Okay, Travis says we're ready to go.
[0:01]
Thank you everybody for joining us in
[0:03]
Spanish Fork City Council meeting
[0:05]
tonight, June 2nd, 2026. We appreciate
[0:08]
everybody that's here in person and out
[0:11]
in the lobby and on TV all over the
[0:13]
world. Uh we'll get started like we
[0:15]
always do in Spanish Fork with the
[0:17]
prayer and the pledge. And uh tonight we
[0:20]
have Councilwoman Beck offering the
[0:23]
spiritual thought or prayer and then
[0:25]
Councilman Marshall with the pledge.
[0:27]
Councilwoman Beck. Thank you, mayor. Our
[0:30]
dear father in heaven, we're very
[0:31]
thankful to have the opportunity to
[0:33]
gather here this this evening, and we're
[0:36]
grateful for this beautiful community
[0:38]
that we all have the chance to live and
[0:41]
serve in. And we pray that that would
[0:42]
watch over and protect us all
[0:43]
continually. Bless our youth as they're
[0:45]
out and about this summer to be safe.
[0:47]
And please be with our first responders
[0:49]
as they're serving and watching out for
[0:51]
us. We pray that that would be with us
[0:53]
this evening that we can make good
[0:54]
decisions and be with us that we can
[0:59]
make good choices, serve our neighbor,
[1:01]
lift those who we are around and we say
[1:03]
these things humbly in the name of thy
[1:04]
son Jesus Christ. Amen.
[1:06]
>> Amen.
[1:07]
>> You all please rise and
[1:10]
repeat after me. I pledge algiance to
[1:13]
the flag of the United States of America
[1:16]
and to the republic for which it stands.
[1:19]
One nation under God, indivisible, with
[1:22]
liberty and justice for all.
[1:25]
>> Thank you.
[1:26]
Councilwoman Beck and
[1:28]
Councilman Marshall. Okay. Uh we have a
[1:30]
couple of recognitions that would like
[1:33]
to to start off with uh tonight's
[1:35]
council meeting before we get to the
[1:36]
business. Uh first, we have uh
[1:39]
Councilman Tuk uh to introduce us to a
[1:42]
great youth in our community. Councilman
[1:44]
Tuk.
[1:45]
>> Yes. Thank you, Mayor. Good evening,
[1:47]
everyone. Good evening, Spanish Fork.
[1:48]
So, uh, whenever we get the opportunity
[1:51]
to recognize, um, folks doing good
[1:54]
things in our town, we love to do that.
[1:56]
And we have a really special situation
[1:58]
where we wanted to recognize someone
[2:00]
this evening. So, we have a Maple
[2:02]
Mountain High School uh, student named
[2:05]
Palmer Brandt. He's with us tonight with
[2:06]
his family here in the back. And I'm
[2:07]
going to say a couple things and then
[2:09]
we'll um, we'll kind of go from there.
[2:11]
But I just wanted to say this student is
[2:14]
um is amazing and his accomplishments
[2:16]
and especially when it comes to to uh
[2:19]
orchestra band. And so I'd like to read
[2:22]
a couple highlights that I've learned
[2:24]
about him. Uh so much attention was
[2:26]
brought to us about him and and what
[2:28]
he's done, how amazing he is that um we
[2:31]
wanted to share that with the community.
[2:32]
So here are a couple highlights here. He
[2:34]
was selected for uh the prestigious
[2:35]
honor band of America, earned first
[2:37]
chair uh baritone saxophone in the Utah
[2:40]
Allstate wind symphony and a spot in the
[2:42]
Utah Allstate Jazz Band. Uh and if I get
[2:45]
these wrong, mom, please, you know,
[2:47]
correct me. Uh also he composed and
[2:49]
premiered an original tenor saxophone
[2:51]
concierto with the Utah Valley Youth
[2:54]
Symphony Orchestra and uh or organized
[2:57]
and taught a jazz clinic for local
[2:59]
junior high students. uh had artwork
[3:01]
selected for the Utah All State Art Show
[3:03]
and all the while maintained nearly a
[3:05]
4.0 GPA of 3.9. Those are just a couple
[3:08]
of the amazing accomplishments that that
[3:09]
Palmer has had. So, uh as recognition,
[3:13]
we have this uh we have this plaque here
[3:16]
and I'll just read it quickly and then
[3:17]
we'll we'll get a picture and some
[3:19]
things. But just so we all can hear what
[3:21]
it says because this is incredible. So
[3:23]
this says special recognition
[3:25]
um proudly presented to Palmer Brandt uh
[3:28]
Maple Mountain High School for his
[3:30]
exceptional musical achievements
[3:31]
including selection to the 2026 honor
[3:34]
band of America, first chair of baritone
[3:35]
saxophone and the all state wind
[3:37]
symphony and baritone saxophone in the
[3:39]
all-state jazz band. A dedicated student
[3:41]
and mentor, he has led a clinic of
[3:43]
fellow musicians and stands out as an
[3:45]
outstanding representative of our
[3:47]
community. And that's is signed by our
[3:49]
mayor, Mayor Mendenhal. And so, uh, I
[3:52]
say let's give him a little round of
[3:53]
applause if we could.
[4:01]
And before we if we could grab a picture
[4:03]
in a minute, but um,
[4:05]
Palmer and your mom, Cara, if you'd like
[4:07]
to say a couple words, you're welcome
[4:08]
to. If not, we can just jump right to a
[4:10]
picture. We'd like to give you this
[4:11]
though, Palmer. Um, to congratulate you.
[4:14]
So, if you want to come on down, you can
[4:16]
come together, whatever works best, and
[4:17]
we'll we'll go from there. Sure.
[4:25]
Yep.
[4:27]
>> Right here.
[4:28]
>> Yep. Right there. Yep. Right here.
[4:30]
>> Well, yeah. There we go.
[4:32]
>> Okay. You didn't bring your instrument
[4:34]
with you, Palmer. [laughter]
[4:35]
>> Okay.
[4:37]
>> Yeah, for sure.
[4:37]
>> Probably been more comfortable.
[4:41]
>> Well, very cool. What a what a what a
[4:42]
great accomplishment. What What year are
[4:44]
you at Maple Mountain High School? Is
[4:46]
this your senior year? Uh yes, I'm going
[4:48]
into my senior year.
[4:49]
>> Okay. What's plans after [snorts] after
[4:51]
you uh after you next year when you
[4:54]
graduate after next year?
[4:55]
>> Um I'll be studying saxophone
[4:57]
performance at either BYU or
[5:02]
>> Okay.
[5:03]
>> And
[5:05]
not sure. I'm considering a double
[5:08]
major, but I'm not sure in what yet.
[5:11]
>> Cool. Very cool.
[5:12]
>> Very cool. And is there any other
[5:13]
musical talent in your family or did you
[5:15]
just suck it all out of your family and
[5:18]
kept it for yourself?
[5:19]
>> Both of my parents sing and my dad is he actually teaches voice at BYU.
[5:25]
>> Oh,
[5:26]
>> and both my parents actually went to BYU
[5:29]
for classical voice.
[5:31]
>> Very cool.
[5:32]
>> And also my brother plays saxophone and
[5:37]
my other brother Adam, he plays guitar.
[5:41]
>> Pretty cool. You have a loud household.
[5:43]
[laughter]
[5:45]
>> That's very cool.
[5:45]
>> That's awesome.
[5:46]
>> It's not quiet, but uh those are cool
[5:48]
instruments and and put them with good
[5:50]
voices like that. I'll bet it's a I'll
[5:52]
bet Councilman Tuk probably walks the
[5:54]
east side looking for their home to Yes.
[5:56]
Listen to what's going on.
[5:57]
>> We live close.
[5:58]
>> We're lucky. Yeah, we do live close. So,
[6:01]
>> well, congratulations. Um let let me
[6:04]
give this to you, Palmer, and then can
[6:05]
we get a picture with you? Just wanted
[6:07]
to say really quick thank you to our
[6:09]
band director [clears throat] M. McKay
[6:11]
Osborne who's amazing and his private
[6:13]
teacher Ray Smith.
[6:15]
>> Oh, very cool. Very cool. Palmer, come
[6:17]
right up here. And uh manager parents,
[6:22]
>> congratulations.
[6:25]
» Thanks for coming. Nice to meet you.
[6:27]
He's going to take our picture right
[6:28]
here while you stand in front of us.
[6:34]
Do you want the straggler back there?
[6:36]
>> Yeah, we Yeah.
[6:37]
>> Get the whole family.
[6:38]
and then we'll do
[6:39]
one by himself, too. Yep. Come on,
[6:41]
Matthew. Let's go, buddy.
[6:44]
[laughter]
[6:45]
>> I don't blame you.
[6:47]
>> I don't want to. All right, we're gonna
[6:51]
go one, two, and three.
[6:57]
And then
[6:59]
one, two,
[7:01]
and three. Perfect.
[7:04]
>> All right. One. One. One with Palmer
[7:06]
alone.
[7:08]
>> Zoom in a little tight then.
[7:12]
No, we won't. Palmer. Uh, scoot over
[7:14]
just a little bit. You're block. There
[7:15]
we go.
[7:16]
>> It's better if you block someone.
[7:20]
» Got it.
[7:21]
>> Congratulations.
[7:24]
Appreciate it. Very
[7:32]
cool stuff to represent your high school
[7:35]
and your city on on a national level.
[7:37]
That's that's very cool. Keep uh keep it
[7:39]
up and keep it going. We appreciate good kids doing good things.
[7:45]
Okay. Uh we have another recognition uh
[7:47]
tonight as well from uh the other high
[7:50]
school in town from Spanish Fork uh high
[7:53]
school and the boys baseball team. I
[7:55]
think I see coach right there in the
[7:56]
back. Um, this is this is getting to be
[8:00]
a a regular thing here uh year after
[8:04]
year and it's it's it's a highly
[8:06]
irregular thing to to be able to win the
[8:09]
state championship. But we'd like to to
[8:11]
have uh have coach come up and and uh
[8:14]
tell us a little bit about the about the
[8:17]
team and and about what they've uh
[8:19]
accomplished here. Um it's uh it's quite
[8:22]
the thing to to have uh this going on
[8:26]
and uh and do it again.
[8:28]
>> Yeah. Well, thanks for having us. Um
[8:30]
yeah, the season was a little bit
[8:32]
different than last year. Luckily, we
[8:34]
were able to get to the same point as
[8:35]
the state champions, but um so last year
[8:38]
we came in as a very young, unproven
[8:41]
team. And this year, after winning it
[8:43]
last year, we came in with all the
[8:44]
expectations of returning basically our
[8:47]
whole starting team. and we were able to
[8:48]
go come out as the preseason favorite
[8:50]
and carry that all the way all the way
[8:52]
through the season and end up winning
[8:53]
the state championship again this year.
[8:55]
So, it was an awesome awesome ride and
[8:57]
an awesome season with the B group of
[8:59]
great kids.
[9:00]
>> I think that's a point that uh I've
[9:02]
heard talked about quite a bit that the
[9:04]
tale of two years the year before I
[9:07]
think your final game you won just put
[9:09]
you over 500 for the season.
[9:11]
>> Yep. One game over 500. That's what we
[9:12]
were joking. No better way to get over
[9:14]
500 to win the win the championship. So,
[9:17]
>> and now this year it was uh you had the
[9:19]
target on your back from the beginning,
[9:21]
right? Yeah. Were you going to
[9:22]
>> Yeah, it was kind of a totally different
[9:24]
uh state tournament with all the
[9:25]
expectations coming in and just the kind
[9:28]
of the I think I speak for the group
[9:29]
here just the kind of the stress it
[9:31]
carried carrying the one seed
[9:32]
throughout. But last year was just all
[9:34]
emotions riding on the the hive, the the
[9:37]
roll we were on and then this year we
[9:39]
come in with all the expectations
[9:40]
getting every team's best shot. So,
[9:42]
yeah, it was kind of a a tale of two
[9:44]
seasons like you said. Coach Thorp, you
[9:47]
played uh you were a Dawn in what year?
[9:49]
>> In 2009.
[9:51]
>> And that's a lot uh sooner than coach
[9:54]
Dart was a dawn, right? [laughter]
[9:56]
>> Quite a bit. Um grandpa.
[10:00]
>> Okay.
[10:01]
>> Yeah. One of our coaches always jokes
[10:03]
that he's he's the adult in the room, so
[10:05]
[laughter] the adult.
[10:06]
>> He was the adult.
[10:08]
>> Coach Dardis.
[10:09]
>> Yeah.
[10:11]
>> Scary.
[10:13]
[laughter]
[10:15]
So maybe Councilman Rod Dart was the
[10:17]
great grandpa of the of the of the
[10:19]
school.
[10:20]
>> That's that's one of the great things
[10:21]
about being a part of Spanish Fork
[10:22]
Baseball is just the community support
[10:24]
we get. So we we thank all the community
[10:26]
for showing up. We we pack UVU every
[10:28]
time we do that. So that's that's what
[10:30]
means a lot just playing being a part of
[10:32]
Spanish Fork Baseball is just the
[10:33]
awesome community that comes with it.
[10:35]
>> Tell us about obviously the the news
[10:37]
coverage of it the the day and the
[10:39]
couple days after. Uh it was pretty hot
[10:41]
and hot hot and heavy on on recognizing
[10:43]
you guys. So we're grateful to let that
[10:45]
dust settle and then you guys come in
[10:46]
here and and get recognized here. But uh
[10:50]
what what what's it like playing, you
[10:52]
know, I guess what what we can call a an
[10:55]
in city rivalry. I mean, you and you and
[10:58]
the the Maple Mountain uh uh Eagles are at the the top, it seems like quite
[11:04]
a bit now, but obviously those kids
[11:07]
probably know quite a bit about each
[11:08]
other and know each other and probably
[11:10]
played together in in years past.
