[0:02] Woo!
[3:54] » Mhm.
[4:56] » Thank you.
[4:59] It wouldn't have mattered if I hadn't
[5:00] been here. I'd still forget that.
[5:04] » Good evening.
[5:05] I'd like to welcome everyone to the
[5:08] August 6th, 2026 meeting of the Walton
[5:10] County Planning Commission.
[5:12] Uh thank you all for being here.
[5:15] I'm happy to be back. How many of y'all
[5:17] were watching TV in the '80s?
[5:21] Some of y'all with the same hair color
[5:22] as me didn't raise your
[5:24] Y'all didn't want to raise your hand,
[5:25] you know.
[5:26] How many of you remember Welcome Back,
[5:28] Kotter?
[5:29] Okay, here I am.
[5:30] I'm back after 2 months. Welcome Back,
[5:32] Kotter. I am glad to be here. I'm
[5:35] appreciative of Tim Camp, who is not
[5:37] here at the moment, uh but uh stepped in
[5:40] as chairman in my absence for 2 months.
[5:42] I greatly appreciate that, but I'm so
[5:44] pleased to be back and thank everyone uh
[5:47] else that has been here and been a part
[5:49] of uh decision making
[5:51] of the cases for the last couple of
[5:52] months.
[5:53] Uh this evening
[5:55] uh I want to let everybody know if if
[5:57] there is a time that you would like to
[6:01] gain knowledge of anything that's on our
[6:03] agenda and you can at can't attend, you
[6:06] can always join us on Walton County
[6:09] Facebook Live and view those meetings. I
[6:12] know Tracy
[6:14] in my absence, I tried one night and
[6:16] there was been a little bit of an issue
[6:18] with Facebook. Well, we got that
[6:19] corrected. So, we're up and everything's
[6:22] going well there.
[6:24] Our the meeting tonight, the cases that
[6:27] we hear tonight will be heard by the
[6:28] Board of Commissioners on September the
[6:30] 1st. The Planning Commission we will
[6:33] meet again on September the 3rd.
[6:36] Uh
[6:37] I'm going to go over a little bit of
[6:38] housekeeping real quick with you and
[6:40] this is part of
[6:42] what we try to do and keep in our
[6:44] meeting moving forward as best we can.
[6:47] So, I'm going to call and ask for the
[6:48] applicants for the cases to come up and
[6:51] give us the information as to what their
[6:53] requests are.
[6:54] Uh
[6:55] and then after I have done that, I will
[6:58] ask for any opposition. I set this aside
[7:01] for 10 minutes for each side. That's 10
[7:04] minutes for each side, not 10 minutes
[7:06] for each individual.
[7:07] So, obviously the applicant is usually
[7:09] one. The opposition could be multiple.
[7:13] If you guys could work with us either by
[7:15] having one person who speaks on behalf
[7:17] of a group or if you would be very
[7:21] mindful that there's others who want to
[7:23] speak and keep your uh comments as
[7:26] condensed as possible and then lastly
[7:29] if someone mentions something,
[7:32] uh it's not really necessary for someone
[7:34] else to come up and tell us the same
[7:36] thing over. What I would like to do is
[7:38] if someone comes up after someone has
[7:40] spoken that they would be able to convey
[7:42] something that we have not heard or
[7:44] concerned that we have not heard. So, if
[7:46] y'all could help us out with that, we
[7:47] would greatly appreciate it.
[7:50] And with that, I am going to ask Josh
[7:52] Ferguson if he'll open us in prayer.
[7:54] When he is finished with prayer, we're
[7:56] going to turn around and face the flag
[7:58] here and and have the pledge. If y'all
[7:59] would join us with that, we would
[8:00] greatly appreciate it.
[8:02] >> Let's pray.
[8:03] » Let's pray.
[8:03] Dear heavenly Father, Lord, we just come
[8:05] to you tonight thanking you for the um
[8:08] ability to be in good health enough to
[8:10] to come to this meeting. Uh Lord, we
[8:13] thank you for the uh privilege to be
[8:16] able to do do so.
[8:18] Father God, I just pray that tonight uh
[8:20] you will let cooler heads prevail and
[8:23] allow us um
[8:25] to make well-thought and meaningful
[8:27] decisions on behalf of the county.
[8:29] Uh Father God, I just ask all these
[8:31] things in Jesus' name I pray. Amen.
[8:33] >> Amen.
[9:02] All right, thank you guys. We really
[9:03] appreciate you doing that. At this time,
[9:05] I would like to show that all members
[9:07] are present with the exception of Tim
[9:09] Killop and Chris Alexander.
[9:12] So, those two are absent tonight.
[9:21] Before I open up the open uh the opening
[9:24] format uh public format of our meeting,
[9:26] I would like to ask if any of the
[9:28] representatives have any cases that they
[9:30] would like to table before I open public
[9:32] comment.
[9:36] None? Very good. At this time, if each
[9:39] one of you has had an opportunity to
[9:40] review our minutes from our last
[9:42] meeting, if you would please uh if
[9:45] there's no additions or alterations that
[9:47] need to be made, I will take a motion
[9:49] for approval or if there is something
[9:51] that needs to be modified, if you would
[9:52] please let us know.
[9:54] >> Motion to approve.
[9:56] » Motion to approve.
[9:56] >> I have a motion, do I have a second?
[9:57] » I have a motion, do I have a second?
[9:57] >> Second.
[9:58] » Second.
[9:58] >> All in favor, raise your right hand and
[9:59] » All in favor, raise your right hand and
[9:59] say, "Aye."
[10:00] >> Aye.
[10:01] » Aye.
[10:01] >> Thank you so very much.
[10:07] So, we do have um on our agenda for the
[10:11] evening, as I now will open the public
[10:14] portion of our meeting. Uh one case, uh
[10:17] old business, and we will be going to
[10:19] that first.
[10:25] So, this will be Z260159
[10:28] to rezone a portion of a parcel
[10:30] uh 4 acres from R1 to A1 to have
[10:32] personal outside animals. Applicant
[10:35] owner Fig Leaf Risk Advisors LLC,
[10:38] property located at 3084 Brooks Trail.
[10:42] Is that applicant here?
[10:43] >> Yes.
[10:44] » Yes.
[10:44] >> Okay, if you could step up to the podium
[10:46] » Okay, if you could step up to the podium
[10:46] and please tell us what your plans are
[10:48] or what you're trying to accomplish here
[10:50] with your zoning request.
[11:02] » Um good evening, Mr. Chairman and
[11:04] members of the Planning Commission. Uh
[11:06] my name is Michael Campbell
[11:08] and we thank you for the time to hear
[11:10] our requests. My wife and I are
[11:11] requesting approximately 4 acres
[11:14] of our 83-acre property to be rezoned
[11:16] from R1
[11:18] residential to A1. Our goal is simple.
[11:21] We want to use a small portion of our
[11:23] property as a hobby farm
[11:25] for our family while preserving the
[11:27] natural rural character of the land. The
[11:30] Homeowners Association publicly claimed
[11:33] that our property was subject to the HOA
[11:34] restrictions and stated that its
[11:36] attorney had prepared an opinion
[11:38] supporting that position.
[11:40] We respectfully requested a copy of that
[11:43] opinion so that we could better
[11:45] understand their position.
[11:47] But our request was denied.
[11:50] Because of the conflicting information,
[11:51] we sought legal counsel
[11:53] to better understand the issues
[11:55] surrounding our property.
[11:56] While these legal questions
[11:59] >> [clears throat]
[12:00] » [clears throat]
[12:00] >> are still unresolved, we've made every
[12:02] » are still unresolved, we've made every
[12:03] effort to be transparent
[12:06] and forthcoming by sharing the
[12:08] information and findings available to us
[12:11] throughout this process.
[12:13] I mention this only because it explains
[12:16] why there's been confusion surrounding
[12:18] our property.
[12:20] I understand the declarations itself is
[12:22] not the issue before you tonight.
[12:24] I'm not asking the commission
[12:26] to resolve the legal that legal
[12:28] question. My request this evening is
[12:30] simply for the rezoning
[12:32] of 4 acres based on the merits of the
[12:33] application.
[12:35] Turning to rezoning itself,
[12:37] >> [snorts]
[12:37] » [snorts]
[12:37] >> we believe this request is both
[12:39] » we believe this request is both
[12:39] reasonable and compatible with the
[12:41] surrounding area.
[12:44] We are seeking A1 zoning on only 4 acres
[12:47] of the land that exceeds 80.
[12:50] Much of the land surrounding is already
[12:52] zoned A1,
[12:54] making this request consistent with the
[12:56] nearby land uses.
[12:58] This is not a request for agricultural a
[13:00] commercial agriculture,
[13:02] a livestock operation,
[13:05] or an intensive use of the property.
[13:09] We simply want a small hobby farm
[13:12] with a limited number of animals for our
[13:14] families' enjoyment.
[13:16] The animals will remain in a fenced area
[13:20] on our property. The land where the
[13:22] animals will graze
[13:23] is simply approximately 200 ft from the
[13:26] nearest neighboring property line.
[13:28] We intentionally chose that location
[13:31] because
[13:33] it's closest to our residence,
[13:36] minimizes additional land disturbance,
[13:39] makes our daily care practical.
[13:42] This request will not increase
[13:44] residential density.
[13:46] It will not create significant traffic.
[13:50] It will not require additional public
[13:53] infrastructure.
[13:54] Instead, it will preserve open space
[13:57] and maintain the rural character that
[14:01] drew us to Walton County.
[14:04] We've worked diligently to comply with
[14:06] the county's requirements throughout
[14:08] this process.
[14:09] We've made every effort to be respectful
[14:12] of both our neighbors
[14:14] and the county.
[14:16] I understand that change can sometimes
[14:19] create concern.
[14:21] I simply ask this application be
[14:23] considered based on the facts before you
[14:26] and the planning merits of the rezoning
[14:28] request.
[14:29] We believe this is an appropriate,
[14:31] low-impact
[14:33] agricultural use that is compatible with
[14:36] the surrounding area and consistent with
[14:38] Walton County's
[14:40] rural heritage. Thank you for your time,
[14:43] your consideration, your service to the
[14:44] community,
[14:46] and we respectfully ask for your
[14:48] approval of our request.
[14:51] >> Thank you.
[14:52] » Thank you.
[14:52] At this time, just stay right there if
[14:54] you don't mind for sir. At this time, is
[14:56] there any questions from any of the
[14:58] board members for this applicant?
[15:01] >> To what extent
[15:03] » To what extent
[15:03] would the would the hobby farm be
[15:06] What what are you proposing?
[15:07] >> Um we're trying to do um four sheep,
[15:10] » Um we're trying to do um four sheep,
[15:10] four goats, and up to 12 chickens, and
[15:12] that would be the max. And we're just
[15:14] trying to graze the
[15:16] I'm sorry. Um four chickens I'm sorry.
[15:19] Four goats, four sheep, 12 chickens
[15:21] would be the maximum we're asking for.
[15:24] We only have three stalls, which is 440
[15:27] square feet of the barndominium would
[15:29] actually be allocated for animals, so
[15:31] it's a kind of a small space, so we
[15:33] really couldn't do any more than that in
[15:36] the barndominium.
[15:38] Um
[15:38] and it's really to graze the hill going
[15:42] down is a sloped hill, and it would keep
[15:44] us from having to use a tractor
[15:47] um or, you know, something else to
[15:50] graze that for us.
[15:55] » Thank you. Any additional questions?
[15:57] >> You currently live in the
[16:00] » You currently live in the
[16:00] the barndominium or in an adjoining
[16:03] home?
[16:04] >> Um our home is on the lot right next
[16:06] » Um our home is on the lot right next
[16:06] door. It's 3085 Brooks Trail on a 3-acre
[16:10] lot. Um the 86 acres only has the
[16:12] barndominium and we're using it um
[16:15] to help our family aging family members
[16:18] and um have small groups and stuff like
[16:20] that in it. So, it's not a like we're
[16:23] not going to be living in it.
[16:25] >> So, you won't have a a permanent
[16:27] » So, you won't have a a permanent
[16:27] residence at that barndominium?
[16:30] >> No, it will it will be in our
[16:31] » No, it will it will be in our
[16:31] possession, but not a residence.
[16:33] >> Okay.
[16:35] » Okay.
[16:35] >> I'm sorry, I'll talk up. I'm sorry.
[16:41] » Josh, uh
[16:43] I I don't know if it's worthy, but maybe
[16:46] whoever could not hear the last reply,
[16:48] if you want to repeat what the applicant
[16:50] said there to your question.
[16:51] >> Sure. Um the barndominium will not be
[16:54] » Sure. Um the barndominium will not be
[16:54] used for our um residence. We built it
[16:58] our aging parents um live in Idaho, and
[17:00] we wanted to provide a spot for them. Um
[17:03] you know, if they want to snowbird here,
[17:05] um and also, you know, when family comes
[17:07] into town, it's primarily a residence,
[17:11] and then we have a large garage area
[17:13] that's um heated and cooled, not
[17:15] appropriate for animals, that will be
[17:17] used for like a small group space or
[17:20] um if we ever had, you know, a vehicle
[17:22] or something that we needed to store
[17:23] there.
[17:27] » Okay. Any other questions?
[17:30] >> But the only access you have is through
[17:32] » But the only access you have is through
[17:32] the community, right?
[17:34] >> It is.
[17:34] » It is.
[17:34] >> nothing out to 81
[17:36] » nothing out to 81
[17:36] >> Correct.
[17:37] » Correct.
[17:37] >> Correct. And um our house is the only
[17:39] » Correct. And um our house is the only
[17:39] house on the cul-de-sac, so we do share
[17:42] one side of the cul-de-sac is our
[17:44] driveway to our residence, the other
[17:46] side of the driveway is to the
[17:48] barn-dominium.
[17:49] Um and I know that some of you may be
[17:52] concerned about the gravel, um and we
[17:54] will address that. We are it's part of
[17:56] the building process um that we will
[17:59] make an apron, make sure that that
[18:01] gravel is taken care of.
[18:03] >> The barn-dominium, did you
[18:05] » The barn-dominium, did you
[18:05] It don't really go with a community over
[18:08] there. Did y'all go through the HOA to
[18:09] get approval of what you built?
[18:11] >> We did. We We did not think that we were
[18:14] » We did. We We did not think that we were
[18:14] subject to the
[18:16] um HOA covenants, but as a courtesy, we
[18:19] did go to the HOA and ask for a metal
[18:21] building to be built um that size and
[18:24] approximately that location. We did have
[18:27] to turn the building, and I do have a
[18:29] I might have I don't know if I actually
[18:31] added it to your paperwork, but we did
[18:33] have to turn the building. I think it's
[18:34] like
[18:36] maybe 35° or 40° from where we said it
[18:39] would be.
[18:40] Um it does make it slightly more
[18:41] visible, unfortunately, because we
[18:43] turned it a little bit. And I know that
[18:45] that's a concern that we are hoping to
[18:47] address um and hoping we can talk to the
[18:50] HOA board about that, which we've never
[18:52] had any communication with the HOA board
[18:55] about this yet, the current sitting
[18:57] board.
[19:00] » Okay. Thank you.
[19:03] Anyone else?
[19:05] I've got a few questions, but I'm going
[19:06] to bring them I'm going to hold them for
[19:08] uh your time of rebuttal. So, we
[19:10] appreciate it. You guys can have a seat.
[19:13] Is there anyone here tonight in
[19:14] opposition to this request?
[19:20] All right. So, obviously I can't give 10
[19:23] minutes to each one of y'all out there.
[19:24] Hopefully y'all have somebody who can
[19:25] speak on their path or the ones that I'm
[19:27] going to call up can be timely.
[19:30] Yep. Okay. So, or by you standing, does
[19:32] that mean you're walking?
[19:35] Come to the podium, give us your name,
[19:37] address, and then state your concerns.
[19:46] » Uh Mr. Chairman, my name is Ed Fair and
[19:48] my mother and I live
[19:49] in the neighborhood, 1620 Bluff Creek
[19:52] Trail.
[19:53] And we're here in opposition to the
[19:56] rezoning.
[19:58] If you look at the application for this
[20:00] rezoning, I think it's page 10
[20:03] on tonight's agenda.
[20:05] The reason says, quote,
[20:08] "To allow appropriate tax classification
[20:11] for the structure
[20:13] and to permit raising farm animals on
[20:15] the property."
[20:16] End quote.
[20:19] A little bit about that structure.
[20:22] It's already built.
[20:25] It's quite large and it's far out of
[20:27] character in the neighborhood.
[20:30] And it was built despite much opposition
[20:33] from the neighbors.
[20:39] If the owner didn't understand the tax
[20:41] implications of building his structure,
[20:43] that's on him.
[20:46] And if he didn't understand the
[20:47] livestock restrictions on his property,
[20:50] that's on him, too.
