if it becomes more vibrant and more used,

any of these other activities and utilize that space, we must fix that the surface, it's
[37:20]
must feel. But, yeah, just kind of showing the potential. It really strikes me as very, very

Next. Why have you done it? See? Yeah. Again, I already said, allow multiple groups to use the square at the same time. You know, someone's doing a family group meeting over in this corner, someone's, you know, having another art event over in another corner. I could see that happening. If there were that more usable spaces, why that being, I already mentioned not how do we're usable space, not necessarily part of a building, a lot more open, but yet usable.

by a Canadian and there's a lot of truth in that and I feel over the last four or five

years we have a lot of good input. Everyone's going to have different ideas and thoughts on

And if we're going to leave it up to five of us to kind of design it and come up with it and agree on every little aspect of it, I think it will never get there, and I think that's what has delayed us quite honestly, and so I would much rather rely on the planners, master planners to kind of come up with the overall concept.

We adopt that, and then, as each little phase, you know, in terms of the details, how that's worked out, you know, we can work that out.

But, but it should be relied very heavily, you know, with the planners.

I think it's an economic grant. And we did make some progress on the signing of a building

gangric. My suggestion is, based on my next experience I have with grants, is to get a contractor

overlaid district known as the trot.

This is a proposal to do a land use map
[55:23]
amendment or a zoning map amendment.
[55:26]
What we're looking at is reducing the area of the transient rental overlaid district.
[55:31]
This really stems back a couple of years.
[55:33]
We've had several proposals to expand the trot over time.
[55:37]
And so we've had public hearings.
[55:38]
the City Council Planning Commission have considered those expansions over time and some of those
[55:45]
expansions of the Trog World Group, somewhere tonight.
[55:49]
And what we ended up is with the General Plan, there was language written into that that we
[55:53]
should not expand the Trog, or short-term rental area, and that's what the Trog does is allow
[55:59]
for short-term, and also that's rentals less than 30 days.
[56:02]
And as we had a work meeting about three months ago, direction was given from City Council
[56:08]
the staff to take a look at the land use map and make recommendations where we could reduce the
[56:13]
trot and there are positive reasons to have the trot and there's negative reasons to have the
[56:19]
trot and we've talked about those in previous meetings we will go over those tonight. The just
[56:24]
is kind of an overview. The proposal is to remove several areas out of the trot. What is the
[56:31]
trot that lasts for short term rentals less than 30 days? Well, with this due this would eliminate
[56:35]
new amplifications in the areas removed from the trot. What about the existing rentals in these areas?
[56:42]
Would they be grandfathered in this leave alone conforming they would? And in the trot right now
[56:48]
fit the 152 properties that we're looking at taking out of the trot,
[56:53]
there are three licensed transient rental units. One is in the commercial zone on the side of Main Street
[57:00]
and we'll look at maps where these are located and then there's two up and turnberry.
[57:05]
And so, notice that the three could be grandfathered in.
[57:08]
Also, we have received three applications for additional use permits, which is required for any transit rental unit application in a residential zone.
[57:19]
And these are all along first south.
[57:21]
And this is an area that was re-zoned in recent years.
[57:23]
And those three property owners, and we'll look at the map, have a flight for the conditional use permit,
[57:28]
which per state law they are vested.
[57:30]
And they can move forward with those conditional use permits.
[57:32]
So essentially out of those 152 that we've noticed, there could be six that we'd be grandfathered
[57:38]
in as we go on conforming.
[57:40]
So just a little bit of a background on that.
[57:43]
So there are three licensed units, three more pending applications that both the planning
[57:46]
commission and city council will consider.
[57:49]
This is our land use map, and we have areas on the land use map, which is the overlays
[57:56]
on for the trot.
[57:56]
It's the blue land and the zoom in on it.
[57:59]
And so the main areas for the trod are around the commercial areas.
[58:04]
You can see a long main street for the C3 and C2 zones and down center street.
[58:09]
We have an island over at Johnson Mill.
[58:12]
We have another island area, which is around the Alley, which is the mountain spot, property.
[58:18]
And then the main area is around the two resorts and upline canyon.
[58:22]
So we have the Zermod.
[58:24]
We have the homestead, and then we have Turnberg and Turnberg,
[58:27]
some other properties in this main overlay district. We also have one where the rising
[58:34]
ranch subdivision is. And so that one traditionally has been a nightly rental weeks,
[58:40]
the one home that's on site. And then we have one, one more spot. Let's see, I did mention
[58:48]
Johnson now. So those are the spots around town where we do have the transit rental overlay
[58:52]
district. We very consistently receive phone calls of people who want to buy properties in midway and they want to be able to rent their units on a nightly basis.
[59:03]
So we do direct them to the map and people have purchased in those areas based off of the current maps. So that's something to consider.
[59:11]
As we look at reducing the area of the truck. Now, again, we did send out 152 letters for all the properties that will be looking at tonight, pull out of the truck.
[59:21]
And so they've all received notices if that notice has arrived at their address.
[59:26]
We have received a few back, and so we do send them to the address on the tax roll.
[59:33]
So it is possible some property owners never received their notice because of that issue.
[59:39]
As for the areas proposed for removal from the charade, we've got churned very point unit development,
[59:44]
churned very wood's point unit development, midway village PD, rising branch subdivision.
[59:49]
There's some two lots and the mountains follow real preservation subdivision.
[59:54]
There's also an area in the commercial zone for 100th South, but actually this area.
[1:00:00]
On First, South, it's in a residential zone, First South between 50 west, 100 west and then an area in the commercial zone located east of Box preserving road in South of Main Street
[1:00:09]
so we'll talk about each one of these individually.
[1:00:12]
This first one is Turnberry, in Turnberry Woods, at originally when the truck was adopted back in 2006.
[1:00:19]
Turnberry in Turnberry Woods allowed for nightly rentals and so they were included within the boundaries of the truck.
[1:00:26]
Before that, there wasn't any regulation from nightly rentals, just generally the North East area of town was the recreational resort zone.
[1:00:34]
That was reduced down to the resort zone at that point in time.
[1:00:38]
But these two subdivisions did allow nightly rentals. They have since changed their CCNRs to where they do not allow nightly rentals.
[1:00:45]
We have two licensed units in this area that would continue as long as they kept their license up and
[1:00:54]
There wasn't a ownership change and I bring up the ownership change because the CCNRs for in my understanding for turnberry turnberry was as if there's an ownership change
[1:01:04]
Then that does not pass on to the new owner. So taking the units out of the tribe would make it so there wouldn't be any grandfathering at that point

