[0:00] September 23rd, 2026, the special
[0:02] meeting of the Eden Town Council to
[0:05] order. I apologize for starting a few
[0:07] minutes [clears throat] late. We have a
[0:08] few technical difficulties up here which
[0:10] we have taken care of. Um the first
[0:13] matter is uh consideration of approval
[0:16] of a 2026 community waste reduction and
[0:19] recycling grant. And we've got David
[0:21] Meyers here and also uh Corey Gooden to
[0:25] help us explain uh more about that.
[0:28] Evening council.
[0:29] >> Sorry, I have a cough, so I do have a
[0:31] cough drop in.
[0:32] >> Um, so this grant here would be our
[0:35] third grant for recycling. Um, you know,
[0:38] our recycling program started December
[0:41] of 2023. Um, so this is for $30,000 to
[0:45] help with a skid steer to help load um
[0:49] the recycle into the trailer. Um, and
[0:52] the one we currently use is about 25
[0:54] years old. you know, dealing with all
[0:55] that trash. You can imagine the the
[0:57] shape that it's in. Um, you know, this
[0:59] will go for our 26 27 budget. Um, the
[1:03] town had to spend about $40,000 to get
[1:05] that 30, but that'll be something we
[1:07] budget uh come our our new budget in
[1:10] July.
[1:11] >> So, and it's it's much much needed, I
[1:13] can promise you. So,
[1:15] >> our um
[1:17] what was it tons per month or whatever,
[1:19] has that increased?
[1:20] >> Uh, I was looking at it right before I
[1:22] came here. You know, I think we were the
[1:24] first year around 190. We were around
[1:27] 181,000 tons this time and this year
[1:29] we're already at 50,000 tons.
[1:31] >> So, I I see it going up. U we just did
[1:34] our last recycle grant. We got
[1:36] dumpsters, we got recycle carts, you
[1:39] know, a lot of education material. So,
[1:41] we're seeing a lot more um involvement
[1:43] from the community. Um and now with the
[1:45] dumpsters, we got, you know, commercial
[1:47] properties.
[1:49] citizens know what ways do you
[1:52] >> sometimes it depends on issue with that
[1:54] >> we still get calls so
[1:58] >> okay any more questions um it sounds
[2:00] like uh we need it and I'd rather get it
[2:03] when we have some money available to
[2:04] help as opposed to waiting and it break
[2:07] down and have to act out of desperation
[2:10] and not have $30,000 to help us. So
[2:12] those are my thoughts on sir
[2:14] >> any more comments? I just need to thank
[2:16] them for continuing to go after these
[2:18] things, too.
[2:19] >> Yeah.
[2:23] » Go.
[2:24] >> Okay. Um, I'll entertain a motion to
[2:27] approve this grant as described.
[2:29] >> So, move.
[2:30] >> Second.
[2:31] >> Okay. We got a motion, a second. All in
[2:32] favor of the town approving this grant
[2:34] as described by David Myers with please
[2:36] indicate by saying I. I.
[2:38] >> Any opposed? Thank you, David.
[2:40] >> Thank you. Let's see.
[2:42] >> So, next we move to uh a series of
[2:45] public hearings, and I need to open the
[2:48] public hearing for the five agenda items
[2:51] that are on um the agenda. So, I declare
[2:54] the public uh hearing for these
[2:56] purposes. So, opened. The first matter
[3:00] that before us is a public hearing in
[3:02] case [clears throat] number RZ26-01
[3:06] which is an application for John Larry
[3:08] sellers
[3:09] requesting to reszone property located
[3:11] at 706 Northam Street North Oak Street
[3:14] from R5 residential to R3 residential.
[3:18] The affected um property is also
[3:21] identified as pin number
[3:23] 7805-20-81-5589.
[3:28] Before um we proceed on this uh hearing,
[3:32] uh Councilman Sellers, is a matter of
[3:34] procedure we need to discuss?
[3:35] >> Yes. Uh Mayor Hi, I'd move to recuse
[3:39] myself um from any hearings uh involving
[3:43] my direct family members. And the law
[3:46] reads if a direct family member is
[3:48] involved, it's mandatory that um Mr.
[3:51] Celis make make that notification to us
[3:53] and we would also need to vote on his
[3:55] request to recuse himself from this
[3:58] matter.
[3:58] >> Move, ma'am.
[3:59] >> All right, we got a motion. Do we have a
[4:00] second?
[4:00] >> Second.
[4:01] >> Okay, we got a motion to second. All in
[4:03] favor of Councilman Sersh recusing
[4:06] himself from this particular hearing,
[4:08] please signify by saying I.
[4:09] >> I.
[4:10] >> Any opposed? Okay. Thank you for letting
[4:12] us know that.
[4:15] Okay. The way uh we run these things,
[4:18] first there's a presentation of staff
[4:21] reports and uh Dwayne Wilton, will you
[4:24] come forward?
[4:38] There's a lot of paperwork to go around.
[4:40] So, the applicant u Mr. Sellers um is
[4:47] seeking to reszone uh property located
[4:49] at 706 North Oak Street to R5 from R5 to
[4:52] R3. Um in your packet you will have the
[4:55] map showing uh the specific location. Um
[4:58] and the existing zoning R5 minimum lot
[5:01] size 5,000 minimum lot width 50. Uh lot
[5:04] coverage is limited to 60%. Uh recently
[5:07] uh council has uh approved the R3 zoning
[5:11] district uh which um would require
[5:13] minimum lot size of 3,000 square feet,
[5:16] minimum lot width of 30, lot curvage of
[5:18] 60 and building height of 35. Um both
[5:22] are uh in the proposed land use
[5:25] classification is identified as medium
[5:26] to high density residential.
[5:29] uh in the uh medium to high residential
[5:33] uh it occupies about 20% of the town's
[5:35] planning jurisdiction uh and if you
[5:37] remember uh R3 was uh for you know to
[5:42] help with affordable housing I think is
[5:43] the old calls but also for infield
[5:45] development uh and to help with uh um
[5:48] the the infill on lots that are already
[5:50] non-conforming and to bring these lots
[5:52] into a more conforming status and
[5:54] putting restrictions kind of on how it
[5:55] can be developed. So uh public utilities
[5:59] um properties in the corporate limits um
[6:02] it is uh located within the town
[6:04] protective service provided by the
[6:06] police department. Uh it's subject
[6:08] properties located on Oak and East Hick
[6:11] Street. Uh physical characteristics at
[6:12] this point is vacant land. Um the
[6:16] aftermission parcels of the applicant
[6:18] seeks reszoning uh from R5 to R3.
[6:21] [clears throat] Resoning request may be
[6:22] considered appropriate given the
[6:23] compatibility of the surrounding
[6:25] residential properties and the intended
[6:27] purpose of the parcel as single family
[6:29] uh detached dwellings. Um the potential
[6:32] reasonzoning of this parcel R3
[6:34] residential is consistent with future
[6:35] land use uh map designation for medium
[6:39] to high density residential areas.
[6:42] So, uh, please be aware that the
[6:45] reszoning of this project, uh, this
[6:47] property will will permit all uses
[6:49] permanent R3, uh, residential as list in
[6:52] the town of Edon's, uh, unified
[6:55] development ordinance.
[6:57] Grant, if granted, the reasoning
[6:58] requests, property owners will continue
[7:00] to have to comply with all the
[7:01] regulations included within the town of
[7:03] Edon's unified development ordinance.
[7:06] Uh, you see, uh, there was an existing
[7:08] structure that has been demolished, but,
[7:09] uh, you see your maps there. Uh the
[7:11] recommendation uh staff has determined
[7:13] the applicant uh application for Mr.
[7:15] Sellers for a zoning map amendment uh is
[7:17] complete and that is compatible with the
[7:19] 2018 land use plan and that the
[7:21] reszoning would result no inconsistency
[7:23] with the existing and future land
[7:25] classifications for the subject property
[7:27] and it meets uh the requirements of the
[7:30] town of E10's uh unified development
[7:32] ordinance. uh the plan board met on
[7:36] March 2nd and as we recommended approval
[7:38] of this reasoning request
[7:41] uh so town council plan consistency
[7:44] statement um would be required at this
[7:46] point but uh that's it for the
[7:53] » plane board recommending 100%.
[7:56] >> Yes sir. Yeah, I every number.
[7:59] >> And Dwayne, we uh re recently, was that
[8:02] within the last six months or so, uh
[8:05] changed our zoning ordinance to include
[8:07] a R3 designation? Yes. Is that correct?
[8:10] Mhm. [clears throat]
[8:11] >> And I recall some of the thought
[8:13] processes behind that was smaller lot
[8:18] size reduces the cost of the land and
[8:20] also uh reduces the size of a house you
[8:22] could put on that land with the hope
[8:24] that you would have more affordable
[8:26] housing than a big house on a big lot.
[8:28] Is that correct?
[8:28] >> That's correct. Yeah. And with the
[8:29] reasoning, I mean, they're still going
[8:30] to have to meet uh the setback
[8:32] requirements as as approved by council
[8:34] and every other restriction that's
[8:36] approved by council. this just will
[8:37] allow for them to subdivide this and be
[8:39] able to pour or be able to put uh some
[8:42] smaller homes there. Uh which I've heard
[8:45] from the community is a great necessity
[8:47] for the school system and the new school
[8:50] is there and uh the board of education
[8:52] that's right there. So, this could be an
[8:53] asset to them as well.
[8:55] >> And the only difference between R5 and
[8:57] R3 is the minimum lot size. Everything
[8:59] else is pretty much the same.
[9:00] >> Yeah, minimum lot size. I think some
[9:02] setbacks uh are a little uh lenient on
[9:04] R3. Um but it still has to meet the 6%
[9:07] lot coverage uh 35 uh feet max height.
[9:11] Uh but I think other than that um most
[9:14] of the regulations are uh the same as R5
[9:18] and defined as medium to high
[9:20] residential
[9:24] and I mean it's sort of my understanding
[9:26] that these these type of developments
[9:28] are encouraged by
[9:30] not necessarily our main street but the
[9:33] sort of main street approach brings
[9:35] [clears throat] more people into the
[9:36] middle of town. It helps create, you
[9:38] know, a vital thriving center core of
[9:41] the of the town.
[9:42] >> More walkable uh community is kind of
[9:45] the
[9:46] >> kind of Yeah. Less disperse services. I
[9:49] mean, it's all right there. Just Yeah,
[9:52] we'll I guess everything's already
[9:54] there.
[9:55] >> School.
[9:56] >> It's been very very close to school.
[9:58] >> It's been a great parking lot for
[10:00] football games, though.
[10:04] And Dwayne, this fits in with our um
[10:07] future land use map and plans and goals.
[10:09] >> Yeah. Well, with the R3, it's it's
[10:11] basically marrying the R5, which is our
[10:13] smallest lot. Uh so it's all considered
[10:16] medium to high residential. Uh when we
[10:18] update our land use plan, we'll include
[10:20] the R3 zoning district, but as of right
[10:22] now, it's it's listed under the the
[10:24] medium to high resial density.
[10:26] And this house is on um like Mosley
[10:29] Street, MLK. They all would be in this type of
[10:33] >> 30 to 33
[10:36] feet wide. Basically, this
[10:39] >> when you asked that question, you refer
[10:40] to existing lots.
[10:41] >> Existing lots that are already in town.
[10:43] >> You the town founders already had
[10:46] planned this. It's just
[10:48] >> we see several
[10:49] >> gotten away for a while. Yeah, we see
[10:51] several throughout the the town
[10:53] municipal limits of of being about 33
[10:55] feet wide and we just have to work with
[10:57] them at this point on attempting to meet
[10:59] the setbacks but not punishing them for
[11:02] uh not meeting them. So pretty good. So
[11:04] this helps alleviate that, put stricter
[11:06] or put a standardized um kind of
[11:10] development ordinance in place for those
[11:12] particular properties.
[11:14] Okay, any more questions of uh staff?
