A little bit left. That tells you that
it's the right dimension. It's funny how
[0:18]
the things the numbers work.
>> Recording in progress.

[1:17]
Um, tonight in person, we have Tim
Thompson, Mike McGovern, Jamie Marin,
[1:22]
myself, Bill Wentz, our consultant,
Brandon Fanf, uh Jared Deval is not
[1:27]
available tonight. And to the public or
anyone on Zoom, is anyone recording this
[1:33]
meeting?
And I'm seeing no one raising their hand
[1:37]
online. Okay. Um, first up, 6 PM. This
is a continuation for 11 Cody Lane.
[1:45]
» I'm going to recuse.
>> And Mike is recused on this one. Welcome
[1:48]
back, Ra.
>> Thank you. I think it was approved last
[1:51]
meeting.
We're done with this one.
[1:54]
» That's what I thought.
>> I thought so, too. Um, Sarah is no
[1:58]
longer with the town of Sutton and I
went through the minutes. It's on there.
[2:04]
Did it say it's approved?
>> Yeah.
[2:06]
» Yes.
[2:10]
» Where's one?
>> 11 Cody Lane, but it says motion to
[2:13]
continue the public hearing.
>> You voted on it last week.
[2:17]
» Oh, yeah.
>> 400 Z.
[2:20]
» It is.
>> Motion carries.
[2:23]
» So, we need to when we get to the
minutes, we need to amend the minutes.
[2:26]
» We need to amend the minutes. So, yeah.
I kind of thought everything was done on
[2:30]
this, too. I hope that's not the only
reason you came in. No, I'm I'm here for
[2:33]
two other meetings.
>> Okay, perfect. All right, so um I guess
[2:38]
we'll just amend the minutes. Is that
the quickest thing? Okay,
[2:41]
» perfect. Thank you guys for picking up
on that. All right, next up at this is
[2:46]
also at 6 o'clock. Uh notice of intent,
a continuation for 354 West Sutton Road,
[2:52]
single family home and associated
facilities.
[3:11]
Good evening.
>> Welcome back.
[3:14]
» Thank you. You got the B team tonight.
So, for the record, Margaret,
[3:18]
» they did well in that class.
>> They did a very good job. I was very
[3:20]
proud of them. Um,
so for the record, Margaret Bacon, Civil
[3:25]
Site Engineering, and I have the uh the
property owner, Mark Mike Perso with us
[3:31]
to meet you.
>> Um, and so I did watch the video, so I I
[3:35]
I got a a sense of the commission's uh
comments and concerns. So I I did revise
[3:41]
the plan,
and the big issue was the storm water.
[3:47]
And I I heard Mike McGovern's comments
regarding, you know, putting something
[3:53]
over here and and preventing the storm
water from getting to the street. So So
[3:59]
what I did here on this plan, this
hasn't really changed at all. Uh up here
[4:05]
where we have the uh I have the erosion
control and then I put the uh the
[4:11]
additional shrubs we're going to plant
to make up for the trees we were cutting
[4:14]
down. I've got a little burm there. Just
a one foot burm. So I don't have to
[4:20]
worry about this water coming down the
hill. That's going to go that way. Uh so
[4:24]
any water. So the only water I have to
deal with is what's on the site. So I
[4:29]
have that little swale here. I moved
that that rain garden down here. I moved
[4:33]
the driveway up so it it would work a
little better. And then under and this
[4:38]
if it reaches capacity, which during the
big storms it will. Um I have a little
[4:45]
a culvert under the driveway
>> and each side of the culverts I got
[4:50]
little plunge pools or little stone
lined plunge pools and then under the uh
[4:56]
this water will go into the driveway and
then it's going to eventually go into
[4:59]
the wetland and not into the street and
then over here on this side of the
[5:04]
driveway I pitch the driveway a little
more so that all that water from the
[5:10]
driveway will hit a stone line swale and
that too going to discharge over here.
[5:17]
And because of the the way the existing
topography is, I mean, here's kind of
[5:22]
like a natural swale that heads down
this way. So, I I had to try to tie into
[5:28]
that. And that that's kind of why I've
got extra plans here. Would that be
[5:32]
helpful?
Big plans for anybody?
[5:36]
» I'm following along. I'm good.
>> Let's see. Yep. I'm following along.
[5:40]
» So, so those were the big ones on the
storm water. I'm capturing everything or
[5:44]
controlling everything on the site and
this water off the site I'm keeping it
[5:49]
off of the site. And then the other one
I think I heard about the placards. You
[5:54]
no longer want placard. So I removed the
placards.
[5:59]
And then I still have to meet with the
tree warden regarding the trees and the
[6:04]
planning board regarding the stone wall
and the the scenic bylaw.
[6:09]
» So I think that addressed everything
>> I believe. So,
[6:14]
» um to Jamie
>> question real quick. The additional
[6:17]
plantings I saw a copy of the plan. I
don't know when that was revised, so I
[6:21]
don't know if I was looking at the
today.
[6:22]
» Yeah.
>> The previously you had included some
[6:26]
additional plantings along the edge of
the limited disturbance, but they
[6:29]
weren't uh included in the table. The
table just had the plantings for the
[6:34]
rain garden.
>> No, here here the here's the planting
[6:36]
scheme.
>> Okay.
[6:37]
» Uh right down here. Basically, it's high
bush blueberry, winter berry, and some
[6:42]
uh red maples.
>> Okay, that's my only question.
[6:45]
» Y
I'm good. Anybody from the public or
[6:50]
anybody on Zoom tonight have any
questions?
[6:53]
» Brandon, did you have anything to weigh
in on?
[6:55]
» Nim,
[6:58]
you want to do the motions?
>> Uh, sure. [clears throat]
[7:01]
I'll make a motion to close the public
hearing for
[7:04]
uh 354 West Sutton Road.
>> I'll second it. Tim made a motion to
[7:09]
close the public hearing. Mike seconded.
Tim vote I.
[7:11]
» Mike vote.
>> I vote I.
[7:12]
» Jamie Addi vote.
>> And I bill vote I.
[7:15]
» I'll make a motion to issue a
certificate of compliance for three
[7:21]
» order of conditions.
>> Oh yeah. Got ahead of myself there.
[7:25]
» Got the project done for you.
>> Been a couple weeks. An order of
[7:27]
conditions um for 354 West Sutton Road.
>> I'll second it.
[7:33]
» Do we have a D number? Just say this.
>> Yep.
[7:35]
» X's. There is a D number for this,
right? Correct.
[7:38]
» Okay. It's still just saying access. Do
you know what it is off? Just so we can
[7:40]
make
>> Yes. Yes, I do. I have it with me. Hang
[7:43]
tight.
[7:54]
» It's got to be like 1041, 1042,
something like that.
[7:58]
» You know, they issued one. I don't Hang
tight. Here it is.
[8:04]
uh 303
uh 1039.
[8:08]
» Okay.
>> And no comments.
[8:09]
» Okay. Perfect. So Tim made a motion to
issue order conditions for DP 1039. Mike
[8:14]
seconded. Tim, how do you vote? I
>> Mike, how do you vote?
[8:17]
» Vote I.
>> Jamie, how do you vote?
[8:18]
» I Bill vai. Thank you. Good luck with
the project. Have a great night.
[8:22]
» Thank you.
>> And these revised plans, should I leave
[8:24]
them with you, Brandon?
>> Nope.
[8:27]
» We don't need it.
>> Oh, you can leave them here. Yeah.
[8:29]
» Yeah. Yeah,
>> I can put them in the folder.
[8:31]
» Okay, perfect. Thanks both for coming
in.
[8:33]
» Yep. Thank you.
>> Uh next up is a discussion an RDA for 11
[8:38]
Spring Hill Road as septic system
upgrade. Welcome back.
[8:42]
» Thank you.
[8:48]
» Brenda, can you bring it to Mr.
>> Oh, you know what?
[8:51]
» Once again, I forgot Chris.
>> Yeah.
[8:54]
» Failed to remind me. That's why
>> you get on Zoom.
[8:58]
» No, I did send it to you, didn't I? No,
but I just sent it to you. Did you get
[9:02]
it?
>> Uh, probably.
[9:03]
» I just emailed it to you.
>> Give me a second. I'll put the plan up
[9:06]
on the the screen.
>> Sure.
[9:10]
» Go ahead and talk.
>> It's a septic system repair uh in a
[9:15]
grass area. Um,
we the land is large, but there is a
[9:20]
problem that we if we put it away from
the wetland, we're going to be a pump
[9:24]
system and we'll be in an area where he
keeps his animals like he has some pigs
[9:28]
and cows. So, we're trying to get it as
a gravity system and also
[9:33]
stays within the lawn area so we don't
have to cut any trees. And I think the
[9:36]
the location we're proposing is the best
location for the septics. They were not
[9:40]
cutting any trees. It's a very simple
septic repair.
[9:42]
» Okay.
>> Brandon's pulling that up just to
[9:45]
repair. And currently grass, no tree
cutting. Yeah. Pretty straightforward.
[9:49]
While Brandon pulls that up.
>> Yeah. even without showing the plan or
[9:52]
the pictures. Um, this was uh a
no-brainer except for two things that
[9:57]
concerned me. Um, again, it's all lawn.
It's like beautiful manicured lawn that
[10:03]
this is going to go in, but it's on a
slope. It's like on a moderate slope and
[10:06]
the wetland's at the bottom of the hill.
So, on the plan, it reads uh straw
[10:12]
waddle silk fence combo.
>> Uh, I think just to be safe on on the uh
[10:17]
the determination form, uh, It would be
a negative determination with conditions
[10:22]
and just just to you know belt and
suspenders right in there make a motion
[10:26]
that uh uh the uh erosion control shall
consist of the double line of silk fence
[10:32]
and straw waddles as just be
precautionary. Yeah. Uh, the other thing
[10:38]
too was, uh, not that I need to give Joe
Bolino a pro tip,
[10:43]
but on the wetland flagging,
um, he started it at a point that didn't
[10:50]
quite go over as far as he needed.
You're nodding your head.
[10:53]
» Yeah.
>> So, so when I see something like that, I
[10:56]
want to know where the wetland's going.
And I wish he had done like one or two
[10:59]
more flags to show that the wetland
wraps away from the house.
[11:03]
» The lot line is very deceiving. So he
got confused with the lot line because
[11:07]
it's it's very angled. But
>> when when given that opportunity, show
[11:10]
how the wetland curves away.
>> Sure.
[11:13]
» And that way there's no question because
when you just see it on the plan, you're
[11:16]
like, where's the wetland line going?
>> Okay.
[11:18]
» Yeah, sure.
>> All right. Let me bring it up.
[11:20]
» I have a dumb question. Was this all
filed?
[11:24]
» Yes.
>> Okay. Because it's just under as
[11:25]
discussion, but
>> with a bunch of changing hands, I just
[11:28]
wanted to make sure it was listed
properly. Okay.
[11:32]
» Yeah. Okay. Here it is.
>> I thought it was, but
[11:35]
Okay.
Uh, it's it's on a street that I have
[11:40]
never been on.
[11:44]
And come on. Where is it? Go. Backyard.
And big backyard. This is the area. What
[11:51]
am I? What's going on?
>> Well, uh,
[11:54]
» the client owns under like a different
name the whole farm around it. So, the
[11:59]
the farm around the whole area is also
owned by the client.
[12:04]
Let me turn off the light.
>> Did I share the wrong one?
[12:09]
» I'm fine.
>> You're fine.
[12:10]
» I hate to dig up that lawn. It's a
beautiful lawn.
[12:14]
» Well, it's going to be lawn again.
>> So, the the system's going to go in this
[12:17]
area here.
>> Yes.
[12:19]
» Okay. So, you know, it it looks I guess
suppose it looks flat from the angle I'm
[12:23]
taking it, but it's not. It's like a
what? 6% slope, maybe.
[12:27]
» About Yeah.
>> Yeah. About 6% slope. And right at the
[12:30]
bottom here is the wetland. It's a nice
wetland. There's a lot of sugar maple in
[12:34]
there, too. Is a very nice wet wetland.
So, if anything happens here, and he's
[12:38]
going to do some grading. So, if
anything happens, uh it's going to shoot
[12:42]
right down into here with with no stops.
Okay. So, this is why I think it's
[12:46]
important to have uh a condition that
they do the the double line.
[12:54]
So,
and this is our nice wetland,
[12:59]
very healthy wetland at the bottom of
the hill.
[13:02]
and then looking up at the edge of the
lawn. So, and then looking back up. So,
[13:07]
this gives you the idea of what the
slope is.
[13:10]
Otherwise, uh, one of the easiest
inspections I've ever done.
[13:17]
Anybody want to see the plan?
>> I would like to.
[13:19]
» Okay.
[13:30]
And system plan,
[13:36]
» Ralph, your plans always come like
vertical and I have to turn them. Why is
[13:40]
that?
>> Keep you on your toes.
[13:43]
» You can rotate it in the screen.
>> And where' it go? Here it is. Okay. On
[13:50]
its way.
[13:54]
Here we go.
[13:58]
Spring Hill Drive right here. It's a
dead end. Uh
[14:04]
hello. Where did my thing go?
If you go down, it's a it's a it's a
[14:11]
dead end. And the house is here. They're
putting the system a little bit off to
[14:16]
the right. Here's the wood line. But,
you know, they got some grading going
[14:19]
on. So, I want to make sure that the
wetland is protected down here.
[14:27]
through the chair.
>> Yeah.
[14:30]
» Because you're going to follow the self
fence line, right? That's on the plan.
[14:33]
» Yeah.
>> So, the only difference is he's
[14:37]
recommending that that we double it. It
just shows a single now.
[14:41]
» It It shows It shows the detail, right?
Which is great.
[14:44]
» And it shows the whole line, right?
>> Yeah.
[14:47]
» Right.
>> Yeah. It wraps around the whole the
[14:49]
whole area.
>> Yeah.
[14:50]
» Yeah.
Okay. So double it up.
[14:57]
» Is there one spot that would see more
than another?
[15:01]
» I mean it's it's a it's a very
straightforward area and I don't think
[15:05]
it's going to take time for installing
the septic maybe a week maximum.
[15:09]
So I I mean we can uh can be a condition
that uh
[15:13]
» I mean you're going to be there doing
inspections very you're going to be
[15:17]
there doing inspections periodically?
>> Yeah. Yeah. So it's just saying double
[15:21]
the whole thing is a lot of work. Can we
just say that
[15:24]
» double the area where the water flow
would hit? Is that And you I know you'll
[15:28]
keep an eye on it.
>> Yes.
[15:30]
» Right.
>> I'd be okay with that. So kind of pretty
[15:33]
much approved as by plan.
>> Just keep an eye on the
[15:37]
» you just keep an
>> Yeah. Double up when needed.
[15:41]
» Okay.
>> So it's an RDA. We just get a
[15:44]
determination.
Um, so I I do have Does anyone in the
[15:48]
audience have questions before we go to
vote? And I Jared online has a question.
[15:54]
» Jared, your hands raised. If you have a
question on this one,
[15:59]
» I did not have a question about this. I
just want
[16:02]
I needed to be here for the meeting
tonight.
[16:06]
» It's on the agenda.
>> It's on the agenda. So, it will be
[16:08]
coming up in a few minutes if you if you
want to hang out.
[16:11]
» I don't think he needs to be here. I can
give an update. Oh, you uh Jamie's
[16:14]
saying you do not need to be here and he
can give an update for us. So,
[16:19]
that will do it.
>> Okay. So, I can log off.
[16:21]
» You can log off. Have a great day.
>> Thank you.
[16:23]
» Thanks, Jared. [snorts]
>> You, too.
[16:25]
» All right. Any questions on 11 Spring
to the board, to the public? Okay.
[16:33]
Um, [clears throat] I'll make a motion
to issue a negative determination for 11
[16:37]
Spring Hill Road um with the condition
that a double silt fence be placed
[16:45]
where the peak water flow where where
needed. Is that what we're going to say?
[16:48]
» I'll second that.
>> Uh Tim made a motion. Mike seconded.
[16:51]
Tim, how do you vote?
>> I Mike, how do you vote?
[16:53]
» Vote I Jamie, how do you vote?
>> I Bill vote eye.
[16:56]
» Thank you.
>> Thank you. Have a good night.
[16:59]
Uh, next up is 400 Boston Road and this
is a septic system repair. Is anybody
[17:04]
here for 400 Boston Road or anybody
online?
[17:10]
» Uh, raise your hand if you're online for
this one.
[17:14]
» Liz is online.
>> Is Oh,
[17:17]
» okay.
>> Hi, Liz. Uh,
[17:19]
» hi.
>> The floor is yours.
[17:21]
» Okay. [laughter]
[gasps] I couldn't find the hand. Um,
[17:25]
yeah. And my client is there. Can you
hear me? Okay.
[17:29]
» Yes, we can.
>> Okay. Um Gary's there in the uh in the
[17:33]
audience. Um so septic repair on this
property. We were we're really squeezed
[17:41]
in between the wells and the wetland and
the limited space on the property. Um
[17:47]
but we fit in an advanced treatment
system. This is a Perkrite system and it
[17:52]
has um advanced nitrogen and phosphorus
removal. It's kind of like an irrigation
[17:58]
system. It almost um transpires before
it even infiltrates. Um but between that
[18:04]
and the wetland, we have a stone wall.
