Good evening, everyone. Welcome to our special meeting of council of Montreal West held by held virtually on February 18th, 2021. My name is Benny Masella.
[0:14]
I'm joined tonight by councillors Dino Metzoni, Elizabeth Eulen, Colleen Feeney, and Maria Torres, as well.
[0:22]
And we're joined by Maître Raphael de Stasio, our director general, and Maître Claude Gilbert, our town clerk.
[0:28]
This session of the Council was held in Bicclo and members of the Council assist in a virtual way,
[0:34]
according to the Ministerial Rites of 2021-074 of October 2, 2020 of the Ministry of Social Services.
[0:46]
So, if I may have the opening of the session, please.
[0:50]
Yes, Mr. Lever, I propose opening the session.
[0:54]
[1:17]
to 18 February 2021, tell que presenté.
[1:24]
[1:33]
Oui.
[1:35]
Number three, the city of Beaconsfield lawsuit against the city of Montreal and the Quebec
[1:40]
government and the retaining of a lawyer on behalf of the town of Montreal West and other
[1:44]
related municipalities. So this is an action that's being undertaken by the city of Beaconsfield.
[1:53]
They're taking the minister of municipal affairs and the city of Montreal to court
[1:58]
because they don't agree with the way that a ministerial decree was being applied.
[2:05]
And that's their right to do that.
[2:07]
They've now, unfortunately, they've included all the demerged towns as interested third parties.
[2:12]
So this is a motion whereby we're hiring a lawyer, all the other demerged towns are hiring a lawyer
[2:18]
to defend our rights if this case ever goes to trial.
[2:23]
The other members of the ASM are of the opinion that the proper way and the more fruitful
[2:29]
way to come to an agreement is by sitting down at the negotiating table, and that's
[2:33]
what we're going to be doing with the city of Montreal and being overseen by the Minister
[2:37]
of Municipal Affairs.
[2:39]
Unfortunately, this lawsuit now has delayed that process for, it's already two weeks,
[2:43]
it's being delayed now because now there's this whole other level of bureaucracy that
[2:47]
has to be undertaken to ensure that what's said at that negotiating table stays at the negotiating
[2:54]
table. So like I said, the ASM is of the opinion that the better way is to negotiate a settlement,
[3:00]
but unfortunately Beaconsfield is chosen this way. We don't think that this is the fruitful way.
[3:05]
Any changes that come about by this court proceeding will cause very little difference in
[3:12]
what Montreal pays and what Beaconsfield recuperates will come at the expense of other
[3:18]
So, if I can have somebody make the motion to adopt this, please.
[3:23]
Yes, Mr. Mayor.
[3:26]
Whereas the Minister of Municipal Affairs and Housing published in the Gazette officielle du Québec on December 4, 2020.
[3:34]
The order concerning rules to establish the fiscal potential of the related municipalities of the urban agglomeration of Montreal.
