[1:59]
Mhm.
[3:31]
» All right, it's 1:30. We'll go ahead and
get started. We'll have the prayer
[3:33]
followed by the pledge of allegiance.
[3:37]
Father God, we thank you for your
kindness in bringing us all together
[3:39]
today.
Though we may not know what this meeting
[3:42]
holds, we know that you do.
As we begin, Lord, help us to keep your
[3:46]
mind and keep your word in mind. Lead us
into conversations that are fruitful and
[3:50]
enrich the lives of those who are here
today.
[3:53]
When we are undecided, please lead us in
your wisdom. When our opinions may
[3:57]
disagree,
help us to remain respectful to one
[4:00]
another. More than anything, Lord, would
you help us both to seek your will and
[4:04]
to pursue your glory through all that we
say and do. In Jesus' name I pray. Amen.
[4:09]
» Amen.
>> I pledge allegiance to the flag of the
[4:13]
United States of America and to the
republic for which it stands, one nation
[4:18]
under God, indivisible, with liberty and
justice for all.
[4:26]
» All right, I call the meeting to order
for agenda business. Public comment?
[4:29]
» No, sir.
>> Minutes. We have two sets of minutes. We
[4:33]
have our first one from our um
regular session that we held
[4:39]
on the 16th of April.
[4:44]
» I'll make a motion to approve the
minutes as submitted for the April 16th
[4:48]
uh commission meeting.
>> All right, motion on the floor is to
[4:51]
approve the minutes from our April 16th
meeting. Is there any further
[4:53]
discussion?
All in favor?
[4:55]
» Aye.
>> Then we have um
[4:58]
we had a special meeting after that. It
was for our court security um
[5:02]
grant. And then we also laid the levy
on that same It was the same
[5:08]
the 21st.
It was the 21st that we had that special
[5:11]
» All right.
>> So, do we have a motion to approve the
[5:13]
minutes from our special session on the
21st?
[5:17]
» I'll make a motion to approve the min-
minutes from the special session meeting
[5:21]
held on April 21st as submitted.
>> All right, so the motion on the floor is
[5:24]
to approve the minutes from the 21st uh
April meeting. Any further discussion?
[5:29]
All in favor?
>> Aye.
[5:31]
» Uh
um reports.
[5:34]
Rob?
>> Uh other thing I have is um
[5:38]
it's the time of year where we update
our bulletproof vests uh for our court
[5:44]
security officers.
We've got I think five that need need to
[5:47]
be replaced.
I'll be bringing in
[5:51]
of the law enforcement
that this is called.
[5:57]
I'll get that to you later.
>> Curry, do you have anything?
[6:02]
Ron, do you have anything? Brenda?
Update?
[6:20]
» I was just going to give a little
election report from the election
[6:24]
Tuesday.
Um,
[6:26]
early voting and election day went
pretty smooth. We did have a few issues
[6:30]
with the machines, but that's a usual
thing that happens every time.
[6:34]
They're computers and sometimes they
have little problems. We did have a
[6:39]
maintenance before the election, but it
still happens. Most situations we can
[6:45]
just talk to the poll workers, have them
reset them, and they're fine. Couple
[6:50]
couple of them we did have to go out to
the precincts and work on them a little
[6:54]
bit, but everything went smooth. We
didn't have any complaints or anything.
[6:58]
Um, election night results went pretty
fast. We were got done about 10:00 and
[7:04]
that all went pretty good. Um, the
canvas for the election results will be
[7:08]
on Monday, May the 18th starting at
9:00. It'll be here in this room. It is
[7:14]
open to the public if anybody would want
to come and watch how we do the canvas.
[7:18]
They're welcome to come.
Um, we have all the unofficial results
[7:22]
at the county clerk's office if anybody
wants a copy of that.
[7:26]
Um,
what we show here is that we had a total
[7:30]
ballots cast of 4,314
for the whole county,
[7:35]
which is voter turnout total was 24.89%.
[7:41]
Um,
and once the canvas is over, we have to
[7:45]
wait the time period. They have a
48-hour after we declare our results for
[7:50]
the county candidates to ask for a
recount. And then we have to wait for
[7:54]
the multi-county candidates for all the
other counties to declare and wait their
[7:59]
time period before we can officially
certify everything.
[8:06]
» Well, I um
>> Thank you.
[8:08]
» I just want to thank you and your staff
cuz um and the poll workers
[8:12]
» Yes.
>> um
[8:13]
for their um support of the process.
I've I've volunteered and did the poll
[8:19]
work that day. That's the first time
I've ever done it. And
[8:23]
» it, too.
>> I did it at Midland with a good group of
[8:26]
ladies there. Um it was a long day, but
um they had done it, I guess, several
[8:31]
years. And they knew how to the hook the
machines up and get the stuff rolling
[8:36]
and take care of any questions that the
people had. So, I was really impressed
[8:39]
with that. Um again, it's a long day for
them.