Um the entire system is on the lawn. We
[18:10]
have proposed erosion controls and um
Joelino was my uh my um wetland person
[18:19]
there and it is also an isolated
wetland. Um, so
[18:27]
do you have any questions?
>> Liz, thank you. Um, Bren, did you want
[18:32]
anything to add on this one?
>> This This wasn't one of my 53g jobs.
[18:36]
» It wasn't. Okay.
>> So, I don't I don't even know anything
[18:39]
about this job.
>> Do Did you send a site plan in on this?
[18:43]
» I did.
>> Brand is looking through the file now to
[18:47]
see if we have anything.
>> Well, I do have I I did download it.
[18:51]
» Okay.
>> So, I do have it. So, I can bring it up
[18:52]
if you want, but I did not involve with
review.
[18:55]
» Okay. If you wouldn't mind bringing it
up. No
[18:57]
» problem.
>> Thank you.
[18:59]
» Okay.
>> Thanks for your patience, Liz. We had
[19:01]
some changes here in the office, so
we're just
[19:04]
» Sounds like it. Yeah.
[laughter]
[19:08]
» But it's going to pull up the plan for
us to do a quick review on this for you.
[19:12]
» Okay. See,
>> that one's done. See, it was it was uh
[19:17]
four 400 400 Boston Road.
Okay, I gotta go. Give me a second. I go
[19:23]
looking for it. I gotta go.
>> You know what? I'll check the files now.
[19:29]
» Yep. And now
you might want to pull the other two
[19:33]
because you got to sign those two if you
can find them.
[19:35]
» Yeah,
>> I was That's what I was just doing.
[19:49]
Okay. Okay. So, so this is an RDA,
right?
[19:51]
» Yeah.
>> Okay. Yep.
[20:00]
» Um
I don't see a a site plan. Is there a
[20:07]
site [clears throat] plan associated
with it?
[20:11]
» It's a question to Liz through the
chair.
[20:14]
» Oh, wait. Soils and wets on wetland map,
but I don't actually have a site plan.
[20:21]
» Bring it up. That would work. It'll get
us through the meeting.
[20:24]
» Yeah.
[20:30]
» You want me to try to open it on my end?
>> Well, you know what? That's great. If
[20:34]
Chris can give you permission.
>> No, I got something.
[20:37]
» Uh, it might take me a second, though.
the details of the
[20:53]
» one.
>> No, not really.
[21:03]
» All right, we're back online. We We have
a plan.
[21:06]
» Do you have it?
>> Yep. Thank you. And this was submitted
[21:09]
um either right before or right after
Sarah. So going to just take a quick
[21:15]
couple minutes to look at the plan. If
you want to just give us an overview
[21:18]
while we're looking of what's going on
with 400 Boston.
[21:22]
» Okay. Um
>> concerning.
[21:24]
» No, I know the question is whether
they'll be located here or located here.
[21:30]
» So you can see the wellheads the well
the the protection zones of the two
[21:34]
wells.
Can you you guys listen to Liz?
[21:37]
» To do with gravity, you have to make a
big pumped mount.
[21:45]
» It's already pumped.
You see?
[21:47]
» Yeah, we're pumping it. It's a pressure
system.
[21:52]
Uh no reduction in groundwater um
because we're in the wellhead zone.
[21:59]
We just have uh lateral reduction
requests.
[22:03]
That's a
>> Oh, yeah. It's there.
[22:08]
» Um,
>> Liz, is this the area you're working in?
[22:12]
Are you cutting any trees down? What's
the condition of the property now?
[22:16]
» It's all lawn right there.
>> It's all lawn. Okay.
[22:19]
» All lawn. And um the only only uh
there's some bushes around the house
[22:23]
that will come out.
>> Okay.
[22:27]
She's
>> for the tanks.
[22:33]
It's a repair. It's an all lawn. It's
seen.
[22:36]
» She has erosion controls.
>> It's a replacement.
[22:38]
» No, it's a repair.
>> Subject system repair.
[22:42]
» Existing house.
>> Yeah.
[22:43]
» This is not
>> And you can see the size of that
[22:46]
property is just
>> it's a repair.
[22:49]
» Looks pretty good.
>> Yep.
[22:51]
» She has everything covered. I mean,
there's not a lot of slope. There is
[22:54]
some slope
>> towards the wetland.
[22:55]
» But then that there's also a two-ft
stone wall along that property line
[22:59]
between the between the project and the
wetland.
[23:02]
» Okay.
>> And that wall staying.
[23:04]
» Yes, it is.
>> Perfect.
[23:05]
» They got the version controls in front
of it.
[23:07]
» Yeah. Yeah. Good. I'm just wanting on
wrecky because we're not we can't see
[23:10]
anything. Tim, do you have any
questions?
[23:12]
» Oh, did you want to see?
>> No, no. I saw I'm just saying the public
[23:15]
can't see it right now.
>> Uh Jamie, Mike, do you guys have any
[23:18]
questions?
>> No questions. Does anyone from Zoom or
[23:20]
the public have any questions on 400
Boston Road?
[23:28]
» I'm good.
>> We keep this for the file.
[23:29]
» Go down.
>> We have one. We have one. This is the
[23:31]
one in file. Yep.
>> Which is where?
[23:34]
» Right there.
>> Oh, yeah.
[23:36]
» All right. I'm good.
>> Now go to discussions.
[23:40]
» I'll make a motion to issue a negative
determination
[23:43]
» for [clears throat] uh 400 Boston row.
>> Gotcha.
[23:46]
» I'll second it. Tim made a motion to
issue a negative determination for 400
[23:50]
Boston Road. Mike seconded. Tim, how do
you vote? I
[23:52]
» Mike, how do you vote? I
>> vote I.
[23:53]
» Jamie, how do you vote? I
>> And I, Bill, vote I.
[23:55]
» Thank you. Thanks for your patience and
uh with this one, Liz, good luck on the
[23:59]
project.
>> No problem. Thank you very much. Have a
[24:01]
good night.
>> All right. Yeah, that one will go back
[24:05]
in the file.
And before we all leave tonight, we got
[24:09]
a bunch of stuff we'll need to sign.
I'll have to pull it all. I just don't
[24:11]
want anyone to run off. Okay. So, the
minutes, uh, Sarah did do the minutes of
[24:15]
July 22nd, 2026. and the minutes of
8526. We do have one correction on 85
[24:20]
that we issued an ORAD for 11 Cody. Um,
did everyone else review the minutes of
[24:26]
the two meetings that we feel?
>> You're going to on Cody, but are we
[24:31]
comfortable with approving the minutes?
>> Um,
[24:34]
or do we want more time to review them
with corrections?
[24:37]
» I'm pretty sure I wasn't actually at the
July 22nd meeting. Oh, we listed you
[24:42]
» in every vote and oh
>> present, but I pretty sure I I missed
[24:48]
one in July and I think there was only
one in July. So
[24:50]
» yeah,
>> this was at the last meeting.
[24:52]
» No, it's two minutes. The last meeting
>> you were you were at the 85 meeting via
[24:56]
Zoom.
>> Yeah, July 22nd. I was there.
[24:58]
» You weren't here July 22nd. Okay.
>> So we should
[25:02]
» correction. Okay.
So we have corrections on the July 22nd
[25:07]
26 meetings. Removed him because he was
not here for any of the meetings.
[25:12]
uh and clean up the vote.
And on the 85
[25:17]
26 meeting correction on 11 Cody to make
it a motion we issued an ORAD. It just
[25:23]
said we continued for the public
hearing. So just a couple changes. Are
[25:26]
there any other changes or things we
need to discuss on minutes?
[25:29]
» Okay.
[25:33]
» We should do them separate, right?
>> Yeah, I would just because of the
[25:36]
corrections.
>> I wasn't here for this one.
[25:38]
» Yeah, Tim wasn't here. Someone else
>> I got to recuse. So you won't have a
[25:41]
quorum.
>> No, Cody wasn't the LA the 22nd.
[25:45]
» It's just cool if it's
>> Cody was August 5th.
[25:47]
» No. No. Yeah.
>> Anything to do with Cody Lane? I can't
[25:49]
vote.
>> Well, you can vote on the minutes
[25:51]
though.
>> Oh, this is just voting on the minutes
[25:53]
with changes. Yeah. Yeah. No, no, no.
You're fine. Yeah. No, you're being
[25:56]
clear. That's good.
>> But
[26:00]
» Kim was saying, so if you want to make
the motion
[26:01]
» I was here. I did see I I saw it with my
own two eyes that it I was here for the
[26:04]
meeting.
>> Okay. Okay. So, you're making a motion
[26:06]
to approve the minutes of
>> I'll make a motion to approve the
[26:08]
minutes of 7226 and 8526 with the
>> change.
[26:14]
» Oh, vote on the 22nd.
>> So, do the 22nd
[26:19]
» with correction
>> motion first and then the 85 with
[26:22]
correction second.
>> The one Yeah, go ahead. Have you got it?
[26:27]
» Uh, I'll make a motion to approve the
minutes for 7226.
[26:32]
I'll second it
>> with the corrections of 7:22.
[26:35]
» No, the corrections are on 85.
>> Yeah, but Tim wasn't here for 22. We got
[26:39]
to correct that.
>> With the correction of removing Tim from
[26:41]
attendees at the meeting of 7:22.
>> That easier if you That's what Yeah,
[26:45]
that's
>> okay. So Jamie made a motion. Mike
[26:48]
seconded July 22nd meeting removing Tim
as voting. Jamie, how do you vote? I
[26:54]
vote I. Mike, how do you vote? And I
bill vote I.
[26:57]
» Now we need a motion to approve the
minutes for 8526.
[27:01]
And that's the one where we have to make
>> the correction. Just
[27:04]
» correction for the Cody Lane was
approved.
[27:07]
» Was approved. Yep. Is that a motion?
>> That's a motion.
[27:10]
» Second.
>> Mike made a motion to approve minutes of
[27:12]
85 with corrections on Cody Lane. Jamie
seconded. Mike vote.
[27:15]
» I vote I
>> Jamie Addy vote.
[27:17]
» I vote I and I vote I. Thank you all.
>> That was the most difficult motion for
[27:22]
minutes ever. [laughter]
>> Ever. Well, it's the only time we've
[27:25]
ever had correct two minutes two forms
of minutes. Uh, next up is a quick
[27:31]
billing. I literally just had it here.
1,600 bucks for Brandon.
[27:38]
» I'm just sorry, that was a bill.
>> No, that's an old one. This is uh 1,604.
[27:43]
You guys want to review it
for work already done? We don't I'm just
[27:48]
bringing it up. We don't need to vote on
it. Certificate of compliance for 231
[27:52]
Manchog Road, 0825. Brandon, I think
this is the one I talked to you on. It's
[27:56]
from a buddy years ago.
Uh yeah, I don't have any of the
[28:00]
certificate of compliance uh documents
here, but I I do have the old plans if
[28:06]
» Yeah, but I believe we got everything in
and um it was in substantial build. I
[28:12]
believe
[28:16]
» you guys want to look at the bill.
[28:27]
» This is
Which one?
[28:29]
» It's on meeting materials
>> under meeting materials in here.
[28:37]
» Online.
>> Online. Okay.
[28:43]
» Okay. Which one are we looking for?
>> 231.
[28:46]
» I think that I'm under. It's directly
across the street from me.
[28:50]
» I'll have to excuse myself if we have to
vote.
[28:54]
» It's close enough for me to Bill. I
think I'm a direct debut to that. Like I
[28:59]
think it's across the street from me.
>> You should probably
[29:01]
» Yeah. Just I wouldn't want
>> Is anyone here for 231 manug?
[29:05]
» I don't think so. I think we should just
probably table that one till we can
[29:09]
» raise their hand.
>> Raise your hands if anyone
[29:13]
would only be Wayne.
>> So what I can do is out of my own stash
[29:19]
I have just to get a I have all the the
forms. So if you want to do it, you can
[29:24]
at least have something to sign.
>> Okay.
[29:25]
» Okay. So just just tell me.
>> I'm going to recuse. I'm going to
[29:27]
recuse. I mean,
>> this is a completed project. We had I
[29:30]
saw it earlier today. We had a letter
from the engineers of of complete
[29:34]
buildout.
>> Everyone okay with that? Mike's excuse.
[29:42]
» I'm okay with it if if you saw it.
>> Yeah. Yeah, I did. I just don't know why
[29:45]
it's not
>> Yeah.
[29:49]
» Okay. I'll make a motion to issue a
complete certificate of compliance for
[29:53]
231 Manch Road D number 303 0825.
[29:59]
» I'll second.
>> Tim made a motion to approve 231
[30:02]
Manchark Road. Jamie seconded um vote I
>> J vote I bill what I Mike was recused as
[30:09]
he's in a butter.
Uh ratify an emergency order for 128
[30:13]
Arms Road.
[30:18]
Does anyone even know what this one's
about?
[30:19]
» Yeah. I didn't even know what that
>> There's a couple things.
[30:22]
» Oh, this is the beaver dam, I be
believe.
[30:25]
» Oh, yeah. Yeah.
>> And I thought we already ratified this.
[30:31]
» That's coming from the town, right?
>> That's a town. Yep.
[30:33]
» Yeah. No, that you're right. It's the
beaver receiver that they installed.
[30:37]
» Oh, I found 231.
>> You found it. Look at that.
[30:41]
» It's not a It's It was under
discussions.
[30:44]
» Yeah. Oh, we have but we have everything
for
[30:47]
» two folder.
>> But here if you could just keep them
[30:49]
together that'd be great
>> with the when you sign
[30:54]
» any
I mean that the whole beaver thing's
[30:57]
done right
>> you reproduce.
[30:59]
» Yeah. Yeah. I wasn't I was just going to
pass it right back. Yeah.
[31:06]
» All right. Any questions on the I guess
we just make a motion to ratify it. Is
[31:10]
that how that works, Bren?
>> Yes.
[31:13]
» All right. Do we need any discussion on
that?
[31:18]
» Uh, no. You can just go ahead and make a
motion. And I there's no folder, but
[31:22]
what I'm going to do is I'm going to
give you
[31:24]
» a form to sign.
>> See if I have the emergency sert. I do
[31:28]
not have emergency.
>> We can sign.
[31:30]
» I think as long as you ratify it. You
got your signature on it, Bill. And as
[31:33]
long as you ratify, I think you're going
to be just fine.
[31:35]
» Okay.
>> It's online.
[31:37]
» It's online.
>> Y.
[31:39]
» Okay. We need a motion on 120 Ozby Road.
Now I'll make a motion to ratify
[31:43]
[clears throat] the emergency
certificate for 128 Arms Road.
[31:47]
» I'll second it.
>> Tim motion to ratify 128 Arms Road. Mike
[31:51]
seconded. Tim vote I.
>> Mike, how do you vote?
[31:53]
» I vote I.
>> Jamie, how do you vote?
[31:54]
» I vote I. Thank you. Thanks for looking
for that, Brandon. Okay. Uh, next thing
[31:58]
up, we had um raw officers in the
audience for 135 Dodgeill Road. This is
[32:03]
just an update. I am going to recuse on
this. It was my family's land and I was
[32:08]
involved. So Mike, just roll with this
one.
[32:11]
» I got you.
>> Good evening, Ro.
[32:13]
» Good evening. Uh the client is asking if
he can eliminate that drainage system
[32:19]
and instead of that plant more trees and
shrubs, there is a huge area that can be
[32:23]
planted actually and then fill the
wooded area. And I sent some pictures to
[32:28]
Brandon behind the house and to the left
of the house when we eliminate I mean
[32:32]
the whole site is surrounded by wetland.
So adding more trees and shrubs will
[32:36]
protect the wetland more and also can
eliminate the retaining walls that's
[32:39]
going to be proposed around the drainage
system and keep the the natural grid.
[32:45]
Did anybody have any questions for RAU
on this?
[32:49]
» Let me I got this in the plan. Let me
read up.
[32:55]
» I did go to the site and the contractor
called me and asked me to meet him there
[32:59]
to take a look at it. his site
contractor when they were doing the
[33:03]
foundation work
asked if we could go this route instead
[33:06]
of the chambers buried in the ground. I
think it has chambers, correct?
[33:09]
» Yes.
>> He was worried about ground water.
[33:11]
Basically, he was putting the chambers
in ground water. So, he offered to do
[33:14]
like rain garden type plantings, you
know. So,
[33:20]
» so this wooded and it's all pitched away
from the street like so the whole site
[33:24]
isn't pitched towards the road. It's all
pitched to the back where all the
[33:26]
plantings would be. So this this huge
area behind the house, it's I mean we
[33:30]
can plant some trees and shrubs here to
fill the area between the wetland and
[33:34]
the house and we can protect more of the
wetland area.
[33:38]
» See how flat the site is.
>> But to do the drainage system, we have
[33:43]
to put some retaining walls and raise
the ground so we can get the system
[33:46]
outside of out above the ground.
