[3:39] Mr. Action, you want Yep. You want to
[3:41] stand up to the podium, please?
[3:48] So, Mr. Action, we
[3:52] got a couple different reports from your
[3:54] neighbors.
[3:56] couple of, you know, the one neighbor
[3:58] sent us quite a few photographs
[4:01] of all of it back there and
[4:05] they're not very happy with everything
[4:06] that's going on back there with all that
[4:08] tents
[4:09] in your property.
[4:11] They think you should clean it up a
[4:13] little bit, but
[4:16] that's what we're going to address the
[4:17] tent tonight. And is there anybody here
[4:22] that would like to speak? Hi, Mr. Exon.
[4:25] Okay.
[4:26] Are you okay? All right, Mr. Action, do
[4:30] you want to take a seat and then Art
[4:32] state your name, your address,
[4:35] and anybody who speaks, we give you
[4:37] three minutes and then
[4:42] Okay, our little Warbury Road. Uh, I
[4:45] oppose the request and I have sat
[4:48] through every one of these meetings. uh
[4:51] and u uh at the last meeting I think the
[4:53] board adequately described uh what the
[4:56] current situation is and uh that uh
[5:00] clearly made my mind up. So I'm I'm
[5:02] opposing this application. Thank you.
[5:05] >> Thank [clears throat] you.
[5:08] » So Mr. Do you want to see any of these
[5:11] pictures?
[5:11] >> Yes, I'd like them.
[5:13] >> All right.
[5:14] You want to go up to the podium and I'll bring them over to you. You can
[5:19] take a look at them.
[5:38] » [clears throat]
[5:42] » I'll give you a couple minute or so to
[5:44] go through them and take a look at them.
[5:54] » [snorts]
[6:37] » So, did these come from my tenant that
[6:39] just got evicted?
[6:40] >> I don't think so. Um, I do cuz they're
[6:42] on my property. Take these pictures.
[6:44] before taking outside my fence.
[6:47] >> What's the last name?
[6:49] >> What's that?
[6:49] >> What's the last name?
[6:51] >> I can't hear.
[6:51] >> What's the last name of you? What's the
[6:54] last person saying?
[6:55] >> Uh
[6:57] the Craig.
[6:58] >> No,
[7:00] that goes to them.
[7:01] >> About
[7:02] >> No, somebody was on my property there.
[7:06] These are nothing to do with the tent.
[7:07] This is the front yard of the SL tenant
[7:09] that I just got evicted. It's not
[7:12] >> look.
[7:13] >> All right. So you have
[7:14] >> the 14
[7:16] >> the tent's been an issue for three
[7:17] years.
[7:19] >> No, the garage has been issue for three
[7:21] years. The tent was there and please the
[7:22] garage.
[7:23] >> No, the garage wasn't. You pulled your
[7:25] application.
[7:27] >> Well, I got it right here. Would you
[7:28] like to see that?
[7:28] >> You don't have the right stuff because I
[7:30] went in there when I came back here last
[7:32] month. We reckon
[7:39] right there when I signed stuff. Yes.
[7:41] >> But that was three years ago. That was
[7:43] last month.
[7:49] » I know nothing about I knew that you
[7:51] applied for a garage three years ago.
[7:53] >> That's correct.
[7:54] >> And your house was an ituation and they
[7:57] wanted
[7:58] an architect's drawings on what you did
[8:00] to your house and the work being done.
[8:02] >> That's not true.
[8:03] >> The true It isn't true about this.
[8:05] >> That's not the whole sentence.
[8:06] >> Okay. But your house isn't let's call
[8:08] isn't your house isn't what we're
[8:10] talking about. talk about the times
[8:12] >> you're talking about the house. This is
[8:14] >> I'm just giving you
[8:16] >> Okay. All right, Mr. Ex.
[8:18] >> It's You want to get it right one time?
[8:21] >> Actions.
[8:22] >> Okay. Sorry. My apologies.
[8:24] >> Thank you.
[8:25] >> Um
[8:29] have any questions?
[8:35] Any
[8:36] questions?
[8:45] » Sorry about the whole backyard.
[8:47] >> Whole backyard.
[8:48] >> Yeah.
[8:50] >> So,
[8:52] um,
[8:52] >> so we're asking for a permit for a tent
[8:54] that he's had already up for three
[8:57] years.
[8:58] >> That's correct. That's correct.
[9:01] >> We're in court.
[9:01] >> That's what I was told. We're
[9:03] prosecuting. Mr.
[9:05] and justice court over this. So
[9:09] I I don't feel a special use for it was
[9:14] made was developed for tents in the
[9:17] backyard for storage. It's for home
[9:20] occupancy work for different businesses.
[9:25] >> So what might be helpful for the board
[9:27] when when you get around to looking at
[9:29] the merits of the application is the
[9:31] burden's on the applicant. So the person
[9:33] that comes before you have to
[9:34] demonstrate why they're entitled to the
[9:36] special use permit. That's solely their
[9:38] burden, [clears throat] not your burden,
[9:39] their burden. And the criteria that
[9:41] you're faced with is they have to show
[9:44] all the following that the location,
[9:46] size of use and structure, na nature and
[9:49] intensity of the operations involved,
[9:51] the size of site in relation to it and
[9:54] the location of the site with respect to
[9:56] streets give giving access to it will be
[9:58] in harmony will be in harmony with the
[10:00] orderly development of that area. So
[10:02] your first question is is having these
[10:04] things on that property in harmony with
[10:06] the orderly orderly development of not
[10:08] just that property but the properties
[10:10] surround it. That's your first question.
[10:12] And then the second piece of it is that
[10:14] the location, nature and height of any
[10:16] buildings, walls or fences will not
[10:18] discourage the appropriate appropriate
[10:20] development and use of adjacent land and
[10:22] buildings or or impair their value.
[10:25] Third is um operations of any
[10:28] conditional use should not be more
[10:29] objectionable to nearby properties than
[10:32] will any permitted use. So the question
[10:34] is would these things are these things
[10:36] more objectionable than something you're
[10:38] allowed to have as of right? And um and
[10:41] the last piece really I don't think is
[10:43] relevant but has to do with adequate
[10:45] parking that's really relevant but
[10:48] that's a requirement for an applicant to
[10:50] approve to to obtain a special use
[10:52] permit.
