[10:14] coding that we can evaluate for these
[10:16] types of gains as well if that's what

[28:41] the county on Monday via a resolution
[28:45] saying that the proposed Vape ordinance
[28:47] is attached for County's review and
[28:51] pursuing to the state of law they have
[28:52] 30 days in which to do the
[28:55] review because as you all know the the
[28:57] more a atorium is coming up and expiring
[29:00] in June pursuing to that then we need to
[29:02] do a public hearing um prior to the
[29:06] extension of that for another uh 3
[29:09] months so um I would recommend that the
[29:14] council pass a uh resolution calling for
[29:17] a public hearing on for next week for
[29:20] the 10th if it's necessary to extend
[29:24] that
[29:25] moratorium obviously it depends on what
[29:28] you all do here tonight as far as
[29:30] changing you know the the draft and then
[29:33] subject to the County Planning
[29:35] Department's review and
[29:38] recommendations so that's the process
[29:42] the big picture and Mr con will go
[29:44] through some of the uh Provisions that
[29:47] uh staff has been going through so the
[29:50] first provision is pretty brief um in
[29:51] section B location uh the only thing
[29:54] that need to Chang is are to is not
[29:56] included as one of the Z districts that
[29:58] these will be prohibited in all the
[30:00] other residential districts as long as
[30:01] C1 2 3 and the I districts were included

[30:22] restriction on location of H vate BR
[30:24] smoke Andor vape shops um we decided to
[30:29] take out paragraph 1 um in regards to
[30:32] the radius regarding um residential uses
[30:36] uh originally there was a th000 ft
[30:38] radius in any residental in any
[30:40] industrial Zone that was near uh within
[30:42] 1,000 ft of a residential district the
[30:44] reason we decided to get rid of that is
[30:46] because the majority of our uh
[30:48] industrial districts are very small to
[30:50] begin with um and pretty much all of
[30:52] them have hes that are within 1,000 ft
[30:55] of residential districts so I I pulled
[30:58] the data
[30:59] earlier uh M1 and M2 districts which is
[31:02] which are our industrial manufacturing
[31:04] districts are only about 11% of the of
[31:07] the area of the city um to begin with
[31:09] and the vast majority of those Parcels
[31:11] that lie within those districts are
[31:14] within the you know within the radius of
[31:16] the residential so we'd effectively be
[31:18] banning them from nearly all of the
[31:20] industrial districts regard uh If This
[31:22] Were to be enacted um given the fact
[31:25] that the industrial is obviously very
[31:27] clear and separate from the residential
[31:29] um we didn't see that as necessary the
[31:32] other reasons why we didn't see it as
[31:33] necessary go with the next two items um
[31:37] first of all there's going to be we
[31:39] wanted to keep up the 1000 ft radius
[31:42] with similar uses meaning if there's a
[31:45] one smoke shop in that region that you
[31:47] can't have another one within 1,000 ft
[31:49] therefore if you have one in an M1
[31:51] District unless things are very
[31:53] perfectly situated which you're not
[31:56] going to have a second in that
[31:57] Industrial distri
[31:58] um meaning there's only going to be one
[32:01] per District close to Res relatively
[32:04] close to residential I should say it's
[32:05] not even going to be near residential um
[32:08] but because of that we're going to
[32:09] severely decrease the amount the density
[32:12] of the smoke shops um there the last
[32:14] thing in number
[32:17] three um we wanted to switch it from
[32:20] 2,000 ft to 750 ft away from schools the
[32:24] reason for that is again similar to what
[32:28] I was saying before these are already
[32:30] being
[32:31] severely limited um 2,000 ft from as
[32:34] it's currently listed right now would
[32:37] effectively REM limit it completely um
[32:41] and and it would effectively make it so
[32:43] you cannot open one of these shops which
[32:45] I understand is part of the purpose of
[32:47] the moratorium however you know we need
[32:49] to allow for some uses of it we can't
[32:51] outright ban it completely um so the
[32:53] goal was to get a 750 ft away from
[32:56] schools um most of which are already
[32:58] located in residential districts that
[33:00] wouldn't
[33:01] have any any use for this anyway there
[33:04] are a few schools that I have listed
[33:06] that that would be affected and that
[33:07] would take that would uh eliminate some
[33:09] of those business and Industrial
[33:11] districts from uh consideration but for
[33:14] the most part it would stay relatively
[33:16] similar to how it is um again the
[33:20] purposes written as it is um with the changes that I just detailed we
[33:24] would still be severely limiting the the
[33:27] smoke shops um but it would make it a
[33:30] bit more accessible for them with that
[33:31] was still making it completely uh
[33:33] restricted for for our
[33:35] purposes and just to follow on on Mr K's
[33:39] comments uh regarding section two
[33:42] currently section two there would
