[1:03] council the City of Pacific Grove it's Wednesday December 4th 2024 it's 6: pm

[1:09] I'll call the meeting to order note that all council members are present please

[1:56] mogenson thank you Mr Mayor um the last time perhaps will'll say that this

[2:01] evening to you um um this item will be presented by our city

[2:07] clerk thank you city manager mogenson good evening honorable mayor

[2:12] council members staff and members of the public my staff report includes a

[2:16] resolution to declare the results of the November 5th 2024 municipal election

[2:22] City Charter article 9 requires results of the Municipal elections be declared

[2:27] by action of the council at its first public meeting after certification of

[2:31] the election results California elections code

[2:35] 10263 requires Council declare elected the persons For Whom the highest number

[2:40] of votes were cast for each office adoption of the proposed resolution will

[2:45] accomplish this declaration and as you will note uh that uh resolution was

[2:50] revised and the uh final results were attached via erata and it should be on

[2:56] the dis as well as a copy for the Public's View

[3:00] the statement of C votes cast certifies the election of Nick Smith as mayor the

[3:05] reelection of chaps perur and the election of Tina Ral and Paul

[3:09] walkingstick as council members to our city council additionally measure Q

[3:14] passed by majority vote by the people of the state of I'm sorry the City of

[3:18] Pacific Grove and measures Z did not pass staff's recommendation tonight is

[3:23] to approve the resolution declaring the results of the November 5th 2024

[3:28] municipal election this includes staff's report and thank

[3:33] you thank you and now we'll go for public

[3:49] right my name is Susan goldbeck and I've been a citizen of Pacific grow for 35

[3:55] years um and I'm now the queen bee of the

[4:00] BBB society and what our goal is is to do public Outreach to bring the

[4:06] butterflies back to Pacific Grove and what that means is the giant beautiful

[4:12] stained glass butterfly on the top of the homman building for four

[4:17] decades um was taken out of there when a sold the building there may be some

[4:22] confusion about what item we're on now this is this is not general public

[4:26] comment this is comment just general public comment no I'm sorry this is not

[4:31] general public comment oh say public comment anyone wants to speak it's on

[4:35] this particular item the Declaration of be back the election

[4:44] okay all right let's try it one more time how about a virtual

[4:59] I would just like to congratulate everyone who is going to be seated on

[5:05] the city council and thank everyone who ran I think this is indicative of a town

[5:14] or a village that really cares and tries to be involved there are some sticky

[5:21] issues coming up but I know that you will do your best thank you so much for

[5:26] being there for us

[5:40] member Luke ketti for his dedicated service to the residents of Pacific

[5:44] Grove over the past four years he has demonstrated exceptional leadership and

[5:49] a steadfast commitment to supporting our community his deep knowledge of our

[5:53] City's needs and priorities has consistently guided his work and he has

[5:57] always put Pacific Road first I wish him all the best in his future endeavors and

[6:01] want to express my sincere gratitude for being one of the finest council members

[6:05] I have had the privilege to work with and observe in service in our city and

[6:10] I'd like to congratulate incoming council member Tina raal and also Mr

[6:15] walking stick have a great

[6:21] evening we do not have any more public comment

[6:26] online all right uh let's uh I'd like to hear a motion I'll make motion go ahead

[6:44] before we vote I have a couple of comments to make on this I want to Echo

[6:48] some comments that were just made by Miss Miller uh first of all

[6:53] congratulations uh to uh the newly elected or about to be sworn in uh

[6:59] officials and those that have been reelected to city government uh um well

[7:06] done and I'm I'm hoping and rooting for your success because when you're

[7:12] successful we all are

[7:34] have sacrificed personal time and efforts with the expectation that they

[7:40] might be sacrificing uh quite a bit of uh their personal time in the future and

[7:46] and bit of courage to be out there to be judged by the community for the position

[7:53] of uh government here and so I I'm I'm very very much appreciative of all the

[8:01] people that that ran put themselves out and this is the way our city government

[8:08] our democracy works best right without without choices and you provided um the

[8:14] choices and the discussions of what our city government should do so thank thank

[8:20] you all very much um council member pador um thank you

[8:26] mayor and and I would also like to Echo the same thoughts I would like to thank

[8:30] first of all uh mayor B Peak uh it's it's a really tough job to be on the

[8:35] seat for four years but you've been doing for than that but I I really

[8:40] appreciate what you've done with with the city uh to take the city forward on

[8:44] on a lot of items here I would also like to appreciate uh and and thank Mr klei

[8:49] uh for for what he's done in the past four years as well as Council woman back

[8:52] who was there on the council uh I would also like to thank uh the candidates who

[8:56] are running and congratulations to the new candidates that are are here in in

[9:00] addition I would actually like to thank the city because an 80% plus turnout

[9:04] that is fantastic so I really congratulate all of you for

[9:07] participating in the Democratic process and and taking things forward so thank

[9:11] you very

[9:16] much council member McDonald well since we're doing shoutouts I would definitely

[9:22] like to thank uh mayor Peak first of all for great mentoring because coming into

[9:26] this seat there's so much you don't know you don't know until you get here so

[9:30] thank you so much for all you have taught us all the year about over the

[9:33] years about good government um and good governance and and thank you so much for

[9:38] that and the same to uh Luke ketti who um I feel I've learned so much about

[9:42] really understanding all you've brought forward for all the ordinances and

[9:46] things we could do to fix and improve city government to make sure that uh

[9:49] We've updated things that may have been way out of date and always so much

[9:53] supporting the public and also congratulations to Paul walkingstick and

[9:56] Tina Ralph for joining us and I'm looking for for to more business to come

[10:00] thank you council member klei thank you your honor I I too want to Echo uh my

[10:07] thoughts uh and congratulations to the mayor and also to really point out the

[10:12] fact that he always let council members explore the space as it were and he was

[10:20] always the last to speak and the first to encourage council members to go out

[10:25] and develop their own ideas bring them to council ground truth them and

[10:30] hopefully have them adopted so I think the mayor has been an exceptional mayor