[10:54] I just want to remind you of that. And
[10:56] that's um Jenna, that's um 275-9
[11:02] uh
[11:04] uppercase C.
[11:25] » [clears throat]
[11:49] » So, at this point, you're probably going
[11:52] to close this public hearing. Everybody
[11:54] else has spoken. You got the letter that
[11:56] you have.
[11:59] >> So, can I have a motion to close this
[12:01] public?
[12:02] >> Second.
[12:04] >> So, hang around then come back up at
[12:06] when we start a regular meeting at 7
[12:08] o'clock. Then we go back and discuss
[12:11] everything.
[12:14] » Yeah.
[12:20] » What's going on? Went over and talked to
[12:22] the judge today. I was in there again
[12:24] for that person with all that crap.
[12:26] >> Yeah.
[12:31] » But these photos are showing the tent
[12:34] that you currently have up, right?
[12:38] >> The tent that's in these photos is the
[12:41] tent that you've had up for three years
[12:43] now, which is what we are discussing.
[12:45] >> Wait, what? Is there something wrong
[12:46] with my home? You see something wrong
[12:48] destroyed on it like your attorney
[12:50] talked last week
[12:53] apart.
[12:53] >> I'm going off of what the attorney just
[12:55] pointed out about
[12:58] how it compares to
[13:02] adjacent land other uses.
[13:04] >> Apparently, nobody's been on the
[13:12] » secondary. You want me to read that
[13:14] again? Yeah, if you would because they
[13:17] just came in.
[13:21] » A public hearing will be held by the
[13:23] town of Sullivan Planning Board on March
[13:25] 3rd, 2026 at 6:45 p.m.
[13:30] 7507 Lake Road, Chittangle, New York
[13:33] 1337 to consider the application of
[13:36] Brent and Melissa O'Neal for property
[13:39] located at 152 Washington Canes Stooga,
[13:42] New York. SPL number being 10.36-1-42
[13:48] for a special use permit pursuant to the
[13:50] town of Sullivan code article 4 animals
[13:54] and file sections 105-28 and 105-29 to
[13:58] have six chickens the above application
[14:01] is open to inspection at the town office
[14:02] building 7507
[14:05] road chip mango New York during regular
[14:07] business hours persons wishing to appear
[14:09] at such hearing may do so by person
[14:11] attorney or other representative
[14:15] You guys want to talk to them? Thank
[14:17] you.
[14:47] Good evening. Um, in the papers there,
[14:50] uh, our neighbor
[14:52] just u written a letter in response to
[14:55] this
[14:57] situation.
[15:00] » And then um I was asked to kind of draw
[15:03] up like where the coop goes. That's our
[15:07] um
[15:09] our property. Uh can't remember what
[15:12] it's exactly called, but anyways. Um, I
[15:14] did kind of change the lines for the 25
[15:17] foot because I know the 25 foot away
[15:19] from the neighbors is kind of uh what we
[15:21] need to be concerned with for chickens.
[15:24] So, I re some lines and I also um in the
[15:29] next
[15:31] page it talks about a chicken tractor
[15:34] which we kind of discussed just a little
[15:35] bit um and the benefits of it in that
[15:38] the chickens are healthier. Um, it also
[15:41] keeps your lawn in a better condition
[15:44] and um
[15:47] can also help uh with
[15:52] uh ticks and other things because
[15:53] they're moving around eating those
[15:54] things that you don't really want to
[15:55] have around. Um,
[15:58] see what else I put on there.
[16:02] Take up less space,
[16:04] keep the yard better, and yeah, keeps
[16:08] the birds healthier, too. And then um
[16:11] the next pages it just talks about how
[16:12] our fresh eggs are so much healthier for
[16:14] you and then what we purchase in stores.
[16:23] » That's it.
[16:24] >> Okay.
[16:25] So
[16:27] [snorts]
[16:28] I took I took a ride down and I looked
[16:32] at your property from the road and
[16:34] you're right on the corner
[16:36] >> and the lake is right across.
[16:37] >> Yeah.
[16:38] So, the only place looks like you had
[16:41] any room [clears throat] whatsoever to
[16:43] scoot your portable cage around is your
[16:45] front yard, George Lake.
[16:50] » And you have 10 chickens,
[16:52] >> but your application is for six.
[16:54] >> Yeah, we discussed the fact that we are
[16:56] 300 square feet shy of of being able to
[16:59] keep 10 chickens. So,
[17:02] >> at the last meeting, we discussed that.
[17:04] >> Yeah.
[17:04] >> Um Yeah. because you stated you thought
[17:06] that you may have what 20,000 square
[17:08] feet your building your yard
[17:13] you were going with 10 chickens right
[17:16] >> yeah and I think that's what is a lot of
[17:18] 10 2000 and we're like something
[17:22] >> that that would be clear land not with
[17:26] house setting on it a swimming pool deck
[17:30] and another garage besides the one
[17:33] attached to your house
[17:34] >> I guess this is not specific
[17:38] Yes, lot that just a lot of size, right?
[17:41] You got what 16,800 square foot house
[17:45] with an attached garage.
[17:48] What's your other garage sit 14 by 20
[17:50] something in the back?
[17:54] >> I don't know.
[17:55] >> Pools 28 foot round
[17:59] >> with a deck. Yeah. So that cuts down
[18:02] your square footage quite a bit.
[18:06] >> Yeah, the cage is um 4 foot by if you
[18:11] include the uh the coupe and the
[18:14] extending cage is 4 by3 which isn't very
[18:17] large.
[18:19] >> So is there anybody here that's wants to
[18:23] speak for this? All right. So, okay. I'm
[18:28] going to have them speak first. If you'd
[18:30] like to sit down,
[18:40] » so I got a couple rules. You get three
[18:43] minutes. So, and state your name,
[18:48] address, and then I start the three
[18:51] minutes after that.
[18:51] >> Okay.
