city council because Melanie Ang um
[3:18]
resigned. She moved to Sutter Creek and
because of change of uh jurisdiction,
[3:23]
could no longer serve on council.
Tonight, we have um two letters of
[3:28]
interest. one from Steven Ta and one
from James Monday. I want to state
[3:33]
before going any further that I wish we
had two open seats on council because we
[3:37]
have two highly qualified, very capable
individuals who would be of tremendous
[3:42]
benefit to city council. And before
going further again, I want to remind
[3:48]
folks this is a six-month appointment.
It is through December 26. In August of
[3:54]
26, there will be an election because in
January there will be three seats and
[4:00]
there will be I hope James Monday and
Steven Ta who will both run for one of
[4:07]
those three seats who in January
[snorts] can both be sworn in. Tonight
[4:12]
it's one person. Um, I also owe an
apology because I had the agenda ready
[4:19]
before James's letter of interest came
in and while I attached it, I did not
[4:25]
change the introduction on the agenda
item. And James, I offer you the
[4:31]
opportunity to say you would like to
postpone this until July because of my
[4:36]
error.

resignation of city council member Miss

Melanie Unquest. I have been a restor
city for over a year and my professional
[6:21]
background would be well suited in
fulfilling this particular vacancy. As a
[6:27]
professional engineering and
environmental geologist, I have
[6:31]
participated in hundreds of public
hearings on behalf of clients and in my
[6:35]
role as the executive officer of the
California State Planning and Geology
[6:39]
Board from 2005 to 2016. In such roles,
I am very acquainted with the state
[6:47]
administrative procedure act, the Brown
Act, and various codes pertaining to
[6:51]
ethics and conflicts of interest. My
resume is attached. I believe my skill
[6:56]
set would be complimentary and an asset
to that of existing council members. I
[7:01]
appreciate your consideration of this
letter of interest. Thank you.

Um, so, dear city council members, I'm
ready to express my interest in filling
[7:46]
the vacant seat on the city council.
I'm 75 years old, so I meet the age
[7:53]
requirements
[7:56]
and I've resided within the city limits
uh of Amber City since in 2019
[8:04]
and I'm a registered voter in city. I
regularly
[8:12]
attend city council meetings and as a
practicing architect,
[8:17]
I presented various projects to the
council over the past six years,
[8:23]
including the tavern up on Main Street
and residents on last James.
[8:32]
I've also served as a member of the
design committee for the past several
[8:37]
years.
Through these experiences, I have gained
[8:41]
familiarity with the municipal code and
city governments
[8:49]
and I
assume and I welcome the opportunity
[8:55]
to expand my engagement
through service on the city council.

I'm confident that I am well qualified
to serve the residents of Angular City
[9:08]
as a city council member.

architect with UC Davis

and senior project manager where I
manage many million dollar projects. So,

letter, but you know, budgets [snorts]

and negotiations with um shareholders in
any given project is some something that
[10:00]
I became very skillful at. Thank you for

then, you know, again, we'd have open

that West that's West School Street. and

we're having um issues with commercial
deliveries. Uh we know it's, you know,

on Google Maps, but there needs to be a
street sign on the city property. So,

there's no sign.

too. This is city hall at night at 10:00

Last city council on May 12th. I
[24:34]
requested under government code 5946 if
I be and city council have a close
[24:41]
session city council meeting. Um I
learned today from Mayor Staples that
[24:47]
apparently supposedly a letter was sent
out um by supposed city attorney
[24:54]
indicating that he didn't believe that
that was the right venue for
[24:59]
whatever. Um, I'm a little confused
since during the last city council
[25:04]
meeting I was kind of blocked off from
discussing some of the issues that I
[25:08]
would have liked to. So, I'm kind of
curious as to how a conclusion was made
[25:15]
in point about what I was going to talk
about um during that meeting
[25:19]
specifically enough to say that it
wasn't the correct venue. I believe it
[25:22]
is the correct venue.

