[0:02] foreign
[0:28] I've heard things I don't know
[0:31] I don't know what's happening
[0:35] happens to that
[0:41] on water and sewer
[0:51] um
[0:58] thank you
[1:10] you guys paid cash for this
[1:15] supposed to
[1:16] create subject
[1:24] okay
[1:36] how long will this take
[2:10] good morning chaplain can you hear us
[2:15] cool
[2:24] where's your suit and tie Chaplin
[2:35] that's only for live meetings
[2:42] well today is technically your Friday so
[2:45] yeah it is
[2:53] I'm even going to try to get out of town
[2:55] a little early but we shall see
[4:27] thank you
[4:53] this
[5:02] is
[7:14] good morning I'd like to call the uh
[7:18] Village Council work session meeting
[7:20] August 31st 2023 to order I show the
[7:24] time at 907 I also show we have a quorum
[7:27] uh the only one we're missing is Wayne
[7:30] at this time and is he planning to come
[7:34] to we know or is he going to participate
[7:36] remotely
[7:37] Christina or Austin did he say
[7:45] all right well we'll just see if he
[7:47] joins us
[7:48] um next up uh
[7:51] who if he does join us I need a motion
[7:55] to consider allowing Council to
[7:58] okay
[7:59] sounds good
[8:01] um
[8:02] next up we have adoption of the agenda
[8:04] do we have any changes or omissions or
[8:08] yes we need to add under items of
[8:12] discussion number 13.
[8:15] discussion of Geo Bond public education
[8:17] project scheduled
[8:19] and
[8:21] microphone
[8:22] and number 14 consider approval of
[8:25] change order from first try on for
[8:27] geobond advertisement at NOCO at a cost
[8:30] not to exceed thirteen thousand dollars
[8:32] and direct staff to prepare the budget
[8:34] amendment
[8:36] and that is all I have Mr Mayor all
[8:38] right anyone else from Council
[8:40] that or
[8:42] all right I'll need a motion to approve
[8:44] the agenda as amended so moved all's in
[8:47] favor
[8:48] aye
[8:55] first up on presentations we do not have
[8:58] any I assume is that correct Christina
[9:02] and that it was a discussion okay first
[9:04] up under items of discussion we had
[9:06] discussion consideration of a private
[9:08] road acceptance plan traffic mitigation
[9:11] fund non-marvin Road
[9:14] allocation plan in conjunction with
[9:17] General obligation fund issues issuance
[9:21] pending March 2024 election results
[9:26] is that you Christina
[9:30] Jamie your trunks open
[9:33] your trunk
[9:35] steal something
[9:37] um
[9:39] good morning mayor and cancel
[9:43] so
[9:44] um the last time we were here I think
[9:47] jazza was here and we discussed the
[9:49] total number for the
[9:52] General obligation bond for roads the
[9:54] total tax number which we had kind of
[9:56] landed on a 4.5
[9:58] Cent increase in year 26 and then an
[10:02] additional three cent in 2029 he can
[10:05] correct me if I'm wrong
[10:07] um
[10:08] since then there's been a couple of
[10:10] things that we've thought of that you
[10:11] might want to consider adding in but
[10:14] there's one particular thing that I want
[10:16] to make sure we discuss
[10:17] and just to note that any additional
[10:19] roads that we're going to discuss today
[10:21] or any additional deletions would have
[10:25] would have an impact on that model so
[10:26] those numbers that I previously
[10:28] mentioned will be impacted if we change
[10:30] anything at this point
[10:31] the biggest piece as you as you all know
[10:33] we've been working with DOT to get the
[10:35] roads
[10:37] um intended to be released if the Geo
[10:40] Bond passes it's definitely something we
[10:42] want to have in our back pocket to make
[10:44] sure that they're willing and able to do
[10:45] what we want and that we're educating
[10:47] the citizens to um
[10:50] to that degree and so we've had a couple
[10:52] meetings with DOT
[10:54] we are for the most part
[10:56] they're in line with what we're trying
[10:58] to do there's a couple of hiccups on
[11:00] Marvin School Road Waxhaw Marvin
[11:03] and then Newtown Road which I didn't
[11:06] specify in this memo but Newtown Road is
[11:08] one of them
[11:10] basically they want to maintain control
[11:13] of the roundabouts unless they have
[11:15] unless we own 100 of the functionality
[11:19] of the roundabout so what that would
[11:20] mean is you'd have to back up from any
[11:23] given roundabout approximately 1500
[11:25] linear feet they want to be able to
[11:28] control the kind of stat that flows into
[11:31] the functionality of those roundabouts
[11:33] so the last time we had met for the most
[11:35] part all of the roads in Marvin they
[11:37] were okay with us taking over
[11:39] with the exception of this roundabout
[11:41] here they want us to go back all the way
[11:43] to the Ladera Providence down south
[11:46] entrance
[11:47] chaplain's still researching to make
[11:49] sure that we're able to do that I let
[11:51] him speak on that in just a second hold
[11:52] on Christina is it the PDS or is it
[11:55] Ladera because CDs is way before it's
[11:58] the it's the Ladera and it's the Ladera
[12:00] Gates there
[12:03] um hang on I can tell you the exact
[12:04] because PBS and were there are not like
[12:07] pds's first then Ladera but Ladera and
[12:10] the gates
[12:11] are across from each other thank you let
[12:14] me I'll look at that I'll look at that
[12:15] real quick but it is Ladera I can't it's
[12:18] a weird it's a weird Road name okay
[12:21] um
[12:24] chaplain do you have that road name
[12:25] pulled up by chance
[12:27] lucky I do I do not lucky something yeah
[12:32] that's the intersection
[12:34] is that PDS no no okay
[12:40] yeah because it's all horse names lucky
[12:42] Debonair is PDS so so it's that yeah
[12:45] it's that intersection so it doesn't go
[12:47] all the way down to Ladera then right
[12:49] well this says Ladera Drive
[12:51] well you've got Ladera slash lucky
[12:54] Debonair way yeah lucky debonaira and
[12:57] then Ladera Drive is across the street
[12:59] lucky Dev
[13:01] Ansley
[13:04] yes
[13:05] hang on let me pass this down I'll show
[13:07] you I'm looking
[13:09] no lucky Debonair goes into
[13:14] you know
[13:18] nope you're right it does it goes into
[13:20] Gates okay okay that's fine
[13:23] just just double checking
[13:28] you good okay
[13:30] so basically that's where they would
[13:31] want us to go down
[13:33] um
[13:34] they're willing right now to give us the
[13:37] uh they're willing to stop at Rising
[13:39] Road
[13:41] and then we would have to figure out
[13:42] basically from rising road all the way
[13:44] down to that intersection that I just
[13:46] mentioned in order to get
[13:48] between here
[13:49] and that would include the Marvin School
[13:51] Road
[13:52] going back 1500 feet if they don't
[13:55] so they won't do the wax on Marvin
[13:57] roundabout they want to do both of these
[13:59] together
[14:01] so so any and ever any of in all
[14:03] roundabouts they would want us to have a
[14:04] hundred percent basically back 1500 feet
[14:08] so we wax on Marvin would be included
[14:10] yes we would that that section's fine
[14:12] just getting
[14:15] all the way down to that intersection
[14:16] that I mentioned the lucky debonaira
[14:20] in order to get that that roundabout if
[14:22] we don't have that
[14:23] intersection down there they're not
[14:25] willing to give us any of this stretch
[14:27] because they want to control that
[14:28] functionality
[14:31] um that being said we can either exclude
[14:33] this this portion and go to Rising Road
[14:36] and still have ownership and control
[14:37] over there same thing with here we'd
[14:39] probably have to go back to the first
[14:41] intersection which I think is flowering
[14:43] Peach area
[14:44] and then have control all the way down
[14:47] and then we'd have to figure that out
[14:49] what that area would be on the wax on
[14:51] Marvin so my question to you all if if
[14:53] we're still researching this if we are
[14:55] willing and able to
[14:57] find a solution to have ownership and
[14:59] control over this section from Village
[15:02] Hall to the lucky debonaira is canceled
[15:05] willing to do that
[15:08] we and just so you all know I have I
[15:11] have reached out to the gates of Ainsley
[15:13] Ladera and PDS about potentially
[15:16] annexing their common area
[15:18] which would basically mean just that
[15:20] road Frontage so that we can
[15:21] have an easier process for ownership and
[15:25] control if if they are open to that idea
[15:27] they're discussing it with their
[15:28] respective HOA boards
[15:31] I gave them a deadline of October 1st I
[15:33] believe
[15:35] so we should have an answer back from
[15:36] them shortly
[15:38] well if we can get the uh the right of
[15:40] ways then there's no issue right if we
[15:43] can what if we get the right of ways and
[15:45] there's no issue we can chaplain's still
[15:47] researching that because it's called a
[15:51] half Road and there may be some
[15:52] workarounds so we're still looking into
[15:54] that but the more conventional and
[15:57] easier way
[15:58] is to have parties on both sides that's
[16:01] what I'm saying so if we get the right
[16:02] of ways then we are
[16:04] yeah the common areas I should say then
[16:07] we on both sides of the road
[16:09] then what then we're on both sides of
[16:11] the road yes then it's not an issue at
[16:13] all yes okay
[16:25] they would go
[16:27] approximately 10 years before they
[16:30] failed
[16:31] started failing having backups on the
[16:34] roundabouts which would require a second
[16:36] Lane right in each thing so think about
[16:39] that when we are deciding if we're going
[16:42] to take that over that's going to no
[16:44] longer be on the D.O.T or the state
[16:47] that's going to be on us
[16:49] The Village I don't even know what that
[16:51] well but then the one thing to consider
[16:54] Joe is the traffic impact of our
[16:57] heritage District where it's going to be
[16:59] restrictive and we probably don't want
[17:01] to add those two lanes so dot was
[17:04] planning
[17:06] um through traffic with no restrictions
[17:09] okay so probably four lane
[17:11] South Carolina to Providence possibly
[17:14] but they I mean I was
[17:16] and at those meetings and all that and
[17:18] heard all that stuff too at the time and
[17:20] and that was their plan is that they had
[17:23] projected a two percent growth per year
[17:26] in traffic volume and that was why they
[17:28] did that and acquired the extra right of
[17:31] way to expand those so that and
[17:36] concern
[17:37] um
[17:37] Mr Mayor of us that us being on the hook
[17:40] for that it's going to come down to the
[17:42] same thing if we build a roundabout at
[17:44] Marvin and Joe Carr if we build a
[17:46] roundabout at Joe Carr and Marvin School
[17:48] Road like those will then be our roads
[17:50] but we will do exactly what
[17:53] dot does and we'll go out and get
[17:55] funding federal state even though there
[17:57] are roads like we would do the same
[17:59] thing that the state does because I've
[18:01] had that conversation with Hunter
[18:02] because I was like oh time out like I
[18:03] don't want all this stuff if we have to
[18:05] then
[18:07] 100 on the hook for it right and he's
[18:10] like no we we would go out for funding
[18:12] and things like that for it yeah there's
[18:14] federal DOT grants and funding for with
[18:17] road construction
[18:22] how are you we'll be reaching out to
[18:25] everyone here yeah absolutely will you
[18:28] hit the button on the microphone
[18:30] so we've invited Bjorn from the county
[18:32] because he just happened to be in the
[18:34] audience good morning Bjorn Hanson with
[18:36] Union County planning so if I understand
[18:39] the discussion the village is looking at
[18:42] taking ownership and responsibility of
[18:45] some sections of
[18:46] Newtown and some roads intersecting with
[18:49] Newtown pretty much in the area where
[18:51] we're sitting right now
[18:53] okay the thing I would note
[18:56] is that if the municipal municipality
[18:59] owns them the dot doesn't own it it may
[19:01] lose its federal aid designation
[19:04] meaning that you couldn't apply for
[19:06] carpo funds in the future you would lose
[19:08] that eligibility
[19:11] I'm not saying that's a hundred percent
[19:13] but that's definitely something you're
[19:15] gonna have to look into because if
[19:16] you're operating the road in a different
[19:18] way if you look at the map
[19:20] uh which we were successfully between
[19:23] the county the tap the village and the
[19:26] City of Charlotte
[19:27] three years ago with Marvin Roe which is
[19:29] why we're actually talking about
[19:30] potentially doing a design at Joe car
[19:32] and Marvin we were ineligible to do so
[19:34] in the past because we couldn't use
[19:37] carpo money on that section of road now
[19:39] we can
[19:40] you're going to want to make sure that
[19:43] any of your actions are not going to
[19:44] result in those sections of roads being
[19:46] taken off of the Federal Aid System
[19:48] unless you're willing to pay for all the
[19:49] cost of those improvements okay well
[19:51] yeah because I had talked to because
[19:52] that was a concern of mine because I was
[19:54] like I don't want to be on the hook for
[19:55] all of that if it's you know now our
[19:57] Reds and Hunter seem to think that we
[19:59] would be okay but we'll double check on
[20:02] that so sure yeah Okay cool so one of
[20:04] the things I'll mention to you all is
[20:07] there's a couple different issues with
[20:09] this is number one if we are owning
[20:11] roads that are not within our
[20:14] jurisdiction we're still researching but
[20:16] we think that we cannot use Powell Bill
[20:18] funds to pay for those roads to be
[20:20] maintained so if we decide to do this
[20:22] section here let's just say it's 1500
[20:25] linear feed I'm not really sure exactly
[20:27] how much it is but let's just say that
[20:28] then we would have to come up with some
[20:30] type of payment allocation where we
[20:32] would spend general fund dollars on
[20:33] whatever cost of that fifteen hundred
[20:36] dollars would be that's not in the
[20:37] jurisdiction chaplain and I are still
[20:39] researching that
[20:41] um to tell you 100 for sure
[20:44] we can have that answer and we can also
[20:46] look to see if we would lose the federal
[20:48] funding what we can do
[20:51] um with this specific section if if
[20:53] y'all are leaning if y'all are leaning
[20:55] towards you don't really know where to
[20:58] go on
[21:00] keeping this in or taking it out I would
[21:02] suggest you probably keep it in for now
[21:04] and we can always take it out later
[21:05] might as well tell citizens the worst
[21:08] case scenario we can always take it out
[21:10] if we don't if we find that we can't do
[21:13] it and then we'll just borrow less which
[21:15] will be less of an impact to them so
[21:18] [Music]
[21:23] costs that we're taking over the roads
[21:25] part of the cost is we're going to be re
[21:27] we're going to be getting all of our
[21:29] roads up to what Marvin standards are
[21:31] yes so at that point we will take that
[21:33] out to the entrance of Ladera with the
[21:36] Geo Bond money so how long is that road
[21:39] going to last 15 years
[21:43] um we did not do an assessment on that
[21:45] road because it's not in our
[21:47] jurisdiction currently I can tell you
[21:49] what Jill do you happen to have that PCS
[21:51] pulled up for Newtown but my I think
[21:53] it's a 44. we're going to have it read
[21:56] we're going to have it brought up to
[21:57] Marvin standards if that's what we have
[21:58] to take then we're going to have it
[21:59] brought up to Marvin standard yes so
[22:01] then we will have a
[22:03] life expectancy of however much it is 12
[22:07] years 15 years whatever it may be and
[22:09] then so during that time because we
[22:11] can't use Powell Bill funds unless we
[22:13] get
[22:14] common space on each side that would
[22:17] then bring it into Marvin we could then
[22:18] have it in Marvin
[22:21] um we can be putting money away for that
[22:23] 1500
[22:24] linear feet correct okay so we would
[22:27] have some time to then put it away if we
[22:29] couldn't specifically just use Powerball
[22:31] funds on it yes initially and and
[22:34] chaplain will have to continue to
[22:36] research this on his end I don't know if
[22:38] we can use the general fund dollars I'm
[22:40] sorry the general obligation dollars
[22:42] that we obtained from the Geo bond for
[22:45] that section that's a question that we'd
[22:46] still have to research let me I'll write
[22:49] that down yeah and the Powell bill is
[22:52] expressed us under GS
[22:55] 136413 the power bill funds can only be
[22:58] used
[22:59] for the transportation improvements
[23:02] within the municipal limits so that one
[23:04] is Express we know Powell bill is out
[23:06] all right well okay that's fine I I had
[23:09] asked you to estimate the cost you know
[23:12] roughly what that was
[23:14] so that's the 0.125
[23:16] it would 37 000 roughly okay and this is
[23:20] just a a general gas what we did was was
[23:22] it a 44 rating
[23:27] it has a 69.3 PCS score okay so what I
[23:31] did was from some from the village
[23:33] limits
[23:35] down by South Carolina
[23:37] all the way up to Rising Road we have a
[23:40] PCS score of 69 so I can only assume
[23:42] that's what the PCS score is from there
[23:45] to there that being said that's one of
[23:48] the areas where we would likely probably
[23:50] not repave that one in the next couple
[23:52] of years unless you guys wanted to would
[23:55] probably hit the worst first the 40s and
[23:58] the 50s then come to this road within
[24:00] the next probably two to three years
[24:02] once it passes that's fine but we would
[24:04] still have the money from the Geo bond
[24:06] for it according to chaplain you have to
[24:08] spend it within the jurisdiction the
[24:10] corporate limits so assuming that we got
[24:12] PDS Ladera and the gates to Annex those
[24:15] common spaces yes if not we could work
[24:18] on that over the next couple of years to
[24:21] obtain that then how are we going to
[24:23] Marvin Waxhaw Road that's I'm going to
[24:25] get to that one in just a second I'm
[24:27] okay well that one's not enough
[24:29] bad State except for way up on the other
[24:32] end which is not in our jurisdiction
[24:33] right
[24:35] was really bad it's not in Marvin on Wax
[24:38] On Marvin Road it was repaved five years
[24:40] ago
[24:41] I don't know when it was repaid last I
[24:43] believe it was five years ago because
[24:45] um it hasn't been all that long that
[24:47] it's been repaved and then but the the
[24:50] bad parts are up past the high school
[24:51] where it's really falling apart and
[24:53] that's not okay so chaplain I've got a
[24:56] question for you
[24:58] if
[25:00] dot says okay Marvin here's the road
[25:03] okay
[25:05] and we say that we want to go through
[25:07] the roundabouts up to ladero so dot has
[25:12] now said okay Marvin these are your
[25:14] roads now
[25:15] you own them they are now in Marvin
[25:19] so then how in the world are they not in
[25:21] Marvin
[25:22] because they're not adjacent on either
[25:25] side to Marvin
[25:30] not DOT has an easement or a dedication
[25:35] for the road but they don't own in fee
[25:38] simple
[25:39] underneath the road
[25:41] they have a right-of-way across for the
[25:43] road okay but if I back up okay because
[25:47] we all say we always say that stuff has
[25:49] to be Marvin adjacent right in order to
[25:52] be
[25:54] in Marvin you've got to be Marvin
[25:55] adjacent in order to get into Marvin so
[25:57] if I back up down the road I'm
[26:00] eventually going to be Marvin adjacent
[26:02] at some point so how is the road not in
[26:04] Marvin
[26:05] you have a half Road
[26:08] it's only you're only contiguous on one
[26:11] side
[26:12] so if you're in the office but at some
[26:14] point I'm not at some point I'm
[26:16] contiguous on both sides so how is it
[26:18] not in Marvin if it's Marvin adjacent at
[26:20] some point on both sides and it's got to
[26:22] be more of an adjacent period
[26:24] what areas can go inside and outside the
[26:27] municipal limits
[26:30] and I think that's what it would be just
[26:32] like the neighborhoods are outside on
[26:34] the other side of the the road right of
[26:36] way they're outside of the municipal
[26:37] limits but on the other side of the
[26:39] street is within the municipal limits up
[26:41] to the center line of the street
[26:45] okay I don't like that answer
[26:48] I'm going to work on another one okay
[26:50] good thanks
[26:51] [Laughter]
[26:53] appreciate that so for now do you guys
[26:55] want to keep that section in and then
[26:57] also add the 0.25 that we estimated
[27:01] again this is just a very high level
[27:02] estimate but we want to plug something
[27:04] in for what we think is going to call be
[27:06] the cost of this if we can't if we can't
[27:08] get all of the Heritage District
[27:09] regulated by having Newtown Road and
[27:12] that means it'll stop at Rising Road
[27:14] then we won't have all of it then it
[27:16] doesn't make sense to me so my yes I
[27:20] will I want it in there and I have I
[27:22] have all faith in chaplain and us that
[27:24] we will figure out how to get common
[27:26] spaces into Marvin or chaplain's going
[27:28] to come up with a better answer that I
[27:30] like better
[27:32] such as right now is adding our estimate
[27:34] of 0.125 cost of the total cost of new
[27:39] um Marvin limits to Rising Road
[27:43] to include you can just call it
[27:45] oh you got it right new town to
[27:46] Providence Downs
[27:49] um
[27:51] and that was 36 000 and we'll come back
[27:54] to the tax model in just a second to
[27:55] show you how that how much that impacted
[27:56] it what year is that being plugged in
[28:01] okay
[28:04] um so just keep in mind if we can't find
[28:06] a solution we would have to work over
[28:08] the next several years to come up with
[28:10] some type of funding allocation for
[28:12] general fund versus Powell Bill if we
[28:14] don't have the common space opened up or
[28:17] finding a solution to the power bill and
[28:18] when you
[28:19] use 37 000 is that from the roundabout
[28:22] over or is that from rising Road over
[28:24] and this is not an engineer drawn
[28:26] estimate this is literally us just
[28:28] taking a number what is it Rising Road
[28:30] over or the end of the roundabout over
[28:32] Jill on the
[28:34] cost allocation for that Newtown Road
[28:37] what is the beginning and ending
[28:38] description
[28:40] Marvin limits to
[28:43] it says Marmon School Road to the South
[28:45] Carolina state line so it's
[28:53] not there it could be a little I got it
[28:55] or it could be a little less I got it
[28:56] okay so the next one is
[29:05] the next one's wax on Marvin
[29:10] Blackstone Marvin is very weird
[29:14] [Music]
[29:14] um
[29:15] there's several sections of wax on
[29:17] Marvin that are in out in out and out
[29:20] that's a problem in and of itself we've
[29:22] got to find a solution for getting those
[29:25] Parcels in that are in and out the the
[29:27] only suggestion that I can recommend at
[29:29] this point in time is to go to the very
[29:31] first
[29:33] area where we have no contiguous Parcels
[29:37] in and that's
[29:40] that's I don't know if we've got that
[29:42] reflective in the model that's something
[29:43] that chapel and I have been working on
[29:45] over the last couple of months and
[29:47] trying to figure out how we can our
[29:48] weeks I should say how where's our
[29:50] starting and stopping point for wax on
[29:52] Marvin
[29:53] we've we feel very confident that unless
[29:55] we can get those part the parcels
[29:57] annexed in that that are
[30:01] let me see if I can pull up a map
[30:03] um
[30:05] unless we can get those Parcels annexed
[30:07] in that have no continuity whatsoever
[30:09] we're going to recommend to go to that
[30:10] first starting and stopping point
[30:13] and we definitely don't have that
[30:15] plugged into the model I don't know if
[30:16] we have any of the bonds Grove in there
[30:18] you know if we do
[30:26] okay
[30:34] we can work on those numbers that that's
[30:36] not really a huge deal because we can
[30:38] again we can keep those numbers in we
[30:40] can take them out as we're working on
[30:41] that if we see that it's not going to
[30:43] work out
[30:46] But to answer your question about where
[30:47] to pave and where to start and stop it's
[30:50] it if
[30:51] we had to say if we had to give an
[30:53] answer today it would be to that first
[30:55] point of where we have nothing in Marvin
[30:57] at all
[31:00] it is
[31:07] Nesbit right I think it's
[31:11] yeah it's it's uh chaplain if you
[31:14] remember it was parcel 2207
[31:16] I don't know if you remember that one
[31:17] that's where we said it was the first
[31:18] one it's basically right at the
[31:19] intersection of Henry Nesbitt
[31:22] road
[31:27] if you want to pass that down sorry
[31:30] Christina you were talking and other
[31:32] people were talking what'd you say
[31:35] I'm gonna pass around the map this is
[31:37] where we had noticed the first
[31:39] you see where that intersection is you
[31:41] see where the the white box is that's
[31:44] where the first area of
[31:48] not having ownership on either side so
[31:51] okay so with the chimneys
[31:54] so if we can get the chimneys to Annex
[31:57] in their common area
[31:58] which won't cost them a thing
[32:01] then we could which would be very
[32:03] beneficial for them if they could get
[32:05] the rope repaved in front of their place
[32:08] along with a sidewalk that would be
[32:10] going down in front of their
[32:12] neighborhood that would make a lot of
[32:15] sense for them to Annex in in order to
[32:17] get that that we could fix the drainage
[32:19] issue fix the drainage issue for them if
[32:22] they can Annex in
[32:25] you see that parcel identified as two
[32:27] two zero seven
[32:30] that's the one that's not in Marvin
[32:34] or or if we could get that partial up
[32:37] approved I'm not really sure chapel and
[32:39] I are still working on that like I said
[32:40] so we can keep the numbers in for now
[32:43] worst case scenario we keep the numbers
[32:44] in we can always take it out later
[32:55] okay so Marvin School Newtown that
[32:58] covers all of that and then Marvin
[32:59] school there's really no issues other
[33:00] than right here beside us which
[33:02] hopefully will get addressed with the
[33:05] gates of Ansley
[33:07] in their common space aside from that
[33:09] there's pretty there's pretty much no
[33:11] gaps in Marvin School Road
[33:14] okay and again Christina I'm just want
[33:16] to reiterate that if any of these
[33:18] neighborhoods Annex in their common
[33:20] space that does not mean that they're
[33:22] paying an additional tax on that land
[33:25] correct I would encourage them to talk
[33:27] to their attorney but there are statutes
[33:30] that exempt HOA common space to not have
[33:33] to pay taxes now it's all how they're
[33:35] individually set up but generically I
[33:37] would say the answer is yes okay
[33:48] the time if they're adjacent okay cool
[33:50] thank you and then that also includes
[33:53] demons grow obviously bonds Grove
[33:55] wouldn't be touched at all
[33:57] well I guess it could be
[33:59] but if we're going to stop on Wax On
[34:01] Marvin at the first non-marvin area
[34:04] we would have to figure out where to
