because we know at some point in time um
you know our planners will move on

something else either retirement or
whatever and it could be that we need

something established

but we don't know what that new
investment group might be doing with

that piece of property
um and all the property surrounding it

because that's they have a lot of
property. So, things of that nature.

Also, uh, more and more city council
regularly is somebody trying to build
[11:17]
the neighborhood between here and the
bypass and so we've got to I make them
[11:23]
aware all the time that there is going
to be a jet 200 feet over their house
[11:27]

only way that we really can protect the

airport is through zone. The first being
associated with the racetrack idea is

the airspace is height zoning height
zoning ordinances that we work with. Uh

restricting because if you especially
[11:50]
when you mention zoning in the county it
really goes squirly if the idea is just
[11:56]
making sure that there isn't that they
have to go through a process. So
[12:01]
everybody that puts tower over uh he
puts tower up period within that
[12:05]
racetrack has to file with FAA.
Anything over certain elev anything over
[12:11]
200 ft has to be lit no matter where
whether it's an issue or not. But also
[12:16]
we have to we want to make sure that off
the end of the runway where it is most
[12:21]
restrictive for us and most important
for us that we protect that through not
[12:25]
allowing things over certain elevations,
certain heights. Uh, perfect example is
[12:30]
one of our own tenants put a tower right
up there off the north end because
[12:33]
that's right across the street to his
property and he's he's got a airplane
[12:37]
here and he still put a tower there
because it was for his for his business
[12:41]
and it messed with our numbers on a
couple of different things.

the authority now to regulate the area
around there. You have the authority to
[13:25]
be able to zone
uh and we'll back you the with the power
[13:30]
of the federal government." Now, they're
not going to say no to somebody. They're
[13:33]
going to say, "Yes, you are
construction. Yes, you need to light it.
[13:37]
And we're going to inform the locals
where it is and give them the
[13:41]
opportunity to to stop it." But they're
not going to stop. That makes sense.

But uh
the other is the other piece that we
[13:56]
have you can see of um the land use plan
that's around there. You can that will
[14:01]
also give you an idea of how big our
piece of property is that we have and
[14:04]
we've been able to control most of our
approaches uh the runway protection zone
[14:10]
and different things like that. you'll
the it's kind of hard to read, but I'm
[14:13]
just giving you this as an example just
so eventually there will be a a bigger
[14:17]
version once it's complete that
everybody will be able to see.

But you can see to the south of them
we've got we've owned all the property
[14:26]
and there's only a small triangle that
we don't on the north end that we don't
[14:31]
have not been able to acquire because of
231 and right across 231. Uh, one of the
[14:37]
things that we thought we had and we
went and Lisa and I a while back went
[14:41]
looking for and never found one. But
some some of the older members of the
[14:46]
authority are know that thought that at
one point in time there was a land uh an
[14:50]
navigation easement bought over that
that corner, but we can't find any
[14:55]
example of it. So all I can figure is it
maybe was discussed in meeting at some
[14:58]
point in time and never happened. It
probably never came to an agreement or
[15:01]
something like that.

of this airport layout plan is that we

do acquire a navigation easement over
that small piece of property so that at
[15:14]
some point in time right now that it's
it's owned by a widow and

she will somebody will finally give her

enough money that she'll sell it right
now she still has a lot of sentimental
[15:24]
value because her you know her husband
was out there every day working on it
[15:28]
and so she'll hold on to it I'm sure as
long as she can at some point in time

it'll be out there and with it right
there on 231 right next to TCAT and
[15:39]
right next I mean it's going to be hard
for somebody to not to walk away from
[15:42]
that piece of property. So the best
thing we could do it is currently in the
[15:46]
county uh is to uh work with the county
to for proper zoning and all of 231 is
[15:54]
going to be uh working through a zoning
process throughout the starting in uh
[16:00]
beginning of the year especially are
really going to get a lot more focus and
[16:03]
we're we're diligently working with the
the planning office to make sure you can
[16:07]
be involved in that process. So, we want
to be able [snorts] to restrict around
[16:12]
us, but we don't want to restrict
ourselves,
[16:14]