[18:52] >> Uh, my name is John Smith. live on
[18:54] Washington 133 Washington with my wife
[18:57] Betty. Um we know of them. We're not,
[19:00] you know, really close to them, but we
[19:02] are neighbors.
[19:03] >> The chickens don't seem to cause any
[19:05] problems. Anytime we've been down that
[19:07] road or down the lake, the chickens are
[19:09] in their yard or they're in the
[19:12] um I don't see it as a problem.
[19:16] I think there's bigger problems in that
[19:17] area than chickens.
[19:20] >> Yeah.
[19:21] >> All right. just, you know, our opinion
[19:23] and our, you know,
[19:28] » Yeah, we appreciate it.
[19:30] >> Thank you.
[19:44] » [clears throat]
[19:45] >> Um, I'm actually going to oppose this uh
[19:50] chicken cell. Uh according to modern
[19:53] agriculture magazine, their special
[19:56] chickens issue, chickens uh excrete two
[19:59] cubic feet of manure every year. So 10
[20:04] chickens are going to excrete 20 cubic
[20:07] feet of manure on this property every
[20:09] year. Now this box only holds one and a
[20:12] half cubic feet [clears throat]
[20:14] uh in volume. And uh that may be the
[20:17] volume of manure dropped by one chicken
[20:19] times the 10 15 cubic feet of manure
[20:23] perhaps that have already been dropped
[20:25] by the 10 chicken thing. Uh chicken
[20:28] manure is a smelly liquid blend of
[20:32] ammonia based urine and feces uh that
[20:36] kills the grass that it drops onto and
[20:38] it drops
[20:40] from a single combined vent in the
[20:42] chicken.
[20:45] um which because it's blended and
[20:49] ammonia based, it attracts flies galore
[20:52] and kills morass before it partially
[20:55] sinks into the ground. Uh which defeats
[20:58] composting actually and and blends with
[21:00] every breeze which is why many of the
[21:02] residents are down there is for the near
[21:04] constant breezes
[21:06] uh providing neighbors with a constant
[21:10] width of barnyard success. I think the
[21:14] congested area of MR12 throughout is
[21:17] made up of waterfront and water view
[21:18] homes on mostly quarter acre and smaller
[21:21] lots. This one's a large lot uh in
[21:24] comparison, but we need to be talking
[21:27] about the neighbors down there. And
[21:28] that's really why we're here. Uh and
[21:30] these properties are costing two to
[21:32] three times more than other properties
[21:33] south of 31 and paying two to three
[21:36] times more in taxes as well. People here
[21:38] buy from the waterfront, the breezes,
[21:40] the outdoor lifestyle. But this proposal
[21:43] is eventually, if not already,
[21:45] subjecting them to farm smells and flies
[21:47] galore. It's not a problem south of
[21:49] Route 31. But it is here and especially
[21:52] during the 80°ree and 90 degree weeks we
[21:55] all try to enjoy outdoors. And this MR12
[21:59] area, people are out even more. This
[22:01] proposal is a greater detriment to the
[22:03] MR12 neighborhood lifestyle and and it
[22:05] is a benefit to the applicant. Uh town
[22:08] code limits foul in MR12 to protect the
[22:11] lakefront taxpayers from smells of
[22:14] manure flies by the way and other
[22:18] nuisances that might be managed as if
[22:20] they were simply on a farm or a farm
[22:22] south of Route 31. The stinky
[22:24] combination of uh liquid ammonia based
[22:27] manure and near constant waterfront
[22:31] breezes depletes periodic composting. It
[22:33] cannot be undone by simply a partial
[22:36] weekly manure scraping because this
[22:38] stuff over the course of a week sinks
[22:40] down into the top two inches of the
[22:42] ground. Uh, and nobody's talking about
[22:44] taking that out. Um, or limiting to a
[22:47] hot barn. Imagine that. As the manure
[22:50] builds up, we are talking 15 to 20 cubic
[22:53] feet per year of this stuff. Chickens
[22:56] are prone. In conclusion, chickens are
[22:58] prone to farm nuisances, manure smells,
[23:00] flies galore, uh worms, parasites, lice,
[23:04] and salmonella spread by the flies, by
[23:06] the way, who travel a quarter mile fly
[23:09] biology for you across the neighborhood
[23:12] for picnic dining. Uh that's why our
[23:14] county board is going to be holding a
[23:16] public hearing and a vote in one day
[23:18] whether to have a moratorum on these
[23:20] types of applications. Uh, please don't
[23:22] approve this application just before a
[23:25] moratorum is considered by the town.
[23:27] Thank you.
[23:29] >> What was his name and where he lived?
[23:33] >> What's that?
[23:36] >> Oh, that's because he said it the first
[23:37] time. You want to give your name?
[23:39] >> Sure. Artio
[23:45] » doesn't have to be.
[23:47] >> So,
[23:49] does have any other questions?
[23:59] » [clears throat]
[24:02] » six
[24:05] push
[24:12] special.
[24:14] >> Yeah, you can get up to six special.
[24:18] How many without a special?
[24:22] >> Well, there's a there's a little
[24:25] chart we have in our code
[24:28] [laughter]
[24:29] right there. It's 105-209
[24:33] density for um density for fowl.
[24:38] So under 10,000 square feet up three
[24:43] between 10 and 20,000 square ft up to
[24:45] six
[24:47] and then goes up and up from there.
[24:57] [clears throat]
[25:04] How close are you to the lake?
[25:07] >> Uh just on Lake and then it's the lake
[25:12] right across the street. Across the
[25:14] street
[25:17] there's the street that goes the front
[25:19] of their house. Then there's a grass
[25:20] area where people
[25:24] then the lake is on the other side of
[25:25] that
[25:26] >> and the parcel circle land is only
[25:38] [clears throat]
[25:47] » you know you get rain water whatever
[25:49] Here's a street. There's a street goes
[25:51] down
[25:52] here.
[25:57] Thinking how much
[26:00] chicken put out and
[26:03] how much filtered down into the soil.
[26:08] >> Is there anything we can do about the um
[26:11] Canadian geese?