[33:45] be a minor tweak there where would say
[33:48] uh legal hookah lounge uh smoke shot and
[33:51] vape lounge that's just added just to
[33:54] make it
[33:55] consistent and excuse me were you adding
[33:58] that language it would be under two it
[34:01] would be such legal Hooks and and vape
[34:05] bounds in the original draft the smoke
[34:09] shop was was deleted but was was not was
[34:12] omitted and should have been in there so
[34:14] that's just a corrective action okay and
[34:16] then uh Madam president as you know the
[34:20] council also got a a memo from the uh
[34:23] from the Planning Commission regarding
[34:25] uh this um while they didn't indicates
[34:29] a a uh a uh specific percentage of the
[34:34] floor area of a smoke shop Vape Shop
[34:37] hooker Lounge um they did indicate that
[34:41] it would be something some less than 40%
[34:47] which the current draft has and just uh some localities have gone down as far
[34:53] as
[34:54] 25% so I'm just giving you a range 25 to
[34:59] propos was was take ordinance that
[35:02] language was taken from the Town of
[35:04] Babylon so other localities have G to
[35:08] 25 so just giving the council a range of
[35:11] uh
[35:13] numbers um so you were there with a
[35:15] planning meeting do you want to talk
[35:17] about that please uh effectively what
[35:19] they said is they wanted to they thought
[35:20] 40% was too large of an area um because
[35:24] you can their their main concern is you
[35:26] could have 30 8% of the floor area be
[35:29] dedicated to smoking materials and then
[35:30] the rest just be filled with they call
[35:32] it fluff items um so technically it's
[35:35] not 40% of the floor area that's that's
[35:37] we smoking um and they can be legally
[35:39] operating but it would effectively be
[35:40] operating as a smoke shop so that's why
[35:42] they wanted that threshold uh lowered as Mr BR said they don't have a specific
[35:46] number they wanted it something closer
[35:48] to how a sparts operates um with you
[35:51] know smoking products in the back and
[35:54] speaking with uh Christine perano
[35:55] upstairs we thought I mean clearly
[35:58] stewards is not a smoke shop um so we
[36:00] wanted it a bit more than that 25% in
[36:03] our estimation seemed like a fair number
[36:05] um as Mr BR said we got that was similar
[36:08] to other municipalities in the
[36:14] area so um my my only concern with that
[36:18] is that smoke shops that's all they have
[36:20] is so um it's not like STS where they
[36:23] have ice cream and cigarettes smoke
[36:25] shops that's that's all they have so
[36:28] um I'm not sure if we I'm not saying
[36:30] that we shouldn't lower it I just don't
[36:32] want to make it so restrictive that
[36:35] there we're essentially trying to tell
[36:36] them they just can't have their products
[36:38] um advertised not I don't both CHS but I
[36:42] think we need to be fair and how we U
[36:44] put this legislation together I think
[36:45] that's fair yeah they uh the reason they
[36:47] brought it up is there was a uh was a
[36:50] convenience store opening up and when
[36:51] they found out that it could be up to
[36:53] 40% they found that it would they were
[36:55] effectively going to operate as a smoke
[36:56] shop based on the conversation that was
[36:58] had in the Planning Commission meeting
[36:59] with with that applicant um so that
[37:02] that's what spurred their
[37:07] recommendation yes Mr Tor I did notice
[37:09] one um convenience store that that did
[37:12] um advertise as a smoke shop on half of
[37:15] the store that smoke shop sign came down
[37:18] so um I know there's been some um
[37:20] enforcement out there as well so and it wasn't on our list of even legal
[37:25] smoke shops so yeah off officers put a
[37:28] lot of effort into restricting the
[37:32] sence Mr WS so I had one question
[37:35] and just not really sitting that well
[37:39] with me in the section c uh
[37:42] reducing the uh the the property around
[37:44] schools from
[37:47] 2750 as you as you mentioned just
[37:49] referencing just the intent with which
[37:51] this was presented to the to the council
[37:53] in 2008 says this ordinance this
[37:56] ordinance is an athet regul land use and
[37:58] to protect health and safety and the
[37:59] welfare of our community pursuant can
[38:01] you just speak to the reasoning behind a
[38:05] identifying 2,000 as an appropriate
[38:06] measure and I understood what you
[38:08] speaking towards of reducing that to 750
[38:11] so you're saying why was 2,000
[38:12] originally considered 2000 was that was
[38:14] the model that we used that was out of
[38:16] the Town of Babylon that's where the
[38:18] figure 2000 came from so upon further
[38:21] review that's where we're we're looking
[38:23] at now taking that those feet and
[38:26] looking at the zoning map and where
[38:28] these location where these these shops
[38:30] are going to go and then regarding the
[38:34] 750 you Al that that would really just
[38:38] affect the the commercial districts in
[38:40] C4 and C5 is that pretty much there so I
[38:44] went through all the schools in the city
