[0:00] I pledge allegiance to the flag of the United States of
[0:03] America. >> To the flag
[0:05] for which it stands, one nation under God, indivisible, with liberty and
[0:11] justice for all. >> Roll call.
[0:15] » Here. >> Here.
[0:16] » Molly. >> Here.
[0:17] » Francis. >> Here.
[0:18] » Lynn. >> Here.
[0:20] » Make a motion to waive the reading of the pre-read minutes.
[0:26] » Second. >> All in favor?
[0:27] » Aye.
[0:30] » Um
[0:32] update or open a public hearing on the 2027 budget. Ask if anyone has any
[0:38] questions. Any questions on the 2027 budget?
[0:46] Uh close the hearing on the 2027 budget. Commonwealth engineers project update,
[0:52] memo retro.
[0:56] » Hello. Um I think you guys should have an
[0:58] updated memo. I do not have much to update this month.
[1:02] I don't have anything to present. Um
[1:06] 2026 community crossings project, work
[1:10] continues. Um it's sounding like it's going to be wrapped up here in the next
[1:14] month, month and a half. Uh concrete work should be finished soon.
[1:19] We don't have a schedule for paving yet. That's continuing.
[1:24] 2027 continues under design. I think the applications coming up here in
[1:29] September. And then on the water projects under
[1:33] construction, um we received draft pay applications,
[1:37] but they weren't ready to be presented yet. Um it put them at about 30%
[1:41] complete. So, they're also moving along pretty well.
[1:46] Everything's continuing. Potholing's continuing.
[1:49] Service line replacement continues as we get the right of entry forms received.
[1:53] Uh hydrants and valves are under being
[1:58] and um I think the filter media two of the three has been completed so that's
[2:03] that's hopefully working really well for the
[2:05] plant. Um, we have a construction meeting tomorrow
[2:08] morning here. The board and welcome the board is
[2:12] welcome to attend, call in or be in person if you can.
[2:17] That's that's all I have unless you guys have any comments for me.

[2:45] » Aye. >> Uh, motion to approve Commonwealth this
[2:50] is for the 2027 community crossings grant.
[2:53] Um. Motion to approve Commonwealth payment
[2:56] for $11,620 for preliminary design and survey data
[3:00] collection. >> Motion.
[3:04] » Second. All in favor. >> Aye.
[3:07] » Uh, wastewater preliminary engineering meeting on the 21st.
[3:13] Contract is being assembled for design and addition services to break project
[3:17] bidding. They are currently
[3:20] reviewing funding options and we should expect to resubmit to
[3:24] IFA >> next year.
[3:31] » No, you don't have to there's nothing to pay for or anything.
[3:39] » Uh.
[3:41] Purple County economic development uh 2027 interlocal
[3:45] agreement.
[3:50] Oh, sorry. Um.
[3:53] Motion to This is for the water improvements lead service line. Motion
[3:57] approved Commonwealth claim of $30,000 for construction and commissioning RPR
[4:01] and legal financial assistance. >> Motion.
[4:04] » Second. All in favor? >> Aye.
[4:07] » Motion approved Commonwealth 47 8 of $1,800 for construction and
[4:12] commissioning RPR regulatory assistance legal financial assistance
[4:16] building investigation survey and service line evaluation for the lead
[4:19] service line program. >> Make the motion.
[4:28] » I just want to make that clear. >> 47,827
[4:32] » Oh, okay. Second. All in favor? >> Aye.
[4:37] » Rippe County economic development 2027 interlocal agreement
[4:43] same as we've always done all's good grease to play pay to RCED
[4:49] 12% of the 2027 added funds motion approved
[4:53] Rippe County economic development 2027 interlocal agreement.
[4:58] » I'll make the motion. >> All in favor?
[5:02] » Aye. >> I would like to know if those charts are
[5:05] telling me for construction expenditures are those real
[5:09] numbers or >> No, they're from last month because
[5:13] they're new numbers. We don't have a new pay up yet.
[5:15] I'll get it I'll get the pay ups added to that. I'll resend it. Hopefully next
[5:19] week. We We talked to the contractor today and
[5:22] they're still working on their final numbers.
