[8:38] Good morning.
[8:41] It is Thursday, August 27th, 2026 at 831 AM, and we're here for the Board of County Commissioner's Commission regular meeting. As always, we start our meetings with prayer and a pledge. If you have an telephone or electronic device, if you'll just put that on vibrator silent, just so does it disturb the meeting and it's respectful of everyone else. We've got Pastor Craig Bourne of risen savior. If you're on church here this morning, he's going to give us the invocation, and then we'll do the pledge immediately after, and I'll lead us in the pledge.
[9:09] if you'll stand as able.
[9:13] Thank you, commissioners.
[9:18] Appreciate the opportunity to be able to share God's word
[9:20] with us this morning.
[9:21] Today, you're going to walk through a bunch of issues.
[9:25] That walk is going to mean that each issue gets presented.
[9:28] And there's time for slow and methodical review.
[9:31] The details of both sides get presented questions,
[9:35] get asked, and that walk will even include time
[9:39] for citizen comments.
[9:41] And then the walk will finish, and the decision will be made.
[9:47] Citizens expect commissioners to take that walk seriously, though, they let the issues
[9:53] come forward, they're patiently here both sides, and when they must make a decision
[9:58] they'll strive to do it as justly and fairly as possible.
[10:03] Citizens want commissioners to listen to issues and make decisions, realizing the truly
[10:08] important work they have been given by the citizens, that way when commissioners act, they
[10:15] act with humility. It might not be on today's agenda, but it's a, it's a, it's a rock
[10:23] that God calls everyone to, it's a rock with him. God also invites slow mathematical review of what
[10:30] he says about himself about our lives and about the future. God presents the details of his plan
[10:37] for your rescue, and invites questions to be asked. God wants every single person close to
[10:44] him walking through this life to its finish, walking and learning to love the mercy
[10:50] God shows in Jesus Christ, walking humbly with God, who is greater by far. And acting like
[10:59] who are made for an eternity beyond this world, God calls you and me and everyone to walk with him.
[11:09] The Word of God for you and everyone to consider before this commissioners meeting from Micah chapter 6 verse 8.
[11:18] And what does the Lord require of you to act justly, and to love mercy, and to walk
[11:26] humbly with your God, amen.
[11:34] Please show me in the pledge.
[11:36] I pledge allegiance to your flag of the United States of America, and to the Republic for
[11:42] which stands, one nation, under God, indivisible with liberty and justice for all.
[11:53] Pastor, thank you for being here this morning.
[11:54] we appreciate your message.
[12:00] All right, gentlemen, I'll start to my right this morning.
[12:02] There are any changes to the agenda. All right, we'll accept the agenda as presented.
[12:09] Are there any communion announcements? I'll start to my left with Commissioner Smith, anything?
[12:16] Tonight, first Division 1, UWF football game. So that'll be that'll be exciting tonight.
[12:23] It's called us a long journey for University of West Florida and that's a culmination of a
[12:30] a lot of hard work from a lot of past in current leaders, so exciting, exciting times there.
[12:39] Yeah, Commissioner Rale was given President Diaz a hard time. He said, hey, are you going
[12:42] to come to our first D1 game? I said, we have a zoning meeting. That's what we just can't do it.
[12:48] Can't be in two places alone. But yeah, it's exciting. Good news for our community. Anything?
[12:54] All right. All right. So we'll move on. We've got a public hearing scheduled.
[13:00] at nine. So we'll move on to public forum
[13:07] and I've got Barbara Redden. If anyone that hasn't
[13:13] come to public form before, when you approach, if you just push, there's a little button on the
[13:16] base of the microphone. When that turns green, the microphone is live.
[13:28] Good morning everybody. My name is
[13:29] Barbara Redden. I live at 5781 Yucca Drive. The reason for my appearance today is because I've been
[13:35] originally working to get speed tables put on our road and the parallel road to us
[13:42] packed a little bit closer by side and what's the street again? It's
[13:47] yet the drive and the other road that's involved is cactus drive which is
[13:51] parallel to it. It runs into a brand new subdivision that D.R. Horton has built
[13:56] too many homes on and there's too much traffic on the road.
[14:04] They did a road
[14:05] and driving 59 miles an hour on my street that's 15 miles an hour is the speed limit.
[14:12] There was another person driving 56 miles an hour during the 11 to 12 o'clock hour in the
[14:16] morning on my street at 50. It was just speed limits 15 miles an hour. I have a petition that's
[14:24] signed and you have in front of you a map that I'm going to refer to. I got 100% of the people on
[14:30] drive to sign with the petition to get the speed bumps put in. I've been diligently trying to meet
[14:36] all my neighbors on cactus drive. I didn't know any of them before now, and if you hold the
[14:41] map like this, I'll read East is at the top, West is at the bottom, we'll have a long boulevard
[14:47] is, and the DR, Horton subdivision is at the East side. People drive down this road way too fast.
[14:56] I'm going to be incapacitated and handicapped.
[15:00] After my knee replacement in September and be walking on this road that has no sidewalks.
[15:06] So I would really appreciate this happening as soon as possible because I'll be walking with a walker.
[15:12] On cactus drive, I went to almost every house except for the ones that would not come to the door.
[15:21] I, the notes on the map show me how many times I went to the house. The stars show how many signatures I got.
[15:28] The houses are labeled as whether they look like they're empty or not.
[15:33] I did get a list from public works of the addresses and who owns them.
[15:38] As you can see my worksheet and I have diligently been trying to get the signatures
[15:46] according to public works, I still need two more signatures.
[15:50] I don't think any of these people that haven't signed yet are going to come to the door
[15:54] sign, and I don't know what else to do. So I'm here to plead on my behalf. There's my
[16:03] signatures.
