[3:26] Um I know that's been time consumptive for nearly everyone involved.

[3:31] Um but they were particularly helpful um lately and um they know the nature of

[3:37] those discussions. Some of those things have not come of record yet. I expect

[3:40] that they will shortly, so I will keep the commission apprised, but it's worth

[3:43] noting the extra time and investment and efforts they both put in

[3:47] there because it is significant. Um on that point, uh shortly after I met with

[3:51] that pair today, um, I received a series of motion filings that ought to keep me

[3:55] busy for the next couple of weeks, um, in connection with that litigation.

[4:00] Um, nothing to worry about at this point, and I'll keep you updated

[4:03] as I prepare our responsive filings. All all of the motion filings that were had,

[4:08] um, were anticipated, so, um, just letting you know in case you see or hear

[4:12] any of that, um, that is underway and expected,

[4:17] um, Finally, uh, on the roller coaster road

[4:20] front, I should say. Finally on that front, um, there is a deposition, uh,

[4:24] likelihood of deposition to occur, um, with another, uh,

[4:28] I I guess disclosed expert or identified expert in connection with that matter.

[4:34] Probably that will occur in or near September 17th. Um, we haven't firmed up

[4:38] that scheduling with all the counsel yet, but that's what it's looking like.

[4:41] And shortly after the meeting I had today, we became aware of possibly

[4:45] another two depos that may need to occur. I would expect those might be

[4:48] sometime in late, uh, September given the

[4:52] tracking of that case. Um, I guess it's also worth mentioning that, um,

[4:57] Wendy and I are working on one project. Um, when we get that complete and it

[5:01] becomes ripe for public disclosure, um, we will clue you all in, um, but I

[5:08] imagine, um, following the the budget work that I know was pretty, again,

[5:12] heavy duty for both Jade and Wendy. Wendy's going to find herself pretty

[5:14] busy over the next couple of weeks helping me with that matter.

[5:18] Um, and I know she'll do a good job, so I appreciate that in

[5:21] advance. Um, running through my checklist here, I didn't see anything

[5:25] else on tonight's agenda, which I think requires attention, but I'll stand by

[5:30] through the duration of the meeting and be pre-

[6:15] we move towards closing that out. The contractor's application for payment. I

[6:20] did not receive that yet. So, I anticipate that at the

[9:40] Uh starting off tonight I got the Signal Road rehab project. So we've gone

[9:44] through and analyzed the drainage. Um done the preliminary drainage analysis.

[9:51] We have a plan kind of going forward of what we're going to need to do with that

[9:54] flood plain being through that Signal Road project. Talking with my uh storm

[9:58] water designer here, his plan is to draft a memorandum that uh understanding

[10:03] and kind of provide that to the appropriate regulatory agencies as long

[10:07] as as well as apply for a no rise permit.

[10:10] Uh the long and short of it is since we're helping the water get to where it

[10:13] needs to go instead of impeding it with our construction, we should have an easy

[10:17] time going through that process. Um so they're already working on that

[10:20] now. Earlier we get started on it, the earlier we can confirm that's going to

[10:25] work with the regulatory agencies and make any adjustments they need, so

[10:29] uh we're in the process of that now. Um in addition, we went through and did

[10:34] an evaluation of the existing infrastructure conditions, just kind of

[10:36] making sure that we're not planning anything to be replaced that

[10:39] doesn't need to be replaced. Uh particularly like

[10:43] areas where the sidewalk is and if it's in good condition, we obviously don't

[10:46] want to have any grading that's going to affect it, so then we know to grade

[10:49] those areas appropriately. Um so we did kind of just a drive through to make

[10:53] sure that we're not inadvertently [clears throat] affecting something good

[10:56] and making it worse. Um I marked that up.

[11:00] That being said, uh we did get the soil recommendations

[11:04] in and uh typical section from the geotechnical. They did find that there

[11:09] was a lot of organic materials throughout the soil here uh except for

[11:12] about a foot down below the base. They said they didn't see it everywhere,

[11:16] but that they are seeing kind of a high rate of that.

[11:20] Um which means we are going to have to do either some sub cuts or some subgrade

[11:24] preparation with this plan um in order to address that.

