What room are you in,
[0:09]
Frank?
[0:10]
Um, I'm in that little
[0:11]
conference room
[0:12]
near Corey's office.
[0:14]
Oh, okay. Yes, I know
[0:15]
where you are now. Good.
[0:19]
Um, you got kicked out of
[0:20]
the last one, so...Um,
[0:21]
Jen and Josh
[0:22]
set it up.
[0:24]
Yes, they
[0:25]
just had to
[0:27]
show up. So, okay.
[0:28]
Um, we're all here. We
[0:31]
can start the show.
[0:33]
Good evening and
[0:34]
welcome to, uh
[0:36]
, September, where are we
[0:37]
now? 21st meeting
[0:38]
of the Commission on the
[0:39]
Preservation of
[0:40]
Locations. Before
[0:42]
we start, a
[0:43]
quick, uh,
[0:43]
read here. These
[0:45]
meetings are being held
[0:48]
virtually as an
[0:48]
alternative means of
[0:50]
public access
[0:51]
pursuant to
[0:51]
Section 20 of the Acts
[0:53]
of 2021, which temporarily
[0:54]
amends
[0:54]
certain provisions of the
[0:55]
Open
[0:56]
Meetings Act.
[0:57]
You are hereby notified that
[0:58]
these meetings and all
[0:59]
communications during the
[1:00]
meeting will
[1:02]
comply with the
[1:03]
Open
[1:04]
Meetings Act. And secondly,
[1:07]
it is Situate's commitment to
[1:08]
diversity,
[1:09]
equality and
[1:10]
inclusion. The
[1:13]
Site Preservation Commission
[1:14]
strives
[1:15]
to ensure an
[1:15]
atmosphere of respect
[1:17]
during our meetings.
[1:18]
We ask all
[1:19]
members to interact
[1:20]
politely, even when there
[1:22]
are disagreements. We
[1:23]
value the participation of our
[1:24]
community. We want
[1:26]
all participants,
[1:27]
including
[1:27]
marginalized
[1:28]
minorities, to feel
[1:29]
welcome and
[1:30]
respected, and we
[1:30]
ask
[1:31]
our committee members and
[1:32]
everyone who participates to
[1:33]
uphold these
[1:34]
standards and to
[1:35]
support and
[1:36]
respect the community.
[1:38]
Along with that, we would like to
[1:39]
ask if there are any
[1:44]
issues with
[1:45]
some of the hearings
[1:46]
tonight...I
[1:47]
know sometimes different
[1:49]
people like to
[1:49]
talk about these
[1:50]
issues, but if
[1:51]
the issue has already
[1:52]
been addressed,
[1:53]
can we avoid
[1:54]
repeating similar
[1:55]
things and also
[1:56]
try to keep
[1:57]
our comments
[1:58]
direct and to the point.
[2:02]
We usually have
[2:03]
several meetings, and out of
[2:04]
respect for the people who
[2:06]
are discussed later on the
[2:07]
agenda, it would be
[2:08]
nice if we could
[2:10]
continue the meeting.
[2:12]
So, with all of that in mind
[2:13]
, we have an agenda
[2:15]
. Are there any
[2:17]
additions or
[2:18]
exclusions to this
[2:19]
agenda?
[2:22]
Yes, I think there is.
[2:25]
Penny, would you like to
[2:26]
add a vote
[2:28]
for
[2:29]
retention restrictions?
[2:30]
Well, Josh added that. This is F,
[2:32]
administrative
[2:34]
matters.
[2:35]
Good.
[2:36]
Oh, I guess that's all
[2:37]
we needed to
[2:38]
do?
[2:39]
Well, we don't see it
[2:40]
on what I have,
[2:41]
so I don't know if
[2:42]
it's on mine.
[2:43]
Well, let's...So,
[2:44]
let's just
[2:45]
say we're
[2:46]
going to add a
[2:46]
vote on this on the
[2:47]
agenda.
[2:48]
CR, yes.
[2:50]
Okay, um, and maybe
[2:51]
I'll take a moment to
[2:53]
comment on
[2:54]
our meeting
[2:55]
last night, if
[2:56]
we're not late...
[2:58]
Um...
[2:59]
Hi, Frank.
[3:00]
Yes, Eric.
[3:01]
Your sound, at least to me
[3:02]
, is a bit
[3:04]
choppy. I don't know
[3:05]
if it's just because of the
[3:06]
position, but maybe
[3:07]
it's just me... So
[3:08]
if anyone else...
[3:09]
How do you like it? Better?
[3:10]
That's pretty good.
[3:11]
Yes, it got better.
[3:13]
I think my
[3:14]
microphone was a little bit
[3:15]
on my
[3:15]
chin. Thank you,
[3:17]
Eric.
[3:17]
Yes, you all...
[3:19]
So, I propose to
[3:19]
adopt the
[3:21]
agenda with
[3:22]
two additions.
[3:23]
This is Penny. Um,
[3:25]
I support it. I
[3:26]
support.
[3:27]
From Eric. Eric, all
[3:29]
in, Brendan.
[3:30]
Yes.
[3:31]
And Robbie.
[3:33]
Yes.
[3:33]
And Frank, yes. Thank you.
[3:36]
Good. We have a house at
[3:41]
14 Lincoln Road.
[3:46]
Oh, sorry.
[3:47]
Turn the page
[3:49]
. We have a house at
[3:51]
165 Stockbridge Road, and that was an
[3:53]
extension.
[3:55]
Right. Good.
[3:59]
And I believe we have
[4:01]
, um, Jacob here.
[4:03]
Yes. Yes.
[4:04]
Uh, my name is
[4:05]
Jacob Lemieux of Hancock
[4:06]
Associates, 315 Elm Street,
[4:08]
Marlboro,
[4:09]
Massachusetts,
[4:10]
representing CAL Realty. Um
[4:11]
, we're sharing my
[4:13]
screen.
[4:14]
We...We'll open it
[4:16]
from our side.
[4:17]
Good. This...So, uh,
[4:19]
we had some
[4:20]
minor changes to the
[4:22]
plan that the commission
[4:23]
requested. Sorry. Um,
[4:31]
for example,
[4:32]
moving... We
[4:33]
moved the
[4:34]
dumpster
[4:35]
closer to the
[4:36]
wetlands, where the
[4:38]
dumping area is
[4:39]
, to the other side of the
[4:40]
parking lot. Um, this
[4:41]
dump area
[4:42]
is just for
[4:43]
turning around a fire
[4:44]
truck if a fire
[4:45]
truck or, uh,
[4:47]
ambulance ever
[4:48]
needs to
[4:49]
go there, and for
[4:50]
extra
[4:51]
snow storage
[4:52]
in the winter. Um, this
[4:53]
will help organize the site a little better
[4:55]
. Hmm, other than that, all the
[5:00]
significant changes were
[5:01]
essentially changes in
[5:02]
stormwater modeling
[5:03]
. Um, I don't know if
[5:08]
you want me to
[5:09]
look at these
[5:10]
technical changes, but I
[5:11]
believe we have a
[5:12]
clear expert
[5:13]
opinion from an expert engineer
[5:15]
regarding the
[5:16]
stormwater system. And, uh, that's all there is to the
[5:21]
changes.
[5:23]
Good. Um, well, I want to
[5:25]
ask
[5:27]
Jen to comment first,
[5:28]
and if she has any
[5:29]
additional questions,
[5:30]
you can
[5:31]
answer them for the
[5:32]
panel members. How do you like it?
[5:36]
Frank, we have
[5:37]
Janet here from Horsley
[5:38]
Witten.
[5:40]
Oh, okay. Um, maybe
[5:44]
we could ask
[5:45]
Janet to give
[5:46]
us a brief rundown.
[5:48]
Okay, can you hear me?
[5:49]
We understand you.
[5:51]
Hello, Janet.
[5:52]
Okay, for the record,
[5:53]
my name is Janet
[5:54]
Bernardo. I am a
[5:55]
professional civil engineer
[5:56]
with Horsley
[5:57]
Witten Group. And the city
[5:59]
asked us to
[6:00]
conduct a review of this
[6:02]
project. Essentially, a
[6:04]
stormwater management system on top of a
[6:07]
stormwater management system. We
[6:08]
provided a letter dated
[6:09]
July 9, 2026, and then a
[6:11]
second letter in
[6:12]
response dated
[6:14]
September 9. And, essentially,
[6:19]
you know, the applicant
[6:20]
is proposing an
[6:20]
apartment
[6:21]
building with parking,
[6:23]
and to deal with the
[6:24]
water, they're
[6:24]
installing a
[6:25]
relatively large
[6:26]
underground
[6:27]
chamber system. We were looking for
[6:36]
confirmation of
[6:37]
soils,
[6:38]
groundwater, drainage area, and
[6:40]
we had several
[6:41]
queries that the
[6:42]
applicant was able
[6:43]
to answer. Uh, one
[6:47]
question I have for the
[6:48]
applicant is that there is a
[6:50]
culvert
[6:51]
that runs, um, under the
[6:53]
driveway. The
[6:55]
culvert
[6:56]
was originally shown as 6
[6:57]
inches, and we
[6:58]
suggested that
[6:59]
since they were in
[7:01]
this area and
[7:02]
were going to extend
[7:03]
the length of the
[7:03]
culvert
[7:05]
, um, maybe they
[7:06]
could increase it
[7:07]
to 12 inches, um, to
[7:08]
make sure that it
[7:09]
didn't get clogged while
[7:11]
feeding, um, the adjacent
[7:12]
wetlands.
[7:14]
And then it
[7:15]
came back as a 12-
[7:16]
inch. So, I'm not
[7:18]
sure if it
[7:19]
was always 12 inches
[7:20]
or if it was increased to
[7:22]
12 inches, and just to
[7:23]
make sure it's
[7:24]
clearly stated in the
[7:25]
protocol, I
[7:26]
just increased it
[7:28]
based on your
[7:29]
recommendation.
[7:29]
So, he was 6 inches.
[7:31]
He is still 6 inches tall.
[7:33]
You extend its
[7:34]
length so that it is
[7:35]
completely under the
[7:36]
driveway and
[7:37]
increase the size to
[7:38]
12 inches just to
[7:40]
make sure there is no
[7:42]
clogging
[7:43]
during a rainstorm.
[7:44]
Yes, this should prevent
[7:45]
overflow through the
[7:46]
driveway.
[7:47]
Perfectly. So, that was
[7:49]
one thing I didn't
[7:50]
quite understand. Um, we
[7:59]
suggested a few
[8:00]
conditions in our letter,
[8:02]
assuming they
[8:03]
did some
[8:04]
test rooms,
[8:05]
but we, we want to
[8:06]
make sure that
[8:08]
there's, um,
[8:09]
a sufficient distance of
[8:10]
two, um, feet from the
[8:11]
groundwater under the system. Therefore,
[8:20]
we asked the commission
[8:21]
to consider this
[8:22]
issue during
[8:23]
construction,
[8:23]
as this
[8:24]
construction
[8:25]
begins, to do an
[8:26]
additional test
[8:27]
well in the
[8:28]
chamber system. There is one, but it would be
[8:30]
great if,
[8:31]
um, they just
[8:32]
confirmed that the entire
[8:33]
system has the
[8:34]
necessary separation
[8:36]
. So, this was the
[8:38]
proposal on
[8:39]
page five of
[8:40]
eight of our letter of
[8:41]
September 9th. We
[8:44]
also proposed
[8:46]
on page seven of
[8:47]
eight that, um,
[8:48]
the commission consider
[8:49]
a requirement to
[8:50]
place a
[8:51]
silt fence barrier and
[8:53]
compost filter layer along the
[8:55]
erosion control line as a special
[8:56]
condition. Um, there's an
[9:00]
erosion control line, there are
[9:01]
two pieces, but we
[9:02]
recommend that these
[9:04]
two, um, products be
[9:05]
assembled together and
[9:06]
used
[9:07]
simultaneously. Both requests and
[9:12]
we should also
[9:13]
ask the commission
[9:14]
to consider the request for an
[9:15]
operations
[9:16]
and
[9:17]
maintenance sketch as a
[9:18]
special condition.
[9:25]
Sketches allow a
[9:26]
property owner
[9:27]
to just look at a
[9:29]
very simple sketch and
[9:30]
see, here's where
[9:32]
the catchment is, which
[9:33]
I have to
[9:34]
look at often. Um,
[9:38]
property owners
[9:39]
don't even know
[9:41]
what a
[9:41]
watershed looks like. Therefore, it is
[9:42]
good that it should be
[9:44]
marked with a circle on the
[9:45]
plan. This is where
[9:46]
the cover of the
[9:48]
underground
[9:49]
chamber system is located. Because they're
[9:52]
underground, often, you know,
[9:53]
no one even knows
[9:55]
they're there. So it's
[9:57]
nice to have a very
[9:58]
simple sketch so that the
[9:59]
property owner
[10:00]
can say, "Okay,
[10:02]
this is something I need to
[10:03]
review,
[10:03]
decide on, and
[10:04]
make sure
[10:05]
the conditions are met." So
[10:09]
, those were actually
[10:10]
three
[10:12]
conditions offered to you. We
[10:14]
felt that
[10:15]
we had reviewed
[10:16]
the calculations and that they had been
[10:17]
done
[10:18]
properly.
[10:21]
OK. I don't think
[10:24]
we have any
[10:25]
problems with any
[10:26]
of these conditions. We
[10:27]
can, of course,
[10:28]
make an additional
[10:30]
test shaft during the
[10:31]
work on site. This is not a
[10:32]
problem or before
[10:33]
work begins on
[10:34]
site. Um, so I
[10:36]
think, uh, I think
[10:37]
we can take
[10:39]
all of these conditions into account.
[10:44]
OK. Um, Jen Smith,
[10:48]
thank you, Janet. And thank you
[10:51]
, Jacob. Um,
[10:55]
I have no
[10:56]
further questions at
[10:57]
this time.
[10:58]
Right. Jacob, are
[10:59]
you okay? I
[11:00]
mean, it was a
[11:01]
lot to
[11:02]
take in. Do you agree
[11:03]
with this, if we can
[11:04]
take some of
[11:05]
this into account? I am not.
[11:06]
Oh yes, absolutely.
[11:08]
OK. Um, we've already
[11:10]
reviewed the conditions
[11:12]
that
[11:13]
Janet recommended, and I think
[11:14]
we agree that
[11:15]
they should all be there. OK.
[11:19]
Good. Sorry, Jen
[11:23]
Smith. Do you have
[11:24]
any questions
[11:26]
now? Thank you.
[11:27]
Okay, thank you. Um, so
[11:29]
let's see. Eh
[11:30]
, Penny?
