[0:10] He's sitting back. He's sitting back on
[0:12] his couch. He's going, "Gotcha."
[0:15] [laughter]
[0:25] » Oh, you're
[0:35] Is she here to read a proclamation?
[0:38] >> She shows up.
[0:42] » Call her if she
[0:45] is there. I mean, it's highly possible.
[0:49] >> No, I guess that's good. So, you just
[0:51] need the
[0:57] » We've already passed the resolution. We
[1:01] just need
[1:17] » Okay. Okay.
[1:28] Hello everyone and welcome to the
[1:31] September
[1:34] 2026 Anderson County Board of
[1:36] Commissioners meeting. Um like to say
[1:40] welcome to all the newer commissioners
[1:42] and also welcome to all the reelected
[1:44] commissioners. Uh we've got a lot to do
[1:47] this year and three years after that. So
[1:51] happy to serve with you all.
[1:54] I'm going to call the public hearing to
[1:56] order where we are will discuss
[1:59] resolution number 26091276
[2:04] to amend zoning resolution of Anderson
[2:07] County, Tennessee by reszoning partial
[2:10] 081.00
[2:12] 00 Anderson County Tax Map 032
[2:17] from I2 heavy industrial district to R1
[2:22] suburban residential district. Do we
[2:26] have anyone here to speak on that?
[2:37] Do you want to speak on it?
[2:38] >> I don't care.
[2:39] >> Okay.
[2:40] >> Uh we took this up in planning
[2:41] commission. And this is just reszoning a
[2:43] uh industrial to residential. Um on it's
[2:46] the property on the other side of
[2:48] mountain where the David Jones
[2:50] Industrial Park is. It's on the other
[2:51] side of North Freeway. Most of the stuff
[2:53] behind it's all residential. So um
[2:55] they're asking it be moved to
[2:56] residential. We've had a lot of new
[2:58] houses go in there. There was an old
[2:59] farm that has big lots and so it's just
[3:01] one house being built on that um
[3:03] currently. So that's and you haven't had
[3:06] any issue. We had nobody here at
[3:07] planning commission that was against it.
[3:09] So and we approved it unanimously.
[3:15] I guess I would just ask uh two
[3:17] commissioners from that district. Do you
[3:19] have any issues with this?
[3:23] » Okay. No, I don't have any issues with
[3:26] it at all. I've not received any comment
[3:28] from the community uh for or against
[3:32] this reszoning.
[3:34] >> Same with me. No comments from the
[3:36] community and I don't have any issues.
[3:41] Okay, with that then I will close the
[3:44] public hearing. Uh we'll move on to a
[3:48] proclamation
[3:49] recognizing the contribution of
[3:52] Community Mediation Services, Inc. to
[3:55] the residents of Anderson County. This
[3:57] was requested by Greta Owen.
[4:11] before.
[4:12] >> That's okay.
[4:14] It's a proclamation recognizing the
[4:15] contribution of Community Mediation
[4:17] Services, Inc. to the residents of
[4:19] Anderson County. Whereas Community
[4:21] Mediation Services, Inc. is a nonprofit
[4:23] organization serving Anderson County and
[4:26] is celebrating their 40th anniversary
[4:28] this year. Whereas Community Mediation
[4:31] Services, Inc. has served more than
[4:34] 17,000 people during their 40 years of
[4:36] operation. And whereas Community

[4:41] different mediation programs for
[4:42] residents of Anderson County. Victim

[4:49] visitation mediation program. All of
[4:52] which are conducted by highly trained
[4:53] volunteers and are provided at no or
[4:57] minimal cost.
[4:59] And whereas the services conducted by
[5:01] Community Mediation Services, Inc.
[5:03] promote peaceful dispute resolution,
[5:05] creative conflict engagement by actively
[5:08] facilitating productive and constructive
[5:11] and effective dialogue through the
[5:12] intervention of trained neutral third
[5:14] party.
[5:16] And whereas through modeling the
[5:18] mediation process teaches participate
[5:21] participants skills in conflict conflict
[5:24] articulation, negotiation and settlement
[5:28] and authentic participation using words
[5:30] rather than force or violence. And
[5:32] whereas promoting the broader use of
[5:34] mediation will help create more
[5:36] cooperative and connected community and
[5:39] will assist in resolving conflict that
[5:41] diminishes the quality of life of its
[5:44] citizens. And now therefore, the
[5:46] Anderson County Board Commissioner does
[5:48] here commissioners does hereby pro
[5:50] proclaim October 2026 as Community

[6:04] And um so Mayor Frank and and members of
[6:09] the county commission, I my name is Amy
[6:12] Hoer. I am the program coordinator for

[6:19] meaningful recognition of uh the 40-year
[6:22] anniversary of CMS. We were the first
[6:25] mediation center in the state in 1986.
[6:29] So for 40 years uh so 40 years of
[6:31] service is an extraordinary
[6:33] uh milestone and we're deeply grateful
[6:36] to have the opportunity to celebrate
[6:37] this with the community. This
[6:39] recognition belongs not just to the
[6:41] organization but to the many volunteers,
[6:43] staff members, board members, and
[6:45] community partners who have contributed
[6:47] to this work over the past four decades.
[6:51] At its heart, mediation is about giving
[6:54] people an opportunity to be heard, to
[6:56] understand one another, and to find
[6:58] constructive ways to move forward. For
[7:01] 40 years, Community Mediation Services
[7:03] has been privileged to provide no cost
[7:06] mediations to help individuals, teens,
[7:09] and families resolve conflict and
[7:11] strengthen relationships.
[7:13] With more than 6,000 referrals to our
[7:15] program, we have worked with separating
[7:17] parents to create parenting plans.
[7:19] Through our access and visitation
[7:20] program, we have established almost
[7:23] $100,000 in restitution for victims in
[7:26] the victim offender reconciliation
[7:28] program.
[7:30] And we also have the teen and parent
[7:32] program who help troubled teens
[7:34] communicate with their parents.
[7:37] Um we are especially grateful to the
[7:40] county commission for recognizing the
[7:41] value of this work and for honoring the
[7:43] role that community- based mediations
[7:46] play in building a stronger and more

[30:41] glory that we fail you each and every
[30:43] day. We ask Lord that you be with us
[30:45] tonight. We ask Father that you guide us
[30:48] in the decisions that you would have us

[31:26] anything any item that is on or off the
[31:28] agenda. And I'd like to call on Miss
[31:31] Louise Macau
[31:34] first want to speak to the commission.
[31:48] I only have three minutes. Um I have
[31:54] written out
[31:56] my speech for you. Um and um
[32:02] the last two prayer requests are um
[32:06] really important. But um other than that
[32:11] um I I am Louis and I live at 34.
[32:23] I am the chair of the industa
[32:39] coordinator who is the best coordinator
[32:43] we ever had.
[32:45] Don't let him go. Um, I have been on it
[32:50] for almost
[32:53] three decades because Commissioner
[32:57] Jerry
[32:59] um asked me to be on it and
[33:04] made the comm the chair and um then four
[33:10] or five years later
[33:14] has made the B of the chair.
[33:17] Um
[33:19] mostly we surveyed
[33:24] and dealt with low and medium plus
[33:30] and I'm so nervous
[33:33] why this is important.
[33:36] One in three Tennesseeians have a
[33:39] disability
[33:41] and I'm one of them. Um,
[33:46] one day, um, a decade ago, the um,
[33:51] someone from the US highway
[33:55] administration
[33:57] knocked
[33:59] door
[34:04] [laughter] and she put me up, do I have
[34:09] do we have a plan? Um they
[34:14] lifted our courthouse parking lot. Um if
[34:19] we had co and toed drops over them and
[34:27] painted sidewalks and pestic
[34:35] entrance
[34:38] and they said if you don't face this
[34:43] at a certain time we may eventually like
[34:48] pull your highway buttons and that is
[34:53] really
[34:54] not
[34:58] really.
[35:01] Um, we have someone to do a survey for
[35:05] our county owned business for the
[35:09] library that the county funds and 28
[35:15] pulling locations.