[11:11]
>> For sure. Yeah. A lot of our guys play
[11:13]
together throughout all the summer, so
[11:15]
there's a there's a friendly rivalry
[11:16]
there. We we joked with Coach Thomas
[11:19]
over at Maple Mountain that of course of
[11:20]
course all roads were going to lead to
[11:22]
us playing in the state championship. It
[11:24]
was funny. Some people were talking
[11:25]
about maybe the state tournament doesn't
[11:26]
run through Spanish Fork, but then it
[11:28]
ended up both both schools from Spanish
[11:29]
Fork being there. [laughter] So, it was kind of a a good ending to the
[11:34]
season.
[11:34]
>> Yeah. Yeah. That's cool.
[11:36]
>> If I may, I'm going to put you maybe a
[11:38]
little bit on the spot, coach, but I I
[11:40]
understand that in some of the postgame
[11:42]
conversations that you had with some of
[11:43]
the coaches of some of the teams that
[11:45]
you played that there was a new school
[11:47]
played really well and they had some
[11:49]
really high praise for you in terms of
[11:51]
what it meant for them to play like you
[11:52]
and and some of their aspirations. Yeah.
[11:54]
So, what are you comfortable sharing?
[11:55]
The head coach at Westfield just came up
[11:57]
and had nothing but great things and
[11:59]
that like we have nothing but respect
[12:01]
for that program. We got a big lead
[12:03]
multiple times and just couldn't put
[12:04]
them away. They were just a tough
[12:05]
resilient group of kids. But yeah, their head coach as we were going
[12:09]
through the line, he just said what an honor it is to play Spanish Fork
[12:12]
baseball and just just that's where we
[12:15]
want to be as a program. So, it's just
[12:17]
super high praise. That's the best thing
[12:18]
another coach or another program could
[12:20]
say about you is how much they want.
[12:21]
They they look up to us as a program and
[12:23]
wanted just that they respected how we
[12:25]
went about our business. And so it was
[12:28]
really awesome for him to say that
[12:29]
through in in that moment.
[12:30]
>> Thank you.
[12:31]
>> I got to be honest when we heard that
[12:33]
and people kept saying, "Well, we're
[12:35]
playing Westfield. We're playing
[12:36]
Westfield again." Are we sure it's
[12:37]
Westfield? Not West Lake, not West, not
[12:40]
like it up to like where is
[12:42]
>> we had to pull up a map, see where they
[12:44]
were located. [laughter] But yeah,
[12:45]
nothing but respect for those guys. They
[12:46]
were an awesome team.
[12:48]
>> Yeah. Yeah. Anybody else have questions
[12:50]
for
[12:51]
>> for coach or any
[12:53]
>> I would just say congratulations. Um
[12:56]
long tradition of success whether it's
[13:00]
academic
[13:02]
sports or musician. I mean it's to be
[13:05]
here in amongst all of the success that
[13:08]
we've had as a community. Um even if it
[13:11]
happens to be Eagle Mountain or Maple
[13:13]
Mountain. Um, no, there it is is cool to
[13:17]
have that type of competitiveness and
[13:20]
success by both schools in our community
[13:22]
and I appreciate it. The the tell of two
[13:25]
seasons I had I went through a similar
[13:26]
thing in 1988 we won. Um, maybe we
[13:30]
shouldn't have the next year we should
[13:32]
for sure should have. 89 should have
[13:34]
been the year and we lost. We took like
[13:37]
third. Um, but
[13:40]
what I love about the program is that it
[13:44]
creates good young people that are
[13:47]
members of our community,
[13:49]
>> right? And you don't have to win the
[13:51]
state championship to do it. You just
[13:53]
have to be part of the team and be um a
[13:55]
good member of the team, right, to build
[13:58]
that success. I certainly wouldn't be
[13:59]
sitting here if I was not a member of
[14:01]
the baseball team and we didn't win. Um,
[14:03]
so it's I appreciate your effort, all of
[14:06]
you kids. kids. It's It's I'm a grandpa
[14:09]
now. I can say that stuff. I feel like
[14:11]
Rod Dart up here. [laughter]
[14:14]
But it's to be a member of that that
[14:16]
unit and coming to compete every day um
[14:19]
and putting yourself out there is is
[14:21]
pretty cool. Win or lose, you're going
[14:23]
to be better for the for the
[14:25]
opportunity. So, thank you, coach.
[14:26]
Appreciate.
[14:26]
>> Thank you. We appreciate that.
[14:28]
>> How do you balance that, coach? with
[14:30]
kids, they they must know that they're
[14:33]
playing it long enough, but they must
[14:34]
know they've signed up to play a game of
[14:36]
failure where like, hey, if you're
[14:38]
hitting three out of 10, you're you're
[14:39]
at the top of the top and stuff like
[14:41]
that. How do you how do you keep kids
[14:42]
motivated and and and looking looking
[14:45]
towards a long path of a game of
[14:47]
failure?
[14:47]
>> Yeah, luckily luckily for us, we get to
[14:50]
coach the greatest group of kids around.
[14:51]
Um, I think there's for us, it's not a
[14:54]
ton of motivation just because they're
[14:55]
so self motivated and work so hard at
[14:58]
the at the game of baseball. So, it
[14:59]
makes makes our job easy as far as that.
[15:01]
I mean, I could draw out of a hat and
[15:03]
pick nine guys and we'd be very
[15:04]
successful because of the work that
[15:06]
those guys put in. So, yeah, all all the
[15:08]
credit goes out to those kids and the
[15:10]
assistant coaches that put in countless
[15:12]
hours of basically free labor, but I
[15:14]
know how much they [clears throat] love
[15:15]
it. So, they they love being there and
[15:17]
being with the kids. So, just a
[15:19]
testament to how tough, resilient,
[15:21]
hardworking our kids are. And it's it's
[15:23]
[clears throat] amazing the way that you
[15:25]
just presented that though because you
[15:26]
watch the state tournament and you watch
[15:28]
every game when you guys would come from
[15:29]
behind and hit the walk-off. It the
[15:32]
team's composure during those moments
[15:34]
were was incredible because it was like
[15:35]
oh we're never out of this. We got this.
[15:37]
Like I don't was it I don't remember
[15:38]
that what game it was. It was sent going
[15:40]
to the championship and I don't know if
[15:41]
it was was it was it against um
[15:43]
>> Westfield?
[15:44]
>> Yeah, Westfield. That first pitch that line driving I think I sent the
[15:48]
video to mayor. I'm like there was no
[15:49]
doubt it was happening right. It was it
[15:51]
was just such a cool experience and it's
[15:53]
great for us as a community to be a part
[15:55]
of it. So, thank you for letting us be a
[15:57]
part of your guys' moment.
[15:58]
>> Yeah.
[15:59]
K kudos to your coaching staff,
[16:01]
too. I thought it was really cool how
[16:03]
final game you got a comfortable lead
[16:06]
and you give a senior an opportunity to
[16:09]
close that out. And
[16:10]
>> that that was I will say that was kind
[16:13]
of misconstrued. He was just a junior
[16:14]
that came back in. Yeah. Okay.
[16:16]
>> He had he had a tough spot earlier in
[16:18]
the in the state tournament and Nixon
[16:20]
was kind of our leader all year. So, it
[16:21]
was it was nice to have him come in and
[16:23]
get that last out.
[16:23]
>> I thought that was pretty cool that you
[16:25]
did that.
[16:27]
>> Well, congratulations.
[16:28]
>> Thank you so much.
[16:29]
>> Well done,
[16:30]
>> Coach Thorp. Thanks for leading the Dons
[16:32]
again and and we're super proud of you.
[16:34]
We'd uh we we hope I hope there's
[16:37]
another baseball that somebody gets for
[16:39]
me signed so we can put it in the
[16:41]
mayor's office. But you kids should all
[16:43]
know that uh that's that's the game in
[16:45]
the mayor's office. Anybody that comes
[16:46]
visits uh gets to see some some cool
[16:49]
pictures of of cool kids doing good
[16:51]
things and you guys are are in there
[16:54]
once and now being in there twice is uh
[16:56]
is pretty cool too. So thank you guys
[16:58]
for for not only playing hard uh you
[17:02]
know doing your doing your job but
[17:03]
representing your city well too uh on
[17:05]
and off the field. That's that's an
[17:07]
important part. But I know that the
[17:08]
coaches stress that too of of uh being
[17:11]
good on the field and being good kids
[17:12]
off the field.
[17:13]
>> For sure.
[17:13]
>> Y
[17:14]
>> if you come up and get a picture, we'd
[17:16]
love to give you a round of applause and
[17:17]
a picture if that's all right. Guys,
[17:26]
after this picture, if you start with
[17:28]
the if you'll start with the chief over
[17:29]
there and shake the chief's hand and
[17:31]
then come all the way around. We like
[17:33]
the youth to know who the police chief
[17:35]
is and the city attorney is. So that's
[17:39]
where you start.
[17:43]
» I'm just going to
[17:46]
squeeze it in.
[17:50]
» Yeah.
[17:52]
>> Wait a second.
[17:57]
» Just lay out in front.
[18:06]
Seth, just get out of the way and let
[18:07]
the photographer do it.
[18:09]
>> I don't know.
[18:15]
» Thought Seth wasn't that
[18:18]
>> gonna work. All right. One, two.
[18:26]
» There you go. One, two, three.
[18:31]
» More.
[18:36]
» That's good.
[18:38]
>> Yeah. Very good.
[18:39]
>> Start over there with the chief right
[18:41]
there.
[18:44]
>> Coaches, too.
[18:46]
>> 2009.
[18:49]
>> Congratulations, coach.
[18:51]
>> Congratulations.
[18:52]
>> Thank you, brother.
[18:55]
>> Congrats.
[18:58]
walked past me.
[18:59]
>> Way to go.
[19:02]
Congrats. Congratulations, young man.
[19:04]
What's your name, brother?
[19:09]
Congratulations.
[19:11]
>> Yeah, we're good.
[19:13]
>> Dylan, congratulations. Chambers.
[19:15]
>> All right. Congratulations.
[19:19]
» Sam,
[19:24]
what's your name? Congratulations.
[19:29]
» Congratulations.
[19:30]
>> Thank you.
[19:33]
» Thanks for being here tonight.
[19:35]
>> Good to see you.
[19:37]
>> Nice job, guys.
[19:38]
>> Hey, coach. Before they before they
[19:40]
leave,
[19:41]
>> let's One thing that we've usually done
[19:43]
is have them come up and say their name.
[19:45]
So, it's just uh the city and and uh
[19:47]
let's say their name, what year they
[19:50]
are, and uh their parents because the
[19:53]
parents are part of uh kids to this
[19:55]
point, too. Once you're done with that,
[19:57]
you can
[19:58]
>> you're free. You're free.
[20:00]
>> Pull pull the mic up.
[20:02]
>> What do I say again? I don't remember.
[20:04]
>> Your name, what year you are in school,
[20:06]
and your parents.
[20:08]
>> All right. Um my name is Kingston
[20:10]
Johnson, and I'm a class of 2029. And my dad's name is Jason Johnson and my
[20:16]
mom's name is Lesie Johnson.
[20:18]
>> All right, perfect.
[20:19]
>> Well done.
[20:20]
>> Thank you. You did it.
[20:21]
>> So, class of 29. Is that freshman?
[20:23]
>> I don't know.
[20:24]
>> I'm Tape Wahberger. I'm a class of 2028
[20:27]
and my mom is Lisa Wahberger and my dad
[20:29]
is Mike Wahberger.
[20:30]
>> Yeah.
[20:30]
>> Thank you guys.
[20:31]
>> They help horses.
[20:33]
>> I'm Trac. I'm 2029 and my parents are
[20:37]
Josh and Melanie Orton. Perfect.
[20:40]
>> Um I'm Talon Nelson. and I'm a class
[20:42]
2029 and my parents are Heather and
[20:44]
Tyler Nelson.
[20:46]
>> I'm Nolan Hickman. I'm a class of 2028
[20:49]
and my parents are Ryan and Nicole
[20:51]
Hickman.
[20:53]
>> I'm Sammy Dart. My parents are Kyle and
[20:56]
Ally Dart. And I just finished junior
[20:58]
year, so 2027.
[21:01]
>> Uh my name is Cohen Nelson. I'm a class
[21:03]
of 2028. My mom and dad are Tyler and
[21:04]
Heather Nelson.
[21:05]
>> Cohen, wait. What was one of your
[21:08]
favorite parts of this whole experience?
[21:10]
Um,
[21:12]
I'd probably say the Westfield game
[21:15]
three,
[21:16]
>> the come uh come from the dinger.
[21:19]
>> Yeah, that was sweet.
[21:20]
>> Sweet.
[21:22]
>> Um, Dylan Chambers. I'm a class of 2028.
[21:24]
My parents are Ryan and Bethany
[21:26]
Chambers.
[21:28]
>> Matai Johnson. I am a senior. I just
[21:31]
graduated. And my parents are Lesie and
[21:33]
Jason Johnson.
[21:34]
>> Now, they didn't have a speed they
[21:36]
didn't have a speed gun at that game,
[21:37]
but you're one of the pitchers, too,
[21:39]
right?
[21:40]
a few pictures here. What are they? I
[21:43]
mean, some of these pictures are in the
[21:44]
90s, right?
[21:47]
>> I don't know where they came from, but
[21:48]
we'll take them.
[21:48]
>> We'll take them. Yeah. [laughter]
[21:50]
I couldn't see the ball.
[21:52]
>> You couldn't see them?
[21:52]
>> Yeah. That's incredible. That's awesome.
[21:56]
>> I'm Cody Mlan. I'm a class of 2028. And
[21:59]
my parents are Mike and Lindsay Mlan.
[22:04]
» I'm T Cloud. I'm a class of 2028. And my
[22:06]
parents are Amberly and Casey Clard. We
[22:09]
good.
