[7:11] 2016. and personally this man's responsible for

[7:16] the VA first of all downtown Redevelopment

[7:21] he has done a marvelous job I will tell you that we started this journey for the

[7:26] VA probably about five years ago I guess it's

[7:29] it started with Senator or Congressman MacArthur asking

[7:34] me to write a letter about a new VA cboc in Ocean County and when I inquired

[7:40] where it was going to be they said well we're looking at Brick we're looking at

[7:43] Burke they said what about Toms River my next call was to Dave and said Dave

[7:48] put something together we have about three weeks before the submissions are

[7:52] over Dave put it all together

[7:55] an air designated an area of Redevelopment out near the TD Bank

[8:00] and we were Off to the Races truth be known we had it in 2020 and the

[8:06] contractor didn't sign the contract he bailed out so the whole process started

[8:10] over again and Dave I know in retirement is going

[8:14] to be glad because he won't hear me calling him every week and saying what's

[8:17] the status of the VA what's the status of the VA but that was important to me

[8:22] and it was important to Dave and it was important to the veterans of Ocean

[8:26] County it's a perfect site you have mass transit there you have bus service you

[8:32] have two large banks in the area you have malls you have restaurants plus you

[8:37] have the Ocean County Social Service building right behind it with the

[8:41] veterans Service Bureau so it was a perfect location and Dave spearheaded

[8:45] that put a lot of work into that and I can't thank him enough and he leaves big

[8:51] shoes to be filled and I know he's not going to be away I

[8:55] said I hope you don't leave the area because if we have a question I want to

[8:59] be able to dial you up and and get a quick answer now Dave will always give

[9:05] you the right answer it's not necessarily the shortest answer

[9:10] so so I do have to ask them sometimes when

[9:14] I do my rounds Dave give me The Abridged version

[9:18] but I guarantee you if Dave gives you the answer you can take that to the bank

[9:23] and Dave I for one along with all the council and I think all the residents of

[9:28] Toms River and your staff at zoning engineering planning are going to miss

[9:33] you and we spared no expense on your plaque

[10:47] accomplished a lot I first want to thank God for allowing me to move close enough

[10:51] to where this when this position became available it was it seemed too good to

[10:55] to be true and then I I also want to express my gratitude to late mayor Tom

[11:01] Kelleher for uh recommending me at the time in the council for supporting me at

[11:05] the time and then especially the man to my left uh mayor mohill for keeping me

[11:11] on um in 2020 and then really

[11:15] um just the uh just all of the the people I've been fortunate enough to

[11:19] work with and and the organizations I've been fortunate enough to to work with as

[11:23] well uh the Toms River bid the ortley beach voters and taxpayers associate

[11:28] Nation different organizations around town one thing I learned when I came to

[11:33] Toms River I thought I knew something about the town because I drove through

[11:37] it all the time to get home but this is an extraordinary Community I've been

[11:42] working I can have the gray hairs to prove it since 1981 in this profession

[11:48] I've been around many parts of the state and worked with many towns and I have to

[11:54] tell you this community that you are one of the best there is no better and

[11:59] especially the folks that work in this building

[12:02] um with every Department I was I think I mentioned on Friday evening that when

[12:07] you come to department head meeting and you look around the room and see the

[12:09] talent and the expertise that is that works for that serves this Township it

[12:15] is truly an honor and privilege to be concluded in that group and I've been

[12:19] able to have that privilege for the last six years so I also want to I also want

[12:23] to express my gratitude to all the folks in uh that are sitting in the third row

[12:28] we really do um and also in the first row

[12:32] we really do work as a team and we're really a family I think I can say that

[12:36] honestly we if family members have disagreements from time to time but they

[12:41] always have each other's back and you'll notice that in our group so I was it was

[12:46] a great privilege to work with this group uh for the last six years also in

[12:51] in response I want to express appreciation to the mayor for all the

[12:54] kind words about the VA but I remember um they and I think a number of the

[13:00] council folks have been through this as well over the past few years working

[13:06] with all these different Redevelopment projects but I remember with the day we

[13:10] found out that the lease had been signed it was actually signed which was July

[13:14] 30th of 21. and we were we got together at the end

[13:19] of the day to kind of celebrate and I I remember saying to the mayor well now

[13:24] the hard work really begins because this thing this thing has to get built in 24

