[2:16] this is a really nice basis. Familiar
[2:18] faces and new ones. My name is Katie
[2:21] Catchman and I'm from Ward 3 and I
[2:25] served on this council with some of you
[2:27] um from 2020 to 2024 and I want to speak
[2:32] in support of reducing the council from
[2:36] 12 seats to six. Like you
[2:42] and I can tell you from experience that
[2:45] more seats did not mean better
[2:47] decisions. It meant longer meetings,
[2:50] group think, and votes that took more
[2:52] coordination to reach the same outcome.
[2:55] A similar group could have reached
[2:56] faster and more informed. And here's the
[3:00] part I saw first hand. This council is
[3:02] part-time. You're putting in evenings
[3:04] after your regular jobs, meeting only a
[3:06] few times a month for a salary that
[3:09] doesn't pay many bills. A council that
[3:11] size with that little dedicated time and
[3:14] no personal staff does not use its extra
[3:17] seats for deeper policy review. It uses
[3:20] them for longer debate on the same
[3:21] questions. 12 people trying to find
[3:24] agreement on a volunteer schedule is
[3:26] slower. Unfortunately, not more
[3:28] thorough. There's also real risk that
[3:30] comes with a body this size. It's large
[3:32] enough to split into competing factions,
[3:35] but way too underresourced to um tax to
[3:40] manage that the way bigger cities do
[3:42] with real committee structures and staff
[3:44] support. I watch coalitions form and
[3:47] shift on issues that have nothing to do
[3:49] with the merits simply because with 12
[3:52] people, there's more room for that kind
[3:54] of maneuvering. Six member council with
[3:56] a clear simple majority threshold would
[3:58] still represent every ward fairly and
[4:01] allow council candidates to show their
[4:02] wards that they're the best candidate
[4:04] when they're running for office.
[4:06] Reducing our council to six seats would
[4:08] not reduce representation. It would char
[4:11] members each carrying
[4:15] hold on.
[4:18] So, council, I just want to end by
[4:20] saying thanks for all you do and I know
[4:23] that you truly care about our city and
[4:25] want to see it succeed. So, I hope that
[4:26] you'll support bringing this to the
[4:28] voters and letting the voters decide.

[5:03] there and the majority of the people
[5:05] that presented there were very much in
[5:08] favor or at least leaning towards doing

[5:14] research on effective work groups and
[5:18] much of the Eric says, an effective work
[5:21] group is between five and eight people
[5:23] for all the reasons that Katie mentioned
[5:26] and I won't repeat those and there's
[5:27] others. The research is very clear that
[5:30] smaller work groups are far more
[5:33] effective. So I'm clear to you to
[5:35] proceed with uh considering that and
[5:38] hopefully you'll find in your favor city

[6:33] having six where there's not all this
[6:36] bickering and backstabbing with you
[6:37] guys, I think would be a lot better to

[7:39] Aberdine wastewater treatment plant is
[7:42] receiving in the 2025 wastewater
[7:44] treatment plant outstanding performance
[7:46] award. Approximately 300 wastewater
[7:49] treatment plants statewide. Yours was
[7:51] among the top wastewater treatment plant
[7:53] operations. The 2025 ecology evaluates
[7:57] specific domestic wastewater treatment
[8:00] plant information for individual permit
[8:03] compliance. Your plant is one of the top
[8:05] performers for regularly meeting these
[8:07] urban criteria, including monitoring and
[8:11] data reporting. Ecology acknowledges the
[8:14] exceptional level of effort required to
[8:16] protect water quality and provide this
[8:19] quick service to your community.
[8:22] dedicated and proficient operators are essential
[8:28] to successful plant operations and to
[8:31] protecting the health of Washington's

[9:10] the world that we live in is a loud and
[9:12] boisterous place. I recognize that the
[9:14] city of Aberine has received its fair
[9:16] share of critical feedback from
[9:18] stakeholders involved with homelessness
[9:22] uh challenges in the downtown business
[9:24] area. The hard work and efforts by the
[9:26] Aberine Police Department to address
[9:28] these issues to address these issues
[9:30] however do not go unnoticed. I am I am a
[9:35] partner with a law firm Ingrams Alaska
[9:38] Goodwills LLP. Our office is located a
[9:41] block behind city hall on First Street
[9:44] and Kitty Corner from the site of our
[9:47] city's infamous homeless encampment
[9:49] before and after implementation of this
[9:52] camp. We enjoyed many days at night with
[9:54] those dedicating in our lawns, urinating
[9:57] in our bushes,
[9:59] and lighting up their crack in the
[10:02] shadows of our office. No more. We've
[10:05] seen clear, visible, and measurable
[10:07] results. The area around our office and
[10:10] surrounding streets continue to appear
[10:12] safe, clean, and welcoming. Yes, more
[10:15] can be done, but the conditions have
[10:18] improved. Public spaces are enhanced.
[10:20] community concerns do not go unnoticed.
[10:23] These efforts reflect a meaningful
[10:25] commitment to both the public welfare
[10:27] and economic stability of Chief Dale
[10:30] Green and his team. I get it.
[10:32] Homelessness is a complex and sensitive
[10:35] issue that requires a thoughtful balance
[10:37] of compassion, accountability, and
[10:40] collaboration. is encouraging to see the
[10:42] city taking proactive steps towards
[10:45] solutions that support individuals in
[10:48] need while also safeguarding the
[10:49] integrity of our business community.
[10:52] Please extend my sincerest appreciations
[10:55] to Chief Dale Dream, the entire police
[10:57] department, staff and partners involved.

