[2:08]
Good afternoon everyone. Welcome to the
[2:10]
Township of Mapleton Committee of
[2:12]
Adjustments.
[2:14]
I'm the secretary treasurer. My name is
[2:15]
Larry Wheeler and we'll start the agenda
[2:19]
with regrets and we have uh regrets from
[2:22]
our member Jeff Dumering.
[2:25]
Next item business is 1.2 two
[2:28]
appointment of a chairperson. Do we have
[2:31]
a recommendation?
[2:36]
» The seconder.
[2:39]
[laughter]
[2:41]
>> Thank you.
[2:47]
» Okay. So, um next item then becomes uh
[2:51]
call for uh deferral or withdrawal of
[2:53]
any matter before the committee. Do we
[2:55]
have any?
[2:56]
>> We do. Okay.
[2:59]
Do we have any declarations of pecunary
[3:03]
interest?
[3:05]
None.
[3:07]
All right.
[3:09]
On to the minutes of the last meeting
[3:11]
that we had. So, we had a committee of
[3:14]
adjustment meeting dated July 15, 2026.
[3:18]
And we have draft minutes.
[3:21]
Um, there is a recommendation here that
[3:23]
the minutes of the Township of Mapleton
[3:25]
Committee of Adjustment meeting held on
[3:27]
July 15, 2026 be confirmed as circulated
[3:31]
in the agenda. Do we have a mover and a
[3:36]
second for that?
[3:37]
>> I'll move.
[3:39]
>> Okay,
[3:40]
>> I'll second.
[3:41]
>> Benjamin's and Stanners.
[3:47]
» All right. Now do we have any matters
[3:49]
arising from the minutes anyone wishes
[3:52]
to raise? None.
[3:56]
Okay. So that moves us to our uh first hearing which is A20614.
[4:08]
The location of this subject property is
[4:10]
legally described as part of lot 17
[4:13]
concession 8P and is municipally known
[4:16]
as 73448
[4:18]
line. Subject property is 40 hectares in
[4:22]
size and is occupied by a residence and
[4:26]
a dairy farm operation.
[4:32]
The purpose and effect of this variance
[4:34]
application is to provide relief from
[4:36]
the required minimum distance separation
[4:39]
to MDS2 from a type A use. The
[4:43]
applicants are proposing to construct a
[4:45]
dairy barn and manure tank and are
[4:48]
seeking an MDS2 setback of 171 m whereas
[4:53]
220 m is required for the barn and 162 m
[5:00]
whereas 298 m is required for the manure
[5:03]
tank from the closest type A use. The
[5:07]
other variances other variances may be
[5:09]
considered where deemed appropriate.
[5:13]
Do we have uh any um notifications or
[5:17]
comments that have been received to date
[5:19]
by the secretary treasurer?
[5:22]
>> Thank you, sir. Staff can confirm that
[5:25]
property owners, Mapleton staff and
[5:28]
agencies were provided with the required
[5:30]
notice on or before July 22nd.
[5:34]
There is a comment summary included in
[5:36]
the planners report. Proper on-site
[5:39]
postings were completed July 23rd.
[5:42]
Source water comments from our risk
[5:44]
management inspector were received and
[5:47]
there was no concerns expressed.
[5:49]
County of Wellington comments from their
[5:51]
planner Jamie Barnes were received and
[5:53]
they're attached. And the GRCCA comments
[5:57]
from their resource planning technician
[5:59]
were received and they are attached.
[6:01]
Thank you.
[6:06]
Okay. Do we have any further comments
[6:08]
from on behalf of the township planner
[6:11]
for the on this application?
[6:15]
» Thank you through your chair. No, we
[6:17]
don't. We are we don't see any issues
[6:19]
and we are in full support.
[6:25]
So this is an opportunity for the owner
[6:27]
Gary and Marilyn applic uh Martin and
[6:30]
the applicant Cleon Martin to introduce
[6:32]
themselves and speak to the application
[6:34]
if there's any further clarification
[6:36]
they wish to give.
[6:50]
» Good afternoon. I'm Cleon Martin acting
[6:53]
as the agent on behalf of Gary and
[6:55]
Carolyn Martin on this uh file. Um I
[6:59]
have no other comments. The u appreciate
[7:02]
the planning staff support. I have no
[7:04]
further comments.