[26:13] We have Canadian geese that poop all
[26:15] over the properties and our yard too. I
[26:18] mean, that's just that's a thing that's
[26:20] I don't know. It's just kind of that's happening. But I know we can't do
[26:26] anything about that. We have to survive
[26:28] with them.
[26:28] >> They really work.
[26:30] >> Yeah. Um and but about the chicken
[26:33] tractor, it's actually much more
[26:34] sanitary than just having them all in
[26:36] one place because it does move around.
[26:38] He's he moves it. He cleans it up and
[26:40] moves it around. So, and he's really
[26:43] good at cleaning out the poop and
[26:44] everything, too. So, yeah. All
[26:52] right.
[26:57] Second. All in [laughter] favor?
[27:01] >> Thank you.
[27:09] » Well, we're past 7:00, so we'll start
[27:11] our meeting for March, our planning
[27:13] board meeting.
[27:17] were passed around. Did anybody see any
[27:19] questions?
[27:22] Can I have a motion to pass?
[27:27] Second favor
[27:32] are passed.
[27:36] Right.
[27:39] So, let's come on up and we'll discuss
[27:42] your You want to stand at the podium
[27:45] here?
[27:48] » [clears throat]
[27:53] » So
[27:56] that's that's been an ongoing issue for
[27:59] three years now. The tent I'm not
[28:00] talking the house. I'm talking the
[28:02] backyard and the tent.
[28:05] That's that's what the special use for
[28:06] that. He would like this as the tents
[28:09] for storage, right? Well, until like the
[28:13] garage [snorts]
[28:17] the garage starts, the tank's got to
[28:18] come down,
[28:21] » right? So, I mean,
[28:26] well, it's up to I mean a special use
[28:29] permit
[28:31] once you issue a special use permit that
[28:35] goes on that property forever.
[28:38] Is that correct, John? Special use
[28:40] permit runs with the land. Yes.
[28:42] >> Yes.
[28:43] >> So,
[28:44] >> well, it's going to be special use for
[28:45] the garage, too. You still got to have
[28:47] whatever you do with special use.
[28:48] >> Well, the garage would be a whole
[28:50] different subject with the tenants. Um,
[28:52] obviously the tents do not go with the
[28:55] area. Doesn't go with the culture. And
[29:02] if
[29:04] the board's ready to vote, we'll vote on
[29:07] it.
[29:08] >> One way. One way to approach this, it's
[29:10] up to you, could be you could ask
[29:11] yourself whether this applicant has
[29:13] carried the burden of proving uh that
[29:17] they're entitled to a special use
[29:18] permit, reminding you of those criteria
[29:21] that I had read to you earlier, which
[29:23] included whether this request and you
[29:26] seen what it is. He's asking, can I keep
[29:28] this here? Do you think that that that
[29:31] [laughter]
[29:32] existing use or continue continuation of
[29:35] it would be in harmony with the orderly
[29:37] development of that property and beyond
[29:40] that uh allowing to stay there? Will it u discourage the appropriate
[29:46] development of that land or adjacent
[29:47] lands? It might be easier to look at it
[29:49] as to whether the applicant has proven
[29:51] their case. Every applicant [laughter]
[29:52] has to prove their case. So that might
[29:54] be a way and your comments you know that
[29:56] you have about it all dove tail into
[29:58] that that's the way you approach it
[30:02] >> right it's kind of leads into the
[30:05] question
[30:12] right
[30:13] are you know my voice doesn't project
[30:16] very well
[30:18] um
[30:22] » okay what you're trying to do Are you
[30:24] bringing in a tent in there?
[30:26] >> Have you seen the pictures of this?
[30:28] >> Tents are already there.
[30:29] >> It's right there. It's It's that green
[30:31] canvasy
[30:35] » structure.
[30:36] >> What are they made of?
[30:38] >> Tents. What are they made of?
[30:41] >> This is Army Heavywe.
[30:44] >> Yeah. Your attorney. Last time I was in
[30:46] here, he thought, "Oh, the tent's going
[30:47] to go up there. The wind's going to blow
[30:48] apart. It's all look like crap in no
[30:50] time." Been up for two years. Not
[30:52] nothing wrong.
[31:00] [snorts]
[31:02] That's
[31:06] another picture.
[31:20] Is this visible?
[31:22] Uh
[31:26] the is the tent going to be taller than
[31:29] the fence?
[31:35] » It's taller. Should be safe from
[31:37] >> Okay. So, what about the tent or the uh
[31:42] [snorts] occupants of other houses down
[31:44] that road?
[31:46] >> There's no problem with anybody. Not
[31:48] one.
[31:51] You know, you showing me these pictures.
[31:52] Don't they had to be here in person?
[31:53] They want to complain about this.
[31:55] >> They do not.
[31:56] >> No, they can send us correspondence.
[31:59] >> Seems to me maybe Larry took those for
[32:01] you supposed to be there.
[32:03] >> It's irrelevant who took the picture.
[32:06] >> The photographs depict the property as
[32:08] it exists.
[32:10] >> The thing is you're arguing over a tent
[32:11] that I want to come down myself. The
[32:14] application is in again for the garage a
[32:17] month and whatever. I came in a week
[32:19] before I don't know where the meeting.
[32:22] >> So you are you going to be using this or
[32:25] are you going to be taking this
[32:27] >> down
[32:32] is up as and if you look at the pictures
[32:34] you can see what the property is all
[32:36] about.
[32:36] >> So from the photographs
[32:38] >> when when's your when's your plans for
[32:41] doing the garage? This spring.
[32:42] >> Maybe this spring.
[32:44] >> Yeah. So this is just temporary. Yes,
[32:48] that's what I'm doing.
[32:51] temporary. There's things inside that
[32:52] can't get wet. John,
[32:54] >> you're on the contractor. That's what I
[32:55] >> Well, he's in court right now and and
[32:57] our office was asked to prosecute him.
[32:59] Not just on the tents, but all of that
[33:01] stuff that's lying outside. So, if the
[33:03] tent comes down, you got you don't
[33:05] approve the tent. We'll continue with
[33:07] our prosecution. We'll get an order to
[33:08] clean all of that stuff off of the
[33:10] property. It'll be taken somewhere else.