[20:53] So, now he's trying to turn his problems
[20:56] into our problems.
[20:59] So, even if he promises only to do
[21:02] one, two, and three with the property
[21:04] today, there's nothing to stop him or
[21:07] the next owner in the future
[21:10] from doing five, six, and seven,
[21:12] eight, nine, and 10.
[21:14] For example,
[21:16] put a cell phone tower up.
[21:20] Put some electrical lines through the
[21:21] neighborhood.
[21:24] Or open a Airbnb.
[21:32] So, it's for these reasons that we
[21:35] would ask you to
[21:37] deny the application. Thank you.
[21:39] >> Thank you, sir.
[21:46] Well, you jumped up, so I don't know
[21:47] what I'm going to tell you now. I don't
[21:48] know.
[21:49] I may I I'm not Once you jump up, I
[21:51] ain't going to tell you no. What would
[21:52] your husband tell you?
[21:54] >> He doesn't tell me no.
[21:55] » He doesn't tell me no.
[21:55] >> Okay.
[21:56] » Okay.
[21:56] >> Um my name is Jessica Seifert. I live in
[21:59] » Um my name is Jessica Seifert. I live in
[21:59] Alcovy Bluff.
[22:00] Um
[22:01] many of our neighbors has have asked me
[22:03] to speak tonight on their behalf
[22:05] regarding this rezoning request. Um
[22:09] thank you for the opportunity to speak.
[22:11] Um we as a community respectfully ask
[22:14] that you deny this request to rezone
[22:16] these four acres of the property from R1
[22:18] to A1.
[22:20] Um this is not about opposing anyone's
[22:22] desire to own farm animals or have a
[22:24] hobby farm. We respect private property
[22:27] rights.
[22:28] Um
[22:29] we also understand that the county has
[22:31] the authority to approve this request if
[22:32] it determines it is appropriate.
[22:34] However, with that authority comes the
[22:37] responsibility to consider whether the
[22:38] proposed zoning is compatible with the
[22:41] surrounding area, serves the public
[22:43] interest, and will benefit not only the
[22:45] applicant, but the surrounding
[22:47] community.
[22:48] Tonight's decision will affect far more
[22:50] than one property owner.
[22:52] So, I do have a picture here. Um it's an
[22:55] aerial photograph from Google Maps. Um
[22:57] and it shows why this request is
[22:59] different. I probably should have given
[23:00] it to you beforehand, but it shows that
[23:02] there's only one entrance. There's only
[23:04] one way to access this property.
[23:07] And so while there are agricultural
[23:08] properties, I know he said there are
[23:10] many agricultural properties surrounding
[23:12] the area, those are not accessed through
[23:14] Alcove Bluffs.
[23:15] Um they're accessed from outside roads.
[23:19] So any future use of this property will
[23:22] directly affect the families who live
[23:23] there every day.
[23:25] There are more than 160 families
[23:27] invested in Alcove Bluffs because it is
[23:29] an established residential community.
[23:32] The application states that the purpose
[23:34] of this rezoning is to allow a
[23:35] residence, pasture, a barn with animal
[23:37] stalls, and an orchard and garden for
[23:39] personal use. It sounds harmless and we
[23:42] respect those intentions. However, A1
[23:45] zoning stays with the land, not the
[23:47] owner.
[23:48] Today's proposal may be for personal
[23:50] use, but your decision will affect every
[23:52] future owner of this property.
[23:55] So in the rezoning application, it also
[23:57] says that um this property is not part
[24:00] of a subdivision.
[24:01] And we did have um a title search done.
[24:04] I have that um certificate. I did submit
[24:07] that to the county for y'all's um review
[24:10] beforehand.
[24:11] Um happy to give it to you also. Um and
[24:15] and the entire community, but I did
[24:18] send a message out to the community with
[24:20] a summary of that that said exactly what
[24:22] it was. So um
[24:26] We've also been told by the county that
[24:28] enforcing private covenants is
[24:30] ultimately the responsibility of the HOA
[24:32] and I completely understand that. Uh
[24:34] we're not asking you to enforce our
[24:36] covenants.
[24:38] But we do not believe that lessens the
[24:40] commission's responsibility to make its
[24:42] recommendation based on complete and
[24:44] accurate information.
[24:46] So um
[24:49] We simply ask that the commission
[24:50] carefully consider all of the relevant
[24:52] information before making a permanent
[24:54] zoning recommendation.
[24:56] While the Campbells did request approval
[24:58] for the barndominium
[25:00] from the HOA, they did not approach the
[25:02] current board with their intentions
[25:04] before requesting this rezoning.
[25:06] We learned about it when you put the
[25:08] signs up.
[25:09] Um also,
[25:12] many homeowners are concerned because of
[25:14] what has already occurred on this
[25:16] property. When the approval for the
[25:17] barndominium was requested from the HOA
[25:20] board, the written request stated that
[25:21] the structure would be positioned so
[25:23] that it would not be visible from the
[25:25] street.
[25:26] Today, the completed structure is
[25:28] clearly visible from Brooks Trail.
[25:31] Particularly during the winter months
[25:33] when the trees have no leaves.
[25:35] Because of that experience, many
[25:36] homeowners are asking the commission to
[25:38] carefully consider not only the
[25:39] applicant's current intentions, but also
[25:41] the long-term consequences of
[25:43] permanently changing the zoning of this
[25:44] property.
[25:46] Through records obtained from Walton
[25:47] County open records requests,
[25:49] many open records requests, sorry. Uh
[25:52] we were unable to identify another
[25:54] barndominium approved on R-1 zoned
[25:56] property. While every application should
[25:59] be considered individually, this appears
[26:01] to be an unusual situation that has
[26:03] affected many homeowners in our
[26:04] community.
[26:06] Tonight's decision isn't about a
[26:07] barndominium, but it's also not just
[26:09] simply about 4 acres either.
[26:12] It's about balancing the rights of one
[26:13] property owner with the impact on an
[26:15] established residential community.
[26:18] We can't go back and change the
[26:19] decisions that have already been made on
[26:20] this property,
[26:22] but the commission does have the
[26:23] opportunity to shape what happens going
[26:25] forward. We respectfully ask that you
[26:27] preserve the residential character of
[26:29] Alcove Bluffs by denying this rezoning
[26:31] request.
[26:32] Thank you for your time and your
[26:33] consideration and also your service to
[26:34] Walton County.
[26:35] >> Thank you.
[26:38] Thank you. Uh any questions for this
[26:40] person that's in opposition here?
[26:43] Thank you, ma'am.
[26:44] Who else uh Who has something to state
[26:47] about this request that has not yet been
[26:49] stated because
[26:51] from now on, we're getting close to our
[26:53] time limit. If I start hearing things
[26:55] that's going to be stated, I'm either
[26:57] going to ask you to move on or let
[26:58] somebody else come up, okay? So, just
[27:00] give me something different. That's all
[27:02] I'm asking for.
[27:04] Sir, state your name, your address, and
[27:06] tell us what your concerns are.
[27:08] >> Dan Reynolds. I'm at uh 1490 1429 Bluff
[27:12] » Dan Reynolds. I'm at uh 1490 1429 Bluff
[27:12] Creek Trail in Alcovy Bluff subdivision.
[27:15] Um
[27:17] what I think it's important to note is
[27:18] that once this rezoning does go into
[27:21] place, and even though we've been told
[27:24] this evening there's going to be a
[27:25] couple of chickens, maybe a goat, and a
[27:27] dog,
[27:28] the zoning does provide for large hoofed
[27:31] animals,
[27:33] horses, cows, etc. And they can be two
[27:38] per fenced acre. That means on 4 acres,
[27:41] we can have up to eight of any one of
[27:43] those. Also, multiple when it comes to
[27:47] goats, sheep, etc., you can have up to
[27:50] eight per acre. Now, what concerns us is
[27:54] not necessarily what happens tomorrow,
[27:56] but what happens next year because once
[27:58] the zoning takes place,
[28:01] these rules are in place forever. That
[28:03] someone could take over this piece of
[28:05] property and basically start not a hobby
[28:08] farm, but a real farm. One thing to
[28:10] note, if cattle's put on there, just
[28:12] eight cows produce,
[28:15] and I used Walton County Extension
[28:18] Service University of Georgia to get
[28:20] these numbers, but at 4,500 lb per
[28:24] month,
[28:25] four head of cattle produce 36,000
[28:28] lb of waste each and every month.
[28:32] What's going to happen to that waste?
[28:34] Where does it go?
[28:35] Back through our neighborhood?
[28:38] Or is Or is that property going to be
[28:40] able to sustain that?
[28:42] Um the prevailing winds there come off
[28:44] that property
[28:46] uh
[28:47] being west
[28:49] by northwest back through the
[28:50] neighborhood each and every day and
[28:53] that's also given to me
[28:55] >> [clears throat]
[28:55] » [clears throat]
[28:55] >> by the extension service.
[28:57] » by the extension service.
[28:58] Uh community health effects from those
[29:00] who live within 200 ft of this can can
[29:03] be quite uh
[29:06] it can be a problem when you have this
[29:09] type of waste taking place.
[29:12] Elderly people, small children, asthma,
[29:14] COPD, etc. There are lots of reasons not
[29:18] to let this go to an A1 configuration
[29:21] where you can have that many animals on
[29:23] that piece of land
[29:25] be it tomorrow or 2 years from now.
[29:28] There are too many people that live
[29:30] within 200 ft of this.
[29:32] Thank you for your time.
[29:35] >> Thank you, sir.
[29:38] All right, now two of y'all jumped up
[29:40] same time.
[29:45] Okay.
[29:46] State your name and address. Tell us
[29:48] what you have.
[29:48] >> Clinton Bostwick, 1609 Bluff Creek
[29:51] » Clinton Bostwick, 1609 Bluff Creek
[29:51] Trail.
[29:53] And I
[29:54] I have a
[29:55] a summary of what y'all basically
[29:56] already heard. I'd like to pass it to
[29:58] y'all guys if that's cool.
[29:59] >> Yeah, that's fine.
[30:05] » Thank you.
[30:10] » Thank you, sir.
[30:11] >> Thank you.
[30:17] I'm sorry.
[30:21] So basically that's a summary of what
[30:23] you've already heard or some of it
[30:24] tonight. And I have 75 signatures
[30:27] that the neighbors signed to that
[30:30] that that basically agreed with those
[30:33] statements.
[30:33] >> Do you have those signatures with you?
[30:35] » Do you have those signatures with you?
[30:35] >> Yes.
[30:35] » Yes.
[30:35] >> Would you please hand them to Ms. Tracy?
[30:41] » Thank you for your time.
[30:41] >> Yep, thank you. Sir.
[30:47] Tell me something I haven't heard.
[30:49] New and improved.
[30:51] >> Uh my name's David Johnson. I live at
[30:53] » Uh my name's David Johnson. I live at
[30:53] 1625 Bluff Creek Trail, and I'm a
[30:56] 20-year resident of Bluff Creek, and
[30:58] before that lived in a neighborhood in
[31:01] Loganville with no HOA, and it was the
[31:04] suburban wild west. It was anything
[31:06] goes, and when we finally escaped there,
[31:09] we lost tens of thousands of dollars in
[31:11] equity because of what other people were
[31:13] just
[31:15] willingly allowed to do.
[31:17] And that's our concern here as we're
[31:18] dealing with this.
[31:20] >> I'm sorry, yes. And that's our concern
[31:21] » I'm sorry, yes. And that's our concern
[31:21] here as we face the situation. As people
[31:24] have said, they we know what the plans
[31:26] have been stated for this, but they've
[31:28] been very fluid and vague throughout,
[31:31] and we're not really sure what could
[31:32] happen, but we do know one thing that
[31:35] that's of concern, and the bottom line
[31:37] is this is that
[31:39] the plans could potentially be very
[31:40] beneficial
[31:42] for the owner and whatever they plan to
[31:44] do,
[31:45] but for the rest of the community, for
[31:46] all the rest of the people,
[31:48] it's going to have zero benefit, and the
[31:50] fact is it could potentially have a very
[31:53] negative impact on us and on what is for
[31:56] most of us our biggest investment. So,
[31:58] with
[31:59] that being said, we do request that you
[32:02] not allow the rezoning to go through.
[32:04] Thank you.
[32:07] Thank you, sir.
[32:08] Is anyone who has something new to add
[32:11] that's here in opposition that I we as a
[32:14] board have not heard?
[32:15] Yes, ma'am.
[32:17] Please come to the microphone, state
[32:19] your name and address, and then tell us
[32:20] what you have.
[32:28] » Linda Dudish, 1601 Bluff Creek Trail. I
[32:31] just want to remind I don't I haven't
[32:34] heard every
[32:36] every person, but I don't it has been
[32:37] brought up. This actually impacts three
[32:41] different cul-de-sacs, not just one,
[32:44] which is next to the house,
[32:46] um the actual resident
[32:49] residents. And then the other thing was
[32:52] that
[32:53] we were told
[32:54] we would not be able to see the
[32:56] barndominium.
[32:58] And this is part of the permit.
[33:01] But the barndominium is already built,
[33:03] and it's very visible.
[33:05] That's all.
[33:06] >> Thank you.
[33:08] » Thank you.
[33:08] Anyone else?
[33:13] All right, thank you so much. Sir, I'm
[33:15] going to ask that you come back up for
[33:17] rebuttal.
[33:32] » Um I think that some Go ahead.
[33:34] >> Yeah, pull it. Yeah, you're you're kind
[33:36] » Yeah, pull it. Yeah, you're you're kind
[33:36] of tall there.
[33:37] >> Um I think that some of um
[33:40] » Um I think that some of um
[33:40] the concerns about um if we are in the
[33:43] HOA and within the restrictions, and we
[33:46] understand if we are in the HOA and
[33:48] we're in the restrictions, obviously we
[33:50] will not have animals. This is only um
[33:53] if the lawyers find that we are indeed
[33:57] outside of the covenants, um which right
[34:00] now is still
[34:02] am- ambiguous. We're still doing our
[34:05] research to figure that out. Um also, I
[34:08] did want to say that there is a petition
[34:11] with lots of signatures, and I do
[34:13] believe there was a lot of signatures
[34:15] there with information that wasn't
[34:17] accurate. I know that there was a rumor
[34:19] going around that it was a petting zoo
[34:22] um that we were trying to have there,
[34:24] and without um a number of other um
[34:29] um approval,
[34:31] we can't do a petting zoo at 81. That
[34:34] was never our intent um and that's
[34:37] something that would go through more
[34:39] scrutiny and more regulations and we
[34:41] just we wouldn't be able to do that and
[34:43] um
[34:45] we also did try to approach the board.
[34:48] At this point, we've never talked to
[34:50] anybody on the HOA the current sitting
[34:52] HOA board, although we've reached out um
[34:55] twice through email.
[34:57] I think
[34:58] >> Also, my cell phone has been on the
[35:01] » Also, my cell phone has been on the
[35:01] thread for every single neighbor to
[35:04] call. Two have called.
[35:07] Two.
[35:09] >> Thank you.
[35:09] » Thank you.
[35:09] >> Um we've also we've also um
[35:13] » Um we've also we've also um
[35:13] um approached the um
[35:15] the um
[35:18] I think we have approached the HOA
[35:20] president um via text and phone and um
[35:25] the management company, although I know
[35:27] they're not the current management
[35:28] company, but we have approached them and
[35:30] they said that they would not be sharing
[35:32] any information with us. So um
[35:36] yeah, we've made attempts and I do
[35:38] understand that um seeing
[35:41] the the barn is distressing for a lot of
[35:44] people and we do want to address that
[35:46] and we know that you know
[35:48] possibly putting up a gate is something
[35:50] that might help, but without
[35:53] communication with the board um HOA
[35:55] board, we wouldn't want to do anything
[35:57] like that and we have planted um some
[36:01] some shrubs and stuff that will grow and
[36:03] hopefully it will at some point
[36:05] completely be obstructed from any view
[36:08] from any cul-de-sac. Um and then also um
[36:12] we did get
[36:15] an evaluation
[36:16] of our property from a very reputable
[36:20] real estate agent and I'd like to share
[36:22] that information with you guys. Um right
[36:24] now the barndominium will be valued um
[36:28] as the highest um
[36:30] the
[36:32] Yeah, it'll be the most expensive
[36:33] structure in the neighborhood if it's
[36:34] sold for what the real estate agent is
[36:37] asking.
[36:38] >> This this structure
[36:40] » This this structure
[36:40] will bring the value of the neighborhood
[36:42] up.
[36:43] That's what we need to say.
[36:45] >> Right.
[36:46] » Right.
[36:46] So,
[36:48] uh I'm going to ask while they're up
[36:49] here if you guys can kind of help me
[36:52] out.