[22:11]
>> My name is Tillen Scott. I'm the class
[22:13]
of 2028 and my parents are Matt and
[22:15]
Brandy Scott.
[22:18]
>> Hi, I'm E Smith. I am a class of 2028.
[22:21]
My parents are Jeff and Marlo Smith.
[22:24]
>> My name is H Freeland. I'm a class of 27
[22:27]
and my parents are Lacy and Jake
[22:28]
Freeland.
[22:29]
>> Perfect.
[22:32]
>> Young.
[22:32]
>> In case you didn't notice, that's a lot
[22:34]
of 28s and 29s. The Dons will be good
[22:37]
for a bit here.
[22:39]
>> We're looking forward to next season.
[22:41]
>> Yeah. Yeah.
[22:42]
>> No pressure.
[22:44]
>> Coach Dart, anything you want to say?
[22:46]
Ally, anything you want to say? You're
[22:47]
here.
[22:50]
» Appreciate the community support.
[22:53]
>> Come on up to the mic. You got to come
[22:54]
up.
[22:54]
>> Come up to the mic. Grandpa,
[22:57]
>> old man. What was he?
[22:58]
>> The adult.
[22:59]
>> He's the adult in the room. from almost
[23:01]
every team we played. Our crowd was the
[23:04]
envy of every team. Uh they just were
[23:06]
amazed at the turnout that we get. And
[23:09]
so it really does mean something to to
[23:11]
have the community support we have. And
[23:14]
when we when the kids win it, we're dog
[23:17]
piling. The very first thing they say is
[23:18]
someone get the fire trucks ready. And
[23:20]
for the city to do that for us and to
[23:22]
have the support um see the people on
[23:24]
Main Street and stuff is really an
[23:26]
awesome thing. It makes it even more
[23:28]
special to win a state championship in
[23:30]
Spanish Fork. I I believe that that it's
[23:32]
more special here than any other place.
[23:34]
So, we appreciate all the community
[23:35]
support. These kids are tough and
[23:37]
they're really good and it's been
[23:38]
awesome to be part of it. So, thank you
[23:40]
guys very much for having us.
[23:42]
>> Thanks, coach.
[23:43]
>> Congrats you guys.
[23:44]
>> One more round of applause. Thank you
[23:46]
guys.
[23:52]
» Very good.
[23:54]
>> Thanks, coach.
[23:55]
Mayor, if you get the ball, do I get the
[23:57]
saxophone?
[23:59]
>> That's true. That's true. There's cool.
[24:01]
Yeah, I already got a ball. I'll take
[24:02]
the saxophone.
[24:04]
>> No,
[24:06]
>> I want the sacks.
[24:08]
>> I don't know what to do with the ball.
[24:10]
>> Yeah,
[24:11]
>> you know what to do with this.
[24:12]
>> Baseballs and softballs and soccer balls
[24:14]
and volleyballs, all signed by state
[24:17]
champions
[24:18]
>> in the mayor's office. So,
[24:20]
>> it's pretty It's been quite the
[24:22]
>> state championship run from two high
[24:24]
schools in the last four years and uh be
[24:28]
excited.
[24:28]
>> What does a wrestler sign? I'm just
[24:30]
wondering.
[24:30]
>> Singlet,
[24:31]
>> but he doesn't get a singlet. No.
[24:33]
>> What did they Maybe there's Is there
[24:35]
headgear in there? I don't know. Maybe
[24:36]
there's
[24:38]
>> Yeah. What did they sign? What did they
[24:39]
get?
[24:39]
>> Sign the mouth gear.
[24:41]
>> No, we just got a picture of the
[24:42]
wrestlers. We didn't
[24:43]
>> tell you.
[24:44]
>> Yep.
[24:45]
>> But very good stuff. Thank you guys.
[24:47]
Thank you. Thank you, Spanish Fork
[24:49]
again. And I hope uh I hope parents and uh and the citizens at large get to
[24:55]
see recognitions like that and uh both
[24:58]
what Councilman Marshall touched on both
[25:00]
sides of of greatness from our our city
[25:03]
in the arts and in the sports. So very
[25:05]
cool stuff. Okay. Um takes us uh to the
[25:09]
public comments section uh of our
[25:11]
agenda. Anybody from the public that
[25:13]
would like to address uh the mayor and
[25:16]
council, feel free to do so now. Jack or
[25:19]
Jordan, excuse me. We'll be keeping our
[25:21]
clock up there. We'll try to keep it at
[25:22]
three minutes if possible. But any
[25:24]
questions or comments to the mayor and
[25:26]
council. Uh this is the public comment
[25:28]
section where you can come up and
[25:29]
address us for three minutes if you can
[25:31]
keep it to it.
[25:35]
Looks like no takers tonight. So we'll
[25:37]
move on from public comments and we'll
[25:39]
move to council comments. We'll start
[25:40]
with Councilman Oiler, work our way that
[25:42]
way and end with Councilwoman Beck if
[25:44]
that's okay.
[25:45]
>> Thank you, Mayor. I don't have anything
[25:46]
tonight.
[25:47]
>> Okay. Councilman Carden,
[25:49]
>> just uh two things. Uh the youth arts
[25:51]
festival is going on right now at Maple
[25:53]
Mountain High School. So, they've
[25:54]
invited us as council and mayor if we
[25:56]
have the time to go and check that out.
[25:58]
It's usually from about 9 till about 2.
[26:00]
Um reach out to Whitney or Emily and
[26:02]
they can get you in. The other thing I
[26:03]
just wanted to say thank you to the
[26:04]
veterans and I know we'll probably will
[26:07]
talk about it, but thanks for the
[26:08]
Memorial Day celebration and
[26:09]
specifically um Bronco. Make sure the
[26:11]
staff at the cemetery know how what a
[26:13]
good job they do of making sure that
[26:14]
cemetery looks pristine coming into it.
[26:16]
visited a couple other cemeteries and
[26:18]
they did not look the same. So, thank
[26:19]
you for all the work that they do.
[26:21]
That's all I got. Mayor,
[26:22]
>> very good. Thank you, Councilman Cardon.
[26:24]
Councilman Tuk.
[26:24]
>> Thank you, Mayor. I do have a couple
[26:26]
items, but before I I go, I'd like to
[26:28]
give some time to our Chamber of
[26:29]
Commerce President, Kathleen Levit.
[26:31]
>> Thank you so much. Just a few quick
[26:33]
things to share. Um, I wanted to share
[26:36]
our business of the month for this month
[26:38]
is Nothing But Cakes. I'm sure you
[26:40]
remember they came a few months ago and
[26:42]
brought cake for everyone. They've
[26:44]
actually been doing that. I think you
[26:46]
missed, but [laughter]
[26:48]
it was a good time. They've actually um
[26:50]
they're under new ownership and those
[26:53]
new owners hit the ground running. It's
[26:55]
a young uh brother and sister and they
[26:59]
just really showed I think the community
[27:02]
how it's done to get their name out
[27:03]
there in the community, how to showcase
[27:05]
their product and lead with generosity.
[27:07]
And so they've been sending they've been
[27:09]
bringing cake to lots of other
[27:10]
businesses and schools and making
[27:13]
connections in the community. So, we're
[27:15]
really proud to celebrate them as our
[27:17]
business of the month. Um, and then
[27:19]
upcoming our women in business is next
[27:21]
week on June 10th at 10 o'clock in the
[27:24]
morning. Uh, we're going to be playing
[27:26]
bingo with the residents of the Legacy
[27:28]
House. So, please join us for that. If
[27:32]
you're a woman in business, if you are a
[27:35]
woman thinking about getting into
[27:37]
business, if you support women in
[27:38]
business, please join us for Women in
[27:40]
Business. um because it's a it's a
[27:43]
beautiful thing that's developing here.
[27:45]
And then new networking is June 18th
[27:48]
hosted at the Hampton Inn. We're having
[27:51]
Jersey mics for lunch. And then we're
[27:53]
hearing from Spanish Fork's very own
[27:55]
Trevor Sperry um in from the emergency
[27:58]
preparedness program. So we're looking
[28:00]
forward to hearing from him. And that's
[28:02]
all I've got for you guys.
[28:03]
>> Thank you, Kathleen. Thank you,
[28:05]
>> Kathleen. And thanks for all you do to
[28:06]
keep our business community strong and
[28:07]
healthy. Appreciate it. Just a couple
[28:09]
items, Mayor. So, um, and I may there
[28:11]
may be a picture, too, Jordan. If you
[28:12]
can get those, great. If not,
[28:15]
okay, no, no worries. So, just two two
[28:17]
items to report on. We recently had, uh,
[28:20]
the mini and junior and then also the
[28:22]
pre-teen and teen little Miss Spanish
[28:24]
Fork pageantss. And, uh, those were
[28:27]
exciting for a lot of young women in our
[28:29]
community. And, um, my youngest daughter
[28:33]
actually competed in the the pre-teen
[28:35]
competition. and and I've never had a
[28:36]
daughter do that and kind of didn't know
[28:38]
it was for us but it clearly was and so
[28:40]
we prepared and did it and it was a fun
[28:42]
experience to see it on this other side
[28:44]
of competing and she had a wonderful
[28:46]
experience and so um anyway great
[28:49]
outcomes though for for so many of like
[28:51]
I said of our young women in the
[28:53]
community uh in addition to those
[28:55]
pageantss um I just wanted to say kudos
[28:58]
to parks and recreation I know Bronco
[28:59]
Menal's here uh and Dell as well and and
[29:02]
Nick for the city grand opening of the
[29:04]
outdoor portion on Memorial Day. It was
[29:06]
fun to go stop in. Um and uh my oldest
[29:10]
daughter actually is a lifeguard and so
[29:12]
I took a picture with her and she didn't
[29:13]
want to get a picture of me and she was
[29:15]
lifeguarding trying to work. Dad, don't
[29:17]
bother me. And so anyway, um maybe I'll
[29:20]
show you next time. But uh anyway, just
[29:23]
that that's all I've got. Come here.
[29:25]
>> Thank you, Councilman Tuk. Councilman
[29:27]
Marshall.
[29:28]
>> Councilman Tuk, your daughter's been
[29:29]
waiting years for her to say, "Please,
[29:31]
Dad, leave me alone." And she had an
[29:33]
opportunity, right? legit. Um I went
[29:37]
[clears throat] to the South Valley
[29:37]
Solid Waste District meeting last week.
[29:40]
Um we passed our tenative budget, so
[29:42]
we're all good there. Um one thing that
[29:43]
the city ought to be aware of and the
[29:45]
citizens as well is that if the gas
[29:47]
prices continue to be as high as they
[29:49]
are, um due to poor leadership in the
[29:51]
White House, um there could be a search
[29:54]
charge on our our loads coming up. So
[29:57]
the budget may adjust as we move forward
[30:00]
depending on the what the fuel charge
[30:01]
is. Um,
[30:03]
I think that's about it. One thing I
[30:05]
went to, I missed the memorial thing.
[30:07]
How did the memorial um thing look? Was
[30:09]
did it look good?
[30:10]
>> Looks good.
[30:11]
>> That's awesome. I I appreciate the city
[30:13]
taking some ownership up there. I know
[30:14]
this the Veterans Council does as well.
[30:17]
Um, our our plane got delayed or I'd
[30:20]
have been there. That was one of the
[30:20]
things I wanted to get to this year
[30:22]
pretty bad. So, I appreciate everyone
[30:23]
being there um representing the city. I
[30:25]
know the veterans really appreciate you
[30:27]
guys attending that. So, thank you very
[30:28]
much.
[30:30]
>> Thank you, Councilman Marshall.
[30:31]
Councilwoman Beck.
[30:32]
>> Yeah, the Memorial Day program is
[30:34]
definitely one of the highlights of the
[30:35]
year. Um, I think the only thing I'd
[30:37]
like to Well, two things. Yard of the
[30:39]
week is up and going, so you can hop on
[30:41]
the city's website to nom nominate a
[30:43]
yard. And the summer reading program is
[30:46]
also in full swing from kids, teens, and
[30:49]
adults. You can come to the library or
[30:51]
um call them and and get signed up. So,
[30:53]
they have lots of fun prizes throughout
[30:56]
the entire summer, and then they'll have
[30:57]
a year-end summer reading program in
[30:59]
August. That's all I have.
[31:01]
>> Perfect. Thank you, Councilwoman Beck.
[31:03]
Yeah, it's already been said uh the
[31:04]
Memorial uh day celebration um uh I
[31:09]
don't know how far again Garrett
[31:10]
Johnston is [clears throat] from you
[31:13]
guys. Pretty close
[31:13]
>> that for me.
[31:14]
>> Okay.
[31:14]
>> Carrie's age.
[31:15]
>> Um
[31:17]
traveled up from St. George uh to to to
[31:20]
give the the keynote part of that. Very
[31:23]
good. um very if if you had the chance
[31:26]
to see it, I know um I know you guys
[31:28]
were there and uh but there were um I
[31:32]
think SFCN was there and and got some
[31:35]
footage uh as well, but um some some
[31:39]
poignant uh remarks from somebody that's
[31:42]
not too far removed from um from, you
[31:46]
know, from active duty uh in in our
[31:48]
military. and and I think uh a lot of
[31:50]
people came up to me after and uh said
[31:52]
that it's it's really good every year.
[31:54]
But thank you Garrett Johnston. I can't
[31:57]
remember what rank you are. You're a lot in the
[32:00]
>> Sergeant Major.
[32:00]
Is that what it is?
[32:02]
Okay.
