We discussed with the applicant was the North facade of the.

Had a much blank wall.

And we wanted to.

Make sure that it provides a more pedestrian, pedestrian friendly approach.
[18:12]
So we talked about potentially breaking it up with some landscaping in which they agreed with. So that's how it's going to look
[18:17]
like some IV's and some trees.
[18:22]
Just to make it look more appealing and not look like a blank wall.
[18:26]
On the on the.
[18:27]
Pool building side of the building.
[18:32]
And this is how.
[18:33]
What they have also.
[18:35]
Updated the restaurant to look like.
[18:38]
Now, having said that, the conditions.
[18:41]
Of approval based on the review and every.
[18:44]
Thing that we've had to go through.
[18:46]
Was that they pay the outstanding fees and you know, these are standard.
[18:52]
Conditions that we have.
[18:53]
The applicant.
[18:55]
Is also required as I mentioned earlier.
[18:57]
To have the northern facade of the.
[18:59]
Pull meet the agreed upon landscaping to provide a more pedestrian friendly experience and limit the blank wall.

So they agreed to again.
[19:09]
Include these trees and other landscaping elements to make it look.
[19:14]
Better and.
[19:16]
You know, more human scale as well.
[19:20]
There's another part of it that I have not spoken about, but this condition is born out of a meeting that we had this morning,

which is the applicant should provide a safe.
[19:30]
Park in and circulation plan while the spar building is being.
[19:34]
Completed or finished up? I want to go up here to explain a few things.

So when you look at this site plan that's being.
[19:42]
You know, uh.

The applicant has.
[19:47]
A phase in plan for this.
[19:49]
You know, development itself where they look into.

Get the phase two which is the main.

So that while they're doing all of.

The, you know, finishing.
[20:30]
Finished work in this other part of the building.

People can still use the main pool safely.
[20:37]
And not have any issues since it may still be an active construction site.

On the North End and east side of the site.
[20:47]
So that's the reasoning behind.
[20:50]

The last condition that was included.
[20:56]
Would need to have all of those at least.
[20:59]
Discussed and agreed upon.

They have that as part of the conditions before it gets to the point where they need to start operating the main pool.

things. We're trying to put a lot of that detail in here.

It means a tremendous amount to us to make this whole development.

So the purpose of this is.

The purpose of this public input and also for the.
[1:28:08]
For the update.
[1:28:11]
On in this presentation is. Bottom line is for.

Vineyard City and all other cities who are going through the same process. Excuse me?

To stay compliant with the FEMA, the federal Federal Emergency Management Agency.
[1:28:26]
And the NFL.
[1:28:28]
I see the NFIP which is a national flood insurance program.
[1:28:33]
Keeps the city eligible.
[1:28:34]
For flood insurance.
[1:28:35]
Put federal disaster funding.
[1:28:38]
Specifically, it's for FEMA.
[1:28:39]
As well as grants, which is through FEMA and other resources.
[1:28:43]
Bottom line, this is to protect public safety.
[1:28:47]
Property and also infrastructure.
[1:28:49]
This initiative is being led by the.
[1:28:52]
Utah Department of Public Safety, Division of Emergency Management.
[1:28:56]
Who spent a lot of time gathering information, all that a lot of data and so forth.
[1:29:00]
To put together the proposed updates.
[1:29:03]
On this.
[1:29:05]
So what does floodplain management, just in a nutshell, is this helps regulate?
[1:29:11]
Floods, flood and flood zones in short.
[1:29:15]
The main purposes of it is to help reduce flood risks.
[1:29:19]
This is specifically flood risk.
[1:29:21]
Not caused by broken sprinklers or broken.
[1:29:25]
Faucets and inside but floods.
[1:29:27]
Due to outside.
[1:29:30]
Causes.
[1:29:31]
Specifically.
[1:29:33]
Wetlands or.
[1:29:35]
Buys water such as Utah like.
[1:29:38]
And of course, trying to help manage long term growth to ensure the as people as.
[1:29:44]
Areas grow as develop, and so forth at.
[1:29:47]
Public safety is the main focus.
[1:29:50]
And loss of life, property damage, and of course, public costs.
[1:29:55]
A lot of these pictures that are being shown.

Utah's uh.
[1:30:01]

Other departments of public safety.
[1:30:07]
So what records this update?
[1:30:10]
Then a new Utah late all.