[8:42]
Um they they take time away from their
families, but they seem they seem to
[8:46]
enjoy it cuz they're looking forward to
doing it again in the fall.
[8:49]
Um but again, I appreciate your staff
because they they they they were ones,
[8:53]
too, that picked up the phone and and
they got a quick response back from your
[8:57]
office during that time frame.
Um for the questions that people you
[9:01]
know, most of the calls that we had were
um they weren't in our poll book. We
[9:05]
were at 185 or the precinct 55 85
precinct We were 155, they were 85.
[9:12]
Um they weren't either one of our books,
so we would call and find out where they
[9:15]
were needed to go and and most of them
well, all of them had to go to North
[9:19]
School.
>> A lot of people did, yeah.
[9:21]
» So, I just encourage people to make sure
that um that they're
[9:26]
either they they were perfectly fine
with having their picture ID, but their
[9:29]
voter's card helped out because we could
quickly see what precinct they were in.
[9:32]
And making sure that their information,
their address, and stuff is up-to-date
[9:35]
because that's where it kicked them into
like more school.
[9:39]
Um but yeah, I mean it went very smooth
at Midland. Again, I appreciate the
[9:42]
staff and the poll workers again for
that. And then
[9:46]
maybe we'll be doing it again in the
fall because they're already they're
[9:48]
already they're already asking and
they're already setting up their plans
[9:52]
for the fall. So
>> Well, thank you.
[9:54]
» You're welcome. All right, anybody else
for reports?
[9:58]
Yep.
Where's Kenny? What did you do with him?
[10:04]
He's off today.
We got Kenny for Kenny.
[10:06]
» Hi, I'm Anthony Ford for court security
for April.
[10:10]
In the courthouse, we've seen a total of
195
[10:14]
people.
Uh the items we found was a one knife
[10:19]
and two uh
other items, miscellaneous items.
[10:23]
And James Annex, we've seen 1,376.
[10:28]
Knives 164, guns two, pepper spray
three, and three 23 miscellaneous.
[10:34]
It's from scissors to vapes to window
punch and some ammo.
[10:38]
» A window punch?
[10:41]
» And uh we
>> Huh?
[10:43]
» You never know when you might need it.
>> I guess not.
[10:46]
» The we we seen Annex, we seen 216
at two knives
[10:50]
and uh one miscellaneous and that was a
needle.
[10:54]
Uh magistrate was uh seen 710.
[10:59]
That 49 knives, one gun, two pepper
spray, and
[11:03]
two miscellaneous and they was vapes.
So there was a total of uh scanned
[11:07]
2,497.
[11:10]
I had 216 knives, three guns, five
pepper sprays, and 31 miscellaneous.
[11:16]
» K&N Annex is still the busiest one?
>> The K&N Annex, oh yeah.
[11:20]
Yep.
>> Thank you.
[11:23]
Thanks, Kenny.
All right, correspondence.
[11:30]
Okay, we have one from Rachel Warner
who's the secretary treasurer of the
[11:33]
Kiwanis behalf of Elkins Kiwanis Club. I
want to thank you for the opportunity to
[11:37]
speak at your
um about the Project Safe graduation for
[11:40]
Elkins High School and thank you for the
donation of $2,000 that we gave them.
[11:45]
And then we have one from
Mary and Joe Johnson who um wanted to
[11:50]
thank about choosing their daughter
Heather
[11:53]
for that eagle mural that we had done.
Um so they were really appreciative of
[11:57]
that and I just can't say enough about
the
[12:00]
um Heather and what she's done. I mean,
the projects that she's done for the
[12:04]
community but also for the
mission. She's really a very talented
[12:08]
artist.
All right, so announcements.
[12:12]
Next meeting will be here Monday the May
18th like um Brenda had discussed uh
[12:16]
8:00. Is it 8:00 in the morning?
>> 9:00.
[12:18]
» 9:00. 9:00 um
to canvas the votes um for the um
[12:24]
recent election that we had and then the
following meeting will be the May the
[12:27]
28th that that's our regular session.
May the 28th at 1:30 here at the
[12:31]
building.
Um reminder that the courthouse will be
[12:33]
closed May the 25th in observance of
Memorial Day.
[12:37]
And then to the uh elected officials,
all state budget revisions must be
[12:41]
submitted by the by the June 14th
meeting because we'll be ending our
[12:44]
fiscal year. So we have to have all
state budget revisions into the state
[12:48]
auditor um in time to get approved
before the July the 1st.
[12:53]
All right, so items for discussion and
action. First one is consider approval
[12:56]
of the child provider appreciation day
proclamation.
[13:00]
Who would like to speak on that one
first? Is it Stephanie?
[13:04]
Sandra.
[13:11]
» Would you like to read the proclamation
or
[13:12]
» You go ahead first and then I'll read
the proclamation.
