uh that's currently offering us portable
[2:56]
showers and um toilets uh in their rate
[3:00]
is $5,200 per
[3:02]
month can you just tell them about the

background a little bit on that there's
[3:06]
a bit of a background right so initially
[3:08]
um Mike's we contacted them because they
[3:11]
were local and they've done a great job
[3:12]
we put it out to bid we had two biders
[3:15]
uh one the winning bidder for $5,200
[3:20]
came from Tent South LLC they're out of
[3:22]
uh South Carolina uh they they came up
[3:25]
here and ultimately experienced problems
[3:27]
with uh freezing temperatures and um
[3:31]
basically just just bad luck on their
[3:32]
part they pulled out the next day and
[3:34]
could not honor the contract anymore U
[3:37]
Mike's Portables really kind of give
[3:38]
them some accolades and and a shout out
[3:40]
initially their uh contract was for 6560
[3:44]
per month but um they they actually
[3:47]
suggested that they can honor the $5,200
[3:49]
per month uh which was the lowest
[3:54]
bit Mr chair follow what theant just
[3:57]
said this was terminated for the mutual
[3:59]
convenience both the uh for us and for
[4:02]
the uh the vendor um they couldn't
[4:04]
perform they thought they could it was
[4:06]
logistical was as as the lieutenant has
[4:09]
indicated so we both mutually terminated
[4:13]
the the city as well as the uh as the
[4:15]
vendor that's on the record in the city
[4:18]
purchasing officer office so my
[4:20]
recommendation is that the resolution go
[4:23]
forward and will'll make reference to
[4:25]
the previous resolution in the new
[4:27]
resolution that the other one is is
[4:29]
recent previous resolution we awarded we
[4:31]
seem and we're awarding it uh to the new
[4:33]
vendor at the at the price
[4:36]
indicated so so we don't need to Res no
[4:39]
it will be be incorporated by reference
[4:41]
into that so you we don't have to do you
[4:43]
don't have to do a separate Standalone
[4:45]
resolution you can do in one resolution
[4:47]
which makes reference that the reason
[4:49]
why you're doing this new re resolution
[4:51]
is that it was terminated for
[4:54]

so the contractor on the bathrooms does

think that it could take a year for the

happening over the last two weekend

there have been multiple U vehicle uh

vandalism in the city in specific into

area like Hamilton Hill and mon Pleasant
[6:12]
and you know it's like a pattern last
[6:15]
Saturday the previous Saturday and I
[6:17]
would like if Chief clip may can give us
[6:20]
an update as what can we do or what
[6:23]
action can be take to kind of like
[6:25]
increase Patrol in these areas to kind
[6:27]
of you know push these um corpet trate
[6:30]
off that not power in the future go
[6:33]
ahead please chairman again the uh
[6:36]
police
[6:37]
department an hour ago
[6:39]
or more put out a press release
[6:43]
summarizing some of that and asking for
[6:46]
Public's assistance put out some
[6:48]
photographs Tings to help
[6:51]
identify uh the individuals depending on
[6:55]
what questions you're going to look for
[6:58]
would questions be done an executive
[7:00]
session because it's still a active
[7:03]
ongoing criminal
[7:05]
investigation I I can some some of the
[7:07]
question or thing been asked to um by us
[7:10]
on the resident and said what can the
[7:12]
police do to help you know push this off
[7:15]
people on show back again next weekend
[7:17]
again and you know vitalizing car what
[7:20]
action what increase Patrol things like
[7:22]
that I don't think we want talk about
[7:24]
you know the arrest or you know what is
[7:26]
the investigation or things like that to
[7:27]
be it's more of an action kind of item
[7:30]
as so increased Patrol will be there you
[7:33]
know somebody helping identify those
[7:36]
pictures very quickly make sure it
[7:39]
doesn't happen so in the press that I
[7:40]
went out today it has image it has yes
[7:43]
there are images available okay would
[7:46]

you're putting them in additional

expense to to do that so they're asking

us what can do to help and that's why

here putting an agenda to ask we need to
[8:33]
do something to help them sure so I
[8:35]
would say that uh the first thing that
[8:38]
we can do is is the public in the in the
[8:40]
Mount Pleasant neighborhood because
[8:42]
that's primarily where these are is to
[8:43]
be extra vent with with looking outside
[8:46]
their Windows if they hear a noise if
[8:49]
they hear uh kids walking down the
[8:51]
street making loud noise it could be
[8:52]
these individuals um we don't know if
[8:55]
they're juveniles or adults but we we we suspect the juveniles we're just not
[8:59]
sure what age they are um if they have
[9:03]
cameras call us there's a tip line
[9:05]
that's going to be put out um with a
[9:08]
press release call the tip line let us
[9:10]
know about it lock their car doors don't
[9:12]
leave anything in sight of them a couple
[9:15]
cars have been stolen so lock their
[9:17]
doors if they had the ability to park
[9:19]
off Street in their driveways where
[9:21]
there's motion detecting lights that
[9:23]
would be very beneficial um so that
[9:26]
you're limiting your risk to having your
[9:28]
playes uh vandalized
[9:30]
um as far as what we're doing um we have
[9:32]
our our detective assigned to this case

that works our 800 p.m 4 a.m. p uh uh

time frame he''s been Consulting with
[9:42]
our school resource officers our uh our
[9:45]
the probation department um every every
[9:48]
Network that we have Citywide that might

be able to ENT identify young

individuals that we believe are doing
[9:54]
this and

um we also have increase Patrols in
[10:00]
those areas so uh we spoke with the
[10:02]
patrol Chief this uh this morning and we
[10:05]
will be having uh additional patrols
[10:07]
regular a regular timed interval uh
[10:11]
overnight uh throughout this week um so
[10:14]
that we can we can make sure that we're
[10:15]
out there um and as the mayor already
[10:17]
indicated we put some photos out um that
[10:20]
do have identifiable clothing we'd like
[10:23]
to know who these individuals are so
[10:25]
please give us a call if they have any
[10:26]
idea and uh we're looking to identify
[10:29]
them and get restitution for the for the
[10:31]
victims if
[10:33]