[36:53] Don't Okay, if you can't hear, you can
[36:55] let us know you can't hear, but uh
[36:57] please no outburst. They were very
[36:59] polite. They sat over there while you
[37:01] spoke in opposition and didn't
[37:03] interrupt. And for you guys to
[37:05] ad-lib while they're up there, I think
[37:07] it's a little bit disrespectful. So, if
[37:09] you could help us with that, I'd
[37:10] appreciate it.
[37:12] >> Sir, can I mention one other thing, too?
[37:14] » Sir, can I mention one other thing, too?
[37:14] >> Sure.
[37:15] » Sure.
[37:15] >> So, on the communication to the board
[37:19] » So, on the communication to the board
[37:19] on the communication to the board on the
[37:21] Facebook page, there is a communication
[37:24] that went out to the HOA.
[37:26] And in that communication,
[37:29] there is a
[37:33] a notice saying if we wanted to get the
[37:36] results
[37:37] of a legal opinion,
[37:40] it was right there.
[37:42] You can ask for it and we'll give it to
[37:44] you. Within 5 minutes, I asked for it.
[37:48] And I did not hear any communication,
[37:50] and then later on, it was denied.
[37:54] And so, in this process, we've tried to
[37:56] be communicative.
[37:59] We've We're sick over this. This has
[38:02] been a
[38:04] terrible situation, and we are nervous
[38:07] as all get out. And we have tried to be
[38:11] respectful of these Facebook boards that
[38:14] have said terrible
[38:16] incorrect information.
[38:19] This has not been a hard an easy process
[38:21] for us.
[38:22] And in it we've tried to be kind
[38:25] throughout it.
[38:29] And we operated with the information
[38:31] that we had. That's it.
[38:35] » Thank you.
[38:37] Um I've got a couple of questions for
[38:38] you and I'll open it up to any of the
[38:40] other board members have a question as
[38:41] well.
[38:42] Um
[38:45] I'm going to make some assumptions just
[38:48] to asking you if you could just kind of
[38:49] answer these because they're just
[38:51] helping me filter things through my
[38:52] mind.
[38:54] Um you guys purchased this property and
[38:56] when you did so
[38:58] you went to an attorney's office for a
[39:01] closing.
[39:03] And
[39:04] for whatever
[39:06] sum you paid for the property you were
[39:08] given a deed to this property. Is that
[39:10] correct?
[39:11] >> Yes, sir.
[39:11] » Yes, sir.
[39:11] >> Was that deed for the entirety or was it
[39:14] » Was that deed for the entirety or was it
[39:14] in different parcels?
[39:16] >> There's two parcels.
[39:17] » There's two parcels.
[39:17] >> But so so you were given deed to two
[39:20] » But so so you were given deed to two
[39:20] separate parcels.
[39:21] >> Correct.
[39:21] » Correct.
[39:21] >> Okay.
[39:22] » Okay.
[39:22] >> Correct.
[39:22] » Correct.
[39:22] >> Did
[39:25] » Did
[39:25] in remembrance of that
[39:29] do you remember that either of those
[39:30] parcels were identified by a lot number
[39:33] regarding the neighborhood?
[39:36] >> S- Sir, I I can't answer I don't know.
[39:38] » S- Sir, I I can't answer I don't know.
[39:38] >> Okay. Thank you. I I'm I'm just all I
[39:40] » Okay. Thank you. I I'm I'm just all I
[39:40] want you to do is answer what you know,
[39:42] okay?
[39:43] >> Yes, sir.
[39:43] » Yes, sir.
[39:43] >> There is not a plat
[39:44] » There is not a plat
[39:44] >> Were you
[39:45] » Were you
[39:45] Sir, were were you given uh a title
[39:48] policy at closing a title insurance
[39:49] policy at closing?
[39:51] >> Yes, sir.
[39:51] » Yes, sir.
[39:51] >> Thank you.
[39:58] I think that's probably all the
[39:59] questions I have uh
[40:02] for you guys at this time. Does any
[40:04] other board members have any other
[40:05] questions?
[40:07] Uh I do have one more.
[40:09] Has your use of the property from when
[40:11] you initially bought it what your intent
[40:13] to do with that property? Has it changed
[40:14] from the time that you bought it till
[40:16] today?
[40:17] >> No, sir.
[40:18] » No, sir.
[40:18] >> So, you intended in the very beginning
[40:20] » So, you intended in the very beginning
[40:20] to have animals?
[40:22] >> No. We
[40:23] » No. We
[40:23] we did not like we knew we wanted to use
[40:26] the land in some way.
[40:28] Um
[40:29] >> So, just give me a yes or no. Was it the
[40:31] » So, just give me a yes or no. Was it the
[40:31] day you bought it, did you intend to
[40:32] have animals?
[40:33] >> No.
[40:35] » No.
[40:35] >> She said no.
[40:36] » She said no.
[40:36] >> [laughter]
[40:37] » [laughter]
[40:37] >> She's the boss.
[40:37] » She's the boss.
[40:37] >> Right. Well, I mean, you know, it's just
[40:39] » Right. Well, I mean, you know, it's just
[40:39] a honest real quick question, so no. So,
[40:41] what that tells me is that since you've
[40:43] owned the property there's been a change
[40:45] of something that you guys have done
[40:47] that you've had a change. You want to do
[40:48] something different that
[40:50] you got a large piece of property in
[40:51] back of you there, too, so
[40:52] >> Use it.
[40:53] » Use it.
[40:53] >> All right, very good. Any other
[40:55] » All right, very good. Any other
[40:55] questions from any other board members?
[40:56] >> I have one.
[40:57] » I have one.
[40:57] >> Okay.
[40:58] » Okay.
[40:58] >> Uh
[40:59] » Uh
[40:59] correct me if I'm wrong, did you uh make
[41:01] a statement that
[41:02] you went through the HOA as far as the
[41:05] location of the barndominium and they
[41:07] requested it to be changed, the
[41:09] direction of it?
[41:11] >> No, um there's a piece of paper. I
[41:12] » No, um there's a piece of paper. I
[41:12] handed it to you. Um initially we had
[41:15] told the HOA that it was going to be um
[41:17] in that little yellow square on that
[41:19] paper that I gave you. Um and then we
[41:21] did have to rotate it because the grade
[41:24] of the land was too sharp. We couldn't
[41:26] actually get a stable enough foundation.
[41:28] So, we did have to rotate the barn a
[41:30] little bit, but um that was that was a
[41:32] change that we made that um was
[41:34] different than the HOA. But at the time
[41:37] we honestly thought that the HOA we were
[41:39] only being considerate and that we
[41:41] didn't actually have to get their
[41:42] approval. Um we were under the
[41:45] assumption, well, not assumption. I
[41:47] mean, it's even on um some of the Q
[41:50] public says we're not in the HOA. Um and
[41:54] plats that say we're not in the HOA and
[41:55] our deed that says we're not in the HOA.
[41:57] Um so, we did not think at the time that
[41:59] we were in the HOA.
[42:02] >> Okay, thanks.
[42:02] » Okay, thanks.
[42:02] >> Okay, thank you.
[42:04] » Okay, thank you.
[42:04] Any other questions?
[42:07] Thank you all. We appreciate it.
[42:13] Mhm.
[42:16] » Yeah.
[42:17] So, is there anyone here
[42:19] >> [clears throat]
[42:20] » [clears throat]
[42:20] >> who would be a proponent of the
[42:21] » who would be a proponent of the
[42:21] applicant that would speak on their
[42:23] behalf that is in favor of what they're
[42:25] doing? Or their request?
[42:28] All right, thank you.
[42:29] So, at this time I'm going to
[42:31] close the
[42:32] public comment section
[42:34] uh
[42:35] for this request.
[42:38] Uh I I
[42:40] have a lot of stuff in
[42:41] this this came to me. I wasn't here last
[42:44] meeting. This was table.
[42:45] Uh it came to me this afternoon. Uh I
[42:48] have talked to multiple individuals this
[42:51] afternoon
[42:52] um regarding this case. Uh it's it's
[42:56] quite odd.
[42:58] I'm I'm going to look at this in three
[43:00] different objective views.
[43:02] One is I sit here as the chairman for
[43:04] the planning commission. One
[43:07] uh 28 years as a licensed realtor.
[43:10] And thirdly,
[43:11] uh
[43:12] as a member of the community. So, I kind
[43:15] of have
[43:16] three different I live a very short
[43:17] distance from this property.
[43:20] Um
[43:24] One thing that I asked questions
[43:27] initially. I called Christie this
[43:29] afternoon.
[43:31] And my question was
[43:34] Chris Christie, was there a final plat
[43:37] for the neighbor neighborhood recorded?
[43:40] And obviously, if you guys are living in
[43:41] houses there, the answer is yes because
[43:44] you could never get title to a property
[43:46] without a recorded plat. That's where
[43:48] the final recorded plat
[43:51] indicates every lot that's in that
[43:53] neighborhood and has a ton of notes that
[43:54] are required by the development
[43:56] department. It also shows each and every
[43:58] lot usually on a sidebar.
[44:00] It will indicate each lot in that
[44:01] neighborhood.
[44:03] My second question to Christie was
[44:07] was the partial or any portion of the
[44:10] partial
[44:11] that is the request has been made for
[44:14] tonight. Was any of either of those
[44:16] partials given a lot number?
[44:19] And Christie's answer was no.
[44:22] I actually have in front of me while
[44:24] we're sitting here. I just cuz I have
[44:25] quick access to it. I've pulled up the
[44:27] tax records.
[44:29] And
[44:31] I'm not going to say exclusively because
[44:33] that would be a bit unfair.
[44:35] Um but I will say predominantly
[44:38] if I pull a tax record up and the
[44:41] property I'm looking at is part of any
[44:44] neighborhood
[44:46] the name of the neighborhood is listed
[44:49] on the tax report.
[44:51] Neither of the partials, whether it be
[44:53] the large partial they have or the
[44:55] smaller partial which is being requested
[44:57] tonight, neither of those pop up with a
[44:59] subdivision name.
[45:03] Um I just told you in what capacity I'm
[45:06] viewing this. So the one I did not
[45:07] mention and there's a fine lady sitting
[45:09] out here with a blue dress on
[45:11] uh
[45:12] who would remind me quickly I'm not an
[45:13] attorney.
[45:15] Um
[45:16] but after attending
[45:19] hundreds and hundreds of closings
[45:22] I will say there are certain things that
[45:24] take place that we
[45:26] adhere to and acknowledge.
[45:29] And one of those is that as we have
[45:32] clients who purchase in neighborhoods
[45:34] that's tell us, "Hey, we would like to
[45:36] have
[45:37] a survey of our lot where we can install
[45:41] a fence." Our reply is, "That's on a
[45:44] final plat that's recorded for the
[45:46] entirety of the neighborhood that shows
[45:48] all of the lots and you can do so by
[45:50] contacting a surveyor.
[45:53] They will reference the final plat, find
[45:55] your lot, find the dimensions, stake
[45:57] your lot, build your fence, but you have
[45:58] to go
[46:00] and you have to find the final plat. It
[46:01] shows every lot. If you're looking at a
[46:04] 5-acre out parcel, obviously it's going
[46:06] to only show that 5 acres. There's just
[46:08] one parcel. But in subdivisions, they're
[46:11] recorded as a
[46:14] final plat recording. At that time, also
[46:16] deemed necessary would be if there's
[46:19] going to be HOA or covenants that those
[46:21] HOA that that the covenants would be
[46:23] recorded at the same time.
[46:25] The covenants would be applicable only
[46:28] to in most cases, the lots that are
[46:31] referenced on the plat that's being
[46:32] recorded. It would be frivolous for
[46:36] someone to put a neighborhood next to my
[46:37] house
[46:39] and then the HOA of that neighborhood
[46:42] want to impose
[46:44] their covenants on me because I'm not
[46:47] listed on the plat.
[46:49] So, in asting asking Christie
[46:53] if their lot or their property is shown
[46:56] on the final recorded plat for the
[46:57] neighborhood and the answer being no,
[47:00] then the only assessment I can make,
[47:03] not being an attorney, but just trying
[47:05] to conceptually understand things,
[47:08] is that there should not be any
[47:09] adherence by them if they're not on that
[47:12] final recorded plat. I mean, that's just
[47:14] me trying to use common logic.
[47:17] So,
[47:18] I I take that and then I start looking
[47:22] at other things. And some of those being
[47:26] the question that I ask,
[47:29] "Was your intent when you bought the
[47:31] property to have animals?" No.
[47:33] "Well, do you have the right to change
[47:34] your mind?" Certainly.
[47:37] I've I've changed the use of my
[47:38] property. I didn't have to change the
[47:39] zoning, but I've changed the use of it
[47:41] several times. You know, I used to have
[47:42] cattle, now I don't. I do other things.
[47:44] I mean, I you know, I just changed the
[47:46] use of my property. So,
[47:48] uh do I have the right to do that? Yeah,
[47:50] I mean, I feel like I have a right. It's
[47:51] my property. I paid for it, paying taxes
[47:53] on it. So, I should have a right to use
[47:55] it in the manner I wish to use it.
[47:58] Um
[47:59] So,
[48:01] I'm I'm trying to just build in my mind
[48:03] as I'm looking at this and then
[48:06] I'm thinking about the rest of my agenda
[48:07] tonight. I'm not trying to give fuel to
[48:10] the fire,
[48:12] but I have a couple of subdivision
[48:13] requests tonight where we're going to
[48:15] hear cases that are asking to be rezoned
[48:18] from A1
[48:20] to R1 for a neighborhood.
[48:23] Uh I would like your participation in a
[48:25] little bit if any of y'all can remember
[48:27] that and your tenure in the neighborhood
[48:28] is long enough.
[48:30] Uh about 4 years ago, there was a
[48:31] request to rezone 142 acres at the
[48:34] corner of 81 and Double Springs Road to
[48:37] R1 for a neighborhood. How many of y'all
[48:39] remember that by raising your hand?
[48:42] How many of you were opposed to it?
[48:46] One guy. Come on, y'all be honest with
[48:47] me now. How many of you Yes, ma'am, you
[48:49] raised yours halfway. You must be
[48:51] Baptist.
[48:53] Uh
[48:54] So, here's where I'm going.
[48:58] I'm going to have people tonight who are
[49:00] going to come to the podium as you guys
[49:02] did,
[49:03] and they're going to tell me why
[49:07] I should really contemplate not allowing
[49:09] the use of a subdivision on an
[49:11] agricultural property
[49:13] on the same night that I've got
[49:15] someone who is wanting
[49:18] to take a piece of property that's zoned
[49:20] as a {quote} subdivision R1 and change
[49:24] it to agricultural.
[49:26] Secondly, the 142 acres after it was
[49:29] zoned and it was zoned R1,
[49:31] was then zoned back to A2. So, it
[49:34] currently sits there as A2.
[49:37] They can have the cattle. There's been
[49:38] cattle there for years and some of you
[49:40] guys was in support of the cattle and
[49:41] not the houses.
[49:43] The other thing I find most ironic
[49:47] is with this property being zoned R1
[49:51] without anyone coming before us and
[49:54] simply going before Christie and the
[49:56] plan and the development department
[49:59] that property can be further utilized
[50:01] today
[50:02] if deemed so
[50:04] as a continuing portion of a
[50:06] neighborhood with easily
[50:08] at a minimum of 70 lots
[50:11] which means you're going to have 70 more
[50:13] families commuting through your
[50:14] neighborhood.
[50:16] Okay? You're going to have the traffic
[50:18] from the development itself tracking mud
[50:21] and concrete trucks. It's the only
[50:23] access point.
[50:24] And you're going to have all the
[50:25] constructions of all the houses being
[50:27] built for the next five or six years.
[50:30] And for me to think that you had rather
[50:32] be imposed by that
[50:36] as opposed to four animals, eight
[50:39] animals, whatever
[50:41] on 84
[50:43] acres they own. I understand we're only
[50:45] looking at four, but they have 84 acres
[50:47] zoned R1.
[50:49] Um
[50:51] and if their future plans would be to to
[50:53] alter that uh to A as well and I don't
[50:56] know what their plans are, but I mean if
[50:57] it was, it's much seems like it'd be
[51:00] much less evasive
[51:02] than 70 plus more families coming in out
[51:04] of your neighborhood. That's just me. I
[51:06] mean, that would be me. Doesn't mean it
[51:08] coincides with everyone. So
[51:10] um
[51:13] I have been able
[51:15] hopefully as you can tell to give a
[51:17] whole lot of thought to this this
[51:19] afternoon. And those are just some of
[51:21] the thoughts that I came up with. And
[51:23] the reason I bring those up is because I
[51:25] didn't hear any of them mentioned
[51:27] tonight. You know, as I was attentive to
[51:29] what you guys were saying
[51:31] I I didn't hear those things that were
[51:33] said as to how can we look at this in a
[51:36] different manner. What can the property
[51:38] be used for?