[13:15]
» Okay, so child care providers play a
vital role in supporting families and
[13:18]
strengthening communities across West
Virginia. In large and small towns, they
[13:23]
create safe, nurturing nurturing
environments where children can learn,
[13:28]
grow, and thrive during the most
important developmental years.
[13:32]
For working families, reliable child
care makes it possible to maintain
[13:35]
employment and pursue opportunities,
especially in rural areas where
[13:41]
resources may be limited. Beyond care,
providers lay the foundation for
[13:45]
lifelong learning, nurturing
curiosity, building confidence, and
[13:50]
supporting emotional and social
development. Simply put, when child care
[13:55]
providers are supported and valued,
children thrive, families succeed, and
[13:59]
communities grow stronger. We sincerely
thank our child care providers for their
[14:04]
dedication, patience, and lasting
impact.
[14:08]
» So, we would like to do a proclamation,
um
[14:11]
Child Care Provider Appreciation Day,
May the 8th, 2026.
[14:15]
Whereas Child Care Awareness of American
organizations
[14:19]
nationwide are recognizing child care
providers on this day, and whereas the
[14:23]
child care system supports child growth,
development, and educational advancement
[14:28]
while creating positive economic impacts
for families and communities, and
[14:31]
whereas child care providers are
essential to the health of our
[14:34]
communities by fostering safe and
welcoming spaces, supporting working
[14:39]
families, and creating enriching
environments where child develop
[14:43]
children develop lifelong skills, and
whereas Randolph County recognizes that
[14:48]
child care has been has been and
continues to be a lifeline for families,
[14:52]
communities, and the economy,
as such, it is pro it has provided
[14:57]
much-needed support to providers to help
sustain the viability
[15:01]
of child care, and whereas Randolph
County recognizes that our community
[15:05]
benefits from a comprehensive, well-
resourced child care resource and
[15:10]
referral organizations like Mountain
Mountain Heart Community Services,
[15:15]
which build the supply and equality of
child care and support child care
[15:19]
providers through coaching, mentoring,
and technical assistance. And whereas
[15:24]
support for affordable, accessible,
high-quality child care represents a
[15:28]
worthy commitment to help families work,
support children's health, healthy
[15:31]
development, and learning, and keep our
economy growing.
[15:35]
Now, therefore, the Randolph County
Commission proclaims that May the 8th is
[15:39]
that the day that you wanted
May the 8th?
[15:42]
» Yes.
>> 2026 as Provider Appreciation Day in
[15:45]
Randolph County and urge all citizens to
recognize
[15:48]
child care providers for their important
work and how valuable they are to our
[15:51]
communities.
All right.
[15:54]
So, do we have a motion to approve this
proclamation?
[15:57]
» I'll make a motion to approve the
proclamation for child provider
[16:00]
appreciation day as submitted.
>> All right. So, motion on floor is to
[16:03]
approve the proclamation as it has been
submitted. Any further discussion?
[16:06]
All in favor?
>> Aye.
[16:08]
» I'd like a picture now or at the end?
Okay, we'll do yours and then do the
[16:12]
picture. All righty.
>> Thanks.
[16:14]
» You're welcome.
>> Thanks.
[16:15]
» All right. Next one.
[16:18]
All right. Next item on the agenda is to
consider approval of the Community
[16:20]
Action Month proclamation.
[16:29]
» The Community Action Network is a
proven, result-driven partnership
[16:34]
between federal, state, and local
government. One that helps hardworking
[16:39]
families move toward economic
independence while strengthening our
[16:43]
communities.
In 2025,
[16:46]
West Virginia's Community Action Agency
served
[16:50]
nearly 94,000
constituents
[16:54]
and employed more than 2,000 people
statewide. These are not abstract
[17:00]
numbers. They represent working families
gaining stability, local residents
[17:05]
employed in meaningful jobs, and
communities growing stronger from
[17:09]
within.
All agencies are locally controlled with
[17:13]
boards of directors composed of local
elected officials, private and public
[17:19]
sector representatives, and engaged
community residents.
[17:23]
Continued support for the Community
Action Network is an investment in local
[17:29]
leadership,
fiscal responsibility, and proven
[17:33]
results. Strengthening families,
supporting the workforce, and building
[17:38]
stronger communities across West
Virginia. And we have a community action
[17:44]
um
worker uh Jean Perkey
[17:49]
with us today.
>> So, what we'd like to do then is to um
[17:54]
do a proclamation for Community Action
Month for May.
[17:58]
And it states that whereas community
action creates pathways to prosperity by
[18:01]
helping hardworking families achieve
economic independence rather than
[18:04]
keeping them reliant on government
assistance. And whereas community action
[18:08]
is built on innovative, responsive, and
effi-
[18:10]
efficient programs that are uniquely
tailored to meet local needs. And
[18:14]
whereas community action delivers
high-impact, cost-effective results that
[18:17]
generate a significant return on
investment for local communities.