[38:46] um there are a couple that come within
[38:49] 750 ft of this as I said most schools
[38:51] wouldn't be affected by this anyway
[38:53] because they're in primarily residential
[38:54] districts there would be a few schools
[38:56] that earn that 7 50 foot buffer um
[39:00] effectively what it would be looking
[39:01] like is this a majority of our
[39:03] industrial districts which I said after
[39:05] these things are about 10% of our our
[39:08] city would be able to have smoke shops
[39:10] as as a freight if they have one there
[39:12] can't be another within 1,000 ft M it
[39:14] would be severely limiting there C4 and
[39:16] C5 which is downtown in our business
[39:18] districts it would be special use permit
[39:20] again with the same rules applying with
[39:21] 1,000 ft um what that allows the
[39:25] Planning Commission to do is have a lot
[39:26] more leeway over what's allowed so even
[39:29] though you might come into issues where
[39:31] you know it's near residential areas
[39:34] that are technically C4 um the Planning
[39:37] Commission has the authority to view
[39:39] that as a whole and take that into
[39:40] consideration when passing approvals and
[39:43] just okay would you be able to provide
[39:45] us a listing of those schools that might
[39:46] potentially be affected absolutely thank
[39:48] you and just following on Mr K's remark
[39:51] regarding the special use permit um the
[39:54] uh section 2649
[39:57] 9 subb of of the code says the proposed
[40:00] building that would be the Vape chop or
[40:03] use will not have a substantial undo
[40:05] adverse effecta on adjacent property the
[40:08] character of the neighborhood traffic
[40:10] conditions parking uh utility facilities
[40:13] and other matters affecting public
[40:15] health safety and general welfare so
[40:18] those even though you're decreasing that
[40:20] as far as the special use permit the
[40:22] Planning Commission has to factor those
[40:25] uh uh items into their decision and just
[40:29] as a sort of a a standpoint right now I did the analysis for this obviously
[40:33] this building would never be a smoke
[40:34] shop let's hope um but a 500t radius
[40:37] from here would take you down to
[40:39] Broadway to Union Street and State
[40:41] Street so in 1,000ft radius would you
[40:43] know be twice that size so so having one
[40:46] smoke shop there is going to severely
[40:48] impact the rest of that neighborhood and
[40:49] make it clear if any
[40:53] others did you have hand up um that was
[40:56] good clarified point I I mean I was
[40:58] questioning the 750 as well and how we
[41:00] got to that lower number from 2000 so
[41:04] and also wasn't sure why you know we
[41:06] just didn't say a thousand since we were
[41:08] you know using a thousand as the marker
[41:11] in the other in in the other bullet um
[41:15] but cuz I mean my concern is having them
[41:18] close to schools we don't want them
[41:20] close to schools um
[41:22] so you know but sounds like that's a
[41:26] good enough distance
[41:28] we felt as if it was we spent a lot of
[41:29] time talking about it um 750 we thought
[41:32] was a was a fair number um and like I
[41:34] said I looked at all the schools the the
[41:37] ones that would be affected are still
[41:38] going to be you know a decent amount
[41:40] away from the industrial districts and
[41:41] again that's only also if things are
[41:45] perfectly placed to be as close as
[41:46] possible if there's one on the farther
[41:48] end of the industrial district that's
[41:50] closer to a th000 or more feet away from
[41:52] the school that's going to make it so
[41:53] there's nothing else that can get even
[41:54] remotely close
[41:59] so these are for the um like people that
[42:01] are goinging to be applying so for the
[42:04] existing VAP the existing legal vape and
[42:07] smoke shops um these those will be taken
[42:10] into account when you when somebody else
[42:12] is trying to locate so those would take
[42:14] into account let me pull up or something
[42:17] it's
[42:18] on section one
[42:21] um those businesses according to this
[42:24] legislation would be would cease to
[42:26] exist after 1 year um of the city
[42:29] council adopting the legislation now if
[42:31] they are in an industrial district
[42:33] already they can apply for site plan
[42:36] approval again if they are in a c4 C5
[42:39] District they can apply for a special
[42:40] use permit um if they are in another
[42:43] District as I I know one of the main
[42:45] problem areas is Upper Union Street
[42:46] which is C2 they could apply for a use
[42:49] variant um which at the last page
[42:51] details that it could be granted if they
[42:53] showed that they have not received
[42:55] Financial
[42:57] you know the proper financial
[43:00] repercussions for opening the business
[43:02] in the first place and the use variants
[43:04] would only be good until they get their
[43:06] finances in order once they you know get
[43:09] a return on their investment then the
[43:11] business would cease to exist again and
[43:13] could not reopen again unless there was
[43:15] a used variance granted which would be
