I have a plane base there. I filled out
an application for board member uh
[1:24]
membership. I didn't get any official
response. So, one, I wanted to know if I
[1:28]
need to do anything else. And then also,
I was reading the requirements. Uh, do
[1:32]
you need to be a resident of the city of
Springdale to be a member of the board?
[1:37]
I was a little bit unclear on that.

no longer, is it?

I think you just had to be a qualified
elector of the state.

Okay, moving to number five on the
agenda, discussion of hangar 501
[2:52]
assignment. So, just to
catch you up, uh this was brought to the
[2:59]
commission's attention in October.
Um
[3:06]
we had Mr. Dodson come in. He had uh
purchased an aircraft over a year ago
[3:15]
and wanted to keep the hanger.
And I read to him and explained to him
[3:25]
in the lease agreement under number 11,
subleting,
[3:30]
ley may not sublet the premises in whole
or in part of assign or transfer this
[3:36]
lease or any interest therein without
the prior written consent of the leor.
[3:42]
Any such assignment without the leor's
consent shall be void and shall at the
[3:47]
option of less terminate this lease. And
so I ruled uh after he had let us know
[3:52]
that he bought it over a year ago that
that voided the lease agreement. Uh it
[3:57]
came to my attention that that needed to
go to a vote and so we're here today to
[4:03]
readress this and take it to a vote.

the hanger the lease was to Dr. Makavoy
prior prior to that was Mr. Storm. It
[4:21]
was transferred to Mr. Makavoy who then
sold the plane to Mr. Dodson. It's my
[4:26]
understanding that the transaction of
the sale of the plane is currently in
[4:30]
litigation
and there is a possibility that the sale
[4:34]
of that plane
uh that transaction could be voided. Uh
[4:40]
Mr. Dodson has indicated to me, I can't
speak for him, he's here, but he has
[4:44]
indicated to me that he understands that
he is responsible
[4:48]
uh if it the lawsuit does not turn out
in his favor. Um that he will be subject
[4:55]
to the vote of this commission, but in
the meantime, he does he does understand
[5:00]
and acknowledge that he's responsible
for any rent due actually started from
[5:04]
October 22nd.
Um, so I just wanted to bring that to
[5:08]
the commission's
attention that there is pending
[5:11]
litigation involving the plane that's in
this hanger. It it's not really apples
[5:16]
to apples, but it's similar to when
sometimes we have a reasonzoning request
[5:20]
that might come to planning commission
that there's a lawsuit over the property
[5:24]
and we're hesitant to take any action on
the property while there's litigation
[5:28]
pending. So that's why I bring it to the
commission's attention that there is a
[5:33]
possibility. I don't I don't know all
the intricacies of the case, but but
[5:37]
there is a possibility that the sale
could be voided and the plane would be
[5:42]
returned to Mr. Makavoy.
Uh and then it would be up to the
[5:46]
commission whether to let him stay in
the hanger or if Mr. Dodson prevails in
[5:50]
his lawsuit whether you let let it be
assigned. But Mr. Dodson has indicated
[5:54]
to me that he would be willing to pay
the rent that is due for the hanger in
[5:58]
the during the pendency of the
litigation.

I think from conversation
he's responsible for that rent
[6:07]
regardless.

mean if you take a vote today
versus we don't know how long the
[6:14]
litigation is going to go. Mr. Dodson
has indicated to me that however long
[6:18]
the litigation may take whether it's a
month or eight months. Court dockets are
[6:22]
slow sometimes, sometimes they're fast,
that he's willing, whatever that time
[6:25]
period is, he understands that he's
responsible for that rent in the
[6:28]
meantime.

that doesn't really address why we're
here and why we're meeting on this. The

and the reason for this coming back up
is because a vote was not taken on this
[6:44]
back in October. I ruled on it as the
chairman because president had been set
[6:48]
on these in the past um and it needed to
go to a vote. So that's why we're here
[6:54]
to discuss that again. Mr. Mr. Dawson,

this commission has voted
[7:20]
the last issue with summit hangers, head
hangers. you've you've went ahead and
[7:26]
issued people that was not on the
waiting list a hanger. So, I just want
[7:31]
to let you all be aware of that
stipulation.

Like I told the city attorney, I'm not
asking for any special favors.
[7:40]
I'm just simple asking you for
consideration,
[7:45]
equal protection, none of the law. You
gave it to one group, one guy, two of
[7:51]
the guys.
And why not me? So, it's pretty simple.

