[1:34]
>> I'll call this meeting of
[1:34]
the planning and zoning board,
[1:38]
local planning agency regular
[1:41]
meeting on SEPTEMBER 3rd to
[1:41]
order.
[1:41]
Thank you.
[1:45]
I was going to do that, but I
[1:45]
appreciate that.
[1:45]
Oh, sorry.
[1:45]
Are you ready?
[1:48]
I'll do a roll call.
[1:49]
Chairperson cochran ma'am.
[1:53]
I sure for my michael ferrante
[1:53]
board member lou law here.
[1:56]
Format board member rachel hood
[1:57]
here for member matt criswell
[2:00]
here assistant city attorney
[2:03]
chris mike here beautiful.
[2:07]
So as I think we'd like to
[2:08]
stand for the pledge of
[2:08]
allegiance and all almost
[2:14]
silent
[2:21]
I pledge allegiance to
[2:25]
the flag of the united states
[2:26]
of america and to the republic
[2:29]
for which it stands one nation
[2:33]
under GOD, indivisible, with
[2:36]
liberty and justice for all.
[2:40]
Beautiful.
[2:41]
I don't know of any agenda
[2:41]
changes.
[2:44]
Staff is there any?
[2:44]
Yeah.
[2:45]
Well, as you can tell we do not
[2:48]
have our chairperson or a vice
[2:49]
chairperson here today so we
[2:52]
will have to do another pro tem
[2:52]
chair election.
[2:55]
So it's pretty much just you
[2:56]
having to run the meeting for
[2:56]
today.
[2:56]
Is there anyone that is
[2:59]
comfortable with doing so?
[3:00]
I know MS. Hood has done it
[3:01]
before so I didn't know if she
[3:03]
wanted to take the reins like
[3:04]
she did at the beginning or I'm
[3:07]
happy to do that if the.
[3:08]
>> yes I agree.
[3:08]
Beautiful.
[3:11]
I'd run us right into a ditch
[3:14]
so I think that's perfect.
[3:15]
You have a lot of experience.
[3:18]
No promises that we can
[3:19]
continue.
[3:19]
All right.
[3:22]
Any awards or presentations I
[3:22]
assume?
[3:25]
No.
[3:26]
Which leads us to public input.
[3:29]
So anyone wishing to speak on
[3:30]
an item that is not covered on
[3:31]
the agenda MAY do so at this
[3:33]
time.
[3:37]
>> seeing and hearing none we
[3:38]
can move on to the consent
[3:40]
agenda which is item number
[3:40]
three approval of the thursday
[3:43]

[3:54]
Planning zoning board agenda
[3:57]
regular meeting minutes.
[3:58]
I'll
[4:01]
I was in here but I read
[4:01]
through them so if there's
[4:02]
changes I would think that they
[4:04]
would be changed.
[4:05]
So know I'll do a quick roll
[4:09]
call them chipper isn't it?
[4:13]
I remember hello I remember
[4:15]
first of a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a a.
[4:20]
Oh great movie I'm saying good
[4:23]
you can moving on to the public
[4:27]
hearings agenda item number 400
[4:30]
audience ordinance 2026 dash
[4:30]
there seven town center
[4:37]
district 5t5 transect setbababababababababababababababababababababababababababababababababababababababa move to staff
[4:37]
presentation.
[4:41]
Good evening everyone.
[4:44]
Carolyn royal director ofe any visuals today.
[4:48]
Item number 400 ordinance 2020
[4:52]
6-07 which addresses town
[4:52]
center district t five transect
[4:54]
setbacks.
[4:55]
Just a little bit of history
[4:58]
there back in 2020 ordinance
[4:58]
2020 dash two.
[5:01]
Chapter 20 of the code of
[5:05]
ordinances was updated to
[5:05]
address streetscapes, setback
[5:09]
and step back requirements
[5:09]
along for 34 specifically in
[5:11]
the town center district.
[5:12]
So thatttttttttttttttttttttttttttttttttttt
[5:16]
applicable transects except for
[5:16]
the t five that was
[5:20]
inadvertently out.
[5:24]
So we are updating the code now
[5:24]
to allow.
[5:27]
To specify the setback
[5:30]
requirements for townhomes and
[5:35]
the t five transit and to bring
[5:38]
the standards in the t five
[5:38]
transect to align with those
[5:44]
and t three and t four and and
[5:48]
then to clarify the setbacks
[5:52]
for structures and t five
[5:52]
transects.
[5:53]
So in essence we had some
[5:56]
requirements that should have
[5:57]
been addressed back a few years
[5:59]
ago and we're updating.
[6:03]
To have the t five included in
[6:07]
that to reflect this thing and
[6:10]
I'll take any questions again,
[6:11]
I mean is there anything that's
[6:15]
changed between the time that t
[6:18]
three and four was was set into
[6:22]
the the ordinance from what t
[6:23]
five is now or is it all the
[6:23]
same?
[6:24]
>> we know we didn't have any
[6:26]
changes since then.
