[3:29] related to our sidewalk project the Safe Streets to school project where we will

[3:34] be um having to do some some work with with property owners to um take some of

[3:41] their properties take some of their some of the fences off replace things so

[3:46] we're trying to work on a process that limits the um the cost and exposure for

[3:52] our residents um the next resolution is for

[3:57] us to authorize um pilot agreement for Rockland Gardens um when we get to that

[4:04] um we'll we'll talk a little bit more about that um I understand that the town

[4:08] of Orangetown has tabled their approval um and so for further discussions they

[4:13] wanted to ask some questions of their assessor um the next one is for us to

[4:22] approve um the installation of a commemorative plaque um naming the

[4:26] Gazebo Memorial Park after Bert and Chris Hughes

[4:31] the next is for us to approve um a stargazing in Memorial Park on the

[4:37] Memorial Park viewing Pier um for for the week of 20 October 22nd to 27th at

[4:44] least once hopefully the skies are clear for for Joe Carlin to lead and the last

[4:49] is for us to um award um another of our sidewalk repair projects to Belleville

[4:58] Landscaping um for Main Street any comments on any of those

[8:07] litigation um that in my legal opinion we have conducted this survey correctly

[8:14] with compliance with the applicable law there's not a ton of law out there but

[8:18] from what I've uh researched and reviewed carefully and also spoken to uh

[8:24] some colleagues in the municipal attorney sphere

[8:29] um I'm comfortable that we The Village through Andy um have performed this

[8:36] survey study for vacancy rates in compliance with the law as it stands

[8:43] today that's all I can really share about that thank you and um of course

[8:48] Andy can talk about the mechanics of conducting the survey which was his well

[8:54] I I think we've actually done that a couple times in public session I think

[8:58] the one thing thing that we did do was um we did receive additional information

[9:04] and the reason for tabling this motion at the last meeting was for us to

[9:08] consider it to give fair look at it and then and then to decide whether we

[9:13] should move forward we've done that we've added a section into the

[9:17] resolution regarding that which anybody can look at if they want to is there any

[9:24] other clarifications or questions of the yes than please I'm assuming all the

[9:30] trustees have read the draft resolution the proposed resolution um if not maybe

[9:37] suggest that we take a minute or two to review it now I just like sure this is

[9:43] an important one so yeah so if you haven't reviewed it if you could just

[9:47] read it over real quickly if you have you have any questions about legal

[9:51] question or mechanical for Andy regarding the conducting of the survey

[11:32] everybody that worked on this this was a very careful painstaking and extended um

[11:39] approach that they took and very disciplined and I appreciate the work

[11:43] they did to make sure that it was done precisely and um that we got good

[11:49] information reliable information that we can act upon so thank you Andy and

[12:18] additional email from from an attorney of a coalition of landlords um which

[12:29] to us and I want to make sure for the record that it's stated that we are

[12:33] willing and will continue to work through that process um as we move

[12:39] forward so that um just I just want to make sure that the public is aware that

[12:43] we have received that um and that we will um consider it just like we've

[12:48] considered anything that's come before us about this issue just want trustees

[12:53] the next step is to schedule an actual public hearing on whether or not to

[12:58] declare a housing emergency in the village of n act that's by public

[13:02] hearing I'll prepare that a with vany get that published and uh so we have not

[13:07] declared tonight we have not declared a housing emergency this not this is not a

[13:12] declaration of a housing emergency it is simply the accepting of the survey um

[13:18] that demonstrates a housing emergency based on us do we need a resolution to

[14:30] process will continue this just gives us the ability to um to use Grant funds to

[14:35] to do to make that happen any

[15:57] a certain number of years um it's not a tax impact right so

[16:02] there's no impact on our taxes um only on the assessment of the building so our

[16:08] taxes will remain the same we just won't have the assessment of the building will

[16:14] not go up until the Pilot is is finished and it will phase in if I understand it

[16:20] correctly when I read it I believe it goes

[16:24] 6.8 so um any questions I I understand the town of Orange

[16:29] asked for um some clarification from the assessor before they wanted to vote on

[16:34] it um we can vote on it before they do don't yeah I would recommend that we do

[16:40] to show um to show the the the owner that we this is a positive thing for for

[16:47] our subsidized housing to get it completely um refurbished and and and

[16:53] worked on and it will be a positive thing for our residents and it will not