You've done it in the past. Your track
record is set out. You've done it. So,
[8:08]
if you choose not to do it, if you want
to vote it up or down, you're welcome to
[8:11]
do that. But like I said, I got the
litigation on the airplane and there's a
[8:16]
good chance that,
you know,
[8:21]
he's breached a contract and the
contract says clearly that I get the
[8:26]
hanger. That's on him. Had a deposition
two days ago.
[8:31]
And
I think this body
[8:35]
needs to look at
the repercussions on down the road and
[8:40]
and then there could be some because you
all have got federal guidelines you got
[8:46]
to follow and trust me I've read federal
guidelines so I'm blew in the face but
[8:52]
I'll take your vote. You guys decide
what you want to do. We'll take it up
[8:57]
with the city attorney and and uh but
before I leave the podium, I want to
[9:03]
give you all something. And uh Mr.
Koger, I had asked you a couple weeks
[9:08]
ago, I sent you an email. You said you
never got it.

just to follow up on that, how we have,

handled these in the past, it's a little
different than what Mr. Dodson is

saying. From the FBO standpoint, there
was new lease agreements made through
[10:12]
them to the individuals. how we've ruled
in the past from someone buying an
[10:19]
aircraft
from an individual
[10:23]
that that does not come to us then that
voids that lease and that's how we've
[10:28]
represented that all along. So

So, it would take an eviction

you know, if you rent a house, you can't
just go on there and take the tenant
[11:25]
out. You have to go through a specific
procedure to evict someone from the
[11:29]
hanger.

for that, we didn't actually take a vote
on Mr. Dodson's request in October. So,

that's why he's back today.
So, when did the plane actually sell?

» From memory, at the October meeting, Mr.
Dodson said he bought it over a year
[11:55]
ago.

on April 4th of 2024.
>> So, my understanding is that's when we

voided the lease agreement with the

» And if we' have known at that point, we
would have asked him to vacate at that

that I if Mr. Dodson My understanding is
Mr. Dodson was the when he bought the
[12:22]
plane, it was represented to him that
the lease came with the plane. Now,
[12:25]
whether that was right or not is a
different story. If if
[12:32]
the lease agreement that was in effect
at the time stated that Mr. Dodson would
[12:36]
have had the right to come to this
commission before he consummated the
[12:40]
sale to ask to have the lease
transferred. That that's what should
[12:43]
have happened
and you know I obviously wasn't privy to
[12:48]
all the conversations that took place
but again that's that's what's prompted
[12:52]
this litigation
was that that representation was made
[12:55]
and relied upon and here we are you know
almost two years later. James, can you
[13:01]
tell us where if instead of uh just
taking over that lease incorrectly, if
[13:08]
he had at that point been put on the
hanger list, what number he would be on
[13:12]
the hanger list from that April of 24?
[13:17]
» I was going to say that would be almost
to the end of the list.

My my thinking with that is that um we
have always when
[13:28]
a a lease has been terminated because of
subleasasing we have always ended that
[13:32]
lease unless they have come before us
and asked with the exception of the
[13:37]
recent issue that we had with summit
aviation and if I would say that we've
[13:41]
ever deviated from our policy of the way
we handle things um that was the when we
[13:47]
have made the change for that and our
change was that if that was
[13:51]
misrepresented by Summit that they could
lease those hangers to uh Dr. Sh Dr.
[13:57]
Adams is one that's in my head. Um then
we saw that if he had known that wasn't
[14:02]
an option, he would have been on the
hanger lease or hanger list
[14:06]
» and we would have put him on that list.
So that's that's what we chose to do in
[14:10]
in that specific case. Now, it's a
little different of taking over a lease
[14:14]
and there's no paperwork exchange with
the city versus Summit having an actual
[14:19]
paper lease that those folks signed
saying that they had a space. So, I
[14:23]
don't know if I I could see going both
directions
[14:26]
that he definitely out of the hanger,
but secondly, we could put him on the
[14:30]
hanger list where he would have been if
instead of getting that hanger
[14:35]
incorrectly, he would have asked to be
on the list.
[14:40]
Keep in mind when we're approaching this
that the precedent has been set and if
[14:46]
we're going to make a change here then
we need to look towards the future on
[14:50]
how we're going to address these as
well.
[14:55]
You mentioned the plane was in
litigation um or some sort of dispute is
[15:02]
do we know when that might be does that
void the sale? That's the question I
[15:06]
have. Does it void the sale because it's
still in litigation?