>> But so far, we're able to uh we're zoned
[16:18]
as industrial as far as the city's
concerned. So, we're we're able to do
[16:23]
what we need to do, but we also want to
because what you want around your
[16:27]
airports is um it's pretty much you want
to have your um commercial, you you try
[16:35]
to leave it agriculture if you can,
that'd be great, but um you want to have
[16:41]
your industrial.
And so that's a big part of what I
[16:45]
encourage for around the airports is to
really push the even industrial more
[16:50]
than commercial because they have uh
with commercial you start having some
[16:55]
restrictions on the number of people
that can park things like that under
[16:57]
your approaches and different things
like that. As a matter of fact um they
[17:02]
even in under certain approaches they
don't want you to have even a park where
[17:07]
people can gather in large groups. So
there are just different ways but
[17:12]
industrial really works well because
they already their own noise. So it
[17:17]
really works well with noise
compatibility. I encourage people when I
[17:21]
in my previous life I said the best
thing you can do is buy is get storage
[17:24]
units and put them around airports
because everybody wants storage units it
[17:27]
seems like and that's the best place
because boxes don't complain. It's like
[17:31]
this is what people say about wanting to
fly for FedEx and UPS. They said when
[17:34]
they have a rough landing the boxes
don't complain.

the biggest part of what we need to make
[18:59]
sure through zoning in this area
is the incompatible land uses which is
[19:06]
for for the most part for most airports.
For some reason airports seem to attract
[19:10]
houses like you know bees and honey. I
don't know why it is but for some reason
[19:15]
they really seem to attract airport uh
airports seem to attract houses and you
[19:21]
can see that to the north big time. the
airport to the north is really
[19:24]
constrained and can't do anything. Uh as
much as their population wants it, they
[19:30]
can't do anything about it because
they've built houses all around that
[19:32]
airport. And so here we've been able to
acquire a lot of it and so far we've
[19:39]
been able to work well with that that
particular neighborhood, but that
[19:42]
neighborhood is still is still county.
Um so that's the thing is we we have
[19:47]
some odd shapes in this area as far as
city and county is concerned. We have to
[19:51]
really work well with the county because
uh big chunks of our property line are
[19:56]
up against the county.

six months working with the county,

working with the city planners, things
of that nature, maybe a little bit
[20:06]
longer than that, it just takes time to
uh plan through because really when you

start talking zoning in the county, it

restrictions based on obstructions in

metal mainly metal like putting
buildings up that's why you see the

white fence over there things like that
so it doesn't impede on the navigation
[21:12]
purpose of the VO. And so that is uh
that is something that's actually um
[21:19]
they've been reminded of in this process
where they're talking about stopping the
[21:22]
farming and doing something else to
remind [clears throat] them that they
[21:26]
have that V there that causes a
restriction on that piece of property
[21:29]
and they're very aware of it. Um now if
they sell it, I'm sure somebody that
[21:33]
buys it will, you know, conveniently
forget that. But that will be one other
[21:39]
thing that they I can't tell you because
I was not around when that was installed
[21:43]
in the 70s where um if now the tailor's
own that property in the 70s. So I don't
[21:49]
know if they made an agreement with FAA
at that time or not. I don't know. I
[21:53]
don't have that information. The other
smaller one you see that's similar is
[21:58]
AWS and that's our weather system. It's
a much smaller circle. The other one's
[22:02]
500 foot. The other one's 100. So it's a
you go out 500 feet and make the large
[22:07]
circle and then you go out 100 feet to
make the smaller circle for the AWAS.

