[7:05] a resident of the Imperial Woods neighborhood and I am here today, it

[7:09] looks like, but joined by a lot of my neighbors that ended up signing one of

[7:13] our petitions uh specifically opposing a gas station at 1016 Vestal Parkway East.

[7:18] Um the neighborhood and I submitted two notorized petitions to the town um

[7:23] regarding this. Both were received on August 5th and one was updated and

[7:27] received today showing unanimous opposition of all homeowners within

[7:31] residences zoned within 100 ft. Um, so I wanted to speak today about the gas

[7:38] station and how it's going to affect our neighborhood. From my research, I can't

[7:41] find a single other incident in the entire town of Vestal where a gas

[7:45] station is within 50 ft of residential homes, let alone 25 ft. And I'm saying

[7:51] 25 ft because I went out and measured and from Walter Road to my property at

[7:55] 10:05 Imperial Woods Drive, it's 21 feet. That's all. And we're talking

[8:00] about a potentially 24hour 7-day a week business here that's servicing thousands

[8:06] of customers, not hundreds, thousands, drawing them off of a very heavy

[8:11] interstate parkway system in addition to the university. And just speaking to

[8:15] this plan today that I'm seeing for the very first time, I noticed the

[8:18] drive-thru is specifically facing the residences on Walter Road, which I find

[8:22] to be very irresponsible. That canopy is going to have to be zoned at least 16 ft

[8:27] off the ground and 247 lighting. Those lights are going to come directly in my

[8:32] bedroom windows, my neighbors bedroom windows, illuminating our decks, our

[8:36] entire properties all night, 365 days a year, 7 days a week, 24 hours a day.

[8:43] Also, the drive-through traffic it looks like will be sweeping back there and

[8:46] looping out onto Walter Road, which is massively disturbing because Walter Road

[8:51] has no curbs, no drainage, and is 21 ft wide. There are not even sidewalks back

[8:56] there. It's a popular place for people to walk their strollers and their dogs.

[9:00] If we are now competing with gas station traffic, two cars coming at each other,

[9:05] opposing directions, no sidewalks, no curbs, and it's 21 feet wide, and we

[9:10] have a lady with a baby and a dog. I don't see how we're not going to have

[9:14] incidencies back there. Um, I also wanted to speak to the fact

[9:19] the Vestal Town Code 24-385, which governs vehicle service stations,

[9:24] specifically prohibits vehicle service stations from being within 100 ft of a

[9:29] resident's district unless twothirds of those uh homes approve it. I furnished

[9:35] the town unanimous opposition from all homes within that 100 ft. It is signed

[9:40] and notorized that it is completely opposed. Additionally, the town code

[9:44] says people within 500 feet can get a vote if he gets 50% I have more than 50%

[9:50] of the people within 500 ft on the maps I provided you. That's map two. um that

[9:55] also are in opposition. And I just want to bring up again, I really hope you

[10:00] will protect our neighborhood because we're talking about a 57 decel limit for

[10:03] a commercial property versus crossing into a residential district that at

[10:08] night we can only have 50 dB of noise. I'm also very concerned about water

[10:12] runoff and drainage from the gas station touching our properties. That's flat

[10:16] land. I called my homeowners insurance and if we had floods like in 2011 when

[10:20] massive properties were flooded, if gas station runoff touches a wooden home, I

[10:24] was told it would be condemned. So now we're worried about condemning things in

[10:29] a time of climate change and we have wildly fluctuating weather. I had one

[10:34] more big point to make today and that's that um of the 52 people that signed my

[10:39] petition, we pay 2,900 $290,148

[10:44] to this town and school district per year. Just the 52 residents that signed

[10:49] the petition and it is a known fact that gas stations can diminish home values by

[10:54] up to 16% to people within 500 ft. This is documented and studied. It is online.

[10:59] Our own DEEC and um I can't think of the exact person that published that, but it

[11:06] is online if you literally Google governmental studies.

[11:09] » Okay. I'm I'm just going to have to ask you to wrap it up. Okay.