[35:18] We are not the only county
[35:21] or city where this had been done. Um
[35:28] [clears throat] the USA
[35:32] highway administration is doing it in
[35:36] all counties and middle size cities in
[35:42] this nation.
[35:44] [sighs]
[35:45] We
[35:46] um
[35:49] we have to send um what we done and it's
[35:55] close every 3 years to the state
[36:00] department of transportation
[36:03] when May is a grant for the state of
[36:10] Tennessee for health health for the
[36:15] health department.
[36:19] So, um you can read or
[36:24] thank him. Thank you.
[36:40] Louise. Anybody else would
[36:42] like to address the commission?
[36:45] Yes, sir.
[36:48] State your name and address, please.
[36:52] My name is Christian Breeden. I reside
[36:54] at 5020 Laurel Woods Drive in Knoxville,
[36:57] Tennessee. I am the co-founder and
[37:00] president of a nonprofit voter education
[37:02] called Volunteer Patriots. We have for
[37:04] sort of been at the forefront of the uh
[37:07] flock and ALPR issue in Knox County. and
[37:10] we also spoke at the uh town hall a
[37:13] couple of weeks ago. I have a few other
[37:15] additional points that I didn't get to at the town hall that I'd like to
[37:19] get to today. In particular, a couple of
[37:22] things that the Flock representative
[37:23] stated about their cameras capabilities.
[37:25] The Flock representative stated that the
[37:27] cameras do not have facial recognition
[37:29] technology and they are not used to
[37:32] detect analyze humans. This is false.
[37:36] They do. US patent 10795933b1
[37:41] specifically states that these cameras
[37:43] are used and are supposed to detect
[37:45] vehicles and humans to detect and
[37:48] analyze them. Meaning that the AI that
[37:50] is powering these cameras are detecting
[37:53] you. They are cataloging you and they
[37:55] are taking account of everything you are
[37:56] doing and everything you are wearing. On
[37:59] top of that, they also stated that the
[38:03] cameras
[38:05] uh if you'll excuse
[38:07] this uh little confused, my sugar's a
[38:10] little high, so bear with me. Um the
[38:13] cameras do not have the capability of
[38:15] tracking specific bumper stickers that
[38:17] they simply track that a car has bumper
[38:20] stickers. Now, take this with a grain of
[38:22] salt, but there was a group recently who
[38:24] illegally obtained data from a camera
[38:27] that they took down from their local
[38:29] jurisdiction and discovered that not
[38:31] only can they detect the bumper
[38:33] stickers, they can detect what type of
[38:35] bumper sticker? The one example they
[38:37] gave was the American flag. If these
[38:40] cameras can detect the American flag as
[38:42] part of a bumper sticker, they are able
[38:44] to detect other factors on bumper
[38:46] stickers. Meaning that if you have a
[38:48] particular candidate's information on a
[38:50] sticker, if you have a particular party,
[38:52] a or a particular political stance, it
[38:55] can track that. More to the point, I
[38:58] would like to read very quickly from our
[39:00] state constitution, the Tennessee State
[39:02] Constitution, Article 1, Section 7. It
[39:06] is like the Fourth Amendment, but with a
[39:07] very clear distinction. that the people
[39:09] shall be secure in their persons,
[39:11] houses, papers, and possessions from
[39:13] unreasonable searches and seizures. And
[39:15] that general warrants whereby an officer
[39:18] may be commanded to search suspected
[39:20] license or suspected places without
[39:22] evidence of the fact uh committed or to
[39:25] seize any person or persons not named
[39:27] whose off who offenses are not
[39:28] particularly described and supported by
[39:30] evidence. We could go into the history
[39:32] of the Fourth Amendment and the court
[39:33] case that spawned the Fourth Amendment,
[39:36] but in my opinion, and the law director
[39:38] may be able to speak to this, this means
[39:40] that if there is not a specific warrant
[39:42] being used with these cameras, these
[39:44] cameras are in fact being operated
[39:46] illegally by essentially being general
[39:48] warrants on the public for surveillance.
[39:50] Thank you for your time. May God bless
[39:52] each of you.
[39:58] » Anybody else? Yes, sir.
[40:05] Hello, I'm James [clears throat] Arthur.
[40:08] I live on 100 Delmare in Oakidge. I also
[40:11] wanted to speak about the flock cameras.
[40:13] I watched the video of the uh operating
[40:16] commit committee's meeting at Clinton
[40:19] High School and it was I watched it
[40:21] several times and
[40:24] uh I heard the sheriff say that we have
[40:27] no expectation of privacy on a public
[40:29] road
[40:32] and in a in an sense way. Of course we
[40:36] expect people can see us and we might go
[40:38] by a sheriff and that's fine. We want
[40:40] the sheriffs to be out on the road. What
[40:42] we never expected though would be that
[40:44] they had some electronic apparatus and
[40:46] were cataloging every single transaction
[40:49] everywhere we went several times a day.
[40:52] We never had an expectation of that.
[40:55] We expected that we would say hi to the
[40:58] sheriff and then if we were doing
[41:00] something wrong, he might write us down
[41:02] or chase us, right?
[41:04] And once this information is collected,
[41:06] uh it never goes away. bad people can do
[41:09] bad things with it in the future or it
[41:12] can be hacked. It can wind up in China.
[41:15] So [clears throat] I really feel like
[41:16] the they are a violation of the fourth
[41:19] amendment because we are collecting data
[41:22] on people to search uh that have done
[41:26] nothing wrong and aren't suspected of
[41:28] any crime without a warrant.
[41:31] And I just feel that that's
[41:34] people don't like being watched and they
[41:37] don't like being spied upon.
[41:40] Try looking at your dog. Just stare at your dog. Your dog won't
[41:45] like it. Well, we don't like it either.
[41:48] So uh I wanted to with some apologies
[41:52] say uh two roads diverged in a yellow
[41:56] wood and sorry I could not travel both
[41:59] and be one traveler long I stood and
[42:03] looked down one to where it bent in the
[42:05] undergrowth
[42:08] and then I saw there were these flock
[42:09] cameras and I took the other road.
[42:11] [laughter]
[42:12] Thank you.
[42:15] Anybody else?
[42:19] Yes, sir.
[42:30] My name is Nathan Mullins. I'm from
[42:31] Oakidge.
[42:33] This year, there will be 5,000 requests
[42:37] expected nationally for ICE searches
[42:41] using APLR devices. according to the
[42:45] immigration policy tracking project.
[42:48] That itself adds to the debate over the
[42:51] purpose of this mandated mass
[42:53] surveillance being pushed by government
[42:56] DHS.
[42:58] For example, they sent me a letter when
[43:01] I was cited for rolling through a stop
[43:03] sign stating that they could double the
[43:05] points put on my license if I was
[43:09] suspected of doing it again.
[43:12] There's the problem.
[43:14] DHS incentivizes making it legal to
[43:17] gather suspected evidence with new tech,
[43:22] all the while profiteering by using
[43:24] taxpayer funds.
[43:27] Are you innocent until proven guilty?
[43:30] Your fourth amendment protections from
[43:32] profiling are Pay
[43:35] with the new directives from DHS and
[43:37] Palanteer.
[43:39] Ultimately, flock systems are selling
[43:42] the whereabouts of any particular
[43:44] individual to the government, good, bad,
[43:47] or indifferent.
[43:49] The database, like cell phone data, is
[43:53] what's for sale. The Supreme Court
[43:55] recently protected phone tracking, but
[43:58] they are less likely to consider what
[44:01] APLR systems are collecting because the
[44:04] feds are going to prejudice the argument
[44:06] based on increased pressure from the
[44:09] next generation of the Patriot Act,
[44:11] which is Palunteers tracking
[44:13] technologies from which there are
[44:16] inadequate constitutional protections.
[44:20] Finally, there is plenty of evidence
[44:23] that all this warrantless access is
[44:26] stemming from excessive government
[44:28] overreach.
[44:30] This year's 200,000 goal of Palunteer's
[44:34] new camera platform is not an accident.
[44:38] I'm proud that we're heard at recent
[44:41] public forums by a real mayor that
[44:44] represents our conservative voter base.
[44:47] Can our established political classes
[44:50] move forward and share the unonyimity
[44:53] the public has shown?