That again is that metal doesn't affect
it but it does it's affected by um

percentage of of structure. So like
anything over certain distance out you

can't grow anything grass can't be over

get along, but uh they know they know we

are a utility for everyone, not just for
the city, right?

you know just because I there may be
some assumptions on my part that I don't

mean for there to be and so it really
needs to be able to that any any person

that sees the rules and regulations can

» And even if it's a brand new pilot,
most cases, rules and regulations are

written for pilots, but they also cover
anybody that's trying to uh have
[32:34]
aeronautical activity on the airport,
just like our minimum standards are
[32:37]
written for anybody that has an
aeronautical service on the airport. So,
[32:40]
it's an aeronautical activity and that
includes like your paragliders, that
[32:44]
includes your in some cases even um you
know parachute jumpers and different
[32:49]
things of that nature. you've got other
things that they have to include and so
[32:53]
not all those guys are or at least have
or carry a pilot's license or student
[32:57]
pilots license and so these have to be
written in Atlanta that can cover a lot
[33:02]
of them. So I was hoping that they get
some some guidance from you uh as far as
[33:07]
some areas that you obvious that seem to
be obvious or other ones that maybe not
[33:11]
so obvious. Uh some I already know that
will need to be updated. I I as
[33:18]
mentioned before I did ask uh at the
city at city hall if there was some
[33:21]
certain any types of rules and
regulations that were established for
[33:24]
city buildings to make sure that we were
adhering some of the same situations.

this is a city facility to make sure and
surprisingly there's not uh there's
[33:34]
nothing in writing for like city hall
for example um as far as any type of
[33:40]
rules there might need to be but there's
not so I couldn't say I couldn't mimic
[33:45]
any of those

have of course is we do rent out rooms
at the rec center but you know park and
[33:52]
wreck is really the only thing that I
mean we're we're our own animal out here

there's no smoking in government

buildings and that's just known and so
they don't have any writing. But what

things that we mentioned here is how
close you can be to the building.

seen it here too where literally they're

walking in the door and they're blowing
it out and flicking a cigarette as
[34:20]
they're stepping through the threshold.
Well, we're we we're trying to keep that

from happening here by putting a
restriction on it. Uh, one of the things

I did want to ask, you know, I was
thinking Kelly was here too, but at
[34:33]
least some of the the lawyers in the
room um and find out in reference to um
[34:40]
smoking and vaping because I know vaping
is a big thing right now to the point
[34:44]

not? How is it being looked at as far as

cases I think the restrictions are less

I thought the law was there's a statute

that tells specifically how far you can
have to be.

Courthouse, they have it on the on the

how far you have to be away from the

airport other than where it's designed.

But we have people that do that
um because they're too lazy to walk up

past from a their anger or something

like that.

what we can look at as far as keep in
mind what we can do to try to enforce

these and can there be something that

at that. Some of these issues might be
such that you'd want to

truly find someone that you would take
it to municipal court, but of course

finding out what we can do. Now, rules
and regulations, yes, they adhere to

of hard. So, if we have somebody that's

just flying through and they stopped
just long enough to get fuel and they're
[40:54]
moving on somewhere else to another
state, may or may not be back. It's not
[40:58]
like we can tell them you can't come
back because you you did X,

it's also hard to follow and try to
[41:09]
send them a sent

enforcement. We've got some ordinances
having trouble enforcing right now.

animals especially.
>> And that's again that's another thing

because is what we've discussed with
with minimum standards. Uh one
[41:28]
template [snorts] and different things
that I've looked at offers and
[41:31]
recommends that your minimum standards
be put through as a potential ordinance.