Those were sent on toward legal deployment,

So those are the only two properties in this area that's in the trot, initially the resort

needs when unsighted. We re-reasoned part of the property to residential, but the

trot boundary did not move. So we did look at areas around town where it seemed like it
[1:06:39]
might be reasonable to reduce the trot. And this would reduce these to the unit. It's
[1:06:44]
both property owners have reached out to us. They would like to stay in the trot. So again,
[1:06:49]
the bodily letter was sent to you. I received a communication with Joe Clark today also
[1:06:55]
wanting to stay in the trot. Again, these are just two properties that make sense if they
[1:06:59]
they have an issue with being removed that we would leave them just in the
[1:07:04]
trot and so that would be stashed recommendations. It's not changed to
[1:07:08]
boundary here.

As for the C, this is the C2 zone. You can see Fox 10
[1:07:18]
run over here on the left and they're main street as it curves to the south. Just

know that the Hamlet. We have had uplook hearings in this area and some of the

To the public hearings and expressing concerns with having nightly rentals in this area, because it is a established residential neighborhood where I think about every home is a primary residence.

We do have one licensed unit in this area that would be grandfathered in, but we did some letters out and we just received letters and support of removing this area out of the trot.

So what remain is C2 zone, but it would be out of the transient
[1:07:58]
runoverly district if approved as presented.

And then one last area, this is a long first south in between
[1:08:07]
center street and first west.

We had three properties.

amendment. There's a public hearing required for the Planning Commission and the

City Council. So we had a public hearing before the Planning Commission. The Planning

Commission to Recommendation was to move forward as recommended. But we have received quite
[1:09:09]
a bit of correspondence since that meeting. And so, again, that's part of your packet.

Again, two areas that we would recommend that probably stay within the
[1:09:19]
and one is this area around OMELE, it's just two properties, and then this area for the rising
[1:09:27]
range subdivision, we've had some legal issues to look at with this one, and so that would,
[1:09:35]
because they have that prulink, it conditionally is prulink, it makes sense to leave them, and also right now.

to provide you revenue for property owners, it generates transient room tax and resort taxes for

the city. So we're able to qualify because of the amount of rental rooms in entown for the extra

1% sales tax. And so the truck does help us meet that and we did receive a letter which I included
[1:10:06]
in your packet saying very strongly that reducing our area for a truck could jeopardize us being
[1:10:15]
able to get the resort tax, which, again, is about six of our budget.
[1:10:19]
So there's a concern for that to consider.
[1:10:22]
It does support local economy by tracking tourist spending.
[1:10:25]
Some of the drop-backs for short-term rentals, it creates commercial competition for local
[1:10:29]
resorts.

We have quite a few more hotel rooms and other products in the resort zones that's under construction
[1:10:34]
right now, both in Amihale, also at the homestead, and even in the commercial zone, for
[1:10:40]
since at South Yale, so those are new rooms
[1:10:44]
that will be added to the calculation for the resort tax.
[1:10:48]
Again, having a larger trot area creates competition.
[1:10:52]
It also introduces neighborhood disruptions.
[1:10:55]
And this is probably the biggest thing
[1:10:56]
is receive complaints if properties are not following the rules.
[1:11:00]
And we do have a mechanism for enforcement
[1:11:02]
but sometimes it's easier said than done.
[1:11:06]
And then reduces long-term housing supply
[1:11:08]
for permanent residents in the town.
[1:11:12]
So this is something that we've talked about quite a bit.

The more homes in the nightly rental pool,
[1:11:18]
the less option there is for permanent residents in town.
[1:11:21]
And that's a big factor for why many cities
[1:11:23]
have eliminated nightly rentals.