>> I mean, I think we're trying to shy away
[33:51]
from buried systems and go to more rain
gardens and plantings.
[33:57]
And trees absorb between 10 to 150
gallons per day. So planting more trees,
[34:06]
some of them can go up to 300 gallons
per day of water. So if we can move to
[34:10]
trees and shrubs, we can actually
protect more wetlands.
[34:17]
» Is there a planting plan? move to you.
>> No, we I I was I mean when Sarah was
[34:22]
here, I was going to plan to meet with
her at the site, but I can meet Brandon
[34:26]
and uh we can just decide on what he
likes to see.
[34:29]
» Okay.
>> This is an account,
[34:32]
Brandon. This was set up
>> the I don't know if there's any 53G
[34:36]
money, but this was a 53G NOI review and
the money stays in until certificate
[34:41]
compliance is issued.
>> I my I haven't looked it up, but I'm
[34:44]
guessing there's money left.
>> I would, you know, second the county. I
[34:48]
would sure there's enough time.
>> Yeah.
[34:50]
» To meet on site with Robing the
plantings.
[34:53]
» Tim,
>> this Well, no, that this is they're
[34:56]
requesting what? A field change.
>> Yeah, a minor field change.
[34:59]
» A minor field change. I'd like to see
the planting schedule before
[35:05]
I know that
I don't know what we're talking about.
[35:10]
Three trees, five trees, 10 trees. It's
not on the plan. And if it's not on the
[35:14]
plan,
>> yeah, it's uh
[35:15]
» if it's not followed, we don't have the
reference point.
[35:18]
» It's basically whatever uh Brandon will
see that's going to be good for the site
[35:22]
to protect the wetland, that's what
we're going to work on.
[35:24]
» Okay. So, if we continue it and Brandon
gets out and they determine what they
[35:29]
need to do and put it on a plan, I I
think I, you know, I wouldn't have an
[35:32]
issue.
>> I have to agree with Jamie. I mean, just
[35:36]
you should if you could just mock up the
plan, show us where they're going to go
[35:39]
and exactly what you're going to do.
>> No problem. Sure.
[35:42]
» Yeah. I would agree with that.
>> We meet in two weeks and you got you got
[35:45]
a couple of months left before
>> No problem.
[35:47]
» Sure. We lose growing season. All right.
>> All right. Thanks.
[35:50]
» All right. Thank you so much, Ralph.
We'll see you at the next meeting.
[35:52]
» Thank you.
[35:57]
» You guys
[36:00]
uh enforcement issues. Um 72 Main Street
is still on here. I assume there's
[36:04]
nothing or Brandon, correct me if I'm
wrong. Is there anything to talk about
[36:07]
on that right now for 72 Main Street?
Any updates?
[36:11]
» No. Uh Douglas is is uh has the hands
full with it. Uh but I don't think
[36:16]
there's any action uh needs to be taken
by this board. Um you made it clear that
[36:21]
the last meeting that you want to keep
it open uh just basically to reserve
[36:27]
your right which is good idea. Um and
Douglas is uh continuing to work on
[36:33]
their end.
[36:36]
» All right. Um
>> did you hear this?
[36:38]
» That goes with 400 Boston. Next up, 320
Putham Hill Road. Jamie, that would be
[36:44]
your update, I believe.
>> Yes. Uh, I did a site visit on Thursday
[36:48]
of last week. Um, we had requested at
the last meeting that they fully on the
[36:54]
downhill slope of the disturbance that
they add additional silt fence. It was
[36:58]
installed and installed properly. And
there's also a silt fence that needs to
[37:03]
be installed around where they're going
to store the removed materials.
[37:08]
uh that was not up because they're
waiting to locate a contract. They're
[37:12]
waiting to find a contractor and and
have the contractor determine. We gave
[37:16]
them the flexibility as to where they
put it. Um and wait for the contractor
[37:21]
to determine where he would put it and
then we'll do another site visit at that
[37:24]
time.
>> That's the update.
[37:26]
» Perfect. Any questions on that update?
>> No.
[37:28]
» And I they that was nice that Jared
asked if he needed to be on and he was
[37:32]
here so keeps it moving. Okay. Um
Burbank Road.
[37:36]
Jim,
>> I need to recuse myself.
[37:38]
» Jamie's gonna recuse and uh just kind of
go over this. Jim, Jim and Jess, thanks
[37:43]
for coming in. If you want to come up,
you're welcome.
[37:46]
» Tim, uh Brandon, have you been out there
at all?
[37:49]
» Yeah, I went out there today.
>> Okay. Would you like to uh And Mike and
[37:52]
I went out last Thursday and met with
Jeff Graves.
[37:56]
» Um do you want to start with it or do
you want
[37:58]
» Well, I was specifically asked to look
at the wetland application area.
[38:02]
» Okay. I know that that uh you had a site
work yourself, Mr. chairman.
[38:07]
» Yeah.
>> Recently.
[38:08]
» Yep. Last Thursday.
>> Okay. So, last Thursday. And I was there
[38:11]
today uh at the request of uh commission
member to check out the well and
[38:18]
replication area. Um let me
[38:26]
Okay.
[38:40]
Okay. So the performance standard on
wetland replication area construction
[38:45]
is that after uh two growing seasons,
well there are some other caveats, but
[38:49]
we're at the point now where the the big
uh standard is that after two uh full
[38:56]
growing seasons, at least 75%
of the replication area is populated by
[39:04]
uh indigenous plant species. Okay? And
uh we most certainly have that. Um
[39:12]
when you do a weather replication,
you're supposed to replicate like for
[39:16]
like, right? So if it was a forested
swamp, in the end, you want it to be a
[39:21]
forested swamp and so on and so forth.
This was a forested swamp. So what they
[39:26]
did is they planted trees and shrubs and
then in the you know, in the herbaceous
[39:31]
layer they they put down a seed mix.
Uh
[39:36]
I'm not going to say that this is I in
my opinion overall this uh well and
[39:42]
replication area is compliant. Uh the
first third of it uh at the entrance is
[39:49]
a little strange to me because it's
mostly populated by a grass called
[39:56]
barnyard grass which is a like a weed
grass. It's native but it's like a weed
[40:01]
grass. It's not something that would you
would see in a seed mix. Okay. But as
[40:07]
soon as you get about one/ird in there,
it clears up and the vegetation is much
[40:11]
lower. You see a lot more u wetland uh
herbaceous vegetation. I saw one dead
[40:19]
swamp white oak and there are a couple
others on the right side that are that
[40:25]
are flagging. So that's something that I
would I would keep your eye on. Um but
[40:32]
uh that first third this area here see
it's just it's it's like a jungle. It
[40:37]
the the grass is taller than me.
Okay.
[40:42]
But then you get past that and it's
open, you get a lot of the the what I
[40:47]
call quote unquote normal herbaceous
species in the understory. The trees are
[40:51]
doing just fine over here. Uh so what's
going on close to the road? I I don't
[40:58]
know. But I think that it it should be
looked into because what I did here is I
[41:02]
took a picture right down that line to
the left is all the barnyard grass which
[41:06]
by the way is not a wetland species. Uh
in the understory like down by the
[41:12]
ground uh in that jungle is another
plant called bitterdock that is also not
[41:18]
a wetland species. So, I recommend that
the wetland scientist who uh helped to
[41:25]
build this, it is supposed to be on call
to do the inspections and uh corrections
[41:31]
if needed, be be called to to take a
look because there's a major difference
[41:36]
between this and the 7 foot tall uh
barnyard grass and this and the normal
[41:42]
uh wetland vegetation over here.
Okay,
[41:48]
here's here's one of the that that's the
one dead tree. That's a swamp white oak,
[41:52]
which which is kind of confusing because
the other swamp white oaks in there are
[41:56]
doing great.
And then this is a picture of Lago going
[42:00]
uphill, but uh
that's what we have still technically in
[42:06]
compliance, but you have another full
growing season to go. My recommendation
[42:11]
is to get the I believe it was Glenn
uh get him back to see what's going on
[42:17]
and give an opinion to uh Mr. Lennand as
to what might need to be done if
[42:23]
anything.
>> That's it.
[42:27]
» Thank you very much. Um any questions
from the board? Jim, anything to add or
[42:33]
» No, it was Glenn he's talking about. So
I'll reach out to Glenn.
[42:36]
» And one dead tree is actually not bad.
All things considered, that's pretty
[42:39]
good odds.
>> Yeah. 75% of them need to to need to
[42:41]
live. And if only one's dead, you're
still within that, but there's I saw two
[42:45]
others that were flagging.
>> Okay.
[42:47]
» Yeah.
>> All right.
[42:48]
» There were 20 total.
>> Were there 20? Okay.
[42:53]
» Uh, anything else that you need to go
over on that?
[42:56]
» No. Uh, maybe it uh again I I focused on
the replication area and I will hand it
[43:01]
over to
>> All right. So, Mike and I went Thursday,
[43:04]
met with um last Thursday, week
tomorrow. Jeff Graves, man on site. I
[43:08]
think we there probably half hour, 45
minutes. Um, overall pretty productive
[43:12]
meeting. Mike, do you want to talk about
um
[43:17]
so me and Jeff Walsh and Bill were there
on Thursday. We started up at the street
[43:22]
and it was a site visit just to walk the
entire site to see what wasn't completed
[43:26]
and what was completed.
We were under the assumption that we
[43:30]
would be going to a more completed
project than we saw
[43:34]
through the approval process through
conservation.
[43:38]
One of the conditions was that before we
started any construction of a home
[43:44]
that this roadway would be completed.
Um
[43:50]
started building enforcement,
get back on track. I think sometime in
[43:56]
March or April, we allowed work to go on
on the other side with a completion date
[44:01]
of end of July. They asked for June, we
gave them till July. So, I think that's
[44:04]
why me and Bill reached out at the
beginning of August to see where we were
[44:09]
as far as completion of the project.
Um,
[44:16]
if we start at the beginning of the road
on the left side, there's quality
[44:20]
swelles that weren't
they weren't done. Jeff Walsh said they
[44:25]
weren't. There was infiltration trenches
front left going in where telephone
[44:30]
poles proposed. Yeah,
>> these quality swailes and that trench
[44:34]
» and then the trench on the right side
wasn't completed.
[44:37]
So, there's a few things left at the
beginning of the entrance of the road.
[44:41]
And then as we traveled down, everything
looked good over the bridge. And when we
[44:46]
got to the end of the bridge,
there was storing of construction
[44:51]
equipment in the resource area that in
your order conditions says not to. There
[44:54]
was an excavator and a dump truck there
that day. So, we just ask you to be
[44:58]
mindful for that in your order
conditions. Keep your equipment out of
[45:01]
the the area of the
wetland.
[45:06]
And then it appears
that the elevation on the right side of
[45:11]
the driveway was much different than the
approved plan. And we didn't notice that
[45:15]
there was no grading. There was no
quality.
[45:19]
There was no water quality swelles.
There was no check dams.
[45:25]
And Jeff Walsh said that if that was his
intent, there would be a a new plan. a
[45:32]
new plan to reference what his
>> changes were and his concerns were was
[45:37]
this grading and how that water would be
captured in this upper section because
[45:41]
this is where the biggest change started
taking place as this load was much lower
[45:45]
than the upper road.
>> Yeah. Well, the two driveways go
[45:48]
parallel kind of kind of parallel.
[snorts]
[45:52]
» So, I guess
we were surprised to see why it's not
[45:57]
completed.
It appears that the plan isn't being
[46:02]
followed with grading and elevations,
but I'll let you guys speak. Maybe it
[46:06]
is. It's not done. So,
>> it's not done. That's the answer. It's
[46:10]
under construction and that's the only
area I have to store materials. So,
[46:12]
that's where the materials go
>> and the road is under construction
[46:15]
still. So, I can't build quality swailes
in an area where I have to store
[46:19]
material.
>> So, it's just
[46:24]
getting it's under construction. The um
the trucks weren't weren't stored where
[46:28]
the swailes are.
>> This whole right side as you go up the
[46:31]
driveway
isn't even close to completion. He was
[46:35]
engineer.
>> Uh my name's Mike Scott. I'm working for
[46:37]
Jim on this.
>> Well, welcome Mike.
[46:40]
» You want to look at the plan of what
we're talking about?
[46:42]
» I think I'm familiar with it. I was out
there yesterday. Okay. I've seen.
[46:45]
» Yeah. So, so when we left it and I don't
know when the last meeting was, but it
[46:48]
was left that by July 31st or August
[clears throat] 1st that that would be
[46:52]
done because it was the summer months.
It's not done. Just looking for an
[46:56]
update and if you're going to change
something, just let us know. Put it on
[46:58]
the plan. Um
I think the bridgeway was fine. The
[47:04]
entrance was a little bit and I think
part of it was the telephone pole was
[47:08]
going to go in. I don't think we're too
concerned about that. I I don't want to
[47:12]
speak for anybody, but this area as you
go right where the two levels of road or
[47:17]
driveway are now completely different.
>> Talking about when you get past the
[47:19]
pavement.
>> Past the pavement. Yeah. when you take a
[47:21]
right after the bridge or start to take
a right. Um that's just different.
[47:25]
» Yeah, that area is upgrading of the two
rows of erosion control barriers. Lo
[47:30]
pile seated. It's fully stabilized. Um
and Brandon, you were there today. I
[47:36]
took pictures as well. There's no
evidence of any erosion. There started
[47:40]
cutting in the driveway on the left, the
second lot. That's low. It was dry when
[47:44]
I was out there yesterday, even despite
some of the heavy rains we've had. So,
[47:48]
you know, I I don't see I didn't see any
evidence of any erosion even up or any
[47:51]
sediment even up to the first barrier,
never mind beyond the first barrier. And
[47:55]
again, I did read the order. He's
allowed to stockpile or stage anywhere
[47:59]
within a limit of disturbance, that's
what I see as going on. I certainly
[48:02]
didn't see any equipment in the wetland.
And if there had been equipment in the
[48:05]
in the wetland, if you're talking the
wetland resource
[48:09]
with equipment or were you talking
>> down right by the bridge?
[48:12]
» It's in the buffer zone,
>> right? And it's in his order conditions.
[48:15]
He's not supposed to store it there.
supposed to be outside the buffer zone.
[48:18]
» So then I didn't see I didn't see any
equipment stored there. I was there
[48:21]
yesterday. So you know if you saw it,
you saw it. [clears throat] Um but there
[48:25]
you go. That's that's obviously a no.
>> It wasn't there overnight. So I'm not
[48:29]
sure what time you guys are there, but
it wasn't there overnight.
[48:31]
» Were there workers there?
>> No, I didn't. Well, we didn't go up to
[48:34]
the house. It didn't appear anyone was
working at the house. We went up as far
[48:37]
as where where it goes right where
>> where the work stopped.
[48:41]
» Where Yeah. Where where the work
stopped.
[48:44]
» Could see the house. See the house from
a distance. didn't see anybody up there.
[48:47]
So,
>> I guess the biggest thing is what's the
[48:50]
update on what needs to be built? What's
the game plan on [clears throat] that
[48:54]
timeline?
>> I'm still working on the grading of that
[48:56]
that driveway. I excavated the left
driveway to subgrade. That's why it
[49:00]
looks so low. There's areas where there
were lots of loom. Um, and that's the
[49:06]
status it's at.
>> So, and as I understand, you have power
[49:10]
coming in the left side. So that's why
those
[49:12]
» still working with national grid to get
the power squared away
[49:15]
» where the red and white stake was. I saw
that. Yeah, you're waiting for poll.
[49:18]
» That's their pole locations and then
they're supposed to have a plan also to
[49:21]
show there's underground routes where
there's going to be pedestals and temper
[49:26]
uh house meters on pedestals and a
transformer and I don't have that plan
[49:30]
yet from them.
on the street end of the disturbance
[49:35]
before the pavement by pacing it. That
buffer zone area has been seated and
[49:40]
stabilized. His stockpile or staging
where he's got the materials up by the
[49:45]
street that's well beyond the 100 ft. On
the other side, clearly there's still
[49:49]
buffer zone that's exposed right up to
the even the replication area because
[49:53]
you have that little
>> pulloff there.
[49:55]
» Yep.
>> Yeah.
[49:56]
» That that's where the
>> that's not our concerns. uh concerns is
[49:59]
the right side that's not completed.
>> Well, that's what I'm talking about. The
[50:01]
right side across the
>> a house under construction.
[50:04]
» Yeah.
>> And we had already given him
[50:08]
granted him more time and allowed him to
work on the other
[50:11]
» valid for a whole year from now. I think
a year and a half.
[50:14]
» Isn't that true?
>> Yeah, the order is valid, but that was
[50:17]
supposed to be completed prior to
started construction of the house.
[50:20]
» We've only started any construction of
the house.
[50:22]
» I didn't see that as a specific
condition. That's what I'm getting at.
[50:24]
It was one of the meetings
on the order conditions, but it was
[50:30]
» wasn't in one of the enforcement orders.
I didn't I just didn't see it. So, I'm
[50:32]
just asking the question as a
>> wasn't anyone
[50:34]
» someone who read it for the first time
today.