[10:35] and was a privilege serving with you and uh and also congratulations to all the

[10:40] candidates who uh who uh were uh elected at this last election thank you council

[10:46] member Amelia we're discussing everything now

[10:52] bill it's been great uh knowing you and I know we'll see each other in the

[10:56] future that's for sure and uh in I also want to congratulate Shirley Peak who's

[11:02] out in the audience because you got you have to have a

[11:08] spouse that's going to support you and I uh do want to congratulate all the

[11:14] candidates too and I want to tell you uh a quick story from a a former mayor uh

[11:21] that was on for a long time and he told me Joe the first day is great then it's

[11:31] then it's all downhill no it isn't it's uh it's also

[11:38] will it's been a pleasure working with you and uh and getting together socially

[11:43] and uh you've been a real mentor to me when I first got elected in 2018 I

[11:47] really appreciate it and um thank you very much and Luke good luck to you and

[11:55] thank you for your input and everything I really appreciate it so and and uh

[11:59] chaps I'll see you next time May Smith thank you your honor I'll

[12:05] just said I'm going to be making some comments and I don't want to spend too

[12:09] much time talking tonight so you know they expect them to be

[13:08] certificates of appreciation and I will do so right away

[13:13] but I will do so um by asking our supervisor elect Kate Daniels who is

[13:20] here to come and join me for this because you'll all be able to work with

[13:24] Kate in the near future I'm sorry I wasn't at the meeting this morning

[13:29] great good so thank you I'm not going to take over your meeting I promise so

[13:33] we'll just just scooch on here um but um maybe you could help me by holding the

[13:38] microphone so our first uh certificate goes to Luke colleti and um it is with

[13:43] sincere appreciation for your service to the Pacific Grove Community um as a

[13:48] local Boy you know you really know your way around Pacific Grove and you showed

[13:53] terrific leadership and much hard work particularly around the chiaka hall um

[13:59] restoration and and work it was really wonderful just standing on the outside

[14:03] seeing the work that you did was really something so it's it gives me good big

[14:07] pleasure or can H why don't

[14:11] you stay up there okay do you want to see yes I just I mean I'm thinking

[14:18] vacation rental ordinances as well and so thank you very much for your work and

[14:24] and the connection that I've been able to have with you on housing when in a

[14:27] few meetings where I got to know you and see your real commitment to ensuring

[14:31] housing for our community members so thank you for that work and even Beyond

[14:35] Your Service here I look forward to working with you in my next iteration as

[14:40] the County Supervisor so I hope you'll stay in touch yeah thank you thank you

[14:45] so

[14:51] much and now it is a great honor and pleasure for me to present this

[14:56] certificate to Bill Peak the the outgoing mayor of City of Pacific Grove

[15:01] with sincere appreciation for your many years of exemplary service to the City

[15:05] of Pacific Grove the residents of the county of Monteray wish you much success

[15:10] Joy health and happiness in all your future endeavors and I um especially

[15:16] pleased to be able to present this to bill because uh he has really been a a a

[15:21] strong um a very good contact for me to have a

[15:26] really strong leader someone who represents not just the City of Pacific

[15:30] Grove but a really a like a more of a Visionary sort of person uh as the

[15:37] supervisor I pulled together the we had uh sort of bimonthly meetings of the uh

[15:42] three mayors that I represent city of Carmel City of Monteray and City of

[15:46] Pacific Grove and Bill was always so um important at those meetings because he

[15:51] would ask questions that the others hadn't thought of and then we would have

[15:56] the opportunity to have Unity among the Mayors particularly around the issues of

[16:01] covid bill was a really strong leader in Co in our community and in our County

[16:07] and will be remembered for that um one of the first things that we did of

[16:11] course everyone remembers the the uh ship that came in but honestly Pacific

[16:17] Grove has a reputation of being a really welcoming Community because of that

[16:21] activity and then the the opportunity we had to speak with the other two Mayors

[16:26] leading with Bill's leadership about how how we are we going to deal with the

[16:31] beaches during covid and it was really helpful and he really you should be very

[16:35] very proud of the mayor that you have had and I know equally proud of the new

[16:40] mayor that you're going to to have so it is just with that that I wanted to be

[16:44] able to present this to you personally because um it's been such a treat to

[16:48] work with you so I really really value you thank you and I thank you as well

[16:54] and I'm looking forward to carrying on in the time that I've had a chance to

[16:57] work with you the things that I know are important to you and to Pacific Grove

[17:01] and getting to continue working with the rest of your colleagues here on the

[17:05] council and making sure things like our water supply are secure and solid and

[17:10] continuing the work you did thank you thank you so much

[17:29] um so the first the first uh outgoing council person that we'll recognize

[17:34] tonight for their years of service and all that they accomplished in that time

[17:38] I'll turn this way is uh council member Luke

[17:42] KY um as you all know in I think all of years Luke Luke's years of service he

[17:48] has been uh very busy he's definitely somebody who comes to work every day and

[17:52] has put a lot into this position a couple of the accomplishments that we'll

[17:56] we'll highlight here this evening are first of all introduced um some valid

[18:00] measures you know the most recent one being major Q which passed which further

[18:04] clarified the city's prohibition on time shares um Luke also introduced quite a

[18:08] few ordinances um that further limited the impacts of short-term rentals on the

[18:12] community push um pushed forward efforts to protect the urban forest and our

[18:17] natural habitat things that motion things that been put in motion will

[18:21] continue on uh promoted additional Financial transparency in the city and

[18:25] in Council decision-making initiated a council policy to increase public

[18:29] participation in Council meetings and then served on several subcommittees

[18:34] again you know kind of the tireless work that he's been doing the whole time here

[18:37] one of the things that I will miss being only six months on the job here is just

[18:41] having that research you know person that I that is always there to answer a

[18:45] question but we'll still have your phone number so I'm sure I'll be able to call

[18:49] um but uh you definitely you know have an archive of information so with that

[18:55] um on behalf of the the city city council and the residents we like to

[19:01] present you with this recognition and a certificate of appreciation for your