[33:12] >> It's all coming up anyway. That's not
[33:14] >> That'll work out well then. It's all
[33:15] coming up anyway.
[33:17] But I think the delay it's been delayed
[33:18] for Larry. How long has this been
[33:20] delayed for?
[33:22] >> How long has this been going on, Larry?
[33:23] >> More than two years, I think.
[33:24] >> More than two years.
[33:26] >> So, probably enough time to submit an
[33:28] application for a true garage.
[33:31] >> It's redone.
[33:34] >> But he can and he's allowed to pursue a
[33:36] storage building.
[33:37] >> Yes.
[33:37] >> And he can and he can move stuff into it
[33:39] once it's built. But I think the issue
[33:41] has been it's been this for some time.
[33:45] So, but again, it's it's a special use
[33:47] permit. He has to prove he's entitled to
[33:49] the special use permit as the code is
[33:51] written. So, you would have to make
[33:52] findings saying yes, what I what we see
[33:55] here is in harmony with that
[33:56] neighborhood. Is that what that
[33:57] neighborhood looks like? Generally
[33:59] speaking,
[34:01] >> that's one way to look at it.
[34:04] >> I don't.
[34:05] >> It's up to you. You guys can vote for it
[34:06] or you don't have to. No. Right. Right.
[34:09] So,
[34:13] you ready to vote? We'll
[34:15] do a roll vote. I'll start first. I say,
[34:19] Mr. Action, I vote no for permit for
[34:22] special use. If you're taking the tents
[34:26] down, you're cleaning it out and you're
[34:28] going to build a garage.
[34:31] I don't see why you need a special use
[34:34] permit for that.
[34:36] So, Tory, I'm opposed. Also, I don't
[34:40] know how long it's going to take to
[34:41] actually get the permanent garage built
[34:44] if it goes through. And I mean, this
[34:47] time can be here for multiple years
[34:49] again.
[34:51] >> The tenant has to come down immediately
[34:54] service.
[34:55] >> Correct. But we don't know when you're
[34:58] going to build that garage. When
[35:00] >> Well, you ask yourself because the
[35:01] permit or the application is in for the
[35:04] garage. It's right there. You say yes,
[35:07] it'll start tomorrow. But you've been
[35:08] saying no for two years
[35:11] >> and I gave you everything you wanted for
[35:13] that garage. You got the variance from
[35:16] the dot or whoever the hell it was and
[35:18] everything else. So what's that?
[35:21] Because every time I come in here, Larry
[35:23] says, "Oh, you got to know when the
[35:25] birds fly over, what color of the grass
[35:27] is going to be garbage."
[35:29] >> I remember these violations that I had
[35:32] on my house. You know, you want a
[35:34] lawsuit here because this is where it's
[35:35] legal. Okay. There's no proof. Anything
[35:39] done at my property by me.
[35:44] There's something here that just doesn't
[35:47] >> probably be driven over to look the
[35:48] property person.
[35:50] >> No, I will tomorrow.
[35:52] >> Unfortunately, he's already lost because
[35:54] two people have voted no. So, his
[35:56] application
[35:58] >> your application is tonight.
[35:59] >> But Paul, I do think you should take a
[36:00] look at it
[36:01] >> for a special use permit. Yeah,
[36:04] >> but Paul, you should you should go one
[36:05] way or the other if you want.
[36:07] >> You want I'll meet you there. I'll give
[36:08] you a tour.
[36:10] >> Okay. Where your address?
[36:12] >> 8964 Green Road. Right next to where the
[36:15] Bible return
[36:20] right by the when you cross before you
[36:22] cross the creek going into Bridgeport.
[36:23] >> Okay.
[36:31] So there's a call. There's a vote
[36:33] called. So either you have to vote yes
[36:35] to approve it, no to say like the other
[36:38] two gentlemen did, or you can abstain,
[36:41] which isn't going to matter because it's
[36:42] not the approval is not going to.
[36:45] >> Now that I know exactly it is kind of to
[36:49] me, it looks like it's not going to
[36:51] impact
[36:53] much. There's already a store there. If
[36:57] anything, my property has improved the
[36:59] neighborhood. So, even with all the junk
[37:01] you have in the pictures, it isn't mine.
[37:05] >> Which way are you going? Yes or no?
[37:10] » So, it's two against, one in favor. It
[37:13] fails because it needs three to be
[37:15] approved.
[37:17] So now there's a pending court case that
[37:20] will be pursued to uh obtain
[37:23] [clears throat] an order to have
[37:24] everything removed from the property
[37:27] that's not properly, you know, inside of
[37:29] a building. Not not he can keep it all.
[37:32] He's got to move it off off of the yard
[37:34] and the tent
[37:36] and he can pursue his garage and do
[37:39] work. So that's clearly fine. And then
[37:42] if he's got it stored somewhere else, he
[37:44] can move it all back into his garage.
[37:45] Yeah, absolutely. You can pursue your
[37:47] garage. Yeah, it's not a problem.
[37:49] >> The application is in right now. Same
[37:52] time as they have it on the agenda for
[37:54] next month then be ready to go. Yeah,
[37:56] but but he's gonna Meanwhile, our office
[37:58] is going to prosecute the violations.
[38:01] >> Yeah. You want me to put you want to get
[38:03] on the agenda for your garage next
[38:05] month?
[38:07] >> No, you're not following what I'm
[38:09] saying.
[38:09] >> I I [laughter] follow exactly what
[38:11] you're saying. Why aren't we?
[38:12] >> But but the thing of it is is what the
[38:14] business was tonight is your special use
[38:16] for for your tent. That was the business
[38:18] tonight.
[38:20] >> No, both things were on that
[38:22] application.
[38:25] >> Well, even even if anything [laughter]
[38:26] had been approved, it doesn't mean you
[38:28] get to keep it in violation. That the
[38:31] amount of fines that are building up on
[38:32] this property are potentially staggering
[38:35] when you look at every day as a
[38:37] violation. So, I think it's good to sort
[38:38] of cut it off now.
[38:40] >> Yeah. But he can Yes, he can pursue it.
[38:42] Yeah.