[11:12] » Yep. And the last thing I wanted to say is that um it's this is going to

[11:17] completely change the neighborhood of the character the character of the

[11:19] neighborhood. This is going to make it feel like we're on the Parkway. There is

[11:22] no amount of barrier or anything that you could do to protect our properties

[11:27] from this gas station noise, lighting, and contaminants of xylene, benzene, you

[11:31] name it. So, I hope you vote to help us out and protect the neighborhood. Thank

[11:57] uh exit out onto Walter and also the first time I've heard that there's also

[12:09] residential neighborhood. Uh there's no shortcuts to get to anywhere else. The

[12:13] only people coming up into the neighborhood are the people who live

[12:17] there. Uh this would completely change that. Walter is a narrow road uh fronted

[12:24] or rather backed by uh several houses. It it the traffic would become

[12:29] horrendous. You might as well put on the parkway. There's no need for a gas

[12:34] station there. Uh we had one on that side of the parkway down by the Morabido

[12:39] which went out of business uh for lack of customers. Uh the same thing could

[12:44] happen here. Uh as far as the drive-thru part, I have no idea what they're going

[12:48] to be doing with the drive-thru. you going to be selling alcohol through the

[12:50] drive-thru or is that just going to be sandwiches also in addition to the

[12:55] normal uh gas station stuff? Uh 24 hours worth of lighting is going to go right

[13:02] into my front uh my front yard into my kids bedroom windows.

[13:09] The whole idea uh is a farce. There's absolutely no reason to have a gas

[13:15] station there. Uh, does the person who owns this property also own I believe

[13:20] it's 917 Imperial Woods

[14:27] you brought up the concerns with the hotel there, we don't need part two

[14:33] where now the residents are going to have quick, easy access to beer and

[15:39] potholes in it. And if you did this, who's going to be responsible for

[15:44] keeping that road up? cuz it is a mess. Now, I don't know if any of you have

[15:49] walked down it or driven down it, but it I mean I have no place else to walk.

[15:54] Like you said, we have no no walk or uh sidewalks in our neighborhood. So, I

[16:00] walk down there and I've done it for 50 years with baby strollers, dogs, and I'd

[16:08] like to know who would keep up that road so it is in good condition. And I'm not

[16:14] for that, but I just if it does go through, I'd like to know who's

[19:13] planning board in which those particulars including entrances and exit

[19:18] to to um to streets. All the particulars about what driveway is where and

[19:24] screening and all those issues get decided and finalized at the planning

[19:28] board. Uh and no project goes forward before it gets finalized at the planning

[19:32] board to the satisfaction of the planning board members. So it would be

[19:36] addressed at that point. So, um, we wouldn't have an answer for you in terms

[19:40] of the name of of the thing at the end after the residents have pro spoken. If

[19:47] anybody that represents the company or the owner wishes to speak and answer

[19:51] some of those questions, we will ask them to if they want to. Okay. Does any

[20:09] been there 25 years and I remember when that car dealership went in next to the

[20:16] California grill between the California grill and the motel. They came around

[20:20] and we signed a waiver that they were going to maintain that fence on the back

[20:25] side of their property to stop all that light from shining. Now there's no fence

[20:30] at all. I'm surprised more of the residents on Walter haven't complained

[20:36] about that because that was one of the reasons they got the waiver to open that

[20:41] gas station and keep it lit up at night. Thank you very much for allowing me to

[22:29] that are going to come into our neighborhoods. And not that I I don't

[22:32] care if there's a business coming into our neighborhood, but just not a gas

[22:36] station, not a 24-hour gas station. That's just ridiculous. I mean, in every

[22:41] way I can even think. And I don't that's all

[23:20] to whether this fits within the nature and character of the neighborhood and

[23:24] the effect that it would have upon the people that live there. Um, I was just

[23:27] wondering if some of the predicate conditions have been met. Specifically,

[23:32] there was supposed to be a sworn notorized statement provided today

[23:36] would be 50% of the properties within uh what is it 500 ft and because it's

[23:43] within 100 ft of residential properties, I think 2/3 of the eight properties that

[23:47] are within 100 ft. So, I don't know if those were provided today to the board.

[23:56] first the second question about um whether there's a a predicate

[24:02] requirement that um the uh uh that no service station shall be built within

[24:09] 100 ft of a residential district. Um there's a there's two ways to interpret

[24:29] interpretation uh for the benefit of the board because

[24:33] as you probably know there's two ways to interpret that. Um, one way to interpret

[24:38] that and it's elsewhere in the code about situating uh, a station um,

[24:44] [clears throat] is to measure from the station the location of the station

[24:50] itself, the building to the residential district. The map that has been provided

[24:55] by Keystone Associates, I can't see it from here, but I looked at it briefly

[25:00] like when you did when you came in here. Sure. And it look just to check that

[25:04] measurement and it looks like it's about 115 feet uh away from if you do measure