[19:05] years of service than

[19:12] Ma and uh we also had two others that couldn't be with us tonight we have one

[19:16] from um assembly member Don Addis his office that will present A C certificate

[19:21] of recognition and also one from Senator lair's office keep for yourself all

[19:27] right thank you I would like to

[19:31] say thank you Matt first I want to thank uh the PG voters for all their support

[19:37] over the years that's meant a lot to me and I I deeply appreciate it I also want

[19:41] to thank my colleagues and staff uh I've enjoyed participating in local

[19:45] government and I'm very proud of the accomplish accomplishments and progress

[19:49] we have made especially in the last two years so thank you very much

[20:04] and doing the honors of um recognizing mayor Peak this

[20:08] evening do I have incorrect we switching up the

[20:12] schedule okay I think this one's good too dueling microphones Max

[20:17] yes good evening everyone mayor I'm gonna stand right

[20:22] here so you want to join me over here so it's great to be here tonight

[20:27] and see everyone here uh H and I've been given this great opportunity to thank uh

[20:33] Mayor Bill Peak for his many years of distinguished service to the community

[20:37] City of Pacific Grove first elected in 2014 he served on the council for one

[20:43] four-year term but in 2018 his number was called and he won his first mayoral

[20:49] election he won two elections after that in 2020 and

[20:54] 2022 so he's 4-0 as it is and I would say in my opinion it's no

[21:01] accident that he's 4 and0 because he's a tireless campaigner he's very bright and

[21:06] he made it a point to visit every single door in the

[21:10] community um I feel that he wanted to know what the voters wanted for the

[21:14] community and that's really what drove him doing that and also what drove his

[21:20] leadership in the City of Pacific Grove now if you've been around here long you

[21:24] know that we have some pretty long meetings here some that go into the to

[21:29] the late hours of the evening and I sometimes joke that I never saw Bill eat

[21:33] or drink anything over the course of a six-hour meeting I wasn't sure how he

[21:38] did that I said he was a machine the majority of the council

[21:44] could be enjoying fine cuisine from one of our great restaurants upstairs during

[21:48] a Clos session and trying to get full before anticipating a long meeting but

[21:52] Bill would just be sitting there steadfastly focusing on the agenda items

[21:56] getting the things checked off and an orderly fashion and that was Bill that's

[22:01] classic bill right there and that shows his dedication he also has a superhuman

[22:06] ability to sit very still during a meeting and assimilate

[22:11] information often reaching the necessary conclusions to bring consensus to the

[22:15] group these things speak to his intellect which is impressive and his

[22:20] work ethic which is equally impressive and now I think this might be

[22:24] an understatement but Bill is committed to transparency and it's not just lips

[22:28] service and it showed throughout his term he pushed for the completion of a

[22:32] great many informative reports and the publication of City documents online he

[22:38] was very in tune with the understanding the business of the government and

[22:41] making that information available to the public and Bill he loves reports I mean

[22:47] this guy really loves reports all kinds of reports I'll be frank some of these

[22:53] reports were a bit Arcane but I saw the method you get the information and you

[22:58] better understand a problem and then you can fashion solutions that was a

[23:02] Hallmark of Bill's terms his inclination to open the book and share with the

[23:06] community and his willingness to wait into a tough problem and try to solve it

[23:11] and because he was by trade an engineer you might think Bill may not be

[23:15] interested in writing a contr I will tell you that bill loves writing maybe

[23:20] as much as he loves reports he routinely took things I and

[23:25] others wrote and cut them in half much to our dismay he is an aggressive editor

[23:31] always trying to provide clear a clearer picture to the reader dispense with

[23:35] frivolities and lay out all of the options his writing is clear and concise

[23:39] and he was not afraid to put his sentiments in writing which benefited

[23:42] the community greatly giving Clarity to our policies now I could have put this

[23:48] one first but Bill is also committed to procedure and that may be an

[23:52] understatement as well but that may be his greatest gift to the city Bill

[23:57] drafted a policy for just about every issue of importance and we adopted those

[24:02] policies and they Now guide our decision-making processes for many

[24:06] important issues you see Bill before his Council service Bill worked at Chevron

[24:11] for many years and I don't know exactly what he did at Chevron but if they

[24:14] didn't have him working on policies and procedures or quality control or

[24:18] something of that nature then they were totally missing out on that skill

[24:22] set Bill understood that good procedure would not only clarify the objectives of

[24:27] the body but also to the most Equitable results he was efficient and effective

[24:32] during his terms and the council completed a great many tasks too many to

[24:35] go over but I will highlight a few the local Coastal program certification the

[24:40] point peno's Coastal Trail completion outdoor dining program the downtown PG

[24:45] Hotel under construction the ATC Hotel project in progress virtual public

[24:51] meetings in response to the pandemic the library renewal project completion the

[24:55] hiring of the new city manager and City attorney

[24:58] improved governance and we're going back to policies reserves policy board and

[25:03] commission handbook code of conduct city manager performance evaluation policy

[25:09] Council goals policy online posting of City agreements policy I mean I can go

[25:14] on here you could see that kind of see a trend here workplace safety

[25:17] policy and he also worked on building Partnerships between the school district

[25:22] and the city um helping to create a joint subcommittee with the school

[25:26] district and also helping to create the facilities use agreement so that we

[25:30] could use and share our facilities together as uh sister jurisdictions and

[25:35] all of these tasks were completed with an environment of civil and open debate

[25:39] and discourse and that is a win for local government now I I could go on and

[25:44] on and extol Bill's many virtues but I will cut this short and just add that

[25:48] bill is as wise as he is all of the other things I mentioned the city

[25:52] benefited from his Keen judgment on difficult issues that we

[25:56] faced and Bill ALS Al what some people don't know because he is such a

[26:00] professional is he likes to have a good time and hang out with his wife and

[26:03] friends so this will be his opportunity to do that now more often probably not

[26:08] going burning the midnight oil writing policies and things of that

[26:11] nature so bill with that we thank you from the bottom of our hearts for your

[26:16] contributions to our Fair City and wish you the very best in your

[26:27] retirement and I also have this is from the City of Pacific Grove and I also