they if they have any outdoor lights

leave them on overnight the better the

lighting the better the cameras work you

know they don't work work great in the low light situations um but you know

we have a lot of cameras in Mount
[12:17]
Pleasant you know there's no doubt that
[12:19]
we will be able to identify them so with
[12:21]
the public assistance we'd rather do it
[12:23]
sooner than later and uh find out what's
[12:26]
going on with these individuals and get
[12:28]
them stopped
[12:30]

concern of there res sure we certainly

detective konis is the tough sign

detective and he's been working on it

everybody is aware of that that he has
[12:51]
been working on it he's been making
[12:52]
progress It's just unfortunately hasn't
[12:54]
been able to make an arrest yet one of
[12:57]
the concern and I told most of the
[12:59]
residents who be calling is that they're
[13:00]
asking that the police response time to
[13:02]
them is like you know couple hours out
[13:04]
but I can't you know notify them that
[13:06]
they have to deal with so much um so
[13:08]
much of complaint so much of call for
[13:10]
the very same thing so they're working
[13:12]
their way towards that is that a true
[13:14]
statement is the kind of tell from yeah
[13:17]
from a Tre perspective we always uh
[13:20]
prioritize uh you know incidents that
[13:22]
have all people over property so that
[13:24]
most so that that's it's possible that
[13:26]
especially on a weekend that may have
[13:27]
happened
[13:31]
so so I did get some of this information

but 100 cars is
[13:36]
missing I think it's up of that TS I wow

I didn't know was that significant I

know it was a lot yeah we had

uh 25 to 30 vehicles on the first night

verifies their video and all that but we

have an easy way that they can send them
[15:06]
up to us um via the internet but they
[15:09]

next item on the agenda is a discussion
[15:24]
to amend city code chapter 183 which is
[15:27]
nuisance um if you can recall our
[15:30]
conversation previously it highlighted
[15:32]
that the ongoing nature of just noise
[15:34]
complaints throughout the city is
[15:36]
definitely something that continues to
[15:37]
affect us the quality of life for a lot
[15:39]
of our
[15:40]
cadians um in the special meeting that
[15:44]
we had the commissioner Divine
[15:46]
recommended adjusting our nuisance code
[15:49]
specifically and improving or raising
[15:52]
the value Point threshold for noise from
[15:55]
fre and he didn't give us an actual
[15:57]
number to change it to however my
[15:59]
recommendation is increasing it to six
[16:02]
which would be the maximum and I think
[16:04]
that takes into consideration just the
[16:06]
ongoing nature of just how disruptive
[16:08]
noise is to our residents and although
[16:12]
it would lower it from three or four
[16:16]
instances to two to have to meet that
[16:18]
12p point threshold I think it takes
[16:20]
into consideration not every call is
[16:24]
having one infraction there might be
[16:26]
multiple calls associated with each
[16:28]
infraction
[16:29]
um so I think it shows or presents a
[16:33]
very aggressive response from the city
[16:35]
and that this is something that we do
[16:37]
not want to continue to tolerate and
[16:39]
absolutely we understand that
[16:40]
individuals enjoying their themselves uh
[16:44]
and their parties or with their vehicles
[16:45]
is definitely nothing we're trying to um
[16:48]
disrup but making sure you do that in a
[16:51]
manner that is appropriate and not
[16:53]
infringing on other people's um personal
[16:57]
space so if there any question questions
[16:59]
or comments Mr Mr chairman you've got in
[17:02]
your packing of a copy of the proposed
[17:04]
ordinance which the chairman indicated
[17:08]
increases uh the penalties from one
[17:11]
category up to the sixth category so a
[17:13]
lot of that's adding it on and deleting
[17:16]
you know ring the paragraphs and also
[17:18]
the bottom portion of it is dealing with
[17:20]
the actual fines Mone money portion
[17:24]
there's no you can that's the current
[17:25]
schedule I didn't do anything to amend
[17:28]
what the penalties are there for 250 400
[17:31]
Etc the council wishes to as part of
[17:34]
this overall package which wishes to
[17:36]
increase
[17:37]
those fine amounts if you do so part of
[17:40]
the overall Amendment of the
[17:43]

form for the sound permit the code calls

for it but as far as the form has to be
[18:17]
developed and we're using the forms that
[18:19]
you provided as the basis in which to
[18:21]
create a simple form for folks to
[18:25]
use can we at that find
[18:29]
together two cycles from yes two cycles
[18:33]

issue would would be six points for um

offenses involving marijuana so would

that just be smoking it on the street or

it at dispensaries and things so should

that be six points versus um you other
[19:48]
things that that are on here that may be
[19:52]
especially yeah a little bit more un LLY

dealing with a child I mean different

things like that

I I'm in favor of this I just wondered

these are your recommendations if we

could get some you know I say with
[20:09]
respect to the noise it is if there are
[20:11]
other items that are U other individuals

like to address absolutely but I would
[20:16]
say for me was specifically highlighting
[20:18]
on noise um and focusing on adusting
[20:20]
that one issue um I think often times
[20:23]
when we do expand our scope sometimes we
[20:25]
lengthen the timelines and I think this
[20:28]
has been an issue that's been ongoing
[20:30]
for years since I've from the council so
[20:32]
I think wanting to just remain um with
[20:35]
addressing this one area but if you'd
[20:37]
like to expand that absolutely I would
[20:39]
just want to make sure that did not
[20:41]
delay our response in total um I think
[20:44]
that's for Mr just to follow up on that
[20:47]
Mr chairman I mean you can move forward
[20:49]
with a call for a public hearing on
[20:51]
amending this portion of the noise and
[20:53]
then always revisit whatever portions of
[20:56]
those various C you know those other
[20:58]
categories as points so you can do it as
[21:01]
a stand alone rather than doing all at
[21:04]
one time so that's that's your option so
[21:06]
you can go back and revisit those other
[21:08]