Hazard analysis specifically for vineyard the new Utah lake flood hazard analysis.
[1:30:17]
It's been it's util.
[1:30:19]
This analysis was led by the state of.
[1:30:23]
Department of Public Safety.
[1:30:25]
It used updated FEMA data and modeling.
[1:30:29]
And the main things it does is it.
[1:30:31]
Has changed inclusive.
[1:30:33]
Changes to.
[1:30:34]
Lake levels.
[1:30:35]
Wave action, so when?
[1:30:38]
We predominantly see it around here.
[1:30:40]
When with high winds and especially in the winter time when we had the stacking of the ice.
[1:30:45]
Slates that's.
[1:30:47]
They're very easy, realistic.
[1:30:49]
View what wave actions are.
[1:30:51]
And of course, flood elevations.
[1:30:53]
How high the flood wires go.
[1:30:56]
This year we're not expecting.
[1:30:58]
High elevations of.
[1:30:59]
Utah Lake, but in previous years.
[1:31:02]
I believe it was 2023. We've had quite a.
[1:31:05]
High elevations on util light on Utah Lake. What this does is evaluates and.
[1:31:11]
Right here is quite simply the 100 year flood and then the 500 year flood.
[1:31:15]
What that says is a chance of a high level flood is.
[1:31:20]
Once every 100 years or once every 500 years?
[1:31:23]
Doesn't mean that.
[1:31:24]
If it happens once, it won't happen again.
[1:31:27]
100 years from now or 500 years from now, I.
[1:31:31]
My previous city I I came from Florida.
[1:31:34]
I've experienced 100 year flood.
[1:31:36]
Probably 3 times in one year.
[1:31:38]
It's not fun.
[1:31:40]
But that's.
[1:31:41]
Pretty much saying this is a this is a chance of it happening 1%.
[1:31:46]
Happening three times in one year. 1% was for the.
[1:31:49]
Pretty far on the on the right, there's a historical flooding and flooding disaster declarations in Utah and this has a
[1:31:53]
historical.
[1:31:58]
Kind of picture showing that.
[1:32:02]
What ultimately the goal is that if a declarations.
[1:32:09]
As a flood decoration is done, it has as minimal damage as possible.
[1:32:14]
Typically if it's a state level declaration.
[1:32:17]
It reaches a threshold of X amount of dollars of damage.
[1:32:21]
And if we can minimize that decoration.
[1:32:25]
By doing all the by doing these.
[1:32:28]
Measures up front.
[1:32:29]
It's better for the community.
[1:32:31]
Embarrass for the state.
[1:32:33]
Moving on Vineyard specific updates.
[1:32:36]
We've, you know, I would hope that everyone who lives in Vineyard is obvious to them.

There is. We have a large body right next to us.
[1:32:47]
You know those comes with a.
[1:32:49]
Pros and Cons The pros is this very beautiful lake for you know it provides towards a quality of life etc. The Collins is you know
[1:32:54]
obviously when it comes to flood it is a.
[1:33:00]
Source of flooding.
[1:33:02]
So the flood impact shoreline properties, infrastructure specifically, we do have lift stations that are long.
[1:33:09]
Within vineyards. So we do.
[1:33:11]
Maintain Ensure that flooding does not impact our lift stations.
[1:33:16]
Which?
[1:33:17]
Conveys a sore to.
[1:33:19]
The area away from the public.
[1:33:21]
And of course, public access, specifically roads.
[1:33:25]
What is the city required to do the city, and not to spend your city but all cities, is required to adopt updated floodplain
[1:33:29]
regulations.
[1:33:33]
Make sure that they're regulating development and flood areas.
[1:33:36]
To ensure structures are protected specifically.
[1:33:40]
And of course.
[1:33:42]
We do that through ensuring that we're issuing permits specifically for.
[1:33:47]
Development in flood plains.
[1:33:49]
So specific permits.
[1:33:51]
Addressing developments that would be in a floodplain.
[1:33:54]
Because we need to consider public safety, development impacts and, of course, compliance.
[1:33:59]

Portions of the lakeside power plant and a small portion kind of tearing.