[26:31] have um Senator L's office provided you with uh the Senate's uh certificate and

[26:39] assemblywoman Addis provided you with the assembly certificate thank you very

[26:44] much awesome thank you very much um last time I can say mayor protm Smith mayor

[26:53] elect Smith and uh now my head is about to burst from all the kind words so

[26:59] thank you so much um it's uh you know it's really been an honor and a

[27:05] privilege to serve the City of Pacific Grove and its residents and

[27:12] citizens um you know the key for me is that uh you all put your trust in me as

[27:20] well as city council to do the right thing and though obviously we don't

[27:26] always agree on things there was the trust that will try to do um what's

[27:31] right for everybody and so I and I know speaking for my my colleagues now former

[27:40] colleagues I can say we we always had that uh in mind so uh someone I've been

[27:47] asked um uh why steep why not run again it was just my turn to pass the Baton

[27:57] you know city government is never ending and uh so we've got a a crew that has a

[28:04] lot of energy enthusiasm and um I wish them again so

[28:10] much of success and uh now for my um my Academy Award moment and I want to

[28:19] thank first of all all my supporters I want to thank all the

[28:24] people that have participated um sometimes very vocally

[28:30] in city government at City Council meetings because that's the way this

[28:35] whole system works I especially want to thank all my colleagues um they they've

[28:42] just been um awesome and I I want to I want to single out council member

[28:49] colleti um he came in um no one has worked harder and investig ated

[28:58] more aspects of city government than he has in the in uh the last four years so

[29:04] that was always appreciated we had many many long discussions about how things

[29:09] should should work better so thank you so much and then of course um I want to

[29:15] uh thank uh Shirley who put up with so many discussions often you know it's a

[29:23] late at night council uh Council meetings and none of can just you know

[29:29] turn it off and go to sleep at uh at 11:00 at night and she's there nice

[29:35] nicely listening to me go on and

[29:40] on so thank you so much

[37:17] vs of Pacific Grove the total came out it was about

[37:21] 85.3% of the city voted and I me we could tell the rest of the country a

[37:27] thing or two about how important it is to get out and

[37:31] vote um and to the people who came here tonight to support the process thank you

[37:36] very much tonight I would like to offer a

[37:40] land acknowledgement with the hope that we can add this to the council agenda at

[37:44] some point in the near future perhaps after the C of Allegiance

[37:49] and have a different council member read it at each

[37:52] meeting I would also like to suggest that we put this item on the agenda

[37:58] uh next time with the council supp direct the Dei task force to work with

[38:03] the r representatives to draft the land acknowledgement for the City of Pacific

[38:10] Grove indigenous land acknowledgement ining according to North West University

[38:16] it will so understanding history that has brought us to his ey on the land and

[38:21] to seek to understand all place within that history one acknowledgements to

[38:27] exist in past tense or historical content colonialism is a current ongoing

[38:34] process and we need to be mindful about our present

[38:39] participation so for tonight I offer this we acknowledge that we are meeting

[38:45] today on the land of the Rumson aloney people whose ancestors cared for this

[38:50] land for thousands of years we honor their connection to this land and

[38:55] respect their presence past present and future thank you your honor thank you

[39:01] council member uh any further council member comments before we go on to

[39:05] reports from the city attorney if any seeing none we'll go ahead and I'll

[39:11] turn to my uh city manager do you have any report

[39:15] tonight you uh Mr Mayor um I do have a couple things to update the the council

[39:20] and community on um the first one is from our Community Development

[39:23] Department on our regarding our housing element so our draft housing element is

[39:26] going to be reded for public review and comment on Monday December 9th um this

[39:31] will will address hcd comments that were received in January and changes to the

[39:35] housing sites inventory that removed unclassified sites that would have been

[39:39] require that would have required a vote of the people you remember we went

[39:42] through this process a couple months ago the 7-Day public comic period will be

[39:47] open um from December 9th 5:00 pm through December 16th and all comments

[39:52] should be sent to housing at City ofp Pacific grove.org or um and you'll be

[39:58] able to find all that information on our website under our housing element web

[40:02] pages um the other thing just for the public and for the council's preview is

[40:07] on our next council meeting uh uh we will be talking once again about

[40:10] districting so we'll have our second public hearing of our four um and that

[40:14] will be basically a repeat of the the hearing we did on November um 20th so

[40:20] just a heads up on that one thank you very much and I'll turn to my our City

[40:24] attorney if you have anything I have no reports tonight oh thank you sir okay

[40:37] agenda I will uh acknowledge Rotary Club of Pacific Grove for Their

[40:55] donation you probably all are aware this is our 30th year of the auto rally and

[41:01] the auto rally was developed um in 1994 to support the youth center so we

[41:08] have a check tonight for the Youth Center and our president Julie

[41:18] Ross it's the amount of 10,000

[41:28] uh there's also a donation for the children's Library as well and we just

[41:32] really wanted to thank Dan go Katie Clark for all their support the city for

[41:37] supporting this event for 30 years as well as uh he's retired now but Rocky

[41:43] always did a great job for us from public works and this past year Martin

[41:47] really stepped up and filled his shoes and helped out immensely so we really

[41:52] appreciate all the support uh to be able to continue to do this event so thank

[41:56] you thank you very much thank you so much for all you

[43:13] Lights be down there at six o'clock on lighthouse we have 57 entries including

[43:18] Santa then Saturday is still will fun in the park 11 to 2:00 Santa will be there

[43:25] as well lot of fun for the kids and it's all free um Tuesday is our holiday at

[43:30] the ends we're almost sold out we're going to sell 500 tickets this year

[43:35] we're at almost 400 right now so get your ticket if you want to go they're

[43:38] $30 that's from 5 to 9 on Tuesday the 10th then we're bringing for the

[43:43] business improvement district we have um it's called shop zip and stroll from 5:

[43:49] to 9 on Thursdays December 12th and the 19th and Santa will be down there hot

[43:56] chocolate stores will be open do your last minute shopping downtown Pacific