[11:58] have to uh look at videos or go to
[12:02] seminars. there's an assortment of
[12:04] things they could do and then one of
[12:05] them was also to go to
[12:08] their uh the meeting we just had at
[12:11] Spokane their state state meeting and it
[12:13] was a good meeting and so that pushed
[12:17] some of these representatives
[12:19] so they got their certificates and I
[12:21] just wanted to give them their certific

[13:53] well I I'm the chairperson for the Grace
[13:55] Harbor Transit Authority they just did

[14:05] lady's name, but it was there high
[14:08] school student who submitted the artwork
[14:10] and was selected as this event this
[14:13] year. It'll be a 250 250th anniversary

[14:18] hardware bus. And I just want you to
[14:20] know that when I was a kid in high
[14:22] school, I entered the same thing and I
[14:28] Let's see.
[14:31] So, uh, downtown right now there is
[14:34] aation
[14:36] right kind of in front of 118, uh, the
[14:40] build build or the maybe someday museum
[14:43] building downtown that the city owns. I
[14:46] plugged in one of our new Christmas
[14:48] decorations down there so people could
[14:50] get just an idea of what it's going to
[14:52] look like. So, those will be going up. I
[14:55] met this also our city electrician and we're figuring
[15:01] out the locations and getting
[15:02] electricity. So, we'll have some really
[15:04] beautiful new decorations just for
[15:06] Christmas. Hopefully, uh we'll have some
[15:09] new shops downtown and speaking of new
[15:11] shops downtown. Um I also attended the
[15:15] ribbon cutting for Dedris downtown
[15:18] Deli. I love their location over in
[15:21] Oakland, but I'm so much happier with
[15:22] them here in Aberine. And I think uh if
[15:25] you haven't been there, they have
[15:27] wonderful food. They're open
[15:30] Tuesday to Friday. Have a chance. It's
[15:32] free kind of limited hours, but their
[15:34] food is really worth it.

[15:41] ceremony for business of the quarter
[15:43] from Greater Grace Harbor Incorporated
[15:45] and their lawyer multimedia.
[15:51] That young man has spent so much energy
[15:54] showing our city in such a positive
[15:56] light and he's really welld deserving of
[15:58] that. His wife Amy Emma also are
[16:01] celebrating their 40th anniversary so
[16:03] you see him congratulated.
[16:06] Then on the 17th uh we had our first
[16:10] museum transition committee meeting and
[16:12] I thought that went really well. I was
[16:14] really encouraged to see that the group
[16:17] of people that we have on that committee
[16:20] are all excited and willing to work
[16:22] together and I think I'm going to see
[16:25] good things coming from that that group
[16:27] in future.

[17:14] cheer team is at cheer camp in Tacoma.

[17:22] the most spirited and showing great
[17:24] leadership. Um also later tonight you'll
[17:27] be voting on the reading um regarding
[17:31] city council. I'll share more about
[17:33] that. Um also this is my last council
[17:35] meeting. I want to thank you all for
[17:37] listening to my ideas figuring out how
[17:39] we can bring the youth closer. I also
[17:41] want to thank the citizens of Aberdine.

[17:47] your representative on Aberine City

[18:13] committee meetings. Uh noon the ethics
[18:16] committee met for the first time. Um and

[18:23] um so we met on Wednesday and we'll have
[18:27] something to bring before you later on.
[18:30] Um this is brand new committee so we're
[18:32] still kind of learning the ropes too. So
[18:35] go easy on us. Um and then later after
[18:39] uh in the evening um Justin Jacobs,
[18:42] Michelle Nipper and I met and Deb Wilson
[18:46] and Dev Hodkin had chimed in by email
[18:49] and we went over all of the information
[18:53] that I brought back from Associated
[18:54] Washington City's office on setting up a
[18:57] youth uh council and we created uh the
[19:01] ordinance and changes that you will see
[19:04] later on in the Those we based off of um
[19:09] the city of Ridgefield's youth
[19:10] commission and then made our own changes
[19:13] for things like the size of that
[19:15] council. Um it was important to a few of
[19:18] us that we let the council themselves
[19:21] choose their topic rather than us
[19:22] assigning them one. So we made that
[19:24] change and then also having their
[19:27] president and vice president become our
[19:29] representatives on council. So that's
[19:31] what I was up to this week.

[20:05] week uh due to unemployment and need to

[20:14] around to discuss some potential
[20:16] opportunities. Also coming up next week
[20:19] is the grand opening for the B project
[20:21] down the court. Uh this event is
[20:23] expected to have nearly 600 attendees
[20:26] from all over the world and I'm looking
[20:28] forward to getting a new tour or a tour
[20:29] of the new facility as
[20:34] certificate leadership. I completed
[20:37] those requirements after attending the
[20:39] last conference in March for council
[20:42] leaders and I'm just glad that they were
[20:44] able to slow down long enough to
[20:46] recognize the hard work of myself and of
[20:49] the council members here today. I also
[20:51] want to just take a moment to remind
[20:53] everyone to share the community survey
[20:56] with folks in your network so they can
[20:58] complete it. The more answers we get,

[21:56] legislative break. Um as mayor stated,
[21:59] we met for the first time. The museum
[22:01] transition committee met. Um I will be
[22:04] facilitating the conversation and the
[22:06] discussion and the building of the
[22:08] project plan. Um, so if you have any

[22:15] me, Council President Swore stated, um,
[22:17] the Port of Grace Harbor does have a,

[22:48] I will be um at a city the statewide
[22:52] city managers conference in Kenowick. So