[50:37]
» So, we had a meeting back in March or
April that I have to pull the
[50:40]
» him to work on the other side because he
could only work to a certain point and
[50:45]
then we were doing phase two and phase
two was this last part of the road. Was
[50:49]
face is phase two within the buffer zone
and within your jurisdiction or you
[50:52]
talking about areas way beyond your
jurisdiction?
[50:54]
» No, it falls in our jurisdiction through
the Sutton bylaw under the
[50:59]
» Brandon, you want
>> He hasn't.
[51:01]
» I'm I'm I'm going to look up memos here.
Okay. Well, I so I guess the question is
[51:06]
or from what I see
having done this for Jim two visits now,
[51:11]
once with Jeff and Brandon and then
yesterday is that the buffer zone area
[51:15]
is effectively stabilized between the
road and the crossing. On the other
[51:19]
side, the buffer zone is in a in a state
of construction and under the order is
[51:25]
allowed to stockpile or stage within the
buffer zone. That's explicit. It's
[51:28]
within any area that's to be disturbed.
That's what I saw. I didn't see any
[51:31]
evidence of erosion or sedimentation to
the wetland. So that would be my report.
[51:36]
I don't know if Jeff wrote you a report
when you were out there.
[51:38]
» I'm not disputing any of that. Right. We
walked the hay bale line. It needed a
[51:41]
few.
We didn't see any spoils beyond the edge
[51:45]
of
>> the limited disturbance.
[51:47]
» Right. So I'm just trying to get to the
point of where your jurisdiction starts
[51:49]
and ends. And if if there was something
that's not written down, that's all I'm
[51:52]
trying to figure out.
>> I think we got something here. Brandon,
[51:54]
did you want to
>> that that was a memo that was
[51:56]
» So Brandon, I think what he's trying to
say is anything outside the 100 ft, they
[52:00]
don't have to answer to us for it.
>> I disagree.
[52:02]
» Yeah, I'm sure. I'm sure he does.
>> Right. Because because we have a we have
[52:07]
a catchment area that leads to the storm
water system which gets goes into the
[52:12]
buffer zone. So any work in the
catchment area that is not per the plan
[52:22]
uh it means that water is not flowing in
either the direction or in the manner in
[52:28]
which it was intended which ultimately
goes down and impacts the AWR and
[52:34]
resource area. So,
you know, and I think that holds true
[52:39]
under the Wellness Protection Act, but
it certainly holds true under the
[52:42]
Wellland Protection bylaw.
Okay. So, right now, the grading scheme
[52:48]
is effectively draining in the same
direction. The swailes aren't there. No
[52:52]
question. But in terms of the overall
site grading, he hasn't redirected the
[52:55]
hill to the I don't know which direction
it is. East, I guess. It hasn't hasn't
[53:00]
broken over towards the house. So
everything's still coming down to the
[53:02]
same localized low area, which is
immediately to the right of the past the
[53:08]
bridge, the area you're talking about.
Um, so I'd contend that there's no
[53:12]
change to drainage patterns and the
work's not been finished. There's
[53:16]
actually probably less or about the same
amount of disturbed area that was
[53:20]
required. And I'm going back to a survey
that was done by who was your
[53:24]
» who was your land planning
>> planning land planning did an as looking
[53:28]
at that looks like he's within his
limits of disturbance. And again, if
[53:32]
there's no greater footprint of
disturbance and if there's no obvious
[53:38]
setting aside schedule, but if there's
no obvious um damage to the wetland or
[53:43]
infringement, it seems like he's working
in, you know, good standing from my
[53:48]
perspective. Again, setting aside a
schedule because I'm not familiar with
[53:51]
that, but
>> that's what I think we were trying to
[53:53]
look for is a schedule. Um,
so I guess just an update as the
[53:58]
engineer. When what's the time frame
that you think that area is going to be
[54:01]
built?
>> I mean, you need place to store
[54:05]
material.
>> Well, I didn't see any material stored
[54:07]
in that area.
>> I you saw a pile of rocks and pile of
[54:11]
logs.
>> Pile of rocks, pile of mulch, pile of
[54:13]
loom. There kind of stuff over there.
Yeah,
[54:15]
» it it appeared to be all like uh growing
like green, but
[54:19]
» yeah, the lone piles will stabilize.
>> Okay. Yeah. I mean, logs logs rock. No,
[54:24]
everything p everything ped stable.
Yeah. I'm not
[54:28]
» It's the infiltration trench that's at
the edge of the road and all these water
[54:32]
quality swailes to control all the
water. We're some of the reasons we
[54:37]
conditioned the job wanting it done is
we're going into another winter. Wind's
[54:42]
order conditions over.
[54:46]
Uh, okay. Let's take a look.
>> I can tell you that because I have it
[54:50]
» because these water quality swells in
that trench is a big part of where all
[54:53]
this water and like Brandon says, it
directly feeds into the resource area,
[54:57]
» right?
>> And this is the plan he brought to us
[55:00]
and all that grading on that left side
or right side as you go up is necessary
[55:05]
for all those
>> things to work to go down.
[55:08]
» The water quality swels, we've had
discussions about it. The road that's
[55:12]
now is not it. It appears he did a big
cut on the right side. If you look at
[55:18]
the bend of the road, it shows all the
grading on both roads to be equal.
[55:21]
» Yeah, it's definitely lower.
>> So, what we're saying is if he's going
[55:24]
to modify the plan, he should come in
front of us because that
[55:28]
» way to subgrade.
>> No, no, the the road that goes up to the
[55:32]
first house is lower.
>> The left road is it's
[55:35]
» the one on the left appears to be by the
plan
[55:38]
» as you go up. The one on the left, I
would say, is by the plan. It's at
[55:41]
subgroup.
>> It's the other one that's lower.
[55:43]
» It's the one on the right. And the one
on the right is where all this
[55:45]
infiltration and all these water quality
swells take place. And you see where
[55:49]
they start, how far up the hill, right?
And how it all directly runs right down
[55:53]
into the resource area. All of it.
>> Well, it it runs down into the buffer.
[55:57]
Yes. Your local resource area, I think.
>> Well, we don't have a buffer zone in
[56:02]
this town. We only have resource area.
Our definitions under our bylaw are
[56:05]
there is no buffer zone. We only have
resource area.
[56:08]
» So, we consider the buffer zone just as
precious as the resource area.
[56:12]
» Understood? And It's the area that was
permitted for construction,
[56:15]
» right?
>> Okay.
[56:16]
» So, our question is when's it going to
be completed? We're getting going into
[56:19]
another winter.
>> This needs to be stabilized. That's what
[56:23]
stops all the water. We were told this
would be completed before any
[56:27]
construction of the houses.
>> That's not accurate, Mike. Stop saying
[56:29]
that.
>> You want to play the meeting?
[56:31]
» That's not accurate.
>> We have to find that. We
[56:33]
» That's not accurate, Mike. You keep
saying that, but that's not accurate.
[56:35]
» Jim, at the meeting, we can play it. It
was Listen to it. Play it
[56:40]
» where where your engineer with you
sitting right next to him and his final
[56:43]
words.
>> We don't have it here, but we can pull
[56:46]
you have the you have
>> I can find it in my phone.
[56:48]
» All right, then pull pull the
>> You want us to play the meeting where
[56:51]
you say that there'll be no construction
of any homes until this roadway is
[56:54]
completed?
>> A public meeting.
[56:56]
» Find that where you required me to do
that.
[56:58]
» Find out where you required me to do
that, Mike.
[57:00]
» Well, so that would be helpful to know
the dates.
[57:02]
» I'll just We can play the meeting. It's
not
[57:04]
» just telling you what we would
>> I have minutes of every meeting, Mike. I
[57:06]
can hand them to you and you can go
through the documents. I'm not going to
[57:08]
go through my phone right now. We'll get
them to very confident that at the
[57:12]
meeting we were told there was no
construction of these homes until this
[57:14]
road was
>> I don't want to delay the meeting. Look
[57:16]
it up.
>> Mike, you know how you know that's not
[57:17]
accurate? Because you went to the
building commissioner and told him not
[57:20]
to issue me a building permit until this
is squared away. And he issued me a
[57:23]
building permit because it was squared
away.
[57:26]
» I disagree.
>> That's accurate. Michael,
[57:28]
» I didn't go to the building department
and tell them not to issue a
[57:31]
» Sure.
>> You did.
[57:33]
» That's not true.
>> Guys, we're not getting anywhere. We'll
[57:35]
get you the We'll get you the
information. get you the information.
[57:38]
» So, in return, if I may, yeah,
>> it sounds like you're looking for an
[57:41]
updated plan with where he's at,
>> what the final intention is.
[57:45]
» Yeah.
>> If it deviates from
[57:47]
» if it Yeah. If the plan's going to
change, if this is going to be 100%
[57:49]
built per the plan,
>> then I'm personally don't worry because
[57:53]
it's in writing, but if you're going to
change the plan,
[57:55]
» then you want an update. Understand?
Yeah. And then it would be a
[57:58]
consideration of whether it required a
new hearing or it's just a correct.
[58:01]
» Yeah. Yeah.
>> Absolutely.
[58:03]
» Yeah. Jamie has an imputter.
[58:08]
For the record, Jamie is recused on us.
[58:14]
» Um, just for my purpose, you're the new
engineer of record on the project.
[58:21]
» I am working on the project. That's
correct.
[58:23]
» So, you're not the engineer of record.
What's your relationship?
[58:26]
» At this point, I will be taking over the
design.
[58:28]
» So, that's how many?
>> Well, I'm I'm Wayne Bell's partner who
[58:32]
was here previously. So, All right, LBC,
same company.
[58:36]
» Um, what I would like to mention today
is 99 Burbank, which is the project
[58:39]
that's being built across the street.
They're currently accumulating fill in
[58:43]
the project. Monday night, I uh we had
probably a quarter of an inch of rain,
[58:48]
not a material amount of rain.
the septic plan. The septic plan which
[58:56]
was filed with the board of health shows
the silt fence line is right on the 100
[59:02]
foot
line from the wetland area
[59:06]
approximately.
Um in that rainstorm the silt fence
[59:10]
failed. I sent pictures to Mike and Bill
and there was material that made its way
[59:16]
if if
the fence is in the right place as per
[59:20]
the plan, there were materials that made
its way into the resource area.
[59:24]
» So, you're saying it made it into the
jurisdiction of the conservation?
[59:28]
» Yes, it did.
>> Okay.
[59:30]
» The materials being placed there,
there's no compaction going on. There's
[59:33]
they just it continues to grow and grow
and grow. And
[59:37]
um the first significant rain that we've
had, not even a significant rain, um
[59:42]
washed a a significant the silt fence
failed
[59:46]
and it washed a a from the road. It
appeared that it that the debris went
[59:52]
probably 20 ft into the resource area.
>> You saw that from the road?
[59:57]
» Saw that from the road.
>> Your pictures are from the road.
[59:59]
» My pictures are from the road.
>> So that's that. You can see it from the
[1:00:05]
road. You stand on the stone wall right
on the road. You can look right in.
[1:00:08]
» So with that being said, it's a
>> I'm not involved in this project.
[1:00:11]
» Okay. I I would
>> I came here for 126. I don't know.
[1:00:14]
» We're on 12. What's the number of that,
Jim?
[1:00:16]
» 99.
>> So 99 Burbank. If that falls under the
[1:00:20]
jurisdiction of this board, please just
make sure you file
[1:00:25]
a just double check it. If it's
>> I had a hearing here with you guys
[1:00:28]
because I redesigned that property to
take it out because it was a previous
[1:00:32]
order conditions on a previous design
that was done
[1:00:34]
» and you like voted it out. Yeah.
>> Now it's right and now it's completely
[1:00:37]
outside the buffer zone completely. I've
been there before, during, and after
[1:00:41]
multiple rainstorms and there's been
zero issues.
[1:00:44]
Shortly before uh Jamie trespassed,
there was a well company that was there
[1:00:50]
and they were doing a well test to get
the water. They had a generator and the
[1:00:53]
well running for eight hours. I didn't
know this that one point of source of
[1:00:58]
water was going right down to that exact
point he's talking about. I walked this
[1:01:02]
with building commissioner. He saw
exactly what happened. You can see the
[1:01:06]
runoff right from the well directly down
to where that was the a
[1:01:11]
unique event, not a rainstorm. Had
nothing to do with rainstorm. Upon
[1:01:15]
finding this out, I immediately fixed
it. Building commissioner thought it was
[1:01:19]
a non-issue.
>> I saw the sil fence. He's the He's your
[1:01:22]
storm water management guy and he
recognized it as a non-issue.
[1:01:27]
» So 8 ft past the I rectified it and I
took care of it.
[1:01:31]
» Yeah. Because we're not even really it's
brought up by the butter and if it falls
[1:01:35]
in the jurisdiction of conservation, you
know, you need to file and come in front
[1:01:38]
of us. If it's not in our jurisdiction,
I I would say it's not our problem.
[1:01:42]
» It's designed to be outside that and
it's going to stay outside that.
[1:01:46]
» Okay.
>> 100%.
[1:01:49]
Jamie,
>> in terms of I I would disagree that it
[1:01:52]
was solely a the result of the well
test. If you look at the entrance to the
[1:01:58]
site, the it appears as though based on
grading, the road water runs across the
[1:02:03]
top of the pad of the site and there
were signs of erosion in the top surface
[1:02:09]
of the material that was deposited
there. So I don't
[1:02:13]
» if you'd like to have Brandon come to
the site and meet with me during the
[1:02:15]
next rainstorm. We can watch all the
rain and see how far it doesn't it does
[1:02:19]
go down the hill. It doesn't go close to
the
[1:02:21]
» That's all I
>> Thank you, Jamie. If if you're okay with
[1:02:24]
that where it's not under our control,
if you're okay with Brandon going on
[1:02:29]
there, that's
>> more than happy to show. Brandon, the
[1:02:31]
silk fence is installed by SNM Farms.
It's doing its job. John Coocher also
[1:02:35]
agreed. It's installed properly. It's
doing its job.
[1:02:38]
» Yep. There was one little breach caused
by the well with an excessive amount of
[1:02:42]
water coming in a short amount of time
>> and I fixed it.
[1:02:45]
» You fixed it. Okay.
>> He's outside of jurisdiction.
[1:02:48]
» That's what see if you're outside of jur
if you come in our jurisdiction come
[1:02:50]
find us. If you're outside of our
jurisdiction
[1:02:52]
» coming down and if it was one event with
a well I
[1:02:57]
just fix the fence and clean it up and
you did it. That's all I would have
[1:02:59]
that's all we would have asked. I mean
>> you know where the 100 feet is.
[1:03:04]
» That's it.
>> Okay. Back to 12. Any other discussion
[1:03:06]
on 126? Is this something different that
you wanted to go over, Brandon?
[1:03:11]
» Nope. I just want to know what your
action items are.
[1:03:16]
» What What What do we want to have? What
do we want to do and what do we want to
[1:03:19]
have resolved for the next meeting?
>> I mean, the construction I just
[1:03:25]
» I guess what?
>> Schedule and I'll I'll have it
[1:03:28]
stabilized by the winter. I'm assuming I
I would want to have it done
[1:03:32]
» by then, but that's my goal. So, I don't
know. But it's not.
[1:03:36]
» Yeah,
>> I'm not restricted to a timeline. I'm
[1:03:38]
doing it the best I can. I'm a small
company, so it's in process is all I can
[1:03:42]
tell you. I don't know.
>> Will there be any deviations to the plan
[1:03:44]
that you know of that you'll have to get
a new plan?
[1:03:46]
» To be determined. I'm trying to figure
that out.
[1:03:49]
» You want a balance cut fill on the site?
You keep saying that some
[1:03:53]
» No, no, no.
>> Doing the best I can. They're looking
[1:03:54]
for just if you make changes to the
elevation of the driveways where the
[1:03:58]
storm water
that's all we care about
[1:04:01]
» when an official
>> if they make a change to any upgrading
[1:04:03]
of the roads that would affect those
quality swailes that's where we would
[1:04:06]
want to
>> just update the plan
[1:04:08]
» be an update
>> right
[1:04:10]
» yes
>> driveway on the left at the top of the
[1:04:12]
hill the other house on we I mean that's
all very far it's all flat up there it's
[1:04:18]
so to us after the site visit that's our
only concerns was to complete that right
[1:04:23]
side
>> that My only question on it was the the
[1:04:26]
far right. I wasn't personally concerned
about the beginning because you got a
[1:04:29]
telephone pole going in. You're going to
be disturbing it again. And
[1:04:32]
» we're just making note of what wasn't
done.
[1:04:34]
» To me, that's refreshing his D sign. You
could barely even see it.
[1:04:38]
» Yeah. To me, there's a reason it's
>> you're supposed to be able to see. Yeah.
[1:04:42]
» Take the spray can and just spray paint
it again.
[1:04:47]
» Those are ongoing maintenance things.
And you should go through your erosion
[1:04:50]
control line. There was spots that it
needed
[1:04:52]
» on the left side. Yeah. Couple walking
into the woods, but just make sure you
[1:04:55]
maintain your erosion controls.