[5:26] » All right, Sarah. Laying on the Hoosier Hills water
[5:30] » Hoosier Hills water easement. So, Hoosier Hills has reached out through
[5:34] their attorney requesting a easement. It's a perpetual
[5:39] easement not to exceed 10 ft in width on either side of the water line and meter
[5:43] pit as constructed. Um
[5:47] or think it it it's just it's real estate owned by the town commonly known
[5:52] as 550 and Osage. Um
[5:58] This was sent out and alters there are corresponding temporary construction
[6:03] along with it. Um I had requested for just an
[6:07] explanation of the project and I think they're just doing improvements to their
[6:11] line and I asked if there was a benefit to Osage and allowing this and
[6:16] apparently they are your backup in the event you have a water catastrophe.
[6:21] Um so obviously if the water was closed and the water is there um
[6:25] it it you do have a benefit to it. The
[6:29] um other issue with it I I think there was
[6:33] an email that was sent out to your water superintendent. He had suggested that if
[6:38] they would actually like reinstall the meter there that it might be a benefit
[6:42] but they have no intention of doing that. It's not a big deal. If you if
[6:46] there was that emergency and you needed to install it quickly it could be that
[6:49] quickly. >> Okay.
[6:50] » So I have not been made aware of of any issues with the easement um
[6:55] from anybody like superintendents or anything.
[6:59] So it's just a matter of whether or not you want to approve it. They there is a
[7:04] little bit of time. I think they want to bid the project in December so he wanted
[7:07] to take another look at it. Um you can table it for next month or so
[7:12] it's fine. >> I'd like to table it so I can talk to
[7:15] John. >> Okay.
[7:17] » I'm I'm with Bill.
[7:22] Uh I need
[7:25] » Technically you need a person and a second to table a vote.
[7:29] » You already have two. >> I'm I'm second vote to table.
[7:35] » [clears throat]
[7:37] » Uh motion to hire Rodney Weaver in for this gas street position.
[7:42] » I'll make the motion. >> Second.
[7:44] » All right.
[7:47] Travis
[8:02] The allocation was submitted today to the
[8:06] county. It's a
[8:09] Everything in there There's just more in depth.
[8:13] It's 225 pages roughly.
[8:17] There's no copies or anything. Everything is condensed down.
[8:21] This is the final study here. This is the final study here.
[8:25] This is a copy for your interview.
[8:35] It's a It's
[8:54] So, we've been here a multitude of time a
[8:58] few times on this, but we've got a clear and concise plan on
[9:02] where we're headed with this. Um
[9:06] The site development has changed somewhat in structure based upon the
[9:10] engineering. Uh We had um
[9:15] I consulted with French and Associates and decided to go with a civil
[9:18] engineering firm, Gonzales, based out of North Vernon, who has done
[9:23] all the site work and site plan studies. Um French and Associates did
[9:29] uh apply They did come and do the field
[9:33] work on the topographies and provide that to the engineering.
[9:37] Some things have shifted somewhat in um what I what my original thoughts were
[9:43] based on what is actually there and uh stormwater studies.
[9:49] Um There were some concerns at the last
[9:51] meeting we was at a couple months ago of stormwater and how that would be.
[9:56] We will be a 100% self-compliant on our We will be putting no water off on any
[10:02] neighbor's property. Everything is directly ditched on us, retention pond,
[10:07] um retention area. Everything is down
[10:11] um to us. We um
[10:15] They did There's a 100-year stormwater study. It is in this pack that we'll
[10:20] leave with you. But it's a it's nearly 100 pages in
[10:24] calculations and how that's been determined and how that's done.
[10:29] Um We have been
[10:33] So, we have compliances that we have to follow, chapter 80, 40.5 in the Ripley
[10:38] County code books. That's the codes that we have worked
[10:42] with the county. We've worked with engineering firm.
[10:45] Lynn had sent me an email last week and with some other article stuff. I went to
[10:49] the county um and asked them to pull any other documentations that we need to be
[10:54] following, any other ordinances. They referred me back to 40.5 and said
[10:59] this is the county codes. This is what we're following. So, that's what we we
[11:03] proceeded with. Um In here is a completed application
[11:07] which is a total of six buildings. Each building has a separate application on
[11:11] it. Simply to keep it clear and precise in how we'll build one, build the next,
[11:16] and build on. Um and our inspections will be done as that.