[38:44] >> So, Mr. Would you like to be on the
[38:46] agenda for next month?
[38:47] >> Yes.
[38:48] >> Okay. So, we're going to put you on the
[38:50] agenda for next month and we're going to
[38:51] discuss your garage. Okay.
[38:55] >> Larry, Larry, what does he need? Larry,
[38:57] what does he need for that garage? They
[38:59] have to be
[39:01] >> everything you needed. Uh, all of a
[39:03] sudden, Larry brought in wanted to
[39:05] change my house for three family and I
[39:08] we're talking about the garage. I know.
[39:09] >> What does he have to have for plans and
[39:11] drawings for this board?
[39:13] >> Drawing.
[39:13] >> Okay.
[39:14] >> Prepared by hope
[39:16] >> slab or
[39:17] >> it can be done a bigger garage.
[39:20] >> It's the same 24 by 46.
[39:22] >> Okay. Do [clears throat] we have all
[39:23] that now for next month's meeting? You
[39:25] know,
[39:26] >> I would have to have foundation plan
[39:30] building application filled out or
[39:32] anything.
[39:32] >> Okay. Then I don't know
[39:34] >> that I think he's referring to we filled
[39:36] out was for this special use permit
[39:38] >> for the for the temporary correct
[39:40] whatever the temporary [laughter]
[39:42] >> am I going to take it out both were on
[39:44] that you and both were there you both
[39:46] said put it into the meeting
[39:49] second
[39:52] [laughter]
[39:52] >> this was happened from day one nowhere
[39:55] >> you guys have other
[39:56] >> Yep. So,
[39:59] we'll be you'll be here next month and
[40:01] we'll talk about about your
[40:04] um your garage.
[40:07] >> All right. What about the back stairs? I
[40:09] gave you the drawing for that.
[40:13] » Your stairs.
[40:14] >> Yeah, that's one of the violations.
[40:17] >> Yeah, that's that's not us. That's going
[40:20] to court.
[40:20] >> That's going That's not us, sir. Hey, as
[40:23] you said, I had to come to you for
[40:24] special use permit. So, she knew my
[40:26] service.
[40:28] >> I got your permit right in front of me
[40:29] right here. And here it states you're
[40:32] looking for a permit for a 24x 46
[40:36] temporary tent.
[40:39] >> Thank you.
[40:44] » Tell me one thing.
[40:48] » Well, tell them it is. Did we talk about
[40:50] this? Why am I here if you're just going
[40:52] to ignore it and let it go?
[40:55] >> Everything that was on the property had
[40:58] >> Okay, there they are. You hear that?
[41:01] >> I brought you the drawings specifically
[41:03] with a picture and you ignore it.
[41:06] >> The your application is for your tent,
[41:09] sir. That's it.
[41:10] >> No, it's not.
[41:11] >> It's done.
[41:12] >> It's over.
[41:19] the applicant pursuant.
[41:21] See, it's a permit for 24x 46 temporary
[41:25] tent.
[41:29] Add new 36 in entrance door to the front
[41:32] left of the home.
[41:35] That's what your application is for.
[41:39] That's it. That's what your application
[41:40] is for.
[41:43] Um
[41:46] there is no date
[41:48] >> there. There should be a date on
[41:49] application. They don't have
[41:51] >> I could tell you that there's a date
[41:52] where it says date application completed
[41:55] but there's no date filled out blank.
[42:00] Let me
[42:09] [clears throat]
[42:31] » [snorts]
[42:34] » Okay. [laughter] Yeah. Want to come on
[42:36] up?
[42:48] » Okay. So,
[42:53] we have
[42:55] chickens.
[43:10] We're in the what?
[43:11] >> Neighborhood.
[43:13] I mean,
[43:18] does anybody have any questions here?
[43:20] >> You're in a MR12.
[43:22] So, can I ask? So, before you decided to
[43:28] purchase these tickets and bring them to
[43:31] your home. Did you think there was any
[43:33] kind of regulations on that with the
[43:35] town?
[43:36] >> So, um, in couple of streets throughout
[43:40] our time living in Lake before where we
[43:42] live, there have been people with
[43:43] chickens. So, we didn't realize that.
[43:46] >> Well, there was a woman up on Lafayette
[43:49] and they had chickens. Her chickens are
[43:51] all gone.
[43:53] They were taken off the property.
[43:56] because you're in an MR12,
[43:59] you know, it's not there's a lot all
[44:02] that green right behind you on that map,
[44:05] that's all agricultural land.
[44:08] About that map, it's [clears throat]
[44:09] interesting. Um, our neighbors uh ways
[44:12] down, they have 13 acres. They're also
[44:15] in MR12 because they live like on the
[44:18] wrong side of 31, I guess you could say.
[44:20] And I don't understand why they couldn't
[44:22] have chickens either. It's just the way
[44:24] it's zoned.
[44:27] Yeah.
[44:27] >> Yeah. I I don't know.
[44:29] >> 12 high density neighborhood.
[44:32] >> They have 13 acres. I [laughter] know we
[44:34] don't have 13. I know we have almost a
[44:36] half acre of land.
[44:41] » We have neighbors on three sides instead
[44:44] of four.
[44:46] >> If somebody came in here with an MR2,
[44:48] they had 13 gres
[44:51] and they had six or 10 chickens. They
[44:54] got a lot more spots to put those sh
[44:59] >> Yeah, we have a a pen that's 13 feet by
[45:02] four feet,
[45:03] >> right? But they don't have a neighbor.
[45:07] >> Well, about the neighbors, we have
[45:08] actually met more neighbors than we ever
[45:11] had except they come and visit us and
[45:12] say hi. Just because we have chickens,
[45:14] we've met the most neighbors ever this
[45:16] past summer.
[45:18] >> I know it's sad, but it's
[45:22] regulations.
[45:23] that we can ask for.
[45:33] » Just do you have any other
[45:37] questions for him? Anything you'd like
[45:38] to talk about?
[45:42] Just feeling
[45:47] I don't know what it is.
[45:50] I understand why
[46:01] >> Almost a half acre.