[44:56] Also taking a stand on what the majority
[44:58] of citizens of this county want. Thank
[45:02] you.
[45:05] » Thank you. Anybody else? Yes, sir.
[45:12] » State your name and address, please.
[45:15] Chairman McKenna, I'm uh Tommy Mariner.
[45:18] I live at 11 Hawthorne Place in Norris,
[45:20] Tennessee. Uh Mayor Frank,
[45:23] commissioners, uh I was at a library
[45:26] board meeting on uh last month and one
[45:30] of the gentlemen stood up and talked
[45:32] about the various things that have been
[45:33] done in the library board for the past
[45:35] year under the current leadership.
[45:38] and he asked uh as a library employee uh
[45:43] what could be done, what were the
[45:46] accountability for the hostility that
[45:49] was being uh shown toward the library
[45:52] directors and the violations of state
[45:55] law that were taking place. And uh
[45:58] nobody answered it, but I do have an
[46:00] answer. this body can hold accountable
[46:04] the leadership of the Anderson County
[46:07] Library Board and you do it by replacing
[46:10] the person that represents the board on
[46:13] the library. Uh I listened to him say at
[46:16] our your last meeting that when he was
[46:18] put on the board, he told people he was
[46:20] going to change things and he has. He's
[46:23] taken our board from one of the most
[46:24] efficient and respected in the state to
[46:28] the least efficient. uh we don't answer
[46:30] our mail on time and uh we're being
[46:34] sued.
[46:36] Uh he also wants to substitute his
[46:40] personal prejudices
[46:42] uh toward that of our library directors
[46:45] who are trained in the art of trying to
[46:49] open up libraries and maintain a curated
[46:52] uh collection uh that has some reading
[46:56] materials for everybody.
[46:59] uh y'all are the people that put him on
[47:01] there. There's a new group of uh people
[47:03] that are here and I'd like you to
[47:05] consider changing the person that's on
[47:07] the library uh board from this
[47:10] commission to somebody that does care
[47:13] about the library and understands that
[47:17] the library is for everybody's opinions,
[47:20] everybody's reading and there is a right
[47:22] for people to read uh not just those
[47:25] people who have a certain viewpoint.
[47:28] Uh, I'm going to go to uh Bible study.
[47:31] Uh, I won't be around. You guys are not
[47:33] going to take any action tonight, but if
[47:35] anybody has any questions for me, I'll
[47:36] be glad to answer them now or anytime.
[47:39] I've been on the library board uh this
[47:42] is my last year, and I'd like to see us
[47:44] go back to the old standard of
[47:47] >> uh following uh state law and the uh
[47:51] right to read. Thank you.
[47:53] >> Thank you. [applause]
[47:56] Anybody
[47:59] else?
[48:03] If not, we'll close this portion and
[48:05] move on. Uh, next is the approval and
[48:08] correction of the agendas. First off is
[48:11] the consent agenda.
[48:13] >> Yeah, I got I'll do a motion to approve,
[48:15] but there is a correction on the
[48:17] notaries. There was a double list of
[48:19] name. It was just typo. So,
[48:22] you remember the names?
[48:24] >> Sorry. But they've got it correct.
[48:27] They've got it corrected. But there is
[48:29] twi two names on there listed twice. We
[48:31] only need them listed once. If you'll
[48:33] give me a second, I pull the name up.
[48:35] >> On number 11, I have a correction.
[48:41] I'm the cap that was
[48:48] the name Stan Russell hatmaker. It's
[48:50] listed twice. So just correct that on
[48:52] the consent agenda on the notaries.
[48:56] She's talking about on the regular
[48:57] agenda, right?
[49:01] » On the consent agenda. Which one?
[49:05] >> Oh, on the minutes.
[49:06] >> Okay.
[49:08] >> So, your motion is to approve with that
[49:10] one change.
[49:11] >> And
[49:12] she got changed in the minutes. Is that
[49:14] correct?
[49:15] >> Did what?
[49:16] >> Yes.
[49:17] >> Okay.
[49:19] Second by Commissioner Cap.
[49:22] Any discussion?
[49:25] If not, I'll fail the motion. Leave it.
[49:27] But no saying. Oh, go ahead.
[49:28] >> Um, is this just to approve the consent
[49:30] or the regular
[49:31] >> consent? Consent. Thank you.
[49:37] » Okay. I have a motion, second. Any
[49:39] discussion? If not, all in favor of the
[49:41] motion, leave a number saying I.
[49:43] >> Any opposed? Motion carried. Next is on
[49:46] the regular agenda
[49:49] and I've got three additions or two
[49:51] additions. U
[49:55] one is a letter from the
[49:58] county law director uh reference to
[50:01] flock camera.
[50:03] Uh that I think should go maybe to
[50:06] operations and put it under operations
[50:10] >> budget
[50:12] for discussion.
[50:14] >> Yeah. monetary thing. I guess you could
[50:16] put it either.
[50:17] >> I think it needs to be brought up under
[50:19] operations and it could be referred to
[50:21] wherever if there's any action to be
[50:23] taken by but we'll put it under
[50:25] operations to begin with.
[50:27] >> But u law director's report.
[50:30] >> Yeah, we could do that.
[50:32] >> Let everybody get that.
[50:34] >> I'll make a motion to approve the
[50:36] agenda.
[50:37] >> Uh one more. The mayor's asked that we
[50:40] put the uh flood control map. It's some
[50:43] wording. This is a This is one that we
[50:46] approved several months back, the flood map, but
[50:52] they wanted in
[50:54] some language change here on the
[50:57] numbers. Instead of just an exhibit, we
[50:59] have to list all those. So,
[51:03] you have a problem with that motion?
[51:06] >> Okay.
[51:10] Is this the same motion?
[51:12] >> This is a new one.
[51:14] >> Okay. Uh, Commissioner Wales. Um,
[51:18] >> yes. I'd like to ask that we consider
[51:20] adding to the agenda the consideration
[51:22] of adding Phil Joerger to the ATL large
[51:24] seat on the finance committee. I think
[51:25] you all got the email from Amy last
[51:26] week. Um, former Commissioner Joerger
[51:29] actually sent the email request over a
[51:31] month ago um to the office. It got lost
[51:33] in translation. So, he reiterated this
[51:35] week to me. Um, so if we could I'd like
[51:37] to make a motion that we consider adding
[51:39] that to the regular agenda as well.
[51:41] >> Okay.
[51:41] >> Go to that.
[51:44] >> And it was actually from the first we
[51:46] ref we referred that to this meeting
[51:48] today. It just didn't get put on the
[51:50] agenda.
[51:52] >> Commissioner Palmer.
[51:54] >> Sorry. I made a motion that we add that.
[51:56] Does that need to be taken up at this
[51:58] point or
[51:58] >> we just add it to the agenda?
[52:01] >> I mean, he's got a motion and a second
[52:02] to approve the agenda. So, we'd have to
[52:05] just add these. Commissioner Palmer.
[52:08] >> Yes, sir. Thank you, Mr. Chair. Um, I
[52:11] think under um the operations I'll ask
[52:14] the operations chair. I think there's a
[52:16] couple of motions that were not picked
[52:18] up on the agenda. Um motion to approve
[52:21] the uh TNCP
[52:24] >> that that's on there. I wrote in there.
[52:26] >> Okay. And then the
[52:27] >> passport for the full commission.
[52:28] >> Okay. And then the motion to approve the
[52:31] strategic planning workshop. I put it on
[52:33] there as well. Motion passed forward
[52:35] commission.
[52:35] >> So you you've added it. It's not on our
[52:38] agenda.
[52:38] >> Well, it just says well how it was
[52:40] stated.
[52:41] >> I guess this is where we've changed
[52:43] secretaries or so. But usually when it's
[52:46] approved and it's an action item, it
[52:48] will say passed forward to full
[52:49] commission for approval.
[52:51] >> Okay.
[52:51] >> So she just put that it was passed
[52:53] unanimously. So I put on there that
[52:56] motion [snorts] passed forward to full
[52:57] commission for Okay. So, I was going to
[52:59] read that that way in the report.
[53:02] >> It's just a matter, you know, some new
[53:04] people.