[11:33]
Yes, I can't
[11:34]
read this plan.
[11:36]
Good. Oh, I could
[11:37]
make mine myself. What's
[11:39]
yellow, Jacob?
[11:41]
So, yellow is the
[11:42]
wetland replication zone
[11:43]
.
[11:44]
Okay, that's what I thought.
[11:46]
Now we...Yes, we
[11:47]
added that as well from the
[11:47]
last meeting. I think
[11:49]
I forgot to
[11:50]
mention that.
[11:51]
Yes. No. No, that's my
[11:52]
only question. I
[11:54]
think this is a great
[11:55]
project. Um, it must
[11:58]
be wonderful there. Do you have a
[12:01]
wheelchair access,
[12:02]
yes, it is accessible for
[12:03]
people with disabilities.
[12:05]
Away from the road.
[12:06]
Yes. No, and it's a beautiful
[12:08]
area. Thank you.
[12:13]
Good. Um, Brendan?
[12:17]
No, I don't have
[12:18]
any questions.
[12:19]
Thank you.
[12:22]
Um, Eric?
[12:26]
Um, yeah, I'm definitely...glad to
[12:34]
hear that the applicant
[12:35]
is going to...you know,
[12:36]
support all of the...
[12:37]
suggestions from
[12:38]
the reviewers...Janet
[12:39]
...the report and the comments
[12:41]
were pretty
[12:41]
comprehensive, and...I
[12:42]
think...they're all
[12:43]
good additions and
[12:45]
changes. Uh, and Jacob,
[12:52]
I, um, also appreciate
[12:53]
adding a
[12:54]
recovery zone to the plan.
[12:58]
The plants
[12:59]
look good too.
[13:02]
I'm just wondering
[13:03]
if you have a standard
[13:04]
for seeding rates
[13:05]
? It looks like
[13:09]
you have about
[13:11]
7 pounds per 1000 sq ft in total.
[13:13]
feet, but I didn't know
[13:14]
if that was anything like that, or
[13:15]
how you arrived at that
[13:17]
number.
[13:18]
In the replication zone, we
[13:19]
use 10
[13:20]
pounds of the
[13:21]
recovery mix for
[13:22]
dry areas and 4
[13:24]
pounds of the
[13:25]
preservation mix. Uh, in
[13:27]
terms of local
[13:28]
plantings. Uh, that would be
[13:30]
our wetland scientist
[13:31]
. I'm not
[13:33]
sure exactly how
[13:34]
he calculates this. Do
[13:37]
n't worry. I'm
[13:40]
just curious, but, uh
[13:41]
, typically
[13:43]
New England wetland plants and
[13:45]
any other kind of, uh,
[13:47]
grouting compound, uh, would be fine
[13:48]
for this
[13:49]
area. So, uh, that's
[13:52]
all I have. Thank you
[13:54]
, Frank.
[13:54]
Thank you. Uh, Robbie.
[13:59]
Thank you, Frank. Uh,
[14:03]
nice project,
[14:04]
detailed expert
[14:05]
review, uh,
[14:07]
stormwater infrastructure
[14:07]
looks good. Uh,
[14:11]
a few questions about
[14:12]
...I don't know if it's...
[14:14]
StormTech or Coltech. Are there
[14:15]
viewing holes?
[14:17]
Yes. Can you
[14:18]
just move on to the
[14:19]
next sheet in the
[14:20]
plan set,
[14:21]
please? If you, uh,
[14:25]
zoom in on the
[14:27]
infiltration system
[14:28]
, you'll see that there are
[14:35]
three viewing holes.
[14:37]
Uh, those are the circles right in
[14:39]
the middle of the system.
[14:41]
Yes, you,
[14:44]
uh, and then on, uh,
[14:45]
wetland restoration
[14:47]
in the
[14:48]
planting plan, is there a
[14:49]
requirement for
[14:50]
plant survival? Well,
[14:56]
yeah, I mean,
[14:58]
usually I think that,
[14:59]
uh, commissions have a
[15:01]
standard, uh,
[15:02]
time period where you
[15:04]
need to have something
[15:05]
like an 80% survival rate. Uh
[15:08]
, it varies from
[15:09]
commission to commission. Uh
[15:11]
, but it makes sense for a
[15:13]
project like this.
[15:16]
Good. Maybe we
[15:17]
can provide you with this
[15:19]
information. Er,
[15:21]
10 years.
[15:23]
And then, uh, in terms of
[15:24]
operations and
[15:26]
maintenance, uh,
[15:27]
very comprehensive and
[15:29]
detailed. Uh, I
[15:31]
noticed that the
[15:32]
water quality unit
[15:33]
didn't seem to have a period for
[15:35]
inspection. And I think that's an
[15:38]
important part of
[15:39]
, uh, you know, protecting the
[15:41]
resource zone,
[15:42]
ultimately. I don't know if
[15:44]
we want to...include,
[15:46]
uh, this. It seems like, uh
[15:48]
, a lot of other
[15:49]
elements have been
[15:50]
determined in terms of
[15:51]
when
[15:52]
the inspections and
[15:53]
cleanups will take place.
[15:57]
Yeah, the reason why, uh
[15:59]
, it's not called...
[16:00]
It's in the, uh,
[16:01]
long-term
[16:02]
maintenance plan
[16:03]
as the
[16:06]
ADS Barracuda Max hydrodynamic separator.
[16:09]
Hmm.
[16:11]
Uh, yeah, well, that
[16:12]
will definitely be included there.
[16:16]
Yes, I do, it
[16:23]
says periodic
[16:25]
inspection.
[16:26]
Oh, okay. You're asking for
[16:29]
more detailed...I
[16:30]
think there's actually
[16:32]
vendor documentation, uh,
[16:33]
for this device
[16:34]
that I can provide.
[16:37]
Yes.
[16:38]
As part of the package.
[16:40]
Yes, what I think the
[16:41]
manufacturer recommends
[16:42]
regarding
[16:43]
inspection frequency. Do you think
[16:46]
these devices can be
[16:47]
filled with, I
[16:49]
mean, plastic
[16:50]
cups and
[16:51]
stuff, bottles and stuff like that?
[16:54]
Yes.
[16:55]
Uh, and then one
[16:56]
detail that I didn't
[16:58]
quite understand is, uh
[16:59]
, about the
[17:00]
culvert
[17:01]
. Does it transfer water
[17:04]
from below to the neighboring
[17:06]
property, or...
[17:08]
No, it goes from the
[17:09]
neighboring property
[17:10]
to the
[17:11]
wetlands.
[17:11]
Hmm.
[17:13]
So it runs
[17:14]
between two houses
[17:15]
to the lowest point and
[17:17]
then it runs
[17:18]
through a...
[17:19]
culvert to the
[17:20]
wetlands under
[17:21]
existing conditions, and that's what
[17:22]
we support.
[17:24]
We're simply increasing
[17:25]
the size of the
[17:25]
culvert
[17:26]
to accommodate
[17:28]
any
[17:30]
future large downpours that would
[17:31]
otherwise
[17:32]
overflow this
[17:33]
pipe and
[17:33]
spill over the
[17:34]
driveway.
[17:36]
Good. And what is the total
[17:38]
catchment area for
[17:40]
this? Side
[17:41]
load on
[17:42]
private property.
[17:43]
For example, what does he
[17:45]
collect?
[17:46]
I have a map of the
[17:46]
underwater pool
[17:48]
that I can find.
[17:55]
Just curious.
[17:59]
Give me a minute.
[18:19]
I have to...Can
[18:24]
you see this plan?
[18:28]
It's amazing, but I can.
[18:30]
Hmm, I think you
[18:31]
should...people can't
[18:32]
share. Is
[18:34]
that
[18:37]
true? So this, uh,
[18:39]
1S submersible
[18:40]
bypasses this area.
[18:42]
It's leaking from the other
[18:43]
side of the house. And this
[18:45]
2S subbasin,
[18:46]
this small area, is
[18:47]
the only area that
[18:48]
flows into this
[18:49]
culvert
[18:50]
basin.
[18:52]
Good. Hmm, and then
[18:55]
I guess one more
[18:56]
question about, uh, I don't
[18:57]
know, it could be a
[18:58]
communications plan or a
[19:00]
location plan.
[19:03]
The location of
[19:04]
the entrance, is it a shared
[19:05]
entrance?
[19:08]
Yes. This is a shared
[19:09]
driveway. Uh,
[19:11]
this has already been approved, and
[19:12]
we are laying our
[19:13]
access road
[19:14]
according to this
[19:15]
data, approved by the
[19:16]
plan.
[19:20]
You mean the
[19:21]
existing, that is,
[19:24]
uh, existing access
[19:25]
road, there is an
[19:26]
approved
[19:27]
shared access
[19:28]
road plan that is
[19:29]
sized at, um, the
[19:30]
turning area on the
[19:31]
shared access
[19:32]
road that has not yet been
[19:33]
built, so we are
[19:35]
completing its
[19:35]
construction as part of
[19:37]
this project.
[19:38]
Hmm. And does
[19:41]
this access road require a
[19:42]
setback from the
[19:43]
property line?
[19:48]
Uh, we're comparing the
[19:49]
existing setback, uh,
[19:51]
on the street, and with the
[19:52]
existing, um, on the
[19:53]
north side, we're
[19:54]
comparing those
[19:55]
existing lines where, um, it
[19:57]
extends on the
[19:58]
south side, and there's
[20:00]
no, um, actual
[20:01]
clear setback
[20:02]
that's needed.
[20:12]
And then this...Does
[20:13]
this require a
[20:15]
special permit
[20:16]
from the ZBA or
[20:17]
not...
[20:18]
No.
[20:19]
Planning board review?
[20:20]
No, it's protected by the
[20:21]
Dover Amendment. Er,
[20:24]
so it's a bypass
[20:25]
road, it needs to
[20:26]
be considered as a
[20:27]
separate house to
[20:28]
get, um, a
[20:29]
permit. And generally, that
[20:34]
means that if it
[20:35]
doesn't meet
[20:36]
the requirements for
[20:38]
site plan review because of,
[20:39]
um, such terrain...
[20:40]
violations or something
[20:41]
like that, um, it's
[20:42]
exempt from that.
[20:53]
Um, I just asked
[20:54]
because it seems like more or
[20:56]
less of the
[20:56]
driveway
[20:58]
could have been within the 50-
[20:59]
foot buffer
[21:00]
if it was closer
[21:02]
to the property line, and
[21:03]
then, you know,
[21:04]
the geometry was
[21:05]
changed in some way
[21:06]
to, um, reduce that.
[21:11]
Hmm, that makes sense. So
[21:13]
if you can,
[21:13]
go to the
[21:15]
planning materials sheet, just the one
[21:16]
before this one. So,
[21:21]
you see, um, let
[21:22]
me just
[21:23]
ask you
[21:24]
to repeat what you
[21:25]
said.
[21:28]
So if there is, if the
[21:30]
driveway, as
[21:31]
shown, is kind of
[21:32]
shifted to the
[21:33]
property line, I think,
[21:39]
northeast, and
[21:40]
then, and then, um, I
[21:41]
think, the right turn
[21:44]
is altered in some way. It looks like
[21:50]
you could almost
[21:52]
completely avoid the 50-
[21:53]
foot buffer in the
[21:55]
part where the
[21:56]
driveway crosses. If
[21:59]
that makes sense.
[22:01]
Well, we're trying to
[22:02]
minimize
[22:03]
the disruption there, and we
[22:04]
also have to
[22:04]
build it
[22:05]
according to what
[22:06]
was approved in the
[22:08]
access
[22:09]
road plan, where there were
[22:09]
setbacks. Um, and if
[22:11]
you go to the
[22:13]
gradation sheet,
[22:14]
um,
[22:18]
this whole area there is
[22:19]
covered by this
[22:20]
watershed
[22:21]
. Therefore, no stream from
[22:23]
this area
[22:24]
enters the
[22:25]
wetlands without
[22:26]
passing through the
[22:27]
system. Um,
[22:31]
moving it
[22:32]
further, uh, would create an
[22:33]
awkward layout
[22:35]
because we would have to
[22:36]
pull our
[22:37]
driveway
[22:38]
tight to this
[22:39]
dotted line, which
[22:41]
is...which is, um, the
[22:42]
shared
[22:43]
driveway line. And then we would...
[22:48]
be modifying outside of
[22:49]
our
[22:50]
easement area, which
[22:51]
we're not really
[22:52]
allowed to do, and
[22:54]
we also wouldn't be
[22:54]
compliant with...um,
[22:55]
the permission granted for the
[22:57]
shared
[22:58]
access road planning.
[23:01]
Ahem. And this permit that
[23:04]
was granted, did the
[23:06]
applicant apply for this permit
[23:07]
? Was it the
[23:09]
previous
[23:10]
owner, I guess.
[23:12]
Okay, I understand.
[23:17]
Um, Robbie, a little
[23:18]
idea of this
[23:19]
piece of land that
[23:20]
has been allocated, um, for
[23:22]
these projects. The house
[23:26]
next door was
[23:27]
affordable. And
[23:29]
at that time, I think
[23:31]
the city owned this
[23:32]
property, we
[23:33]
were trying to find a
[23:34]
way to bring them in and
[23:35]
also get around the
[23:36]
wetlands. And there was
[23:39]
another applicant who
[23:40]
started and then
[23:41]
backed down. Um, and so, uh
[23:46]
, the group that's here
[23:47]
with us now seems to
[23:48]
have inherited some of
[23:49]
those parts. When you're
[23:53]
done with yours,
[23:54]
Robbie, maybe we can
[23:55]
back off if
[23:56]
Janet's still online. I don't
[23:58]
know if she's still with
[23:59]
us or not.
[24:00]
I'm still here.
[24:01]
Okay, if you
[24:02]
accept that, maybe
[24:03]
you could
[24:04]
comment too. Um,
[24:07]
if there's any
[24:08]
information that
[24:09]
you think should be
[24:11]
considered. Sorry.
[24:15]
Yes, that was it. I was
[24:18]
just trying
[24:19]
to understand, uh, the
[24:19]
origins of the
[24:21]
driveway design and
[24:22]
how it affects
[24:23]
resource capabilities.
[24:26]
Therefore. Um,
[24:28]
no more questions from me
[24:30]
. Thank you.
[24:32]
Um, Janet, everything
[24:35]
in these comments
[24:36]
that you want...
[24:40]
Um, I don't think so. I
[24:47]
noticed on the...uh, that on
[24:48]
the sheet of better
[24:49]
materials plan at the entrance
[24:51]
to the road, where the
[24:52]
driveway first connects
[24:53]
, it's a small
[24:54]
area that I
[24:55]
assume was
[24:56]
built where
[24:57]
that 20-foot measurement is.