[44:01] Grove and that'll be all over lighthouse we have a lot of stores that are open

[44:04] that usually are not open at night and then we're looking for carolers so if

[44:08] you know anybody send them our way thank you thank you miss

[44:20] m tonight not only to congratulate the new council members and the new May well

[44:26] the new council member the reelected council member and the mayor but also

[44:29] really to introduce myself as the supervisor elect and and encourage

[44:35] everybody on the deis that to reach out to me in my new role I take office on

[44:41] January 7th and I really feel so strongly that you know all the things

[44:46] that I talked about on the camp campaign Trail all the things that I would like

[44:50] to accomplish as The Fifth District supervisor together if we work together

[44:55] we will do so much much more so I'm looking forward to hearing from all of

[44:59] you what your vision is for Pacific Groove what are the big things you want

[45:03] to get done what are the little things that you need our help at the

[45:06] supervisor's level to help you with and just to really encourage everyone to

[45:11] please stay in touch let's work together let's do this work together and I know

[45:15] that the future is really bright so thank you all for just giving me a

[46:01] report about the BBB which is the bring back the butterflies and the butterflies

[46:05] for you new council members is a stained glass window that's hung for four

[46:10] decades in the Homan building and now we are doing the BBB is the bring the

[46:15] butterflies back committee and we're trying to get public Outreach to see

[46:21] whether or not the public wants this before we resubmit the gift and where

[46:26] they'd like to have it and I can tell you that just like it was when they were

[46:30] in the in front of the B brn bnrc people are wildly supportive of

[46:36] this gift they also by far and way support having it installed in the front

[46:44] curved window of the museum I mean it's it's a perfect place for it it fits

[46:50] there it's going to be lighted from the back I was at the tree lighting on

[46:56] Monday the kids were up on the steps singing carols and you could see the

[47:00] curved windows but if you can imagine that it's made for there it it fits in

[47:05] there it's beautiful next year if you guys accept it it'll be shining down on

[47:12] those kids and it's going to be awesome so but I did did want to give you a

[47:16] little update we've been going in front of the markets in front of what

[47:19] butterfly weekend and in front of the post office and I want to give you a

[47:23] couple of the comments that have been made because I think it gives you an

[47:26] idea how much the public really likes this um is there anything about this

[47:32] that doesn't make sense this is that's a firm yes that's excellent the perfect

[47:37] place after all it's butterfly town it's part of our history the city ought to

[47:43] jump at this I hope to see it I don't know anybody who wouldn't want this I

[47:48] like that it would be nice for people to see that I think it would go perfectly

[47:52] in our town we did ask for other locations but but the city has pretty

[47:57] much put thumbs down on the idea of it being outside somewhere you know like

[48:02] some of the people wanted it to be between the two

[48:06] lighthouses and but there's it's there's a vandalism problem it's just not very

[48:11] good so we're now going we've we've done a lot of Outreach to the public we're

[48:16] continuing to do it we have talked to hundreds of people and our group has

[48:21] been working very hard and so we're going to come here periodically to let

[48:25] you know and when we get everything set up we're meeting with the business

[48:29] Community next week but so far we talk to the people um that are building the

[48:34] new hotel there on Central this isn't working very well um but anyway they're

[48:40] really in favor of it because it'll be such a nice thing to have that square

[48:43] there with the hot brand new hotel and the library and the museum and the

[48:47] rotary gave him some nice uh picnic benches now that we have there so it'll

[48:53] be just fabulous that's that's three months going to move on to the next

[49:39] more on that later but I'm going to address the uh position of w BR bre's

[49:46] position and I am I was reading on a website called well uh PG aggressive

[49:56] party and they are congratulating their members which and they should

[50:02] congratulate their members and they are who are are the Democrats are who are on

[50:08] this Council I like you to consider the fact

[50:13] that there um on this website PG Progressive is you know some we holding

[50:20] a sign saying executive Trump I'm sure there's many people in California who

[50:25] feel that way but you also have to remember diversity

[50:30] and there are people who are Independents uh they're Republicans who

[50:34] have different points of view and I hope that the person you select for Debbie

[50:39] Vex Position will represent somebody other than Democrats or leftwing people

[50:53] the Mr I'm just a reminder that you only need to be um four to 5 Ines you should

[50:59] be four to five inches from the um microphone otherwise it's very garbled

[51:08] is Alex Miller and I am a council member with the great city of Seaside Seaside

[51:12] and Pacific Grove have a lot in common we used to share a police chief our

[51:17] police chief used to wear Seaside patch on one side and Pacific Grove Patch on

[51:20] the other we are friends I promise we both live on the we both our cities are

[51:25] both located on the best place of the world on the montere peninsula we have

[51:29] hearts of gold and we are great people everywhere on the peninsula I'm here as

[51:33] a council member to recognize the incoming Council and our new and the

[51:37] Pacific Grove new mayor Mr Smith and congratulations and a well hardfought

[51:42] campaign uh we want to strengthen the bond with the with the cities on the

[51:46] coast if we strengthen the bonds on the communities and the cities on the coast

[51:49] and the county we will be stronger together I do remember meeting the new

[51:55] mayor M Nick Smith at a cal cities event and Cal cities is a lobbyist uh part

[52:03] branch of California and Sacramento

[52:06] and being a council member one of the greatest Parts is the joys in the

[52:11] journey the joy is meeting the people meeting fellow council members meeting

[52:16] the people of our community and when I was at the restaurant at the hotel that

[52:21] we were staying at in Pasa rbl I was fortunate enough to sit next to Mr Smith

[52:28] and Mr Smith and I immediately uh started talking law and

[52:33] politics and things that are important to Everyday People things that are

[52:38] important to the youth things that are important to the elderly things that are

[52:42] important to our community and it was so refreshing the ideas that he was talking

[52:47] about because I shared similar similar thinking and similar ideologies as him

[52:52] and as he embarks on this new Journey as mayor we want to say from the city of SE

[52:57] side we wish you the best of luck and we list we wish the new council members as

[53:02] well the best of luck and we look forward to working with everybody thank

