[7:42] trying to keep our economy going trying to

[7:45] not overstep our legal bounds on civil liberties

[7:58] two unexpected allies pulled me off to the side

[8:02] and had a talk with me uh after a lot of prayer and

[8:06] consultation with my wife i have am officially announcing that i

[8:13] am going to run for my third term as mayor of midwest city and uh

[8:18] so we'll see what happens but uh i do appreciate the confidence that you've

[8:22] shown to me over the last five and a half years

[8:25] representing this community and being an ambassador

[8:28] for our city and and i look forward to another four years if that's what the

[8:34] voters want so with that being said

[8:39] i have one thank you i wanted to address some community announcements too

[8:42] that i failed to do so graduation was saturday for all the middle

[8:47] high schools and fnb community bank sponsored a congratulations

[8:54] card with a dollar coin in each of the graduates

[8:57] sleeves type of thing as a little token to commemorate their graduation

[9:02] and so i just wanted to say a special thank you to f b community bank for that

[9:07] it was for all of the mid dell kids so thank you very much

[11:04] began his career with midwest city in may of 1989

[11:08] as a route service person in sanitation retired

[11:18] he's proven himself as a valuable part of the midwest city

[11:21] sanitation team being knowledgeable of all residential route collection methods

[11:26] and willingness to help others especially

[11:29] during the difficult time of 2020 and whereas stoney has been a good team

[11:33] member and accept additional responsibilities with no

[11:37] problem wisely providing ideas that

[11:42] might improve the department and improve effectiveness

[11:46] of problem solving whereas his professional manner toward his customers

[11:50] and always professional he demonstrates efficiency competency

[11:55] and courtesy whereas tony's co-worker said that he loves his family

[11:59] and loves to spend time with them and where he'll fight for equality for each

[12:03] employee and that he's very dedicated to his job

[13:57] following the tragic death of five five firefighters in australia

[14:02] and is celebrated on may 4th each year remembering the dedication courage

[14:06] and need for firefighters all the way all over the world

[14:09] whereas the international firefighters day is a time where the whole world's

[14:13] community can recognize and honor the sacrifices

[14:16] that firefighters make to ensure that their communities

[14:20] environments are safe as possible whereas our midwest city firefighters

[14:24] are committed to providing the highest level of public

[14:27] service for our community and residents protecting lives property

[14:30] through fire suppression disaster management fire prevention and

[14:34] public education whereas they endeavor to be mentally and

[14:37] physically prepared to take bold and aggressive action in the

[14:41] execution of their mission as evidenced by the 254 fire calls and over 8 000 ems

[14:47] calls in the year 2020. therefore i'm matthew

[14:57] and rather than just one day all year round

[15:01] recognize what these guys do for us and thank them for their service

[16:52] one but whereas national police week is to honor the

[16:56] service and sacrifice of those law enforcement officers killed in the line

[16:59] of duty while protecting our communities and

[17:02] safeguarding our democracy whereas the dedicated men and women who

[17:06] have chosen law enforcement as a career face extraordinary risks and

[17:10] dangers in preserving our freedom and security

[17:12] whereas it is fitting and proper that we express our gratitude for the dedicated

[17:18] service and courageous deeds of our law enforcement officers

[17:21] and for the contributions they have made to the security and well-being of our

[17:25] people and whereas by joint resolution approved

[17:29] by approved october 1st 1962 the congress

[17:33] has requested the president designate may 15th of each year

[17:36] as peace officer memorial day and the calendar week

[17:40] during which may 15th falls occurs as police week

[17:44] whereas the members of the midwest city police department play an essential role

[17:48] in safeguarding the rights and freedoms of citizens of our community

[17:52] i therefore matthew dukes mayor milwaukee do hereby proclaim

[21:00] work in public works and that's an all-encompassing

[21:05] area streets sanitation

[21:13] water the water you drink the seeds that you flush away

[21:17] all of that and i'll tell you what the one thing that will ring our bells every