[25:04]
Yes, this is an existing
[25:05]
asphalt area
[25:06]
. After it is gravel.
[25:10]
And so...There's a gravel
[25:11]
driveway that
[25:12]
goes over an
[25:13]
existing
[25:14]
culvert
[25:15]
underneath it, and you...
[25:16]
Yeah...
[25:17]
meet. So,
[25:19]
yes, the beginning of the
[25:20]
access road seems to
[25:21]
be established from
[25:22]
this existing
[25:23]
asphalted
[25:24]
area. And the rest is,
[25:27]
in fact, replacing
[25:28]
gravel with pavement.
[25:32]
So this is not unusual.
[25:39]
Good. Um...Um...Someone...
[25:56]
given this
[25:57]
discussion, someone else
[25:58]
...going back to the
[26:03]
members...someone else wants
[26:04]
...It seems
[26:05]
pretty good there...
[26:12]
Does the city or the
[26:13]
commission have a requirement for
[26:14]
plant survival?
[26:20]
Sorry. What...What was the
[26:23]
question, Robert?
[26:25]
Like plantings, should
[26:26]
they survive a
[26:27]
year or should they be
[26:28]
transplanted?
[26:30]
Um, we usually
[26:31]
stipulate 3 years of
[26:33]
monitoring.
[26:34]
This is standard, I think,
[26:35]
too. You usually
[26:37]
see this.
[26:39]
Great, thank you.
[26:41]
And I believe this is a mitigation zone
[26:43]
. This is not a
[26:45]
replication zone.
[26:46]
Right.
[26:49]
Good. Um, do we have
[26:52]
anyone in the audience for
[26:53]
this?
[26:59]
Um, I don't see...I don't
[27:00]
see any hands raised.
[27:03]
Good. Jen,
[27:05]
considering the comments
[27:06]
that were not made on
[27:08]
this subject...
[27:09]
we discussed it a bit. Um,
[27:14]
if the committee members
[27:16]
are inclined to close, would
[27:17]
you like to
[27:18]
close and then give
[27:19]
you an opportunity
[27:20]
to work through a few, um
[27:21]
, issues that
[27:25]
were discussed
[27:26]
tonight, in
[27:27]
terms of
[27:28]
bringing them up for consideration?
[27:29]
Um, yes, that's right. I wouldn't
[27:31]
want to give it away. I would
[27:32]
like you to
[27:33]
see the project, um,
[27:34]
give you the terms and conditions
[27:35]
for your consideration.
[27:36]
Provided it's only 2
[27:38]
weeks.
[27:39]
Provided that other
[27:40]
members are inclined to
[27:41]
do the same. Um, do
[27:46]
you need
[27:47]
a suggestion, Frank?
[27:49]
Does everyone agree with this?
[27:51]
Does this make sense
[27:52]
to you, Jacob? Um
[27:53]
,
[27:54]
yeah, I think that, um, that would
[27:55]
work. This will give us,
[27:57]
um, the opportunity to go
[27:59]
and decide on
[28:00]
pricing.
[28:02]
Good.
[28:04]
Um, okay, Penny.
[28:07]
So, I'm making a
[28:08]
motion to
[28:10]
close, um, 165
[28:11]
Stockbridge.
[28:15]
Good. Is everything okay,
[28:16]
is that so? Thank you, Penny.
[28:18]
Um, Brendan. Do
[28:22]
you want me to
[28:23]
support this? I
[28:24]
will support.
[28:25]
Please.
[28:25]
Thank you. Yes.
[28:27]
I will support.
[28:28]
Sorry about that. Um, Eric?
[28:32]
Yes.
[28:33]
And Robbie?
[28:35]
Yes.
[28:35]
And Frank? Yes. Perfectly.
[28:37]
Thank you for...
[28:38]
Thank you very much. Good
[28:40]
evening. Be
[28:41]
healthy. Thank you. Thank you.
[28:44]
See you later.
[28:44]
Thank you, Jen. Um...
[28:46]
Good...Yes.
[28:50]
Um...208 Stockbridge.
[28:55]
It seems the applicants
[28:56]
are asking to continue...
[28:58]
Frank, isn't
[29:00]
50 Oceanside Street our next stop?
[29:01]
Oh, God. Sorry. I so
[29:03]
want to move on,
[29:04]
Jen. My apologies.
[29:07]
Um...On September 21, 2026
[29:11]
at 6:00 p.m., the
[29:13]
Sites Conservation Commission
[29:14]
will hold a
[29:15]
Wetlands Hearing
[29:17]
under Section
[29:19]
131 of Title 40 of the
[29:20]
Massachusetts Statutes
[29:22]
on the Condition of the Order
[29:24]
issued under
[29:25]
File Number DEP 068-3198,
[29:27]
upon the request of the Helen Hazard
[29:28]
Revocable Trust for
[29:30]
the extension of the terrace
[29:31]
located at
[29:34]
50 Oceanside Drive. Abters and
[29:35]
other interested
[29:37]
parties are invited
[29:39]
to attend. Access to
[29:41]
meeting information is available in the
[29:42]
agenda
[29:43]
published on the
[29:44]
website.
[29:46]
Good evening. This is
[29:48]
Greg Morse.
[29:49]
Hi, Greg.
[29:50]
Greetings. For the record
[29:51]
, Gregory Morse,
[29:52]
registered...
[29:53]
engineer, Morse Engineering. I
[29:55]
represent the
[29:57]
property owner, Helen S. Hazard
[29:58]
Revocable Trust. This is a new
[30:00]
house at 50
[30:02]
Oceanside Drive. The Commission
[30:04]
considered the
[30:05]
matter and previously
[30:06]
issued an order on
[30:07]
conditions. The house itself is
[30:10]
currently under construction. Hmm,
[30:12]
this property
[30:13]
is on land
[30:14]
subject to
[30:15]
coastal
[30:16]
storm runoff. This is a
[30:18]
speed zone at
[30:19]
altitude 18 along the
[30:20]
Atlantic Ocean.
[30:23]
And then when you
[30:24]
get to where the
[30:26]
house is, it's AE at
[30:27]
15. Again
[30:29]
, the house was previously
[30:30]
approved. Work on
[30:32]
this project has already
[30:33]
begun, but
[30:33]
tonight we are
[30:35]
requesting an
[30:35]
amendment to this
[30:36]
order of conditions. And
[30:39]
the amendment
[30:40]
specifically concerns the terrace, which is
[30:41]
located behind
[30:42]
the house. Hmm, a
[30:45]
terrace
[30:46]
at the back of
[30:47]
the house was previously approved. We would like to
[30:50]
extend this terrace
[30:51]
about 14 feet
[30:52]
further out to the
[30:53]
seawall. This requires
[30:57]
the installation of six
[30:59]
additional, ahem,
[30:59]
concrete piles to
[31:01]
support the
[31:02]
terrace extension. Hmm,
[31:05]
the terrace itself will be
[31:06]
about 1 1/2 feet
[31:08]
from the seawall.
[31:10]
Under the terrace it is
[31:11]
paved with cobblestones.
[31:13]
Um...it will remain a
[31:14]
cobblestone. The deck is
[31:16]
significantly raised. Um, the
[31:19]
existing
[31:20]
ground surface is about
[31:22]
16. The deck
[31:24]
will be at 21.6.
[31:27]
Um, the adjacent
[31:28]
elements on both sides
[31:29]
have decks. They don't
[31:32]
extend as far to the
[31:33]
sea wall, but they do
[31:34]
have concrete
[31:35]
patios to the
[31:36]
sea wall. We
[31:38]
understand we can't
[31:39]
do a
[31:40]
concrete
[31:42]
patio, but we want to
[31:43]
extend the deck, uh,
[31:44]
like a raised deck
[31:46]
about 14 feet,
[31:47]
as shown in this
[31:48]
plan. So I'm passing it on to
[31:50]
you.
[31:54]
Good. Jen?
[32:03]
I think, uh, I saw
[32:04]
on this plan
[32:05]
the distance from the deck
[32:06]
to the wall where, uh, the
[32:07]
pylons would be. That's not
[32:12]
true...So the
[32:13]
pylons are
[32:15]
3 feet
[32:16]
from the sea wall.
[32:18]
And the deck
[32:19]
tilts slightly above them.
[32:21]
The deck itself
[32:21]
is
[32:22]
about a foot and a half
[32:23]
from the sea
[32:24]
wall.
[32:25]
Hmm. Uh, no. Good. I
[32:33]
mean, uh, it's
[32:34]
always a
[32:35]
concern when
[32:36]
she's so close to the
[32:37]
wall when
[32:38]
any
[32:40]
work needs to be done. seawall
[32:42]
Then this, I think, is the
[32:43]
comment I want to
[32:45]
share. Hmm, I...At
[32:52]
this point...I have
[32:54]
no other questions.
[32:56]
Good. Hmm, Brendan?
[33:07]
Yes, thank you, Frank. Hmm,
[33:10]
yeah, I don't...I don't...er...I
[33:12]
don't...I don't
[33:13]
like the
[33:14]
terrace being so close to the
[33:15]
wall. I can't
[33:18]
talk to you about
[33:19]
the neighbors and their
[33:20]
concrete patios,
[33:21]
how old they are or
[33:23]
when they were installed,
[33:24]
but...I would...I would like to
[33:25]
see it from behind the
[33:26]
wall. Probably 3
[33:30]
feet. It's simple... If
[33:33]
work needs to
[33:34]
be done on this wall
[33:35]
, no one is going to want to
[33:36]
do the work
[33:37]
when they're a
[33:38]
foot and a half away from
[33:39]
your patio. You know,
[33:40]
we need to be
[33:41]
able to work
[33:43]
on the wall. Because everyone
[33:44]
loves a wall that's...
[33:47]
er, stable.
[33:50]
Good. Uh, Eric?
[33:57]
Hmm, yeah, I think from
[33:58]
my perspective, uh,
[33:59]
similar to Brendan,
[34:01]
uh, we just
[34:02]
can't go straight
[34:04]
to the wall. Hmm, you know, 18
[34:08]
inches is just
[34:10]
too far, I
[34:11]
think. Hmm I think
[34:14]
any movement closer
[34:16]
to the ocean is
[34:17]
impractical. Uh,
[34:19]
especially something so
[34:21]
close, uh, even
[34:22]
considering its
[34:23]
height, uh, which it is
[34:25]
above the existing
[34:26]
seawall. Uh,
[34:30]
as far as
[34:31]
preventing
[34:33]
storm damage, uh, I think
[34:34]
it's in
[34:35]
everyone's best interest: the applicant, the
[34:36]
neighbors, etc. Uh, to make
[34:41]
it as far away
[34:43]
from this wall and the
[34:44]
ocean as possible, uh, and I don't
[34:45]
think 18 inches is as far away
[34:48]
as we can
[34:49]
reasonably get. This is the
[34:54]
best. This is my
[34:55]
position on this
[34:56]
issue at the
[34:57]
moment. Thank you.
[35:00]
Good. Uh, Robbie.
[35:05]
I think the deck
[35:07]
is in the
[35:08]
speed zone?
[35:10]
Yes, that's right.
[35:11]
And then it is
[35:12]
attached to the
[35:13]
structure?
[35:15]
No, it
[35:16]
stands alone. Will
[35:18]
this be the engineering
[35:20]
deck?
[35:22]
Yes, the proposed
[35:23]
deck is already an
[35:24]
engineering deck.
[35:26]
This will simply be a
[35:27]
continuation of it.
[35:30]
Good. Uh, and then this is the
[35:34]
revised plan
[35:35]
that we're looking at.
[35:38]
That's right.
[35:41]
Uh, in the initial
[35:43]
plan Uh, I think I
[35:44]
see it.
[35:49]
Just show it
[35:50]
to you, Robbie.
[35:53]
And then revised?
[35:59]
Okay, I understand.
[36:02]
Do you want to be close? Uh
[36:04]
, no. No, I understand.
[36:06]
Er, that is, the stairs
[36:07]
lead, that is, the stairs
[36:09]
lead down to the deck
[36:10]
, that's
[36:11]
right. So, the
[36:13]
deck extension
[36:14]
is at a slightly
[36:15]
lower height. This will be
[36:17]
at a height of 21.6, which
[36:19]
gives it 3 1/2 feet above the
[36:22]
speed zone height. But it's a
[36:25]
slightly lower height.
[36:31]
Uh, no more questions from
[36:33]
me, Michael.
[36:35]
Good. Uh, Penny?
[36:40]
Minimal.
[36:41]
3 feet from
[36:44]
this seawall.
[36:47]
That's ridiculous, a foot and a half
[36:48]
. We need to be,
[36:53]
um, aware of the
[36:55]
storm and the work that
[36:56]
needs to be done.
[37:02]
Even 3 feet, if you
[37:03]
stop and
[37:04]
think about it, that's not a
[37:05]
lot of room for
[37:06]
some people to
[37:07]
get in there and
[37:08]
work, and you
[37:09]
can't even
[37:10]
fit equipment
[37:11]
on a 3-foot, um. No, it
[37:14]
can't be that
[37:15]
close to the
[37:16]
seawall. That's my only
[37:18]
comment or
[37:19]
question, Frank.
[37:21]
Good. Uh, do we have
[37:23]
anyone in the room about this
[37:25]
?
[37:29]
Uh, at the moment I
[37:31]
don't see any hands raised.
[37:33]
Good. Um, let's just
[37:35]
go back a little bit
[37:36]
, Greg. I'm
[37:38]
looking at
[37:39]
the aerial photo, photo
[37:40]
two. It was a house.
[37:44]
This house burned down,
[37:45]
right?
[37:46]
That's right. He
[37:47]
burned down.
[37:49]
Okay, so this
[37:50]
house, if I
[37:51]
remember correctly, did
[37:52]
we prepare this
[37:54]
house for lifting?
[37:58]
And then, and then it
[38:00]
burned down before, um,
[38:01]
they got the job done,
[38:02]
right?
[38:05]
No, I believe it
[38:06]
burned down, and then, and
[38:08]
then they came with a
[38:09]
notice of
[38:10]
intent.
[38:11]
Hmm.
[38:13]
Yes, it was... You
[38:14]
can see one in the photo
[38:15]
, it was already
[38:16]
raised on a
[38:17]
concrete foundation
[38:18]
. It wasn't a pile
[38:21]
foundation, but, um, it
[38:22]
was a concrete
[38:23]
foundation, and this
[38:24]
house burned to the ground
[38:25]
completely. Um, that's when
[38:29]
we were hired to
[38:30]
allow the remodeling of the
[38:31]
house.