[11:21] You guys have a construction plan of each proposed building.
[11:26] That there are a group of uh there are there is a group
[11:30] of
[11:33] Let's see. There are three groups of uh
[11:42] So, the first four buildings will be duplexes.
[11:46] And they should be uh
[11:56] That is the duplexes. Those are the four buildings that are right out here.
[12:02] Those will have two car garages.
[12:09] So, the duplexes will be completely handicap accessible. They'll be uh first
[12:14] floor entrance, um
[12:17] have a garage, everything in them. Um
[12:21] compliance uh bathrooms, handicap accessible bathrooms. They are two
[12:26] bedrooms, they are two full baths in each of those. Uh so, they I just still
[12:30] think there's a need that people still like privacy in their master bathroom
[12:34] off of that um in their personal residence. If they
[12:37] have somebody come and stay with them for care, then they can go from that.
[12:42] Those buildings are proposed there. They'll all be um
[12:46] the construction will be uh concrete foundations, slabs poured, 2 by 6
[12:53] exterior walls, vinyl and veneer siding, and shingled
[12:57] roofs. Uh
[13:00] you also in here, there are the sixplexes. We had to drop
[13:05] units off of those in the backside simply for stormwater reasonings and
[13:10] parking reasons. The construction plan does show that we
[13:15] have added that we needed an additional 24 parking spaces. We are more than
[13:19] covered our additional space. Um we met with uh this goes to tech
[13:25] review with the county. We dropped it off down there today.
[13:29] Um and have emailed hard we have emailed this to them but they may want full sets
[13:34] of this but they're they'll comply to make sure we're on that.
[13:37] You've got engineer trust plans that are um part of the state or
[13:43] are part of the state requirements on building permits. They're in here.
[13:46] There's several pages on that. The last meeting you had told asked me
[13:51] to get with each of the the superintendents of the various
[13:55] departments and solve any concerns. Um we did do that. We met with
[14:03] we have spoken with water and have a verbal no problem. We spoke with sewer
[14:08] gave him that hey we're looking at 20 units. They've complied and my
[14:12] understanding is they can consult with Commonwealth Engineering.
[14:15] There's not a um there's not an issue there in hooking to
[14:20] it. Obviously we understand um our proposal is to put a manhole at the road
[14:26] there and then our sewer lines would tie into that and tie off of that. But it's
[14:31] pretty in-depth and what the sewer trenches and all that have to look like.
[14:35] So in here we put our utility letters. We have a letter of commitment from Duke
[14:40] Energy. It actually the property was designed for a build out years ago and
[14:45] the transformers are on the back side of the property now. So there'll be really
[14:49] no new infrastructure. Nothing through any neighbor's yard. It's already been
[14:53] installed. Um which was nice to hear uh as far as
[14:57] where we're at. They've got the transformers are on the property right
[15:01] at on our property line now so we don't have to we will have to not encroach any
[15:05] neighbor's property at all for that. We have a compliance or a letter of
[15:11] commitment from Trent Lindville to provide high-speed internet. He
[15:14] currently does Buckeye but he also will do that.
[15:18] Um out of these 200 and some pages, the
[15:21] only thing that I believe we're missing still is our sewer letter commitment.
[15:26] Everything else is plot. Everything else has been fulfilled.
[15:30] You asked me to meet with the fire department. We met with the fire
[15:33] department. We took a lengthy letter of their concerns,
[15:39] their draft, their things. Everything has been addressed with them.
[15:43] That's part of the redesign. There's turnarounds back there now.
[15:47] As far as it's not you can't go in in 360 a a semi back there, but there's
[15:52] there's turnarounds now. There's turnaround installed for the trash bins.
[15:56] We're going to lock down the trash bins. It'll become much more secure area. The
[16:01] whole place will be under surveillance. Most of it is currently now, but we
[16:06] still got weasels dumping trash on us. It's just
[16:10] we're having trouble with that everywhere we've got a dumpster. Except
[16:13] at the car lot cuz it's right by the office door. But everywhere else we have
[16:16] trouble with that. You have a very in-depth site plan.