[53:04] >> I just wanted to make sure that the
[53:06] strategic planning workshop was um
[53:09] >> Yes.
[53:10] >> included [snorts] was pushed to this
[53:11] body. Thank you.
[53:13] >> Good. And the other one is the Clarkson
[53:17] school. Amy sent that out, but it's not
[53:19] on the agenda. So, that needs to be
[53:20] taken up under appointments to
[53:23] >> the task force. Commission Mr. Wando.
[53:26] >> Uh,
[53:27] >> do we need to add Mayor had a request
[53:30] for us to add that letter or is that
[53:32] already covered under the U motion to
[53:35] have the law director look at it or
[53:37] >> mayor
[53:38] >> lost Sham?
[53:39] >> Yeah.
[53:39] >> Yes. Okay.
[53:40] >> That's the same thing, right?
[53:42] >> Okay.
[53:42] >> That's what I was thinking. And then I I
[53:44] thought and I'm open to the idea, but I
[53:47] thought we have a nominating committee
[53:49] was moved to the operations committee.
[53:51] And I don't understand why we would be
[53:53] taking up um people from the floor
[53:56] without it going to [snorts] the
[53:57] operations committee. So the finance
[53:59] committee, in my opinion, that motion
[54:01] should go to the operations committee to
[54:03] be taken up because that has been moved
[54:06] to the uh nominating committee since we
[54:09] did away with it several years ago. And
[54:11] uh so if I'm gonna have to vote on it
[54:13] tonight, I'm gonna vote against it
[54:14] because [clears throat]
[54:15] I don't think we're giving the
[54:16] opportunity to anybody uh to participate
[54:20] in that. And I think we need to give
[54:22] fair uh opportunity to all to to fill
[54:25] that position.
[54:30] » Uh we dissolve the nomination committee.
[54:33] We didn't put in operation. It just come
[54:35] all nominations come to full commission.
[54:37] So we can defer it, but all nominations
[54:40] are handled by a full commission. That's
[54:41] we was and it got referred to us on the
[54:45] September 1st meeting. We didn't take up
[54:47] the finance committee because we did
[54:48] have a citizen that applied. So we
[54:50] referred it to this meeting to take up
[54:52] the finance committee.
[54:53] >> So all nominations come to full
[54:55] commission to be acted upon.
[54:57] >> Yep.
[54:57] >> Wow. I didn't know that.
[55:01] » Mr. Caps.
[55:03] >> Okay. I'm on the right agenda. Um, on
[55:05] the regular agenda on page 11, I just
[55:07] wanted to correct that I'm I'm the capaw
[55:10] that withdrew the request from rules
[55:12] committee
[55:18] as sapshaw. Just a correction.
[55:41] That's it.
[55:56] make that part of your motion.
[55:58] >> Yeah, I'm good with that. I'm good with
[55:59] all the changes that have been added.
[56:05] » Okay. Is there any further discussion?
[56:10] If not, all in favor of approval of this
[56:12] agenda as amended by saying I.
[56:16] >> I.
[56:16] >> Any opposed? Motion carried. Next, we'll
[56:20] have the public hearing report of Vice
[56:22] Chairman Mander.
[56:25] >> Thank you, Chairman. Earlier this
[56:28] evening, we did have a uh public hearing
[56:31] to discuss the reszoning
[56:36] uh or the sorry, a resolution to amend
[56:39] the zoning regulations of Anderson
[56:41] County, Tennessee by reszoning partial
[56:44] 081.00 00 Anderson County Tax Map 032
[56:50] from I2 Heavy Industrial District to R1
[56:54] Suburban Residential District.
[57:00] We'll need a motion to approve. Okay,
[57:06] second.
[57:08] >> Okay, we have a motion and a second to
[57:10] approve reszoning. Any discussion?
[57:15] If not, I'll favor the motion by saying
[57:17] I. I.
[57:18] >> Any opposed? Motion carried.
[57:21] >> Next [clears throat] item is a letter of
[57:22] notice. Uh this was sent out by
[57:26] our county clerk about the vacancy that
[57:30] we as a county commission need to accept
[57:34] vacancy
[57:36] that exists on this county commission.
[57:41] So you need a motion to accept.
[57:42] >> Yes.
[57:46] » Have a motion to accept the resignation
[57:49] or the vacancy and seconded by
[57:53] Commissioner Pack. Any discussion?
[58:02] Commissioner Palmer.
[58:03] >> Thank you, Mr. Chair. I just have a
[58:05] couple questions. Um, so do we have a
[58:09] vacancy at this moment or will we only
[58:12] have a vacancy when we approve this?
[58:16] >> We had a vacancy in my opinion. I'll let
[58:19] the law director give his opinion.
[58:22] You know, opinions are kind of like
[58:24] belly buttons. Everybody's got one. So,
[58:25] I'll let the mayor I mean the law
[58:28] director go ahead and give his opinion.
[58:30] >> Commissioner, you had a vacancy as of
[58:33] 12:01 a.m. September 1. that vacancy uh
[58:38] has not been filled.
[58:39] >> Okay.
[58:40] >> And remains open.
[58:42] >> So this vote tonight is for
[58:45] >> it's I think it's something that the
[58:47] commission I think the statute says
[58:49] shell it's uh basically confirming the
[58:53] vacancy should commission wish to move
[58:57] ahead with an appointment.
[58:59] uh it had there has to be a declaration
[59:01] of the vacancy but the notice of vacancy
[59:04] would have gone out by uh Jeff Cole on
[59:07] the first.
[59:09] >> Okay. So if if this com this body wants
[59:13] to move ahead with an appointment I
[59:17] thought there was an election
[59:18] >> there is
[59:19] >> November 8th
[59:20] >> there is you would be you have the right
[59:23] to appoint it's going to be for a very
[59:25] limited time.
[59:27] >> Okay. Um, is this letter that we
[59:30] received is it a form letter?
[59:32] >> No, it's one it's not a form letter in
[59:35] the fact that uh I prepared it. You will
[59:39] see there are blanks in the letter
[59:41] because I didn't know who the
[59:42] commissioner was at the time I drafted
[59:44] it.
[59:44] >> Okay.
[59:45] >> Um,
[59:46] >> did Mrs. Henry request that form letter?
[59:51] >> It was requested. I did not speak
[59:53] directly with her until after the letter
[59:56] was signed. believe it was a chairman of
[59:58] the Democratic Party that contacted me.
[1:00:00] >> Oh, interesting. Who would that be?
[1:00:03] >> Oh gosh.
[1:00:04] >> Chase Lindsay.
[1:00:06] >> Okay.
[1:00:07] >> All right. Um,
[1:00:11] so I was just a little confused about
[1:00:13] the vacancy and the election. So, who
[1:00:16] made the decision
[1:00:18] to put this on the ballot for November
[1:00:20] the 8th?
[1:00:21] >> That would have been your election
[1:00:22] commission.
[1:00:23] >> The election commissioner did. Okay. and
[1:00:25] he I'm sure he has TCA to back up his
[1:00:29] decision.
[1:00:30] >> I mean, they have a copy of that letter.
[1:00:33] Um, he's been he talked to me early on,
[1:00:36] but he's been in communication with
[1:00:37] attorneys for the election commission in
[1:00:40] Nashville, as I understand it.
[1:00:42] >> Okay. It's just a little confusing that
[1:00:44] we we are now kind of seems like we've
[1:00:47] got the cart before the horse here and
[1:00:51] it's feeling like a rubber stamp for
[1:00:53] tonight. So, I just wanted to kind of
[1:00:55] clear that [clears throat] up a little
[1:00:56] bit. I've had several questions.
[1:00:58] >> I I mean, whatever questions you have,
[1:01:00] Commissioner, I'll I'll do my best.
[1:01:02] >> Well, I mean, I've had several questions
[1:01:03] that I could not answer. That's why I'm
[1:01:05] asking some of these.
[1:01:07] >> Um, also, I was curious as to this
[1:01:09] letter was dated August 31st. Correct.
[1:01:12] >> I was wondering why it took two weeks to
[1:01:14] notify commission of her intent to not
[1:01:18] take the position.
[1:01:20] >> That is a question you would have to ask
[1:01:21] Miss Henry. I do not know the answer.