[38:33]
Good. Good. Um, and
[38:37]
then between the house and the
[38:38]
seawall they
[38:39]
once had a concrete
[38:41]
patio?
[38:44]
Yes, there was. They had a
[38:45]
concrete
[38:46]
patio almost
[38:47]
flush with the top of the
[38:48]
wall.
[38:49]
This is what I'm trying to
[38:50]
imagine.
[38:51]
broken and demolished
[38:52]
at the moment.
[38:53]
Good. So, now it's
[38:55]
just an open
[38:56]
pavement.
[38:57]
Of course. And this
[39:03]
part of the
[39:04]
seawall hasn't been
[39:05]
repaired or,
[39:06]
um,
[39:08]
I don't think so.
[39:10]
They worked on it,
[39:11]
right? They went in
[39:12]
several directions,
[39:13]
but for some reason
[39:15]
this section was not
[39:15]
taken into account.
[39:18]
I don't think she was
[39:19]
touched, no.
[39:20]
So, it's still an old
[39:21]
seawall. And to
[39:28]
Robbie's question, I
[39:29]
assume that whoever
[39:31]
designed the house
[39:32]
would design and
[39:33]
certify the
[39:34]
terrace.
[39:37]
Yes, they will do it.
[39:38]
There is a design
[39:39]
engineer. It is Structures
[39:40]
Engineering Incorporated that
[39:41]
certified the terrace
[39:43]
, and they are certifying the
[39:44]
terrace extension
[39:45]
for
[39:47]
building permit purposes.
[39:49]
Good. Um, well, I think
[39:52]
you get the gist of
[39:53]
the commission regarding the size of the
[39:55]
terrace. Do you want to
[39:56]
get some?
[40:00]
I have, and I...I
[40:01]
certainly understand
[40:03]
the concerns here. Um
[40:06]
, if the terrace
[40:07]
is reduced to 5 feet
[40:08]
from the seawall,
[40:09]
could we
[40:14]
do that either on the
[40:15]
revised plans
[40:16]
or as a condition of
[40:17]
approval if
[40:18]
the commission votes "
[40:19]
yes". And a 5 foot setback, would
[40:21]
that be
[40:22]
acceptable?
[40:26]
For me it would be.
[40:28]
Okay, Jen, if we
[40:32]
could close, but I don't
[40:38]
think this is an
[40:39]
amendment to the order,
[40:40]
so it's not...Uh,
[40:47]
we can...uh
[40:48]
close it provided a
[40:50]
revised plan is submitted with,
[40:51]
uh, you know,
[40:52]
showing a greater
[40:53]
distance from the wall.
[40:56]
5 feet from the wall? Yes.
[41:02]
Good. Uh-huh. Okay, I'll
[41:06]
accept the offer.
[41:09]
I...I'm not...I'm not quite
[41:10]
sure how you
[41:11]
want to
[41:12]
phrase this, Jen.
[41:15]
Uh, make an amendment,
[41:17]
uh, and please, uh, a
[41:18]
revised plan, uh
[41:20]
, with the terrace further from the
[41:21]
wall.
[41:24]
5 feet from the wall. I
[41:28]
move that the
[41:29]
amendment be adopted
[41:31]
provided that the terrace
[41:32]
is
[41:33]
5 feet from the
[41:34]
wall.
[41:38]
Okay, this is a suggestion
[41:40]
from Penny. Do I have a
[41:41]
second?
[41:43]
I support this,
[41:44]
Brendan.
[41:45]
This is Brendan. Uh, everyone is "in
[41:47]
favor"? Eric?
[41:49]
Yes.
[41:50]
Robbie?
[41:51]
Yes.
[41:52]
And Frank, yes. Perfectly.
[41:54]
Thank you both. We're
[41:55]
done with this.
[41:57]
Good night.
[41:58]
Thank you.
[42:00]
Um, now we're at
[42:01]
208 Stockbridge,
[42:02]
and they want to
[42:03]
continue.
[42:05]
Uh, yeah, they didn't
[42:06]
give me a date. Um,
[42:09]
my date is December 7th. I-I
[42:12]
know it's not that far
[42:14]
ahead, but we have
[42:15]
some pretty
[42:16]
big announcements coming up in
[42:17]
October and then, um, another
[42:18]
one in mid-
[42:19]
November.
[42:21]
Good. Yes, I think
[42:22]
their request was for the
[42:24]
next available
[42:26]
meeting. Yes. Good.
[42:29]
So, can I make a
[42:31]
suggestion, Frank?
[42:32]
Of course.
[42:34]
Stockbridge, 208, at
[42:36]
December 7th.
[42:39]
Yes. I will support
[42:42]
Brendan. All in favor? Er
[42:46]
, Eric?
[42:48]
Yes.
[42:49]
And Robbie?
[42:50]
Yes.
[42:51]
And Frank, yes. Good.
[42:54]
Rebecca.
[42:57]
And now we are at
[42:58]
55 Rebecca Road. This
[43:00]
has been extended.
[43:05]
Um, yes, and I think
[43:17]
my suggestion would be that
[43:19]
after talking to the
[43:20]
building
[43:21]
department, um, we
[43:22]
would require structural
[43:23]
plans, and we, can
[43:25]
we add this to the conditions
[43:26]
that we would like the
[43:27]
details, as well as the
[43:28]
structural plans,
[43:29]
to be provided to the
[43:30]
conservation commission, um,
[43:32]
for review before the
[43:35]
building permit is signed.
[43:44]
So you say that the
[43:45]
structural engineer
[43:49]
will provide you with these plans.
[43:51]
Yes.
[43:52]
Okay, just like
[43:53]
we did at the
[43:54]
last meeting in
[43:55]
Hemlock.
[43:57]
Yes. Um, yeah, and we, we
[43:59]
want it
[44:00]
done before I
[44:02]
sign the
[44:03]
building permit. I,
[44:04]
you know, not just
[44:05]
submit it to the
[44:06]
building commission,
[44:07]
but, uh, come to the
[44:08]
commission for our
[44:09]
file. Um,
[44:12]
can I ask
[44:13]
a question?
[44:14]
Of course.
[44:16]
Um, you know.
[44:17]
Who will tell you "no"?
[44:19]
Well, you. And then I'll
[44:21]
punch you in the nose. Um, I would, vote "no."
[44:26]
Sorry. Stay tuned.
[44:30]
Um, okay, it's just an
[44:31]
idea I had
[44:32]
. Robbie, you are
[44:35]
very concerned, and I
[44:37]
understand that. The roof
[44:38]
is attached to
[44:39]
the house, right?
[44:41]
Good. What
[44:44]
about such areas?
[44:47]
If they want a roof,
[44:49]
why can't we
[44:50]
ask them
[44:51]
to install, you know,
[44:52]
those retractable awnings
[44:53]
that you can buy and
[44:54]
they extend and
[44:55]
you take them back
[44:57]
when a
[44:58]
storm comes. Why does it have to
[45:02]
be a structured
[45:03]
roof, a wooden roof? Wouldn't that make
[45:08]
more sense, or am I
[45:09]
just guessing? Do you
[45:14]
understand what I'm
[45:15]
talking about, Frank and
[45:16]
Jen?
[45:17]
I know I understand. Uh
[45:19]
, the applicant can't
[45:20]
join
[45:21]
tonight due to a
[45:22]
conflicting meeting,
[45:24]
but I'm right. Then
[45:26]
it's much, um, less
[45:28]
structured work in a
[45:29]
sensitive area.
[45:33]
Well, I think it might
[45:34]
be tricky because,
[45:35]
you know, even without a
[45:37]
storm, it's probably
[45:38]
going to be a very windy
[45:39]
area, right? And I don't
[45:43]
know if these retractable
[45:45]
awnings are, um,
[45:46]
strong enough for, I don't know. No matter what
[45:52]
wind speed it experiences.
[45:54]
Um,
[45:55]
I don't know either, Robbie,
[45:57]
but I, I'm with you. I
[45:59]
don't like the roof
[46:03]
over the terrace. What
[46:07]
worries me is that in
[46:09]
a couple of years someone
[46:10]
will add walls to
[46:11]
this roof. And
[46:14]
I think it's
[46:17]
just a
[46:23]
concern because I'm looking for, uh
[46:24]
, stamped
[46:25]
drawings to have a
[46:26]
professional engineer
[46:28]
design it in a
[46:29]
way that it does
[46:30]
n't fly off, essentially, and I do
[46:32]
n't get hurt, and
[46:33]
you know, that's what I'm getting at
[46:34]
. Not so much the
[46:43]
roof itself, but
[46:44]
the structure of the terrace, and
[46:46]
you know, the roof, I don't know.
[46:51]
The roof on the terrace is like that.
[46:54]
I know it's
[46:55]
halfway to
[46:56]
expansion. Yes.
[46:57]
I don't know. Like that. Uh-
[47:00]
huh.
[47:01]
Well, what I'm concerned about is, you
[47:03]
know, if they,
[47:04]
if we let it,
[47:06]
the next thing we
[47:07]
know is, someone's going
[47:08]
to say, "Hey, did you see the
[47:10]
walls, the side walls
[47:11]
going up on
[47:12]
each side?" "You know,
[47:14]
blah blah blah. I
[47:16]
just don't
[47:17]
like the roof on the
[47:18]
terrace. I don't
[47:19]
see the need
[47:21]
for that at all. But, you're
[47:23]
right, engineer, if a
[47:24]
structural engineer is supposed to
[47:26]
give us
[47:28]
guidance.
[47:32]
I'm wondering, on the
[47:34]
procedural side of
[47:35]
this, if
[47:36]
we don't have a certified
[47:37]
plan, can we
[47:42]
do anything with this
[47:43]
project tonight
[48:01]
? The reason I think I've stalled or caused this issue is that if the plans can't be certified as they are, don't we have to review any changes to those plans after they've been reviewed by the engineer?
[48:06]
So I think we
[48:09]
can do something with
[48:10]
this project
[48:11]
tonight?
[48:16]
Um, well, I also have a
[48:18]
problem with
[48:18]
Frank's connection. I
[48:21]
think his shut down
[48:23]
.
[48:23]
Okay.
[48:24]
Um, he shut down, and
[48:25]
then he said, "Okay,
[48:26]
can I
[48:27]
pause for a minute?" "I
[48:29]
just want to...
[48:31]
Pause.
[48:32]
Okay. Okay. Yeah. Um,
[48:37]
okay. Josh
[48:38]
will take care of it.
[48:40]
Um,
[48:41]
we'll just go ahead,
[48:43]
Jen.
[48:44]
Well, I do, but
[48:45]
can we... So we
[48:46]
need the information
[48:48]
before we
[48:48]
close. We
[48:52]
need the structural
[48:53]
information before we
[48:54]
close, not
[48:55]
getting it on a conditional basis
[48:56]
, and then
[48:57]
it's at their own risk,
[48:58]
if it's, um, significant
[49:00]
changes like
[49:01]
needing more
[49:02]
support, then they're going to
[49:03]
need
[49:04]
modification and
[49:05]
maybe making
[49:06]
changes.
[49:10]
I think you could, I
[49:12]
think, stipulate
[49:13]
that. And then, let's say the
[49:15]
plans are structurally sound
[49:16]
,
[49:17]
the engineer looks at
[49:19]
them and says it's
[49:20]
fine. I
[49:21]
like it. I'm
[49:22]
ready
[49:22]
to stamp it. And
[49:24]
then it's
[49:25]
stamped,
[49:26]
right? And, um, you know,
[49:29]
if they say,
[49:30]
the engineer says, 'Uh, no.'
[49:36]
We need to
[49:37]
do A, B, and
[49:38]
C first. And then they, I think,
[49:40]
will have to
[49:40]
come back,
[49:42]
right? And then look for
[49:46]
a fix? I don't know.
[49:48]
Right. OK. I
[49:51]
think that's reasonable.
[49:53]
Phew. I know. I'm not a
[49:55]
fan of closing this tonight
[49:56]
.
[49:59]
Personally, I would like to
[50:00]
see
[50:01]
the plans first. I don't have the
[50:04]
best feeling
[50:05]
about this project.
[50:07]
This is also fair. I
[50:08]
mean,
[50:09]
hmm,
[50:10]
I agree with that too.
[50:19]
Brendan, where are you?
[50:21]
Introductions. What do you want?
[50:26]
Stop laughing,
[50:28]
Eric. I see you.
[50:33]
Well, uh, I'm not, uh, I'm
[50:39]
generally probably not
[50:40]
too keen on
[50:41]
closing without a plan.
[50:44]
Okay, then let's
[50:45]
just keep it going
[50:47]
until December. Then they
[50:48]
will have enough time
[50:49]
to do it.
[50:53]
Uh, well, I'd also like to
[50:55]
hear what, if anything,
[50:56]
Frank has to
[50:57]
say about this
[50:58]
. Uh, I'm not
[50:59]
sure if
[51:01]
we can get him back, if
[51:02]
we can. Well, I
[51:03]
see his face. I
[51:05]
think I'm inside
[51:06]
.
[51:06]
Good.
[51:07]
I don't know. Josh miraculously
[51:09]
managed it. So where are
[51:11]
we? 55 uh, Rebecca, and
[51:17]
uh...Some want
[51:18]
to close, and some of us
[51:20]
want to close. Okay
[51:24]
. I don't want to close
[51:27]
and then I don't know.
[51:29]
Uh, and I...And
[51:30]
the discussion was that there
[51:32]
should be
[51:33]
more information. And
[51:34]
I apologize.
[51:36]
Certified plan. The
[51:38]
real plan.
[51:40]
Before we close.
[51:42]
Yes, that's as
[51:43]
opposed to
[51:44]
making it a condition for
[51:45]
them to have it.
[51:46]
Right.
[51:47]
You're the one who makes
[51:49]
the decision, uh, excuse me?
[51:52]
I mean, I
[51:53]
had a lot of
[51:54]
arguments with Jen in the
[51:55]
background. Um,
[52:00]
if Jen is okay with
[52:01]
closing and
[52:02]
getting this...I've
[52:03]
heard a lot of arguments
[52:04]
about this, and I'm
[52:05]
glad we're
[52:06]
getting a certified
[52:07]
plan. Um, I think
[52:14]
the applicant probably should have
[52:16]
gotten it earlier
[52:17]
, so, um, if we
[52:23]
get it, then I guess
[52:24]
if we don't
[52:25]
do it, the project won't go
[52:26]
ahead.