[53:05] you so much for your time thank you council member Miller appreciate

[53:52] acknowledgement um the this land was taken from the native

[53:59] people who lived here uh the current indigenous people the descendants of the

[54:07] people who were there at that time um have ancestors here

[54:13] and I I have trouble understanding the threat people feel in acknowledging that

[54:21] um this they lived a different way on the land and and current Society in the

[54:28] face of uh climate change is recognizing that the traditional

[54:35] indigenous ways of living on the land and and how they use resources um the

[54:43] the respect they had um for the land and the Sea were a tremendous

[54:52] um model to follow as whether we're doing cultural burning now with the uh

[54:59] state state parks or um is so many different ways that we that we are

[55:06] learning um and and practicing this so I do hope that that the City of Pacific

[55:14] Grove will adopt uh land acknowledgments it's a very simple but meaningful step

[55:21] in recognizing what who who has gone before

[55:27] who is still here the Native Americans who are still here and suffering from

[55:32] from uh how they were brutally treated um I'd also like to say really quickly

[55:40] even though it's too late uh and the May mayor Peak has probably gone home former

[55:46] mayor Peak but I do want to say how much I appreciated his respect for the public

[55:51] his respect on the dis for public comment and the fact that he went to I I

[55:58] can't I don't even know how many different uh board and commission

[56:02] meetings he must have gone to all I know is from from my zoom uh vantage point

[56:09] there was the back of his head all the time so I appreciate that connection and

[56:13] that respect for the work that boards and commissions do um and of course

[56:19] salute ket's tremendous contributions to to the city as well right thank you very

[58:02] have one classification which needs to be adjusted to avoid classification um

[58:07] salary compaction issues which is Recreation assistant 2 and as for fiscal

[58:13] impact um there is no fiscal impact since the minimum wage was taken into

[58:17] consideration for this fiscal year and this concludes my presentation thank you

[1:03:21] council effective the end of the meeting on November 20th uh and our city Charter

[1:03:26] provides a process for when we have a vacancy on our Council um that that

[1:03:31] process is fairly high level but it describes the council appointing a

[1:03:35] council um making an appointment and if the council doesn't make that

[1:03:39] appointment then within 30 days the mayor can make an appointment so the

[1:03:43] city clerk U to to get us moving within this process here has created an

[1:03:46] application form that we'll be able to use to for for those interested in

[1:03:51] applying for this position to to use to apply um so tonight we brought forward

[1:03:56] some recommendations on how the council can go through the go about this process

[1:04:00] and uh once we kind of lay these out we'd like to you know have the council's

[1:04:03] discussion and give direction on exactly how you would like to go about it so our

[1:04:08] our um our recommendation includes opening up an application period that'll

[1:04:12] go from roughly um tomorrow through January 3rd and um in that time

[1:04:17] anybody's interested to submit to be a council member can submit an application

[1:04:22] along with any other information that they'd like to to provide as well

[1:04:25] supplemental information I mean after January 3rd we'll close the application

[1:04:29] period so we won't take any more applications at that point and then um

[1:04:35] on January 15th I should step back prior to the the meeting on January 15th all

[1:04:41] the applications will be packaged together and then published on the city

[1:04:44] council agenda and on January 15th the council will um will hold a hearing if

[1:04:50] if you will almost so we we'll we'll provide a Agenda Report that's going to

[1:04:54] have all the ations with the information but we're going to redact all the

[1:04:58] personal information of course um the so during the the meeting the council will

[1:05:03] ask questions um of of the applicants but we're going to give each applicant a

[1:05:08] short period of time say five minutes if that's if that's what you desire for

[1:05:12] them to give their their um their put their best foot forward if you will and

[1:05:16] to you know present to the council the reason why they they' be a good a good

[1:05:20] nomination for the council uh following that the council will will um ask

[1:05:24] further questions if you wish to of the applicants but you will also deliberate

[1:05:29] and then ultimately you'll make a motion and begin your voting process and before

[1:05:34] I before I complete my report I will ask the City attorney if I've omitted

[1:05:40] anything well I would just add uh to what you've commented on I didn't hear

[1:05:44] you mention this you might have um as shown on the application form which is

[1:05:49] attached to the Agenda Report um the uh applications are to be obtained um from

[1:05:58] the city clerk uh either um upon request by an email to the city clerk or or uh

[1:06:05] coming in person to make that request and then the application form would be

[1:06:09] returned to the city clerk as well and uh her email address is uh in the um uh

[1:06:14] application form itself I I would also mention that um applications that are

[1:06:20] received after January 3D which is the deadline will not be considered by the

[1:06:24] city council and I have nothing more to

[1:06:28] add Mr Mayor if I could also just in your deliberations tonight if you could

[1:06:33] give us some direction as to items number I guess five and six I think

[1:06:40] that's going to be the heart of the process on January 15th just um a

[1:06:44] concurrence of whether or not you believe that's a correct process or if

[1:06:47] any of it needs to be

[1:09:25] speaking on my own behalf ioko Mr Murphy's questions it would be great to

[1:09:30] have these available before they appear in the packet so everybody can bruse

[1:09:34] them and that U I'm assuming there will be no discussions about the applicants

[1:09:40] uh outside of the brown act um I think that's probably a given my only question

[1:09:45] is really my only question is really um if

[1:09:52] uh if one of the candidates is out of town on the 15th will it be possible for

[1:09:58] that candidate to have their five minutes uh via Zoom calling in Via Zoom

[1:10:04] to make the presentation of their qualifications that's all I have thank

[1:10:24] requests as well um I do have a question um so the last

[1:10:29] day for the applications to be accepted is that by 5:00 pm or midnight um if

[1:10:54] brown act I think that extremely important right now and the fact that

[1:10:58] for the past two years we have worked very hard on transparency so I would

[1:11:02] encourage everyone to be very careful on Council as we move forward through the

[1:11:07] application process thank

[1:11:12] you no further hands are raised um thank you very much we'll go ahead and close

[1:11:17] the online public comment bring back to the council for

[1:11:21] discussion uh council member yeah I have asking for some clarification from Mr