On the Northside, where the.
[1:34:46]
Yard would be.
[1:34:47]
Those are the main areas of for.
[1:34:50]
Where flood hazards.
[1:34:52]
Have been identified.
[1:34:54]
Everything else, the Blues is where.
[1:34:58]
The identification are.
[1:35:00]
But those are technically outside.
[1:35:04]
So what people are able to do is.
[1:35:08]
Go to this map and kind of zoom into their areas.
[1:35:11]
And kind of see.
[1:35:13]
FEMA also has a website.
[1:35:15]
Where you can actually where you can enter into enter an address.
[1:35:18]
And kind of see your address specifically.
[1:35:21]
On the when I'm support, yeah. And this is not just for Utah specific, this is nationwide.
[1:35:27]
As well.
[1:35:29]
So jumping into what the proposed ordinance, so make sure it was draft. It doesn't take any effect until the City Council
[1:35:34]
officially adopts it. We anticipate June.
[1:35:40]
As the number one thing it does is it aligns.
[1:35:45]
Vener City with the National Flood Insurance Program.
[1:35:49]
This is important to the public.
[1:35:50]
And of course been your city is a help allows.
[1:35:53]
To maintain the eligibility for federally backed flood insurance.
[1:35:57]
So if you if.
[1:35:59]
Your homeowners are able to get flood insurance.
[1:36:03]
Even if they don't live specifically in a flood zone.
[1:36:06]
If you live in a floodplain zone.
[1:36:08]
Not so much here in Utah, but.
[1:36:11]
I dealt with this quite a bit in Florida.
[1:36:14]
You know mortgage companies require.
[1:36:17]
The flood insurance to be to to.
[1:36:20]
To have flood insurance.
[1:36:21]
And then of course and I've had there's instances where.
[1:36:26]
Insurance companies kind of go into the whole.
[1:36:28]
How did the water damage enter the house in Utah? We do have those basements for there's not, but how water interests of the
[1:36:32]
house.
[1:36:36]
Is important.
[1:36:38]
And these are federally backed insurance programs.
[1:36:40]
It adopts FEMA flood maps.
[1:36:43]
Which is which takes effect.
[1:36:45]
June 23rd, 2026.
[1:36:47]
As the basis for the floodplain management, So what? So what this ordinance does is.
[1:36:51]
Says that we're utilizing these maps, which is.
[1:36:54]
On the previous slide, the proposed map on the on the GIS website.
[1:36:58]
Which?
[1:37:00]
Was put together by the state of Utah.
[1:37:02]
Using the FEMA data.
[1:37:05]
In order to use that as a basis to.
[1:37:09]
How we drive our.
[1:37:11]
Regulations.
[1:37:13]
And what areas have to abide to those?
[1:37:16]
Flood regulations.
[1:37:18]
And of course it requires A floodplain development permits for any development inside a flood.
[1:37:22]
Hazard Area.
[1:37:24]
That is something that.
[1:37:26]
Patrick and myself and the planners as well as the building department handle on our side.
[1:37:32]
Bottom line, it takes make sure that's a. Structures within these areas are.
[1:37:37]
Equal to.
[1:37:38]
Their finished floor, so the Congress. So when you walk into the livable areas, the concrete elevation.
[1:37:44]
Is at least one foot above the base flood elevation.
[1:37:49]
They're designed.
[1:37:50]
To resist flood forces as well.
[1:37:53]
Residential as well as commercial.
[1:37:56]
And they're utilizing certain specific.
[1:38:00]
Materials. Utilities.
[1:38:02]
And that the impacts that.
[1:38:05]
Excuse me that when they do the development that it's not changing.
[1:38:09]
The floodplain.
[1:38:11]
Zones that you know what they do does not impact.
[1:38:14]
Their neighbor.
[1:38:15]
Like put and this is.
[1:38:18]
A lot of this, a lot of this is common.
[1:38:20]
Would be considered common sense.
[1:38:24]
You know you don't want to impact your neighbor by pushing.
[1:38:26]
While causing increasing.
[1:38:29]
The floodplain on their.
[1:38:31]
On theirs, that actually has civil implications.
[1:38:35]
You know, if you're building inside an area with that.
[1:38:38]
I could be prone to flooding.
[1:38:40]
The course you want to use.
[1:38:42]
Proper materials, putting proper utilities.
[1:38:45]
And of course you want the structure to.
[1:38:47]
Resist.
[1:38:49]
Being damaged from flooding.
[1:38:50]
And then the elevation. Of course you don't want the water to go inside, however this codifies it specifically.
[1:38:57]
And I can say in Florida where?
[1:38:59]
Flooding is more prevalent.
[1:39:01]
The 12 inches above the.
[1:39:03]
Base flood elevation is very common.
[1:39:06]
Some areas have it 18 inches, some areas have 24 inches.
[1:39:10]
24 inches is pretty excessive.
[1:39:12]
18 inches and Florida is kind of the norm, but again we're talking about areas that.
[1:39:17]
See 100 year flood.
[1:39:18]
Every other year, apparently.
[1:39:21]
On that.
[1:39:24]
So the additional thing it does.
[1:39:27]
Is on the Ministry of Enforcement. This actually goes a couple steps above. Is it?
[1:39:33]
I identify as a public works director or designee.
[1:39:36]
As a floodplain administrator.
[1:39:38]
In essence, what they do, what it says, is that.
[1:39:41]
This that there's an entity that actually makes the call.
[1:39:45]
On when it comes to flat plane decisions.
[1:39:48]
My last city in Florida.
[1:39:50]
We actually have flop doesn't a.
[1:39:53]
A person that was a floodplain manager, it was a specific role.
[1:39:57]
For the.
[1:39:58]
Purpose, you know, don't want to get too much, get us through the planners. But she was she, she was a planner.
[1:40:05]
And was a very good floodplain manager and she was also the assistant.
[1:40:09]
Emergency Manager.
[1:40:10]
So she was very in tune to a lot of that stuff, but.
[1:40:14]
At the end of the day.
[1:40:16]
The final decision making.
[1:40:18]
What it fell on to me as a public works director in Florida.
[1:40:23]
The city is responsible for reviewing development.
[1:40:26]
The development proposals.
[1:40:28]
Maintaining records.
[1:40:30]
And they're coordinating with FEMA state agencies.
[1:40:33]
The first and third one really doesn't change. The third, the one, the second one.
[1:40:37]
Is really just kind of.
[1:40:40]
Making sure that it's codified, that it puts the responsibilities on the city.
[1:40:45]
Luckily and gratefully, we have an awesome building department.
[1:40:49]
Team that is very meticulous when it comes to record keeping. So we don't foresee any additional.
[1:40:56]
In essence, additional work on the city.
[1:40:58]
But that was also put some additional.
[1:41:01]
Tools into our toolbox.
[1:41:03]
Allows us to have stopped work orders.
[1:41:06]
As well as fines for $1000 per day in jail time for violations of.
[1:41:11]
Public Works is not planning on building in jail.
[1:41:13]
In our facility, so we are.
[1:41:16]
Just looking we would just really really be looking at working with code enforcement for fines, the stop work orders.
[1:41:21]
On this before, what we would do is we would use public health as our.
[1:41:26]
Mechanism.
[1:41:26]
For a stop work order or work with our building official.
[1:41:31]
This ordinance.
[1:41:33]
Which is a model from this state. Which is the model. We use the model from the state.
[1:41:38]
Would actually allow.
[1:41:39]
A stop work order from the Public Works director specifically.
[1:41:43]
For this reason.
[1:41:45]
On that.
[1:41:48]
Talking about the public process, where there's a public process period, we've posted on our website, but it's from May 1st to May
[1:41:52]
31st.