[52:30]
Right. I
[52:33]
mean, I think it would be
[52:34]
good for
[52:35]
projects, especially in the
[52:36]
speed zone, to have
[52:38]
that information
[52:42]
up front. Yes, this
[52:44]
should all be part of the
[52:45]
submission. Um, so I
[52:49]
think at this
[52:50]
point it would be something like
[52:51]
, it
[52:52]
could be like, if we
[52:53]
want to close an
[52:54]
issue that requires
[52:55]
certified plans,
[52:56]
then, you know, if the
[52:58]
plan changes, then
[52:59]
they would need to
[53:00]
make changes to their
[53:01]
orders. Or we'll
[53:04]
continue and we'll
[53:05]
get the
[53:07]
plans first before we
[53:08]
close.
[53:11]
Okay, and do we have movement
[53:13]
now?
[53:15]
I suggest
[53:16]
continuing until we
[53:17]
get an
[53:18]
approved plan.
[53:20]
Okay, this is
[53:22]
Penny's suggestion. And do we have a
[53:24]
second on this
[53:25]
?
[53:30]
Oh, well.
[53:32]
What ca
[53:33]
n't I do,
[53:34]
Jen, Jen, what are you
[53:35]
leaning towards? I think it
[53:38]
was, it could go
[53:39]
either way. Well, I'm
[53:40]
not leaning towards it, because Jen,
[53:42]
you can.
[53:44]
Yes, no, it would be
[53:45]
if, if it were two
[53:46]
ways, the condition would be that
[53:47]
we
[53:48]
would require the submission of
[53:49]
plans with
[53:50]
approved
[53:50]
plans to be
[53:51]
retained before the
[53:53]
building permit is signed. And
[53:56]
if it's
[53:57]
dramatic, if it
[53:58]
changes, if
[53:59]
additional
[54:00]
support is needed, if something
[54:02]
changes, then the plan will
[54:03]
need to be
[54:04]
changed, and we'll
[54:04]
go down that path.
[54:07]
Um, or we need
[54:09]
all of this before we
[54:10]
close.
[54:15]
Wait, aren't those
[54:16]
three ways?
[54:19]
Well, it's possible. Maybe a
[54:20]
third one, right
[54:22]
? He is correct.
[54:23]
One of these paths has
[54:25]
A and B.
[54:28]
Okay. Um, so now
[54:32]
Penny has made
[54:33]
a suggestion, um, not to
[54:39]
continue. Yes, don't
[54:40]
close it.
[54:43]
We have and, uh, so there
[54:45]
was no second question,
[54:48]
Eric will support that.
[54:50]
Okay, that's the second
[54:51]
question. So, all "for
[54:53]
" the continuation until
[54:55]
we get the plans
[54:56]
, Penny said,
[54:57]
Eric supported. All in
[55:00]
, Brendan.
[55:04]
Can we
[55:05]
continue the
[55:06]
goodbye if we
[55:07]
continue it?
[55:08]
Yes, December 7th. Brendan,
[55:17]
speak up.
[55:20]
I...Yes.
[55:23]
Good. And Robbie?
[55:26]
Yes.
[55:27]
Good. So, I think
[55:30]
we have the quorum for
[55:31]
this. Good. Good. Uh
[55:38]
,
[55:38]
no.
[55:39]
I think on this one
[55:41]
, precisely because it's about
[55:44]
speed, I think
[55:45]
that was what changed
[55:49]
my mind, because I was
[55:50]
hesitant. I could go
[55:53]
either way, but
[55:54]
given that this is
[55:55]
speed, I think
[55:57]
we need to
[55:58]
hold this zone
[55:59]
specifically to, uh,
[56:00]
maybe a little higher,
[56:02]
uh, bar,
[56:02]
given the implications
[56:04]
that this zone has. And
[56:11]
it also allows you to
[56:12]
ask questions
[56:13]
about any
[56:14]
comments or
[56:14]
corrections that may
[56:16]
not require a
[56:16]
return of the application, uh
[56:18]
, just for
[56:18]
clarification on the
[56:20]
design itself. So, it's
[56:26]
just...
[56:30]
but it would be nice... I
[56:32]
was glad we had the
[56:34]
opportunity last night
[56:35]
to talk about different,
[56:36]
um, types of hearings and
[56:37]
different clarifications... and,
[56:39]
uh, you know, as you
[56:40]
said, Derek,
[56:41]
discussing
[56:42]
being in the V-zone
[56:50]
adds a certain level of...
[56:51]
uh, anxiety to
[56:52]
these projects. So, I
[56:57]
think that's something we
[56:58]
should
[56:59]
make clear to the applicant
[57:00]
when they submit their application
[57:02]
, that this package should
[57:03]
include a certified
[57:07]
plan. I mean, there
[57:08]
might be some
[57:10]
minor...I...I don't
[57:11]
know. Let's say someone
[57:13]
came in with a renovation or
[57:15]
something like that, that
[57:16]
something is already
[57:17]
designed, but
[57:18]
if that's the policy that
[57:21]
the commission is going to
[57:22]
follow, I
[57:23]
think we should
[57:24]
make that clear to the
[57:25]
applicants.
[57:29]
Yes.
[57:30]
That's smart, I think.
[57:32]
And scale
[57:33]
matters too, right? I
[57:36]
mean, someone
[57:37]
puts 5 on 5, you know, a
[57:39]
landing
[57:40]
or something, that's a different
[57:42]
matter. It seems to be
[57:45]
30 by 14 with a roof, you know,
[57:47]
so...Yeah.
[57:49]
OK. I think this would be
[57:51]
helpful for
[57:52]
Jen and Josh. So
[57:54]
when we receive
[57:55]
packages, we can
[57:56]
let people know that
[57:58]
they need to give
[57:59]
us additional
[58:00]
information. Hmm,
[58:03]
especially in zone V.
[58:08]
Okay. So, Jen, will you
[58:10]
report the applicant?
[58:12]
Yes, I will notify
[58:13]
the applicant.
[58:14]
OK. Thank you. Hmm, we
[58:18]
are at
[58:20]
49 Mordecai Lincoln Road. On
[58:23]
September 21, 2026 at 6:00 p.m., the
[58:27]
Scituate Conservation Commission will hold a
[58:28]
public meeting
[58:29]
pursuant to
[58:30]
Chapter 131, Chapter 40,
[58:33]
Massachusetts General Laws, and
[58:35]
Chapter 30,700, Scituate Code of
[58:36]
Statutes, to
[58:38]
discuss a request for a
[58:39]
determination of
[58:40]
applicability
[58:41]
filed by William and
[58:43]
Janet Provost regarding the
[58:44]
removal of several
[58:45]
ash trees located
[58:47]
at 49 Monakai
[58:48]
Lincoln Road,
[58:49]
Scituate. But,
[58:50]
since other
[58:51]
interested parties
[58:52]
are invited to
[58:53]
participate...The information is
[58:58]
available and
[58:58]
posted on the
[58:59]
website.
[59:04]
And I believe that the applicant
[59:05]
and the homeowner are in
[59:06]
contact.
[59:08]
Yes. Yes.
[59:09]
Good evening.
[59:12]
If you just want
[59:13]
to tell us a little bit
[59:14]
about your...
[59:17]
Okay. Um, here's the description,
[59:20]
it's very simple. Um,
[59:25]
we have a dozen, we
[59:26]
counted the
[59:28]
tree care companies
[59:29]
, we got two
[59:30]
estimates, and they both
[59:32]
said there are 12 trees
[59:33]
that are... that are dead. Um, 11
[59:40]
of them are ash trees that,
[59:41]
you know, have been
[59:42]
rotting for several years now because of the
[59:44]
ash borer. And, um,
[59:49]
they're very dry, and
[59:50]
most of them are
[59:51]
leaning toward our
[59:53]
house. Um, one of
[59:57]
them, the one I know, well,
[59:59]
actually the one on
[1:00:00]
the far left if
[1:00:01]
you look at the
[1:00:02]
plot plan. Um, this one fell through
[1:00:07]
and I recently
[1:00:08]
sent an additional
[1:00:09]
photo to Jen and copied
[1:00:11]
Joshua. Um, it fell
[1:00:15]
right after there
[1:00:16]
was a
[1:00:17]
heavy downpour last week. Or the
[1:00:20]
week before that. Um,
[1:00:24]
so others are just
[1:00:25]
waiting for
[1:00:27]
the wind or heavy
[1:00:28]
rain to fall on them. I know we're going to have a
[1:00:34]
storm this weekend, so,
[1:00:36]
yes, one tree
[1:00:37]
is headed straight for
[1:00:38]
our house. It is
[1:00:40]
leaning towards our
[1:00:41]
house. Um,
[1:00:44]
the ones near the
[1:00:45]
driveway are also quite
[1:00:46]
steep. Um,
[1:00:50]
some to the mill,
[1:00:51]
Lincoln mill, which is a
[1:00:53]
concern, and there
[1:00:54]
are power lines there too
[1:00:55]
. Um,
[1:00:57]
I'm just
[1:00:58]
saving you some
[1:00:59]
time, I don't think
[1:01:00]
you need to
[1:01:01]
make any more
[1:01:02]
arguments about
[1:01:02]
your situation.
[1:01:03]
Good.
[1:01:04]
Good.
[1:01:05]
Uh, it goes
[1:01:07]
into
[1:01:07]
wetlands a little bit,
[1:01:08]
so
[1:01:08]
it's a little
[1:01:09]
overwhelming when
[1:01:10]
we looked at the
[1:01:11]
cost of
[1:01:13]
removing them. Um, that's
[1:01:15]
about a little
[1:01:17]
under $10,000.
[1:01:19]
This was a lower estimate.
[1:01:21]
The lowest score
[1:01:23]
we had was, um,
[1:01:24]
about 16. That
[1:01:25]
would include the police
[1:01:27]
because the crane would have to
[1:01:28]
be outside.
[1:01:30]
They might
[1:01:31]
have to block
[1:01:32]
the street. Em. So, that's
[1:01:36]
basically the description we have
[1:01:37]
. Em.
[1:01:40]
Good. I think we...
[1:01:41]
So, you know, we'll
[1:01:42]
go through the
[1:01:43]
commission members, but...
[1:01:45]
you know, we understand
[1:01:46]
that ash trees are a real
[1:01:48]
problem. And, um, I
[1:01:49]
think the only thing that
[1:01:51]
maybe Jen told
[1:01:52]
you was your plans
[1:01:54]
for the stumps. So,
[1:01:56]
the cutting and
[1:01:57]
removal of trees,
[1:01:58]
you know, we...we...we'll
[1:01:59]
discuss it with the
[1:02:00]
commissioners, but,
[1:02:01]
um, just so there's no
[1:02:03]
disturbance of the soil. Um,
[1:02:05]
of course.
[1:02:05]
So, that's true. I
[1:02:07]
mean, eventually we would
[1:02:09]
like to plant
[1:02:10]
more trees, because these
[1:02:11]
trees were great
[1:02:12]
for shade and, you know, with
[1:02:13]
wildlife and so on.
[1:02:16]
Um, but we don't plan on
[1:02:17]
chopping up stumps.
[1:02:18]
We never had
[1:02:19]
stumps chopped with
[1:02:20]
all the trees we
[1:02:21]
had felled...Well
[1:02:22]
, we had a few
[1:02:23]
felled, and, you know,
[1:02:24]
over the
[1:02:25]
years. We have been here for 40
[1:02:26]
years. Um, so we don't
[1:02:29]
plan on
[1:02:29]
chopping any
[1:02:31]
stumps.
[1:02:32]
No. There's also, um, there's
[1:02:35]
also, um, a
[1:02:36]
tree branch overhanging
[1:02:37]
Mordecai
[1:02:38]
Lincoln Road
[1:02:39]
in front, almost in front of
[1:02:41]
our house. It's on the
[1:02:46]
grounds of, um,
[1:02:48]
52 Mordecai Lincoln Road. But there's something
[1:02:50]
like a cherry tree there
[1:02:51]
that's growing a little wild
[1:02:53]
and overhanging the
[1:02:55]
power lines. Hmm,
[1:02:59]
it's not on our
[1:03:00]
property, but, uh, the
[1:03:02]
nut service asked if
[1:03:04]
we could get
[1:03:05]
permission to remove a
[1:03:06]
branch that's overhanging
[1:03:07]
the street because it looks
[1:03:08]
like it's wrapped around
[1:03:10]
power lines.
[1:03:14]
Yes, I should mention that
[1:03:16]
in the description. Sorry.
[1:03:19]
Hmm, when Jen
[1:03:20]
sent me that
[1:03:21]
letter last week,
[1:03:22]
I didn't think to
[1:03:23]
mention it, but it's
[1:03:24]
just a scrap,
[1:03:25]
you know.
[1:03:26]
Well, it's not on our
[1:03:27]
property.
[1:03:28]
No, it's not on our
[1:03:29]
property, but it
[1:03:33]
makes it necessary
[1:03:35]
for the
[1:03:36]
tree care company
[1:03:37]
to use a crane
[1:03:38]
and, uh, to get the
[1:03:39]
job done.
[1:03:43]
Hmm, so whose
[1:03:46]
property is this on
[1:03:47]
Hmm, this is Mordecai
[1:03:49]
Lincoln Road, 52. It was
[1:03:50]
recently sold. It
[1:03:52]
was an old
[1:03:53]
house, uh, Gong. Hmm,
[1:03:58]
then I would say that
[1:03:59]
maybe you can
[1:04:00]
work something out with
[1:04:01]
the person it's on
[1:04:02]
or the
[1:04:03]
city, but
[1:04:05]
of course
[1:04:06]
it's none of our business...
[1:04:08]
Okay.
[1:04:09]
It can be done, but it is a
[1:04:10]
matter of
[1:04:11]
nature conservation.
[1:04:15]
As we were considering the
[1:04:16]
committee members,
[1:04:17]
I had another
[1:04:18]
thought: If you've already
[1:04:19]
reviewed the costs
[1:04:20]
and submitted them to us
[1:04:21]
, Jen, is there
[1:04:23]
any way we
[1:04:24]
could include,
[1:04:25]
um, tree transplanting,
[1:04:27]
um, as long as they're
[1:04:28]
not closer to the
[1:04:29]
pond than the trees being
[1:04:30]
removed?
[1:04:35]
This way, you won't have to
[1:04:37]
come back to us to
[1:04:38]
plant trees.
[1:04:39]
Maybe you just
[1:04:40]
want to get back
[1:04:42]
to Jen with a sketch
[1:04:43]
of what you're planting,
[1:04:44]
but we could
[1:04:44]
include it, um, on this
[1:04:46]
return so you
[1:04:47]
don't have to
[1:04:48]
re-file the return.
[1:04:50]
But just
[1:04:51]
get back to Jen with what
[1:04:52]
you plan to
[1:04:53]
do for the
[1:04:54]
transplant.
[1:04:55]
Of course. Of course.
