house. I am, I have trust of

the house. I also live at that,

Pulaski Road. Um, and we're

looking to legalize
[2:24]
the existing shed that was
[2:26]
there when it was purchased my
[2:27]
parents purchased
[2:31]
it 23 years ago. So essentially
[2:31]
by with the, uh,
[2:34]
The real request, the bottom
[2:34]
line request
[2:38]
is that the, for accessory
[2:38]
buildings
[2:41]
the code allows 1200 square feet
[2:41]
and with the shed, you're up
[2:44]
to 1,462 square feet. So you're
[2:45]
looking
[2:49]
at 262 square feet variance just
[2:49]
to
[2:52]
maintain it 800 Pulaski Road has
[2:52]
been there for a long time. It's
[2:52]
a
[2:55]
corner plot. It's hard by
[2:58]
Minnicock and it's a it's a big
[2:59]
piece of property

more than 1 acre or 40. So is
[3:03]

requesting
[4:26]
an area variance that would
[4:27]
allow us to keep our existing
[4:27]
chicken coop in
[4:30]
its current location. Uh, we
[4:31]
understand that under town law,
[4:31]
the
[4:34]
board must be balanced the
[4:35]
benefit of granting the variants
[4:35]
to our family
[4:39]
against any potential detriment
[4:40]
to the health, safety, welfare,
[4:40]
and character
[4:44]
of the surrounding neighborhood.
[4:44]
We believe the facts and
[4:44]
evidence we are
[4:48]
presenting tonight demonstrate
[4:49]
the allowing the coup to remain
[4:49]
as reasonable
[4:52]
and consistent with those
[4:53]
considerations. A property
[4:53]
presents a unique challenge.
[4:57]
We live on a on a court. It's a
[4:57]
pie-shaped lot located in the
[4:58]
center and
[5:01]
are adjoined by 7 neighbors.
[5:02]
Because of that configuration,
[5:02]
there was no
[5:06]
practical location on our
[5:06]
property where the coup could
[5:07]
simply be relocated
[5:11]
and satisfy the requirement
[5:11]
required setbacks from all
[5:12]
surrounding properties.
[5:15]
We originally selected the
[5:16]
location, we were unaware of the
[5:16]
specific coupe
[5:19]
requirement. We thought we were
[5:20]
simply following the
[5:20]
requirements of a shed.
[5:24]
Uh, the coup is located 15 ft
[5:25]
off the property line, we
[5:25]
thought we were
[5:28]
in, um, Um, We're meeting the
[5:29]
requirements.
[5:31]
Um, we chose the, what we
[5:32]
believe to be the most discreet
[5:32]
and least
[5:36]
intrusive area of our yard. Once
[5:36]
we learned that the coup did not
[5:36]
meet the
[5:40]
required setbacks, we
[5:40]
immediately took the necessary
[5:40]
steps to address the
[5:44]
issue properly and apply for
[5:45]
this variance. A great deal of
[5:45]
thought and
[5:49]
care. Went into the construction
[5:50]
and maintenance of the coupe.
[5:50]
Uh, we have
[5:53]
3 kids. We were very concerned
[5:54]
about. Rodents and odor during
[5:54]
the town's inspection
[5:58]
we received positive feedback
[5:58]
regarding its condition and
[5:59]
quality
[6:02]
The inspectors both said that
[6:03]
they had never seen a coupe
[6:03]
built like this.
[6:07]
The coupe includes a
[6:07]
solar-powered exhaust system for
[6:08]
ventilation, as well
[6:12]