» And that's one way you have to remember

» when we talk about municipal court and
so those of you that may not be aware
[41:44]
our municipal court is a true municipal
court. It is an appointed judge. He does
[41:50]
not have the type of authority like your
general sessions judge. City of
[41:54]
Murphusboro's city court, it has an
elected judge and has the same power as
[41:59]
a general sessions court. They can do a
whole lot of things. So when there is a
[42:04]
quote violation of city law, meaning
just something that the city has passed
[42:08]
by ordinance, it's in our municipal code
>> and you take that violation to
[42:14]
city court. The authority in Tennessee
is our judge is limited to finding
[42:19]
someone up to $50 a day per violation.
Now, that's basically standard law,
[42:24]
something that's going to go across the
the way.
[42:27]
» The way I would imagine you would do
this is this is someone that's operating
[42:31]
by permission on the airport. You need
to tie that to basically rescending some
[42:38]
of their
authority to operate here if they don't.
[42:43]
It's basically a contract between the
two of you. This is not law per se that
[42:48]
applies to everybody in the city. This
is somebody that's operating here. And
[42:52]
really, I think the the threat, if you
want to say it, is if you keep doing
[42:57]
this, violating our rules and our
standards, you're not going to be out of
[43:00]
your business or whatever it is you're
doing here.

» In the meantime, though, how do you go
about kindly getting them to get to that
[43:09]
point?
>> Yeah. You know,
[43:11]
» I think that's a great point, uh, what
you're saying because rather than trying
[43:16]
to go a legal route and all that stuff,
you just administratively we just warn
[43:22]
them and say, "Please don't do that
again." And, right,
[43:25]
» you know, and then the second time you
warn them a little stronger and then you
[43:29]
say, "Well, we're [snorts] to cancel
your lease on your the tea hanger."
[43:32]
» Yes. And I think we write that in, you
know, that it's a part of our leases.

It's already in there. If you will
continually violate our rules and
[43:40]
regulations, we're going to consider
that a breach.

>> And so that's part of the thing is is

all of our leases will need to be re
re-evaluated

and there could be and I I think that's
including the long-term leases on the
[43:55]
ground as well.

them to be flexible and can change but
[44:06]
» also enforceable in some form of fashion
like that by pulling your lease. Um

operating agreements I mean that
wouldn't be done without fair warning

due process warning you know
discontinued we consider it's it is of
[44:20]
such nature that we would

regulations they're pretty
[44:27]
stop it now kind of thing but as far as
minimum standards that might be a little
[44:30]
different
>> as you've seen later as we we'll discuss
[44:33]
later I know I'm kind of mixing old and
new business together but they kind of
[44:37]
some of some of the legalities of them
work similar
[44:40]
But the minimum standards
>> as we'll discuss um those are some that
[44:45]
you can establish a timeline saying
given them 30 days or 45 days or 60 days
[44:50]
whatever you're correct and if you don't
then

read the document, this will give you

idea of
you know what's changed, what's not
[46:05]
changed. Absolutely. I am not suggesting
this is right, wrong, good or bad. Okay?

have another template too that we can

put together with that and it's and I
I'll send you I was uh going through and
[46:26]
editing those to because it was a
generic template and I took from another
[46:30]

reinvent the wheel especially if they
[46:35]
thought about it because there are so
many different aeronautical activities
[46:39]
and aeronautical services I should say.

distinguish between the two minimum
standards are really decided and set up
[46:47]
for aeronautical
um services
[46:52]
» and a lot of the minimum standards
as Paul to actually go through a lot of
[46:58]
these decisions he needs to tell us what
he recommends what should he that's

and review and approve

» one of the things and I did like I said
um before my staff that don't carry a
[47:13]
badge and a gun. So, how do you enforce
some of these and what are

» what does it make sense? You can put
them in there, but if you know that

that's going to just cause a a riff or
cause a problem, then you're constantly
[47:24]
going to be, you know, uh saying please
or don't do that again or whatever. I
[47:31]
mean, it's so
>> as an example, can you give us an

