Good afternoon, commissioners. I would like to call this meeting to order. It is now 6.11 p.m.
[0:18]
Commissioner Gooch.
[0:23]
Commissioner Oswald. Commissioner Manning. Commissioner DeHereda. And Commissioner Weiner. We have five. We do have a quorum. So the reason why.
[0:37]
I am calling the meeting to order is because we are out two commissioners.
[0:44]
Mr or Commissioner Mondragone has resigned his position and Commissioner Goldman has accepted the planning director position.
[0:58]
So we are going to be mayor will be appointing two new commissioners or alternatives.
[1:05]
I'm not sure how that'll go but he is aware of it and so he will be doing I believe they're going
[1:12]
to do that at the next town council meeting but I'm not 100% sure but as soon as we do get
[1:21]
full quorum or a full commission again the five plus the two alternates at that time we will put the
[1:28]
the meeting or the election of officers so that we can elect new officers. Commissioner
[1:38]
Wanderbone, as you know, was the chair, Commissioner Goldman was the vice chair. So right now
[1:43]
we don't have one. So at this time, I would ask that you, one of you or whoever can make
[1:50]
a motion to appoint a temporary chairman for today. And then again once we get a full commission,
[1:59]
we will move forward with appointing or nominating new chair and vice chair.
[2:04]
I move that Commissioner De Herrera be acting chair.
[2:11]
A second. Commissioner De Herrera, do you accept?
[2:15]
Yes, I do. I accept. Thank you guys. Okay, so let me call a vote Commissioner Manning. Yes, Commissioner Gooch. Yes, President
[2:27]
Commissioner Oswald. Yes, Commissioner DeHereda. Yes, and Commissioner Wiener. Yes. Thank you. He
[2:36]
Commissioner DeHereda will take over as chair for tonight. Okay
[2:41]
Commissioner Oswald. Can you lead us in the federal agents?
[2:52]
of the United States of America and for which it stands, one nation, under God, indivisible,
[3:01]
liberty and justice for all.
[3:07]
Commissioners, have you had a chance to review the agenda?
[3:13]
Any questions?
[3:16]
If there's no questions, I will entertain a motion to approve.
[3:23]
So, the second.
[3:31]
So, was that commissioner Manning that made the motion?
[3:33]
right. And who seconded? I did. Thank you. Okay, commissioners, have you had a chance to agree?
[3:43]
All in favor? All in favor? Aye. Aye. Thank you. Okay, commissioners, have you had a chance to review the
[3:54]
minutes from last month?
[3:58]
Any questions?
[4:02]
Well, I will entertain a motion to approve.
[4:07]
A motion to approve the minutes. Second, can we vote?
[4:14]
Yeah, so, Commissioner Gooch made the motion. Yes.
[4:18]
And who seconded? I did. Okay.
[4:24]
You can do all in favor. All in favor?
[4:26]
Hi. Hi. Hi.
[4:30]
Okay. Citizens forum. Citizens who wish to comment before or during the meeting may submit your requests, comments or questions to Diana Gonzalez, deputy planning director at the Gonzalez at Towson, New Mexico.
[4:46]
go.gov, no action may be taken. Do we have anybody signed up, Dyna, to speak?
[4:56]
Chairman DeHereda, no, we do not have anybody signed up. Let's check the Zoom to see if anybody's online.
[5:03]
Nobody is online.
[5:07]
Okay, number seven, presentations.
[5:11]
Do we have any presentations?
[5:13]
questions? No presentations at this time. Okay. Number eight public hearings. Do we have anybody
[5:22]
Dynas signed up?
[5:25]
No, I don't think so, but let's let me introduce the case first and then we'll
[5:31]
have the applicant come up and present their case and then we can open the public hearing after that.
[5:36]
Okay. So, a case number HPC2026-32 discussion, consideration and possible approval for a certificate of appropriateness for the rehabilitation of an existing structure on a contributing property located at 137 Ben Street.
[6:02]
The proposed work includes the replacement of exterior windows and doors as well as applying new stocko to the walls.