[11:17] [clears throat]
[11:18] Okay, thank you. Thanks.
[11:21] Next, we've got presentation from the
[11:24] applicant or applicants representative.
[11:27] Anything you want to add?
[11:30] >> Well, I'm going to bring Chris back up
[11:31] here. [laughter]
[11:33] He's the builder. He's going to buy the
[11:35] lots for me. Originally, we were going
[11:37] to do town houses, but this way,
[11:40] everybody wants a single family house.
[11:42] Not everybody wants a townhouse. So,
[11:44] maybe one day we'll do some town houses
[11:46] in in town. But Chris can explain to you
[11:49] what he wants to do and I think it's
[11:51] wonderful width on those lots.
[11:56] » So in this particular parcel
[12:00] currently zoned R5
[12:02] it it's 14,800
[12:06] and some square foot which is not three
[12:10] lots and not three homes. Um by going to
[12:14] R3
[12:15] it becomes four lots four locations for
[12:18] homes and our width is
[12:22] greater than
[12:24] >> it's 40
[12:24] >> 40.
[12:26] >> So we're going to make maximum use of
[12:28] this property. Um as Dwayne mentioned
[12:32] there's minor differences in the
[12:34] setbacks. Maybe instead of 12 it's 10.
[12:38] But as was also mentioned, um we have a
[12:41] lot of lots in this town that are
[12:44] nonconforming that are going to fit in
[12:46] this category and that kind of makes
[12:48] them legit again. Um somewhere along the
[12:52] way, Cape Colony for example, where
[12:55] we're also trying to build some houses
[12:57] that are in considered affordable um
[13:00] that got painted R15
[13:03] and we're building on 50 by 100 lots and
[13:06] I have to you know, I have to use those
[13:09] setbacks, which makes it even harder to
[13:12] get a house on those lots. So, I think
[13:14] the more we can set these up the right
[13:17] way, the better off we're going to be
[13:18] moving forward where, you know, the the
[13:21] setbacks meet what you actually have for
[13:23] a piece of property.
[13:25] >> What uh size houses do you anticipate um
[13:29] would be placed on these lines?
[13:30] >> Uh anywhere from a two bed, we do a
[13:33] two-bedroom, two bath. It's about 850 square ft. Um up to maybe 11,200
[13:42] square ft². Again, we're, you know,
[13:44] we're we're asking for smaller lots.
[13:45] We're working on smaller lots. So, we
[13:47] may have to go up, you know, a twotory
[13:50] version, which we've got several models
[13:52] of that.
[13:53] >> What's the cost per square foot? Yeah,
[13:57] >> we have to build the whole house,
[13:58] including the driveway and the porches
[14:00] and the I always tell customers, I know
[14:02] you're going to go home and divide the
[14:03] heated square footage by my price and
[14:06] say, "Oh my gosh, it's this much."
[14:08] >> Um, but you know, the reality is they're
[14:11] going to be between two and probably on
[14:14] these lots 200 to 225 a square foot sale
[14:18] price, which includes the land.
[14:21] Somewhere in that range. Somewhere in
[14:23] that range. But, you know, we're not
[14:25] going to cut on any of the quality.
[14:28] We're going to have the same house.
[14:30] The price is driven. That's consistent.
[14:33] Price is driven by the cost of the land
[14:36] and the size [clears throat] of the
[14:36] home.
[14:39] >> The house that you built, I think you
[14:40] built it by the street department by
[14:43] Dave's office.
[14:44] >> Yes.
[14:45] >> That's going to be about the size of the
[14:46] house.
[14:47] >> Yeah. That that's an example where, you
[14:49] know, we're not spending too much money
[14:51] until we get this through, but we're
[14:53] looking at different elevations for that
[14:55] size house. So, that size house was
[14:56] drawn as a two-bedroom, one bath. We
[14:59] make it 5 1/2, 6t deeper, and make it a
[15:03] two-bedroom, two bath. So, you know,
[15:07] potentially someone could buy it, have a
[15:09] roommate, another teacher, you know,
[15:13] >> would everybody have a young
[15:14] >> a driveway?
[15:15] >> Yes. Yes, we're mandated on a
[15:18] twobedroom, one and a half.
[15:21] >> I think it's two, three parking spaces,
[15:24] I believe.
[15:26] >> Oh, two. Yeah, it would be two parking
[15:28] spaces.
[15:28] >> Yeah, I mean, we're going to do two. I
[15:30] think I thought I thought it was 1.5 on
[15:32] a twobedroom and two when you get to a
[15:34] threebedroom, but
[15:35] >> Yeah, 1.75 something like
[15:37] Yeah, we don't we don't do those 75
[15:40] parking places. [laughter]
[15:43] There's a few 75 cars running around
[15:45] here, but we're going to give you a
[15:46] whole parking.
[15:50] » Okay, questions [clears throat] of the
[15:53] applicant and applicants representative.
[15:56] >> Okay. Thank you, Chris.
[15:57] >> Thanks.
[16:03] » As our procedures go on this uh type of
[16:06] hearing, we uh have a public comment
[16:08] period uh designated as a public
[16:10] hearing. within this public hearing. And
[16:12] at this time, the next uh agenda item is
[16:15] public comment. Uh if you have public
[16:17] comment, I'd ask that you come forward
[16:19] and identify yourself and limit your
[16:21] comments to three minutes. So, I will
[16:22] hereby open the public comment uh period
[16:25] of this agenda item. Do we have anybody
[16:28] present that wishes to speak?
[16:31] There appearing to be none. I would
[16:33] close the public comment um section of
[16:35] this agenda item. And at this time we
[16:38] move forward to further comments,
[16:40] questions, and deliberations from town
[16:43] council. Um, council Dixon, did you have
[16:46] anything else to add?
[16:47] >> I think this is
[16:48] >> I think so. Great.
[16:50] >> Yeah.
[16:51] >> And affordable housing, too.
[16:54] >> Well, when we made the change to our
[16:56] zoning map to include a R3, this is the
[16:59] type thing that we had in mind. Um, and
[17:02] it'll address something that almost
[17:04] every time we have some sort of public
[17:06] event related to how things we can do
[17:08] different here at Eaton, people talk
[17:10] about afford affordable housing, smaller
[17:12] housing that can be affordable for
[17:14] people. So, I think it meets uh our long
[17:16] range plans in that regard. Um, any
[17:19] other comments?
[17:21] All right. Well, council and uh general
[17:23] public, there is an established
[17:25] procedure that we must follow in these
[17:27] types of matters. And we'll have to go
[17:29] through this four more times. But as you
[17:31] recall, council, there are five um
[17:34] questions that we need to answer. One of
[17:36] those is um the ultimate question of
[17:38] whether we've approved this. But before
[17:40] we get to that, there are four
[17:42] preliminary questions that the council
[17:44] must answer in the positive before we
[17:46] can move to the next question. And so
[17:48] the first question that we always have
[17:50] in this type of thing is uh whether or
[17:52] not the uh proposed uh change will
[17:55] endanger the public health or safety.
[17:58] And I would entertain a motion um that
[18:01] this project would not endanger the
[18:03] public health or safety.
[18:05] >> So move.
[18:06] >> Okay. Do you have a second?
[18:07] >> Second.
[18:07] >> Okay. Any further comment on that sub
[18:09] question? All those in favor of a
[18:12] finding that this particular change will
[18:14] not endanger the public health or
[18:16] safety, please signify by saying I.
[18:19] >> I.
[18:19] >> Any opposed?
[18:22] >> Okay. The next subsection sub question
[18:24] that we have to answer is uh whether or
[18:26] not um the proposed change in use would
[18:30] injure would not injure the value of
[18:32] adjoining or abing property. Does
[18:34] anybody have a motion on that?
[18:35] >> So moved.
[18:36] >> Okay. We got a motion by Councilman
[18:39] Dixon and a second by Councilman Bond.
[18:41] Um all in favor of a finding that the
[18:44] proposed change and use will not injure
[18:47] the value of adjoining or abunding
[18:48] properties, please signify by saying I.
[18:51] >> I. Any opposed?
[18:53] The next sub question is whether the uh
[18:56] particular change will be in harmony
[18:59] with the area in which it is located. Uh
[19:01] do I have a motion and a second for that
[19:03] particular finding?
[19:04] >> So
[19:05] >> second. Okay, we've got a motion and a
[19:07] second. All those in favor of the
[19:09] finding that this change will be in
[19:10] harmony with the area in which it is
[19:12] located, please signify by saying I.
[19:14] >> I.
[19:16] >> And next, we um need to make a finding
[19:19] that the um use and change will be in
[19:22] conformity with the land use plan,
[19:24] thoroughare plan, or other plan
[19:25] officially adopted by town council. I'll
[19:28] entertain a motion and a second on that
[19:30] sub question.
[19:30] >> Motion.
[19:32] >> Second. Okay, we've got a motion and a
[19:33] second. All in favor of a finding that
[19:36] this change will be in conformity with
[19:38] the land use plan, thoroughfare plan, or
[19:40] other plan officially adopted by the
[19:42] town council, please signify by saying
[19:44] I. I.
[19:45] >> Any opposed?
[19:47] >> Okay. Since council voted in the
[19:49] affirmative on all those findings, it
[19:51] leads us to the uh ultimate question.
[19:54] And I would uh entertain a motion that
[19:57] the town council approve the reszoning
[20:00] of the subject property from R5
[20:02] residential to R3 residential.
[20:05] >> I got a motion.
[20:06] >> Second.
[20:07] >> Got a motion and second. All in favor of
[20:09] the resoning of the subject property
[20:11] from R5 [cough] residential to R3
[20:13] [clears throat] residential. Please
[20:14] signify by saying I. I.
[20:17] >> Any opposed?
[20:19] Okay. So that particular change uh from
[20:22] R5 to R3 is hereby passed by town
[20:25] council. The next um public hearing is
[20:29] on the same piece of property from the
[20:31] same um applicant and this is to um
[20:37] create four lots on um the property
[20:40] located at 706 North Oak Street uh by
[20:43] subdividing into those aforementioned
[20:46] four lots. And um Councilman Sellers, do
[20:48] you have the same concern here that you
[20:50] had in the first?
[20:51] >> I do. I'd again ask to be recused.
[20:53] >> Okay. I need a motion and a second in
[20:56] order to recuse Councilman Sellers from
[20:58] participating voting in this matter.
[21:00] >> Second.
[21:01] >> Okay. All in favor of Councilman
[21:03] Sellers's recusal from hearing this
[21:05] matter, please signify by saying I.
[21:07] >> I. Any opposed? Okay. We move forward to
[21:11] the staff reports. Um Mr.
[21:15] >> [clears throat]
[21:20] » When you pack it, you see the the
[21:22] preliminary plan is there. Uh so any lot
[21:25] over three in this uh this zone requires
[21:28] major special use permit for the
[21:30] subdivision. Uh so basically the same as
[21:33] before uh with the major species permit,
[21:36] I pulled the goals and objectives from
[21:37] our land use plan. Uh and those are
[21:39] listed in the staff report. uh develop
[21:41] and implement uh strategies to promote
[21:43] three generation population growth. Uh
[21:45] ensure the town's development ordinance
[21:46] conducive with emerging uh economic
[21:48] trends such as telecommuting and
[21:51] industry entrepreneurship.
[21:53] Establish local uh development policies,
[21:55] programs, resources to promote increased
[21:57] home ownership in town. Uh
[22:03] the town will encourage location,
[22:04] business, residential development and
[22:06] service providers that serve retirees
[22:07] while creating jobs for young residents.
[22:09] [clears throat]
[22:09] Town is supportive of cottage industry
[22:11] entrepreneurship. The town encourages
[22:12] development of housing types that
[22:14] accommodate retirees, young
[22:15] professionals, and millennials.
[22:17] Uh you see uh an exter
[22:23] same location 76 North Oak Street. Um
[22:27] the matri process requires applicants to
[22:29] specify the exact pros use uh of the
[22:31] land and allows the town council place
[22:33] restrictions on the actual development.