[51:40] I I'm I don't know what's going to
[51:42] happen. I can tell you what's happened
[51:43] in other counties around us.
[51:45] Um
[51:46] you know, if sewer ever becomes
[51:48] available,
[51:50] uh they follow
[51:52] rivers for the flow of for sewer. And if
[51:57] that were to ever I mean
[51:59] 84 acres, then you get three units to
[52:02] the acre and you're looking at
[52:04] almost 200 houses. I'm just saying,
[52:06] somewhere down the road. Who knows? I
[52:08] mean
[52:09] but
[52:11] that we're
[52:12] against
[52:15] farm animals and agriculture one moment
[52:18] and then the other time you're here and
[52:19] you're against homes because you want
[52:21] the agriculture. I mean, I'm I'm in a
[52:23] bit of a struggle. I don't have any hair
[52:25] left, so I quit pulling my hair out a
[52:26] long time ago. So, uh but it's just hard
[52:29] for me to to understand. I don't take it
[52:31] that I don't understand your concerns.
[52:34] Um and I do have a question that if you
[52:37] as a subdivision entity, and that'll be
[52:39] determined obviously in a court system,
[52:41] but if you have a way without them being
[52:44] considered a lot number on a recorded
[52:46] plat to impose your covenants upon them,
[52:49] uh or if they should even seek your
[52:51] approval. I mean, I don't know any of
[52:52] that. None of us know it until it's
[52:54] decided. So, ma'am, I I'm not coming
[52:56] back to public comment.
[52:58] I'm not Okay. I'm not I'm I'm good. So,
[53:02] those are my concerns and those are just
[53:04] some thoughts I had. I hope that you
[53:05] guys will exercise those because this is
[53:07] not a final decision tonight. This will
[53:09] go before the Board of Commissioners.
[53:11] That's where the decision will be made
[53:13] final. Hopefully, it'll give you some
[53:15] time to kind of both sides. I appreciate
[53:16] the fact that you've offered your number
[53:18] to to to the people in the community. Uh
[53:21] I I'm hope you guys will communicate.
[53:24] And uh
[53:25] you know, maybe more common ground can
[53:28] be found. Um
[53:30] but I do find it quite an ironic
[53:32] situation. So, with that, is there any
[53:35] other discussion upon any of the members
[53:38] of the board?
[53:42] If not, I will ask for a motion
[53:45] regarding this case.
[53:47] >> Mr. Chairman, I'd like to make a motion.
[53:49] » Mr. Chairman, I'd like to make a motion.
[53:49] Um
[53:51] in considering this application,
[53:53] um
[53:54] I'm looking at the appropriateness
[53:58] uh
[53:59] to the
[54:01] current development patterns in the
[54:02] area.
[54:04] Um
[54:06] I I appreciate your your explanation
[54:09] there.
[54:10] Um I don't think that the
[54:13] fact that the
[54:15] whether or not the covenants apply to
[54:17] this property
[54:19] uh is is not weighing on this decision.
[54:22] Um that's something for the attorneys to
[54:25] to sort out. Um the county does not
[54:27] enforce uh
[54:30] uh HOA covenants, as you're well aware.
[54:32] Um but the the fact of the matter is
[54:36] that the property is zoned R1
[54:38] and was originally
[54:40] included in the subdivision the proposed
[54:43] subdivision of the property. The fact
[54:45] that the property was not developed as
[54:48] such does not
[54:49] uh exclude it from that in my in my
[54:52] view.
[54:53] Um the access is solely through the
[54:55] subdivision,
[54:57] which uh additionally makes it uh
[55:00] inappropriate, and for those reasons, uh
[55:02] my recommendation would be for a denial.
[55:05] >> Thank you.
[55:06] » Thank you.
[55:06] I have a motion. Do I have a second?
[55:11] no second.
[55:13] So, I am going to make a motion
[55:16] that
[55:18] with the conditions
[55:23] four sheep, four goats, 12 chickens,
[55:27] no more than that ever.
[55:31] Okay?
[55:32] Also, uh there was some considerate
[55:35] there's concern brought up about a cell
[55:37] tower.
[55:38] Uh, that would have to come before us
[55:40] before it was approved. There was
[55:41] something else, another modified use
[55:43] that you were concerned about would come
[55:44] before us. Anything that might would
[55:46] modify this property would have to come
[55:47] back before us before anything can
[55:49] happen other than what's being asked for
[55:51] tonight.
[55:53] Um, so with the conditions of that
[55:55] limited amount of animals and again
[55:58] being appreciative of the fact that's
[55:59] been brought forth that we have no
[56:01] governance over any covenants, I am
[56:04] going to make a motion for approval of
[56:06] this request and I will ask for a
[56:09] second.
[56:12] » Second.
[56:13] >> I have a second. All in favor with your
[56:15] » I have a second. All in favor with your
[56:15] right hand and the second, raise your
[56:16] hand and say I. I. It's three and two
[56:21] that did not support the motion.
[56:23] You got all that, Ms. Tracy?
[56:25] Thank you.
[56:27] All right, we're moving on with our
[56:29] agenda for the evening.
[56:36] Yeah, I'm I'm going to take just a
[56:37] minute and let this group that's here
[56:39] for this case uh head on out and then we
[56:42] will
[56:43] start back up.
[58:08] » I'm going to wait on Mr. Banks to take a
[58:09] seat and then we're going to move on
[58:10] with tonight's agenda.
[58:12] >> It's what you get for having an old man
[58:13] » It's what you get for having an old man
[58:13] on the board.
[58:13] >> I know. I'm going to forgive you and
[58:16] » I know. I'm going to forgive you and
[58:16] you're not an old man.
[58:18] Next on our agenda is new business and
[58:21] we have LU260188
[58:24] and Z260187
[58:27] land use change from rural residential
[58:29] agricultural to from
[58:32] rural residential and agricultural to
[58:33] suburban and rezone 5.99 acres from A1
[58:37] to R1 to create a five-lot residential
[58:39] subdivision. Applicant owner is Mark
[58:41] Sanchez Properties located on Lochland
[58:43] Road is the applicant present?
[58:47] If you would please step up to the mic,
[58:49] state your name, address, tell us what
[58:50] your plans are.
[59:02] » Yes. Um
[59:03] my name is Mark Sanchez. I live at 313
[59:06] Milledge.
[59:08] Um
[59:10] I'm asking to uh this evening uh for my
[59:13] property. It's uh 5.99 acres on Lochland
[59:17] Road
[59:18] uh to be rezoned uh to R1.
[59:23] Um currently it is raw undeveloped land.
[59:28] Uh the purpose of the rezone is to
[59:32] rezone the property from A1 to R1 to
[59:34] permit development of a five-lot
[59:36] single-family
[59:38] residential subdivision consisting of
[59:40] approximately one-acre home site.
[59:43] Uh the proposed development is designed
[59:45] to be compatible with the surrounding
[59:47] residential character
[59:49] while utilizing planned public water
[59:52] service and individual septic systems.
[59:58] Um
[1:00:01] with that, uh about 500 ft from my
[1:00:05] property tract now,
[1:00:07] uh water has been installed. Uh Bright
[1:00:11] Homes, I believe, owns 24 lots, one-acre
[1:00:14] lots.
[1:00:15] Uh it's demarked to the left of their
[1:00:18] property.
[1:00:20] Uh my plan would be to bring that
[1:00:23] uh water line down to my tract.
[1:00:26] Uh and then I would install it in the in
[1:00:29] the subdivision.
[1:00:32] and then I have a proposed road
[1:00:35] uh with a cul-de-sac at the end as well.
[1:00:41] And I have had this land surveyed.
[1:00:44] The picture up on the monitor is
[1:00:47] that that you see.
[1:00:50] And
[1:00:53] what else? Um the name of the
[1:00:56] subdivision would be termed Lochlinburg.
[1:01:00] Um be it that it's on Lochlin Road.
[1:01:03] And
[1:01:06] the type of homes that would be going on
[1:01:08] this would be matching the surrounding
[1:01:11] area.
[1:01:12] Uh done my homework there, so um about
[1:01:16] 850,000 to 1.1
[1:01:19] uh would be what I would propose to to
[1:01:21] build uh and sell for.
[1:01:27] I believe that is all I have to say. So,
[1:01:30] if I'd open up for questions.
[1:01:32] >> Thank you. Any questions for the
[1:01:33] » Thank you. Any questions for the
[1:01:33] applicant?
[1:01:34] >> Mr. Sanchez, [clears throat] this land

[1:01:35] to the west is the new subdivision that
[1:01:37] just went in.
[1:01:38] >> Yes, sir.
[1:01:39] » Yes, sir.
[1:01:39] >> You would butt up to those lots.
[1:01:40] » You would butt up to those lots.
[1:01:40] >> That's correct.
[1:01:41] » That's correct.
[1:01:41] >> That's what
[1:01:42] » That's what
[1:01:42] And those lots are Are they one acre?
[1:01:44] >> They are.
[1:01:45] » They are.
[1:01:45] >> Okay.
[1:01:49] Is there Is there a pond on your
[1:01:51] property?
[1:01:52] >> There is no no pond. No no stream. Um
[1:01:56] » There is no no pond. No no stream. Um
[1:01:56] it's
[1:01:56] >> How about a retention pond?
[1:01:58] » How about a retention pond?
[1:01:58] The area
[1:01:59] >> That will have to be Yes, yes. That will
[1:02:01] » That will have to be Yes, yes. That will
[1:02:01] have to be figured out and I haven't got
[1:02:03] >> But it's not on your plat. It's not on
[1:02:04] » But it's not on your plat. It's not on
[1:02:04] what you're proposing.
[1:02:06] >> Uh
[1:02:07] » Uh
[1:02:07] this is just uh a survey that was done
[1:02:11] and a and a mock-up of what that would
[1:02:13] look like, but a retention pond would
[1:02:14] need to be uh figured out in a civil
[1:02:18] uh drawing. So, I just haven't haven't
[1:02:20] gotten that far yet.
[1:02:21] >> Okay.
[1:02:26] I don't really as much have a
[1:02:29] question just as a comment. So,
[1:02:35] I look at a lot of subdivision plats.
[1:02:37] I'm going to look at a couple tonight
[1:02:38] later on. And you you have got a ton of
[1:02:42] frontage just to pick up one lot.
[1:02:45] Um you got
[1:02:48] five lots and street that when you're
[1:02:50] complete it's going to be donated to the
[1:02:52] county.
[1:02:54] And then the county is going to have to
[1:02:56] figure out how to maintain what's within
[1:02:58] this neighborhood
[1:03:00] off of just five lots.
[1:03:04] it just seems like
[1:03:07] it seems like trying to push this and
[1:03:10] once you get retention on there, I think
[1:03:11] you're probably going to lose a lot. So,
[1:03:13] then you're going to be down to four.
[1:03:16] how
[1:03:17] the burden that's going to be placed on
[1:03:19] those homeowners
[1:03:21] for just the taxes to maintain
[1:03:24] their particular street. I
[1:03:27] I just seems
[1:03:28] seems
[1:03:30] hard to make the economics. That's just
[1:03:32] thought I'm having as I'm looking at it.
[1:03:33] Any other questions?
[1:03:35] >> And public works noted a diesel lane as
[1:03:37] » And public works noted a diesel lane as
[1:03:37] well.
[1:03:38] >> Yeah, she's stating that public works
[1:03:40] » Yeah, she's stating that public works
[1:03:40] has indicated that there would need to
[1:03:41] be a diesel lane which is going to
[1:03:43] encroach on your first lot on the right
[1:03:45] coming in.
[1:03:46] >> Okay.
[1:03:47] » Okay.
[1:03:47] >> Any other questions?
[1:03:49] » Any other questions?
[1:03:49] >> I believe the price range you were
[1:03:51] » I believe the price range you were
[1:03:51] talking about the other the nearby
[1:03:54] homes is on larger tracts though,
[1:03:57] correct?
[1:03:58] >> They are. They are on larger tracts, but
[1:04:00] » They are. They are on larger tracts, but
[1:04:00] I with the resources that I was putting
[1:04:02] in there,
[1:04:03] I was going to do curb and gutter
[1:04:05] on there as well.
[1:04:08] And I was going to make it a five home
[1:04:10] site enclave there.
[1:04:12] Uh,
[1:04:14] and
[1:04:15] uh, have the home prices be higher to
[1:04:17] account for what you're talking about. I
[1:04:20] did not know that I needed a diesel
[1:04:22] lane,
[1:04:23] so that's new to me.
[1:04:25] I was hoping is is that going to be a
[1:04:28] fact? That's I'm going

[1:04:38] then they noted back to us that that
[1:04:40] would be something that they would
[1:04:41] require.
[1:04:42] >> Okay.
[1:04:45] » And they also noted verifying site
[1:04:46] distance with the entrance location.
[1:04:49] >> I I I had called in and asked about a
[1:04:53] » I I I had called in and asked about a
[1:04:53] diesel lane, so I guess I misunderstood
[1:04:56] because I didn't think I needed that for
[1:05:00] uh, my particular project, but they're
[1:05:03] saying that that is needed.
[1:05:07] >> Yes.
[1:05:07] » Yes.
[1:05:07] >> Okay.
[1:05:10] » Any additional questions?
[1:05:15] Thank you.
[1:05:17] We're good, sir. If I need you, I'll get
[1:05:19] you back. Is anyone here in opposition
[1:05:20] to this?
[1:05:24] No one in opposition?
[1:05:26] Sir, are you raising your hand?
[1:05:30] Well, I think
[1:05:32] if you could step up and put that into
[1:05:33] public record, we'd appreciate it. And
[1:05:35] we'll get that answer for you in his
[1:05:36] rebuttal.
[1:05:37] That's the best way for me to handle
[1:05:39] business. That way everybody that's
[1:05:40] watching on Facebook gets to see you,
[1:05:41] too.
[1:05:43] If you'd had on a Georgia Tech shirt,
[1:05:45] I'd have told you to just stay back
[1:05:46] there.
[1:05:48] Uh-oh, I done made somebody mad up here
[1:05:50] on the board.
[1:05:55] » I'm Doug Fisher. I'm at 1141 Lockland.
[1:05:59] Uh the only question I really have is um
[1:06:01] the price sounds nice. How many square
[1:06:03] feet are these houses to offset
[1:06:06] the fact that it's on 1 acre versus, you
[1:06:08] know, most of most of it's two or two,
[1:06:11] five or six.
[1:06:12] >> Thank you, sir. Yes, sir. We'll get an
[1:06:14] » Thank you, sir. Yes, sir. We'll get an
[1:06:14] answer for you. Anyone else in
[1:06:15] opposition?
[1:06:17] All right. If you would If you would
[1:06:19] come back up and just address that in
[1:06:20] your rebuttal.
[1:06:33] » Yes, sir. So, um that would be
[1:06:36] anywhere between 3,200 and 3,800
[1:06:40] square feet.
[1:06:41] >> Okay.
[1:06:42] » Okay.
[1:06:42] Any other questions while the
[1:06:44] applicant's here?
[1:06:46] Thank you, sir.
[1:06:49] Is anyone here to speak on behalf of the
[1:06:51] applicant as a proponent?
[1:06:54] If not, I will bring it back to the
[1:06:56] board for a motion.
[1:07:01] » In lieu of the uh
[1:07:03] concerns that came up and the
[1:07:05] appropriateness for this area, I make a
[1:07:08] motion to deny.
[1:07:10] >> I have a motion for denial. Do I have a

[1:07:11] second?
[1:07:14] >> Second.
[1:07:14] » Second.
[1:07:14] >> I have a second. All in favor, raise
[1:07:16] » I have a second. All in favor, raise
[1:07:16] your right hand and say I.
[1:07:18] >> I.
[1:07:18] » I.
[1:07:18] >> I.
[1:07:20] » I.
[1:07:20] Any opposed?
[1:07:22] >> I.
[1:07:22] » I.
[1:07:22] >> One opposed.
[1:07:24] » One opposed.
[1:07:24] Two opposed.
[1:07:31] All righty. And this will go to the
[1:07:34] Board of Commissioners uh next month,
[1:07:36] okay?
[1:07:40] Tracy, you got the vote.
[1:07:43] Thank you.
[1:07:49] Next on the agenda for this evening is
[1:07:52] Z260189
[1:07:54] to rezone 5.70 acres from A1, B3, M1, M2
[1:07:58] to M2, B3 for a motor vehicle sales,
[1:08:01] auto repair, maintenance, salvage yard,
[1:08:05] warehouse and outdoor storage, and
[1:08:07] variance on setback buffers to eliminate
[1:08:10] the 10-ft landscape strip along Highway
[1:08:12] 11. The applicant is Reyes Autos and
[1:08:15] Trucks LLC. Property is located at 2412
[1:08:18] Highway 11 is the applicant here. If you
[1:08:22] would please step up to the podium, give
[1:08:24] us your name, and tell us what your
[1:08:26] plans are.
