[21:47] out a proper vote.

[21:50] So we should allow our voter

[21:54] registrars to efficiently update

[21:55] voter roles when an individual

[21:57] tells the clerk they are not

[22:00] eligible to vote unfortunately,

[22:02] partisan is undermining local

[22:04] officials' efforts to

[22:05] efficiently and accurately

[22:07] conduct elections in the

[22:08] commonwealth of virginia.

[22:10] Is there a problem you might

[22:10] ask?

[22:13] A crosscheck of voter rolls down

[22:15] in 2014 by the virginia voter

[22:18] alliance turned up 44,000 people

[22:20] registered in both virginia and

[22:21] maryland.

[22:22] Over the last five legislative

[22:23] sessions, republicans have

[22:25] attempted to preserve the

[22:27] integrity of elections and to

[22:28] improve processes and make

[22:32] technical fixes in legislative

[22:33] districts.

[22:36] Governor northham's three see

[22:37] toes of

[22:42] vetoesfollow 24 similar by governor

[22:48] Mcall legislative.

[22:48] Mcauliffe.

[22:52] i will include the law.

[22:53] Which they do by sending

[22:55] questionnaires to potential

[22:56] jurors.

[22:57] If an individual who is

[22:59] registered to vote returns

[23:00] claiming they are not eligible

[23:02] to vote and seven on a jury that

[23:04] information can and should be

[23:06] made available for the voter

[23:10] registrar and they then notify

[23:12] and allow the individual to

[23:14] confirm the eligibility to vote.

[23:16] I will not contest this veto.

[23:55] address an unfair property tax

[23:56] issue for certain golf courses

[23:58] that were literally being billed

[24:01] 10 times what others are.

[24:02] I want to thank the governor,

[24:05] even in the veto message he said

[24:06] if we don't fix this we would

[24:08] come back and work on it again

[24:08] next year.

[24:10] I'm pleased to say that because

[24:11] of the members who voted for

[24:12] this bill and how it passed the

[24:14] house and the senate there has

[24:18] been an equitable resolution

[24:18] that I believe the golf courses

[24:21] are now working on that will

[24:21] take place.

[24:23] I don't think this would have

[24:24] happened if the people here

[24:26] hadn't been able to work on

[24:26] this.

[24:32] So I appreciate that bipartisan

[24:32] agreement.

[24:33] That we worked on.

[24:36] And for one course this fixes

[24:38] 600 of my constituents who are

[24:41] members but also 5,000 military

[24:41] personnel.

[24:42] I appreciate it.

[24:44] Mr. Speaker, I do not wish to

[24:45] contest the veto.

[25:26] adopt any ordinance procedure or

[25:28] policy that restriction the

[25:29] enforcement of federal

[25:33] immigration laws.

[25:36] I read the veto message and it

[25:37] didn't even seem like it was

[25:39] written about this bill.

[25:40] Because, the governor said that

[25:42] this legislation could have

[25:44] negative impacts on public

[25:44] safety.

[25:46] Well, you know what actually has

[25:49] a negative impact on public

[25:50] safety?

[25:51] Not enforcing the law.

[25:52] It is important to remember that

[25:55] we are a nation of laws and not

[25:57] of men as john adams said.

[25:59] And it is important to remember

[26:00] that when it comes to keeping

[26:07] our communities safe,

[26:09] enforcement of the law is key

[26:12] and that is why we have law

[26:13] enforcement officers.

[26:14] It is frustrating when we hear

[26:22] of incidents that are occurring

[26:22] in the commonwealth why the laws

[26:24] are not being enforced and

[26:26] actual barrier is are being put

[26:28] in place to enforcement of our

[26:30] laws such as our federal

[26:31] immigration laws.

[26:34] I'm not talking about 287-g

[26:35] programs which are optional for

[26:37] each locality to participate in.

[26:42] I'm talking about policies like

[26:43] arlington's where the locality

[26:47] will not honor an I.C.E.

[26:48] Detainer without presentation of

[26:51] a warrant issued by a judge.

[26:53] Or, just two weeks buy

[26:55] weeks ago in

[27:01] fairfax where you had a

[27:02] discussion going on about gang

[27:06] violence in fairfax and

[27:07] immigration and customs

[27:10] enforcement officials disinvited

[27:12] from the meeting not allowed to

[27:14] speak at a public meeting and

[27:16] then according to the washington

[27:18] post several members of the

[27:21] board of supervisors

[27:22] congratulated the sheriff on her

[27:25] decision to not participate in

[27:26] 287-b

[27:29] g and asked her and the

[27:32] police chief to make sure that

[27:37] I.C.E. Agents aren't easily able

[27:40] to arrest anyone who is not the

[27:43] target of a criminal

[27:44] investigation.