[22:35] You see an excerpt from the UDO showing
[22:37] major subdivisions and the requirements
[22:39] of a major space use permit plan of
[22:41] board met for this one again on March
[22:43] 2nd unanimously recommended approval
[22:47] um to the town council with staff
[22:49] recommended conditions and uh we'll once
[22:51] again go through those four um five
[22:55] requirements that has address these
[22:56] conditions of attached application
[23:00] um and uh I have uh two of the approved
[23:03] staff recommended and approved planning
[23:05] board recommended conditions. All
[23:07] details [clears throat] and improvements
[23:09] including but not limited besides
[23:10] signage, infrastructure, sidewalks,
[23:12] landscaping, street lighting shall be
[23:14] installed slash constructed according to
[23:15] UDO requirements. All necessary traffic
[23:18] improvements, utility installations and
[23:20] connections, electric, water and sewer
[23:21] built with town standard and drainage,
[23:23] storm water detention improvements shall
[23:25] be installed by and all associated and
[23:28] required fees more by the developer. Um
[23:31] staff does find the proposed use to be
[23:33] in conformity with the Gington Shaw
[23:34] [clears throat] Lenny's plan and
[23:35] officers the following decision
[23:36] statement for the council's
[23:37] consideration.
[23:38] Um so you have uh the
[23:42] consent statement [clears throat] right
[23:43] there and list of the goals that were
[23:45] read through before. So basically uh
[23:47] taking one parcel and converting it into
[23:50] uh uh four uh subdivided lots um and
[23:54] matching the zoning requirements of R3.
[23:59] >> Okay. Dwayne. Um,
[24:01] so u the planning board recommended
[24:04] approval unanimously and you as part of
[24:07] the staff are coming back with the same
[24:09] recommendation that we approved it.
[24:10] >> Yes sir.
[24:11] >> And the policy reasons for approving
[24:13] this are those basically the same as the
[24:15] reasons why you recommended that we um
[24:18] change the zoning from R5 residential to
[24:20] R3 residential.
[24:21] >> Yes sir. infield development. Um
[24:23] creating uh a lot consistent with the R3
[24:27] zoning district that was approved by
[24:28] council. Um checking off a bunch of the
[24:31] uh goals and policies that the land use
[24:34] plan uh has identified including you
[24:36] know [clears throat] supportive of u
[24:38] development of housing types that
[24:40] accommodate retirees, young
[24:41] professionals and millennials. uh and
[24:43] knowing that their uh intentions are to
[24:45] uh build single family detached
[24:47] dwellings. Uh and the opportunity to
[24:49] meet these goals and policies is the
[24:51] reason why I came, you know, planning
[24:53] board and and myself came on and u
[24:56] recommendation of approval for the um
[24:59] major special use permit for the
[25:00] subdivision. [clears throat] And if we
[25:03] approve it, um that doesn't necessarily
[25:05] mean that they just get that bill out
[25:06] there and do whatever they want to do.
[25:08] They're still going to have to meet all
[25:09] the requirements of the town that you
[25:10] just set forward.
[25:11] >> Yes, sir. the the conditions uh the
[25:13] recommended conditions and any condition
[25:15] that is imposed by town council they
[25:16] would have to follow as well as UDO
[25:18] requirements building code requirements
[25:21] uh if approved tonight the next steps uh
[25:23] when they decide to build would be the
[25:24] port building permit uh I would probably
[25:26] meet with them beforehand uh and then a
[25:28] zoning permit to make sure they're
[25:30] meeting setbacks of the R3 zoning
[25:31] district so there's still checks and
[25:33] balances in place to make sure that all
[25:35] the requirements are being met
[25:38] >> are there any other questions of you
[25:40] from council.
[25:42] >> Okay. Thanks.
[25:46] >> And Chris, if you don't mind, just come
[25:47] forward just so we can establish
[25:50] something for the record. Um, similar to
[25:52] what I asked uh Dwayne, um, basically
[25:55] the reasons you think this is a good
[25:57] idea. Are those the same reasons they
[25:59] thought it was a good idea
[26:00] >> to change the designation from R5 to R3?
[26:03] >> Absolutely. And as it relates to this
[26:06] specific request to allow subdivision in
[26:08] the full residential lots, anything that
[26:10] you want to add to your earlier
[26:11] statements?
[26:13] >> I'm open for questions if anybody has
[26:16] any, but I think um you know, I think
[26:19] most of it has been said and these are
[26:22] not the last four that I want to build
[26:24] for the town or the community. So
[26:26] obviously I'm I'm going to work through
[26:28] everything we need to get through to get
[26:29] these right. What would be your goal
[26:31] time
[26:33] once everything's approved?
[26:35] >> Honestly, I've got so much going on
[26:37] right now. I tell people all the time, I
[26:40] could start you sooner than most people,
[26:42] but it's taken me longer. So, most
[26:44] houses are taking me six, seven months.
[26:48] Now, these are not really large, but
[26:49] I've got a great team that I use on
[26:52] every single house, and there's a whole
[26:55] lot of them going on right now,
[26:57] mostly in Cholan and Ed. Few inquiries
[27:01] >> in this particular parcel. Will you be
[27:03] doing one house at a time?
[27:04] >> Uh, probably at least two at a time. Two
[27:06] at a time,
[27:07] >> right? Two at a time. Um, initially that
[27:09] would leave a great, you know,
[27:11] tremendous layown area. It will get more
[27:13] challenging as we get down to the last
[27:14] lot. But, um, we've got, if you ride by
[27:18] now, we've got one staked out at the
[27:20] other end that we were going to do. Um,
[27:22] and I'm probably going to do two of
[27:23] those at the same time. We're doing two
[27:25] simultaneous in Cape Colony. We've done
[27:27] that before. That makes it easier for
[27:30] everybody. And if something's not quite
[27:32] ready, they can go next door.
[27:34] >> They all look a little different,
[27:36] though.
[27:36] >> Yeah. Oh, yeah. Okay.
[27:37] >> Yeah. Yeah. Yeah. We're working on
[27:39] elevations now.
[27:40] >> Okay. Um, we want it to look we want it
[27:43] to look like it belongs here but not
[27:45] look like, you know, four in a row that
[27:47] look the same.
[27:48] >> Yeah.
[27:48] >> How many of your houses that you've done
[27:50] have you sold in Cape Colony?
[27:54] >> Seven. Maybe.
[27:57] >> All of them. I can tell you.
[27:58] >> Seven. And we're building two more right
[28:01] now.
[28:01] >> Yeah. Two under construction. We have 10
[28:04] or 12 more lots in there. We're working
[28:07] with that HOA. They're trying to
[28:10] strengthen their HOA again. So, we're
[28:13] helping them do that and helping them.
[28:15] >> And you move those fairly quickly,
[28:17] haven't you? I mean, it's not been any
[28:18] problem at all.
[28:19] >> No, we've seen some of them we come in
[28:22] with the USDA customer in place and and
[28:24] the ones that we feel all we got people
[28:28] interested in one right now that's only
[28:30] a foundation. I I I can't finish it fast
[28:33] enough for some people, you know.
[28:36] >> Honestly, it's almost impossible to
[28:37] build a a spec house in this area
[28:41] because somebody's gonna buy it before
[28:43] we go. It's going to be a contract
[28:45] house, you know, and a lot of times they
[28:48] want to do that soon enough to make
[28:51] selections, which we let them make some
[28:53] selections. Siding color, paint color,
[28:56] maybe flooring, you know, certain things
[28:58] that they can pick. They get there fast
[29:00] enough.
[29:02] >> Okay. Anything else?
[29:05] >> Okay. Thank you, Chris. Thank you.
[29:08] >> Next, we move to the public hearing
[29:10] portion of this [laughter] public
[29:12] hearing. Uh is there any public comment?
[29:15] Again, uh limit your comments to three
[29:18] minutes. And if you'll come forward and
[29:20] let us know your name, identify
[29:21] yourself, we'll be glad to hear from
[29:23] you. Any comments on this? There
[29:26] appearing to be none. We next move to uh
[29:28] the section of the agenda where town
[29:30] council can uh ask further questions,
[29:33] seek uh answers, and also deliberate.
[29:35] Are there any further further comments
[29:36] or questions as it relates to this uh
[29:39] application?
[29:42] » Okay, as we did before, we have to go
[29:44] through the five questions. At this
[29:46] time, I would entertain a motion that
[29:49] the subdivision as proposed would not
[29:51] endanger the public health or safety.
[29:54] >> So, move second.
[29:55] >> We got a motion and second. Um all in
[29:57] favor of finding that the um subdivision
[30:00] would not endanger the public health or
[30:02] safety, please signify by saying I. I.
[30:05] >> Any opposed?
[30:07] >> Next question for consideration is um
[30:10] that the subdivision will not injure the
[30:13] value of a joining or abing property. Do
[30:15] I have a motion and second?
[30:16] >> Motion, sir.
[30:18] >> Okay, we've got a motion and second. All
[30:20] in favor of finding that the subdivision
[30:22] will not injure the value of adjoining
[30:24] or voting properties, please signify by
[30:26] saying I.
[30:27] >> I.
[30:28] >> Any opposed?
[30:29] >> The next question that we have to
[30:31] consider is um whether the subdivision
[30:34] will be in harmony with the area in
[30:36] which it is located.
[30:39] >> Motion second.
[30:41] >> All in favor of a finding that the
[30:43] subdivision will be in harmony with the
[30:44] area which is located, please signify by
[30:46] saying I. I. Any opposed?
[30:50] Next up question is consideration of
[30:53] whether the sub condition will be in
[30:55] conformity with the land use plan, third
[30:57] rate plan or other plan officially
[30:59] adopted by town council. I'll entertain
[31:01] a motion and a second regard to that
[31:03] question.
[31:04] >> So second.
[31:06] >> Okay, we've got a motion and second. All
[31:07] in favor of the finding that the
[31:09] subdivision will be in conformity with
[31:11] the land use plan, the thoroughfare plan
[31:14] or any other plan officially adopted by
[31:16] the town council, please signify by
[31:18] saying I. I.
[31:20] >> Any opposed?
[31:22] >> Okay. And then we move to the ultimate
[31:24] question. Uh this time based on the
[31:27] positive answer to the four previous
[31:28] questions, I would entertain a motion uh
[31:31] to approve this major um special use
[31:35] application.
[31:37] Second.
[31:37] >> Okay. All in favor of approval of the uh
[31:41] major special use um permit application
[31:44] as presented, please signify by saying
[31:46] I.
[31:47] >> Any opposed?
[31:50] That is approved. Next we move to agenda
[31:55] item
[32:00] subsection D and this is a consideration
[32:03] of case number RZ 26-3
[32:06] an application from Interbanks Asset
[32:09] Group LLC which involves a request to
[32:12] reszone the property located at 307 East
[32:15] Queen Street from R5 residential to R3
[32:19] residential. The subject property is
[32:21] further identified as having pin number
[32:24] 7804-08-88-921.
[32:28] At this time, we would ask Dwayne Wilton
[32:31] to come forward with the staff report.
[32:39] » All right. Um
[32:42] this is uh
[32:44] an application uh for a um basically
[32:47] reszoning from R5 to R3 zoning district
[32:50] 3070s Queen Street.48 acres uh
[32:56] basically the same as before. Um within
[33:00] town um classified as medium to high
[33:02] density residential.
[33:04] um vacant. This this particular lot was
[33:07] a vacant land with a former class C
[33:09] trailer park uh on it. Um
[33:14] the request resone after mentioned
[33:15] parcels um from R5 which is 5,000 ft to
[33:18] R3 allowing 3,000 ft minimum. Uh this
[33:22] resist may be considered appropriate
[33:23] given the compatibility surrounding
[33:24] residential properties in the tenant
[33:26] purpose of the parcel. proposed
[33:28] reszoning classification R3 residential
[33:30] does not alter the predominant existing
[33:32] land use pattern in the surrounding
[33:34] area. Uh the potential reszoning of this
[33:36] parcel R3 residential is consistent with
[33:38] future land use plan designation of this
[33:40] enabling properties as medium high
[33:42] density. Um proposed reserve results in
[33:45] no change either existing or future land
[33:46] use classification properties.
