[9:20] code update for Title 16, subdivision ordinance, and I believe our Director Greg is going

[9:32] Today before you, we had intended to bring the first section of the development code

[9:36] update to the Commission for your recommendation to the Board of Supervisors to adopt at this

[9:43] point in time due to some absences and scheduled vacations and a technical matter after a

[9:51] conference with the county surveyor, we're asking that the item be continued to the September

[9:56] 18th agenda for a description of our approach and methodology to the separation of the development

[10:06] code and the necessary changes that were made and to address the CEQA compliance for

[10:11] the item.

[10:12] So at this time, what we're asking from the Commission is your continuance of the

[10:16] item to the September 18th at the regularly scheduled meeting of 9 o'clock.

[10:27] transition and I know a lot of this was worked on at previous meetings and some

[10:31] of those concerns and comments and items that we had wanted addressed in that

[10:45] commissioners actually on your concerns on the matter if you'd like to

[13:21] explain our methodology on this, and then we would give an explanation of our approach

[14:02] which is referenced in the recommendations and justification section of page 7 of

[14:08] the staff report on our report that we have.

[14:13] Could the staff clarify the basis

[14:15] for determination specifically? And my question, sir, is does this ordinance

[14:21] update include any changes to actual land use of development standards?

[14:31] For

[14:31] or other development requirements or is this update limited strictly to the

[14:39] administrative and organizational changes such as reorganizing existing code

[14:44] sections and corrected outdated references. I'd appreciate it if the

[14:51] staff could walk us all through this distinction since it's

[14:58] the basis of this.

[15:11] it's primarily the reason that we've separated or segregated what was referred to as the development

[15:17] code back into Title 16 and Title 17, which is zoning and or development standards. As

[15:26] As Commissioner Wardle had pointed out, we had identified a section of the CEQA guidelines

[15:34] 15378B5, which allows for administrative changes and updates.

[15:39] In this particular case, Title 16 is primarily a regulatory instrument on the administration

[15:45] of the Subdivision Map Act by local government.

[15:48] That's what Title 16 does for us, and it is in fact exactly what Commissioner Wardle

[15:53] had suggested an update to the code to identify both statutory and regulatory changes to the

[16:01] way we administrate that act. So in this particular case, anything that would affect density,

[16:08] development standards, any of those things that would be found in Title 17, we have segregated

[16:13] for this purpose so that would allow us to move forward with Title 16 under that administrative

[16:20] section of CEQA identifying this would not be, in fact, a project per se as identified under CEQA

[16:27] and would allow for further environmental evaluation on a project by project basis. So your question,

[16:34] it was in fact a question, but your question was also kind of an answer and it was perfectly stated.

[16:39] That's exactly what we're doing.