[16:05] I was told at the beginning I had to get the addresses at 5800, which is in the
[16:11] R-Horten subdivision. So one Sunday afternoon, in the heat of the day, I went and got of the
[16:16] eight homes that are on that, that in that subdivision on cactus drive, I got five of the
[16:21] so it's time to petition. So, I feel like I'm doing more everything in above. So, thank
[16:31] you very much for your time. Thank you, ma'am. Erica Thomas and then David Jensen will be next.
[16:48] Good morning. Today, I'd like to speak to you on a more personal note regarding the boardwalk
[16:55] that's a project. Mr. Eddington, I came here as one of those tourists that you claim do not count
[17:03] on a petition in 2014. We fell in love with a place that was quiet and spoiled a place where we brought
[17:11] our family to vacation. We returned every year and finally moved to the island in 2023.
[17:19] I walked that beach most mornings. I go east to watch the sun come up over the dunes and listen to
[17:26] I'm going to share a few locals and tourist thoughts on the Boardwalk project.
[17:31] With you currently on change.org, we have 4,756 signatures and it's climbing.
[17:39] I hope you will listen. From the forum of Concerned Citizens of Nevada, Ed Greer wrote
[17:45] More Life Guards, a Free Peer Day, sponsored bands on the beach.
[17:50] And again, now that it's tourist money better spent.
[17:52] Dale Taylor, a general contractor in Navar, suggested instead of spending the money on the
[17:59] boardwalk, make the improvements on what you already have.
[18:04] He says that some of the sinks are loose, tile is broken, there are screws coming up out
[18:10] of the boardwalks all along Navar Boulevard that go over to the beach and in the marine park
[18:16] that need to be taken care of.
[18:19] Fix what we have, not what we don't.
[18:22] Wendy Pug wrote, we have lived in Navar for 21 years. We raised three children there.
[18:29] Our sons lived every spare moment, fishing and surfing, and even saving people from drowning
[18:35] on the beach. I would hate to see the beautiful wildlife disturbed on such a beautiful beach.
[18:41] Sherry Resos wrote, we love our undeveloped land at the beach. We don't want it destroyed,
[18:46] are looking like Destin or Pensacola. People love to come here for the seclusion.
[18:54] Paddy McGee said this is basically the last unspoiled beach on the Panhandle.
[18:59] Decades of locals have enjoyed it, but it will be destroyed and turned into another
[19:03] Destin if you will allow this to happen. Stop the building of anything else on this beautiful area.
[19:09] I moved over here for a specific reason. Please don't let greed take over.
[19:16] Thank you for your time.
[19:19] Thank you.
[19:20] David Jensen and then Frederick Schmidt.
[19:28] Good morning.
[19:29] David Jensen, Navar.
[19:32] Good morning, commissioners.
[19:33] I actually wanted to pause for a moment and reflect on that indication.
[19:36] I thought that was very appropriate for day.
[19:39] Slow down, walk humbly.
[19:41] Micah six eight great verse.
[19:43] We should all commit that to memory and to heart.
[19:46] On Tuesday, I actually asked this board to slow down on this project for the Navar.
[19:50] each event hall in boardwalk.
[19:52] Since then, I've gone back through the board record
[19:54] and I learned something that I think is important.
[19:57] The current event hall design traces
[20:00] to September 2025, on September 11th,
[20:03] the board discussed the redesign but took no action.
[20:06] Two weeks later, the board approved the revised design task order.
[20:11] Only three commissioners were present.
[20:14] Two voted for, one voted against.
[20:17] Commissioner Smith and Commissioner Zeddington voted again, voted for it, Commissioner Rao voted against it.
[20:24] He's the only one that's going to continue on to the next board.
[20:28] So I think, and Commissioner's right, Burkett, we're absent.
[20:31] I have searched the subsequent records so staff, please correct me if there was another vote,
[20:36] where all five commissioners went on record to say, this is the design we want.
[20:42] On Tuesday, I think Chairman Wright proposed the right path forward.
[20:45] We open the Bids on September 3.
[20:48] Let's see what this project actually is going to cost rather than relying on budget estimates.
[20:54] And the staff has done a great job breaking it into a plan A for the event hall,
[20:59] and a plan B for the parking lot in restrooms,
[21:02] which is actually what the original project was, and then several options.
[21:05] So we'll get good detail.
[21:07] He also talked about looking back at the district floor master plan.
[21:12] The county spent $125,000 developing that plan in 2018 with extensive community participation.
[21:20] Yet, when it reached this board, you simply acknowledged it. It was not accepted. It was not
[21:25] approved. It was simply acknowledged. We don't need to throw away that plan. We don't need to throw away
[21:31] the event hall and boardwalk plan. We need to use what we've already done. Let's engage the
[21:37] community again, not delay indefinitely, but to determine what
[21:40] Navar wants, what parts of the project makes sense, and where
[21:44] they belong. Then when the new board is seated and brought up to
[21:48] speed, let's give them the bids, the answers, the master plan, and
[21:52] that public input. And I actually agree with you at Commissioner
[21:56] Edington, we should get everybody in a room, so we know what the
[21:59] locals want. Let's all get around the table, let's get
[22:02] engaged, and it's going to rely on these folks and the people
[22:05] watching today. If you want to have a say show up please we all want to hear. Then let's put
[22:11] that final direction before the five commissioners for a recorded vote before the contract is
[22:17] awarded. I'm not sure why we're in a rush to try to get this awarded. We need process. We need
[22:22] legitimacy. We need community engagement and then we need a deliberate decision by this board. Thank you.
[22:32] Thank you. Frederick Schmidt, and up next week, Linda folks,
[22:40] push it again.
[22:41] There you go. Good morning. Thank you for your time. I'm here to speak on behalf of myself, my wife and
[22:47] Miss Linda here about the noise that we receive in southern brew. Frederick Schmidt, Shadow Hope Drive.
[22:53] If they can be heard from the center of my property, there's no doubt in my mind that Miss Linda is hearing it throughout the entire home.