Um,

one of the things that most all the
minimum standards have in common for
[47:45]
aeronautical services is that you
establish a um
[47:52]
hours that you're open or x number of
employees or days that you're open,
[47:55]
things of that nature. And if you have
people that are closing up shop early on
[48:01]
a regular basis or not providing that
service that you that they've stated
[48:05]
they're going to uh that would be one
that that you would that could easily be
[48:11]
one that they find that you know we
don't have any especially for like a
[48:15]
flight school for example we don't have
anything flying because the weather's
[48:18]
bad in day or we don't have um anything
on the schedule so we're not here. So
[48:23]
there's just different things like that
that if you establish those which
[48:27]
upfront if you establish a minimum
standard with them
[48:31]
um that's the thing you make it so
minimum that somebody that's full force
[48:44]
in other words I'm paying somebody to be
here
[48:48]
» five days a week
>> or seven days a week whatever the
[48:51]
scenario is and then somebody just comes
onto the ramp and decides to do flight
[48:55]
school to be a flight school off the
ramp. Um they come and go when they want
[49:00]
to, but that doesn't and then you start
trying to enforce it or trying to stop
[49:06]
it and different things of that nature.
It it starts becoming a little a little
[49:10]
hairy in some cases just because
>> and I've had it before for example on a
[49:16]
maintenance shop. Uh the previous owner
was quite vocal if you recall of Mac Air
[49:22]
and when people would come in and try to
do stuff on the ramp that for themselves
[49:26]
or try to do stuff in their hangers for
themselves that were above and beyond
[49:30]
and he was basically saying why you're
telling me I got to carry you know
[49:34]
million dollars worth of insurance and
he's got none
[49:38]
and things like that you know and so
there's a cost for me to have it. So,
[49:42]
some of those same type of things as far
as on those minimum standards.

Um,
making sure they're properly
[49:51]
established, but also not. So,
what do you put the minimum I guess is
[49:56]
also does that make sense? My qu I know
I'm kind of talking around and around,
[50:00]
but because I've read it so much, it's
hard to stay quite square on it. But I
[50:05]
want things to be nice here, but also
it's still we got to think about it as a
[50:08]
community type general aviation airport.
You got to make it business. You want
[50:16]
you want it friendly for your
businesses.
[50:18]
» And if you get into a situation where
you need the Shelby Police Department or
[50:21]
emergency services or whatever, this is
this is Shelbyville property. So,
[50:28]
but
like you say, you have to kind of handle
[50:33]

So, one of the things for the minimum
standards is trying to
[50:46]
um
[50:50]
establish all the different types of
aeronautical services. And uh one
[50:54]
particular template I have basically
breaks it down to about 15 areas that

need to be looked at and adopted and
particularly critiqued
[51:04]
for 15 general areas of of activity.
Um,
[51:10]
some go into more some some try to
broaden them into different groups if
[51:14]
you can. Um,
[51:24]
so it just depends on how
guess how detailed we want to get into
[51:29]
the minimum finishes too.

recommendation.

incorporated into their leases. So every

one of them

out those are just rules and they didn't
have the minimum standards with them.

new lease hanger six macare lease um mac
uh 8 and 10 lease and consent sub lease.

» So the rules and regulations don't have
minimum standards set in them.

okay cuz if you want to one's

guess you could say one regulates it's
more for activity and one is for
[53:16]
services but your rules and regulations
are for everybody that are doing

aeronautical activity on the air your
minimum standards are for those that are
[53:24]
providing a service and so in some cases
you can look at it that um that's why
[53:31]
the minimum standards in a lot of cases
need to be pretty strong because it's
[53:35]
going to be a black eye on the airport
if somebody's not providing the proper
[53:38]
kind of service are providing for
service.
[53:41]
» So I get what you're saying. You they
have just been included inside their
[53:45]
leases individually.
>> Okay.

» And they're all different.
>> They may all be different until we
[53:52]
consolidate at least on our land leases.
I think they all have the same.

long-term land leases. Yes. Is the U

talking about fuel storage facility?

