[7:05]
indulgence for just a second you know
five and a half years ago
[7:09]
uh this citizens you guys uh elect
me as mayor of midwest city it's been a
[7:17]
humbling experience i can't say it's all
been pleasant
[7:21]
but
[7:27]
i forget what the verbiage was
unexpected allies
[7:32]
and uh you know i'll be totally honest
with 2020 as
[7:37]
did a lot of people took a toll on all
of us
[7:42]
trying to keep our economy going trying
to
[7:45]
not overstep our legal bounds on civil
liberties
[7:50]
all of that and and i had considered
not running but again
[7:58]
two unexpected allies pulled me off to
the side
[8:02]
and had a talk with me uh after a lot of
prayer and
[8:06]
consultation with my wife
i have am officially announcing that i
[8:13]
am going to run for my third term
as mayor of midwest city and uh
[8:18]
so we'll see what happens but uh i do
appreciate the confidence that you've
[8:22]
shown to me over the last five and a
half years
[8:25]
representing this community and being an
ambassador
[8:28]
for our city and and i look forward to
another four years if that's what the
[8:34]
voters
want so with that being said
[8:39]
i have one thank you i wanted to address
some community announcements too
[8:42]
that i failed to do so graduation was
saturday for all the middle
[8:47]
high schools and fnb community bank
sponsored a congratulations
[8:54]
card with a dollar coin in each of the
graduates
[8:57]
sleeves type of thing as a little token
to commemorate their graduation
[9:02]
and so i just wanted to say a special
thank you to f b community bank for that
[9:07]
it was for all of the mid dell kids so
thank you very much
[9:10]
that's awesome okay we have uh several
proclamations to do and city manager
[9:17]
presentation so
we'll move into that
[9:22]
stoney would you come down
[9:44]
how are you doing
[9:58]
yes ma'am
[10:03]
oh i got to use this one okay
[10:07]
so this is a special recognition for a
long-term employee here for the city
[10:11]
who's
been a dedicated worker and has done an
[10:14]
outstanding job
and and we're we are saddened that
[10:19]
you're having to leave us and and we
really appreciate all the years of
[10:23]
service
stoney that you've done for us and this
[10:26]
is a recognition special recognition of
stony tiasky for loyal and dedicated
[10:31]
service to the citizens
of the city of midwest city may 1st 1989
[10:36]
through april 27
2021. thank you awesome
[10:42]
team here congratulations appreciate it
[10:56]
and stoney i can't give you anything but
a day
[11:00]
but you deserve a lot more but whereas
stoney tynsky
[11:04]
began his career with midwest city in
may of 1989
[11:08]
as a route service person in sanitation
retired
[11:11]
april 20 april 2021 after nearly 32
years of faithful service and whereas
[11:18]
he's proven himself as a valuable part
of the midwest city
[11:21]
sanitation team being knowledgeable of
all residential route collection methods
[11:26]
and willingness to help others
especially
[11:29]
during the difficult time of 2020 and
whereas stoney has been a good team
[11:33]
member and accept
additional responsibilities with no
[11:37]
problem
wisely providing ideas that
[11:42]
might improve the department and improve
effectiveness
[11:46]
of problem solving whereas his
professional manner toward his customers
[11:50]
and always professional he demonstrates
efficiency competency
[11:55]
and courtesy whereas tony's co-worker
said that he loves his family
[11:59]
and loves to spend time with them and
where he'll fight for equality for each
[12:03]
employee
and that he's very dedicated to his job
[12:07]
and would be reached
no matter what time of day or night so
[12:12]
therefore i'm matthew dukes
mayor of midwest city do hereby proclaim
[12:16]
may 25th
2021 stoney tsk day
[12:21]
in the city of midwest city and hereby
urge all citizens to show
[12:24]
stoney the appreciation he deserves for
his selfless contribution to the
[12:28]
residents
and businesses in the city of milwaukee
[12:48]