[16:57] be increased act end up in an increase in their rent so this is quite an

[17:02] accomplishment and we should really I think be thanking on rock and Gardens

[17:07] for for the idea and the process to get us here so I would suggest that we vote

[17:13] on it tonight um and then let the town of Orangetown make their determination

[17:23] it's a tax I believe the school passed pass

[22:33] can't after the Kingston law oh so you're talking about the emergency

[22:37] tenant protection act and what are you talking about for the

[22:41] fire um from what I've uh been informed that the fire department find uh the the

[22:48] management of 197 sickles for improper uh management of uh equipment so they

[22:56] were using illegal will uh varnish and things like that uh in

[23:02] the building and also without the uh permit for the

[23:10] town I am not aware of those violations so we don't normally get those

[23:16] violations sent to us those are normally handled through the Justice Court um so

[23:20] I don't know if we can actually respond but we can certainly find out and let

[23:23] you know unless um we did have S will fire

[23:29] excessive false along cases excessive false along cases it sounds like you're

[23:34] referring to a different type of violation they were in court a couple of

[23:38] weeks ago sadly or disappointingly none of the defendants

[23:42] showed up I've been I've been working with the building department fire

[23:46] inspector to try to address that that problem of lack of appearance by code

[23:54] violation defendants but there were set sets of false alarms uh not something

[23:58] that you just described I I'm not sure you're talking about no you're talking

[24:03] about7 C Avenue I don't alarms that we do have uh from the fire department was

[24:10] a lot of times with the time Hotel the time hotel we have excessive alarms that

[24:15] went off and there was no reason for the alarms to go off but with uh the uh 19

[24:22] 197 sickles it was about varnish and the contractors us

[24:28] things that were not supposed to be used and was toxic to people

[24:34] that that may have been on the court calendar but if it was the defendant did

[24:39] not show up but I don't think it was um as as the mayor pointed out

[24:45] uh Village administrator and I will will contact Building Department fire

[24:50] inspector and see what's happening 197 second can you leave a email address so

[24:56] that we can or or phone number that we can correspond with you after we find

[24:59] get to the bottom of it absolutely because the fire department you normally

[25:04] is not in the business of issuing summonses that's usually done by our Co

[25:08] enforcement fire inspector so this was this was back in the time when Dana

[25:12] Nichols was still the was 101 of the and now it's changed over to J pill

[25:22] right so as J came then you start cracking down on the things that were

[25:29] going wrong sure well have have Jim give either Andy or I a call but we'll get

[25:34] the information for you if there's something that he needs from us he I'm

[25:38] not aware of him I haven't been in contact with Jim for a couple weeks

[25:43] about any of these issues so I'm not aware of the specifics that you're

[25:47] talking about so if you want to have Jim either contact myself or Andy he has our

[25:53] cell phones well the reason I the reason that I was asking is because since I've

[25:58] been a resident there for the last 15 years and I've seen all everything

[26:04] changing back and forth that's why I'm concerned with a lot of other residents

[26:09] that are here with me and so there is I don't want to say that there's you

[26:18] know sliding of the hands but uh we all do know that there is sliding of the

[26:23] hands going across the board so I want to see if that is something think

[26:28] because this is I'm a person that lives in the neighborhood I worked in the

[26:33] neighborhood I was I left the neighborhood because I was pushed out

[26:37] because I fell out of business and I still live in the

[26:41] neighborhood but the most important thing is the safety for our children and

[26:46] our community we we agree with you 100% I um so we'll we let us let us do some

[26:52] research to find out um well I'm not going to agree with you or disagree with

[26:56] you about slight of hand on anything but let us do the research and we'll figure

[27:00] out um the issues that you're bringing we can trade information across the

[27:05] board with uh emails and uh everything else so that we we can stay in

[27:10] communication with each other we we will be happy to email you

[27:15] any of the information you of course can email us anytime or come to any meetings

[27:19] and raise them again but we're not I'm not just not familiar with the issues

[27:22] you're bringing up so I can't really respond we talked about it three months

[27:25] ago three months ago before I disappeared and it was all about the

[27:29] housing and the legal building and everything else that was happening and

[27:33] that was only the beginning of uh well I don't recall that discussion so and we'