and you hear complain about the time you

know loud music you know exhaust and all

these things are happening loud music

from Cars so we we need to act

so it's it's a good working

document any other questions or

comments probably because I agree uh
[22:14]
with uh Mr M was saying as far as like
[22:17]
addressing this now before we weather
[22:20]
breaks and we have more people outside
[22:21]
more people having events things of that
[22:23]
nature and I would just you know kind of
[22:25]
um also let the amplify the fact that
[22:27]
this again that there's an educational
[22:28]
component to this as well um so as we're
[22:31]
making these changes we're just you know
[22:33]
letting people know that you know that
[22:35]
we are taking a more um a Ser stance on
[22:39]
this therefore I think that some of that work can be preventative so
[22:42]
I think that that's an important part
[22:43]
there I just didn't want of those in
[22:45]
conversation Mr and that will factor in
[22:48]
the the permit um application process so
[22:51]
that if if someone has an event they can
[22:52]
come and apply for a permit so we know
[22:54]
all the details who who's promoting this
[22:56]
event and you know the approval process
[22:59]
they contact information so the police
[23:01]
can directly contact them they don't
[23:02]
need to go show up on the property they
[23:04]
can call them or let them know you know
[23:05]
we're receiving complaint you permit is
[23:08]
11:00 or 10:00 you need to shut down we
[23:11]
don't need to come over there they can
[23:13]
do that in house so that perit process
[23:15]
will help but this
[23:17]
also and I would say last comments I
[23:20]
know a lot of people uh within the city
[23:22]
say well I call the non-emergency number
[23:24]
and I don't necessarily see a response
[23:27]
uh in this case this will help build a
[23:29]
justification on the back end for
[23:30]
Corporation Council to proceed with
[23:33]
legal actions so if you are experiencing
[23:35]
these types of noise issues in your
[23:37]
immediate area please document it by
[23:40]
calling the nonemergency number um and
[23:43]
then that will help us understand uh how
[23:46]
many times and that'll fuel into this uh
[23:50]
nuisance adjustment moving forward Mr
[23:52]

you can get a permit to make noise from

noon to 6 when your neighbors whatever
[24:05]
and I'm sure we're going to work that
[24:06]
out but I'd also like to ask Chief
[24:08]
Clifford maybe if he can come forward to
[24:10]
maybe address um just a little bit about
[24:13]
the new ticketing system um that you
[24:16]
have which will make your officers and
[24:18]
Patrol men uh easier to ticket uh when
[24:21]
these instances come up like right away
[24:23]
and how that's moving along with the
[24:25]
department and getting to the courts
[24:31]
so um so City Court ordinances um the
[24:35]
way that we enforce that is it's it's we
[24:39]
process it the same as we would do in
[24:40]
arrest so the old way was we have to go
[24:44]
and take a person into custody literally
[24:46]
which may or may not involve handcuffs
[24:49]
we have to we have to write an incident
[24:52]
report um and then we have to complete a
[24:55]
master name on the individual go back to
[24:57]
the police station
[24:59]
jump on a computer write an accusatory
[25:01]
instrument file that paperwork with the
[25:03]
death Sergeant book that person and then
[25:06]
released them on an appearance ticket
[25:07]
that was the old way um we've we've now
[25:11]
streamlined that process to make it more
[25:13]
like receiving a traffic ticket where
[25:16]
right there on the spot we can do all
[25:17]
the paperwork issue a person an
[25:19]
appearance ticket on the spot go back
[25:22]
the death Sergeant would still have to
[25:24]
book the person but there's a lot less
[25:26]
paperwork and that means that we we can
[25:28]
make the arrest a lot uh faster more
[25:32]
efficient um while accomplishing the
[25:34]
same goal um so that what that does is that that encourages our officers to
[25:39]
make that arrest um so that we hold the
[25:41]
people accountable um a lot of the
[25:44]
hesitations in the past which led to um
[25:48]
advisements is that it's a Saturday
[25:50]
night we're low on Staffing the call
[25:53]
volume is up and officers just didn't
[25:55]
want to get bogged down for 45 minutes
[25:57]
making a loud music arrest when they
[25:59]
know that we have other more important
[26:01]
calls um I should say not more important
[26:05]
but more violent calls coming in calls
[26:07]
that really needed their attention were
[26:09]
coming in and they didn't want to get
[26:10]
tied up on them so um so we've been able
[26:13]
to implement that process we had a few
[26:15]
hiccups with the court system and we we
[26:18]
finally worked it out with all the
[26:19]
judges to make sure that they're all okay with it uh we we tested
[26:23]
the process this year uh specifically in
[26:25]
the summertime it worked well so we're we've implemented that and we're

starting to utilize that more often now
[26:32]