[43:16] unlikely
[43:21] mhm I I don't know telling people
[43:24] they're going to do their business in
[43:25] the year I'm not sure that

[50:55] sale and it's way for the the zoning

[51:03] on the floor space inventory what's this
[51:05] business all

[51:12] 40% substantial or significant it's 25%
[51:15] you know 25% is
[51:18] that significant or
[51:21] substantial um like I said some
[51:24] localities have gone down to 25% so

[51:37] that that an inspector can can use but

[51:54] of them I mean it's the same they have
[51:58] the same product store after store after
[52:00] store I would say more than 40% of their
[52:03] floor is dedicated to vape and smoka and
[52:06] paraphernalia and things like that so um
[52:09] 40 and I mean 40 would I think a lot of
[52:13] the stores I've been in would reduce
[52:15] their inventory as it is now uh 25%
[52:19] would even reduce it further um so again
[52:24] I'd like to hear what um you know what
[52:26] the Planning Commission recommends I can
[52:28] see lowering it a little bit but the I
[52:31] think the 25% would really limit what
[52:33] they have in their shop and if we're
[52:35] allowing their shops to be there then
[52:38] they should at least be able to kind of
[52:40] sell what they have I guess I 40% was a
[52:43] number originally that was agreed upon
[52:45] between the department of development
[52:46] and the law office so that that was a
[52:48] number that we took from a couple
[52:49] different spots and and looked at um the
[52:53] Planning Commission just agreed
[52:57] so um I think we can move this forward
[52:59] but we'd have to I still would like to
[53:00] hear from the Planning Commission what
[53:02] their um rationale was for that and we
[53:04] could get that before um before it's
[53:07] time to actually um within 30 days that
[53:10] the council that the county would have
[53:12] to send it back um I have to agree with
[53:14] mror I think that we don't want to limit
[53:16] it really too much so we're just
[53:18] basically not giving people an
[53:19] opportunity to run their business Mr you
[53:23] suggested moving forward in
[53:25] 40% but that and amend it when we
[53:28] receive the recommendation from the
[53:29] county

[59:19] on projects in the city uh this item
[59:23] coming before you tonight I want to
[59:25] thank
[59:27] uh the landbank team ecni Community
[59:31] Builders developers
[59:33] Metroplex it will
[59:36] have as big an impact or more than some
[59:40] of the other things that have we've
[59:42] announced and are getting bigger
[59:45] headlines but it's going to clean up a
[59:47] lot of blight within the area it's going
[59:49] to create housing opportunities and
[59:51] hopefully just continue the level of
[59:53] excitement that we have on community on
[59:55] this Community where people are making
[59:57] Investments here and that they'll be
[59:59] able to take advantage of your
[1:00:01] moratorium on the price structure Mr
[1:00:03] here but with that I turn it over to Mr
[1:00:06] Gillan from uh Metroplex to go through
[1:00:09] the uh proposal and the request we thank
[1:00:13] the council it should be we thank the
[1:00:17] council president for uh having us
[1:00:19] tonight and for all of you for being
[1:00:21] here I want to introduce Steve strikman
[1:00:23] from our land bank love having backing
[1:00:26] on our team s bua from Five Corners
[1:00:29] development very involved in this
[1:00:31] project Andy brick our legal
[1:00:34] counsel Courtney Davis from LaBella
[1:00:38] Associates and yon Thompson from
[1:00:40] Community Builders who's already done so
[1:00:42] much good work on the Aly Street
[1:00:44] Corridor as the mayor said we're very
[1:00:46] pleased to bring this forward this me
[1:00:49] this is really we're riding on the
[1:00:51] coattails of the great work done by the
[1:00:54] legal team and the codes team here in
[1:00:56] the city and the mayor and everyone in
[1:00:58] this room to uh it kind of reminds me of
[1:01:02] the wedgeway building we went after our
[1:01:04] bad owner there we're able to collect a
[1:01:08] huge fine get the building transferred
[1:01:10] to a new owner we have a $20 million
[1:01:12] project under way there with the help of
[1:01:14] the restore theor program we want to do
[1:01:16] the same here so first and foremost
[1:01:18] though the cod's team the Leal Team Max
[1:01:20] has been spectacular on this and she
[1:01:22] joined the city team uh won a judgment
[1:01:25] against the owner of this connected 40
[1:01:27] properties of $760,000 that's the
[1:01:30] biggest fine in the history of the city
[1:01:32] as I understand it again I have nothing
[1:01:34] to do with it I wish I could take credit
[1:01:36] for it this it's so spectacular but I
[1:01:38] can't and um with this so you not only
[1:01:42] are you going to get $760,000 to put in
[1:01:44] your budget but we're going to get these
[1:01:46] blighted properties cleaned up which is
[1:01:48] just so exciting and you see a couple
[1:01:50] pictures there just go back to me if you
[1:01:52] can the one building I've talked to the
[1:01:54] council president on this upper left