Will that change with MTSU? I mean, will
you have to have more fuel storage,

they've got there.

what we have um there is right now one
lease at this airport that allows for
[54:28]
their own fuel
and that uh that is the Kings Kings
[54:36]
lease. Um other than that we tried to
avoid that capability avoid that and I
[54:41]
know in in in this particular situation
with with with Doug now it could change
[54:46]
in the future when I retire Doug
retires. whatever, they might think of
[54:50]
something different, but right now MTSU
doesn't want the headache.

he's threatened it before and he's in
the fuel business and so he knows what
[55:01]
it's going to take to do it and he
doesn't want to get into that because of

that's and that's one of the things uh

we probably need to find out is if we
can remove that
[55:17]
and not have it.

flexible enough that if for some reason

the city decided at some point in time
that they no longer wanted to be a full

service FBO because somebody else came
in and offered you know to to do that at

airport because at some point in time we

will get beat enough and enough activity
here that we've already been there's
[55:45]
we've already had two people come take a
look at us that wanted to do something
[55:48]
more. Um, and so we've had others that
I'm sure will be back. Those two will be
[55:53]
back at some point in time when the
numbers finally get where they want them
[55:56]
to be.

» And they'll be trying to entice the city
to turn it over to them.

» The other thing is that the minimum

airplane. But the idea is that you have

a a lease with them. And that is one
thing you can I guess in turn hold
[58:54]
hostage. So that it is on those leases
and you can and that was definitely a
[58:58]
way

definitely put those minimum and say

reference those minimum standards big

just came from the construction monthly

been over a month since I walked the

site. So, it was nice to see the
progress. We're about 90% framed out on

the first floor of the flight ops
building and probably 30 to 40% framed
[1:04:19]
out on the second story. Um in the
hanger floor they're finishing up the
[1:04:24]
tubing for the heated floor and and
expect to start pulling slab next week
[1:04:28]
and also on the apron um space aircraft
parking gate video to start asphalt next
[1:04:36]
week. So

part of the project that you see all the
progress happen right and it then it
[1:04:44]
looks like nothing happens but it it is
really great to see it. I apologize. I'm

hope um the other construction we've had

by uh two different things happened

here. One, we had a a waterline issue at
at Patriot and so there was a lot of
[1:06:16]
equipment you probably saw out here and
we had three buildings without water for
[1:06:20]
a while until we can get that found. Uh
it cost us about luckily the labor
[1:06:26]
public works is not going to charge us
for the labor, but u was nice enough to
[1:06:30]
charge us about $16,000 worth of water
without telling us that we had an issue.

Um, but we're going to try to work with

and so it will wear and pop loose and so

they did replace all the piping through
there. Uh they found some old stuff that
[1:07:33]
had just been abandoned in place. They
did remove that. Um the other you saw
[1:07:39]
that we were kind of surprised about was
a fiber optic cable that came in from
[1:07:43]
United
um that was brought in for we're not
[1:07:48]
even really sure who who instigated it.
Uh they picked probably one of the
[1:07:53]
hardest places. There might have been
one other place that was harder to put
[1:07:56]
in that would have been hard to put in a
conduit for fiber optic.
[1:08:01]
And they in turn only cut they cut one
line for AT&T. So they'll have to pay
[1:08:06]
for that. But it does feed those other
hangers in Mac Air and some other. So we
[1:08:11]
do have fiber optic cable coming from
231 to the north area of the airport.
[1:08:16]
That's the only place that has it
because we we had it laid out for here
[1:08:20]
but the water line at GSU took our money
because we were fiber optics for
[1:08:24]

update on that? As far as I know, Tomcat
is no longer involved. They're rerouting

they're trying to get it done like this

week or next. They hope to be able to
get the wiring and the conduits for the
[1:09:53]
wiring for the lights. Uh they're
they're experiencing some of the same
[1:09:57]
problems any airport does. Uh the light
people don't really pay much attention
[1:10:01]
to you unless you're doing an entire
airport. If you just want a small
[1:10:04]
quantity, they're looking at I think
they're doing eight or 10 12 something
[1:10:08]
like that. They don't really pay much
attention to. So you're at their mercy
[1:10:13]
until they deliver them.