[24:29] the year. So we're through the second
[24:31] quarter, so we should be pretty close to
[24:33] um 50% on the we're looking for for
[24:36] revenues and expenditures.
[24:39] We're actually a little bit higher than
[24:40] in both of those categories. So our
[24:42] revenue collections are coming in at 58%
[24:45] for the end of the second quarter. Um
[24:47] part of that is due to we receive a
[24:50] large portion of our property taxes come
[24:52] in in April and May. Uh so that has a
[24:55] little bit to do with that. We're also
[24:57] still up in sales time. So that's also
[24:59] contributing um in we had a the HCA jail
[25:05] re-entry grant was also a large
[25:07] intergovernmental that we received in
[25:09] the first part of the year. Uh we're
[25:11] also a little higher in our
[25:12] expenditures. We're at 54%.
[25:15] And some of this is due to the um delay
[25:19] of the EMS cost allocation change. So,
[25:22] we were still subsidizing EMS out of the
[25:24] general fund for that first quarter of
[25:26] the year. We were able to add $985,000
[25:31] to general fund reserves through the first two quarters of the
[25:34] year.
[25:39] We look at we'll look at some details.
[25:41] So, as I mentioned, um our property
[25:43] taxes is at 59% and that's because we
[25:47] received a word version of that already.
[25:49] sales taxes coming in at 55% and you can
[25:52] see the intergovernmental news about is
[25:56] 167%.
[26:01] I kind of already went through a few of
[26:02] these because I talked about them in the
[26:04] first slide. So this is basically just
[26:06] talking about the uh intergovernmental
[26:09] revenues why those are up and the
[26:11] property tax and then overall general
[26:13] fund is is up for revenues through the
[26:15] works two quarters of the year. uh we
[26:18] are up 12% over revenues from last year.
[26:23] And then on our general fund
[26:24] expenditures, this is just a breakdown
[26:27] of the different types of expenditures
[26:29] in the general fund through the first
[26:30] two quarters.
[26:33] And again, we're breaking down the grant
[26:36] categories in the general fund. And
[26:38] we're coming out at the 54% mark. Again
[26:42] pointing out fire is at 82% currently
[26:44] but that is due to again the delayed ENS
[26:50] increase. So the allocation was delayed
[26:52] as well. Our general fund reserves uh
[26:55] the target for reserves is 90 days and
[26:59] we are currently at 92 days in cash. Um
[27:01] through the first quarter we were not
[27:03] meeting that target. Uh we are meeting
[27:05] that target now mostly due to receipt of
[27:08] our property tax. Um and so we're
[27:11] currently at on net und designated
[27:13] reserves 5.4 million and that does not
[27:16] include any of the um armory money
[27:19] that's excluding all of that money.
[27:23] Uh so our DMS just breaking down our EMS
[27:26] special revenue fund
[27:29] and um again this one's kind of a little
[27:32] bit in the negative right now and that
[27:33] is again because of the delay of the EMS
[27:36] rate increase. So I do think we'll see
[27:38] that come into the positive for the
[27:40] source of um source or use of reserves
[27:44] as we move through the year. It has kind
[27:46] of caught up a little bit in this past
[27:47] quarter. So and then we just break down
[27:50] the utility funds. Um there's a lot of
[27:52] details on here so I I don't want to
[27:54] bore you too much.
[27:59] We're doing we're doing well on our
[28:01] utility funds. And then there's some
[28:04] additional um revenue that are also
[28:07] provided at the back of the packet that
[28:09] have lots of information. So please let

[29:55] Shahalis wersheds and I live right on
[29:57] the Shahalis River.

