[1:39] celebrate the varied perspectives, backgrounds and

[1:52] whereas, we are better because of our deaf and

[1:53] hard-of-hearing neighbors,individuals with an alternative

[1:56] sensory and social experience who harness the power of

[1:57] visual language, and who come from wide ranging variations

[1:58] in onset of deafness, level of hearing, educational

[1:59] background, communication method, and cultural

[2:12] affiliations; and

[2:13] whereas, olathe has been named one of america's "most deaf

[2:14] friendly cities"in recognition of the opportunities and

[2:15] programs we offer, as well as culture that embraces our

[2:30] deaf and hard-of-hearing residents; and

[2:31] whereas, we are proud to be home to the kansas school for

[2:32] the deaf, the museum of deaf history, arts and culture,

[2:36] and the olathe club of the deaf; and

[2:37] whereas, the lives of all olatheans are enriched by the

[2:38] contributions of our deaf neighbors as well as this

[2:39] opportunity to recognize their achievements within our

[2:47] great city.

[2:48] now, therefore, I, john bacon, mayor of the city of

[2:49] olathe, do hereby proclaim september 2026 as deaf

[2:50] awareness month in olathe, encouraging all citizens to

[2:51] learn about and celebrate the values, culture,

[3:04] heritage,and languages unique to the deaf community.

[8:33] and mr. Baldwin you could have gotten more steps in the

[8:40] 30,000-foot pole for two reasons number one, this is a

[8:45] project that we as a city were concerned about for safety

[8:49] and our friends along with kdot pushed forward so would

[8:56] you please talk about how this will enhance safety number

[9:00] one, and second, a little bit about the funding of that.

[9:05] we're going to the budget process are staff is telling you

[9:09] we're to be going on a diet and cutting the cip and

[9:15] looking at a number of things to save money and talk about

[9:19] that funding that is what it will impact.

[9:23] >> and nate baldwin city engineer so we had

[9:30] conversations about the project as a whole. And a lot of

[9:35] of our our concerns and the concerns of many of us the

[9:39] safety along eam lone elm road and the pickleball court

[9:45] and that is a thought of putting a truck bypass route that

[9:52] safely gets trucks to college boulevard up to k-10 without

[10:00] the going to the school it accomplishes that a

[10:05] consideration dot will fund the full amount of that

[10:09] project is $18.7 million no city fund or for this project.

[10:25] we're actually voting on not voting on. Does the city

[10:31] council think that interchange is necessarily a good idea;

[10:49] road will make the city of olathe safer when the

[10:54] interchange opens. That is a dumb idea, a waste of money

[10:59] and still vote "yes" to get k dots money to mitigate the

[11:05] risk? We -- from this idea.

[13:49] >> olathe and I have currently lived here 45 years

[13:58] on the west side and subdivision backs up to the r-3

[14:15] zoning to the east. For the non-apartments in our area is

[14:29] r-1 or r-2 and go to the south have the court and r-1 and

[14:39] r-2 goes to the east and have the let me oaks and those

[14:49] are all just r-1, r-2s. Okay.

[14:53] >> I'm not against the developments. That I would

[15:01] hope that the apartments and like the one on rage view and

[15:08] college are too good and I hope the one has been approved

[15:14] for the zoning for college and then the one on the other

[15:21] side of highway. This is to it be 5 hundred and 50 parking

[15:29] stalls with 1,000 people and about three hundred and 33

[15:34] apartment units. The major part of this traffic that is

[15:40] coming out of this apartment complex is going to hit

[15:45] straight and middle lanes down sunnybrook drive.

[15:50] >> there is the middle lane school and there is

[15:55] olathe northwest and it is all right. If the school time

[16:02] is very dense with cars. And this situation. Also, if you

[16:09] go east hit st. Paul grad schools and numerous daycare

[16:19] centers in that area as everything to the north and to the

[16:22] east is c-1 or c-2 and many I'm not opposed to develop.

[16:29] but I am opposed to over development. Which is screw as

[16:34] didn't fit our neighborhood

[16:51] >> good evening brian I experienced homelessness. I

[17:07] walked and struggle I've slept and hunger and theatre any

[17:15] church opened their doors to me.

[17:18] >> I started advocating for my brothers and sisters

[17:21] in the homelessness and in may b-4 I stood over 40 public

[17:30] comments not about me but that but the people living on

[17:34] the streets every single day.

[17:35] >> homelessness was brought up a lot and highland a

[17:41] lot during our special use permit. That came before you

[17:47] guys I wish it didn't have to be. I want to thank the

[17:53] police chief was intentional with that presentation.