drawing the conclusion that someone
concluded without the council meeting

about. Right. and that that might not

since I wasn't able to speak how the

assumption was made about exactly what
my approach was to let the city council
[25:53]
know the reason I objected to the vote
which I I believe the vote is irrelevant
[26:00]
anyways um to not abandon the street um
those are all opinions that I was going
[26:05]
to share with city council and and
city's attorney um because the opposing
[26:12]
ing argument is several and one of those
is that that move in itself would have
[26:18]
made the entire transaction illegal
because I would have lost particular
[26:22]
access to the property. So therefore, we
can't just split it down the middle
[26:28]
which was part of the abandonment thing.
It's not going to work. Secondly, and
[26:32]
most importantly, that's not what the
city council approved. They approved to
[26:36]
quit claim. I've been told and I'm
paraphrasing
[26:41]
slightly that the opinion of city
council is that it cannot be quit
[26:47]
claimed. That is just factually wrong.
The city can
[26:53]
quit claim public property to a private
owner under the conditions that it was
[26:57]
voted on by city council. it was they
can avoid the public lands act or public
[27:04]
I have written down if such a move
benefits the city including the city no
[27:10]
longer having to maintain or repair such
property. All of those conditions have
[27:15]
been met and the other condition would
literally render my lot unaccessible. So
[27:22]
it would have been illegal anyways just
on the face. This is a problem. The city
[27:28]
has agreed. [clears throat] I have
performed that's detrimental reliance
[27:34]
and nothing's happening. So again on the
second part of this why this item was
[27:41]
taken off of the agenda without
notification to me. These are two
[27:44]
separate items. One is a special close
session with the city council. That was
[27:49]
an attempt to from from me to approach
city council and city's attorney to
[27:55]
avoid a lawsuit with the city at the at
the benefit of the city. That's the
[28:01]
first thing. The item then being removed
from the agenda, which I don't think the
[28:05]
two are test technically related, which
is why I kept it on the agenda, is kind
[28:10]
of it's a little curious. I don't think
it was proper. I'm a little frustrated.

I do not know if this is the intent of
the city council or city attorney or if
[28:22]
it's just
unintentional negligence at this point.
[28:27]
However, the law does not allow intent
or willful negligence to be separated.
[28:34]
It's a problem. We need to resolve it
and that's why I'm here today. Also,
[28:39]
because I thought it was on the agenda.

delay. I had email. The city has its own
letter head and I don't have that. I

mean, normally I think something from
the city should be on city letterhead. I

thought it had been emailed at some
point. I can't find it, Sandy. I don't

know what to do at our mayor.

[29:28]
I I printed it out and redated a letter
today. Essentially, the letter said,
[29:35]
"Dear Mr. James, the city council and
mayor had requested that I respond your
[29:39]
public comments to the last council
meeting regarding the abandonment of the
[29:42]
portion of O'Neal Alley which runs
across the property. The city has
[29:46]
determined by communication with the
Amodore Water Agency that there are
[29:50]
public utility easements in or under
O'Neal alley which would be affected by
[29:54]
an abandonment of the alley by the city.
Streets and highways code section 8334.5
[30:01]
provides as follows. Notwithstanding any
of the provision of this article, a
[30:05]
street, highway, or public service
easement may not be so narrowly vacated
[30:09]
if there are in place public utility
facilities that are in use and would be
[30:13]
affected by the vacation. Because of
this, the city does not have and never
[30:18]
had the authority to vacate O'Neal Alley
or that portion of it as a result of the
[30:23]
above state law since those facilities
would clearly be affected by its
[30:27]
vacation. And finally, the council
recently reconsidered the issue at a
[30:32]
prior meeting and determined not to
vacate the street. Therefore, from the
[30:36]
city standpoint, the matter is at an
end. And that that was my opinion in
[30:40]
terms of that. I did not reference
8334.5
[30:44]
previously because it I don't know that
I had information whether there were or
[30:50]
were not uh public utility facilities,
either water or sewer pipes underneath
[30:57]
it. It turns out later on we now have or
I now have this information that there
[31:02]
were and consequently that with that law
as I interpret it is pretty clear by its
[31:08]
own language that the city can't
summarily vacate [snorts]
[31:13]
um if there were public facilities that
would be affected by the vacation. I
[31:19]
know it's frustrating. I get that. I'm
aware of that. But I'm I'm just I
[31:24]
addressed in this simply the legal
issues that I thought were important.