[1:01:56] many many times it's it's burned out
[1:01:58] it's a disaster um you know you look at
[1:02:01] the interior conditions of some of these
[1:02:03] buildings along the Albany Street
[1:02:04] quarter so it's it's really exciting
[1:02:07] that uh this this judgment was levied uh
[1:02:10] and now we're moving forward the plan to
[1:02:12] clean up the pl
[1:02:14] sites in addition this all of those
[1:02:17] buildings are along the Aly Street
[1:02:19] quarter adjacent to that Al Street
[1:02:21] quarter of course is the Mohawk Honda
[1:02:23] site which our partners at the county
[1:02:25] agreed to buy and have closed on
[1:02:27] purchased it for $980,000 and the county
[1:02:31] has dedicated as you all know $3 million
[1:02:33] to develop that site of arpa funding to
[1:02:35] develop a grocery store at that site so
[1:02:37] we've got all of this potential uh good
[1:02:40] things happening on Aly Street and of
[1:02:42] course the um Monda site is right next
[1:02:46] to one of the great things about this
[1:02:48] site it fronts both on Aly Street and on
[1:02:50] State
[1:02:51] Street next
[1:02:54] slide when we looked at
[1:02:57] developing uh the Monda site for um
[1:03:02] retail and for new development it
[1:03:05] quickly became apparent that you
[1:03:06] couldn't do one project without the
[1:03:08] other you had to run these projects in
[1:03:10] tandem I didn't think of this I wasn't
[1:03:12] smart enough but our team is is very
[1:03:14] smart so they said You' got to run these
[1:03:16] in tandem when we started showing the
[1:03:18] Mohawk Honda site to to developers and
[1:03:20] to uh interested retailers they said
[1:03:23] what about all this BL on ay street
[1:03:25] right next to s so you have to do them
[1:03:26] in Tandem and that's why we're here to
[1:03:28] talk about tonight we're moving them
[1:03:30] forward at the same time we've put
[1:03:32] together a great team commity Builders
[1:03:34] Five Corners development Better
[1:03:36] Community neighborhoods uh the
[1:03:37] consultant team is very strong from our
[1:03:40] environmental experts to CT mail laella
[1:03:43] Andy brick Law Firm Jackson Demolition
[1:03:46] and of course Metroplex of the
[1:03:49] land this team has been very busy uh
[1:03:53] over the last uh 6 to8 months surveys
[1:03:56] have been completed phase one
[1:03:57] environmental reviews completed Phase 2
[1:04:00] is basically completed ongoing Geotech
[1:04:03] so we're testing the soil ongoing
[1:04:05] asbestos testing demolition budgets put
[1:04:08] together asbestos abatement is underway
[1:04:10] on these properties so we're getting
[1:04:12] ready to develop the site this is the
[1:04:14] same thing we did at the ALCO site this
[1:04:16] is the same thing we've done time and
[1:04:17] time again in this
[1:04:20] community again not only did the county
[1:04:22] buy Monda and get site control but we
[1:04:26] went after and again the city uh was
[1:04:28] super Cooperative on this uh we were
[1:04:31] awarded a $2.75 million Grant from the
[1:04:34] Restore New York program to demolish and
[1:04:36] clean up this site and prep it for
[1:04:38] development so we have that in hand so
[1:04:40] again it's a development momentum we
[1:04:41] have these properties on Aly street that
[1:04:43] are coming under control we have the M
[1:04:45] Honda side under control and now we have
[1:04:47] this grant to help prep the M Honda site
[1:04:50] for um development we're here tonight
[1:04:53] because you need to play a key role in
[1:04:55] moving this project before we want to
[1:04:57] rezone and this is critical for this
[1:04:59] project to go forward it's in a minor
[1:05:01] change there's four Parcels on sken
[1:05:04] street that are that need to be reson uh
[1:05:08] and there are three Parcels on Albany
[1:05:11] Street the four on all on sken street
[1:05:14] two are owned by Sora and they're in the
[1:05:16] process we're in the process of asking
[1:05:18] those to be turned over to the land bank
[1:05:21] the other two are part of this connected
[1:05:22] 40 the infamous connected 40 assemblage
[1:05:26] all of the properties on Albany Street
[1:05:27] are part of the uh uh the sk40
[1:05:31] assemblage so you see uh on the first
[1:05:34] Slide the current zoning see the red box
[1:05:37] um on SKC Street see the small red box
[1:05:40] on Aly street again four Parcels on
[1:05:42] skincity three on on Albany we move
[1:05:46] those into the green uh and um you can
[1:05:50] see that all the adjacent areas are
[1:05:52] already zoned uh you know as C4 so we're
[1:05:56] making a very minor change with three
[1:05:58] Parcels on ALB street that are part of
[1:06:00] the sked 40 assemblage four on connected
[1:06:04] Street what that allows us to do is move
[1:06:07] forward with the project uh site a is
[1:06:10] the Monda site to to demolish that
[1:06:13] building almost an 18,000 ft building
[1:06:16] clean it up remediate it site B there
[1:06:19] are 10 Parcels there very blighted those
[1:06:22] come down the buildings are unsafe Again
[1:06:24] part of theu 40 assemblage site C
[1:06:28] similar activity the parcels are cleaned
