purpose of tonight's meeting, how notice
[3:22]
was provided, and whether any comments
[3:24]
were received.

purpose of this public meeting of the
[3:29]
West Perth Committee of Adjustment is to
[3:31]
allow the presentation of an application
[3:33]
for minor variance
[3:35]
and to allow interested members of the
[3:36]
public the opportunity to ask questions
[3:38]
or offer comments regarding the
[3:39]
application.
[3:41]
Any member of the public that would like
[3:42]
to be notified in writing of the
[3:44]
Committee of Adjustment's decision
[3:46]
on the application are to provide their
[3:48]
name and mailing address to
[3:49]
clerk@westperth.com.
[3:51]
This will also entitle you to be advised
[3:53]
of a possible Ontario Land Tribunal
[3:55]
hearing in the event the decision on
[3:57]
this application is appealed. Public
[3:59]
notice was provided to the neighboring
[4:00]
property owners on June 19th, 2026 in
[4:03]
accordance with the requirements of the
[4:05]
Planning Act. I'll turn it back over to
[4:06]

Uh now we get into the uh public
[4:11]
portion. Now, first we'll have uh Perth
[4:14]
County Planner John Bice present his
[4:15]
report and then give members of the
[4:18]
public a chance to ask any uh questions
[4:21]
or make any comments. Um the the
[4:23]
applicant, if they wish to uh speak to
[4:25]
it as well, too, and the committee
[4:27]
members. And then we'd move down to the
[4:29]
decision portion of the the meeting. So,
[4:32]
I'll now call on Perth County Planner
[4:34]
John Bice to present the minor variance
[4:37]
application report.
[4:44]
» Thank you very much, through you, Chair.

Um
[4:47]
so, this application is for a minor
[4:49]
variance.
[4:50]
Uh it's located at 49 William Street,
[4:52]
which is just at the red star on the
[4:55]
slides.
[4:56]
Owners are Patrick Lelystad Candace
[4:58]
Lumens.
[5:01]
Uh so, the property is designated
[5:04]
neighborhood in the Perth County's new
[5:07]
official plan.
[5:08]
Um and the property is zoned Mitchell
[5:11]
Residential High Density uh Zone 4 R4 in
[5:15]
the West Perth Zoning Bylaw.
[5:19]
So, the re- relief being sought uh
[5:22]
is to decrease the minimum distance
[5:24]
between a driveway and an intersection
[5:27]
uh from 9 m to 6 m.
[5:30]
You can see that's outlined
[5:32]
approximately where that would occur um
[5:35]
in the red box.
[5:36]
And then the secondary relief uh is to
[5:39]
decrease the minimum landscape open
[5:41]
space uh from 35% to 33% and that is for
[5:45]
the unit two
[5:47]
um to facilitate the construction of the
[5:50]
deck out back. Uh just it so that it can
[5:53]
be the same size
[5:54]
as the other decks that are proposed for
[5:56]
units one and three.
[5:59]
Uh this image just showcases
[6:01]
approximately where the lot line
[6:04]
um
[6:05]
exists currently and it's uh intended to
[6:07]
show um how large uh the right of way is
[6:11]
uh on the corner of Blenheim Street and
[6:15]
uh and uh Napier there. Um so Perth
[6:18]
County uh
[6:19]
consulted uh West Perth uh the director
[6:22]
of public works who has indicated that
[6:25]
uh he has no concerns with uh the
[6:27]
driveway reduction due to the large uh
[6:30]
area for the sidewalk in the right of
[6:32]
way along Blenheim there.
[6:34]
Um
[6:35]
So the
[6:36]
So going back a bit, the intent um of
[6:39]
the minimum distance a driveway can be
[6:40]
constructed uh from an intersection is
[6:43]
to prevent sightline issues with
[6:46]
motorists utilizing the intersection
[6:49]
um as well as vehicles coming and going
[6:52]
from driveways that are in close
[6:54]
proximity uh to said in intersections.
[6:57]
Um and then the intent of the landscape
[7:00]
open space
[7:01]
uh is to ensure that a property remains
[7:03]
consistent in um
[7:06]
the lot uh
[7:07]
the landscaping of the neighborhood
[7:10]
um and enhance outdoor livability of the
[7:12]
residents who will live there.
[7:14]
Uh so Perth County planning staff
[7:16]
believe that uh the two requests are
[7:19]
minor in nature
[7:20]
um and that we uh support the
[7:22]
application as applied for and I can
[7:25]
take any questions.

applicant and agent and if you just hold

Just to want to confirm with the
[8:07]
uh our planner um
[8:10]
on the diagram
[8:12]
provided in the agenda
[8:14]
the just there's a distance of 15.5.
[8:18]
Guessing that's 15.5 m
[8:21]
from Napier Street to the
[8:25]
west edge of the
[8:27]
proposed driveway.
[8:30]
So, that is from the curb line of Napier
[8:33]
to the edge of the the driveway. So,
[8:35]
that that would be um located in front
[8:37]
of the porch, correct?
[8:39]
» Uh through the chair, um
[8:41]
it's either that or the center line.
[8:44]
This uh drawing that was proposed was uh
[8:46]
done through sketch
[8:48]
um and it's not
[8:50]
to exact scale. It's more of
[8:52]
approximation um at this time.

whether it's center line or curb?

