[2:58] structure built a house a residence single family dwelling built over on

[3:01] Northeast Road. Um the individual provided us with a

[3:05] plot plan which

[3:07] unfortunately he laid out himself said that he met the setbacks by 80 ft.

[3:12] Um he [clears throat]

[3:15] had to get a foundation certification to verify once it was once he should have

[3:19] done it before but he did it after. Um and he also had a mortgage and uh

[3:25] survey and it showed that he meet missed the setbacks by

[3:29] instead of being 80 ft I believe it was down to 66 ft. He needed to be at 75 ft.

[3:37] » so now that the structure is built and we can't really it's a more of a

[3:41] complicated thing to move it over the 6 ft we're just asking for a consent

[3:44] agreement. Um he is paying a violation fine as well as the legal fees for to

[3:49] have this consent agreement um, drafted.

[3:55] We did go up on the violation because we felt that

[3:59] the last one didn't even meet the the amount for the CBA, which he

[4:04] wouldn't have gotten approved through the CBA anyway.

[4:07] So, this is why we went with the he has a thousand dollar fine plus the six

[4:11] hundred and sixty eight dollar legal fees.

[4:16] to stay where he is. >> And you're okay with all that?

[4:20] » Yeah, I'm fine with it. It was It wasn't a

[4:22] a malicious act. He really He went off a pin that had been moved that he didn't

[4:25] realize it was moved. So, somebody who maintained the road had moved some pins.

[4:31] Um, so he measured off a pin which he thought was his property pin and so

[4:35] that's why he went eighty feet. Come to find out when um

[4:39] the a licensed surveyor went out, that pin was in the wrong spot.

[4:43] So, he It was His intent was there. It just didn't He didn't meet the intent.

[4:52] like I said, it wasn't a malicious act. He wasn't trying to pull up the wool

[6:58] be reviewing it saying how many parking spots he has as per dock slips

[8:16] moving to the Carolinas here at some point.