remember in the conversations um well

some of the conversation was around like
[26:38]
how do we distinguishing or measuring
[26:40]
kind of like that noise like the valume
[26:43]
and like how how that's going and my
[26:45]
question is to you is that you know is
[26:47]
there anything that you need you know
[26:48]
further from us as city council to be
[26:51]
for you to be able to enforce that like
[26:53]
cuz I don't know do we have the right
[26:55]
type of instruments or to to to make
[26:58]
that distinction between okay you were
[27:00]
just being allowed but now you're kind
[27:01]
of over this thing or do you need
[27:03]
anything from us for anything further
[27:05]
from us to support from that uh right
[27:07]
now I don't believe we do that might
[27:09]
change in the future as we test this
[27:11]
process and they go through more through
[27:12]
the courts if the if the judges require
[27:15]
some some kind of instrument reading
[27:17]
then we might um but but as of right now
[27:20]
I'm not aware of it if an officer shows
[27:21]
up and they feel that's unreasonable
[27:23]
noise um they can make the
[27:26]
arrest thank you Mr Chief is this the
[27:30]
same ticket process we had passed
[27:32]
through city council several years ago
[27:34]
and you had some problem with it the
[27:35]
office is there and they were thrown out
[27:37]
by the court and it was pushed back to
[27:39]
Corporation Council for them to revisit
[27:41]
the tickets yes so that was done a
[27:45]
revision and the done by cooperation
[27:49]
Council the ticket that you're rolling
[27:51]
out now yeah okay yeah and you have
[27:55]
discussion with the the court system to
[27:58]
make sure that we're not going to have
[27:59]
another sort of a problem correct yeah
[28:02]
we uh we had to change the form um so
[28:05]
it's all on the front page so so so
[28:07]
nothing on a second page correct yes
[28:10]
that that was the problem with the
[28:12]
second page uh constitute another um
[28:15]
incident so instead of one incident it
[28:17]
was two incidents and it was not
[28:18]
recorded properly something like that yeah the judge
[28:22]
wanted it um Wanted The Originals um and
[28:25]
by by putting it on the back that wasn't
[28:27]
sufficient so we made pH photo copies
[28:28]
and so the judge just we we compli with
[28:31]
what the judge was asking for and then
[28:33]
we tested the process and it's been uh
[28:35]
it's been working fine so so when we had
[28:38]
passed that ticket I'm trying to
[28:39]
recollect back a couple years ago on the
[28:40]
city council here it was more not for
[28:42]
noise it was more General to purpose you
[28:46]
can go there and site for for
[28:48]
litter uh things like that is is it the
[28:51]
same it's the same yep Yeah we actually
[28:53]
on the ticket itself it has multiple
[28:55]
City Court coordinate violations that are you probably the the ones that
[29:00]
are um that people mostly complain about
[29:04]
that are on there but we also have a
[29:05]
last spot that we can put anyone in
[29:07]
there that we wanted to so that we could
[29:09]
just like an other where we could write
[29:11]
it in there is it possible you can share
[29:13]
that template to the council so look at
[29:15]
that um the revise um that VI good I'm
[29:20]
thank you thank you me a couple years in the works when we passed it
[29:24]
originally and then we had some push
[29:26]
back from the court system and I'm glad
[29:28]
working with Corporation com to move
[29:29]
forward because that was a big quality
[29:32]
of live back in then we move forward
[29:34]
with that and I think it's going to be
[29:36]
well received out there and kind of make a difference in our city
[29:41]
yes um so people don't now get any
[29:44]
warning at this point in time so if
[29:47]
someone gets a loud if there's a loud
[29:48]
noise will call your officer show up
[29:50]
there's there's before it was like turn
[29:52]
the noise down so we don't have to come
[29:54]
back Etc so now is that no longer
[29:58]
happening there there's no guaranteed
[30:00]
one warning okay you know there's a lot
[30:02]
of misconception out there that you got
[30:04]
the first first one for free there was a warning and that's not the case it
[30:08]
always comes down to discretion of the
[30:09]
officer and the condition of what they they walk into okay um and you know
[30:14]
they'll look at the premise history and
[30:15]
see if they've been they've they've been
[30:18]
spoken to before um but um you know
[30:21]
there's it always comes down to the
[30:22]
situation and you know they're not out
[30:25]
there looking to write tickets uh you
[30:27]
know for any reason other than
[30:29]
enforcement and um you know if if they
[30:32]
can if they feel that they can get the
[30:33]
mission accomplished by speaking to the
[30:35]
person then they do it they feel like U
[30:38]
this needs to be sent before the judge
[30:40]
then they'll write the ticket and and
[30:41]
ask them to to go and speak to the judge
[30:43]
about it okay thank you danan I remember
[30:47]
part of the um we the discussion
[30:49]
assistant chief an noic spoke about when
[30:51]
an officer responds then you have your
[30:53]
change over making sure that
[30:54]
communication is transferred over to the
[30:56]
next shift um but I think in a similar
[30:59]
fashion to the response with vehicle
[31:01]
vandalism I I think there were a lot of
[31:04]
trigger words back in the day where you
[31:05]
hear community policing it's important
[31:07]
to recognize that putting all of the
[31:09]
onus on to law enforcement might not be
[31:12]
the best and most appropriate Way
[31:13]
Forward so it's working collaboratively
[31:15]
with the community um to make sure that
[31:17]
this is received well and that we're
[31:19]
also doing our actions on our
[31:21]
part there were no other question one
[31:24]
more question in terms of a timeline for
[31:26]
an officer to complete that process K I
[31:28]
know back in then when we we pass like
[31:31]
45 minutes do you have like a timeline
[31:33]
to that now if you were to go there and
[31:35]
write that ticket how much of a time
[31:37]
would it take yeah I mean you're you're
[31:40]
right in that um the old way it was
[31:43]
definitely 45 minutes probably somewhere
[31:45]
between 45 minutes in an hour and now
[31:46]
it's probably more like 20 to 30 minutes
[31:49]
so it's it's I'd say cut in half
[31:52]
nice so the in Chief if there are no
[31:55]

increase of penalties you wish to

increase penalties since you're going

the penal the fine phase at this point

the process works complete so I think at
[32:32]
this point is just making sure the
[32:34]
points actually reflect the degree of

just wanted to remind folks to about the January 13th public hearing um

and again reinforce the idea that we're
[33:44]
uh proposing this as a safety feature uh
[33:47]
and and we'll see how it
[33:50]
goes if there are no other items to