as a mini split heheheheheheheheniconditiom to help
[6:12]
regulate extreme
[6:16]
temperatures and prevent odors.
[6:16]
It's cleaned regularly and the
[6:17]
chicken's
[6:20]
feed is kept in a sealed
[6:20]
container inside of a, um,
[6:21]
storage bin to prevent
[6:25]
attracting rodents and other
[6:25]
pests. According to the
[6:25]
complaint registered
[6:29]
in the portal, uh, there were
[6:30]
concerns regarding pests that
[6:30]
have been raised
[6:34]
and the town came to our
[6:34]
property specifically to inspect
[6:35]
for the evidence of
[6:38]
pest activity and smell, none of
[6:39]
which were found. Believe the
[6:39]
actual conditions
[6:43]
observed during the inspection
[6:44]
are important when considering
[6:44]
whether the
[6:48]
coup has created an adverse
[6:48]
impact. Um, We'd also like to
[6:52]
provide some context regarding
[6:52]
the screening in this area.
[6:52]
There
[6:56]
were previously 3 mature trees
[6:57]
directly located on the side of
[6:57]
this.
[7:01]
Separating the coupe from the
[7:01]
adjoining property where the
[7:02]
complaint came. Those
[7:05]
trees were removed several years
[7:06]
ago by a tree cutting service
[7:06]
hired by
[7:10]
our adjoining neighbor without
[7:10]
our prior knowledge or
[7:11]
permission. Sent to
[7:14]
Tree cutting Service into our
[7:15]
yard, leveled those trees,
[7:15]
leaving us with
[7:19]
five-foot stumps that I then had
[7:19]
to pay to remove and grind out.
[7:20]
Those trees
[7:23]
would now be providing the
[7:24]
privacy that could be leading to
[7:24]
this complaint. Chicks
[7:28]
have also become something
[7:28]
meaningful to our family, our,
[7:29]
our children participate
[7:32]
in caring for them, feeding
[7:33]
them, collecting, and cleaning
[7:33]
the eggs and
[7:37]
learning the responsibility that
[7:37]
comes with caring for the
[7:37]
animals. It has
[7:41]
become both an educational and
[7:42]
rewarding experience for them.
[7:42]
And something
[7:46]
we genuinely enjoyed together as
[7:46]
a family. Most importantly,
[7:46]
we've made
[7:50]
every effort to ensure that
[7:51]
keeping these chickens does not
[7:51]
negatively affect
[7:55]
the people around us. Submitted
[7:55]
signed letters from our
[7:56]
neighbors who support
[7:59]
the coup. Um, have enjoyed our
[8:00]
eggs and have expressed that it
[8:00]
has not created
[8:04]
a problem or a nuisance for the
[8:04]
neighborhood. We understand why
[8:05]
setback
[8:08]
requirements exist and we
[8:09]
respect the town's regulations.
[8:09]
We're simply asking
[8:13]
the board to consider the
[8:13]
unusual configuration of our
[8:14]
property. The lack
[8:17]
of feasible alternative
[8:18]
locations, the condition and
[8:18]
maintenance of the
[8:22]
existing coupe. The town's
[8:22]
inspections finding no pest
[8:23]
infestation and the
[8:33]
support of our neighbors in the
[8:34]
actual impact the coup has had
[8:34]
on the surrounding
[8:37]
neighborhood. For, we
[8:38]
respectfully ask the board to
[8:38]
grant the requested
[8:42]