[13:28] months and I want to just point out even though I've been getting a lot of the

[13:33] credit which I appreciate there's a lot of folks that are responsible for that

[13:38] VA getting built I want to very specially mention Bob Jim Kelly and

[13:42] who's sitting in the front row he deals with things with that project behind the

[13:47] scenes that nobody knows about keeping that project alive he's saved it

[13:51] multiple times since we started it the building department that Bob oversees

[13:55] has been part of that project and and is going to be part of all the other

[14:00] Redevelopment projects that we hope to see happen in this in this town so I

[14:04] just wanted to also pass along some of that credit uh they did they all deserve

[14:08] your thanks uh for that project getting done and I just wanted to again

[14:13] appreciate the opportunity to be a public servant that's what we do and it

[14:18] was a privilege to be here for the last six years of my career I couldn't have

[14:22] asked to be in a better place thank you very much

[20:41] and the former in the form of partial cash and partial bond to ensure that the

[20:46] work is completed in accordance with the plans approved by the planning board in

[20:49] this case after the work has been done and inspected by my office they moved to

[20:54] what's called a maintenance bond which is sort of like the warranty so after

[20:57] the work is done we certify that then it's appeared make sure the the trees

[21:01] don't die the sidewalk doesn't crack so just to clarify though this this isn't

[21:05] releasing this is accepting right Mr Chuck Hanley can you also

[21:09] explain that if you didn't subject the township to litigation I just want to

[21:12] clarify something it is releasing the performance guarantee and accepting a

[21:16] maintenance guarantee which is what Mr Chicken was just explaining

[21:19] this Project's complete yes right so we're moving them on to the basically

[21:23] the warranty period the project been developed as in

[21:28] accordance with the approvals yes sir and the performance guarantee uh the

[21:32] recommendation to release a performance guarantee would not be provided to the

[21:35] council unless your office had inspected those uh work and found it find it

[21:39] acceptable in accordance with the approval that's correct sir thank you Mr

[21:43] lamb good question I was gonna say if you didn't if you didn't follow the

[21:46] procedures probably for Mr McGuckin as well then that would subject the

[21:49] township to exposure litigation is that correct

[21:53] yeah spine or something the the applicant went to the planning board

[21:56] it's a condition of their approval and they're following what the right word

[22:00] requires thank you just for a legal opinion uh Mr McGuckin if you don't

[22:03] release the performance guarantees if our engineer says the work's been done

[22:07] in accordance with the plan and we don't release the performance guarantee the

[22:10] attach it would be subject to a lawsuit then face the law uh monetary damages

[22:14] penalties and potential attorneys fees for the plan and if we don't accept the

[22:18] maintenance guarantee the town is not protected in case something happens is

[23:42] this is uh really actually a grant agreement uh Amendment

[23:47] um to answer your question the particular there's really it's called a

[23:51] loop because that's what we thought it was going to be when we first made the

[23:54] application it's really uh too parallel two-way roads now Water Street and

[23:58] herflicker Boulevard a lot of the work is going to be involving her the

[24:02] construction of perfect Boulevard which right now is not a full Road

[24:06] um the other part of it another part of that will be the roundabout that we've

[24:10] talked about past what this item is uh just to explain to the for the matter

[24:15] for the public is we had a grant agreement dated I believe is September

[24:20] of 21 with the Federal Highway Administration for the 5.66 million

[24:26] dollar Grant of which uh is a portion of the projects about uh 76 percent of the

[24:33] project the grant agreement had a budget and a

[24:38] schedule in it uh what we what this grant agreement changes is they allowed

[24:44] us right now we're in final design we're about to start final design and then the

[24:48] next step would be to go out to bid and then build the project by uh September

[24:52] of 2025 you're supposed to have it built within five years of of the

[24:57] appropriation by Congress of the money so what this grant agreement does is it

[25:01] it changes the the budget so it front loads the design into the grant so that

[25:09] all of design costs that we really the only cost we're incurring over the last

[25:12] couple of years have been design costs the original budget had its split

[25:17] between the Grant and the match the townships match now everything's going

[25:21] to be able to be paid for out of the grant so we've had invoices that we've

[25:24] paid that we haven't been able to get reimbursed for by signing this grant

[25:28] agreement that that will that that's a formal recognition by the Federal

[25:31] Highway Administration that we can now submit for reimbursement it's a

[25:35] considerable amount of money uh it's about the the preliminary engineering