[30:04] invited to come tonight and I want to

[30:21] three different two-year grants from the
[30:24] Department of Ecology called public
[30:26] participation grants. And the purpose of
[30:29] these grants is to educate the public
[30:30] about contaminating sites and to
[30:34] encourage people to participate in the
[30:37] cleanup process.
[30:39] Next
[30:41] um and so kind of the the backbone of
[30:45] our work is educating people about the
[30:48] model toxics control act and that's like
[30:51] the state version of super law. Um
[30:57] there's over 14,000 cleanup sites in
[31:01] Washington and about 141 are in Grace
[31:05] Harbor County. Um
[31:08] many of these are are the ones in Grace
[31:11] Harbor County and across the state like
[31:13] they can include small sites like gas
[31:16] stations or you know places where
[31:18] there's been spills. Um, but some of
[31:21] them are large, complicated sites that
[31:24] take years to clean up.
[31:28] And so the goal of Washington's
[31:30] Cleveland law is to protect people and
[31:33] the environment and the animals
[31:36] from contaminants in soil, groundwater,
[31:41] and water and air.
[31:45] Um, so what is a contaminated site? Um,
[31:50] you guys probably know because you have
[31:52] your share of them here, right? Um,
[31:56] you know, in in the nine years that I've
[31:59] been here, I've seen one complicated
[32:02] site get cleaned up, and that was the
[32:05] hungry whale in Westport. Oh, that that
[32:10] site. Are are you guys familiar with
[32:11] that? it it was a gas station
[32:14] convenience store and they had a
[32:16] gasoline tank leak and so it
[32:19] contaminated groundwater and surface
[32:21] water and so they went through the
[32:24] cleanup process which is outlined there
[32:28] um is a series of steps and and the the
[32:33] little orange bubble thing is where the
[32:36] public has an opportunity to comment.
[32:40] And so most cleanups in Washington are
[32:44] cleaned up using this process which
[32:46] includes
[32:48] um a remedial investigation where the
[32:50] site is characterized with samples and
[32:53] so so um I'm just going to mention the proposed wood power plant site. So
[33:00] that that is is not going through this
[33:04] formal cleanup process because the court
[33:06] and the proponents have elected to do
[33:09] the voluntary cleanup process there. And
[33:12] so they still have to achieve the same
[33:16] cleanup standards but but they don't but
[33:19] there's no opportunity for public
[33:21] comment.
[33:23] Whereas at Cosmos Specialty Fibers, you
[33:27] know, the state of Washington now is
[33:29] trying to get the owner
[33:32] to, you know, not only characterize and
[33:35] remove and
[33:37] sample and stabilize the site with all
[33:40] the massive amount of chemicals that are
[33:42] stored there. But they're also, you
[33:46] know, the next big step at that site
[33:48] once it's stabilized is to do a remedial
[33:51] investigation. And that that's a process
[33:53] with sampling that kind of characterizes
[33:57] and maps out where the pollution is
[33:59] because a lot of the stuff there we
[34:02] don't know because it's not fully
[34:04] characterized yet. And so sometimes this
[34:07] process takes 25 years and I lived in
[34:11] Bellingham for most of my life and there
[34:12] was a large um
[34:16] GP had a giant pole mill there that
[34:18] closed and it went through the cleanup
[34:21] process there and it took about 20
[34:23] years.
[34:27] Um and so you know the the reason that
[34:32] there are
[34:34] sever a half dozen or so large
[34:37] complicated sites in Aberine and Opium
[34:41] is that there was there were many
[34:43] facilities that operated before the
[34:45] Clean Water Act. And so then you know
[34:48] there was no law no framework of laws
[34:51] that prohibited discharges into water or
[34:55] soil or ground for seven. So now we have
[34:59] the Clean Water Act and it's illegal to
[35:03] discharge pollution without without a
[35:06] permit, a pollution discharge permit.
[35:12] And so one of my favorite things about
[35:14] this this work, which sounds kind of
[35:16] nuts, is there's a really fascinating
[35:21] um mapping tool
[35:24] that Department of Ecology manages and it's called what's in my
[35:29] neighborhood. And so if you use your
[35:33] search engine and pull up what's in my
[35:36] neighborhood, you get the whole state
[35:38] and you get all these little dots
[35:42] here and and so you can you can go to
[35:45] the dots and click on them and then
[35:49] you'll get the site that you're
[35:51] interested in.
[35:53] So um
[35:56] I think this is Cosmo.
[35:58] >> Yeah.
[35:59] So um so so you can click on that and
[36:02] then you'll get for Cosmo there's a lot
[36:04] of documents you know you'll get 20 that have been written over the years
[36:13] and and so you can look at you know
[36:15] court orders um
[36:18] past legal documents you know lots and
[36:23] lots of reading
[36:25] next
[36:27] um and and So there's a new tool that
[36:31] department of ecology was started to
[36:32] use. It's called the sharp tool and
[36:34] there's a hydrogeeologist staff at
[36:36] ecology who ranks these sites using this
[36:41] tool and it assesses the exposure and
[36:45] the severity of the risk. And so if you
[36:48] open up one of the little dots and look
[36:52] at the documents up in the corner,
[36:55] you'll or on on one of on on the site um
[37:01] one of the main documents there you'll
[37:04] see what the sharp rating is. Next
[37:09] um you know I am very concerned about
[37:13] the site.
[37:15] Um, I have trouble sleeping at night
[37:18] sometimes. I'm so worried about it. You
[37:20] know, I
[37:22] 800,000 gallons of toxic chemicals in
[37:26] leaking tanks
[37:28] right next to the river. And then
[37:30] there's another 1.7 million gallons of
[37:34] stuff in improperly stored tanks and
[37:38] buildings. And um, you know, I think
[37:42] this is an emergency.

[37:48] Um, and I go walk on the trail.
[37:52] Does anybody here go walk on that trail?
[37:56] It's Yeah. You know, it's pretty
[37:58] interesting cuz you all know this.
[38:00] There's no power, there's no water,
[38:01] there's no security, there's no nothing
[38:03] out there. And people are stealing wires
[38:07] out there. And and uh and this is the
[38:11] wastewater.
[38:13] and it's supposed to be being airrated
[38:16] as part of the treatment and it's been a
[38:18] couple years since it's been airrated
[38:20] and I'm a paddler. I paddle by the
[38:24] outside of these things and the the the
[38:28] BMS of these walls are eroded
[38:32] and that that worries me. Next,
[38:37] um
[38:39] I don't know if I have time. Let's see.
[38:43] But this is so Department of Ecology
[38:47] issued a legal document last year, an
[38:51] agreed order demanding that the owner
[38:54] conduct a remedial investigation
[38:56] instead. And he has not done that.
[39:01] And and I can provide you guys this a
[39:06] copy of of this agreed order. It's it's
[39:09] really interesting because it shows, you
[39:11] know, the names of all the buildings and
[39:14] these are the primary treatment
[39:16] tank or systems and then here's where
[39:19] the outfall is. Um,
[39:23] and I I didn't know that until I I read
[39:27] the door.

[39:33] And this is so and then more recently
[39:36] the EPA came in and did a an analysis
[39:40] and a site evaluation
[39:42] that's called the renewable site
[39:44] evaluation report and and they did a
[39:48] pretty pretty good characterization
[39:51] of where the tanks are and what's in
[39:54] them gaps.
[39:56] Um
[39:58] and and so it's that I spent a whole day
[40:01] reading 118 tanks long. It says there's
[40:07] in addition to the 800,000 gallons of
[40:10] toxic chemicals being stored there, are also 28 tanks containing over
[40:16] 1.7 million gallons of chemicals.
[40:20] Um and the digestive tanks may be over
[40:24] gallons of solid
[40:29] and the possibility of the whole thing.
[40:37] Um I'm sure you guys saw the article by
[40:40] Wayneier
[40:42] the thirst county commissioner. that
[40:45] goes into the daily world and he's a
[40:49] city of Aberine firefighter, right? And
[40:52] I had a meeting with him last week.
[40:56] Um,
[40:57] and as part of our grant, we're we're
[41:01] starting to organize a public meeting
[41:04] about this. And so if if you guys have
[41:08] ideas about who you would like to be on
[41:10] a panel of seven,
[41:13] I hope you'll let me know.