[33:50] Uh you see a uh current zoning map uh
[33:53] showing
[33:54] uh the R5 uh zoning district
[33:58] uh as well as the location of that and
[34:02] the location on the
[34:05] [clears throat] land use map. Uh staff
[34:07] has determined that application from uh
[34:10] Jes from for a zoning map amendment
[34:13] reszoning is complete that is uh
[34:15] compatible with the 2018 showing land
[34:18] use plan and that the reasoning will
[34:20] result in no inconsistency with the
[34:21] existing future land use classification
[34:23] for the subject property. Uh plan board
[34:26] metal March 2nd unanimously recommended
[34:28] approval of this resoning request. Uh,
[34:31] one thing I do want to state is um that
[34:33] this is this is just a reszoning uh and
[34:36] not uh a major special use permit or
[34:39] anything like that. This is just the
[34:41] they're going to uh present what their
[34:43] intentions are with the property. But uh
[34:45] this isn't if if it requires them to
[34:48] come back for a specialist permit, they
[34:49] will. Uh I think after this I would work
[34:52] with them on any feedback that is given
[34:54] to kind of u wrangle it in. But, uh, as
[34:56] what they've given me, it meets the R5
[34:58] zoning district, um, requirements. Uh,
[35:01] so I just wanted to put that up. But,
[35:04] um, so, and then the town council, uh,
[35:06] planning consistency standard.
[35:08] >> Well, that's it.
[35:11] >> Okay. Any questions? Uh, Dwayne, do does anybody remember how
[35:17] many mobile homes were on this lot?
[35:20] >> If I remember correctly, I think there's
[35:22] six uh, structure points. Am I might be
[35:26] located.
[35:28] There are six structure points up there,
[35:30] which leads me to believe there was at
[35:31] least six at any given time uh of class
[35:34] C trailers on that location. Uh when I
[35:37] got here, I think there was two or three
[35:39] uh left, but uh historically there's
[35:41] four structure points leading me to
[35:43] believe there was at least six
[35:44] structures on the property.
[35:46] Is this near the oldest house
[35:54] » mayor point out that it's it's odd that
[35:57] we have to vote on this for six new
[36:00] property new houses to go there when
[36:02] before there was six homes there.
[36:05] >> Yeah,
[36:07] >> that's why I asked a question. Yeah,
[36:10] >> I think previously the property was
[36:13] non-conforming use for this location.
[36:16] >> Yeah, I think uh given the it happened
[36:18] some point in and with zoning uh that it probably became non-conforming with
[36:23] it. Uh but historically, you know, I
[36:26] don't know how far this goes back,
[36:27] probably the 70s or 80s, there's at
[36:29] least been six structure points and I
[36:31] can get the history probably from land
[36:33] records and bring next time if we come,
[36:35] but uh come back for a special use
[36:36] permit.
[36:38] I think historically there's was
[36:40] operating as non-conforming but had six
[36:42] units on.
[36:44] >> Okay. Any other questions or comments
[36:47] while he's up there?
[36:50] >> Okay. Thank you again.
[36:55] Next we've got uh presentation from the
[36:57] applicant or the representatives.
[37:13] Good evening,
[37:16] Mr. Mayor and town council. Um, like
[37:18] Dwayne mentioned, we're working on the
[37:20] R3s tonight. Um, I come as a private
[37:22] resident. Um, we'd like to test the uh
[37:25] cottage fort concept in that um on that
[37:28] lot similar to the uh trailer parks. And
[37:30] we've thrown together a kind of a 3D
[37:32] rendered model of what that could
[37:34] potentially look like uh with a a
[37:36] walkable
[37:38] uh smaller square foot concept um that
[37:42] provides accessible housing units that
[37:44] are walkable downtown um and right next
[37:46] to and honor that kind of street near
[37:48] the the mill village. Um, so this is just a mockup of a model. The
[37:54] architectural designs have not been
[37:56] finalized or anything of that sort, but
[37:58] the idea being that this is Queen Street
[38:00] here. And so you have the cottage court
[38:02] concept in the R3 zoning is that all the
[38:04] houses face a common common courtyard.
[38:07] Uh, 300 square ft per unit. Uh, and then
[38:10] the clean street facing houses, which
[38:12] actually I think I turned it around on
[38:14] you, would be this side, would have kind
[38:16] of a wraparound porch to look as if
[38:18] they're facing the street as well as the
[38:20] common space between the units. [cough]
[38:24] >> Are they [clears throat] about 1,000 ft?
[38:26] >> That's the That's what we're going off
[38:27] of. A two bed, one bath, 900 to,000 ft.
[38:30] >> A little crowded in that area.
[38:32] [clears throat]
[38:33] >> It is a tight concept. That's what the
[38:35] that lot can support. You couldn't do
[38:37] any more unless you go a lot smaller on
[38:39] the square footage. You could do a tiny
[38:40] home concept. But the R3 zoning allows
[38:42] from four to 12 units on a single lot
[38:45] >> without subdividing.
[38:46] >> You seen a really interesting older one
[38:48] in
[38:50] >> Yeah, it's really
[38:53] >> it's kind of it's mocked up on the same
[38:55] and trying to mimic the the um the mill
[38:58] village, you know what I mean? Same kind
[39:00] of concept, same kind of houses. So, it
[39:02] kind of blends in with it. Not trying to
[39:04] stand it out. Not trying to make a track
[39:06] housing in there. Not trying to put up a
[39:09] townhouse. I think it would stand out a
[39:11] little too much in that area, but I
[39:14] think that was also approved in that
[39:16] area. But, you know, this would just
[39:18] kind of just blend with everything on
[39:20] the street and up the street and just
[39:22] trying to mimic
[39:24] what the town already is.
[39:26] >> So, that's Queen going.
[39:28] >> Yeah. Okay. So, you sleep down.
[39:30] >> Yeah. I mean, these are models just to
[39:31] put it on there so people grasp. But
[39:33] like like he said, wrapping the front
[39:35] porches around the front to, you know,
[39:37] give it more of a a street view and then
[39:41] mimicking the houses down, but not
[39:42] trying to change the houses too much.
[39:44] Not trying to make one small, one
[39:45] little. They're all going to pretty much
[39:48] coincide with each other like this to
[39:50] make them all blend
[39:52] just like
[39:55] each character, color, elevation. Okay.
[39:58] And to get to the back ones
[40:00] >> be two two uh two roads on either side
[40:04] of the units. And to your earlier
[40:06] >> roads be behind like in the backyard so
[40:08] to speak.
[40:09] >> Right now the site the site does not
[40:12] support that without the setback
[40:15] requirements and of that sort. But to
[40:16] your earlier question council Miller
[40:20] you could do less units but then the
[40:22] economics of the development of the site
[40:24] require larger units at a higher price
[40:25] point. You could do
[40:27] So the six units at a smaller footprint
[40:30] makes the economic makes it paper a
[40:32] little better. [clears throat] Um if you
[40:34] bring it in and split it into two two
[40:36] lots or two units on there, you got to
[40:37] do larger houses at a higher price
[40:40] point.
[40:42] >> So the
[40:49] each house has a driveway.
[40:52] It does next to it. And there is room
[40:54] enough to double the driveway to double
[40:56] the car parking. Again, this is just a
[40:58] concept that we put together to get
[41:01] through the approval. And then obviously
[41:04] once through this approval, we then go
[41:06] to the building approvals, which then
[41:08] we'll change up what we have to to make
[41:10] the changes, you know, to meet code.
[41:14] One nice thing about having the
[41:15] driveways on the side is that it adds to
[41:17] the set, you know,
[41:19] >> I think this is just so awesome. Yeah,
[41:22] this we we understand there hasn't been
[41:23] a cottage sport in Eston. This is more
[41:25] to visualize it.
[41:26] >> Yeah.
[41:28] >> As planned, like if I'm looking at your
[41:29] mock up here and models in front of me,
[41:32] if if I own that far left, I would drive
[41:36] on this side.
[41:39] >> His left.
[41:41] >> Yeah.
[41:45] [laughter]
[41:49] » Okay. Are there any other questions?
[41:56] » All right. Thank you.
[41:56] >> Thank you.
[41:58] >> Make it look good.
[42:01] » No other way.
[42:05] » Okay. Next uh we come uh to the uh
[42:09] public comment public hearing um phase
[42:11] of this particular public hearing. Um,
[42:14] if you have comments, please step
[42:16] forward, identify yourself, and limit
[42:18] your comments to three minutes.
[42:22] » Good evening, Mr. Mayor. council.
[42:24] [clears throat]
[42:25] My um biggest concern comment and I I
[42:30] guess it would also apply to the
[42:32] structures to be built on North Oak is
[42:37] last year because of power failure.
[42:41] According to the lineman who worked on
[42:43] the lines across from my house, my brand
[42:46] new HVAC unit was blown out because what
[42:49] the linemen had told me is one fuse, one
[42:53] transformer blew, they changed the
[42:55] transformer, power went back on, and
[42:57] then another transformer blew, they
[43:00] changed that and another one went on. So
[43:02] last, I believe it was around October,
[43:06] um the power went on and off three times
[43:10] on South Oak Street. My home is at 107
[43:13] South Oak. My name is Leslie Kasbarrow.
[43:15] I apologize for not saying that to begin
[43:18] with. Um I live at 107 South Oak. My uh
[43:23] the computer board inside of our HVAC
[43:26] unit was blown out. Uh both the
[43:30] electricians from the town told me it
[43:33] was because of the power outages as did
[43:36] the four separate HVAC companies who
[43:39] still have not been able to find a a
[43:42] control board to put in to fix my brand
[43:45] new HVAC system that I put in uh a year
[43:50] less than a year ago. My entire winter
[43:52] was spent with space heaters and a gas
[43:55] fireplace. Thankfully, I'm in a position
[43:58] where I can afford to pay twice as much
[44:01] for my utilities because I can't use my
[44:03] brand new HVAC system. If you're
[44:05] planning on 10 more housing units on the
[44:08] exact same block,
[44:11] I want to make sure that we're not going
[44:15] to have issues with power, that there's
[44:17] substantial issues with power. I know
[44:20] having had meetings with the town and
[44:22] the town has and I would like to
[44:25] personally commend Corey um for
[44:28] following through, taking very accurate
[44:31] notes and and and really trying to
[44:34] assist us with a variety of issues we
[44:36] had and I have absolutely no complaints
[44:40] about any of that. He stood up to his
[44:42] word on everything. I'm not looking to
[44:45] damper anyone's projects. Certainly, I
[44:48] own a restaurant. So, when you bring
[44:49] more people in, it's much more money in
[44:51] my pocket, but I don't want to live
[44:54] another winter with pieced together, and
[44:56] I'm certainly not going through a summer
[44:58] here with no air conditioning. So, I
[45:01] want to make sure that there are things
[45:04] in place that will guarantee that we're
[45:07] not going to cause more problems with
[45:09] the grid by putting all these new
[45:13] houses. That's my one concern.
[45:15] >> Thank you.
[45:16] Thank you for that, Senator.
[45:18] Any other comments from the general
[45:20] public?
[45:21] >> I just want to say I think it's
[45:23] spectacular to have a have that built
[45:25] here in Eden. I mean, I see people
[45:28] copying that all over Eastern North
[45:30] Carolina. I think uh it's just
[45:33] wonderful.
[45:35] >> Thank you, Larry.
[45:38] >> Okay, come come forward.
[45:45] My name is Mimi Stark. I live on Philip
[45:47] Street in the Middle Village. Um, I've
[45:50] never paid attention to any of this.
[45:51] is my first night to know about it.