[32:03]
>> Chief, you know I mess you know I mess
[32:05]
that stuff up all the time. So I just
[32:07]
don't
[32:08]
>> Okay. All right. So you know uh
[32:11]
currently serving in a police department
[32:14]
>> in St. George. Okay. So very good. Um,
[32:17]
thank you for for coming up and and
[32:19]
thanks for uh again the public coming
[32:20]
out and and and again making your
[32:22]
community feel small uh in in the way of being together. Uh and then heading
[32:27]
over to the the Fit City uh as already
[32:30]
been said. Sorry the weather didn't
[32:31]
quite cooperate uh for for a bit there
[32:34]
though. It was really nice and and uh
[32:36]
and fun and and I know boy the days
[32:38]
since then Bronco have just looked like
[32:40]
they're packed. Uh so good luck.
[32:43]
summer's here and uh and so kudos to
[32:48]
that staff working on the fly and trying
[32:50]
to trying to make sure everything's good
[32:52]
and and Nick and and you and everybody
[32:54]
taking care of us and being safe, too.
[32:56]
So, appreciate that. Um yeah, uh lastly,
[33:01]
um geez, I had something else uh that
[33:04]
was really profound. Oh,
[33:07]
>> um not that profound. Simply [laughter]
[33:10]
>> you set yourself up.
[33:11]
>> Yes. Yeah. Sorry, guys. mean the pause
[33:13]
there. Uh but just driving around town,
[33:15]
seeing a lot of, you know, now we're
[33:16]
into summer and it seems like
[33:17]
construction starts like that. Um
[33:20]
there's a lot of construction projects
[33:21]
happening around the city. A lot of cool
[33:23]
ones that that, you know, we we tend to
[33:26]
let other companies kind of do their
[33:28]
announcements when it, you know, when
[33:30]
it's time. So, just know there's a lot
[33:31]
of cool things happening in the city uh
[33:34]
at all different parts of town that
[33:35]
you'll start to see signage of and and
[33:37]
everything else of great companies uh
[33:39]
landing in Spanish Fork and and that's
[33:41]
always happening, but also residential
[33:43]
construction that happens on our
[33:44]
streets. I guess here's my public
[33:46]
service announcement and and maybe the
[33:48]
chief could say say this better than I
[33:50]
could, but we're always worried about
[33:52]
the winter and and when snow plows come
[33:54]
and everything, but summer's a really
[33:55]
active time. So just remind your kids.
[33:58]
Uh we we say it every year when the when
[34:00]
the river is supposed to rise, but we
[34:02]
never had the river rising this year and
[34:03]
so it wasn't that dangerous as far as a
[34:05]
river, but it's always a little gets a
[34:08]
little bit heightened when our streets
[34:10]
crews are out doing their work and and
[34:12]
construction's going on. So please just
[34:14]
sit down at dinner and remind your
[34:16]
family and and especially little kids to be looking out and and let's all of
[34:21]
us uh look out as well as we're going
[34:23]
through our communities. it might be a
[34:25]
little bit tighter on those streets with
[34:27]
grass being dropped off or fencing or or
[34:30]
homes being built. So, let's take an
[34:33]
extra minute and uh and keep each other
[34:34]
safe uh by going a little bit slower and
[34:37]
being a little bit more attentive to uh
[34:39]
to who's on the roads in the summer. So,
[34:41]
uh let's have a a safe summer now that
[34:43]
we're not in school. So,
[34:45]
>> not very profound, but just the public
[34:47]
service announcement. Sorry,
[34:48]
>> you made up for it.
[34:49]
>> All right. Uh okay. Council comments. Uh
[34:52]
now, staff reports. anything manager
[34:54]
parents that we wanted to report on?
[34:56]
>> Thank you, mayor. Uh maybe just a quick
[34:59]
followup from last council meetings.
[35:00]
There was a a resident that came in with
[35:02]
some concerns about a trail if you
[35:04]
remember from that property along the
[35:06]
railroad on the eastish side of Highway
[35:10]
6. We've been doing some research u back
[35:13]
into the uh annals of time. This is back
[35:16]
in 2008. We we been able to find some
[35:19]
agreements on that. um things aren't
[35:22]
perhaps as exactly as she outlined, but
[35:24]
it's been really helpful. Dale and and
[35:26]
his team are working to identify a
[35:28]
couple things that we can do perhaps in
[35:30]
the interim. Um
[35:32]
no land was dedicated, but there was a
[35:35]
lot of things that happened with that.
[35:36]
Actually, more of it was focused on the
[35:38]
front side of their property uh in terms
[35:41]
of getting the road built and getting
[35:42]
some connection to utilities back in '08
[35:45]
when when that part of town was
[35:47]
beginning to develop. and all of that
[35:50]
was done. Uh there wasn't any agreement
[35:52]
on a fence, but um we're looking at the
[35:55]
possibility of putting up a fence now
[35:57]
and what that costs and and then the
[36:00]
possibility of putting the trail in. The
[36:02]
downside there is the trail hasn't had
[36:04]
any connection further to the to the
[36:06]
northish
[36:08]
to the north and west. Um and so that
[36:12]
that's the reason why the trail hasn't
[36:14]
continued on. But it's been really good
[36:16]
for us to dig into it because it's
[36:17]
really old, right? This is back in 2008.
[36:20]
So, uh, a little bit more I think that
[36:22]
we still need to research on that, but
[36:24]
we're we're looking into it and and, uh,
[36:26]
the parks crews will give us some some
[36:29]
ideas and some estimates here in the
[36:31]
next couple of weeks.
[36:33]
>> The idea for that trail, that section of
[36:35]
trails to continue north and
[36:36]
[clears throat] clear over to what used
[36:38]
to be Councilman Argyle's
[36:40]
>> home, right? Yeah.
[36:42]
>> Yeah. Uh, and the challenge that that we
[36:44]
I guess we ran into is um you quickly
[36:49]
run into railroad rideway.
[36:51]
>> And so you can't put the trail on the
[36:54]
railroad right away unless you just put
[36:56]
it and you know don't tell anybody.
[36:58]
That's not how we roll, right? And so
[37:00]
you can't do that. So you you have the
[37:03]
trail dead end and so maybe you run it
[37:05]
to some sidewalk across the street. uh
[37:07]
you want to eventually get it to the
[37:08]
trail that is either uh on the other
[37:11]
side of Center Street on that same side
[37:12]
of the railroad tracks or on the west
[37:15]
side of Center Street that goes down on
[37:17]
to Fort North. Both of those are great
[37:19]
locations, but we just don't have a good
[37:21]
path to connect them. So, the project
[37:22]
kind of fizzled out because of that uh
[37:25]
way back when. We do have the we do have
[37:27]
the the easement to do it. So, that's great. But, of course, there was
[37:31]
no fence ever put in. they they can put
[37:34]
fence up and that certainly is something
[37:35]
that they they can do. But like I said,
[37:38]
we'll work with them. I think if we can
[37:39]
put something up that perhaps will stand
[37:42]
the test of time and maybe not be that
[37:45]
expensive, that that might be the best
[37:47]
next step. And then when we do the when
[37:50]
we can do the trail meaningfully, then I
[37:52]
think that may be the right time. But
[37:54]
like I said, we we'll get a couple of
[37:55]
ideas and then
[37:56]
>> perfect share those with you.
[37:59]
>> Thank you. Following up on that,
[38:00]
anything else that we want in that
[38:02]
section?
[38:03]
>> Okay.
[38:04]
>> Thank you, manager. Per takes us to
[38:06]
consent items. If there's nothing else
[38:08]
uh from the council, we'll go to consent
[38:10]
items. Any questions on the consent
[38:12]
items A and B? If not, I'd entertain a
[38:15]
motion for the consent items.
[38:17]
>> I'll make a motion to approve the
[38:19]
consent items.
[38:20]
>> Second.
[38:20]
>> Motion made by Councilwoman Beck, second
[38:22]
by Councilman Marshall. All in favor say
[38:24]
yes.
[38:25]
>> Yes.
[38:26]
>> Consent items are approved. takes us to
[38:28]
our first of uh four public hearings
[38:32]
tonight. Um A and B in the public
[38:35]
hearing section will be Mr. Jordan Hails
[38:37]
for the fiscal year 2027 budget.
[38:41]
Up on the screen I've got the the
[38:43]
timeline of this budget. Um
[38:46]
so a month ago the tentative budget was
[38:49]
presented. Um for those that would love
[38:52]
to hear my presentation that night, they
[38:54]
can go to YouTube and watch it there. Um
[38:57]
the budget is available at
[38:58]
Spanishwork.gov as well. Um tonight we
[39:01]
have like you said four public hearings,
[39:03]
one for the RDA, one for the LBA, the
[39:05]
city's council budget or the city budget
[39:08]
and then uh a dividends transfer public
[39:11]
hearing as well and then two weeks from
[39:13]
today we will approve the budget. Um but
[39:16]
any questions before we go to the public
[39:18]
hearing? Questions for Jordan?
[39:21]
>> Thank you Jordan. I'd entertain a motion
[39:23]
to go into public hearing for fiscal
[39:24]
year 2027 budget. So moved.
[39:27]
>> Motion made by Councilman Carden.
[39:29]
>> Second.
[39:30]
by Councilman Oiler. All in favor
[39:32]
say yes.
[39:32]
>> Yes.
[39:33]
>> We're in public hearing for the 2027
[39:35]
budget. Anybody that would like to speak
[39:37]
to the mayor and council about this
[39:39]
item, please come up.
[39:42]
>> Seeing none, I'd entertain a motion to
[39:43]
go out of public hearing.
[39:45]
>> So moved.
[39:46]
>> Motion made by Councilman Tuk. Second.
[39:49]
>> Second by Councilwoman Beck. Ty goes to
[39:52]
the prom.
[39:54]
All in favor say yes.
[39:56]
>> Yes.
[39:56]
>> Okay. Public hearings uh closed on this.
[39:59]
Any further questions as a council that
[40:01]
you have for Jordan on uh the 2027
[40:05]
fiscal year budget?
[40:06]
>> I can't speak for everyone, but I know
[40:08]
that we've said it. If you have any
[40:10]
questions or things, our numbers and
[40:11]
things are out there still. We're still
[40:13]
talking. We're not proving this for
[40:14]
another couple weeks, but I have yet to
[40:16]
have anybody reach out about the budget
[40:18]
at this point.
[40:22]
>> Thank you, Councilman Carden. Anybody
[40:24]
else?
[40:26]
So, this public hearing uh does stay
[40:28]
open like Councilman Carden referenced.
[40:30]
So, it's the the budget's up on the
[40:32]
website. People can find it. So,
[40:34]
continue to to look for it to citizens
[40:36]
and feel free to shoot us questions and
[40:39]
uh if we don't know the answer, we'll
[40:40]
get you to the right the right place uh
[40:43]
during this budget public hearing. Okay.
[40:46]
Next uh public hearing is for the fiscal
[40:49]
year 2027 enterprise funds transfers.
[40:53]
One of the items that we one of the
[40:55]
things that we do in the city is we take
[40:57]
uh profits from our utilities and
[40:59]
transfer those into the general fund um
[41:02]
to keep property taxes low. Um state law
[41:04]
requires us to have a public hearing in
[41:06]
order to uh as part of that process. So
[41:10]
that's what the purpose of this hearing
[41:11]
is.
[41:13]
Thank you Jordan. They find that uh
[41:15]
information in the same budget section
[41:18]
right online. Okay. I'd entertain a
[41:20]
motion to go to public hearing for item
[41:22]
B.
[41:24]
>> So moved.
[41:24]
>> Motion made by Councilman Oiler.
[41:27]
>> Second.
[41:27]
by Councilman Carden. All in
[41:29]
favor say yes.
[41:30]
>> Yes.
[41:31]
>> We're in public hearing for item B, the
[41:33]
fiscal year 2027 enterprise funds
[41:35]
transfers. Anybody from the public that
[41:37]
would like to speak to that item, please
[41:39]
come forward.
[41:41]
Seeing none, I'd entertain a motion to
[41:43]
close the public hearing.
[41:45]
>> So moved.
[41:46]
>> Second. Motion made by Councilwoman
[41:48]
Beck, second by Councilman Marshall. All
[41:50]
in favor say yes.
[41:51]
>> Yes.
[41:51]
>> Discussion back up here. Any questions
[41:54]
for Jordan about that section of the
[41:56]
budget.
[41:59]
>> Okay. Thank you, Jordan. Again, public,
[42:00]
you can find that uh in uh this in a
[42:03]
section of the fiscal year budget of the
[42:05]
enterprise funds transfers and what
[42:08]
they're for. Please look over it and ask
[42:09]
us any questions if you need to. takes
[42:12]
us to item nine tonight. New business
[42:14]
ordinance to approve title five
[42:15]
amendment for directional signs.
[42:19]
>> Can al also call this the intermission
[42:20]
to all the public hearings on the
[42:22]
budget.
[42:22]
>> That's what it is.
[42:23]
>> Um this I'm Joshua Nielson. Von and Dave
[42:25]
Anderson asked me to come present this.
[42:27]
Title five, as you may or may not know,
[42:29]
we don't discuss a lot has to do with
[42:30]
businesses and we reg all the
[42:32]
regulations we have with respect to
[42:33]
businesses. Um there's a section inside
[42:35]
of there regarding um signs. Um, we have
[42:38]
a business that's coming or that's here
[42:40]
in town, Wheeler, that um, one of the
[42:43]
there's all kinds of different signs
[42:44]
that businesses put up on respect to
[42:46]
their property. One of those has to do
[42:48]
with directional signs. And Wheeler,
[42:50]
this property wants to put up
[42:52]
directional signs, um, multiple
[42:54]
directional signs on their property. So,
[42:56]
you can see they have a big property.
[42:59]
It's kind of hard to tell from here.