[18:21]
And whereas community action invests in
a private sector job creation and career
[18:24]
training, ensuring that communities grow
through free market solutions.
[18:29]
And whereas community action agencies
are trusted pillars of the community
[18:32]
that that engage volunteers who donate
their time to advance local progress,
[18:37]
support working families, and contribute
to lasting community success.
[18:41]
And whereas community action programs
are both necessary and popular,
[18:44]
delivering effective, high-quality
assistance that strengthens communities
[18:47]
resilience and fosters local prosperity
prosperity.
[18:51]
And now therefore, the Randolph County
Commission does hereby proclaim May 2026
[18:55]
as Community Action Month in recognition
of the hard work and dedication of all
[18:59]
West Virginia community action agencies.
>> Now, we can get a picture.
[19:06]
» You want to do it
>> Oh, we got to do a vote first. Um
[19:09]
so, we have a motion Do you have a
motion on the floor to approve community
[19:11]
action month?
>> It might be a good idea.
[19:14]
» I'll make a motion to approve the
community action
[19:17]
month
proclamation as submitted.
[19:20]
» All right, so the motion on the floor is
to approve the community action month
[19:22]
proclamation. Any further discussion?
All in favor?
[19:24]
» Aye.
>> Aye. Now, Peter.
[20:32]
» All right.
[20:36]
» All right. Thank you, ladies and
gentlemen.
[20:39]
Um next item on the agenda is consider
approval of the fiscal year 2026-27
[20:43]
pro officer contract with the Board of
Education. You want to go over that,
[20:46]
sir?
>> Yes, sir. Um every year we uh we have
[20:58]
Um school safety and all. And uh this
year's we've done the same thing. We've
[21:03]
worked out a a contract with the Board
of Education.
[21:06]
And I it's you guys have copies for
review there. Um they're going to um
[21:10]
continue to fund like they they have in
the past uh officers in the school. And
[21:16]
uh it just needs commission's signature
today, president's signature, and uh
[21:21]
then it'll go to the board for approval
to start the new fiscal year.
[21:26]
» Right.
Yeah, it says in there they're going to
[21:28]
um shall provide two that we shall
provide two police officers and they
[21:33]
those officers are
>> Uh Bear Rocky Heavner and uh Sergeant
[21:36]
Pennington.
>> And they'll be stationed out of
[21:39]
» Um
we may we may transition Danny into
[21:44]
Elkins High. We've had a lot of
activity there.
[21:48]
And uh so we may transition him into
Elkins High. They'll still cover Elkins
[21:51]
Middle and Tygart Valley High Middle as
well. Um he his station may change from
[21:57]
Elkins Middle to Elkins High.
>> Okay.
[22:01]
Any questions on this?
>> No.
[22:03]
» I read through this the other day, so
we're good.
[22:06]
» Pretty much the same every year.
>> Yep. All right. Um so do I have a motion
[22:10]
to approve the agreement with um
Board of Education for the fiscal year
[22:15]
2026-2027 PRO Officer contract?
>> I'll make a motion to approve the fiscal
[22:20]
year 2026-2027 PRO Officer contract with
the Board of Education, Randolph County.
[22:24]
» All right, so motion is on the floor.
Any further discussion?
[22:28]
All in favor?
>> Aye.
[22:30]
» I grant the motion.
[22:45]
» Thank you.
>> You're welcome.
[22:48]
» All right, next item on the agenda is
consider approval of Leads-ville PSD
[22:51]
Board reappointment of Barbara
Zicafoose.
[22:54]
All right, so we've received a letter um
requesting that um we reappoint
[23:00]
um Barbara back to the board. Her new
term
[23:03]
um, will begin July the 1st and expire
uh, this year and expire of June 30th of
[23:08]
20 2032.
Um, so do I have a motion to approve the
[23:12]
board reappointment of Barbara?
>> I'll make a motion to approve the
[23:18]
board reappointment of Barbara Zicafoose
to the Leedsville PSD board as
[23:21]
submitted.
>> All right, so motion on the floor is to
[23:23]
uh,
to approve the reappointment of Barbara
[23:26]
Zicafoose to the Leedsville PSD. Is
there any further discussion?
[23:29]
All in favor?
>> Aye.
[23:31]
» All right, the next one we have a
consider approval of Norton Harding Jim
[23:34]
Town PSD appointment to fill the
unexpired term of Gary Currents in his
[23:40]
resignation.
Um,
[23:48]
so we have a a letter from them
requesting we have Gary Currents who's
[23:52]
resig- resigning from the board and
they're they're wishing to appoint
[23:55]
Curtis Elmore to fill that unexpired
term
[23:59]
um, to begin May the 14th of this year
and expire June the 30th of 2026.
[24:05]
So do I have a motion to approve?
>> Yeah.