question, um, just a few points
[8:56]
I submitted

a pdf complaint via email as per
[9:01]
the hearing notice letter that I
[9:01]
received,
[9:04]
so I don't know if that gets
[9:05]
brought up during the discussion
[9:05]
as well, um,
[9:09]
but there's information on
[9:09]
there, um, in regards to the
[9:10]
comments made by
[9:13]
MR. Bentley, um. He references
[9:14]
that the coup was put up in a
[9:14]
fifteen-foot.
[9:18]
Um, distance from the property
[9:19]
line, but the notice hearing
[9:19]
that I received,
[9:23]
specifically says from my lot,
[9:23]
it's 7 ft and 13 ft
[9:24]
respectively, um, he
[9:27]
mentioned something about a tree
[9:28]
removal. Uh, that was done, I'm
[9:28]
assuming
[9:31]
by us on his property line. I'm
[9:32]
not aware of any service that we
[9:32]
hired to
[9:36]
have go over to his side that
[9:37]
would create a uh Cover for the
[9:37]
Said uh chicken
[9:41]
coop uh chicken uh chicken coop
[9:41]
uh chicken, um, and lastly
[9:41]
rodents and odor
[9:45]
that he mentioned. Um, he
[9:46]
specifically said in terms of
[9:46]
how it impacts his
[9:50]
children. I have children
[9:50]
myself. The odor and. Increase
[9:51]
in bugs and rodents
[9:54]
on our side of the fence because
[9:55]
of The chicken coop has become a
[9:55]
nuisance
[9:59]
which led to the initial
[9:59]
complaint in the first place.
[9:59]
Um, And
[10:03]
that's really all that I have to
[10:03]
say about it. We are on the
[10:04]
southerly side and
[10:08]
I believe. The coupe is actually
[10:08]
closer to our residential area
[10:13]
than any recreational area on
[10:13]
his side of the property.

wire that encapsulates that is
[11:11]
not the
[11:15]
solid structure that I'm

referring to. That that run is
[11:16]
the sloped, uh,
[11:20]
roof in the back there. Again,

as far as, um, Reconfiguring
[11:20]
that
[11:24]
that that is Easy enough to do.

I mean, it, but, again, this
[11:25]
thing is
[11:29]
directly next to my pool. We are
[11:29]
10 ft away from it, downhill.

Any smell, any rodent would be
[11:34]
in there. Town came
[11:38]
Again, said they had never seen,

never smelled anything. There
[11:38]
was
[11:47]
no signs of anything. Um, That's
[11:51]
all I really have in response to
[11:52]
that. No, no roosters out there,
[11:52]
right
[11:56]
No roosters. So at the time I
[11:56]
had the complaint, I
[12:00]
had 2 additional chickens. They
[12:01]
were hens. Polish hens. They
[12:01]
happen to be.
[12:05]
They squawk loud. I, I didn't
[12:05]
know. The Polish end were any
[12:06]
different than any
[12:09]
other ends, but uh. When the
[12:10]
complaints came in, all I could
[12:10]
think of is
[12:14]
that the neighbor might not have
[12:14]
liked the sound. I got rid of
[12:15]
those two
[12:18]
chickens. I thought this was
[12:19]
gonna go away after that. I've
[12:19]
since lost.

3 days' pay coming here to go to
[12:23]
court numerous times, spent
[12:24]
thousands of
[12:27]
dollars reserving my resurveying
[12:28]
my, my plot of land, sending
[12:28]
letters. In

addition to the tree stumps, I'm
[12:32]
I'm in quite a big hole here.

that there was no hog rendering

involved. I'm

not asking for that. All I'm

asking for is the fact I, I
[13:17]
built a retaining
[13:21]
wall on my property, and we have
[13:22]
a fence that my
[13:26]
neighbor requested he billed to
[13:26]
contain his dogs on his property
[13:30]
and it's within. It's, um,
[13:30]
Within 8
[13:33]
inches of what the required
[13:33]
setback of should be.
[13:37]
So, um, I'm requesting a
[13:37]
variance for the setback for the
[13:38]
fence to
[13:41]
be allowed. And also I have a
[13:42]
shed which is 4 inches from
[13:46]
the property line, I included
[13:47]
that in my request. So basically
[13:47]
the
[13:50]
two requests that you're
[13:51]
bringing before the board have
[13:51]
to do with
[13:55]
um, the shed, which is required
[13:56]
to be 2 ft off the property
[13:56]