[1:04:57]
Okay, that's a valid
[1:04:58]
point, and I don't
[1:04:59]
think we're
[1:05:00]
going to plant a
[1:05:01]
dozen trees.
[1:05:02]
Of course. No, I
[1:05:04]
mean, fortunately, there are
[1:05:06]
a few, you know,
[1:05:08]
saplings,
[1:05:09]
wild maples
[1:05:10]
growing out back there.
[1:05:14]
So, I think
[1:05:15]
removing these
[1:05:16]
dead ash trees
[1:05:17]
will allow the maples, you
[1:05:18]
know,
[1:05:20]
certainly, to
[1:05:23]
grow much better,
[1:05:25]
and maybe they, you
[1:05:26]
know, I don't think
[1:05:27]
we have the money to
[1:05:28]
plant trees right now
[1:05:30]
because we're both
[1:05:31]
retired, but, um, but, I
[1:05:32]
think, you know, it's
[1:05:33]
unfortunate with these
[1:05:34]
trees because we
[1:05:36]
see dead ash trees all over
[1:05:37]
town.
[1:05:40]
Yes, no problem. I
[1:05:41]
think we had a
[1:05:42]
few, I say that on my
[1:05:44]
own behalf. We're
[1:05:45]
going to
[1:05:45]
review the
[1:05:46]
commission members, but we have a
[1:05:47]
few more hearings
[1:05:48]
after that. Yes.
[1:05:50]
Um, okay.
[1:05:51]
Good. Finish here.
[1:05:52]
Thank you.
[1:05:53]
So what do we have to forgive?
[1:05:55]
We are gathering, we are
[1:05:56]
gathering. The process is
[1:05:58]
this: I was a little
[1:05:59]
rushed. We
[1:06:00]
are going to quickly
[1:06:01]
review the members of
[1:06:02]
our committee.
[1:06:02]
Oh, okay. Sorry.
[1:06:04]
No, everything is fine. Um,
[1:06:07]
so Eric...Um, yeah,
[1:06:10]
no, obviously there
[1:06:13]
's a significant
[1:06:15]
amount of dead
[1:06:16]
ash in this area, um,
[1:06:17]
at least a year ago.
[1:06:18]
I have no problem with that
[1:06:20]
Okay, thank you. Robbie?
[1:06:22]
No questions asked.
[1:06:23]
Good. Penny?
[1:06:26]
No, everything is fine.
[1:06:28]
Brendan?
[1:06:29]
I, um, I have no
[1:06:31]
questions. Everything is fine.
[1:06:32]
Thank you.
[1:06:33]
Jen, I'm a little
[1:06:34]
ahead of myself on this. Do you agree with this
[1:06:36]
I-I, everything is fine. They
[1:06:38]
do their work from the
[1:06:39]
street. You know, their
[1:06:40]
equipment will be in the
[1:06:41]
appropriate location, and
[1:06:43]
we can add,
[1:06:44]
you know, encourage
[1:06:45]
any local
[1:06:46]
plantings if they
[1:06:47]
want to.
[1:06:48]
Good.
[1:06:49]
Thank you.
[1:06:50]
Perfectly. So, um, do
[1:06:51]
we have a suggestion?
[1:06:54]
Negative, Jen? Three?
[1:06:56]
Um, well, two. Yes.
[1:06:59]
I'm making
[1:07:00]
a suggestion about
[1:07:01]
minus two, which is good.
[1:07:02]
Jen...
[1:07:03]
So this is Penny. Do you have a
[1:07:04]
second suggestion?
[1:07:05]
Um, second suggestion
[1:07:07]
from Brendan.
[1:07:07]
Good. All in, Eric
[1:07:09]
Yes.
[1:07:11]
And, um, Robbie?
[1:07:12]
Yes.
[1:07:13]
And, Frank, yes. So,
[1:07:17]
minus two actually
[1:07:18]
allows you
[1:07:18]
to go ahead and
[1:07:19]
do this work.
[1:07:22]
Good.
[1:07:23]
And, um, do
[1:07:24]
we need a separate
[1:07:25]
piece of paper,
[1:07:26]
like a permit, or
[1:07:29]
Y-yes, we'll provide you with the
[1:07:30]
documents.
[1:07:31]
Good.
[1:07:32]
But, if you can,
[1:07:33]
contact a
[1:07:34]
tree care company and have
[1:07:35]
them do
[1:07:36]
the installation.
[1:07:37]
Of course. Because I think
[1:07:40]
they have, like, three
[1:07:42]
weeks to do it,
[1:07:43]
so, um, and should we
[1:07:45]
pick up the permit, um, from the
[1:07:46]
city council? Y
[1:07:50]
-yes, we'll let
[1:07:51]
you know when it's
[1:07:52]
ready.
[1:07:53]
Good.
[1:07:53]
Sounds good.
[1:07:54]
Thank you very much.
[1:07:57]
We appreciate it.
[1:07:58]
Thank you for visiting.
[1:08:00]
Good night.
[1:08:01]
You too.
[1:08:02]
Um, number seven, Hornbeam
[1:08:05]
, um, September 21, 2026
[1:08:08]
, 6:00 p.m. The Scituate Conservation Commission
[1:08:12]
will hold a public
[1:08:13]
meeting pursuant to
[1:08:14]
Section 131 of Title 40 of the
[1:08:16]
Massachusetts General Laws and
[1:08:17]
Section 30700 of the
[1:08:19]
Scituate City Charter to
[1:08:20]
discuss a request to
[1:08:22]
terminate
[1:08:23]
a contract filed by
[1:08:24]
Connor Dougherty
[1:08:25]
for repairs to a
[1:08:26]
septic system
[1:08:27]
located at
[1:08:29]
7 Hornbeam Road, Scituate.
[1:08:30]
Representatives from
[1:08:31]
Abbutters and
[1:08:32]
other interested
[1:08:32]
parties are invited. Information
[1:08:33]
for accessing the meetings
[1:08:34]
is available in the agenda
[1:08:36]
published on the
[1:08:37]
website.
[1:08:37]
And we also have Greg Morse
[1:08:39]
from Morse Engineering.
[1:08:41]
Perfectly. Thank you. For
[1:08:43]
the record, Gregory
[1:08:44]
Morse, a registered
[1:08:45]
engineer of Morse Engineering,
[1:08:46]
represents the applicant
[1:08:48]
, Connor Dougherty. This is
[1:08:49]
an RDA for a
[1:08:50]
septic system upgrade at
[1:08:54]
7 Hornbeam Road. Looking at the plan, the
[1:08:55]
site boundary
[1:08:56]
is marked with a bold
[1:08:57]
black line. The lot area
[1:08:59]
is
[1:09:01]
approximately 18,176
[1:09:02]
square feet. There
[1:09:04]
is an existing
[1:09:05]
house on it. This is the building
[1:09:07]
you see on the left
[1:09:08]
. There is also a separate
[1:09:10]
garage, which
[1:09:10]
is located somewhere at
[1:09:12]
the top of
[1:09:13]
the screen on the right.
[1:09:15]
Wetlands
[1:09:16]
in the area are highlighted in
[1:09:17]
blue. They
[1:09:18]
were outlined by John Zimmer, a
[1:09:20]
professional
[1:09:21]
wetland scientist,
[1:09:23]
in July 2026. Next
[1:09:25]
to it, the
[1:09:25]
50-
[1:09:27]
foot buffer is marked in red, and the
[1:09:28]
100-foot
[1:09:29]
buffer is marked in green. This house,
[1:09:31]
again, the structure
[1:09:32]
on the left, has a
[1:09:33]
faulty septic
[1:09:34]
system. The proposal
[1:09:35]
is to
[1:09:37]
replace it with a new
[1:09:38]
septic system
[1:09:39]
that meets
[1:09:40]
Section 5 requirements.
[1:09:41]
The proposal
[1:09:42]
calls for a new
[1:09:43]
1,500 gallon septic tank, a
[1:09:44]
1,000 gallon pump chamber
[1:09:45]
, a junction
[1:09:47]
box, and then a
[1:09:48]
gravity
[1:09:49]
leach field
[1:09:50]
located in the
[1:09:51]
front yard. All
[1:09:53]
work is performed
[1:09:54]
outside the 50-foot
[1:09:55]
buffer zone.
[1:09:59]
There is a presumption in the Wetlands Protection Act 310 CMR 10.04
[1:10:00]
that a
[1:10:02]
septic system upgrade
[1:10:03]
located
[1:10:04]
outside the 50-foot
[1:10:05]
buffer is deemed to
[1:10:06]
protect all
[1:10:08]
interests of the law. I
[1:10:09]
believe we
[1:10:10]
meet this
[1:10:11]
presumption. We
[1:10:11]
proposed
[1:10:12]
installing an
[1:10:13]
erosion control barrier at
[1:10:14]
the edge of the works to
[1:10:15]
prevent any
[1:10:16]
sediment migration
[1:10:17]
during the
[1:10:18]
construction phase of this
[1:10:19]
project. This is an area with an
[1:10:20]
existing lawn.
[1:10:23]
It will be
[1:10:24]
used as a lawn
[1:10:25]
after construction, with
[1:10:27]
the exception of two
[1:10:27]
ornamental trees: a
[1:10:29]
Japanese maple and a
[1:10:30]
dogwood, which
[1:10:31]
will unfortunately be removed as
[1:10:32]
part of this project.
[1:10:35]
None of them are
[1:10:36]
local to this
[1:10:37]
area. We will try to
[1:10:39]
move
[1:10:39]
at least one of them.
[1:10:42]
But beyond that, we
[1:10:43]
comply with
[1:10:45]
the presumption of 310 CMR 10.04.
[1:10:47]
The Board of Health
[1:10:48]
, I believe, fully
[1:10:49]
agrees with this plan. Uh
[1:10:50]
, I'll turn it over to you
[1:10:52]
for questions or
[1:10:53]
comments.
[1:10:54]
Thank you, Greg. Jen? Uh
[1:10:58]
, yes, uh, I
[1:10:59]
agree, the Board of
[1:11:01]
Health, uh,
[1:11:02]
I agree with the plan.
[1:11:04]
This is as far away from
[1:11:05]
wetlands as possible.
[1:11:07]
Er, both trees
[1:11:08]
were decorative.
[1:11:10]
Quite an interesting place to
[1:11:11]
have this
[1:11:12]
little stream
[1:11:13]
running between the garage
[1:11:14]
and the house. Uh, I would
[1:11:17]
say my
[1:11:18]
comment would be:
[1:11:20]
uh, maybe
[1:11:21]
disagree with the
[1:11:21]
distinction. I
[1:11:25]
think if it was a
[1:11:26]
more complex
[1:11:27]
project, um, we would
[1:11:28]
want more
[1:11:29]
detail, more
[1:11:30]
overview of the demarcation,
[1:11:32]
especially given that
[1:11:33]
there's, um, I think
[1:11:34]
they called it a
[1:11:35]
periodic flow,
[1:11:37]
but just...we would
[1:11:38]
want more
[1:11:39]
information and more
[1:11:40]
overview of that.
[1:11:44]
Good. Hmm, let's
[1:11:47]
see. Where did I
[1:11:49]
start? Hmm, I think
[1:11:51]
Robbie.
[1:11:57]
Thank you, Frank. Hmm.
[1:12:02]
So, test pit
[1:12:03]
number one had no
[1:12:04]
advantages, I
[1:12:05]
guess. There was
[1:12:07]
groundwater there.
[1:12:09]
So, when you do a
[1:12:10]
septic tank repair, you
[1:12:12]
make two inspection
[1:12:13]
pits. Uh, one of them
[1:12:14]
needs to be
[1:12:15]
tested for benefits. And
[1:12:16]
so, we conducted a test
[1:12:17]
for benefits in
[1:12:18]
test pit number
[1:12:19]
two.
[1:12:22]
And in section five,
[1:12:23]
only
[1:12:24]
one is required.
[1:12:24]
That's right.
[1:12:27]
Good. No more questions
[1:12:29]
Good. Hmm, Penny?
[1:12:32]
No, I think
[1:12:34]
everything is fine. Thank you.
[1:12:37]
Brendan?
[1:12:38]
I have no questions.
[1:12:40]
Thank you. Uh,
[1:12:41]
Eric? Uh,
[1:12:43]
I don't have any
[1:12:44]
other questions either. Thank you,
[1:12:46]
Frank.
[1:12:47]
Good. Do we have anyone in the
[1:12:48]
audience?
[1:12:50]
Uh, yes, we have one
[1:12:52]
hand raised. I'll
[1:12:53]
turn on the sound for them.
[1:12:58]
Hello, guys. I am,
[1:12:59]
in fact, the future
[1:13:00]
homeowner of this
[1:13:02]
house. So I
[1:13:03]
was working on this with
[1:13:04]
Greg and I just wanted to
[1:13:05]
express my
[1:13:06]
gratitude to everyone for
[1:13:07]
watching this tonight
[1:13:11]
Thank you. It looks like you're
[1:13:14]
moving on.
[1:13:16]
Hooray.
[1:13:17]
Frank, can we
[1:13:19]
just confirm the
[1:13:20]
name?
[1:13:20]
Yes, okay. Name and
[1:13:22]
address, please.
[1:13:23]
Oh well, my name is
[1:13:24]
Devon Zolk. My
[1:13:25]
partner's name is
[1:13:26]
Connor Dougherty.
[1:13:27]
Got it.
[1:13:28]
Yes.
[1:13:30]
Thank you, Devon. So,
[1:13:34]
Devon, while you're here,
[1:13:35]
um, just so you know, what you're
[1:13:36]
hearing
[1:13:37]
tonight, and you've seen the
[1:13:39]
plan, is that there was a
[1:13:40]
wetland line
[1:13:42]
, um, drawn by,
[1:13:43]
um, Self River Environmental, which
[1:13:45]
shows something like a
[1:13:46]
creek
[1:13:47]
running through
[1:13:48]
the area and the wetlands
[1:13:51]
behind it. So for the purposes of
[1:13:54]
this hearing,
[1:13:55]
the commission accepts this
[1:13:57]
wetland line
[1:13:58]
. But, if
[1:14:02]
you're
[1:14:03]
going to do
[1:14:04]
other projects on this in the future
[1:14:05]
, you'll have to
[1:14:06]
check out this
[1:14:07]
wetland line,
[1:14:09]
um, the other side.
[1:14:12]
So, we're not questioning that tonight
[1:14:14]
. The septic
[1:14:17]
system is far enough
[1:14:18]
away, but in
[1:14:19]
the future if you
[1:14:20]
plan on doing other
[1:14:21]
things on the lot you
[1:14:23]
should obviously
[1:14:24]
check with
[1:14:24]
the commission as there
[1:14:26]
is quite a bit of
[1:14:28]
wetland
[1:14:29]
or buffer zone around your property.