[1:08:28] And your address as well, please. Name,
[1:08:30] address, and tell us what your plans are
[1:08:33] for the property.
[1:08:51] » Good evening, uh
[1:08:52] Mr. Chairman and member of Planning
[1:08:54] Commission. My name is Esa Khan.
[1:08:57] Yeah, EK Engineering Consultant, the
[1:08:58] applicant for this case is located at
[1:09:01] 555 North Point Center East, Alpharetta,
[1:09:04] Georgia. And I'm an engineer with EK
[1:09:08] Engineering Consultant and I'm here to
[1:09:10] present this application on behalf of
[1:09:13] the property owner. Uh the property
[1:09:15] owner and the member of his team is with
[1:09:18] me and they will be happy to answer any
[1:09:21] question
[1:09:22] later.
[1:09:25] Uh as you can see on page 32
[1:09:29] the case number, the total site area is
[1:09:33] approximately 10.4
[1:09:36] acres and is currently zoned A1, B3, and
[1:09:39] M2.
[1:09:41] Uh the property has historically been
[1:09:43] used for residential, vehicle storage,
[1:09:45] and salvage-related activities.
[1:09:48] And the proposed uses include motor
[1:09:51] vehicle sales, automotive repair and
[1:09:54] maintenance,
[1:09:55] salvage yard office, warehouse, and
[1:09:59] screened
[1:10:00] outdoor storage.
[1:10:02] this application proposed proposes to
[1:10:05] rezone approximately 5.7 acres by
[1:10:09] rezoning A1 zoned portions to B3 and M2.
[1:10:14] And approximately 1.13 acres of the
[1:10:18] existing M2 zoning to B3.
[1:10:20] Uh this proposed zone rezoning is
[1:10:23] consistent with Walton County
[1:10:26] 2022 future land use map. Uh the
[1:10:30] application also will include some
[1:10:34] variances and transition buffer requests
[1:10:36] that we will discuss.
[1:10:38] Now,
[1:10:40] if you look at the page number
[1:10:45] the the top figure shows the surrounding
[1:10:50] the surrounding zoning, which is
[1:10:52] uh the surrounding area contain both
[1:10:54] residential and commercial uses.
[1:10:57] The adjacent property to the north, uh
[1:11:00] the south and west are preliminary zone
[1:11:03] A1,
[1:11:05] uh which are single-family residential,
[1:11:08] and
[1:11:10] the properties across Highway 11 include
[1:11:14] both commercial, B2, and A2 zoned
[1:11:18] properties.
[1:11:21] Below that same page 34, the future land
[1:11:24] use map for this property is highway
[1:11:26] corridor character area, and the
[1:11:29] proposed B3 and M2 M2 zoning is
[1:11:32] consistent with this designation.
[1:11:36] On the next page,
[1:11:45] the current zoning
[1:11:47] The current zoning is, I discussed
[1:11:49] before, we have A1, M2, and B3 zoned
[1:11:54] area. The the total A1 zoned portion
[1:11:58] are proposed to be zoned to B3 and M2,
[1:12:01] while approximately 1.13 acres existing
[1:12:04] M2 is proposed to be zoned to B3.
[1:12:08] And the proposed, as you can see on this
[1:12:20] uh page here, the proposed B3 zoned wide
[1:12:25] a 200-ft uh
[1:12:27] wide
[1:12:28] frontage along the Highway 11, while the
[1:12:31] remaining area is proposed to be zoned
[1:12:34] M2, as you can see in this figure on the
[1:12:36] screen.
[1:12:41] This proposed zoning creates a logical
[1:12:44] and unified development pattern that is
[1:12:46] consistent with his with the highway
[1:12:48] corridor future land use designation.
[1:12:51] Also, the proposed, If you look at this
[1:12:54] proposed development layout including
[1:12:57] the general arrangement of building,
[1:12:59] access,
[1:13:01] parking, and
[1:13:03] internal circulation and other required
[1:13:05] site improvements.
[1:13:14] Some existing residential driveway along
[1:13:18] Highway 11 are proposed to be removed
[1:13:21] while the remaining driveway access
[1:13:23] point are proposed to be modified.
[1:13:25] Any proposed modification to the
[1:13:27] existing highway access point will be
[1:13:30] subjected to GDOT approval review and
[1:13:33] approval through the applicable
[1:13:35] permitting process.
[1:13:38] As I mentioned, there are some variances
[1:13:40] and and transition buffer modification
[1:13:44] variances. The first one,
[1:13:48] if you look at
[1:13:52] this s-
[1:13:54] um page on the top is the
[1:13:57] b- uh the B3 on the north side and also
[1:14:01] on the south side, the transition buffer
[1:14:05] variance for 0 ft uh because of the this
[1:14:09] was an access easement before and there
[1:14:11] is a current existing building that is
[1:14:14] in this area.
[1:14:15] Uh so, we are requesting for the
[1:14:18] improvement
[1:14:19] on the site and also due to the existing
[1:14:21] building a 0-ft buffer. Also, on the
[1:14:24] south side, we are requesting for this
[1:14:26] B3 area only a 0-ft buffer because there
[1:14:30] is an existing um pond in this area.
[1:14:35] >> An existing what?
[1:14:36] » An existing what?
[1:14:36] >> A pond, retention pond.
[1:14:38] » A pond, retention pond.
[1:14:38] >> Okay.
[1:14:40] » Okay.
[1:14:40] >> So, those are the two reason we are sp-
[1:14:43] » So, those are the two reason we are sp-
[1:14:43] we are we are requesting the 0-ft
[1:14:45] transition buffer.
[1:14:47] Also, on M2
[1:14:49] zoning, we are asking for design
[1:14:51] modification and requesting a 25-ft
[1:14:54] transition buffer with screened fence.
[1:15:00] On the
[1:15:01] on the
[1:15:02] for the for the two existing properties
[1:15:04] that is renovated that is supposed to be
[1:15:07] renovated,
[1:15:09] uh one those properties are not
[1:15:11] satisfying the 60-ft front buffer
[1:15:13] require front setback requirement and we
[1:15:16] are we are requesting
[1:15:19] a variance for the two existing
[1:15:22] properties for that front setbacks.
[1:15:26] Also, we are requesting uh to the extent
[1:15:29] possible a 10-ft landscape strip
[1:15:31] variance along Highway 11 because of the
[1:15:34] existing property condition, because of
[1:15:36] the existing pond, and uh
[1:15:39] um and to accommodate the
[1:15:42] parking in this area.
[1:15:45] With that, uh
[1:15:46] to summarize, this application eliminate
[1:15:49] the existing split zoning configuration,
[1:15:53] uh creates a unified B3 and M2 M2 zoning
[1:15:57] pattern,
[1:15:58] and is consistent with the Walton County
[1:16:01] future land use map, and it creates a
[1:16:03] unified zoning pattern that support the
[1:16:06] coordinated future development. Also, it
[1:16:08] supports the continuous investment and
[1:16:10] economic activity along the highway
[1:16:12] corridor. Uh with this, we respectfully
[1:16:15] request uh your recommendation to
[1:16:18] approve the proposed rezoning together
[1:16:20] with associated variances and tran-
[1:16:23] transition buffer modification. Thank
[1:16:25] you, and we will be happy to answer any
[1:16:27] question from the commission or the
[1:16:30] crowd. Thank you.
[1:16:36] » All right, thank you so much. I
[1:16:37] appreciate that. Uh on the
[1:16:40] shot that's up on the screen, the
[1:16:42] portion in the back where those parcels
[1:16:45] or portion of the parcel is shown as M2,
[1:16:48] what is the proposed use there?
[1:16:50] Everything around the front on the
[1:16:52] highway and then where the warehouses
[1:16:54] are, um we we have a definition as what
[1:16:57] that's being proposed a proposed use
[1:16:59] for, but within that large area in the
[1:17:02] back, what is that proposed for?
[1:17:04] >> Those will be a screen storage area.
[1:17:06] » Those will be a screen storage area.
[1:17:06] >> A screen storage area.
[1:17:09] » A screen storage area.
[1:17:09] And what's going to be stored there?
[1:17:11] >> Those will be salvage vehicle.
[1:17:14] » Those will be salvage vehicle.
[1:17:14] >> What type of vehicle?
[1:17:16] » What type of vehicle?
[1:17:16] >> Salvage.
[1:17:16] » Salvage.
[1:17:16] >> Salvage vehicles.
[1:17:18] » Salvage vehicles.
[1:17:18] >> Salvage vehicles.
[1:17:21] » Yeah.
[1:17:23] So, we're talking about inoperable
[1:17:25] vehicles.
[1:17:26] >> That's correct.
[1:17:27] » That's correct.
[1:17:27] >> Wrecked, whatever. Okay.
[1:17:28] » Wrecked, whatever. Okay.
[1:17:28] >> Yes.
[1:17:34] » Um
[1:17:36] you obviously have not yet
[1:17:39] saw G. Good luck, but you haven't saw
[1:17:41] them yet. So, you don't know if they're
[1:17:43] going to give you these two entrances.
[1:17:45] >> So, there are currently three on our
[1:17:48] » So, there are currently three on our
[1:17:48] preliminary conversation with them.
[1:17:51] The middle one is going to be
[1:17:53] avoided or eliminated. This what the
[1:17:56] initial communication with G.
[1:17:58] But, they're asking for more information
[1:18:00] and
[1:18:01] >> So, are you are you seeking two entry
[1:18:03] » So, are you are you seeking two entry
[1:18:03] points?
[1:18:04] >> Two entry points.
[1:18:05] » Two entry points.
[1:18:05] >> Okay.
[1:18:05] » Okay.
[1:18:06] But, but as right now, you don't know if
[1:18:07] they're going to confine you to one with
[1:18:09] interior
[1:18:10] uh access or if they're going to give
[1:18:12] you the two. You That has not been made
[1:18:14] yet, that's termination. Is that
[1:18:15] correct?
[1:18:16] >> is not made and
[1:18:17] » is not made and
[1:18:17] >> Okay.
[1:18:17] » Okay.
[1:18:17] >> Yes, that's not a part of the rezoning
[1:18:19] » Yes, that's not a part of the rezoning
[1:18:19] we we we
[1:18:20] >> Right. And then you're indicating an
[1:18:23] » Right. And then you're indicating an
[1:18:23] existing building which was I think for
[1:18:26] tire repair.
[1:18:28] >> That's correct.
[1:18:28] » That's correct.
[1:18:28] >> Yes, on the north
[1:18:29] » Yes, on the north
[1:18:29] >> That existing building and it will be
[1:18:31] » That existing building and it will be
[1:18:31] proposed to be used for that in the
[1:18:33] future as well. Is that true?
[1:18:35] >> That's true.
[1:18:35] » That's true.
[1:18:36] >> Okay, so you got the tire repair, then
[1:18:38] » Okay, so you got the tire repair, then
[1:18:38] you've got the car dealership, and then
[1:18:40] as you continue south, you got the auto
[1:18:43] repair.
[1:18:44] Um the request says major and minor auto
[1:18:47] repair. Uh will these be
[1:18:52] like
[1:18:54] just typical vehicles or large trucks? I
[1:18:57] mean, can you tell me the breakdown of
[1:18:59] what you plan to work on?
[1:19:00] >> Yeah, they're typical vehicles. What
[1:19:01] » Yeah, they're typical vehicles. What
[1:19:01] they're going to be used for is taking
[1:19:03] the salvage cars and
[1:19:05] >> Sir, come come to the microphone,
[1:19:06] » Sir, come come to the microphone,
[1:19:06] please.
[1:19:07] >> Yeah, yes, they're going to be typical
[1:19:09] » Yeah, yes, they're going to be typical
[1:19:09] vehicles. What they're going to be used
[1:19:10] for is taking apart the uh the the parts
[1:19:12] that are good from the salvage vehicles,
[1:19:14] and they're going to be using using
[1:19:16] those and storing those, and then
[1:19:18] using the uh those cars and storing them
[1:19:20] in the back side of the M2.
[1:19:23] >> Okay.
[1:19:26] » Do you You're [clears throat] also
[1:19:27] running a wrecker service?
[1:19:33] » Yes. Yes, sir.
[1:19:35] >> And that'd be a 24-hour
[1:19:37] » And that'd be a 24-hour
[1:19:37] on-call?
[1:19:41] » No, it's going to be our regular hours.
[1:19:44] No, not 24 hours, no.
[1:19:46] >> It'll only be working hours.
[1:19:47] » It'll only be working hours.
[1:19:47] >> For the Yes, sir, only working hours.
[1:19:52] » One question I have, uh the
[1:19:54] area that is now A1 in the back, and it
[1:19:58] will be M2, and you said it's going to
[1:20:01] be used for storage of
[1:20:04] salvage vehicles.
[1:20:05] >> Yes.
[1:20:06] » Yes.
[1:20:06] >> property already been cleared, and are
[1:20:08] » property already been cleared, and are
[1:20:08] there storage vehicle salvage vehicles
[1:20:10] already on the property?
[1:20:14] » Um the north side on the A1 on the north
[1:20:17] side, there is.
[1:20:18] And it has been cleared, yes, sir.
[1:20:19] >> It has been cleared.
[1:20:20] » It has been cleared.
[1:20:20] >> Yes, sir.
[1:20:21] » Yes, sir.
[1:20:21] >> Okay.
[1:20:23] » Okay.
[1:20:23] Christie,
[1:20:25] um is there any past history with code
[1:20:27] here?
[1:20:29] >> There is, yes.
[1:20:31] » There is, yes.
[1:20:31] >> Recent?
[1:20:32] » Recent?
[1:20:32] >> Um it is under Well, it was this was
[1:20:34] » Um it is under Well, it was this was
[1:20:34] what brought um
[1:20:37] A portion of it's already being used as
[1:20:39] a salvage yard for Mr. Harville. Um
[1:20:43] and he went went in and did some
[1:20:45] additional clearing out and uh code
[1:20:48] enforcement had stopped him. So, this is
[1:20:51] a result of code enforcement um to get a
[1:20:54] better understanding of what they're
[1:20:55] doing out there, what they want to do,
[1:20:57] and get everything in compliance.
[1:21:00] >> Okay.
[1:21:02] » Okay.
[1:21:02] >> And add the two
[1:21:04] » And add the two
[1:21:04] um on the northern side, the two back
[1:21:06] lots that are currently A1
[1:21:09] and the south part of the A1 property um
[1:21:14] >> [clears throat]
[1:21:14] » [clears throat]
[1:21:14] >> that they have acquired to rezone those
[1:21:17] » that they have acquired to rezone those
[1:21:17] to appropriate zonings.
[1:21:20] >> Okay.
[1:21:21] » Okay.
[1:21:21] And on that portion warehouse office,
[1:21:23] that's mini storage warehouses I would
[1:21:25] expect that you have there. Is that what
[1:21:27] you've got?
[1:21:29] >> There is an existing building and
[1:21:30] » There is an existing building and
[1:21:30] they're going to renovate it to the
[1:21:33] >> to mini storage.
[1:21:34] » to mini storage.
[1:21:34] >> Yes.
[1:21:34] » Yes.
[1:21:34] >> Okay.
[1:21:35] » Okay.
[1:21:35] >> Yes.
[1:21:35] » Yes.
[1:21:35] >> And the office space that's designated
[1:21:37] » And the office space that's designated
[1:21:37] would be for the mini office spaces.
[1:21:39] >> That will be for the purpose of the
[1:21:41] » That will be for the purpose of the
[1:21:41] salvage yard office.
[1:21:43] >> So, the office would be So, it would
[1:21:44] » So, the office would be So, it would
[1:21:44] have nothing to do with the storage
[1:21:46] warehouses. It would only be for the
[1:21:47] salvage portion.
[1:21:48] >> For the salvage portion of the
[1:21:50] » For the salvage portion of the
[1:21:50] >> Okay.
[1:21:51] » Okay.
[1:21:51] >> Yes.
[1:21:53] » Any additional questions?
[1:21:57] Thank you all. Appreciate it.
[1:21:58] >> Thank you.
[1:21:59] » Thank you.
[1:21:59] >> Is anyone here in opposition to this
[1:22:01] » Is anyone here in opposition to this
[1:22:01] request?
[1:22:05] Nobody in opposition.
[1:22:22] So, I'm going to bring this back uh
[1:22:25] to the board for a motion.
[1:22:28] Any Any additional comments from any of
[1:22:30] the board members?
[1:22:32] Anything we need to talk over?
[1:22:36] >> want I just like clarification from
[1:22:38] » want I just like clarification from
[1:22:38] staff that
[1:22:40] a large portion of this property is
[1:22:42] already re-zoned to M2 and the salvage
[1:22:44] yard was approved at that time, right?