[34:06] pick back up on bonds Grove so I haven't
[34:07] even looked at that road to figure out
[34:09] where we would start back up on Wax On
[34:12] Marvin so I'm just throwing that out
[34:14] there we'll have to talk about that one
[34:15] later but as of now that could be a
[34:17] problematic issue if we don't get some
[34:19] of the gaps closed and wax on Marvin
[34:22] again we'll leave the numbers in for now
[34:23] we can always take them out but aside
[34:26] from that dot was good with pretty much
[34:28] everything else
[34:29] so they're working on what I've dubbed
[34:32] as a phase one letter which is including
[34:34] all the internal roads within Marvin
[34:37] um they're working on that letter to
[34:39] with an intent to relinquish and then as
[34:41] we clean up some of these issues
[34:43] we're going to work on a phase two of
[34:45] all the other common areas that we're
[34:47] discussing now
[34:49] do you have any questions on any of that
[34:51] okay I just wanted to reiterate that if
[34:54] we can't find a solution to the Powell
[34:56] bill
[34:58] using the Powell Bill dollars for these
[34:59] roads that are not Marvin we will have
[35:01] to find some type of funding allocation
[35:03] which we can work on
[35:06] any questions
[35:09] okay the next
[35:10] topic I want to go on is private roads
[35:13] we initially did not plan for any
[35:15] private roads to be
[35:18] paved or resurfaced or anything in the
[35:20] Geo Bond but I know as we start the
[35:23] publication education efforts we're
[35:24] going to have a lot of questions on what
[35:26] about me if I'm a private road owner are
[35:28] you going to pave my road the roads
[35:30] estimated for private roads were about
[35:32] eight or nine hundred thousand dollars
[35:34] in the past we've had I know at least
[35:37] one subdivision possibly to come to us
[35:40] and ask for an assessment which
[35:43] basically allows for us to pave those
[35:46] roads and do tax assessments on their
[35:47] property over a course of however many
[35:49] years we decide to do it
[35:52] um essentially it's us running the money
[35:53] and then charging back the property
[35:54] owners in their tax bill we would still
[35:57] have the same authority to foreclose on
[35:59] property if that wasn't paid so the
[36:01] recouping of the money is still very
[36:03] high and it goes with the land so if
[36:07] someone
[36:08] is on a road today that's private and
[36:11] they're planning on selling their house
[36:12] in a couple of years they can still have
[36:14] that road resurfaced and have the
[36:15] subsequent homeowners pay for it if they
[36:17] do the assessment it's a legal process
[36:20] in the state of North Carolina I think
[36:21] it goes up to eight to ten years so we
[36:24] could essentially project out that cost
[36:26] from eight to ten years and it's all
[36:28] based on linear footage linear Road
[36:30] footage footage
[36:31] and 50 percent of those homeowners are
[36:34] 50 of the linear footage owners would
[36:36] have to agree
[36:38] to that assessment
[36:40] so Robinwood for example if they wanted
[36:43] to come in and get their roads paved
[36:45] they would have to Rally amongst their
[36:47] neighborhood to get over 50 percent of
[36:50] linear footage owners to say yes they
[36:52] provide that petition to us we go out
[36:55] and have an engineered study drawn of
[36:57] how much it's going to cost then we
[36:58] charge that back to them they they will
[37:00] have to sign more additional paperwork
[37:02] but we would charge that
[37:03] assessment back to them and their tax
[37:05] bill over the course of however long
[37:06] y'all decided to do it
[37:12] yes yeah yeah it would be an individual
[37:15] assessment
[37:16] so at Firethorne let's say your roads
[37:19] were bad and and we didn't own them
[37:20] y'all owned them you could come to us
[37:22] and say hey can you make this happen we
[37:24] would go out and measure Joe owns
[37:27] 500 linear footage Jamie owns 800 so
[37:31] Jamie's going to be a little bit more
[37:32] Joe's going to be a little bit less and
[37:35] then you would pay that over the course
[37:36] of five ten years
[37:42] something that would
[37:44] sensory bio foreign
[37:54] that's right
[37:56] the same we would okay but we would we
[37:59] would just help them because we would
[38:01] front the money they don't have enough
[38:02] money to do it themselves
[38:04] so we would float them alone and they
[38:07] could pay us back over time but of the
[38:10] loan or we what you're saying is
[38:12] basically they're just paying us back
[38:13] the cost of the of the of the repair
[38:16] yeah the paving
[38:18] we can't
[38:21] charge them to carry right can we charge
[38:24] you carry you can charge them an
[38:25] interest rate
[38:26] but that has to be agreed upon before
[38:28] they even go to the whole thing okay
[38:29] yeah and it's uh there's a there's
[38:31] there's statutes that dictate up to how
[38:33] much I can't remember right now it's
[38:34] been a while since I've looked at it but
[38:35] you can
[38:37] and and there's also there's also a
[38:39] pre-payment
[38:41] um discount so to say for that person if
[38:44] they want to just be done with it and
[38:47] okay
[38:49] so you brought this to us
[38:51] I don't know a couple years ago maybe
[38:53] and at that point I was not for it
[38:55] because we were going to have to try to
[38:57] find the money and do everything we're
[38:58] still gonna have to find the money but
[39:00] we're going to have it with the Geo Bond
[39:01] so I'm okay doing it but I'm with Jamie
[39:06] like if it's if there's a carry cost for
[39:08] it then they they need to be paying that
[39:10] interest rate
[39:11] um so I'm fine if we want to do that I
[39:15] just don't know how we
[39:18] plan for that because we don't know if
[39:21] anybody wants to do it but we need those
[39:24] numbers so I know we can put the numbers
[39:26] in there and if we don't need it we
[39:28] don't have to pull from it you know so
[39:30] then the tax rate won't be as much as if
[39:32] we pulled it
[39:34] that's great okay well it kind of goes
[39:36] in line with I'm what I'm going to talk
[39:37] about next
[39:39] are all of y'all have that same opinion
[39:41] is everyone okay with
[39:43] I guess advertising that we're going to
[39:45] address private roads by a petition
[39:47] format
[39:48] yes yeah everybody's got to be on board
[39:50] it can't be like one house and they're
[39:52] like I'm in and we pave in front of
[39:54] their house it's gonna be the whole
[39:55] neighborhood but the way that the
[39:56] statutes work is it's I don't know the
[39:58] the specific details but I know it's
[40:00] over 50 percent of the linear Square One
[40:02] linear footage owner so you could have
[40:04] an area where
[40:06] um where four people on four people are
[40:09] on the street and one person is a 75
[40:12] owner and the other three are just
[40:15] little hits and misses that equal 25 and
[40:18] you could still have that one property
[40:19] owner that says let's do it make it
[40:21] happen
[40:23] and the other four homeowners or other
[40:25] three homeowners Sol yeah okay I don't
[40:27] love that so again I'm gonna need
[40:29] everybody in the neighborhood to be on
[40:30] board with doing it before I even think
[40:33] about doing that we can create a policy
[40:34] for it that dictates that but
[40:36] statutorily that's the way that I just
[40:37] mentioned surely that's fine but that
[40:39] doesn't mean that that's how we have to
[40:40] do it okay correct that's right we could
[40:43] force somebody to do it but I don't want
[40:44] to do that I'd much rather everybody be
[40:46] on board wanting wanting to do it and
[40:48] wanting to you know have this extra
[40:51] everybody is in 100 yeah
[41:01] most of the time when you have those
[41:03] minor owners that oppose it it's it's
[41:06] going to be either
[41:07] a smaller linear footage which means a
[41:10] smaller cost and they just don't want to
[41:12] do it so we can make the policy around
[41:14] it we just we just want we as staff want
[41:17] to be able to educate the public as to
[41:19] how the Geo Bond will is going to have
[41:22] an implication on them they're going to
[41:23] pay the tax are they going to get
[41:25] anything for it yes we would be willing
[41:27] to do the petition format according to
[41:29] our policy is is kind of what what I'm
[41:31] hearing
[41:32] I mean I'm fine with it but I think
[41:35] there needs to be some parameters set
[41:36] around it and we'll we would come back
[41:38] to you all before that we just want to
[41:39] make sure that y'all are conceptually
[41:41] okay with running the money for an area
[41:43] that wants to have the roads paved I
[41:45] mean essentially we're funding the area
[41:46] the money for everybody
[41:49] but right like you do front the money
[41:53] for my neighborhood like you'd front it
[41:55] for in front of Andy's house yeah but
[41:57] you're not paying it back right but I'm
[41:59] just saying essentially like we're doing
[42:00] it for everybody so why wouldn't we do
[42:01] it for the private roads yes they're
[42:03] private they're going to own them we're
[42:04] not going to own them we'll have to
[42:05] maintain them but we would want them to
[42:08] be brought up to our standards and
[42:09] that's what we're doing so if we can if
[42:12] we can help them do it and do it a
[42:14] little bit more economically than them
[42:16] just doing it on their own you know
[42:18] getting economies of scale because we're
[42:19] doing large projects then I don't know
[42:22] why we wouldn't offer that yeah and one
[42:24] I just don't want to force people to do
[42:26] it that's my whole thing point of
[42:27] clarification I need we need to look up
[42:29] me and chaplain do is I'm not so sure
[42:31] they can maintain to be they can they
[42:33] can be private I think they have to go
[42:34] to public at that point so we'll chapel
[42:36] and I will look at look that up
[42:39] that would be bringing it up to our
[42:40] standards so that we would then maintain
[42:42] it
[42:42] take it over and maintain it from there
[42:45] well we we should already know we we
[42:47] know what neighborhoods those are
[42:50] and there's only a few so we
[42:53] I'm fine for this exercise
[42:55] setting that
[42:57] you know bringing that in
[43:00] but we need to kind of be proactive in
[43:03] reaching out to them and saying okay you
[43:04] need to do your due diligence on whether
[43:06] your neighborhood is going to be for it
[43:08] or against it we don't it's it's not up
[43:11] to us we've we've allocated the funds
[43:13] for it through the through the bond and
[43:15] going from that standpoint so for this
[43:17] exercise yes but we could be proactive
[43:20] in going to the neighborhoods and saying
[43:22] this is what you guys need to do and
[43:24] give them the give them the box that
[43:26] they need to play in okay well we'll
[43:28] come up with some policy creation so
[43:30] y'all can wrap your head around it we'll
[43:31] look up the private roads versus public
[43:33] after the assessment's done
[43:36] um also want to note as we're talking
[43:39] about the financial model if we are
[43:42] recouping the money over a course of
[43:45] five years so to say I'm not really sure
[43:47] we need to put it in as an expense
[43:49] because it's not really going to be an
[43:50] expense that we have to additionally
[43:52] plan for because we're getting the money
[43:54] back
[43:55] okay so Chaser when do you need to know
[43:57] that number by
[44:00] um so that would just need to be known
[44:03] when we submit our
[44:06] application to the local government
[44:08] commission that puts the amount that's
[44:11] going to be on the referendum question
[44:12] and so right now that is
[44:15] beginning of November so ideally
[44:17] sometime maybe okay so we've got a we've
[44:19] got a little bit of time to see if we
[44:21] can reach out to some of these people
[44:22] Christina that you may think yeah I'm
[44:24] just I just don't I don't think we need
[44:26] to plug the number in though because we
[44:27] would get that money back within five
[44:29] years and if we're if we're talking
[44:30] about doing one tranche and let's say
[44:33] say 25 one tranche and 25 one five years
[44:37] from there three years from there we
[44:39] will already be generating that money
[44:40] back into our coffers okay so you don't
[44:43] think that we would need to I don't
[44:44] think we do I mean we could probably
[44:45] plug in a hundred thousand dollars just
[44:47] for engineering costs that we may not
[44:51] charge back to them I mean it's a total
[44:53] cost of all private roads right now is
[44:56] estimated at nine hundred thousand
[44:57] dollars which is basically just gonna be
[44:58] a wash then it's not gonna be okay I got
[45:00] it okay we just want to make sure we're
[45:02] putting that information out to the
[45:03] public that that's a possibility
[45:05] um do you agree I would just say from
[45:08] the modeling tax impact standpoint it
[45:10] will be a wash but if it is something
[45:12] that we do want to consider for the
[45:13] general obligation Bond referendum that
[45:16] number will need to be included in our
[45:17] Max offer authorization amount
[45:20] so if it is 900 000 that'll need to go
[45:22] on top of all the other roads but
[45:24] Christine is saying like let's say that
[45:25] we did it
[45:27] in the first
[45:29] like we paved their roads in the first
[45:32] section of it
[45:34] we'd already be getting paid back so we
[45:36] wouldn't have to pull as much on the
[45:37] second
[45:38] issuance right
[45:40] is that what you're saying Christina yes
[45:42] but I think you're saying that if it's a
[45:43] part of the project
[45:45] initially that we're going to spend the
[45:46] money on they need it needs to be in
[45:48] there right so for example if all other
[45:51] projects aside from the private roads
[45:53] were 14 million dollars and that's just
[45:55] what you went to the public with but
[45:57] then you used part of that 14 million
[46:00] dollars to pay for private roads then
[46:02] you're just siphoning off money that
[46:03] could go to other projects
[46:05] you're getting paid back quicker than
[46:08] you would repay the debt that doesn't
[46:11] refresh or
[46:13] um
[46:14] bump back up your authorization
[46:16] Authority into issue a second tranche
[46:19] down the line so you would want to
[46:20] include 14.9 million dollars for example
[46:23] you could use up to that 14.9 but if all
[46:27] the private roads don't come to fruition
[46:28] then
[46:29] you can repurpose that authorization you
[46:32] can just let it lapse but even though
[46:34] you're getting repaid back you still
[46:35] need to have that max amount authorized
[46:37] to issue the debt up front but you would
[46:39] borrow but you the money that you would
[46:41] use in the first tranche you would have
[46:42] it paid back by the time the second
[46:44] tranche is pulled so therefore you
[46:45] wouldn't have as much as you've
[46:47] estimated in the first or the second you
[46:49] and I can talk about that offline from
[46:51] the modeling standpoint it shouldn't it
[46:54] shouldn't affect the bottom line
[46:58] we'll talk about that the only other
[47:00] thing I want to mention to you is the
[47:02] potential for a traffic mitigation fund
[47:04] this would impact the model
[47:06] um over the course of five years that
[47:09] I've been here we've constantly had
[47:10] people come in and ask for Speed tables
[47:13] stop signs that kind of stuff in their
[47:15] subdivisions crosswalks
[47:18] um pedestrian refuges like we've had a
[47:21] lot of those requests we've offered to
[47:24] do cost share with HOAs like when the
[47:26] unfortunate case on Joe Carr where the
[47:29] pedestrian
[47:30] um
[47:31] fatality we had about three
[47:35] subdivisions over there that want to do
[47:36] a pedestrian Refuge last crosswalk we
[47:39] offered a call share with them none of
[47:42] them were willing to do it at that point
[47:43] in time so we we just want to know
[47:45] do you all want to put some type of
[47:47] money that reoccurs to help some of
[47:51] these minor projects that come up
[47:53] when they come up for these requests
[48:09] like Marvin school or Joe Carr right
[48:36] so
[48:39] Marvin Creek had to Pony up their money
[48:41] too for theirs right so let's just keep
[48:43] it the same from that perspective but
[48:45] then I agree if there's issues
[48:51] right there
[48:57] so what we can do and it's hard for us
[48:59] to really say how much to put in there
[49:00] because if you're talking about just a
[49:02] crosswalk with lights and that kind of
[49:04] stuff it's fairly cheap I say cheap
[49:06] meaning forty thousand dollars but if
[49:09] you're talking about adding in a refuge
[49:10] and you can yarn you can probably
[49:12] correct my numbers if I'm wrong when
[49:14] you're talking about adding in a refuge
[49:16] you're talking about expanding the area
[49:18] of the road and therefore it's going to
[49:19] be a lot more costly
[49:21] I'd say upwards of 60 to 80 000 on those
[49:25] types of areas so I don't know if you
[49:27] just want to leave that alone and not
[49:29] put anything in the model and if we have
[49:31] a surplus of funds from us being able to
[49:33] save money elsewhere we can talk about
[49:35] it at that point in time or if you want
[49:37] to put in a couple hundred thousand for
[49:39] addressing those areas I thought we had
[49:41] some money in there for crosswalks
[49:43] especially on Joe Carr and Marvin no
[49:53] online
[49:56] because I mean we've because we've got
[49:57] some issues on Joe Carr about crossing
[49:59] the street and I know that we had wanted
[50:00] to kind of cost share with the
[50:03] neighborhoods over there
[50:04] um but I think that if as we're doing
[50:07] these Road improvements and we can do
[50:08] some of these things with the bond money
[50:10] I'm I don't know why we wouldn't
[50:13] put some money in there and I'm sure
[50:14] that your quotes that you got from a few
[50:17] years ago Christina are probably not
[50:19] accurate but we can at least you know
[50:23] just for safety purposes okay
[50:27] somebody's listening to me sorry I just
[50:29] I remember we have some stuff marked in
[50:30] the CIP and I don't know I mean it's got
[50:34] the Story of My Life the dashboard
[50:37] or in the um
[50:40] part projects
[50:43] but your this reflects okay
[50:46] we do not have anything specific in
[50:48] there about
[50:50] um crosswalks so if y'all want to add
[50:53] some in there we can or we can do the
[50:55] approach of if we save on other projects
[50:57] as we anticipate we're doing we can
[50:59] address that situation then
[51:06] yeah
[51:09] I'm inclined to see yes
[51:14] no no
[51:18] no so y'all want y'all want to add two
[51:20] hundred thousand
[51:22] do you remember what the quotes were and
[51:24] again I'm sure that they've gone up I
[51:27] remember inflation and all I remember
[51:29] the Joe Carr situation was about forty
[51:31] thousand dollars each
[51:33] I want to say yes see I feel like we
[51:35] were getting all three at around 90.
[51:37] does that not sound right maybe because
[51:39] we were doing bulk
[51:41] I think I remember that name
[51:44] Bjorn do you have any
[51:45] general idea of Refuge crosswalks
[51:58] so I would say 50
[52:00] 50 for just a normal crosswalk like you
[52:03] see down Marvin School Road if you're
[52:05] talking about making a refuge you're
[52:07] probably talking about a hundred
[52:08] thousand dollars
[52:12] you have at least four places
[52:15] that I can think of right off the top of
[52:16] my head there's probably going to be
[52:18] more than that
[52:20] um are those where you'd want a refuge
[52:21] or would you want just a regular
[52:23] crosswalk they're just like some sort of
[52:24] not necessarily Refuge just a just a
[52:26] crosswalk just to have something lit up
[52:28] so it's just a little bit safer
[52:31] um well it depends on the speed zone too
[52:33] because if it's over 35 it requires
[52:36] Refuge if I'm not mistaken if I'm on the
[52:39] roads we're going to have 10 mile an
[52:41] hour roads through Marble I'm just just
[52:43] throwing that out there that I'm pretty
[52:45] sure if it's over 35 you have to have a
[52:47] refuge if you're crossing that's why
[52:49] they had to do that down here
[52:52] um and then they lowered the speed limit
[52:54] but that was why that that Refuge was
[52:56] was placed okay well we can create 250
[53:00] 000 and then we can create a committee a
[53:02] subcommittee to help decide
[53:04] how that how that's going to look for
[53:07] the for the purposes of this model are
[53:10] we going to do 50 000 per year
[53:14] what is that okay 50 000 a year starting
[53:17] 2025 going five years in a row
[53:21] he's just gonna put it in the first
[53:22] tranche okay so you're gonna put 250.
[53:25] especially like if we do it on Joe Carr
[53:27] then we might as well do all of them at
[53:29] the same time
[53:30] while we're you know doing the road
[53:37] okay so he's got 250 in one Joe Carr 20.
[53:42] 15. I'd be toast
[53:45] you would be toast
[53:49] um so aside from that I wanted Jill to
[53:51] recap all the projects and this is going
[53:54] to be
[53:55] time consuming but I want to make sure
[53:57] everyone's on the same page with all the
[53:58] projects that are listed for the Geo for
[54:01] the roads to make sure there's nothing
[54:02] that y'all think that we've forgotten
[54:04] that you thought was in there
[54:07] um so can I wrap this up in a nice
[54:10] pretty boat tell you the major attacks
[54:12] impact because once we start the public
[54:14] education piece which Austin's going to
[54:16] get to in just a second this kind of is
[54:17] what we're going to push out there these
[54:19] are the projects this is the tax impact
[54:20] this is how we're doing it so if Jill
[54:22] you can spend a couple minutes to go
[54:24] through each line by line on those
[54:26] specific projects that'd be awesome
[54:28] so just to confirm only the ones that we
[54:31] have listed roads referendum fund yes
[54:34] now none of none of what she's saying
[54:35] none of what we're doing right now
[54:37] covers anything to do with the parks
[54:42] okay
[54:43] so under Road referendum fund the
[54:46] projects that I show is being turned on
[54:49] is the roundabout at wax on Marvin in
[54:52] bonds Grove Church Road did we turn that
[54:54] off we turned that on and that is just
[54:57] our share that is not the total cost
[54:59] with um the county and crtp just our
[55:03] chair okay
[55:05] then we have way finding signs phase one
[55:08] through four
[55:11] then we have the s2b Stacy Howie Road
[55:14] wax on Marvin Greenway
[55:18] we have the C5 intersection of Joe Carr
[55:21] and Marvin Road
[55:24] we have s2a wax on Marvin Road and
[55:27] Newtown Road
[55:30] C1 which is Tom Short Road
[55:34] c20a intersection of Newtown and Marvin
[55:37] School Road
[55:41] s2c Crane Road
[55:45] s1b the remaining portion Wheat Field
[55:48] Drive to saddle Ave
[55:51] C15 Waxhaw Marvin Road
[55:59] on Waxhaw Marvin that section
[56:02] it says s2c Crane Road in parentheses
[56:05] wax on Marvin Greenway
[56:07] and Tyler's making a copy real quick of
[56:09] the map so y'all can visualize what
[56:10] she's saying so he'll be right back with
[56:12] that that copy
[56:15] The Greenway
[56:18] you said S1 S1 or
[56:22] s2c yeah yeah any any of the numbers
[56:25] like that would be a Greenway okay sorry
[56:26] so should it not have Road referendum
[56:28] should it should it have Greenway
[56:30] instead no okay just checking because
[56:32] it's for transportation purposes okay
[56:35] um
[56:36] I don't know not sure where I left off
[56:38] but
[56:40] okay no you're fine
[56:42] um so s1b is the remaining portion
[56:44] Wheatfield Drive to saddle Ave
[56:46] C15 wax on Marvin Road
[56:50] um and since bonds Grove Church Greenway
[56:54] c20b Marvin eford Park Newtown Road
[56:57] Greenway
[56:59] C-17 bonds Grove Church Road
[57:03] then we have NC DOT totals
[57:08] we have sidewalk acquisition and repairs
[57:12] Street blades miscellaneous drainage
[57:16] then the three that we just added
[57:18] Newtown Road from the roundabout to
[57:21] Ladera slash PDS
[57:24] we have the private roads that we just
[57:26] agreed to take on potentially and then
[57:29] we have traffic mitigation slash
[57:31] crosswalks slash safety improvements
[57:36] test out the map to you all there is one
[57:37] section that's missing that we've
[57:39] actually got updated I just don't have
[57:40] it here but
[57:41] C1 was one of the ones that you guys
[57:43] added in which is one that she mentioned
[57:45] so that's not highlighted in purple but
[57:47] that is one included just so you all
[57:49] know everything else you'll see the
[57:50] purple overlay and those are the trails
[57:53] that we have slated for transportation
[57:55] purposes in the general obligation bond
[57:57] for roads
[58:01] is there anything that you guys see that
[58:03] we missed that we didn't that we
[58:05] shouldn't have put in
[58:28] I think I'm good
[58:30] I think it looks great I'm so excited
[58:32] about this I mean that is going to be
[58:34] massive connectivity for all sides of
[58:37] the village this is gonna if we can get
[58:39] this passed this is going to be amazing
[58:41] so this mat that you see here we
[58:44] generate this from our Consultants that
[58:47] did our master plan for parks and
[58:49] Greenways we are going to pass this
[58:51] along to our Communications consultants
[58:53] for the Geo Bond so they'll actually
[58:54] make it a lot more prettier a lot more
[58:56] nicer for the public to absorb this
[58:59] section
[58:59] and Austin we'll get to that in just a
[59:02] second but if everybody's good with this
[59:03] I'm going to ask chazo to give you guys
[59:06] again the tax impact and the years that
[59:08] you guys will
[59:09] no
[59:14] um so excluding private roads right now
[59:17] we are at about 14.7 million dollars of
[59:20] Road related projects that's about 300
[59:24] 000 or so higher than what we started
[59:26] with last time um so when Christina
[59:29] mentioned that the roads were four and a
[59:31] half cents gone up a little bit now
[59:34] um right now it's about 4.75 so 0.25
[59:37] increase above where we were when we
[59:40] started this morning
[59:42] and that that is beginning a near fiscal
[59:45] 2026 assuming that we issue half the
[59:48] bonds in fiscal year 2025. and then
[59:51] three years later we're assuming we take
[59:52] the second half and issue that and that
[59:55] would be an additional
[59:57] 2.75 cents
[59:59] which would take us up to seven and a
[1:00:00] half cents now again this includes an
[1:00:03] above Market interest rate assumption so
[1:00:06] obviously when the time comes for us to
[1:00:08] issue the debt we'll have current market
[1:00:10] interest rates at that time and we can
[1:00:12] refresh the model to suggest for that
[1:00:15] particular budget year what the property
[1:00:17] tax rate would need to be but for
[1:00:18] planning purposes we want to be a little
[1:00:19] bit on the high side just so that we're
[1:00:21] not missing the mark and cavity come
[1:00:23] back to the public later with a property
[1:00:25] tax increase above what we stated what
[1:00:28] was the 2.5
[1:00:29] uh to 2.75 would be in fiscal year 2029.