[1:14:32]
So, we know that there
[1:14:33]
is a lawn there, and it was already
[1:14:35]
built on before. So, we
[1:14:39]
see all this. Just
[1:14:43]
keep in mind that if you
[1:14:45]
are in a
[1:14:46]
sensitive area, or in
[1:14:47]
the future if you are
[1:14:48]
planning
[1:14:49]
yard work, you will want
[1:14:50]
to check with the
[1:14:51]
conservation department about
[1:14:52]
this.
[1:14:56]
Of course. Good.
[1:15:01]
Considering all this, I
[1:15:02]
accept the offer.
[1:15:03]
I propose a
[1:15:05]
minus three.
[1:15:06]
This is Penny. Do we have a
[1:15:08]
second?
[1:15:09]
from Brendan.
[1:15:11]
All P. Eric?
[1:15:14]
Yes.
[1:15:15]
And Robbie?
[1:15:16]
Yes.
[1:15:17]
And Frank, yes. So,
[1:15:19]
minus is good for
[1:15:20]
you, Devin. And good luck
[1:15:23]
with your house.
[1:15:27]
Thank you.
[1:15:28]
Perfectly.
[1:15:35]
Sorry. 11 145 RR Glades Road.
[1:15:42]
Right. On
[1:15:44]
September 25, 2026 at
[1:15:45]
6:00 p.m., the Scituate Conservation Commission
[1:15:48]
will hold a
[1:15:49]
public meeting
[1:15:50]
pursuant to
[1:15:51]
Chapter 131, Chapter 40,
[1:15:53]
Massachusetts General Laws,
[1:15:54]
Chapter 30700, Scituate Code of
[1:15:56]
Statutes
[1:15:57]
, to
[1:15:57]
discuss the request for a
[1:15:59]
determination of
[1:15:59]
applicability
[1:16:00]
filed ex post facto by
[1:16:02]
Bill Murphy regarding
[1:16:03]
the installation of a storage shed
[1:16:05]
located at
[1:16:06]
145
[1:16:08]
Rear Glades Road,
[1:16:09]
which is no longer
[1:16:10]
of interest. We invite you
[1:16:11]
to a meeting regarding prices
[1:16:12]
. Access to
[1:16:13]
meeting information
[1:16:14]
is available in the agenda
[1:16:15]
published on the
[1:16:16]
website.
[1:16:18]
And I believe we have a
[1:16:19]
homeowner on the line.
[1:16:22]
Yes. Can everyone hear?
[1:16:24]
We caught you.
[1:16:25]
Okay, great.
[1:16:27]
Thank you very much everyone, and sorry
[1:16:28]
I'm not in the video. I
[1:16:29]
tried, but it wouldn't let
[1:16:31]
me
[1:16:32]
do it.
[1:16:33]
I had the same
[1:16:34]
problem.
[1:16:36]
But I think you don't
[1:16:37]
mind if you don't
[1:16:38]
see my face.
[1:16:39]
Yes, Bill Murphy, 145 RR,
[1:16:41]
yes, Glades Road. Um, in
[1:16:44]
Scituate, and yes, my
[1:16:45]
wife Susan is
[1:16:47]
here too. And we, yes, we
[1:16:50]
dismantled and
[1:16:51]
rebuilt about
[1:16:52]
three and a half
[1:16:53]
years ago. Hmm, a
[1:16:56]
little 1920 cottage
[1:16:57]
that
[1:16:59]
my parents owned. We are very
[1:17:00]
pleased with how
[1:17:01]
everything turned out, and I am
[1:17:03]
sorry that we are here
[1:17:04]
before you today,
[1:17:05]
because after going through
[1:17:06]
so much that we have
[1:17:07]
been through, we certainly did not
[1:17:08]
intend for this
[1:17:10]
barn to turn out the way it
[1:17:11]
is. We, um, we...
[1:17:14]
it's a 96
[1:17:15]
square foot shed, and I
[1:17:17]
believe 200
[1:17:18]
square feet or
[1:17:19]
more is what the
[1:17:21]
building
[1:17:22]
inspector requires
[1:17:23]
a permit for. When we
[1:17:24]
found out, we
[1:17:25]
thought, “Oh, okay.
[1:17:27]
Well, we'll just have
[1:17:28]
our little
[1:17:29]
shed. We will lift
[1:17:30]
it above the ground. We will
[1:17:31]
put him in a
[1:17:32]
place that we
[1:17:33]
believe will be the
[1:17:34]
safest for
[1:17:35]
his safety. He
[1:17:38]
will be four piles away.
[1:17:41]
It will also be on
[1:17:42]
three of the four
[1:17:43]
sides behind cross
[1:17:44]
beams that
[1:17:45]
attach to the piles
[1:17:46]
to keep them
[1:17:47]
stable. So, yeah, we're
[1:17:52]
here, I guess, to
[1:17:53]
ask, what is it?
[1:17:57]
We have already considered this.
[1:18:00]
Yes, I'm not sure about the
[1:18:01]
correct
[1:18:01]
wording. Um, I'm not
[1:18:03]
sure what else you
[1:18:04]
want me to
[1:18:05]
tell you. The floor of the barn
[1:18:10]
is
[1:18:11]
14 inches off
[1:18:12]
the ground, and in fact, the
[1:18:13]
photo you
[1:18:15]
all see says
[1:18:16]
"northeast,
[1:18:17]
north,
[1:18:18]
northeast." Um, this is the door.
[1:18:23]
They only have one door.
[1:18:25]
Um, and I think the door
[1:18:26]
shows that it's
[1:18:27]
quite tall. This, um,
[1:18:29]
that floor you
[1:18:30]
see is
[1:18:31]
at a height of 14 inches.
[1:18:32]
above the ground. And there is only
[1:18:35]
one door. This...This is
[1:18:37]
actually just...This is
[1:18:39]
attached to...um, the
[1:18:40]
plywood that is the bottom of
[1:18:41]
our
[1:18:42]
first floor. So
[1:18:45]
it's very, very
[1:18:46]
securely attached by
[1:18:47]
...um, a licensed
[1:18:48]
builder. And, uh,
[1:18:52]
it's just...a
[1:18:53]
storage shed.
[1:18:55]
It has no
[1:18:56]
electricity. It
[1:18:57]
doesn't have a window. It
[1:18:58]
just has a door so
[1:18:59]
you can go in
[1:19:00]
and out. Uh, and everything
[1:19:01]
we store there
[1:19:02]
is stuff that used to
[1:19:03]
be in the basement when
[1:19:05]
we had a basement, and, uh,
[1:19:06]
there obviously has to
[1:19:07]
be minimal. There
[1:19:09]
is some furniture there that,
[1:19:10]
when my daughter
[1:19:11]
finally moves in,
[1:19:12]
will go with her. Uh, and
[1:19:13]
then a few...um,
[1:19:14]
items that we've
[1:19:15]
collected over the
[1:19:16]
years.
[1:19:17]
Good. Thank you. Uh, Jen
[1:19:21]
, do you want
[1:19:22]
to explain this first?
[1:19:24]
Of course. Uh, it was,
[1:19:28]
you know, a house that had
[1:19:29]
recently been
[1:19:30]
built on stilts, as
[1:19:31]
mentioned, and, uh
[1:19:33]
, noticed that there
[1:19:34]
was this
[1:19:35]
fence built there, and since
[1:19:36]
they were in the back, it was
[1:19:37]
hard to tell exactly
[1:19:39]
what it was. Uh, you...
[1:19:43]
I know whether it was a
[1:19:44]
finished area or a
[1:19:45]
staircase. Um, an
[1:19:47]
email was sent and
[1:19:48]
they responded and
[1:19:50]
confirmed that it was a
[1:19:51]
barn. It's
[1:19:53]
okay, it's not
[1:19:54]
ready. These are not stairs.
[1:19:59]
The stairs are located,
[1:20:00]
perhaps, on the side of the barn,
[1:20:01]
on the side of the swamp, if
[1:20:03]
possible...Um,
[1:20:05]
we have...well, um, the stairs are
[1:20:06]
by the barn, not on the
[1:20:08]
side of the swamp. They are
[1:20:09]
located on the
[1:20:10]
north side.
[1:20:12]
Okay, but they're not
[1:20:13]
fenced. They are
[1:20:15]
still open. So,
[1:20:17]
the building had no
[1:20:18]
objections.
[1:20:21]
It was too
[1:20:22]
small to
[1:20:23]
need a
[1:20:24]
building permit, and I
[1:20:25]
actually
[1:20:26]
checked with Coastal as well,
[1:20:27]
as it's essentially
[1:20:28]
in a
[1:20:29]
floodplain, and since
[1:20:30]
it wasn't a finished
[1:20:31]
space, they didn't have
[1:20:32]
any specific
[1:20:33]
concerns about it from
[1:20:35]
that perspective. Um,
[1:20:39]
also from some of their
[1:20:40]
photos and
[1:20:41]
discussion, um,
[1:20:42]
I learned that she was
[1:20:43]
attached to their
[1:20:44]
piles. So, there were no
[1:20:46]
disturbances in the
[1:20:48]
soil. There is no
[1:20:50]
concrete platform,
[1:20:51]
um, or any
[1:20:52]
such changes. So I
[1:20:56]
brought it here as a
[1:20:57]
shed after
[1:20:58]
it is
[1:20:59]
installed, which
[1:21:00]
can be permanent;
[1:21:01]
Um, you know,
[1:21:01]
given that we're
[1:21:02]
in a
[1:21:03]
barrier beach
[1:21:04]
area, we're
[1:21:05]
in a buffer zone of
[1:21:06]
marsh and land that's
[1:21:07]
exposed to
[1:21:07]
coastal currents.
[1:21:10]
But, um, you could often
[1:21:11]
argue that if
[1:21:13]
it's small enough
[1:21:14]
not to need a
[1:21:16]
building permit, then it's, um
[1:21:17]
, you know, you could
[1:21:18]
argue that it's been
[1:21:20]
minimized, which would be
[1:21:21]
, um, one of the rules for
[1:21:22]
building a shed in a
[1:21:24]
coastal
[1:21:24]
resource zone.
[1:21:31]
Good. Um, I think we're
[1:21:34]
back to Penny.
[1:21:37]
Yeah, just a quick
[1:21:38]
question. Um,
[1:21:40]
please don't store
[1:21:41]
any hazardous
[1:21:43]
materials, gasoline,
[1:21:44]
or anything like that in the
[1:21:45]
shed. Just in case
[1:21:47]
we have a storm
[1:21:49]
and...
[1:21:49]
you know, it'll be the first thing to
[1:21:51]
disappear. So, um, that's
[1:21:53]
all I'm asking is that
[1:21:55]
you don't...
[1:21:56]
Yeah. No, thank you for the
[1:21:57]
suggestion.
[1:21:58]
We keep all that stuff,
[1:22:00]
um, we keep it
[1:22:01]
inside.
[1:22:02]
Yeah, it's just...
[1:22:04]
The house, I
[1:22:05]
mean, not...
[1:22:06]
No, no, I see what
[1:22:07]
you mean. This
[1:22:09]
... This is part of it, right? Yes, that's
[1:22:12]
right.
[1:22:13]
and we don't want
[1:22:14]
pollutants
[1:22:15]
, okay? But other than that
[1:22:17]
, I have no
[1:22:18]
problems with the project.
[1:22:19]
Thank you.
[1:22:20]
Thanks, uh, Brendan.
[1:22:24]
Yes, I have no
[1:22:25]
questions.
[1:22:26]
Good. Eric.
[1:22:30]
Um, yes, when I
[1:22:32]
look at the FEMA map,
[1:22:33]
it shows AE zone 15,
[1:22:35]
not speed. So, I
[1:22:38]
think considering
[1:22:40]
we're going over the
[1:22:41]
speed limit and there's no
[1:22:43]
pad or anything
[1:22:45]
like that, I think it's
[1:22:46]
okay. Thank you.
[1:22:49]
Um, Robbie.
[1:22:51]
Thank you, Frank. So, is
[1:22:54]
this under construction?
[1:22:57]
Yes.
[1:23:04]
And did you mention that this is
[1:23:05]
attached to the
[1:23:06]
existing piles
[1:23:07]
as well as the existing
[1:23:08]
structure?
[1:23:13]
This is attached to the
[1:23:14]
existing structure from
[1:23:16]
above. Mmm.
[1:23:17]
Right. Yeah, I
[1:23:18]
get it, I don't think
[1:23:20]
I was asked to
[1:23:21]
appear higher, but,
[1:23:22]
um, you know, our
[1:23:23]
first floor
[1:23:24]
obviously has the floor that
[1:23:25]
we're standing on, and
[1:23:26]
then the
[1:23:27]
subfloor, and then the
[1:23:28]
insulation, and then the
[1:23:29]
plywood that goes under
[1:23:30]
all of that. This...This is
[1:23:31]
attached to this.
[1:23:33]
And then
[1:23:34]
along with what's
[1:23:35]
attached...
[1:23:36]
Sorry.
[1:23:36]
No, sorry. Boldly.
[1:23:38]
From below. This is, uh, its
[1:23:40]
support on existing piles
[1:23:42]
. How is it down there? Or...
[1:23:51]
No, from the bottom, the four corners
[1:23:52]
... uh, you know, there are pillars
[1:23:54]
that stand on it,
[1:23:55]
I think, so-called
[1:23:57]
diamond pillars.
[1:24:00]
Good. So, the supports, uh
[1:24:02]
, are unique to the
[1:24:03]
barn structure. Er
[1:24:08]
, yes. Uh,
[1:24:11]
no more questions for you.
[1:24:12]
Thank you. Good. Is there
[1:24:14]
anyone in the audience
[1:24:16]
on this?
[1:24:20]
No, I didn't raise my hands. It's
[1:24:22]
just us.
[1:24:23]
Good. So, I want to
[1:24:26]
understand this in more detail. Is this a shed
[1:24:30]
, or was it... There were
[1:24:32]
driven foundations
[1:24:33]
or diamond piers, and
[1:24:34]
then this was
[1:24:35]
built, and this was
[1:24:40]
built in place,
[1:24:41]
and this is attached to the
[1:24:42]
bottom of the
[1:24:43]
existing structure
[1:24:45]
. Is that correct?
[1:24:47]
Yes, that's right.