let me
thank you
[12:57]
okay we're a little late on a couple of
these but lake
[13:02]
is better than never all you firemen
come down here
[13:18]
chief
you can smile
[13:23]
come on i don't know half of you now
[13:38]
again we're a little late on this we
should have done this last month but
[13:43]
it's been kind of a busy uh you know
these are the guys and girls that go out
[13:49]
to protect us every day
and we own the debt of gratitude but
[13:54]
whereas international firefighters day
was created in 1999
[13:57]
following the tragic death of five five
firefighters in australia
[14:02]
and is celebrated on may 4th each year
remembering the dedication courage
[14:06]
and need for firefighters all the way
all over the world
[14:09]
whereas the international firefighters
day is a time where the whole world's
[14:13]
community
can recognize and honor the sacrifices
[14:16]
that firefighters make
to ensure that their communities
[14:20]
environments are safe as possible
whereas our midwest city firefighters
[14:24]
are committed
to providing the highest level of public
[14:27]
service for our community
and residents protecting lives property
[14:30]
through fire suppression
disaster management fire prevention and
[14:34]
public education
whereas they endeavor to be mentally and
[14:37]
physically prepared to take
bold and aggressive action in the
[14:41]
execution of their mission as evidenced
by the 254 fire calls and over 8 000 ems
[14:47]
calls
in the year 2020. therefore i'm matthew
[14:51]
dukes mayor of midwest senior here by
complaining
[14:53]
may 4th 2021 firefighter appreciation
day
[14:57]
and rather than just one day all year
round
[15:01]
recognize what these guys do for us and
thank them for their service
[15:06]
again uh given to my hand this day
uh well the 12th of may of uh
[15:13]
year of our lord 2021. thank you guys
thank you guys appreciate it
[15:32]
well i guess win party pick
[15:44]
all right chief i'll give this one to
you
[15:48]
there you go thank you guys be good
[15:59]
this is a good night all you police
officers come over there
[16:04]
i don't need everybody don't sigh
i saw that sigh lieutenant come on
[16:23]
and once again these ladies and
gentlemen are the ones that go out and
[16:28]
fight the fight every day and um
some of you guys come here they're 100
[16:35]
dedicated
to the city and into your protection
[16:39]
and despite all that's going on
throughout throughout the nation these
[16:45]
folks show up
every day and uh and do their job and
[16:48]
serve you
and again we're a little late on this
[16:52]
one but whereas
national police week is to honor the
[16:56]
service and sacrifice of those law
enforcement officers killed in the line
[16:59]
of duty
while protecting our communities and
[17:02]
safeguarding our democracy
whereas the dedicated men and women who
[17:06]
have chosen law enforcement
as a career face extraordinary risks and
[17:10]
dangers in preserving our freedom and
security
[17:12]
whereas it is fitting and proper that we
express our gratitude for the dedicated
[17:18]
service and courageous deeds of our law
enforcement officers
[17:21]
and for the contributions they have made
to the security and well-being of our
[17:25]
people
and whereas by joint resolution approved
[17:29]
by
approved october 1st 1962 the congress
[17:33]
has requested the president designate
may 15th of each year
[17:36]
as peace officer memorial day and the
calendar week
[17:40]
during which may 15th falls occurs as
police week
[17:44]
whereas the members of the midwest city
police department play an essential role
[17:48]
in safeguarding the rights and freedoms
of citizens of our community
[17:52]
i therefore matthew dukes mayor
milwaukee do hereby proclaim
[17:56]
may 9th through 15th as
police week in midwest city and urge all
[18:01]
police are all citizens of midwest city
to uh thank them for their service and
[18:06]
their continued
dedication to our community given my
[18:10]
under my name
the 25th day of may year 2021.