[6:27]
We just did not apply the last
[6:30]
set of changes to the t five
[6:30]
which included allowing
[6:34]
townhomes and specifying the
[6:36]
setbacks for those.
[6:36]
Okay.
[6:43]
Thank you
[6:44]
.
[6:49]
And so I put a emotion yes, we
[6:49]
need to do a public hearing
[6:52]
just because it's a public
[6:53]
hearing it does speak to the
[6:56]
other questions from the board
[6:59]
before we open up to public now
[6:59]
.
[6:59]
Okay.
[7:00]
All right.
[7:00]
That I will open the topic up
[7:02]
for public input.
[7:06]
Scene and hearing none I would
[7:10]
call for a motion.
[7:11]
>> I'll make a motion to adopt
[7:15]
the ordinance and to into the
[7:23]
set back as stated in written I
[7:28]
second we want to write to a
[7:31]
person who I remember hello I
[7:37]
remember chris well I.
[7:38]
All right thank you.
[7:41]
Thank you.
[7:42]
All right.
[7:44]
Moving on to agenda item 401
[7:47]
the 1626 would drive accessory
[7:51]
dwelling unit conditional use
[7:52]
three I we started with a
[7:55]
presentation by I.
[7:56]
Hi good evening john rayburn
[7:56]
senior planner.
[8:00]
So this is a fairly simple
[8:00]
conditional use application for
[8:06]
edu located at 1626 wood drive
[8:07]
the property itself as you can
[8:13]
see is 1.29 acres.
[8:17]
The home is currently sitting
[8:18]
on the property is.
[8:21]
>> was sorry was constructed in
[8:21]
1986.
[8:25]
It located in tuscaloosa unit
[8:28]
12 and has a low density
[8:29]
residential future land use the
[8:33]
structure in question here is
[8:33]
actually been a preexisting
[8:35]
accessory structure that was
[8:36]
constructed in 1989 and
[8:41]
identified its plans as a
[8:43]
backyard playhouse.
[8:46]
>> it is six hundred and 62ft,
[8:50]
which is roughly 15% of the.
[8:53]
>> 4330 five square feet of
[8:53]
living area of the single
[8:57]
family residence.
[8:57]
And the 82 as it's proposed is
[9:01]
going to include two bedrooms,
[9:03]
one bathroom kitchen and a
[9:04]
living room.
[9:08]
>> furthermore, because this is
[9:08]
an existing structure, the
[9:12]
exterior already has physical
[9:16]
similarities to the primary
[9:16]
structure and it is subservient
[9:20]
in height to the primary
[9:20]
structure.
[9:23]
You can see this survey here.
[9:27]
There is some flood plain on
[9:30]
the property or of the in in
[9:34]
this instance the building came
[9:38]
included with a fema national
[9:38]
flood insurance program
[9:41]
elevation certificate which
[9:44]
means it has been raised above
[9:45]
the appropriate level where
[9:49]
flooding should not be an issue
[9:53]
on this site.
[9:54]
And so moving on to this site,
[9:54]
the floor plan here, you can
[9:57]
see as was outlined, these are
[10:00]
the two bedrooms, the bathroom,
[10:00]
the kitchen over here in the
[10:07]
living room
[10:08]
.
[10:09]
>> so and one more thing just
[10:11]
to give you an idea of what
[10:11]
this looks like.
[10:13]
The outside views are nice
[10:18]
photo.
[10:21]
And lastly, so we're proposing
[10:22]
that this accessory dwelling
[10:29]
unit recommend that you all
[10:30]
recommend approval to the city
[10:33]
commission of the conditional
[10:34]
use adu subject to the
[10:34]
following conditions.
[10:37]
The execution of the
[10:37]
declaration of restrictions
[10:40]
which was provided to staff by
[10:41]
city attorney's office earlier
[10:44]
this week and we and you have
[10:45]
been provided with a copy that
[10:48]
includes the additional
[10:48]
conditions that are listed
[10:52]
below, including that the adu
[10:53]
should not be sold or conveyed
[10:53]
separate from principal
[10:56]
residence and use restricted to
[11:00]
the size approved by the city.
[11:01]
The use permit shall be in
[11:04]
effect only so long as either
[11:05]
the principal residence or the
[11:07]
edu was occupied by the owner
[11:08]
record of the principal
[11:11]
residence who is with us
[11:15]
presently today and lastly that
[11:16]
the ag you should not be used
[11:17]
for commercial purpose other
[11:19]
than being leased for
[11:22]
residential purposes and if it
[11:23]
is leased for residential
[11:26]
purposes the period must be a
[11:30]
minimum of six months and with
[11:31]
that I will open myself up to
[11:34]
any questions.
[11:38]
The questions from the board
[11:38]
not not for you.
[11:41]
Okay.
[11:42]
Would the applicant care to
[11:48]
give any comments to the board
[11:49]
if you could just if you could
[11:50]
come up to the board, you don't
[11:52]
have to.