[41:19] yeah, so this is just the headline you
[41:21] see on the lines that I think this was
[41:23] about two years ago.
[41:26] Um and you know in addition to having
[41:30] public meetings and and producing um
[41:34] gasoline
[41:36] site maps that we put out and we have
[41:39] public meetings and we do presentations
[41:41] um we do tours and so the last couple
[41:46] tours that we've done from tours from
[41:49] the public right away like you know we
[41:51] can't go into hospitals or any of the
[41:53] sites but from blue smooth roads. I find
[41:58] it very concerning that the site is
[41:59] flooding. Even when there's a low tide
[42:03] and that's I think it's because of the
[42:07] but you know having a site that's
[42:09] contaminated
[42:11] flooding is not a good thing.
[42:16] Um and so back to this. So if you click
[42:19] on on one of the little dots on the
[42:22] what's on so this is another
[42:26] um
[42:28] this is what you get to see if you click
[42:31] on the what's in your neighborhood map
[42:34] or the interactive site.
[42:40] I spend a lot of time looking at this. I
[42:42] hope you at least take a look.

[43:22] about whether the rest of the site is
[43:25] high, medium or low.

[43:32] you know, these are some of the other
[43:33] sites that are big complicated sites
[43:35] that are this is this one is in the
[43:38] cleanup process now.
[43:40] Um there's a remedial investigation
[43:43] that's underway
[43:45] and um there was a public meeting
[43:48] about a year ago
[43:51] and um I find it very interesting that
[43:56] during upsets of this plant there was an
[43:59] underground pipe that piped the effluent
[44:03] to Reedi Island
[44:05] to an unlined lagoon.
[44:09] um you know that's just the way things
[44:11] were done before the three moder but
[44:13] that that's not the way things were done
[44:15] now.
[44:16] Yes.
[44:18] Um this this is another site that I find
[44:21] very concerning because
[44:24] nothing has happened here in a really
[44:26] long time
[44:28] and I think we need to to
[44:34] let department of ecology know that we
[44:37] are concerned about these sites and try
[44:41] to push for more cleanup
[44:44] more and faster cleanup. I mean here
[44:47] they sand blasted boats
[44:50] for a long time before the clean water
[44:52] act was which is was common but all the particles zinc copper and things
[45:00] like that that are used in boat paint
[45:02] are in the center there
[45:05] next
[45:07] and then there's the warehouse or sill
[45:09] aine you know this is also undergoing a
[45:11] cleanup process but it's proceeding at a
[45:14] very slow
[45:24] So, um, I had a really good experience
[45:27] with your pollution prevention or your
[45:30] pollution hotline. I was walking by the
[45:33] Avenue by the lock pavilions during a
[45:36] very low tide about 10 days ago and I
[45:39] looked down in is it Joe Creek?
[45:44] Detroit that's right by the Avenue
[45:47] » and the tide was like a minus three foot
[45:51] tide. I looked down and there's a derel
[45:53] vessel in the bottom of the of the creek
[45:57] and so we called
[45:59] >> your guys's hotline and you came the
[46:03] next day and took it out. It was amaz
[46:07] I think it's a shopping cart that was
[46:09] there.
[46:11] Well, well, I you know, to me, shopping
[46:13] carts are not a big deal
[46:16] >> compared to this other shop, but it I

[47:52] with with me for some reason. and they
[47:54] don't answer my questions, but
[47:58] they they've told me that they're giving
[48:02] Richard Basset 6 months to comply with
[48:06] the agreed order. And if he doesn't,
[48:09] then EPA and ecology will go in and
[48:13] either remove or stabilize all those
[48:16] toxic gallons of chemicals.
[48:20] And if if it would be of interest to any
[48:23] of you, I I did a public disclosure
[48:26] request and and and I have all those
[48:29] documents if anyone.

[1:05:10] Councilman Shaw had was he was

[1:05:15] infrastructure and I know that they're
[1:05:16] working on that. They told me that
[1:05:17] they're working on that. Part of the
[1:05:19] problem is is they not everything has
[1:05:22] been transferred yet. They don't even I
[1:05:23] don't think they even know exactly what
[1:05:25] they have at this point. They're but
[1:05:27] they're in that process. So, um anyway,

[1:05:34] take advantage of because they are the
[1:05:37] experts on this and and I am not I did