[45:54] My concerns that the houses are not so
[45:56] tight together that if you sneeze on one
[46:00] porch, they say, "God bless you." One
[46:02] down. Um, I think there needs to be a
[46:04] substantial sideyard between these
[46:06] houses. And I I question if six is too
[46:09] many, perhaps it should be four.
[46:11] [clears throat]
[46:12] I think it's [laughter] wonderful. It's
[46:13] going to be used. I hope they're
[46:14] charming. I hope they look just like
[46:16] that original little house that's there.
[46:18] But I just I don't want to see it be so
[46:20] tied together that it it looks
[46:21] overcrowded.
[46:24] >> Thank you.
[46:32] » Okay, there appearing to be no further
[46:35] public comment. Okay, come on Pat.
[46:37] >> I'm Pat Groker. I also live in the mill
[46:40] village and I'm just wondering what the
[46:42] distance is from wall to wall on those
[46:46] houses in the mill village it's 27 ft.
[46:50] So if it's at least that much it looks
[46:52] like it'll be okay.
[46:56] Do you know do you know approximately
[46:59] >> I just want to reiterate that this is
[47:01] just this is just
[47:03] >> this is not yet and then we can we're
[47:05] going to work through for as we get to
[47:07] our special use permit um but this is
[47:10] just for reasonzoning to move forward
[47:11] with the
[47:14] site design and stuff like that all that
[47:16] >> they'll be back here the preservation
[47:18] commission also
[47:19] >> it's just outside the pres
[47:21] >> so they'll be back the applicant will be
[47:24] back Yes, correct.
[47:27] >> Yes.
[47:28] >> And we've got a excellent example of how
[47:30] it works, but it can work either way.
[47:33] >> Here we have an applicant who's asking
[47:35] for the change from R5 to R3 and they're
[47:38] going to come back later to request the
[47:41] special. And then earlier we had Mr.
[47:45] sellers and Chris come to us and they
[47:46] ask for a reasonzoning from R5 to R3 and
[47:51] then follow that up in the same here
[47:53] tonight as for um the approval of the
[47:56] special use permit. That's right.
[47:57] >> So, one did in one meeting and one's
[48:00] doing it one now and
[48:01] >> that was because of the snowstorm that
[48:03] kind of hooked us up with with the first
[48:06] the special use per they come that's
[48:07] when the conditions for the placement
[48:08] property. This is just the reason I need
[48:10] to see it. It's even allowable to move
[48:11] forward, but that's
[48:14] >> And does the um the special use permit
[48:18] does it always involve the TRC, the
[48:19] technical review committee, or is that
[48:21] just a certain size development?
[48:23] >> Uh usually certain size development
[48:25] coming in. Uh these what I would do is
[48:27] uh which David has left, but see what
[48:30] needs to be done from an infrastructure
[48:32] standpoint if the taps are still there.
[48:34] Uh but it's just an infield development.
[48:36] that's not one of your larger
[48:37] developments that will require all kinds
[48:40] of, you know, infrastructure to be
[48:41] placed on the property. So, uh, we'll
[48:44] probably have like a small TRC that we
[48:46] would run. This is just, um, we would
[48:50] probably do that either right before or
[48:52] just after to make sure everything's
[48:54] been this is a smaller development
[48:56] trigger.
[48:57] >> And given the concerns that have been
[48:59] raised with the electric department be a
[49:01] part of that smaller version of the T.
[49:02] >> Absolutely. Yeah. Absolutely. Usually
[49:04] it's department within the town that
[49:07] would be a part of any small discussions
[49:10] that would require that. Absolutely.
[49:12] >> And at those meetings you'll bring it up
[49:14] to the um electoral department.
[49:16] >> That way we can have some answers at the
[49:17] next meeting to be able to kind of tell
[49:20] you what's going on and if it's good to
[49:23] go.
[49:27] » You got a question? So Cy, last meeting
[49:29] we talked about the new grid and how we
[49:32] can transfer power from station to
[49:36] station. Correct.
[49:40] Would if 10 of these were to overload
[49:42] it, do we have room to transfer it to
[49:45] another area?
[49:46] >> Yes. So we feed in off Church Street in
[49:50] two locations, particularly with the
[49:52] location. Schwarz is located right at of
[49:58] our
[50:00] circuit disconnects. Um, and one of the
[50:02] things we've been doing and particularly
[50:04] for this one is to move the
[50:07] [clears throat] service line for this
[50:08] particular property just north of that
[50:10] so it stays on. But one of the things
[50:13] we've been doing for our system
[50:14] improvements is putting those back into
[50:16] auto closures where they cycle and close
[50:19] on their own. So as things return, crews
[50:22] don't have to come back out and switch
[50:24] those in as sealed units. We do have the
[50:27] ability to feed the Queen Street
[50:29] location from both Hill Village side as
[50:31] well as the Oakland Street side. And
[50:34] there was some um
[50:37] above ground power that was removed from
[50:40] the rear of the property when we um were
[50:43] able to work with the former propert
[50:48] um from the original six homes that were
[50:50] there. So there may be a third entry
[50:53] point at the north end of this 2acre
[50:57] property that's already there for
[50:58] overhead. So we may have three options
[51:01] to choose from here. And with the uh
[51:05] mill village line, do we have the same
[51:07] degree? How do we have the same degree
[51:09] of difficulties as was described on Oak
[51:12] Street?
[51:13] >> No. Um particularly with Mill Village,
[51:15] the only service area in town that's
[51:17] powered by Dominion. So it's not a town
[51:20] electric customer,
[51:21] >> but you can still route it that way. Uh
[51:24] is that through some interlocal
[51:25] agreement or
[51:26] >> we have overhead that um parallels the
[51:30] area there along the railroad track
[51:33] >> um and east to west along church and
[51:36] then north to south on as well as on
[51:38] street 400 block of east
[51:42] >> and next is up and running in that part
[51:44] of town.
[51:45] >> Um I I do not know.
[51:49] But um we started really at our most
[51:52] outer edges and we're working our way
[51:54] back towards the center there.
[51:58] >> Any other questions, comments, concerns?
[52:04] » Okay, as we've done before, uh let's go
[52:06] through the five questions. Um the first
[52:09] question is whether or not the um
[52:11] resoning would not endanger the public
[52:14] health or safety. And I would entertain
[52:17] a motion, a second regard that question.
[52:22] » Second.
[52:22] >> Okay, I got a motion and a second. All
[52:25] in favor of finding that the
[52:27] reasonzoning will not endanger the
[52:29] public health or safety, please signify
[52:31] by saying I.
[52:32] >> I.
[52:33] >> Any opposed?
[52:35] >> Okay. Next, uh we need to consider um
[52:38] whether or not we'll adopt a finding
[52:40] that the reasonzoning will not injure
[52:42] the value of adjoining or abuing
[52:43] property. We got a motion. We have a
[52:46] second.
[52:46] >> Second.
[52:47] >> Okay. All in favor of finding that this
[52:50] resoning will not injure the value of
[52:51] adjoining or rebuting property, please
[52:53] signify by saying I.
[52:55] >> I.
[52:55] >> Any opposed?
[52:59] » Next, we need to consider uh whether
[53:01] this resoning will be in harmony with
[53:03] the area which is located. I entertain a
[53:06] motion and second regard that finding.
[53:07] So move.
[53:09] >> Okay, we've got a um motion in a second.
[53:12] Um, all in favor of finding that this
[53:16] resoning will be in harmony with the
[53:17] area in which it is located, please
[53:19] signify by saying I.
[53:21] >> Any opposed?
[53:23] >> And next, the fourth sub question is
[53:25] whether this would be in conformity with
[53:27] the land use plan, thorough effect plan,
[53:28] or other plan officially adopted by town
[53:30] council. Do I have a motion?
[53:32] >> All right. Second.
[53:33] >> Second.
[53:34] >> Got a motion and second. All in favor of
[53:36] finding that the proposed reszoning will
[53:38] be in conformity with the land use plan,
[53:41] thair plan or other plan officially
[53:43] adopted by town council, please signify
[53:45] by signify by saying I. I.
[53:47] >> Any opposed?
[53:49] >> Okay. Having answered those four sub
[53:51] questions in the affirmative. Uh we need
[53:54] a motion and a second on the um ultimate
[53:56] question of whether or not we're going
[53:57] to approve this um group proposed
[54:00] resoning. So moved.
[54:02] >> Is that a motion?
[54:03] >> Second. Got a motion and second. All in
[54:05] favor of approving the reszoning from R5
[54:09] residential to R3 [clears throat]
[54:10] residential, please signify by saying I.
[54:13] >> Any oppose?
[54:15] >> Okay,
[54:17] thank you. Just bear with me. We got two
[54:19] more to go. The next matter that we need
[54:22] to consider is identified as public
[54:25] hearing dem.
[54:29] This is an application from Paul Latcher
[54:32] requesting to create six new lots by
[54:34] subdividing property located at 204
[54:37] Whiteman Lane. The um property is also
[54:41] identified by pen number 7805-58-786.
[54:49] And Dwayne, you're earning your keep on
[54:51] board.
[54:52] >> This was a lot of work this last couple
[54:55] question.
[54:56] >> Yes, sir. How far's lane was in the
[54:58] county?
[54:59] >> This is uh in the ETJ. So, it's uh in
[55:02] the planning jurisdiction of the town,
[55:03] but is it is outside the corporate
[55:04] limits? Yes, sir.
[55:06] >> It is uh
[55:09] >> I don't know how far it is in the ETJ
[55:11] away from county property, but that's uh
[55:14] it's within our county or town
[55:16] jurisdiction.
[55:16] >> It's in the county. It's in the county
[55:18] for tax purposes, but in the planning
[55:20] jurisdiction for town purposes
[55:23] [laughter]
[55:24] >> that extend and that extends one mile
[55:26] past our corporate limits or our city
[55:28] limit. So it's within that one mile
[55:30] zone.
[55:30] >> Okay.
[55:31] >> Does that make sense?
[55:32] >> So that's right across from uh Ford
[55:34] Place and Hampton
[55:36] >> in that same down that same white lane.
[55:38] Yes. Right.
[55:41] >> Yeah. And that is within one mile city.
[55:46] You trying to get out? I was just having
[55:48] to hear this.
[55:49] >> No, no. When when you say white lane,
[55:52] you know, always white lane was in the
[55:54] county, right? So, so I was just
[55:55] wondering where resident at.
[55:57] >> Yeah, he knows where his brothers are,
[55:59] >> huh?
[55:59] >> You know where your brothers are?
[56:01] [laughter]
[56:03] » Your water and sewer will go through who
[56:05] then?
[56:08] » Okay.
[56:09] >> So, is that property for sale?
[56:13] north of that was just north of where
[56:21] » that's all the way down.
[56:25] » Was that the property
[56:29] one time?
[56:30] >> That's more than
[56:32] >> the way the crow flies.
[56:36] more than a mile down there.
[56:39] >> It just feels like way down there. We've
[56:42] got we've got that ETJ mark on our map.
[56:45] >> That's down by you. A jar.
[56:47] >> There you go.
[56:50] >> That's down there up.
[56:53] >> Sit in our ATJ.
[56:54] >> Yeah, it goes actually down to where the
[56:56] pavement is the rocks.
[56:58] >> The pavement goes to the dirt road.
[56:59] That's it goes up.
[57:00] >> That crow will be tired by time.
[57:03] [laughter]
[57:07] » Okay, Dwayne, we'll leave it up to you
[57:10] for the presentation of staff reports.