» Uh we could take it back and and look
[9:05]
into it a bit more.

Um

the 9 m is uh the lot line just for
[9:11]
reference.

Um and that's what's is being varied.

Uh so, it's 9 m down to 6 m.

Uh it's essentially to allow the uh
[9:21]
future residents to park along Blenheim
[9:23]
Street uh
[9:27]
if not approved, the individuals would
[9:30]
park uh they would access through Napier
[9:32]
Street through a second access um
[9:36]
that would meet all the provisions of
[9:38]
the zoning bylaw. So, it's essentially
[9:40]
to have all the parking in one location.
[9:42]
On that end unit.
[9:45]
» Okay, and I guess the supplemental
[9:47]
supplementary question if I could, Mr.
[9:49]
Chair. So, if the access was to be
[9:53]
off of Napier Street, how far
[9:56]

» Like how far along Napier from the
[10:00]
Blenheim Street, where would that be?
[10:02]
So, would it be beyond that 9-m triangle
[10:05]
or what would it be looking at?

» Yes, so through the chair, it would be
[10:08]
past the 9-m mark.

» So, this proposal as it sits
[10:18]
right now, West Perth
[10:21]
um
[10:23]
roads department, they're satisfied that
[10:25]
this causes no potential impact on
[10:29]
sightlines or safety traffic safety at
[10:32]
this intersection.

» Sure, through the chair, Director of
[10:35]
Public Works Adam Ryan
[10:37]
sent staff out and they had took a look
[10:41]
at the intersection and advised that
[10:42]
they had no concerns.
[10:44]

driveway is off of Napier. Are they only

» So, through the chair,

they have the ability to put that there.
[11:14]
It meets all the parameters of the
[11:15]
zoning bylaw if they wish.
[11:17]
Their choice, their preference is to
[11:19]
keep all the parking in one location. Um
[11:23]
but if there is a need down the line for
[11:25]
future, if they find that there isn't
[11:27]
enough parking for say visitors, they
[11:29]
have every ability to go and uh
[11:33]
obtain a driveway permit off of Napier
[11:36]
Street through the building department.

[12:29]
Mitchell in the Municipality of West
[12:30]
Perth as it relates to relief from
[12:33]
section 5.19.2.1
[12:37]
to decrease the minimum distance between
[12:39]
a driveway and an intersection of street
[12:41]
lines from 9 m to 6 m to facilitate the
[12:44]
construction of a driveway for the
[12:46]
westerly most unit of a three-unit
[12:49]
townhouse subject to the following
[12:51]
conditions.

That the proposed driveway be generally
[12:55]
of the size and in the location
[12:57]
identified on the applicant's sketch
[12:59]
attached to the report to the
[13:01]
satisfaction of the West Perth Building
[13:03]
Department and that the proposed
[13:05]
driveway be located along Blenheim
[13:07]
Street and not located along Napier
[13:10]
Street.

That the owners obtain any necessary
[13:14]
building permits within 2 years of the
[13:16]
approval of the minor variance.
[13:18]
Relief from sec in part two, relief from
[13:21]
section 12.6.10
[13:23]
to decrease the minimum landscape open
[13:26]
space from 35% to 33% to facilitate the
[13:29]
construction of a deck for the middle
[13:31]
unit of the three unit townhouse subject
[13:35]
to the following conditions. That the
[13:36]
proposed deck be generally of size and
[13:39]
in location as identified on the
[13:41]
applicant's sketch attached to this
[13:43]
report to the satisfaction of the West
[13:45]
Perth building department and that the
[13:47]
owners obtain the necessary building
[13:48]
permits within two years of the approval
[13:51]
of the minor variance.

for the following reasons. The relief
[14:13]
requested is minor nature. It is
[14:15]
required for appropriate development of
[14:17]
the property. It maintains the general
[14:19]
intent and purpose of the official plan
[14:21]
and it maintains the general intent and
[14:23]
purpose of the zoning bylaw. Could I
[14:25]