[7:07]
Thank you.
[7:09]
Now I don't know that I see anybody but
[7:11]
uh is there anybody here that wishes to
[7:14]
speak to the proposal? Um, and if you do so, then you can give your name and
[7:20]
address to planning staff. Anyone? None.
[7:26]
I don't know that we have any questions
[7:29]
then from any interested persons. So,
[7:31]
I'll move to committee member questions
[7:35]
uh of the owner applicant.
[7:38]
And do we have anyone that has any
[7:40]
questions on this particular
[7:43]
application? Member Stanners.
[7:45]
>> Thank you, Chair. No, I have no com no
[7:48]
uh questions. I'm I was glad to see this
[7:51]
neighbor's letter that uh there's
[7:53]
somebody else in the township that's
[7:55]
concerned about it and and they they're
[7:58]
quite happy to see this. Go ahead. Quite
[8:00]
often we never see any comments from
[8:03]
anybody other than the applicant. So, I
[8:05]
was really glad to see that there is a
[8:07]
concerned citizen that and their comment
[8:08]
was positive to it. Thank you.
[8:13]
Okay, thanks. Anyone else with anything
[8:16]
else to offer?
[8:18]
>> Thank you, chair. I don't have any
[8:19]
questions. I did do a site visit this
[8:22]
morning and I think it makes good sense.
[8:24]
It's taking the the um the barn and the
[8:27]
manure storage away from the water
[8:29]
course kind of midway back on the farm.
[8:32]
So, um I think it's uh I'm have no
[8:35]
further questions or comments.
[8:38]
>> Thank you.
[8:40]
So at this point it's uh up to the to
[8:44]
the committee to uh either grant,
[8:48]
refuse, defer or reserve uh a decision
[8:51]
on this application and the four tests
[8:54]
that are required for us to consider are
[8:57]
is the variance minor in nature. Is the
[9:00]
variance requested desirable for the
[9:02]
appropriate development or use of the
[9:04]
lands, building or structure?
[9:06]
Does the variance maintain the general
[9:08]
intent and purpose of the official plan?
[9:11]
Does the variance maintain the general
[9:13]
purpose and intent of the zoning bylaw?
[9:18]
So based on on those those questions and
[9:21]
the the um analysis by staff, there is a
[9:25]
recommendation here that the minor
[9:27]
variance applied for in application A
[9:29]
202614
[9:31]
located at part of 7 part of lot 17
[9:34]
concession 8 municipally known as 73448
[9:40]
line to provide the following relief as
[9:42]
proposed.
[9:44]
a new livestock facility and manure
[9:46]
storage.
[9:48]
Um MDS2 set back to a type A use for a
[9:53]
livestock facility. The required
[9:56]
distance is 220 m proposed distance 171
[10:00]
m difference of 49 m and MDS2 set back
[10:05]
to a type A use manure storage
[10:09]
requirement is 298 m. The proposal is
[10:13]
for 162 meters. There's a difference of
[10:16]
136 meters.
[10:19]
So at this point, I ask for a motion or
[10:23]
a mover of the recommendation if we have
[10:26]
one.
[10:26]
>> I'll move that, Dennis.
[10:27]
>> Okay. Member Sheik and a seconder.
[10:31]
>> Seconded.
[10:32]
>> Benjamin's. Okay. So, um, put that to a
[10:36]
vote then. All in favor?
[10:41]
All right.
[10:43]
So we have a granting of that variance.
[12:30]
Okay, we've had the circulation of the
[12:32]
decision sheet um for this uh particular
[12:37]
item. The hearing for minor variance A
[12:40]
202614 is now concluded.
[12:44]
Thank you.
[12:56]
So under general business, we have an
[12:58]
item for upcoming hearing dates. Guess
[13:01]
the question is for September 9th. Do we
[13:04]
have any items at this point?
[13:13]
» So we have nothing for September 9th,
[13:16]
but we do have September 9th, October
[13:18]
14th, and November 18th as the next
[13:20]
scheduled meetings of the committee.