[11:29] Uh we have the 30% review meeting uh scheduled for this Wednesday.

[11:34] Uh um We'll kind of give our recommendation at

[11:37] that point of what looks best, kind of talk about in

[11:40] details of how you how we can address the situation, but uh just kind of be

[11:44] aware that that's right now the biggest uh um

[11:48] biggest thing that's popped up is low soil organics.

[11:52] Um and at that meeting we plan to propose our our provide our uh

[11:56] preliminary drainage plan, our uh initial grading, you know, it's not all

[12:02] fine-tuned, but what we've got so far and uh

[12:05] the typical sections, which uh based off the

[12:09] recommendation from soil is they recommended 8 on 12 for concrete or 5 on

[12:13] 12 for asphalt. So, the aggregate's basically the same

[12:17] either way, just kind of varying pavement thickness depending on

[12:21] the material there. And then uh we'll kind of discuss that

[12:25] in the plan going forward and what our recommendations are and uh move forward

[12:29] from there. That being said, we're about 2 and 1/2 weeks 2 and 1/2 weeks ahead of

[12:33] the schedule on that. We're going to hold that meeting, so that's kind of a

[12:37] good sign moving forward. It was uh scheduled for early September.

[12:41] And uh we're ready a little bit earlier than that.

[12:45] Any questions about Signal Road at this time?

[12:49] » Not for me.

[12:52] » I'll move into 67th Street then. So, last week our survey team completed the

[12:57] survey and they're uh processing and now they're nearly done. I was hoping they'd

[13:02] be done today before I got here, so I wrote processed. I guess I was giving

[13:05] them a little more credit than they were due. It's going to take them one more

[13:09] day. But, that being said,

[13:12] we have services now ready to go and the design team is going to be reviewing

[13:16] those existing services the same way we did with Signal Road, find out kind of

[13:20] where the problem spots are for sure in the surfaces and start tweaking things

[13:26] to address them and create a drainage plan.

[13:28] They're also creating a drainage model the same way. Um

[13:32] and it's being constructed for those existing conditions, see how things are

[13:35] flowing first, and then we'll kind of build a recommendation or proposed

[13:38] drainage plan from that. Um and actually on the way here, got the

[13:42] quote from the soil borings and for the report. So, I will sign that and send it

[13:46] over to uh material testing services tomorrow

[13:49] and get them going. It's a good-looking quote with everything we need. They're

[13:52] going to do 13 soil borings. Uh so, that's two on Dakota Street, two on the

[13:57] intersection there, and the rest spaced evenly throughout on 67th Street. Uh

[14:01] that should give us a good idea of what what is needed along that street.

[14:06] One thing that we did see as we did the survey,

[14:08] um that just to be aware of is that the properties along 67th Street actually,

[14:16] as we do the topographic survey, we also complete a legal survey, so that way we

[14:19] can help with any grading easements that need to be done. We found those

[14:22] properties actually extend quite a way uh towards the road, about halfway into

[14:27] the ditch. Um

[14:30] it's not a huge problem for construction. When we get a temporary

[14:33] easement anyway, it's to build that stuff. And anytime we're working along

[14:37] their properties, we always get some sort of temporary easements with those

[14:40] properties, so that way we can work in there.

[14:43] But, with them owning about half the ditch, and if we're building a ditch and

[14:47] culvert section, the city probably wants the ability to

[14:50] go in there and access and maintain it in the long run. So, I would recommend

[14:55] getting some kind of permanent access and maintenance easements uh constructed

[15:00] while we're doing this kind of survey work. That way, the city has the ability

[15:04] to maintain those ditches once they're built.

[15:14] » I don't at this time. We can speak more on Wednesday, too, with our

[15:29] notification from the the drinking water state revolving fund that they are

[15:33] currently putting together the priority list for the next year.

[15:41] allows you to be eligible for the SRF funds if you apply for them later. Um

[15:47] so, if you have any drinking water projects that

[15:49] you think the city might do in the forthcoming years,

[15:53] it's takes about a half hour for us to fill out the questionnaire and get you

[15:55] on there. And then, you're eligible for the funds

[15:58] in the long run. So, I just wanted you guys to be aware of that.