[6:10]
The subject property is approximately 0.4379 acres and is located in the central business district CBD zones within the historic overlays on within the town limits of the town and
[6:25]
House. The property owner is Rebecca Fry and the agent is Towson Mountain Builders Inc.
[6:33]
Who will present? I will. Okay. Good afternoon commissioners.
[6:39]
Chairman the head of I'm sorry and commissioners. Staff would like to enter the following into
[6:44]
the record. The certificate of appropriateness application and supporting documents submitted for
[6:50]
Rebecca Brigh by Touse Mountain Builders Inc., the agent, and the staff report.
[6:58]
The applicant is requesting the planning, zoning, and historic preservation commission
[7:03]
approval for a certificate of appropriateness for the rehabilitation of an existing structure
[7:08]
on a contributing property located at 137 Bent Street.
[7:13]
The proposed work includes the replacement of exterior windows and doors, as well as applying
[7:19]
new stuff go to the walls. According to the 2017 town of Tau's survey summary form,
[7:26]
it is listed as a contributing property to the Tau's downtown historic district and historic
[7:32]
overlay zone. Furthermore, this structure is listed in the state register, the national register
[7:41]
of historic places and the Tau's historic overlay zone as contributing. And it features a historic
[7:49]
plaque on the wall. For historical context, the rear section of the structure was built
[7:55]
between 1939 and 1957, while the front section was constructed in the late 1900s.
[8:04]
Staff recommendation is, if the Planning Zoning and Historic Preservation Commission
[8:08]
determines that the proposed project demonstrates compliance with the requirement of the historic
[8:14]
overlaid zone and all policies of the town of Towsland use development code, then staff recommends
[8:19]
conditional approval of the certificate of appropriateness subject to the following conditions.
[8:25]
The applicant must comply with all local state art and or federal regulations related to the
[8:32]
development of this property. The proposed use must be in accordance with any additional conditions
[8:37]
determined necessary by the commission to protect the health safety, welfare and continue
[8:43]
aesthetic beauty of the community, if approved the applicant must obtain the zoning review from the planning department prior to obtaining a building permit from construction industry's division.
[8:55]
The applicant has met all noticing requirements and has paid all fees and miss Alameda is here to present the case with one of the property owners.
[9:07]
I'm sorry, I didn't get it, right?
[9:09]
Adam Flourst, if you can, yeah.
[9:15]
Hello,
[9:18]
yes, the button should be green.
[9:26]
Can you please state the name and your address for the record?
[9:29]
Yes, hi, I'm Al Meade Martinson, and I'm here on behalf
[9:32]
of Tiles Mountain Builders Inc.
[9:34]
The address is 165 MySS Road, Rancho State Tiles,
[9:38]
New Mexico 877-875570.
[9:41]
And my name is Adam Forrest. I am the current owner of 137 Venn Street. Okay. Thank you.
[9:48]
Proceed. Hi. So essentially we are trying to get this certificate of appropriateness approved
[9:55]
because the owners would like to upgrade their windows and have more eco,
[10:00]
non-make, you know, warmer windows, cooler windows, all of the things. And essentially they have gone
[10:07]
on through and had custom windows designed and made.
[10:11]
They were attached to everything.
[10:13]
Well, not media until we get the approval from you guys.
[10:17]
But they're all pretty much to mimic what is there
[10:22]
to look as much as possible as they are already.
[10:25]
The only ones that are going to change and not all the windows
[10:28]
are being replaced, but a good majority of them.
[10:31]
And the only ones that will actually
[10:32]
change the shape of the windows is a couple of egress windows
[10:36]
because we have to meet code because we're reading a permit and all the things that go along with that.
[10:41]
And the big thing here aside from that, because they did strive to keep it as historical
[10:45]
and as similar looking as it already is, is that they wanted to change the color of the windows.
[10:52]
To have this really nice clay color that's going to kind of blend in and match with the
[10:56]
stucco and look really nice at the area.
[11:00]
That's pretty much the gist of it.
[11:06]
Okay. Mr. Forrest, anything to add?
[11:09]
No, I think she covered it pretty well.
[11:12]
The existing color being it white, I think, was just something that was done by somebody that was a caretaker of the building.