[18:17]
uh again with everything that's going on
in the world today
[18:22]
these guys do an amazing job and please
and please thank them for their service
[18:30]
matt before you before you cut them
loose
[18:33]
i think it's important for the community
to know that we just went through the
[18:36]
budget deal
and to fund the police never came up
[18:40]
good point and it will never come up in
this community
[18:44]
trust me on that one thank you guys for
your service
[19:08]
yes i am a politician
[19:37]
i can't anymore
[20:01]
thank you great group of folks firemen
policemen thank you guys very
[20:04]
[Applause]
[20:17]
okay you got to listen to me one more
time
[20:32]
um
[20:37]
well i've said it a lot of times
although well deserving the police and
[20:43]
fire
get a lot of credit and they deserve it
[20:48]
but there's some unsung heroes in this
community
[20:52]
that rarely get in credit but are just
as important
[20:56]
to the safety and security of our
community and that's those folks that
[21:00]
work in public works
and that's an all-encompassing
[21:05]
area streets
sanitation
[21:13]
water the water you drink the seeds that
you flush away
[21:17]
all of that and i'll tell you what the
one thing that will ring our bells every
[21:22]
time is if your trash doesn't get picked
up
[21:24]
we're hearing about it so they they're
extremely important so
[21:29]
it's uh it's good to come to uh
together to recognize these folks and
[21:35]
whereas public works professionals focus
on the infrastructure facilities
[21:39]
and services there are vital importance
to sustainable and resilient communities
[21:45]
into the public health and high quality
of life and well-being of the citizens
[21:49]
of midwest city whereas the
infrastructure
[21:52]
facilities and services that could not
be provided without the dedicated
[21:56]
efforts of public warfare professionals
who are engineers managers employees of
[22:01]
all levels of government and pro
in the private sector who are
[22:04]
responsible for rebuilding improving
protecting our nation's transportation
[22:09]
water
and water treatment and solids waste
[22:12]
systems
for public buildings and other
[22:15]
structures and facilities
are essential for our citizens whereas
[22:19]
is in public interest for the citizens
civic leaders
[22:22]
and children in the midwest city to gain
the knowledge and to maintain
[22:26]
an ongoing interest and understanding of
the importance of public works
[22:30]
in public works programs in their
prospective communities whereas
[22:34]
your 2021 marks the 61st annual
national public works week sponsored by
[22:40]
the american public works
association canadian public works
[22:45]
association
therefore i'm matt dukes mayor of
[22:48]
midwest city do hereby proclaim
the week of may 16th through the 21st as
[22:54]
public works appreciation week week
stronger together
[23:25]
all right we're done
[23:53]

[29:31]
part of
the southeast quarter section 7 township
[29:35]
11 north range one west
mr hartless thanks again mr line
[29:41]
this application is a revision of the
preliminary plot
[29:45]
for turtle wood edition the 34.4
[29:52]
area preliminary pattern sorry much of
the entire area
[29:56]
has been developed the revision is
requested in order to
[29:59]
for the developer to add additional land
to the subdivision for the purpose of
[30:03]
detention
maintenance of the new area for
[30:06]
detention will be the responsibility
of the hoa as with the other common
[30:10]
areas detention ponds
throughout the turtle wood aspen ridge
[30:13]
edition the installation of public water
sewer streets and sidewalks is a
[30:17]
requirement
throughout the remaining of the
[30:19]
undeveloped area within the preliminary
plot
[30:21]
actually is a discretion of the city
council i'll be glad to answer questions
[30:27]
so is he he they're extending the
detention
[30:30]
if you'll remember back and this is done
under the old subdivision regulations so
[30:34]
it's not quite like what everybody's
used to on
[30:36]
on this but we had to do uh
the developer had to add additional
[30:42]
detention
for the problems that were going on
[30:45]
downstream
and this is added to the preliminary
[30:50]
plat
in order for it to be included in the
[30:52]
hoa this is really
a staff's request for them to do this to
[30:57]
tidy up some of the uh
paperwork and plaid i noticed in the
[31:04]
one of the the issues that was brought
up was the responsibility of the
[31:08]
detention pond who was going to keep
that up
[31:11]
and it says in your report that the
aspen h.o.a
[31:14]
or aspen ridge hoa is going to be
responsible for that do they know that
[31:19]
yes it's um any time that that that
when you go buy a house and you're an
[31:24]
hoa those responsibilities are
outlined in your in your in your in your
[31:29]
covenants
and so they would know that and the