[25:39] costs alone was 544 thousand dollars so we're going to be able to get reimbursed

[25:43] for some of that money now because of this granted

[25:56] roundabout which according to the picture

[26:01] the pictures don't fit the definition of Amanda

[26:04] the pictures fit the definition of a circle the circle is where the roads

[26:08] that are your roads come in square and you go around around about where there's

[26:12] a minimal 30. so basically we circle now my question is this

[26:19] Department of Transportation has many many

[26:24] cons to building these okay one of the cons for example is

[26:30] where one roadway or two can monopolize the circle meaning where there's two

[26:36] lanes of traffic coming into the roundabout or the circle this Mr Kelly

[26:43] Davis statistical back in April that there's a

[26:48] 40 percent less chance of accidents around

[26:52] important truth because if you look at all the statistics that lead the end of

[26:57] the Record Service said the same thing where you have two lanes of traffic in

[27:01] the same direction going into the circle the accident rate goes up 60 percent

[27:05] the other thing in the states is they should not be built in an urban area

[27:08] which we are a city here it should not be built where you have consecutive

[27:13] traffic lights you have to buy traffic lights down Water Street

[27:17] it's dangerous to pedestrians and bicyclists and part of the premise of

[27:21] the new towers going up was that the people because the hospital is a

[27:27] teaching hospital now people would be walking or riding bikes going back and

[27:31] forth to the hospital and Department of Transportation

[27:35] has already said they're dangerous to pedestrians and bicycles so I guess it

[27:40] comes back to my question would be if there are so many

[27:45] companies and what the other con is it slows down traffic in peak hours that's

[27:49] another one of the concepts of Department of Transportation road

[27:53] so why are we getting something that is not going to help us

[27:59] it's from all the things all the guns beating

[28:03] this situation

[28:05] as well and my lesson on the decision I was told in April that one of the

[28:11] questions I guess that that I had back then but I was I was uneducated as far

[28:16] as a man was that the traffic coming into Lakers Grove there well the parkway

[28:21] going north uh who's backed up in the mornings on

[28:25] the parkway well this year I've had the great Fortune to go down to Manahawkin

[28:29] because my two grandsons and I come back every morning between

[28:34] quarter after three and quarter to nine

[28:38] I've never been backed up on apartment so I don't I I think one of the problems

[28:45] is being overlooked here is where do

[28:52] they walked at Lakers Grove go and

[28:57] number two is we still don't have a way once you get people downtown

[29:03] we have two late roads we don't have four lane roads to get around they get

[29:07] jammed up uh I I

[29:11] don't understand how the people couldn't do something as

[29:17] simple as if you look like they follow people Mr

[29:20] tramone if you don't mind I'm just going to ask Mr Chicken to explain what item p

[33:18] inspect the developers project right the developers contributing uh for our

[36:07] goes on but we're again the obvt and myself are eager to get this off the

[36:17] out that whole Corridor to Northbound Corridor and and the signage I'm told by

[36:21] the obvta they liked it as well so we're looking forward to getting this started

[39:06] if there's any way I could put a request in to have a pavement done

[39:11] is it uh just uh the pavement is that the issues it's it's got a ton of issues

[39:16] but even so I believe at least no plows are

[39:21] shards are sticking up from it so I'm we're like the only Street where my kids

[39:25] kick a soccer ball and it pops so I know one of the other residents here his wife

[39:30] had an issue someone else's mother had an issue so is there someone I can

[39:35] request that to Mr trinkelian he's going to give you his card right here Mr Kelly

[41:17] because I called the township about six seven times the guy Andy very nice guy

[41:23] he comes right out they patch the holes but when it rains they just peel right

[41:29] back up we have pictures it's really bad it's the water department came out they

[41:35] put a whole new valve system in there was a box about that big it was about

[41:39] five inches deep they came out the next day to fix it Andy's been very nice it's

[41:43] been coming out all the time and patching them but we got past years old

[41:47] people right Mr Chicken do you think you could do an inspection on that street

[42:05] been very good he's been coming out and patching he knows we've been dealing

[42:09] with it for two years and when I called her she told me that it's not on

[42:17] mailbox like razor blades we'll have a site

[42:20] inspection done tomorrow and if you want to leave