[17:59] >> appreciate the breaking down and the explanation

[18:02] of the point and time in count I on the committee and part

[18:08] of another committee and with the d c s.

[18:11] >> the unhoused communities are human beings that

[18:16] might happen to passive their own decisions at the end of

[18:26] the day, homelessness community on unhousing communities

[18:31] are still communities I wish several of you that advocated

[18:36] for this project didn't have to. I wish more passion and

[18:43] in our nation and too often we try to over explain roams.

[18:50] >> we walk, talk and bring and eat and breathe and

[18:55] put our pants on the same way that everyone else does.

[19:01] and our nation continues with with stipulations shorter

[19:08] conversation and more direct meaningful and intentional

[19:12] planning decision that produce positive outcomes we can

[19:17] show leadership in our community. Everything is possible

[19:23] until it is done and have a great opportunity to show true

[19:27] leadership and asking to be part of it thank you.

[19:51] idaho this is one of the anti bye sexual assault we're the

[20:02] umbrella crossed the united states and supported three

[20:08] hundred centers and for victims of domestic violence to

[20:14] make that easy for survivors and adults and kids to go to

[20:20] one place we have centers in 25 crises but this week we

[20:27] plan for the first center in kansas in olathe no johnson

[20:31] county I want to say hello and say a special thanks to dr.

[20:37] felter for 2 days of planning and thank you very much. Ms.

[20:42] essex we appreciate we are so honored to have the support

[20:46] of this it committed group of leaders and not how you

[20:55] intense but I grew up in a home on domestic violence we

[21:03] created the first center in san designee we break

[21:16] generation is cycle I'm joined by people katrina johnson

[21:22] is the leader and brings successor agency act and sarah

[21:27] part of our justice center team and johnson county

[21:33] prosecutor and now douglas county with business leaders

[21:41] and other leaders from the da's office and very involved

[21:49] we have people coming up with more than 1 hundred I want

[21:53] to say thank you for your commitment to public safety we

[21:57] are going to create the first family justice center in

[22:02] kansas I believe we will be the model for the rest of

[22:06] state and for generations. And oprah winphrey said I

[22:15] changed the rest of her life I have a wife and kids she

[22:20] was right openly practices profile led george gush to

[22:28] launch this movement not just in the united states we have

[22:34] bipartisanship for so thank you for your commitments and

[22:41] help us in the journey as we move forward. Thank you very

[23:16] >> I've been a olathe resident since 1979 on my

[23:22] third home here. We moved here when olathe had a

[23:27] population of 26 thousand and was south of charlton and 51

[23:34] street was a dirt road. I watched the city grow over the

[23:41] years for 50 years that's for the growth has to be smart

[23:45] and after my wife passed a few years I downsized and

[23:51] choose my home carefully and it was single-family and our

[24:02] neighborhood a r-1 all single-family couped homes I want

[24:11] you to understand I don't oppose the development of the

[24:15] sunnybrook property I look forward to that will be bring

[24:21] to our neighborhood.

[24:22] >> strongly oppose rc 26 zero, zero, zero 6 and

[24:29] oppose the 3 story apartment collection to sit in our r-1

[24:39] neighborhood just to be clear, not simply a development

[24:43] this is a major change no density and tint and traffic and

[24:48] character and placed next to the single-family

[24:59] neighborhood and those are fundamentally different from

[25:02] the homes that surround this property. The question for

[25:07] you is can this property be responded and the question

[25:11] should be is as the right to build this density in the

[25:17] location I believe the answer to no and asked to have a

[25:22] staff study will impact will not be significant enough to

[25:28] require additional lanes or redesigned intersections but

[25:33] the store is not there the three hundred and 36 apartments

[25:42] are no there how can you adequately judge with all the

[25:53] additional traffic around that area and surrounding

[25:56] schools and churches. The city should evaluate the impact

[26:02] from grouping this restoring I respecting ask the council

[26:07] to deny this project as opposed and require complete

[26:12] valuation

[26:15] before you make your decision please don't let one

[26:20] rezoning decision compromise and establish the

[26:23] neighborhood that is already been a great value as part of

[26:26] the olathe for many years and growth should strengthen our

[26:30] neighborhoods not peter marsh.

[27:03] gatewood. Thank you for your time and my comments in

[27:08] regards to the zoning we'll be voting on september 15th.