[11:21]
I don't think it was—I don't know how long I've been there in historic or anything like that, but it's just something that they just did for maintenance.
[11:28]
So that's why it's white right now.
[11:31]
Commissioner, do you have any questions?
[11:38]
I can't say how delighted I am that someone is investing the money to protect a remarkable
[11:48]
location and remarkable building, and I was a little bit blown away that you could actually
[11:56]
get windows made that are reflective of that era that's the light to know. The only question
[12:05]
I have is there are two doors that I feel like are fairly remarkable that is like what's the
[12:15]
game plan for those doors so we retain something that to me is kind of defines this property. I think
[12:25]
those doors are great. I agree with you. Both the doors that you just showed me,
[12:31]
I'll be a hundred percent plan on either.
[12:35]
I believe the artist is David Vidoe who did
[12:38]
these doors and painted these doors. He's a local artist and he's a friend of mine and he,
[12:43]
I became a friend of him after I told him that I was on this house now and I met him and he said
[12:49]
that he would actually paint, refresh with the paint of that, of the Mary and also on the front.
[12:56]
There's a, it's not, you don't have a picture of it. I don't know if we have a picture of it,
[13:00]
but there's also, it's called, it's the name of the house that's Casa Feliz and it has a beautiful
[13:04]
painting on the front. Right there. If he's in the man on that, you can see. So we were actually
[13:10]
going to have him, he was going to come over and and his father painted that and he was going to
[13:13]
refresh up the paint for us. So not only would he plan on keeping that, we're going to
[13:17]
and bring it to what it originally was from the same artist.
[13:25]
I can't be more placed.
[13:32]
I noted in the packet that the window package from Sarah Pacific is like $13,500.
[13:42]
Can you estimate how much it costs you to put together the application for the certificate
[13:46]
of appropriateness, administrative fees?
[13:53]
It was about $1800 of time mailing, filling out the application, running around, getting
[14:01]
the paperwork needed. All of that was around $1800 to get to this point today.
[14:07]
And that includes the certified mail?
[14:09]
That includes everything.
[14:11]
Thank you.
[14:12]
Yes, sir.
[14:17]
Diana, do we have anybody else signed up to speak?
[14:42]
Okay.
[14:42]
Okay, many more questions, commissioners, if not, I will entertain a notion.
[14:50]
Yes.
[14:52]
I just have a question for Ms. Martinson.
[14:56]
So the fees that you
[15:00]
I'm going to send him the invoice part. Does that include your time for doing all that? Okay, yes, ma'am. And the application fee and the mailing costs and gross receipts tax because government gets their size. Thank you.
[15:19]
I'm going to go ahead and close the hearing. If there is no other questions, I will go ahead and entertain a motion.
[15:27]
I move that we approve this
[15:32]
subject to the conditions and the staff report.
[15:36]
Seconded.
[15:41]
Commissioner Manning.
[15:42]
Yes.
[15:44]
Commissioner Wiener.
[15:45]
Yes.
[15:46]
Vice or I'm sorry, Chairman DeHereda.
[15:49]
Yes.
[15:50]
Commissioner Oswald.
[15:51]
Yes.
[15:52]
And Commissioner Gooch.
[15:53]
Yes.
[15:54]
It passes.
[15:54]
Thank you.
[15:55]
Congratulations.
[15:55]
Thank you.
[15:59]
Okay.
[16:00]
Number nine matters from staff.
[16:02]
Do we have anything kind of I don't the only thing is just again reiterate that we will be looking for two new commissioners, I don't know when mayor, you know, I know he did receive a couple of letters already, but it's up to the commissioner or the council members and the mayor to appoint those people so good.
[16:34]
Number 10 matters from the planning and zoning director Goldman wants to say some sorry director. Oh, that's okay. Good evening commissioners. I just wanted to say hello.
[16:49]
From the side of the podium.
[16:52]
Thank you for your service. I'm looking forward to continuing to working with you all in this different role.
[16:58]
If there's anything that I or we can do to continue to support you all in this important work or you just want to chat about land use.
[17:11]
I think you know where to find me. Yeah. Thank you so much.