[3:42]
for the purposes of apportioning the agglomeration expenditure, the order, whereas the Ministry
[3:50]
of Municipal Affairs and Housing published in the Gazette d'Officiat du Québec on January 15,
[3:57]
2021, and a ratem to specify in section 3 of the order that the task force shall be composed
[4:04]
proposed of City of Montreal and Association of Suburban Municipalities, ASM, representatives,
[4:12]
in order to review the apportionment terms of aliquot shares, notably the calculation
[4:18]
of the fiscal potential of any other sustainable solution, and report on this to the Minister
[4:24]
by August 31, 2021, whereas the related municipalities of the urban agglomeration of Montreal, through
[4:33]
through the Association of Suburban Municipalities have assured the Minister of Municipal Affairs
[4:39]
and Housing of their willingness to be involved in the committee as decreed in the ministerial
[4:44]
order, whereas the City of Beaconsfield filed an originating notice of motion for judicial
[4:51]
review with the Superior Court on January 15, 2021, against Quebec's Attorney General
[4:57]
and the City of Montreal, whereas the related municipalities were all named as third parties
[5:03]
by the city of Beaconsfield in said motion, whereas the filing of this motion by
[5:08]
the city of Beaconsfield raises considerations for the interests of
[5:13]
Montreal West on agglomeration taxation, whereas the town of Montreal West
[5:18]
intends on exercising its right to full review and defense, if need be, in this
[5:25]
originating notice of motion for judicial review, whereas
[5:29]
the town of Montreal West has adopted a bylaw concerning contract management in accordance
[5:35]
with section 573.3.1.2 of the Cities and Towns Act. Therefore, I move first that the services
[5:49]
of the law firm, McCarthy-Tetro-SEN-CRL, SRL, to be retained to this end. Second, that
[6:00]
this legal mandate be deemed essential as part of the motion to the Superior Court in
[6:05]
which all the related municipalities are named as third parties. Third, that an amount not
[6:11]
exceeding $5,000 be approved for all necessary expenses to this end by each one of the related
[6:18]
municipalities. Fourth, that the city of Dorvala be appointed as the drop point for the payment of
[6:25]
the fees of McCarthy-Tetro SCN-CRL-SRL by all municipalities involved in this motion.
[6:33]
And fifth, that the management of this mandate be delegated to the ALEQUAT share committee
[6:38]
of the related municipalities, being made of Mr. Vincent Obida, Executive Director of
[6:46]
the ASM, Mr. Martin Bonham, Director General of St. Anne de Bellevue, and Ms. Natalie
[6:52]
Rayom, Treasurer of Tanama Royal.
[6:55]
Thank you very much, Councillor Feeney. Can I have a seconder, please?
[6:59]
Yes, I second that.
[7:01]
Thank you very much, Councillor Euland. All in favour, please?
[7:04]
Aye.
[7:05]
Thank you very much.
[7:07]
[7:32]
And we also use it for the purchase of mazout for heating, the heating island.
[7:39]
So that's a good group, that's our participation in a good group for the purchase of diesel and bio diesel.
[7:47]
So I can see someone to do the, please.
[7:51]
Yes, thank you, Mr. Lemaire.
[7:53]
Thank you.
[7:53]
It is expected that the service of the provisioning of the city of Montreal to deal with the city
[7:58]
of Montreal West, to participate in a call to regroup at the end of the judgment of
[8:06]
contract for management and the supply of carbon, diesel and biodiesel, piloted by the
[8:13]
SPM.
[8:14]
It is expected that the forecast economy, thanks to such a strategy, justifies to accept
[8:20]
the DIT-OF.
[8:21]
[9:04]
Thank you very much, and that's just to give a little summary. Again, we've gotten together
[9:09]
with the city of Montreal in the past to purchase other things. Just at the end of last year,
[9:13]
we got together with the city of Montreal to purchase, to have a group purchase for
[9:18]
And we've done in the past also for heating oil. In this case here what we're doing is we're getting together with the city of Montreal and in this case more specifically with the STM to buy diesel and biofuel for our fleet of vehicles.
[9:32]
So this is just one way usually we end up saving the significant amount of money considering the small amounts that we purchase relative to some of these other people, but we end up paying the same price as they do per leader.
[9:43]
[9:58]
Oui, je propose de lever la séance. Merci la conseillère, toi. Et je peux avoir la
[10:03]
puit, s'il vous plaît. Oui, je la puis. Merci la conseillère, Yolaine. Tout en faveur, s'il vous
[10:10]
That's it, folks. Our agenda is finished, so I appreciate you joining us tonight.
[10:17]
Our day is over, so thank you for joining us tonight.
[10:22]
And we'll see you on Monday evening.
[10:26]
It will be February 22 for our regular session.
[10:30]
We'll get together again on Monday night, the 22nd, for a regular Council meeting.
[10:34]
Thank you, Ponswati.