[27:11] we have been olatheans and 9 years ago we built our land

[27:19] we reasonably expect our styles are to be built

[27:23] underdevelopment to be continued. We didn't buy in the

[27:28] 3 story apartments. The presentation you'll be looking at

[27:35] does not accurately describe the neighborhood you're asked

[27:39] to change. This is a single-family under the umbrella

[27:45] mixed or r-1 or rp 3 west of this site that is not a small

[27:56] labor issue, that was on page 8 of the staff cites 6

[28:05] townhomes as a compliment to the homes on the south side

[28:12] to treatment in the report of gate wood to the west.

[28:16] staff has conceded the townhomes are - gate wood is

[28:27] single-family homes this is making it worse. The planning

[28:35] commission had to walk the site with a measuring wheel.

[28:40] my driveway is - 995 feet and 60 feet east of the okay.

[28:50] creek and under the development zone is 1,00010 and

[28:54] halfway to the proposed site moving towards the ridge is

[28:58] 1,000 plus 14 and are to 24-foot from the homes this is a

[29:08] 3 story development will be a 4 or 5 story structure from

[29:13] our homes that is not a minor detail this is against a

[29:21] single-family neighborhood not on a recommendation that

[29:25] one mischaracterizes the neighborhood and too omits it is

[29:32] - and 3, leaves valuation concerns ongoing answered we

[29:38] have that from our backyard don't be deceived with the

[29:43] trees and the leaves go away in the wintertime we would

[29:53] welcome the development and owner occupied townhomes

[29:57] attached homes under the objectives and ownership is

[30:05] building the long term residency. Thank you for your time.

[30:41] the proposed amendments to the title vi of the olathe

[30:49] municipal code and so - just a brief explanation of this.

[30:56] I did read in the report that this is necessary for us to

[31:04] work for the county to I guess inspect if we don't adopt

[31:16] the codes the county -- whoever enforces those rules will

[31:22] be able to do it inside the city limits?

[31:25] >> is that correct?

[31:26] >> the city attorney. It is correct, mayor. We

[31:31] have those codes adopted I think the last in 2004. They

[31:38] were single and johnson county updated them a couple of

[31:41] years ago and they went into effect. But for us to keep

[31:48] current on the latest, we have to readopt the updated

[31:53] version to continue the current version of the county code

[31:59] as --

[32:02] >> is it stuff we already do in the park?

[32:07] >> I think that ryan told me that there is a sanitary

[32:12] part of code that governs private sewerage. It is

[32:19] essentially unchanged the aquatic code is semi public

[32:28] aquatic swimming pools the changes allow the city to

[32:34] implement the regulations on this part. So it gives the

[32:39] city more room to regulate.

[32:42] >> that for our faculties not hoa; is that correct?

[32:49] and they apply to the hoa and semi public pools but not to

[32:55] the back that is the back pool.

[33:07] discussion on the santa fe, ridgeview to mur-len,

[33:12] improvements project, pn 3-c-025-18.

[33:13] >> teresa city engineer joins us for a presentation.

[33:19] >> thank you mayor and city council I'm teresa the

[33:35] assistant engineer I'm here to talk about the I-35 work

[33:40] project and the aesthetics. In july I presented about a

[33:49] deep scope and the schedule and phasing and by today, I

[33:57] want to bring you an overview of the aesthetics we're to

[34:05] talking about 9 and lighting and while this interchange

[34:13] not a gay way to like 119th street or one and 59 and I-35

[34:20] the interchange is a vocal point to the downtown area we

[34:28] move through the presentation we'll see key pieces that

[34:34] tie to the downtown areas as it stands today and the

[34:41] aesthetics of this project are focusing on the experience

[34:45] of driveway driver and pedestrian we want the vocal point

[34:56] not on the experience of I-35 as a reminder this is being

[35:00] constructed as a stable point interchange that is similar

[35:04] to I-35 and the big the vocal point is the signal and in

[35:13] the middle as all of traffic unit at that signal so really

[35:20] the trucks structure is the vocal point and the wave that

[35:26] you can see on that truck structure is on the support on

[35:32] either side bring this element to the.

[35:35] >> clerk, call the roll. Aspect of the design here.

[35:39] you can see there is a double fencing on the bridge

[35:45] barriers that matches the fencing on 119th street over the

[35:50] railroad at the interchange and will be installed on the

[35:54] 119th street bridges over the any portion of 119th street.

[36:02] little brick portion of medians the pattern on those brick

[36:07] that is mimic the downtown streetscape ties those into the

[36:14] element of the downtown as well. And heavy landscaping

[36:19] provides added experience for vehicles and pedestrians as

[36:23] they move through the space. And looking closer at the

[36:29] decorative trust supports it, it is hard to depict on the

[36:35] visual, but if you look at the picture feel person walking

[36:39] underneath the trust structure you feel the scale how that

[36:44] will be and really will be a large and impactful element

[36:50] people will be passing through on this bridge. The trust

[36:55] supports the medal panel on each side to the space and

[37:03] again, as you can see with the double fencing and the

[37:07] decorative patterns on the elements to olathe.