[46:06] But you look at that
[46:08] half acre. You got a very nice house
[46:11] sitting on that acre. Half acre. You got
[46:14] it. It's got a attached garage. Then you
[46:16] have a second garage. It's a good size
[46:19] garage. And then you have a swimming
[46:21] pool.
[46:22] Then you have a deck and it takes all
[46:25] that away.
[46:26] >> And we have a large side yard or
[46:28] whatever you call it.
[46:29] >> Front yard.
[46:30] >> Whatever you want to call it.
[46:33] >> When you live down by the lake, anything
[46:35] the lake is your front yard,
[46:37] right?
[46:38] >> Yeah. It doesn't really matter what you
[46:39] call it. It's just it's a nice part of
[46:42] land we have there.
[46:46] Um,
[46:49] are you are you ready? Do you want to
[46:51] vote on it or do anybody have any more
[46:53] questions or anything more clear up?
[47:00] » Remember,
[47:02] >> all three of you have to vote in favor
[47:04] of it to for it to get approved because
[47:07] of the way the rules work in your state.
[47:09] Your five person board takes three to
[47:11] approve it.
[47:15] Okay.
[47:16] >> So, does that mean we can come back and
[47:18] verify?
[47:19] >> You can, but
[47:22] hearing this more often.
[47:27] [laughter]
[47:31] So, I just want to make sure.
[47:33] >> Yeah.
[47:35] I I I'm so confused because like
[47:39] chickens are really beneficial with
[47:42] their eggs and with what they do like
[47:44] the eating like bugs and things that
[47:46] aren't helpful. I don't I understand
[47:48] like I mean places usually allow
[47:50] chickens. I don't really understand
[47:52] what's so harmful to them.
[47:54] >> Free rolling chicken. No,
[47:56] >> they have a cage and it's a a tractor so
[47:59] we can move it around the yard so that
[48:01] it can a it's sanitary for the chickens
[48:03] and it also is he cleans it up every
[48:06] day. So that
[48:10] » you can you can only approve up to six.
[48:13] You're not allowed to approve more than
[48:15] six
[48:15] >> six. [clears throat]
[48:16] >> I know they like to have 10, but it's
[48:18] you don't have that power.
[48:21] >> So I will ask this question. Do you want
[48:22] to wait till the next month until
[48:24] there's five or do you want us to vote
[48:26] on it tonight?
[48:28] >> That's your choice.
[48:30] >> But if the moratorium's in place, you
[48:32] can't you can't vote on it, but that the
[48:34] application's frozen by our moratorum.
[48:37] So,
[48:38] >> Tom, we're voting on that moratorium
[48:40] tomorrow, right?
[48:41] >> That's what I thought.
[48:42] >> Yeah. I don't I didn't I didn't I don't
[48:44] know what the board's going to do. I'm
[48:45] not sure if they're gonna vote in favor
[48:47] of the moratorium or not.
[48:49] little bit of
[48:50] >> Can you explain? I don't really
[48:52] understand the moratorum.
[48:53] >> No, you're right. I'm sorry. So, so in
[48:56] land use, sometimes in land use, a tool
[49:00] that a town has is to recognize that if
[49:04] we want to pass a law and there's some
[49:05] pending applications and things, we can
[49:08] call a timeout. Town call timeout
[49:10] through a moratorum. The law moratorium
[49:12] means to stop. We're not going to
[49:14] consider any more. might be a wind farm,
[49:16] might be garages or whatever. Could be
[49:19] anything. In your case, if that the
[49:22] proposed law, the mortorium has to do
[49:25] with foul exactly what you want to do
[49:27] and gets approved tomorrow night. It
[49:29] [clears throat] freezes every
[49:30] application in place until the town
[49:34] board decides what they want to do with
[49:36] those regulations. So then they if they
[49:39] do it then they have I think we did it
[49:40] for six months or a year, I forget. Then
[49:42] they have to [clears throat] sit down
[49:43] and work out are we going to change the
[49:44] regulations? How would we like them to
[49:46] read? And it happens quite more than you
[49:48] think, but most recent ones we've been
[49:50] doing have been wind laws and solar
[49:53] projects and things like that. So that
[49:56] just gives you an idea. But in this
[49:57] case, this one deals with chicken.
[50:00] >> So does that mean that a lot of our
[50:02] community members in Sullivan County
[50:04] want for Sullivan want to have chickens?
[50:07] Is that
[50:07] >> No, it doesn't mean any one way or the
[50:09] other. just just means that the board
[50:11] was was asked to consider a moratorum
[50:13] because the town had been getting a
[50:15] whole bunch of chicken applications
[50:16] recently.
[50:17] >> So, it sounds like they do.
[50:18] >> You are you are like the last latest
[50:20] [clears throat] in a in a
[50:21] >> a lot of chickens.
[50:22] >> I'll say this, your application is by
[50:24] far the best. You guys are the
[50:26] [clears throat] most wellprepared.
[50:27] Explain yourselves really well. But the
[50:29] underlining issue is can does a town
[50:32] want to consider allowing chickens in
[50:35] certain areas? And that's that's where
[50:37] you got caught up in a moratorum for
[50:39] now.
[50:40] >> But if the board comes back, oh, we're
[50:42] just going to keep allowing it, then you
[50:43] can you can still be considered for or
[50:45] if they go, "No, we're not doing this."
[50:46] Then you're going to be out of luck. But
[50:48] [laughter]
[50:49] the other problem you have, there's only
[50:50] three board members here tonight. One of
[50:52] them says, "I I'm not comfortable that
[50:55] you really aren't going to get those
[50:56] chickens,
[50:57] >> right?"
[50:58] >> So then if we went with a moratorum,
[51:00] would we be able to keep the chickens
[51:02] during that time? Technically, well,
[51:05] you'd be in violation.
[51:07] >> Technically, you'd be in violation. It's
[51:08] not a
[51:10] >> even though it's not decided yet.
[51:12] >> Yeah. Because you're not approved to
[51:13] have the chickens right now. It's such a
[51:15] catch 22 different sides. It's a little
[51:19] weird. It's a very strange situation.
[51:20] Yeah. If you have the chickens, you're
[51:22] probably supposed to have gotten that
[51:23] special use permit before. You could
[51:25] have. I don't know if you would have.