[57:12] Yes sir. And uh I look now see I made a
[57:14] mistake on my staff report. This was for
[57:15] six lots
[57:17] >> not for four. I put four down there but
[57:18] this is for six lots. Um it is a basic
[57:22] manage permit for a subdivision to
[57:24] subdivide lots not for a subdivision
[57:26] which you would think of create new
[57:28] roads extension to sewer services or
[57:30] anything like that. It's just creating
[57:31] new lots. So we're turning uh they're
[57:34] going to be turning 18 acres uh which is
[57:36] right there or 20 residential. Right now
[57:38] it is vacant uh I guess existing
[57:41] farmland or or was farmland at some
[57:43] point. Um so with this I I go through
[57:46] and look at encourage population growth,
[57:48] promote economic uh development, provide
[57:50] recreation and open space and foster
[57:52] housing choice. Uh the goals listed um
[57:55] the most applicable goals is development
[57:57] develop and implement strategies to
[58:00] promote three generation population
[58:01] growth in town that builds on existing
[58:03] resources and efforts to attract retirey
[58:05] population. expand these efforts to
[58:07] include attracting new millennial and
[58:08] mid-career professionals. Uh ensure the
[58:11] town's development ordinance is
[58:12] conducive to economic trends as telecom
[58:14] community college industry
[58:15] entrepreneurship establish local
[58:17] development policies, programs,
[58:18] resources promote increased ownership
[58:20] within town. Uh
[58:24] >> the town will encourage the location of
[58:26] business residential development service
[58:27] providers that serve retirees while
[58:29] create jobs for younger residents. Uh
[58:31] the town encourages the development of
[58:33] housing type that accommodate retirees,
[58:35] young professional, millennials.
[58:37] Um as you stated, this is outside of the
[58:39] town corporate limits. Uh uh the water
[58:43] uh services um
[58:46] will be uh available by Chan County and
[58:49] electric by the town. Uh the park is
[58:51] located um within the town's HJ. Um
[58:55] [clears throat] the subject uh property
[58:57] is located uh on Whiteitman Lane.
[59:00] Uh so basically R20 means a minimum of
[59:04] 20,000 square feet. If you look at the
[59:06] preliminary plat that was submitted
[59:07] within the application, we're ranging
[59:09] anywhere between uh two and almost 4
[59:12] acres I believe it was. So well above um
[59:16] what is actually needed for that
[59:18] particular zoning district. Uh the
[59:21] recommendation of the major special use
[59:22] per process requires advocates to
[59:24] specify specify the exact proposed use
[59:26] of land uh and allows town council to
[59:28] place restriction on the actual
[59:29] development. Uh according to the
[59:31] advocates, I'll let them speak on this
[59:33] uh for single family detached uh loans.
[59:36] Uh the plan board met on March 2nd, 2026
[59:38] and unanimously uh recommended approval
[59:41] uh of the miss use permit application uh
[59:45] along with the uh five questions that
[59:47] y'all will vote on tonight. Uh next is
[59:51] the uh future land use map uh showing
[59:54] the location. Uh and if you have that
[59:56] front of you, Councilman Bond, you'll
[59:57] see that is just inside the ETJ
[1:00:02] limits
[1:00:02] >> as a profile. as
[1:00:06] um so uh the proposed um staff
[1:00:11] recommendation along with the planning
[1:00:12] board all details and improvements uh
[1:00:15] shall be installed and constructed in
[1:00:16] according UDO requirements all necessary
[1:00:19] traffic improve improvements utility
[1:00:21] installation and connections um shall be
[1:00:24] installed uh by the developer and fees
[1:00:27] associated fees board and storm water
[1:00:29] drainage shall meet any required NCDQ
[1:00:31] regulations
[1:00:33] Um and staff does find the proposed you
[1:00:35] speak before me with the uh land use
[1:00:38] plan, eat joint land use plan um for you
[1:00:42] know lower density uh residential areas.
[1:00:46] >> Yeah, I hear you right. But didn't you
[1:00:48] say water was going to be provided by
[1:00:50] the county?
[1:00:53] >> So electricity is not going to be
[1:00:54] provided by the town either, right?
[1:00:56] >> Yeah, we have electric runs down by the
[1:00:58] way. How
[1:00:59] >> about is it
[1:01:02] We have electric that comes in north
[1:01:04] from Paradise across Paradise Fur along
[1:01:08] the dirt path to the farthest end of
[1:01:12] Paradise and then down or
[1:01:16] » that is
[1:01:19] electric
[1:01:21] any concerns from residents?
[1:01:26] >> Not that I'm aware of. I think I've
[1:01:27] spoken to a few. Um, I think there was
[1:01:29] some misconception cuz anytime somebody
[1:01:31] hears about a major subdivision, they
[1:01:33] automatically think uh they're going to
[1:01:35] put in a lot of houses when when in fact
[1:01:37] this is just creating lots that are
[1:01:39] going to be accessed only from White
[1:01:41] Lane. There's no internal roads. Uh,
[1:01:43] it's just going to be very large lots
[1:01:45] with homes on them.
[1:01:47] >> How many? Six.
[1:01:48] >> Six.
[1:01:49] That's right.
[1:01:50] >> These lots different size.
[1:01:52] >> Yeah, I think they range and I I'll let
[1:01:54] the advocate speak on it. you have your
[1:01:55] preliminary uh uh plat uh in your
[1:01:59] application. I want to say they range
[1:02:01] from 2 point some acres to high three
[1:02:04] acres.
[1:02:08] » This is sort of more of the same I mean
[1:02:10] it sort of down there now.
[1:02:13] >> Yeah, it's it's very rural down there.
[1:02:15] This is going to maintain the rural
[1:02:17] feeling. It's not uh high density. It's
[1:02:19] very very low density. Like I said, a
[1:02:22] developer could go in there and put in
[1:02:23] 20,000t lots, which is a half acre.
[1:02:27] >> And it's currently on what right now?
[1:02:29] >> R20.
[1:02:29] And it's going down to R4.
[1:02:32] >> No, no reszoning. It's just R20. Except
[1:02:35] this is going to be a lot higher density
[1:02:37] because it's larger lots.
[1:02:43] » Okay. Any other questions of the So,
[1:02:46] this is still going to be classified as
[1:02:48] county land. It's still county land, but
[1:02:51] we've got zoning control over that.
[1:02:54] >> I got that. But it's still going to be
[1:02:55] county land.
[1:02:58] >> Yes.
[1:03:01] >> All right.
[1:03:01] >> You know, it's town utility, right?
[1:03:03] >> Yes.
[1:03:05] >> Any more questions?
[1:03:07] >> Is that where
[1:03:10] is because it's
[1:03:11] >> because it's within the ATJ.
[1:03:16] » Okay.
[1:03:18] neighbors in the city.
[1:03:20] >> All right. Thank you.
[1:03:21] >> Thanks, sir.
[1:03:24] >> Next, we'll hear from the applicant or
[1:03:26] the applicant's representatives. Good
[1:03:29] evening.
[1:03:31] >> Good evening. My name is Eddie Hman. I'm
[1:03:33] a professional land surveyor and I'm
[1:03:35] helping the client with the project. Uh
[1:03:37] we've done a bad survey prevention
[1:03:41] subdivision plat here of six locks. The
[1:03:43] clients wanted to use each all the
[1:03:46] existing drainage of the agriculture
[1:03:49] land and actually did have a
[1:03:51] [clears throat] crop planted on it last
[1:03:52] year, soybeans. Um,
[1:03:55] and they didn't want to disrupt the
[1:03:56] drainage. So, we're going to let each
[1:03:58] cut of land be a lot and they vary in
[1:04:01] sizes from just a little under two acres
[1:04:05] to 4 and 12 acres, 4.3 acres. Again,
[1:04:09] there's we're putting six units on 18
[1:04:11] acres of land. which is very low
[1:04:14] density. Uh like I said, it exists under
[1:04:18] R20 zoning which would allow uh a lot on
[1:04:21] every half acre. Uh but but going with
[1:04:24] the low density end is not to disrupt
[1:04:26] the drainage. Like I said, the existing
[1:04:28] drainage patterns are set up. So we
[1:04:30] didn't feel like going through and
[1:04:32] disrupting all that and doing a lot of
[1:04:34] land disturbing. Each cut of ground is
[1:04:36] going to be a one unit residential lot
[1:04:39] or one house. Um the
[1:04:45] um like I said the all the joint owners
[1:04:47] got mailings for the meetings. Uh you
[1:04:50] notify them all by mailings and uh but
[1:04:53] I'll be here to answer any questions you
[1:04:55] may have. And let me speak to your
[1:04:57] question about the ETJ.
[1:05:00] As cities grow, they want to have a say
[1:05:03] in what's been going on closely adjacent
[1:05:05] to into the county areas. So every city
[1:05:08] municipality has an ETJ that they have a
[1:05:11] say in of what's coming because at some
[1:05:13] point this may get annexed in later down
[1:05:16] the line. Uh but so as mun
[1:05:19] municipalities grow in all the counties
[1:05:22] they have an ETJ so they they can have a
[1:05:25] say in what's going on and uh and that's
[1:05:28] what's taking place here. We're actually
[1:05:30] in the county and will remain in the
[1:05:32] county, but the uh but the city has a
[1:05:35] say on what's happening at their back
[1:05:37] door for now.
[1:05:39] >> Okay. What size houses are you planning
[1:05:41] on building?
[1:05:43] [clears throat]
[1:05:43] >> Uh we're going to have to set up a
[1:05:48] G restrictions and we'll probably be
[1:05:50] around 2,2500 square foot. Um, my plan
[1:05:55] is is not to build every house, but to
[1:05:57] just turn them into lots and then there
[1:06:00] sell them. Um, we may build a few houses
[1:06:02] cuz I do build homes for a living. So,
[1:06:05] we may build a few houses on a couple of
[1:06:06] them. We are not 100% sure yet. We're
[1:06:08] just trying to get this all kind of
[1:06:10] passed through and um get this part
[1:06:14] done.
[1:06:15] >> So, you're [clears throat] trying to get
[1:06:16] it established, build a couple of homes,
[1:06:18] and then sell the rest of the land for
[1:06:20] >> We could Well, we we could sell the
[1:06:22] lots. Yes, sir.
[1:06:25] >> But we will but we will set up deed
[1:06:26] restrictions because of course if we're
[1:06:28] going to keep some of the lots to build
[1:06:29] on, we want to make sure that the house
[1:06:31] that are built next to us follow the
[1:06:33] same guidelines that we are going to
[1:06:34] build.
[1:06:34] >> Is this going to be like a little
[1:06:36] community? You going to have streets in
[1:06:38] here?
[1:06:39] >> No.
[1:06:39] >> You think of that?
[1:06:40] >> Every every lot in here is going to
[1:06:42] throw on Whitman.
[1:06:46] » He's got a copy.
[1:06:47] >> But I'll show it to you.
[1:06:49] >> Can I can I approach you?
[1:06:51] >> Yeah, sure. Huh? I ain't going to shoot
[1:06:52] you. [laughter]
[1:06:56] » I hope so. Nice meeting you.
[1:06:59] This too small for you to read. This is
[1:07:02] >> I got glasses.
[1:07:08] » Each cutt
[1:07:18] I know that good. Okay. family that
[1:07:20] lives down there. That's why I'm asking
[1:07:22] a whole lot of questions.
[1:07:26] » Okay. So, each lot is going to go
[1:07:28] straight to the to the lane itself all
[1:07:31] the way to the back.
[1:07:32] >> Okay.
[1:07:41] » All right. I'll be available for any
[1:07:42] other questions. Do you foresee uh if
[1:07:46] you were to sell one of these lots um
[1:07:48] somebody else asking us to subdivide
[1:07:50] that even further or would the covenants
[1:07:52] protect against that or the the deeds
[1:07:54] protected?
[1:07:55] >> We will protect we'll in the deed
[1:07:56] restrictions we will put that they are
[1:07:58] to stay have we subdivide them.
[1:08:00] >> All right.
[1:08:01] >> Yes sir. Thank you.
[1:08:05] Still they told me what kind of houses
[1:08:06] you're doing
[1:08:08] >> single family
[1:08:10] >> homes
[1:08:12] in the in the D restrictions
[1:08:13] >> 2500
[1:08:14] >> in the D restrictions we'll put 2
[1:08:17] >> 2400 foot homes um the lots are nice
[1:08:20] size you know
[1:08:22] >> um
[1:08:22] >> if you think of a spec home at all
[1:08:25] >> yeah I mean that's we we do plan to
[1:08:27] build a spec
[1:08:29] what you know
[1:08:30] >> we do we do plan on building a spec home
[1:08:32] and that's why we would need heat
[1:08:34] restrictions. Um because if not then I
[1:08:36] could build a spec house and then they
[1:08:38] have a bunch of double wide trailers and
[1:08:39] that's not going to be
[1:08:41] >> in comparison to what we want it to look
[1:08:43] like. And
[1:08:48] » any more questions of the advocate?