[1:11:32] bar people calling and trying to whip votes and that kind of thing can you

[1:11:38] maybe give us some guidance and if the answer is that they shouldn't be doing

[1:11:41] that can you just make a statement tonight to let people know that they

[1:11:46] need to refrain from reaching out right thank you for asking that question um I

[1:11:50] can't stop the candidates from reaching out um but I can give you advice um

[1:11:56] which I will do right now um which is that if you are contacted by a candidate

[1:12:01] my recommendation is that you um direct them to the city manager if they have

[1:12:06] any questions regarding the application process um the reason for that is uh a

[1:12:11] matter of due process and transparency so that um the uh opportunity for the

[1:12:17] council and the public um to hear from the applicants will be at the meeting on

[1:12:23] January 15 they uh the city manager has indicated that he's recommending that we

[1:12:29] expand the public comment period from the standard 3 minutes to to give each

[1:12:33] candidate five minutes um also there'll be an opportunity for council members to

[1:12:38] ask questions um of the applicants as well so um there will be that

[1:12:43] opportunity for communication um and beyond that the application form as you

[1:12:48] can see in your packet um does include um a reference to

[1:12:54] the information that would be um requested which would be a brief

[1:12:58] description of background and qualifications and further excuse me

[1:13:03] that additional information may be attached on separate sheets and

[1:13:07] attachment of a resume is desirable so there's multiple opportunities for

[1:13:12] applicants to communicate with the council um uh with regards to their

[1:13:16] background and qualifications and their interest in the position and as I said

[1:13:20] there's opportunities for the council to ask questions and this will all be in a

[1:13:24] public meeting so that the council and the public will be hearing those

[1:13:28] Communications so my recommendation is that if you are contacted by candidates

[1:13:33] is that you um direct them to the city manager who could respond to questions

[1:13:37] that they may have about the application process because we want to make sure

[1:13:41] that that's clear and understood as far as the January 3rd date I heard one of

[1:13:45] the members of the public ask about the time my advice is that we make it 5:00

[1:13:50] that's the end of the business day um so I would suggest that that be added to

[1:13:55] the recommended action which is the motion where it says January 3rd we

[1:14:00] would add to that at 5:00 p.m as far as the brown Act is concerned

[1:14:05] um um that's what I'm here for so if anybody has any questions about that as

[1:14:10] we go along through this process um certainly getting in touch with me but I

[1:14:14] can just advise you now and the public as well that the whole purpose of the

[1:14:19] brown Act is to make sure that items happen excuse me in public so rather

[1:14:24] than uh through um I don't want to say back channels but through offline

[1:14:29] Communications especially for a position such as a ccil member we want to make

[1:14:34] sure that it's an open transparent due process um uh procedure that we that we

[1:14:41] follow here and that's why the city manager I think is um recommending the

[1:14:46] process that that you see in this Agenda Report um so I can certainly if that

[1:14:50] hasn't answered all your questions I'm I'm a lawyer I can answer questions so

[1:14:55] just ask me the next one all thank you very much Council council member mcdonal

[1:15:01] thank you mayor and um to follow up on that we had a question about whether a

[1:15:04] candidate could speak over Zoom at this meeting should we cover that at this

[1:15:07] time as well or can you answer that yeah we could cover that um attendance at

[1:15:11] meetings is allowed both in person and by zoom and um the agenda uh itself does

[1:15:18] say that so I don't think we need to add that un unless you all felt it was

[1:15:24] necessary but um any any member of the public applicants or otherwise um are

[1:15:31] are aail they they can attend by

[1:15:36] Zoom Council thank you um I wanted to just clarify a couple of things to um

[1:15:43] the so so at any point in time between now and January 15th the council is not

[1:15:48] uh expected to engage with any of the applicants

[1:15:53] correct I'm sorry you asked it you should engage in discussions with the

[1:15:57] candidates yeah no correct um you should just say one thing okay speak to the

[1:16:03] city manager got it and um the um the applications itself uh will they be uh

[1:16:10] posted on the website uh if not posted on the website will they be available to

[1:16:14] the council prior to January 3rd they will be attached to the um Agenda Report

[1:16:21] which goes out for the April excuse me for the Janu anuary 15th meeting um

[1:16:26] which generally is posted on the Wednesday or Thursday prior to that and

[1:16:31] and that Agenda Report is posted on the city's website so the council will uh

[1:16:36] see the applications at that time as well as the

[1:16:39] public okay um and and then I wanted to just find

[1:16:44] out if is there a time constraint on um essentially appointing someone here the

[1:16:51] charter doesn't um specify a time constraint um so if for whatever reason

[1:16:59] you know you weren't able to come to a decision on January 15th and you needed

[1:17:03] to you know have another meeting later some future date to to discuss that you

[1:17:08] could do that um the only time reference that's in uh article 12 is the 30-day

[1:17:14] vacancy um and if the vacancy has been um more than 30 days then the mayor uh

[1:17:22] has the opportunity to make the appointment uh how ever as you saw in

[1:17:26] the Agenda Report mayor Smith has indicated that um he does not intend to

[1:17:31] exercise that power if you will to appoint unilaterally um is that his

[1:17:38] preference is again as shown in the um Agenda Report is to uh seek the input

[1:17:45] from Council a vote by Council on on their preferred candidate and and he has

[1:17:49] said that he will abide by the the the vote and and only if for whatever reason

[1:17:54] the council's unable to to reach um uh agreement um at least by a majority vote

[1:18:00] on a candidate then um you know you need to have someone appointed to fill a

[1:18:04] vacancy then then the mayor would take the opportunity to do it at that point

[1:18:08] but not before okay understood um the the five minutes timeline is that uh

[1:18:15] like set in stone or or can that be changed on January 15th if if there are

[1:18:19] too many applicants for instance the the timeline on submission of applications

[1:18:24] or the timeline for the inter for the application the applicants present to

[1:18:28] the council and the time duration is 5 minutes as is written in the report is

[1:18:33] that five minute five minutes set in stone or no okay you could make it