[25:09] from the building to the residential district it looks like it's about 115 ft

[25:13] to the road and then I don't know how wide the road is the road might be 20 ft

[25:17] or something so it's it's probably like 125 ft from the residential district. Um

[25:22] the other way to measure these um it would be from

[25:26] uh property line to property line which it's the same property line so it's zero

[25:29] um and that definitely would be affected but um there's there's definitely uh um

[25:36] there's definitely two schools of thought that have been presented. Um,

[25:41] this board uh I I'm told intends to uh seek uh uh an opinion from uh the ZBA uh

[25:50] who provides uh that kind of an opinion not only for ZBA uh matters but also

[25:55] matters before the town board. Okay. I had the same thought earlier today and

[26:00] did a little research to try to find the same thing. Elsewhere in that same

[26:04] section of code, it does talk about it coming from the the property line

[26:08] itself. And for this particular plan, there's really no differentiation

[26:12] between the actual physical footprint of the structure and the business work

[26:17] that's to be done, particularly because there's going to be a drive-through

[26:19] window, an overhang, whatever business is going to happen behind it. Uh, but

[26:25] » that's a that's a reasonable um uh point. If there's improvements behind

[26:29] the uh building, that's another consideration. As far as elsewhere in

[26:33] the code, um I mean the there is a measurement standard that's in that

[26:39] section of the code. It pertains to um being within 250. You're not supposed to

[26:44] be within a station is not supposed to be within 250 ft of a school or a

[26:48] church. Um and the measurement standard that's put in there is from the building

[26:53] itself to the so there's some precedent for that measurement uh because it's

[26:57] contained elsewhere in the uh u and that's not to say I mean as you know

[27:01] that doesn't mean that there's a special permit approval by this board. This

[27:04] board has uh discretion but it's a it's a it's a very relevant factor how that

[27:10] measurement takes place. But the must part that's in the code was that today a

[27:15] notorized statement with 50% of the properties within 500 feet that they

[27:20] have their ascension to or approval of the project. And it seems to me if that

[27:24] wasn't provided today that they haven't met the predicate conditions under your

[27:27] own terms and code. I don't know how you would approve it uh outside of the

[27:31] finding or the necessary finding that it somehow meets the uh the well-being and

[27:37] doesn't devalue the neighboring properties.

[27:52] these are things that that are going to be uh um looked into before the board

[27:56] votes, and it will probably not be tonight. It'll probably be um when uh

[28:07] tonight uh such as yours and uh hear from the ZBA, get their opinion

[28:13] [clears throat] and um uh have an opportunity to review the maps and

[28:16] whatnot. Um so that's what that's what tonight is for and um and then a

[28:22] decision will be made and we'll make sure that um that your questions are

[29:01] approved. Um the applicant [clears throat] would have to um have to

[29:07] seek approval, seek a a special uh use permit from this board, from the town

[29:14] board. Okay. Um and the applicant would also have to get uh through the planning

[29:21] board. the planning board uh is more concerned with the site plan, the

[29:26] buffering. Sometimes the planning board says, "No, we don't like that back exit

[29:30] off of the uh onto Walter." You can maybe the planning board says, "Uh yeah,

[29:36] if you're up, you know, if you're up against the parkway and you've got an

[29:39] appropriate buffer uh behind the station, that's fine. Uh maybe they have

[29:45] comments on drive-thru activity. maybe they have they have that those types of

[29:49] mitigating um uh considerations when it's before the planning board. But um

[29:57] so if it were to go to the planning board first, the planning board would be

[30:00] able to approve a site plan. But in this particular case under the code, if it's

[30:05] a if it's a vehicle service station, uh the planning the planning board doesn't

[30:10] have the last word. The last word would be from the town board and the town

[30:14] board has the authority to issue the special use permit. Also, under uh if

[30:20] they if they deem it appropriate under conditions such as buffering conditions

[30:25] and lighting conditions and hours of operation and all that stuff. So,

[30:30] there's two boards that are relevant here. it's the town board um and the

[32:50] my house this weekend and I was like stay away from the road because there's

[32:53] just a traffic so crazy nowadays even to add this to it. We we just want to

[32:58] register our concerns and we are we are not interested in having that in that

[33:38] offices. Nowhere does it ever mention a 24-hour gas station that can serve

[33:43] thousands of customers. That's more along the lines of a C8 or a B2 zoning

[33:48] from my understanding. Those are heavy industrial uses that New York State

[33:52] usually gives to gas stations. So, a C1 property is an irresponsible and

[33:57] inappropriate use in my opinion of that land. Thank you. And lastly, we would

[34:02] love development there. Just a good neighbor that would not be 247 with

[34:06] thousands of customers. Something that would seamlessly blend with the

[35:05] I've got to be careful. The folks on the left coming out of the former uh Joanne

[35:08] Fabrics parking lot failed to stop at the stop sign and the other people do.