[1:06:38] they have included in ask them and I
[1:06:41] understand from that they're working on
[1:06:43] creating that be included in the
[1:06:45] contract in the back contract of the
[1:06:47] franchise or if if there is not any then
[1:06:52] that's stated that there isn't any uh
[1:06:55] what I hear is that they're trying to
[1:06:57] find out what they have and that was the
[1:07:00] push that was the caution from my
[1:07:03] discussions with the IT people at the
[1:07:06] PUB was that quite often we have a gray
[1:07:10] area or lack of understanding of what
[1:07:13] exactly is included with franchise
[1:07:15] agreement and it leads to significant
[1:07:18] problems down the road in time and
[1:07:20] money. So as we go forward sounds like
[1:07:23] they are working on creating an
[1:07:24] inventory what was passed down and if
[1:07:28] that all comes together I have no
[1:07:30] difficult
[1:07:40] during this discussion um per Robert's
[1:07:42] rules of order this would need to come
[1:07:45] back by someone who voted no um when
[1:07:48] this was originally brought forward. So
[1:07:50] once we have these answers to these
[1:07:53] questions, just please bear that in
[1:07:55] mind. This cannot be brought back to the
[1:07:57] table for the council to vote on unless
[1:07:59] someone who voted no is going to bring
[1:08:01] it back to the table. side.
[1:08:06] Um, so this conversation with the PUBG
[1:08:10] that
[1:08:15] I I just um a little so the PUB advised
[1:08:19] and like gave you advice to
[1:08:22] >> I took I I read it I read it in depth. I
[1:08:25] asked a few people and I found that the
[1:08:27] people that were expertise on this issue
[1:08:29] or had some expertise that we deal with
[1:08:32] are our friends with the community and I
[1:08:34] sat down and talked to them about things
[1:08:36] that we should look at when they look at
[1:08:38] this topic and it stuck out to me the
[1:08:41] fact that this could you couldn't tell
[1:08:44] from reading this agreement initially
[1:08:46] whether it was a new agreement or
[1:08:48] whether it was a series of transfers.
[1:08:50] That was that was not clear in reading
[1:08:52] the agreement. And then in asking that
[1:08:54] question back to our city attorney, it
[1:08:58] was stated that oh no, there are no
[1:09:00] transfers. This is a they asked for an
[1:09:03] entirely new thing. So just trying to
[1:09:06] avoid the issue of
[1:09:10] what are ghost polls, what are un
[1:09:13] undocumented closets, who
[1:09:17] what assets might go with this
[1:09:19] franchise. Now, as I understand how
[1:09:21] franchise agreements work, and I'm not
[1:09:23] an expert, but I know how to ask the
[1:09:25] question, um
[1:09:28] are if there's no asset or no transfer
[1:09:30] from these previous u agreements that go
[1:09:34] back through
[1:09:35] um these other companies, it's really
[1:09:38] easy to state that in the contract and
[1:09:41] the franchise agreement that this
[1:09:43] reflects no past or existing. And if
[1:09:46] there are past or existing assets, those
[1:09:50] are in the contract so that they
[1:09:51] reflected what we're giving franchise
[1:09:53] for.
[1:09:55] Hope I'm not making it complicated, but
[1:09:58] it was just it's it's a form. It's a
[1:09:59] question of contract.
[1:10:04] » So go back. Yeah, I was really hoping
[1:10:06] that you would bring up what you were
[1:10:08] mentioning during public works about the
[1:10:10] how sometimes to solve this they do
[1:10:13] what's called location the lo the
[1:10:16] locating process we just basically it
[1:10:18] was on basis of the franchise to go out
[1:10:20] and try to find
[1:10:21] >> yeah honestly the people we should be
[1:10:25] talking to are the ones that are
[1:10:26] spending their online
[1:10:29] but yes the uh the lucky process will
[1:10:34] identify where They you know they all
[1:10:38] participate and pay in the service when
[1:10:40] we go out the right way and we want to
[1:10:43] know what's on the ground. We don't call
[1:10:44] the PD call locate service and they come
[1:10:47] out and they locate all the utilities in
[1:10:50] the ground. They they know where they
[1:10:52] know where things are better than than
[1:10:54] or knows where they are. Right. So um
[1:10:58] that's how we locate uh and and it's the
[1:11:01] responsibility of whoever calls that
[1:11:04] locate that's doing that work to ensure
[1:11:06] that we know where the utilities are. Um
[1:11:10] I I don't I'm not even sure we are
[1:11:13] really clear on what drivers buy. So
[1:11:17] there's there's like um you know they're
[1:11:19] not buying all of assets or they're
[1:11:23] buying the end user. they're not buying
[1:11:26] the main buy agreement and I I really
[1:11:29] encourage either Lisa Wolf to give us
[1:11:32] some background of the the franchise
[1:11:34] agreement or Liz to give us some
[1:11:36] background on
[1:11:38] this is not new. They they've gone
[1:11:40] through this process all over the state
[1:11:42] of Washington. He has written a number
[1:11:44] of franchise agreements for other cities
[1:11:46] in the state of Washington as they were
[1:11:48] Cambridge just said which represents a
[1:11:51] lot of different cities. So this is not
[1:11:53] a new agreement. this is the same order
[1:11:56] type of agreement that's been given to
[1:11:58] us. So, um I'm sure that they can answer
[1:12:03] these questions really clearly and uh
[1:12:06] more
[1:12:09] so my question for her would be is this
[1:12:12] something that's usually documented in
[1:12:13] these transfers? We usually have full
[1:12:15] inventory list or is this something
[1:12:17] that's just kind of undocumented?
[1:12:21] Is is it is this unusual that we're
[1:12:23] asking for this type of information just
[1:12:25] a lot more information than we're are we
[1:12:27] asking for

[1:12:45] to do is just give you the guard rails,
[1:12:47] what we can ask for, what we can't ask
[1:12:49] for, and then I'm going to turn it over
[1:12:51] to Liz to um answer technical questions
[1:12:55] about the infrastructure itself. Um,
[1:12:57] oftentimes when franchises expire, there
[1:13:01] isn't a real solid understanding of
[1:13:03] where that infrastructure is. That
[1:13:05] infrastructure location comes becomes
[1:13:08] critical when construction is going to
[1:13:10] proceed. So that's when 61 locate is
[1:13:12] called. That's where we figure out where
[1:13:14] the um where the infrastructure is so we
[1:13:16] don't hit it. But it is not normal to
[1:13:19] know exactly where everything is when
[1:13:21] the franchise is drafted or when it's
[1:13:24] executed. We define a franchise area. We
[1:13:27] define the right ofway. And within those
[1:13:29] definitions, we do not engineer the
[1:13:31] location of the infrastructure. That
[1:13:33] said, in all fairness to council member
[1:13:35] Shaw, I do think it's um a legitimate
[1:13:38] question to ask the carrier whether or
[1:13:40] not there is infrastructure on the in
[1:13:42] the ground or not. And if there is no
[1:13:45] infrastructure on the ground, what the
[1:13:47] plan might be. Um, I'll also add that locate um question does come up
[1:13:53] from councils from time to time and this
[1:13:55] is typically the way we answer it and we
[1:13:58] also explain that when construction
[1:13:59] comes um you know when it is imminent
[1:14:03] then we do get all the information we
[1:14:04] need. So I'm going to turn it over to