[1:06:31] up they're heavily damaged that's the
[1:06:33] fire damage parcel that you see in Aly
[1:06:35] street now it has to come down it's very blighted and and dilapidated site
[1:06:41] so we're able to clean up a lot of this
[1:06:43] bried Corridor on ALB Street and here's
[1:06:46] the good part uh what we are planning to
[1:06:49] do with this great development team
[1:06:51] we've put together is to build the new
[1:06:54] grocery store of 16 000 ft um in site
[1:06:59] a and build
[1:07:02] 125 housing units as well in site a in
[1:07:07] site B on the lower left uh 80 units
[1:07:11] site C 20 units so 225 units of new
[1:07:16] affordable high quality
[1:07:19] housing uh Fitness Center business
[1:07:21] center community indoor outdoor space
[1:07:24] you see all the green space on on the
[1:07:25] map there's a lot of green space in this
[1:07:27] project one of the things we talked to
[1:07:29] the council president about many times
[1:07:31] is having a very nice pathway from the
[1:07:35] grocery store back to Albany Street
[1:07:37] that's in the plan uh we have big buffer
[1:07:40] areas around underground parking uh uh
[1:07:44] you know first level parking of the
[1:07:46] apartment buildings being uh first floor
[1:07:48] parking so it's really a a very good
[1:07:51] site plan and uh we're excited to move
[1:07:54] it forward but we need to do this
[1:07:56] uh zoning change this minor zoning
[1:07:58] change in order to do this what does
[1:07:59] this get us more more quality housing
[1:08:02] removal of blighted and hazardous
[1:08:05] buildings uh continue the the uh
[1:08:07] development that we want to see in this
[1:08:10] quarter provide access to Transit
[1:08:12] provide walkable development and um a
[1:08:16] tree line sidewalks we talked to the to many of you about you're concerned
[1:08:20] that this be a walkable development have
[1:08:22] good sidewalks have good landscaping and
[1:08:25] really be a nice addition to our
[1:08:28] community of course one of the reasons
[1:08:30] we're doing this one of the drivers is
[1:08:32] to improve access to fresh food enhance
[1:08:36] food security improve quality of life
[1:08:38] and and the store will create 25 to 30
[1:08:40] new jobs as well so it's really a a very
[1:08:43] creative development taking those
[1:08:45] blighted buildings down that you won
[1:08:47] this big judgment against this notorious
[1:08:49] landlord who was um Breaking All the
[1:08:52] Rules uh getting us 760,00 ,000 getting
[1:08:57] those sites developed for quality
[1:08:58] affordable housing taking the site that
[1:09:00] the county purchased cleaning that up
[1:09:02] knocking the building down and
[1:09:04] developing it for
[1:09:06] grocery to move this forward that's what
[1:09:08] we're asking you to do declare your
[1:09:10] intent that you often do to be lead
[1:09:12] agency under Seeker which is required
[1:09:14] for any project like this make a
[1:09:17] referral to the Planning Commission uh
[1:09:19] the evening on the zoning change and
[1:09:22] they'll go through their usual process
[1:09:24] and call for a public hearing as
[1:09:27] well you see a couple of the skanky 40
[1:09:30] properties there um they're really
[1:09:32] blighted and um again they all get
[1:09:35] cleaned up uh with this project and we
[1:09:38] happy to answer any
[1:09:43] questions um so you talked about the
[1:09:45] grocery storees do you have has you
[1:09:47] identified who that grocery store we're
[1:09:49] under a non-disclosure right now but we
[1:09:51] have a letter int of intent uh in place
[1:09:54] we're working very diligently to
[1:09:56] complete that transaction okay could you
[1:09:59] give us a little bit information what
[1:10:01] the timeline might would look like would
[1:10:02] look like on this project the the
[1:10:04] timeline is is we move this ahead take
[1:10:08] the zone change to the Planning
[1:10:10] Commission uh it's critical to allow um
[1:10:15] uh this development to to move forward
[1:10:18] uh and again it builds on the momentum
[1:10:19] we've already seen on allby stre the
[1:10:21] community Builder Hillside Crossings
[1:10:23] project uh the Joe Allen
[1:10:25] apartments and um uh some of the other
[1:10:28] developments Hillside Crossing 2 um we
[1:10:32] then move into the uh development stage
[1:10:35] and bring the the project the building
[1:10:37] designs and and other uh features of the
[1:10:40] project back to the Planning Commission
[1:10:41] for final review and move the project
[1:10:45] forward overall do you know about and
[1:10:48] the time onine I'm not trying to like
[1:10:50] pin it down to the day we have been
[1:10:51] meeting weekly for longer than I want to
[1:10:54] tell you
[1:10:56] we have a call every Friday with this
[1:10:59] development team and we take notes and
[1:11:01] uh it is moving forward um I would say
[1:11:05] what would you think to me yeah Q2 Q3
[1:11:08] 2027 we would expect delivery so we
[1:11:11] we're hoping to have all HCR approvals
[1:11:14] by Q2 Q3 of this coming year and then
[1:11:17] it's about a roughly a two-year build oh
[1:11:20] okay the the key is getting the the