[27:45] That is actively interfere

[29:25] local law enforcement officials

[29:28] are to be feared and avoided

[29:34] These policies encourage people

[29:35] to report crimes to the police

[29:36] that we have regardless of the

[29:44] legal status.

[29:46] They encourage people to report

[29:48] crimes regardless of their legal

[29:49] status.

[29:52] This bill goes the opposite

[29:53] direction.

[29:54] A recent university of illinois

[29:56] study found that 45% of

[29:59] immigrants documented and

[30:00] undocumented were less likely to

[30:01] report a crime you as a result

[30:03] of increased involvement of

[30:06] local police in immigration

[30:07] enforcements.

[30:08] More alarming and I mentioned

[30:09] this before in just the first

[30:12] eight months of last year, in

[30:14] arlington county, immigrant

[30:16] communities have seen a drop of

[30:19] 75% in reports of domestic

[30:22] violence and 85% drop in reports

[30:23] of sexual violence.

[30:25] The fear in my community and

[30:27] across the commonwealth is real.

[30:28] Immigrants are avoiding police

[30:30] for fear that their contact

[30:32] might lead to deportation of a

[30:33] loved one.

[30:36] Not only will immigrants be

[30:37] afraid to report crimes as

[30:39] witnesses or victims or

[30:40] coordinate with police and

[30:42] prosecutors in helping to solve

[30:45] crimes, their fear of doing so

[30:47] will make them easy targets for

[30:49] crime from gangs and bad actors

[30:50] who prey on them.

[30:52] In effect, this legislation

[31:01] makes our communities less safe

[31:04] by stoking irrational fears of

[31:06] immigrants and stopping the

[31:08] community policing that we value

[31:09] for true public safety.

[31:11] I hope it is the will of the

[31:15] body to sustain the governor's

[49:44] trump administration regarding

[49:47] the tariffs on steel from china

[49:49] only exacerbated the issue.

[49:50] There are several things that

[49:54] are clearer about the coal tax

[49:54] credit.

[49:57] We have had a coal tax credit in

[49:59] virginia until last year for

[50:01] since the 1980s.

[50:04] And, during that time, virginia

[50:07] taxpayers have invested some

[50:08] $750 million.

[50:11] These are your tax dollars, that

[50:14] have gone to the coal -- largely

[50:16] coal companies but some

[50:20] electricity companies.

[50:21] And but have not brought the

[50:22] results that the coal tax credit

[50:27] was supposed to bring.

[50:28] Y'all don't remember because you

[50:30] weren't here in the 1980s but it

[50:32] was sold as a vehicle to create

[50:34] jobs and increase coal

[50:36] production and $750 million

[50:38] later what do we have?

[50:40] We have an employment situation

[50:44] where about 12,000 plus were

[50:47] employed by coal industries in

[50:49] the 1980's and now down to less

[50:50] than 3,000 people.

[50:56] Tonnage to the drop by 67% since

[50:57] the 1980's.

[50:58] We tonnage continuing to drop,

[50:59] in.

[51:01] >> fact, the most recent date

[51:03] interest from the U.S.

[51:04] government and now this is a

[51:05] government controlled by

[51:08] President Trump, shows the coal

[51:09] production based on April

[51:11] numbers of this year is down

[51:13] almost 5% in virginia from what

[51:22] it was last year.

[51:26] It's not getting any better and

[51:29] instead of saying we will invest

[51:31] in virginia in a different way

[51:33] we will double down and keep

[51:38] sending tax dollars down for

[51:38] this.

[51:40] Two other things happened in the

[51:41] industry and they have to do

[51:42] with technology.

[51:45] Coal is being challenged by the

[51:46] market.

[51:47] And by automation.

[51:49] And if you take a look at what

[51:52] is happening in coal production,

[51:55] and what this is supposed to do,

[51:56] this bill, you have to realize

[51:59] that the technology is changing

[52:00] around us.

[52:01] The delegate from scott is going

[52:05] to rise and say this is not met

[52:08] coal, this is not about steam

[52:08] coal.

[52:09] >> that's right.