[1:01:23] >> Oh, okay. So, um I think it was the
[1:01:27] Anderson County clerk that sent out the
[1:01:28] letter to us. That's correct. It took
[1:01:30] two weeks to
[1:01:33] >> to uh inform commission. I know we heard
[1:01:37] through the grapevine and all of that,
[1:01:38] but
[1:01:39] >> just the process and procedures. I'm
[1:01:41] just trying to
[1:01:42] >> right the um when the letter was
[1:01:46] returned
[1:01:49] >> time.
[1:01:50] >> There's no time on questions. This is
[1:01:52] only for um it's my understanding.
[1:01:59] » Commissioner, when the letter arrived
[1:02:01] back at my office, it came from Ms.
[1:02:04] Henry
[1:02:05] >> from her email address.
[1:02:08] A copy was forwarded to
[1:02:11] you as chairman of the commission.
[1:02:14] >> A copy was sent to Jeff Cole and a copy
[1:02:17] was sent to Mark Stevens. Now, the
[1:02:20] letter came back addressed to uh the
[1:02:23] five election commissioners. That was a
[1:02:25] change that was made to the letter from
[1:02:27] what I sent out.
[1:02:28] >> Okay.
[1:02:30] All right. Thank you for clearing that
[1:02:31] up.
[1:02:35] » I just have one question. So, if Miss
[1:02:38] Henry walks in right now and says, "I
[1:02:40] want to take my seat and get sworn in."
[1:02:41] Could she do it?
[1:02:42] >> She could do it
[1:02:43] >> until we vote on this
[1:02:44] >> until you until you accept. I don't know
[1:02:47] if you call it a resignation. She didn't
[1:02:49] what's she resigning from? She never
[1:02:50] qualified to take the office. So, it's a
[1:02:53] refusal to serve or declination to
[1:02:56] serve.
[1:02:58] And you can call it a you can call it a
[1:03:01] resignation if you'd like, but I think
[1:03:04] it's important that commission take some
[1:03:06] action to shift the burden from
[1:03:08] commission to Miss Henry should she
[1:03:10] change her mind.
[1:03:17] most unusual circumstance,
[1:03:21] >> but it's not it's not unprecedented.
[1:03:23] >> Uh there what was very helpful to me was
[1:03:26] a 1984 Supreme Court decision.
[1:03:29] >> Okay,
[1:03:31] Mr. Chairman, I will yield my time to
[1:03:33] Commissioner Palmer for any questions
[1:03:34] she has further.
[1:03:36] >> Um I I'm okay with the No,
[1:03:38] >> you Mr. Chairman, there's no yielding of
[1:03:40] time.
[1:03:41] >> This isn't Congress.
[1:03:44] We got three minutes. We got three
[1:03:45] minutes. It's the chairman's discretion
[1:03:47] to allow commissioners to talk. So, Mr.
[1:03:50] Chairman, this this this item is Mr.
[1:03:52] Chairman,
[1:03:53] >> this item is not on the agenda. We need to get down to business. If we
[1:03:57] want to have a discussion about uh the
[1:04:00] chairmanship, we need to call a
[1:04:01] different meeting for that. That that ship has sailed and we need to move
[1:04:05] on and get down to business.
[1:04:08] >> Mr. Chairman, I would respectfully
[1:04:09] request that you allow me to yield my
[1:04:11] time. Yeah, go ahead.
[1:04:13] >> Go ahead.
[1:04:13] >> Thank you.
[1:04:14] >> I I don't have any further
[1:04:16] [clears throat] questions, Mr. Chairman.
[1:04:17] This has nothing to do with the
[1:04:18] chairmanship. I'm trying to understand
[1:04:21] how where we're at
[1:04:23] >> um in this vacancy. This is not
[1:04:28] unprecedented, but it's unusual for us.
[1:04:31] And that's all I was trying to get to
[1:04:32] was how what happens what happens next.
[1:04:36] And commission's been kind of kept in
[1:04:38] the dark about this. We've not had any
[1:04:40] formal um
[1:04:43] any kind of formal communication from
[1:04:46] those in it. It's all been through
[1:04:48] social media and word of mouth. So
[1:04:51] that's that's all that was about.
[1:04:53] >> Commissioner Palmer, I disagree. Uh we
[1:04:55] had a special call meeting on September
[1:04:57] the 1st and the law director informed us
[1:05:00] then that there was a vacancy and that
[1:05:02] the commission was a 15 member
[1:05:04] commission until
[1:05:06] you know we took action and that's what
[1:05:09] we're doing tonight because we didn't do
[1:05:11] it on September 1st. It was not on the
[1:05:13] agenda. Uh but this is the first meeting
[1:05:16] we've had. So we're taking that action
[1:05:20] tonight to clear this up and actually
[1:05:23] declare the vacancy. So,
[1:05:25] >> thank you, Mr. Chair.
[1:05:26] >> Accept the vacancy.
[1:05:27] >> I I do not all that could be discussed
[1:05:30] on September 1st was what was on that
[1:05:32] agenda. So, we did not discuss it.
[1:05:34] >> A couple of people did get a letter
[1:05:37] 4:30, 5:00, August 31st. It was not
[1:05:41] discussed on September 1st, but I've not
[1:05:44] had any emails or anything, but I will I
[1:05:48] respect your opinion. That's fine. Thank
[1:05:50] you.
[1:05:51] >> Thank you.
[1:05:52] >> Anybody else?
[1:05:55] If not, all in favor of the motion, let
[1:05:56] me know by saying I.
[1:05:58] >> I.
[1:05:58] >> Any opposed?
[1:06:00] >> Motion carried. Now,
[1:06:03] >> next item is appointments.
[1:06:11] Civil service board appointment
[1:06:12] reapport.
[1:06:15] Is that uh that's something you're going
[1:06:18] to handle, mayor? Um I think those first
[1:06:21] appointments there um
[1:06:24] those were sent to I mean those were not
[1:06:27] my appointments. So those are um I know
[1:06:31] the sheriff looked at those and I think
[1:06:34] he submitted those because their terms
[1:06:36] had all expired and so that's just for um he doesn't make those
[1:06:42] appointments either but that those folks
[1:06:44] that are currently serving are willing
[1:06:46] to continue serving. So,
[1:06:50] >> is there a motion to approve those two
[1:06:52] under service board?
[1:06:55] >> I have a motion on the second. Any
[1:06:58] discussion?
[1:07:02] » Who makes those appointments? You said
[1:07:03] it wasn't you or the the sheriff. Who
[1:07:05] makes those appointments?
[1:07:06] >> Commission makes those appointments.
[1:07:08] >> Okay.
[1:07:12] So, the
[1:07:14] Okay. So, my question is then where do
[1:07:16] these names come from? if they I I know
[1:07:17] they're reappoints.
[1:07:18] >> Yeah.
[1:07:19] >> But
[1:07:20] >> our process is is to post openings,
[1:07:24] >> you know,
[1:07:26] and I don't have an issue with any of
[1:07:27] these people. It's just that we don't
[1:07:30] have know anything about them or
[1:07:31] reappoints that, you know, and I know we
[1:07:33] usually reappoints go fine, but
[1:07:36] just have some questions. So,
[1:07:38] >> sure. It it's up to you all if you want
[1:07:40] to post it. Um, all the sheriff did. He
[1:07:43] he's not trying to I just reached out to
[1:07:45] him as I was going through my boards and
[1:07:47] said, "Hey, you know, these are expired
[1:07:51] and I think in the past you all have
[1:07:53] operated based on the sheriff's
[1:07:55] recommendations even though it's, you
[1:07:58] know, your appointment." So, if you want
[1:08:00] to post those as vacancies and then um
[1:08:04] take the applications again from these
[1:08:06] individuals, that's certainly your
[1:08:07] purview. Um if that makes commission
[1:08:10] more comfortable.
[1:08:13] We have a motion and a second to approve
[1:08:15] these two names.
[1:08:17] Any further discussion? Mr. P.