[17:15]
Thank you. Congratulations.
[17:19]
Congratulations.
[17:20]
Director, I have a quick question.
[17:22]
So I think the council approved the consultant.
[17:26]
That's right.
[17:27]
Contract.
[17:28]
Last week.
[17:29]
Could you give us an update on what you see coming down the process?
[17:33]
So Commissioner Manning is referring to the contract with the consultants who are going to be helping us update the land use code.
[17:40]
I emailed with the chief, what is her title, procurement officer, Bailey Andrea earlier today,
[17:52]
and she said that the contract with them is awaiting their signatures, you know, just
[17:58]
anticipated. It's just a matter of signing it, not that there's anything particularly controversial
[18:03]
about the contract. And as soon as they sign it, she is going to call a kickoff meeting
[18:10]
with the consultants. And at that time, we will be creating a timeline and figuring out
[18:16]
what's next. As you all know, there's been a land use code development committee that's
[18:23]
been meeting for about 10 months. So I think that group will be reconvening once we have
[18:29]
better sense of a timeline in collaboration with the consultants. So, I don't have anything
[18:33]
more concrete at this time. If you're all interested in reviewing the proposal put forth
[18:39]
by the consultants, that's available on last week's town council agenda, or you can email me
[18:46]
and I'll send you a copy. I'm sure there'll be some revisions, but that at least gives you a sense
[18:51]
of what they're generally planning to do. Will there be any adjustments made to the
[18:59]
But who's the committee or is that committee fixed now?
[19:04]
We'd have to talk about that, I think it's possible.
[19:09]
I mean, they're going to look at the entire land use development code and make amendments
[19:14]
or suggest amendments.
[19:16]
And so I believe that is possible.
[19:20]
And I do think that it's in my power as the director to me hearing from the community,
[19:28]
people who have been exploring the limitations of the land use code over the past almost 30 years,
[19:35]
since it was last updated. I really want to hear from those people. So my hope is that we will
[19:44]
in collaboration with the consultants have ample opportunities to hear from people about where they
[19:49]
bumped up against the limitations for what they really love about the land use code.
[19:56]
We want to hear
[19:58]
or in other opportunities we do want to hear from many, many community voices.
[20:05]
And I believe that the consultants will be scheduling not public meetings, but I guess
[20:10]
public community meetings for people to come and get together and give their suggestions.
[20:17]
Do you guys have like a time of when that's going to be a date?
[20:20]
So the timeline that they gave us had them providing the final deliverables, I think February of 2028, so in about a year and a half.
[20:34]
That feels far away, but it also feels soon when you think about the weight of what we want to accomplish.
[20:45]
revisiting this code that, again, hasn't been holistically updated in almost three decades.
[20:53]
And understanding that any change comes with a lot of conversation.
[20:58]
So I hope we can do it as quickly as possible, but we also want to do it in the right way.
[21:08]
And I just want to add that once we do get a document, you all will be reviewing it as a public
[21:17]
hearing to make a recommendation to town council so you can go through it and then if you have
[21:25]
any suggestions that maybe you want to continue it to another meeting so that we have time to
[21:31]
incorporate those changes. I'm sure that the consultants will be here for that meeting and they'll
[21:39]
take your ideas into consideration and either update it or send those forward to town council for
[21:46]
final approval. And you all, as well as anyone who's listening to this now or in the future,
[21:55]
is welcome to send me an email with suggestions or me with me to talk about suggestions I do really
[22:02]
want to hear from people.
[22:06]
Thank you. About matters from the Planning and Zoning and Historic Preservation
[22:11]
commission.
[22:15]
I would just like to say a big thank you to ex chair Mondragon for the time and
[22:22]
service he put into the board and the knowledge he taught us all. I just wanted to say a big thank you
[22:27]
and also thank you to director Goldman for the time she put on the board and look forward to
[22:35]
working with you in the future.
[22:42]
Number 11, I will enter a motion if there's nothing else to a Jordan.
[22:46]
So move. Second.
[22:54]
Thank you. You can do all. Yeah. I'll see. Hi. Hi. Hi. Thank you for just meeting
[23:04]
You never see the cops.