[22:58] A home that is supposed to be private. By definition, a home is a place where a person lives such as a house or an apartment.
[23:04] and where they feel safe, comfortable, and accepted.
[23:07] The definition of privacy is the right of an individual to be left alone and control
[23:10] who has access to their personal space, body, communications, and information.
[23:15] By definition, Miss Linda no longer has a home.
[23:19] She has lost her personal space because she's forced to leave her home to get away from
[23:22] seven brews music, and this is multiple locations over the last few months.
[23:26] If the county is unable to enforce the ordinance due to insufficient or unavailable resources,
[23:30] maybe there needs to be a change to the ordinance itself.
[23:32] adopting a plainly audible standard seems to be the shortest path to resolution.
[23:37] Any law enforcement official could walk into our property and clearly hear what song is being played.
[23:41] No expensive equipment to be trained or maintained.
[23:45] And the amount of time I have been here in front of you, the whole minute that I've been speaking,
[23:50] it could be determined that there's a violation of that noise ordinance.
[23:53] It's a simple fix. I don't think it takes shutting down a business. We're grateful to have another business in the community.
[24:00] We'd like the privacy of our home.
[24:01] And I'd like to thank everyone here, come to speak up, the community needs it, and thank you all for your time.
[24:09] Thank you, sir.
[24:10] Linda.
[24:11] And up next, uh, Kwon Lawson Schmidt.
[24:19] My name is Linda Fowl.
[24:22] I live in the pine groves of vision and pace.
[24:25] On December 2025, seven brew, drive in, or drop through, was open in our neighborhood.
[24:32] there has been an ongoing dispute of the plane of the extremely loud music coming from
[24:38] seven brew. We spoke with the store manager, Madden McGummery, and he talked with corporate,
[24:45] and the music was turned off for almost two months. District manager, Caitlin Browning,
[24:52] had the music turn back on in June and was told to blast it because I was the only person
[25:00] complaining, but I am not the only person complaining. Our neighborhood has been under assault
[25:06] with the music lads sometimes turned down, sometimes turned off for short periods of time,
[25:13] and then turned back on. I am always listening for the intrusion to begin. The disruption is overwhelming.
[25:22] I have lost all peaceful enjoyment of my home and yard. I want to play the video
[25:28] of me talking with acting manager page at seven brewed during a day when the music was
[25:35] extreme and it started which they are allowed at seven a.m. I say acting manager
[25:43] because no one there will say they are the manager or how to get in touch with
[25:48] management. I am holding my phone during the recording and I encourage you to
[25:54] listen to the entire seven minutes, although we're going to play part of that right now.
[26:28] That's what we were told by COVID, not even a month ago, but it turned over last
[26:34] two and about.
[26:36] So we were just following COVID tools, and I'm doing time.
[26:40] Where you understand, and you're in a walk-in walk-in walk-in, but you know, I have
[26:57] I said, I will mess with the settings when I do apologize.
[27:03] Maybe we can do a compromise and I'll talk to my manager, possibly doing like the speakers apart and said.
[27:11] You know, I don't know.
[27:14] You know, I don't know.
[27:15] You know, I say the compromise only for me.
[27:18] Well, I know.
[27:21] Thank you.
[27:23] Thank you.
[27:32] I need to hit it.
[27:33] And Joe Hurley will be next.
[27:34] Good.
[27:35] Just take your name for the record.
[27:36] Okay.
[27:36] Hi.
[27:37] My name is Corin Lawson Schmidt.
[27:38] I'm here again.
[27:40] We've been here before for the noise ordinance coming from the Res, or excuse me, the commercial
[27:45] business that is moved into a residential neighborhood.
[27:47] We've been dealing with this loud and amplified music for a very long time.
[27:50] It also affects our child who has a hearing aid.
[27:53] He just doesn't even go in our yard anymore to enjoy it.
[27:56] You know, we want to be clear.
[27:57] We are not asking for this business to be shut down.
[27:59] We're not asking them to stop operating.
[28:01] we just simply believe that this should be able to operate without forcing surrounding residents
[28:06] to listen to loud and amplify music within the R.R. and Linda lives about 45 to 55 feet.
[28:11] I'm 100 feet across the street, depending on where you are in my yard. It can be 500 feet.
[28:16] I can video record as if you are right next to the speaker. It's just obnoxious. It's
[28:22] this is a for a business that cultivates kindness. It's not very kind when I can hear you inside of my home.
[28:29] We've done everything that we were told to do, we contacted code enforcement, we contacted law enforcement, we've documented the noise, we've made repeated complaints, we've attended meetings, we've brought this issue to everyone here and we're still dealing with this, I think the most frustrating part is the circumstances often changed, the music is turned up one day, it is off one day and there's never an accurate assessment that can be made by the time someone is able to arrive, you know, we understand you guys are busy.
[28:56] We're told that there's nothing that can be done, even though the noise was clearly disturbing us before the call was made.
[29:02] And I have a serious concern about how the decibel readings are supposed to be replied upon when I have called for law enforcement.
[29:10] It's either not properly calibrated and they're uncertain of how the equipment should even be used.
[29:15] Some of your officers don't even know how to use it or they're not charged.
[29:18] They've never been able to actually get a proper reading.
[29:23] And when you guys pull up, I've got it on video.
[29:25] When you pull up with your code enforcement card,
[29:27] they run inside and they turn it off.
[29:30] It's, it's intentful.
[29:31] It's malicious.
[29:32] They do this on purpose.
[29:33] I know that it can be turned off because it was,
[29:35] it was so nice and quiet.
[29:37] And everybody lived peacefully.
[29:39] And then the new manager, I'm not even sure she's the manager.
[29:42] No one seems to know who they work for there when you ask.
[29:45] I ask them, how do you take a day off?
[29:46] And they say that they don't know.