[1:08:20] >> Commissioner Foster asked most of my
[1:08:22] questions. The last thing I had was that
[1:08:25] um I tried to get the answers and I was
[1:08:28] told uh by the clerk that we needed to
[1:08:31] um I needed to ask the sheriff. So that
[1:08:33] was one of them. It looks like this term
[1:08:36] expiring on 929 might be an appointment
[1:08:39] instead of a reappoint. And that was my
[1:08:41] only clarification. Is that a new one?
[1:08:44] >> No. No. He's he's currently serving.
[1:08:46] >> Okay. So, it's a reappoint. That's all I
[1:08:47] needed to ask. Thank you.
[1:08:49] >> Okay.
[1:08:50] >> Any further discussion? If not, all in
[1:08:52] favor of the motion saying I.
[1:08:55] >> Any opposed? Motion carried.
[1:09:03] » Next one is uh
[1:09:08] Claxton School Task Force.
[1:09:11] Motion to appoint a commissioner to the
[1:09:13] open seat.
[1:09:17] Have a motion by Mr. Foster. Is there a
[1:09:20] second?
[1:09:22] >> What is your motion?
[1:09:22] >> My motion is to appoint Commissioner
[1:09:24] Palmer. And I think technically we need
[1:09:25] to appoint you as chair. I don't think
[1:09:28] when we made the original motion it was
[1:09:30] as chair. I think we picked the chair,
[1:09:33] but I don't think that was actually
[1:09:37] the case.
[1:09:38] >> Okay. Right. I think it was just chair.
[1:09:43] >> Yeah. So, I'm not actually sure if
[1:09:45] Commissioner Palmer would technically
[1:09:47] still be on the committee because she
[1:09:48] was appointed because she was chair, but
[1:09:52] I don't think it was the way it was
[1:09:54] originally appointed. So, actually, I
[1:09:55] guess my motion is to appoint
[1:09:57] Commissioner Mckame to the one seat as
[1:09:59] chair and then Commissioner Palmer would
[1:10:01] already be on there. I don't think it
[1:10:03] was tied to the chairmanship.
[1:10:06] Somebody can correct me if I'm wrong on
[1:10:07] that, but is there a second to that
[1:10:09] motion?
[1:10:12] Could
[1:10:12] >> restate the motion.
[1:10:13] >> Yeah. So, as I was making the motion, it
[1:10:15] hit me that I don't think we So, my
[1:10:17] motion is to nominate Commissioner
[1:10:19] McCain as chair to be on that committee.
[1:10:21] I think the only open spot would be
[1:10:23] Commissioner Bo Champ because she's no
[1:10:24] longer on committee on commission.
[1:10:28] >> Okay, we have a second. Any discussion?
[1:10:33] If not all in favor of the motion lab
[1:10:35] saying I.
[1:10:36] >> Any opposed? Motion carried.
[1:10:42] next is county mayor report.
[1:10:45] >> Thank you Mr. Chairman. The first item
[1:10:46] on the agenda has already been
[1:10:48] corrected. I had requested that my
[1:10:51] parliamentary inquiry regarding whether
[1:10:53] a vacancy existed be added to the
[1:10:55] amendments and um those were included
[1:10:58] under the consent agenda. So there's no
[1:11:02] action required because what you what
[1:11:05] you all approved
[1:11:07] um I'm not sure if Miss Emmert did it or
[1:11:10] net but it was corrected.
[1:11:13] Um next I'm requesting a motion to
[1:11:15] confirm the reappoint of Ernie BS to the
[1:11:18] Anderson County Water Authority term
[1:11:20] expiring 92030.
[1:11:23] >> Have a motion and a second. Any
[1:11:24] discussion?
[1:11:26] Not all in favor of that motion late
[1:11:28] saying I. Any opposed? Motion carried.
[1:11:32] >> Next is I'm requesting a motion to
[1:11:34] confirm the reappoints of the following
[1:11:35] to the board of health. Dr. Thomas
[1:11:37] Meyers for the dentist position. Jim
[1:11:40] McBride for the pharmacist position. Dr.
[1:11:42] Mark Garrett, veterinarian. Brenda Val,
[1:11:45] registered nurse. Dr. Thomas Clary,
[1:11:47] physician, and Dr. Curtis Ston,
[1:11:50] physician.
[1:11:51] >> Have a motion and a second to approve
[1:11:54] those for the board of health. Any
[1:11:56] discussion?
[1:11:58] If not, all in favor of the motion late
[1:12:00] saying I.
[1:12:01] >> Any opposed? Motion carried.
[1:12:04] >> Next, I'm requesting a motion to confirm
[1:12:05] the reappoint of Bryce Kidwell to the
[1:12:07] Emergency Communications District Board
[1:12:09] of Directors term expiring January 2030.
[1:12:14] >> Have a motion and a second to approve
[1:12:17] Mr. Kidwell.
[1:12:19] Any discussion? If not, all in favor of
[1:12:22] the motion saying I
[1:12:25] >> just had a question. Uh he he's not
[1:12:28] employed by Anderson County anymore. So
[1:12:30] it's as a citizen.
[1:12:33] >> Um yes, but you nobody has to be a
[1:12:36] member of Anderson County government.
[1:12:39] Yeah.
[1:12:39] >> I just wanted you know because people
[1:12:41] see the name and think that still in
[1:12:42] that position.
[1:12:43] >> Yes.
[1:12:44] >> Okay.
[1:12:44] >> Yep.
[1:12:47] >> Um
[1:12:49] next is I'm requesting a motion to
[1:12:51] confirm the appointments and reappoints
[1:12:53] to the solid waste advisory board. Steve
[1:12:56] Poppik, term expiring 9 2032. Harold
[1:12:59] Edwards, term expiring 9 2031.
[1:13:02] Commissioner Robert McCain, term
[1:13:04] experience expiring 9 2032. Commissioner
[1:13:07] Jeff PAC, term exper expiring 9 2032.
[1:13:13] >> Have a motion and a second. Is there any
[1:13:15] discussion?
[1:13:17] If not, I'll in favor the motion saying
[1:13:20] >> I.
[1:13:20] >> Any opposed? Motion carried.
[1:13:23] Next, I'm requesting a motion to confirm
[1:13:25] the [clears throat] reappoint of Ned
[1:13:26] Ferguson to the Anderson County Regional
[1:13:28] Planning Commission term expiring 92030.
[1:13:33] » Have a motion and second. Any
[1:13:36] discussion?
[1:13:38] >> If not, all in favor of the motion,
[1:13:39] leave the number saying I.
[1:13:40] >> I.
[1:13:41] >> Any opposed? Motion carries.
[1:13:44] Um, next I'm requesting a motion to
[1:13:46] appoint the following, these are
[1:13:47] one-year terms to the ethics committee,
[1:13:50] and that's uh by resolution. Uh, two of
[1:13:53] the positions are spelled out in the
[1:13:55] resolution. One is an other related
[1:13:57] governmental member. So, um, I'm
[1:14:00] requesting the reappoint of Dr. Tim
[1:14:03] Parrot and the reappointment of Regina
[1:14:05] Copelan for the constitutional officer
[1:14:08] position as well as Commissioner Shane
[1:14:10] Val, Commissioner Denise Palmer and
[1:14:13] Commissioner Michael Foster.
[1:14:15] >> Have a motion and a second. Any
[1:14:17] discussion?
[1:14:19] If not, all in favor of that motion
[1:14:21] saying I.
[1:14:22] >> Any opposed? Motion carried.
[1:14:25] Next is a request um I'm requesting a
[1:14:28] motion to appoint the following to the
[1:14:30] adultoriented establishment board. Uh in
[1:14:33] my time here, we've never had to meet
[1:14:35] and hopefully we won't ever have to
[1:14:37] meet, but I it is an important board
[1:14:39] should should we have to. So, uh I'm
[1:14:42] requesting to appoint Commissioner Chad
[1:14:45] McNab, Commissioner Denise Palmer,
[1:14:47] Commissioner Shannon Gray, Commissioner
[1:14:50] Shane Val, and Commissioner Jeff PAC.
[1:14:52] These are four-year terms by statute.
[1:14:55] So, their terms would expire 92030.
[1:14:59] >> We have a motion and a second. Any
[1:15:00] discussion?
[1:15:02] >> If not, all in favor of the motion, let
[1:15:04] them say I.