>> I think that was all.
[1:04:59]
» I was happy with the area Brandon looked
at. I I did see the dead tree, but I was
[1:05:03]
like I didn't go in. I didn't walk in.
>> It was a certain percentage,
[1:05:06]
» but I thought that grew pretty well
personally.
[1:05:09]
» I as well thought the resource area
looked fine.
[1:05:11]
» It it's it is growing well. Um this that
first third is the plants in there do
[1:05:19]
not correspond with what the hydraology
should be and
[1:05:24]
I have I I have a hypothesis but I can't
like
[1:05:29]
» doesn't matter.
>> It doesn't matter. You just I I
[1:05:31]
recommend calling Glenn.
>> Okay. So let's have Glenn take a look at
[1:05:34]
that if you can and then keep us posted
on when you go right that area that
[1:05:39]
hasn't been built yet. Uh, it was my
understanding that was supposed to be
[1:05:42]
done before the house was built. I'll
take some time and going through YouTube
[1:05:46]
and all that. If I can find it, we'll
look through the minutes.
[1:05:50]
I just want to keep the project moving
forward, but I want to get the stop.
[1:05:53]
» No. And I I'd like to see that done
before the winter just because I don't
[1:05:59]
if you know water runs downhill. That's
that's it. Yes, I only asking because at
[1:06:05]
the meeting and I we will get you where
you and Ruf are sitting right there in
[1:06:09]
that chair and you one of our only
concern through the whole approval
[1:06:14]
because we had had trouble on other
sites that we conditioned them so that
[1:06:19]
the projects got completed. It started
with Old Mill Road and it was a similar
[1:06:23]
driveway and that was fresh on our mind.
So when we did this approval, we just
[1:06:27]
wanted to make sure the road got built
in accordance with the plan before they
[1:06:30]
started building the roof, the ro the
houses at the top and the storm water
[1:06:34]
and the water started to come down the
hill. And Mike, we talked about this
[1:06:38]
because there was such an excessive cut
up there of material and fill for the
[1:06:41]
driveway that I would utilize that
material from the house build to also
[1:06:45]
build the driveway. We had that
discussion here.
[1:06:47]
» Wait.
>> So it was a it was a concurrent
[1:06:49]
operation that had to happen. We talked
about that.
[1:06:53]
» Okay. All right. I mean that you have
the approved plan. I mean
[1:06:56]
» I build a road up and then all of a
sudden I got a thousand yards come out
[1:06:59]
of a foundation. Then that doesn't make
any sense, right? So I would take the
[1:07:03]
foundation material and utilize that on
site. So
[1:07:05]
» right now the road at the fork is 7 ft
lower than the plant. I mean we didn't
[1:07:10]
take lasers out and Jeff Wal said he
never verified any elevations but
[1:07:13]
there's a huge discrepancy from
elevations from the approved plant to
[1:07:17]
what's out there. You can see it. You
can see it walking the site. You can see
[1:07:21]
the elevations that are existing and
proposed. It's 7 ft lower right now
[1:07:26]
where the pavement shortly after ends
>> as you start to go right going through
[1:07:31]
from the road
>> as you start
[1:07:33]
» even at where the fork is. The whole
thing is 7 ft lower than it's supposed
[1:07:36]
to be. So what he was supposed to do is
he had a little bit of a cut and that
[1:07:41]
went over here and then this had to get
filled in. So if he had material from up
[1:07:44]
top he would bring it down here but this
part of the look 626.
[1:07:49]
» Yeah.
>> And it's supposed to be
[1:07:53]
628.
>> So two foot difference.
[1:07:56]
» No, no, no. This one down here 626.
>> This one.
[1:08:04]
» The point being follow the plan. It
doesn't matter.
[1:08:06]
» And if you're going to verify change
from the plan, just update the plan.
[1:08:09]
» Understood.
>> Keep us posted.
[1:08:11]
» We'll do.
>> Thank you both. Thanks for coming in.
[1:08:14]
Any other questions? Everybody good? All
right. 17 and 19 Pinepoint Road.
[1:08:20]
Brandon, do you know anything about
this?
[1:08:22]
» Zero.
Didn't hear I was like like an old road.
[1:08:27]
Parents used to live down the end.
>> It's just an old dirt road on Ramsan
[1:08:31]
Lake.
>> Yeah. Um someone call with a complaint
[1:08:34]
and it never
>> I'll have to check the file. I don't
[1:08:38]
know. This again, apologies. This is all
stuff that came in when Sarah was here.
[1:08:41]
So, I'm figuring out as I go.
>> I was thinking somebody called and
[1:08:45]
complained.
You would think down there.
[1:08:49]
Uh there's a bunch of can I mean?
>> Yeah. Somebody probably took a tree down
[1:08:55]
the neighbors.
I'm guessing
[1:09:07]
his emergency certificate for 128 road.
>> It's not 128. It's 1719.
[1:09:14]
» Do you have Do you see anything on
>> Point Rock or whatever it is?
[1:09:20]
Please.
>> Pinepoint.
[1:09:22]
» Five point. I was
>> nine point.
[1:09:24]
» Fine point.
>> Pine point. Yeah.
[1:09:27]
» There it is.
Oh,
[1:09:32]
» this was from Sarah.
[1:09:37]
This was for for tree removal
[1:09:44]
from like five plus years ago. Someone
must explain. I got a complaint that
[1:09:48]
they were cutting a tree. So I was
curious if there was activity or
[1:09:51]
something that was permitted.
Yep. So we approved cutting a tree. I
[1:09:56]
guess it took him five years to cut it.
I have no recollection of this.
[1:10:00]
» Sounds just like a nosy neighbor. Okay.
All right. Next thing up is to discuss
[1:10:06]
the meeting scheduled between Sutton and
Douglas. As far as I'm concerned, this
[1:10:09]
does not need any discussion. This was
something Sarah wanted. She's not here.
[1:10:14]
doesn't concern us when Douglas has
meetings,
[1:10:16]
» right?
>> Great.
[1:10:18]
» All right. So, Brandon, this pine point
was just a tree that we approved cutting
[1:10:22]
down five years ago. Some neighbor
complained about it.
[1:10:25]
» Okay. So,
>> so nothing to do.
[1:10:27]
» So, and it just said Sutton Douglas has
no reason discussing those schedules
[1:10:30]
because it's Sarah's gone.
>> Okay.
[1:10:32]
» All right. So, I had asked Sarah to put
on here to discuss local fees consultant
[1:10:37]
subcontractors in 53G so we could
discuss it as a board.
[1:10:41]
» Okay. I I I'm perfectly happy stepping
out if you want me to.
[1:10:45]
» I would prefer you stay unless you want
to leave.
[1:10:48]
» I You're just your pleasure.
>> Well, the reason I asked is if when
[1:10:52]
Sarah was here or if another agent comes
in tomorrow and it's an agent doing some
[1:10:56]
of these things,
>> for example.
[1:10:59]
» Brandon, go ahead. I'm sorry. I was
going to say so when the way it's set up
[1:11:02]
now is if we have an agent and someone
comes in we cannot collect 53g money
[1:11:08]
which means any applicant that's coming
in to meet with an agent we hire an
[1:11:13]
agent tomorrow and it's not not an
outside consultant the cost of any of
[1:11:17]
their work stuff we just did for the
past two hours would go in my opinion go
[1:11:22]
back on the taxpayers it would not go
back on the individual and the reason I
[1:11:26]
wanted to bring it up is because I've
been very vocal that if someone's doing
[1:11:29]
a project whether they're building a
house or they're building a subdivision
[1:11:32]
or they're building another unified that
I think those fees should be the
[1:11:36]
responsibility of the applicant and not
be falling back on the town of Sutton
[1:11:40]
taxpayers and without a 53G account or
anything like that it would fall back on
[1:11:45]
the taxpayers
so our bylaw still allows so where did
[1:11:50]
we I know that a consultant will take
care of some of it but if a big project
[1:11:53]
came through how is that not going
through a 53g account
[1:11:57]
» people that's the question it still
could How do we The question is how do
[1:12:01]
we determine how this is going to work
and not work? And maybe this is not a
[1:12:05]
discussion right now because we don't
have an agent as of today.
[1:12:07]
» Well, I mean it's an easy discussion for
me. I mean it it's it's you we have it
[1:12:12]
all in place. We have everything in
place. Our bylaw allows us to charge 53.
[1:12:17]
Soon as we have anything that's of any
scale that we feel we need outside
[1:12:20]
representation, you require a 50. You
require a deposit. our our bylaw already
[1:12:26]
outlines exactly how much the fees all
are. It's all there. It's all there.
[1:12:30]
Everything is all we have to do is say
to implement it, I would believe.
[1:12:33]
» So, I guess that's the question. How
when do we determine we implement an
[1:12:36]
agent or do we hold off till we have a
new agent?
[1:12:38]
» So, the easy thing to do is for now is
anytime that we feel we need his
[1:12:41]
services on anything that's on the
agenda. We could continue it for a
[1:12:44]
meeting. We could hire our consultant
and require money go into a 53G, right?
[1:12:49]
Am I correct?
>> You you may do that. I I don't know what
[1:12:54]
why you couldn't just continue to
uh
[1:12:59]
uh collect the consultant fee right at
the beginning even if you do have an
[1:13:03]
agent. But that's a question for maybe a
more legal question.
[1:13:07]
» Well, that was my question. Say we
collect the fee. I'm making it up. It's
[1:13:11]
500 bucks and we don't need an outside
consultant in this case your firm for
[1:13:15]
53g. Could that $500 be collected? And
I'm asking because I don't know the
[1:13:19]
answer and put into another fun. And so
it's legal and it would help fund the
[1:13:24]
position of the agent.
>> You can't do that. 53G funds,
[1:13:28]
» right? You have to go
>> by law specifically for third party peer
[1:13:31]
review cannot be used for any other
reason.
[1:13:33]
» But what if it wasn't 53? What if it was
just a general payment? We kept the fee
[1:13:37]
this.
>> Okay. So, so if you change your bylaw
[1:13:40]
fee structure, okay, um that money is
under your control. You can use for just
[1:13:46]
about anything you want. So that's
that's up to you. you would have to um
[1:13:51]
vote to increase your bylaw fees.
>> Okay.
[1:13:57]
» I have two things. I guess an important
first step would be to take a look at
[1:14:01]
and I have some time on my hands, so I'm
not volunteering for anything, but to
[1:14:05]
take a look at what other towns are
charging and whether they have a an
[1:14:11]
agent
>> or not um to see where we are in line
[1:14:16]
with those application fees. Um because
the agent, if we have an agent, they're
[1:14:21]
getting paid one way or the other,
whether they spend 20 hours in the
[1:14:24]
office or they're out on the road. I I
understand what you're saying about
[1:14:28]
taxpayers, but you know, they're getting
paid. The second one is typically if if
[1:14:33]
we had an agent and we did a third party
review uh with a consultant, don't we
[1:14:38]
usually put that out say this is what we
need done, how much is it going to cost?
[1:14:43]
Like if we hired Grace Engineering for a
review, that's what we do because
[1:14:48]
» [clears throat]
>> We could say, "Okay, well, we collected
[1:14:50]
$125
an hour." The cons and the consultant
[1:14:54]
says, "I'm not going out there for an
hour and a half. You know, it's not
[1:14:58]
worth the time, but they might put a bid
for some for for more money for the same
[1:15:04]
project." Just two thoughts.
>> Yeah, good thoughts.
[1:15:09]
» Yeah, I I did this week go on Grafton
and Shbury's website. It's all
[1:15:13]
accessible right from their website. You
got to be a little savvy navigating to
[1:15:17]
find like all the nitty-gritty all the
pay structures are there exactly what
[1:15:20]
your fees are when you file
>> both those towns. I thought those were
[1:15:23]
good towns to look at. I would consider
them equal to Sutton.
[1:15:26]
» They have their own employee, you know,
their own agent.
[1:15:29]
» Um
>> I don't know if it was true, but at one
[1:15:33]
of our meetings with Sarah, she said
that we could change our fee structure
[1:15:38]
with policies that we didn't have to do
it through town meeting. not change our
[1:15:41]
bylaw, not change our fee structure,
just change those fees. I didn't compare
[1:15:46]
them to I didn't This is where I didn't
have enough time. I just went through
[1:15:49]
them. Nothing jumped out at me. Um I
think similar to ours, I think we are a
[1:15:54]
little less expensive. I think we
definitely had room to charge more. Um
[1:16:00]
so it would be good just to see a
comparison chart of in any other town.
[1:16:05]
tried to stay more hope towards the
>> my other question I had is so when stuff
[1:16:12]
comes in do we have everyone come in for
a first meeting and then determine if we
[1:16:17]
need an outside consultant
>> the thing with an outside consultant and
[1:16:21]
collecting 53g account who's going to do
the accounting so the way it's
[1:16:25]
structured now is it's all set fees so
there's no accounting so with an inside
[1:16:29]
consultant you come in and you pay say
$500 to file your NOI $5 to $800
[1:16:33]
depending commercial was more if there's
all different criteria to it when you go
[1:16:37]
through the the the thing, but then
there's the cost of the town of all the
[1:16:42]
tracking and accounting of money versus
it just goes into directly into the
[1:16:45]
funds of the town. So,
if we're going to go with an inside, we
[1:16:51]
should look at our fee structure. We
should probably raise them to help cover
[1:16:54]
the costs to the town for having an
employee.
[1:16:58]
Um, so to me that would be a very
healthy discussion is that fee schedule.
[1:17:03]
We should look at what we charge compare
with Shbury and Grafton. Shbury has
[1:17:08]
full-time. I'm not sure if Grafton was
full-time, but I know Shburies is. Um,
[1:17:14]
things that we should look at is the
workload that we ask our part-time agent
[1:17:20]
agent to like what's our expectation.
Those are things that we kind of went in
[1:17:24]
blindly to, right? I mean,
it didn't work. I mean, she's she's not
[1:17:29]
here in the minutes and even it just it
wasn't working. There was a lot of
[1:17:32]
things that wasn't working. So, I hope
when we get a new consultant, maybe we
[1:17:37]
can start talking about we don't need
anybody, let's look at those two towns,
[1:17:41]
look at ours, and do a comparison. I
think we're all smart enough
[1:17:43]
finance-wise to say, "Hey, this this
will help." You know, like if we were
[1:17:48]
charging three and it's six now,
I can kind of give you an idea, rough
[1:17:52]
idea. So, if we continue to work with
Douglas, my understanding is Sutton gets
[1:17:56]
16, Douglas gets 16 hours a week. So,
32. However, they break that out. I was
[1:18:01]
also under the impression in Austin and
I were both under the impression that if
[1:18:06]
someone's in Douglas, but something
comes in in Sutton, they're going to be
[1:18:08]
able to shoot emails and return phone
calls. Kind of like job sharing between
[1:18:11]
the two towns. Now, if it's not an
emergency, it probably could wait for
[1:18:14]
the following day. But something comes
in, jump in the car if it's that big of
[1:18:17]
an issue. Tammy, as everyone knows, did
a great job from basically 1 one till
[1:18:22]
June 30th. Tammy and I spoke and and she
figured and I figured I don't want to
[1:18:28]
put words in her mouth that that it's
about a 16 to 18 to under 20 hour a week
[1:18:32]
clerical job, paperwork job. That's all
this junk, the minutes, there's a lot to
[1:18:39]
it. That's before on average getting in
the car and going out and looking at
[1:18:44]
something. So my question is if we have
an agent position and we split with
[1:18:47]
Douglas and we're only roughly getting
16 hours
[1:18:52]
on a normal week. I think it's only
going to be paperwork they're going to
[1:18:54]
get to. And that was my question because
I think if you do that you're going to
[1:18:58]
be delaying people meetings.
We don't have to decide tonight. I just
[1:19:02]
wanted to throw it all out there and get
some food for thought. I agree, Bill.
[1:19:07]
And it's shouldn't be a miss. So if
Brandon Bill's hourly, so we already
[1:19:13]
have a track record of what it takes to
run the field.
[1:19:15]
» Yeah.
>> And we had Wanda's time like her hours.
[1:19:19]
She only worked for conservation. I
[clears throat] think she did do a few
[1:19:21]
other tasks in some other departments
>> on Fridays. Yeah.
[1:19:24]
» But she What was her hours for
conservation?
[1:19:26]
» She was full-time employee. I want to
say it was 30 something hours in
[1:19:31]
conservation. And in in my humble
opinion, you don't need 30 hours on the
[1:19:37]
way things are going for a clerical end
as of today. Now, you get three unified
[1:19:42]
projects in October. That's a different
story. But on the way things are going,
[1:19:46]
but it is pretty time consuming. Uh
right now, Jen's helping out. Tam Tammy
[1:19:51]
was very nice. She's not interested in
continuing the position because of time.
[1:19:55]
Um, so I just it's just food for
thought. If if you have an agent that's
[1:19:59]
say a 50% agent here and 50% Douglas,
how much are you really going to get
[1:20:04]
done? And I don't want to have someone
come in for something simple like
[1:20:09]
whatever and it should be one meeting
and out and now we're continuing it
[1:20:12]
because now we decide we have to bring a
consultant.