[43:00]
It's 11 acres. Um, and there's lots of
[43:03]
different places and different people
[43:04]
who are coming into this property. And
[43:06]
so they kind of need to know where
[43:08]
they're supposed to go. Um our our
[43:11]
regulations currently limit the size of
[43:13]
those signs to um 3 ft tall or 6 ft of
[43:17]
copy, six square feet of copy. They want
[43:20]
slightly bigger signs. And so they've
[43:21]
asked for a te text amendment that is
[43:24]
proposed right here. It's about as
[43:25]
simple as you can get. If it's a site
[43:28]
that's more than 10 acres, then they can
[43:30]
have a slightly larger sign up to four
[43:32]
feet tall or 16 ft of copy. Um, if it's
[43:35]
less than 10 acres, then it stays the
[43:37]
same. That's the proposal. Any questions
[43:40]
for me?
[43:42]
Questions for Joshua on this?
[43:46]
You We know where we're oriented here.
[43:47]
The Wheeler Machinery Building,
[43:51]
Jane. It's on a map. You got it. You
[43:53]
know where it's at.
[43:55]
>> Very cool. Thank you, John.
[43:56]
>> Admit that I don't, but [laughter]
[44:00]
>> it's out west of the freeway.
[44:01]
>> Oh, yeah. No, I'm just kidding. across
[44:03]
the street from Coach Orin Moral's old
[44:06]
home right there.
[44:07]
>> All right.
[44:07]
>> Yeah.
[44:09]
>> I think the proposed change makes sense.
[44:10]
Like it's you don't want people getting
[44:13]
confused on where they should enter and
[44:14]
exit. So, um sites this large, it does
[44:18]
make sense to have a little more copy
[44:19]
out there and telling where people
[44:20]
telling people where to go. So,
[44:25]
>> okay.
[44:26]
>> Ready?
[44:26]
>> Yep. Ready.
[44:29]
I move to approve the ordinance to amend
[44:32]
title five to change the size of the
[44:34]
requirements for directional signs.
[44:36]
>> Motion made by Councilman Marshall.
[44:40]
>> Second.
[44:41]
by Councilman Tuk. A roll call
[44:43]
vote here. Councilman Carden.
[44:44]
>> Yes.
[44:45]
>> Councilman Tuk. Councilman Marshall?
[44:46]
>> Yes.
[44:47]
>> Councilwoman Beck?
[44:48]
>> Yes.
[44:48]
>> And Councilman Oiler?
[44:50]
>> Yes.
[44:50]
>> What' I miss? Why are we laughing?
[44:52]
>> Because we were all going to not
[44:55]
like normal. [laughter]
[44:57]
>> All right. May May I ask a quick
[44:59]
question. Are you with the applicant?
[45:01]
>> No.
[45:02]
>> Oh, you're with him. I don't know you
[45:04]
yet. I'm so sorry. So rude.
[45:06]
>> I need to get to know you. I was hoping
[45:08]
somebody was here from Wheeler because
[45:09]
they're going to open up
[45:11]
sometime in the next couple of weeks and
[45:13]
that's really a good a big deal. Like
[45:17]
these guys don't sell Ford F-150s,
[45:21]
but when they do sell something, it's a
[45:23]
lot bigger. It's a lot more expensive.
[45:26]
And uh it's a great addition uh in terms
[45:29]
of the sales tax revenue that can come
[45:32]
from the sales of those large pieces of
[45:33]
equipment, but also just in terms of the yellow iron that is going to come in
[45:39]
and out of this location for service.
[45:41]
And it's it's great to have we're really
[45:44]
excited to have Wheeler a part of our
[45:46]
community.
[45:48]
Caterpillar is number 64 on the Fortune
[45:52]
500 list as far as large US companies.
[45:55]
So 67 billion in revenue, something to
[46:00]
that figure. So for them to for them to
[46:04]
now sell that equipment inside our city.
[46:07]
>> Really cool.
[46:08]
>> Um, Councilman Argo is going to wonder
[46:10]
if they have a gift shop.
[46:12]
>> He's going to wonder if they have a hat.
[46:14]
>> Yeah,
[46:16]
our employees are have started asking,
[46:18]
"So are we going to get rid of all of
[46:19]
our John Deere tractors and only Wheeler
[46:22]
now?" But
[46:23]
>> we're really excited. This is really
[46:24]
cool. Um, I can't remember their opening
[46:26]
day, but I think it's in the next week
[46:27]
or two. So,
[46:28]
>> I think we're turning I think
[46:30]
>> gift shop.
[46:31]
>> He is definitely going to want a gift
[46:33]
shop.
[46:34]
>> Yeah, I think there's I think there's
[46:35]
something on our calendars to be down
[46:36]
there at the end of the month, right?
[46:38]
>> Friday.
[46:38]
>> Okay, very cool. We got that and and
[46:41]
then what do we got? We got the hospital
[46:43]
thing coming up, too. We didn't mention
[46:44]
that, but Fridays.
[46:45]
>> I don't see gift shop on the signs, but
[46:47]
it does say ho shop. Is that close?
[46:49]
>> It might be. Might be the same thing.
[46:51]
>> Okay,
[46:51]
>> I'll have something. and we'll make sure
[46:53]
former Councilman Argyle is aware of the
[46:55]
day we're down there turning shovels.
[46:58]
So, I'll bet he'll be there with a cat
[47:00]
hat on. So, very cool stuff. Welcome to
[47:03]
our community and uh thanks Josh for
[47:06]
presenting that and uh those those signs
[47:08]
make sense around that area. Okay. Um
[47:13]
takes us uh to uh adjourning to
[47:15]
redevelopment agency uh to entertain a
[47:18]
motion to go into redevelopment agency.
[47:23]
So moved. Motion made by Councilman
[47:25]
Carden.
[47:27]
>> Second.
[47:27]
by Councilman Oiler to go into
[47:29]
redevelopment agency. All in favor say
[47:31]
yes.
[47:32]
>> Yes.
[47:33]
>> In redevelopment agency, we are
[47:35]
directors and I am the chairpresident.
[47:39]
I'd appreciate being referred to as
[47:40]
such.
[47:42]
>> As the chair slp president.
[47:43]
>> Yep.
[47:44]
>> Okay.
[47:44]
>> Either way,
[47:45]
>> deal
[47:46]
>> Jordan. Oh, we have minutes of uh of RDA
[47:51]
uh meeting 552026
[47:54]
to approve in the consent agenda.
[47:56]
Anybody want to make that motion?
[48:01]
» I move to adopt the RDA consent item.
[48:04]
>> Motion made by Director Oiler.
[48:09]
>> Second.
[48:09]
by director Tuk. All in favor say
[48:12]
yes.
[48:13]
>> Yes.
[48:13]
>> The RDA meeting minutes are approved.
[48:17]
Now into the RDA fiscal year 2027
[48:20]
budget. Mr. Jordan Hails.
[48:22]
>> Uh chair slashpresident and directors.
[48:26]
Um the budget for the RDA follows the
[48:29]
same process as the the other budget. Um
[48:31]
so we'll have a public hearing this
[48:33]
evening and then uh approval of the
[48:35]
budget in two weeks.
[48:37]
>> Thank you, Jordan. There's a link in the
[48:39]
minutes and again in the uh on the
[48:42]
website if you want to see the RDA
[48:44]
budget. I'd entertain a motion go to
[48:45]
public hearing for the redevelopment
[48:47]
agency fiscal year 2027 budget.
[48:50]
>> So moved.
[48:51]
>> Motion made by director Carden.
[48:53]
>> Second.
[48:54]
by director Beck. All in favor
[48:55]
say yes.
[48:56]
>> Yes.
[48:56]
>> We're in public hearing for the RDA
[48:58]
budget. Anybody from the public would
[49:00]
like to speak to this. Seeing none, I'd
[49:03]
entertain a motion go out of public
[49:04]
hearing.
[49:05]
>> So moved.
[49:05]
>> Motion made by Director Tuk.
[49:08]
>> Second.
[49:09]
by director Marshall. All in
[49:10]
favor say yes.
[49:11]
>> Yes.
[49:12]
>> Discussion back up here. There any
[49:13]
questions about the fiscal year 2027
[49:16]
budget for the RDA?
[49:19]
>> Okay, we're in um again public uh you
[49:23]
can look at that and uh ask us any
[49:25]
questions about that over the next
[49:26]
couple of weeks as well.
[49:29]
I'd now entertain a motion to adjurnn to
[49:31]
the LBA, the local building authority.
[49:35]
Anybody
[49:37]
dare? Do
[49:37]
>> you have to adjourn one and a move to
[49:39]
the other one or can we
[49:40]
>> No, it doesn't.
[49:42]
Huh?
[49:43]
>> Oh, okay. Just curious. I'm not going to
[49:45]
do the talking, but I was just
[49:46]
>> adjourn to L. I move that we adjourn to
[49:49]
LBA.
[49:51]
>> Director Carden of the RDA has proposed
[49:54]
to move in uh to being a trustee in the
[49:58]
LBA.
[50:00]
>> Is there a second?
[50:01]
>> Second.
[50:02]
made by director Marshall to go
[50:05]
into LBA. All in favor say yes.
[50:07]
>> Yes.
[50:08]
>> We're in LBA. You notice when you
[50:10]
>> prom these meetings, you never get this
[50:12]
kind of stuff.
[50:13]
>> They're very respectful.
[50:16]
>> Um I mean you never have to do the
[50:18]
labels.
[50:20]
>> No, she did once and she just called us
[50:21]
our last name.
[50:22]
>> Oh, did she just
[50:22]
>> She yells it too.
[50:24]
>> She just goes the last name.
[50:26]
>> Okay.
[50:26]
>> Mendal.
[50:27]
>> Okay.
[50:30]
What where are we at?
[50:32]
We're in LBA consent. The LBA minutes of
[50:35]
55
[50:37]
26. I'm sure it doesn't mean to say 25.
[50:39]
It says 25. Do you mean 26?
[50:44]
>> Says LBA meeting minutes of 5525.
[50:47]
>> Yeah, the attachment says 26.
[50:49]
>> Yeah, it should be 26.
[50:51]
>> Okay. I don't know that we went into LBA
[50:53]
in 26.
[50:56]
>> We would have presented the tenative.
[50:58]
>> That was on the 5th, right?
[50:59]
>> Yeah. 5526. I'd entertain a motion to
[51:02]
approve the LBA meeting minutes of 5526.
[51:08]
» Move that we approve the consent item in
[51:11]
the LBA.
[51:12]
>> Motion made by trustee Oiler.
[51:15]
>> Second.
[51:16]
by trustee Marshall. All in favor
[51:18]
say yes.
[51:19]
>> Yes.
[51:20]
>> Meet it. The minutes are approved. Now
[51:22]
into the public hearing. Mr. Jordan
[51:25]
Hails for the for the last time. Um,
[51:28]
we've got the budget public hearing for
[51:30]
the LBA. Uh, in two weeks we'll have the
[51:32]
approval. Um, again, this section of the
[51:36]
budget is part of the same document if
[51:37]
you go to the the the website and you
[51:39]
can view it all there. Perfect. Thank
[51:42]
you, Mr. Hails. I'd entertain a motion
[51:43]
go into public hearing for the LBA
[51:45]
fiscal year 2027 budget.
[51:48]
>> So moved.
[51:49]
>> Motion made by Trustee Marshall.
[51:51]
>> Second.
[51:51]
by Trustee C. Trustee Carden. All
[51:53]
in favor say yes.
[51:54]
>> Yes. We're in public hearing hearing for
[51:56]
the LBA budget. Anybody here to speak on
[51:59]
that item?
[52:01]
Seeing none, I'd entertain a motion go
[52:02]
out of public hearing.
[52:04]
>> So moved.
[52:05]
>> Motion made by Trustee Beck.
[52:08]
>> Second.
[52:08]
by Trustee Tuk. All in favor say
[52:12]
yes.
[52:12]
>> Yes.
[52:14]
>> We're out of public hearing. Sorry, you
[52:16]
were vice chair there, Councilwoman
[52:18]
Trusty Beck.
[52:19]
>> Okay,
[52:20]
>> I'll get you next time.
[52:22]
>> Okay. Um, LBA New business. We have
[52:26]
items A and B.
[52:30]
Manager parents.
[52:31]
>> Thank you, Mr. Mayor. I'm going to
[52:32]
invite uh Jonathan and Garrett to come
[52:36]
up. Garrett's my new friend. Does not
[52:38]
work for Wheeler.
[52:40]
His work for Gilmore Bell. He and I have
[52:42]
spoken on the phone and I know who he is
[52:45]
now. I know what he looks like. Um
[52:48]
tonight we have a presentation of the
[52:51]
LBA parameters resolution which is the
[52:53]
precursor to going uh to issuing a bond.
[52:57]
Uh this bond would be eventually uh for
[53:01]
the construction of the financing of and
[53:03]
the construction of a fire station 61.
[53:06]
That project is actually already started
[53:08]
and uh possibly also for the
[53:10]
construction of a public works shop. I
[53:13]
say possibly because that public works
[53:15]
shop has not yet been designed all the
[53:16]
way and it has not yet been decided by
[53:18]
you that we're going to build it. But um
[53:21]
we've decided that the best tool for us
[53:24]
to finance these structures is an LBA
[53:28]
bond and it is best to be agile.
[53:33]
Um, and so doing some of this leg work
[53:36]
now will enable us to watch markets and
[53:39]
make sure that if there's a moment in
[53:41]
time, say between now and uh when when
[53:46]
we would for sure have to bond, which
[53:48]
would be spring of 2027,
[53:50]
if there's a time where interest rates
[53:52]
are better, uh we'll be able to act
[53:54]
quickly and take advantage of those
[53:56]
interest rates. Uh we've spoken about
[53:58]
this a couple of times in previous
[54:00]
meetings where we've t talked about the
[54:02]
construction of station 61.
[54:05]
We would bond for $15 million for the
[54:08]
construction of station uh 61 and
[54:12]
anticipate that it will have a rate
[54:14]
somewhere in the 4% range. Uh right now
[54:17]
we anticipate four to four and a
[54:18]
quarter, but we'd sure love like three
[54:20]
and a half, right Jonathan?
