Good evening chair. Good evening members
of the planning and zoning board. Um
[5:07]
it's been a while so it's wonderful to
see you all tonight. Um, as our long
[5:12]
header told you, tonight we will be
adopting amendments to chapter 32 um, in
[5:17]
order for us to adopt a master plan that
was presented to you all um, a couple
[5:22]
meetings ago. Before we do that, I'm
going to give a little bit background
[5:26]
just to kind of catch us up. Um, in
January of 2024, we the city council
[5:32]
adopted ordinance 4245 that established
chapter 32, which was the arts and
[5:37]
public places. Um and then from there,
one of the key components that were
[5:41]
found inside of that ordinance was that
we were supposed to have a master plan
[5:45]
um developed in order for us to actually
acquire art in the city in order and
[5:51]
also to identify where to put this art
and how to do all of this, right? So it
[5:56]
was a bit of like how do we do this? So
this master plan is supposed to instruct
[5:59]
us to do this. So what we So the city
council um commissioned designing local
[6:04]
Ltd in order to lead this development.
God bless you. in order to lead this
[6:09]
development um of the master plan. So
tonight we'll talk about what um we'll
[6:14]
talk a little bit more about that master
plan, but a proposed master plan is now
[6:18]
created and we did this utilizing our
community members to envision um how
[6:24]
they would see art here in our city. So,
it's been drafted and what's been
[6:28]
drafted along with this are amendments
to that ordinance 4245
[6:33]
in order to align with our master plan,
in order to actually implement the
[6:38]
master plan.
So, tonight we'll be talking about those
[6:42]
modifications to ordinance 40 um or
4245. And so, the proposed new ordinance
[6:48]
is ordinance number 4283.
[6:53]
Some of the modifications begin with our
definition section. In our definition
[6:57]
section, we're modifying the definition
of art, work of art, and artwork. What
[7:02]
we're doing is removing the word
tangible that is in there and replacing
[7:06]
it with original creations.
In addition, there's a list of items
[7:11]
that are not considered art. We're
trying to say this is not considered art
[7:14]
for us. Um, and we clarify what that
looks like.
[7:19]
We're also adding missing definitions.
Some of those missing definitions that
[7:23]
we didn't have in our first ordinance
was what's a local artist. We didn't
[7:28]
have maintenance with respect to artwork
as well as maintenance when we're
[7:31]
talking about maintenance of the
property that has the artwork. So, we
[7:35]
add those in there. We also were missing
the word the definition for murals. Even
[7:41]
though we talk about murals in our in
our city knows about has murals and we
[7:45]
know about murals, we didn't have a
definition for that. Um, we're also
[7:48]
missing public art collection as well as
temporary artwork. What is that
[7:52]
considered?
In our new um or in our in our proposed
[7:58]
language, we also clarify the definition
of the public art master plan. We talk
[8:02]
about we talk a little bit more about
what do we consider the master plan.
[8:08]
We clarify the definitions of project.
What is a project? And then we add the
[8:13]
term unit because we were talking about
residential development but really we
[8:18]
were trying to say it's a propo it's a
um planned residential unit development
[8:22]
when we talk about our puds.
So that was a scrivener's error on our
[8:26]
apartment which we correct and then we
clarified the definition for renovation.

Further along in our in our um proposal,
we also and this is in section 324, we
[8:50]
clarify that public the public art
board's time commitment. Um we have we
[8:56]
add a time commitment for that and how
they participate a little bit more. And
[9:00]
then we also update their duties in
order for it to align with having these
[9:05]
different art activities and and adding
the community into this. It was missing
[9:10]
language on their role in doing that.
And so they wanted to add that in there
[9:14]
as well. Um for clarity purposes, we
modified the term budget. We had the
[9:19]
word budget in there, but yet everywhere
else we were saying construction costs,
[9:23]
which is uh a m which is a pretty big
difference when it comes costwise. So to
[9:27]
not burden our developers, we we have
the word construction cost there for
[9:31]
clarity as to what it is that we are
taking that 1% from. We also clarify the
[9:36]
options um the options that our
participants have where we're adding as
[9:41]
defined in this chapter so that way
everybody knows we're just talking about
[9:45]
this particular chapter.
We add language in there um that
[9:49]
clarifies how they participate um
especially those that are doing big
[9:53]
developments that come in different
phases. How are you supposed to pay the
[9:57]
fee with this? Are we doing it in
sections or are we doing it one time?
[10:00]
And ours would clarify and say yes,
you'll be paying that at one time. Um,
[10:05]
and we also removed section 3282B3
which was a very muddled. It was a lot
[10:11]
of words and whereas and it was I think
you kind of scratched your head when you
[10:13]
read it. And so we make the language
clearer in order for everyone who is
[10:18]
participating understands how to do just
that.
[10:22]
Other
modifications include um
[10:28]
we had a section where in in a in a
sense it was it did have a lot of words.
[10:33]
It's like you can give us these but they
seem very they seem very um theoretical
[10:38]
and so we we clarified that language and
that language is coming in 37 327. And
[10:44]
then we added sections 3212 which is the
actual adoption of the master plan. And
[10:50]
we added another section which is the
guidelines. It's the policies for the
[10:54]
board to utilize of how they're supposed
to do the call for artists, how they're
[11:00]
supposed to um evaluate. This gives them
more direction so that way they
[11:05]
understand their role as board members.
And those are the adoptions and those
[11:09]
are the modifications that we've made to
chapter 32. the recommendation that we
[11:14]
have as a staff um after working with
designing local which was a very great
[11:19]
experience for our team. Um after
working within our community to hear
[11:23]
where people thought about where they
wanted to go, the type of art that they
[11:26]
want to see in the city. Um our staff
recommends approval or we're
[11:31]
recommending that you all ask city
council um that you recommend to city
[11:36]
council the approval of ordinance number
4283.