[1:14:30] subsidiary or an entity created by AT&T
[1:14:33] to hold assets that they are purchasing
[1:14:35] from Lumen. Um, and council member Shaw,
[1:14:39] your question um is a good question
[1:14:42] asking about um the the maps and the
[1:14:44] locations of those assets that are being
[1:14:46] purch purchased. And I have requested
[1:14:49] that information and I've been told that
[1:14:52] they're just trying to make sure
[1:14:53] whatever I give over to you is as
[1:14:55] accurate as possible. And so
[1:14:57] unfortunately it's taking a little bit
[1:14:58] longer and I apologize. some um for some
[1:15:02] jurisdictions they've asked for maps and
[1:15:04] I've gotten them right away and been
[1:15:06] able to provide them and um I asked
[1:15:09] again today right before the meeting and it's just they're they're just
[1:15:12] trying to make sure that they that what
[1:15:14] I give you is accurate in terms of the
[1:15:16] location of the fiber that they are
[1:15:18] purchasing. Um just to expand a little
[1:15:21] bit um on on what they're purchasing
[1:15:24] what Forge Fiber is purchasing from
[1:15:26] Lumen um from uh it's technically Lum um
[1:15:31] Lumen AT&T or Forge Fiber is purchasing
[1:15:33] the F2 fiber which starts at the
[1:15:36] neighborhood cross connect and ends at
[1:15:38] the customer premises. So they're taking
[1:15:41] a part of it and then Lumen is keeping
[1:15:44] the part um called the F1 fiber which
[1:15:48] starts at their central office and goes
[1:15:50] to that first cross connect panel. So
[1:15:52] one of the questions that I was asked
[1:15:54] which was a really a question we've had
[1:15:56] before is you know why is it just an
[1:15:58] assignment of of a franchise or or why
[1:16:01] does Forge Fiber need their own and they
[1:16:03] need their own for that reason because
[1:16:05] they're not buying the whole thing
[1:16:06] outright. they're they're buying certain
[1:16:08] a certain portion of the assets. Um so
[1:16:12] and again just a I apologize for not
[1:16:15] having uh the map. Um like I said, it's
[1:16:19] something that we've provided to other
[1:16:20] jurisdictions when asked and what I was
[1:16:23] told today is that they're still um
[1:16:25] reviewing the information to make the
[1:16:27] determination um and just you know vet
[1:16:30] the information I'm giving you so that
[1:16:31] we can have accurate information
[1:16:33] provided. But as soon as I have that um
[1:16:36] I will have that over to um uh Rick uh
[1:16:41] Sanger and um I'll send it to Lisa too
[1:16:43] so that you guys will have that
[1:16:45] information as soon as I get it and I'm

[1:19:11] be happening and we really know where

[1:19:17] but I asked I asked them do they see
[1:19:21] issues and they're very positive. They
[1:19:23] absolutely you got you know we need to
[1:19:25] do this and support it. But it was about
[1:19:28] when we see problems, it's because
[1:19:31] somebody forgot to include somebody.
[1:19:34] didn't know something and it
[1:19:36] takes months and months to sort out uh
[1:19:40] something that could have easily been in
[1:19:42] the contract at the beginning.

[1:27:50] not a lot of people, but more people to

[1:28:02] maybe that we could have made. But, um,

[1:28:39] isn't to me anything about the current

[1:28:43] that's been going on for quite a while
[1:28:46] during the election campaign and in
[1:28:48] recent years has been discussed
[1:28:49] regularly and I think it really comes
[1:28:52] down to letting this go to the voters.
[1:28:56] We have developed a habit here at the
[1:28:59] city to uh create um new polls to create
[1:29:06] basically we're going to the public all
[1:29:08] the time asking for their opinion on
[1:29:11] everything from what our budget should
[1:29:12] look like to how to what we should be
[1:29:15] prioritizing at the city. And I think um
[1:29:18] I think it is in good form and walking
[1:29:21] the walk to ask the citizens of this
[1:29:25] question that's been out there for a
[1:29:26] long long time. And I think it is a
[1:29:29] mistake to not allow it to go for
[1:29:33] citizens vote. And again I I came into
[1:29:38] this I'm new on the council. I've
[1:29:40] watched this exhibition for a long time.
[1:29:43] And this is just about giving Aberdine a
[1:29:46] chance and the voters to have a say. We
[1:29:49] ask them all the time. We got QR codes
[1:29:52] on the wall when we're asking people how
[1:29:55] we should do things. We can't be afraid
[1:29:58] to let this go to

[1:30:06] member Shaw was saying and while I was
[1:30:08] campaigning and also just talking to
[1:30:10] people, this has been a topic that comes
[1:30:14] up almost every time I'm talking to
[1:30:16] somebody. Um, the the voters in our city
[1:30:18] care about this topic a lot. And for me,
[1:30:22] it just comes down to letting people
[1:30:24] decide how they want to be represented.
[1:30:27] And I just can't see any reason why we
[1:30:29] wouldn't let people decide the number of
[1:30:31] people they want represented them.

[1:30:55] there. Um, this isn't changing the board
[1:30:57] boundaries. This specific proposal
[1:31:00] doesn't shorten anyone's term.
[1:31:02] Most importantly, we are not voting to
[1:31:05] reduce it. We're voting to allow the
[1:31:08] voters to have that decision. Um, I
[1:31:11] think, you know, as a council member,
[1:31:14] you don't have to personally support the
[1:31:16] reduction of council um
[1:31:20] to allow someone else to allow the voter
[1:31:22] to vote. Those are two very different
[1:31:25] decisions.
[1:31:28] I understand there's some legitimate
[1:31:29] arguments for keeping 12. So they
[1:31:32] believe that, you know, two forward
[1:31:34] provides you with some greater access or
[1:31:36] perspectives of the dis. And I I do
[1:31:38] respect that position.
[1:31:40] This choice about representation should
[1:31:42] belong to the voters. Those who voted
[1:31:45] for us and elected us to represent them,
[1:31:48] not those of us sitting up here. That's
[1:31:51] why this has been brought forward. This
[1:31:53] is why I've pushed so hard for it since
[1:31:55] I've been on council and that's why I
[1:31:57] will be voting yes and
[1:32:00] pass this through.