[31:31]
question did come up about that at the
planning commission
[31:34]
and that is the case for this that it is
divided and that's from what my
[31:38]
understanding is one of the reasons that
they
[31:39]
changed the name on parts of the
subdivision was to help clarify that
[31:45]
is at some point in time
our city attorney is going to either has
[31:51]
or will read the hoa
paperwork correct this is under the old
[31:55]
subdivisions
so technically i don't know if they are
[31:59]
if he is responsible for that
[32:05]
but this is under the old old
subdivision regulations
[32:15]
sure i'm sure we can ask for was that
was that if i remember right
[32:22]
a couple city attorneys ago they did not
think
[32:25]
they were responsible for reading the
hoas yes however
[32:29]
but if you looked at the ordinance
they've always been responsible for
[32:32]
looking at the hoas
they just basically didn't
[32:39]
now i don't remember the second part of
that um i do remember that the the
[32:42]
previous city attorney that was here for
for so long she was very insistent that
[32:46]
we had nothing to do with the hoas
but it was in the ordinance that we did
[32:51]
i i don't remember that being in there
but
[32:53]
i i don't i'm not disagreeing with you i
just don't remember it
[32:57]
i know we changed the ordinance so that
that the city attorney would read it
[33:01]
yeah there's clearly we didn't know we
did do a change and it's part of it now
[33:05]
well with all due respect i mean i guess
my question is about making a motion
[33:11]
that it's subject to
this the city attorney's review and
[33:15]
approval that in fact
the homeowner association agreement does
[33:19]
reflect that the maintenance for this
additional
[33:23]
area will be the responsibility of the
homeowners association to maintain the
[33:27]
detention pond
to make sure somebody's maintaining it
[33:30]
because we've had an awful lot of
drainage problems out in that area
[33:33]
and the last thing we need to do is
cause
[33:37]
there to be you know something put in
place that's not being maintained and
[33:40]
kelly looks like she's got something to
add
[33:42]
so not to put you on the spot but
[33:47]
so this is just an amendment to the
entire preliminary plot the applicant is
[33:51]
aware that if this gets approved they
will have to come back and
[33:54]
re-plat which is essentially a final
plot for the aspen rich
[33:59]
section three showing that detention
area so you could make a motion at this
[34:02]
time
to ask that the city attorney review the
[34:06]
covenants whenever they come back for
the replay of aspen ridge section
[34:11]
that's my motion
[34:14]
thank you kelly good motion kelly and
we're on billy we're only doing that
[34:18]
to make
[34:27]
so i assume your motion is to approve it
uh subsequent to the review of the
[34:34]
hoa covenants by our city attorney as
per
[34:37]
ordinance to ensure that this is being
addressed by the homeowners association
[34:42]
on maintenance so i have a motion and a
second any further discussion
[34:48]
all in favor indicate by saying aye aye
opposed
[34:51]
extension motion carries thank you mr
harvest thank you kelly thank you
[34:57]
we now move into new business public
discussion does anyone have anything to
[35:01]
bring before council
[35:05]
hearing or saying none we do have an
executive session attached to this
[35:09]
agenda mr lyon
[35:13]
f1 discussion and consideration of
entering into an executive session
[35:18]

development including the transfer of
[35:26]
property financing or the creation
of a proposal to entice a business to
[35:30]
remain or to locate within the city
and to an open session authorizing the
[35:35]
general manager administrator
um to take action is appropriate based
[35:41]
on the discussion executive session
motion to adjourn from council agenda
[35:46]
and proceed to the municipal authority
agenda
[35:49]
i have a motion to adjourn or to recess
from the council agenda and move on to
[35:53]
the other agendas
all in favor aye opposed
[35:58]
extension motion carries we're here by
adjourned from the council
[36:02]
and a call to order
[36:06]
the midwest city authority our municipal
authority
[36:11]
we do have consent agenda attached to
this these items are placed on consent
[36:15]
agenda
so the trustees by union's consent can
[36:18]
approve routine agenda items by one
motion
[36:21]
if any item proposed does not meet with
the approval of all trustees
[36:25]
or members of the audience wishing to
discuss and not have been removed
[36:29]
and heard in regular order the charity
entertainment motion
[36:33]
i'm going to motion in a second any
discussion all in favor andy cave is
[36:37]
saying aye
aye extension motion carries we now move
[36:41]
into new business public discussion of
the authority
[36:44]
does anyone have anything to bring
before the authority