[1:08:50] >> I have a question.
[1:08:52] >> Okay. I have a question.
[1:08:54] >> When you can come up um when it's we're
[1:08:56] getting ready to move to the public
[1:08:58] comment
[1:08:58] >> and if you'll express your concerns or
[1:09:00] questions and then we can bring them
[1:09:02] back up. Okay. We'll be glad to hear
[1:09:04] from you. We get really close to that
[1:09:06] part of the agenda. All right.
[1:09:08] >> Okay.
[1:09:08] >> So, we'll bring you up. Okay. From here
[1:09:11] from this uh council, are there any more
[1:09:13] questions?
[1:09:13] >> No, I'm eager to see what uh my uncle
[1:09:16] has to say. [laughter]
[1:09:19] >> Thank you. And if you were to stick
[1:09:20] around,
[1:09:21] >> I'll move over.
[1:09:22] >> Thank you.
[1:09:24] >> So, next we have the public comment uh
[1:09:27] period of this public hearing and I will
[1:09:30] open the public hearing on this
[1:09:31] particular
[1:09:33] agenda item. So, if anyone has any
[1:09:35] questions or concerns, please come
[1:09:37] forward. We just ask that you identify
[1:09:39] yourself and limit your comments or
[1:09:41] questions to three minutes. So, please
[1:09:43] come forward.
[1:09:51] My name is Mary Copelan. Uh, some of my
[1:09:54] questions have already been asked, but
[1:09:56] anyway, I would like to know when the
[1:09:58] houses when they are built, will the
[1:10:01] houses be facing Whiteman Lane or will
[1:10:04] it be?
[1:10:04] >> Yes, Whiteman Lane. Yes, ma'am.
[1:10:06] >> Okay. All right. Will they all be the
[1:10:08] same color or
[1:10:10] >> No, that's they're going to be whatever
[1:10:13] the homeowner that would purchase the
[1:10:15] lot in the house would want to put a
[1:10:16] color.
[1:10:17] >> Okay. Um about how many bedrooms?
[1:10:21] >> Uh threebedroom, two bath is starting
[1:10:28] single families.
[1:10:30] >> Yes, ma'am.
[1:10:32] Um after you use part of the land that
[1:10:34] you plan to use or will other houses be
[1:10:37] built? Um
[1:10:38] >> no ma'am.
[1:10:39] >> The we have six lots. They're already
[1:10:41] subdivided by the ditches and that's
[1:10:43] where we keep we intend to keep them.
[1:10:46] >> Okay.
[1:10:49] >> All right. Thank you.
[1:10:50] >> Thank you. Thank you for coming forward.
[1:10:53] >> Anyone else?
[1:10:56] >> Are you going to stay quiet back there?
[1:10:59] [laughter]
[1:11:01] This sound like to close the public
[1:11:03] hearing on this particular agenda item.
[1:11:05] Uh are there any other questions um or
[1:11:08] comments by council other than the ones
[1:11:11] that we've already stated?
[1:11:14] There appearing none. We're going to go through once again the five question
[1:11:19] format that we have to follow. At this
[1:11:21] time, I would entertain a motion that
[1:11:24] the uh application and the proposed
[1:11:27] subdivision would not endanger the
[1:11:29] public health or safety. So move second.
[1:11:32] >> Okay, we got a motion and second. All in
[1:11:34] favor of finding that the subdivision
[1:11:37] will not endanger [clears throat] the
[1:11:38] public health or safety, please signify
[1:11:40] by saying I. I.
[1:11:42] >> Any opposed?
[1:11:44] Next question before us and I will
[1:11:47] entertain a motion to this effect that
[1:11:49] the proposed subdivision will not injure
[1:11:51] the value of a joining or abuing
[1:11:54] property.
[1:11:54] >> So second.
[1:11:55] >> Okay, we got a motion and second. All in
[1:11:57] favor of a finding that this proposed
[1:11:59] subdivision would not injure the value
[1:12:02] of adjoining or abing property, please
[1:12:04] signify by saying I. I.
[1:12:06] >> Any opposed?
[1:12:08] Next uh question before us. Uh, I'll
[1:12:11] seek a motion and second uh on a finding
[1:12:14] that this proposed subdivision will be
[1:12:16] in harmony in with the area in which it
[1:12:18] will be located. So move.
[1:12:20] >> Got a motion. Second and second. Got a
[1:12:23] motion and second. All in favor of a
[1:12:24] finding that this proposed subdivision
[1:12:27] will be in harmony with the area in
[1:12:29] which it is located. Please signify by
[1:12:30] saying I.
[1:12:31] >> I. Any opposed?
[1:12:34] Next uh question before us is whether
[1:12:37] this proposed subdivision will be in
[1:12:38] conformity with the LE plan, Thorf fair
[1:12:41] plan, or another officially adopted um
[1:12:44] plan um by the town council. So
[1:12:47] >> got a motion. Got a second.
[1:12:50] >> Got a motion and second. All in favor of
[1:12:52] finding that this proposed subdivision
[1:12:54] will be in conformity [clears throat]
[1:12:56] plan, thorough affair plan or other plan
[1:12:58] officially adopted by town council,
[1:13:00] please signify by saying I. I.
[1:13:02] >> Any opposed?
[1:13:04] Lastly, that mo moves us to the open
[1:13:06] ultimate question. I will seek a motion
[1:13:09] and a second that town council approve
[1:13:11] the uh major special use permit
[1:13:14] application as presented. Do I have a
[1:13:17] motion?
[1:13:18] >> Motion and a second. All in favor of
[1:13:21] council approving uh this major special
[1:13:23] use permit application, please signify
[1:13:26] by saying I. I.
[1:13:27] >> Any opposed?
[1:13:29] >> Okay. Thank you, gentlemen.
[1:13:31] >> Thank you very much.
[1:13:35] We actually
[1:13:51] » The next matter before us is a public
[1:13:54] hearing identified by
[1:13:57] case number MSU26-03.
[1:14:01] This is an application from Ryan Bond
[1:14:03] LLC requesting permission to construct a
[1:14:07] building to provide business incubator
[1:14:09] space for small businesses and outside
[1:14:12] storage located at 114 and 116 Mexico
[1:14:16] Road. The property is further identified
[1:14:18] as pin number 780500-34-3829.
[1:14:26] And at this time, Dwayne, you're center
[1:14:29] stage again. Please come forward. Is
[1:14:30] that your report?
[1:14:32] >> You still got to come in tomorrow.
[1:14:34] >> Yeah. Yeah. Oh, no.
[1:14:37] >> This is uh this is uh good stuff. So, um
[1:14:41] application before you today um I sat
[1:14:44] down with uh with one of the applicants
[1:14:47] and trying to figure out what route to
[1:14:49] go because this is fairly unique uh
[1:14:51] idea. Um so, basically uh we have 1.67
[1:14:56] 67 acres at 114 and 116 Mexico Road. Uh
[1:15:01] the existing land use is is commercial
[1:15:03] the zoning is commercial highway.
[1:15:05] Existing land use is vacant property
[1:15:06] with existing uh building um and
[1:15:09] appeared to been commercial at some
[1:15:11] point. Um so going through the four
[1:15:14] things again I won't bore everyone with
[1:15:16] it. uh you know this one really hints on
[1:15:20] the promoting of economic development uh
[1:15:24] and uh identified the goals and
[1:15:26] objectives and policies uh in place uh
[1:15:29] that kind of mirror what this uh you
[1:15:32] know use would be. Um pro promote and
[1:15:36] establish a broad range of new
[1:15:37] commercial uses in town. Um develop and
[1:15:40] implement strategies to promote three
[1:15:42] generations of population growth. uh
[1:15:45] developed a strategy for expanding job
[1:15:47] opportunities in healthcare, tourism and
[1:15:48] vocational training sectors. Uh town
[1:15:52] encouraged the location of business,
[1:15:53] residential development, service
[1:15:54] providers that serve retirees while
[1:15:55] creating uh jobs for younger residences.
[1:15:58] Uh the the town of Edington encourages
[1:16:00] new commercial uses to locate in any
[1:16:02] commercial area uh within town. Uh the
[1:16:05] town encourages entrepreneurship and the
[1:16:06] opening of new locally owned businesses,
[1:16:08] particularly retail establish
[1:16:09] establishments and uh restaurants. Um
[1:16:15] property is uh in the ETJ um
[1:16:21] but it's just outside of the town
[1:16:24] municipal limits.
[1:16:28] [laughter]
[1:16:29] >> Uh the applica application for you is
[1:16:32] requested to have a major space use
[1:16:33] permit for a multi-use incubator space
[1:16:37] uh for small businesses uh and with uh
[1:16:39] some outside storage. Uh so what I did
[1:16:42] is being uh kind of a unique use and not
[1:16:45] really defined within our UDO uh I went
[1:16:48] with outside storage as needed a major
[1:16:49] space use permit um and then anything
[1:16:51] else that kind of fall underneath that.
[1:16:54] Um and uh the major space use permit
[1:16:56] process requires applicants to specify
[1:16:58] the exact proposed use of land and
[1:17:00] allows town council to place
[1:17:01] restrictions on actual development. Uh
[1:17:03] you'll see uh where I took excerpts out
[1:17:06] of the UDO. Uh basically this is office
[1:17:08] use not otherwise classified uh an
[1:17:11] outside bulk storage of non-hazardous
[1:17:13] material. Um the planning board met on
[1:17:16] March 2nd and we unanimously recommended
[1:17:19] approval of legis permit uh with uh to
[1:17:22] town council with staff recommended
[1:17:24] conditions. Once again you have to
[1:17:26] answer those five questions. uh uh the
[1:17:29] proposed use is compatible with the
[1:17:30] eastern future land use map uh where it
[1:17:34] shows it as being a commercial uh space.
[1:17:38] So the uh applicable regulations from
[1:17:40] the UDO uh the following conditions were
[1:17:46] um suggested all details and
[1:17:48] improvements shall be installed and
[1:17:50] constructed according to UDO
[1:17:51] requirements. uh all necessary traffic
[1:17:53] improvements, utility installations and
[1:17:55] connections. Uh drainage uh storm water
[1:17:58] detention improvements shall be
[1:18:00] installed and associated fees by the
[1:18:02] developer and storm water drainage shall
[1:18:04] meet uh any required NCDQ regulations.
[1:18:08] Um and staff does find the proposed use
[1:18:10] of conformity with the land use plan.
[1:18:12] >> Uh so that's kind of where it is now
[1:18:16] with the staff.
[1:18:18] Can that be county water town electric
[1:18:22] and also have access to town sewage?
[1:18:25] Correct.
[1:18:26] >> Uh no. So it is just uh north of that.
[1:18:29] It'll be uh we'll have to have future
[1:18:31] conversations about any annexations that
[1:18:33] wish to happen for the extension of uh
[1:18:35] services. Um and Mexico Road is a DOT
[1:18:39] road. So uh if they want driveway
[1:18:41] permit, if they need driveway permits,
[1:18:42] it would go through NC DOT.
[1:18:44] uh if they want an extension of any type
[1:18:46] of utility services, then we would have
[1:18:48] to look at a annexation of the property.
[1:18:50] >> And what type of business is you right
[1:18:52] now?