[1:32:21] stressful point and allows a lot of us

[1:32:31] programs and process that I've been
[1:32:33] doing now for since 2018 is when I
[1:32:35] started.
[1:32:37] And for me, just to hand over everything
[1:32:39] I've worked for and everything that I am
[1:32:42] pushing for is to I still need to go
[1:32:45] bathroom. That was our first
[1:32:47] conversation.

[1:32:57] now. If we were a vote right now, it
[1:33:00] would leave it to where

[1:33:24] the people but our voice will be unheard

[1:33:34] only thing I that's unfair

[1:47:50] address some of these um concerns. Um
[1:47:53] when the ethics committee met, we were
[1:47:55] very sensitive to all of these concerns
[1:47:57] and we shared them. We discussed the uh
[1:48:01] fear that had been expressed to we've
[1:48:03] heard previously about the um ethics um
[1:48:07] being weaponized and um and we discussed
[1:48:11] all this at length and the reason that
[1:48:14] we came to the conclusions that we did
[1:48:16] is we found that um a couple of the
[1:48:20] issues were not not supported. Um but
[1:48:23] the tone of voice and um calling
[1:48:28] someone's votes in a derogatory manner
[1:48:30] that that was that was supportive.
[1:48:33] Whether you know you are allowed to
[1:48:35] disagree certainly um but we just felt
[1:48:39] that um by calling somebody's choice of
[1:48:42] votes disgusting that was crossing the
[1:48:45] line of the letter of being professional
[1:48:48] and working in a professional way. That
[1:48:51] was why we came to the decision that we
[1:48:52] did and it was unanimous.

[1:49:38] we've made a decision in democracy. That

[1:49:51] other. I'm just saying in a democracy in
[1:49:53] this council
[1:49:56] we make a decision. We as as a group

[1:50:07] has not stood by decision and that was
[1:50:11] completely wrong and unethical.
[1:50:14] moving forward, we need to stand by the
[1:50:16] decision of the council and whatever the
[1:50:18] vote is, we all need to
[1:50:20] swallow whatever anger we have inside
[1:50:23] and stand behind that vote because we
[1:50:25] are a council. We we're we're united and
[1:50:28] we are of course united, but
[1:50:30] individually we're not

[1:53:18] hours um trying to follow reading

[1:53:26] how important this was. This is our
[1:53:27] first time dealing with this.
[1:53:30] We spent hours with our attorney getting
[1:53:34] advice, figuring out steps that needed
[1:53:38] to be made, ensuring cross, you know,
[1:53:40] dotting our eyes, crossing our tees, all
[1:53:42] of the things. And the result is
[1:53:45] probably tens of thousands of dollars
[1:53:48] collectively that we spent just handling
[1:53:51] this issue
[1:53:53] because
[1:53:55] of like maybe there was a a way to talk
[1:53:59] about this or to deal with it at a lower
[1:54:01] level. I understand that this is
[1:54:06] this exists
[1:54:08] and that feels disrespectful.

[1:54:15] I understand that these rules exist to
[1:54:17] keep people safe and to provide a a
[1:54:19] process and way a procedure for all of
[1:54:22] you to to do this to to to be able to
[1:54:24] air out your grievances. But I just want
[1:54:27] you also to be aware
[1:54:30] of the money that goes and the time that
[1:54:33] pulls her away from the budget process
[1:54:36] handling making sure our payments are
[1:54:38] made, you know, utility bills, all the
[1:54:41] things that go into it. So, I just I
[1:54:43] also want you to be aware I'm not trying
[1:54:45] to discourage you to not pursue this,
[1:54:48] but I just want you to be aware of the
[1:54:50] operational impact to the city that this
[1:54:53] has. So, thank you.

[1:55:14] is nothing if everyone hears sharing
[1:55:16] their voice the way that they should be.

[1:55:21] thing that we should all be building

[1:55:24] accountability to each other,
[1:55:25] accountability to the staff for
[1:55:27] accountability to the people that voted
[1:55:28] us up here and accountability to each
[1:55:31] other comes up real quick when we look
[1:55:33] at the fact that we just approved this. So yes, it might have taken a long
[1:55:37] time this time. Yes, it might have cost
[1:55:39] that much money which never came up in
[1:55:40] our conversations and I wish it had but
[1:55:44] nevertheless
[1:55:46] it's the same thing I I shared with you
[1:55:47] before. I mean accountability is
[1:55:49] everything. So we can't be accountable
[1:55:51] to one another. How can you ever build
[1:55:52] trust? It's not going to be advertised
[1:55:54] to break down this concept of us being
[1:55:56] on two two sides, two teams.
[1:55:59] And I'm not going to sit here and
[1:56:00] pretend like it doesn't exist. But I'm
[1:56:02] also not going to sit here and pretend
[1:56:03] like I haven't spent the last two years
[1:56:05] as council president trying everything I
[1:56:07] can to break that down, trying to get
[1:56:10] people on that other side to have
[1:56:11] conversations with me, to meet with me,

[2:11:31] them for advertising space. I cannot
[2:11:34] stress enough the importance behind a
[2:11:36] press release because there are several
[2:11:39] companies like that that are scams and
[2:11:42] then our small business owners are
[2:11:43] paying anywhere from $200 to $600 for an
[2:11:46] advertisement that is then not purchased
[2:11:49] by the municipality or whichever
[2:11:51] business those are to be displayed at.
[2:11:54] So if you do need to do this, please
[2:11:56] consider a press release so that we are
[2:11:58] helping our small businesses and
[2:12:00] operating. Yeah, we we did something
[2:12:02] like this with the bands that are out

[2:12:12] selling tool. So that showed that we