[1:00:36] at the max it would be seven and a half
[1:00:38] cents um but as the principal and
[1:00:41] interests on the bonds start to pay down
[1:00:43] as presumably your value of a penny
[1:00:45] continues to grow you can reduce that
[1:00:46] over time if you want to to mirror it
[1:00:50] with the debt repayments or if you want
[1:00:52] to keep it in place you can use those
[1:00:53] dollars for other purposes
[1:00:59] any questions on that
[1:01:02] any questions on the map here because
[1:01:06] we're going to roll with this once we
[1:01:07] leave here okay
[1:01:10] um and again this is just for
[1:01:12] transportation this is not including the
[1:01:14] parks which doesn't if you want to go
[1:01:16] over that number one more time we have
[1:01:17] not changed anything on that well I was
[1:01:19] going to ask about the park because you
[1:01:21] and I had had a conversation about the
[1:01:23] drainage in the situation with
[1:01:26] current Village Hall site
[1:01:28] Amphitheater
[1:01:30] possible site
[1:01:33] do we want can we roll the the drainage
[1:01:36] study the drainage work into that
[1:01:39] project because
[1:01:42] what they're asking for now in terms of
[1:01:46] the cost to do it I would much rather
[1:01:48] roll it in to that than
[1:01:53] we can and so remember that number that
[1:01:55] we had in the Parks model was around 3
[1:01:58] million I can't remember exactly was it
[1:02:00] 3.5 this number was given to us by the
[1:02:03] Consultants McAdams that did the master
[1:02:06] plan these are not engineered drawn
[1:02:08] estimates so we don't know for sure that
[1:02:10] number is exactly right we can add
[1:02:12] another 100 200 000 in there to drainage
[1:02:15] if you would like but that 3.5 could
[1:02:18] include some of that
[1:02:20] I don't have an engineered stamps plan
[1:02:23] so we can or we can roll with this and
[1:02:25] just try to figure out
[1:02:27] what would y'all rather do have have
[1:02:29] more in there
[1:02:32] well if you just if you add the tax
[1:02:34] what's the tax application on it right
[1:02:36] now
[1:02:37] so on the three and a half million for
[1:02:39] the parks that's about 2.25 cents so if
[1:02:42] we added another couple hundred thousand
[1:02:44] four drainage and studies and
[1:02:47] Engineering costs what would that be
[1:02:50] what it's not going to go much I know
[1:02:52] but what would it be just for fun so
[1:02:55] round numbers if I went from 3.5 to 3.75
[1:02:58] it's about another 0.25 cents okay so
[1:03:01] two and a half then yes okay I mean I'd
[1:03:03] rather have more in there and not need
[1:03:05] it and be able to pay it back quicker
[1:03:07] and drop the tax implication then not
[1:03:11] have it and need it
[1:03:14] I mean that's that's a wise and again
[1:03:17] it's not our decision so I mean we're
[1:03:19] putting it out there right but it's it's
[1:03:21] better to to have it not need it to need
[1:03:24] it not have it I agree so okay chazo can
[1:03:27] you change that yes absolutely so that
[1:03:29] would be 3.75 million on the parks
[1:03:32] referendum and that'll be in a two and a
[1:03:34] half percent tax increase
[1:03:36] whenever that hits we're assuming right
[1:03:38] now in fiscal 26 but whenever you all
[1:03:40] issue that portion of the debt
[1:03:48] that's everything that I had for geo
[1:03:50] bonds does anybody have any questions
[1:03:51] comments concerns on anything
[1:03:55] uh in just a couple minutes Austin will
[1:03:57] go over
[1:03:59] the communications plan which is pretty
[1:04:02] in-depth
[1:04:03] and y'all can have another opportunity
[1:04:05] at that point in time but for the most
[1:04:07] part we're going to roll with the
[1:04:09] numbers that are here the tax
[1:04:10] implications that are here you'll start
[1:04:11] seeing some of that public education
[1:04:13] piece roll out shortly and and also get
[1:04:15] to that in just a second that's going to
[1:04:17] be more towards the end of the meeting
[1:04:18] though
[1:04:20] that's all I have Mr Mayor
[1:04:23] all right
[1:04:25] next up we have presentation
[1:04:31] a presentation of Union County 2023
[1:04:34] critical intersection and Analysis and
[1:04:37] consider adoption of resolution
[1:04:38] supporting the Union County 2023
[1:04:40] critical intersection analysis
[1:04:46] yeah
[1:04:48] so this is
[1:04:52] a really productive eight months
[1:04:56] and
[1:04:59] so we started in January we had a
[1:05:02] stakeholders Committee comprising of
[1:05:04] staff from each of the communities dot
[1:05:07] carpo Union County and we met until
[1:05:11] August our September meetings actually
[1:05:13] supposed to be tomorrow but we cancel it
[1:05:14] because we didn't necessarily need it
[1:05:16] and
[1:05:18] went through the schedule you see here
[1:05:21] so we identified intersections based on
[1:05:24] local knowledge
[1:05:26] we confirmed our ranking across us
[1:05:29] started collecting data on traffic
[1:05:32] counts crashes
[1:05:34] the configurations of the intersection
[1:05:36] constructability concerns we went out
[1:05:38] for public Outreach which was remarkably
[1:05:41] successful we then analyzed all that
[1:05:44] information and confirmed our scores for
[1:05:46] the projects and then came up with our
[1:05:49] top 15 that 15 is not a magic number
[1:05:51] it's just what we in what we started
[1:05:53] with seven years ago when we started
[1:05:55] this process and we've
[1:05:57] keep kept that same number as we have
[1:05:59] done updates over the years and so now
[1:06:01] in July and August into September
[1:06:04] presentations and adoptions so we've
[1:06:07] presented to most of the municipalities
[1:06:09] that are impacted we actually have eight
[1:06:11] that have locations which is good means
[1:06:14] that there's a geographic dispersion to
[1:06:17] the locations and we'll go to the Board
[1:06:19] of Commissioners in mid-september for
[1:06:23] adoption
[1:06:24] so in terms of the public Outreach the
[1:06:27] western part of the county was well
[1:06:29] represented we had nearly 3 000 people
[1:06:31] County Wide
[1:06:33] um black or I'm sorry Marvin had over a
[1:06:36] hundred respondents which was consistent
[1:06:40] with half of the municipalities in the
[1:06:41] county we had really good Outreach
[1:06:43] priorities were safety and congestion
[1:06:46] I'll note that I I didn't word the
[1:06:48] question very well about safety and
[1:06:50] congestion because I asked them
[1:06:51] independently and when asked
[1:06:53] independently people said that's the
[1:06:54] number one priority which is obviously
[1:06:56] impossible so I needed to have it in the
[1:06:58] same question for the future but they
[1:07:00] are both important and they're both
[1:07:02] considered in the evaluation process
[1:07:04] truck traffic it's a consideration it
[1:07:06] wasn't a particularly strong one though
[1:07:08] Geographic
[1:07:10] dispersion not so much people wanted to
[1:07:14] prioritize growing areas
[1:07:16] bike ped it's a consideration it
[1:07:19] shouldn't be the only reason why we
[1:07:20] choose a location and congestion safety
[1:07:23] comments were made throughout the county
[1:07:25] on Transportation needs in general so we
[1:07:28] heard a lot about a lot of
[1:07:30] issues that weren't necessarily at a
[1:07:33] specific intersection we also received
[1:07:34] them for Indian land and and Charlotte
[1:07:37] as as things that they just wanted to
[1:07:40] get it off their chest
[1:07:42] so the scoring process we used the
[1:07:45] previous cycle used a a nice round
[1:07:48] number of 100 it's now 115 because the
[1:07:51] two rows at the bottom multimodal
[1:07:53] considerations and constructability were
[1:07:55] added it says that a project score or a
[1:07:59] location scores better if there's a
[1:08:01] readily identified pedestrian or bicycle
[1:08:04] deficiency at that location or by
[1:08:06] improving that intersection you're going
[1:08:08] to help connect the network and then
[1:08:09] constructability is let's let's
[1:08:12] prioritize locations that are easier to
[1:08:14] build than just hoping for the best and
[1:08:17] so that was a consideration as well to
[1:08:19] know how much
[1:08:21] high power
[1:08:23] electricity lines water sewer historic
[1:08:27] buildings
[1:08:28] other types of considerations that are
[1:08:31] going to make a pro a project more
[1:08:32] complicated
[1:08:34] and the public Outreach process was very
[1:08:37] useful we identified multiple
[1:08:39] intersections that made it into the list
[1:08:41] as a result of what the public asked to
[1:08:43] say doesn't mean it doesn't mean it was
[1:08:45] Mob Rules it just meant that they
[1:08:47] identified issues that we then looked at
[1:08:50] and said for most of them yes this is
[1:08:53] the location that actually scores really
[1:08:55] well and we should include it and one of
[1:08:57] which is not necessarily in Marvin but a
[1:08:59] lot of Marvin resonance would use which
[1:09:01] is Ray Road and Marvin School
[1:09:03] some locations didn't make it in
[1:09:08] they're also not necessarily in this
[1:09:10] part of the county more towards the
[1:09:13] Indian Trail stylings Monroe area where
[1:09:15] there are intersections that have
[1:09:18] objectively bad congestion and safety
[1:09:21] scores the problem is they've already
[1:09:22] been essentially built out and so the
[1:09:25] solution is not necessarily improving
[1:09:27] that intersection it's improving the
[1:09:28] corridor which is beyond our capability
[1:09:32] of what we're considering through this
[1:09:33] process
[1:09:34] also the carpo
[1:09:37] prioritization process for their
[1:09:39] long-range plan historically is only
[1:09:41] looked at Corridor widenings or New
[1:09:42] Roads your Monroe expressways your
[1:09:45] Providence roads of the world not
[1:09:46] necessarily intersection improvements
[1:09:48] but we successfully argued over the last
[1:09:51] couple years that one there just isn't
[1:09:53] enough money to do everything you've
[1:09:55] talked about in the past and secondly
[1:09:57] you can get a lot of
[1:09:58] cost-effective improvements by focusing
[1:10:01] at larger intersection particularly the
[1:10:03] ones that are too expensive for the
[1:10:04] locals to consider on their own a
[1:10:06] perfect example is 75 and Potter which
[1:10:09] is in downtown Mineral Springs if you're
[1:10:11] driving towards Monroe on 75 it's a bad
[1:10:15] intersection you have a lot right on the
[1:10:17] intersection and a part of the reason
[1:10:18] why the intersection is complicated to
[1:10:20] improve because you have the railroad
[1:10:21] tracks not even 100 yards to the north
[1:10:23] why should a town be responsible for
[1:10:26] improving an intersection and on an NC
[1:10:29] Highway and a class one Freight Railroad
[1:10:33] as opposed to the dot so that's why we
[1:10:36] were able to successfully argue that in
[1:10:38] situations like that they should be able
[1:10:40] to be evaluated through carpo's
[1:10:41] long-range plan meaning they make it
[1:10:43] into the step and they get implemented
[1:10:45] by the dot without local match and and
[1:10:47] that impacts three intersections all of
[1:10:50] which are actually going to be evaluated
[1:10:52] in this step cycle uh 74 and 601 is one
[1:10:55] of the highest Freight bottlenecks in
[1:10:58] the entire region
[1:10:59] Rocky River and Old Charlotte Highway
[1:11:01] that is where the railroad the CSX
[1:11:04] railroad going to Charlotte crosses at a
[1:11:06] diagonal you actually have two railroad
[1:11:07] crossings within 100 yards of that
[1:11:09] intersection is horrible we actually
[1:11:12] submitted that as a railroad project so
[1:11:14] it might get funded not as a highway
[1:11:15] Improvement project but as a railroad
[1:11:18] Improvement project which is a different
[1:11:19] pot of funds and then one in hemby
[1:11:23] Bridge which are two intersections right
[1:11:24] there in their downtown which have a
[1:11:26] huge amount of flood Plains very
[1:11:28] congested and is in need of improvement
[1:11:31] it's going to be very expensive and
[1:11:33] there's no way that hemby bridge could
[1:11:35] come up with the local match on its own
[1:11:36] that's actually being submitted as a
[1:11:39] step project as well so we've we've
[1:11:42] grown and matured and been able to take
[1:11:44] advantage of different flexibility and
[1:11:46] pots of funds to implement these
[1:11:48] recommendations
[1:11:51] so what people care about the most is
[1:11:54] did my intersection make the list so
[1:11:55] here's here's the list there's 15 uh
[1:11:58] there is a score associated with them I
[1:12:00] will not say that the highest scoring
[1:12:02] one is the number one priority because
[1:12:05] we partner all the time we obviously
[1:12:08] have partnered with the village we've
[1:12:10] partnered with the dot with
[1:12:11] municipalities and
[1:12:14] whoever wants to submit a project and
[1:12:16] partner with us becomes our priority
[1:12:18] this just helped us determine what
[1:12:20] should make it into the list for example
[1:12:23] were
[1:12:24] committing seventy five thousand dollars
[1:12:27] in partnership with Wesley Chapel for
[1:12:29] the fourth intersection Newtown and
[1:12:31] Cuthbertson we the dot said we think a
[1:12:34] roundabout is the right thing to put
[1:12:36] here
[1:12:37] we don't have all the money we'd like to
[1:12:39] go to carpo for some we need some local
[1:12:40] match
[1:12:41] Wesley Chapel and Union County would you
[1:12:44] come up with the money
[1:12:46] Wesley Chapel is already committed to it
[1:12:48] Board of Commissioners are going to
[1:12:50] consider that at their meeting on
[1:12:52] Tuesday fairly confident that that's
[1:12:54] going to get approved so that's an
[1:12:57] example of partnership and how we're
[1:12:59] moving these ahead
[1:13:00] so I'll stop here for a sec do you have
[1:13:03] any questions about this list or what I
[1:13:05] presented so far
[1:13:11] okay
[1:13:14] there were two I'm sorry there's one
[1:13:16] location that's on this list now which
[1:13:18] was Stacy Howie and
[1:13:21] wax on Marvin
[1:13:24] I would note that
[1:13:26] you are also being considered or you've
[1:13:29] also been asked as a part of previous
[1:13:33] critical intersection analyzes to
[1:13:35] approve lists one of which was Joe Carr
[1:13:37] and Marvin and the reason why we weren't
[1:13:39] able to advance that as a project was
[1:13:41] because Marvin Road was on the Federal
[1:13:43] Aid System The Dot may own 80 000 miles
[1:13:47] of roads but only a subset of that the
[1:13:50] most important roads actually are on the
[1:13:52] Federal Aid System where they can use
[1:13:53] federal dollars to make the Capital
[1:13:55] Improvements that may be needed we were
[1:13:58] able to between
[1:14:00] City of Charlotte Union County and
[1:14:03] Marvin we were able to successfully
[1:14:04] argue that this road serves that caliber
[1:14:07] of traffic and should be added it's
[1:14:09] since been added so now it's an option
[1:14:11] if the village in cooperation with the
[1:14:15] county wanted to submit that
[1:14:17] intersection to get designed and cost
[1:14:20] estimates developed to help with future
[1:14:22] Grant applications you also have the
[1:14:24] option of Stacy Howie and wax on Marvin
[1:14:26] I'll note that Union County
[1:14:29] is willing to go into a 50 50 share on
[1:14:33] the local match the estimated cost per
[1:14:35] location is uh forty thousand dollars
[1:14:38] that's the budget so twenty percent of
[1:14:41] that's eight thousand dollars
[1:14:42] we assume that if it's inside of
[1:14:44] municipality we'll split at 50 50. so
[1:14:46] your share is four thousand dollars
[1:14:48] however we only have twenty thousand
[1:14:50] dollars to work with so which means
[1:14:51] we're talking five intersections five
[1:14:53] intersections and we've had interest for
[1:14:55] more than five so what
[1:14:58] um we determined internally is a way to
[1:15:00] be fair is to say okay with all the
[1:15:04] municipalities that have two or more
[1:15:07] locations you could consider we'll go 50
[1:15:09] 50 with you on the first one
[1:15:11] but
[1:15:13] for the subsequent one if you're willing
[1:15:15] to put in all the match we could include
[1:15:16] that in our list but otherwise you've
[1:15:20] got to choose a location like if you
[1:15:22] only want to go in on the 50 50
[1:15:23] Arrangement you'd have to choose which
[1:15:25] one of these two locations you want to
[1:15:27] have
[1:15:28] um submitted as part of this design
[1:15:30] Grant which is due to carpo at the end
[1:15:32] of October so we have about two months
[1:15:34] to figure this out and if you were
[1:15:37] sitting in our chair how would you
[1:15:38] prioritize that from if we had to choose
[1:15:41] Joe car and Marvin
[1:15:46] Beyond where where is uh where do we
[1:15:49] stand with
[1:15:54] Waxhaw Marvin and bonds Grove Church we
[1:15:58] executed the interlocal last week and we
[1:16:02] are
[1:16:03] we kind of run into a we'll work through
[1:16:05] it but we're working we're we're working
[1:16:07] through a little bit of Finance
[1:16:09] contractual issues with the D.O.T
[1:16:11] because our finance officer because
[1:16:13] we're the we're the applicant
[1:16:15] essentially and we're Contracting with
[1:16:17] the dot the dot is saying well
[1:16:21] you need to you need to acknowledge that
[1:16:23] if there's overruns you're going to be
[1:16:24] responsible for those two which our
[1:16:25] finance department says well we don't
[1:16:27] know what that number is so we can't
[1:16:28] sign for it until we know what that
[1:16:30] number is and it's that that
[1:16:33] interpretation's actually and if Finance
[1:16:36] director share you can confirm or deny
[1:16:39] this that there's been recent changes in
[1:16:40] like the responsibilities of Finance
[1:16:42] departments for local governments that
[1:16:45] kind of hits on that accounting
[1:16:47] situation so we're trying to figure out
[1:16:49] what to do but we'll we'll work on it so
[1:16:52] that's the fact that we're in that
[1:16:54] Contracting process right now so that
[1:16:56] the dot can start the design process
[1:16:58] concerning 12 months ago you were being
[1:17:00] asked to consider putting grant money on
[1:17:02] it is remarkably fast I mean yes Newtown
[1:17:06] and Marvin's under construction right
[1:17:07] now and that's great but how many years
[1:17:09] ago did that process start so we're
[1:17:12] pretty pleased that that's where we
[1:17:14] actually stand with that right now
[1:17:15] because that's got to be priority
[1:17:17] especially when you're talking about the
[1:17:19] widening of Providence that's that's why
[1:17:21] that's why we identified it right that's
[1:17:24] right and the dot agrees and that's why
[1:17:25] we're that's why we're potentially going
[1:17:27] to Design Within months
[1:17:31] so I'd like to add um so in your packets
[1:17:33] I have uh drafted a resolution
[1:17:36] um the first part of the resolution is
[1:17:38] uh supporting the 15 intersections in
[1:17:41] their critical intersection findings
[1:17:44] and I also then in the highlighted
[1:17:46] section of that draft
[1:17:48] up to council's discretion if we would
[1:17:50] like to ask the county to include
[1:17:52] both intersections no car Marvin and
[1:17:54] Stacy Howie and Marvin or just one of
[1:17:58] those in the grand application to crtpo
[1:18:02] as Bjorn mentioned there is a funding
[1:18:06] that we would have to be on the hook for
[1:18:09] for that Grant application
[1:18:12] so if we want to discuss that now I mean
[1:18:15] or I think we can adopt the resolution
[1:18:17] to supporting the intersections and then
[1:18:19] have further discussion at the September
[1:18:21] meeting
[1:18:22] about the two intersections
[1:18:25] correct it's Fourth that is correct we
[1:18:28] don't it'd be nice to you know put this
[1:18:30] issue to bed but you don't have to make
[1:18:32] a decision on the design Grant
[1:18:33] application at today's meeting you
[1:18:36] really have through September to allow
[1:18:38] us to then respond to it at our October
[1:18:40] meetings
[1:18:42] it's not but it's not today that's all
[1:18:45] right but if we do one
[1:18:47] um if we just do Joe car and Marvin we
[1:18:49] would be on the hook for four thousand
[1:18:51] of that Grant application if we do both
[1:18:52] it would be 12 000 total correct
[1:18:57] so putting things in perspective August
[1:18:59] September October this is this is what
[1:19:01] we're working on
[1:19:06] I need a motion we want to talk about it
[1:19:10] bring it up I mean they're both terrible
[1:19:14] yeah I mean when when the Costco comes
[1:19:17] online I suspect that
[1:19:21] the roads that you can sneak through
[1:19:22] from wax on Marvin over to 521 are going
[1:19:25] to be
[1:19:27] impacted when the who comes to where the
[1:19:31] Costco online
[1:19:33] where's the Costco
[1:19:34] possum possum Hollow on 521
[1:19:40] I got a new home to go to
[1:19:42] okay all right I mean I think we should
[1:19:45] do both I mean I know it's going to be a
[1:19:47] little bit more because we have to pick
[1:19:48] both but I think if we can get the
[1:19:50] process started for both of these
[1:19:51] correct like that's really what you want
[1:19:53] to do you've got to get the process
[1:19:54] started once you get the process started
[1:19:56] then we can really go out for more
[1:19:58] funding opportunities yeah Step One is
[1:20:00] identifying the location step two is
[1:20:02] what should be done at that location
[1:20:04] step three is getting the money to do
[1:20:06] what was determined and stuff too so now
[1:20:09] we're to step three right
[1:20:11] get the money for it to do this no no
[1:20:13] well no no I'm saying the money to build
[1:20:15] it that's step three okay
[1:20:18] okay do we have 12 000 if the council
[1:20:20] decides to do both intersections we do
[1:20:23] not we'd have to do a budget amendment
[1:20:24] budget amendment okay that would be an
[1:20:25] fy25 expense it would not be the bill
[1:20:29] would not come to this fiscal year so
[1:20:30] basically we would just be committing
[1:20:32] those funds and then we'd incorporate
[1:20:33] that 12 000 match for the grant
[1:20:37] in next fiscal year okay and refresh my
[1:20:40] memory what's the remedy for
[1:20:42] Marvin School Road and Ray
[1:20:45] we don't have one that hasn't been
[1:20:46] designed either
[1:20:49] okay I mean it could be dual lefts
[1:20:51] that's something that's an option but I
[1:20:53] I can't say hasn't been designed it just
[1:20:55] yeah but it's and it's not only traffic
[1:20:58] it's a lack of sidewalks we've had we've
[1:21:01] had Hunter Oaks uh HOA reps call us in
[1:21:03] the past saying hey can you guys install
[1:21:05] a sidewalk there
[1:21:07] no we can't
[1:21:09] um but you know if we got a project this
[1:21:12] is an example of where we could do
[1:21:14] something like that
[1:21:22] right
[1:21:24] so Hunter I'm looking at the resolution
[1:21:28] the second whereas it says identified
[1:21:31] two intersections in Marvin Stacey Howie
[1:21:34] and Waxhaw Marvin where's the second one
[1:21:36] sorry that should just be one
[1:21:40] I'm amending it as we go okay and then
[1:21:43] we've got so we've got this
[1:21:45] this Joe car and Marvin got it okay
[1:21:48] Joe car and Marvin was identified in
[1:21:50] their 2019
[1:21:51] and so that's why I wasn't in their
[1:21:54] their new updated 2023 because it's
[1:21:56] still eligible
[1:21:57] that's fine I just wanted to clarify
[1:22:00] that make sure that it didn't need to
[1:22:02] have two and have both of them there or
[1:22:04] just say one and just have for nine
[1:22:08] okay I mean I'm I mean I'm good with
[1:22:10] this what do you guys think I'm good
[1:22:11] with it

[1:22:18] for your sake for the two intersections
[1:22:20] I have it reading that now be resolved
[1:22:23] that the Village Council hereby supports
[1:22:25] the results of the Union County 2023
[1:22:27] critical intersection analysis and
[1:22:28] requesting intersections of Joe Carr and
[1:22:30] Marvin
[1:22:31] and the intersection of Stacy Howie and
[1:22:33] wax on Marvin to be included in the
[1:22:35] County's design Grant application do we
[1:22:37] need to add languages and that funding
[1:22:38] be committed in the next fiscal year
[1:22:41] whatever works for you to to account for
[1:22:44] those funds is fine
[1:22:45] we'll deal with it I mean we'll go
[1:22:47] through the interlocal process in 2024.
[1:22:50] we need to we're good however okay
[1:22:53] we're good I'll just put it in the
[1:22:54] budget for next year
[1:23:02] so yeah someone want to yeah I mean I'll
[1:23:04] do it I'm just I'm good so Hunter you
[1:23:07] actually changed the resolution Austin
[1:23:08] is right now okay
[1:23:10] so can I just do it as presented since
[1:23:12] you're changing it or do you want me to
[1:23:14] say it
[1:23:15] okay so I'm going to make a motion to
[1:23:17] adopt a resolution supporting the Union
[1:23:19] County 2023 critical intersection
[1:23:21] analysis and supportive including the
[1:23:23] intersection of Joe Carr Road and Marvin
[1:23:26] Road and the intersection of Stacy Howie
[1:23:28] and Waxhaw Marvin roads to be included
[1:23:30] in the crtpo design Grant application
[1:23:34] further discussion
[1:23:36] all those in favor aye promotion passes
[1:23:40] thanks Bjorn thank you for your time
[1:23:43] nice to see you you too
[1:23:53] motion for five minute recess thank you
[1:23:56] all's in favor
[1:23:57] aye
[1:24:10] thanks Bjorn
[1:24:33] foreign
[1:28:08] [Music]
[1:28:31] foreign
[1:28:39] yeah
[1:28:41] just I prevent you both before what
[1:28:45] Chipotle how's that coming yeah
[1:29:04] me too
[1:29:07] I brought it yesterday and didn't get to
[1:29:36] just
[1:30:00] yeah
[1:30:02] you know you can watch it live
[1:30:15] Missouri
[1:30:20] the line for the potty was long
[1:30:50] there's no way ever getting out of here
[1:30:53] I felt that I don't know
[1:30:55] yeah we're not
[1:30:57] what are you trying to go I have to go
[1:31:00] to Greenville
[1:31:01] deliver some furniture for my daughter
[1:31:08] 's board
[1:31:15] hey Austin
[1:31:18] all right so Brown said
[1:31:39] give me one second
[1:31:41] spell
[1:31:47] okay
[1:31:51] I'll see you again
[1:31:54] yeah I'm good
[1:32:00] I'm going to jump back into reopening
[1:32:02] our session and a work session and uh
[1:32:05] uh next up we have on the agendas
[1:32:08] discuss and consider adoption of an
[1:32:15] ordinance for conditional rezoning
[1:32:17] application
[1:32:18] cz2023-1 to reason the 1.51 acre located
[1:32:24] Acres located at 9908 Newtown Road from
[1:32:27] our Marvin residential to the Marvin
[1:32:29] Harris District commercial only
[1:32:33] okay so Council if you recall we held
[1:32:36] the public hearing on August 8th heard
[1:32:39] from the residents we closed that public
[1:32:41] hearing and tabled the decision so this
[1:32:44] is kind of that discussion portion
[1:32:45] between the council
[1:32:46] I do want to kind of go over uh just to
[1:32:49] refresh your memory of the staff report
[1:32:51] of the submittal and highlight some kind
[1:32:54] of key points so this middle is for the
[1:32:57] rezoning of the former Scott Wide
[1:33:01] Property crane house property uh from
[1:33:04] Marvin residential to the Marvin
[1:33:06] Heritage District commercial only
[1:33:08] the applicant is zapsa at all at all
[1:33:14] um but uh zepsa Capital LLC they are
[1:33:18] proposing to renovate the existing home
[1:33:20] at a commercial kitchen and the proposal
[1:33:24] of two additional commercial mixed use
[1:33:26] retail buildings on the site
[1:33:31] the applicant also uh
[1:33:33] the the site from a buffer standpoint
[1:33:36] it's a 20-foot no uh undisturbed buffer
[1:33:40] on their property to couple with the 30
[1:33:42] feet of The Preserve common open space
[1:33:44] for a total of 50 feet that back
[1:33:46] building sits 84 feet off their rear
[1:33:49] property line it sits 114 feet from the
[1:33:52] property line of any Residential
[1:33:53] Properties in The Preserve
[1:33:58] the applicant is proposing
[1:34:00] 28.26 percent of landscaping and
[1:34:02] buffering about 12 percent of
[1:34:04] pedestrian-oriented Hardscape and
[1:34:06] outdoor amenities this total is 40
[1:34:08] percent of reserved open space for the
[1:34:10] development which is succeeds the
[1:34:13] minimum of 30 percent per the ordinance
[1:34:16] the applicant is also proposing a
[1:34:20] to construct originally
[1:34:23] the easement at the front for the Marvin
[1:34:26] Loop they were dedicating and he's been
[1:34:27] to the Village but they have offered to
[1:34:29] construct that eight foot path of their
[1:34:32] portion of the Marvin loop it's per the
[1:34:35] standards and has to be approved by
[1:34:36] ncdot and us so it's going to be built
[1:34:38] to the design standards that we're
[1:34:40] working on for that Marvin Loop project
[1:34:43] they're also proposing that connector
[1:34:45] piece at the back of their lot to
[1:34:46] connect with The Preserve internal Trail
[1:34:50] the vehicle and access and
[1:34:52] transportation
[1:34:53] the property is being proposed to be
[1:34:55] accessed from Newtown Road it will be a
[1:34:57] right in right out configuration the
[1:35:01] applicant has also agreed to consult
[1:35:03] with DOT of any additional Road
[1:35:05] improvements for their driveway entrance
[1:35:10] and all that will be taken care of
[1:35:11] during the preliminary plot and
[1:35:13] construction document phase
[1:35:15] parking the developer is proposing 53
[1:35:17] regular parking spots and four Ada
[1:35:20] accessible parking spots for a total of
[1:35:22] 57. as you recall the Marvin Heritage
[1:35:25] district form-based code does not have a
[1:35:27] minimum parking standard for non-ada
[1:35:30] spots but this roughly equates to one
[1:35:34] and
[1:35:35] 400 square feet of commercial one spot
[1:35:38] for every 400
[1:35:40] square feet of commercial retail space
[1:35:43] the applicant is also looking to secure
[1:35:45] additional shared use parking options on
[1:35:46] other adjacent sites that will that's
[1:35:49] that's the um that is up to the
[1:35:52] applicant developer to secure those in
[1:35:54] riding and work those agreements out
[1:35:57] with any adjoining property owners as
[1:35:58] they so choose
[1:36:03] um I do want to hit on
[1:36:05] the some of the deviation questions that
[1:36:09] kind of came up during the public
[1:36:10] comment because the applicant and their
[1:36:12] some their current submittal being
[1:36:13] considered there's only three requested
[1:36:15] deviations there's not eight uh prior to
[1:36:18] at their first submittal they submitted
[1:36:20] a deviation chart perk that's required
[1:36:23] per our ordinance those deviations
[1:36:26] um regarding
[1:36:28] setback building size all that stuff was
[1:36:31] uh not needed because the form-based
[1:36:34] code was amended those amendments were
[1:36:35] being
[1:36:37] addressed by staff and the village
[1:36:39] attorney way prior to actually receiving
[1:36:41] their application
[1:36:43] um that went through planning board
[1:36:44] Council approved those so there's their
[1:36:47] proposal is compliant the only three
[1:36:49] deviations left are the parking spots
[1:36:52] being nine by 18 our ordinance requires
[1:37:00] sorry hold on
[1:37:03] where's that are the ordinance requires
[1:37:05] 10 by 20 staff is okay with 9x18 that's
[1:37:08] what we the minimum parking standard for
[1:37:10] DOT that is also the minimum parking
[1:37:11] size in Marvin Gardens
[1:37:14] the applicant's also proposing to do a
[1:37:16] crushed concrete parking service
[1:37:18] compared to Paving the ordinance does
[1:37:20] require that parking lot spaces must be
[1:37:22] paved over any spots over 10 parking
[1:37:25] spots
[1:37:26] staff's okay with this deviation request
[1:37:28] as well is because it does promote kind
[1:37:30] of that Rural Preservation feel it also
[1:37:32] helps with uh less impervious surface
[1:37:34] they will they are required to do a
[1:37:37] maintenance planning agreement for their
[1:37:39] parking service so if if the rezoning is
[1:37:41] approved they will submit that
[1:37:43] maintenance plan in agreement with their
[1:37:46] construction documents
[1:37:48] the final deviation that's left is the
[1:37:50] no designated loading space the
[1:37:53] ordinance requires a 12 by 25 loading
[1:37:55] space
[1:37:56] they the applicant is proposing two