» The the relief requested by Mr. Dodson
in the pending litigation could
[15:16]
theoretically involve the recision of
the sale. Yes.

packet this time um a a price list of
our of our services that we provide um

just for just transparency and everybody
can see what's going on and

that's what those numbers are. So, this
is a direct reflection of what we keep

behind the the counter.

I'm retiring at the end of April. And
the city council has already passed a

resolution appointing Garrett Harlland,
city attorney, effective May 1st. He's
[20:39]
already started working uh with me,
started last week. And so you will be
[20:44]
left in fantastic hands. I think many of
you know Garrett already. He worked in a
[20:49]
city attorney's office previously. Uh he
most recently was serving on the city
[20:53]
planning commission.
So, and he's running for city attorney,
[20:57]
and I think he'll do a great job.

start with Mr. Steve Clark from last
[21:16]
month's meeting. Steve Clark was able to
keep his hanger. So, the few people that
[21:21]
are above him did pass on that hanger,
and he's now the new lease holder
[21:24]
effective February 1. So, we're happy
about that. Uh, we also did have, as far
[21:30]
as rent goes, we had three past due
tenants and they were contacted, so they
[21:34]
should be working on getting paid up.
And, uh, I guess the last thing I'll
[21:38]
talk about, so a couple of months ago,
James and I had reached out to our fire
[21:43]
department. We figured that with
everything going on and big things
[21:46]
happening here at the airport that it
would be a good idea to, you know,
[21:51]
reconnect and restrengthen that
relationship with our fire department.
[21:55]
So, and as well as update making sure
that our emergency plan is current. So,
[22:00]
we kicked that off with airport tours.
We brought the whole department through.
[22:04]
We did six individual tours to do that
and uh we had a good time. It was very
[22:09]
informative for everybody and it was it
was it was a very good deal. Next steps
[22:13]
in that will be running tabletop
discussions and scenarios and then
[22:18]
hopefully after that we'll be running
some active training exercises out on
[22:22]
the airfield. So, but in saying all
that, I'd like to take a minute real
[22:26]
quick to thank Joel Gardner and his team
at OT. You know, we appreciate Joel
[22:30]
supplied a a bus for us to go up and
down the taxiways and the runways and go
[22:36]
look at the proposed National Guard
facility. So, we thank you for that. And
[22:40]
uh I'd also like to thank Brian over
here. So, Brian played a played a pretty
[22:45]
big role in that too, helping out on the
tours. And boy, I tell you, we were a
[22:48]
pair of a couple of master tour guides
by the end of all that. So, but it was
[22:53]
fun. But anyways, I just wanted to fill
y'all in on that. I'm pretty excited
[22:56]
about that. And that's all I got.

in the field for the last couple weeks.
So, it's been nice seeing those

helicopters flying around. So, um,
Austin is working on more insurance
[23:21]
claim from lightning strike we had a
month or so back. So, apparently it's
[23:25]
taking out more than just our approach
and papies. It's hit some of our sign
[23:29]
boxes. So, he's working with Saber in
the city clerk's office to get that all
[23:35]
back up and running. Um, operations were
still up from last year a little bit.
[23:40]
Um, like I said, fuel sales is down.
Other than that, everything's still
[23:44]
going great.

Chairman. So, James, uh, some numbers
[23:50]
from yesterday. So, we were talking to
the tower yesterday and, um, 80 counts
[23:57]
per clock hour um, getting over that.
They consider that a little bit of um,
[24:02]
safety issue with only having one person
in the tower. Yesterday, they hit 77
[24:09]
multiple times per clock hour yesterday.
And due to the military being there,
[24:13]
nice weather, all that stuff. So, you
know, the traffic is increasing big time
[24:19]
up there. So,
[24:23]