[29:49] If the equipment is not going to be consistently ready, it'll probably maintain calibrated,
[29:54] then how are readings supposed to be considered for reliable representation for your residents should this turn into a lawsuit?
[30:00] The week ends, you know, is probably the biggest issue that we have. You all are not available. Coden enforcement is not available. That is when the music goes very, very high. It's, it really does show that it, this is maliciously done. This is intentful. If you can turn it off during the week and have it up and down, it can be turned off. I think this is them just choosing not to do this because they simply just don't have anybody making them.
[30:24] Um, you know, it's, it's up, it's down, you know, and some point I think we just have to ask ourselves whether the, the current noise ordinance, uh, for Santa Rosa, is it, is it really working, you know, and as commissioners do you all believe that commercial businesses have more rights than residents.
[30:41] Thank you.
[30:42] Thank you, ma'am.
[30:45] Up next, Joe Hurley and then Jerry Cooley.
[30:49] Good morning, Joe Hurley.
[30:51] There's been a lot of talk recently about transparency with the board open communications.
[30:56] And to that end, I tried to getting some public records.
[31:00] And I've had an extensive discussion
[31:02] of your email with the county attorney.
[31:05] And really stating that I was looking for NDA information.
[31:10] And the attorney finally came back and said,
[31:12] the BCC has no such records.
[31:14] Additionally, as stated previously,
[31:16] even the economic development doesn't have NDAs.
[31:19] The company just sends in a request.
[31:21] So I think we're just kind of playing with words here.
[31:23] We have, it's not an NDA.
[31:25] it's just a request from a specific company that we do not disclose what we're talking about,
[31:31] which by the way has a lot of implications with the sunshine, law, etc.
[31:36] So I go back to Tom and I said, you know, I'm not trying to be difficult here, but what
[31:39] the NDAs that Mr Smith and Mr Wright have been talking about is response was, he has no idea,
[31:46] but non-lawyers often use general terms that are not legally precise. And that really concerns me
[31:52] at the five of you city are paid handsomely to represent us the people and don't know the difference
[31:58] between an NDA and somebody's request for privacy. So either you the board has to talk to the
[32:05] attorney, somebody has to get their story straight, where you're both telling us on public radio
[32:10] that you've had NDA sign in your attorney saying those such things exist. So I think we've beaten
[32:16] this to death, but it's not going to go away. I will continue with it. The state's attorney now has
[32:21] paperwork and we'll see where it goes. I'm glad you're getting a good
[32:24] chuckle out of it sir. Thank you. Mr. Chairman, the reference to the
[32:30] chuckle is just because Mr. Hurley unfortunately didn't read the following
[32:35] communication or read it for you. And the board was copied. When Mr. Hurley
[32:40] thought there was some unique or problem with non-lawyers using the term
[32:46] in DA if that's what a Commissioner did. I followed up with if a Commissioner or anyone else
[32:55] use the term quote in DA to summarize the subject that would be totally reasonable and practically
[33:00] accurate. The term quote in DA is often colloquially used as shorthand for the point that the
[33:08] county is prohibited from disclosing the information per statute. I believe even some economic
[33:14] development people use the term. However, the statute is worded as I originally sent to you.
[33:19] There is no quote agreement, but the effect is the same as an NDA as the information is confidential
[33:26] per law for the prescribed time period. And as I explained to Mr. Hurley and y'all been copied,
[33:33] we have no choice. This is a law enacted by the legislature,
[33:36] release of any request for confidentiality by a company is a criminal offense. So obviously
[33:44] as county attorney, I'm not going to advise anyone to commit a criminal crime.
[33:51] Thank you, Tom.
[33:54] Jerky and
[33:59] then Tara Milillo will be next. Good morning Jerky, Milton. Certainly I've let Mr.
[34:09] Mr. Hurley's kind of taking the lead on that question.
[34:12] I think it's a question that needs to be answered and as I said before, nobody's asked
[34:20] for any confidential information in the NDA.
[34:26] We've only asked for the title page and any signature that might be there.
[34:32] Mr. Chairman, there's not such things a title page, but any title in the signature would
[34:37] a direct violation of the statute and a criminal offense, because you'd be revealing the
[34:42] information from the company who submitted the statutory request.
[34:49] I appreciate your opinion.
[34:50] It's a black and white law.
[34:52] Any citizen can look it up.
[34:53] I'll be glad to send you a copy.
[34:56] And Mr. Kooey, if you want to walk in the economic development and without our permission
[35:00] violate the law, you can maybe be a test case.
[35:04] Okay.
[35:05] So we got to the point that we're threatening people.
[35:08] I appreciate that thank you no no no no this is my time. I'm done. I'll be happy to give him this plenty of time back.
[35:20] After the conversation on Tuesday regarding the the overseas trip that was a
[35:28] well quite a few people had some additional questions to that so I'll just ask the two questions
[35:33] And if the chairman wants to answer him, he can have the rest of my time.
[35:40] No one question was, where did you travel in that period of time?
[35:49] And the other question that I was asked repeatedly was, what was the total length of the trip?
[35:57] And so if you want to answer those feel free, thank you.
[36:03] Thank you.
[36:03] there are a Milillo and then Christopher Curb.
[36:14] Get to push the button once.
[36:16] There you go.
[36:18] Good morning.
[36:19] Thank you very much.
[36:20] My name is Tara Milillo.
[36:21] I live in Navar, and I'm also talking about the boardwalk event hall
[36:26] and bridge proposal.
[36:29] I call it paving paradise and putting up the parking lot.
[36:34] By the sounds of what we're hearing today, gentlemen and ladies,
[36:39] there is a need for infrastructure.
[36:40] I'm just going to speak loud so everyone can hear.
[36:43] There's a real need for infrastructure here and you know I have to just have a lot of questions about the cost of this, you know, proposal from 5 to 15 million dollars.