[1:15:06] >> Any opposed? Motion carried.
[1:15:08] >> Uh, next, I'm requesting a motion to
[1:15:10] confirm the reappoints and appointments
[1:15:12] to the Anderson County Economic
[1:15:14] Development Association. Uh, John K.
[1:15:17] Alli Jr., Leonard Abatello, Ernie BS,
[1:15:21] Steve Clap, Jason Deal, Tim Isbull,
[1:15:26] William Bear Stevenson, and Nikki
[1:15:28] Swisser.
[1:15:30] >> Have a motion and a second one. Any
[1:15:33] discussion? If not, all in favor of that
[1:15:35] motion saying I.
[1:15:37] >> Any opposed? Motion carried.
[1:15:41] And um the next is I'm requesting a
[1:15:45] motion to enter the budget review letter
[1:15:47] for fiscal year 2027 from the Tennessee
[1:15:50] CompTroller Division of Local Government
[1:15:52] Finance into the minutes. Presentation
[1:15:55] of this letter to commission is
[1:15:57] required.
[1:15:59] >> Have a motion and a second. Any
[1:16:00] discussion?
[1:16:02] If not, I'll in the motion late with no
[1:16:04] saying I.
[1:16:05] >> Any oppose? Motion carried.
[1:16:08] >> And then uh Mr. Mr. Chairman, I have no
[1:16:11] other action items. All the other
[1:16:13] information I put in there were status
[1:16:15] reports. Um I hope you're finding those
[1:16:18] reports useful and if there's other
[1:16:20] information you want from them, just
[1:16:22] please let me know. Um we'll start um
[1:16:26] EMS is going to add one next month. So
[1:16:29] we'll start getting them on that same
[1:16:31] monthly rotation as well. And then I
[1:16:34] included the annual financial reports
[1:16:35] for the volunteer fire departments and
[1:16:37] rescue squad. And at operations meeting,
[1:16:41] I mentioned a list of TOT investments
[1:16:45] for a 10-year period and um it was
[1:16:49] requested I offered to submit that as
[1:16:52] part of the mayor's report and that was
[1:16:54] uh requested. So that's in your packet
[1:16:56] as well. And that's all I have for this
[1:16:59] evening.
[1:17:00] >> Thank you.
[1:17:01] Next is uh department head director of
[1:17:04] finance request to speak not working.
[1:17:07] Somebody's cut me off.
[1:17:09] >> I didn't see it. I'm sorry.
[1:17:11] >> I just have a quick question about the
[1:17:12] volunteer fire departments. Is it
[1:17:14] required that they report their
[1:17:16] financial reports to commission?
[1:17:19] >> Um it's required that they are reported
[1:17:21] to the state of Tennessee.
[1:17:23] >> Okay. And um each year
[1:17:27] um they have to fill those out. And part
[1:17:29] of Anderson County's
[1:17:32] um I don't know how long ago this was. I
[1:17:34] mean before I was ever here, part of
[1:17:36] their review was ensuring you are by
[1:17:40] statute required to if you're going to
[1:17:42] make a donation,
[1:17:43] >> you have to um you know, most if if
[1:17:48] they're over a certain level, a
[1:17:50] nonprofit agency has to have an audit on
[1:17:53] file with the finance office. And in the
[1:17:59] case of Anderson County's donation, it's
[1:18:01] just part of ensuring that they have met
[1:18:04] the financial requirements and each year
[1:18:08] for the donation, they look at that to
[1:18:10] make sure that they have met the
[1:18:12] requirements of the state submitting
[1:18:14] that form to the state.
[1:18:15] >> I noticed that a couple had significant
[1:18:19] money in CDs or some money in CDs, not
[1:18:23] all of them, but a few of them. I
[1:18:25] wondered is that the norm? Is that a
[1:18:28] normal practice?
[1:18:31] >> I don't know. I'd have to go back and
[1:18:32] look at um the prior reports. I mean, I
[1:18:36] normally look at them. Our EMA does
[1:18:38] because that's part of the finance
[1:18:40] office signing off to make sure they can
[1:18:41] get their contribution.
[1:18:43] >> Um they look at a couple of different
[1:18:45] things
[1:18:46] >> and I've looked at them, but I haven't
[1:18:48] made mental note of that. I just
[1:18:50] wondered because you know if it's in a
[1:18:52] CD it's tied up for a period of time so
[1:18:55] I didn't know if that was a normal
[1:18:57] financial practice or not. So I was just
[1:19:00] curious. Like I said not all of them had
[1:19:01] that but I did notice it on a couple.
[1:19:04] >> Yeah.
[1:19:05] >> Thank you.
[1:19:05] >> I can find out
[1:19:08] >> the CD [clears throat] fire department
[1:19:10] has
[1:19:10] >> we can take it out at any time and we do
[1:19:13] it to raise more money. It's an effort
[1:19:14] to raise more money and you know the the
[1:19:17] county and the the community is most
[1:19:20] gracious. So instead of it just sitting
[1:19:22] there not drawing any interest, we
[1:19:24] choose to do that because it helps out.
[1:19:27] >> Okay.
[1:19:28] >> But we can draw it out at any time.
[1:19:30] There's a penalty, but we can still draw
[1:19:32] it out.
[1:19:34] >> Okay.
[1:19:38] » We'll move on to the director of
[1:19:39] finance.
[1:20:00] Okay.
[1:20:11] » [clears throat]
[1:20:12] >> Sorry. Cash and fund balance report
[1:20:14] ending August 31st um 2026.
[1:20:17] Restricted funds 1.1 million. Committed
[1:20:20] funds are 388,270.
[1:20:23] Assigned funds 301,876.
[1:20:26] Unassigned fund balance is 7,291687
[1:20:31] for a total fund balance of 9,152079.
[1:20:35] cash 14,49748
[1:20:39] which is 1.8 million less than last year
[1:20:42] at this time. I'd also want to point out
[1:20:44] that the unassigned fund balance is
[1:20:46] below the limit of 8 million requiring
[1:20:48] 2/3 votes for budget amendments that
[1:20:51] affect the unassigned fund balance. And
[1:20:54] so I'm trying to point those out to
[1:20:55] y'all and we do have one tonight. Um
[1:20:57] when we get to that I'll let you know
[1:20:59] that for sure um which one it is. But um
[1:21:03] we are below the 8 million limit in our
[1:21:06] fund balance policy. Also schools um
[1:21:09] total fund balance 16,28,766.
[1:21:14] Cash $13,493928.
[1:21:18] Any questions on the fund balance or
[1:21:20] cash and fund balance report?
[1:21:27] » Sales tax. Uh
[1:21:28] >> Commissioner Wandelle. Oh, I'm sorry.
[1:21:30] >> Thank you, Mr. Chairman. Robbie, I don't
[1:21:32] mean to I want to catch you before you
[1:21:34] get into everything else. What What was
[1:21:37] the rollover amount from last year?
[1:21:39] >> Well, I should have mentioned too, these
[1:21:41] are unudedited, so I don't have really
[1:21:42] have a rollover amount, but obviously I
[1:21:45] mean, we didn't have any rollover. We
[1:21:48] had a deficit rollover if if anything
[1:21:50] this year
[1:21:52] >> and this is the first year we've not had
[1:21:54] any ARPA funds that we spent an assigned
[1:21:57] fund balance. I
[1:21:59] we spent 1.5 million of the fund balance
[1:22:02] on different items in the budget um
[1:22:06] capital project items and we also had a
[1:22:08] budget deficit of a,83,247
[1:22:12] and I'd also like to add that with the
[1:22:15] 7.2 million it's already taken into
[1:22:16] account this year's budget deficit of
[1:22:18] 1,277,000.
[1:22:21] So that comes off automatically on the
[1:22:22] fund on the unassigned.
[1:22:25] So all those are factors in why it's
[1:22:27] lower.
[1:22:29] >> Mr. Chairman, just for point of
[1:22:30] clarification, how how many votes would
[1:22:32] it require to allow us to go below that
[1:22:36] threshold with that rule? Robbie, you
[1:22:37] mentioned
[1:22:38] >> 2/3. And that's a good question. And for
[1:22:40] 15, it would have been 11, but we have
[1:22:41] 14 tonight. So I'm not sure if
[1:22:43] Commissioner Barren is a no vote or
[1:22:48] how that works.