[52:14] >> and met coal is effective

[52:18] because it is the basic

[1:10:36] for years and gone beyond the

[1:10:38] wording in the code and finding

[1:10:40] of fact as to what is in the

[1:10:41] child's best interest.

[1:10:42] The language in the governor's

[1:10:46] amendment is'

[1:10:47] is' essential.

[1:10:49] Again underscoring in the

[1:10:55] important developmental years of

[1:11:02] a

[1:11:09] child eligibility for free and

[1:11:10] retuesdayed lunch, family

[1:11:12] unification program and housing

[1:11:16] vouchers, obtaining a passpart.

[1:11:18] Supplemental social security

[1:11:19] income.

[1:11:25] we wait to look at this fully in

[1:22:29] Metro sometimes had 7, 8, 9%

[1:22:36] We have a 3% percent cap on

[1:22:36] funding.

[1:22:38] This would take the ig outside

[1:22:38] of the cap.

[1:22:40] I would ask that we keep that in

[1:22:42] there and keep the cost

[1:22:43] restraints in there and keep the

[1:22:45] pressure on and keep the 3% cap

[1:22:45] firm.

[1:23:32] too much money on its internal

[1:23:36] And it is, frankly, something we

[1:23:38] want to make sure it well

[1:23:38] funded.

[1:23:40] Metro is about to get

[1:23:41] $500 million a year in

[1:23:42] additional funds.

[1:23:44] The current office of the

[1:23:48] inspector general is about

[1:23:49] $5 million.

[1:23:54] This is simply an exception to

[1:23:55] that 3% notion so that metro --

[1:23:57] we don't create some incentive

[1:23:59] to not increase funding to the

[1:24:02] oig if they need additional

[1:24:03] funding in the oig.

[1:24:05] That is something we would all

[1:24:07] want metro to be doing to make

[1:24:08] sure that its internal

[1:24:10] organization is being properly

[1:24:13] monitored by the oig.

[1:24:14] This I think is an excellent

[1:24:16] amendment and I hope you will

[1:24:16] vote for it.

[1:31:02] this to-do over mulch but we all

[1:31:03] well know that the issue at hand

[1:31:06] is larger than just the issue of

[1:31:06] mulch.

[1:31:09] The governor's recommendations

[1:31:11] on 1595 make numerous carveouts

[1:31:14] as you can see in the language

[1:31:17] and for all practical purposes

[1:31:18] guts the bill.

[1:31:20] After all of those carveouts and

[1:31:22] those exemptions, it begs the

[1:31:23] question who is left?

[1:31:25] Just that would be just you and

[1:31:27] I.

[1:31:29] But alas, Mr. Speaker, ladies

[1:31:30] and gentlemen of the house, if I

[1:31:31] want everybody to take a close

[1:31:34] lack at the lap -- close look at

[1:31:41] the language down in letter d.

[1:31:44] Building containing one or more

[1:31:45] dwelling units.

[1:31:47] i contend that includes single

[1:31:48] family dwellings.

[1:31:50] What started all this was the

[1:31:52] ordinance in the city of

[1:31:53] harrisonburg.

[1:31:54] They didn't even include that.

[1:31:56] They were kind enough, well,

[1:31:58] they knew this they were going

[1:32:00] to be in for a fight it they

[1:32:06] included all of the citizens

[1:32:06] half

[1:32:08] citizenshalf

[1:32:10] citizens'homes.

[1:32:14] That is why they exempt them.

[1:32:15] The governor doesn't take that

[1:32:23] into consideration, Mr. Speaker.

[1:32:24] The original bill allowed that

[1:32:28] any -- the occupancies issued

[1:32:30] prior to January 1 of this year

[1:32:38] wasn't going to be affected but

[1:32:40] going forward it would be.

[1:32:45] That was a good compromise.

[1:32:46] Felt like that was a good come

[1:32:48] promaze that the lowe

[1:32:50] localities

[1:32:53] could regulate mulch going

[1:32:53] forward.

[1:32:55] If we believe that the locality

[1:32:57] should not have the authority to

[1:32:59] retroactively apply new rules

[1:33:01] then we should reject the

[1:33:03] amendments and again I want to

[1:33:06] reiterate the whole issue of

[1:33:06] retroactivity.

[1:33:13] And there is always discussions

[1:33:14] about the dillon rule.

[1:33:16] Ecan oversee issues like this

[1:33:18] and prevent because many of you

[1:33:19] that supported the resolution

[1:33:21] measure in the beginning you saw

[1:33:23] the bigger pictures and there is

[1:33:24] more than mulch.