[21:22] time is if your trash doesn't get picked up

[21:24] we're hearing about it so they they're extremely important so

[21:29] it's uh it's good to come to uh together to recognize these folks and

[21:35] whereas public works professionals focus on the infrastructure facilities

[21:39] and services there are vital importance to sustainable and resilient communities

[21:45] into the public health and high quality of life and well-being of the citizens

[21:49] of midwest city whereas the infrastructure

[21:52] facilities and services that could not be provided without the dedicated

[21:56] efforts of public warfare professionals who are engineers managers employees of

[22:01] all levels of government and pro in the private sector who are

[22:04] responsible for rebuilding improving protecting our nation's transportation

[22:09] water and water treatment and solids waste

[22:12] systems for public buildings and other

[22:15] structures and facilities are essential for our citizens whereas

[22:19] is in public interest for the citizens civic leaders

[22:22] and children in the midwest city to gain the knowledge and to maintain

[22:26] an ongoing interest and understanding of the importance of public works

[22:30] in public works programs in their prospective communities whereas

[22:34] your 2021 marks the 61st annual national public works week sponsored by

[22:40] the american public works association canadian public works

[22:45] association therefore i'm matt dukes mayor of

[30:03] detention maintenance of the new area for

[30:06] detention will be the responsibility of the hoa as with the other common

[30:10] areas detention ponds throughout the turtle wood aspen ridge

[30:13] edition the installation of public water sewer streets and sidewalks is a

[30:17] requirement throughout the remaining of the

[30:19] undeveloped area within the preliminary plot

[30:21] actually is a discretion of the city council i'll be glad to answer questions

[30:27] so is he he they're extending the detention

[30:30] if you'll remember back and this is done under the old subdivision regulations so

[30:34] it's not quite like what everybody's used to on

[30:36] on this but we had to do uh the developer had to add additional

[30:42] detention for the problems that were going on

[30:45] downstream and this is added to the preliminary

[30:50] plat in order for it to be included in the

[30:52] hoa this is really a staff's request for them to do this to

[30:57] tidy up some of the uh paperwork and plaid i noticed in the

[31:04] one of the the issues that was brought up was the responsibility of the

[31:08] detention pond who was going to keep that up

[31:11] and it says in your report that the aspen h.o.a

[31:14] or aspen ridge hoa is going to be responsible for that do they know that

[31:19] yes it's um any time that that that when you go buy a house and you're an

[31:24] hoa those responsibilities are outlined in your in your in your in your

[31:29] covenants and so they would know that and the

[31:31] question did come up about that at the planning commission

[31:34] and that is the case for this that it is divided and that's from what my

[31:38] understanding is one of the reasons that they

[31:39] changed the name on parts of the subdivision was to help clarify that

[31:45] is at some point in time our city attorney is going to either has

[31:51] or will read the hoa paperwork correct this is under the old

[31:55] subdivisions so technically i don't know if they are

[31:59] if he is responsible for that

[32:05] but this is under the old old subdivision regulations

[32:15] sure i'm sure we can ask for was that was that if i remember right

[32:22] a couple city attorneys ago they did not think

[32:25] they were responsible for reading the hoas yes however

[32:29] but if you looked at the ordinance they've always been responsible for

[32:32] looking at the hoas they just basically didn't

[32:39] now i don't remember the second part of that um i do remember that the the

[32:42] previous city attorney that was here for for so long she was very insistent that

[32:46] we had nothing to do with the hoas but it was in the ordinance that we did

[32:51] i i don't remember that being in there but

[32:53] i i don't i'm not disagreeing with you i just don't remember it

[32:57] i know we changed the ordinance so that that the city attorney would read it

[33:01] yeah there's clearly we didn't know we did do a change and it's part of it now

[33:05] well with all due respect i mean i guess my question is about making a motion