[1:11:23] sites prepped and cleaned up uh getting
[1:11:26] Monda cleaned up getting the building
[1:11:28] down we have the restore Grant in hand
[1:11:30] the developer the development team we
[1:11:33] put together has the financing to
[1:11:35] purchase these buildings from the
[1:11:37] receiver that's has been appointed by
[1:11:38] the courts to sell these properties so
[1:11:40] you get your $960,000 this
[1:11:47] year9 76 you got me all right and then
[1:11:52] uh so that happens the demolition of
[1:11:55] cond would happen this year the
[1:11:57] demolition of the sky 40 properties
[1:11:59] would happen this year hopefully this
[1:12:01] year yep and then we'll have cleaned up
[1:12:05] sites environmentally remediated like we
[1:12:07] did look at the you know the the corner
[1:12:09] of KRA all where we built that beautiful
[1:12:11] new housing and cleaned up you know a
[1:12:14] dry cleaner site that was very very
[1:12:16] dirty you know so all of those things
[1:12:18] take a little time but then we head into
[1:12:21] the development phase and the
[1:12:23] construction phase and it's a it's a very large exciting
[1:12:28] project as a mayor said this Rivals some
[1:12:30] of the larger developments that we've
[1:12:32] seen happen in this community uh as a
[1:12:34] result of our great partnership between
[1:12:36] the county and the city and our unified
[1:12:38] economic development team is it
[1:12:41] conceivable that the the store the
[1:12:43] grocery store will be open before all
[1:12:44] the apartments are completed or there
[1:12:47] like everything going if you want to if you wanted to add something to this
[1:12:50] you could join Mr Gillan up here because
[1:12:51] then you'd be on the cameras um is it
[1:12:54] conceivable that the grocery store would
[1:12:56] be open prior to that is it are you
[1:12:58] planning just everything kind of launch
[1:12:59] it at one time it's probably going to
[1:13:01] happen all at the same time just CU part
[1:13:03] of the funding from from the HCR is
[1:13:05] going to include funding for helping to
[1:13:07] support the grocery store okay so
[1:13:08] realistically speaking it would all be
[1:13:10] delivered around the same time I mean uh
[1:13:13] the Monda site is obviously going to be
[1:13:14] the first we're not necessarily phasing
[1:13:16] it but it's going to be the first to be
[1:13:17] built and then we're going to move on to
[1:13:19] the other sites it's going to sites
[1:13:21] after but it wouldn't be open until
[1:13:23] everything else is finished even if yeah
[1:13:25] okay thank
[1:13:27] you Mr Wes uh so it's more of a comment
[1:13:31] definitely scany winning and respect to
[1:13:33] economic revitalization and
[1:13:35] Redevelopment is definitely something
[1:13:37] that I've come to just appreciate
[1:13:39] whenever you come to our Council and
[1:13:40] definitely is respective of the team and
[1:13:42] its Collective work so to definitely
[1:13:44] thank you for continuing to provide
[1:13:46] these types of results um in that same
[1:13:48] context I also want to say U taking a
[1:13:50] Step Beyond that where it's apparent the
[1:13:53] end users benefit from these types of
[1:13:55] efforts where the grocery store and the
[1:13:57] additional housing and some of the other
[1:13:59] areas that you highlighted but also I
[1:14:01] want to make sure there's considerable
[1:14:02] Investments kind of speaking in in
[1:14:04] spirit to what councilman Farley always
[1:14:06] brings up um making sure that our small
[1:14:08] business owners and our small business
[1:14:10] contractors can see those wins as well
[1:14:12] not to speak as though they do not um
[1:14:14] but saying that we need to continue
[1:14:16] making sure that there are also tangible
[1:14:19] wins for those types of individuals
[1:14:21] where having uh these developers come in
[1:14:23] and help clean up definitely very
[1:14:25] welcomed but I know we have some upand
[1:14:27] cominging businesses within the
[1:14:28] community who are truly prideful scant
[1:14:31] dians that would love to be a part of
[1:14:32] these efforts as well you know that's a
[1:14:33] great point I'm glad you rais it we just
[1:14:35] had an Outreach event up at the Mosaic
[1:14:37] development on Crane Street inviting you
[1:14:39] know the neighborhood in inviting the
[1:14:41] local businesses in we'll do the same
[1:14:42] thing here over and over inviting the
[1:14:45] team in and I'm just comment on earlier
[1:14:47] thrilled that you passed the pro housing
[1:14:50] uh move that forward tonight thank you
[1:14:51] because that's going to help us in so
[1:14:52] many ways that is really be becoming
[1:14:55] something that they they'll look at when
[1:14:56] they're scoring these Grant applications
[1:14:58] to the state so as your development
[1:15:00] director said very well this evening
[1:15:02] that's a very important that'll be
[1:15:04] helpful to our grant applications that
[1:15:05] we're applying
[1:15:07] for Miss Patrick I just um wanted to
[1:15:10] comment about the grocery store because
[1:15:12] of course there's also the Electric City