[1:37:58] there's two parallel spots at the top of
[1:38:01] the site
[1:38:02] sorry I don't have it pulled off
[1:38:05] but up here by their trash and I can
[1:38:07] pull it up in PB those are going to be
[1:38:09] designated
[1:38:10] um a designated loading zone During
[1:38:12] certain hours but it'd be used for
[1:38:14] parking and outside those hours
[1:38:16] so those are the only three deviations
[1:38:18] being requested as part of the submittal
[1:38:22] and the other five
[1:38:24] that were I guess brought up
[1:38:28] we were changing those deviations
[1:38:31] before they even purchased the property
[1:38:33] correct
[1:38:35] and those and those five deviations were
[1:38:38] based on
[1:38:40] other municipalities and being coming up
[1:38:43] to other Municipal other municipalities
[1:38:47] standards correct earlier this year with
[1:38:50] meeting with certain Property Owners
[1:38:51] within the Heritage district and kind of
[1:38:54] going through hey how you know working
[1:38:55] on submittals they pointed some things
[1:38:58] out dealing with inconsistencies and
[1:38:59] kind of how it uh really impacts
[1:39:03] even getting to the develop like getting
[1:39:05] to the point where they can propose
[1:39:06] something to us I discussed this with
[1:39:08] chaplain chaplain identify him and I
[1:39:10] both went through it highlighted
[1:39:11] sections that were inconsistent didn't
[1:39:13] make sense and those were sections that
[1:39:15] were that were addressed
[1:39:17] the applicant was following that process
[1:39:19] because they submitted their rezoning
[1:39:21] after the fact and obviously we're aware
[1:39:22] and so when they when it was going
[1:39:24] through planning board they catered the
[1:39:27] the their side to what planning like the
[1:39:29] ordinance that planning board
[1:39:31] recommended so that's why it was kind of
[1:39:33] following that process but other than
[1:39:34] that yeah those those amendments started
[1:39:37] prior to the rezoning okay and the three
[1:39:40] remaining
[1:39:41] deviations would you say that they would
[1:39:44] be consistent with other municipalities
[1:39:47] uh yes I mean the um parking space like
[1:39:51] I said the 9x18 ncdot standard we also
[1:39:54] allowed that that's the minimum parking
[1:39:56] space requirement for Marvin Gardens the
[1:39:58] parking surface most other
[1:39:59] municipalities
[1:40:01] you know they are the form-based code
[1:40:03] says it has to be paid most of their
[1:40:05] municipalities have in there where it
[1:40:07] says
[1:40:07] must be paved or you know some type of
[1:40:11] hard surface Crush gravel something like
[1:40:13] that and then it always has some turns
[1:40:15] in there but it's uh subject to maybe
[1:40:17] you know Village engineer or you know
[1:40:19] Municipal engineer or planning directors
[1:40:21] um discretion uh and same thing with the
[1:40:24] loading zone most ordinances do require
[1:40:26] a loading zone for any type of
[1:40:27] commercial retail establishment
[1:40:31] and they're still providing that but
[1:40:33] it's also it's just how the
[1:40:34] functionality of their site that's why
[1:40:36] they're requesting this deviation
[1:40:37] because it is a lot like a long and
[1:40:39] narrow side compared to something that
[1:40:40] has a little bit more movability per se
[1:40:44] okay because I just want to make sure
[1:40:45] that we're that we as a village are
[1:40:48] consistent with other municipalities so
[1:40:50] someone you know can't come in and say
[1:40:53] that the that
[1:40:54] were inconsistent right and the changes
[1:40:57] that were made to the form-based code
[1:40:58] were all when I took um was presenting
[1:41:01] it to planning board like I said it was
[1:41:02] in planning board for three months it
[1:41:04] was April May and June
[1:41:08] I provided them research of about 10
[1:41:10] different municipalities and what their
[1:41:12] ordinances read for kind of similar like
[1:41:14] neighborhood commercial
[1:41:16] districts and that's how that those
[1:41:19] amendments the form-based code were made
[1:41:21] or derived were out of looking at
[1:41:24] what other municipalities are doing how
[1:41:26] it best impacts and best fits Marvin and
[1:41:29] um you know to mention too is like I
[1:41:30] said it's conditional zoning District so
[1:41:33] things can always kind of be greater
[1:41:35] than what we uh
[1:41:38] can always kind of be amended to be
[1:41:40] greater or requested to be greater than
[1:41:41] what's in the ordinance okay thank you
[1:41:49] so finally
[1:41:51] after some discussion too with the
[1:41:53] applicant and from the public hearing
[1:41:55] the applicant has agreed on their site
[1:41:57] plan to do a fence on the side property
[1:42:00] line between the church and their
[1:42:03] property they've also agreed to raise
[1:42:05] the height of the fence to seven feet uh
[1:42:09] from six to seven so it'll be seven feet
[1:42:10] on the side and rear
[1:42:20] honor I know that we we haven't
[1:42:27] we're scheduled to have a meeting with
[1:42:32] uh Weddington Methodist
[1:42:35] so how does that impact any of this
[1:42:37] today
[1:42:38] if there's an like I said it goes back
[1:42:41] to that shared agreement for parking
[1:42:44] they are proposing the 57 spots on their
[1:42:46] site
[1:42:47] the districts intended like I said it's
[1:42:50] kind of you know piece Milling like we
[1:42:51] have the
[1:42:53] no minimum parking standards because
[1:42:54] it's supposed to be kind of a you know a
[1:42:56] Village Center intertwined type
[1:42:57] development throughout this is just the
[1:43:00] first application it is one of the
[1:43:02] smaller properties so if the applicant
[1:43:04] does secure you know some type of shared
[1:43:06] parking agreement through the church per
[1:43:09] um it would not I mean impact this
[1:43:12] rezoning it would just it would actually
[1:43:13] benefit them it would it could also
[1:43:15] potentially benefit the church
[1:43:17] okay I just want to because I just want
[1:43:19] to be
[1:43:22] aware of and have everyone aware of work
[1:43:25] that that we're still working through
[1:43:28] other
[1:43:30] concerns from the church and respectful
[1:43:34] of them that that we work through those
[1:43:36] concerns continue to work through those
[1:43:38] concerns correct yeah yeah the
[1:43:41] their site plan has those vehicular
[1:43:44] stubbed to adjacent properties there at
[1:43:46] the rear like I said that is
[1:43:49] set up through the ordinance to have
[1:43:51] that interconnectivity between
[1:43:52] properties so potentially you know
[1:43:55] additional parking could be at the rear
[1:43:57] there could be some additional parking
[1:43:59] at the front but that just has to be
[1:44:01] agreed upon between the property owners
[1:44:03] okay
[1:44:11] Hunter for for mayor may I speak this is
[1:44:13] chaplain Spencer we've also got the
[1:44:15] development agreement you previously saw
[1:44:18] a draft of the development agreement
[1:44:21] in this zoning District
[1:44:23] and in accordance with the proposed
[1:44:25] ordinance if you do move forward with
[1:44:27] approval you approve the development
[1:44:29] agreement at the same time which sets
[1:44:32] forth supplemental terms and conditions
[1:44:35] there have been some minor deviations
[1:44:39] and clarifications from the development
[1:44:41] agreement that you saw in your agenda
[1:44:43] packet
[1:44:44] at the the first meeting uh one is in
[1:44:48] section 4.3 vested rights
[1:44:50] they proposed 10 years that would give
[1:44:53] them 10 years to develop uh without any
[1:44:56] changes or modifications in our rules
[1:44:58] and regulations
[1:45:00] I had originally suggested I think three
[1:45:03] but hunter said that was um
[1:45:05] too tight and he didn't like that I
[1:45:08] think Hunter was at Bob the draft
[1:45:10] language is for seven years and that's
[1:45:12] something that Council can discuss also
[1:45:15] in section 4.4 are the uses we added
[1:45:19] language
[1:45:20] so that each of the three special permit
[1:45:24] uses that being the restaurant serving
[1:45:28] alcohol the micro Brewery and the vet
[1:45:30] clinic each one of those is now limit
[1:45:33] limited to one use so there could only
[1:45:35] be one restaurant unless they came back
[1:45:37] before the board
[1:45:39] or for a minor Amendment which they
[1:45:41] could certainly do but they would have
[1:45:42] to get another permit if there's a
[1:45:45] second restaurant or a second
[1:45:46] microbrewery
[1:45:48] uh and we also addressed uh
[1:45:52] the parking
[1:45:55] uh and the um
[1:45:58] and the sidewalk
[1:46:00] um issues and just clarify that a little
[1:46:02] bit more
[1:46:04] along with regulations on the hours of
[1:46:07] um the noise
[1:46:13] chaplain where did you say the vested
[1:46:15] rights were four section 4.3
[1:46:23] 4.6
[1:46:25] the term is seven the term is 4.3 so the
[1:46:29] term of the agreement is kind of their
[1:46:30] vested period so it is 70. okay all
[1:46:33] right okay thank you
[1:46:41] so all the all the terms within this
[1:46:43] development agreement have already been
[1:46:45] agreed upon by the applicant
[1:46:49] um they have been discussed with Council
[1:46:53] so all these have been mutually agreed
[1:46:55] upon but this is just kind of the the
[1:46:57] document that kind of makes it binding
[1:46:58] it does get recorded it incorporates the
[1:47:01] site plan and all those Provisions uh
[1:47:03] the elevations and all that
[1:47:14] Hunter is there somewhere in here where
[1:47:16] there cannot be a second hand
[1:47:21] store remember we talked about that that
[1:47:24] is yes that's the way they still have to
[1:47:26] go through the special use permit
[1:47:27] process
[1:47:29] yeah but you said that we couldn't deny
[1:47:32] it that way so we were going to put it
[1:47:34] in this that and no buildings could they
[1:47:36] have a second hand store until we get
[1:47:38] that changed on the
[1:47:41] use list
[1:47:45] I don't know where's the group at City
[1:47:50] that's what I'm saying I want that
[1:47:54] basically is just to prohibit
[1:47:57] um the use of because the way the
[1:47:59] language reads it was a concern of
[1:48:01] counsel
[1:48:03] prohibit consignment thrift secondhand
[1:48:05] store
[1:48:06] as it just said prohibited use
[1:48:13] it's
[1:48:14] I don't I don't want a good will rolling
[1:48:17] up in here and we can't prohibit
[1:48:20] specific companies from being here
[1:48:22] Goodwill would be second-hand
[1:48:24] Consignment and I do not want a Goodwill
[1:48:26] in there so I would
[1:48:28] prefer that that is not a use that would
[1:48:31] be allowed in this until we can get it
[1:48:33] off of this list for the entire District
[1:48:44] I I think it would be no it would be an
[1:48:47] antique store
[1:48:50] okay can we put that in there somewhere
[1:48:53] because I do not want a Goodwill
[1:48:55] I love Goodwill I donate to Goodwill
[1:49:01] no well because that's a Goodwill store
[1:49:03] I mean I don't want any
[1:49:06] you but you can't prohibit Goodwill from
[1:49:09] coming in so I do not want that is my
[1:49:12] fear is it a Goodwill will come in there
[1:49:22] and antiques is different it would be a
[1:49:26] design store or an antique store but
[1:49:28] we're
[1:49:32] you can go down the Antique Road for
[1:49:34] that not a consignment thrift second
[1:49:37] hand
[1:49:38] Hunter and chaplain y'all can work out
[1:49:40] some language where the primary use
[1:49:41] would be to
[1:49:42] uh secondary I just I don't
[1:49:47] where the primary use is that if you
[1:49:49] want to y'all can work on that language
[1:49:51] can you cite yes we we do need to
[1:49:53] confirm that the applicant
[1:49:56] consents to that
[1:50:00] stuff
[1:50:01] they do consent chaplains can you you
[1:50:05] can chaplain I guess I'm assuming that
[1:50:08] you can cite
[1:50:10] specific
[1:50:12] stores like you can't
[1:50:15] yeah we're here to regulate you
[1:50:20] no we can't prohibit especially a
[1:50:22] specific store from coming in
[1:50:24] you can't prohibit a McDonald's you can
[1:50:26] prohibit a fast food restaurant uh
[1:50:30] that has a window so we go after uses
[1:50:34] but I think we can add the language that
[1:50:37] you'll prohibit a consignment and
[1:50:39] secondhand store and I do concur that
[1:50:42] that is completely different than an
[1:50:43] antique store
[1:50:48] okay thanks chaplain
[1:50:54] so chaplain for them to uh to adopt the
[1:50:56] development agreement they just need to
[1:50:57] adopt it as amended to add the provision
[1:50:59] there to prohibit consignment thrift
[1:51:02] secondhand store as a use
[1:51:04] yes and with uh and authorized the
[1:51:07] manager to execute with any final
[1:51:09] changes okay
[1:51:11] we need to have somebody to approve it
[1:51:13] on our end that'd be the manager
[1:51:20] development agreement as amended
[1:51:23] to prohibit
[1:51:41] I unlocked it this morning
[1:51:45] any other questions by Council
[1:51:49] so Chaplin in the just uh in the packets
[1:51:51] I have an ordinance for the rezoning do
[1:51:54] they need to make us to do a motion to
[1:51:56] adopt the ordinance for the rezoning and
[1:51:58] then do a separate motion for the
[1:51:59] development agreement
[1:52:01] no it is all you you have both in the
[1:52:04] ordinance already
[1:52:05] okay your ordinance includes the
[1:52:09] rezoning
[1:52:10] and the development agreement and they
[1:52:12] can just say the development agreement
[1:52:14] as amended because we know
[1:52:16] what the the amendment is through this
[1:52:18] discussion it's just one Amendment
[1:52:30] for development agreement
[1:52:33] our 4A development agreement
[1:52:35] yes your um ordinance has section one
[1:52:39] with the zoning
[1:52:40] and then uh section two is the
[1:52:43] development agreement
[1:52:45] along with section three so it's already
[1:52:47] governed so
[1:52:49] Okay so
[1:52:50] sorry chaplain go ahead
[1:52:52] yeah but I was just saying it's already
[1:52:54] comprehensive so
[1:52:56] the only thing you need to add in your
[1:52:58] motion from the language that is already
[1:53:00] in there would be the development
[1:53:01] agreement as amended and authorized The
[1:53:04] Village manager to execute the final
[1:53:06] version
[1:53:11] Mr Mayor has a question
[1:53:13] um he's like well
[1:53:15] we don't want we may not want two pizza
[1:53:18] places within the same thing I know
[1:53:20] we've got it where if it's a brewery
[1:53:22] microbrewery they have to come and ask
[1:53:24] if there's more than one restaurant
[1:53:26] serving alcohol more than one they have
[1:53:28] to come and ask and then also the
[1:53:30] Veterinary Clinic
[1:53:32] so are we good with just those or do we
[1:53:35] want to say something like like
[1:53:38] like you know do we want two pizza
[1:53:40] places and in all honesty it's kind of
[1:53:43] it's kind of getting the chaplains
[1:53:45] things then you're kind of being nip
[1:53:46] like regulating you you're right you
[1:53:49] only can regulate the use the use is
[1:53:50] restaurant right right um You can't
[1:53:52] necessarily then get into the to the
[1:53:54] menu and who it is
[1:53:57] um and from a market standpoint I mean
[1:54:00] that's kind of if they have two tenants
[1:54:01] that want to have a pizza place and
[1:54:03] think that they both can be competitive
[1:54:13] where you'd never see uh you know that
[1:54:16] they wouldn't allow it because they're
[1:54:19] entities like I said that's something
[1:54:21] that they would probably have to have in
[1:54:22] their own kind of type of lease
[1:54:23] agreement
[1:54:24] um we can't get into regulating
[1:54:30] they're not sure what they're going to
[1:54:32] do with that
[1:54:33] I think that would they be able to
[1:54:35] they'd still have the same opportunity
[1:54:39] correct
[1:54:44] they would likely do that on the private
[1:54:45] end to not have competitive tenants so
[1:54:49] they would be long-term tenants I would
[1:54:50] assume
[1:54:58] oh yeah
[1:55:03] yeah they want to put an ice cream store
[1:55:05] in it but they the other group owners
[1:55:08] talked about an ice cream store it may
[1:55:10] be first in wins or you know you just
[1:55:12] don't know yeah better getting it to win
[1:55:20] all right any other questions
[1:55:25] so Austin has amended the um I will say
[1:55:28] before last name before the adoption is
[1:55:30] the proposed land use land use
[1:55:32] consistency and reasonable statement I
[1:55:35] have provided you guys a draft of that
[1:55:37] chaplain last question in my ordinance I
[1:55:40] just
[1:55:41] have them kind of adopting this they
[1:55:44] don't need I'm going to read it but they
[1:55:45] don't need to have it in there they just
[1:55:47] it just needs to be incorporated into
[1:55:48] the minutes as part of their motion
[1:55:49] correct correct they can incorporate it
[1:55:52] by reference okay has been propelled I
[1:55:55] think to save meeting time
[1:55:58] um so I'm going to read this for you
[1:56:00] guys
[1:56:01] um The Village Council finds that the
[1:56:02] proposed rezoning of 9908 Newtown Road
[1:56:05] further identified by parcel number zero
[1:56:07] six two two five zero zero nine a from
[1:56:11] our Marvin residential to the Marvin
[1:56:13] Heritage District commercial only is
[1:56:15] consistent with the goals and
[1:56:16] recommendations of the village of Marvin
[1:56:18] 2020 land use plan and the Marvin
[1:56:20] Heritage District small area plan
[1:56:22] the Marvin the village of Marvin 2020
[1:56:24] land use plan designates this area as
[1:56:26] the Marvin Heritage district and the
[1:56:28] Marvin Heritage District a small area
[1:56:30] plan further designates the subject
[1:56:32] property to the Marvin Heritage District
[1:56:34] commercial only
[1:56:36] the scale of development is consistent
[1:56:38] with the adopted plans furthermore this
[1:56:39] development is consistent with the goals
[1:56:41] and purpose of the plan by the following
[1:56:43] cultivating a sense of community and
[1:56:44] creating a gathering place within the
[1:56:46] Heritage District maintaining the rural
[1:56:48] character and Heritage
[1:56:50] providing development adjacent to
[1:56:52] existing neighbors that are compatible
[1:56:53] in terms of intensity scale and
[1:56:55] architecture
[1:56:56] providing conservation land or fee and
[1:56:58] Liu for future Greenway connections and
[1:57:00] additional pedestrian oriented amenities
[1:57:01] creating a walkable compact core of a
[1:57:04] neighborhood friendly commercial retail
[1:57:05] and public use uses and spaces
[1:57:08] reuse of existing single-family dwelling
[1:57:11] architectural consistent with new and
[1:57:13] old development in the area maintaining
[1:57:16] rural Aesthetics
[1:57:17] proposing and further incorporation of
[1:57:19] appropriate traffic calming strategies
[1:57:21] and providing shared Parking Solutions
[1:57:23] slash options of future vehicular
[1:57:24] connectivity within the district
[1:57:26] the proposed rezoning of 9908 Newtown
[1:57:28] Road from R Marvin to the Marvin
[1:57:31] Heritage District commercial only is
[1:57:33] reasonable and and is in the public
[1:57:35] interest because it promotes the goals
[1:57:36] and recommendations of the adopted 2020
[1:57:38] land use plan the Marvin Heritage
[1:57:40] District small area plan and any other
[1:57:42] officially adopted plans
[1:57:56] there's a typo
[1:58:03] nope
[1:58:06] I know we've we go to it for a vote um
[1:58:10] you know I I want to assure that
[1:58:15] the audience that this we've looked at
[1:58:19] this for numerous years before I was
[1:58:22] even elected this has always been talked
[1:58:25] about a Heritage district and what could
[1:58:27] be in this
[1:58:28] District
[1:58:30] it required probably a land use change
[1:58:34] or plans that we did
[1:58:36] it was vetted by planning board members
[1:58:41] and I think uh to the concern I and I
[1:58:46] I hear the concerns of some of the
[1:58:48] residents that that abut to this
[1:58:50] property but uh you know I gotta say I'm
[1:58:53] I'm not I think the biggest concern I
[1:58:55] heard was safety
[1:58:57] and I
[1:58:59] I can't obviously nobody can promise
[1:59:02] anything but if it's related to the
[1:59:04] alcohol being served I I I'm trying to
[1:59:08] wrap my head around that when it comes
[1:59:10] to how Firethorne has served alcohol and
[1:59:14] food for numerous years and there are
[1:59:17] Pathways that lead to almost every home
[1:59:20] in that neighborhood and we haven't
[1:59:22] experienced that so with with that said
[1:59:25] we also talked about uh
[1:59:27] um you know the the changes that we what
[1:59:30] we would like to see happening here and
[1:59:32] how that's going to work with you know
[1:59:35] we would encourage the walkability so I
[1:59:37] know there was a traffic concern here
[1:59:40] one of the things that we learned when
[1:59:43] we did this is that it was walkable it
[1:59:46] was accessible not necessarily by
[1:59:48] parking with cars which still in in my
[1:59:51] mind is a concern the parking and how we
[1:59:55] address that
[1:59:58] or how it gets addressed if you know and
[2:00:01] hopefully it is if if this passes and it
[2:00:04] goes through as a restaurant that it is
[2:00:06] a successful restaurant but uh
[2:00:08] um I
[2:00:10] I even though I don't vote I I take this
[2:00:13] this stuff very seriously and I I want
[2:00:15] to assure that I've had conversations
[2:00:18] with I think almost every council member
[2:00:21] here and you know we are aware of that
[2:00:24] and I think there's been a lot of
[2:00:25] thought put into this and
[2:00:27] um if there's
[2:00:29] no other comments or thing I guess we're
[2:00:32] ready for a vote right
[2:00:37] okay I'm going to make a motion to adopt
[2:00:39] an ordinance to rezone the 1.518 Acres
[2:00:42] located at 9908 Newtown Road from our
[2:00:47] Marvin residential to the Marvin
[2:00:48] Heritage District commercial only and
[2:00:51] adopt the following land use consistency
[2:00:53] and reasonableness statement that Hunter
[2:00:56] just read and to approve the development
[2:00:59] agreement as amended and authorize the
[2:01:01] manager to execute the development
[2:01:03] agreement
[2:01:06] further discussion
[2:01:09] all those in favor
[2:01:11] aye
[2:01:15] all right
[2:01:23] thank you mayor
[2:01:25] I believe I'm going to sign out unless
[2:01:27] y'all need anything further from me
[2:01:30] thank you all right good
[2:01:32] meeting and a good long holiday weekend
[2:01:35] thank you you too thank
[2:01:37] you that's right
[2:01:40] all right next up we have discuss and
[2:01:41] consider acceptance of the drainage and
[2:01:44] 30 study and 30 plans and consider
[2:01:48] approval of change order
[2:01:53] well thank you
[2:01:56] change order up to 56 000 for 100
[2:01:58] drawings
[2:02:04] okay so the final study is in your
[2:02:06] agenda packets hopefully you've had a
[2:02:07] chance to review it particularly
[2:02:09] councilman Wortman because they
[2:02:11] Incorporated the changes that you had
[2:02:13] requested so I want to make sure that's
[2:02:15] final and
[2:02:17] we're ready to roll with what's
[2:02:18] presented so I did put the final
[2:02:22] study in that you guys saw a couple
[2:02:24] months ago which is pretty much nothing
[2:02:25] but a bunch of engineered drawn numbers
[2:02:27] you probably don't know what you're
[2:02:28] looking at but it's in there
[2:02:31] um and then the final design
[2:02:33] is also in there also ask them to do
[2:02:35] some schematics of what it would look
[2:02:37] like so I don't know if you had a chance
[2:02:39] to look at that but looks pretty
[2:02:41] um pretty nice the Landscaping plan is
[2:02:43] also included in there
[2:02:45] if you recall when we initially went
[2:02:48] into these conversations we
[2:02:50] had mentioned the Whole 30 percent
[2:02:52] numerous times and wasn't really quite
[2:02:54] sure what that meant initially so I had
[2:02:56] them clarify that basically we would be
[2:02:58] getting a portion of a final document so
[2:03:01] 100 percent of the drawings or what was
[2:03:04] what would be necessary to actually go
[2:03:06] out for a proper bid would be that 100
[2:03:10] percent
[2:03:11] drawing and that would include all the
[2:03:14] different specifications and everything
[2:03:15] that's needed to have an engineered
[2:03:16] stamp drawn sealed package to send it
[2:03:19] out the door there may be an opportunity
[2:03:21] for us to find a contractor to do the
[2:03:25] work as presented as close to
[2:03:28] as close to what we can see based on
[2:03:30] that 30 plan here's the images I'm not
[2:03:32] sure if y'all saw that Christina one
[2:03:35] question real quick
[2:03:36] um just following up did did
[2:03:39] we locate where the well is and no I did
[2:03:45] ask them that question she said that it
[2:03:47] would have to be something that they do
[2:03:48] in a survey
[2:03:51] um in the 100 so she okay so we're not
[2:03:54] sure if this pipe goes right through the
[2:03:56] well or not
[2:03:58] so my question to you all is
[2:04:00] um number one do you want to do the 100
[2:04:03] if so
[2:04:05] uh it would we could either do a budget
[2:04:08] amendment from fund balance we obviously
[2:04:09] don't have the money to do the 100
[2:04:10] drawings
[2:04:12] um we could tie it into the park project
[2:04:14] and pull it from that or we can try to
[2:04:16] RFP with what we've got presented here
[2:04:19] however if we do that I want to make
[2:04:21] sure that y'all fully understand that we
[2:04:24] have to let have a level of discretion
[2:04:25] of the contractor there has to be a
[2:04:27] little bit of understanding that they
[2:04:29] they might not do it exactly what you
[2:04:31] see here we can try as close to possible
[2:04:33] as getting that done but we would have
[2:04:36] to offer them the opportunity to use
[2:04:37] their discretion on some of the things
[2:04:39] we won't be able to get specific on
[2:04:42] grading or any of those expectations for
[2:04:45] flattening the moat so to say
[2:04:48] um we would have to just kind of
[2:04:51] play that by year well they do have
[2:04:53] specifics on elevation on this
[2:04:56] so the grading
[2:04:59] elevations would be followed by by this
[2:05:03] um I'm not I don't well I do know that
[2:05:07] when I asked her about getting rid of
[2:05:10] the moat that would have been part of
[2:05:12] the Topo because they didn't actually do
[2:05:14] exact Topo so I don't know if the
[2:05:16] grading is exactly 100 accurate so it
[2:05:20] very well could be I just don't want to
[2:05:22] have the expectation that it's going to
[2:05:23] be a you know a two percent grade or
[2:05:25] whatever and it ends up being 3.5
[2:05:29] I mean I think that uh
[2:05:32] there's enough information here if
[2:05:36] if I was doing this project myself say I
[2:05:39] was bidding on this I think there's
[2:05:41] enough information here to get a pretty
[2:05:43] accurate
[2:05:46] representation of what
[2:05:48] they're looking for here I mean this
[2:05:51] isn't rocket science it's it's a
[2:05:53] drainage pond with a drainage pipe and
[2:05:56] re-grading to make it aesthetically
[2:05:59] pleasing and functional so
[2:06:03] I mean I I think I would uh consider
[2:06:06] doing the RFP and see what we get back
[2:06:09] if we if we find that we don't have
[2:06:13] contractors or comfortable with doing it
[2:06:15] at this level then we
[2:06:17] consider the 100 plans
[2:06:20] but
[2:06:22] that's just my opinion on it
[2:06:24] and we can definitely do that just I
[2:06:26] want to kind of compare it to to Village
[2:06:29] Hall and essentially like when we
[2:06:30] created Village Hall we had a Sign
[2:06:32] Sealed stamped architectural and
[2:06:34] engineered drawn
[2:06:36] plan so this would essentially be like
[2:06:39] building Village Hall giving only a
[2:06:42] fraction of the plans to say hey this is
[2:06:45] what we're looking for use your
[2:06:46] discretion to do it and there very well
[2:06:47] could be enough for a normal grading
[2:06:50] contractor to do all this stuff I just
[2:06:51] want to make sure y'all understand that
[2:06:55] we can put it out see what kind of
[2:06:57] results we get back and then if we don't
[2:06:59] get anything we can go from there
[2:07:05] what do you think yeah
[2:07:07] okay yeah
[2:07:18] so um
[2:07:20] we do there are specific most of the
[2:07:22] important features have specifics as far
[2:07:25] as the pipe location now it may not be
[2:07:27] exactly precisely where they've
[2:07:29] presented it because it's again it's not
[2:07:31] 100 survey drawn plans but they could
[2:07:35] probably figure out roughly what what
[2:07:38] should happen I mean it's probably
[2:07:39] anything we do at this point is going to
[2:07:41] help
[2:07:41] so yeah it may not solve the problem 100
[2:07:44] it may be uh 85 and we can address that
[2:07:48] at that point so do we think that we
[2:07:49] should do it now or wait until we find
[2:07:51] out if the okay I think that we should
[2:07:54] move forward on a drainage plan for
[2:07:56] Village Hall immediately the
[2:07:59] um and
[2:08:00] and if there is a shortcoming on the
[2:08:03] drainage
[2:08:04] which I highly doubt given this plan but
[2:08:08] if there is we can address it when we
[2:08:11] develop the adjacent property with that
[2:08:14] drainage system
[2:08:16] okay
[2:08:18] Andy feels good about it
[2:08:21] I'm good
[2:08:25] well you don't get about it anyway Joe
[2:08:28] um all right so I'm going to make a
[2:08:29] motion to accept the drainage plans as
[2:08:32] presented and direct staff to solicit
[2:08:34] rfps based on the limited 30 plan
[2:08:38] and authorize a manager to execute the
[2:08:41] oh no that's it
[2:08:44] RFP based on the limited 30 plans period
[2:08:49] further discussion
[2:08:51] all's in favor
[2:08:53] aye the motion passes so I just want to
[2:08:55] remind you too this project wasn't
[2:08:56] budgeted so when we get the rfps we'll
[2:08:58] have to do a budget amendment on that
[2:09:00] just let you know
[2:09:05] I don't know I don't know if this is the
[2:09:08] appropriate time to bring this up I was
[2:09:09] just going to ask the the other issue
[2:09:12] with leakage I
[2:09:15] where are we at with that yeah that's a
[2:09:17] good question we're still identifying
[2:09:18] that Source we think that we have come
[2:09:21] to the conclusion that it's irrigation
[2:09:22] the drip line
[2:09:25] but we are still trying to isolate it
[2:09:27] we've had a leak person come out and
[2:09:29] they told us they identified a leak
[2:09:30] however when the contractor came out to
[2:09:34] fix the leak when they dug it all up it
[2:09:35] was not leaking we have had the
[2:09:37] irrigation lines pressurized twice they
[2:09:40] said that it wasn't the irrigation lines
[2:09:42] um so we're waiting for a dry day so we
[2:09:45] can kind of see if it's from the
[2:09:47] irrigation which is what we think it is
[2:09:49] or if it's groundwater so since they
[2:09:52] said it was a leak and they went in to
[2:09:54] fix the leak and they broke up all the
[2:09:55] concrete and there was no leak uh we
[2:09:58] shouldn't have to pay for that and they
[2:10:00] need to give us our money back and give
[2:10:02] us some money to fix it so we had we've
[2:10:04] been fighting them and unfortunately the
[2:10:06] leak and the leak person so
[2:10:09] Roto-Rooter was called Roto-Rooter came
[2:10:11] out they said that they can't identify
[2:10:13] where the leak is coming from they
[2:10:15] recommended a vendor come out called
[2:10:17] leak Squad leak Squad came out they shut
[2:10:20] the lines down they ran pressurized
[2:10:22] tests they do use this audio device that
[2:10:25] they put into the pipes to see where
[2:10:27] it's coming from or in the ground they
[2:10:28] heard something in the area where they
[2:10:31] marked that it was a leak we think that
[2:10:34] what they heard was a frog
[2:10:37] they yes
[2:10:40] which one of our experts you have to be
[2:10:43] there to get the whole story Joe but yes
[2:10:46] yeah so
[2:10:52] they they marked it off they came in to
[2:10:54] locate the city came or the utilities
[2:10:56] came in did a locate on the gas line
[2:11:00] um they came out the the crew
[2:11:02] Roto-Rooter then came back out they
[2:11:04] actually did what the contract said they
[2:11:06] were supposed to do excavate find the
[2:11:09] location where it was located and then
[2:11:10] make the repair so they were out here
[2:11:12] for probably I don't know three hours