the problem I have with the vacation is
[31:33]
one vacation does not necessarily convey
title. It conveys fee interest and
[31:38]
there's a big difference there and that
is not what I approached the city
[31:41]
council originally about. I'm not asking
you to vacate an easement. That was
[31:45]
never the question. I never motioned for
it. Secondly, as far as the water
[31:49]
utilities that are under there, the
problem with the vote you guys held is

that the water agency, and I have the
chain of emails between the mayor and
[31:57]
the water agency, and in general, they
were general emails. I don't think that
[32:01]
it was pointed specifically at the water
agency or any other utility. But what
[32:06]
that email says is that we are, and I'm
slightly paraphrasing, we are
[32:11]
considering abandoning our easements on
this section of O'Neal Alley. What it
[32:15]
fails, which is either
intent or accidental negligence, is it
[32:23]
fails to notify the water agency that a
grant a a deed public utility easement
[32:30]
was included in what I have stated to
the city. Of course, I spoke with the
[32:35]
engineer at the water agency regarding
that very same thing and his impression
[32:39]
of the email was clearly that the intent
of the city was to completely abandon
[32:44]
the easements which may have according
to the email and the codes that you
[32:49]
listed even required him to move those
facilities. Thus the reason for his
[32:54]
objection. So I understand where he's
coming from. So then I asked him, well,
[32:59]
did they happen to mention in any form
during the council meeting or in any
[33:02]
other email that I had already offered a
deed easement for public utility access?
[33:08]
He said, "Nope. No one indicated that to
me." So whether that misrepresentation
[33:14]
was intentional, and I'm not saying that
it was, or whether it was just
[33:17]
accidental, it's a misrepresentation.
And thus, according to government code,
[33:22]
that [clears throat] vote that you guys
held
[33:25]
can be invalidated because did not have
the proper information.
[33:29]
» He told me, and we were more
[clears throat] than willing, you know,
[33:32]
happy to email him back, he doesn't
really care who owns the land as long as
[33:37]
he has an easement to access his
utilities. That was my intention. I've
[33:42]
agreed to that with everyone there. That
that should not have been an issue.

Although you did properly notify the
utilities that was proper. They're just
[33:50]
missing a major piece of information.
and public comment can't have can't
[33:56]
involve any action from council. So I
appre I just I appreciate you sharing

next step an agenda item a close session

» I can address the prior request for a
close session. You can't have a closed

session that involves one member of the
public and no others. It could only

which can include the city attorney and

the uh other staff. I sometimes that
would include city engineers that sort

close sessions in that regard. But you

can't have a member of the public
present and exclude everybody else. I

didn't request it to exclude everybody

ordinance of the city of Amodore,

California, amending the municipal code
to establish through truck to spellings
[44:33]
restrictions within city limits
consistent with California vehicle code
[44:37]
section 35701.
This will be a first reading and this is
[44:42]
a draft. Second reading and passage will
be at the regular city council meeting
[44:47]
Tuesday 7 of July. If passed, ordinance
190 would take effect after 30 days or
[44:53]
when appropriate signage is in fa in
place. And the uh attachment here is
[44:59]
ordinance 190. Let me pull down to part
of that. Anyway, we can wave the full
[45:06]