[36:55] That's a huge range.
[36:56] And you know we'd like to see some transparency where are the funds going to come from.
[37:01] So I have to just have a couple of questions and I'll go very quickly.
[37:07] Well, if this passes, will the business owners, you know, who are going to be the vendors
[37:12] on the boardwalk, are they going to be told that the property is uninsurable and that
[37:16] FEMA won't not be able to touch it, and their own business policy with Santa Rosa County
[37:22] as additional insured, are they going to be told that, you know, right up front?
[37:25] has our military been briefed about the size and structure of the
[37:30] 16-foot pylons and anything with their strategic protection of our shore. Thank you very much to our veterans and active service professionals. You know, so that's these are questions. For the bridge,
[37:45] I understand we need a new EP and D study. Who's going to pay for that gentleman? Where is that going to come from? Or is it going to be tacked onto the end?
[37:56] citizens are very concerned to just about the money for this and I would like to ask
[38:01] do we have more funds in the coffers for when the next hurricane rolls in you know there's
[38:07] a lot of crazy stuff going on I will be I can witness to that I escaped from the you know
[38:13] craziness of north I'm sure you can tell with my accent but I have the same values as my
[38:18] constituent you know the people here and all of you who will run the event space business what
[38:25] the plans that say if I was a wedding planner, but I am a notary public so I can't
[38:30] officiate weddings, if I wanted to, you know, organize that for a customer or somebody
[38:36] wanting to get married, how is it going to be fair? Is it first come for a serve on a server
[38:43] that everyone's just, oh, this someone has already taken that with a deposit? How is that
[38:47] going to be just to make sure no one has, you know, uh, uh, uh, uh, uh, uh, uh, more
[38:53] influence than anyone else, you know, because it has to be fair. Um, and I
[38:59] have some questions for Julie. I, you know, I don't know how to address these. I
[39:02] can submit them in a written format. I would love to see an audit of the tourist
[39:08] bed tax. We have a lot of, wow, we're getting, we're, you know, Novara Beach is pulling
[39:12] in a lot. Can we can we have an audit just like the other volunteer fire departments have to,
[39:17] you know provide audit for funds. Can we see the result of the poll? Okay, thank you very much.
[39:23] I think I could take the risk and written for that. Chris Kirby and then Chris Malcolm.
[39:54] Chris Kirby with flood defenders. I spoke to you, you know,
[39:59] cheesy about me that by, you know,
[40:05] it's not working out there. So, what you mean doing,
[40:10] and I'm in work and so. What are you going to do? How do you fix it? Well I reckon
[40:18] then first of all you do it. Very clean and dry in the study of what's going on and we'll
[40:24] let by you in that watershed because the hydrology there is getting very interrupted by development.
[40:34] There's a lot of gaps in your
[40:41] policies for permanent inspection and enforcement. We need to stop
[40:45] bleeding,
[40:49] he doesn't stop to blame, he's not going to get worse.
[40:54] You're already going to be more flooded.
[40:57] Sound crews move on right now, we're about to rest around, I won't beat subdivision.
[41:04] You can't policy touch the bar to the state to determine an enforcement.
[41:13] That's not working for a year.
[41:16] taxpayers money to take bad actors to court for not doing
[41:22] like they're supposed to do. That's your tax dollars. My tax dollars. I
[41:29] got to do a stop the bleeding and how do you stop the bleeding where the
[41:34] buck stops at the local building permit? That's how you stop the bleeding at
[41:41] the local building permit. And your development orders. I tell you you need to
[41:47] provide proof of application and regulatory permits.
[41:50] You have codes that reference state and federal laws.
[41:55] And for some,
[41:58] we need to be consistent with what DOT has done with 3309.157
[42:04] Florida statutes, flood resilience statutes.
[42:10] They use the most current and updated NOAA rainfall data,
[42:20] since only at 32 seconds left.
[42:22] also passed out a memo of the past administration about North West Florida Water Management District
[42:30] of Environmental Resource Permining Policy. It really deals with on-products of divisions, but one
[42:36] of the things you need to look at in the state statutes that deal with regulatory activities for
[42:42] environmental resource permitting is the thresholds. When you have a common development that puts in
[42:51] out of the square foot of a public area. It requires an environmental resource permit.
[42:56] Thank you, Chris.
[42:59] Chris Malcolm.
[43:09] Turn it back on day morning.
[43:12] First time speaking, my wife and I live in District 4.
[43:20] I'm here to talk about the Board of Art Project.
[43:23] My understanding is that this property is currently designated as public recreation and conservation space.
[43:31] Now the board, supposedly approved the project before changing the zoning by changing it to, before changing it to commercial zone to accommodate the project.
[43:42] seems to me, you put the car before the vores.
[43:46] This is just my initial understanding.
[43:50] Second point is regarding amendment three.
[43:54] We all know that if it passes in November,
[43:57] it's going to result in significant revenue laws
[44:01] for the state, and they were about $12 billion.
[44:05] And I haven't heard or seen any estimates on what
[44:09] it's going to cost the county. I don't believe that there's any estimate for Santa Rosa County
[44:15] that I've seen or heard of. Until we know what the impact is going to be, all that seems
[44:22] to me, all non procured services and vanity projects should be paused until after the November
[44:29] election. Until then, it seems we should only focus on procuring only essential services. Even if it
[44:38] the past, we have a bridge to pay for. Next point is regarding what's on the Santa Rosa County
[44:47] Tourism Development website. It states regarding tourist invitations.
[44:54] We invite you to venture to Florida's Panhandle, slow down.
[45:00] And discover the uncrowded, unspored, and unburied, natural beauty, and charm of an award-beach. Here, you'll find a relaxing blend of waterfront beauty.
[45:13] And no way, in my estimation, will this project maintain or enhance the imitation to such
[45:23] tourist, trash from the particular location from this project is going to be a challenge
[45:34] to maintain?