[24:08]
I'll make a motion to approve the Norton
Harding Jim Town PSD appointment of
[24:13]
Curtis R. Elmore
for the unexpired term of Gary Currents
[24:18]
uh, due to his resignation. It'll begin
May 14th of 2026 and will expire on June
[24:23]
30th of 2026.
>> All right, so motion on the floor is to
[24:26]
approve the appointment of Curtis Elmore
to um, the Norton Harding Jim Town PSD
[24:32]
beginning May the 14th and expiring June
the 30th of 2026. Is there any further
[24:36]
discussion?
All in favor?
[24:38]
» Aye.
>> All right.
[24:41]
Um, next is consider approval of

[25:08]
So, they need to get them all caught up.
[25:13]
Okay.

[25:23]
So,
>> You want to do these individually or
[25:26]
together?
>> Her term is going to end on June Well,
[25:30]
just all at once. We do Her term is
going to end June the 30th of '28.
[25:34]
Heidi's is going to expire on June the
30th of of '31.
[25:39]
Uh Christine Long is is June the 30th of
'2030. And Donna Knotts is June the 30th
[25:45]
of '29. Yeah, usually they wrote they
fall off, so they don't all fall at the
[25:48]
same time. So, we're just getting them
all caught up. Um so, do we have a
[25:51]
motion to approve these reappointments
as they've been submitted?
[25:55]
» I'll make a motion to approve the
Helvetia Public Library Board
[25:58]
reappointments as submitted.
>> All right. So, motion on the floor is to
[26:02]
to approve the reappointments to the
Helvetia Public Library's board. Any
[26:05]
further discussion? All in favor?
>> Aye.
[26:08]
» All right. Next item on agenda is
consider approval of Whitmer's Federal
[26:11]
Surplus Property Program letter.
Um received a letter um
[26:17]
from the Whitmer Volunteer Fire
Department. So, we're uh
[26:21]
we're going to do a support letter. Be
advised the Whitmer Volunteer Fire
[26:24]
Department provides an essential public
service to the citizens of Randolph
[26:27]
County. The Whitmer Volunteer Fire
Department is is an essential part of
[26:30]
Randolph County's safety program. It is
considered an instrumentality of the
[26:34]
Randolph County Commission is carrying
out fire fighting and other public
[26:36]
services. The Whitmer Volunteer Fire
Department is funded by the Randolph
[26:39]
County Commission if and when funds are
made available for this purpose.
[26:43]
Randolph County Commission supports the
the Whitmer Volunteer Fire Department in
[26:47]
their efforts to participate in the
Federal Surplus Property Program.
[26:50]
So, do we have a to approve um
the
[26:54]
surplus property program letter for
Whitmer Federal Whitmer Fire Department?
[27:00]
» All right. I'll make a motion to approve
the Whitmer Volunteer Fire Department
[27:03]
letter on the Federal Surplus Property
Program.
[27:05]
» All right. So, motion on the floor. Is
there any further discussion?
[27:08]
All in favor?
>> Aye.
[27:11]
» Next, Priscilla, consider approval Our
Town's 4th of July event funding
[27:16]
request.
[27:20]
» Um I'm here asking the county commission
for $5,000 in support of the July 4th
[27:28]
car show.
Um it will take place on Saturday, July
[27:32]
4th and Sunday, July 5th. The big news
is that it's moving. It's going to be
[27:39]
held once again
at Elkins City Park. It took a lot of
[27:45]
hours and discussions, but they finally
got there and
[27:50]
the Mountain State Street Machine
members are very excited about it. There
[27:54]
are a lot of classic car owners
who want shade for their cars.
[28:01]
They're hopeful that the move back to
City Park might increase that
[28:07]
those really old cars coming back to the
car show. And all we can do is wait and
[28:12]
see, but it was one of the big reasons
for the move.
[28:16]
Um they're going to have
there'll be five monetary prizes. There
[28:24]
are a number of trophies including best
in show. They are going to have food
[28:29]
vendors on site.
Um
[28:34]
you know, we're at the point where back
in 2018, Our Town
[28:39]
was established
to save the car show and time has
[28:44]
evolved and Our Town has evolved. We're
now doing the
[28:48]
July 4th concert and the fireworks.
We think that
[28:54]
um
collectively we we are really providing
[28:58]
a good experience for the residents and
visitors to come to Elkins for the 4th
[29:04]
of July. And we think that the different
events feed off each other. Car show,
[29:10]
you come to see the car show, you stay
to see the concert.
[29:13]
Vice versa, you come for the car show,
I'm sorry, the concert, you come early,
[29:18]
you go to the car show.
So, we're thinking we're anticipating
[29:23]
having a very good crowd. It is
America's 250th birthday. There will be
[29:28]
several other activities put on by other
third parties. There will be the parade.
[29:35]
And I think some other things are in the
offering.
[29:38]
So,
I'm hopeful that
[29:42]
we will have a really good event.
>> And good weather.
[29:47]
» Yes.