[27:39] about church the church came and Wasing as well about the uh situation about the

[27:46] rent increase across [Music]

[27:50] town violations are different that that requires a different type of response

[27:54] the response the issue that you brought up about the rent increase has been

[27:58] something we've been meeting about regularly since then culminating in

[28:02] today accepting the vacancy study on the etpa been some advice about information

[28:07] that I need to figure out but at the same time like so if they

[28:13] have violations how do they pay a a fine and the village doesn't know about the

[28:18] fine no The Village doesn't know it's said I don't know I wouldn't I don't

[28:24] there's lots of fins that are given out in the village and I have no idea who

[28:27] they're giving to um so it's that I don't know it's not that the village

[28:31] doesn't know I'm sure the Village Court is very aware of every fine that's been

[28:35] given out the building Department's aware of every of every code violation

[28:40] that they've made but I don't have that information to give to give you feedback

[28:45] and this is I'm s unless I'm completely forgetting the only thing that I

[28:50] remember you bringing to us was the rent increases and we have been working we've

[28:54] been working diligently on them and building they didn't use any permits

[28:59] they reuse one permit and and our building inspector went up our building

[29:03] inspector and fire inspector did go up but I don't know what the results of

[29:07] that was but we will find

[29:10] out thank you because as as a member of to go into a building and other

[29:18] buildings where people are doing things illegally and I'm GNA put my life on the

[29:22] line as I PID completely agree with and I don't get paid anything to

[29:39] community but at the same time needing to know and understand what's going on

[31:07] certainly upsize the property he has right now and probably bu more than one

[31:12] but not being satisfied with that he wants to put multif family housing there

[31:16] he obviously has good lawyers and understands that if he just ask for SE

[31:19] Amendment based on one it's back summoning we not going to do that so he

[31:23] carved out a niche of six about six properties of a certain size

[31:27] and he saying to well let's change it and up Zone that and everyone knows

[31:31] affordable housing is good and therefore we should do this to these six

[31:35] properties and that won't have a huge impact but the truth is it would have a

[31:39] huge impact in our neighborhood you'd end up with smaller properties in

[31:43] between multif family housing on gney it is a small block um as people have

[31:49] testified beforehand there are lots of parking issues in the neighborhood

[31:54] although it's a two family Zone it's mainly one family housing and we are not

[31:59] interested in having neighborhood change n has a master plan if you're going to

[32:04] change the zoning in the community you should do it through a master plan we

[32:08] see no reason why you should spend money on the resources NX resources because

[32:12] someone individual wants to change the zoning with his property and it does not

[32:18] benefit any of the neighborhoods and any of our neighbors and we're all V opposed

[32:24] I think a lot of people aren't here tonight there's a lot going in world in

[32:27] the world at the moment but they certainly all showed up at the zba

[32:31] meeting and they signed a petition and they let you know loud and clearly that

[32:35] they did not want up zoning in our neighborhood that we har our property

[32:40] values that we love our neighborhood that we want to live in this

[32:43] neighborhood we bought homes knowing that it was two family residential

[32:47] neighborhood and we're very satisfied with that and we would like to keep it

[32:51] that way and we ask you to vote no and to represent the community and your

[32:56] community does not want you to up Zone these blocks so thank you thank you

[34:16] the to the Jewish community so we wanted to make sure we acted quickly and and to

[34:22] try to help people to kind of get through where we are right

[34:36] Andy that our Fine Collection in the Justice

[34:41] Court this through my prosecutorial work has brought in

[34:49] significantly higher numbers than I guess the past and I only say that

[34:55] because it it's something that I think I've heard over the past n months or so

[35:03] about quality of life people speeding not coming to complete stop stop signs

[35:07] going through red lights and by being a little bit more aggressive with the

[35:11] findes U maybe the word gets out that hey slow down come to a complete stop

[35:16] the stop sign stop with red lights maybe it

[35:21] will eventually improve the quality of life when it comes to Traffic Safety so

[35:26] I'm happy to accept that report from the village administrator and I hope to

[35:31] continue to uh send the message out on the street that a new

[35:36] sheriff well thank you Dennis and I think it also speaks to what we heard

[35:42] about making sure that we're that we're following through on our finds and

[35:46] Notting not allowing people to just do things that they shouldn't be doing in

[35:51] their vills and being very very diligent about that and making sure that we have