[16:21] I think they did I think it's nine pages long. It's pretty in-depth. I believe it
[16:24] covers I had multiple meetings with the
[16:28] engineers from Gonzales. There's been three different ones that have looked at
[16:31] this. They have
[16:35] They have done they I think they've done a wonderful job in detailing it out.
[16:39] They have said that we have to deal with IDEM on this and that they will comply.
[16:44] They said that's just a formality. We have hired them to go ahead and do that
[16:48] additional permitting for us so that IDEM will be involved. And I think that
[16:53] brings in I think that brings in a soil and water
[16:57] conservation in this area. That they'll be in some aspects of that.
[17:01] But they would told me how they They said that that would be in their
[17:06] It's part of the package that we're paying them to to do for us.
[17:10] The storm water design is in-depth.
[17:14] We we understand it. There's no Like I said, there we you
[17:20] know, last time there was concerns that we're going to be putting water off on
[17:23] Shultz Street. Our
[17:26] ditch swale starts at our property line. We can will hold all We are diverting no
[17:31] water onto Napoleon State Bank. We're diverting no water onto
[17:37] anybody no neighbor. So, that was a concern that I did not want somebody to
[17:43] say we're flooding their garage. So, part of the design, there's 814
[17:48] linear feet of ditching and um 6-in drain tiles that go into this retention
[17:54] area. This retention area is not deep. Uh it's like 18-in deep on the deepest
[18:00] thing, but it also has They've got it designed out how we triple flow and get
[18:04] our water out of that.
[18:08] As far as I know, every section of 40.5
[18:13] on the code requirements has been met. There is nothing that If there is
[18:18] something that has been left out, tech review will get that. Like I said, they
[18:22] were given that today. Tech review will go My understanding is
[18:27] it's the first maybe Tuesday or Wednesday Tuesday in
[18:33] September. We have missed this month's already.
[18:36] This will go on to Tuesday of the the first meeting in September to tech
[18:42] review. And then they would issue any of their
[18:46] um if they find things, which I suspect
[18:49] there's going to be something that they're going to come back at us with.
[18:52] That What do you need to resolve? We will um do that.
[18:56] I do want to commend the town and Derek Walker. Um
[19:01] he's been very very pleasant to deal with. Um seems very educated, very
[19:05] professional. And you know, I've met with him
[19:10] maybe three times now. And do you know and he's been wonderful
[19:15] to deal with. And my understanding is the
[19:19] county attorney, BZA representative, um,
[19:23] Dave Osborne and maybe John Ertel sat on this tech
[19:28] review. So, we provided them an exact copy of
[19:33] this. The thing that you guys have added to this is that we have put in what a um
[19:42] rental application looks like for us for renting from our properties.
[19:46] We've been closed that we have included that.
[19:49] We have also partnered, um, we will be partnering with Isaiah's
[19:53] Image, which you guys aren't aware of, but that's all a a um
[19:58] a home health agency that we will be able to offer this to
[20:04] people moving forward. Once this is completed, we will
[20:08] everybody will have an opportunity to do that. I have people there at all
[20:12] different sets of financial aspects. I cannot limit
[20:19] the age that lives there at Buckeye. People have the misconception that
[20:24] Buckeye is a senior facility. We are governed by uh Indiana Housing
[20:29] Authority. And we
[20:33] I'm telling you their laws, they audit us, they go through our books
[20:37] continuously. We have to provide who are um who our applicants are, reasons for
[20:42] denial, uh uh everything. It's a very cumbersome. We
[20:47] report We report monthly on that. So, we are under those guidelines to 2032 at
[20:53] Buckeye. So, we are a facility that has to comply
[20:58] to federal law. In there, we will be um
[21:04] we are trying to curtail pets. It still is one of my number one thorns in my
[21:10] side. However, there is nothing that any
[21:15] attorney has told me I can do to combat a service animal.
[21:20] I it is one of the most fictitious terrible laws for a landlord that I
[21:25] don't know how ever got passed, but it is the card we're dealt. We were
[21:29] proactive with our attorney. We drew up a
[21:33] We can we charge a fee for the pet and we can charge a um
[21:39] a uh a security deposit.