we get into the section of the pricing
for this art, the planning and zoning

plan talks about like the feeling and um

the types of things that we'd like to
see, but we don't have an idea of what

those are exactly. That would be the
artistes that actually would that
[16:54]
respond to our call to art. And then
from there, we'd be able to go, okay,
[16:59]
this this goes based off our checklist
that is given within because art is it
[17:06]
varies, right? And so at this moment
based off of what we're trying to do
[17:10]
when the artists respond then we see if
it hits our checklist of what we
[17:14]
consider art and um what we're trying to
evaluate and then from there we know
[17:20]
what it really looks like. But today I
couldn't tell you we're going based off
[17:24]
of
this idea. Um we can but we can only
[17:29]
talk about um does it connect because
right now the idea is connecting. So
[17:34]
connecting neighbors, um connecting art
to health, connecting as that's the
[17:38]
theme that we're going with is
connecting our community.
[17:42]
» So is are we are we going behind another
city or another county in far as the
[17:47]
design we got? Are we trying to um I
don't know. I know Miami has a lot of
[17:51]
nice things down there, but are we going
behind another uh company far as trying
[17:56]
to look a certain way or we have an idea
where
[18:00]
» Riviera Beach? We are looking like
Riviera Beach. So it it'll be what
[18:04]
accentuates our community. So during the
surveying process, some of the questions
[18:09]
were one, how do you see our city,
right? And two, how do you want to see
[18:13]
our city? So our master plan revolves
around that. How does our community want
[18:18]
to see us? So we're not going to look
like Miami and we're not going to look
[18:21]
like West Palm Beach. The hopes is that
we're going to look like the collective
[18:25]
ideas that our community has brought
forward to say this is what Riviera
[18:29]
Beach. And it was pretty special because
a lot of people talk that this is home.
[18:33]
Like this is it's a feeling like
acquaintance in a bit of feeling like
[18:37]
home, but at the same time we're we're
big girls and boys, right? Like we want
[18:41]
to do so many big things. Um and so the
idea is that the art will capture those
[18:45]
feelings um into that and at the same
time art that connects us with our
[18:50]
neighbors and art that connects us with
our environment.
[18:54]
» So it it'll look different. It'll look
like Riviera Beach is our is our hope.

» So when there's art work that will be
purchased or you know things that the
[19:11]
city wants to do, what is the process
like? It goes through the board first
[19:17]
through the arts board and then they
make their recommendations to go to the
[19:21]
city council for a final.

So, and our idea is that we have
professionals,
[19:32]
well, let me experts within different
art fields that will be able to do help
[19:37]
with that determination and to define
art and then for them to give their
[19:42]
recommendations to our council members.

» the maintenance and the upkeep of the
grounds around our actual art, who's
[19:54]
going to handle that? So if this is art
that is on a per on the owner's
[19:58]
property, the owner worries about it.
And if it's art on our own property, we
[20:03]
will do that. Part of the evaluation
process of un of saying yes, this is the
[20:08]
art we're going to choose. We have to
make sure it's maintenance that we're
[20:10]
able to keep up with. At the same time,
>> so we won't select something that's too
[20:16]
egregious for our team and and so and
that's not too expensive for our team to
[20:20]
be able to keep up with. The artist will
come up with a rendering of what may be
[20:25]
appropriate and then the board will vote
on that.

