[0:09] One, two. Good. Okay. Um, welcome. Uh,
[0:15] this is the call to order for the Ches
[0:16] Beach Board of Appeals, uh, March 31st,
[0:20] 2025. Uh, today we are here to do two
[0:23] things. um approve some meeting minutes
[0:26] uh from our last get together and
[0:28] conclude deliberations on case
[0:31] 202303. We begin with a roll call for
[0:33] board members. Um please answer if you
[0:36] are present. Uh Mr. Paul Dhy present.
[0:38] Miss Amy Everett present. I am Mr. Jody
[0:41] Hoonar. We have a quorum. Uh the first
[0:44] agenda item is the approval of the
[0:45] meeting minutes from March 17, 2025 uh
[0:49] for case
[0:50] 202303. Um, does anybody
[0:53] have issues with the minutes as they're
[0:56] provided?
[0:57] Objection. All right. In that case, I
[0:59] would entertain a motion to approve the
[1:02] meeting minutes. I move a second. I'll
[1:04] second that. All right. Meeting meeting
[1:07] minutes are approved. Um a lastly we are
[1:12] in deliberations for case 2023 Rodenreal
[1:16] Incorporated Donovan Estates LLC to
[1:18] consider an application from Rodenreal
[1:20] Donovan Estates Estates of 4160 Mir
[1:22] Avenue uh for a decision on
[1:24] interpretation alleged error to article
[1:25] 6 section 2923 2931 A1 and A6 of the
[1:28] Ches Beach zoning ordinance and C309
[1:31] C310 C311 of the Chesapeake Beach Town
[1:34] Charter. uh applicant requests that the
[1:36] Ches Beach Zoning Board of Appeals to
[1:38] quote order the zoning administrator and
[1:39] planning and zoning commission to
[1:41] immediately commence and prioritize the
[1:42] processing and review of the relevant
[1:44] site plan submitted by Rod and Real. Uh
[1:46] Don states and that the zoning
[1:47] administrator and planning and zoning
[1:49] commission be ordered to apply the
[1:50] zoning ordinances in effect as of
[1:52] January 29, 2021 when their applications
[1:55] were submitted and for such other and
[1:57] further relief as the nature of their
[1:58] cause requires. All right. Where we left
[2:01] it last time was we had uh
[2:04] discussed uh the where the board stood
[2:08] uh verbally and we had sent Fred off
[2:12] with his uh lawyer hat on to uh write
[2:15] that up. After some uh Fred, is there
[2:19] something you'd like to say? No, I was
[2:21] just going to say after the last
[2:23] meeting, uh the board board members
[2:27] worked with me to prepare a draft of a
[2:30] resolution uh embodying the decision of
[2:34] the board. Uh I want to thank board
[2:36] members for their
[2:38] cooperation. Uh I think we went through
[2:41] eight or so drafts of the resolution.
[2:44] Some revision uh more significant than
[2:47] others. and
[2:50] uh have before you tonight for
[2:53] consideration a resolution disposing of
[2:56] this case. Thank you, Fred. Um yeah, uh
[3:01] at this point in time, I know we've all
[3:03] done this, but for the record, is there
[3:05] anything any of our board members
[3:08] uh would like to state
[3:11] or comments they have about the
[3:14] resolution on paper that we have here?
[3:17] anything worth mentioning?
[3:21] No.
[3:23] Uh all right. In that case, we will
[3:27] um get to
[3:31] voting.
[3:32] [Music]
[3:34] Um let's
[3:38] see. Okay. So, I'm just going to read
[3:40] this last bit on the decision if that's
[3:41] all right. Okay. So the decision that we
[3:45] are now uh voting on is whether or not
[3:49] to put our names on the
[3:51] following. Um there before this
[3:55] particular block of text there are a lot
[3:57] of reasoning for the board's decision
[3:59] but ultimately this is uh where we land.
[4:02] So the decision states for the forgoing
[4:04] reasons it is this the 31st
[4:08] um uh day of March 2025 by the board of
[4:12] appeals of the town of Chesapeake Beach
[4:14] at least three members of the board who
[4:16] attended all proceedings uh concurred
[4:19] ordered that the appeal of the Rodri
[4:21] Incorporated Donovan Estates LLC in case
[4:24] 2303 is hereby dismissed.
[4:27] I will go around the room and ask if you
[4:31] are willing to put your name on that
[4:33] decision. Uh Mr.
[4:43] [Music]
[4:45] I'm sorry. Uh the motion should be does
[4:49] the board approve the resolution uh
[4:52] deciding case number
[4:55] 2023-3 as presented. All right. Um so it
[5:00] is
[5:01] um Mr. Dhy, do you accept the resolution
[5:05] as it's presented?
[5:07] I do. Miss Everett, do you accept the
[5:10] resolution as presented? I do.
[5:12] My name is Jody Hunstar and I also
[5:14] accept the resolution as presented. The
[5:17] decision uh can now be signed by the
[5:20] board members who have attended all
[5:23] sessions here. Um so thank you
[5:25] everybody. We have a decision.
[5:30] Think the clerk has a signature copy.
[5:39] Probably not the best color, huh?
[6:24] Thank you, Mr. Chairman. If you would
[6:25] hand that back to the clerk.
[6:30] Uh, all right. Thank you everybody and
[6:33] uh big thank you to you, Fred, for for
[6:35] sticking with us all this time.
[6:38] Um, and that is the conclusion of case
[6:43] 2023. Um, is there any additional
[6:46] business before the board at this
[6:49] time? Hearing none, I'll entertain a
[6:52] motion to adjurnn. I'll make a motion to
[6:54] adjurnn. I have a second. I'll second.
[6:56] All in favor? Meetings adjourned. Thank
[6:59] you.
[7:11] It's definitely worth keeping.
[7:17] You guys did a good job. You know, that
[7:20] was a