Um, the purpose of the ordinance is to
enhance traffic safety. Um, and it's
[45:18]
stated in there, reduce roadway
maintenance costs, preserve the
[45:21]
residential and historic character of
Main Street by prohibited prohibiting
[45:26]
the use of Main Street by trucks
exceeding 10,000
[45:31]
pounds or five tons gross weight.
um consistent with the requirements of
[45:37]
California vehicle code and it does
state in there on the next section very
[45:43]
clearly that what the definitions are
commercial truck through traffic the
[45:48]
restricted street is main street city
limit to city limit so this is
[45:54]
minimizing through traffic that is not
doing delivery that is not
[45:58]
[clears throat] doing business within
the city of Amador city so so delivery
[46:03]
trucks buses School buses, ambulances,
fire trucks, moving vans, etc. that are
[46:09]
doing business and deliveries within the
city limits and using Main Street are
[46:14]
not restricted. It is through truck
through truck traffic that is using Main
[46:21]
Street as sort of a shortcut up into the
county area and into Setter Creek. In
[46:26]
the mornings, there's a fair amount of
rumbling of them. And uh this was one of
[46:32]
the traffic calming recommendations.
An ordinance is available for public
[46:38]
comment for a cons you know uh for
postings and uh we will with approval
[46:46]
post it have public comment on it in
July and then uh vote on approving it.

It will not take effect for 68 day for
65 days after that. I have one addition
[47:00]
or one wording I'd like to add to this
draft version

and it is under section three that is up
here just for clarification. Restricted

street is main street city limit to city
limit. Section three states as except as

otherwise I'll read here so it carries
provided in section four it is unlawful

for any person to operate drive any
commercial vehicle using Main Street to

enter I would like to insert an exit
city limits for a dur a duration outside
[47:34]
destination outside city limits. So that
does not preclude
[47:39]
the
trucks that need to go to the ranches
[47:42]
and use water street. They enter main
street and then use water street. They
[47:46]
come from the ranches, use water street
and then exit main street. It is
[47:50]
entering main street exiting main street
from city limit to city limit using Main
[47:56]

words you know if the it's approved add

commemorative pride flag in recognition
of pride month. Discussion and possible

action regarding displaying the pride
flag in June to honor LGBTQ plus history

and affirm the city's ongoing commitment
to fostering an inclusive and welcoming
[57:00]
community. The attachment is the
resolution.

Um the process for doing a regular
agenda item and we'll go through that

process tonight is to first have
questions taken by council members

regarding this item. Then questions for
council members and comments will be

think it's important to point out that

one of the questions that often comes up
is about what constitutes a
[57:41]
commemorative flag and it's when it's
been designated a commemorative flag by
[57:46]
either our state or our federal
government. The pride flag was
[57:51]
designated a commemorative flag by the
state of California June 17th in 2019.
[57:58]
Pride uh has been designated uh June has
been designated as pride month
[58:03]
commemorating Stonewall protests and is
recognized as such by the federal
[58:07]
government beginning in 1999.
So the pride month of June was
[58:13]
designated 1999. The flag was recognized
as a commemorative flag in 2019.
[58:20]
Um and
within the wherefors and wise there is
[58:26]
clear designation that any commemorative
flag is flown below the US flag. The US
[58:32]
flag has to be larger than or at least
equal in size to any commemorative flag
[58:37]
that is flown such as the P
commemorative flag that's on the flag
[58:41]
pole outside of post office. And the US
flag must be the first raised and the
[58:46]
last lowered. So the respect and
etiquette of the US flag is always
[58:50]
protected with any commemorative flag.
And it does state the process for any
[58:56]
individual wanting another commemorative
flag to be recognized by the city. An
[59:01]
individual comes to city council member.
A council member may take up that bring
[59:06]
a resolution to council. Council would
vote on it. So in the future, that's the
[59:11]
process. That was the process for this
time with this resolution.

