business is our meeting schedule. And be it resolved by the planning board of the

township of montgomery that the planning board will meet in 2026 on the second and the
[3:41]
fourth monday of the month, and that the monthly meeting dates of the board are hereby scheduled on the following dates to commence at 7 p.m. In the municipal building located
[3:50]
at 100 community drive, skillman, new jersey. All interested persons may attend
[3:54]
and be heard. Special work sessions scheduled periodically will be noticed as required.

upon scheduling, this notice shall be transmitted to the officially designated
[4:05]
newspapers and filed with the clerk of montgomery township. Those dates in 2026 are january

26th, february 9th and 23rd, march 9th and 23rd, april 13th and 27th, may 11th, june 8th

and 22nd. July 13th and 27th. August 10th and 24th. September 14th and 28th october 12th.

november 9th and 23rd. December 14th and then the reorganization meeting will be
[4:39]

special work session schedule periodically will be noticed as required upon scheduling. This
[6:33]
notice shall be transmitted to the officially designated newspapers and filed with the clerk of montgomery township. All interested persons may attend those portions of the

meeting that the applicant is being heard. Those dates are february 3rd, march 3rd, april
[6:49]

township notices will be posted on the montgomery township website and will be available

will be on the various subcommittees. First is the master plan land development

ordinance update committee that meets from six, 6 to 7 p.m. On the second and fourth mondays.

so there will be an hour before the planning board meeting. The members are. Mayor and myself
[9:29]
and marvin schuldiner and arun mani. Site plan subdivision committee meets the first
[9:35]
tuesday of every month at 8:30 a.m. Via zoom. Members are. I'm sorry, patricia taylor todd

paul blodgett, mayor, and myself. And then marvin schuldiner will be the planning
[9:52]
board liaison to the transportation advisory committee that meets on a
[9:56]
quarterly basis. And the planning board liaison to the edc economic development

commission will be our. And marnie. And I believe those are our committees. I have a
[10:10]

item is the appointment of professional services under the local unit pay to play law. And
[11:48]
the professional services resolution is resolution oh one dash 2026. Look at that. The

first one. Whereas there exists a need to acquire the following professional services for 2026
[12:01]
without a fair and open process as defined by pl 2004 c 19, the local unit pay to play law that
[12:10]
includes the planning board, attorney, planning board, planner, planning board, landscape architect, planning board, traffic engineer and the planning board engineer. And
[12:20]
whereas, the montgomery township purchasing agent has determined and certified in
[12:25]
writing that the value. I'm sorry, just making sure the value of the services over the
[12:30]
course of the contract is anticipated to exceed $17,500. And whereas the new jersey
[12:37]
local public contracts law njsa 40 a colon 1101 authorizes the award of professional services
[12:45]
contracts without competitive bidding. And whereas the chief financial officer has certified
[12:49]
that sufficient funds are available for the aforesaid services in accordance with the
[12:54]
amount set forth in the 2026 temporary budget, with performance of said services
[12:59]
after march 31st, 2026 being subject to the township's amendment of the 2026 temporary
[13:06]
budget and or adoption of the final 2026 budget. Now, therefore, be it resolved by
[13:11]
the planning board of the township of montgomery as follows. And the chairman is
[13:16]
hereby authorized and directed to execute a proper agreement with the following the law.

hence, as our planning board planner and just. Thank you and clarke caton hintz, as well as

our planning board landscape architect, tnm associates as planning board, traffic

is awarded for a period of one year for the amount set forth in the contract and without

competitive bidding as professional services under the provisions of the local public

contracts law. Njsa 40, a colon 11 51a as contracts for services to be performed by
[14:10]
persons authorized by law. To practice recognized professions that are regulated by law, and
[14:15]
because the services to be performed are not susceptible of quantifying in bid
[14:21]
specifications. Everyone got all that these contractors have completed and filed with
[14:27]
montgomery township a campaign contributions affidavit as required by njsa 19. Colon 44
[14:35]
20.2 certifying they have not made any prohibited contributions to a candidate
[14:39]
committee or municipal committee representing the elected officials of the
[14:44]
township. A copy of this resolution, the certificate of contract value, the campaign
[14:50]
contributions affidavit and the executed agreement shall be placed on file in the office of
[14:54]
the planning board. The notice of this action shall be published once in the official
[14:59]
newspaper, as required by law and performance of services under the terms of these
[15:04]
contracts and payment for services is subject to the certification of availability
[15:08]

2025 stormwater management element as an amendment to the montgomery township master plan.