beautifying the city is definitely one
thing that we want to do cuz we all

about progress in the city and
everything but I definitely want to make
[25:04]
sure that um when the next opportunity
comes along and this is I guess directed
[25:09]
towards uh city council that the next
time something comes along with
[25:13]
education given the amount of money that
we're spending here now we should not
[25:18]
have any um dispute about education in
our community because a lot of our
[25:23]
schools and stu students that are here
and everyone knows I'm a school teacher
[25:27]
that we need to invest into our city
also far as education along with
[25:31]
beautifying it. We also need to make
sure we're educating it also at the same
[25:34]
time. So when it's time for the money to
come in to approve these items as sure
[25:39]
as we want to make sure our city is
beautiful. We definitely want to make
[25:41]
sure that we're educating our city at
the same time. That's all I have. Does

I just wanted to know from uh staff if
is there an update on the items that I
[25:56]
requested probably about two meetings
ago. Um things that the city could do in
[26:01]
order to help its residents. We are
coming close uh to property tax season
[26:08]
and I do know last week the Palm Beach
County Property Appraiser sent out the
[26:14]
trim notice to all property owners. So
I'm just wondering is there any update
[26:20]
on the the numerous items uh
recommendations I provided?
[26:27]

perhaps the next meeting.

the little the amendments that we added

several projects to include Berkeley
[27:10]
Landing that have already received their
CEO. Just don't forget to update us on
[27:15]
the project. and the list the contractor
was supposed to provide. So the board
[27:20]
can see exactly what who they hired
vendors to ensure that our Riviera Beach
[27:27]
citizens
have a sheriff in the development
[27:33]
profits.

CO that they provide that information

and I saw um

What is that? Because it did did it come
before planning and zoning? Maybe I was

out that week. I'm not sure. But I'm
trying to find out how did he get that

project? What was the process? Because
it didn't come through planning and

zoning. I mean, I never heard I was
shocked. I had to stop and go back and
[29:39]
and I love Ezra, don't don't get me
wrong, but how did he acquire this
[29:43]
project with it not been vetted out
between planning and zoning?

So that's um the town home project

in the first phase um and they have
started construction.

builders? How how did he acquire that? I

given to him? How how did that go?
>> I believe what they did

» a public bid where the plan and then
contractors provide a bid. But I I
[30:47]
couldn't say for sure cuz um
but I believe they did a a a bid uh for
[30:54]
construction.
>> It was a bid for the construction. Yes.

» How many people bidded for that project?
>> I'm afraid I I wouldn't have that
[31:03]
information. I don't know.

» No, that because it's the CRA's project.
>> I have to go to the CRA and ask us ask
[31:14]
this.
That's just okay. I I just passed by
[31:18]
that day and I Well, I remember the
whatever it is uh because it did come
[31:24]
through. Um I think we did. Didn't we
talk about that project? I think we did
[31:29]
not look like it was not too long ago we
tal talked about it and already they
[31:34]
have the thing draped around ready to
go. I mean it was just that quick.

» Yeah. I think it was maybe seven or
eight months ago that they went through
[31:43]
the approval process.
It's been that long.

» If we have a special if the board would
like a presentation or an update on the

activities of code enforcement, we could
schedule that for a future meeting.

» Right. I would because I would like to
have a I have a lot of questions about
[32:18]
some items that um we discussed before
and I know the city is probably tired of
[32:23]
um us talking about it, but we have um I
know a lot of parking issues on some of
[32:27]
our main roads where there's a lot of
parking on the side of the main roads
[32:33]
which pretty much is deemed I I feel is
deemed unsafe. I mean during the time I
[32:37]
managed FedEx, this was something that
was almost um was was not it was not
[32:43]
acceptable. So, I wanted to be able to
be able to talk to code enforcement and
[32:47]
kind of give a clear uh definition of
what we can and what we can't do and
[32:52]
what's enforceable and what's not
enforceable so we can understand it. Cuz
[32:55]
I know I get frustrated a lot in my
neighborhood by seeing certain things
[32:59]
being done and watching the dangers that
it presents and then nothing's being
[33:03]
done about it cuz sooner or later
something's going to happen and when it
[33:07]
does happen I don't want the city to be
held liable for anything. Um, so the
[33:14]
parking within the rightaway is actually
the police department, but we could ask
[33:19]
for them to come and and present to the
board to to go through um the rules and
[33:25]
how what what's allowed and and the
enforcement actions that they do take
[33:29]
place to try and uh prevent misuse of
the rightway with vehicles.

appreciate that if you can do that

cuz I'm pretty sure not only myself but
so other board members have questions

and of course the public would like to
be cleared up on it also.