[1:22:47] >> That is correct.
[1:22:48] » That is correct.
[1:22:48] >> Okay.
[1:22:48] » Okay.
[1:22:49] >> Um this The salvage yard kind of
[1:22:51] » Um this The salvage yard kind of
[1:22:51] pre-dates the ordinance. Um Mr. Harwood
[1:22:53] did come in
[1:22:55] um and bring that into compliance over
[1:22:57] time.
[1:22:59] Um and then this is just to get the rest
[1:23:02] of the property
[1:23:03] that has potentially already been used
[1:23:06] for this use into compliance. And then
[1:23:10] what hasn't been used in the back has
[1:23:12] not been used in the back in compliance
[1:23:14] with zoning so that it could be further
[1:23:17] used.
[1:23:18] >> Thank you.
[1:23:19] » Thank you.
[1:23:19] >> Okay. So that clarifies that part of the
[1:23:21] » Okay. So that clarifies that part of the
[1:23:21] property being asked for salvage has
[1:23:24] been
[1:23:26] currently is being used and has
[1:23:27] previously been approved. Thank you,
[1:23:30] Josh. Thanks for bringing that up.
[1:23:32] Um one of the things I wanted to mention
[1:23:35] is I certainly understand
[1:23:37] that you guys asking for
[1:23:41] the landscape strip up front that to be
[1:23:44] removed.
[1:23:46] I can appreciate that because I don't
[1:23:48] think there's a auto dealership that
[1:23:50] I've ever been by that didn't park the
[1:23:52] cars right out on the road.
[1:23:54] However, you have a tire repair
[1:23:56] and auto repair.
[1:24:01] I I don't want to give the same weight
[1:24:04] to those structures that I give to
[1:24:06] when you need visibility. There's
[1:24:08] certain things you need visibility for
[1:24:09] and there's things that you don't as a
[1:24:10] business owner is what I'm trying to
[1:24:12] say. And I realize what those are
[1:24:17] and at the same time I think that
[1:24:20] there's a purpose for for that uh
[1:24:23] land-
[1:24:24] strip to be there. So,
[1:24:26] kind of want to shed light on both of
[1:24:28] those
[1:24:30] in a reply. And also on the south side
[1:24:32] of the property, the comment was made in
[1:24:35] the request for the reduction to zero
[1:24:38] buffer in that there's an existing
[1:24:40] retention pond.
[1:24:42] Christie, would it be fair for me to say
[1:24:45] that
[1:24:46] with the addition of these other tracks
[1:24:48] into a salvage yard situation and the
[1:24:51] development of potentially new
[1:24:53] structures on the front and to the side
[1:24:56] that the site plan and retention that's
[1:24:58] there now may not be adequate for
[1:25:00] future?
[1:25:03] Would that be
[1:25:03] >> That would be. And they would need to
[1:25:06] » That would be. And they would need to
[1:25:06] submit that what they're adding
[1:25:10] that additional
[1:25:11] >> Okay.
[1:25:12] » Okay.
[1:25:12] >> That pond would hold it.
[1:25:14] » That pond would hold it.
[1:25:14] >> The pond that's there now would hold any
[1:25:16] » The pond that's there now would hold any
[1:25:16] additional they add.
[1:25:17] >> They would have to prove that all of
[1:25:18] » They would have to prove that all of
[1:25:18] this, if not, they would have to either
[1:25:20] increase it or provide additional.
[1:25:22] >> Yeah.
[1:25:22] » Yeah.
[1:25:23] >> Yes.
[1:25:23] » Yes.
[1:25:23] >> Um
[1:25:28] And where the tire repair existing tire
[1:25:31] repair is there, what what is the
[1:25:33] abutment of the adjoining property?
[1:25:44] Now, well, just what's the use and the
[1:25:45] zoning for the adjoining property on the
[1:25:47] side, which would be the north end of
[1:25:49] the frontage?
[1:25:54] » On the north is a an A1 piece of
[1:25:56] property.
[1:25:57] >> Okay. So, the adjournment where there is
[1:26:00] » Okay. So, the adjournment where there is
[1:26:00] an It's really hard to to read in that
[1:26:02] small print, but on that north end that
[1:26:04] that last building is an existing tire
[1:26:07] repair building according to the
[1:26:10] the applicant.
[1:26:11] There's also a request there for zero
[1:26:16] how about one of you guys step back up
[1:26:18] for just a second?
[1:26:32] So, my question is on the on the north
[1:26:35] end where the tire repair is, the
[1:26:38] adjoining property there is being
[1:26:39] indicated as an A1 property, is that
[1:26:41] correct?
[1:26:42] >> Yes.
[1:26:43] » Yes.
[1:26:43] >> And you're asking for zero
[1:26:46] » And you're asking for zero
[1:26:46] variance
[1:26:48] to a join an A1 property.
[1:26:50] So, you're wanting to take a B3 A1 with
[1:26:52] zero
[1:26:54] >> So, there was a there is an existing
[1:26:56] » So, there was a there is an existing
[1:26:56] easement driveway
[1:26:59] easement for the A1
[1:27:01] properties on the back side.
[1:27:03] Uh,
[1:27:04] and this is the back of the building.
[1:27:07] So, there will be no noise because of
[1:27:09] the existing masonry wall.
[1:27:11] And the front of the of the
[1:27:15] tire shop is the
[1:27:17] is to the word the driveway that we are
[1:27:19] showing. So, it's toward the south side.
[1:27:21] >> So, the entrance to the south side, the
[1:27:23] » So, the entrance to the south side, the
[1:27:23] rear of the building faces the A1, and
[1:27:25] on the A1 property there is a drive that
[1:27:28] goes up directly behind there. It's an
[1:27:30] easement to a property in the rear.
[1:27:32] >> Right. So, we are removing that A1
[1:27:34] » Right. So, we are removing that A1
[1:27:34] zoning, so it's going to be in in two
[1:27:36] now. So, there will be no need for that
[1:27:39] driveway access easement. So, we are
[1:27:41] removing that driveway on the north side
[1:27:44] and using that area because there will
[1:27:46] be a need for a septic system. So, we
[1:27:49] may need to use that area for a septic
[1:27:51] system as well, but since this is the
[1:27:53] back of the property,
[1:27:55] um, the back of the building, it
[1:27:57] wouldn't create any
[1:27:59] noise because it's a masonry structure
[1:28:02] as well.
[1:28:04] >> Okay.
[1:28:07] Um,
[1:28:08] I think you're you're Thank y'all. I
[1:28:10] appreciate you answering that. You guys
[1:28:11] can have a seat. I think that
[1:28:14] the fact that uh
[1:28:18] the property has a current use
[1:28:22] for salvage, storage.
[1:28:24] Um this would be a modification to make
[1:28:26] that a bit larger.
[1:28:28] Uh but also to add
[1:28:32] some various
[1:28:35] other opportunities, I might say,
[1:28:37] uh to the area. It is certainly well
[1:28:41] within the character area map. Um I
[1:28:44] can't dispute that at all.
[1:28:48] But there are there's a few things just
[1:28:51] for concern that I want to see
[1:28:53] um addressed. So, I'm going to make a
[1:28:56] motion of approval with the following
[1:28:58] conditions. On the south side of the
[1:29:00] property where the current retention is,
[1:29:03] any area
[1:29:05] being shown
[1:29:07] on what we have, Christie, and I'm
[1:29:09] referencing what's up there,
[1:29:12] that to me is in a color brown
[1:29:14] because the back portion says screened
[1:29:17] salvage.
[1:29:19] And so, therefore, there is a line that
[1:29:22] circles around the warehouses and the
[1:29:24] office area that is not within the
[1:29:27] portion that would be deemed as screened
[1:29:29] salvage.
[1:29:31] So,
[1:29:32] anything from where where the retention
[1:29:35] pond does not intersect the adjoining
[1:29:38] property,
[1:29:39] anything from that point
[1:29:41] all the way back past the warehouses
[1:29:43] will be screened in the same manner as
[1:29:46] the salvage storage in the rear. That
[1:29:50] will be
[1:29:51] at a minimum of a six fence six foot
[1:29:55] uh opaque fence
[1:29:58] along that whole south boundary back to
[1:30:02] what they've already indicated as
[1:30:03] screened storage. And the screened
[1:30:05] storage itself will also be a 6-ft 6-ft
[1:30:08] opaque fence.
[1:30:10] The portion on the north end where the
[1:30:13] tire it's indicated for tire repair
[1:30:16] that a zero variance is being requested
[1:30:19] understanding that's the rear of the
[1:30:21] building.
[1:30:22] Um we do have a an adjoining property
[1:30:25] there. Also would want the 6-ft opaque
[1:30:29] fence to go from the section showing as
[1:30:33] salvage storage uh screening all the way
[1:30:37] uh to that abutment up at Highway 11
[1:30:40] all behind that building.
[1:30:44] On the front of the property
[1:30:48] a portion being used and identified as a
[1:30:51] car dealership showing parking spaces
[1:30:54] out near the street
[1:30:56] that section and that section alone
[1:30:59] I will I'm recommending uh that the land
[1:31:03] strip landscape strip uh require
[1:31:05] requirement be removed for the part
[1:31:08] there where the car dealership is
[1:31:10] identified and only that portion.
[1:31:13] Any other portion fronting Highway 11
[1:31:16] for auto repair, tire repair the
[1:31:20] required landscape strip would have to
[1:31:23] be maintained as the code has
[1:31:25] identified.
[1:31:27] And that will be a completion of my
[1:31:29] recommendation uh
[1:31:31] with approval.
[1:31:34] Do I have a second?
[1:31:37] >> Second.
[1:31:38] » Second.
[1:31:38] >> I have a second. All in favor raise your
[1:31:39] » I have a second. All in favor raise your
[1:31:39] right hand and say I.
[1:31:41] >> I.
[1:31:41] » I.
[1:31:41] >> I.
[1:31:43] » I.
[1:31:43] This will go to the Board of
[1:31:44] Commissioners next month.
[1:31:46] Thank y'all.
[1:32:15] » Okay.
[1:32:17] Next on the agenda for this evening,
[1:32:20] Z260192.
[1:32:22] This is the rezone of 103.56 acres from
[1:32:25] A2 to R1OSC to create 57 residential
[1:32:29] lots. The applicant is Bald Pate General
[1:32:32] Contracting LLC. The owner is Grady
[1:32:35] Thompson Enterprises LLLP. Property is
[1:32:38] located on Nickelsville Road.
[1:32:41] And I believe this person I referenced
[1:32:43] earlier in the night with the blue dress
[1:32:44] on is going to step up and present this.
[1:32:47] So, come on up, give us your name, tell
[1:32:49] us what the plans are here.
[1:33:06] » Right.
[1:33:07] Good evening. I'm Andrea Gray, 300 East
[1:33:10] Church Street, Monroe, Georgia. This
[1:33:12] evening, I'm representing Bald Pate
[1:33:14] General Contracting LLC and its request
[1:33:17] to rezone approximately 103 acres from
[1:33:20] A2 to R1OSC for a residential
[1:33:22] development called Bison Landing.
[1:33:26] The property is just east of Fanny
[1:33:28] Thompson Road and just west of Highway
[1:33:30] 11 and has frontage on Nicholson
[1:33:33] Nickelsville Road.
[1:33:37] It is in the neighborhood residential
[1:33:39] character area under the future land use
[1:33:41] plan, which does allow for the requested
[1:33:44] zoning of R1OSC.
[1:33:48] Here's just the general stats of the
[1:33:50] project. It's 103.56
[1:33:52] acres. We're proposing 57 homes,
[1:33:56] uh 49.32
[1:33:58] acres of open space. Significant open
[1:34:00] space on this property.
[1:34:02] Uh we're proposing to combine this with
[1:34:04] the Bison Landing development that was
[1:34:06] approved last year. And so when we
[1:34:08] combine those two together, they'll be
[1:34:11] together 221.75
[1:34:13] acres. It'll be a total of 149 homes and
[1:34:16] a total of 82 acres um of open space.
[1:34:20] When you average all of that together,
[1:34:22] it's about 1.5 acre um per home.
[1:34:26] Here's the site plan with some some
[1:34:28] notes made here. The thing that stands
[1:34:30] out really from the site plan is all the
[1:34:31] dark green, which is the open space.
[1:34:34] Uh 49.3 acres. Um there's an amenity
[1:34:36] lake within that, and we'll have a
[1:34:39] pavilion and a walking trail um around
[1:34:41] that lake. Uh we've got landscape strips
[1:34:44] uh where the frontage is on Nickelsville
[1:34:47] Road at the entrance and then at another
[1:34:48] spot where where we um
[1:34:50] um come back down to that road. We've
[1:34:53] got the 50-ft transitional buffers um
[1:34:55] around the property.
[1:34:57] And we've got at the top there you'll
[1:34:59] see that there's two connection points
[1:35:01] to the existing residential development,
[1:35:03] the R1OSC development to the north. So
[1:35:05] we will tie into that development.
[1:35:09] And here's a depiction of the
[1:35:11] developments together. So once we tie
[1:35:13] in, um you'll see that we'll have an
[1:35:14] entrance off George Williams and then
[1:35:16] another entrance off Nickelsville Road.
[1:35:18] So we'll be able to flow traffic um
[1:35:20] through two areas um of the development.
[1:35:25] Um again, land use compatibility of the
[1:35:27] neighborhood residential um future land
[1:35:30] use designation accommodates this type
[1:35:32] of development. Um this is a fantastic
[1:35:34] location halfway between Monroe and
[1:35:37] Bethlehem. Um it's already getting
[1:35:39] popularity um and um
[1:35:41] the demand for housing here in Walton
[1:35:43] County. Um and again, the R1OSC I favor
[1:35:47] anyway because it allows the green space
[1:35:49] to be um
[1:35:51] contiguous together and then the lots to
[1:35:53] be a more manageable size.
[1:35:57] Um, the community design and amenities
[1:35:58] again on this 103 acres, there's 48%
[1:36:02] open space which is nearly two times the
[1:36:04] requirement. Um, we'll have the two
[1:36:06] entrances. It'll be governed by an HOA.
[1:36:10] Um, and then again the amenities that I
[1:36:11] mentioned before with the lake, the
[1:36:12] walking trail, um, and um, the pavilion.
[1:36:16] And then of course as standard in all of
[1:36:17] our developments, um, sidewalks and
[1:36:19] streetlights will be um, a part of this
[1:36:22] as well.
[1:36:23] The homes themselves, um, 1,800 square
[1:36:26] feet is the ordinance requirement. We're
[1:36:28] proposing 2,000 square feet per home uh,
[1:36:32] with upgraded exterior materials
[1:36:34] including fiber cement siding and brick
[1:36:36] and stone accents, um, sodded front
[1:36:39] yards,
[1:36:40] um, and then following the the Walton
[1:36:42] County new tree ordinance requirements
[1:36:44] uh, for trees.
[1:36:46] Um, and then
[1:36:47] again, this will be a high quality
[1:36:48] community that blends in with the
[1:36:50] development to the north uh, which was
[1:36:52] also called Bison Landing. And so those
[1:36:54] will blend together as a cohesive
[1:36:56] development.
[1:36:58] And these are representative um,
[1:36:59] depictions of the houses, same ones with
[1:37:01] that were used for the prior um,
[1:37:03] development. Again, high quality homes,
[1:37:05] 2,000 plus square feet, um, you know,
[1:37:08] long-term durable, attractive materials.
[1:37:13] Um, as mentioned before, 50 foot um,
[1:37:14] transitional buffers. A lot of the um,
[1:37:18] open space is already wooded so we'll be
[1:37:20] leaving that as a buffer against the um,
[1:37:22] homeowners on Fanny Thompson uh, road
[1:37:25] there. Um, and again we're upgrading the
[1:37:27] entrance with a 10 foot landscape strip,
[1:37:30] um, and you know, it'd be a very
[1:37:31] attractive development from the road
[1:37:33] frontage.
[1:37:36] We did have a traffic analysis completed
[1:37:39] um, on this property that was included
[1:37:41] in the application um, that we prepared
[1:37:44] and submitted based on the trip
[1:37:46] generation thresholds that the Georgia
[1:37:48] Department of Transportation puts forth,
[1:37:50] the analysis showed that we would need
[1:37:52] to do right turn deceleration lanes
[1:37:55] coming out of Nickelsville and the
[1:37:57] Williams George Williams
[1:37:58] entrances. My client's happy to do
[1:38:00] those.
[1:38:02] The analysis showed that we were not
[1:38:04] required based on those trip generation
[1:38:06] standards to do a center turn lane.
[1:38:08] So based on our analysis, we are going
[1:38:10] to do those two right turn deceleration
[1:38:13] lanes.
[1:38:14] With that, we request approval of the
[1:38:16] rezoning from A2 to R1 OSC for the Bison
[1:38:20] Landing development. Happy to answer any
[1:38:22] questions you may have.