pb oh 323. The applicant is harlingen associates llc. It is for block 6001. Lots 3334 34.01,

35, 35.01 and 36 route 206 montgomery township. It's an extension of preliminary and
[16:45]
final major subdivision site plan approval to january 8th, 2027, and for the applicant,
[16:54]
richard johnson, attorney. Good evening. Good evening. Here to get an extension of vested
[17:00]
rights under njsa 40, column 55 d hyphen 52. We got preliminary and final site plan,
[17:09]
subdivision and bulk variances, design waivers, exceptions on. January, the resolution was
[17:24]
adopted on january 8th, 2024. So our time is up for vested rights as of january 8th of
[17:31]
this year. Was approved by the planning board in november of 2023. This is the application
[17:39]
for two story, two story, affordable market rate mix housing apartment buildings
[17:46]
with 18 apartments, 11 of which are affordable. As your third round obligation on the mount
[17:54]
laurel. Seven of market rate at 36 three bedroom townhouses. You recall that this is one
[18:02]
where we're doing extra work for the township, for sanitary sewer, to bring the sewer line
[18:12]
across down the rutland road to the manhole, and then the township then will decide to
[18:20]
connect to the properties in harlingen village, which have failing septic systems, which
[18:28]
have been failing since I came to town about 50 years ago. So it's it's a real boon to the
[18:36]
town. Beside being your third round obligation. So what have we? What have we been doing in
[18:42]
the last two years? We got somerset planning board approval on august 9th, 2025.
[18:51]
we got somerset union conservation district approval on site on june 4th, 2025, we
[18:59]
got new jersey dep approval for the stormwater discharge general permit on site approved
[19:05]
on january 26th, 2021. We have somerset union soil conservation district for the
[19:11]
all on site soil, sediment sediment control certification on june 30th, 2025. That's for
[19:19]
the sewer line we got doing dnr canal commission approved certificate of approval
[19:26]
received on october 15th, 2025 fret freshwater wetlands statewide general permit number
[19:34]
two for force for the force main crossing, the fox brook gp. General permit number six for
[19:41]
filling up the swale and a gp ten a for a driveway crossing and a transition area waiver
[19:49]
averaging. It was submitted by our environmental consultant, environmental sciences on
[19:55]
862024. I've been advised that it should be approved within a month. We got approved njd p
[20:05]
approval for the flood hazard area verification method six on september 16th, 2025 we got
[20:15]
njdep approval for freshwater wetlands. A letter of interpretation approved on
[20:22]
january 7th, 20222020. The nj permit for flood hazard area verification was approved on
[20:32]
august 29th, 2022. Let's see what else. We've done. Various easements and other things in
[20:43]
order to. Get our plans approved, which are being reviewed by mr. Darcy's office.

revised plans. We've had comments and so did mark herman, your engineer. And let's see
[21:01]
for that. We got the cross easement approved on the november on october. Sorry,
[21:17]
november 11th, 2025. We got the municipal services agreement approved on on december 15th,
[21:28]
2025. We got the drainage easement for the open space lot approved on october 29th, 2025.
[21:37]
we got the driveway easement because if you recall on this one there, the driveways
[21:45]
crossed into the common area, and that was a condition of the resolution drawn by miss casey
[21:50]
that was approved on july 9th, 2025 open space dedication. There's open space lands. We
[21:58]
submitted our environmental audit was approved by miss wasikowski. We have to clean up
[22:07]
some garbage, which we agreed to do. We completed the construction sequence agreement,
[22:12]
the affordable housing agreement. The deed restriction for affordable housing was done
[22:18]
today. Was approved today. I did a contract for a temporary construction access easement
[22:28]
for your public works. That's the offsite sewer that's being reviewed by mr. Herman and miss.
[22:37]
mrs. Quiroga. A temporary construction access agreement between montgomery and the ems,
[22:44]
the first aid squad, which is finally signed. Let's see what else we have. And we sent in
[22:57]
our homeowners association papers last week through mark herman wanted a certain
[23:07]
restriction on the stormwater. Stormwater facilities. We said that in he's reviewing that and
[23:19]

easement that we had to get from richard meier for the sewer took for a long time,
[23:33]
because you had to get an appraisal and you went back and forth and back and forth with
[23:38]
mr. Myers attorney. And that was only done on may. The easement was dated on may 25th

at 2025, and that prevented us from going on to his property and doing soil testing, in
[23:53]
which delay the sewer, which we now have. We do have the sewer. Bids in approved by mr. Herman,