>> I know one of the things too, like I
[29:50]
mean I used to go to it and and also
take my car to the one downtown.
[29:55]
Like you said, there's no shade.
>> Mhm.
[29:57]
» And it was so hot sitting there. And I
enjoyed it at the park. So, yeah.
[30:01]
» I mean I think it's a really good thing
that we're back at the park, but it
[30:05]
wasn't easy to get there.
>> You know, I mean I I it just it just
[30:09]
makes I mean I I enjoyed it at the park.
Yeah, and I'm glad they have food
[30:12]
vendors and everything for them too.
Over there.
[30:16]
Um so, do you have anything on it?
Do I have a motion to approve?
[30:21]
» I'll make a motion to approve the
request from Our Town for the 4th of
[30:25]
July event. Uh the funding request of
$5,000.
[30:29]
» All right, so motion on the floor is to
approve the funding request for Our
[30:32]
Town's 4th of July events.
>> Okay, our hotel motel?
[30:35]
» Yes, $5,000 out of our hotel motel line.
Is there any further discussion?
[30:40]
All in favor?
>> Aye.
[30:42]
» And I just like to say we you have
really supported this for years and we
[30:48]
greatly appreciate.
>> It's a
[30:50]
» the support.
>> Again, we're taking the money out of
[30:52]
hotel motel. And that's a tax that we
get on the hotels outside the city
[30:56]
limits and you because you guys there's
a lot that they come all these out out
[31:00]
of towners with their bring their cars,
they got to stay somewhere, right? So,
[31:03]
if they stay at the Hampton or um the
Holiday Inn here in town that we collect
[31:08]
the collect we collect on Hampton, they
collect on the the city of Elkins
[31:12]
collects on the Holiday Inn. It's a
hotel motel tax that we can turn around
[31:15]
and give back to projects like this to
bring more people in the county because
[31:18]
they spend more they spend that you
know, they spend money at the hotel, but
[31:22]
they spend it at the restaurants, gas,
food, you know, everything here in town.
[31:26]
So, it's a it's a it's a win-win for us.
So, we appreciate it.
[31:30]
» Well, thank you.
>> All right. Last item on the agenda is
[31:34]
consider approval changes to special
emergency ambulance service uh fee
[31:37]
ordinance.
Um all right. On this
[31:42]
we've been we've talked about the
ordinance for
[31:46]
several months.
Um
[31:49]
we had it on our
we had in the paper, I think, twice. It
[31:53]
was on the paper at least twice.
It was on channel 12 WBOI.
[31:59]
I mean, I know I did an article uh with
the gentleman here in this room for
[32:02]
WBOI.
Then we brought it back to the
[32:05]
commission. It was on
um
[32:08]
we talked about it and then we brought
it up at a meeting for a first reading
[32:12]
and then brought it up for the second
reading.
[32:14]
And
we had no public comment on it.
[32:18]
And I knew there'd be public comment on
it cuz it's such a it's it's a big it's
[32:23]
a big thing.
Um so, I knew once we got it out there
[32:26]
for people to see when we had it out
there for people to see because it was
[32:29]
on our it was on the paper and it was it
was on our website. It was uh posted. Um
[32:34]
but they'd pay attention to it once we
had enacted it, and we sent out letters
[32:39]
to the businesses, right?
>> Once they got the letters.
[32:41]
» Once they got the letters, then
then they they paid attention.
[32:45]
All right, but we knew we would get it.
Cuz we we needed feedback, and we
[32:49]
weren't getting feedback because no one
had come to the meeting about about the
[32:54]
ordinance.
So,
[32:57]
in the ordinance, it states that um
Let me get to that page.
[33:11]
This ordinance may from time to time be
amended by the majority of members of
[33:15]
the Randolph County Commission as they
deem necessary and appropriate.
[33:19]
Um
well, after listening to
[33:23]
people in the community, businesses, and
you know, just regular citizens about
[33:27]
the about the ordinance,
we're going to make some changes, and
[33:31]
I'm glad that, you know, we finally had
the uh
[33:34]
the um feedback from the people about
it.
[33:38]
All right, one of the the first ones
[33:42]
is we're going to change the due date.
All right, so we had it in the ordinance
[33:47]
that collections would be for like if
they're going to do it for this month,
[33:51]
it'd be due they collect the money this
month and it'd be due the 5th of next
[33:55]
month. Well,
um
[33:58]
if you're running a business and stuff,
you pay usually pay your state taxes on
[34:01]
the 20th of the month. So, we're moving
the due date that
[34:06]
the money is due to us from the 5th to
the 20th of the month. So, that should
[34:10]
help um
some businesses because they won't have
[34:14]
to go to the
um accountant have them pay the 5th to
[34:18]
us and then go back and pay it the 20th
to the state, so it's all done at one
[34:21]
time.
>> Well, 5th is just too short of a time
[34:23]
period for them to try to get that
separated and get it figured out. Cuz
[34:27]
some people are going to have to do this
uh by hand simply because they don't
[34:31]
have a point of sale.