[1:24:49]
So, technically it's not
[1:24:51]
like a freestanding
[1:24:52]
shed. This...This is outside the
[1:24:54]
house. Uh, well,
[1:24:58]
I'm not sure if
[1:24:59]
detached is the
[1:25:00]
term to
[1:25:01]
use, but
[1:25:02]
I mean it's
[1:25:03]
not...a shed that's
[1:25:05]
in someone's
[1:25:06]
backyard.
[1:25:06]
Good. Um...Oh, that's... It's
[1:25:14]
a shame there's a gap between the
[1:25:17]
building
[1:25:18]
department, you guys,
[1:25:19]
when they can
[1:25:20]
build a shed...
[1:25:21]
Mhm...
[1:25:22]
that's less than 200
[1:25:23]
square feet and
[1:25:24]
doesn't require
[1:25:25]
a permit, but I do
[1:25:28]
n't really see
[1:25:30]
the danger here. Although
[1:25:31]
personally, if this
[1:25:32]
issue were being considered
[1:25:34]
by the commission, I think
[1:25:35]
we would at least
[1:25:36]
ask that it
[1:25:37]
be a little further from the
[1:25:38]
ground...
[1:25:39]
Mhm...so that
[1:25:40]
the water could flow.
[1:25:45]
Um, it looks like there
[1:25:47]
's only a few inches under this,
[1:25:48]
um, and I'm not entirely
[1:25:49]
sure I
[1:25:51]
define it as a shed.
[1:25:52]
Boldly.
[1:25:55]
Sorry.
[1:25:57]
It actually varies a little bit
[1:25:59]
, um,
[1:26:00]
because the whole area is not...
[1:26:01]
It's uneven.
[1:26:04]
Ahem.
[1:26:05]
So, I actually
[1:26:07]
measured, um, in
[1:26:08]
daylight for
[1:26:09]
another measurement,
[1:26:10]
um, during the day, and at some
[1:26:12]
points it's 6 1/2
[1:26:13]
inches above the ground. And I'm
[1:26:16]
talking about the
[1:26:17]
exterior, which
[1:26:18]
is actually...it's Hardie
[1:26:19]
...The board that we
[1:26:20]
did on the outside because
[1:26:21]
it matches the house
[1:26:23]
, and it's...Umm...
[1:26:24]
fireproof, and
[1:26:25]
waterproof, and all
[1:26:26]
that. Um, and then at
[1:26:28]
other points it's
[1:26:29]
3 1/2 inches off the
[1:26:31]
ground.
[1:26:32]
Good. Good. Um...Oh. I
[1:26:40]
think, uh... Again
[1:26:41]
, it's too bad that there
[1:26:43]
was such a
[1:26:43]
misunderstanding, uh... and
[1:26:45]
uh, I think if it had
[1:26:46]
been in a speed zone
[1:26:48]
or some other
[1:26:49]
area, I think
[1:26:50]
we would have a different
[1:26:51]
conversation, honestly
[1:26:53]
. Um, you're in a
[1:26:58]
flood zone, and um, and there's nothing
[1:26:59]
there,
[1:27:00]
so I...I'm fine.
[1:27:05]
Can anyone make
[1:27:06]
a suggestion?
[1:27:07]
Yes, I'll make
[1:27:08]
a suggestion about
[1:27:09]
minus two, Jen?
[1:27:13]
Um, I don't know if it's
[1:27:14]
two or three in this
[1:27:15]
case. Two, two. We are in
[1:27:17]
...We are in...We are on a
[1:27:18]
barrier beach. Um,
[1:27:20]
but just to add
[1:27:22]
to what
[1:27:23]
Frank said about...um, you'll
[1:27:24]
probably want to go above
[1:27:25]
, and then I would talk
[1:27:27]
to either your engineer
[1:27:28]
or the board of
[1:27:30]
health, as far as
[1:27:31]
you know, any
[1:27:32]
interaction with...um
[1:27:33]
septic system.
[1:27:36]
Ahem.
[1:27:37]
Just, uh, you know, in
[1:27:39]
case something
[1:27:40]
happens and
[1:27:41]
needs to be
[1:27:42]
rebuilt, uh,
[1:27:43]
damaged, I would, uh,
[1:27:45]
check with them as well
[1:27:46]
to make sure that
[1:27:47]
, uh, access isn't
[1:27:48]
blocked by this
[1:27:50]
construction here.
[1:27:52]
Oh, yes. We would definitely
[1:27:54]
do that, and, uh, we
[1:27:55]
actually have...We have a
[1:27:56]
great
[1:27:57]
service company. Uh,
[1:27:59]
they were there recently.
[1:28:00]
Some maintenance guys
[1:28:02]
sent
[1:28:03]
one guy every time and
[1:28:04]
they said everything was in
[1:28:05]
great condition and I
[1:28:06]
think they
[1:28:07]
should last
[1:28:08]
about 20 years so
[1:28:09]
...
[1:28:09]
Okay.
[1:28:09]
But yes, we would definitely
[1:28:11]
do that. And again
[1:28:12]
, we're sorry that we're in
[1:28:14]
front of you...We would like to
[1:28:15]
, uh, we would like to
[1:28:16]
know that we should have
[1:28:18]
gone a little further,
[1:28:19]
uh, Bob Vogel.
[1:28:21]
Good. Well, they have their own
[1:28:24]
requirements, and we have
[1:28:25]
some too, so...
[1:28:26]
Hmm.
[1:28:27]
Good. Thank you. You see,
[1:28:30]
I think we...Do
[1:28:31]
we vote? Are we
[1:28:32]
ready?
[1:28:33]
No.
[1:28:33]
Okay, continue.
[1:28:35]
We don't even have a
[1:28:36]
second.
[1:28:37]
I support this for...
[1:28:38]
Brendan.
[1:28:39]
then all in
[1:28:40]
, Erica?
[1:28:44]
Yes.
[1:28:44]
And Robbie?
[1:28:46]
Yes.
[1:28:47]
And Frank, yes. Good.
[1:28:49]
Perfectly. Thank you very much.
[1:28:51]
Okay, thank you very much, everyone
[1:28:53]
. And, uh, thank you, Josh
[1:28:54]
and Jen,
[1:28:56]
thank you very, very much.
[1:28:56]
Good evening.
[1:28:57]
Good night. See you later.
[1:28:59]
Emm.
[1:29:02]
So, on other
[1:29:03]
matters, we have the terms of
[1:29:05]
the order, Jen, 107
[1:29:06]
Glades.
[1:29:08]
Uh, yes, it was an
[1:29:09]
enhanced
[1:29:10]
reconstruction.
[1:29:11]
Good.
[1:29:12]
I propose to accept
[1:29:14]
these orders in
[1:29:14]
writing.
[1:29:17]
The second one is from Mark.
[1:29:19]
Sorry, that was Eric.
[1:29:21]
I'll pass this on to Eric. I
[1:29:24]
will entertain
[1:29:25]
Brendan.
[1:29:27]
Yes.
[1:29:27]
And Robbie.
[1:29:29]
Yes.
[1:29:29]
And Frank, yes. Thank you.
[1:29:32]
Good. Any, uh.
[1:29:34]
Then we have a request to
[1:29:36]
extend the
[1:29:37]
order at
[1:29:38]
70 Glades.
[1:29:39]
Yes, this is an elevated
[1:29:40]
reconstruction that they are
[1:29:41]
currently working on.
[1:29:43]
They started
[1:29:44]
work a few
[1:29:44]
months ago. Emm.
[1:29:47]
So, yes, they
[1:29:48]
are asking to continue
[1:29:50]
their orders.
[1:29:51]
For how long, Jen?
[1:29:53]
Uh, they asked for 3
[1:29:54]
years, so if you don't
[1:29:55]
mind, that's it. their
[1:29:57]
first sequel.
[1:29:59]
Good.
[1:29:59]
Okay, then I'll make
[1:30:01]
a suggestion, Frank.
[1:30:02]
Yes.
[1:30:02]
To grant the house at
[1:30:05]
70 Glades Road a 3-year extension
[1:30:06]
under their order.
[1:30:08]
Okay, this is a suggestion
[1:30:09]
from Penny.
[1:30:10]
The second suggestion is from
[1:30:12]
Eric.
[1:30:13]
All in, Brendan?
[1:30:15]
Yes.
[1:30:16]
Robbie?
[1:30:17]
Yes.
[1:30:18]
Frank, yes.
[1:30:19]
Good. Penny, do you want to
[1:30:21]
...
[1:30:21]
Let's go over
[1:30:22]
the protocol.
[1:30:23]
Good.
[1:30:24]
proposal, we
[1:30:25]
accept the minutes as
[1:30:27]
they were written on
[1:30:28]
August 31.
[1:30:29]
Is this an offer from
[1:30:30]
Penny, a second
[1:30:31]
offer? Robbie, you
[1:30:34]
can even add a
[1:30:35]
second sentence
[1:30:36]
if you want.
[1:30:36]
I will support.
[1:30:37]
Thank you.
[1:30:38]
Robbie. I
[1:30:40]
will publish this. I'll
[1:30:41]
speak up, you know.
[1:30:44]
Be
[1:30:45]
careful. Brendan?
[1:30:47]
Yes.
[1:30:47]
Eric?
[1:30:48]
I'm holding back. I
[1:30:50]
wasn't there.
[1:30:50]
Good. Frank, yes.
[1:30:53]
Um, and then Penny, do you
[1:30:55]
want to...
[1:30:56]
Yes. I just have to
[1:30:58]
formalize it. I know
[1:31:01]
some of you have already
[1:31:02]
been to Katie's and
[1:31:03]
signed the CRI, but I
[1:31:04]
need to hold an
[1:31:06]
official vote
[1:31:07]
that we were unable to
[1:31:08]
do at our
[1:31:09]
workshop. So, I would like to
[1:31:13]
make a motion
[1:31:14]
that the Conservation Commission
[1:31:16]
adopt
[1:31:24]
the super-restriction on
[1:31:25]
conservation that
[1:31:26]
has been approved by the state,
[1:31:27]
and we just need to
[1:31:29]
get the signatures of the
[1:31:30]
Board of Selectmen and
[1:31:31]
the rest of the members of the
[1:31:31]
Conservation Committee
[1:31:32]
. It was a
[1:31:38]
proposal.
[1:31:39]
Yes, this is an important
[1:31:40]
proposal.
[1:31:40]
I will support Eric.
[1:31:43]
I support Eric. All in
[1:31:45]
favor. Brendan?
[1:31:47]
Yes.
[1:31:48]
Robbie?
[1:31:49]
Yes.
[1:31:50]
And Frank, yes. And Penny,
[1:31:52]
thank you very much. It was a
[1:31:54]
long saga. Hmm, this is a
[1:31:57]
vital
[1:31:58]
part. We kind of
[1:31:59]
explained this last
[1:32:00]
night, but I appreciate
[1:32:01]
your diligence.
[1:32:02]
Also, when you
[1:32:03]
talk to
[1:32:04]
Wildlands, tell them
[1:32:05]
we appreciate their
[1:32:06]
hard work.
[1:32:07]
Oh, yes. I always
[1:32:09]
do this. But Frank and
[1:32:10]
Brendan, can
[1:32:12]
you take your
[1:32:13]
little sons
[1:32:14]
to Katie's office and
[1:32:15]
sign?
[1:32:16]
Send by mail.
[1:32:18]
This needs to be
[1:32:19]
notarized, Don.
[1:32:20]
OK?
[1:32:21]
Tomorrow, Penny. I'm
[1:32:22]
going to town hall tomorrow
[1:32:24]
Thank you very much. I really appreciate it
[1:32:26]
. And then I'll just
[1:32:27]
catch Roger as soon as
[1:32:29]
he
[1:32:29]
gets back. city.
[1:32:31]
Thank you.
[1:32:32]
Of course, he will be
[1:32:34]
right. Well,
[1:32:36]
we'll keep an
[1:32:38]
eye out. I am OK.
[1:32:40]
Thank you, Penny.
[1:32:41]
Good. Uh,
[1:32:42]
what else? What else do we have?
[1:32:45]
You. Did you want to
[1:32:46]
No, I just really
[1:32:47]
wanted to thank
[1:32:48]
you all for being here
[1:32:50]
last night. I
[1:32:51]
think we had a
[1:32:52]
good seminar where
[1:32:54]
many things were discussed. I was
[1:32:56]
happy to see the people from
[1:32:57]
Trails Group. I'll try to
[1:32:59]
contact them, uh,
[1:33:00]
with a few things
[1:33:02]
that would be
[1:33:02]
helpful to them, and Jen has
[1:33:03]
made some
[1:33:04]
progress with Modica and
[1:33:06]
Lincoln, and he's
[1:33:07]
been weeding and
[1:33:08]
stuff, and getting
[1:33:10]
Porter Street sorted out.
[1:33:11]
I mean
[1:33:12]
Porter Street. Yes, sorry.
[1:33:13]
We won't touch
[1:33:14]
Modica and Lincoln.
[1:33:15]
No, no, no, no. We are
[1:33:17]
perfect there. You all
[1:33:18]
need to
[1:33:19]
go there right now and
[1:33:20]
see the garden.
[1:33:22]
He is wonderful.
[1:33:23]
So, uh, but
[1:33:25]
thanks again. I thought it
[1:33:26]
was a constructive, uh,
[1:33:28]
meeting. I'm glad it
[1:33:29]
takes extra
[1:33:30]
time, but I think
[1:33:32]
it's worth it. Uh,
[1:33:34]
as for
[1:33:36]
Border Street, we're working
[1:33:37]
on it and we're going to
[1:33:38]
figure it out.
[1:33:40]
Make a plan
[1:33:41]
to mow the field and
[1:33:42]
clean the stone
[1:33:43]
wall.
[1:33:45]
Good.
[1:33:45]
Once you
[1:33:47]
clean it, it will be
[1:33:48]
easy to care for. But
[1:33:50]
this requires
[1:33:51]
professionals. This is
[1:33:53]
too much for
[1:33:54]
anyone. So, can I
[1:33:57]
make a motion
[1:33:58]
to
[1:33:59]
adjourn, Frank?
[1:34:00]
Yes, please.
[1:34:01]
I am making a suggestion. Does
[1:34:03]
anyone else want to
[1:34:04]
say something, Jen? Josh?
[1:34:07]
Members?
[1:34:08]
No. Good. Good.
[1:34:10]
I propose
[1:34:11]
to postpone the
[1:34:12]
meeting.
[1:34:13]
Uh, take that, uh,
[1:34:15]
second word.
[1:34:16]
I will support.
[1:34:17]
This is, uh, Eric. All in,
[1:34:19]
Brendan?
[1:34:20]
Yes.
[1:34:21]
Robbie?
[1:34:22]
Yes.
[1:34:22]
Frank? Yes. Thank you all
[1:34:25]
Thank you. Good night.