[35:55] the the process to let this gentl know I missed your

[35:58] name I'm sorry um I have been in communication with the uh attorney

[36:03] representing the board of fire Commissioners and um expressing to me

[36:07] the board of fire Commissioners very serious concern about the excessive

[36:11] false alarm problem and I'm treating that very very very seriously and um

[36:18] unfortunately these last several defendants that were supposed to appear

[36:53] information to the board at our next meeting um you did have in your packets

[36:57] and posted online a um a year to date for the first quarter um

[37:03] and in terms of fines through the court system um dramatic Improvement compared

[37:10] to last year I know there's a backlog I think Dennis has really been working

[37:14] hard so again I want to also commend Dennis for his hard work working with

[37:18] Ryan and Alexandria and judge Noble and others to um to run a tight ship there

[37:25] so thanks for that um so we'll have a full planishing

[37:29] report for you on the 26 while you have that in hand if you

[37:34] have any questions or things you want us to focus on for that report please let

[37:56] project right now we've been we had two things

[37:59] going on this week one was a piece of the tap Broadway sidewalk project which

[38:04] was a burying of of electrical lines between light poles in front of P book

[38:09] shop and south of Bird Street that was completed this week and um they have a

[38:14] couple little things to do to finish up their

[38:17] project um we may have enough money left after all the billing we're waiting to

[38:22] see to do more next year so we obtained proactively an extension on that

[38:28] contract with the state in case after we pay the remaining bills to attack hva

[38:34] and play and that we're we can assess whether we have enough to take on

[38:37] another section of the sidewalk which would be nice of course

[38:42] um we also have sidewalk work going on heading down South Broadway in front of

[38:46] tman towers the brick house and a nyak center that cdbg funded um Tera Firma

[38:52] has doing a great job they're working fast they're about to turn the corner

[38:56] onto few originally we had bid out just the South Broadway section but they came

[39:00] in with a really good price so it's was enough money to make probably all the

[39:04] way up to Franklin on the sections that are that are deteriorated there there's

[39:08] a couple sections that were done fairly recently they're in good shape up by the

[39:12] Franklin Corner it's on Pew Avenue so so we were

[39:17] we're talking with the um man Plaza Housing Authority n Center and others to

[39:23] coordinate um that project will be going up to pew started um probably not Friday

[39:29] but certainly early next week that's great so so that's going on the marina

[39:35] Paving project we're really excited about that's starting this week yeah um

[39:38] because of the rain this weekend um they're not going to go full boore today

[39:43] tomorrow um but they're definitely rallying their forces and mobilizing to

[39:48] to pave that lot which hopefully we'll improve the drainage as well because we

[39:53] get some big puddles down there and we're hoping to see that situation

[39:57] mitigated a

[40:00] bit I wanted to just mention also the mayor mentioned this the last meeting is

[40:05] there's going to be unveiling of a new Memorial sign right here on the corner

[40:08] of Broadway and ler um commemorate commemorating the victims of the Brinks

[40:13] robbery that's on October 20th at 2 o' right before the annual event that takes

[40:20] place at one mountain un I don't know if you want to say more about that but

[40:23] that's it no that's perfect I just um we have date again October 20th at 2:00

[40:29] right out here right outside um we use the Village Hall steps as sort of the

[40:35] the U de and U it's I'm I'm really excited

[40:40] about we've got the sign we're ready to go um and it's it's I think it'll be a

[40:46] great event and then it'll be followed by the by the normal memorial service

[40:50] we've worked very closely with Bob vuro um under Secret Under secretary under

[40:55] sheriff for for Rockman County who has been very active in following up with

[41:00] the families that were affected by that since almost since the day it happened

[41:05] um and uh he's he's been working with the families to make sure that they'll

[41:08] be able to be here for so it's it's will be a nice event you know this is where

[41:14] this is the building that the um police um station was in during that time um so

[41:21] they were actually in our jail here for a while before they were transferred to

[41:26] to the county Jil so very significant event on October 20th that's just so I

[41:33] hope hope lot of people from the public come join

[41:37] us one other item mayor I have for you a draft of our 2024 calendar work on with

[41:44] Amar with circles on the dates proposed for village board

[41:49] meetings and everybody can just check out with their calendars and make sure

