agenda item is the approval of the

meeting minutes from March 17, 2025 uh

for case

Charter. uh applicant requests that the

Ches Beach Zoning Board of Appeals to

quote order the zoning administrator and

planning and zoning commission to

immediately commence and prioritize the

processing and review of the relevant

site plan submitted by Rod and Real. Uh

Don states and that the zoning
[1:47]
administrator and planning and zoning
[1:49]
commission be ordered to apply the
[1:50]
zoning ordinances in effect as of

January 29, 2021 when their applications

were submitted and for such other and
[1:57]
further relief as the nature of their
[1:58]
cause requires. All right. Where we left

it last time was we had uh

discussed uh the where the board stood
[2:08]
uh verbally and we had sent Fred off
[2:12]
with his uh lawyer hat on to uh write
[2:15]
that up. After some uh Fred, is there

meeting, uh the board board members

worked with me to prepare a draft of a

resolution uh embodying the decision of

eight or so drafts of the resolution.

Some revision uh more significant than
[2:47]
others. and
[2:50]
uh have before you tonight for
[2:53]
consideration a resolution disposing of
[2:56]

at this point in time, I know we've all

done this, but for the record, is there

reasons it is this the 31st

at least three members of the board who
[4:16]
attended all proceedings uh concurred
[4:19]
ordered that the appeal of the Rodri
[4:21]
Incorporated Donovan Estates LLC in case
[4:24]
2303 is hereby dismissed.
