brings us on to number three on our
[8:18]
agenda is a public hearing and a
[8:20]
decision from Steve Muros in behalf of
[8:22]
Suzanne Jameson, property owner to
[8:25]
authorize the use of automobile service
[8:27]
and repair to occur at the property
[8:29]
located at 397 North Main Street in the
[8:31]
general commercial GC zoning district on
[8:35]
26 acres.

month for a car rental uh of

or car dealership here. And um they are

the property owners, but they have

property to an automotive auto

automotive repair and service um
[9:08]
business instead. Um and so we do have
[9:12]
to go through the conditional use
[9:13]
process again because it is not the use
[9:16]
we did approve um with the dealership.

Um so as you can see this is in the
[9:24]
general commercial zoning district
[9:27]
uh and all surrounding uh properties are
[9:32]
zoned GC but there are some
[9:34]
non-conforming residential uses that are
[9:37]
adjacent to this property as well.

again, the proposed business hours are
[9:47]
Monday through Friday, 8:00 a.m. to 6:00
[9:49]
p.m. and Saturday 8 to 3:00 p.m. Um, and

the reason why I bring that up is

because automotive services are going to

be a little bit louder than a car
[10:01]
dealership because there's going to be
[10:03]
constant
[10:04]
um noise from um cars being repaired and
[10:09]
tools being used and that type of thing
[10:12]
there. And so,
[10:15]
uh, one of the things that we are
[10:17]
recommending is that we put, um, a limit
[10:22]
on the time frame as far as them using
[10:25]
the louder, um, tools and that type of
[10:28]
thing with the card, uh, auto repair
[10:30]
shop. And so, um, that is one condition
[10:35]
of approval that we, uh, that the staff
[10:38]
is recommending. And then this is also
[10:42]
again the auto repair shop. We've got um
[10:49]

site where they're going to be storing
[10:56]
the um vehicles that are getting ready
[10:59]
to be repaired on uh the west side of
[11:03]
the building. Um, it is currently there
[11:07]
is a like a rod iron fence across the
[11:10]
front of it and I'll get to that and
[11:12]
show that to you a little bit later. Um,
[11:15]
this is also the front side or the main
[11:18]
street side of the building. There is um
[11:23]
parking that is available there. There's
[11:25]
a handicap stall along with [gasps]
[11:28]
a couple additional um off- streetet
[11:31]
parking spaces. On the original
[11:33]
approval, we did uh put in the condition
[11:37]
that uh there's no on street parking for
[11:41]
their customers and I was just going to
[11:43]
carry through with that or carry that on
[11:45]
to this condition of approval as well.

and then again on the prior approval we

did uh say that or put on the condition

to help reduce any issues with lighting

that all any new lighting that is

condition of approval with this again

that was carried over. Um

And then this is um the fencing that is

facing westward. And so um that is not

an a a solid fence just so you guys are
[13:06]
aware. And then there is also um some
[13:09]
fencing towards the west and then um
[13:13]
south portion of the property that does
[13:16]
have solid fencing. There is also
[13:19]
fencing or this is from inside the the
[13:24]
um
[13:25]
parking area looking on 400 north and um
[13:31]
that's just showing you the view of the
[13:33]

recommended uh motion is to approve the
[14:26]
conditional use with the conditions of
[14:29]
approval that I discussed. So, if

is a condition a conditional use, that

could be something that we would need to
[15:30]
do to mitigate any kind of issues that
[15:33]
would arise with the commercial being
[15:36]
next to residential.

are waiting to be repaired can be on

site. So, um I can let him go into
[17:24]
details. I believe he is here right now

on how he is planning on doing that. Um,
[17:31]
I think looking at the lot, it looks
[17:34]
like there's
[17:36]
um there's a bit of room onsite and then
[17:40]
really it wouldn't make sense to do off
[17:43]
offsite parking. Um, it just would be
[17:47]
really dangerous off of 400 North and
[17:49]
then um up in front of Main Street. All
[17:53]
of that is just approach and you know
[17:56]
like drive in and drive out areas.

that are right next to the building. It
[18:03]
just it wouldn't really be intuitive for
[18:06]
people to park on the street there
[18:08]
really. So,

that until the the owner is up

I own the property west of the the
[21:11]
building right there next to the
[21:13]
parking. Um
[21:16]
many of my questions were already
[21:18]
answered with what she has said, but um
[21:22]
so so this is going to override the
[21:26]
other which we already did the other
[21:30]
week. So um

does this mean that we're going to have
[21:35]
like early morning dumpster pickup and
[21:38]
how often uh are they going to put a
[21:40]
dumpster in there? Um

let's see. Um and my my biggest concern
[21:49]
really is um environmentally what does
[21:52]
this mean about the waste management?