[1:18:52] >> So, it's it's incubator space, and I'll
[1:18:54] let the applicants kind of speak on what
[1:18:56] they're thinking uh with it, but uh it's
[1:18:58] I believe it's up to six um five areas
[1:19:03] where a small business can have a
[1:19:05] startup. Um, and I'll I'll let them
[1:19:08] answer that, but it's it's uh I guess if
[1:19:11] uh someone wanted to do uh tent, I think
[1:19:14] was broad, then they can ran out of a
[1:19:16] space to do tent while they um they're
[1:19:18] not having to spend money on a larger um
[1:19:21] unnecessary area. So, they would have a
[1:19:23] place to do that.
[1:19:24] >> Is that commercial now?
[1:19:25] >> It is a commercial. Yes, sir.
[1:19:31] » All right. Any other questions? All
[1:19:33] right. At this time, we would um get a
[1:19:36] presentation from the owner's
[1:19:40] representative. I think we've got Dr.
[1:19:41] Brian Bun here.
[1:19:45] » Thank you so much. Um name's Brian Bun.
[1:19:48] Myself and Josh Ryenbark are kind of the
[1:19:50] two owners of this LLC. Um and a lot of
[1:19:54] this came out of just um you know
[1:19:56] brainstorming ideas and wanted to work
[1:19:58] together. Um you've been in Eden for
[1:19:59] about 12 years now. um of course work in
[1:20:02] the community as well as invest in the
[1:20:04] community. Um work with South Broad
[1:20:06] Investments have a building downtown. Um
[1:20:08] but they have a building as well as a
[1:20:09] couple rounds of properties in the area.
[1:20:11] So um you this is my home and my my hope
[1:20:13] is to make it better. Um you know Josh
[1:20:16] same been here a lot longer than I have.
[1:20:18] Um you know several wash houses. He's uh
[1:20:20] you involved in in entrepreneurship um
[1:20:23] and likes to make nice stuff as well. So
[1:20:25] we came together this idea. Um the
[1:20:28] acreage that we purchased is um just shy
[1:20:31] of uh 1 and 3/4 acres um there on Mexico
[1:20:34] Road and in between was the the Dixie
[1:20:36] Auto and the um there's a a garage there
[1:20:39] as well. Um you know with the goal of
[1:20:42] basically putting up a building um
[1:20:43] 10,000 foot metal building um on the
[1:20:46] space uh potential for another one in
[1:20:49] the future, but you know uh we'll kind
[1:20:51] of see how this goes. as well as to have
[1:20:53] um on-site uh storage opportunities. Um
[1:20:57] part of this is you know incubator for
[1:20:59] us as well as incubator for whoever
[1:21:01] wants to you know um start a business.
[1:21:04] Um some of the ideas that kind of
[1:21:06] swirled around and that spoke to a
[1:21:07] gentleman who um fixes boats in his
[1:21:10] driveway. He said he loved to have 3,000
[1:21:12] you know square foot to figure out hey
[1:21:13] how can I do this? This is nowhere for
[1:21:15] that need to um you know folks that
[1:21:17] might want to u um a place to store an
[1:21:20] RV. There's no real good places to do
[1:21:22] that in Edington. Um folks that somebody
[1:21:25] doing a um a tenting business out of
[1:21:27] their uh garage that needs 2,000 square
[1:21:29] foot. Uh there's nowhere to do that in
[1:21:31] Edington. So we said, "Well, let's try
[1:21:32] to find a way to get that in Eden." Um
[1:21:34] so that's where this came out of the the
[1:21:36] building. um as it is right now is
[1:21:38] 10,000 ft² um with 14T um garage doors
[1:21:43] as well as a door five doors um to be
[1:21:46] potentially divided up into up to five
[1:21:49] um 2,000 foot um um units as well as
[1:21:53] opportunities for using outdoor um
[1:21:55] space. There's a current building on the
[1:21:56] premises. It's about thousand square
[1:21:58] foot and um East Coast Site Works um
[1:22:01] which is the the business owner Josh
[1:22:03] Roden Mark is um is currently renting
[1:22:05] out that space. Um fixing it up for
[1:22:08] starters and then going to use that to
[1:22:09] help source some of their goods. So
[1:22:12] that's our goal and plan. Um
[1:22:16] >> what base Mexico road
[1:22:18] >> the the building?
[1:22:19] >> Yeah.
[1:22:20] >> So not exactly. Um the building's
[1:22:22] actually so there there's currently
[1:22:24] about thousand square foot building that
[1:22:26] is facing kind of perpendicular to the
[1:22:28] road. It's going to be behind that one.
[1:22:30] Um, so that's that's where we
[1:22:33] >> So that they can rent it out shortterm
[1:22:35] or long term, whatever y'all decide on
[1:22:38] or they will
[1:22:39] >> um, so I mean the
[1:22:42] I most likely it'll be long term because
[1:22:44] there will need to be, you know,
[1:22:45] infrastructure put in. Um, for instance,
[1:22:47] if they wanted 4,000 square foot, then
[1:22:49] there's going to be a wall that's going
[1:22:51] to come into that bay. Um, as well as
[1:22:53] whatever, you know, buildup needs to be
[1:22:54] done inside. Um
[1:22:57] so long term
[1:22:59] >> it was mentioned pl board meeting about
[1:23:01] bathrooms that that is a requirement is
[1:23:03] that correct
[1:23:05] >> bathroom inside the building
[1:23:09] >> yeah most likely we'll have at least one
[1:23:11] per unit.
[1:23:12] >> Yeah they they'll have to meet the
[1:23:13] building codes requirements. So that
[1:23:15] would be required for bathrooms.
[1:23:20] » Okay. Any more questions of that?
[1:23:25] Okay. Thank you, Dr. B.
[1:23:30] All right. I'd like to open the public
[1:23:32] hearing uh portion of this.
[1:23:36] Anybody here to speak on this particular
[1:23:38] application?
[1:23:40] >> I just have one question. Um,
[1:23:45] as we know, across from my home was
[1:23:48] built, it is someone who's supposed to
[1:23:50] have a a mobile auto repair and they're
[1:23:53] doing it all in their driveway, which
[1:23:55] leads to over trash and things around
[1:23:58] that. I wouldn't expect in a residential
[1:24:01] area. I know this is a commercial
[1:24:03] building, but [clears throat] they're
[1:24:04] going to have outdoor storage. So the
[1:24:06] question is, are they going anything
[1:24:08] stored outside is it going to be
[1:24:12] usable? In other words, I my my concern
[1:24:15] is that the town winds up having a
[1:24:16] junkyard because somebody rents a space
[1:24:19] and puts three cars that will never run
[1:24:22] in there and then it slowly becomes a
[1:24:25] place to store. For 100 bucks, I can
[1:24:27] store a junk car here, a junk car there.
[1:24:30] So, the outdoor space, are there going
[1:24:33] to be restrictions on what can be stored
[1:24:35] in that?
[1:24:37] >> Um, for us in particular, I I I don't
[1:24:41] prefer to have John. Um, and so for me
[1:24:44] to be able to keep tenants in these
[1:24:46] properties, it's going to have to be
[1:24:46] nice. Um, and our major goal is going to
[1:24:48] be or one of our goals is going to be to
[1:24:50] fence in everything with flat fence so
[1:24:52] that you can't see in. For instance, I'm
[1:24:54] going to charge them 100 bucks a month
[1:24:55] to char to park their RV. It needs to be
[1:24:57] secured, safe. Um, you know,
[1:25:01] if it's junk, it's got to go. Um, so
[1:25:03] that's not going to be part of what we
[1:25:05] have envisioned.
[1:25:06] >> So, whatever it's going to be stored,
[1:25:07] it's going to be usable in some form.
[1:25:10] >> Oh, correct.
[1:25:11] >> That that was my concern. I just didn't
[1:25:13] want because sometimes when you get
[1:25:14] these outdoor spaces, it goes from I'm
[1:25:18] going to just park my car here to all of
[1:25:20] a sudden you have
[1:25:21] >> junk everywhere.
[1:25:22] >> Yeah. It would be hard for us to make
[1:25:23] money if we had too much junk on the
[1:25:25] floor.
[1:25:26] >> I I thought so. Just want to put that on
[1:25:28] there.
[1:25:28] >> Thanks.
[1:25:29] >> Thank you.
[1:25:32] >> Okay. Any uh more comments from the
[1:25:35] public?
[1:25:36] >> All right. At this point, and I will
[1:25:39] order that the public comment section of
[1:25:40] the agenda item be closed. Uh any
[1:25:43] further questions or comments uh from uh
[1:25:46] town council before we deliberate on the
[1:25:48] questions that are before us.
[1:25:51] Okay, we've got this down pat by now. I
[1:25:53] hope do we have a a motion to the effect
[1:25:57] that a motion and a second that the
[1:25:59] proposed use will not endanger the
[1:26:01] public health or safety.
[1:26:02] >> So move.
[1:26:03] >> Got a motion and a second. All in favor
[1:26:05] of a finding that the proposed use will
[1:26:07] not endanger the public health or
[1:26:09] safety. Please say goodbye by saying I.
[1:26:11] >> I.
[1:26:11] >> Any opposed?
[1:26:13] Next, I'll entertain a motion that this
[1:26:15] proposed use will not injure the value
[1:26:17] of a joining or a budding property.
[1:26:20] >> Second.
[1:26:20] >> Okay, we've got a motion and a second.
[1:26:22] All in favor of a finding that the
[1:26:24] proposed use would not endanger the
[1:26:26] value of adjoining or abundant property.
[1:26:28] So, please signify by saying I.
[1:26:30] >> I.
[1:26:31] >> Any opposed? Next, we move forward to
[1:26:34] the uh question of whether this proposed
[1:26:36] use will be in harmony with the area in
[1:26:38] which it is located. I'll entertain a
[1:26:40] motion.
[1:26:41] >> Got a motion and a second. Um, all in
[1:26:44] favor of a finding that the proposed use
[1:26:46] will be in harmony with the area in
[1:26:48] which it is located, please signify by
[1:26:49] saying I. I
[1:26:51] >> any opposed?
[1:26:53] >> Fourth question. I'll entertain a motion
[1:26:55] that the proposed use will be in
[1:26:56] conformity with the land use plan
[1:26:58] thorough for fair plan or other plan
[1:27:00] officially adopted by town council.
[1:27:03] >> So move got a motion. Second.
[1:27:07] >> Okay. Got a motion and a second. Um, all
[1:27:10] in favor of a finding that this use will
[1:27:12] be in conformity with the land use plan,
[1:27:15] thoroughare plan, or other plan
[1:27:17] officially adopted by town council,
[1:27:19] please signify by saying I.
[1:27:20] >> I.
[1:27:21] >> Okay. The ultimate question. I'll
[1:27:23] entertain a motion that we approve the
[1:27:25] major special use permit application as
[1:27:28] presented.
[1:27:30] >> Okay, we got a motion and a second. All
[1:27:32] in favor of town council approving the
[1:27:34] major special use [clears throat] permit
[1:27:36] application as presented, please signify
[1:27:38] by I
[1:27:40] >> Any oppose? Okay. Thank you, Dr. Bond.
[1:27:43] Appreciate it. Good luck.
[1:27:47] >> Okay. Next, uh the item that uh we need
[1:27:50] to discuss uh requires us to go go into
[1:27:54] close session per North Carolina General
[1:27:56] Statute 143-318-11
[1:28:00] A4. Uh the purpose of the close to uh
[1:28:03] session is to discuss matters relating
[1:28:05] to the location or expansion of
[1:28:08] industries or other businesses in the
[1:28:10] area served by this public body
[1:28:12] including an agreement on a tentative
[1:28:14] list of economic development incentives
[1:28:16] that might be offered by the public body
[1:28:18] in u its negotiations. Uh I would
[1:28:22] entertain a motion that we go into close
[1:28:24] session.
[1:28:25] >> We got a motion and we got a second. All
[1:28:27] in favor of this body entering into
[1:28:29] close session for the purposes uh so set
[1:28:33] forth, please syndicate by saying I. I.
[1:28:36] >> Any opposed?
[1:28:37] >> Thank you ladies and gentlemen for being
[1:28:39] here. We've got to go into close
[1:28:41] session.
[1:28:43] Listen.