And kind of outlying.
[1:42:00]
We're having our public here our.
[1:42:02]
Public input period.

Through multiple means.
[1:42:07]
One of the means is through the Planning Commission where we're presenting.

The public can submit comments, attend meetings which is this one, speak in person which if anyone would like to.

But they all can also provide input.

Or by e-mail or physically and in the mail.

People have said the map is hard to use.

Some I would sometimes agree with.
[1:42:47]
But they've made it there's, they've taken that and tried making it.
[1:42:52]
Love it, easier to use.
[1:42:54]

Is the Utah County.
[1:42:58]
Did a great job with making a much friendly user map.
[1:43:02]
This the.
[1:43:04]
Map as you know.
[1:43:05]
I was, hopefully they're not listening to me right now, but it's kind of par with the federal government.

They make it hard to use.
[1:43:12]
If it's not hard, impossible to use, then it's not the federal government's map.
[1:43:16]
But Detox County has a great floodplain interactive map.
[1:43:20]
On that SO.
[1:43:22]
And a lot of people get this question, we get this question, I want to say a lot, but we do get this questions that do I have to
[1:43:26]
get flood insurance?
[1:43:30]
If you ever call our office and ask us that question, we will never say yes. We will never say no, but we say that.
[1:43:36]
We will always tell people that it is.
[1:43:38]
You're right to get the flood insurance even if you're told not to.
[1:43:41]
If you're told you have to.
[1:43:43]
Then obviously there might be a reason as to why.
[1:43:46]
The city does not require flood insurance.
[1:43:50]
However, lenders are typically the ones that do.
[1:43:52]
Required if you own your home free and clear.
[1:43:56]
And you choose not to get flood insurance. That's a risk.
[1:43:58]
That people take.
[1:44:00]
Depending on what's going on.
[1:44:02]
And where you're located.
[1:44:04]
Which map should I use?
[1:44:06]
The updated map which will be effective June 23rd.