[35:12] So, you increase the volume of traffic there, um it's going to be a disaster. I

[35:18] just think that uh you folks ought to look at this very hard and very long and

[37:43] They're going to go over the specifics of it and double check all of the

[37:49] legalities. Then it's going to go to them. And there

[37:52] were many there were a lot of concerns about the planning and things that are

[37:56] involved particulars with the project. Um so it may or may not go to them. It

[38:02] cannot get passed before it comes back to us. Okay? This project cannot be

[38:08] approved fully before it comes back to us. So, nobody can approve it until it's

[38:14] going to come back to us. But the legalities must be checked. Um, every

[38:19] members of the town board, we represent you, okay? We understand that and but we

[38:25] also have to follow all the regulations. So, we're sending it back for all those

[38:30] considerations for everybody to take a look at it. When he referred to Gina,

[38:34] that's the attorney for the planning for the zoning board. So they are going to

[38:38] be talking about all of the legalities. It cannot be approved before coming back

[38:44] to us and coming back here. Okay. Can't get the special permit without us. So

[38:50] there is no way it can get approved in any other way. Um we are going to table

[1:04:30] are going to be more than we thought. So the board discussed it on Monday and we

[1:04:36] are trying to do this project without any tax money. So um we are going to

[1:04:41] continue in process for the project. Um, however, because we've already been

[1:04:45] awarded the grants, we are not going to spend any more money and I have already

[1:04:50] begun to reach out to get more funding to make up that $152,000.

[1:04:56] So, we will make the decision further along the road, but personally, I am

[1:05:00] confident that we're going to be able to get more award money, but um, we just

[1:05:05] want to make the public aware that we're doing our best. Um, and we're not going

[1:05:09] to make any more expenditures until we assess, verify, and secure more funding.

[1:23:50] town employees voted because I did a survey and I was able to get um 82 of

[1:23:58] them because we have different schedules. But um and they put forward

[1:24:03] uh the I double checked the last design to make sure there weren't any issues,

[1:24:08] but I voted on their behalf tonight because um that's what they had wanted.

[1:24:13] But um but they also said at the same time that they would be good with any

[1:24:17] design. Um if you are not familiar with it, the town the hometown banners are

[1:24:24] hosted um in a lot of towns in Endicott and everything. It does not cost the

[1:24:30] town or municipality any money. Family sponsor the banners. The price that we

[1:24:36] we're going to finalize the price, but the initial price, if we do it in blocks

[1:24:41] of 40, will be $185. Our highway and parks department will be

[1:24:46] putting up the BL banners every year and taking them down, so there's no out-of

[1:24:50] pocket cost for the town. Um, and the banners will stay up for three years at

[1:24:56] a time. So, it's $185 for three years. And at that point, it would have to be

[1:25:01] renewed or not. and the family would get the banner back if they choose not to

[1:25:05] renew. So there's really no loss to the family. So um we are going to continue

[1:25:11] on and we will have put public notice out as soon as the last mockup is done

[1:25:16] and we will I know that we've had a lot of inquiries on how to sponsor a banner.

[1:25:22] Um so we will put the information out as quickly as the company gets back to us.

[1:30:54] on their preliminary budgets. Public safety. The New York State Police

[1:30:59] Juvenile Officers Association recognized SRO Connor Talbot as youth officer of

[1:31:05] the year for his incredible work in our community. The Vestal Police Department

[1:31:09] states that officer Talbot has for the past 11 years been the mascot for the

[1:31:14] Vestal Youth Police Academy, a dedicated SRO, an important part of local youth

[1:31:20] sports. Thank you to the Vessel Central School District for assisting the Vestal

[1:31:24] Police Department with the application process for this award. Check the Vestal

[1:31:28] Police Facebook page for pictures and details. The public is reminded that a

[1:31:33] two or three-w wheeled vehicle without pedals that is powered purely by

[1:31:37] electric motor but is not registered is not legal on public roads and highways

[1:31:43] in the town of Estel. EMS report. In July, there were 343

[1:31:48] calls, 284 transports, seven missed calls. They have a 97 98% call coverage,

[1:31:55] 2% missed calls. Year-to date 97% call coverage. Uh 3% miss calls. Transport

[1:32:03] miles, 1571.9 in July, 8,133.20

[1:32:10] year to date, March to July. uh fire department. The fire department

[1:32:14] continues to provide training to enhance the quality of fire services in the town

[1:32:18] of Vestal. A significant uptick in calls has occurred as the students return.