[1:33:26] It is about the whole notion of

[1:33:28] the localities being able to go

[1:33:31] in and retroactively enacting

[1:33:34] all kinds of ordinance and

[1:33:35] regulations on us and our

[1:33:36] citizens.

[1:33:37] And so with that, Mr. Speaker, I

[1:33:40] ask that we reject the

[1:33:42] governor's recommendations.

[1:34:22] then we need to make -- take

[1:34:25] into account things like the

[1:34:27] multifamily dwellings and so on

[1:34:29] that are -- that had the most

[1:34:30] problems.

[1:34:31] The fire services found that

[1:34:35] there were 835 total mulch fires

[1:34:36] during 2016 and 2017.

[1:34:38] Now we are sitting as a local

[1:34:39] government and we want to be

[1:34:41] responsible for how we adopt the

[1:34:42] fire services provisions for

[1:34:46] health and safety let's then

[1:34:47] accept the governor's

[1:34:48] recommendation and take out the

[1:34:50] areas where the greatest threat

[1:34:51] and concern exists.

[1:34:53] I would ask you, please tortion

[1:34:54] support the governor's

[1:34:59] recommendation.

[1:36:46] criteria listed.

[1:36:48] And then number six and number

[1:36:54] seven are cleanup language.

[1:36:55] Excuse me, five and six.

[1:36:57] And number seven revises the sub

[1:36:58] section on communities of

[1:36:59] interest requiring communities

[1:37:01] with similar social cultural and

[1:37:08] economic interests be

[1:37:08] considered.

[1:37:10] And then number eight adds two

[1:37:12] new criteria.

[1:37:13] The first protect the voting

[1:37:15] rights of minorities and the

[1:37:17] second prohibits districts from

[1:37:20] being drawn to favor or disfavor

[1:37:22] political parties and incumbent.

[1:37:24] And so, Mr. Speaker, I argue

[1:37:26] that the amendments push the

[1:37:27] redistricting process to be more

[1:37:30] just and more clearly defined

[1:37:32] and I offer that we do not have

[1:37:35] to wait for a court decision or

[1:37:38] wait for someone to tell us the

[1:37:41] minimum required standards for

[1:37:41] fairness.

[1:37:43] Previous court decisions that

[1:37:44] have already come down have set

[1:37:46] the precedent and we now have an

[1:37:48] opportunity today to approve

[1:37:49] these amendments and help

[1:37:52] protect our democracy and ensure

[1:37:55] all virginians' votes matter

[1:37:56] equally.

[1:37:58] I urge us to support the

[1:38:01] governor's amendments by voting

[1:38:06] no to encourage trust in the

[1:38:10] system and inspire more voter

[1:38:11] participation and not less.

[3:17:06] controversial until we started

[3:17:08] talking about the funding.

[3:17:10] It has become very controversial

[3:17:13] because it takes money out of

[3:17:15] nvta and out of local road

[3:17:16] projects and I don't understand

[3:17:18] why any delegate in this

[3:17:20] chamber, whether they are in the

[3:17:22] metro jurisdictions or not,

[3:17:24] would be against these metro

[3:17:25] funding sources because what

[3:17:28] it's going to do is drive

[3:17:29] northern virginia transportation

[3:17:31] projects into the smart scale

[3:17:33] system, competing with other

[3:17:36] projects around the state for

[3:17:36] money.

[3:17:38] This is a way to tax two small

[3:17:40] taxes on northern virginians,

[3:17:41] northern else in virginia.

[3:17:43] This is a way to -- and by the

[3:17:44] way, localities are all in favor

[3:17:45] of this.

[3:17:46] All of the localities are in

[3:17:49] favor of this because what the

[3:17:51] passed bill, the conference

[3:17:52] committee report does is take

[3:17:54] local money out of their system

[3:17:56] and will require them to raise

[3:17:58] taxes on their own citizens to

[3:17:59] do local road projects.

[3:18:02] And none of us want to do that.

[3:18:03] So Mr. Speaker, we should not

[3:18:04] pass this by.

[3:18:08] We should have a substantive

[3:18:09] debate on these amendments.

[3:24:14] announced they're going to be

[3:24:16] investing here, but if they were

[3:24:17] to be cut out from July, they

[3:24:19] would not be able to invest.

[3:26:32] premature to assume that this

[3:26:33] project is going to get off the

[3:26:37] ground.