[1:15:14] grocery store going in at the other end
[1:15:17] um and I'm just wondering if there was
[1:15:19] ever consideration
[1:15:21] of using this site for the Electric City
[1:15:24] grocery store so that now in we'll have
[1:15:27] two Grocery Stores um instead of one
[1:15:31] both are still under development it's a
[1:15:32] good question we have spoke spoken to
[1:15:35] both groups they're both still under
[1:15:38] development um um that's a question you
[1:15:42] have to ask to call
[1:15:45] up okay and I think this is fabulous I'm
[1:15:48] very excited especially that the
[1:15:50] demolition will happen within this year
[1:15:52] is what I think I heard you say um so
[1:15:55] the fence will be going up um the next
[1:15:56] couple weeks around M Honda and um
[1:16:00] you'll see the site remediated and the
[1:16:02] other and the house and the demolition
[1:16:03] as well we're just wait waiting on
[1:16:05] closing the contract once that with the
[1:16:07] housing once we close on that we'll demo
[1:16:09] those Monda will come down sooner uh but
[1:16:12] realistically speaking within the next
[1:16:14] two or three months would be our V I
[1:16:16] really want to thank the team the mayor
[1:16:18] mat we've taken up a lot of your time
[1:16:21] her time on preparing legal briefs and
[1:16:24] other things for the development team
[1:16:26] council president has been uh advising
[1:16:29] us on this and working with us for
[1:16:30] months now on this development you know
[1:16:32] going back made some very good points
[1:16:35] about when we should bring this forward
[1:16:37] uh given the U the legal issues that
[1:16:40] were surrounding this we're very
[1:16:42] confident now this is the time and place
[1:16:43] to move this project forward and and
[1:16:45] clean up this this blight on Al Street
[1:16:48] and and clean up the mwanda site as well
[1:16:51] and again we should say Manda has been
[1:16:53] nothing but Cooperative on this
[1:16:54] abolutely great citizens of the
[1:16:56] community held the option with the
[1:16:59] county for 3 years so that all the
[1:17:01] proper due diligence could be done with
[1:17:03] the cleanup and Etc
[1:17:06] so Mr M on the apartments are there
[1:17:10] considerations for set aside low income
[1:17:13] apartments yeah so the uh the entire uh
[1:17:17] all of the buildings all four of the
[1:17:18] buildings will be affordable affordable
[1:17:20] in income regulated so so you have to
[1:17:23] show
[1:17:25] your your rent is based on your
[1:17:27] income
[1:17:29] okay there these are high quality units
[1:17:32] Business Center Fitness Center
[1:17:35] Parking uh Green Space uh these are
[1:17:38] units every one of us would be proud to
[1:17:40] live in they're made affordable by state
[1:17:43] housing tax credits that are issued so
[1:17:46] that um we don't price these out of the
[1:17:49] range of hardworking connect idiot
[1:17:52] basically and and that's a big part of
[1:17:54] our our agenda as well you wouldn't know
[1:17:56] the difference if this was a marker rate
[1:17:58] or affordable housing it just happens to
[1:17:59] be for affordable people who qualif yeah
[1:18:03] thank you in terms of infrastructure um
[1:18:06] you know we had this we had a similar
[1:18:08] conversation when um the other Hills
[1:18:10] side view went in terms of the sidewalks
[1:18:12] essentially you know what the sidewalk
[1:18:14] BLS look like and obviously walked it so
[1:18:16] that is all built into this so that
[1:18:18] we're it's going to become really
[1:18:20] walkable yes absolutely it's all part of
[1:18:22] our plan okay y a lot of green space
[1:18:25] cleaning up light cleaning up
[1:18:27] environmentally uh dirty sites and and
[1:18:29] building quality units and uh making a a
[1:18:32] walkable development okay we've spent a
[1:18:35] lot of time we're viewing through the
[1:18:36] complete streets program so we're very
[1:18:39] familiar with what city wants and what
[1:18:41] we need to deliver thank
[1:18:44] you anyone else Chris Wen said to me be
[1:18:48] short tonight be
[1:18:50] quicket I have a tendency to go on but
[1:18:53] we wanted to fully on this development
[1:18:56] and we appreciate our whole team coming
[1:18:57] out and U being here tonight we

[1:19:10] time um the council would need to thank

[1:19:52] think there's any requirement that you
[1:19:54] have the public hearing before that but
[1:19:56] I was hoping that the public hearing
[1:19:57] could be either on June
[1:20:00] 14th dates June 10th or June 24th I mean
[1:20:03] there will be public there people will
[1:20:06] have the opportunity to speak publicly
[1:20:08] the Planning Commission meeting they'll
[1:20:09] have opportunity to speak at every one
[1:20:12] of the council meetings as this gets
[1:20:13] adopted down the road Madam president I
[1:20:15] would recommend that the 24th because by
[1:20:17] that time the Planning Commission would
[1:20:19] have had their meeting and then there
[1:20:22] you would have it on the 24th
[1:20:25] and it would be draft legislation
[1:20:27] perhaps for comment by that time based
[1:20:30] on the actions of the Planning