[33:11] that it's subject to this the city attorney's review and

[33:15] approval that in fact the homeowner association agreement does

[33:19] reflect that the maintenance for this additional

[33:23] area will be the responsibility of the homeowners association to maintain the

[33:27] detention pond to make sure somebody's maintaining it

[33:30] because we've had an awful lot of drainage problems out in that area

[33:33] and the last thing we need to do is cause

[33:37] there to be you know something put in place that's not being maintained and

[33:40] kelly looks like she's got something to add

[39:07] agents for the midwest city memorial hospital authority

[39:10] in the preparation filing and representation of zoning

[39:14] indoor planning applications to the city of midwest city

[39:17] mr coleman i wanted to go over a couple of minor corrections

[39:20] with you in both the real estate agreement and the economic development

[39:24] agreement these would have been included in your

[39:27] packet if we got them in time but we received these

[39:30] yesterday the real estate council in this matter had a chance to review

[39:35] the real estate agreement and the changes that are proposed are

[39:40] highlighted in the contract that i just passed out

[39:44] and that includes a a couple of minor amendments

[39:48] but they also added language on the second

[39:51] and third page of the agreement as well as the fourth page of the agreement

[39:56] that concerns zoning these lots are not zoned multi-family at this time

[40:02] and the buyer would like to have that matter resolved before they

[40:07] agree to close on the property and when i talked to ms oakley she didn't have

[40:11] any problem with what they were proposing

[40:14] and so we recommend approval of the the real estate contract

[40:20] as you see it i'll answer any questions do we have a

[40:27] timing issue on this robert that since these didn't go out as part of the

[40:32] agenda items that are available for public review do we

[40:36] have a reason why we can't delay this to take this up next time

[40:42] i don't know of any reason you can't delay it

[40:54] provided the items were placed on the agenda accordingly and provided that

[40:58] this information has been provided to the public at least at this meeting

[41:02] it would me that would meet the open meetings act

[41:06] requirements now if the city council believes that you have not

[41:11] had enough time to review these obviously that's what's in the city

[41:14] council's discretion as to whether you would like to have a chance to

[41:17] review them and bring this back up at a subsequent meeting these changes don't

[41:23] affect the title as published on the agenda

[41:29] my concern is just we've had a constituent show up in the gallery

[41:32] and complain about not being able to see things that are posted

[41:36] and so that's what where my concern goes to since they weren't posted items

[41:40] yes the notice was posted and yes i'd refer to the city attorney in terms of

[41:44] the legal sufficiency of the notice it's just a matter of the substance of that's

[41:47] not available so that was what my question went to

[41:50] if everybody's comfortable with it and if we have a timing issue then certainly

[41:55] none of these uh corrections affect item six

[41:58] only uh four and five so there's really no need i mean other

[42:04] than language changes everything remains the same yes sir

[42:10] a motion to approve the real estate contract as

[42:18] zoning guns because isn't there a question you need a vote on each one of

[42:49] 100 on the actual contract i think that may include some of the closing costs

[42:55] because we've agreed to pick some of them up

[43:35] there is uh really only one change of significance and that's found

[43:39] in article 1 under the purpose of the agreement

[43:42] the buyer slash prospect has inserted language as is highlighted

[43:49] as section 102 as far as the attorney the term of the

[43:53] agreement the term of the agreement shall become

[43:55] effective upon execution by all parties and it shall continue

[43:59] in full force in effect until one completion of the project evidenced by a

[44:03] certificate of occupancy issued by the appropriate authority or

[44:07] two default of either party is set forth in section five or

[44:10] three upon mutual agreement of the parties buyer may terminate the

[44:13] agreement uh on reasonable notice for reasons

[44:16] consistent with terms of sections three four and eleven

[44:20] of the real estate agreement in other words if the zoning is not

[44:26] approved then this would be null and void

[44:34] and there was a change to an address in the back on where we're supposed to

[44:37] deliver notices and those are the really only two substantive changes

[44:55] and he's serving as just for economic development contracts