[54:21]
>> Yes, we would. Um, our best loan rate
[54:24]
that we have to date, uh, is in the
[54:27]
ones, and we'd sure love that as well,
[54:29]
but I don't think we're going to see
[54:30]
that, uh, perhaps ever again. Uh, but
[54:34]
right now, we're planning that this
[54:35]
would be somewhere in the 4% range. Um,
[54:38]
again, $15 million for station 61. We
[54:41]
want that to be a 10-year repayment. Uh,
[54:44]
and then the and those numbers are are
[54:47]
known. You gave the green light on that
[54:49]
project a couple of months ago. the GMP
[54:52]
was issued and and we know that we'll
[54:54]
need about $15 million in that bond.
[54:58]
The public workshop is about six or
[55:00]
eight months behind that in terms of its
[55:01]
timeline and process. And so we are
[55:04]
still going through the design phase,
[55:05]
but we're we have great estimates along
[55:07]
the way and and we estimate that that
[55:09]
bond will need to be um about no more
[55:13]
than $45 million.
[55:15]
So, the parameters resolution that you
[55:18]
have before you is an all-encompassing
[55:20]
parameter. It says we're not going to
[55:22]
bond for anything more than. And this
[55:25]
parameters resolution says we're not
[55:26]
going to bond for more than $83 million.
[55:30]
Now, we're not going to go and bond for
[55:31]
83 because we can, but it just it does
[55:34]
give us the ability to bond for a little
[55:36]
bit more in case we said we're going to
[55:37]
go bond for 58 and then we were wrong by
[55:40]
$3 million and we can't go and get those
[55:43]
extra $3 million. So we tell the
[55:46]
financial uh folks this is what we think
[55:49]
we need $60 million for those two
[55:51]
projects and they recommend for us what
[55:55]
that parameters resolution
[55:57]
high extent should be uh and also the
[56:00]
interest rate. And so today we'll tell
[56:03]
you that uh we think the most the public
[56:05]
workshop project will cost would be a
[56:07]
bond of 45 million. So 45 + 15 is 60
[56:10]
million. So, in case anybody wonders why
[56:13]
the parameters resolution says up to 83,
[56:15]
it's that that comfort level that that
[56:18]
our financial advisors suggest that we
[56:20]
always have. How did I do with that? Was
[56:22]
that terrible or was that okay? All
[56:25]
right, with that, I'm actually going to
[56:27]
let either Jonathan or Garrett walk
[56:30]
through any of the issues or details
[56:31]
about this. And please, if you have any
[56:34]
questions about uh the ins and outs of
[56:35]
these, please um please ask them. Mayor,
[56:40]
there is something that you need to do
[56:41]
in with that statement resolution. We'll
[56:44]
have you read um that statement
[56:46]
resolution and then I think we go into
[56:48]
the discussion on the parameters
[56:49]
resolution after that.
[56:51]
>> Perfect.
[56:53]
Okay. Uh maybe you want me to read that
[56:56]
before you come up. Okay. No, I was
[56:58]
going to say just just to explain to the
[56:59]
statement resolution was a new
[57:01]
requirement added by state law in 2024
[57:05]
for whenever you issue a lease revenue
[57:08]
bond specifically.
[57:10]
>> It's now a requirement to read this
[57:11]
statement resolution in in your public
[57:15]
meetings. So
[57:15]
>> that's why I haven't done that's why you
[57:17]
have not done it before and may not be
[57:18]
familiar with it for any any bond issue
[57:20]
over over $10 million. It's a new new
[57:22]
requirement. So just FYI.
[57:24]
>> Perfect. Okay. I'll read this and then
[57:26]
we'll go into that discussion. Uh
[57:28]
statement reads, "The Local Building
[57:30]
Authority of Spanish Fork City, Utah,
[57:32]
hereby intends to issue a lease revenue
[57:34]
and refunding bond. The purpose of said
[57:37]
bond is to provide funds to a finance
[57:40]
the cost of construction of a fire
[57:42]
station and public works building and
[57:44]
all related improvements, the quote
[57:47]
project. B refund certain outstanding
[57:50]
bonds of the authority. And C fund any
[57:52]
required debt service reserve fund. and
[57:55]
D pay costs associated with the issuance
[57:58]
of the bonds. The estimated amount of
[58:00]
the bond is $83 million.
[58:03]
How do I do?
[58:07]
>> Yeah, it's fine. It's okay to clap.
[58:09]
Okay. Uh uh Jonathan, thank you for
[58:13]
being here. Thanks for being our
[58:14]
financial advisor uh in Spanish Fork and
[58:17]
taking care of us. Um this uh uh this
[58:21]
part that I was going to maybe read to
[58:25]
before you come up uh is in uh section B
[58:28]
of our new business of the LBA. It says
[58:30]
the city council and local building
[58:32]
authority are considering possibility of
[58:34]
issuing lease revenue bonds to
[58:36]
construction construct the new station
[58:39]
61 building and a possible public
[58:42]
workshops. Construction on station 61
[58:44]
has already started. the public works
[58:46]
shops has not. This resolution will
[58:48]
allow the city to issue bonds to
[58:51]
construct both buildings if and only
[58:53]
after the city council authorizes the
[58:55]
construction of the public works shop. A
[58:58]
future decision. Our financial adviserss
[59:00]
advise us to undergo these approvals now
[59:02]
to ensure quick and responsive future
[59:04]
actions if or when both of the projects
[59:07]
are authorized. This parameters
[59:09]
resolution outlines the highest and most
[59:11]
limits that the bond amounts and rates
[59:13]
could be. In actuality, the bond totals
[59:15]
and the rates will be less than these.
[59:19]
Good.
[59:24]
» Thank you, Mr. President. Chairman of
[59:27]
the [laughter] local building authority
[59:29]
board and trustees.
[59:31]
The uh
[59:34]
we do think it's in the city's best
[59:35]
interest to consolidate bond issues as
[59:37]
opposed to doing two separate possible
[59:39]
bond issues. a small one for the fire
[59:42]
station and a larger one for the public
[59:43]
works. If we can simplify and economize
[59:46]
by doing it all in one process, we're
[59:49]
saving money in the process. So that's
[59:52]
why we recommended this. Uh in addition,
[59:56]
in that statement that the mayor read,
[59:59]
we discussed refunding bonds. That's
[1:00:02]
municipal bond language for refinance.
[1:00:05]
the city has outstanding uh series 2022
[1:00:08]
transaction that is refinancable because
[1:00:12]
the prepayment terms are such that that
[1:00:15]
we can do that. We're not at a point in
[1:00:18]
our current environment, financial
[1:00:20]
environment and market environment where
[1:00:21]
we think that's um ideal. Meaning we
[1:00:25]
could refinance, we could save some
[1:00:27]
money. It translates to about $15,000
[1:00:30]
per year for the next say 18 years. But
[1:00:37]
we don't think it's we don't think it's
[1:00:39]
as advant ad advantageous now to do that
[1:00:42]
as perhaps some point in the future.
[1:00:44]
Meaning this the savings could be more
[1:00:47]
and to give away the prepayment
[1:00:49]
flexibility to capture 15,000 a year
[1:00:52]
versus 50,000 a year doesn't quite make
[1:00:55]
sense. But we wanted to include that in
[1:00:58]
the resolution and allow ourselves that
[1:01:00]
flexibility. So part of the 83 million
[1:01:03]
is also not just new projects but also
[1:01:06]
possibility of refinancing the 2022
[1:01:08]
bonds. I'll also add that because we're
[1:01:11]
starting multiple projects and they're
[1:01:13]
phased at different times, we have in
[1:01:16]
the resolution a reimbursement clause
[1:01:18]
that says that we can start spending
[1:01:20]
money on the fire station,
[1:01:23]
but if we issue bonds later and we want
[1:01:26]
to and we will want to reimburse our our
[1:01:29]
cash reserves, we're given the
[1:01:31]
authorization to do so. And under
[1:01:32]
federal law, Garrett can speak to this
[1:01:34]
in more detail, that's a requirement. we
[1:01:36]
have to declare our intent to reimburse
[1:01:39]
ourselves with taxexempt money. So
[1:01:42]
that's something we've embedded in here.
[1:01:44]
I'll also note mayor that there is a
[1:01:46]
section referring uh to designated
[1:01:49]
persons. The city council delegates
[1:01:51]
authority to designated persons within
[1:01:54]
the council ranks and the staff ranks to
[1:01:57]
finalize terms and conditions. You as a
[1:02:00]
council have to decide number one, do we
[1:02:02]
do a public works building? If that
[1:02:04]
happens and the council says, "Yes,
[1:02:06]
we're going to do that and we want to
[1:02:07]
finance that." We have the authority
[1:02:09]
that we need to do this, but you have to
[1:02:11]
delegate to what's bracketed in the
[1:02:14]
resolution as three or four people, four
[1:02:16]
three or four individuals who will be
[1:02:18]
those designated persons to uh to
[1:02:21]
determine the final terms and conditions
[1:02:22]
of bonds to be issued. We usually see
[1:02:26]
that as two, usually an elected official
[1:02:29]
and a staff member. We've got in here
[1:02:31]
three or four, so you can choose any
[1:02:34]
number. We've got listed in the
[1:02:35]
resolution. Mayor, council members, city
[1:02:39]
manager, finance director. As a council,
[1:02:42]
you can decide, do we want three, do we
[1:02:45]
want four? And then any of one of those
[1:02:47]
three or four can be called on to make
[1:02:49]
the determination
[1:02:51]
um of final terms and conditions on the
[1:02:53]
bonds. It can do two. If you want to
[1:02:56]
make it two, I simply say we'll
[1:02:58]
designate or delegate to any two of the
[1:03:01]
following versus the three or four in
[1:03:03]
bracket. So that's up to you. That's all
[1:03:06]
I'm
[1:03:08]
I can add, mayor, at this time.
[1:03:10]
>> Any questions for Mr. Ward?
[1:03:13]
>> So if that delegation happens, say it's
[1:03:16]
four, is there a vote amongst the four
[1:03:20]
or do each one of them like what is
[1:03:22]
their role? They have to all approve and
[1:03:24]
agree to the terms and conditions. Yeah.
[1:03:26]
They'll ultimately say we bless the
[1:03:28]
transaction, the terms and conditions,
[1:03:30]
and
[1:03:30]
>> then the mayor and recorder can sign.
[1:03:32]
>> Okay. Otherwise, it's coming back to
[1:03:34]
this body to do that.
[1:03:36]
>> Yep.
[1:03:37]
>> At a future date. Okay.
[1:03:39]
>> Jonathan, what does refunding look like
[1:03:41]
in the future? Is that a public hearing
[1:03:43]
or is that something administrative?
[1:03:45]
>> It would be administrative if the if the
[1:03:47]
council chooses to approve the
[1:03:48]
resolution this evening. So basically
[1:03:51]
we're we're making this we're taking
[1:03:54]
this legislative action and making it
[1:03:55]
administrative by delegating the
[1:03:57]
authority and the terms around which you
[1:03:59]
can negotiate the bond.
[1:04:02]
>> Yep. The timing the terms become much
[1:04:04]
more flexible.
[1:04:05]
>> Okay. And this isn't this we won't issue
[1:04:08]
this bond until after we've decided on
[1:04:10]
the public works building. And if we
[1:04:11]
decide not to then obviously this drops
[1:04:13]
down. That's how I'm hearing it. Right.
[1:04:14]
>> Okay.
[1:04:15]
>> Correct.
[1:04:16]
A couple times in your your description,
[1:04:19]
you said we. It's the collective we.
[1:04:22]
It's not our our bond. It's not you
[1:04:26]
guys, right? It's the we that we
[1:04:28]
delegate the responsibility and
[1:04:30]
authority to the city manager, the
[1:04:33]
mayor, whomever.
[1:04:34]
>> Exactly. Correct. Yeah. We as your
[1:04:36]
financial advisor in conjunction with
[1:04:39]
the delegated persons and the staff
[1:04:40]
execute the process.
[1:04:42]
>> Just want to make sure I I understood
[1:04:43]
that. It's just when you say we are
[1:04:45]
going to make the decision, it's we and
[1:04:48]
not our financial adviser. Just just so
[1:04:50]
the public understands that.
[1:04:52]
>> Good point.
[1:04:52]
>> It's the collective we.
[1:04:54]
>> Um why? So Seth mentioned it's $60
[1:04:58]
millionish and that's is for sure
[1:05:00]
because we don't know exactly what the
[1:05:02]
number is. Why would we want to go up to
[1:05:05]
potentially 83?
[1:05:09]
probably just because of cost overruns
[1:05:11]
or if there are more bonds that are
[1:05:14]
refundable at a future date in time. The
[1:05:17]
economy is great, the interest rates are
[1:05:19]
low and we want to include other trans
[1:05:21]
other series of bonds
[1:05:23]
>> to pay off something else or
[1:05:25]
>> you'd issue new bonds to pay off old
[1:05:27]
bonds at a lower rate. Yeah.
[1:05:29]
>> All right. That makes more sense.
[1:05:30]
>> We wouldn't obviously touch the 1%
[1:05:32]
rates, but if we're at 4%, we can get a
[1:05:34]
three and a half and it and it
[1:05:36]
justifies. use this authority to bond
[1:05:38]
for the additional 20
[1:05:40]
>> and pay off
[1:05:42]
the old.
[1:05:43]
>> Okay,
[1:05:43]
>> that makes sense.
[1:05:45]
>> That's a way better example or
[1:05:47]
explanation, Seth.
[1:05:50]
[laughter]
[1:05:51]
>> Than it's 20 million.
[1:05:53]
>> I thought I was answering you clear.
[1:05:56]
[laughter]
[1:05:57]
>> Thank you, Jonathan. That was that was
[1:05:58]
very helpful.