[45:37] Next point is, my understanding is that this project passed with just three commissioners present,
[45:44] two of which voted for and won against.
[45:48] And my question to the board and supporting staff is, will,
[45:55] would, does passing this project with just two votes, is that sufficient?
[46:00] Is it an importance with the bylaws?
[46:03] And if it's not, then it should, the vote should be voided and revoked it again with at least
[46:11] having three votes and four in combination of it.
[46:15] Last point.
[46:17] Thank you.
[46:18] Sir, sir.
[46:18] Sir, your time is expired.
[46:20] Thank you.
[46:22] Tom, can you answer that question or form?
[46:23] Since he has the legal question, which one in particular?
[46:26] And reference to was the vote legal.
[46:31] Yes.
[46:31] You need a majority of the board president for a quorum, and then majority vote of the quorum
[46:38] to pass any action.
[46:39] And this otherwise specifically prescribed by statute, there are some provisions that require
[46:44] four if they are super majority votes, but in general, just a majority of a quorum.
[46:52] Thank you, sir.
[46:55] I'm certainly going to be willing to address some of the questions that came up in public
[46:58] form and I would ask that a couple of other commissions too as well for discussion
[47:02] sake.
[47:03] But I am going to say we do have two public hearings, so let's give the public hearings
[47:07] out of the way and if people would like to stick around, I'm certainly willing to address
[47:10] some of their questions.
[47:11] But in the meantime, we're going to open the first right away vacation near North First Avenue
[47:15] in Del Monte Street.
[47:17] So, it proved or denial of a vacation request from Mark and Tracy Snyder for North First
[47:21] Avenue in Del Monte Street.
[47:22] So, the applicant here, if you just come to the podium,
[47:29] if you'd like to, yeah, if you'll
[47:31] just state your name and I just for the record and explain what you want to do.
[47:34] Sure, good morning.
[47:35] My name is Mark Snyder, I'm the property owner.
[47:40] Just requesting, there's an alley between two parcels that we own.
[47:44] I did all the paperwork and did the survey that they required and it would allow me to
[47:51] have access to the back portion of our property, which we don't have right now.
[47:59] There are any questions from the board.
[48:04] This is your district.
[48:05] Is it not?
[48:07] No objection.
[48:09] I'm going to make motion to prove that objection.
[48:12] All right.
[48:13] Seen on some move.
[48:15] Contample.
[48:16] Yes, sir.
[48:16] You're approved.
[48:20] Second item.
[48:20] Approval denial of vacation requests for main royalty partnership LLC for right-of-way near
[48:24] 89.50 distribution Avenue. Is that applicant here?
[48:32] Commissioner Smith, this is in here. I know this is in what we need
[48:36] economic development as well. Yeah, this was not sure all of us have looked
[48:41] over. I don't have any objection. No heart burn over this and I'll make a
[48:45] motion to approve this one without objection. See no objection, some moved. That
[48:50] closes the public hearings. Move back over to some quick discussion before we get
[48:55] to the agenda. Regarding the UK trip, it's interesting that the gentleman came up and spoke
[49:02] and has questions referenced me going on a blog and discussing it before I mentioned it
[49:08] to anyone in the public, which is an exactly accurate. I came and told you gentlemen and
[49:15] briefed you about the trip at the next available board meeting, which if you look historically
[49:20] I've done every time we've taken a trip, whether it was the time I attended the Air War College,
[49:25] when Colonel Hamilton asked me to go do that. I came back and immediately told you guys what was
[49:30] going on. I've done that consistently.
[49:35] I stand consistent in defending any of the trips I've taken
[49:39] and knowing they were official county business and we were doing good work and we were planting
[49:43] seeds at a bare minimum we were planting seeds that were going to bear fruit in the future.
[49:48] With regard to where I went at the time, I clearly said, we went to the UK, went to London,
[49:57] went to Scotland.
[49:58] There are meetings in both places.
[50:00] I don't know how detailed we want to get and where I went and what I did.
[50:04] I mean, I guess I can try to recall how many bathroom trips I took.
[50:07] But I just don't know what level of detail you want and at one point you're going to
[50:12] stop taking a personal vendetta against me and laying your disdain for me, cloud your vision
[50:21] on what's good for Santa Rosa County and this entire community.
[50:26] I will tell you that on the section of the trip that I went on with the legislative
[50:31] delegation was the only one here on that trip, west of Tallahassee.
[50:38] I was the only one consistently telling the message and the story of Northwest Florida and how important
[50:44] Senator was a county was when we had people from Orlando, Miami, Tampa and others, constantly
[50:52] touting how great the state of Florida was and how everyone should come there.
[50:58] And if I had not been there we would have no one telling these high tech companies that we
[51:04] existed, the whiting aviation park existed, and we would love to have them come and consider
[51:12] us.
[51:13] I'm all about providing jobs for our kids and grandkids, and I will continue to do that, and
[51:17] I will continue to defend that.
[51:19] With regard to the boardwalk, there's a lot more questions.
[51:21] I've written down a compiled some questions the other day.
[51:24] Jared and I talked about it yesterday.
[51:26] We'll certainly have all those questions and have answers for them, so we can do a workshop
[51:29] and work through everything.
[51:32] I know there was, I mentioned the District 4 Master Plan the other day.
[51:36] I think some people may not even remember long before that in early 2000s.
[51:41] There was a Navarra Town Center Plan that even goes back to that.
[51:45] So, I think there's plenty of opportunity for discussion there and I, it's unfortunate that
[51:52] people see government working and they instantly, and I understand it, but it's frustrating
[51:57] that they instantly start coming out with their own conclusions and we've conspiracies.
[52:04] Because there's no conspiracy on why there was only three people voting that day.
[52:08] There's no conspiracy on trying to push a project forward.