the city council works and this is

coming before you because at our for our

last special meeting there was some
[34:19]
question about whether or not the
[34:22]
notification was proper in terms of our
[34:25]
special meeting um so in particular that
[34:28]
the um it was delivered via email and
[34:31]
whether that was considered personal
[34:32]
delivery so um based on the
[34:35]
recommendation from Corporation Council
[34:37]
it seems uh the best course of action to
[34:40]
actually include that specifically in
[34:43]
the code to make sure that that that it's no longer a question so um
[34:49]
what's coming before you tonight is
[34:50]
actually to amend section
[34:53]
28-3 regarding special meetings and that
[34:56]
email um
[34:58]
be accepted as a a notice of delivery uh
[35:01]
I will say that there were other
[35:02]
questions that came up regarding the
[35:05]
entire chapter which everyone has
[35:07]
printed out for you um and in
[35:11]
particular one of them was and Mr uh Mr
[35:15]
O'Brien has given us copies of the the
[35:17]
amount of time required for notice so at
[35:22]
this point in time it's 3 days um there
[35:25]
was a question whether it needed to be
[35:27]
three days and he provided with the
[35:29]
second City's class laws which says it
[35:31]
can be um at least 24 hours and
[35:36]
um yeah so um so really opening that
[35:39]
discussion up whether we're um first of
[35:42]
all to amend regarding the email
[35:43]
notification and secondly whether we
[35:46]
want to um to change the the length of
[35:51]
time that the notice is required to be
[35:52]
out in front and let me just add one
[35:55]
other um one that I looked at that no
[35:57]
longer longer really even makes well
[36:01]
makes any sense actually is uh 28-31
[36:04]
smoking in council chambers because you
[36:06]
can't smoke indoors anywhere so we could
[36:08]
just lose
[36:11]
that so um so it's opening up for
[36:15]
discussion on these
[36:17]
items I just have a suggestion in terms
[36:20]
of us saying um by email can we use the
[36:24]
word

electronic delivery

same concern saying electronic that

and none of us are given um none of us

come up then we and they need to look at

our text message Etc that means you're

turning over your own personal phone so

I I would agree that email and

government email I hadn't um thought

about narrowing it down to that is

probably the best way to do it um

facts people are facts but that is

electronic delivery so um I I support um

you know using the government email but

be important to have some gender neutr G

gender neutral language um as glad to

see that there have been a lot of

progressive steps taken since

1989 thank you Mr I guess I would just

the fact that uh as we're as we're um
[39:09]
reviewing anything in the city code we
[39:11]
want to make sure that we're using our
[39:13]
Uh current luns of today so I think that would just be a best practice Mo
[39:17]
for to have like home pigeons on so I
[39:22]
think any other uh questions

or thoughts on this so are we talking
[39:28]
about meing this right

now we couldn't because this is just

Essen to review it and to bring up what
[39:36]
people are bringing up the the gender

at the same time just you know flushing

it's a lot of information needed to

amend this section is more of a a few

change language I I'm certainly fine

with that I just want to make sure that

people have an opportunity to give their
[40:19]
input yeah find move we call a public

hearing to amend the
[40:25]
section Mr Mr chair chairman as the
[40:28]
council president has said this this is
[40:30]
an opportunity for you all to review
[40:33]
thew the chapter 28 see what other
[40:37]
things need to be amended call for the
[40:39]
public hearing I guess that would be on
[40:41]
January 26 uh 27th and now we'll give
[40:44]
another committee cycle then to go
[40:47]
through 28th and then do the the final
[40:49]
res divisions and get that out prior to
[40:51]
the uh prior to the public hearing so
[40:55]
all those changes can be made at one
[40:57]
time as just doing each
[41:00]

