[1:43:35] program uh is full for this season. So
[1:43:37] we are operating on a wait list. That
[1:43:38] program um it's limited by uh the space
[1:43:42] of our facility. We can only legally
[1:43:44] have so many children um in the rec
[1:43:47] center uh for after school care. So we
[1:43:49] are full. We have a wait list. Uh we are
[1:43:51] accepting uh for that. Um, special
[1:43:54] events. So, we are in the final planning
[1:43:56] stages for the 3rd annual Madiraa Beach
[1:43:58] Burger Week. Uh, that's taking place
[1:44:00] August 21st through the 30th, as you all
[1:44:02] know. Uh, 18 restaurants participating.
[1:44:06] Um,
[1:44:08] we have the burger bus taking place
[1:44:09] August 22nd. So, tickets are on sale for
[1:44:12] the burger bus if you are interested. We
[1:44:14] are going to three different
[1:44:14] restaurants.
[1:44:16] um on the bus is a tour of all different
[1:44:20] burger love and community fun. So, uh
[1:44:24] that should be a really good time. Um
[1:44:26] and then
[1:44:29] to back up even more, Village Friday is
[1:44:31] our burger week kickoff party as you all
[1:44:32] know. Um that'll start at 6:00 down at
[1:44:35] John's Pass featuring live music from
[1:44:36] the Crowns. Um we'll be down there
[1:44:38] handing out Burger Week passports. We
[1:44:40] have some Burger Week giveaway promo
[1:44:41] items. Um, we also have some Burger Week
[1:44:44] merchandise that is for sale in the city
[1:44:46] store. We will also have it down there
[1:44:48] at Village Friday for sale as well. And
[1:44:51] then we do also have Burger with the
[1:44:53] Board on August 26th at the Cambria
[1:44:55] Hotel. That's taking place from 12 to 2.

[1:45:00] your burgers. And it's kind of a
[1:45:02] spin-off of Conversations with the
[1:45:03] mayor, but we're going to have a burger
[1:45:05] with the board. So, really excited about

[1:45:11] recreation wise is uh the 45th annual
[1:45:14] John Best Seafood Festival. Um, so we're
[1:45:18] we're in crunch time for that planning.

[1:45:24] and 25th. Uh, vendor applications are
[1:45:26] still open through the end of August.