[1:38:24] >> Thank you. Any questions from any of the
[1:38:26] » Thank you. Any questions from any of the
[1:38:26] board members?
[1:38:29] Thank you. Is anyone here in opposition
[1:38:32] to this request?
[1:38:35] Well, ma'am, I would like for you to
[1:38:36] step up to this podium, tell us your
[1:38:38] name and address, and tell us what your
[1:38:40] concerns are.
[1:38:47] » My name is I'm going to address my name
[1:38:50] as a Campton citizen from 1985.
[1:38:53] My name is Kelly Davis Connelly.
[1:38:57] And I
[1:38:58] I became a citizen of Campton in 1985
[1:39:01] when my my mother brought me home from
[1:39:03] the hospital.
[1:39:04] >> Kelly, would you give us your address,
[1:39:05] » Kelly, would you give us your address,
[1:39:05] please?
[1:39:06] >> Yes,
[1:39:07] » Yes,
[1:39:07] the address in Campton or my home
[1:39:08] address?
[1:39:09] >> Wherever wherever you reside
[1:39:11] » Wherever wherever you reside
[1:39:11] permanently.
[1:39:12] >> Nickelsville Road.
[1:39:13] » Nickelsville Road.
[1:39:13] >> Thank you.
[1:39:13] » Thank you.
[1:39:13] >> Doster Manor. I'm speaking on behalf of
[1:39:16] » Doster Manor. I'm speaking on behalf of
[1:39:16] Doster Manor Senior Care Home and Miller
[1:39:18] Manor Senior Care Home.
[1:39:21] >> Okay, I know exactly what we're talking
[1:39:22] » Okay, I know exactly what we're talking
[1:39:23] about.
[1:39:23] >> Yes. So I
[1:39:25] » Yes. So I
[1:39:25] I just want that I wanted to share that
[1:39:28] I have been a citizen [clears throat]
[1:39:30] since '85 because I love the soil I've
[1:39:33] been raised on.
[1:39:34] And and I am here tonight not to oppose
[1:39:38] a subdivision.
[1:39:39] I'm here tonight to address the safety.
[1:39:43] I don't know if you've ever been on
[1:39:44] Nickelsville Road between 4:00 and 6:00
[1:39:47] at night.
[1:39:49] You You can't get out on the highway.
[1:39:51] Um the traffic backs up all the way to
[1:39:54] Junior and Conoy Parker's house.
[1:39:57] Now,
[1:39:59] and you know and and we don't even have
[1:40:01] that 100-acre subdivision that the first
[1:40:04] phase that they're putting in. That's We
[1:40:05] don't even have homes in there yet.
[1:40:08] And so Nickelsville Road, do you know
[1:40:11] how how long Nickelsville Road is?
[1:40:14] >> I do. I travel it numerous times a week
[1:40:17] » I do. I travel it numerous times a week
[1:40:17] at 50 mph, mind you.
[1:40:19] >> That's right. About a mile and a half
[1:40:21] » That's right. About a mile and a half
[1:40:21] long is Nickelsville Road. So So what
[1:40:24] we're looking at is currently right
[1:40:26] Well, we're looking at putting in 157
[1:40:30] houses total on Nickelsville Road.
[1:40:33] And we already have a traffic issue.
[1:40:36] I've spoken to the Department of of
[1:40:38] Transportation three times within the
[1:40:40] last 6 months. So they first were going
[1:40:42] to try to do a roundabout. So that was a
[1:40:45] consideration. But there's gas pumps
[1:40:49] under under the ground at Campton
[1:40:51] Restaurant, and you can't do a
[1:40:52] roundabout because those gas pumps there
[1:40:55] are from the 1960s.
[1:40:57] So there's there's no option with that.
[1:41:00] And if you put a roundabout there, it
[1:41:02] would take out every business there
[1:41:04] basically except for probably mine
[1:41:06] because I have a little bit of frontage
[1:41:08] there.
[1:41:10] So my point is is that it's it's a
[1:41:14] safety thing, and I I want to say this,
[1:41:16] and I hope it's okay that I say this.
[1:41:19] There's a 94-year-old man that lives on
[1:41:21] Nickelsville Road.
[1:41:23] It's Tracy's father-in-law.
[1:41:26] He drives that that that road every day
[1:41:29] to turn into Nickelsville Road to the
[1:41:32] Miller house to see his bed-bound wife
[1:41:34] in her 90s.
[1:41:38] It's it it's a safety issue for him
[1:41:40] anyway.
[1:41:42] But, he wanted her encamped in near his
[1:41:44] home, so he can drive that little short
[1:41:47] distance to see her.
[1:41:49] And my point is is that it's it's all
[1:41:52] about the traffic. I know there's going
[1:41:53] to be an entrance into George Williams,
[1:41:55] but do do you know the curve where the
[1:41:58] where the entrance is going to be into
[1:41:59] George Williams? I I'm a nurse. That's a
[1:42:02] fatal curve right there as it is. And
[1:42:05] tractor trailers fly up and down that
[1:42:07] road. I took care of of Judge Judge
[1:42:10] Searles
[1:42:11] in in that Doster house until he passed
[1:42:13] away. And you know what he used to say,
[1:42:15] Kelly, I'm going to somehow I'm going to
[1:42:17] get a red light here. I don't know how
[1:42:19] we're going to get a red light, but
[1:42:20] we're going to get a red light here.
[1:42:22] And I I said all that to say is that
[1:42:25] that area is so I mean, how many
[1:42:28] accidents do y'all know of that Josh
[1:42:30] Parker face? He puts it on Facebook.
[1:42:32] We've had another wreck another hit to
[1:42:34] the Camden restaurant. Another one. In
[1:42:36] the past year, we've had at least five.
[1:42:39] But, from 4:00 to 6:00, the traffic is
[1:42:42] backed up all the way
[1:42:45] to the Parkers.
[1:42:46] You can't you can't get in the highway.
[1:42:48] I I mean, there's no resolution for
[1:42:50] that. And you know, I and I
[1:42:53] I say this
[1:42:55] with two entrances. Okay, one entrance
[1:42:57] is going to come out near where the
[1:42:59] Burgeses is. And that's within
[1:43:02] 1,000 yd of the other subdivision.
[1:43:05] I mean, how in the world is all this
[1:43:07] going to come and go?
[1:43:09] I mean, it's it's not even feasible.
[1:43:10] You're going to have to have a
[1:43:11] helicopter to bring them in to get
[1:43:13] people out with traffic. I mean, 157
[1:43:16] houses?
[1:43:18] So, and it also and I'm just I mean, I'm
[1:43:22] just speaking is
[1:43:26] you know what? I know what I'm saying is
[1:43:28] null and void because any it's David
[1:43:30] Thompson's family's property. Do you
[1:43:32] know his parents were some of the finest
[1:43:35] people I've ever met in my life. His
[1:43:37] mother filed my first set of taxes when
[1:43:39] I was 16 years old. If he'd have posted
[1:43:42] it for sale, I'd have given him $2
[1:43:43] million $2 million for that 100 acres
[1:43:46] just to leave it farmland.
[1:43:48] QuickTrip can offer me $4 million for my
[1:43:51] corner right there. I wouldn't let them
[1:43:53] have it because the older I've gotten, I
[1:43:56] love the soil I've been raised on.
[1:43:58] And if Junior Parker was living, he'd be
[1:44:00] down here tonight speaking up as well.
[1:44:03] I'm saying that we don't have any more
[1:44:05] room for another subdivision right
[1:44:08] there.
[1:44:09] I mean
[1:44:10] And and you know, and we all have a
[1:44:12] problem on that road where the soil
[1:44:14] don't perk. Soil don't perk. Thompson so
[1:44:17] Thompson soil perks. It it it perked
[1:44:19] over there where they bought that
[1:44:20] property. The James Sales farm right
[1:44:23] next door to it, I take care of James
[1:44:24] Sales right now. And his and his farm is
[1:44:27] right there. You know, his soil don't
[1:44:30] perk.
[1:44:32] And I can promise you all of that 100
[1:44:35] acres they're they're trying to purchase
[1:44:36] all of that don't perk.
[1:44:38] Some of it might, but there's going to
[1:44:39] be low areas that it doesn't. And I mean
[1:44:43] and it's a we're never going to have
[1:44:44] sewer out that far. Sewer's never going
[1:44:47] to come that far.
[1:44:49] I'm just saying and I want to go back. I
[1:44:51] don't want to make it personal. I want
[1:44:54] to go back to the fact. I love Canton.
[1:44:59] We don't need another subdivision. One
[1:45:02] with 100 houses on Nichols Ville Road is
[1:45:05] enough. And we know the James Sales
[1:45:07] farm's not going to move as a
[1:45:08] subdivision because their soil don't
[1:45:10] perk.
[1:45:12] But one is enough. How about put a for
[1:45:14] sale sign on it?
[1:45:16] David told the the cashier at the
[1:45:19] restaurant, "I've got to sell it because
[1:45:21] my brother and sister want their
[1:45:23] inheritance." Put it up for sale.
[1:45:25] There's people that's got money that'll
[1:45:27] buy it. That's some of the prettiest
[1:45:29] farmland you've ever laid your eyes on
[1:45:31] there.
[1:45:32] There's people that'll purchase it. Why
[1:45:34] do we have to make it a subdivision?
[1:45:41] I just share my passion for Canton.
[1:45:43] >> Yes, ma'am.
[1:45:45] » Yes, ma'am.
[1:45:45] >> And for the safety and for the residents
[1:45:46] » And for the safety and for the residents
[1:45:46] that are there.
[1:45:47] >> Thank you so very much.
[1:45:50] » Thank you so very much.
[1:45:50] Anyone else in opposition?
[1:45:54] I'm going to ask the applicant
[1:45:57] to step back up. I'll make a couple
[1:45:58] little quick comments regarding
[1:46:02] And while she's stepping up, let me ask
[1:46:03] is anyone here as a proponent for the
[1:46:06] request or the rezone that wants to
[1:46:07] speak on behalf of the
[1:46:10] in favor of? Okay.
[1:46:13] So,
[1:46:15] ma'am, I want you to understand that we
[1:46:17] heard everything and we greatly
[1:46:19] appreciate you being here tonight, okay?
[1:46:22] All right, Andrea.
[1:46:23] >> Yes, sir. Well, I just want to say
[1:46:25] » Yes, sir. Well, I just want to say
[1:46:25] greatly um appreciate Ms. Connerly
[1:46:27] speaking tonight and her passion for our
[1:46:29] community and for her taking care of
[1:46:31] some of the the greatest members of the
[1:46:33] community that have come through Walton
[1:46:34] County. Um I love her passion uh for
[1:46:37] that and I appreciate her speaking
[1:46:39] tonight. Um
[1:46:42] And trying to kind of look at this from
[1:46:44] an objective standpoint, which this
[1:46:45] board is is that that is what this board
[1:46:48] is here to do. When you look at this
[1:46:50] from an objective, legal, regulatory
[1:46:52] standpoint, we're checking all the boxes
[1:46:55] to be able to be approved for this
[1:46:56] rezoning.
[1:46:57] We're consistent with the future land
[1:46:59] use plan.
[1:47:01] We have done our homework on the traffic
[1:47:03] analysis. We've had an actual engineer
[1:47:05] look at this from a GDOT regulation
[1:47:07] perspective and given us advice on the
[1:47:10] things that we need to do to make those
[1:47:11] improvements to make this a safe
[1:47:13] development and we're going to do those.
[1:47:15] Uh we've got the two entrances to help
[1:47:17] the flow of traffic.
[1:47:21] and as far as GDOT, we can't control
[1:47:23] what the state does, you can't control
[1:47:24] what the state does.
[1:47:25] We're happy to have a conversation with
[1:47:27] GDOT about those two areas, but we're
[1:47:29] doing all that we can do on our
[1:47:30] development to make it as safe as
[1:47:32] possible.
[1:47:33] And when you look at the overall
[1:47:34] traffic, you know, coming down Highway
[1:47:36] 11,
[1:47:38] our two developments combined are 149
[1:47:42] homes for both developments
[1:47:45] would increase traffic less than 2% of
[1:47:47] what's already coming there. So, we're
[1:47:49] we're not
[1:47:50] creating the problem here. We're doing
[1:47:51] all we can on our side for what we can
[1:47:54] control to make it as safe as possible.
[1:47:56] And once again, we're meeting all the
[1:47:57] requirements of the ordinance and the
[1:47:59] future land use plan.
[1:48:01] So, with that, I'm happy to answer any
[1:48:02] other questions you may have.
[1:48:05] >> Um Andrea, I know that you indicated
[1:48:08] » Um Andrea, I know that you indicated
[1:48:08] that you guys planned to have a
[1:48:12] landscape buffer, if you want to call it
[1:48:14] that, out front, and you also know
[1:48:22] I have been a part of
[1:48:25] not only the property that's adjacent
[1:48:27] that's going to be combined with this,
[1:48:28] but also one up the street.
[1:48:35] and in doing so, in consistency with
[1:48:38] what I have done on those,
[1:48:42] being that there's exposure from
[1:48:45] Nickelsville Road both at the point of
[1:48:47] entry, and also there's the other
[1:48:49] between the residential outparcels and
[1:48:51] the commercial outparcels on the corner
[1:48:53] >> Yes.
[1:48:54] » Yes.
[1:48:54] >> uh that the lady spoke of.
[1:48:56] » uh that the lady spoke of.
[1:48:57] I would like to see
[1:48:59] that when you're talking landscape
[1:49:02] buffer, we're both more specific.
[1:49:05] Uh there is no tree line as there was on
[1:49:08] the neighborhood up the street, so
[1:49:10] the whole thing's exposed. Um I want to
[1:49:13] see some type of fencing,
[1:49:15] uh shrubs,
[1:49:19] and trees
[1:49:21] that'll be future buffer from the
[1:49:23] roadway
[1:49:24] that are consistent with the other two,
[1:49:27] uh,
[1:49:28] in the conditions that were proposed on
[1:49:30] those.
[1:49:31] For for that, I'm and I'm asking you,
[1:49:33] that's what I'm asking you, do you see
[1:49:35] an issue with that with your developer?
[1:49:38] >> No issue.
[1:49:39] » No issue.
[1:49:39] >> Okay.
[1:49:40] » Okay.
[1:49:40] Uh, just following consistency there.
[1:49:43] Um,
[1:49:45] I don't have any further questions at
[1:49:47] this time. Anyone else have a question?
[1:49:51] Thank you, Andrew.
[1:49:53] Uh, I want to address a couple concerns.
[1:49:55] So, first of all, I mean, I came there
[1:49:57] tonight. I went to Camden, took a right
[1:49:59] up highway 11 here.
[1:50:01] Uh, I've been driving to Camden
[1:50:02] restaurant and eating for
[1:50:05] 30 plus years.
[1:50:08] You might have, and I just don't
[1:50:09] remember you, and for that I ask your
[1:50:11] forgiveness. As my hair continues to
[1:50:13] turn this color, I forget more. So,
[1:50:16] but uh, so I mean,
[1:50:20] I know everything
[1:50:22] that that, you know, has occurred, and I
[1:50:24] I appreciate your concerns.
[1:50:26] Um, I I don't think that I don't think
[1:50:29] that there's anywhere I was just up at
[1:50:31] my dad's house today, so to get what
[1:50:34] used to be my grandfather's
[1:50:36] property to get to my dad's house, I
[1:50:37] have to drive through a neighborhood.
[1:50:39] Uh, you know, change is
[1:50:41] relevant. As long as we keep having
[1:50:43] children,
[1:50:44] we keep needing houses. So,
[1:50:47] um, the use is the other thing, and
[1:50:51] I feel like that
[1:50:52] as I just spoke, um, obviously there's
[1:50:55] been other requests and been very
[1:50:57] consistent. I don't care who the
[1:50:59] landowner is, that really doesn't matter
[1:51:01] to me. I have a protocol I follow, and
[1:51:04] that's being fair. Wouldn't matter who
[1:51:06] the landowner is. I don't have a right
[1:51:07] to tell one person yes and another
[1:51:09] person no. I don't feel like that
[1:51:10] that's, uh,
[1:51:12] um,
[1:51:12] would be proper in any way uh, if all of
[1:51:15] the other checklist is is there. So,
[1:51:19] um, but I I do want to tell you that I I
[1:51:22] really appreciate your concerns and feel
[1:51:25] uh, any pain that you feel. I live at
[1:51:26] the corner of Hickory Grove and Bolt
[1:51:28] Springs. It used to be no subdivisions
[1:51:31] on Hickory Grove
[1:51:32] and now there's four and I have a hard
[1:51:35] time getting out of my own driveway and
[1:51:37] I have a hard time getting in Bolt
[1:51:38] Springs Road. So,
[1:51:40] um,
[1:51:42] it it just it it sneaks. I did hear
[1:51:45] someone the other day, Tracy, have you
[1:51:47] heard anything that somebody did tell me
[1:51:49] that their DOT was looking really hard
[1:51:51] at putting a traffic light there 11
[1:51:53] Nichols Road. Have you
[1:51:55] heard anything regarding that?