[41:32]
is recommend recommendation to the city

council from the Planning Commission

regarding draft cannabis dispensary
[41:37]
zoning legislation Miss

um um IAM chair I'll take mrri okay um I
[41:49]
also have uh Mr Connelly from the uh
[41:51]
planning department here also to give
[41:53]
out uh uh maps of of the districts uh as well as to explain what some of the
[42:00]
districts are and while he's doing that
[42:03]
um just a a bit of
[42:06]
a you know refresh everybody's
[42:09]
recollection this was last before you uh
[42:11]
last month referral was made to the city
[42:14]
plan commission to uh pursu of disc
[42:16]
connected city code for their review and
[42:18]
input uh they uh reviewed it and then
[42:22]
they have submitted a uh their
[42:24]
recommendation to you regarding this um
[42:28]
the moratorium is still in effect
[42:30]
however it's expires next month it's
[42:34]
February 11th so with the cycle that
[42:38]
they are and the time that it the time
[42:41]
that it is um you're going to have to
[42:45]
call for that public hearing for January
[42:47]
27th on the draft and then pursuing to
[42:50]
article 12b the general Municipal
[42:53]
law amendment of a zoning code that hits
[42:56]
on the orders of other municipalities
[42:59]
has to be ref uh referred to the County
[43:02]
Planning Department because this is
[43:04]
Citywide so these districts obviously
[43:07]
are hitting the boundaries of all the
[43:09]
neighboring communities so assum article
[43:12]
12b of the general Municipal law just as
[43:15]
you recall from back in the spring of
[43:17]
last year we had to do a referral up to
[43:20]
the uh County Planning Department for
[43:22]
The Vape ordinance for their comment and
[43:24]
review uh uh review and comment the same
[43:27]
thing here they have up to 30 days so
[43:30]
you can see how time is now moving along here so um the two asks U
[43:37]
before we get into the details here the
[43:38]
two asks added for this committee and
[43:41]
for the council for the next cycle one
[43:44]
calling for that public hearing on the
[43:45]
draft on on on the 27th of January and
[43:49]
two a transmitt resolution of the draft
[43:53]
up to County planning for their review
[43:55]
and comment so those are the the asks
[43:59]
the immediate asks that you uh that are
[44:01]
before you to move the process along
[44:06]
um regarding the uh the the the proposed
[44:10]
ordinance is that the Cannabis
[44:13]
establishments which include uh retail
[44:17]
dispensaries um as well as uh uh onsite
[44:24]
consumption
[44:25]
and uh retail dispensaries uh and micro
[44:30]
businesses with a retail portion with a
[44:32]
retail portion that's the kind
[44:35]
of aspect that brings them into our our
[44:39]
code here um cannabis estab
[44:41]
establishments is defined above and
[44:43]
that's in the in the code that's
[44:45]
highlighted for you and those
[44:47]
definitions are before you um are going
[44:49]
to be limited to as we discussed before
[44:52]
the M1 the industrial districts M2 C4
[44:55]
and C5 Zone districts and C2 and C3 Zone
[45:00]
districts subject to special use permit
[45:03]
and uh uh Mr coning will tell you about
[45:05]
the special use permit and then uh so at
[45:09]
this point I'll let I'll turn it over to
[45:11]
him regarding the maps and as well as to
[45:13]
explain those districts and giving
[45:15]
examples into those districts thank you
[45:17]
so what the map is showing the the map
[45:20]
is showing schools and churches as uh
[45:23]
provided by our assessment office um as
[45:27]
the the legislation is going to prohibit
[45:29]
any new dispensaries or onsite
[45:31]
consumption spots within 500 ft of those
[45:33]
so all those dots whether they be in
[45:35]
residential zones or not um no no
[45:39]
establishments going forward could be
[45:41]
within 500 ft of those locations and
[45:43]
vice versa if there is a new dispensary
[45:46]
or outside consumption spot that comes
[45:47]
in um a new school church so on and so
[45:51]
forth could not operate in those areas
[45:54]
without getting the approval from the
[45:56]
zoning board to for those uses as uh you
[45:59]
know dispensaries and onsite conception
[46:01]
establishments have been deemed by the
[46:02]
state and the office of can Canabis
[46:04]
management as locations that are not fit
[46:07]
for these locations you know around youth miners so on and so forth
[46:13]
um the planning commission's
[46:16]
recommendation was to have it have uh
[46:19]
their main change from Mr O'Brien's
[46:21]
original legislation was to have onsite
[46:22]
consumption spots via special use permit
[46:24]
only um as that gives them essentially
[46:27]
more authority to protect the
[46:29]
residential interests um General site
[46:32]
plan approval well if it's just
[46:34]
permitted as of right they don't
[46:35]
necessarily have the authority to look
[46:38]
at issues such as
[46:39]
nuisances um if there's any fumes from
[46:43]
uh you know smoking outside whatever it
[46:45]
may be they don't if it was permitted as
[46:47]
of right that wouldn't be aspects that
[46:49]
they were able to look at having the
[46:51]
special use permit gives them the
[46:52]
opportunity to do so and although the
[46:55]
Office of canas canabas Management has
[46:57]
the authority to issue onsite
[46:59]
consumption licenses they have not
[47:02]
rolled any out yet so we don't know what
[47:03]
these on-site consumption spots are
[47:05]
going to look at and the Planning
[47:06]
Commission made the recommendation to be
[47:08]
more proactive with their zoning and if
[47:11]
the time comes when these establishments
[47:14]
are rolled out and they're relatively
[47:15]
unobtrusive to neighborhoods and and
[47:18]
Residences then we can roll back a
[47:20]
little bit but the intent was to be
[47:23]
proactive instead of reactive um and
[47:26]
give them the most Authority possible to protect the interest of the
[47:31]
residential neighborhoods that might be
[47:32]
adjacent to our commercial
[47:34]
corridors um Madam president yes um I
[47:38]
would just ask Mr Connelly to tell us
[47:41]
about M1 M2 C4 and C5 what are those
[47:44]
districts and uh you know give us
[47:47]
examples for those districts yeah so M1
[47:49]
and M2 are strictly strictly industrial
[47:52]
and warehousing no no residentials
[47:54]
allowed um no single family multi family
[47:57]
none of that nothing of that sort um as
[47:59]
you can see in the second half of there
[48:01]
Technology Drive is an example of a
[48:02]
heavily industrial Corridor um the Lower
[48:05]
Broadway and grand grand uh Street areas
[48:08]
as well off of Broadway industrial
[48:10]
they're very there there aren't many of
[48:12]
these M1 and M2 corridors um but their
[48:15]
Express purpose is to have the uses that
[48:18]
aren't fit to be around the residential
[48:20]
NE so we thought it would be appropriate
[48:23]
to have it as of right in those areas um
[48:26]
C5 is the least restrictive commercial
[48:31]
Corridor it's it's essentially the
[48:33]
closest commercial corridors that we
[48:34]
have to these industrial districts so
[48:37]
while it's closer and more adjacent to
[48:39]
residential neighborhoods um we there aren't very many of them and we
[48:43]
generally allow higher leniency in terms
[48:46]
of the impact that uh businesses may
[48:49]
have so for example Upper State Street
[48:52]
past cross toown Plaza is one of our C5
[48:55]
business districts um cross toown Plaza
[48:57]
itself C5 um the section of Dwayne
[49:00]
Avenue if you familiar with the the big
[49:03]
storage Warehouse off of 890 over by
[49:06]
Odell Street these are just to give you
[49:08]
a brief overview of some of our C5
[49:10]
districts um commercial but not
[49:13]
necessarily in the same regard as a C2
[49:15]
District like uh Broadway in bellw or
[49:18]
van Franken in the north side which are
[49:21]
commercial in nature but are much more
[49:23]
residentially oriented than some of
[49:24]
these C5 districts um and then C4 is our
[49:28]
downtown which is intended to be uh you
[49:32]
know very commercial in
[49:33]
nature we have or should I say New York
[49:36]
State the ocm has uh legislation in
[49:40]
place to restrict how many
[49:43]
establishments can be in proximity to
[49:44]
each other I believe we can't have any
[49:47]
dispensaries within 1,000 ft of one
[49:49]
another so even though the downtown
[49:51]
district is very residential in some aspects um that prohibits sort of
[49:57]
an over congestion of U dispensaries in
[50:00]
that
[50:01]
area um Madam chair regarding the
[50:05]
special use permit for um what are the
[50:07]
criteria when what's the planning board
[50:09]
mandated to to look at what are the
[50:12]
things that the planning board has to
[50:14]
look at if they have to if applicant has
[50:17]
to go before and get a special use
[50:19]
permit that's going to look at it it
[50:21]
looks at the impact the the more
[50:24]
holistic so to speak impact that it
[50:26]
might have on the on the residences if a
[50:29]
general site plan approval we look at
[50:30]
purely code is this curve cut legal um
[50:34]
you know as is the sidewalk up to code
[50:36]
so on and so forth this is going to look
[50:38]
at how traffic patterns might be
[50:42]
impacted as a result of this um we were
[50:45]
talking earlier about the noise
[50:47]
pollution that's been happening
[50:48]
throughout the city that gives us a
[50:50]
greater authority to analyze that um for
[50:53]
example something that's already
[50:55]
issuance to AAL shoes permit is is
[50:57]
drive-throughs in most areas um the
[51:00]
reason being is because of the pretty
[51:03]
significant traffic impact that that can
[51:05]
have on Commercial areas that might be
[51:07]
next to residential corridors um so it gives us an expanded area to to view
[51:13]
those impacts and how it might impact
[51:14]
the day-to-day lives that we wouldn't
[51:16]
have if you know for example a more
[51:19]
mundane use that that could be allowed
[51:21]
in those
[51:22]
districts if that answers your question
[51:25]