Bottom line, there's been updated data that's been made available from from FEMA.

Bottom line, we are not increasing risk, we're just better understanding it. So that's what the map says.

And then the last one is, can the city fix this?
[1:44:46]
He asked the engineers. We always say we can always. We can fix anything as long as you were given enough resources and allowed
[1:44:49]
to.
[1:44:53]
Very much.
[1:44:54]
Demo or anything? Anything we're allowed to but.
[1:44:57]
Bottom line, the regulations are based on risk, not just infrastructure.
[1:45:01]
We do have, we do put a lot of infrastructure into the ground, storm drains.
[1:45:05]
Infrastructure, we have pumps specifically around our lift stations and so forth.
[1:45:10]
To ensure that we're protecting our critical infrastructure.
[1:45:14]
And but there are kind of acceptable, I would hate to say acceptable risks as well.
[1:45:20]
One, I would say, and this is not so much here in Utah, but for example, Florida.
[1:45:26]
A good example the 100 with when 100 year flood comes along.
[1:45:30]
The part of the flooding, acceptable flooding, is the streets.
[1:45:35]
We have.
[1:45:36]
Max. So the crown of the road and.
[1:45:39]
Is where the 100 year flood will go up to.
[1:45:41]
Which allows.
[1:45:43]
Emergency vehicles to navigate the streets.
[1:45:45]
However.
[1:45:46]
You know, the streets do have water and it's.
[1:45:48]
And that is just comes down to.
[1:45:51]
Kind of a the cost benefit of what if you try to build the streets so high up that.
[1:45:56]
They're above the 100 year flood.
[1:45:58]
Then, of course, the costs have to go somewhere.
[1:46:01]
On that, that's just an example, example of how we've tried to balance a safety.
[1:46:06]
And, of course, fiscal responsibility.
[1:46:08]
What we do is we ensure that.
[1:46:11]
Homes, property and lives are protected.
[1:46:14]
Was #1.
[1:46:18]
So what does this mean in vineyards? Future developments must meet these requirements, so.
[1:46:23]
That we evaluate what we've already talked about Alpine.
[1:46:27]
You would ask, why wouldn't they?
[1:46:29]
I would ask the same question. Why wouldn't they either?
[1:46:31]
But this is. This codifies it.
[1:46:34]
The impact of the public.
[1:46:35]
This changes the flood zones and vineyards. There's minimal changes specifically, however I always encourage people to look at the
[1:46:39]
maps themselves.
[1:46:42]
To get more details.
[1:46:44]
New building requirements such as being the finished floor of the house or the buildings should be 12 inches above the 100 year
[1:46:47]
flood.
[1:46:52]
Like the flood?
[1:46:56]
But that's only for new building permits or if there's major renovations. Those are typically.
[1:47:02]
The threshold is done typically through the building official and what that threshold would be if there had to be any kind of
[1:47:06]
modifications to a building.
[1:47:10]
Again, the question comes down to is why wouldn't someone want to build their building?
[1:47:13]
In a way that protects their building.
[1:47:16]
This disqualifies it.
[1:47:17]
Potential insurance impacts.
[1:47:20]
I my opinion is I don't see many.
[1:47:23]
If any in Vineyard City specifically.
[1:47:25]
Other cities such as Provost City.
[1:47:28]
Maybe Saratoga Springs and so forth may be seeing a lot more of the changes impacts. We we went through something similar with the
[1:47:32]
updating on maps for.
[1:47:36]
Fire hazards.
[1:47:38]
Where there was a lot of APACS, changes of impacts for fire hazards.
[1:47:43]
For structures.
[1:47:45]
Along like areas where the foothills like Springville etc. Bigger city.
[1:47:50]
Is a great location where.
[1:47:52]
We're kind of in the.
[1:47:53]
Perfect hub where?
[1:47:54]
We are kind of protected by a lot of these things.
[1:47:57]
Bottom line, does not affect. Not all properties are affected, but.
[1:48:01]
This is the public input to ensure that people have the ability to see this.
[1:48:07]