[2:11:14] Excavating isolating the line getting
[2:11:18] ready to do the repair so per the
[2:11:19] contract they really have done
[2:11:21] everything they said they were going to
[2:11:22] do except for the repair section we have
[2:11:26] asked them to deduct that from the bill
[2:11:27] which they have done I'm also still
[2:11:30] trying to fight with the leaked person
[2:11:31] to say basically that you came out here
[2:11:33] and identified a leak and there was no
[2:11:35] leak so until we can fully discover that
[2:11:37] there is truly no leak
[2:11:40] we're kind of at a standstill right now
[2:11:42] we've dug the hole still dug out which
[2:11:44] is why we've got it still open because
[2:11:46] we want to make sure it's still in fact
[2:11:47] not a leak where they said it was
[2:11:51] it's it's rained every single day since
[2:11:54] uh since it's happened the whole dug up
[2:11:56] did they go back and do that
[2:11:59] audio thing and
[2:12:01] because that's where they can determine
[2:12:03] where no they haven't yeah okay because
[2:12:05] I would recommend wouldn't that make
[2:12:07] sense after it stuck up because if it's
[2:12:09] saying it's there and they look and it's
[2:12:11] it's clearly not there well it wasn't
[2:12:13] there when when they were out when they
[2:12:15] actually excavated everything and to
[2:12:16] isolate where this they said the leak
[2:12:18] was
[2:12:19] there was no there was nothing coming
[2:12:21] out we waited a couple of hours while
[2:12:24] they were here and left it open it
[2:12:25] nothing happened they went shut off the
[2:12:27] water shut it back on nothing changed we
[2:12:30] also left it there the entire day it
[2:12:32] didn't fill back up it did fill back up
[2:12:34] the next day because it rained
[2:12:37] um and we were going to keep it filled
[2:12:39] up until it dried out we were gonna
[2:12:41] we were gonna keep it I'm sorry keep it
[2:12:43] open until it dried out completely so we
[2:12:45] were able to turn the irrigation back on
[2:12:47] to see if it actually filled back up
[2:12:50] but unfortunately it's rained every day
[2:12:52] since then
[2:12:53] um what we third thing I want to add
[2:12:55] just for clarification for Joe
[2:12:58] one of the tests that they did was they
[2:13:00] turned off the main valve in Christina's
[2:13:03] office for a 24-hour period and looked
[2:13:06] at the at the meter there was no change
[2:13:08] in the meter so there's no way there
[2:13:13] could be a leak between that it's not on
[2:13:16] any of our main lines so it's not
[2:13:18] underground and we did it again we did
[2:13:21] it we did that twice they did it twice
[2:13:23] result there's no water escaping
[2:13:25] anywhere so therefore I feel very
[2:13:28] confident in the fact that there's no
[2:13:30] leak between the building and the meter
[2:13:33] at the road with the fact that we've had
[2:13:35] rain and with what we just discussed
[2:13:38] is it drainage
[2:13:40] is it the foundation it works
[2:13:44] I feel like and and this is why we're
[2:13:46] back at the irrigation because what
[2:13:49] we've found is the irrigation box stays
[2:13:51] full of water the valve box that's by
[2:13:53] beside the side and it's off of a well
[2:13:55] correct it's off the well yes but it
[2:13:58] comes around but right where I'm getting
[2:14:00] at it is is there were several
[2:14:02] underground uh passages under the
[2:14:04] sidewalk and such for the irrigation
[2:14:06] that would have the water if it's
[2:14:09] leaking in that valve box and filling
[2:14:11] that valve box there's opportunity for
[2:14:13] it to run underground and and come to
[2:14:17] that point so the reason
[2:14:20] we feel like it is the valve box has is
[2:14:24] is leaking water in there as the other
[2:14:25] valve boxes on the property are dry
[2:14:27] that's the only one that seems to be
[2:14:29] consistently full of water so
[2:14:33] I'm not seeing 100 percent there could
[2:14:37] be some other source but we want to rule
[2:14:39] that out because that's the next most
[2:14:42] likely Source if that is not in in fact
[2:14:44] the source of water then there is
[2:14:48] something that
[2:14:50] is either groundwater like a
[2:14:54] spring under here somewhere or something
[2:14:57] that was missed in the soils
[2:15:02] preparation which they did a lot of
[2:15:05] undercut and replacement of soil on this
[2:15:09] property before this building was built
[2:15:10] because of the if you remember I'm not
[2:15:12] sure if y'all remember this but there
[2:15:13] was a whale that was on the property
[2:15:15] that
[2:15:17] they had closed that they had identified
[2:15:19] in construction from my understanding it
[2:15:21] was closed off everything was done like
[2:15:23] it was supposed to
[2:15:25] um so I don't know it's well it's
[2:15:28] actually not even on our property the
[2:15:30] well that was identified was is on
[2:15:32] Robbie's property it's that little box
[2:15:34] over there then subsequently we found
[2:15:37] another well
[2:15:38] which is way up by the road when they
[2:15:41] cleared that has been capped so there
[2:15:46] those are the two Well locations that we
[2:15:48] are aware of now I do know that prior to
[2:15:53] construction when we walked this area
[2:15:55] there was a lot of water that sat in
[2:15:58] this area here that we assumed was
[2:16:02] coming from the drainage from the ditch
[2:16:05] now I'm not going to rule this out
[2:16:08] that
[2:16:10] it could possibly even be underground
[2:16:13] from that and if we do our this this
[2:16:17] re-grading for the drainage and all that
[2:16:19] stuff
[2:16:20] address that may address it as well so
[2:16:22] there's there's
[2:16:24] a couple of things I'd like to see and
[2:16:27] I'd like to at least
[2:16:30] make sure that it's not the irrigation
[2:16:33] 100 before we just look into others the
[2:16:36] next steps that we have to address it
[2:16:37] are to one get a couple good hot warm
[2:16:40] days where it's not going to rain
[2:16:42] keep the irrigation on as we have it now
[2:16:44] see if it fills back up if it does we'll
[2:16:47] shut it off see if it goes away and if
[2:16:49] it does that tells us it's irrigation if
[2:16:51] it doesn't
[2:16:53] then we got another problem that we've
[2:16:55] got to figure out I.E either groundwater
[2:16:57] or something in this oil or or this over
[2:16:59] here right okay so okay it's going to be
[2:17:03] a process let's just put it that way
[2:17:05] it's not going to happen overnight
[2:17:06] unfortunately
[2:17:08] but we are going to have to do
[2:17:10] the repair on the concrete over here so
[2:17:12] at some point we'll figure all that out
[2:17:14] we're not going to even touch it until
[2:17:15] we figure out what what's going on with
[2:17:17] it but we will continue to fight to not
[2:17:19] pay those bills Unfortunately they did
[2:17:21] do most of the work to try to get to the
[2:17:24] area that was identified
[2:17:33] do we have any action on
[2:17:38] all right so next next up we have a
[2:17:41] review council meeting minutes
[2:17:44] I work very fast I work very fast so
[2:17:47] your minutes from yesterday are also
[2:17:48] included I saw myself thank you
[2:17:52] no issues no issues
[2:17:55] I will note that lunch is here by the
[2:17:57] way so you guys decide whenever you want
[2:18:00] to break for that
[2:18:01] work
[2:18:04] okay so we'll need a motion to you don't
[2:18:06] need a motion oh you're Distributing
[2:18:08] right now sorry
[2:18:14] all right next up we have a consumer
[2:18:16] call for a public hearing discussion
[2:18:18] and consideration especially use permit
[2:18:21] application SUV
[2:18:23] 2023-3 for a pool to be located outside
[2:18:25] the setbacks for
[2:18:28] 151.054 E located at 206 Claridge court
[2:18:33] so moved all's in favor
[2:18:36] aye motion passes
[2:18:38] poor Hunter
[2:18:40] all I was going to say is it might not
[2:18:42] be needed I'm going to confirm with the
[2:18:43] applicant today so how does that work if
[2:18:46] they don't need it
[2:18:51] all right let's go get lunch we're
[2:18:52] getting lunch and then we'll reconvene
[2:18:54] now we'll take a quick break motion Paul
[2:18:56] is in favor for a quick break
[2:18:58] aye aye
[2:19:01] I need you to decide
[2:26:53] foreign
[2:27:15] I got it and I figured somebody needs to
[2:27:20] most like
[2:27:23] we really need to support them I agree
[2:27:26] I'll go 17. it's no the 19th
[2:27:32] the Tuesday the 19th
[2:27:35] I'm leaving the 17th that's right
[2:27:38] I can't go because I've got a dentist
[2:27:40] appointment
[2:27:41] but
[2:27:45] the 19th of September it's a Tuesday I
[2:27:49] can change I can change my dentist
[2:27:51] appointment
[2:27:52] but if we've got okay Jamie will go
[2:27:55] Christina's going it's at the AG Center
[2:27:58] so I encourage you guys to but we have
[2:28:01] to RSVP and they're filling up I think
[2:28:04] we have to okay okay
[2:28:09] I was going to have Austin send her an
[2:28:11] email
[2:28:13] awesome your new send or email who's in
[2:28:16] Christina and Jamie I have to work okay
[2:28:21] well pay attention
[2:28:23] it's the Union County it's the Union
[2:28:26] County leadership
[2:28:28] conference and we just got another email
[2:28:30] saying that they were filling up and so
[2:28:32] please RSVP I think by tomorrow
[2:28:34] Jamie's going Jamie and Christine are
[2:28:36] going
[2:28:37] Bob Andy either yeah
[2:28:39] okay I have to work okay
[2:28:43] all right
[2:28:47] Austin Canoe RSVP late today
[2:28:50] thank you
[2:28:59] I'll take this she's she's sick this is
[2:29:01] just something that the county needs
[2:29:03] this is our tax settlement for the year
[2:29:04] not the fiscal year but the
[2:29:06] the calendar year
[2:29:10] they just have to have you all approve
[2:29:12] this
[2:29:15] hopefully there's no questions
[2:29:19] the tax collection settlement
[2:29:22] this is what they collected
[2:29:26] 3.74 I'm sorry 1 million
[2:29:31] 374 000.
[2:29:43] I think she just needs y'all to approve
[2:30:10] all right
[2:30:14] um Laura
[2:30:16] foreign
[2:30:23] to that
[2:31:13] we do pay in advance
[2:31:15] there's
[2:31:16] about six months it's not completely a
[2:31:19] whole year in advance but it's
[2:31:22] yeah I don't know the exact month but
[2:31:24] it's not
[2:31:25] so we get the
[2:31:28] we start collecting taxes around
[2:31:31] November Feb November December January
[2:31:33] we have already floated
[2:31:36] the cost of that from July 1st over
[2:31:40] so yes we do
[2:31:57] in July or whatever
[2:32:01] taxes are what September
[2:32:11] it's because our fiscal year starts July
[2:32:13] 1st
[2:32:18] I mean we can do that but it would
[2:32:20] require us
[2:32:24] but it would it would require us to
[2:32:26] change in the middle of our we we do the
[2:32:28] projections based on a budget year so
[2:32:30] that would basically essentially mean if
[2:32:32] they're doing it by calendar year we
[2:32:34] would have to change mid mid budget
[2:32:36] you know what I'm saying like if they
[2:32:38] give us a rate from January to December
[2:32:40] we wouldn't have set that into our
[2:32:42] budget for the next for the appropriate
[2:32:45] year so if they like for example if they
[2:32:46] say it's going to cost you 300 a
[2:32:49] household from January to December our
[2:32:51] fiscal year comes into play in July so
[2:32:54] we will have had to have known
[2:32:56] for the next year in order to project
[2:32:58] the rates out accurately because we
[2:33:00] can't change the rates mid-year
[2:33:20] I don't know if she prepared one but you
[2:33:23] just needed you need a motion to accept
[2:33:25] okay
[2:33:33] all right so I'm going to make a motion
[2:33:34] to approve and authorize the Union
[2:33:36] County Tax Collector to Levy and collect
[2:33:37] Village of Marvin taxes for 23-24 fiscal
[2:33:40] year
[2:33:41] all in favor
[2:33:44] how easy was that
[2:33:48] next up discussion in 2024 Marvin day
[2:33:51] sponsorship Drive okay so this is me
[2:33:55] so being on the Marvin Day committee
[2:33:57] again this year
[2:33:59] we are
[2:34:00] not going to have because we're trying
[2:34:03] to condense the day have it in one
[2:34:05] location
[2:34:06] we are not going to have Council sit on
[2:34:10] different working groups
[2:34:13] so we're going to have extra meetings
[2:34:15] you're not going to have
[2:34:17] extra tasks the one thing that we ask
[2:34:21] you to do is go get sponsors now I know
[2:34:24] it is hard for some of us to go and ask
[2:34:25] people for money but the worst they can
[2:34:28] say is no and then you say okay thank
[2:34:30] you very much and you go on to the next
[2:34:32] person
[2:34:33] we have people that really get out and
[2:34:35] do it we have people that don't so
[2:34:38] that is what we are asking you to do for
[2:34:40] Marvin Bay I'm not asking to get the
[2:34:42] dunk tank again this year I'm not asking
[2:34:45] you to be on a working group I'm asking
[2:34:47] you to go get money so can we all
[2:34:50] agree
[2:34:52] that when we come back out
[2:34:56] I would say our next meeting
[2:34:58] we will have the list of previous
[2:34:59] sponsors
[2:35:01] people that have donated money who
[2:35:04] haven't who we've reached out to who we
[2:35:06] should be reaching out to
[2:35:08] and we're going to divvy that up
[2:35:11] and I need everybody's commitment that
[2:35:13] they will go out and get money
[2:35:15] or try to yeah
[2:35:19] I think the only thing that we would
[2:35:21] want to know
[2:35:23] is with all the adjustments and changes
[2:35:27] to your point being one location just to
[2:35:30] know what we are able to present in
[2:35:33] other words how how has it changed from
[2:35:35] last year
[2:35:37] how we're anticipating it to be more
[2:35:39] successful
[2:35:41] um that sort of thing you know just we
[2:35:44] know what we're presenting that's all
[2:35:47] Austin I need you back in there I have a
[2:35:49] question for you
[2:35:55] are we
[2:35:57] still
[2:36:00] convinced that you for Park is the
[2:36:02] location
[2:36:06] we've moved on we're past this point we
[2:36:08] booked the band the location
[2:36:11] the man is for the location the ship has
[2:36:13] hailed
[2:36:15] no yep the location
[2:36:17] well only thing the only thing
[2:36:21] we have a hundred percent control of the
[2:36:23] location with ephra Park
[2:36:26] if we want to continue to move if we
[2:36:29] want to continue to move forward
[2:36:31] which which we are we have 100 control
[2:36:34] of V for part we have
[2:36:37] we are always going to run up against
[2:36:40] what we can't do with other locations
[2:36:43] now can we augment eford Park I I
[2:36:48] believe so if we get bigger and things
[2:36:50] happen where we can ask for maybe the
[2:36:53] high school parking lot to do a car show
[2:36:55] to do uh I don't know some kind of some
[2:36:59] type of event
[2:37:01] but as long as we're
[2:37:03] asking for locations and being told what
[2:37:07] we can and can't do it's it's difficult
[2:37:09] but well
[2:37:12] the reason I said
[2:37:14] I've had a quick conversation with the
[2:37:16] principal
[2:37:18] who
[2:37:20] told me it was beyond him but
[2:37:22] I believe he came to you Hunter
[2:37:24] regarding
[2:37:27] sorry
[2:37:29] he came to you about running a space for
[2:37:32] the teachers before school started was
[2:37:36] the principal
[2:37:39] that would do okay
[2:37:48] wow the ptso the ptso for Marvin High
[2:37:52] School came to the village and wanted to
[2:37:54] rip the park before school for a
[2:37:56] breakfast right okay that's what that's
[2:37:58] what you're asking yeah because he he
[2:38:01] asked he reached out to me first because
[2:38:02] he was looking for a venue
[2:38:04] I said well call the park because I I
[2:38:06] don't get involved in
[2:38:08] fact you gotta see if it's even
[2:38:09] available he had a specific day
[2:38:12] I assume he did that then I found that
[2:38:14] later that
[2:38:16] what I was talking about why can't we
[2:38:18] get
[2:38:19] the high school in perpetuity to perform
[2:38:22] I mean to have that as the event
[2:38:26] just asking
[2:38:27] I said well that's
[2:38:29] Beyond him but they did work out
[2:38:32] something where
[2:38:34] they were going to provide parking
[2:38:37] in exchange for what we is that what it
[2:38:40] came out today
[2:38:44] okay
[2:38:47] I'm just saying that potentially opens
[2:38:49] the door to
[2:38:51] carrying a location even if it's well
[2:38:54] before
[2:38:57] events are being held there I think it
[2:38:59] just it makes sense to explore that
[2:39:01] because I think one of the biggest
[2:39:03] things I'm sorry but it's just that that
[2:39:06] having to park somewhere and be driven
[2:39:09] over there was a real
[2:39:12] factor in the attendance
[2:39:14] well Joe I have to tell you that every
[2:39:17] other municipality in this area does the
[2:39:20] same thing
[2:39:21] because parking is a problem for
[2:39:24] everybody
[2:39:26] well but we have an answer just because
[2:39:28] they do the same thing doesn't mean we
[2:39:30] have to fall soon
[2:39:33] but we don't have an answer because the
[2:39:35] high school won't let us use it that's
[2:39:37] see you're you're just assuming that's
[2:39:41] that is final discussion we've not have
[2:39:44] you reached that to the
[2:39:46] um the guy that's over all the
[2:39:48] principles the superintendent has anyone
[2:39:50] talked to
[2:39:52] answer is no and he's the guy that
[2:39:55] decides that that's all I'm saying is
[2:39:58] have that conversation for the future
[2:39:59] why not I mean all they can do is say no
[2:40:04] that's all I'm saying
[2:40:06] but I don't want it at the high school I
[2:40:09] want it at the park because it's our
[2:40:10] park we ought to be able to show off our
[2:40:12] Park that's my that's my opinion
[2:40:16] but I'm saying it's just
[2:40:18] the attendance from the first year to
[2:40:20] the second was way dropped off
[2:40:23] what reasons
[2:40:25] maybe it was multiple parking locations
[2:40:27] Maybe
[2:40:29] I'm
[2:40:30] just stating a fact
[2:40:32] and yes I assume it'll grow each time
[2:40:35] and hopefully we get to that point where
[2:40:38] the one parking location
[2:40:41] multiple buses and it's not as big an
[2:40:45] issue but
[2:40:48] all right well this is not on the agenda
[2:40:51] to discuss I know but it's Marvin day
[2:40:53] sponsorship Drive sponsorship yeah but
[2:40:56] not but but it leads into that because
[2:40:59] here's why
[2:41:01] if if you don't have people
[2:41:04] oh wait
[2:41:07] if you don't have people
[2:41:10] showing up for the event the sponsor is
[2:41:13] not going to step up because I've
[2:41:15] already heard from
[2:41:17] one that I have used that is like well
[2:41:20] we didn't get any leads from that well
[2:41:22] maybe we'll have a better situation I
[2:41:24] haven't talked to him since
[2:41:26] sorry they generated but I'd be curious
[2:41:30] to see all the ones that I procured as
[2:41:33] far as sponsors how well they did how
[2:41:36] many leads I mean
[2:41:40] I've talked to I've talked to two
[2:41:42] out of the ones I got just to see you
[2:41:44] know because we I mean we really haven't
[2:41:48] brought this up as far as sponsorship
[2:41:49] but it's just a note if
[2:41:52] are they going to put money towards just
[2:41:54] like I would predict
[2:41:57] um good luck adding uh the Lobster Truck
[2:41:59] to show up oh we got them secured you do
[2:42:02] yep don't you worry about it all right
[2:42:05] I'll look forward to having them there
[2:42:08] but
[2:42:11] okay so I'm gonna assign you a job then
[2:42:14] buddy to sign in perfect call the
[2:42:16] superintendent okay
[2:42:19] all I wanted permission for there you go
[2:42:21] because I will make that phone call and
[2:42:23] see if I can have that and if he's open
[2:42:25] to it would you consider changing the
[2:42:27] venue to have it all day there
[2:42:30] no I'm just saying have the
[2:42:33] concert there
[2:42:38] I have everything else at the park at
[2:42:39] the park so you still have two locations
[2:42:41] you do and there's you know the only
[2:42:44] thing you had multiple locations you had
[2:42:47] a place where they ran in the morning
[2:42:48] and then the first year and then the
[2:42:51] place where they
[2:42:53] did the car show which led into there
[2:42:57] was raining
[2:42:58] um I'll just mention real quick too the
[2:43:00] fireworks if we're going to keep the
[2:43:02] fireworks the place that let us do it
[2:43:05] the year we were at the high school they
[2:43:06] did call us last year we hadn't reached
[2:43:09] out to them but they did call us and
[2:43:10] said they weren't interested in doing it
[2:43:12] last year so
[2:43:14] I think that would probably be a problem
[2:43:16] if we
[2:43:20] yeah I don't know
[2:43:22] so just putting that out there okay
[2:43:25] Then I then I won't reach out because I
[2:43:27] just thought the way that all was done
[2:43:29] and fireworks went off after we I
[2:43:31] thought we were in better graces with
[2:43:33] them maybe not that's fine
[2:43:35] you know I don't think it's anything we
[2:43:36] did I just for some reason they just I I
[2:43:38] think it had something to do with
[2:43:40] scaring animals and
[2:43:41] that kind of stuff it's always about the
[2:43:43] animals their neighbors their neighbors
[2:43:44] gave them a rational crap about it
[2:43:46] guaranteed
[2:43:48] but do you feel free to reach out to the
[2:43:49] superintendent and just see what he says
[2:43:52] okay
[2:43:55] Mr Mayor if I'm going to commit to that
[2:43:58] then I want to commit to this end you're
[2:44:00] willing
[2:44:01] why am I going after a conversation to
[2:44:05] have him do something if the counselor
[2:44:07] is not really in favor they want to keep
[2:44:08] you want to keep I'm not opposed to that
[2:44:10] do you want to keep it for Parks so be
[2:44:12] it I'm just saying I look at the first
[2:44:14] year in the second year and there was a
[2:44:16] considerable falling off and some of the
[2:44:18] people I talked to weren't even from
[2:44:20] Marvin they just followed the band
[2:44:21] that's why we got people there because
[2:44:23] you know you know do you know what
[2:44:25] brought the peoples what's that it was
[2:44:27] the car show
[2:44:28] possibly no it is okay and that's great
[2:44:32] so it brought the peoples
[2:44:34] but nobody's willing to do the car show
[2:44:35] well it's it's a lot of work and I've
[2:44:39] never done it before I've just helped oh
[2:44:42] I'm just saying nobody's willing to do
[2:44:43] it well I thought that was an annual
[2:44:45] thing with the band yeah their last
[2:44:47] annual thing was when when we they did
[2:44:49] it with us no no it wasn't bad it's
[2:44:51] actually the color guard which they just
[2:44:54] supported and how fun that those guys
[2:44:56] were a big into car and
[2:44:59] I offered five volunteers and and he
[2:45:03] chose not to call any of them and he did
[2:45:05] it all himself and it was just too much
[2:45:07] work for him so and I appreciate that
[2:45:09] because I know how much work is involved
[2:45:10] and I'm certainly I don't have the
[2:45:13] contacts or the ability to Baby able to
[2:45:16] manage that so that's why I stepped
[2:45:19] aside and there's no one there to follow
[2:45:21] up with the band as far as who's in cars
[2:45:23] and who they're what kids are currently
[2:45:25] still involved
[2:45:29] quick question on that is there
[2:45:33] as a circuit of
[2:45:35] of car shows that we could coordinate
[2:45:37] with that were going to do a car show
[2:45:39] anyway that just so happened to do it on
[2:45:41] Marvin Day weekend
[2:45:45] because there's multiple car shows that
[2:45:47] go on all around the
[2:45:49] Charlotte area
[2:45:51] on a monthly basis they're always there
[2:45:53] and then there's some special ones that
[2:45:55] they'll throw in the problem is people
[2:45:58] and you're out there really
[2:46:02] basically pitching hey come to our car
[2:46:04] show but those car shows they want they
[2:46:06] want judges they want you know as people
[2:46:09] expect to have judges and that's where
[2:46:11] it gets all like who's judging I can't
[2:46:15] do you have the uh the amount of people
[2:46:17] to judge because most of that's
[2:46:18] volunteer stuff and finding those
[2:46:21] individuals to do it and then tabulating
[2:46:23] the results it's it's almost
[2:46:26] um impossible but if you were able to
[2:46:28] have a successful car show without
[2:46:30] having Awards and raffle prizes and
[2:46:33] stuff no I get all that but let's just
[2:46:35] say
[2:46:39] Mopar is going to do a car show
[2:46:43] and they're going to do it somewhere at
[2:46:44] some time can we not reach out to Mopar
[2:46:47] and go have it the wicked yeah that's
[2:46:49] all I'm saying and
[2:47:00] it's going to go
[2:47:01] you got to have the attendance to get
[2:47:05] people wanting to sponsor the problem
[2:47:07] with doing doing the car show at the
[2:47:09] park is is the space yeah
[2:47:13] but that's why that first year was that
[2:47:16] was that there was a law for a little
[2:47:18] bit and then it moved on to that for
[2:47:21] those that wanted to stay and you could
[2:47:22] park your car and drive and leave
[2:47:24] anytime you wanted which was nice but
[2:47:26] everyone stayed for the fireworks but
[2:47:28] now fireworks are off maybe it's a move
[2:47:30] points I'm gonna move on
[2:47:35] and we've all committed to getting
[2:47:37] sponsors
[2:47:39] next up we have discuss and consider
[2:47:40] having Marvin Ethan park assist into
[2:47:43] multiple multi-purpose fields and to
[2:47:45] enter contract with
[2:47:47] a five percent contingency and allow
[2:47:50] manager to execute the contract
[2:47:55] so attaching your agenda packets is the
[2:47:58] multi-field assessment we said we would
[2:48:00] get working on a couple meetings ago you
[2:48:03] all had discussed the opportunity to
[2:48:05] have soccer and potentially flag
[2:48:07] football
[2:48:08] we discussed the limitations that we
[2:48:11] have at the school system Fields
[2:48:14] currently so what we've done is reached
[2:48:17] out to experts that know what they're
[2:48:19] doing in the creation of fields ask them
[2:48:23] to come in and give us a quote as to how
[2:48:24] much they think it's going to cost for
[2:48:25] us to really assess what would be needed
[2:48:27] to start that process so that's here in
[2:48:29] front of you it's approximately eighteen
[2:48:31] thousand dollars
[2:48:35] that that's pretty much it I mean Tyler
[2:48:38] unfortunately doesn't have the expertise
[2:48:39] engineering to really understand what's
[2:48:42] needed to put in a field
[2:48:45] so that's that's why we presented this
[2:48:47] option to you all to consider so I've
[2:48:49] had a couple of conversations with you
[2:48:50] about this since we've had you've got
[2:48:52] this information
[2:48:54] this is being driven by residents right
[2:48:58] that's the reason that we're looking at
[2:48:59] this
[2:49:00] so my suggestion is to form a committee
[2:49:04] an exploratory committee that will
[2:49:07] assess the options of multi-field
[2:49:10] multi-purpose Fields try to find out
[2:49:13] what the options are tap into the
[2:49:16] resources that we have in Marvin and I
[2:49:18] know there's a lot and I brought the wax
[2:49:20] off Sports magazine because I guarantee
[2:49:22] that you know there's a lot of people
[2:49:25] that are want some sort of sports Fields
[2:49:28] here in Marvin I know of Two Gentlemen
[2:49:31] who are interested we had Diane from
[2:49:33] belgrove who sent in a public comment
[2:49:35] that we should have field so I think we
[2:49:37] should reach out to her and see if she'd
[2:49:38] like to be on it
[2:49:40] um and then ask everybody if they have
[2:49:42] other people that would like to be on it
[2:49:44] I think we can do a five member
[2:49:46] committee and let them go do some
[2:49:48] research staff doesn't have the time
[2:49:49] staff doesn't have the expertise
[2:49:52] to do this so if our residents want
[2:49:55] something like this which I think it's a
[2:49:57] great idea
[2:49:58] I would like their involvement so good
[2:50:01] question do you need a separate
[2:50:02] committee because that seems to fall
[2:50:03] square in the prg boards
[2:50:06] yeah no I want a separate committee for
[2:50:09] this this is not I'm not putting that on
[2:50:11] them I want people who want this before
[2:50:13] you want to put any money towards it
[2:50:15] before I put any money towards it I want
[2:50:17] some sort of exploratory committee to go
[2:50:19] out and do some research and you know
[2:50:21] what they may be able to reach out to
[2:50:23] somebody and get them to donate their
[2:50:25] time to give us that expertise where
[2:50:27] we're not paying for it so better you
[2:50:30] think about the Elementary School Marvin
[2:50:34] it's built by all sponsors
[2:50:37] um before and then before Union County
[2:50:40] took it over and a lot of the sponsors
[2:50:42] are still on the fences okay so that's
[2:50:46] right so it's it's it's the gentleman
[2:50:48] Mike who came in
[2:50:51] yeah cannot I never never say Israel
[2:50:53] yeah never say his last name right Milan
[2:50:55] from Marvin Creek they both live in
[2:50:57] Marvin Creek they've talked to each
[2:50:58] other about this somebody can reach out
[2:51:00] to Diane see if she wants to be on it
[2:51:02] and then ask those three people who else
[2:51:04] they might want but I'd have a
[2:51:05] five-person committee
[2:51:07] we can form that and let them do that
[2:51:09] publicize that to get that sure or put
[2:51:12] that on our website says we are we need
[2:51:16] um you want to do five or seven people
[2:51:20] three does an ad hoc committee
[2:51:23] we can do that I just we'll just need
[2:51:25] information so that these people know
[2:51:27] what they're signing up for
[2:51:29] okay what kind of information do you
[2:51:30] want
[2:51:31] Tyler and I can come up with something
[2:51:33] okay
[2:51:35] all right everybody good with that
[2:51:36] before we spend any money I I agree
[2:51:38] let's let's again we're driving this
[2:51:41] because residents have come in and asked
[2:51:43] for this so let's ask the residents for
[2:51:45] some help so and I'll just we'll we'll
[2:51:47] do that and um we'll bring it back to
[2:51:50] you all but what I would suggest to them
[2:51:51] is to go through this proposal see what
[2:51:53] some things that they can do on them
[2:51:55] their own if there are certain
[2:51:57] components of it they still think are
[2:51:58] necessary that they don't have the skill
[2:52:01] set and the expertise to do and they
[2:52:02] can't find it
[2:52:03] maybe they can come back and say hey
[2:52:05] what about this component of the
[2:52:07] proposal we all agree to at least do
[2:52:09] this yes and and
[2:52:11] reminder
[2:52:12] Park was built that was always meant to
[2:52:15] be a passive Park
[2:52:16] whether they would have any deals on
[2:52:18] there I don't even know if we have
[2:52:19] enough room for that quite frankly to
[2:52:21] put the fields that they're talking
[2:52:22] about or how many well we don't know
[2:52:25] that either so that's why we're going to
[2:52:26] find out and we're gonna let them do
[2:52:28] some legwork
[2:52:30] Okay so
[2:52:32] we good there you know you're marching
[2:52:35] order there okay thanks
[2:52:38] next up we have uh discuss and consider
[2:52:44] postponing internet installation at
[2:52:46] Marvin E for Parker
[2:52:52] um we thought this was going to be an
[2:52:53] easy fix unfortunately when we got the
[2:52:55] quote back uh well we we got the quote
[2:52:57] that we had
[2:52:59] ask for the five thousand dollars for
[2:53:00] but unfortunately the price it was given
[2:53:02] was per month not annually
[2:53:04] yes and it was like eight or nine
[2:53:05] hundred dollars a month
[2:53:07] um so basically it was going to be for
[2:53:11] Internet service at the park what I mean
[2:53:13] what kind of crap is that nobody pays
[2:53:16] that who pays that what we did was we
[2:53:19] went with our current vendor who's
[2:53:21] Windstream to see what they would cost
[2:53:23] well because there's no line they have
[2:53:25] to run the line out there so they
[2:53:26] basically were going to make us on
[2:53:28] roughly a twenty thousand dollar
[2:53:30] contract for five years
[2:53:34] so and and also I wanted to say maybe it
[2:53:37] was eleven thousand let's see I'm sorry
[2:53:39] it was eleven thousand per year not 20.