[1:32:23] More people, more calls. Please remember to move to the shoulder of the road for

[1:32:28] emergency vehicles to pass safely. Personnel clerk's office, the farmers

[1:32:32] market is up and running until um Wednesdays and Saturdays until November.

[1:32:37] Hunting licenses are available. Preparations are in progress for

[1:32:41] collection of school taxes to begin on September 1. Recreation. The Vessel

[1:33:21] the director down there. It's fascinating place. And then, of course,

[1:33:25] October's coming up in Wreck, so there'll be movies, there'll be the

[1:33:29] Monster Bash. Just keep your eyes open on those Facebook pages.

[1:33:45] David ad David a parks tennis and basketball courts. They also realign and

[1:33:51] added more fencing to accommodate the first pickle ball court uh in the town.

[1:33:56] Uh they are also working on improvements to the bowlers's approach of the cricut

[1:34:00] pitch. Uh they poured a new 10-ft concrete pad and installed new

[1:34:04] playground bedding at the Cricut Pitch Park. So, thank you to our parks

[1:34:10] department and all of our public works. Uh as summer's winding down here, we're

[1:34:14] going to be gearing up for snow before we know it. So, appreciate everything

[1:35:37] in regards to um a project in which a town is expanding a road. um numerous uh

[1:35:44] numerous times the the the town has tried to contact them going all through

[1:35:49] all the steps and they still have not be a been able to contact that person. So

[1:35:53] then you go to procedure which is that there's a procedure where um you where

[1:35:58] the town takes the property with compensation to the owner um but it has

[1:36:03] to go to court basically to a judge and then they they have to show why they

[1:36:07] need it. um all the particulars have to be established and then they can they

[1:36:12] can do a legal document to move towards it but it's for the expansion of a road

[1:36:17] um and the second one is the court seal is that um in the new location the court

[1:36:23] does not have traditionally courts I think always have courts have a court

[1:36:28] seal like behind them um and they they had originally when they moved they had

[1:36:34] tried to have something it didn't work out So there is a grant um that is

[1:36:40] available um in the court district. Um so they're applying for the grant to

[1:36:46] fund a seal that so they can have a seal like they should. So that's it. So

[1:36:51] they're asking for a grant for it. Um but they need permission of the town

[1:36:54] because they're inclusive in the town. So um if you have any other questions

[1:37:17] need a little bit more space to do the building. So, that's where we're getting

[1:37:22] imminent domain to take a piece of property. We tried to contact the owner.

[1:37:54] really listened and just even going down the agenda. the amount of attention and

[1:37:58] thought you guys put behind your decisions on most of all I would say all

[1:38:02] of the agenda items. It was really heartening to see. So, thank you. And my

[1:38:06] question is really just maybe after the meeting if someone could just clarify

[1:38:10] for me the next steps that I should be on the lookout for regarding um agenda

[1:38:14] item four with the public hearing uh the special permanent 1016 Vestal Parkway.

[1:38:19] I'm specifically wondering um the timeline of how does it move through the

[1:38:24] zoning board or the ZBN review? Like do we have a ballpark of how long that

[1:38:28] takes or when I should be checking back for updates?

[1:38:33] » Dan, can you comment? >> Um I don't know when the next the ZBA

[1:38:38] meets monthly. Okay. Um once a month. So I don't know who when their next meeting

[1:38:45] is. It is on their website. tomorrow.

[1:38:52] Because their agenda isn't normally set. >> I don't mean it's probably if it's

[1:39:30] you can check uh the progress there. Those are public meetings you can attend

[1:39:34] and there's more uh at those meetings there's more uh detail about uh the site

[1:39:39] plans and there's and there's discussion about uh uh like I'd mentioned earlier

[1:39:45] whether um remediation is uh is going to be recommended by the planning board

[1:39:50] that sort of thing. >> So like for this Z it's ZVA you said

[1:39:54] it's called >> it's the zoning board of appeals the

[1:39:57] shortand for zoning board of appeals is ZBA.