and this is a residential

application, which solely seeks
[14:59]
side yard setback relief
[15:03]
to erect additions to my
[15:03]
client's home in East Northport.
[15:03]
The
[15:07]
subject premises is 3 gray stone
[15:08]
Drive, and this is located just
[15:08]
east of
[15:12]
the intersection of Larkfield
[15:12]
Road and Clay Pitts Road. So if
[15:12]
you know where
[15:16]
the iga is. Are now the former
[15:16]
iga. This is just east. It's the
[15:17]
second right
[15:21]
off Clay Pitts, and the subject
[15:21]
premises is the first rate on
[15:21]
Greystone.
[15:25]
It's a very well maintained
[15:26]
property and house. It belongs
[15:26]
to my clients
[15:29]
Jacqueline and David Birnbaum,
[15:30]
and the idea here is to erect
[15:30]
additions to
[15:34]
the side and to the rear to
[15:35]
accommodate their growing
[15:35]
family. They've lived
[15:38]
here for over 10 years now and
[15:39]
they have 3 children ages 7, 10
[15:43]
and 12, but it's not solely to
[15:44]
accommodate. The growing family.
[15:44]
It's also
[15:48]
to accommodate Jacqueline's mom.
[15:48]
So a significant portion of
[15:52]
this undertaking is to, um,
[15:52]
include an accessory
[15:55]
apartment as part of the
[15:56]
additional construction. You
[15:56]
have
[15:59]
our plans for the accessory
[16:00]
apartment. They're drawn by our
[16:03]
project architect Louise Agnes,
[16:04]
and as you can see from those
[16:04]
plans, the
[16:08]
proposed accessory apartment
[16:08]
meets all the dimensional and
[16:08]
design
[16:12]
requirements to establish such a
[16:13]
use. What we do not conform to
[16:13]
is side
[16:17]
yard setback, and that's the
[16:17]
only form of relief we need
[16:18]
tonight. With
[16:21]
the r20 zone in which this
[16:22]
property lies, you have to hold
[16:22]
20 ft side
[16:26]
yard setback on each side with
[16:26]
an aggregate of 40. If this
[16:26]
proposal is
[16:30]
granted this evening, we will be
[16:31]
holding 15 ft on the south side,
[16:31]
so it's only
[16:35]
a 25% reduction from that
[16:35]
otherwise required
[16:38]
by code, notably, however, even

after construction. We will

still have

Yes, we're going to the rear,

practical perspective, that the

is presently enclosed on three

sides by a 6 ft high white pvc
[17:17]
fence that will remain,
[17:18]
especially on the south side
[17:18]
where we are closest
[17:22]
to our most affected neighbor,
[17:23]
and with respect to that
[17:23]
neighbor, David
[17:27]
Birnbaum, um, Consulted with him
[17:27]
and talked to him about the
[17:27]
project and
[17:32]
he said he has no problems with
[17:33]
the proposal whatsoever. That's
[17:33]
our case.

2-story addition, a one-story

attached garage addition and a

rear covered patio. The property
[19:42]
is

located in the r40 zoning
[19:47]
district, which requires a
[19:47]
minimum side
[19:51]
yard setback of 25 ft, a minimum
[19:51]
aggregate side yard setback
[19:55]
of 50 ft and permits a maximum
[19:56]
of 3 garage spaces
[19:59]
The application requests relief
[19:59]
to permit. Minimum side yard

household storage

In practice, this addition would

sort of create a his and hers
[21:18]
type

garage with the new person, so.

Surveying more of MR. Levine's
[21:22]
vehicles and
[21:26]
related storage needs workbench,
[21:26]
tool area. The proposed
[21:30]
addition will increase the total
[21:30]
garage area to approximately 900
[21:34]

feet

um, while it's technically
[21:39]
exceeds the code's limitation on
[21:43]
garage capacity, the layout
[21:44]
dimensions and placement of the

garage doors

accommodate 4 vehicles, and the
[21:49]
additional space
[21:52]
is intended to improve the
[21:53]
functionality rather than
[21:53]
increase the
[21:57]
vehicle storage. The garage
[21:57]
addition will remain one. Story

in height and it
[22:01]
is strategically located to, uh,
[22:02]
incorporate the
[22:06]
pool area and create a covered
[22:06]
outdoor seating area. And

furthermore, the

addition will be substantially

screened from the neighboring

the east with existing mature

minimize any visual