[37:16] >> this is a view from the interstate, as I

[37:21] mentioned, want the experience on santa fe but tie oig

[37:26] elements on the intrastate that wave pattern on the

[37:32] retaining walls as you continue on the intrastate at the

[37:35] same feel with the decorative wave patterns throughout.

[37:43] moving on to the medium landscaping this is just an

[37:46] overview of where our medians will be located throughout

[37:50] the project and everything this is heavy dashed black

[37:55] lines will be mediums on santa fe and on the side street.

[37:59] and creating the interchange as vocal point we want to

[38:05] focus on the medians on the interchange bridge itself and

[38:10] to the interchange to everything in red is where we'll

[38:15] will focus our heavy landscaping and mediums and the

[38:24] remainder will be more toward the standards for the trees.

[38:39] any mediums 18 feet wide will be more narrow so you can

[38:47] see and the wave pattern continues throughout the planning

[38:52] bed and the decorative bridge on the mediums as well.

[38:56] >> to give you a glimpse of the interchange at

[39:06] night. The flood lighting inside the support creates a

[39:11] vocal point for the.

[39:13] >> and under the caps will guide them along the route

[39:17] as they move across the bridge. Looking at the interchange

[39:22] from the perspective of the intrastate we really are

[39:27] highlighting the column lighting and the flood lighting

[39:31] one little trust will be a vocal point but as a reminder

[39:37] we want this on top of of the bridge as opposed to to the

[39:43] experience on the interchange itself. As a summary of what

[39:49] we discussed will have a large trust support and will

[39:53] provide the vocal point on the bridge and have the fencing

[39:58] that matches 119th street and the decorative bring that

[40:04] ties the interchange into the downtown landscape and the

[40:08] heavy landscaping adjacent to the interchange and then the

[40:12] lighting will focus on the experience along santa fe with

[40:15] the experience and then the lighting for I-35 and the

[40:27] flood lights and with that, leave you with the overview of

[40:32] the property interchange and I'm here to answer any

[40:36] questions.

[40:42] >> super presentation and the is only point

[40:49] interchange makes sense. As I envision I-35 and a-37 is

[41:00] overwhelming it looks great but in reality will be

[41:06] overwhelming do we envision bicycle traffic on the

[41:11] sidewalks.

[41:12] >> bicyclists will be accommodated and 10-foot walk

[41:16] on the north side of the bridge and - so could be on the

[41:23] streets themselves but at their own risk will want them to

[41:31] be on the sidewalks.

[41:32] >> right.

[41:33] >> the vehicle landscape is irrigated.

[41:37] >> yes or no some will be irrigated and so will be

[41:44] water?

[41:46] >> will be this is full of sun and the beautify

[41:53] landscaping will be look great with adequate water but if

[41:59] it doesn't we don't want to not maintain this and you're

[42:09] assuring we we have enough water.

[42:12] >> yes. Those islands will be irrigated.

[42:17] >> you mentioned not a gateway to olathe explain to

[42:22] me what what makes 119th street the gateway and this not a

[42:27] gateway.

[42:28] >> 119th street street and think the north side and

[45:06] guess on the south side on the north side getting rid of

[45:12] some of that.

[45:17] a safer corridor to control the access points. This is

[45:22] really what we're doing closing off that medium, as well

[45:26] as, closing off and cul-de-sacking with the interchange

[45:32] need to pull those access points as far away as we can

[45:41] folks to the signalized page to move through that. And

[46:54] design this for a 20/40 we starred in 2018 and with the

[47:12] wanting to walk and bike they need to walk and bike that

[47:18] are going to walk across santa fe that maybe we should

[47:23] make sure make it have better buffers and safer so those

[47:35] about increasing with the sidewalks the width all the way

[49:15] and give everyone a better feel of driving through that

[49:19] but I noticed is speed limit is what 35 on santa fe and I

[49:25] believe that is 35 between downtown and intrastate and

[49:31] increases not east. I don't know we have any intention of

[49:36] changing the speed limit I - I see many people drive

[49:41] farther my question will be what part of the aesthetics or

[49:47] landscaping could help people to slow down and is that

[49:54] something you're thinking about for the purpose of.

[50:10] in and of itself will provide people to get there there

[50:14] and on a more reliable basis is a lot of people kind of

[50:20] get upset or agitated so they speed up but if we give them