[1:20:15]
I think there's a lot of stuff to think
about. There's a lot of paperwork. Even
[1:20:19]
though it's paperless, there's a lot of
paperwork. Um, and Austin and I spoke
[1:20:24]
and we thought it might be good to have
it's not a I forget what it's called.
[1:20:29]
It's like a planning meeting where we
can do it with the public. We can all
[1:20:32]
talk. It's open to the public and we
would all be here with Austin to kind of
[1:20:36]
go over the nuts and bolts of
everything, which I think might be smart
[1:20:39]
to do. And he said he would work with
our schedule. I thought it might be good
[1:20:42]
to try to do two weeks from now because
I think two weeks from now the meeting
[1:20:44]
is pretty light.
>> Um, I
[1:20:47]
» I don't mind doing a special meeting.
>> You forget how it's worded. It has to be
[1:20:51]
voted on. Um, but it's not it's not I
called it executive session. He told me
[1:20:55]
it's not an executive session.
>> We've done those before. Remember we
[1:20:58]
» work
but we have he's I believe he told me we
[1:21:02]
should vote on it and put it on. So it's
it's listed. So anyone who wants to sit
[1:21:06]
out in the audience and I believe if if
it's a workshop is it still public
[1:21:09]
Chris?
>> It's public but it's not recorded.
[1:21:12]
» It's not okay. So it's not recorded but
the public could sit here and ask a
[1:21:15]
question. I think it's we did one
>> I think it's healthy to do it
[1:21:19]
» and I think there's a lot to discuss.
>> Um I also spoke I told you guys I was
[1:21:24]
here all day or half a day.
>> I pulled everything because I wanted to
[1:21:30]
get it on the record. Brandon started
with us in 2008. So I'm going to start
[1:21:34]
with 2026. This is fiscal year. When I
say Brandon I mean his company. Fiscal
[1:21:39]
year 26. His company again nothing paid
by taxpayers. All paid by applicants.
[1:21:44]
47,165
and change. 2025 65,296
[1:21:49]
and change. 24 58,437
and change. 23 This was a big one.
[1:21:54]
98,755
22 69 and change. 21 almost 51 20 54
[1:22:02]
1937 1822 17 27 16 20 1535 1432 13 39 12
2012 27 2011 8 It's either 18 or 19. I
[1:22:16]
can't read my writing. 2010 14 2009 24
grand and 2008 $8,600. Now Tammy and I
[1:22:24]
were concerned about some higher amounts
because 98,000 Yeah. six figures almost,
[1:22:28]
right? We pulled that and I pulled a
couple things. The highest bill in n in
[1:22:32]
2023 fiscal year was um 8,600 bucks
on that bill, which is right here, was
[1:22:40]
when um Brandon was going to the
courthouse all the time. And this was
[1:22:44]
for um 224 Manuk Road for just Bernell's
property. This also includes the time
[1:22:48]
that I was online with the attorney
where we had to do it via Zoom. So I was
[1:22:53]
concerned because it was a large year
but most of the majority of that was
[1:22:58]
because of the Britell project. The
second year that was a lot of money was
[1:23:02]
69,000 was in 2022.
This was all the national grid work
[1:23:07]
large project throughout the majority of
town and this was also when uh Mr. Romeo
[1:23:13]
all the projects were under review and
all the issues with that with
[1:23:16]
enforcement. So I pulled a couple
things. Freedom Information Act. If
[1:23:21]
anyone wants this, they can put a
request in. Tammy and uh I think it's
[1:23:25]
Allison, our account, were awesome
pulling stuff because I wanted to see
[1:23:30]
where some couple years were very
expensive. Now, from 2020
[1:23:35]
to 2026, we had some pretty large
projects. We had Unified, we had Great
[1:23:41]
Dane, the old drive-in. We had multiple
enforcement issues between Jim Lanahan,
[1:23:46]
Jess Bernell, Romeo,
um,
[1:23:50]
» Oak Street Solar.
>> Yeah, I was trying to block that one
[1:23:53]
out. The solar farm in Douglas. So,
there was some heavy lifting in those
[1:23:56]
years. Um, when you go through and you
look and I can show all this, you're
[1:24:02]
seeing bills for $200,
$425. These are residential things. I'm
[1:24:08]
not seeing large numbers, but you guys
can correct me if you see something
[1:24:11]
different. But that's I just wanted to
bring up. So where it stands, my concern
[1:24:16]
is you're bringing an agent in, we're
going to find out an agent's not enough
[1:24:18]
having 20 hours here. They're going to
want to go to a full-time agent, which
[1:24:21]
is going to be a six-f figure position
for the town full-time if you did it
[1:24:25]
five days a week. And we're going to
still need a consultant. And at the end
[1:24:28]
of the day, it's going to cost people
more money.
[1:24:32]
» Where's Wanda's salary fact? And you
made a statement. Wait a minute. You
[1:24:35]
made a statement that this did not cost
the taxpayers any money.
[1:24:39]
» This this number.
>> So if you Well, but if you file and we
[1:24:43]
run conservation, you just said it
doesn't cost any money to the taxpayers.
[1:24:47]
We did pay one.
>> No, no, no. Yeah. So, correct.
[1:24:51]
» What was her salary? So, right now, if
you're going to make comparisons of
[1:24:54]
finances, you'd have to take Wanda's
salary, everything we paid her, and say
[1:24:58]
this is what it costs to run the Sen
conservation and now what do we pay?
[1:25:01]
» Yeah, that's a good point. I don't have
I think finances of cost of running a
[1:25:06]
business which we are
>> you have to take everything into what it
[1:25:09]
costs to run the conservation
commission.
[1:25:11]
» You're right.
>> Where are we at with a new inside
[1:25:14]
consultant?
>> So I'll give you cost the town.
[1:25:16]
» So here's here's the update. This these
numbers here
[1:25:19]
» were just paid to ecosystem solutions
Brandon's company from 26 fiscal year to
[1:25:25]
2008 I believe is when you first
started. That's as far back as we could
[1:25:27]
go. So 18 years
>> that that's when I started officially
[1:25:32]
2008.
>> Okay. And I don't think the system went
[1:25:34]
any farther back. That's as far as fine.
Close enough.
[1:25:36]
» I I was a sub to Steve Zisk.
>> Okay.
[1:25:39]
» And start in 2006 2007. But I can count
on one hand the number of jobs I was
[1:25:44]
involved with.
>> And I think 18 years is good enough,
[1:25:46]
right? So these numbers here, my chicken
scratch from 47,000 down to 8,600 bucks
[1:25:52]
are paid by applicants, not paid by
taxpayers.
[1:25:57]
Wanda's salary or anyone in that role I
think she was making in the 40s I don't
[1:26:02]
know was paid that's paid as taxpayers
no different than any other town.
[1:26:08]
» So [snorts] this is the question I would
be asking the town of Sutton.
[1:26:11]
» Yeah.
>> If it cost us X to run conservation for
[1:26:14]
the year 2025 which would be Brandon
salary and Wanders that combined amount
[1:26:18]
of money is what it costs to run the
Sutton Conservation Commission for the
[1:26:21]
year 2025.
And where are we at with what it's going
[1:26:25]
to cost now? And what do we budget? Like
so did our budget go from
[1:26:30]
125,000 down to 50,000 like
>> No, no, no. We don't we didn't have we
[1:26:34]
don't have a budget for outside
consultant. The budget was
[1:26:37]
» it cost X to run. So the Sutton
Conservation cost X amount of money to
[1:26:42]
run between hiring outside consultants
and town administration.
[1:26:46]
» No, you that's where you're wrong, Mike.
This this doesn't c this does not cost
[1:26:50]
the taxpayers,
>> right? We still have to perform all the
[1:26:53]
tasks that that money took to
that money represents a task based on
[1:27:00]
» how are we going to do all those tasks
if we don't have the money.
[1:27:04]
» That's that. Thank you. That's my
question. If you don't have a consultant
[1:27:07]
and you and you're only got someone in
here 16 18 hours a week and you don't
[1:27:11]
raise the fees,
>> that's why that's the question I had a
[1:27:15]
budget of X and now we have a budget
that's substantially less. How are we
[1:27:18]
going to achieve a 13-page bylaw and the
state mandates of all the requirements?
[1:27:23]
» Same thing I've been saying all along is
you don't hire an agent in my opinion.
[1:27:26]
You keep a clerical position and you
outsource it. And I'll say this right in
[1:27:30]
front of Brandon. We put Brandon, not
Brandon, his role, his out to bid and
[1:27:37]
get three, four, five, 50 bids. So if we
take Grafton and Shbury and what I don't
[1:27:41]
know what they pay, but I think that if
you look at what we spent and what those
[1:27:45]
towns spend to run their conservation
commission, we're we're more costly.
[1:27:49]
It's more expensive.
>> I would 100% disagree with you.
[1:27:51]
» Okay. Well, let's just look at the
facts.
[1:27:54]
» Well, can those all Well, you can
because they're all town positions. It's
[1:27:57]
posted in the books. So, we can see the
salary of the Sutton Conservation I mean
[1:28:00]
the Shoesbury Conservation Commission
and the Grafton. So, we can see what
[1:28:04]
their salaries are. Do they use any
>> We know what we paid W and we know what
[1:28:06]
we paid Brandon. take the year 2025 and
let's see cuz everybody says we're
[1:28:11]
expensive.
>> I I don't know who you're I would say
[1:28:14]
you're wrong. When I talk to all my
contractors and other builders,
[1:28:18]
» I'm told that Sutton's one of the
easiest towns to work in and it's not
[1:28:22]
for what you get. It's not
>> we're talking cost to file.
[1:28:26]
» I don't think the cost
>> inspects and Okay.
[1:28:29]
» So, let me
Mike not being argument. I want to lay
[1:28:33]
it out there. Yeah. So what do you do
when the last people that were sitting
[1:28:37]
in here at a public meeting we've been
up to multiple times? How's that paid
[1:28:41]
for? If you say we don't have this,
how's the agent going to do it?
[1:28:45]
» Oh, I don't think they're doing it in 16
hours. I I wasn't like
[1:28:48]
» So that's my question. So how do you do
it?
[1:28:52]
Cuz of course any consultant is going to
make more money when you have a bunch of
[1:28:55]
those things going on versus when you
don't.
[1:28:57]
» It's a more expensive question. So yeah,
what I'm trying to say is when you have
[1:29:00]
administration and all outside sourced,
it's more expensive.
[1:29:05]
It's a more expensive way to f to run a
a business.
[1:29:11]
It may cost the taxpay well we they're
not replacing Wanda's job, right?
[1:29:15]
They're not doing full-time. So we
budgeted
[1:29:18]
» whatever Wanda was making, it's a I
believe it's a little bit more than she
[1:29:21]
was making. So I think the question is
is with what we're going to be budgeted
[1:29:24]
from the town to be able to run
conservation, we have to have an outside
[1:29:27]
consultant.
>> Well, that's what I would say. I mean,
[1:29:31]
you know, you get a couple low hanging
fruits or couple septic system repairs
[1:29:36]
» because in the two towns I was talking
about it cost the tax. So it's less
[1:29:40]
expensive to file, but it costs the
taxpayers more.
[1:29:44]
And that's the problem I have that if if
Bill W decides I'm going to build a
[1:29:48]
subdivision and I'm going to profit off
it. Why should the sub taxpayers pay for
[1:29:52]
that? That should be me. If I put a pool
in and go get a permit, I don't say to
[1:29:57]
Jamie, give me a hundred bucks for the
permit as a taxpayer. I pay. So that's
[1:30:00]
all I'm saying is I and personally I
think these fees should be paid by for
[1:30:05]
the applicants whether it's home or
commercial that it should not be the s
[1:30:08]
taxpayers paid for this. But then we
need administrative.
[1:30:13]
We how many hours of administration to
do do the job?
[1:30:17]
» Well, if we split the job
>> Tammy, I talked to Tammy. She did no
[1:30:19]
accounting, right? She didn't do any
accounting of any the right. No.
[1:30:23]
» So, what is the real hours it takes to
run this this commission?
[1:30:26]
» She figured if I don't want to if she
had to do the accounting that it's it's
[1:30:31]
16 18 to under 20 hours a week.
So, if you bring on an agent that's only
[1:30:38]
here now, that agent is only going to be
here part-time, say Monday, Tuesday, or
[1:30:41]
Wednesday, Thursday. Of course, you
could talk to them in another town, but
[1:30:43]
they're not going to be here. So, now
they're not here. Let's just say Sarah's
[1:30:47]
hours here were Wednesday, Thursday. So,
someone comes in and wants to see Sarah
[1:30:51]
on Wednesday, Thursday. She's not here.
So, they go into Jen or some other board
[1:30:55]
and I don't want to say take up their
time because they're they're good
[1:30:58]
people, but they're working with someone
that's not here. So my opinion is
[1:31:01]
someone should be here full time, not
full-time but five days a week to
[1:31:06]
service the applicants whether it's a
homeowner or a builder or unified.
[1:31:12]
» So then we as a board should be
discussing I don't think anyone said we
[1:31:17]
couldn't use an outside like no one said
anything to us. No one's given us any
[1:31:21]
real direction to go. So we say it this
way. So, even if we hire somebody that's
[1:31:28]
more than just clerical,
>> yeah,
[1:31:30]
» they're still overwhelmed at their job.
just what if we started to utilize
[1:31:34]
somebody that had a little bit higher
skills to do some of what Brandon did
[1:31:37]
that keeps his cost down and and
I don't know you have to figure out
[1:31:42]
who's tracking all the money and what it
>> sample I don't want to insult you
[1:31:45]
Brandon but if someone has to write up a
RDA for for tree removal I would think
[1:31:53]
that someone in the office should be
able to do that with some decent skill
[1:31:56]
set it wouldn't take long
>> yeah I mean those
[1:31:59]
» that in my opinion shouldn't have to
fall on and we don't want it to,
[1:32:04]
» you know.
>> So, Bill, maybe that's more the like so
[1:32:07]
so at 16 hours with our
>> hopefully
[1:32:12]
» maybe we still need an outside
consultant for maybe no RDAs go through
[1:32:16]
an outside disc
unless we I don't know. I mean, these
[1:32:20]
are things we have to these are the
discussions we should have sooner than
[1:32:24]
later because you're gonna we hire
somebody. We saw how easy it was to just
[1:32:30]
not have I don't it probably wasn't a
good
[1:32:34]
» situation is right now we don't have
anyone to Jen's going to help well
[1:32:38]
without being asked Jen helped out. She
did a great job putting stuff together
[1:32:42]
» and she's been I've been talking to her
all week and Tammy all week and Tammy
[1:32:46]
and I said listen to us and I'll just do
the minutes just to get it done but the
[1:32:50]
position needs to be filled. So, I know
something we should probably be doing
[1:32:53]
tonight is is maybe we make a motion
that all any filings until further
[1:32:58]
notice are have to be you have to do the
like the however they used to file like
[1:33:02]
the checks that went back. I don't know.
I mean, what are we doing with the new
[1:33:06]
applicants? So, somebody comes in and
files tomorrow and now we were sending
[1:33:10]
back the 53G and but we don't have
anybody. So, how did we should we be
[1:33:15]
implementing?
>> I in my opinion
[1:33:16]
» me and you said immediately, right? I
mean, that's why we reached out to
[1:33:19]
Brandon after we kind of realized
>> we left Burbank Road and and Mike texted
[1:33:23]
me and I texted him back 10 minutes. I
said,
[1:33:25]
» and we're like, we we need someone to do
that. We can't do all this. I can't
[1:33:28]
continue to do what I'm doing. I'll do
it for a couple weeks, but I can't. I
[1:33:31]
spent from, like I said, 10:00 to 1:30.
I can't do that.
[1:33:35]
» So, I mean, the immediate thing is is I
guess we're just assuming Brandon's
[1:33:39]
going to take care of us again,
>> right? We haven't had any discussion. I
[1:33:44]
mean,
>> thank you. I thank you when you like
[1:33:46]
thanks for being here tonight and thanks
for just at a moment's notice Brandon
[1:33:50]
picked up all the pieces this week and
>> the reason I wanted
[1:33:53]
» got us through these site visits in
these meetings he did.
[1:33:56]
» The reason I wanted to bring up these
numbers yes it is because for years
[1:34:00]
people say it's costing the town a lot
of money. Maybe it cost the applicant a
[1:34:05]
lot of money. Yeah, Unifi paid a lot of
money. I'll tell you that that it's
[1:34:08]
expensive job but look what they did.
That was not removing a tree. But it's
[1:34:12]
not costing in my opinion the taxpayers
a lot of money because the taxpayer has
[1:34:15]
never paid this and that that's
important to me. I don't want to be
[1:34:18]
paying if Tim wants to put an addition
on or you want to do a subdivision or
[1:34:23]
Jaime's building another house. I don't
think I should be paying for that as
[1:34:26]
John Q taxpayer.