[1:05:59]
>> That was good. [laughter]
[1:06:01]
>> Yeah. Yeah, that's that's a good uh
[1:06:02]
that's a good part to bring to the
[1:06:04]
public here. you're you're you're you're
[1:06:06]
having some reserve there to be able to
[1:06:08]
say, "Hey, interest rates are better
[1:06:09]
than what we had that money borrowed at.
[1:06:12]
So, let's refinance it. Let's refund
[1:06:13]
those and save some money
[1:06:15]
>> in expedited way."
[1:06:17]
>> And you don't have to come back here and
[1:06:20]
ask to do that long process of it. You
[1:06:21]
have
[1:06:22]
>> you don't have to refund the other loan.
[1:06:24]
You can just pay off that portion of the
[1:06:26]
loan with the new new amounts. Right.
[1:06:29]
>> Jonathan, how how are we as a risk as a city? Can you speak to that at all?
[1:06:35]
>> Yeah, the city's ratings are very
[1:06:37]
strong. You're in the double A range,
[1:06:39]
which uh AAA is the best. Double A plus,
[1:06:42]
double A even, double A minus. And I
[1:06:46]
think other than
[1:06:49]
I think all of your bonds, water, sewer,
[1:06:51]
or sales tax, and these lease revenue
[1:06:54]
bonds haven't been rated yet, but when
[1:06:56]
they get rated, they'd be in the double
[1:06:58]
A. They'd probably be one notch lower
[1:07:00]
than your general obligation, which is
[1:07:03]
the guilt edge municipal bond security
[1:07:06]
rating. And we don't know what that is,
[1:07:09]
but I suspect it's in the double A
[1:07:11]
range.
[1:07:13]
Perfect. That's a that's what we call
[1:07:15]
high investment grade ratings. It's
[1:07:19]
really uh really commendable. It's a
[1:07:22]
function of your rating or your economy,
[1:07:24]
your finances, your debt load, your
[1:07:26]
management practices and policies as
[1:07:28]
well.
[1:07:29]
>> When you put those offerings out there,
[1:07:32]
there's there's buyers is what you're
[1:07:34]
saying. They like those
[1:07:36]
>> Yeah.
[1:07:36]
>> rated bonds. I was on a call the other
[1:07:38]
day and the question was, you know, do
[1:07:42]
some buyers want more yield? So, they
[1:07:44]
may be dissuaded to buy Spanish fork
[1:07:48]
bonds because the bonds aren't going to
[1:07:49]
be really high interest rates, not a lot
[1:07:51]
of high yield because the credit's so
[1:07:53]
good. But yeah, I think most investors
[1:07:56]
buy municipal bonds because they like
[1:08:00]
good solid credits. they like income and
[1:08:02]
cash flow that's uh reliable and steady
[1:08:06]
and that's what Spanish Fork offers when
[1:08:08]
they sell their the Spanish Fork city
[1:08:10]
bonds.
[1:08:14]
» Any other questions for Mr. Ward on this
[1:08:17]
subject?
[1:08:17]
>> Garrett Gross has Mr. Gross.
[1:08:20]
>> I I just handle the boring legal
[1:08:21]
matters, but uh any any questions on the legal structure of of the LBA? I
[1:08:26]
know you've the city and the authority
[1:08:29]
have issued uh well the authority excuse
[1:08:32]
me has issued lease revenue bonds before
[1:08:34]
on behalf of the city but any any
[1:08:36]
questions there I'm like I said I'm
[1:08:38]
Garrett Gross from Gilmore Bell you're
[1:08:39]
probably familiar with some of my
[1:08:41]
colleagues Randy Larson Brad Patterson
[1:08:44]
Aaron Wade I started with the firm about
[1:08:46]
two years ago after working 14 years
[1:08:49]
inhouse at Zans's bank so
[1:08:52]
>> Garrett what's been your experience
[1:08:53]
between having two three or four
[1:08:56]
individuals.
[1:08:57]
>> But, uh, it just it sort of depends in
[1:09:01]
terms of what you want in terms of the
[1:09:04]
decision- making. You know, do you want,
[1:09:06]
you know, and safeguards around the
[1:09:09]
decision- making, making sure that it's,
[1:09:10]
you know, sort of been vetted out
[1:09:12]
amongst a wide range of people. For for cities, typically
[1:09:18]
two has been the max. for sometimes more
[1:09:21]
complex authorities. I've seen, you
[1:09:23]
know, the three or four kind of being the threshold. The the downside to
[1:09:28]
having more is obviously if you're
[1:09:31]
trying to make some decisions quickly,
[1:09:33]
trying to get, you know, everybody, you
[1:09:35]
know, on board in terms of availability,
[1:09:38]
right, on quick decision- making. So,
[1:09:40]
you know, it's sort of what you feel
[1:09:42]
comfortable in in the middle of that. To
[1:09:44]
me, typically what I've seen the most of
[1:09:46]
is two, right?
[1:09:49]
mo most of in terms of not most upper
[1:09:52]
threshold but most common.
[1:09:58]
» Thank you, Mr. Gross. Appreciate that.
[1:10:01]
Um,
[1:10:03]
>> yeah, I'll just speak to this off the
[1:10:06]
cuff a little bit, but I think uh
[1:10:08]
obviously our city manager and our
[1:10:10]
finance director
[1:10:12]
uh should be a couple of those
[1:10:14]
positions. Um, I've sat on that for the
[1:10:17]
other a couple other issuances, but uh,
[1:10:21]
happy if anybody else wants to join me
[1:10:24]
on that. You guys can all leg wrestle
[1:10:26]
for it if you'd like. I don't know, but
[1:10:28]
>> I don't know. President/chair sounds
[1:10:29]
like it seems like that's right
[1:10:31]
>> enough authority.
[1:10:32]
>> No, it sounds right up your alley.
[1:10:33]
>> Oh. Oh, yeah.
[1:10:35]
>> I don't think we need four.
[1:10:37]
>> No, I
[1:10:37]
>> I'm even comfortable with the two, but
[1:10:40]
unless you
[1:10:43]
>> What do you guys think? I am too.
[1:10:46]
>> I'm not comfortable with two. I think
[1:10:47]
that
[1:10:48]
>> the amount of flexibility that we've
[1:10:51]
given are going to give tonight requires
[1:10:53]
a little bit more oversight than
[1:10:55]
>> and and I think that the elected
[1:10:57]
officials
[1:10:59]
>> should be equal to the staff members on
[1:11:02]
it. So, I'm leaning more towards four,
[1:11:04]
which would be you two and those two.
[1:11:08]
>> I was trying to not
[1:11:10]
>> I know if if you don't want to and and
[1:11:12]
so I mean I would do it. I have no
[1:11:14]
problem. But I I like the idea of
[1:11:16]
because of the range that we're giving
[1:11:18]
here. It's there's a lot of flexibility
[1:11:21]
in this resolution. Not I don't think we
[1:11:24]
have given that much flexibility before.
[1:11:26]
I like the idea of not having to come
[1:11:29]
back to this body every single time to
[1:11:30]
make the make the decision. So I like
[1:11:32]
the expedience this is going to to give
[1:11:35]
us. Um but I like to put some of our
[1:11:38]
butts on the line a little bit and and
[1:11:40]
make us accountable. like it's two of us
[1:11:42]
and one or two staff members.
[1:11:47]
» That was going to be my only additional
[1:11:49]
suggestion is it's typically good to
[1:11:50]
have at least one of, you know, a
[1:11:53]
balance of of each, right? If you're
[1:11:55]
going to have some elected officials,
[1:11:57]
maybe have at least one staff person
[1:11:59]
there to, you know, administratively see
[1:12:02]
things through, right?
[1:12:03]
>> You're inferring that politicians would
[1:12:04]
blame somebody other than themselves for
[1:12:06]
something like this or something. Never
[1:12:08]
happens.
[1:12:09]
>> It never happens. ever. Ever. I I have
[1:12:12]
much more trust in [laughter] city
[1:12:15]
council of the LBA of Spanish Fork than
[1:12:17]
that. I would never say such.
[1:12:19]
>> Let me maybe for the sake of comfort of
[1:12:23]
moving it along. The way the parameters
[1:12:25]
resolution is written today, it doesn't
[1:12:26]
say it's you and you. It just says four
[1:12:31]
of any of the following. So it you don't
[1:12:33]
have to designate anybody today. It can
[1:12:35]
be uh you know when we get to that week
[1:12:37]
even hey Shane's around. Stacy's not.
[1:12:41]
We're going to use Shane and and the
[1:12:42]
mayor or something like that.
[1:12:44]
>> Shane that's not around.
[1:12:46]
>> I'm sorry. I did not mean to open that
[1:12:48]
door.
[1:12:48]
>> I had to go there.
[1:12:50]
>> You had to walk into it.
[1:12:51]
>> But if you want to identify it, I'm sure
[1:12:53]
you can. But the way it's written now,
[1:12:55]
it gives you the flexibility to to
[1:12:57]
identify them in that moment or closer
[1:12:59]
to that moment and then just say that
[1:13:02]
it's going to be four of any of the
[1:13:03]
following or three of any of the
[1:13:04]
following.
[1:13:04]
>> So are you recommending leaving three or
[1:13:06]
four in the in the text?
[1:13:08]
>> I would not leave three or four. I would
[1:13:10]
choose three or
[1:13:11]
>> or four, but then leave
[1:13:13]
>> but you don't have to decide who those
[1:13:15]
three or four are.
[1:13:16]
>> Yep. Because it's following
[1:13:18]
>> and put that in the motion.
[1:13:21]
>> Yep.
[1:13:22]
Okay. Makes sense.
[1:13:24]
>> Good discussion. Good questions. Any
[1:13:26]
other questions or comments about that?
[1:13:30]
>> No.
[1:13:31]
>> Okay. I think that's a good
[1:13:33]
recommendation. And and uh if somebody's
[1:13:35]
ready to make a motion, uh put it put it
[1:13:37]
in that motion.
[1:13:43]
» What is this body called?
[1:13:46]
>> It's a local building authority.
[1:13:47]
>> Not this body. the the three or four
[1:13:51]
>> uh designated officers.
[1:13:53]
>> Designated officers.
[1:13:55]
>> Say that twice.
[1:13:56]
>> Designated officers. Yep. So the top
[1:13:59]
line of the second page there is the
[1:14:00]
designated officers.
[1:14:03]
>> You got it. Sh these officers.
[1:14:06]
>> I'll give it a shot. All right. I move
[1:14:08]
to approve the parameters resolution of
[1:14:10]
the local building authority of Spanish
[1:14:11]
Fork City Utah authorizing the issuance
[1:14:14]
and sale of not more than 83 million
[1:14:16]
aggregate principal amount of leasing
[1:14:20]
revenue and refinding and refunding
[1:14:22]
bonds
[1:14:23]
and four people on the governing board.
[1:14:28]
Is that what you said?
[1:14:29]
>> Designated officers
[1:14:31]
>> be defined as four. I did not have it
[1:14:34]
but I do now.
[1:14:35]
>> You do now.
[1:14:37]
That's why Joshua's here. He can help
[1:14:38]
clean that up. Thank you.
[1:14:40]
>> Yeah, I'll second Jesse.
[1:14:42]
>> Motion made by Trustee Marshall,
[1:14:45]
seconded by Trustee Oiler. This is a
[1:14:47]
roll call vote. Trustee Carden,
[1:14:50]
>> yes.
[1:14:50]
>> Trustee Tuk,
[1:14:51]
>> yes.
[1:14:51]
>> Trustee Marshall,
[1:14:53]
>> yes.
[1:14:53]
>> Trustee Beck,
[1:14:54]
>> yes.
[1:14:54]
>> And trustee Oiler,
[1:14:55]
>> yes.
[1:14:58]
>> Parameters resolution of the LBA of
[1:15:00]
Spanish Fork is approved. I would
[1:15:03]
entertain a motion uh to
[1:15:06]
uh adjourn from the LBA.
[1:15:09]
>> Can we put those together, Tara? Or
[1:15:11]
>> Josh? Okay. I move to adjourn from LBA
[1:15:13]
and reconvene back into city council to
[1:15:15]
continue new business item B.
[1:15:18]
>> Motion made by Trustee Carden.
[1:15:21]
>> Second.
[1:15:22]
by Trustee Marshall. All in favor
[1:15:24]
say yes.
[1:15:25]
>> Yes.
[1:15:25]
>> We're adjourned from LBA and back to
[1:15:28]
city council meeting. Manage your
[1:15:30]
parents.
[1:15:30]
>> Yeah. Thank you. We'll move on to the
[1:15:31]
last item of the agenda. But before we
[1:15:33]
do that, maybe a little show and tell.
[1:15:34]
Terra, do you have those resolutions
[1:15:36]
handy right there? Would you
[1:15:37]
>> Would you put
[1:15:38]
>> Yeah, just put that just set that on the
[1:15:41]
Don't put it too far. We don't want it
[1:15:43]
to fall.
[1:15:45]
Maybe if Travis can zoom in on that
[1:15:47]
piece of that pile of paper. Um, that's
[1:15:51]
one of the resolutions that you just
[1:15:53]
approved and you're going to approve or
[1:15:55]
review another one. Um, that thick stack
[1:15:58]
of papers. There's a number of exhibits.
[1:16:00]
I can't remember what letter we got to
[1:16:01]
in the exhibits, but I feel like it was
[1:16:03]
in the latter half of the alphabet.
[1:16:04]
>> I remember a K.