[51:26] >> And meanwhile, you know, [clears throat]
[51:29] are you prosecuting this or is uh Kim. So we have a animal control officer
[51:36] and that that falls under her
[51:38] jurisdiction.
[51:40] >> It does sound like the people wanting
[51:41] chickens. [laughter]
[51:45] Um,
[51:49] » I guess we're at your mercy.
[52:00] » Regardless, we can only approve up to
[52:02] six.
[52:04] >> We do have friends who really would like
[52:06] our chickens, the four chickens, because
[52:07] they lay eggs really well.
[52:10] [clears throat]
[52:18] Correct.
[52:22] [clears throat]
[52:29] » They're just talking
[52:31] deliberations. You should give them a
[52:33] few minutes.
[52:34] >> Yes.
[52:39] » [cough]
[52:48] » So whatever we do tonight,
[52:54] if you voted for it, if you voted
[52:56] against it, it ends up
[53:01] taking in
[53:05] um what they either
[53:10] notori
[53:13] that's that's the moratorum is going to
[53:15] be nine months
[53:16] >> nine months right
[53:18] >> I can't I can't remember was it a year
[53:21] or six or nine I can't remember
[53:23] >> I do so many I can't remember
[53:25] >> it was a nine okay
[53:27] >> the middle
[53:29] >> so mortorium will be put in for nine
[53:31] months and they'll do a study for it and
[53:34] then after the nine months they'll
[53:36] decide if they want keep it or adjust
[53:38] it, tweak it.
[53:43] But everything will be frost angles.
[53:57] [snorts]
[54:03] Well, they can still come back.
[54:10] I think I think the issue is this. I'll
[54:12] cut right to it. If you don't vote and
[54:15] all three of you vote in favor for them
[54:16] to keep up to six chickens, they'll have
[54:19] to remove them because Kim's going to
[54:21] take them. So,
[54:22] >> yeah.
[54:23] >> If the moratorum, which does the
[54:25] moratorum passes or doesn't pass,
[54:27] [clears throat]
[54:28] >> it doesn't matter because if you if you
[54:30] didn't vote to allow them to keep the
[54:31] six chickens, they're still they're
[54:32] still going to get tickets for them. If
[54:34] the moratorum comes into place and they
[54:37] and the town board decides, yes, this is
[54:39] a great place for chickens, they can
[54:40] come back and apply for it again. They
[54:42] want to, but in the meantime, their
[54:44] chickens will have to
[54:46] go home to roost somewhere else.
[54:48] >> Yes.
[54:56] » We'll do a low vote.
[54:59] I'll vote first. If anybody has
[55:00] any comments on why they vote the way
[55:03] they are, they'd like to explain it to
[55:04] the people.
[55:06] But I'm going to vote nay. No. Yeah. I
[55:11] don't believe chickens are belong down
[55:13] by the lake. I don't believe in an MR12.
[55:16] I mean, do you two people look like
[55:18] great? I'm sure you take very good care
[55:20] of your chickens
[55:23] in the summertime. That's a recreational
[55:25] area and
[55:28] people walk up and down roads and they
[55:30] enjoy that area. It's highly dense.
[55:33] That's the reason why I vote.
[55:41] Unfortunately, I'm going to be voting no
[55:43] as well.
[55:44] I have nothing against freerange
[55:47] chickens or chickens in the tractor.
[55:49] I've seen it successfully done. Um, my
[55:53] concern literally is just with the size
[55:56] of the property and approximately where
[55:59] the location of those chickens would be.
[56:01] If it was not on the main intersection,
[56:06] I think it would be different if it was
[56:08] in the back side of the property.
[56:14] Okay. [laughter]
[56:17] Um the fact that the town
[56:21] board
[56:24] working on this too
[56:28] pass
[56:32] they go with it you
[56:39] know
[56:42] the chicken
[56:43] >> I'm sorry [laughter] I wish you would
[56:45] have done your homework.
[56:48] Thank you.
[56:54] [laughter]
[57:06] [snorts]
[57:06] >> You said you couldn't find the date.
[57:08] >> No, I don't think Jeff Taylor is here
[57:10] anyhow.
[57:12] >> [laughter]
[57:14] » What was that, sir?
[57:22] » You're on You're on the agenda. Come
[57:24] back next month.
[57:24] >> Yes, I said.
[57:26] >> Okay, we'll see you next month on your
[57:28] garage. [snorts]
[57:30] >> What day is that?
[57:31] >> Um I believe that's six
[57:34] >> first Tuesday.
[57:35] Let me check. It's the
[57:37] first Tuesday of April
[57:39] >> at 6:45.
[57:40] >> 6:45.
[57:42] >> No, no, no public hearing.
[57:43] >> No public hearing.
[57:44] >> Sorry.
[57:46] >> I'll be here.
[57:48] >> 7. Yeah.
[57:50] >> 7:00.
[57:52] >> Thank you.
[58:03] » Yeah. Gota have real
[58:10] » should be in two weeks before the actual
[58:13] [laughter]
[58:14] >> understood. Okay. Uh the old business is
[58:17] Jeff Taylor, but I don't believe he's
[58:19] here.
[58:19] >> I don't think he's here. Rick Myers, he
[58:22] didn't show up.
[58:23] >> He called.
[58:25] >> Yeah. And as to be
[58:26] >> the gentleman in the back with a hat on.
[58:28] >> Sorry.
[58:30] >> Rick will be here next month. He didn't
[58:31] >> I was here for that tonight.
[58:33] I was here for the tickets. [laughter]
[58:37] >> Go make an offer.
[58:39] >> They're for sale.
[58:42] >> Rick's gonna be here next month. Talk.
[58:44] Give us what information about
[58:46] population density creating it.
[58:49] >> Where are we going?
[58:51] [laughter]
[58:52] >> I should have never said anything about
[58:53] your hair.
[58:53] >> Yeah.
[58:57] » All right. Can I have a motion close to
[58:59] >> here?
[59:02] All in favor?
[59:03] >> Yeah.
[59:22] » The three meetings.
[59:29] So there's there's your