[52:11] There's just wheels are in motion and the support is going to do their due diligence.
[52:14] And I assure you they'll be plenty of discussion on that.
[52:17] With regard to Malat, buy you.
[52:20] Commissioner Berkett, can you give us an update?
[52:22] I'm a little out of the loop on what's currently happening in Malat,
[52:25] by you. I know I've seen some photos of one resident's back yard.
[52:30] That's directly on the by you with dirt piled up and I don't know if we're referring to Arthur Hawk's house or if we're referring to something else that happened.
[52:38] Yes, there had been issues with, which are Hawk's house, when it was under construction without a proper erosion control. Those have been scripted.
[52:53] The last thing that brought up, I don't have that five o'clock that morning, I'm pulling my truck up if still dark, I'm pulling my truck up to the boat ramp, and with the head last my truck, I walk out on the dock, and I actually see the concrete down below, so that tells me the by-use particular clear, I went back down there, and I was down there that morning, trying to figure out where the violation was, I paned it out, but it being dark, I couldn't get the exact location address, I went back down there,
[53:23] 10 o'clock that morning, found the address, sent it to Assistant County Administrator.
[53:30] They started the case on it, and I went back to the Bay of York 10 o'clock.
[53:35] I have a picture on my back pocket, Jared, do you have that picture?
[53:39] We pull it.
[53:42] That's what Bay of York 10 o'clock, okay?
[53:46] So I'm doing everything I possibly can.
[53:48] There's every issue down there, absolutely there is.
[53:51] the people are breaking up. All the laws every day. I speed limit speech by people on the
[53:58] sixteenth and seventeenth. Through schools, I was on my day. So to say we can cure everything,
[54:07] like administrative administrators, and see it in the interview, let's go and use journal,
[54:12] let's get it. Founding three news, which typically they don't put the whole story down.
[54:19] And that's why I don't like the interview with them. And I just go and record seeing that.
[54:25] You go have people to scumbrate a lot, but as soon as we find out, we will get all the cases.
[54:32] Teared, if I'm not mistaken, the violator has been found inside it, and we'll be contained
[54:39] until he brings this into compliance with our name as that correct.
[54:43] That is correct.
[54:45] I just want to get that taken here.
[54:47] Thank you, sir.
[54:48] Thank you, Commissioner Brookhead.
[54:50] I wasn't aware what was going on.
[54:51] I knew you had been doing something, and I appreciate you letting us know.
[54:55] And I know you care deeply about that, you're district in that community, I know you care deeply about the waterways and we've had many discussions about land development code and what the right thing to do is appreciate your diligence on that.
[55:09] And I know that if there was something that you needed a board to help on, you would have brought that forward.
[55:13] But thank you for clearing that out because I saw some different photos and had some concerns as well.
[55:20] One last thing, and I see the folks, some of the folks that we're here talk about,
[55:23] seven-brue left, but if we have an issue with equipment not properly being charged up,
[55:31] can we just make sure that we have some policies in place,
[55:35] or at least on those of us that we have control over,
[55:38] or the county has control over regard to code enforcement.
[55:40] If there is additional training or some oversight that needs to be discussed with law enforcement,
[55:46] with the sheriff's office because I know we gave a number of those units to them.
[55:51] Then let's let's kind of figure out what needs to happen there and make sure we have an
[55:55] open line of communication on that. If I could Mr. Chairman, just two notes. So first, yes,
[56:01] absolutely will do that. I do believe some of the problematic equipment was that that's maintained
[56:05] by the sheriff's office, so we'll coordinate with them. But I did speak to Ms. Linda yesterday and then
[56:10] again this morning. We're trying to get a meeting set up with the regional manager of seven brew.
[56:13] Obviously, we have an issue with the code definitions, because if it doesn't meet the code requirement,
[56:19] you can't write a citation, but the best we can do with the lack of any changes to the code
[56:25] is sit down with the folks at the table and try to get some better coordination and a little bit of
[56:29] neighborliness. So we're working on that, but that is the next step.
[56:33] Agreed. Thank you. I think communication is always key. Go ahead.
[56:39] And I wish the people who are still here, but I don't want everybody to know.
[56:45] On my own time, which, when you're a commissioner, you have no own time.
[56:49] I'll live on a black thing.
[56:50] That's maybe making trips by there at different times, and recording, even though this is not a,
[56:57] something like a holding court, but it gives me some idea of what the violation is.
[57:02] I've yet to find it meeting, and I'm not saying they don't, and I'm sure they do.
[57:07] But just let people know, I go by their all the time, day, night, Saturday, Sunday, different times, and I record every time I go by their.
[57:17] The complainer got up there and said on channel 3 and used it, Bobby Burke and namely Bobby Burke didn't do anything.
[57:23] The very next morning, she said, yeah, I say you took by their all the time.
[57:29] Okay, so I don't do them, but I'll go there all the time, making recordings, trying to catch the violator.
[57:38] Ryan had a code enforcement. He goes by then his personal true. My wife goes by there. I put
[57:44] this program on her. She goes by there. The other day she was at Ornale place next to it,
[57:54] but she heard loud music and it was coming from a truck. Well, we can. Nothing we can do about that.
[58:01] Point is, we're trying every way we possibly can to catch these people.
[58:07] I asked Jared to set up a meeting with the authority of step ahead of me, and I thank
[58:12] you for that.
[58:13] But, set up meeting with a reasonable manager or owner of the thing, see if we can't get
[58:17] this taken care of.
[58:18] I mean, the people needs to have the right to prophecy, and I'm all about that.
[58:23] But I cannot take, they're about, and correct me, Mr. Tony, if I'm wrong, or Mr. Tony.
[58:28] I cannot take their recording or their word and go to court with hearsay evidence and basically
[58:37] that's why it is my not correct.
[58:39] No, with a decibel standard ordinance because you have to have the decibel, like just
[58:45] like a speed gun for a speeding ticket.