[21:43] So, we do that. Does it deter them all? I find people
[21:47] will go without food if they can still have another dog. So, we have limited to
[21:51] one dog on our application. We've also limited that they have to know they have
[21:56] to They on our lease agreement it is called
[22:00] out that you can have one up to one animal and that animal can only be up to
[22:04] 40 lb. Um
[22:08] Now, I do know I may have a couple dogs that may be pushing 40 and so it's uh
[22:13] it's something we're trying to work through.
[22:16] But, any animals I do have people at Buckeye that there was no limit on the
[22:22] amount of animals that they had. I do have a couple residents with three dogs
[22:26] in those small apartments. Uh drives me crazy and we are you know,
[22:31] we have been as landlords we have said we are going to audit them checking
[22:36] those apartments and making sure they're clean and they're getting wrote up if
[22:40] they are not and we find them where we find they're unsanitary.
[22:44] As far as we have even brought in the health department on a couple situations
[22:47] to say, "Hey, we need to do this." But, I think we're getting it.
[22:51] I think we're curtailing it, so.
[22:55] This is the application that we're presenting.
[22:58] This is our final application
[23:02] barring any tech review requirements. If tech review comes to us with something,
[23:07] we're going to work it out. We're going to figure it out.
[23:12] So, we're here to ask again
[23:15] for a to complete our application, we need a letter of sewer approval.
[23:22] » What's
[23:25] We have that form, Travis. It just needs to be filled out and signed off.
[23:29] What do you call those county offices? Once that's
[23:33] » I'm here. >> Done.
[23:34] » Once that's >> Once that's
[23:35] » That's part of the process. >> Well, what's the hold-up on getting
[23:41] » I'm not sure I've talked to any of the sewer maintenance about it, so
[23:44] Do you have a copy of the form? >> I've been here two or three times. I've
[23:48] met with the >> Do you have a copy of the form?
[23:52] » I know what the form is. It's a
[23:55] » So, is it that they're waiting like what you presented today in your
[23:59] your final application, they need to have reviewed by Commonwealth?
[24:04] » Commonwealth >> They need to fill out the form and then
[24:06] it >> Commonwealth reviewed our sewer there.
[24:09] » I thought Alex had already >> Alex has told me she's been here to sign
[24:13] the letter and has been told not to I was told I mean
[24:18] » I'll just have to contact Alex tomorrow and find out.
[24:21] » She's told me I mean I've seen her and she's done the work.
[24:24] » Yeah, she's signed off on it. We still have that form.
[24:30] » I thought that's what this was all about.
[24:33] » I've never seen a form, Chris. I mean, there was a formal letter that you guys
[24:37] typically sign in all of our other fields.
[24:40] We've just said we need this letter and I'm not aware of any form.
[24:45] » I mean, she signed off She's She's seen what we presented.
[24:49] » They signed off. Tony signed off. It's not so long ago we go back.
[24:57] » We'll have to do some of this, but >> What's to review?
[25:02] » I'm not sure Travis, but I can't just pass it out of hand without talking.
[25:06] » So what you can what you can do is
[25:10] is you can either I mean it it it it appears that she
[25:15] signed off on it. That the two utilities that need to sign
[25:18] off on it have signed off on it. If you just want to confirm that what was
[25:23] presented is what they signed off on. >> Exactly.
[25:26] » You can do that as soon as they confirm it.
[25:29] » Send it to the guy. >> You got the letters, right?
[25:33] » Yeah. >> If it's not that, what was signed off on
[25:35] it? >> This [clears throat] is bizarre.
[25:38] » Lynn, in all due respect, we need a time frame.
[25:41] I've been 18 months here in this. >> So I don't know how long it's going to
[25:45] » I don't know. I'll just have to get and make sure they review the current set of
[25:47] drawings. >> Well, you definitely need a by tech
[25:49] review in September, right? >> I need it now. I mean I can't we're
[25:55] we should I don't see why we couldn't
[25:59] put this up in an hour or a week to be honest with
[26:01] Let's review with everybody and make sure they're reviewing the same drawings
[26:04] you presented. If signed off on that, we should be
[26:07] good.
[26:10] Is that I mean can we get a we can get a commitment that we can have a letter by