>> Okay.
[34:34]
So, that's the first change.
Um next is
[34:40]
businesses some businesses, you know,
pay their sales tax to the state monthly
[34:44]
or quarterly.
Um I know like at the gym I don't bring
[34:48]
in enough
sales uh
[34:51]
tax on items that I don't pay monthly. I
pay quarterly.
[34:55]
Um you probably pay monthly.
Um so, there are businesses that pay
[34:59]
monthly and pay quarterly. So, all if
there were we are going to allow that in
[35:05]
the ordinance.
The change is there for that.
[35:09]
Payment of collected fees can be made
either monthly or quarterly to the
[35:13]
Randolph County Sheriff's Office
or for the Randolph County County
[35:16]
Randolph County EMS Fund as consistent
with that particular how that particular
[35:21]
business pays its sales tax it collects.
Businesses that collect the fee under
[35:26]
this ordinance shall advise the County
Commissioner in writing
[35:30]
um whether it's will submit fees
collected on monthly or quarterly basis.
[35:34]
So, all you've got to let do is let us
know that we pay quarterly to the state.
[35:39]
So, I'm going to pay quarterly to the
the county or I'll pay monthly and I'll
[35:43]
pay uh to the state and I'll pay monthly
to the um
[35:46]
to the county.
That's the second change. Um
[35:51]
The third change
is
[35:55]
um
in we're going to add a line on the
[36:00]
under the exemptions process uh uh
part of the ordinance
[36:05]
that will state that in addition any
single item purchased for a purchase
[36:10]
price that exceeds $10,000 is exempt
from payment of any fee under this
[36:16]
ordinance.
Um that
[36:20]
we're we're aiming towards big ticket
items, cars, um
[36:25]
machinery, um that um
[36:30]
» people won't have to pay that, uh,
fee on that when they buy those items
[36:35]
along with the sales tax. So, um, that
should help out businesses and people
[36:40]
that, you know, when you if you buy a
car, you won't have to pay a
[36:43]
fee on that or you buy a piece of
machinery, you won't have to buy it on
[36:46]
that. Anything that's $10,000
and under.
[36:51]
Uh,
>> and above.
[36:51]
» Above, you don't have to pay the fee on,
yes.
[36:54]
All right. So, on that one, in addition
to any single item purchased for the
[36:57]
purchase price that exceeds $10,000, it
is exempt from payment of this fee under
[37:01]
this ordinance.
All right.
[37:05]
All right, and then we just want So,
those are the
[37:08]
three changes.
All right. So, the changing the due date
[37:11]
from the 5th to the 20th,
letting, uh, businesses they need to let
[37:15]
us know if they're going to pay monthly
or quarterly,
[37:18]
and then that any item purchased over
the amount of 10,000 is exempt from this
[37:23]
fee. Then we just want to clarify that
businesses do not have to list the on
[37:28]
the customer's receipt RS RC ambulance
service fee. They can track it however
[37:33]
their system will allow them, you know,
that was a big thing that how a lot of
[37:36]
businesses couldn't get that to say
that. Um, just however you can track it.
[37:40]
Um, and then to clarify
that that the fee is only applied to
[37:44]
services rendered within the county. We
have a lot of people that, businesses
[37:47]
that do that base here, but they do
services in Upshur, Barbour, whatever.
[37:52]
» You got you got heavy equipment repair
places that that go to other counties to
[37:56]
do repairs, so that that charge is in
that county, not in Randolph.
[38:01]
» Right.
All right. So, was that it on the the
[38:05]
clarifications and stuff? All right. So,
again,
[38:10]
we knew going into this that there'd be,
um,
[38:15]
some we had some pros and we had some
cons,
[38:18]
um, coming from the people, but we
weren't hearing those cuz no one came to
[38:20]
the meeting to talk about it. So, we
knew once we got it out there that we
[38:23]
would hear it. And we did. And so, we
we're trying to again, we we we
[38:28]
specifically put in the ordinance that
we by a majority vote of the commission,
[38:32]
we can change it and we are making these
three changes as of today.
[38:36]
Um so, do we have a motion to let's do
um we'll do them all together. Um so, do
[38:40]
I have a motion to approve the three
changes to the EMS uh service fee
[38:45]
ordinance?
>> I'll make a motion to approve the
[38:48]
changes to the special emergency
ambulance service fee ordinance as we
[38:52]
submitted today on May 14th.
>> All right. So, motion on the floor is to
[38:56]
approve the three changes to the EMS
service fee ordinance. Is there any
[39:00]
further discussion?
All in favor.
[39:03]
» I.
>> I.
[39:08]
Final settlements.
[39:22]
» I'll make a motion to approve the 10
final settlements as submitted.
[39:25]
» All right. So, motion on the floor is to
approve the 10 final settlements as have
[39:28]
been submitted. Any further discussion?