[36:47]
hearing or seeing none we hereby adjourn
and i call the order of the midwest city
[36:52]
memorial hospital authority and once
again we do have a
[36:55]
consent agenda and these items are
placed on the consent agenda
[36:59]
of trustees when unanimous consent can
approve routine agenda items by one
[37:03]
motion
if any item proposed does not meet with
[37:06]
the approval of all the trustees where
members of the audience wish to discuss
[37:10]
an item
it will be removed and heard in regular
[37:12]
order charity entertainment
hang on mayor robert we need to pull um
[37:18]
number five
yeah yes go ahead and vote and but we
[37:26]
need to pull number five for a
discussion
[37:30]
four and five
so four five
[37:40]
and six let's just go yeah let's just be
consistent and pull for it three of
[37:46]
those okay the
chair reconsider emotion
[37:55]
got a motion in a second any discussion
all in favor and keep
[37:59]
saying aye aye opposed extension motion
carries
[38:04]
are will you hear these items or are
they yeah we just know
[38:07]
we're going to hear these items so item
let me go with four
[38:11]
first discussion consideration of
declaring lot 9
[38:15]
block 2 aviation acres subdivision aka
5901 will rogers
[38:20]
road surplus had entered into a real
estate agreement with bentwood
[38:24]
investments llc to sell the property
for 98 100 less closing costs
[38:32]
robert you want me to go ahead and read
all three of them which one are we
[38:41]
yeah we'll have to do a motion on each
one let me read all three of them
[38:45]
discussion consideration proving an
economic development agreement with
[38:48]
bentwood development llc
to construct a multi-family project on
[38:52]
block two aviation acres subdivision
and then number six discussion and
[38:57]
consideration of authorizing
williams bach for she and bullard pc
[39:02]
grubbs consulting llc and bitwood
investments llc to act as
[39:07]
agents for the midwest city memorial
hospital authority
[39:10]
in the preparation filing and
representation of zoning
[39:14]
indoor planning applications to the city
of midwest city
[39:17]
mr coleman i wanted to go over a couple
of minor corrections
[39:20]
with you in both the real estate
agreement and the economic development
[39:24]
agreement
these would have been included in your
[39:27]
packet if we got them in time but we
received these
[39:30]
yesterday the real estate council
in this matter had a chance to review
[39:35]
the real estate agreement
and the changes that are proposed are
[39:40]
highlighted
in the contract that i just passed out
[39:44]
and that includes a a couple of minor
amendments
[39:48]
but they also added language on the
second
[39:51]
and third page of the agreement as well
as the fourth page of the agreement
[39:56]
that concerns zoning these lots are not
zoned multi-family at this time
[40:02]
and the buyer would like to
have that matter resolved before they
[40:07]
agree to close on the property and when
i talked to ms oakley she didn't have
[40:11]
any problem with what they were
proposing
[40:14]
and so we recommend approval
of the the real estate contract
[40:20]
as you see it
i'll answer any questions do we have a
[40:27]
timing issue on this robert that
since these didn't go out as part of the
[40:32]
agenda items that
are available for public review do we
[40:36]
have a reason why we can't delay this to
take this up next time
[40:42]
i don't know of any reason you can't
delay it
[40:54]
provided the items were placed on the
agenda accordingly and provided that
[40:58]
this information has been provided to
the public at least at this meeting
[41:02]
it would me that would meet the open
meetings act
[41:06]
requirements now if the
city council believes that you have not
[41:11]
had enough time to review these
obviously that's what's in the city
[41:14]
council's discretion as to whether
you would like to have a chance to
[41:17]
review them and bring this back up at a
subsequent meeting these changes don't
[41:23]
affect the title
as published on the agenda
[41:29]
my concern is just we've had a
constituent show up in the gallery
[41:32]
and complain about not being able to see
things that are posted
[41:36]
and so that's what where my concern goes
to since they weren't posted items
[41:40]
yes the notice was posted and yes i'd
refer to the city attorney in terms of
[41:44]
the legal sufficiency of the notice it's
just a matter of the substance of that's
[41:47]
not available so that was what my
question went to
[41:50]
if everybody's comfortable with it and
if we have a timing issue then certainly
[41:55]
none of these uh corrections affect item
six
[41:58]
only uh four and five
so there's really no need i mean other
[42:04]
than language changes everything
remains the same yes sir
[42:10]
a motion to approve the real estate
contract as
[42:13]
amended okay do we