And then it can't be real the city sense of community.

So you guys might like the general plan.

for trial removal tonight. Just for simplicity I'll continue to refer to this as the subject
[1:16:04]
YouTube. I read my comments. I'm quick background. I'm a local entrepreneur. As of two years ago
[1:16:11]
I decided to leave corporate america move to the Hebrew valley and start a small local hospitality business.

Mike wouldn't let multiple times expressing all my different ideas and intentions for this town.

She's like as I do love midway, not because this was the more financially stable left decision for me to make.
[1:16:31]
I'm here tonight because I strongly believe in the tribe, I strongly believe in 98% of the proposal as it's written tonight and I'm here to discourage the inclusion of 2% which is the soul and only impacted commercial zone impacted by this proposal.

So, I will propose four questions for Council's consideration and to make one recommendation as to how we could potentially clean this up.

First question for Council's consideration is to reconsider why was this specific C2 area included as that?
[1:17:16]
as eloquently presented to us the entire premise of this proposal has been to focus on
[1:17:24]
residentialized zone areas that were later added to the truck after it's finding.
[1:17:30]
And I think we're here because the general plan says the truck should not be expanded and for
[1:17:35]
all of the one of these properties we're looking at cases where the truck was expanded into residential zones.
[1:17:43]
This may, I believe, have been the work of meeting on May 19 through referred to these instances
[1:17:48]
as the creep in the trot map, where the boundary line seemed to have left logic and spilled
[1:17:55]
into residential areas.
[1:17:59]
I'm here to question whether or not there is any precedent for whether or not there's an
[1:18:03]
instance where any area of the commercial zone was removed from the trot, and I do believe
[1:18:10]
including this commercial area, we'll introduce the first ever precedent for a new type of
[1:18:17]
creep that we will see multiple times in the future on the truck map.

Question 2 for a council
[1:18:26]
is consideration that I have here is, probably in the work meeting on the 19th, the truck conversation
[1:18:36]
was preceded by discussion around C2 and C3 commercials and amendments.

Mr. Mayor, in that meeting as well, you gave the $40,000 foot, or $30,000 foot guidance,
[1:18:48]
that C2 should encourage keeping existing homes. It should prevent commercial demolition and
[1:18:55]
building to maximize square footage, and it should protect green space as relates to the subject
[1:19:02]
C2 property. I also agree with a common you may that you see the area near Southfield being a very
[1:19:08]
interesting place for people to want to visit in midway. So I stand before you today as a
[1:19:14]
commercial investor in the C2 zone, the subject C2 zone on the board here. I stand before you as a commercial
[1:19:22]
operator that has tried to follow all the rules. I believe city council record will reflect that
[1:19:28]
and the biggest land costs or development costs that I have incurred since that purchase
[1:19:34]
is property has been removing a structure and adding green space. All our key goals that
[1:19:40]
we have established as a council for the C2 commercials down.
[1:19:48]
I'm actually going to, but then the questions are realized. It's duplicative so the last
[1:19:52]
question I have for council's consideration is, why does it seem that council has labeled
[1:19:58]
me as to call Eulisa a problem child for the area and the only evidence that I could find
[1:20:07]
in my many many hours of digging had been the inclusion of the one email and the report
[1:20:13]
here submitted by my neighbor who has, like the comments prepared tonight, but I imagine they
[1:20:21]
were going to be in one, there was no notification to her. I do remind you, I'm going to see
[1:20:27]

Second of which, since we bought the property,

She accused me of lying to my neighbors.

That's fundamentally not true.

I can review neighbors that would testify in that.

I can show you evidence that would prove otherwise.

She makes reports of trafficking and parking.

Yes, we did have one since we had way too much parking on our property.

This was our second or third reservation back in September of 2025.

I immediately got an email from Katie.

She read me the right act in her office.
[1:21:41]
And she very timely went through my listing and proposed language,

and it's to prevent these issues from happening.

We made those changes.

We have not, to my knowledge, have had any reported instances of having a problem in what's near a year and many reservations since.

All this to say, I still support today's amendment. I do think we should remove areas from the tribe that were incredibly added from its institution that is clean up work that should be required.

And I do have one mission, if Council is so compelled to include this area in the proposal that we'd actually clean this up to make it aligned with the findings and not reduce the tribe of the region in this area to R-11.

So it is truly a residential zone, and it supports the findings that by removing it from the tribe, it actually returns long-term housing supply to the market.

Because otherwise by reducing the tribe, purely you have not added additional long-term housing supply to the market.

rising ranch from the tribe would be a violation of those properties, the development agreements

and possibly its headings and would cause at least $9 million in invested damage.

That being said, we're just asking that the city expressly ran for the rising ranch,

at full blast and we had, I mean, his properties and nightmare are in a higher street.

People do not sleep with their windows up during the summer because of the noise coming

from this property.

So I understand it's not licensed.

There's never been a property manager over all of the years that we've called going back

before there were never any property manager who were given or never admitted to be the property

manager in the United States.