Like are there floor drains that have
[21:57]
the that have the required uh that are

equipped with the oil grease traps or

how is that going to be cleaned up?

because I noticed that when they were
[22:06]
cleaning out their bay the other day,

the water was just being washed out to
[22:10]
the road and to the um [snorts] into the
[22:14]
gutters, water was coming down through
[22:15]
the gutters. So, I'm just curious as to
[22:17]
where where is this waste going to go
[22:21]
like and is [snorts] it where is it
[22:23]
going to be stored while it's waiting to
[22:26]
be picked up if they're doing a pickup
[22:28]
type
[22:30]
thing? Um,

and I know that years prior when there
[22:35]
was a a building that had um there was a
[22:40]
auto repair, we had issues with um with
[22:43]
the the oil and stuff not being uh
[22:46]
disposed of properly. So, that's like

one of my big concerns right there. And

then um also I just want to um
[22:56]
give a reminder about the American
[22:58]
Disabilities Act about the no parking on
[23:00]
the sidewalks because I've seen that
[23:02]
happen a lot with the businesses. In
[23:04]
fact, the other business up on Main
[23:06]
Street has I've seen some of their cars
[23:09]
parked there. So, but these guys are not
[23:11]
going to be displaying cars and stuff.
[23:13]
So, um I I know that it has to be
[23:16]
whether it be customer or or business
[23:19]
cars that they're not to be parked on
[23:22]
the driveway. Um I didn't realize how
[23:25]
much that affected people until my mom
[23:28]
was in a wheelchair and had to wheel her
[23:30]
around and had to backtrack so many
[23:32]
times just to get around vehicles. So,
[23:34]
it's really important that that's noted
[23:37]
and make sure that their vehicles are
[23:39]
not on the sidewalks. A lot of traffic
[23:41]
comes down that sidewalk. So
[23:44]
just that's pretty much all I have right
[23:46]

heavier repairs like that. I know that leaks all over the floor. Do you

have a a spill plan in place? Do you

have drains or is this going to be kind
[27:40]
of a repeat of of past situations that
[27:42]
the public has brought up where it's
[27:44]
going to be leaked out into into the
[27:46]
gutters and rainwater and such?

there was no oil, you know, it was just
[27:54]
we were washing the floor like the, you
[27:56]
know, dust and stuff off the floor so it

wasn't getting trapped in the office.

But yes, I do, um, you know, they make

the, uh, oil absorbent socks, you know,
[28:03]
stuff. So, if there is, you know, spill
[28:04]
or anything like that, that absorbs
[28:06]
them. Um, I mean, every shop that I've

ever ran and been at, um, you know, we,
[28:12]
uh, we've got bags of floor dry on site,
[28:15]
you know, you get all that up. We have a metal dumpster, a metal bin, you know,
[28:20]
you put all that stuff in and then
[28:22]
dispose of that. Um, I do have a oil
[28:24]
company that I'm working with that it's
[28:26]
all going to be contained. The waste oil
[28:28]
will be contained. Um, the new oil will
[28:30]
have a containment system and stuff as
[28:33]
well.

With the previous limit on the previous
[28:37]
uh conditional use permit of 10
[28:39]
vehicles, is that going to still be
[28:40]
enough space to get those oil trucks in
[28:43]
and out and be able to get um which
[28:46]
brings me up to my next question. Are

you planning on towing vehicles in? Um
[28:50]
and if so, do you have a plan on how
[28:52]
long those will be on property?

>> Yep. Exactly. So, um yes, we
[28:56]

[28:58]
plenty of space. Um, I asked that I mean

11 spots because if you look at that uh
[29:04]
right by the front door, that bay right
[29:06]
there. Um, we're not going to be doing
[29:09]
too much work out of that bay. So, it'll
[29:12]
typically just be my truck that is
[29:14]
parked there. U, but I totally
[29:16]
understand and agree. Yeah, I mean, with
[29:17]
the parking, you're crazy if you're
[29:19]
parking out on the street there. I mean,
[29:21]
you're asking for problems [snorts] and
[29:23]
that's something that me and my staff
[29:24]
will have to, you know, mitigate and
[29:26]
continue to get cars pulled back and
[29:30]
talking with customers of, hey, you
[29:31]
know, we can't park there. Definitely
[29:33]
mindful of that. I mean, first and
[29:34]
foremost is safety is everything to me.
[29:38]
So, and that's everywhere I've been.

utilizing different tow companies or

have your own tow truck on site? No, we

would just uh so it's just customers if
[29:49]
they need their car towed in, you know,

to be towed in. Um that depends, you

know, of how the length of time, you
[29:55]
know, that'll be there depending on, you
[29:57]
know, repairs. But any car that gets
[29:59]
towed in, especially if it's overnight
[30:01]
or anything, we will get it moved, get
[30:02]
it uh moved around to the back lot, you
[30:05]
know, is pretty much um how that works.

But as to um the point that you were
[30:10]
talking about is any cars, so I've got a
[30:12]
very strict limit, and this has been at
[30:14]
every shop I've ever been at. I don't
[30:16]
like clutter and I don't like stuff
[30:18]
building up. I am very OCD about that
[30:21]
stuff. Um, and so what my thing is on
[30:26]
that for any customer and I hang signs
[30:27]
up saying it, any car that is left there
[30:30]
for, you know, more than, you know, 4
[30:33]
days to a week, um, I charge a fee,
[30:36]
right, of how long it is there, it's a
[30:38]
$50 fee each day that the vehicle is
[30:41]
there. And then at that point, I have it
[30:42]
towed and impounded. So, I don't have
[30:45]
cars because to me that's money that's
[30:47]
sitting in my lot that I'm not being
[30:50]
able to do anything with it. I can't
[30:52]
have it. [clears throat] So, and it's
[30:53]
also space that I can't use. So,
[30:56]
>> and then with the concern of vendors, I

mean, he showed a believe it was a
[31:00]
Cornwell truck that was parked up on the
[31:02]
sidewalk there and the concerns of ADA
[31:04]
and access on that sidewalk. Um, my
[31:07]
first question is, will there be ample
[31:10]
space for your vendors to be able to
[31:11]
pull in if they need to be on property?