>> But no matter how we go about this,
[1:34:29]
we're paying to run some of this
conservation commission. It helps with
[1:34:32]
an outside consultant. And the thing
that's not going to probably work is
[1:34:36]
this minimum hours with the exp. When
you look at the facts of what it took to
[1:34:39]
run this commission in 2025, how do you
cut that down to a quarter of what we
[1:34:43]
had
>> in 26 25 24 23 22 and part of 21 were
[1:34:47]
busy busy years? There was a lot
>> getting any less busy
[1:34:53]
right now.
>> Yeah.
[1:34:54]
» No, it's not. We We're still here. What
time is it? Quiet. There's nights we
[1:34:57]
left in a half an hour.
>> I I just saying I Yeah.
[1:35:00]
» Yeah. No, it's not.
>> Amy, you've been waiting patiently.
[1:35:02]
Sorry. What what started this whole
conversation was the money that Sarah
[1:35:07]
returned to the applicants because we
didn't have the ability to do 53G in her
[1:35:11]
opinion.
>> And the way we left it at the meeting
[1:35:14]
was we were going to talk to town
council and figure out whether or not
[1:35:16]
that was the case. And if it was the
case, which Brandon confirmed tonight,
[1:35:22]
if it was the case, we were going to
discuss amendments to our fee schedule
[1:35:27]
so that we didn't leave that money on
the table, right? We were going to
[1:35:30]
figure out a way to take some of the
money that we were applying to the 53G
[1:35:36]
account and
um
[1:35:39]
» change our fees,
>> rename the to some extent rename and
[1:35:43]
take a look at our fee schedule to and
she was going to come to the meeting or
[1:35:47]
was supposed to come to the meeting with
that information. We don't have that
[1:35:50]
information. So, why don't we table this
discussion until we get that
[1:35:53]
information. And if Tim, you're kind
enough to dig some of that up and take a
[1:35:57]
look at how some towns that have a
conservation agent approach the the math
[1:36:02]
issue, I think then we'd have the a
meaningful the ability for a meaningful
[1:36:07]
conversation. I also think and agree
that on the more complex projects,
[1:36:12]
depending on the the the quality of the
applicant and and how efficient they are
[1:36:16]
at executing their job, there is going
to need to be
[1:36:20]
the a bat phone on occasion where you
reach out and say, "Hey, this falls
[1:36:25]
outside of the skill set of the
individual that we have or there's
[1:36:29]
particular um
particular qualifications that that this
[1:36:34]
individual doesn't have that we need to
appropriately address this project and
[1:36:38]
we need to have the flexibility to do
that and we have that through 53G. So
[1:36:42]
really,
you know, Mike, I don't know if it was
[1:36:46]
you or Bella mentioned that, you know,
RDAs should be something that we can
[1:36:50]
manage inhouse, right? Tree removal,
simple stuff like that, right? Um,
[1:36:56]
we need to kind of take a look at
what we do when we the whole
[1:37:03]
conversation is premature because we
don't know what the skills of of the new
[1:37:06]
employer are going to be.
>> Uh, but we can certainly have a
[1:37:09]
conversation in anticipation of that.
Um, and the first thing we need to do is
[1:37:14]
take a look at some of the more common
tasks that we do. Certificates of
[1:37:17]
compliance, orders of conditions, RDAs,
minutes,
[1:37:22]
» and agenda
>> and allocate
[1:37:25]
» answering emails, answering phone like
like
[1:37:28]
» it's it's more than
>> you set up a desk in here,
[1:37:30]
» but a work session is the a work session
is once we get the information,
[1:37:34]
scheduling a work session is really the
way to accomplish.
[1:37:36]
» Do you think two weeks from tonight
would be good for work session?
[1:37:39]
» I think probably if It's a lot. It It's
a lot, right? I don't
[1:37:45]
» Oh, I mean I
>> If Tim you volunteered to collect the
[1:37:47]
information, do you think it's a
discussion you can have?
[1:37:49]
» I said on the record, I don't volunteer
for anything. So, [laughter]
[1:37:53]
» funny how forget that. I
>> um
[1:37:57]
» Yeah, I mean I I can have the
information.
[1:38:00]
» Well, and I think it's important to have
Austin here so he can say, "Well, you
[1:38:05]
guys are way off base. You can't do that
or you can do that." Um and
[1:38:09]
» well, we have two exercises. One is we
need to know understand fully understand
[1:38:12]
what we're charging for fees now.
>> Yeah.
[1:38:14]
» Right. So under the consultant you know
how when an applicant comes and and the
[1:38:20]
project is this
>> this is the check that they write. Yeah.
[1:38:24]
» Um, and then the second is if you take
that same project in Grafton, it's this
[1:38:30]
and Shrewsbury is this and
>> it does get a little complex because
[1:38:34]
they have the set fees and then if it's
commercial, you have to add something on
[1:38:38]
and then if it's
>> you'll see them when you start. It's
[1:38:42]
it's it's mathematical and it's it's
very precise, but it's
[1:38:46]
» you'd have to you'd have to base it on a
project almost to get a true cost if I
[1:38:51]
remember correctly. I did it quickly. So
I'd say
[1:38:54]
» you have to have a hypothetical um pick
a site and say all right we did this one
[1:38:58]
in Sutton and this is what it cost and
then say Grafton with that same criteria
[1:39:03]
legal footage of wetland line you know
type of project and then that would be a
[1:39:08]
comparison of cost that's how you'd have
to really get a true comparison
[1:39:12]
» and I I believe when you it it was very
mathematical when you go and see the two
[1:39:16]
towns it it it doesn't leave anything
you know it's money it's collecting
[1:39:20]
money so there's nothing to to question
it's a very black and white formula. Um,
[1:39:25]
» and in the short term, I'd suggest that
we revert back to what we did before.
[1:39:29]
And to, you know, Mike's question, what
do we do when a new project comes in? I
[1:39:32]
think we should just do what we did
before, right?
[1:39:35]
>> Bill, what do we do a week ago? Well,
[1:39:38]
the good thing is and and 30 days, you
know, I don't two weeks is it would be
[1:39:43]
nice to have the conversation quickly,
but I don't know that we need to really
[1:39:46]
have it
>> well
[1:39:47]
» before 30, you know, before the meeting
after the next
[1:39:51]
» because we don't even know if we're
going to have a conservation agent at
[1:39:55]
that time. Right.
>> One of the things I thought wasn't done
[1:39:59]
the best it could be was
we had applicants filed, they sent in
[1:40:04]
checks, and then money was sent back.
And then Brandon did think he he had had
[1:40:08]
a little bit he didn't make a big deal
of it Brandon and I saw what happened
[1:40:12]
and I thought it could have been done
better. So I think that anything that
[1:40:16]
here moving forward even when the new
consultant starts there should be any
[1:40:19]
project that came in why Brandon was
covering it doesn't get sent back. He
[1:40:24]
doesn't get told that I know you took it
and you you started the process and you
[1:40:27]
started go like that was wrong. It was
>> well he was on his way to a site and
[1:40:31]
then sat.
>> So you understand it too sent the money
[1:40:33]
back. I would want Brandon to know that
if he is willing to help us. I mean, he
[1:40:37]
hasn't even said he would. I I hope you
will. I mean, I know you will, but I I
[1:40:40]
don't mean that. I just know you
>> you love us too much to not You couldn't
[1:40:45]
not do it. You just couldn't. Am I
wrong?
[1:40:47]
» You're not right.
>> You couldn't.
[1:40:50]
» Um
>> but I personally would want to make sure
[1:40:52]
that that doesn't happen again. I I
didn't think there was maybe only two or
[1:40:57]
three of them, but that to me was
>> Yeah, that shouldn't have happened.
[1:40:59]
» That shouldn't happen. And I promise
you, I mean, I can't say, but I I if I
[1:41:03]
know about it, I'm not in favor of it.
>> Well, you're you're also in a bit of a
[1:41:06]
pickle, too,
>> because like, for example, that one on
[1:41:10]
uh Cody Lane that I was driving up here
and found out mid drive that the the 53g
[1:41:16]
fees had been returned for a job that
came in before Sarah started. Um, now
[1:41:24]
you have an approved uh ENRAD, which now
the ORAD needs to be written up and
[1:41:30]
there's no money in it for me. So I
unless you can find ways to uh pay me, I
[1:41:35]
I I cannot help you with that. Someone
else is going to have to do it.
[1:41:38]
» So let me say it this way and maybe the
town has been spending money every week
[1:41:43]
to run this commission and they haven't
since Christmas.
[1:41:46]
» So if we have to spend a little money to
run our commission, I I'm in favor of
[1:41:50]
that. Right. I mean, if we Right? I
mean,
[1:41:52]
» because I'm going to tell you guys,
we're we can all hold our own, but if we
[1:41:56]
write an ORAD
>> or write an order and there's one period
[1:42:00]
missing a comma, it's a recipe for
disaster. And quite frankly, none of us,
[1:42:05]
no offense to any of us. We're not
qualified to do that stuff. So, and I
[1:42:09]
don't think any of us want to do it. I
don't want to speak for you guys. So, I
[1:42:11]
I would say we need to find money
somewhere to pay Brandon. Um,
[1:42:15]
» let's ask how that I mean,
>> how does that how does that work?
[1:42:17]
» Do you know
>> does that come out of where does that
[1:42:19]
come out? He submits an invoice and we
figure out how to pay it. Right. That's
[1:42:23]
» Well, I I've I've I've done that in the
past and it's been it's been difficult.
[1:42:28]
» Well, we'll we'll make sure that it gets
paid, right?
[1:42:30]
» So, you could pay out of your your bylaw
fees, but the thing is you don't collect
[1:42:34]
a whole heck of a lot,
>> but there's got to be something enough
[1:42:36]
to at least cover the
>> I think it's like $25 per application.
[1:42:39]
» No, but it it probably added up to
enough to get us through the
[1:42:42]
» How many things right now? Is it Cody
Lane? Is there any other ones?
[1:42:47]
» Okay.
They're all on this agenda. Okay. So,
[1:42:50]
Cody Lane, 354 West Sutton Road,
uh 400 Boston Road,
[1:42:57]
those three
>> 354
[1:43:01]
is going to involve construction
meetings. We should Can we go back and
[1:43:05]
say we return your fee? We
>> You approved it tonight, right?
[1:43:11]
» Yeah.
>> Yeah.
[1:43:11]
» Too late.
>> Sorry.
[1:43:16]
Well, let's just ask the question
tomorrow what we're allowed to spend to
[1:43:19]
run our commit. You know, like
>> we have to pay our bills.
[1:43:21]
» We have to pay our bills. It's not going
to be a million dollar.
[1:43:23]
» Mike made the point. Mike had made the
point that we've had six months of an
[1:43:27]
absent position. So there's there should
in the budget
[1:43:31]
» making sure that Brandon gets taken care
of for the work that he completes
[1:43:34]
shouldn't put us in a negative variance
to budget.
[1:43:37]
» They have a minimum
>> and Austin's been great. So I can't
[1:43:40]
imagine this. I don't want to speak for
him, but I can't imagine there's going
[1:43:42]
to be an issue. So I
>> I you have my word one way or another
[1:43:46]
this is handled because if not then not
done and we're not qualified to do them.
[1:43:52]
» Yes.
>> One thing I do want to say is that um
[1:43:55]
and I and I said this over the winter
and I'm going to reiterate it again now
[1:43:59]
and I think it's more pertinent now
going forward. Everything's changing
[1:44:02]
now, right? Uh I recommend that the town
put out a new RFP for a consultant.
[1:44:10]
Okay, I'm okay with that.
I talked to Austin about that today as
[1:44:13]
well.
>> Thank you.
[1:44:14]
» I I think that's very important to do.
Put out. I think believe Austin would
[1:44:19]
have to do it or be involved.
>> Yes, he absolutely would
[1:44:22]
» and I think that should go out.
>> Yeah. That's not something the Kong can
[1:44:25]
do it. It would have to go through the
the top administration.
[1:44:28]
» Yeah. Okay.
>> All right. So, do we want to table this
[1:44:30]
discussion for another 30 days and have
the discussion then as it relates to in
[1:44:35]
the event that we get a conservation
agent? This is kind of the task that we
[1:44:39]
would expect them to complete and this
is
[1:44:42]
» how we need to address how we need to
adjust our fee schedule to make sure
[1:44:46]
that we're capturing as much of that as
we can.
[1:44:48]
» The only reason I ask is do we want to
do it sooner rather than later is if
[1:44:52]
they're interviewing someone or they
bring someone in, which I know of
[1:44:56]
nothing right now. It's my understanding
they're posting the position or they did
[1:44:59]
post it that we have some say in it.
>> Okay. Uh may I say something?
[1:45:05]
» Yeah.
being part of the the the town of
[1:45:08]
Douglas as well.
>> Um I've been told that they are doing
[1:45:13]
their very best to repost the position
exactly as it was before uh before the
[1:45:18]
end of this week.
>> Okay. However, this time uh I I am told
[1:45:23]
that the at least the chairs of the
Douglas and and Sudden Conservation
[1:45:28]
Commissions will be involved in the
interview process
[1:45:32]
because that was obviously something
that did not happen last time and and uh
[1:45:37]
the result could have been better. I
suppose that's the opinion over in
[1:45:42]
Douglas and remember that Douglas is
considered the quoteunquote host town.
[1:45:46]
So the hiring and the I guess the the
check comes through the town of Douglas.
[1:45:52]
» I think that there should be it was kind
of abrupt Sarah being introduced and all
[1:45:57]
of a sudden checks going back and all
that stuff with it happened I think too
[1:46:00]
quickly and anything that gets
submitted.
[1:46:04]
We should do what we're doing now. get
our 53G money and agree that whatever
[1:46:10]
comes in, even for an overlapping period
to give that individual the opport the
[1:46:14]
new individual the opportunity to get on
their feet before they have to start
[1:46:18]
playing with live ammunition.
um that we you know so if we get another
[1:46:24]
354 West Hutton Avenue we apply the fee
schedule collect the 53G money um
[1:46:32]
Brandon's firm to the extent that he
wants to or agrees to does the work and
[1:46:38]
we have some period where they're
working in unison to make sure that the
[1:46:43]
transition from one the transition I in
my opinion was was too aggressive. It
[1:46:48]
happened in like I was like really I I
you know with no real material notice we
[1:46:54]
we should have a transi there needs to
be a transition period between
[1:47:01]
our retention of an agent working with
the consultant to understand kind of how
[1:47:07]
the board conducts its business. You
know Sarah was never
[1:47:11]
Sarah was never had the opportunity
before her first day of work. Yeah.
[1:47:17]
Whatever. I
>> So, just so you guys know, you guys find
[1:47:20]
found stuff out either within a minute
after me finding it out or at the same
[1:47:24]
time I found it out. It's not she wasn't
communicating with me. The most
[1:47:27]
communication I got from her was her
last couple days here when she did the
[1:47:32]
» And to and to reinforce your your point
before, to the extent that we do it that
[1:47:36]
way, the 53g money provide that that
doesn't come at the expense of the
[1:47:40]
taxpayer, right? So,
we're better, it's better for the town
[1:47:45]
to collect the 53G utilize a consultant
than to give it back.
[1:47:50]
» And
[1:47:53]
you know, and the question came up in in
in 18 or 16 or however many hours a week
[1:47:59]
it is the position, what tasks are
reasonable to expect that person to do?
[1:48:04]
» Yeah, there's there's a lot of thought
that has to go into it.
[1:48:08]
» A question.
So, if we have all these 53G accounts
[1:48:12]
that are active that are and no one we
we know no one since Christmas has done
[1:48:18]
any I mean we've paid the bills, we paid
invoices.
[1:48:23]
» My understanding and I might be wrong is
any 53g money. So, say Bill went has a
[1:48:27]
project in here and I paid x amount of
dollars up front and my project's done
[1:48:31]
and say I'm owed $200 back. My
understanding is none of that has
[1:48:34]
happened in the past six months. I I
could be wrong. So, I do believe that
[1:48:38]
there's money that could be paid back to
people
[1:48:40]
» who's taking all the accounting. So, if
I pay 2,000
[1:48:42]
» that's supposed to fall
>> that's been billing against it and and
[1:48:46]
the bill where does it go after it gets
paid?
[1:48:49]
» It was supposed to be falling on the
agent to do that and it didn't happen.
[1:48:52]
» So, and not that I don't want to
continue. So, we're going to So, when we
[1:48:57]
collect new fee, uh where's the
accounting part of that?
[1:49:01]
» It's a question for us. Not we're not
conquering that tonight. But
[1:49:03]
» you can't answer that.
I mean, what if applicants start showing
[1:49:06]
up saying, "I want like where'd my money
go? I want I want I want to see where it
[1:49:11]
went." And I
>> I'll tell you what's going to happen
[1:49:12]
now. If you had an applicant say, "Hey,
I gave five grand. Where the heck is
[1:49:15]
it?" It's going to be a call Brandon and
say, "Brandon, you're going to send me
[1:49:18]
how many hours you have because I now I
have to do the math homework to see how
[1:49:21]
many hours he used and how much. It's
it's a nightmare."