All in favor.
[39:31]
» I.
>> I.
[39:33]
All right. Budget revisions. Again, when
was the date on the final one? June the
[39:37]
1st?
June the 4th?
[39:41]
I guess it's June the 4th.
[39:44]
Again, uh we got to have all uh state
budget revisions in by June the 4th.
[39:48]
So, the first we have a couple in-house
budget revisions.
[39:51]
Um
first one is $4,000 for um the sheriff
[39:57]
um moving um out of a contingency
contingency line to a supply line of a
[40:01]
thousand. So, do I have a motion to
approve this in-house budget revision
[40:04]
for a thousand?
>> I'll make a motion to approve the
[40:06]
in-house budget revision to the
sheriff's department in the amount of
[40:08]
$1,000.
>> All right. So, all in favor. I.
[40:11]
» I.
>> Next one is for $200 uh for the sheriff
[40:15]
um decreasing dues and subscription and
an increasing, uh, sheriff training line
[40:19]
by 200. Have a motion to approve.
>> I'll make a motion to approve the
[40:23]
in-house budget revision for the
sheriff's department in the amount of
[40:25]
$200.
>> All in favor?
[40:27]
» Aye.
>> Next, uh, next one is for the sheriff's,
[40:31]
uh, decreasing travel and increasing
contract service line by $600. So, have
[40:35]
a motion to approve this one for $600.
>> I'll make a motion to approve the
[40:38]
in-house budget revision for the
sheriff's department in the amount of
[40:40]
$600.
>> All in favor?
[40:42]
» Aye.
>> Um, next one is again for the sheriff,
[40:46]
moving from, uh, contingency line, uh,
into con- contracted service line,
[40:51]
$8,000. So, have a motion to approve
this one for $8,000.
[40:54]
» I'll make a motion to approve the
in-house budget revision for the
[40:57]
sheriff's department in the amount of
$8,000.
[40:59]
» All in favor?
>> Aye.
[41:01]
» Um,
[41:05]
and we have an in-house budget revision,
um, for $3,000. It's moving out of our
[41:10]
courthouse contractual line to the EMS
fee line. Is this for the expenses that
[41:15]
we've incurred so far?
>> All right.
[41:17]
» Um, supplies, um, letters, uh, mailing,
uh, cost of mailing out those letters.
[41:23]
Um,
>> $3,000.
[41:24]
» $3,000. Uh, we had no money in that
line, so, um, when we, again, when we
[41:28]
set up the budget, we didn't have that
line, so we had to create that line. So,
[41:31]
we had to put money in there until we
get money in. So, it's for $3,000. So,
[41:35]
have a motion to approve this in-house
budget revision for 3,000.
[41:38]
» I'll make a motion to approve the
in-house budget revision for the county
[41:41]
commission in the amount of $3,000.
>> All in favor?
[41:44]
» Aye.
>> All right.
[41:47]
Um,
this one is in preparation of the
[41:50]
courthouse, uh, grant that we got to do
the windows.
[41:54]
We're going to move, we got to, we got
to pay for it, and then we get, like,
[41:57]
reimbursed, correct?
So, um, we're moving out of our
[42:01]
contracted service line, uh, 23,441.03,
and then into, um,
[42:08]
the grant lines for those windows that
were have been created for that.
[42:12]
So, this one is for 23,44103.
It's in preparation for the courthouse
[42:17]
window grant. Have a motion to approve.
>> All right, I'll make a motion to approve
[42:21]
the county commission in-house budget
revision in the amount of $23,441.03.
[42:26]
» All in favor?
>> Aye.
[42:27]
» Aye.
>> All right.
[42:31]
911 to increase his overtime line. He's
moving $20,000 out of his 911 wages into
[42:36]
his overtime line by 20,000. So, a
motion to approve this in-house budget
[42:40]
revision for 20,000.
>> I'll make a motion to approve the
[42:42]
in-house budget revision for the 911
center in the amount of $20,000.
[42:45]
» All in favor?
>> Aye.
[42:46]
» Aye.
All right.
[42:49]
And no state budget revisions.
All right, division of property revenue
[42:53]
assessments.
[42:58]
» I'll make a motion to approve the center
revenue assessments as submitted.
[43:03]
» Motion on the floor is to approve the
center revenue assessments as they've
[43:05]
been submitted. Any further discussion?
All in favor?
[43:08]
» Aye.
>> Aye.
[43:09]
Distressed properties?
Zoning letters?
[43:12]
» No.
>> Uh fire fee adjustments?
[43:17]
» We got 169.
I'll make a motion to approve the 169
[43:20]
fire fee adjustments as submitted.
>> All right, so motion on the floor is to
[43:23]
approve the 169 fire fee adjustments as
they've been submitted. Any further
[43:26]
discussion?
All in favor?
[43:28]
» Aye.
>> Aye.
[43:29]
Payment of the bills?