[41:53] that you don't have any you can avoid conflict

[41:56] we're going want to approve this calendar before the end of the year so

[41:59] people know what's going on in January February

[42:02] time yeah as the board will remember we usually adopt the calendar at our

[42:07] organizational meeting um we have we're still working through the details so Joe

[42:11] and I have not we have to wait for Joe to actually be elected before the UN I

[42:15] and start talking about it but um we're we'll work on an organizational meeting

[42:21] um to ensure that all of the mayor appointments are made for next year in

[42:25] the time way but that's part of it so please look

[42:30] look it over make sure we've got it right and that you're available on those

[42:35] days one other reminder mayor on the 26 uh we invited the um the leadership of

[42:42] our climate action plan to a workshop at 645 and they had already shared

[42:49] extensive documents drafted to The Village's climate action plan so now is

[42:54] a great time to re-review that any questions you want to email me out

[42:57] forward to Marcy and Steve and the team we try to make sure we're prepared

[43:02] anything the board wants to know when they come in Andy one of the things that

[43:06] I that I think we really need to think about I've read through it when first

[43:12] got it and I was skimming through it as I was looking at all the SM climate

[43:16] smart stuff that is coming through a mayor's conference or fin um and um

[43:23] we're ahead of a lot of people and we I we need a marketing plan

[43:28] to ensure that this is publicized and in a public way um and then we we take the

[43:33] leadership that's what level

[43:42] we this SL clent smart plan will I think put us

[43:46] over but we we you know we've been taking leadership on this and I really

[43:50] think we that we ought to ask them to come up with the way that they would

[43:54] like to see us really put this out last week

[44:00] I just got

[44:03] there spaces so yeah Hastings got their bronze just before we did

[44:11] as yeah this is something that we should be proud of as a village should really

[44:17] put it out there what we're doing certainly with that with the

[44:22] presentation and then the edits and ultimately the adoption of this plan

[44:26] um it's a a lot has been done to get there but the plan includes a lot more

[44:33] to do and there's been a good deal of Engagement by members of the community

[44:38] some very active committees and so I think there's going

[44:42] be a lot more to try it's great anything else that's all I got for

[44:48] now thanks okay um old business is the request for us to consider um uh text

[44:56] Amendment um that's exactly what we're doing we're not considering the text

[45:02] Amendment we're considering whether we want to consider the

[45:06] text so two two considers in

[45:12] there um so maybe we could just um get a sense

[45:18] of the um Dennis can you give us the options again you gave us what our

[45:23] options are our options are to the

[45:27] proposed fourth your option is to just decline to consider it and like i' said

[45:34] as long as your reason for declining um is not based upon a

[45:40] unconstitutional and unconstitutional ground um you don't have that's your

[45:47] legislative discretion you can say you just not interested thank you um one of

[45:52] the reasons could be that you think you're zoning in that particular n

[45:55] neighborhood is good the way it is that's a perfectly valid reason to say

[46:00] we're not interested in considering this proposed text Amendment or the village

[46:05] has other priorities right now that we're focusing on and we uh not to say

[46:09] that another several months this is something that we might consider but

[46:13] right now we have other priorities focus on and if and if we are contemplating

[46:18] considering it our next move would it be to ask for for some advisement from our

[46:23] planner from our village planner yes probably ultimately we have that that's

[46:29] a more formal step would be the village plan get his

[46:34] thoughts so what what's the sense of the board thinking of the board at this

[46:38] point on this you have a question yeah I just had a question I know from I think

[46:43] a couple meetings back one Community member who lived in that area had

[46:49] mentioned the person as um not meeting with them or any or talking with them

[46:54] about any of the plans and they're pursuing I just wanted to know if

[46:57] anything has changed has whoever the owner of this is reached out to the

[47:03] community members in that area talk to them at all I'm just curious if any of

[47:08] you guys know I have no idea yeah out at all

[47:13] no and he's he's U we have not had any representation of the text Amendment

[47:19] itself okay to the board either or to the staff just the just the doctor okay

[47:37] this involves a proposal that was already put forth I think to the was

[47:41] planning board CBA that's the CBA for I guess

[47:48] approval on a building plan that was a pretty ambitious pretty

[47:55] ambitious uh plan uh when that was turned down they then came to us for a

[48:00] text amendment that would allow by right the ability to build um I think multif