[58:48] Yes, I just want everybody to know I'm doing everything I possibly can.
[58:53] They in that I make trips by their.
[58:55] So until we can catch them, we're going to think of this, but we are going to hopefully get this
[59:01] lift and bird with a region of manager. I personally like to get the hornar instead of
[59:05] region manager, a possible, get this lift and the bird, but they have the right to privacy. And
[59:11] somehow, some way we're going to make it happen. Thank you. I'm through. Thank you for clearing that up
[59:17] and showing what it wants again, how much due diligence you put out there. One last thing,
[59:23] I'm not sure where this conspiracy with regard to NDAs and data centers and all this came from.
[59:32] I haven't gone back and watched the interview that I did with Blackwater Report.
[59:37] And I may have said something about NDAs.
[59:39] I certainly don't remember saying that I specifically assigned an NDA.
[59:44] And I can assure everyone here that I've only signed one NDA in my entire life that I can ever remember.
[59:50] And that is when I was selling my business back in December.
[59:56] So, I've signed no NDAs with regards.
[1:00:00] Company's common. I just know that when when when a company is interesting coming to the area and I'm
[1:00:06] brought into the conversation that I know that we don't talk about company names. And I think
[1:00:12] everyone's aware of the legal reasons for that. Jim, if you're good with it, we'll just move on to the
[1:00:25] center. The board did that, not her. They didn't want to be on the beach. At all. Take it
[1:00:36] to the board, teach these board. They came up with some of this, not Julie. Y'all are hammering
[1:00:43] her for no reason. It's time to stop doing her that way. This slide is not here. She started
[1:00:51] I'll just pull the ball out.
[1:00:53] I'm going to tell you right now, I'm going to ask this board all five of us.
[1:00:58] Let's step back on this down thing.
[1:01:00] I'm sorry for saying this.
[1:01:02] Let's do away with that center.
[1:01:05] Deal away with the parking lot.
[1:01:06] Deal away with the bathroom.
[1:01:08] Let's step back and don't put it out there.
[1:01:10] Just the boardwalk only.
[1:01:12] That's what I request y'all to do.
[1:01:15] Deal away with the parking lot.
[1:01:17] The seventh center
[1:01:20] Bathroom just the boardwalk and that's the other that's all what they need
[1:01:25] If that's what they want, but I really would love to have my name on that building, but they don't want it take it away
[1:01:32] I wish ever no man. We already had your three minutes. No, you had your three minutes
[1:01:40] we are done
[1:01:42] I wish
[1:01:43] We could pass the ordinance if you're house on that beach gets 50%
[1:01:49] the store, you cannot rebuild, add out. Like they do in the Carolinas on the beach. Then we would do away with all these buildings houses out there on that beach.
[1:02:01] That would be a stop to it. It wouldn't be no buildings out there in no houses. That's what we want. That's what you all want. I've had people call me. Why don't we put a toe on the bridge? I tried that.
[1:02:13] why didn't you come before a stat day? Well, my neighbor will be upset with me
[1:02:19] here on the beach, they don't want it, but we really need it. Well, you should have been here.
[1:02:26] You should have been here. I'm sorry, you don't get it now. Then I got accused of sending
[1:02:33] Keldonforcer and on a business. And that I did because one man in this room today kept complaining to me,
[1:02:42] over and over and over about a dumpster in the county right away.
[1:02:48] I had the kelvin force to go over, tell the man to move it because he agreed to do it at the zoning board.
[1:02:56] And I did have, and that man sitting out here right now,
[1:03:00] kept complaining about that damn dumpster in the county right away.
[1:03:03] I did turn it in.
[1:03:05] My name because he wouldn't do it because now he's buddy buddy with him.
[1:03:10] That's how it is.
[1:03:16] I can hear the frustration and your voice just as a reminder though, we can't take any action on those projects today.
[1:03:23] We'll move on to the consent agenda.
[1:03:25] Are there any questions or concerns with the consent agenda presented?
[1:03:29] All right.
[1:03:30] Seeing none.
[1:03:30] We'll pass the consent agenda.
[1:03:32] And we've got one item on the regular agenda in engineering.
[1:03:36] Mr. Chairman, there's no concerns on that one.
[1:03:38] We've addressed the comments from DOT.
[1:03:40] Typically, we wouldn't bring a contract you've already approved back to the board, but the OT sometimes is a little finicky about grant projects, so that if you'll approve it, there's no additional action that needs to be taken.
[1:03:50] Okay, so all the questions that were where we had on Tuesday were answered.
[1:03:54] All right, any questions from the board?
[1:03:56] I think further.
[1:03:58] All right, we'll approve that one without objection since I see no opposition that addresses the agenda.
[1:04:05] We'll just move on to the meeting list this evening.
[1:04:07] At 5 o'clock we have a commission special rezoning board meeting. I mistakenly said 5.30 at Tuesday's meeting. So I apologize 5 o'clock tonight rezoning board meeting tonight
[1:04:18] September 3rd I830 AM the tourist development council meeting will be held at
[1:04:23] 1370 Tiger Parkling as the Tiger Point Community Center
[1:04:26] So if people have concerns about that project, I would say show it for that
[1:04:30] September 8 at 830. We have a commission committee meeting in this board room. September 8 at 530 PM
[1:04:36] the first budget and msb public hearing will be held by this board in this board room.

[1:05:12] And this September 24th at 5 p.m., a commission special rezoning board meeting will
[1:05:16] be held in this room.
[1:05:17] And gentlemen, just so we'll go ahead and put it out now, it's already on my calendar.
[1:05:21] But I will not be present physically on the September 24th meetings, I will be out of town
[1:05:26] with family.
[1:05:26] However, I will make an attempt to call in for those meetings if possible.
[1:05:31] There are no matters to come for us, all right, see you now, we are done.