[1:16:05]
>> Yeah, I do remember a K. Um, but uh
[1:16:10]
highly technical work when you go
[1:16:12]
through these uh bond offerings, you
[1:16:14]
know, anytime I think you're talking
[1:16:15]
about millions of dollars, the world
[1:16:17]
wants to make sure do it right. And so
[1:16:19]
we appreciate the the legal work. Uh and
[1:16:22]
honestly, I appreciate Tara. I walked
[1:16:24]
into her office and and she's got a a
[1:16:26]
little workspace that she was on and she
[1:16:29]
had the printer just going. There's a
[1:16:30]
little bit of smoke coming out of it. Uh
[1:16:33]
she was gathering everything and and
[1:16:34]
making going off of a kind of a
[1:16:37]
blueprint looking for this and she would
[1:16:39]
find this and put it here and find this
[1:16:40]
and put it there and a lot of
[1:16:42]
reshuffleling and shuffling again and um we really appreciate that work.
[1:16:46]
So anyways, that's that's one of the
[1:16:48]
resolutions that we approved tonight.
[1:16:51]
for those that are watching um online
[1:16:53]
and and here in the room, the process
[1:16:56]
that you've gone through is kind of
[1:16:59]
unusual and and some people might wonder
[1:17:01]
what the heck are they doing going into
[1:17:03]
this other group and this other body
[1:17:04]
that um and I think it's helpful to to
[1:17:07]
maybe remind the public that as a city
[1:17:09]
council, everybody knows you as
[1:17:11]
Councilman so and so or councilwoman
[1:17:13]
such and such and mayor so and so, but
[1:17:17]
you also are the trustee of
[1:17:21]
uh an LBA or a board member of an RDA,
[1:17:23]
Spanish Fork has at least three legal
[1:17:25]
entities that it is. And so uh when you
[1:17:30]
have an agreement, when you when you go
[1:17:32]
do something as the local building
[1:17:34]
authority, the LBA,
[1:17:37]
you're going to do it on behalf of the
[1:17:39]
city. So now you have to have an
[1:17:40]
agreement with yourself.
[1:17:44]
One legal entity, the LBA, now has to
[1:17:46]
have an agreement with the city of
[1:17:48]
Spanish Fork. It's all you, but you're
[1:17:51]
going to take off the one hat you had on
[1:17:53]
and you're going to put on another. And
[1:17:55]
so now we're going to go through a
[1:17:56]
fairly similar process. It's not exactly
[1:17:59]
the same, but another document about the
[1:18:01]
exact same thing. But this document is
[1:18:02]
the relationship between the city and
[1:18:05]
the LBA. Um, it's a different document.
[1:18:10]
It's not the same, but it's about the
[1:18:12]
same thickness. Um, so with that, I'm
[1:18:14]
gonna let either Jonathan or Garrett arm
[1:18:16]
wrestle over who gets to talk about what
[1:18:17]
this is and then we'll go from there.
[1:18:22]
So that that was actually uh very very
[1:18:25]
well wellstated. Um, because of those
[1:18:28]
relationships, under state law, the
[1:18:31]
local building authority does not have
[1:18:34]
the power to do much of anything except
[1:18:36]
the power that's derived to it from from
[1:18:39]
the city council. Right. So part part of
[1:18:42]
why the the city council has to then
[1:18:44]
approve all actions they they first have
[1:18:46]
to approve all actions of the local
[1:18:49]
building authority after they've they've
[1:18:50]
been taken. They have to ratify those.
[1:18:53]
And then a lot of the agreements, the
[1:18:55]
legal agreements, part of the lease
[1:18:57]
revenue bond structure are between the
[1:19:00]
city and the local building authority.
[1:19:03]
With the city agreeing to make lease
[1:19:05]
payments to the authority who the local
[1:19:07]
building authority, an entity created
[1:19:10]
under state law, then assigns those
[1:19:11]
lease payments to to a bond trustee to
[1:19:15]
make those payments uh to to bond
[1:19:18]
holders. Um and and so that's why um not
[1:19:22]
only does the city have to approve all
[1:19:25]
the actions of the LBA, but then it also
[1:19:27]
has to approve of its own right the the
[1:19:29]
bond documents themselves and and the
[1:19:31]
legal agreements that have been drafted
[1:19:33]
there to which the city is a party.
[1:19:37]
The other aspect of this is that when
[1:19:40]
offering these bond documents or
[1:19:42]
offering bond documents, these bonds to
[1:19:44]
the public, the city legally under the
[1:19:47]
SEC rules has to make certain legally
[1:19:49]
required disclosures to the public about
[1:19:52]
essentially its its financial condition
[1:19:55]
and certain certain other ma certain
[1:19:57]
legal matters, tax matters,
[1:20:00]
etc. And so in doing so the the
[1:20:03]
authority typically does not have the ability. I mean it can and it can be
[1:20:09]
dele but under SEC rules the the
[1:20:12]
appropriate entity that makes a lot of
[1:20:14]
the representations and enters into what
[1:20:16]
we call a disclosure undertaking is
[1:20:19]
typically the entity whose credit the
[1:20:21]
investors are looking at which
[1:20:23]
ultimately even though the authority is
[1:20:25]
the obligor or the issuer of these bonds
[1:20:29]
the the ultimate credit that the
[1:20:31]
investors are looking to are are the
[1:20:33]
cities and so that's why the city then
[1:20:35]
approves a few addition additional
[1:20:38]
documents. One one of which being the
[1:20:40]
offering document as well as what we
[1:20:43]
call a continuing disclosure undertaking
[1:20:45]
where it agrees with the public to to
[1:20:47]
let the public know if certain material
[1:20:50]
events take place throughout the the
[1:20:53]
life of the of the repayment of the
[1:20:55]
bonds. We don't think that, you know, is going to happen based on
[1:20:59]
the the wowing credit factors that
[1:21:02]
Jonathan just just uh indicated that the public markets think of the city and and the way that things have been
[1:21:09]
managed. But legally, of course, we're
[1:21:13]
chicken little as lawyers. The sky is
[1:21:15]
falling. We have to deal with case
[1:21:18]
scenario. So, any questions with that?
[1:21:23]
And I and I apologize after the, you
[1:21:25]
know, I should have in advance to Tara
[1:21:28]
and Seth for the amount of documentation
[1:21:31]
that we inundated them with and then
[1:21:34]
[clears throat] tried to explain the
[1:21:35]
order verbally and and I figure, you
[1:21:38]
know, I I there is so much here, you
[1:21:41]
know, we we had to clarify it a couple
[1:21:43]
times in writing and and I do not blame
[1:21:45]
them in the lease. There is a lot to
[1:21:48]
sort of swallow and digest with with
[1:21:50]
these lease revenue bonds. Any with that
[1:21:53]
said, any questions?
[1:21:54]
>> Any questions for Mr. Gross?
[1:21:59]
The financial world, we're still signing
[1:22:01]
paper and faxing at places. So, I mean,
[1:22:04]
the age of AI has not got there yet.
[1:22:08]
>> We're slowly progressing.
[1:22:11]
>> Thank you.
[1:22:12]
Garrett. Appreciate it. Thank
[1:22:14]
you, Jonathan. Anything else, Jonathan,
[1:22:15]
that you need to add? manage your
[1:22:18]
parents.
[1:22:21]
Jordan Hails, anything?
[1:22:25]
» I I don't understand it well enough to
[1:22:27]
speak. [laughter]
[1:22:29]
This is quite complex stuff. So, I'll
[1:22:31]
leave it to the the professionals here.
[1:22:33]
>> Okay. That's why we pay the
[1:22:34]
professionals, but you are a
[1:22:36]
professional finance director, so we
[1:22:37]
appreciate your we appreciate your
[1:22:40]
involvement, too. Okay. Uh any other
[1:22:43]
questions? If there's none from the
[1:22:45]
council, I'd uh I'd entertain this
[1:22:47]
motion that is back in the uh council uh
[1:22:52]
the council agenda.
[1:22:58]
And again, I think that was a great way
[1:23:00]
of putting it, but mirrors what we
[1:23:02]
already discussed in the LBA, but you're
[1:23:05]
relying on the on the credit of of the
[1:23:08]
city ultimately. So, we're making the
[1:23:10]
same resolution
[1:23:12]
inside the the city council body. Now
[1:23:16]
>> I move to approve the resolution of the
[1:23:18]
city council of Spanish Fork City, Utah,
[1:23:20]
authorizing and approving the execution
[1:23:22]
and delivery of a master lease agreement
[1:23:25]
and a ground lease agreement by and by
[1:23:28]
and between the city and the local
[1:23:30]
building authority of Spanish Fork City,
[1:23:32]
Utah, authorizing the issuance and sale
[1:23:35]
by the authority of not more than 83
[1:23:37]
million aggregate principal amount of
[1:23:40]
lease revenue and refunding bonds and
[1:23:42]
related matters.
[1:23:44]
Second
[1:23:45]
>> motion made by Councilman Oiler, second
[1:23:48]
by Councilwoman Beck. A roll call vote
[1:23:50]
here. Councilman Oiler,
[1:23:51]
>> yes.
[1:23:52]
>> Councilman Carden, yes.
[1:23:53]
>> Councilman Tuk,
[1:23:53]
>> yes.
[1:23:54]
>> Councilman Marshall, yes.
[1:23:55]
>> And Councilwoman Beck,
[1:23:56]
>> yes.
[1:23:57]
>> Okay. Item A of new business is
[1:23:59]
approved.
[1:24:01]
So, with that, I think it's maybe worth
[1:24:03]
highlighting that that in these
[1:24:05]
resolutions, specifically the parameters
[1:24:07]
resolution, we did set uh the date of a
[1:24:09]
public hearing for a month from now in
[1:24:10]
the council meeting in July. We can take
[1:24:13]
public comment uh on that. I think we
[1:24:15]
put notice actually I think this one
[1:24:17]
actually still has notice in the
[1:24:18]
newspaper in addition to whatever
[1:24:22]
>> there's actually two hearings a new one
[1:24:24]
that was also added requirement under
[1:24:27]
state law
[1:24:27]
>> here. Come back up. Come up here.
[1:24:30]
>> So So unfortunately as part of this new
[1:24:32]
2024 amendment to lease revenue uh
[1:24:35]
bonds, there will actually be two
[1:24:37]
hearings that serve two slightly
[1:24:40]
different purposes. I think they're very
[1:24:42]
redundant in my opinion, but you know,
[1:24:45]
um, don't quote, you know, don't quote
[1:24:47]
me on that too.
[1:24:48]
>> You just got quoted.
[1:24:48]
>> I know [laughter]
[1:24:50]
that meeting. I'm on the record. They
[1:24:52]
are a little bit redundant, but it is an
[1:24:53]
opportunity to provide
[1:24:55]
the public full disclosure of not only a
[1:24:57]
bond being issued, but a specifically
[1:24:59]
nonvoted on leash revenue bond. And so,
[1:25:02]
they can't be held concurrently,
[1:25:04]
unfortunately, under state law. So they
[1:25:06]
can be held, you know, consecutively on
[1:25:07]
the on the same evening, but they serve
[1:25:10]
two slightly different functions.
[1:25:12]
>> That's another legislation re recently.
[1:25:14]
>> That's that's part of the new 2024 ads.
[1:25:16]
>> Same one.
[1:25:19]
>> So just like tonight, thank you,
[1:25:20]
Garrett. Just like tonight where you had
[1:25:22]
back-to-back public hearings on the
[1:25:23]
budget, then one on the dividend. You'll
[1:25:24]
have two, [clears throat]
[1:25:26]
excuse me, back-to-back public hearings
[1:25:28]
in uh the July, I think it's July 7,
[1:25:31]
that first Tuesday in in July. Uh so
[1:25:34]
we'll have that and then after that as I
[1:25:37]
mentioned the the plan unless something
[1:25:40]
changes that that we would uh finalize
[1:25:44]
everything and go to the bond market in
[1:25:46]
this late winter early spring of 2027.
[1:25:51]
But we will watch it with the uh with
[1:25:54]
our financial adviserss and watch the
[1:25:56]
markets and if there's a reason to go
[1:25:57]
faster, we will come to you quickly and
[1:26:00]
tell you, hey, this is what's going on
[1:26:02]
or we'll communicate with you in some
[1:26:03]
way. U I don't anticipate that'll
[1:26:05]
happen, but it certainly can. We saw
[1:26:08]
that in 2021. We saw that in 2022.
[1:26:11]
Um and so I think this gives us that
[1:26:13]
flexibility. Again, if and if nothing
[1:26:16]
changes, the plan is that we would
[1:26:18]
exercise uh the authority given today in
[1:26:21]
the late winter, early spring of 2027.
[1:26:25]
But if something else changes, we'll
[1:26:26]
communicate that.
[1:26:27]
>> Sorry, I missed it. When would that
[1:26:28]
public hearing be then?
[1:26:29]
>> The public hearing is a month from now.
[1:26:30]
The first council meeting, actually the
[1:26:32]
only council meeting in July, but July
[1:26:33]
7th.
[1:26:34]
>> Okay, perfect.
[1:26:34]
>> Yep. [clears throat]
[1:26:36]
>> Okay, that's it.
[1:26:38]
>> Your fiesta's
[1:26:40]
council meeting.
[1:26:43]
>> Yep. We only have one in July.
[1:26:46]
>> All right.
[1:26:46]
>> Okay.
[1:26:47]
>> Which one?
[1:26:48]
>> Very good. Any other items, council,
[1:26:50]
that needs to come before this body
[1:26:52]
tonight?
[1:26:54]
We've already had a close session uh
[1:26:56]
before council meeting. So, if there's
[1:26:58]
nothing, I'd entertain a motion to
[1:26:59]
adjurnn.
[1:27:00]
>> So moved.
[1:27:01]
>> Motion made by Councilman Carden.
[1:27:03]
>> Second.
[1:27:03]
by Councilman Tuk to adjurnn. All
[1:27:05]
in favor say yes.
[1:27:06]
>> Yes.
[1:27:07]
>> We're adjourned from city council
[1:27:08]
meeting. Thank you everybody for joining
[1:27:09]
us.
[1:27:09]
>> Yes.