[11:53]
>> you don't have to.
[11:54]
It just if you do, just make
[11:54]
sure you state your name and
[11:58]
address for the record.
[11:59]
Well, I had a question in 2022
[12:02]
how far up did the creek come
[12:03]
to the property which he'd have
[12:04]
to go there and give your name
[12:06]
and address.
[12:07]
>> sorry.
[12:10]
Good way to state your name and
[12:11]
address.
[12:13]
>> joseph antonovich address
[12:16]
1626 with winter springs,
[12:17]
florida 32708.
[12:17]
I was not the owner of the
[12:20]
property but the property in
[12:21]
APRIL of 2026.
[12:25]
This year I did speak to the
[12:29]
original owner and he said it
[12:31]
did not make it to the building
[12:32]
and then I did get the
[12:35]
elevation survey the building
[12:36]
was never raised and so the
[12:39]
building sits higher than the
[12:43]
everleigh the flood plain and
[12:43]
fema has already removed it
[12:47]
from their flood flood plain
[12:50]
that thank you.
[12:50]
That's all I had.
[12:51]
Thank you.
[12:54]
Any other questions for the
[12:54]
applicant?
[12:56]
I didn't have any questions
[12:56]
either.
[13:00]
Thank you so much.
[13:01]
All right.
[13:05]
Any other discussion from the
[13:05]
board, christian?
[13:08]
You know, just we have to open
[13:09]
it up for the public, not just
[13:11]
the applicant.
[13:12]
Thank you.
[13:18]
Any public input?
[13:19]
All right.
[13:22]
Seeing and hearing none, I
[13:26]
would call for a motion.
[13:27]
Would you mind putting the
[13:27]
slide the staff recommendations
[13:29]
like that?
[13:33]
There we go.
[13:33]
I'd like to make a motion
[13:37]
approving for public hearing
[13:38]
agenda item for a one based on
[13:43]
staff recommendation to have
[13:43]
through the whole thing or
[13:44]
something.
[13:47]
>> you know, if you would like
[13:50]
you could just say subject to
[13:51]
execution of the declaration of
[13:52]
restrictions because the
[13:55]
remainder are all in the
[13:58]
declaration of restrictions or
[13:58]
subject to the execution of the
[14:02]
declaration of restrictions.
[14:05]
>> and and you said recommend
[14:05]
approval.
[14:06]
>> correct?
[14:09]
Thank you.
[14:18]
Second on that moment
[14:20]
, a few
[14:20]
hoops to go.
[14:24]
Chairperson hi board member
[14:24]
hello.
[14:25]
Hi board member chris will
[14:29]
people oh right.
[14:37]
So it's move on to report.
[14:38]
Welcome to the board to our
[14:39]
newest member.
[14:43]
Thank you I guess for the
[14:43]
board.
[14:47]
My name is matt criswell.
[14:48]
I'm a third generation central
[14:50]
floridian.
[14:53]
I've lived in tuscola for 15
[14:53]
years.
[14:57]
I think previously sat on the
[14:58]
code enforcement board for I
[15:04]
think almost ten years put in
[15:05]
and then I ran for three
[15:05]
consecutive terms and then
[15:08]
termed out.
[15:09]
I'm currently set as the
[15:12]
chairperson for the sumter
[15:12]
county port authority, which is
[15:13]
fine.
[15:13]
We don't really have cruise
[15:16]
ships or anything but it's it's
[15:17]
on the water and it's mostly
[15:20]
industrial and commercial
[15:23]
property that we rent.
[15:24]
But we do have a marina there
[15:27]
that we've done.
[15:28]
I've done some parks and
[15:28]
recreation in the past.
[15:29]
We started the parks foundation
[15:31]
for seminole county.
[15:32]
So this is not new to me.
[15:35]
Politics and boards are not new
[15:35]
to me.
[15:36]
So I was told today that this
[15:38]
is a voluntary position and it
[15:39]
wasn't getting paid.
[15:42]
>> it didn't know that I was
[15:42]
kidding.
[15:43]
>> I'm glad to get back.
[15:44]
If you guys say I'm a local
[15:47]
business owner, I own some
[15:49]
construction companies mainly
[15:54]
roofing where the good guys we
[15:54]
don't do the insurance work.
[15:57]
It's mostly commercial general
[15:58]
contractor and we have just
[15:58]
happy to be here.
[16:02]
So lean on me if you need
[16:03]
something and I lean on if I
[16:04]
need something from you guys
[16:08]
appreciate welcome to the board
[16:08]
.
[16:11]
Please.
[16:12]
I don't have any reports.
[16:12]
All right?
[16:16]
I don't have any reports
[16:16]
either.
[16:19]
Pretty cut and dry and I know
[16:22]
this today, so I thought you
[16:22]
right.
[16:23]
I'll open it up one final time
[16:30]
for any public input.
[16:30]
All right.
[16:31]
Seeing and hearing none will
[16:34]
enter a new meeting.
[16:40]
Thank you