[2:53:41] same thing
[2:53:44] um and that was only a hundred megabytes
[2:53:46] per second
[2:53:47] so just so you know what we use here
[2:53:49] with the staff that we have we use 200
[2:53:52] per 200 millibytes per second so 100 is
[2:53:55] is basically half of the usage year
[2:54:00] additional megabytes per second were
[2:54:01] another 600 per month so we did ask
[2:54:04] Windstream how much they would charge us
[2:54:07] and it was about five thousand dollars a
[2:54:09] year
[2:54:10] that that all right so
[2:54:13] who's the internet provider that does
[2:54:15] all of the neighborhoods surrounding the
[2:54:16] park I was going to say Walter Pond has
[2:54:18] to have internet how in the world are
[2:54:21] they not connecting in there this is in
[2:54:22] Marvin across from the across the street
[2:54:24] yeah the the big huge neighborhood
[2:54:26] that's across the street where do they
[2:54:28] get their internet service from I have
[2:54:30] no clue
[2:54:32] there's got to be I mean there's service
[2:54:34] up and down that road there's too many
[2:54:36] high-end residences in that area that
[2:54:38] there's not internet service along
[2:54:40] Newtown Road that could access the park
[2:54:43] I mean
[2:54:45] this is craziness they want to run a
[2:54:48] line
[2:54:49] specifically I I if you go do we call
[2:54:52] Spectrum
[2:54:54] no we did not we did that's probably Who
[2:54:56] services it because they service
[2:54:57] everything else around here I tell you
[2:54:59] if you call Spectrum and I'm just I'm
[2:55:01] assuming okay I don't want to get too
[2:55:02] far ahead of myself but if you call
[2:55:04] Spectrum and said hey we need internet
[2:55:06] service at even Park they probably go
[2:55:08] okay we'll send the van out there Bam
[2:55:10] Bam Bam and we got internet service 50
[2:55:12] bucks a month right yeah some I think
[2:55:15] somebody's just again as we look at
[2:55:18] government and we want to our government
[2:55:20] sometimes is gets a bad rap for doing so
[2:55:23] Christina call call out there don't sell
[2:55:25] them who you are I mean tell them your
[2:55:27] name give them the address
[2:55:30] I'm gonna get I'll get my mic on it and
[2:55:33] but don't say that you're with the
[2:55:34] village of Marvin because maybe they are
[2:55:36] trying to jack it up like price wise get
[2:55:38] it is like you're a person that you've
[2:55:40] got a building out there a house okay
[2:55:43] that you want internet at or at T or
[2:55:46] Verizon yeah I was about to say they
[2:55:48] have or T-Mobile they have the wireless
[2:55:50] internet that runs off cell service now
[2:55:53] um well that's that's the other option
[2:55:54] if if we wanted to go that route and
[2:55:56] it's still most of those providers still
[2:56:00] provide anywhere from 100 to 200 Megs
[2:56:02] per second okay we'll we'll get some
[2:56:04] more options some of that stuff is but I
[2:56:05] mean if you don't have real good cell
[2:56:07] service in an area then you don't get
[2:56:08] the the good correct speed you have to
[2:56:11] look at what's the best sell provider
[2:56:12] but I guarantee you to Jamie's Point
[2:56:14] spectrum is out there they serve it this
[2:56:16] entire area before anybody else came in
[2:56:18] and I get 200 Megs on mine and I think
[2:56:22] it's 50 or 60 bucks a month for just the
[2:56:24] internet portion of my bill
[2:56:26] it's not that crazy expensive well and I
[2:56:29] don't know you know they have there's
[2:56:31] nothing out there so they literally have
[2:56:32] to run the line from the road all the
[2:56:34] way down to the barn they charge an
[2:56:36] install fee for for spectrum but and I
[2:56:39] think that's where the bulk of the
[2:56:40] charge is coming from is running that
[2:56:42] line down there yeah I mean because
[2:56:44] spectrum is run on coax that stuff is
[2:56:47] cheap and easy to lay people get run way
[2:56:50] off the road to their homes too I don't
[2:56:53] they typically don't charge crazy
[2:56:55] amounts of money
[2:56:57] it doesn't have the linear feet but I
[2:56:59] assure that's probably what the the high
[2:57:02] cost is
[2:57:04] so this is going to be a back burner
[2:57:06] item for for us just so y'all know we'll
[2:57:08] we'll get to Spectrum and start working
[2:57:09] on it but
[2:57:16] that's all that happens
[2:57:26] we're gonna we're gonna table the
[2:57:27] internet until further research is done
[2:57:30] by staff
[2:57:37] all right do we have to motion no
[2:57:40] okay discussing next up is discuss and
[2:57:42] consider entering contract with bars
[2:57:45] Recreation for construction of the new
[2:57:47] playground and all
[2:57:51] allow manager to execute the contract
[2:57:55] should I allow you to
[2:57:57] to do this this is this is massively
[2:58:00] confusing we tried to put this into a
[2:58:03] nice chart which is this that you see
[2:58:06] here not really sure what it's called in
[2:58:07] the agenda packet
[2:58:10] huh it's all in one well this is look at
[2:58:13] this document right here
[2:58:17] you want to do it you want me to do it
[2:58:20] I'll do it
[2:58:21] Okay so
[2:58:28] all right go ahead Tyler all right
[2:58:31] so this just shows the savings and like
[2:58:35] kind of the differences in the three
[2:58:37] options that we presented the three
[2:58:39] quotes we have option A is the
[2:58:41] playground with no top lot option b is
[2:58:44] no poor surface so it's a mulch bottom
[2:58:47] and then option C is the original one
[2:58:50] that we've had for a while
[2:58:53] um if you go down the list you can see
[2:58:55] this is on that chart that's what we can
[2:58:58] save ourselves by doing you know the
[2:59:00] removal the demo
[2:59:02] um when you take out the concrete when
[2:59:05] you take off the performance bond
[2:59:07] the highlighted in yellow is basically
[2:59:10] the savings and then highlighted blue is
[2:59:14] the cost for each quote
[2:59:17] um when you take into consideration all
[2:59:18] the things we've
[2:59:20] can do ourselves
[2:59:22] and at the very bottom you'll see that's
[2:59:24] our quote that we got from an outside
[2:59:26] source for concrete
[2:59:28] and that's included
[2:59:30] one thing that I'll note the things we
[2:59:33] can do ourselves are not necessarily
[2:59:34] things that we can do ourselves they're
[2:59:36] things that mayor Plano had asked to to
[2:59:38] put in that he would potentially be
[2:59:40] interested in removing
[2:59:42] so I don't feel comfortable
[2:59:45] I don't feel comfortable with us at a
[2:59:46] staff level doing these things ourselves
[2:59:48] so my recommendation is we leave the
[2:59:51] demo and the removal in but if you guys
[2:59:54] decide that that's something you all
[2:59:55] want to do
[2:59:57] we can go that route
[2:59:59] I just know that
[3:00:01] there are some additions that may end up
[3:00:05] happening if they're not removed
[3:00:07] correctly and the the ground is not
[3:00:09] regraded correctly there's very specific
[3:00:11] language
[3:00:13] who told you that it's in the contract
[3:00:16] it's in there
[3:00:17] in their proposals yes they won they
[3:00:19] want a piece of that action I guarantee
[3:00:21] you what are you going to screw up when
[3:00:23] you when you remove something you're
[3:00:26] going to really screw up the land not
[3:00:28] necessarily removal but the regrading of
[3:00:30] bringing the grade to the development
[3:00:32] from you but from that company telling
[3:00:35] us that every single option every single
[3:00:39] option has a cost to it because and
[3:00:42] they're going to create some oh you did
[3:00:44] this when you removed it how we can't do
[3:00:47] this so now it's going to cost you extra
[3:00:49] a highlight of that part of the quote
[3:00:52] just so y'all can see it for yourself
[3:00:55] and I threw in tell them what's up on
[3:00:58] top of that estimate I did throw in a
[3:01:00] ten thousand dollar just buffer penalty
[3:01:01] just in case I don't know how much it's
[3:01:04] going to be
[3:01:05] um and she doesn't even know how much
[3:01:07] it's going to be so I just threw that in
[3:01:08] as a buffer
[3:01:12] there's not a specific
[3:01:19] playground equipment having a hiring a
[3:01:23] company to come in there you could
[3:01:25] always go back to the company and say
[3:01:26] you damn
[3:01:28] it says installation of your commercial
[3:01:29] equipment completed on the prepared site
[3:01:31] with a level of within two percent grade
[3:01:34] that has a surface of compacted soil
[3:01:36] only the owner representative must be on
[3:01:39] site when it happens if the site is not
[3:01:41] prepared correctly when the install crew
[3:01:44] arrives a fee will be discussed for our
[3:01:47] crew to complete if the crew is sent
[3:01:49] away for the owner to handle the site
[3:01:50] prep a lost time and remobilization fee
[3:01:53] will occur
[3:01:54] if this Clause this Clause will be
[3:01:57] removed if demo and Grading itemized and
[3:01:59] quote it remains atypical soil
[3:02:02] situations where excessive Bedrock floor
[3:02:04] concrete Footers are encountered
[3:02:07] such that a rock hammer and heavy
[3:02:09] equipment is needed additional fee will
[3:02:11] be assessed this quote does not include
[3:02:13] permits permits or responsibility of the
[3:02:15] project and owner project owner
[3:02:20] ewf where do you see that
[3:02:25] where's that at removal and disposal of
[3:02:27] existing ewf and slight grading of main
[3:02:30] playground areas under service
[3:02:33] it's cost 18 250 dollars
[3:02:39] that's why I'm asking what is ewf
[3:02:44] the slide existing wood
[3:02:48] whatever the material frame
[3:02:51] what is it whatever the what nation
[3:02:53] Maybe
[3:02:54] they call those certain they call them
[3:02:56] playground materials stuff like weird
[3:02:59] names but it but it says removal and
[3:03:00] disposal of existing structure is 7 500
[3:03:03] then right below that it says removal
[3:03:05] and disposal of existing ewf and slight
[3:03:08] grading of main playground area includes
[3:03:11] removing all exist oh existing wood
[3:03:13] surfacing and borders to get to get the
[3:03:16] site to original Earth
[3:03:18] and grading the site slightly to assure
[3:03:21] proper grade and to help with drainage
[3:03:23] issues
[3:03:30] trying to follow all of this even as I
[3:03:32] was reading
[3:03:34] at home
[3:03:35] option b and option C the structures are
[3:03:39] identical correct nothing's changed the
[3:03:42] same thing you got the little talk yep
[3:03:44] structure Etc and the swings yes so all
[3:03:48] we're talking about is just the ground
[3:03:49] yes
[3:03:52] see because obviously both pictures look
[3:03:54] identical but all options are the same
[3:03:56] except for a also includes an additional
[3:04:00] piece for Tots on a different area
[3:04:03] so if it does not included no that's not
[3:04:06] included oh I'm sorry I'm sorry yeah no
[3:04:08] I'm just saying B and C are other state
[3:04:10] structures we're just talking about the
[3:04:13] term which I'll be honest with you like
[3:04:15] I would much rather have their
[3:04:19] sturdier hardier longer lasting surface
[3:04:22] I agree I don't want mulch yeah I don't
[3:04:24] because we're going to have to replace
[3:04:26] it all of the time it's going to be a
[3:04:28] thing and they can guarantee I assume
[3:04:30] what's what's the guarantee on this
[3:04:32] thing
[3:04:34] is there a guarantee the warranty
[3:04:36] warranty on it
[3:04:38] we asked him that before I can't
[3:04:40] remember what they said if we're going
[3:04:41] to go the extra mile
[3:04:44] um with with the turf I kind of want to
[3:04:47] see if you know two years from now being
[3:04:48] broken up with
[3:04:50] whatever rain or whatever is going to be
[3:04:52] happening
[3:04:54] um so basically so keep going sorry
[3:04:57] keep going I interrupted that was right
[3:05:05] but I think it's going to be fabulous
[3:05:07] looking
[3:05:08] I mean it's if we're going this much
[3:05:13] you know with what's going to be a
[3:05:15] spectacular centerpiece
[3:05:19] quite honestly and I totally agree with
[3:05:21] you Kim
[3:05:23] um before I left
[3:05:25] I'd want to make sure that the public
[3:05:27] would want whatever we're doing whatever
[3:05:30] they're thinking they want out at the
[3:05:32] park and spend nineteen thousand dollars
[3:05:33] for that I'd rather invest it in this
[3:05:36] mm-hmm
[3:05:39] um so as far as the the grading
[3:05:44] you know if you remove the the swing I
[3:05:47] still don't think the grade is going to
[3:05:48] be what they're looking for just just
[3:05:51] for a reference a two percent grade is
[3:05:54] what I build patios on it's almost flat
[3:05:57] it's just barely enough to shed the
[3:06:00] water so it's there's going to be
[3:06:03] grading done on this site no matter who
[3:06:06] takes the thing down yes for the
[3:06:09] installation
[3:06:12] you don't feel like saying they're going
[3:06:13] to grade
[3:06:15] they're going to have to grade it no
[3:06:16] matter what yeah but but if we take
[3:06:18] right but if we take that out
[3:06:21] it's 18 they're basically saying they're
[3:06:23] going to remove all the mulch and then
[3:06:24] grade it for eighteen thousand dollars
[3:06:26] yeah
[3:06:29] so I think that I mean we can leave that
[3:06:32] in there
[3:06:33] and they're going to grade so you
[3:06:35] removing the structure I don't think is
[3:06:37] a big deal one year warranty limited
[3:06:40] warranty 10-year limited warranty five
[3:06:42] year limited worry warranty warranties
[3:06:45] are all different like based on what the
[3:06:46] problem is yeah there's different
[3:06:48] warranties
[3:06:49] if you want the place that Joe then it's
[3:06:52] not that big of us it's 7 500 7 500
[3:06:56] bucks here's the thing sounds to me like
[3:06:59] they're going to find something wrong if
[3:07:00] we did it yeah they're going to find
[3:07:02] something wrong with whatever we do
[3:07:04] right that's one thing the other point
[3:07:07] is I don't know where y'all stand on the
[3:07:09] on the top thing
[3:07:12] when we're spending this kind of money
[3:07:17] people have all ages of kids when they
[3:07:19] go out there I I don't know about y'all
[3:07:21] but I want to talk I do too I understand
[3:07:23] yeah but there are people that go out
[3:07:27] there to have the little ones that just
[3:07:28] want to crawl around so God you know
[3:07:31] there's sometimes we pinch pennies and
[3:07:33] we and we should absolutely Pinch A
[3:07:35] Penny yeah
[3:07:37] but there but there are times where
[3:07:40] this is a long-term investment yeah
[3:07:42] absolutely for the centerpiece this is
[3:07:46] for everyone in in Marvin this this says
[3:07:50] Marvin so
[3:07:52] let's spin the the let's I'm all for it
[3:07:57] let's grade let's if they want to grade
[3:08:00] it let them grade it let them do it we
[3:08:02] can go back to them and say you didn't
[3:08:03] do it right yeah but if we do it well
[3:08:05] we're just I just I just think we're
[3:08:07] opening ourselves up to too many issues
[3:08:10] I've heard critics I think we could do
[3:08:12] it better than them but I'm just saying
[3:08:13] they're going to find something wrong
[3:08:15] with it I I as far as the top thing I've
[3:08:18] I've heard criticism from people that we
[3:08:21] don't have that available so I'm all 100
[3:08:24] in on yeah I don't think anybody I think
[3:08:27] we're all in agreement that's hot lot
[3:08:28] yeah for sure I think we're all in
[3:08:30] agreement as option C it's going to be a
[3:08:32] matter of one we gotta find the money
[3:08:34] and two do we want to let somebody else
[3:08:38] remove and dispose of the existing
[3:08:41] structure and then let them do
[3:08:44] the
[3:08:45] ewf flight grading
[3:08:48] I I think if you want to put it up for
[3:08:52] auction put it up for
[3:08:55] bid or put for someone that that wants
[3:08:58] to do it come in because there may be in
[3:09:01] a minute municipality or someone around
[3:09:03] that says I'd like to do I'd like to
[3:09:06] take it away let's let them do that and
[3:09:09] let but let them do it and maybe we make
[3:09:12] a thousand bucks off of it or 500 bucks
[3:09:15] off of it but let them come in after
[3:09:17] that's done and do the grading part yeah
[3:09:19] exactly totally agree yeah
[3:09:27] we're not in the business of of selling
[3:09:32] playground I agree I just think it's a
[3:09:36] I I agree but I mean there are times we
[3:09:39] get in with contractors and they come
[3:09:40] out and they do stuff and I'm like but
[3:09:42] you know what I can fight it for 10
[3:09:44] bucks I'm trying I'm gonna cost myself a
[3:09:47] hundred dollars worth of Sanity to save
[3:09:49] ten dollars go ahead and pay the ten
[3:09:52] dollars yeah one of the other variables
[3:09:54] I'll mention to you too is timelines if
[3:09:57] we're gonna allow someone else to do it
[3:09:59] a third party to do it
[3:10:01] um you know and they come in and say
[3:10:03] we're gonna have to give them some
[3:10:04] timelines I don't know how it's going to
[3:10:05] impact the timeline on
[3:10:08] the vendor of not the you know not being
[3:10:10] up by the certain time we just don't
[3:10:12] have to play with those timelines really
[3:10:14] really close in order to only have the
[3:10:17] Park closed and inoperable for a certain
[3:10:18] number of days
[3:10:21] I'm just throwing that out there but
[3:10:23] didn't we'll have to have a little bit
[3:10:24] of buffer in between which is basically
[3:10:25] going to take more time didn't we also
[3:10:29] consider or discuss that this would be
[3:10:32] done somewhere in the winter months
[3:10:33] where there's not enough there's not a
[3:10:35] lot of activity going on yeah okay yeah
[3:10:38] but what I'm saying is we're going to
[3:10:39] have to probably correction okay
[3:10:41] coordinate that yeah happening I
[3:10:43] understand okay
[3:10:46] the concrete I don't know that I want
[3:10:48] concrete curbing around the playground
[3:10:54] I mean isn't there a way to keep the sir
[3:10:57] I mean is does this mean it's going all
[3:10:59] the way around the surface
[3:11:01] yeah that's real yeah but don't they
[3:11:05] have that don't don't they have that
[3:11:06] hard rubber hard uh plastic I don't know
[3:11:10] what it's called
[3:11:11] foreign place
[3:11:13] it's a Concrete curving for both Maine
[3:11:17] and taut playground areas
[3:11:19] six inch wide by eight inch deep
[3:11:22] I don't know what that is I don't want a
[3:11:24] concrete Pathway to the new playground
[3:11:26] nor do I want a concrete Pathway to the
[3:11:28] top playground I think Ada purposes I
[3:11:32] think you have to
[3:11:35] why can't I why can't it can be our
[3:11:37] Trail
[3:11:39] surface which is Ada approved
[3:11:42] I'm sorry I was listening to both of
[3:11:44] y'all we're saying the same thing what
[3:11:46] was the question yeah our our Trail
[3:11:49] surface our natural Trail surface not
[3:11:51] not whatever's out here I don't know
[3:11:52] what that is but not whatever's out here
[3:11:54] but what's on like our natural Trails
[3:11:56] like out at Tullamore and stuff that's
[3:11:58] Ada approved the crushed concrete yes
[3:12:00] it's a 88 that's Ada approved and that's
[3:12:03] consistent
[3:12:05] concrete sidewalk more concrete yeah
[3:12:08] that's consistent with what we have
[3:12:11] you know our Parks development
[3:12:13] code if you will what we do so I'm with
[3:12:17] Kim I'd much rather have our natural
[3:12:19] trail system it's permeable it's more
[3:12:21] natural it's consistent with what we do
[3:12:25] um here is not our crushed concrete so I
[3:12:28] don't know why this Trail hasn't been
[3:12:30] done in our natural
[3:12:31] crushed concrete surface stuff that's
[3:12:34] like
[3:12:35] gravel
[3:12:37] [Music]
[3:12:39] well I think I think part of what's
[3:12:42] going on right there is is that they
[3:12:44] were to grind and mix that stuff that
[3:12:47] would be killing trees that are too
[3:12:49] close and high up in that area so I
[3:12:52] think they probably did a little bit of
[3:12:54] fudging there just because of that once
[3:12:56] this of course that's going to go away
[3:12:58] anyway that's going to be redone so I'm
[3:13:01] not too worried about that but for our
[3:13:02] normal system
[3:13:04] yeah I agree
[3:13:07] okay well I I would like to know what
[3:13:10] the concrete curbing is well it's in the
[3:13:12] picture
[3:13:13] it holds it all together if you look at
[3:13:16] the playground you see that at that
[3:13:17] outside edge is that concrete curbing
[3:13:19] yeah what what do we have here but like
[3:13:21] why are you having concrete curb around
[3:13:22] like a place where kids are running
[3:13:25] um I think it's structural
[3:13:28] it holds their their surface
[3:13:31] it holds their surface
[3:13:38] drain it right there's no holes in the
[3:13:42] concrete or drains in there then that's
[3:13:44] just going to fill up with water is it
[3:13:45] not if you did I mean at some point you
[3:13:49] have to you have to trust the the
[3:13:51] process I mean this is what these guys
[3:13:53] do for a living everywhere if they had
[3:13:55] problems with it being a pool then they
[3:13:58] wouldn't stay in business long so
[3:14:00] sometimes have to trust the experts she
[3:14:03] can talk how it's constructed do you
[3:14:05] want to hear from the vendor no I mean
[3:14:08] if no just take care of that
[3:14:10] okay I mean we're going to pick option C
[3:14:12] it's a matter of
[3:14:15] what are we gonna leave in what are we
[3:14:17] going to take out
[3:14:30] oh is he talking about us is he talking
[3:14:32] yeah
[3:14:36] [Laughter]
[3:14:40] I'm working on it it's a trailer frame
[3:14:42] okay
[3:14:44] I mean I don't love this price I'm not
[3:14:47] going to lie but I got a perfect place
[3:14:50] for the uh but it is
[3:14:54] you just have to play You're gonna have
[3:14:56] to fight Joe for it
[3:14:58] I'm saying I'll pull a trailer up there
[3:15:01] and as they dispose it they can take it
[3:15:03] out and they can just load it right up
[3:15:05] on the trailer and then we can auction
[3:15:06] it and if it auctions great if not I'll
[3:15:09] pay you guys 100 right now and take it
[3:15:12] out
[3:15:13] I mean it's better than yeah then they
[3:15:17] can't say we had nothing to do with it
[3:15:19] just pull a tractor trailer up there and
[3:15:22] say okay I'm gonna sit there here just
[3:15:24] load it if you're gonna get rid of it
[3:15:26] are you really getting rid of it because
[3:15:28] if they're really demoing it they're
[3:15:30] just taking a a tractor and they're
[3:15:32] knocking everything down it goes to the
[3:15:34] waste
[3:15:35] but we'll have to see how they do it all
[3:15:37] right well I'm going to make a motion to
[3:15:39] approve option C as presented
[3:15:44] oh minus the minus the concrete paths
[3:15:48] and I want those to be our natural why
[3:15:50] do we learn natural Trails I would have
[3:15:52] them remove that
[3:15:56] yep before we go further on this the
[3:16:00] price tag is another hundred and thirty
[3:16:03] some thousand what we've got
[3:16:04] appropriated
[3:16:06] how are we getting the rest of the money
[3:16:08] Christina's gonna figure it out
[3:16:10] she's she's going to work on I'm asking
[3:16:12] Christina how we're going to get the
[3:16:13] rest is going to work she's going to
[3:16:14] work on our 10-year budget deficit
[3:16:17] figure out and we'll have to do a fun
[3:16:19] balance preparation or either pull from
[3:16:20] one of your capital projects that you've
[3:16:22] got PFA pull from in reserve or you can
[3:16:24] go ahead and start pooling from that
[3:16:26] five hundred thousand dollars well four
[3:16:28] hundred thousand dollars now projects
[3:16:30] for parks that we got from the
[3:16:32] legislator that we've kind of
[3:16:33] tentatively got earmarked over here you
[3:16:35] have a finite time to spend that correct
[3:16:38] we do but they did actually extend it
[3:16:42] um but I mean it's there and it does
[3:16:44] have an expiry date so I mean
[3:16:48] it could take this over here years and
[3:16:50] years so we may want to go ahead and
[3:16:52] just start spinning that down so we
[3:16:53] could pull it from there I I have to
[3:16:55] agree with that I think that's a good
[3:16:57] good idea motions on the table well I
[3:17:01] further discussion I would just say I
[3:17:04] would be hesitant to vote on this
[3:17:07] without learning more about the
[3:17:09] concrete and what would be the
[3:17:11] replacement I did text her while you
[3:17:14] guys are talking and she said they put
[3:17:15] the concrete around just for a better
[3:17:19] finished look so she's going to look at
[3:17:21] different options
[3:17:23] and send them to me that they do have to
[3:17:25] have some type of border to hold the
[3:17:26] stuff in but there are other options she
[3:17:28] said she could use
[3:17:30] okay but we definitely want the natural
[3:17:32] Trail it's sort of like you buy a
[3:17:34] McLaren and they say it comes with curb
[3:17:36] feelers and you're not sure whether you
[3:17:38] want the curb feelers or not we're
[3:17:39] talking about the McLaren
[3:17:41] the neighbor has one so that curbing was
[3:17:45] about 12 000 okay so our biker just a
[3:17:49] question our gang member so if we're not
[3:17:53] if we're going to use our natural trail
[3:17:54] system for the pathways instead of
[3:17:56] concrete do we just omit that and have
[3:17:58] our Trail Builder build those yes
[3:18:01] okay
[3:18:04] yes that way we have consistency so why
[3:18:08] don't I need for why don't you all
[3:18:10] approve that the total amount that's
[3:18:12] listed here okay and then I can
[3:18:14] negotiate a different border within that
[3:18:16] same dollar amount or less and then
[3:18:19] negotiate the trail with our current
[3:18:21] Trail Builder or our
[3:18:26] asphalt grading guy the guy that does
[3:18:28] the all-inclusive stuff
[3:18:30] but still keep the dollar amount the
[3:18:32] same that way it gives me a level of
[3:18:33] threshold to work with
[3:18:36] concrete I want our crushed Trail yeah I
[3:18:39] mean I'll I'll tell them we have specs
[3:18:40] on that so I'll tell them either one of
[3:18:42] them all right so I'm gonna redo my
[3:18:45] motion sorry Austin
[3:18:47] I'm going to amend my motion to we're
[3:18:50] going to approve option C not to exceed
[3:18:54] 438 250 dollars
[3:18:59] 438 250.