Um, I can speak as a former um 11-year
elementary school teacher here in Amber

County. um of
sixth graders um having so many students

and helping them along their path and
just um talking a lot about symbols and
[1:01:34]
talking a lot about the flag and just
like tonight I'm really proud that one
[1:01:37]
of our kids got up and was able to honor
our symbol and the symbol represents all
[1:01:41]
of us. Um, but the pride symbol also
does represent us and um, as two Texas
[1:01:49]
transplants here in Amador County, um,
sometimes it feels like we're not that
[1:01:53]
far from Texas and it can be it can be
hard and it feels really good to be here
[1:01:59]
in Amodore County and feel like all
three of our kids can have two moms and
[1:02:04]
we're safe here. It it's really special.
So, um, we just purchased our first
[1:02:09]
house together in Amadar City, and
that's why we're here is because we
[1:02:12]
feel, um, that this is a community that
really honors, um, not just our gay
[1:02:19]
community, but really honors everybody.
And that's to me, I mean, we just read
[1:02:23]
the we have a little story book about
the Pride flag and Harvey Milk and how
[1:02:27]
he founded that, but it's not just for
gay people. It's for everybody. And that
[1:02:31]
everybody um should have the same
rights. And I wish more people saw the
[1:02:35]
flag like that. It's not just some
specific thing. It's like everybody
[1:02:39]
should be um embraced and given the
rights. So, I just I love the thought of
[1:02:44]
the pride flag flying next to the
American flag and that it's there's no
[1:02:48]

projects in California Assembly Bill 413

intersection daylight law. And actually,
I'm going to go up to the agenda after

Okay, there we go. Um, there are two
parts to this. Part A and part B. Both
[1:07:56]
of these involve uh discussion and
possible action regarding the following
[1:08:01]
projects and cost estimates for projects
focused on traffic calming and basic
[1:08:07]
safety for pedestrians, cyclists, and
vehicles.
[1:08:10]
The first is for Senate Bill 1 uh
projects that were submitted for 2526.
[1:08:17]
Now, of the six projects that were
submitted, three of them have been
[1:08:20]
completed already. The report is due at
the end of this month. So, we're
[1:08:24]
squeaking through with the last of the
projects, which require a certain type
[1:08:29]
of weather in order to be completed. You
had to wait for the rain and for the
[1:08:33]
temperature to be right. And so, this is
the right time for it. And these are
[1:08:37]
repainting crosswalk markings on O'Neal
Alley and Main Street. Uh that
[1:08:42]
intersection, the two crosswalks there
and at the intersection of Ion Valley
[1:08:47]
Road or God's Hill and Main Street.
People refer to that intersection with
[1:08:52]
both road names. Um and I'm adding from
the city parking lot to the west side of
[1:08:59]
Main Street. That traditionally went to
the brewery, but you know, without it
[1:09:03]
being a business, I didn't know what to
call it. So that would be three city
[1:09:07]
crosswalks. We have estimates from the
um engineer on the cost for that. They
[1:09:12]
are paid by Senate Bill one monies that
the state gets every year from gas tax.
[1:09:19]
Um there used to be a lot more gas tax
available to cities and with the advent
[1:09:25]
of so many EV EV vehicles and uh
efficient cars, the gas tax that's been
[1:09:32]
available for road repair and
maintenance has been diminished greatly.
[1:09:35]
So our state government put in place
various Senate bills to get money to
[1:09:41]
municipalities and counties called SB1
for those projects. So this money is
[1:09:47]
state money that we get every year, a
small portion of which um and it goes
[1:09:53]
largely towards things like um street
markings, stop sign markings last year
[1:09:58]
and crosswalk markings this year. So
that's one project and we just need to
[1:10:03]
approve the engineering costs really so
we can go forward the bidding for that.
[1:10:09]
The second part B is California Assembly
Bill 413 and it was a traffic calming
[1:10:15]
measure that came up. It prohibits
drivers from parking within 20 ft of
[1:10:19]
approach on the approaching side of any
marked or unmarked crosswalk, mitigating
[1:10:24]
blind spots near intersections and
improving visibility between pedestrian,
[1:10:29]
cyclists and drivers. This took effect
in January of 2025. It is a state law.
[1:10:35]
It is already in place. It is
implemented. The issue is that curbs are
[1:10:39]
not necessarily painted. No parking for
that 20 ft or if it's inappropriate to
[1:10:45]
paint the curbing, just sign no parking
between signs.
[1:10:49]
This is um those signs do not have to be
there. The red curb doesn't have to be
[1:10:54]
there, but the law still exists that
there's no parking 20 ft from a
[1:10:58]
crosswalk. So, it's a question of do we
want to do that? We have cost estimates
[1:11:06]
for painting. We don't for signage, but
that's a small chart cost. And the two
[1:11:11]
spots would be the west side of Main
Street adjacent to the crosswalk at Ion
[1:11:16]
Valley Road. So that would be in front
of what was the Merkante, what is now
[1:11:20]
the the the golf um establishment, just
20 ft from that crosswalk.
[1:11:27]
And that would need to be painted or no
parking signs there. the other spot and
[1:11:33]
I put down the north side of Water
Street adjacent to the crosswalk at Main
[1:11:37]
Street, it could equally be the south
side because coming around that that
[1:11:43]
corner from a southern approach on Main
Street,
[1:11:47]
if someone parks very close to that
crosswalk, there's very poor visibility
[1:11:53]
and the cars, it's a blind turn. and the
cars parked within that 20 ft um are in
[1:11:58]
danger of it are often in danger of
getting clipped or rear ended. It's a
[1:12:02]
narrow street and a blind turn. It could
be one side or the other we talk about.
[1:12:08]
I want to go back to SB1 first.
Um now we've reviewed those. I'm going
[1:12:14]
to zip on to the engineering estimates
[snorts]
[1:12:19]