[1:51:56] >> heard anything.
[1:51:58] » heard anything.
[1:51:58] >> Yeah, so anyway, uh, hopefully that
[1:52:00] » Yeah, so anyway, uh, hopefully that
[1:52:00] someday we we will see that. We all know
[1:52:02] how that goes with state DOT, but
[1:52:04] hopefully we'll see it.
[1:52:07] Yes, ma'am.
[1:52:11] So,
[1:52:12] >> I've tried [clears throat] to deal with
[1:52:13] » I've tried [clears throat] to deal with
[1:52:13] DOT. I'd rather pull a
[1:52:15] >> Yeah.
[1:52:16] » Yeah.
[1:52:16] >> teeth of a tiger on Prozac than I would
[1:52:18] » teeth of a tiger on Prozac than I would
[1:52:18] deal with the DOT.
[1:52:19] >> I'm with you.
[1:52:20] » I'm with you.
[1:52:20] >> They might promise a red light there and
[1:52:22] » They might promise a red light there and
[1:52:22] it might be 10 years before you ever see
[1:52:25] anything. We're still waiting on one at
[1:52:27] 78 and Youthsman Road.
[1:52:29] >> Yeah.
[1:52:29] » Yeah.
[1:52:29] >> From God only knows how many years ago.
[1:52:31] » From God only knows how many years ago.
[1:52:31] So,
[1:52:31] >> Yeah. Yeah.
[1:52:32] » Yeah. Yeah.
[1:52:32] >> Just cuz the state might talk to you
[1:52:34] » Just cuz the state might talk to you
[1:52:34] don't mean you fixing to get it.
[1:52:35] >> That's right.
[1:52:37] » That's right.
[1:52:37] So, [clears throat] with that being
[1:52:37] said, uh, our task or what we're tasked
[1:52:40] with is we're tasked with looking at the
[1:52:41] request, looking at how it conforms to
[1:52:44] our land use map and also
[1:52:46] uh, does it adhere to
[1:52:48] um, general guidelines that were given
[1:52:51] in consideration for any modification or
[1:52:53] change. And with that,
[1:52:55] I would like to make a motion uh,
[1:52:57] regarding this case of approval with
[1:53:00] the condition that I spoke of that and
[1:53:03] this will include you where for entry's
[1:53:05] going and also that portion between the
[1:53:08] single family residential homes
[1:53:11] and the commercial uh properties on the
[1:53:14] corner of this lady here uh spoke of.
[1:53:17] Uh so, all of that would have to be
[1:53:19] inclusive of both the fencing,
[1:53:22] shrubs, and trees all included
[1:53:26] uh in entry as a buffer between
[1:53:28] Nickelsville Road and this development
[1:53:30] to grow up in the future and give a good
[1:53:32] screen
[1:53:34] uh to that neighborhood.
[1:53:35] So, that would be the only implication
[1:53:37] and I think that's uh the only request
[1:53:39] outside. There was no other further
[1:53:41] request for variances or anything. So,
[1:53:42] with that, that would be my motion.
[1:53:45] Do I have a second?
[1:53:46] >> Second.
[1:53:47] » Second.
[1:53:47] >> I have a second. All in favor, raise
[1:53:48] » I have a second. All in favor, raise
[1:53:48] your right hand and say I.
[1:53:50] >> I.
[1:53:50] » I.
[1:53:50] >> I. Any opposed?
[1:53:53] » I. Any opposed?
[1:53:53] All right. One opposed.
[1:53:55] Four approved.
[1:53:57] Thank you. And this will go to the Board
[1:54:00] of Commissioners next month.
[1:54:10] Next on the agenda for this evening is
[1:54:13] Z260195.
[1:54:15] This is the rezone 14.97 acres from A1
[1:54:18] to A2 to create two
[1:54:21] 1.5 acre buildable lots.
[1:54:25] Uh this is going to be for the
[1:54:26] applicant's children children.
[1:54:29] Ramps Ramperstad Rampersad
[1:54:32] Rampersand
[1:54:33] uh is the owner and the property is
[1:54:35] located at 2940 Fanny Thompson. Sir, if
[1:54:38] you would please give us your name and
[1:54:39] address and tell us what you're asking
[1:54:41] for here.
[1:54:43] >> Uh good evening, Chairman. My name is
[1:54:45] » Uh good evening, Chairman. My name is
[1:54:45] Neil Rampersaud and I reside at uh 2940
[1:54:48] Fanny Thompson.
[1:54:50] And uh we're requesting uh zoning from
[1:54:52] A1 to A2.
[1:54:54] Uh we've been residents in Walton County
[1:54:56] and operating a business for over 20
[1:54:58] years.
[1:55:00] Uh my kids here were educated in Walton
[1:55:02] County.
[1:55:03] Uh, they still live in it Walton County.
[1:55:06] Uh, they attend they attend church in
[1:55:08] Walton County. They serve in their
[1:55:09] community. Community, uh, they serve
[1:55:12] with uh Kids Outdoors Zone and uh
[1:55:15] they've just been a blessing and a joy
[1:55:17] to raise. Uh
[1:55:19] It it was really heartwarming when our
[1:55:21] kids decided to you know, talked about
[1:55:24] building on our property. So, we're
[1:55:26] requesting uh, just uh
[1:55:29] A1 to A2. Uh, we had talked originally
[1:55:32] my kids would say probably because I was
[1:55:34] cheap I tried to do 1 acre, but Ms.
[1:55:36] Malcolm suggested that I do 1.5 and then
[1:55:40] uh turn it into A2. So, that's our
[1:55:42] request.
[1:55:43] >> Okay. And so, these two sites will be
[1:55:46] » Okay. And so, these two sites will be
[1:55:46] for both your children.
[1:55:47] >> Yes, sir. One on one side, one on the
[1:55:49] » Yes, sir. One on one side, one on the
[1:55:49] other. Yes.
[1:55:50] >> Yes, sir. All righty. Any questions from
[1:55:53] » Yes, sir. All righty. Any questions from
[1:55:53] any of the board members?
[1:55:56] Thank you, sir.
[1:55:57] >> Thank you.
[1:55:58] » Thank you.
[1:55:58] >> Anyone here in opposition to this
[1:56:00] » Anyone here in opposition to this
[1:56:00] request?
[1:56:02] Anyone to speak as a proponent for the
[1:56:04] applicant?
[1:56:07] No reason for rebuttal. Any
[1:56:10] questions, concerns, comments amongst
[1:56:13] any of the members?
[1:56:16] If not, I would like to make a motion
[1:56:19] uh, for approval as submitted
[1:56:22] for case Z260195.
[1:56:26] Do I have a second?
[1:56:27] >> Second.
[1:56:28] » Second.
[1:56:28] >> All in favor, raise your right hand.
[1:56:29] » All in favor, raise your right hand.
[1:56:29] >> Say aye.
[1:56:30] » Say aye.
[1:56:30] >> Aye.
[1:56:32] » Aye.
[1:56:32] >> Thank you.
[1:56:34] » Thank you.
[1:56:34] Tracy.
[1:56:38] In a public format
[1:56:40] I would like to note that I have made
[1:56:43] some mistakes tonight.
[1:56:45] I've not always in my recommendations
[1:56:47] quoted the zoning number and you've
[1:56:49] probably caught on to that. That's
[1:56:50] because I've been absent for 2 months
[1:56:52] and I apologize.
[1:56:54] But, you keeping me straight, right?
[1:56:56] Yes, ma'am. Thank you so much. We so
[1:56:57] proud to have
[1:56:59] Christie and Tracy and
[1:57:01] >> The rest.
[1:57:03] » The rest.
[1:57:03] >> [snorts]
[1:57:03] » [snorts]
[1:57:03] >> The what?
[1:57:04] » The what?
[1:57:04] >> The rest.
[1:57:05] » The rest.
[1:57:05] >> The rest? Yeah.
[1:57:06] » The rest? Yeah.
[1:57:06] >> All y'all.
[1:57:07] » All y'all.
[1:57:07] >> Our support staff. Even Even Mark back
[1:57:09] » Our support staff. Even Even Mark back
[1:57:09] here.
[1:57:10] >> Hanging out in the back.
[1:57:10] » Hanging out in the back.
[1:57:10] >> In the back. True Baptist back there.
[1:57:12] » In the back. True Baptist back there.
[1:57:12] So, we got We appreciate having all
[1:57:14] y'all here tonight.
[1:57:15] All right. So, last on our agenda for
[1:57:18] this evening
[1:57:20] is LU26-0179
[1:57:23] and Z26-0177.
[1:57:26] This is a land use change from
[1:57:28] employment center to neighborhood
[1:57:29] residential and to rezone 32.479
[1:57:33] acres from A1 to R1OSC
[1:57:35] to create 20 re- residential lots. The
[1:57:39] applicant is Reliant Homes. Owner 81
[1:57:41] Investments LLC. And the property is
[1:57:44] located at Cedar Ridge Road. And Mr.
[1:57:47] Butler, would you please step up?
[1:57:55] » I'll skip the presentation. Uh this is a
[1:57:57] pretty easy one tonight. This is 32
[1:58:00] acres on Cedar Ridge Road, uh just off
[1:58:03] Highway 78. Uh we are proposing to
[1:58:07] develop a 20-lot subdivision here.
[1:58:09] Uh first, we need to request a land use
[1:58:12] map change. This is in an employment
[1:58:14] center land use map, which would allow
[1:58:17] anywhere from B1 to B3 to M1 to M2. So,
[1:58:21] we are asking for a much less intensive
[1:58:23] zoning as a R1OSC neighborhood and
[1:58:27] requesting neighborhood residential to
[1:58:29] do so. Uh that's was done with the
[1:58:32] property to the west of us a couple
[1:58:35] years ago and developed into a
[1:58:36] subdivision
[1:58:37] under R1OSC in a similar lot size and
[1:58:40] lot yieldage per the acreage. Uh you can
[1:58:43] see in the shaded area that is the
[1:58:45] proposed open space. We're providing the
[1:58:47] 50-ft transitional buffer and making
[1:58:49] that open space along the A1 property to
[1:58:52] the east and rear. Um
[1:58:56] stated before, we have an R1 OSC
[1:58:58] subdivision just to the left of us. To
[1:59:00] the north of us, we touch the Meritage
[1:59:03] development that's in the city of Monroe
[1:59:05] that's about 300 lots on 200 acres. So,
[1:59:09] a much more intense zoning there.
[1:59:11] Uh with that, I will see if you have any
[1:59:14] questions and save the rest of my time
[1:59:15] for rebuttal.
[1:59:16] >> Thank you. Any additional questions for
[1:59:19] » Thank you. Any additional questions for
[1:59:19] the applicant?
[1:59:20] >> Good.
[1:59:23] » Uh Nate, just stay right there just a
[1:59:24] minute. Is there anyone here to speak in
[1:59:26] opposition?
[1:59:28] Okay. All right. Come on up, sir. Give
[1:59:30] us your name and
[1:59:32] your address.
[1:59:35] And tell us what your concerns are or
[1:59:37] what questions you may have. We'll allow
[1:59:38] Mr. Butler to come back and answer
[1:59:40] those.
[1:59:40] >> Uh John Ashley Barrientos. I own 599
[1:59:43] » Uh John Ashley Barrientos. I own 599
[1:59:43] Cedar Ridge Road, Ashley Hills Pet
[1:59:44] Center on Cedar Ridge Road in between
[1:59:46] all these big developments.
[1:59:48] My biggest thing is there've been a
[1:59:49] traffic report.
[1:59:51] Uh we've already seen Rowe Road get shut
[1:59:53] off where there's no cross traffic there
[1:59:55] anymore cuz that got dangerous.
[1:59:57] This is a nightmare intersection. I've
[1:59:58] got clients and employees
[2:00:01] that's it it scares the hell out of me.
[2:00:03] Especially the older clients that come
[2:00:04] down here. They try to turn off of 78.
[2:00:06] You try to tell them how to go up and go
[2:00:07] around and get on 138, get on that, get
[2:00:09] on 11, get back on 78.
[2:00:13] And that's that's more confusing for
[2:00:14] them than than anything else. But my
[2:00:16] fear is just that's going to be a
[2:00:17] danger. From what you're talking about
[2:00:19] all these other places, especially with
[2:00:20] Compton, who knows when Georgia
[2:00:22] Department of Transportation will ever
[2:00:23] take a look at these things or try to
[2:00:25] resolve them.
[2:00:26] You know, that's kind of like a
[2:00:27] junction, I guess, of county and city
[2:00:29] right there. So, I kind of feel like
[2:00:30] it's just in this little no man's land.
[2:00:31] Nobody's going to pay attention to it
[2:00:32] until there's astronomical deaths of
[2:00:35] these students leaving that high school.
[2:00:36] Cedar Ridge Road is already pretty
[2:00:38] dangerous.
[2:00:39] That turn coming through there,
[2:00:40] especially in the wintertime, I mean,
[2:00:42] that it's it's a lot of problems in
[2:00:44] there. Um
[2:00:46] that there's issues with the county in
[2:00:48] that. when we had trees fall down, I
[2:00:49] tried to talk to the sheriff about that
[2:00:51] and he didn't even know where it was. Um
[2:00:53] it just interesting little area there,
[2:00:55] but it's we don't even have reports yet
[2:00:57] on what the neighborhood at the end of
[2:00:58] the road's going to be with 300 somewhat
[2:01:00] homes going in. I'm pretty sure they're
[2:01:02] going to be putting homes across the
[2:01:04] street there as well. I think they're
[2:01:05] already
[2:01:06] pre-set for that. So, that's going to be
[2:01:07] another couple hundred homes.
[2:01:10] As far as a business owner, I love it.
[2:01:11] More homes, more people, more business,
[2:01:13] more opportunities for me. But, I'll
[2:01:14] still look at the community and I think
[2:01:16] we need to start looking at the danger
[2:01:17] that we're putting in this community
[2:01:18] with all these neighborhoods so packed
[2:01:20] together.
[2:01:21] It just I it moving to this community,
[2:01:23] I've been here for 20 somewhat years.
[2:01:26] Awesome to see the growth. Again, as a
[2:01:27] business owner, I love to see the
[2:01:29] growth, but I do think we need to put
[2:01:31] more into the aspects of the danger that
[2:01:33] we're creating on the roadways. Cars are
[2:01:35] going faster.
[2:01:37] Kids getting these licenses. It's you
[2:01:38] know, we're right there by a high
[2:01:39] school.
[2:01:40] So, just something to think about.
[2:01:42] That's it.
[2:01:43] >> Thank you, sir.
[2:01:43] » Thank you, sir.
[2:01:43] >> Cool. Thank you.
[2:01:44] » Cool. Thank you.
[2:01:44] >> Appreciate it.
[2:01:49] » Mr. Butler, if you'd step back up for
[2:01:50] rebuttal.
[2:01:51] >> Yes, sir. So, we did not do a traffic
[2:01:53] » Yes, sir. So, we did not do a traffic
[2:01:53] impact study on this one and I'll be
[2:01:55] honest with it being 20 lots, I know
[2:01:57] what it was going to say and that we'll
[2:01:59] need to do a right in D-cell lane. Um
[2:02:03] it's not going to generate enough
[2:02:04] traffic with 20 lots to require a left
[2:02:06] turn lane. So, we saved the $2,000 to do
[2:02:10] that prior to getting a zoning approval.
[2:02:12] If the county in their review of our
[2:02:14] construction plans require it, we we'll
[2:02:16] do whatever the county requires. Um I
[2:02:19] will just say again, with going from the
[2:02:22] employment center to a neighborhood
[2:02:23] residential, we are going with a much
[2:02:26] less intensive zoning that could go on
[2:02:29] this 32 acres that would generate a lot
[2:02:31] less traffic than what we could request
[2:02:34] under the current future land use map.
[2:02:36] So, I think long-term this puts less
[2:02:38] traffic on this
[2:02:40] Cedar Ridge Road than if it stays as
[2:02:44] currently in the future land use map.
[2:02:48] » Okay. Um
[2:02:51] So, while you're here,
[2:02:53] um is there anyone here as a proponent
[2:02:56] on behalf of this applicant?
[2:02:58] Okay.
[2:03:02] Sir?
[2:03:03] Um I
[2:03:05] I kind of I'm I'm just just following
[2:03:07] protocol. You can talk with Nate. I'm
[2:03:09] sure he'll open himself up. Yeah. Yeah.
[2:03:11] Yeah, he'll open himself up talk to you
[2:03:12] after the meeting.