[3:19:03] and allow Christina to negotiate the
[3:19:07] concrete
[3:19:09] curb and paths
[3:19:12] for alternates
[3:19:15] yeah
[3:19:17] further discussion
[3:19:19] all in favor
[3:19:21] aye
[3:19:23] all right next up we have consider
[3:19:25] approval a change order from first try
[3:19:27] on for geo 13. I went
[3:19:31] discussion Geo
[3:19:35] this was just going to be a few minutes
[3:19:37] ago like three hours ago in a few
[3:19:40] minutes yeah I don't know what happened
[3:19:43] um so I've added this to the your agenda
[3:19:45] packets we just got this the other day
[3:19:48] um this is the rough schedule that we've
[3:19:50] developed with a grant Sky our vendor
[3:19:53] who we're going to be working on for the
[3:19:55] education campaign at your next meeting
[3:19:58] you'll be seeing you'll be seeing the
[3:20:01] draft brand the draft logo for the
[3:20:03] campaign it's
[3:20:05] on purpose it's going to look different
[3:20:07] than our recently adopted brand to
[3:20:09] disassociate it a little bit with the
[3:20:12] village because it's more than just
[3:20:16] part of the government here
[3:20:18] um so you're gonna be seeing those logos
[3:20:19] at the next meeting and giving feedback
[3:20:21] those are going to be finalized the week
[3:20:22] after we're going to start developing
[3:20:25] Flyers frequently asked questions
[3:20:28] to go on our website
[3:20:33] and it starts ramping up as we get
[3:20:35] closer to the end of the year one change
[3:20:37] from this schedule is they have our mini
[3:20:40] site going live on December 18th we've
[3:20:43] requested that to be pushed up to
[3:20:45] December 1st to give residents more time
[3:20:48] to test additional time to educate
[3:20:51] residents through our website since that
[3:20:53] seems to be one of our best mediums to
[3:20:55] contact people so that site should be
[3:20:58] going Live December 1st instead of the
[3:20:59] 18th
[3:21:00] and really after that it's
[3:21:04] it's laid out there
[3:21:06] we'll be really ramping it up as we go
[3:21:09] into the new year in advance of the
[3:21:10] referendum
[3:21:15] one of the things that I had mentioned
[3:21:17] to Austin to make sure we're all on the
[3:21:19] same page is there's going to have
[3:21:21] there's really going to be very limited
[3:21:23] opportunity for you all to review every
[3:21:25] single little correspondence that goes
[3:21:26] out a lot of the same
[3:21:29] uh you basically we're going to see a
[3:21:31] lot of the same stuff just done in
[3:21:32] different templates and different
[3:21:33] formats councilman line is looking
[3:21:36] through a couple of different revisions
[3:21:37] that they've done in the past this this
[3:21:40] company so you can kind of see some of
[3:21:41] the graphics of how they lay things out
[3:21:43] like Austin mentioned they're going to
[3:21:45] have like a logo for back lack of better
[3:21:47] words that is specifically for this
[3:21:50] concept did you need any feedback from
[3:21:53] them on what they what elements they
[3:21:54] wanted to see in that are we going to do
[3:21:56] that later we're going to bring that low
[3:21:58] they'll see the draft logo at their next
[3:21:59] meeting they'll get one pass at it then
[3:22:01] we have to finalize it so we can get
[3:22:02] production rolling okay
[3:22:06] there will be male components yes can we
[3:22:10] in some of this education materials can
[3:22:14] we talk about
[3:22:15] like
[3:22:25] I don't know if I want to go down that
[3:22:27] road
[3:22:28] I was going to say can we talk about how
[3:22:30] like it would help
[3:22:31] some of these neighborhoods it would be
[3:22:33] a great idea to Annex in because you
[3:22:35] would we would be able to do more stuff
[3:22:37] for your neighborhoods
[3:22:39] if you and then send them to some of
[3:22:41] these neighborhoods we'd like to see
[3:22:43] annexed in I don't know if that makes
[3:22:45] sense or not I don't think that's within
[3:22:47] the current scope of the project budget
[3:22:49] wise because
[3:22:52] I think the mail the mailing budget is
[3:22:54] based on residents Target voters and
[3:22:56] residents okay so that boy if we did
[3:22:58] something like that that might be a
[3:23:00] change order or that might be something
[3:23:01] separate we do later okay are they
[3:23:04] coming to the next meeting
[3:23:06] saying is yes they should be at the next
[3:23:07] meeting so that's a question we can ask
[3:23:09] them if they can guess does that make
[3:23:10] sense like I get what you're saying but
[3:23:13] should we even think about that because
[3:23:14] I also don't want to necessarily be like
[3:23:16] oh well hey we're going to do some stuff
[3:23:18] for some non-residents I mean we're
[3:23:19] going to have to in order to do some for
[3:23:21] the residents but you you guys choosing
[3:23:24] to offer the
[3:23:27] the assessment for private roads that's
[3:23:29] going to be an incentive to get a couple
[3:23:31] neighborhoods one of the negatives yeah
[3:23:33] but those are in Marvin that's not if
[3:23:35] someone annexes they become in Marvin
[3:23:36] yeah but I don't know how many
[3:23:37] neighborhoods we have that one of the
[3:23:40] negative components that could be
[3:23:41] perceived as negative um would be that
[3:23:43] they would have to pay that additional
[3:23:45] tax and therefore right they probably
[3:23:47] wouldn't be willing to Annex if they
[3:23:49] knew
[3:23:50] the additional tax would be coming okay
[3:23:52] that's just okay
[3:23:55] so but I just wanted to make sure that
[3:23:57] y'all understood like there's going to
[3:23:58] be a very limited opportunity for us to
[3:23:59] provide input into very specific things
[3:24:02] and once things goes out like they're we
[3:24:04] can't we can't redact them like they
[3:24:07] are they coming to our regular meeting
[3:24:08] unring the Bell oh yeah yeah I need to
[3:24:12] confirm with them but that was the
[3:24:13] original plan for them to be at the next
[3:24:14] meeting
[3:24:16] what regular meeting
[3:24:19] we have to stay on schedule
[3:24:23] so as you see some of the stuff that's
[3:24:25] being passed around that's kind of the
[3:24:26] same thing that you would see in this
[3:24:28] context
[3:24:30] um us and if you could ask them if they
[3:24:32] could actually bring examples when they
[3:24:34] do come
[3:24:35] and even if there's a way they can kind
[3:24:36] of tie them into some of our stuff and
[3:24:39] that way that you guys have the
[3:24:40] opportunity to at least see what we're
[3:24:42] looking at and what's going to be fed to
[3:24:44] the public so if y'all want to start
[3:24:46] making some changes or if there's some
[3:24:48] something specific you want to see then
[3:24:49] we can make those
[3:24:51] those things at that point in time
[3:24:52] because we're not going to once we start
[3:24:53] we're just not going to have a whole lot
[3:24:55] of time to review things as we have done
[3:24:58] in the past with other things
[3:25:07] yeah all right next up consider approval
[3:25:09] change order from first try to for geo
[3:25:11] Bond advertisement
[3:25:15] at a cost not to exceed thirteen
[3:25:18] thousand dollars on Direct staff to
[3:25:19] prepare budget men so moved
[3:25:25] no I mean it's just we we're using them
[3:25:27] a lot more throughout the process than
[3:25:29] we in participate we can wrap that into
[3:25:31] the bond price and yeah we can drop it
[3:25:34] to bond price if it approved if it if
[3:25:36] it's approved if it's not we just we
[3:25:37] have to absorb it internally so we will
[3:25:40] likely do a budget amendment from
[3:25:42] contingency if contingencies available
[3:25:45] or it'll have to be a fund balance
[3:25:48] all right stop okay oh we got a there's
[3:25:50] a motion on the floor there is yes she
[3:25:53] said so moved sorry
[3:26:00] I see the looks that Austin is giving
[3:26:02] you right now it is amazing I'm very
[3:26:04] expressive today
[3:26:07] all right open topics I have one all
[3:26:10] right so before me is
[3:26:16] um House Bill 488 session law
[3:26:19] 2023-108 Jeff Perry Monroe uh read some
[3:26:23] some of the excerpts from this bill at
[3:26:26] the loom meeting and had some concerns
[3:26:28] with some of the changes that were done
[3:26:30] in this I would encourage
[3:26:32] that
[3:26:34] Council read this
[3:26:36] bill
[3:26:38] through and be familiar with some of the
[3:26:40] changes
[3:26:43] and this is already passed yes this has
[3:26:47] been passed it was passed just recently
[3:26:49] a couple weeks ago so there's there are
[3:26:52] some changes one of the one of the
[3:26:55] changes of note that I'm looking at here
[3:26:57] is to amend the residential code to
[3:27:00] include three and four family dwellings
[3:27:02] and basically this is kind of a
[3:27:07] safety issue
[3:27:11] they're not requiring greater than a two
[3:27:14] hour fire resistance and or or automatic
[3:27:17] sprinkler systems which is previously
[3:27:19] been required for three and four
[3:27:21] dwelling or three three and four
[3:27:26] family dwellings for safety reasons so
[3:27:30] I'm assuming this was something that was
[3:27:32] pushed through by the uh
[3:27:34] the Builders Association to save cost
[3:27:37] um there are a couple of things that
[3:27:39] refer to driveway paving and different
[3:27:42] things like that
[3:27:43] changing of the uh
[3:27:46] minimums for
[3:27:48] um having to get a permit for
[3:27:51] upgrading properties and such so
[3:27:55] can you repeat that house
[3:27:57] it's the house bill 488
[3:28:00] session law
[3:28:02] 2023-108 yeah
[3:28:04] say that again session law 2023-108
[3:28:09] about what 32 Pages or something like
[3:28:11] that something like that
[3:28:16] yeah I mean I just don't know how he
[3:28:18] didn't hear about this I mean this is
[3:28:20] bad it
[3:28:23] I mean it's stuff that just kind of
[3:28:25] gets sent through and
[3:28:27] this is I mean it was kind of a
[3:28:29] knee-jerk reaction because we weren't
[3:28:31] aware of it and then
[3:28:34] Jeff found out about it and brought it
[3:28:37] up at Uma there are some some concerns
[3:28:39] in there regarding
[3:28:44] update so
[3:28:47] yes and
[3:28:49] and This concerns me as well with being
[3:28:52] a republican super majority whatever the
[3:28:55] Republican party wants basically goes
[3:28:57] through
[3:28:59] um at this point because they override
[3:29:01] The veto the governor so
[3:29:05] um it is a little concerning that
[3:29:07] they're just changing some things like
[3:29:09] this
[3:29:10] we may just want to pass this along to
[3:29:12] chaplain and see what his interpretation
[3:29:13] is for the implications yeah
[3:29:16] okay I mean I think we should do that
[3:29:18] obviously we need to reach out to our
[3:29:19] reps and find out like what's going on
[3:29:21] yeah I would just say some of this stuff
[3:29:23] so I mean there are a couple things that
[3:29:25] do make sense but like that that thing
[3:29:27] to me from
[3:29:30] and this was also raised at the Wilma
[3:29:32] meeting is the safety issue when you
[3:29:34] have multiple family
[3:29:37] buildings and you start rescinding some
[3:29:40] of these safety requirements that's
[3:29:42] that's a red flag to me I don't think
[3:29:45] that that we should be getting less safe
[3:29:47] I think we should be more safe if
[3:29:50] anything so
[3:29:55] multiple multiple family dwelling
[3:29:58] multiple family dwellings right yes so
[3:30:01] these are these are triplexes and quad
[3:30:03] plexes they don't necessarily apply to
[3:30:06] Marvin at this stage because we don't
[3:30:08] have these but it's the premise I mean
[3:30:11] it's like it's they're relaxing some
[3:30:13] safety standards in the in the building
[3:30:15] codes which
[3:30:17] is troublesome that's just one example
[3:30:19] there are several different things that
[3:30:21] they change there's 32 pages of changes
[3:30:22] so developer friendly
[3:30:26] it seems to be
[3:30:28] there are some removing some standards
[3:30:32] private roads and stuff like that too so
[3:30:34] these are things that we need to
[3:30:36] consider
[3:30:37] if we're adopting
[3:30:40] you know taking on any any privately
[3:30:42] constructed driveways and such
[3:30:49] of it
[3:30:55] okay anything else
[3:30:59] [Music]
[3:31:01] I think so
[3:31:11] clean up some emails while we're away
[3:31:16] you had another one yesterday
[3:31:20] did I have another one
[3:31:21] who's that I remember
[3:31:28] radar size
[3:31:30] hmm
[3:31:32] radar signs radar oh yes
[3:31:36] um while you guys are figuring that out
[3:31:38] I have one more
[3:31:39] topic to uh to bring up
[3:31:47] okay so I have one more uh one more item
[3:31:50] to bring up Christina reminded me we had
[3:31:52] discussed this the other day
[3:31:54] it's been suggested to us
[3:31:59] by our deputies that we consider a
[3:32:02] couple more of our radar signs
[3:32:05] that for Joe Carr Road and Marvin School
[3:32:09] Road
[3:32:10] they do seem to be working for their
[3:32:13] intended purpose but there are issues
[3:32:17] with
[3:32:18] excessive speeding on both those
[3:32:21] thoroughfares and
[3:32:23] so I wanted to bring it up to you all if
[3:32:25] you thought that we should entertain
[3:32:27] looking at
[3:32:28] acquiring two more of those
[3:32:31] signs and placing them out there on
[3:32:33] those two thoroughfares
[3:32:35] um I would be
[3:32:37] open to that because we know those are
[3:32:39] two thoroughfares that are also over
[3:32:42] this high
[3:32:43] speeding but
[3:32:45] I've since then you know traveling
[3:32:48] around I've seen different signs
[3:32:51] um I don't know
[3:32:53] just curious I don't know if the one on
[3:32:56] Marvin Road
[3:32:57] is so effective it's slowing down I mean
[3:33:00] it look as people I the one that always
[3:33:04] got my attention was the one on Johnston
[3:33:06] Road as you're going into and towards
[3:33:08] Carmel
[3:33:10] but I've also seen the one that is if
[3:33:14] anybody has seen it going down
[3:33:15] independence from Matthews
[3:33:18] going down going towards Charlotte
[3:33:21] they have one that absolutely from a
[3:33:24] distance looks like blue lights from the
[3:33:26] top of a
[3:33:28] police car
[3:33:29] and when you're riding it's just I mean
[3:33:33] it's like oh my gosh and the first thing
[3:33:35] hits you is somebody's been pulled over
[3:33:37] and then the lights get your attention
[3:33:39] then it has you know what your speed is
[3:33:42] so I don't I would be open to maybe a
[3:33:45] different sign depends on the cost of
[3:33:47] course but
[3:33:49] um that's my
[3:33:52] you know opinion about it there there
[3:33:54] was also a suggestion and it may or may
[3:33:57] not be
[3:33:58] correct but Ed had also mentioned that
[3:34:01] he thought that those signs were capable
[3:34:04] of reading speeds in both directions but
[3:34:07] only displaying the one that you can see
[3:34:10] for Diagnostic purposes for law
[3:34:12] enforcement to be able to enforce
[3:34:14] I'd like to look into that as well if
[3:34:18] our signs are capable of that and if not
[3:34:20] the ones that we may purchase in the
[3:34:23] future if they may be if we can make
[3:34:26] sure that they're they're capable of
[3:34:27] doing that because there's really
[3:34:30] nothing better than having that data for
[3:34:33] our law enforcement to be able to do
[3:34:35] their job it helps them traumatically so
[3:34:38] um you're talking about
[3:34:40] you're talking about the mobile one
[3:34:42] right no the the permanent ones that are
[3:34:44] oh you're talking about the permanent
[3:34:45] ones and the the speeds if I mean if you
[3:34:48] if you compare those speeds
[3:34:52] um maximum speeds and and the amount of
[3:34:55] speeding from when we first installed
[3:34:58] those to what we're getting now
[3:35:00] the maximum speeds have dropped by 20
[3:35:02] miles per hour
[3:35:04] because we were seeing 109 100 and
[3:35:07] whatever now we're down to 85 for Max
[3:35:09] speeds so they are I think they're
[3:35:12] walking I think they're like
[3:35:15] because they've been consistently going
[3:35:17] down so I I could tell you that
[3:35:19] listening to constituents that
[3:35:23] speed trap that they set up on Newtown
[3:35:26] Road
[3:35:27] uh two weeks ago three weeks ago that
[3:35:30] had all the deputies out there got
[3:35:33] everybody's attention everybody thought
[3:35:35] what the heck and I I heard from a lot
[3:35:39] of people like you know obviously Union
[3:35:40] counties wanted to pad their their uh
[3:35:43] sheriff department wants to pad their
[3:35:45] pockets and all this kind of stuff what
[3:35:47] kind of Sting was this but it got
[3:35:48] everybody's attention yeah I heard a lot
[3:35:51] of animals think I don't know if it's
[3:35:52] substitute
[3:35:54] you know also I don't mind us being a
[3:35:56] speed trap
[3:35:58] I'd rather see something instead of
[3:36:00] something permanent you know we have
[3:36:02] enough sign pollution as there is I'll
[3:36:04] call it sign pollution especially in a
[3:36:06] rural area
[3:36:11] um so I would rather get something that
[3:36:13] if we start to see problems we drag out
[3:36:17] a mobile sign and park it and it stays
[3:36:20] at the E for Park and we have one well
[3:36:25] then if we have one
[3:36:29] it gets moved around but one the thing
[3:36:32] about it is it's not it's not there all
[3:36:34] the time and my point is is that the
[3:36:36] ones that are permanent are actually
[3:36:38] making an impact because people's
[3:36:40] they're they're recording it that's what
[3:36:42] is in your packet every month when they
[3:36:44] do the deputies report and the the
[3:36:46] speeds have come down
[3:36:47] the max speeds have come down the
[3:36:50] average speeds have come down so it
[3:36:52] seems to me that they're making an
[3:36:54] impact and especially Joe Carr Road and
[3:36:57] if you talk to our deputies they write
[3:36:59] more tickets on Joe Carter Road than
[3:37:00] anywhere else in the village
[3:37:02] so I think that
[3:37:06] um you know I think it's worth
[3:37:08] considering I think uh you know
[3:37:13] I'm not sure how much we spent on those
[3:37:16] and I'm not sure how much they are now
[3:37:19] but they do seem to be making an impact
[3:37:22] so we can add it to the agenda I think
[3:37:26] and for actual discussion but uh in the
[3:37:29] purpose of time I think
[3:37:31] we'll just note that and yeah that's
[3:37:32] right possibly just wanted to bring it
[3:37:34] up anything else
[3:37:35] um no not for open topics but I need to
[3:37:37] go back to item number 12.
[3:37:40] right which is allowed
[3:37:42] can you do that okay so I need to add I
[3:37:47] need to make an additional motion sorry
[3:37:48] I missed it this is back back to the
[3:37:51] playground playground yeah so I need to
[3:37:53] make a motion to authorize the manager
[3:37:55] to execute the agreement I didn't do
[3:37:58] that sorry
[3:37:59] oh that would be important that'd be
[3:38:01] important
[3:38:04] all in favor I know I'm thinking of
[3:38:07] further discussion because I
[3:38:09] but I'm not going to go down that road
[3:38:12] um I've said my piece I'm so pissed
[3:38:15] um were you pissed about that they're
[3:38:18] they're playing this game where okay we
[3:38:20] can figure that out later I don't know
[3:38:22] if you can't you agree with us but
[3:38:28] agreed to the amount of money Christina
[3:38:30] can still work on the negotiations yeah
[3:38:33] we haven't spent the money yet okay
[3:38:36] um we're going back to where you lost
[3:38:44] all right uh your list is in there as
[3:38:47] usual actually it's not nothing in there
[3:38:50] it's actually not I apologize I must
[3:38:52] have forgot to attach it
[3:38:53] um I will pull it up we got nothing
[3:38:56] I'm slack you put it up on the screen
[3:39:00] we stopped communicating
[3:39:02] um I'll pull it up on my screen here
[3:39:06] um sorry
[3:39:14] [Laughter]
[3:39:20] I'm pulling up on the screen
[3:39:23] there it is all right okay so
[3:39:26] um the Geo Bond stuff is separate we
[3:39:29] have continual
[3:39:31] we have continual reminders going out
[3:39:33] about the roundabout and road closure
[3:39:35] we're advertising the bulk drop-off
[3:39:37] event pretty much every week now the
[3:39:40] candidate questionnaire interviews town
[3:39:42] hall meeting promotions are starting
[3:39:44] trick or treat promotions are starting
[3:39:46] and then you have all the normal things
[3:39:48] such as your meeting notices school
[3:39:50] closures coffee with counsel wuma Labor
[3:39:54] Day trash delays associated with Labor
[3:40:00] that's pretty much all I got
[3:40:04] stable can we add something to send out
[3:40:06] to the residents and hopefully maybe the
[3:40:08] residents will send it out to their
[3:40:10] friends and post it on social media
[3:40:17] please not drive through the roundabout
[3:40:21] that is under construction because it
[3:40:23] will cause delays
[3:40:25] and the village will be on the hook for
[3:40:27] those delays and overruns because that's
[3:40:29] not their fault
[3:40:31] it's not the contractor's fault if they
[3:40:33] have to go in and fix stuff so that's
[3:40:36] going to be on us
[3:40:37] and there's a huge fine for it yeah it's
[3:40:42] misdemeanor to go
[3:40:43] be so
[3:40:47] so if we if we can post that and just
[3:40:51] reiterate somebody ran yeah they went
[3:40:54] through it a couple days ago right
[3:40:56] Christina
[3:40:58] you watch somebody move the working
[3:41:00] there no no After Hours night you should
[3:41:03] see and I'm letting everybody in the
[3:41:05] public know about this really seriously
[3:41:07] you're going down I've been outside
[3:41:10] you're going 55 miles an hour down
[3:41:12] Marvin Road straight into those
[3:41:13] barricades
[3:41:14] and I've seen people like you totally
[3:41:16] ignore whatever's being said and I know
[3:41:19] it's not Marvin can you know residence
[3:41:21] per se
[3:41:22] but I I've witnessed it and it's like I
[3:41:26] don't know what you're thinking and then
[3:41:27] you get to the end and you're hitting
[3:41:28] the brakes and you're going through The
[3:41:30] Preserve to turn around or you go into
[3:41:31] Innisbrook
[3:41:33] um to try to turn around or try to find
[3:41:35] an outlet
[3:41:38] you know it's a 500 fine because I have
[3:41:40] seen people now move I have seen people
[3:41:42] move the barricades and move behind I
[3:41:44] don't know even know what's behind there
[3:41:45] I don't even know if it's drivable
[3:41:47] I just wanted to say that
[3:41:52] I will make that
[3:42:00] okay moving on coffee with Council
[3:42:02] debrief do you want us to still see this
[3:42:04] oh sorry I'm typing my minutes in front
[3:42:07] of you that's okay how embarrassing
[3:42:11] coffee with Council debrief
[3:42:13] um go ahead Joan Jamie well we had a
[3:42:18] surprise visitor and Kim was there so we
[3:42:20] had three of us
[3:42:24] and we had probably the biggest group to
[3:42:28] date for coffee with Council
[3:42:30] started with just one or actually
[3:42:33] representing the church two
[3:42:35] representatives from the church and a
[3:42:38] representative from zepsa and probably
[3:42:45] 10 or 12
[3:42:47] 2015 maybe 15 residents
[3:42:52] president
[3:42:56] but you know we have dialogue going
[3:42:58] which I thought was good and
[3:43:02] some things were unfortunately it's
[3:43:07] again given we had clarify things that
[3:43:09] they were giving wrong
[3:43:11] nation and public hearing that we
[3:43:14] 've got the deviations
[3:43:15] and one gentleman sent me information on
[3:43:26] but I think it was good conversation
[3:43:30] probably most likely not going to be
[3:43:32] happy with what has happened I will say
[3:43:35] that one individual who is affected
[3:43:38] directly and abuts to the property I had
[3:43:41] a phone call with and
[3:43:43] he was aware of what was potentially
[3:43:45] going to happen here and
[3:43:48] expecting it
[3:43:50] this quickly so um but he was aware
[3:43:53] which I think when you as you know Kim
[3:43:56] in real estate it's buyer beware you got
[3:43:59] to know where you're buying and what's
[3:44:01] going to potentially be happening and
[3:44:02] this was talked about well before me and
[3:44:05] is supported by the greater good which
[3:44:10] probably one of the reasons this
[3:44:14] today in our
[3:44:16] but
[3:44:18] other than that was there another coffee
[3:44:21] with Council that someone was at the two
[3:44:23] weeks
[3:44:24] that was discussed at the previous
[3:44:25] meeting okay all right
[3:44:27] but that's all I had is that fair yeah
[3:44:29] that's right the only thing I would say
[3:44:32] is that with coffee with Council we
[3:44:34] appreciate everyone coming in
[3:44:37] and we do listen to everything that you
[3:44:39] say we take all those things in
[3:44:40] consideration and whether you believe it
[3:44:43] or not and I hope hopefully that you do
[3:44:45] and and you'll respect that we do take
[3:44:47] these issues and concerns back to the
[3:44:51] developer or or any instance that that
[3:44:53] someone comes in and has a concern or
[3:44:55] something like that to try to make it
[3:44:58] where it works for both sides and
[3:45:00] there's a win-win on both sides and I
[3:45:03] can tell you from the time that we had
[3:45:05] coffee with council Tuesday night till
[3:45:08] now changes have changes were made
[3:45:12] um that we presented to the developer
[3:45:14] and those changes were made so to think
[3:45:16] that we're we don't listen and we don't
[3:45:19] consider those or take those with with
[3:45:23] with respect we do and um
[3:45:26] you know anyone that that came the other
[3:45:29] night that that has questions about what
[3:45:31] were those changes you know certainly
[3:45:32] reach out to either uh the mayor or
[3:45:35] myself and I've told them then I said
[3:45:38] you've got my phone number please reach
[3:45:40] out to me and we'll sort of discuss them
[3:45:42] but uh listen it was great for me it was
[3:45:45] great to have that many people show up
[3:45:46] and I hope that we continue to have
[3:45:48] people show up and voice their concerns
[3:45:51] but also voice their their
[3:45:54] um the other side of it saying you know
[3:45:57] I'm you know I'm all for something an
[3:46:01] appreciation for what you are doing and
[3:46:03] as opposed to always just being you know
[3:46:06] getting hammered on what we
[3:46:08] you know what people think that we're
[3:46:10] doing I'll have another comment about
[3:46:11] that later in Council comments
[3:46:16] [Music]
[3:46:23] I would like I appreciate people showing
[3:46:26] up I would like to reiterate that their
[3:46:30] work ate coffee with Council
[3:46:32] opportunities between the first Pim
[3:46:36] and
[3:46:37] the public hearing and we didn't have
[3:46:40] anybody show up
[3:46:43] to discuss this project
[3:46:46] and
[3:46:47] if we are to make
[3:46:51] thoughtful
[3:46:53] recommendations
[3:46:54] request to the to the developers we have
[3:46:58] to have that information
[3:47:00] before two days or a day or the day of
[3:47:04] public hearings or when we're going to
[3:47:07] vote on something
[3:47:09] so I would encourage
[3:47:11] anyone who's listening to please be
[3:47:14] informed know what is happening around
[3:47:16] you
[3:47:18] because it is very frustrating and
[3:47:21] difficult for us as Council as we're
[3:47:24] making these decisions we're like great
[3:47:26] nobody's showing up everybody's happy
[3:47:27] with it no problem moving right along we
[3:47:30] love it we think it's great planning
[3:47:31] board loves it they think it's great and
[3:47:33] then all of a sudden we have a very
[3:47:36] large contingent of a neighborhood that
[3:47:39] shows up that are not in favor of it and
[3:47:41] it's
[3:47:42] basically we were blindsided by it so I
[3:47:45] would I would request that people show
[3:47:48] up earlier and be informed and don't
[3:47:51] wait until the bulldozer is in your
[3:47:53] backyard
[3:47:55] last comment from coffee with Council
[3:47:59] I was truly offended
[3:48:05] one gentleman's remarks that we are
[3:48:08] absolutely 100 percent getting bribed in
[3:48:11] this process
[3:48:12] it was uncalled for
[3:48:15] it was called and he said it to me
[3:48:19] called my character into judgment called
[3:48:22] all of this entire council's character
[3:48:25] into judgment
[3:48:26] and it is false and I don't appreciate
[3:48:31] it if you think that you know something
[3:48:34] and you want to say it you show me facts
[3:48:37] otherwise keep your mouth shut because
[3:48:40] it is
[3:48:42] disrespectful and rude and I will not
[3:48:46] stand for that period And I told him
[3:48:49] that
[3:48:57] it's unfortunate that had you go down
[3:48:59] that road but it was after we moved out
[3:49:02] of the building and we were trying to
[3:49:04] continue the conversation from
[3:49:06] civil standpoint but anyways uh thank
[3:49:09] those for all coming out and sharing
[3:49:11] their comments reports and updates
[3:49:14] uh managers report