» Good afternoon, everyone. Let me just
see if I can get this plugged in really
[24:34]
quick. Uh, I don't have too too large of
an update for you all today. Um, we've
[24:39]
got two active projects, the uh,
strategic plan and the tower
[24:42]
rehabilitation. Here it comes. Um I'll
talk about the strategic plan real
[24:47]
quick. Um this one we we kicked it off
in September with the visiting session.
[24:50]
Had another meeting in uh in January.
Our second meeting was in January. Um
[24:55]
where we compared uh the the we compared
Springdale's airport to to other
[25:00]
existing airports. Looked at their
facilities. Looked at other businesses
[25:03]
on the airport. Um we also started to to
brainstorm what type of businesses and
[25:08]
facilities we'd like to bring to the
airport. um and also looked at uh the
[25:12]
land use um in and around the airport
and how we could potentially utilize
[25:16]
that to uh to grow. And so um with our
next meeting which is scheduled for
[25:20]
March, we're planning on bringing um
exhibits on land use alternatives. So
[25:25]
this will be really what the strategic
plan, this is going to be the meat of
[25:28]
the strategic plan. We'll start to see,
hey, where can we start looking to build
[25:32]
new hangers? Where can we infill and
maybe utilize some of the unused space
[25:36]
um at the airport now? So, um, March
20th is when that next meeting is. So,
[25:41]
um, I should be able to have some
exhibits ready, um, for, you know,
[25:44]
feedback, um, for that meeting. Any
questions about the strategic plan or or
[25:48]
what we've accomplished so far?
>> Awesome. So, for the tower
[25:53]
rehabilitation project, um, you know,
it's been ongoing for for quite a while
[25:57]
now. Back in December, um, I reported
some, uh, quality issues with, um, a lot
[26:02]
of the mill work, a lot of the cabinetry
um, in in the tower. Um, we we worked
[26:08]
with the contractor. I know Micah was
there. We also James and Austin, we
[26:11]
worked with the contractor to put
together a plan to get a lot of that uh
[26:15]
quality issue um
sorted out. Um, and we were able to to
[26:20]
get the contractor to uh clear up all of
the cabinet issues by uh January 22nd,
[26:25]
which is when we had a final inspection
and punch list walk with the contractor.
[26:30]
We we identified a handful of items um
in that January 22nd meeting. uh most of
[26:34]
them related to um some of the the
drawers and plexiglass that goes along
[26:39]
the bottom of the tower. And I can
actually show you some pictures of that
[26:43]
real quick.
Um these are the these are the final or
[26:47]
these are pictures from earlier today of
the tower. So there's some plexiglass
[26:50]
down here that that was a little um
wobbly that that we were able to get
[26:55]
sized correctly. Um otherwise the only
outstanding punch list item is an
[26:59]
emergency radio. Um that's just on back
order right now with with the
[27:03]
manufacturer. We expect that to be
delivered in March. So that clears up
[27:07]
the whole phase one of the project, the
FAA money. Um we also talked about a
[27:11]
second phase of the project with um some
of the state grant that we received for
[27:16]
uh a generator, emergency generator and
also um HVAC. Um in this meeting with uh
[27:22]
the the tower and the controllers, we
also identified a few other items. We're
[27:25]
going to pick up some new chairs for
them um as well as make some lighting

adjustments and give them a nice dimmer
switch so that they can make adjustments

um for some of their evening operations.
So, um that phase two is under contract.

Um right now we're working on on getting
them scheduled. Um and we do expect a
[27:42]
little bit of a of a lead time on that
generator as it's something that's
[27:45]
probably going to be six to eight weeks
out is what we is what we anticipate.

>> Leaking? Um they're sealed with duct
[28:09]
tape on several spots. We have uh wasps
that make pretty frequent visits in the
[28:15]
summertime. and
>> air flow. You can just feel air blowing
[28:19]
through the duct tape that we've used to
seal those.

» I can go ahead and answer that one,
Greg. So, with our insurance, with the
[28:25]
company that we have coming in to put a
new roof on the tower, they have agreed
[28:30]
to seal all the windows at no extra
cost. So, they're going to go ahead and
[28:34]
do that while they're up there doing the
work.

Do you I think we after that then we
need to talk to Mike or be there during
[28:42]
a good rainstorm and see if we're still
having a lot of water intrusion because
[28:46]
obviously walking up through there
there's a lot of if you go in the rain

it's dripping all around you and if uh
you look around at some of the wood the
[28:54]
plywood or whatever they used I guess
just to kind of stop some of the rain
[28:58]
that's even rotted through that. So, I
know I know James has tried in the past

and we've had other people come look and
we're just not able to figure out how to
[29:06]
seal this thing. Um, maybe window
sealant will help. It's just hard when
[29:11]
it's a metal building. But, um, and I
think we are, haven't we resealed the
[29:16]
tower before? I think, and I want to, of
course, I don't want to get to speak,
[29:21]
but I think the contractor is also going
to seal the tower before they repaint it
[29:25]
as well. So, I think they're going to go
through and seal the whole entire tower.

I know for sure they're doing the
windows, but I'm I'm kind of leaning on
[29:32]
them to do that. I'm trying to get as as
much little extra stuff out of them as
[29:36]
we can.

Uh yes, from the final inspection, we we
really pestered him about, hey, let's

updating the contacts and phone numbers

in it, but working with the fire
department, we wanted to make sure

everything was correct. So, I thought