um so Mr Brian so the current
[51:31]
existing um locations for cannabis will
[51:35]
they will not be impacted by that that's
[51:37]
correct they'll be grandfathered in in
[51:39]
other words there'll be IL legal non

performing use as long as they remain in

that particular business the minute they move out and if a cannabis
[51:49]
establishment does not move in then they
[51:51]
lose their legal nonconforming use so
[51:55]
those entities that are where they are
[51:58]
right now that may not have fit into
[52:00]
this category will stay there until such
[52:03]
time they they're no longer business and
[52:06]
for those there's some that um haven't
[52:08]
opened yet but they they've chosen their
[52:10]
location which is outside of what we're
[52:12]
currently discussing that this ises
[52:15]
impact anything that's that's already in
[52:16]
the pipeline anything that was already
[52:18]
in the pipeline would have wouldn't been
[52:21]
impacted they would have been
[52:22]
grandfathered and this pursuant to the U
[52:24]
the moratorium that you all put in place
[52:27]
back uh in November I think and if they
[52:31]
had put their applications in then they
[52:33]
were grandfathered in as well um and I
[52:36]
know that two of them also had to go
[52:38]
through special use permits the ones
[52:40]
that were already in the process also
[52:43]
had went through the special use permit
[52:45]
process uh and approval by the planning
[52:48]
board and that there's only one
[52:50]
outstanding there's one outstanding it
[52:52]
still needs to get a special use permit
[52:53]
as well that is for a drive-thru it's
[52:54]
not a special use permit to allow the
[52:56]
use
[52:57]
um to the locations wanted
[52:59]
drive-throughs for their establishments
[53:01]
that's why they need the special use
[53:02]
drive-throughs are you know I know that
[53:04]
drive-throughs are allowed by the office
[53:05]
of Canabis management are they
[53:08]

was just uh curious as to like um is is
[53:18]
this kind of similar to like what we
[53:21]
look at when when people are like maybe
[53:22]
trying to open up a a bar or a pub or
[53:25]

consistency and we view that to for the
[53:29]
time being no in terms of onine
[53:32]
consumptions for the comparison for
[53:34]
consumption to consumption no no no just
[53:38]
um right now it's going it right now
[53:40]
it's a little bit more restrictive the
[53:42]
reason is for two reasons first of all
[53:45]
ocm has restriction guidelines in terms
[53:47]
of distances that are not in place for
[53:48]
bars um and secondly as I mentioned
[53:51]
there's we don't have any guidelines on
[53:52]
how on-site consumption spots are going
[53:54]
to look yet um so if it turns out to be
[53:57]
an instance where maybe it's it's only
[54:00]
THC infus selters or gummies or things
[54:03]
of that sort where there's no smoking
[54:05]
allowed maybe we could roll back some of
[54:07]
the restrictions we could analyze it as
[54:08]
those licenses come out but we don't
[54:10]
know if that's going to be the case yet
[54:12]
we don't know if it's going to have
[54:13]
outdoor smoking patios or whatever it
[54:16]
might be we just don't know so that's
[54:18]
why we did it the way we did I guess I
[54:21]
was thinking along lines of like um the
[54:23]
churches and schools like the proximity
[54:25]
the church schools as far as like what our so if somebody wants to open up
[54:31]
a pup next to a school or something like
[54:33]
that it doesn't we don't have anything
[54:36]
that this wouldn't be anything that
[54:39]
uh closely mirrors how that not on the
[54:43]
local level I don't know the state lier
[54:47]
Authority keeps those distances as far
[54:49]
as and a lot of the distance you see
[54:51]
here are based on state law the 200 ft
[54:54]
the 500 ft to a school
[54:56]
to state law from state that was
[54:58]
something that was discussed at the
[54:59]
Planning Commission meeting they wanted
[55:01]
to in some instances expand those to
[55:03]
make it different Mr O'Brien advised us
[55:06]
that we couldn't alter it one way or the
[55:08]
other just because we had to comply with
[55:09]
the state
[55:13]
guidelines Mr Tom thank you how how many
[55:16]
applications are still pending that
[55:18]
would be grandfathered in just one
[55:20]
there's one there only one only one
[55:21]
outstanding we had two at the last
[55:23]
meeting um we have one outstanding one
[55:25]
on Eastern Park way going into they want
[55:27]
to go into the Old Key Bank across from
[55:29]
the Family Dollar over there that's the
[55:30]
only outstanding one that's left on our
[55:33]
agenda on your agenda okay how how many
[55:36]
dispensaries are open in the city or how
[55:39]
many with that one pending would there
[55:41]
be eight or nine or so we have one on
[55:45]