[48:06] family I'm not sure what the one it would be but multif family but again we

[48:09] would not be approving that we would just be referring it for

[48:14] consideration um I I don't know to me I don't I think this is not right for us

[48:19] and I don't think it's something that we should submit to the planning board um I

[48:23] think that I from what I know um and have seen of the plan that was presented

[48:29] to the zoning board I think it's something that the person who has

[48:34] petitioned for both the zoning change text Amendment as well as propos the

[48:39] building to the building department did not have a realistic approach to what he

[48:44] was trying to build and I think that you know if he wants to do something that is

[48:48] beyond what the zoning allows he should perhaps propose something that would be

[48:52] a little bit more acceptable to the zoning board as as well as to the local

[48:56] community even if that was more than a two family this was six family with a

[49:00] pool I and things like that which was a little a

[49:05] little ambitious put it that way um and so I don't think that this is

[49:11] something we need to consider right now we have a lot on our plate the planning

[49:13] board has a lot on their plate I think that the the the person can go back and

[49:17] try to get another plan for that property approved um in the normal

[49:22] course of uh of trying to get projects St can that be my opinion can I just ask

[49:28] to because it was a mentioned that it's not just that lot it's like the

[49:31] surrounding Lots how does that work what they're saying is that there are other

[49:36] he's he's trying not to say I want a text Amendment from my own lot right so

[49:40] he's saying there are number of lots that are large

[49:43] enough in the in the area to accommodate larger than two family homes

[49:49] theoretically none of them have bigger Lots but they could and so what what

[49:53] he's saying is we should allow Parcels of this size to allow more than two

[49:58] family homs the street Frontage of this amount with the side bulk size of this

[50:02] amount that's that's basic I guess followup is can you do that without the

[50:09] consent of the owners of those property like it does or that doesn't change

[50:13] anything it would allow them to do more than they currently do so it wouldn't

[50:16] need to they wouldn't need we wouldn't need their consent to pass the zoning

[50:21] change um they could certainly come and talk about it if they want

[50:26] we wouldn't necessarily need it's our decision if we wanted to move

[50:31] forward any thoughts I I completely agree with Jo we

[50:37] have so

[50:41] much there this and this will take this will take a lot of study to to make sure

[50:47] that we do it right that it doesn't leak into other zones it's it's not it's not

[50:52] just as simple as the document sounds there's a lot of considerations that

[50:57] need to be made we're working through the etpa we're working through stuff

[51:01] with the LC we're working through stuff with Rock and Gardens um and other

[51:06] entities and and working on affordable housing I I just think that we're we

[51:11] just can't deal with this we make a vote on

[51:18] this is that we're not going to take any action

[51:21] yeah okay um new business was the land use technical committee and the sidewalk

[51:27] repair project which we already approved so I don't think you need to tell us

[51:31] about that um the land use technical is an

[51:35] item right and I I explained what we're doing okay so just it's a little bit

[51:41] different from I don't know if you talked about the the they proposed a

[51:46] change to our sign code what what Steve said was he was sorry he couldn't make

[51:53] it um he would come on the 26th and present everything but he would give us

[51:58] an email explaining all the changes that the

[52:02] lutc so do you think we should move the sign thing faster than that um I don't

[52:08] think it's urgent mayor I just want to distinguish that because what Steve I

[52:12] think is intending on presenting has to do with affordable housing and

[52:15] Abus and he mentioned the he mentioned the sign thing told me he didn't want to

[52:21] he didn't want on the side law question okay what do you propose how do we move

[52:27] this forward well that the The Village trustee should review the the draft

[52:33] amendments to the uh the sign law to the sign law which I can summarize quickly

[52:39] okay why don't you do that and then we'll decide whether we want to move it

[52:41] forward to legislation is that what you want right okay

[52:45] so quick summary yeah it boils down to um lessening the load on the

[52:52] ARB that anytime anybody comes in with any kind of change to an

[52:58] existing legally existing sign it has to go ARB so ARB is saying look if it's

[53:04] only going to be a simple or basic design change to a legally existing sign

[53:10] you don't need to go you don't need to go to the ARB and basic or simple design

[53:16] change is defined I bur you with the definition here it's pretty simple

[53:21] definition but you can figure out it's a basic or simple design change does not