emotion do we need to bring in the
[42:18]
zoning guns because isn't there a
question you need a vote on each one of
[42:21]
these individually
[42:28]
i have a motion on the floor to pass
number four as amended
[42:32]
okay but really quickly number four
reflects a circle on the purchase price
[42:35]
but doesn't reflect the same purchase
price as what's in agenda item number
[42:38]
four
so is the purchase price ninety eight
[42:41]
thousand one hundred
it's ninety eight thousand one hundred
[42:44]
dollars less closing costs
okay that because it says 95
[42:49]
100 on the actual contract i think that
may include some of the closing costs
[42:55]
because we've agreed to pick some of
them up
[43:01]
so the motion is on the 98 000. it's on
98
[43:05]
100 which is what the agenda item is
[43:11]
i have a motion on the floor
i have a motion and a second all in
[43:16]
favor and keep saying
opposed opposed it doesn't conform
[43:22]
so i can't explain uh
motion carries uh item number five
[43:30]
discussion consideration improving the
economic development agreement
[43:35]
there is uh really only one change of
significance and that's found
[43:39]
in article 1 under the purpose of the
agreement
[43:42]
the buyer slash prospect
has inserted language as is highlighted
[43:49]
as section 102
as far as the attorney the term of the
[43:53]
agreement
the term of the agreement shall become
[43:55]
effective upon execution by all parties
and it shall continue
[43:59]
in full force in effect until one
completion of the project evidenced by a
[44:03]
certificate of occupancy
issued by the appropriate authority or
[44:07]
two default of either party is set forth
in section five or
[44:10]
three upon mutual agreement of the
parties buyer may terminate the
[44:13]
agreement
uh on reasonable notice for reasons
[44:16]
consistent with
terms of sections three four and eleven
[44:20]
of the real estate agreement
in other words if the zoning is not
[44:26]
approved
then this would be null and void
[44:34]
and there was a change to an address in
the back on where we're supposed to
[44:37]
deliver notices and those are
the really only two substantive changes
[44:46]
who i do who who reviewed this one
dan mcmahon
[44:55]
and he's serving as just for economic
development contracts
[45:10]
any questions mr coleman i don't like
voting on things i don't understand
[45:14]
sorry no problem uh charity entertained
a motion
[45:22]
second got a motion and a second any
further discussion
[45:26]
all in favor and keep saying aye aye
opposed
[45:30]
abstentions abstain motion carries
uh item number six discussion
[45:35]
consideration authorizing
william box four shea and bullard
[45:42]
grubbs consulting llc and bentwood
investments to act as agents for the
[45:46]
city
of midwest city hofstra memorial
[45:48]
hospital authority in preparation filing
representation
[45:51]
of zoning amendment planning
applications to the city of new west
[45:55]
city
there are no changes to this item i'm
[45:58]
sorry
there are no changes to this do we have
[46:01]
an agreement for it or no
[46:04]
an agreement no just just what you see
in your packet
[46:12]
and this is standard procedure correct
we've done it before with sooner
[46:15]
investment
[46:19]
any further questions charity
entertainment motion
[46:24]
second i had a motion and a second need
for a discussion
[46:29]
all in favor indicates saying aye aye
opposed
[46:33]
extension motion carries thank you mr
coleman thank you
[46:37]
uh we do have one discussion item uh mr
lions no action needed no action needed
[46:44]
on the number one discussion item
we now move into the new business public
[46:48]
discussion does anyone have anything to
bring before the authority
[46:52]
hearing or saying none we hereby adjourn
and i call to order the special economic
[46:56]
development authority
we do have a consent agenda and these
[47:00]
items are placed on consent agenda
so trustees by unanimous consent can
[47:04]
approve routine agenda items
by one motion if any item proposed does
[47:09]
not meet with the approval
of all trustees where members of the
[47:12]
audience wish to discuss an item
and be removed and heard in regular
[47:16]
order
[47:18]
all right motion in a second discussion
all in favor indicate
[47:22]
saying aye opposed abstention motion
carries now move into the public
[47:27]
discussion of this agenda and to see who
wouldn't have anything to bring before
[47:30]
the authority
hearing or saying none we are hereby
[47:33]
adjourned and i
entertain a motion to reconvene on the
[47:37]
council agenda
second the motion is second all in favor
[47:43]
opposed the
council agenda we're called back to
[47:49]
order on the council agenda
and we will be moving into executive
[47:53]
session
executive session will be here held here
[47:56]
in the council chambers
and thanks everybody for
[48:02]
attending