continental crosswalk, zebra crossing or
the lading. There is more visibility
[1:13:12]
with the lading
there, but there is higher cost of the
[1:13:16]
lading. So, um there's the two cost
estimates. These include painting the
[1:13:23]
red curb
and all the intersections me mentioned
[1:13:27]
that needed it. Um and painting the
crosswalks mentioned that need it. Um
[1:13:33]
so, we first go to council for questions
on these items or questions on the
[1:13:39]
projects.
Do we have the money?

» Well, the SB money is all we get that
from the state. We have that money.

and I know we didn't review the budget,
but yes, our street money is pretty

healthy.

funds that can only be spent on street

monies that are given to us, specific

line items, and that money can only be
spent on road repair and maintenance or

crosswalk is I think the better it is

another business owner expressed as well
was a um it's hard enough to have a
[1:17:08]
business in this town and taking away
more parking is really unfriendly to
[1:17:12]
business. Um the second biggest issue is
that there is no enforcement anyway. So
[1:17:18]
you could put a the law is the law with
with or without signs. And so
[1:17:25]
people are going to do what they're
going to do and there's nobody to tell
[1:17:28]
them not to do it.

so, you know, do I want every the entire
curb in front of my business to be no
[1:17:37]
parking?

that people have had about the

enforcement,

the only one who can really designate a
fire lane and who can design make things

declined to do so. And so with that, the

city council had nowhere to go on the
concern of that one fire hydrant.

Uh it's remains my impression that we

probably can do um 40 to 70 uh given the
right talk and the right presenter. Also

there's a large interest in field trips.
Uh notably to learn more about the local

mining history of Amador city and
community around it. Uh that being said,
[1:36:33]
again, thank you on on the society's
behalf for the use of this space and

maybe uh the renovated school will be
available down the road which would

offer more square footage and uh let
them resume uh these meetings there.

two weeks. And the other tenants um are
um asking for a July 1st move in date
[1:37:37]
and lease beginning because they have to
give 30 days notice. And um that's it's
[1:37:43]
very reasonable, but they are very
qualified. It's a couple, so they'll be
[1:37:48]
they are in apartment A and a gentleman
in apartment B. And uh so we have
[1:37:55]
revenue to look forward to in the next
year because we'll once again have
[1:37:59]
tenants up there and we will be working
on the rest of the building going
[1:38:03]
forward.