[53:26] need to go that's all has the ARB said signed off on this yeah I think they

[53:33] were one of the progenitors this was slowing them down

[53:37] because they're getting approvals for minor variations to I just want to make

[53:41] sure that's on the record okay so any questions about

[53:46] that so why don't we go through getting it set for legislation we'll put a

[53:51] public hearing out notot to do public hearing we'll do a public hearing um at

[53:57] the 26 we'll set a public hearing for it and then we'll that for hearing would

[54:28] an executive session to discuss potential litigation and Personnel

[54:49] 800m for the opting in of considering the opting in of the etpa legislation

[55:08] emergency which means consider that just to open a public hearing for the

[55:13] consideration of of that soov second motion from Donna second from all in

[55:32] back and forth with um concerning thepa um you've seen the document with a

[55:54] moving I think think in a very very good way and I'm looking forward to the

[55:58] conversations with the landlords once we have a chance to decide what what we

[56:02] think is the Right Way Forward um the rest of the communications are

[56:09] basically um notices to us I'm not sure that we have to take any action on any

[56:14] of them at this point you don't need to take action so these are just notices of

[56:20] um from the office of cannabis management um for an application for an

[56:27] adult used retail dispensary within our village limits um we have we have no

[56:33] reason to take any action at all they're just notifications there Daniel I know

[56:38] that this is where you wanted to say something so um is there any questions

[56:43] of the board first and then we'll go to public

[56:46] comment

[56:50] except okay we're not um Dennis I need your help here since we're not

[56:55] considering anything um her um members of her family are going to speak to one

[57:00] of the notices which she need to recuse herself and from that discussion from

[57:06] even the presentation or are we okay to move forward there's no there's no

[57:11] action that the board can take on these notices that received from the office of

[57:17] C you probably get once in a while from the state Li Authority we get them all

[57:21] the time yeah wasn't time probably all the time they're ignored because there's

[57:26] really not much for you guys to do with anything so what we should do is put

[57:30] into the rec which I think you've already done

[57:37] that I will I will not make any comments even though we just we're not going to

[57:42] make any comments we're happy to hear everything that anybody has to say but

[57:46] there's no there's no no reason for us to have comments at this point we'll

[57:53] don't have anything to consider so I I also can I also P to the record that I

[57:58] have a vague sense that one of these properties might

[58:01] involve um some sort of relationship with rant commercial which is a real

[58:06] estate company that I have a financial interest in I don't actually know if we

[58:10] do but on the possibility that there might be I just want to have on the

[58:14] record that um if any action was taken I would recuse from the action and um that

[58:20] I don't have any personal knowledge of any any of the actions being

[58:24] contemplated here

[58:28] okay public comment what does that

[58:37] me yeah um recuse recusals are if you're going to vote on something that you have

[58:43] a financial or fiscal um you can gain something from it then you would recuse

[58:49] yourself from the vote the fact that we're not having any votes now where

[58:53] these both individuals have said what they might recuse themselves

[58:57] from if we did consider something but there's no purpose or reason for there

[59:15] you again um in terms of the bmu one and two zones and as it relates to

[59:26] permitting cannabis facilities um the

[59:31] law Zing laws is written currently um basically says everything

[59:39] complemented in the dmu1 is permitted in dmu2 except for three things first one

[59:46] is dmu2 zones allows for um apartments on the ground floor it's not allowed in

[59:53] the dmu1 but that's an incentive there's an

[59:58] incentive for people in that part of the zone to perhaps um put apartments on the

[1:00:04] ground floor then you have a height um

[1:00:10] incentive in exchange for affordable housing in the dmu1 it's not allowed in

[1:00:16] dmu2 but again you're incentivizing creative uses of housing

[1:00:21] so you're rewarding the uh the property owners in a certain way um

[1:00:29] by those things whereas with the cannabis use you're actually prohibiting

[1:00:35] specific just one specific commercial use to property owners in

[1:00:41] dmu2 um why reading them differently for that one specific use and I think that's

[1:00:48] unfair so I'm asking you again I would urge the board to pass a resolution

[1:00:54] stating that the Cannabis facilities that are permitted in the mu1 zones are

[1:00:59] also permitted in the mu2 zones thank you thank you Daniel we we will review

[1:01:05] that and um and discuss it with but not tonight thank you any other public