[3:49:18] again nothing
[3:49:20] planners
[3:49:23] uh the only thing that I want to
[3:49:25] update you guys on is the uh Udo project
[3:49:29] we are getting into the meat of that I
[3:49:32] would either either encourage counsel at
[3:49:36] the upcoming September 19th meeting to
[3:49:38] either attend and just listen because we
[3:49:41] are kind of getting into the direct like
[3:49:42] regulations of zoning districts
[3:49:45] permitted uses setback I mean all that
[3:49:47] stuff and I think it's kind of important
[3:49:49] for
[3:49:50] Council to be aware to go ahead and
[3:49:53] potentially provide feedback we can
[3:49:55] either do
[3:49:56] um a joint meeting or you guys can come
[3:50:00] and we can just do a potential Quorum
[3:50:01] notice you just participate as you know
[3:50:04] residents of Marvin
[3:50:06] um so just listen I can get you guys
[3:50:07] binders and then any comments notes
[3:50:10] questions stuff you guys have just write
[3:50:11] them down let me know because the goal
[3:50:13] of this is where planning board doesn't
[3:50:15] go One Direction and gets in front of
[3:50:17] council you know early next year for
[3:50:19] adoption and it's completely different
[3:50:22] visions that you guys have from planning
[3:50:24] board I don't think that's necessarily
[3:50:25] going to be the case
[3:50:26] but uh the more that you guys are
[3:50:28] involved in this project and kind of
[3:50:30] aware now
[3:50:31] um the better will be and the quicker we
[3:50:33] can get this thing adopted it is going
[3:50:35] great planning boards really really
[3:50:39] group you know grasping this concept and
[3:50:41] loving this process and uh
[3:50:44] so I just wanted to mention that
[3:50:46] is there
[3:50:47] um is you know I obviously couldn't make
[3:50:51] the last playing board meeting but I
[3:50:53] know that the planning board meeting is
[3:50:55] hopping all over the calendar and there
[3:50:59] was supposed to be the training meeting
[3:51:01] and then the planning board are we
[3:51:03] containing it just to the one planning
[3:51:04] board meeting yes so moving forward
[3:51:06] right now
[3:51:08] um they're back down to just one meeting
[3:51:10] a month just because when we started
[3:51:12] this process we did we were working on
[3:51:14] those revisions for the form-based code
[3:51:15] and then we got the rezoning so we did
[3:51:17] have a lot on our plates that's why we
[3:51:18] broke it up in the two meetings but
[3:51:19] right now we don't have any any other
[3:51:23] type of submittals I have to go through
[3:51:25] review and it just kind of as if
[3:51:28] something is submitted then we'll have
[3:51:29] to make that determination if we need to
[3:51:30] schedule an additional meeting
[3:51:32] um but or sorry recess the meeting uh
[3:51:36] but these meetings last anywhere from an
[3:51:38] hour and a half two hours it is the only
[3:51:40] thing on the September agenda uh
[3:51:42] and you like I said you can watch online
[3:51:44] you can watch the recordings but I will
[3:51:47] go ahead and get your guys binders done
[3:51:49] next week
[3:51:50] uh up to date with all the language and
[3:51:53] um if you want to meet about it be happy
[3:51:55] to to kind of also get you guys up to
[3:51:57] speed but uh like I said I do encourage
[3:52:00] you guys to come and attend or watch
[3:52:02] online or watch the recordings
[3:52:07] other than that that is all I have
[3:52:09] unless Council has any questions on
[3:52:11] anything
[3:52:13] thank you Hunter
[3:52:14] Yvette planning report updating
[3:52:18] rules and regulations for the barbecue
[3:52:21] and Brews event yeah so real quick
[3:52:24] barbecue and Brews
[3:52:27] we'll do it ether Park I'm recommending
[3:52:30] November 18th I know we hadn't really
[3:52:32] set a date
[3:52:35] quite yet but November 18th from three
[3:52:38] to five in the afternoon
[3:52:41] the rules are pretty much just talk
[3:52:44] about
[3:52:46] we'll pick up the meat here on Friday
[3:52:48] the 17th
[3:52:50] um everybody it talks about everybody's
[3:52:51] gonna have a 20 by 20 space out of the
[3:52:53] park
[3:52:54] for smoking there may gates are going to
[3:52:56] open
[3:52:57] to the cookers at five o'clock Friday
[3:53:01] night and will be open for you to come
[3:53:05] and go all throughout the park as needed
[3:53:07] all night
[3:53:10] and then basically we just talk about
[3:53:15] you got the council is right now plan to
[3:53:18] be the judges for the event we're gonna
[3:53:20] have three types of meat Boston butt
[3:53:24] ribs and chicken again that's subject to
[3:53:27] change depending on how many people we
[3:53:30] have sign up to cook be kind of might
[3:53:34] vary how much meat we give each person
[3:53:36] to cook but
[3:53:39] any questions about barbecue and Brews
[3:53:42] can we call it Brews and Q
[3:53:45] that's actually cute it is yeah
[3:53:50] we can look into it okay cool hey I just
[3:53:53] wanted to mention real quick we um Tyler
[3:53:55] and I've been working on these little
[3:53:56] templates for events I don't know if you
[3:53:58] see this this is how all the event
[3:54:00] updates will come to you in your agenda
[3:54:02] packets from here forward so you can go
[3:54:04] ahead and review kind of what's there
[3:54:07] what the anticipated budget is in case
[3:54:09] you see anything that just doesn't jive
[3:54:10] with what you're thinking this is kind
[3:54:13] of where we would go ahead and make
[3:54:14] decisions for you and if you don't agree
[3:54:16] with it we would expect you to say it at
[3:54:18] the time
[3:54:19] of the the you know the event
[3:54:22] log when it first comes out for example
[3:54:24] if you look on to the
[3:54:27] one-man acoustic set for entertainment
[3:54:30] we're going to try to put little notes
[3:54:31] in there
[3:54:33] otherwise if y'all don't say anything
[3:54:35] about it we just assume that it's okay
[3:54:36] and we'll go ahead and go through with
[3:54:38] those types of small detail unless
[3:54:41] anything said by the date specified
[3:54:45] so just make sure you're keeping a good
[3:54:46] eye on these components because it's you
[3:54:49] know so we're not getting down into the
[3:54:50] weeds of every single little detail and
[3:54:52] every little event we're going to go
[3:54:53] ahead and just start planning things as
[3:54:54] we think that they should be unless
[3:54:56] y'all tell us otherwise by a certain
[3:54:58] date that we establish
[3:55:07] certainly hope that we have more than 75
[3:55:09] people show up for this which I'm sure
[3:55:11] that's a conservative number that you
[3:55:12] want to
[3:55:13] do you have a contingency for
[3:55:17] if we do have say 200 people show up
[3:55:20] for extra time allotment so those types
[3:55:24] of things I say I know you said three to
[3:55:25] five it's a little early in the
[3:55:27] afternoon but I understand with the
[3:55:30] cooking and all that stuff are as their
[3:55:32] Provisions for it to run longer if
[3:55:35] there's big attendance that kind of
[3:55:37] thing so basically it's got to be less
[3:55:39] than three hours
[3:55:41] um because of
[3:55:43] serving food and not having them
[3:55:46] actually have a sanitation grade and the
[3:55:49] environmental health this is based on
[3:55:50] their form that I had to fill out so
[3:55:51] it's got to be less than three hours if
[3:55:53] we're not going to have them actually
[3:55:54] sell plates of food or them come out and
[3:55:58] check everybody and make sure they have
[3:56:00] all the sanitation grade and all that so
[3:56:03] but
[3:56:06] well can we if it's three hours can we
[3:56:09] just extend it to six
[3:56:10] like from three to six yeah I think that
[3:56:13] would be is it just because I I mean I
[3:56:15] know it's going to be getting dark
[3:56:16] earlier so I know that's why we didn't
[3:56:19] push it later but can we just do yeah
[3:56:22] like that if there are a lot of people
[3:56:23] there squeezing it into two hours could
[3:56:26] be logistically a little bit of a
[3:56:28] headaches and and they will be serving
[3:56:30] it to the people right yeah but it's
[3:56:32] because they're serving samples as
[3:56:34] opposed to plates
[3:56:37] and they're paying their ten dollars
[3:56:38] they're going to get some right you'll
[3:56:40] have like a wristband cues I don't know
[3:56:43] oh I don't know and we're and we're
[3:56:45] going to have bring your own beer okay
[3:56:47] this year just so we can kind of like
[3:56:48] compile the numbers for next year and we
[3:56:50] can or whatever it'll be an easier sale
[3:56:52] to distilleries and breweries and say
[3:56:54] like look here we had 200 people here
[3:56:55] like this is somewhere you want to set
[3:56:57] up okay
[3:56:58] okay so just one thing to note from what
[3:57:01] I have been told and I can't
[3:57:03] substantiate this but it was rumor that
[3:57:05] I've been told that when this new thing
[3:57:10] goes in Valentine that
[3:57:14] OMB is going to be moving their main
[3:57:19] place to the Valentine area from Uptown
[3:57:21] because of space constraints and such so
[3:57:26] just keeping that in mind if they're
[3:57:28] going to be right here around the corner
[3:57:30] you know for some of our events and such
[3:57:33] they uh I hope they did well the last
[3:57:35] time they were here but I didn't get any
[3:57:38] feedback on that but I thought they did
[3:57:40] I certainly spent some money with them
[3:57:49] are you guys okay with the one-man
[3:57:51] acoustic so we don't have to wait until
[3:57:52] the September deadline
[3:57:55] everybody good with that yeah
[3:57:58] does it
[3:58:05] let me get a little more than the same I
[3:58:08] might get a sample and a half I will
[3:58:10] mention too this was a this was a an
[3:58:12] event that wasn't budgeted for so even
[3:58:13] though we're bringing in Revenue we
[3:58:14] still have to go back and do a amendment
[3:58:17] to bring it in and spend it back out
[3:58:19] FYI
[3:58:30] [Laughter]
[3:58:33] you're so full of ideas Joe more
[3:58:36] questions about barbecue Brews all right
[3:58:40] Brews and cues sorry everybody
[3:58:43] all right
[3:58:45] questions on that update on Marvin
[3:58:48] so Marvin day we've booked a band
[3:58:50] Breakfast Club they'll be there as you
[3:58:53] know we've condensed the day from four
[3:58:55] to nine thirty ish however long band
[3:58:59] will stop at 9 15. fireworks will follow
[3:59:01] directly so then however long the
[3:59:02] fireworks go we'll have three food
[3:59:06] trucks
[3:59:07] um and and then a
[3:59:10] dessert sweets truck will be there
[3:59:16] Let's see we have our DJ we have our
[3:59:18] face paint hair tinsels magic show he's
[3:59:22] going to be there and he's actually
[3:59:24] going to broadcast and like we're going
[3:59:26] to say that there is a magic show at say
[3:59:29] 5 30. I'm working on the details with
[3:59:31] him right now but he will be like
[3:59:33] putting on like a 30-minute show
[3:59:37] um as opposed and doing the balloon
[3:59:38] animals and everything
[3:59:44] it's pretty much it right now we're only
[3:59:46] going to come from Marvin Ridge High
[3:59:48] School we that's where we're going to
[3:59:49] shuttle back and forth from just one
[3:59:51] location
[3:59:52] we have the parking lot
[3:59:54] um we'll have disc golf again fireworks
[3:59:57] quotes coming in right now I basically
[3:59:59] asked him for the same show as last year
[4:00:01] because I think everybody liked that one
[4:00:06] pretty much all I got
[4:00:15] a regular venue of how we get messages
[4:00:18] now but targeting all the schools
[4:00:21] whether it's an announcement in the
[4:00:23] morning to some sort of
[4:00:26] way that they have
[4:00:28] banners they put up as people were
[4:00:31] driving cars into maybe we can get
[4:00:33] permission to put signs up as we drive
[4:00:36] into the
[4:00:37] things they're dropping off their kids a
[4:00:39] reminder as it gets closer to that date
[4:00:41] or maybe a month out I'm sure in
[4:00:44] exchange for what we do for them
[4:00:47] and do that and like yeah but that that
[4:00:51] would be key and uh
[4:00:56] breastfeed that one that I had
[4:01:00] this one
[4:01:03] that's all
[4:01:05] everybody good on Marvin day
[4:01:08] 20 000 estimated cost Thirty
[4:01:12] Thirty sorry Thirty I said 20. yeah that
[4:01:15] might I might not have changed that
[4:01:17] number at the bottom but it is 30.
[4:01:20] whatever
[4:01:24] mom's on the move I think yeah so that's
[4:01:27] the first day of this is going to be
[4:01:29] because the 26th of September is going
[4:01:33] to go on the next newsletter we're going
[4:01:34] to start them the first couple are going
[4:01:36] to be here just so we can get a gauge
[4:01:37] they're going to walk The Preserve Trail
[4:01:39] just to get a gauge on who else coming
[4:01:40] first day probably see if I can't go to
[4:01:43] Dunkin and get like a
[4:01:44] some coffee and some donuts or something
[4:01:46] to kind of do a little welcoming thing
[4:01:49] we're going to do it at nine o'clock
[4:01:53] see how that works I don't know like
[4:01:55] when it gets into the winter if people
[4:01:56] think it's too cold we can bump it up to
[4:01:58] 10 or 11.
[4:02:01] but other than that it'll it'll always
[4:02:03] be in like a rotation we'll send out the
[4:02:04] routes every in every newsletter for the
[4:02:07] upcoming two to three weeks and it'll
[4:02:09] just change weekly
[4:02:13] I think at nine A.M
[4:02:23] where we could put up there as they come
[4:02:25] in and say oh sign up
[4:02:28] put their emails they're willing to
[4:02:30] share their email and then drop it not
[4:02:32] that you would expose it to everybody
[4:02:34] but
[4:02:35] the tear off sheets
[4:02:37] I was about to say we have QR codes that
[4:02:39] bring you straight to the website out
[4:02:41] there on the signs
[4:02:47] right
[4:02:48] there you go yeah that's yeah
[4:02:51] Joe
[4:02:53] you're free just do it in today's
[4:02:56] technology and not
[4:03:01] [Laughter]
[4:03:14] yeah you're a mom and you're moving
[4:03:15] right so I guess you fit the bill maybe
[4:03:17] baby
[4:03:23] Marvin babysitting with the mayor Pro
[4:03:25] Tem
[4:03:36] [Laughter]
[4:03:39] all right
[4:03:41] um review of action items
[4:03:45] all right well I've already reserved
[4:03:47] I've already RSV paid for Jamie for that
[4:03:49] Leadership Summit so you're good there
[4:03:52] um Christina's going to get an
[4:03:53] additional quote from Specter for
[4:03:56] internet at the park uh we're gonna have
[4:03:58] Granite Sky bring some examples
[4:04:05] hey everybody everybody Under the Sun
[4:04:08] everybody
[4:04:11] um Granite sky is going to bring
[4:04:12] examples to our next meeting for uh for
[4:04:14] some of their marketing materials
[4:04:24] what's up
[4:04:27] I will be sending out an additional
[4:04:28] communication warning people not to
[4:04:30] drive through the barricades
[4:04:32] and
[4:04:34] scary scary letter fine prosecutor you
[4:04:38] will be prosecuted you know in charge of
[4:04:40] the misdemeanor turn around don't drown
[4:04:44] so I I'll figure something out but
[4:04:47] catchy free
[4:04:55] there you go
[4:04:58] I'll take let's go take a picture of the
[4:04:59] barricades Joe
[4:05:07] we can work on an exploratory committee
[4:05:09] for the multi-purpose Fields that's all
[4:05:11] I got
[4:05:12] the thing I'm sure we have a couple
[4:05:13] agreements to execute in there as well
[4:05:15] review mayor Pro Kim did I at least
[4:05:19] attach this one
[4:05:21] okay I'm opening it
[4:05:25] um we have not heard back they've asked
[4:05:28] for some additional they asked
[4:05:29] additional questions a while back we
[4:05:30] wrote them up a very nice detailed
[4:05:32] response including information on the
[4:05:33] Geo Bond and we have not heard back
[4:05:35] since
[4:05:36] but we can't
[4:05:40] huh
[4:05:41] oh no one ever gives me their phone
[4:05:43] number it's always email
[4:05:49] if you want to do that you can
[4:05:53] speaking of which Christina
[4:05:57] let's talk after Christina speaking of
[4:06:00] that I should have a contact information
[4:06:02] for the HOA president for PDS tomorrow
[4:06:07] what
[4:06:08] um anything else oh yeah
[4:06:13] Mark Brody about
[4:06:16] annexation
[4:06:19] are they going to yes
[4:06:26] oh that's September
[4:06:39] Tyler are you finished talking to Union
[4:06:40] County about their facilities
[4:06:53] thank you okay so we can complete that
[4:06:57] one
[4:07:00] are we going to play more
[4:07:07] Regional stormwater study that's on hold
[4:07:10] air rifle agreement
[4:07:18] we'll finish all of your projects to
[4:07:20] Village Hall well it's interesting that
[4:07:21] you bring this up we actually have some
[4:07:24] movement on the paver situation Matt
[4:07:28] came to me yesterday and said he has
[4:07:30] gotten the engraver working he was
[4:07:33] looking for some software which I helped
[4:07:36] him with I got to follow up with him but
[4:07:38] if everything is working correctly I'm
[4:07:40] going to go ahead and put the sand in
[4:07:41] because we can actually sit it on and do
[4:07:43] the engraving there he's just working on
[4:07:45] some of the Kinks so I'm going to go
[4:07:47] ahead and schedule that to get finished
[4:07:51] well it's progress
[4:07:54] [Laughter]
[4:08:03] meeting
[4:08:06] laughs
[4:08:14] next meeting that's a no
[4:08:28] you gotta check off Thompson
[4:08:32] that's been done that's done
[4:08:34] execute agreement
[4:08:37] that's done
[4:08:39] you want to check off Tom Short Road
[4:08:46] oh yeah we did that yesterday that's big
[4:08:56] officially it's not done until the
[4:08:58] contract son but we're done yeah but
[4:08:59] we're done negotiating
[4:09:02] okay
[4:09:04] thank you
[4:09:07] just uh to go back on the last
[4:09:11] thing you sent out on email about a
[4:09:14] delay again here no delays okay I
[4:09:18] thought I saw something completion
[4:09:21] yeah middle of October hopefully
[4:09:24] all right Council comments let's go
[4:09:27] first Andy
[4:09:32] really have anything other than the
[4:09:34] normal uh
[4:09:36] stuff and it's not that it's normal but
[4:09:39] it is normal because you guys do such a
[4:09:41] good job it is normal to praise you for
[4:09:43] what you guys do so thank you for
[4:09:46] everything that
[4:09:47] everybody here including Council does
[4:09:50] uh thank you to our deputies for all
[4:09:53] they do I know they work hard they
[4:09:55] have a lot of obstacles to deal with on
[4:09:58] a regular basis
[4:10:00] so that's all I have thank you
[4:10:05] I would reiterate what uh councilman
[4:10:09] Wortman has said in the fact that I I've
[4:10:12] personally enjoyed
[4:10:16] the issues and situations that have been
[4:10:19] posed to the council
[4:10:21] and for the public out there we all have
[4:10:24] our different opinions we all have our
[4:10:26] different personalities but it's great
[4:10:28] to see a team that works together that
[4:10:30] works out issues together for the common
[4:10:33] good so I I want to give a thanks to the
[4:10:36] council and as of course well as the
[4:10:39] staff so thank you
[4:10:42] okay
[4:10:44] a couple things
[4:10:46] um one is I had someone come up to me
[4:10:48] that said
[4:10:50] made a claim and I'm not saying it's
[4:10:51] true or not but made a claim that one of
[4:10:54] the the when they were going by to pick
[4:10:56] up trash
[4:10:57] that the guy got off the truck
[4:10:59] and was by or near his yard and was
[4:11:03] peeing
[4:11:05] made the claim I'm not saying it's true
[4:11:08] I'm just saying they made the claim to
[4:11:13] was I I don't know if they filed a
[4:11:16] complaint with with the sheriff's
[4:11:17] department and
[4:11:19] if they followed up on that but that
[4:11:21] that's just a claim can you give me the
[4:11:24] address off the Record and I can follow
[4:11:25] up because they they do have cameras
[4:11:27] I'll do my best it was right here
[4:11:30] we'll talk after yeah
[4:11:33] there is a tree on the trail down
[4:11:41] the tree on the trail has been removed
[4:11:42] but the tree that's in there
[4:11:43] right-of-way is not ours so that's what
[4:11:45] I'm
[4:11:46] we won't touch that with the tree on the
[4:11:49] trail has been removed okay so but who's
[4:11:52] going to remove the rest of it is that
[4:11:54] dot dot
[4:11:56] and and Dot should do it because it is
[4:11:59] blocking up the um the the Gully
[4:12:03] the ditch
[4:12:04] the pitch in the ditch the pitch of the
[4:12:07] ditch we can report a concern to on dot
[4:12:09] yeah that'd be great and it's almost in
[4:12:11] the road actually just tell them it's in
[4:12:14] then they'll come out and do something
[4:12:17] there was um they did the big speed
[4:12:20] thing a month or so ago or a few weeks
[4:12:24] ago
[4:12:25] um we just got to have people just be
[4:12:28] cognizant of of their speed going
[4:12:31] through it's easy to speed down Joe Carr
[4:12:33] it is and to say I haven't done it I'd
[4:12:36] be lying so
[4:12:38] but they have to be aware of it and
[4:12:40] let's just try to work with everyone to
[4:12:42] do this the speed thing
[4:12:46] I want to thank I truly truly want to
[4:12:49] thank Village
[4:12:51] staff
[4:12:52] and Council for all the hard work that
[4:12:55] went into the Tullamore and Amber
[4:12:57] Meadows situation I mean that took a lot
[4:13:01] of time
[4:13:02] a lot of time was spent on that and to
[4:13:05] be able to come come away with this and
[4:13:07] I think we can just use this as an
[4:13:09] example for us because we we should all
[4:13:12] look to improve ourselves as a council
[4:13:15] to to take to to walk away from as best
[4:13:18] we can to walk away with every situation
[4:13:20] that we come in with a win-win where
[4:13:23] it's not a win lose it's not a tie tie
[4:13:26] or whatever but it's a win-win and
[4:13:27] that's a great example of a win-win and
[4:13:30] I think that helps all of us so thanks
[4:13:32] thank Council truly thank Council and
[4:13:36] staff for for really working through
[4:13:38] that through that situation I'm going to
[4:13:42] go back to Kim's piece on because this
[4:13:45] isn't the first it's not the second and
[4:13:48] it's not the third time that one of us
[4:13:51] on this Council have been have been
[4:13:55] an insinuation has been made or a
[4:13:59] statement statement has been made about
[4:14:01] bribes and payoffs and the only thing I
[4:14:04] can say to that if if someone truly
[4:14:07] believes that before you make a
[4:14:08] statement like that just know that
[4:14:10] you're you're really you're really
[4:14:12] spitting in someone's face from an
[4:14:14] Integrity standpoint I don't appreciate
[4:14:16] it and if you think that I'm taking a
[4:14:18] bribe where I'm taking a kickback or I'm
[4:14:20] getting a payoff please come to me and
[4:14:24] or or any of us or come to the come to
[4:14:26] the town The Village manager and address
[4:14:29] that in a way that that has context and
[4:14:33] content around it and if you want to
[4:14:35] audit me please feel free to do it
[4:14:38] you're gonna you're gonna pay for it but
[4:14:40] please understand on the back side of
[4:14:42] that there's going to be a significant
[4:14:44] penalty for you for making that claim
[4:14:47] now I don't know what form that comes in
[4:14:50] I'm not I'm not threatening anyone but
[4:14:52] you're threatening me and you're
[4:14:54] threatening this Council and I think
[4:14:56] it's completely and totally unfair we're
[4:14:58] just trying to do our jobs if you don't
[4:15:00] like the job that we're doing
[4:15:02] come November please just just don't
[4:15:04] vote for me
[4:15:06] I I'll just tell you for me don't vote
[4:15:08] for me if you think I'm if you think I
[4:15:10] would go to the level of taking a bribe
[4:15:12] or a payoff
[4:15:13] please don't vote for me
[4:15:15] and that's all I can say but but it's it
[4:15:17] let's have a discussion to Kim's point
[4:15:21] when when you come with coffee with
[4:15:22] counselor you come to this counsel with
[4:15:24] something
[4:15:25] I hope that we are showing you the same
[4:15:29] level of respect that we deserve in
[4:15:32] return
[4:15:33] and if we can start there I
[4:15:37] we can get a lot of things done and we
[4:15:39] can make this a good Community for all
[4:15:42] of us and be a win-win for all of us but
[4:15:45] it's frustrating to have people say
[4:15:47] bribes and and payoffs because I've
[4:15:50] heard I've heard it now for for three
[4:15:52] years and I I haven't seen the nickel of
[4:15:56] it yet
[4:15:57] and don't want to I don't ever what I do
[4:16:00] what I do here is because I I believe in
[4:16:02] it and it's certainly not because
[4:16:04] someone has given me a dime or wants me
[4:16:06] to do something in return with that
[4:16:08] thanks to the law enforcement for all
[4:16:11] you do and staff you do you guys do an
[4:16:14] amazing job
[4:16:16] for what for the residents of Marvin
[4:16:18] thank you again
[4:16:22] Kim
[4:16:24] ditto to what Jamie said
[4:16:29] now my turn
[4:16:31] um I was going right down the same path
[4:16:33] you were thinking uh right away thanking
[4:16:35] Staff Hunter I know he's not here but he
[4:16:37] did a lot of work Christina obviously
[4:16:40] and specifically the two HOA presidents
[4:16:43] Amber Meadows and Tullamore who it's a
[4:16:46] thankless job but they were on your side
[4:16:49] in the community and to Jamie's Point
[4:16:51] getting to a resolution where it win-win
[4:16:54] and everyone walks away feeling right
[4:16:57] and more importantly we're doing getting
[4:16:59] things back in order there are some what
[4:17:03] do you want us if you want to call it
[4:17:04] sins of our fathers doing things that we
[4:17:07] couldn't control we were handed what we
[4:17:08] were
[4:17:09] handed but the key is to making it right
[4:17:12] and I think that's what we accomplished
[4:17:14] yesterday
[4:17:16] um quick uh prayers to all that are
[4:17:18] affected in the Florida Georgia South
[4:17:20] Carolina North Carolina
[4:17:22] recent hurricane that has passed through
[4:17:25] we're heading down to the beach this
[4:17:27] weekend for vacation and we'll probably
[4:17:30] see some things that we'll need to clean
[4:17:32] up so hoping everything goes well there
[4:17:34] continue prayers also to those displaced
[4:17:37] and our loss in Hawaii as well
[4:17:40] and um I think Bob mentioned this a
[4:17:44] little bit uh they had a little
[4:17:46] um event if you want to call it from the
[4:17:48] sheriff's department 131 citations I
[4:17:51] think were mentioned that were pulled
[4:17:53] over that's a lot of speeding guys a lot
[4:17:56] of tickets
[4:17:57] um if you got one shame on you but uh
[4:17:59] slow down and uh it's uh you know this
[4:18:04] is not just saying this because school
[4:18:06] is back in which you know a lot of us
[4:18:08] are happy our kids are back to school
[4:18:10] but uh you know there's more important
[4:18:13] reasons to be slowing and letting off
[4:18:15] the thing another note
[4:18:19] elections are coming up for local
[4:18:22] elections I just want to point out that
[4:18:25] I'm running unopposed however do take it
[4:18:28] seriously and I'm offering to any group
[4:18:30] or event anybody who wants a host a
[4:18:34] neighborhood where you want to hear from
[4:18:36] me obviously we have coffee with Council
[4:18:38] you can come and talk to the members you
[4:18:41] can wait to the ones that are being
[4:18:42] elected or I will make myself available
[4:18:44] I'm sure Bob and Jamie would extend that
[4:18:47] as well but I'd like to see some some
[4:18:50] dialogue respectful dialogue that we can
[4:18:53] share about the future what's going on
[4:18:55] here because it's it's finally we're at
[4:18:58] a point where things are getting done
[4:19:01] and you know I I I I can clearly hold my
[4:19:06] head high with what I think is happening
[4:19:08] within the village and it's I think
[4:19:10] we're going in the right direction
[4:19:16] last thing I'm a big supporter of our
[4:19:20] schools we're very involved my wife and
[4:19:22] I she's on the uh she's the band booster
[4:19:25] president and I'm I'm in charge of Pitt
[4:19:27] but that's one of the groups within the
[4:19:29] high school that doesn't get a lot of
[4:19:31] funding so uh you know we're doing the
[4:19:34] go play save again they're thirty
[4:19:36] dollars is over sixty one hundred
[4:19:38] dollars in or sixty two hundred dollars
[4:19:40] in local savings on everything from
[4:19:42] grocery stores to you name it it's easy
[4:19:45] to get your money back on that and half
[4:19:47] of the proceeds go to the band uh
[4:19:51] members and we work on a really tight
[4:19:53] budget you think the village is tight I
[4:19:56] would tell you the band is very tight so
[4:19:58] um but we're looking forward to a great
[4:20:00] season lots of competitions coming up
[4:20:02] and we're definitely looking forward to
[4:20:05] that so
[4:20:06] um with that I will ask that we
[4:20:10] close and uh
[4:20:12] end our meeting so I moved all is in
[4:20:14] favor hi hi