[1:18:37] whatever time you wish I mean I I would say it should be at least three minutes

[1:18:43] because that's how long you allow you know general public comment five minutes

[1:18:47] was a suggestion if you want to make it longer than five minutes you could do

[1:18:51] that as well okay all right thank you I think he's suggesting perhaps that

[1:18:57] council member that if we have 10 applicants or 15 we would want a shorter

[1:19:02] time so um perhaps uh we would just I could have some leeway to deter we could

[1:19:08] have leeway at the time to determine uh how long of a time we give folks

[1:19:13] depending yeah the answer that is yes the mayor is the presiding officer does

[1:19:18] have the authority to expand or contract um the time that the speaker uh would

[1:19:25] have to speak and and typically the considerations that mayor Smith has just

[1:19:30] mentioned which would be if you have 10 applicants that you know if you give

[1:19:34] them each 10 minutes then you're you know talking about substantial period of

[1:19:38] time maybe if you have fewer applicants maybe give them a little more time so

[1:19:43] the applicants should be nimble and and be able if they're told on the on the on

[1:19:49] the night that um you know they've only got five they should be prepared to to

[1:19:54] trim their comments to five or if they're going to get more time they they

[1:19:58] might want to have a a backup plan to you know have some additional points

[1:20:01] they want to make thank you very much follow Council I was just going to say

[1:20:07] that uh the council the attorney has mentioned that the applicants need to be

[1:20:11] nimble so duly noted and and and I just wanted to ensure that from a timing

[1:20:17] standpoint my my real concern is really the number of applicants so uh the

[1:20:22] January 15th meeting uh this will be the priority right this is

[1:20:26] for Mr mogenson are there going to be other agenda items that are a priority

[1:20:31] um if you could push them to the back half of the agenda so that we could

[1:20:35] finish this first yeah yeah we certainly could um you know so the district voting

[1:20:39] won't be uh scheduled for January 15th so that'll be one of the bigger items in

[1:20:43] the next couple months U we will have business because we'll have taken a

[1:20:46] month between meetings but okay but we can definitely prioritize this all right

[1:20:51] thank you uh mayor yes uh Mr

[1:20:56] perck so um and I'm just going to use this for an example uh we get um someone

[1:21:04] wants to be on uh the economic development Commission in the past we've

[1:21:09] seen applicants who this is my recommendation for that but if the

[1:21:14] applicants are coming in why can't the council see which applicants are coming

[1:21:20] in I mean if let's say two applicants come in why can't we all see it and not

[1:21:27] discuss it but just see it online U to us see the application forms yeah well

[1:21:33] to see the app you indicated on January if we go to January 15th they're going

[1:21:39] to be um that's what we'll see everybody but

[1:21:44] we should see the applicants before if we get five or six we should see all

[1:21:50] those applicants before before what January 15th yeah don't you think I'm

[1:21:55] not sure how that's going to work you mean you have another meeting before

[1:21:58] January 15 no no I'm just saying you're talking about one onine if suddenly we

[1:22:04] uh let's just say um M candale suddenly gets five applications right uh rather

[1:22:12] than waiting till January 15th can't we see them before my advice is no my

[1:22:17] advice is that in order to keep this as a transparent due process procedure that

[1:22:24] we follow the um guidelines that you see in

[1:22:28] the Agenda Report which would be applications are submitted applications

[1:22:33] are attached to an agenda report that Agenda Report gets published with the

[1:22:38] agenda a week approximately prior to your council meeting and at that council

[1:22:43] meeting you and all the members of the public have an opportunity to hear from

[1:22:48] each applicant um I consulted with the city manager on this and this is the

[1:22:53] process that we came up with that we felt was the the most fair to um to

[1:23:00] everyone okay yeah uh any other council members

[1:23:05] wishing to comment on this I do have a clarifying question yes

[1:23:10] um on the application itself it uh I I wanted to know if all of the fields

[1:23:14] there are mandatory you have three modes of uh contact that I saw there um uh

[1:23:19] their home number their work number and their email because these are going to

[1:23:23] be public documents maybe they don't want to share their work number uh if

[1:23:28] they just put in their uh their email would that be adequate so do you want to

[1:23:33] take that one or I'll just keep rolling here um so so the answer first my first

[1:23:38] response to that is that um as we indicate on the form that the personal

[1:23:44] information is is going to be uh redacted or removed from the application

[1:23:49] form so that won't be um visible uh as part of of the agenda packet um and if

[1:23:57] someone you know for whatever reason didn't want to reveal their work number

[1:24:02] um and that's certainly not going to cause the applicant not to be qualified

[1:24:09] if you will to to submit the application that that information is primarily for

[1:24:14] contact reasons if there was a need to to contact them maybe for example they

[1:24:19] might say on the application form see attachment and then the application

[1:24:23] comes for comes in and there's no attachment so this is a way to you know

[1:24:28] follow up with the applicant and say you know we didn't get the attachment can

[1:24:32] you send that into us it's not intended to um for any other purpose and and and

[1:24:38] and as I said that information isn't is not going to be Public public knowledge

[1:24:43] excellent all right well um heard some comments or would you like to make a

[1:24:49] comment okay um so uh I'm looking for some action on this

[1:24:55] I help with that maybe on the recommendation um if you wanted on

[1:24:59] recommendation number two um which is would be the motion um I would ask that

[1:25:04] you supplement the motion that's in the agenda by adding uh after January 3 uh

[1:25:12] 2025 the time so it'll be January 3 2025 at 5:00 pm and and then um also include

[1:25:20] in the motion uh that the council's approving the procedure for the January

[1:25:25] 15th meeting as described in the agenda um with the exception of the uh time

[1:25:32] limit um which is five minutes that that would be uh left open to um

[1:25:38] determination at the time of the January 15th meeting and if you don't want to

[1:25:43] have to repeat everything I just said you could just make a motion consistent

[1:25:47] with the statements so were just made by the City attorney would anyone like to

[1:25:50] make that motion um I'd like to make the motion with the statement as was made by

[1:25:55] the City attorney thank you we have a motion in a second um any discussion