the applications coming in so there were

three that got in right before the

materials necessary so there's still so

kind of this is it really have there

been any more that have come in no not
[56:10]
since the moratorium has been in place

within you know that we that's not going
[56:17]
to be relegated to the areas that we're
[56:19]
talking about they can still be within
[56:20]
the city it's just like M1 M2 and then
[56:24]
speci I wondered if there were any p

applications no the the only one that I

mean the one on Eastern Parkway would
[56:31]
not fit in with this legislation um
[56:33]
that's the only last one that that would
[56:35]
be grandfa and as Mr O'Brien said if the

one on Eastern Parkway opens and then
[56:39]
has a change in ownership or same same
[56:41]
goes for the one on up Union Street
[56:44]
those would then be subject to these
[56:45]
regulations and and the process would be
[56:47]
different going forward um so let me

just there was another one on Eastern
[56:51]
Park like almost across the street did
[56:52]
that one not get through the process
[56:53]
this is the same same owners so so that
[56:56]
Family Dollar location didn't work for a
[56:59]
myriad out of reason so they purchased
[57:00]

so there is within the state guidelines

no limit of the number that we can have

have a retail aspect to it and then you

business is is for an analogy like a
[58:34]
micro Brewery in other words they
[58:35]
develop their own product they grow
[58:37]
their own product and then
[58:39]
sell so they have to have a retail
[58:43]
aspect and that's what this is is
[58:45]
looking at is retail and you know
[58:50]
and as indicated every Everything uh is
[58:53]
going to require a special use permit
[58:57]
whatever can this establishment in the
[58:59]
C2 and C3 distri
[59:07]
districts and the uh on-site consumption
[59:10]
is is Mr
[59:12]
uh is indicated is is that that
[59:15]
regardless of zone is going to require a
[59:18]
special use permit because you would ask
[59:22]
The Regulators the the
[59:24]
applicants um and and us this is a
[59:27]
developing area of the
[59:29]
law and that's you know we're all going
[59:34]
through this so if you ask any any of
[59:36]
them um uh any of the actors The
[59:40]
Regulators the local municipalities the
[59:42]
applicants it's a a developing area of
[59:45]
the law and I think that recognizes that
[59:47]
fact giving local control but
[59:50]
also allowing these but also taking in
[59:54]
consideration how they fit in
[59:57]
and so just a follow because you and I
[59:59]
had already discussed it's about the
[1:00:00]
micro businesses right and you have to
[1:00:02]
have a we know that you already have to
[1:00:03]
have an establishment um but my concern
[1:00:06]
was that if you were had an
[1:00:08]
establishment where could you actually
[1:00:10]
what is the distance does it have to be
[1:00:13]
25 miles outside the city is it within
[1:00:16]
25 miles of of their business what is
[1:00:20]
yeah Madam chair it's it's 25 miles if
[1:00:24]
they have one in here within that 20 M
[1:00:26]
radius their
[1:00:28]
cultivation part has their cultivation
[1:00:31]
part of the operation has to be within
[1:00:33]
that 25 mile radius of where they're
[1:00:35]
located for the retail
[1:00:39]
operation and they would have to have a
[1:00:40]
special permit to for the
[1:00:42]
cultivation um in those those C2 or C3
[1:00:47]
now you know you know regarding the
[1:00:49]
cultivation aspect that has you know
[1:00:52]
whole separate requirements as far as
[1:00:56]
you know how many square feet
[1:00:58]
Etc so
[1:01:00]
um you could ask for a special use for
[1:01:03]
the cultivation aspects of it for
[1:01:05]
example cultivation aspects only not the
[1:01:09]
retail aspects right so cultivation
[1:01:12]
aspects because that's a whole different
[1:01:15]
aspect it's not a retail it's not it's a
[1:01:19]
cultivation well for the sake of the
[1:01:21]
council um I I think that that may be
[1:01:23]
something we want to consider uh for a
[1:01:26]
special permit for a cultivation aspect
[1:01:28]
because based on what what I'm
[1:01:30]
understanding is that conceivably if you
[1:01:33]
have a large enough property within the
[1:01:35]
city you can use it for cultivation if
[1:01:38]
you own or own an
[1:01:43]
establishment I don't know how long is
[1:01:45]
the large Jack you
[1:01:48]
know I I don't know exactly the
[1:01:50]
specifications for the lot size that
[1:01:52]
would be required for this but you
[1:01:53]
couldn't just put it anywhere you know
[1:01:54]
it would still need to be commercial
[1:01:56]
owned um and it would it would still be
[1:01:58]
sub you know if it was M1 M2 C4 or and
[1:02:02]
C5 C4 would probably not fit into that
[1:02:05]
just because the generally speaking the
[1:02:07]
lot sizes are smaller um M1 M2 C5 have
[1:02:12]
been determined that those would be more
[1:02:14]
suitable for it as they're more
[1:02:15]
commercial more business
[1:02:16]
oriented if it was that case C2 C3 would
[1:02:20]
be as we said before special use permit
[1:02:22]
and it wouldn't apply to any residential
[1:02:24]
zones at all so Mr if you could just provide us with
[1:02:29]
the information about the cultivation
[1:02:30]
part of it I know that we're going to
[1:02:31]
move ahead what you can do just you know
[1:02:33]
just move things forward here is just
[1:02:36]
you know we change that one aspect where
[1:02:39]
it requires a special use permit for the uh the on-site consumption and just
[1:02:45]
say micro bus the cultivation
[1:02:49]
aspects not the retail but the
[1:02:51]
cultivation aspects of of a micro
[1:02:54]
business will require a speci
[1:02:59]
yes I would I think that would um make
[1:03:02]
it at least that would be some say and
[1:03:03]
have to come before the Planning
[1:03:05]
Commission
[1:03:06]