[1:49:25]
» The information is available. It's not
>> When Brandon issues an invoice, it shows
[1:49:29]
the project that it's for, the amount
specific to the project. No, I
[1:49:33]
understand that. So, in order to true
that up, there's a manual process of
[1:49:38]
needing to go through Brandon's invoices
and applying them against.
[1:49:42]
» But I don't think it's been done since
>> I don't think so. The project be done.
[1:49:45]
We have all the information. It may not
be current, but we can
[1:49:48]
» take on that task.
>> Well, it's
[1:49:50]
» and we're going to go down that road
some more.
[1:49:52]
» We have to I'm just saying it's supposed
to fall it was supposed to fall on the
[1:49:55]
agent, the person that was hired. Um,
>> I don't want to talk ill of anyone on
[1:50:01]
here, but I was told that she she told
me she was not going to do that. It does
[1:50:05]
not fall on the, you know, the
accountant writes the checks, but it
[1:50:08]
does not fall on the accountant to do
our accounting. So, I that's another
[1:50:12]
thing that when we repost the position,
>> be ready for that that to have some like
[1:50:17]
to have to deal with that, right? We
should just be aware. Let's just be
[1:50:20]
aware. I haven't seen the position
posting, but if that is the case, we
[1:50:24]
should probably make sure that it's
clear in the job description that that
[1:50:27]
responsibility falls under the the
candidate for the position
[1:50:30]
» or is the way our outside consultant can
track it from some type of all we needed
[1:50:34]
is to be tracked to an address that that
this came in and this was built against
[1:50:38]
it and this is the
>> but Brandon is the one. So, in other
[1:50:41]
words,
>> for it is the accounting part of it.
[1:50:43]
When I do a project, I'm I'm building
development and I come in to write a
[1:50:46]
check and I have row for work with me
and we write money. The money is paid to
[1:50:51]
the town of Sutton,
they then pay based off Brandon's
[1:50:55]
invoice and then if there's a refund to
me as the applicant. It's not Brandon's
[1:50:59]
company writing the check. It's the town
of Sutton writing the check back to me.
[1:51:04]
» So this goes into the 53G account. It's
not the same account.
[1:51:08]
» It's not Brandon writing the check back
to the applicant. I owe you 200 bucks
[1:51:11]
back. out of the 53G.
>> But right now, we just no one's doing
[1:51:15]
that.
>> So, this is what happens. I file, a
[1:51:18]
check comes in, and it can go in two
accounts. If it's the town fee, it goes
[1:51:21]
into the town. They've explained this,
so we've had meetings on it. Some of
[1:51:24]
those checks went into the general fund.
Yeah. Some of those checks went into the
[1:51:28]
53G account. The 53G account is what
needs to be accounted for because that's
[1:51:32]
where somebody could say, I want some
like either they two two-edged sword
[1:51:37]
here. We can run out of money, be
spending money that we don't even have
[1:51:40]
money to cover the expense because we're
not tracking the finances of the job. Or
[1:51:45]
somebody could come in and say, "I want
my money back. My job's closed out." And
[1:51:47]
we don't know how much to give them.
>> That's right.
[1:51:50]
» We could figure it out.
>> We could figure it out. We could figure
[1:51:52]
it out. The figuring out hasn't happened
yet.
[1:51:54]
» So you're going to go back through in
>> January, right?
[1:51:58]
» I just They were years a Austin Austin
and I quickly talked to temp or
[1:52:02]
something of if there's anyone here who
could do it.
[1:52:05]
» Oh, just right. these things that we
should think because we're now
[1:52:08]
increasing that we have to
>> every week you go every two weeks you go
[1:52:11]
there's more money
>> there's more money coming more back
[1:52:14]
» we fall behind like
>> so when do we want to schedule when do
[1:52:18]
we want to put on the agenda the
workshop discussion so that we can have
[1:52:21]
it and and
>> we brought up a lot of really good
[1:52:24]
things
>> why we almost kind of I don't know I we
[1:52:27]
we stuck to fees but that's why I I we
might not be ready for it right away but
[1:52:31]
I think these are things that we need to
come out and [cough and clears throat]
[1:52:34]
really have a conversation
So we get a definitive answer.
[1:52:38]
» So should we 30 days at it or you want
to have a special meeting?
[1:52:42]
» I don't care one way or another. It's up
to you guys.
[1:52:45]
» Doesn't matter to me.
>> So how do we move forward? I file
[1:52:47]
tomorrow morning. I come to the town
hall
[1:52:49]
» just like we did before we had an agent.
>> Okay.
[1:52:52]
» So
>> how do we get that direct? Who knows?
[1:52:53]
» Should we put that as a um
>> like how
[1:52:56]
» so I make a motion on that. So it's
>> or I don't think that's necessary,
[1:52:59]
right?
>> I don't think that's necessary. So we're
[1:53:01]
all in agreement that that's how
>> we're all in agreement
[1:53:04]
» and even during and even and we even
have a transition period
[1:53:09]
where the where Brandon's firm and the
agent are working
[1:53:14]
collaborating to accomplish the job and
we should probably let the conservation
[1:53:19]
agent determine
you know enough of an overlap so they
[1:53:24]
can determine what they think that they
can manage
[1:53:28]
» on an ongoing basis and can't. Right?
kind of let involve them in the
[1:53:31]
discussion as to
>> we know where in the transition now we
[1:53:36]
won't let it happen again. That's what I
was trying to say.
[1:53:38]
» Yeah, exactly. We learned from what
didn't didn't work and
[1:53:41]
» all right. So, do we want to set a
meeting date or do we not or do we
[1:53:46]
» I think we should set something tonight.
When it is, I don't care. Uh but I think
[1:53:50]
it's important to get it on record and I
think we should have a motion on it for
[1:53:53]
a workshop probably. Right, Chris?
>> I'll make a motion to have a workshop to
[1:54:00]
to discuss transition of
[1:54:07]
how would we what type of work agent
>> we want to have yeah we want to have a
[1:54:11]
workshop on agent versus consultant and
transitioning and tasks that need to be
[1:54:18]
continued
>> an adjustment of fee schedule
[1:54:21]
» adjustment of fee schedule
>> so when would an end of September
[1:54:25]
meeting would that be September 30th is
that right now
[1:54:28]
» I hate to tag it to another meeting
because it's just too much. You want to
[1:54:31]
do a special day. Okay.
>> Yeah, I really I would like to do the
[1:54:34]
off week,
>> but you don't want to do it with the
[1:54:36]
regular meeting only because it
recorded. Correct.
[1:54:40]
» We don't We could shut the recording off
and if if it was a 10-minute meeting,
[1:54:43]
fine. But if it's a meeting like tonight
and we had to start on it now. I don't
[1:54:46]
want to put fresh
>> touched anything we're talking.
[1:54:48]
» So, yeah, I think a special meeting
would be good. What What works for
[1:54:51]
people?
>> Anything.
[1:54:54]
» We want to do about a month though. Is
that enough time? Is that too long?
[1:54:57]
Excuse [clears throat] me.
>> I'm available.
[1:55:01]
I think that's too long. My
>> You want to do three weeks? So, we're in
[1:55:05]
the
>> the off week
[1:55:08]
» like the Wednesday like the same
>> Labor Day is the 7th, right?
[1:55:12]
» Yeah.
>> Oh, yeah. We have a meeting on
[1:55:15]
» Do we want to try to do it? Do
>> we have a meeting?
[1:55:17]
» I'm not sure Jared could make, but I
think all four of us could be here 2
[1:55:20]
3:00 in the afternoon and do it. try to
do it during town hall hours when Austin
[1:55:24]
is
>> and we're not
[1:55:25]
» I'm just I'm just asking if Yeah. If it
goes later it's not a big deal because
[1:55:30]
Austin but you versus starting at six
o'clock at night 3:00 special meeting on
[1:55:35]
» Yeah. Pick a date.
>> So we have our next meeting when our
[1:55:38]
next meeting would be what? Like the
first
[1:55:41]
» it should be the second but Wednesday
September 2nd.
[1:55:45]
» So the next meeting as long as it's
within the time required to post we
[1:55:49]
could. So, we might want to talk to
Austin, find out what his availability
[1:55:52]
is, and at the next meeting, we can set
the make the motion to set the meeting.
[1:55:57]
» Okay. So, I'll talk to Austin
and we'll make a try to make a motion at
[1:56:02]
the first meeting in September to pick a
date. Does that work?
[1:56:05]
» Sooner the better. That's my opinion.
>> Well, if we decided we want to meet next
[1:56:08]
week, we'd have to vote on it now.
>> I don't think we'd be ready for next
[1:56:12]
week.
>> Well, I don't need one meeting. I What
[1:56:15]
do we need?
>> Five days to post.
[1:56:17]
» 48 hours.
>> 48 hours. So at the next meeting we
[1:56:20]
could have a meet. If the next meeting
is the e is the 9th what's the next
[1:56:23]
meeting?
>> Well the only other thing
[1:56:25]
» or the first right or the second.
>> So the only other thing is do we want to
[1:56:29]
have input before they get they post a
job tomorrow and they get an application
[1:56:33]
Tuesday and then do we want to have
input in this before they hire someone?
[1:56:37]
That's the only reason I'm saying do we
speed it up. Not that not that I'm
[1:56:41]
saying we're gonna have any input, but
it these are things that if no one was
[1:56:44]
thinking of, we brought up some really
good points tonight like the money being
[1:56:47]
refunded and the accounting. Not that we
forgot about it, but this is do we want
[1:56:52]
to have say in this? So before they
interview someone, we have you know
[1:56:58]
» I think that you could take a look at
the job description and see if you know
[1:57:01]
if it doesn't include accounting for 53g
money, you have them include that in the
[1:57:06]
job description. Glasco's doing it.
[1:57:10]
But no, at the meeting on the 2nd, we
can 48 hours, right? So we can do it.
[1:57:15]
» Is it 48? I don't know what it is.
>> That's just confirmed. 48 hours. So all
[1:57:19]
we need to do is post it in for So at
the next meeting, we can set a date
[1:57:22]
that's two days away from the next
meeting.
[1:57:23]
» So So that works. The only question I
have is what if we get a call, I doubt
[1:57:28]
this would happen, that next Tuesday
they've hired someone. They're going to
[1:57:31]
start in two weeks since before our
meeting. Are we concerned that we
[1:57:34]
haven't had any input to Austin as a
board before someone's hired? The sooner
[1:57:38]
the better.
>> That's the I'm maybe we don't talk about
[1:57:42]
fee schedule because that takes some
time. Do we talk about board
[1:57:45]
» the matters at hand?
>> The matters at hand. And you know, give
[1:57:48]
Tim a couple months. Give Tim a month to
do the feed breakout. Like maybe we
[1:57:52]
don't get once you I don't think it'll
take him long because you just print
[1:57:55]
Sutton's online, print graft and shoes,
>> whoever else. Yeah.
[1:57:59]
» The position description if the job's
posted, the position description already
[1:58:03]
exists.
So all we need to do is ask Austin for a
[1:58:07]
copy of the position to
>> I had I had that somewhere.
[1:58:11]
[clears throat]
>> I got it last.
[1:58:12]
» And whether or not it includes
accounting, you might suggest that it be
[1:58:14]
amended. I don't think that takes a
board to
[1:58:17]
» Do you want to see if we can meet next
week? Is one day during the week better
[1:58:20]
than
>> I think we might want to try to meet and
[1:58:22]
then then we can still meet again.
>> But just have a quick check-in.
[1:58:29]
» There's a lot going on.
>> Yeah.
[1:58:33]
» So next week is the Today's the 19th,
right?
[1:58:36]
» Yeah. I promise I cannot do next
Wednesday, Thursday.
[1:58:41]
» I'm trying to do Tuesday. See?
>> Yeah. Yeah, I can. I will double check
[1:58:45]
my schedule.
>> Tuesday evening booked up.
[1:58:50]
» We were thinking three.
>> If it doesn't need to be videoed, we
[1:58:53]
don't need this room, right? We could we
could
[1:58:55]
» But those rooms next week are taken,
>> but you could always set the lunch, too,
[1:59:01]
if you needed to do evening. What if we
did
[1:59:03]
» during the day?
>> We're probably if we did like Tuesday's
[1:59:06]
farm [snorts]
>> the darling B.
[1:59:09]
» There you go.
>> I'm serious. I wasn't kidding. We're in
[1:59:11]
charge of the whole conservation I mean
with
[1:59:13]
» Yeah, but can you do that if we need
computers and all that?
[1:59:16]
» I don't think
>> I think it's just all discussion.
[1:59:18]
» So I just
>> I don't care. Do we want to do a Do we
[1:59:21]
want to do next Tuesday the 25th?
>> We can meet at Palies.
[1:59:25]
» I don't know if we have to be on town
property.
[1:59:27]
» Probably should.
>> Not as far as town property. I think
[1:59:31]
it's easier for the public if if
>> Yeah, because it's the public. You have
[1:59:34]
to be open to the public. So, I think we
should stick with the town hall or the
[1:59:37]
police station if we're allowed to.
>> So, do we want to do Tuesday the 25th at
[1:59:41]
3:00?
>> Sure.
[1:59:44]
» Does that work for everybody?
>> Yeah.
[1:59:48]
» Brandon, and I think you should be here
because I think it's important
[1:59:52]
» be a big part of it.
>> It's important for you to bring up that
[1:59:54]
you want the role put out to RFP, which
you've made clear. Mhm.
[1:59:58]
» And if if Austin asks a question, you're
going to be able to answer certain
[2:00:01]
things better than us, like on certain
IDAs and filings.
[2:00:06]
» When do you want to do this?
>> Can you do Tuesday the 25th at 3 p.m.?
[2:00:11]
» Uh
maybe I have uh
[2:00:17]
a D adjudicatory appeal hearing uh
starting at 10:00 in Boston.
[2:00:24]
» Is it in person?
>> It's in person. Yeah, they they're Yeah.
[2:00:29]
Uh well, you have to because you're
getting cross-examined, right?
[2:00:33]
» So, it's it's a it's a project uh on
what I call a second level appeal.
[2:00:39]
» Okay. So, there's lawyers involved.
>> And I am not going to guarantee that I'm
[2:00:43]
going to be back by 3:00.
>> Okay.
[2:00:47]
Not that I don't want him to be there,
but I think we could I mean, we could
[2:00:50]
start if he know I mean we we I mean
>> have you checked Austin
[2:00:57]
» Austin said to Austin said he'll try to
work with our schedule, but we have to I
[2:01:00]
think we have to vote on it now. I I
think Tim uh Chris, do you know how that
[2:01:06]
works for workshop? We have to vote on
it and put it post it. Right.
[2:01:10]
» You don't have to vote on workshop. You
just need to schedule it and you need to
[2:01:14]
» Yeah. You you don't have to vote on a a
a meeting.
[2:01:18]
» Yeah.
>> Okay. So, for example, uh on Monday
[2:01:21]
night, the Douglas Conservation
Commission, they didn't vote. They
[2:01:25]
agreed that they were going to go on a
site visit on on a project. It's kind of
[2:01:29]
hairy because they wanted it's one of
those projects they want to see
[2:01:31]
themselves in addition to me. Right.
Okay. Good. Um and they didn't know when
[2:01:37]
they were going to do it. And all you
have to do is post 48 hours ahead of
[2:01:43]
time the location and the time of the
meeting so the public can join if they
[2:01:48]
want to.
>> Oh, so we don't have to decide tonight,
[2:01:51]
» right?
>> No, just 48 hours.
[2:01:53]
» Okay. So, what 48?
>> I'll reach out to Austin, see
[2:01:57]
» there's a business there. Yeah. Can't
count Saturday.
[2:01:59]
» So, we'll assume the 25th at 3:00 and
>> and I'll talk to Austin. If for some
[2:02:04]
reason that doesn't work, I'm going to
I'm going to let you guys know right
[2:02:06]
away.
>> Do the Tuesday. That way you don't have
[2:02:08]
to do anything. If that works, we'll
just we'll all be there. If it changes,
[2:02:10]
you'll let us know by email.
>> Yeah. And I'll let you guys I'll email
[2:02:13]
everyone. So, just so it's in black and
white.
[2:02:15]
» So, this will have to be posted tomorrow
because I don't think Laura's here on
[2:02:22]
Friday.
>> So, I have to know from
[2:02:26]
» I would post it by tomorrow. Um because
PMJ will be here tomorrow. Okay.
[2:02:31]
» Post it by tomorrow.
>> I mean, I'm going to email Austin
[2:02:34]
tonight or and follow up with the phone
call tomorrow morning. So I think I
[2:02:36]
would know by midm morning tomorrow
>> just post it and then the agenda just
[2:02:39]
has to say you know okay
>> workshop discussion
[2:02:43]
» well if you got to re I'm very flexible
>> yeah I'm flexible
[2:02:47]
» and
>> you can probably have the more so you
[2:02:50]
» that's why it has to change just let us
know
[2:02:52]
» okay so let's plan on tenatively Tuesday
the 25th at 3 o'clock for now
[2:02:57]
» you just post if it doesn't work out
just post a different one that's
[2:03:01]
» perfect okay