[1:22:49] >> Typic 15 would be 10.
[1:22:52] >> Be 10 based on the number.
[1:22:55] The commission is 15.
[1:22:56] >> Yes. I'm sorry. 10.
[1:23:01] » So, we still need 10 votes even with one
[1:23:03] missing. Okay. Gotcha. Thank you.
[1:23:05] >> So, if I know we have some new folks on
[1:23:08] commission. Could you explain to them
[1:23:09] what that what that means when we go
[1:23:12] below that threshold?
[1:23:14] >> Why we It's a rule we have.
[1:23:16] >> Sure. the the county had developed a
[1:23:18] fund balance policy for the general fund
[1:23:20] and we said it it it has continued to
[1:23:23] rise the last two or three years. Um the
[1:23:26] latest um
[1:23:28] from the finance committee actually is
[1:23:30] where the fund balance policy comes
[1:23:32] from. The latest one was set at 8
[1:23:34] million which we've been above um we've
[1:23:36] never had we've not gone below that um
[1:23:38] in two or three years but um this year
[1:23:44] we are at 7.2 2 million like I said and
[1:23:46] um of course that's unudited that could
[1:23:48] change but we usually we won't get our
[1:23:51] audit numbers till um November December.
[1:23:59] anyway if it goes below that it requires
[1:24:00] twothirds votes for budget amendments
[1:24:03] that affect the assigned fund balance.
[1:24:08] only in county commission not in budget
[1:24:10] committee level.
[1:24:17] » Any other question?
[1:24:18] >> Go ahead.
[1:24:21] >> Commissioner Wandell, do you have
[1:24:22] anything?
[1:24:22] >> Oh no.
[1:24:23] >> Okay.
[1:24:24] >> Thank you.
[1:24:25] [clears throat]
[1:24:26] >> Okay. Sales tax. Uh the county portion
[1:24:28] as a whole 4,986,898.
[1:24:31] That's up 10.5% from last July. Anderson
[1:24:35] Countyy's portion 599492
[1:24:38] 18% increase from last July.
[1:24:46] [snorts]
[1:24:48] ARP projects um we currently have four
[1:24:51] projects remaining. The uh largest with
[1:24:55] broadband Comcast $250,000. They haven't
[1:24:58] as the mayor explained in the last
[1:25:00] budget meeting were still haven't been
[1:25:02] build for that. Uh two of those projects
[1:25:05] the um block house valley recycling
[1:25:07] center are not tied to the uh December
[1:25:10] date because they are using of ARPA
[1:25:12] interest and the T deck ARP water in
[1:25:16] infrastructure investment 52,419 that's
[1:25:19] what's left should be taken care of by
[1:25:22] the end of October um according to John
[1:25:24] in finance.
[1:25:26] Any questions on the ARPA?
[1:25:29] >> Yes. [clears throat] Wait.
[1:25:32] >> So, Robbie,
[1:25:34] do we have what is it? 48,000.
[1:25:37] >> Oh, I'm sorry. $160 in interest. Yes,
[1:25:40] sir.
[1:25:40] >> So, that's
[1:25:41] >> can be spent on anything. And it doesn't
[1:25:43] have a date time limit as far as
[1:25:44] spending either.
[1:25:46] >> And we can use it on anything that
[1:25:48] relates to the improvement of our
[1:25:51] citizens
[1:25:52] >> or anything.
[1:25:53] >> Okay. Thank you. all any any project in
[1:25:56] the county would like to.
[1:25:59] And a grant list, we provide this list
[1:26:01] each year. This is the newest grant list
[1:26:02] for um fiscal year 2627. Um total grants
[1:26:07] 27,216,524.
[1:26:14] so far this year, we added two new
[1:26:16] grants. CMS uh rural health
[1:26:18] transformation ambulance grant of
[1:26:20] 305,461
[1:26:22] and the district attorney's office of
[1:26:24] special attorneys program of $953,55.
[1:26:30] Any questions on that? [snorts]
[1:26:32] >> Yeah, those two new grants, where do
[1:26:34] they come from?
[1:26:36] >> Where the grants come from?
[1:26:38] >> Um
[1:26:42] well, General Clark might answer this
[1:26:44] question.
[1:26:46] I'm not sure about the and
[1:26:49] the state of Tennessee is is the EMS
[1:26:51] grant, right?
[1:26:53] >> The state of Tennessee with the EMS
[1:26:54] grant. The special attorneys
[1:26:59] » commissioner from the United States from
[1:27:01] the US Department of Justice.
[1:27:02] >> Okay, I that's good information to know
[1:27:05] for the people at home to know that.
[1:27:07] [clears throat]
[1:27:07] >> Thank you.
[1:27:09] >> Yes. And that's this is one year of that
[1:27:11] grant. And I think we have a it's a
[1:27:12] three-year grant of that special.
[1:27:14] >> So we'll get that every year for three
[1:27:16] years.
[1:27:16] >> Yes. Thank you.
[1:27:19] >> The uh EMS one is from the state of
[1:27:22] Tennessee, one of their rural health
[1:27:23] grants and that will enable Anderson
[1:27:26] County to buy an ambulance.
[1:27:29] So it's a really good one.
[1:27:31] >> Mr. Chair, may I continue with that? Now
[1:27:34] when it says rural health grant, is is
[1:27:37] that for the rural areas or they just
[1:27:39] Anderson County is a rural So, um, when
[1:27:42] they distribute the funds across the
[1:27:44] state of Tennessee, they have
[1:27:45] designations rural versus urban under
[1:27:49] their grant application or their how
[1:27:51] they're managing this grant for the
[1:27:53] state of Tennessee is um I have
[1:27:58] Commissioner Isabel, I've forgotten the
[1:27:59] number, but it's pretty much every
[1:28:02] county in the whole state of Tennessee
[1:28:04] except the metro areas. I see like
[1:28:06] MetroDavidson, Knox County, Nashville.
[1:28:08] So, um, it's been a real help for
[1:28:12] counties like Anderson that have a lot
[1:28:14] of rural area, but under many
[1:28:17] designations, we're not considered a
[1:28:18] rural community because we have some of
[1:28:21] the urban centers,
[1:28:22] >> right? And I remember when we were just
[1:28:24] a rural county and then because of all
[1:28:26] the changes.
[1:28:27] >> Yeah.
[1:28:27] Okay. Thank you.
[1:28:29] >> And Commissioner Isel, just to correct
[1:28:31] the district attorney's office, the
[1:28:33] special attorneys program, that's
[1:28:34] 963,5005
[1:28:36] for three years. Okay.
[1:28:37] >> So, not each year that amount amount,
[1:28:39] but three years. So, that's dispersed
[1:28:42] over three years.
[1:28:43] >> All right. Thank you,
[1:28:45] >> Commissioner Palmer.
[1:28:46] >> Yes. Thank you, Mr. Chair. I just wanted
[1:28:48] to say that's [clears throat] 27.2
[1:28:50] million.
[1:28:52] >> All those on the side, that is just
[1:28:54] amazing. And they're doing good work.
[1:28:56] All of the ones listed there on the side
[1:28:58] that's pursuing grants. It's amazing.
[1:29:03] One thing else to point out about the
[1:29:05] district attorney special award attorney
[1:29:07] program is the possibility of indirect
[1:29:10] cost $118,04
[1:29:12] that could come back to the county as
[1:29:14] far as revenue. So that's great.
[1:29:16] >> Yeah, that's
[1:29:18] >> we don't get that often ever.
[1:29:20] >> Mando,
[1:29:21] >> thank you, Mr. Chairman. Robbie, just
[1:29:23] for clarification again for me, um these
[1:29:26] grants when they come in, I think you
[1:29:28] told me in the past they they just go
[1:29:30] right back into that fund for that
[1:29:33] department. Is that right?
[1:29:34] >> If we created by budget amendment. Yes,
[1:29:37] sir.
[1:29:38] >> And we don't adjust the budget at all.
[1:29:41] We just slide it right in.
[1:29:43] >> Well, the budget is adjusted with a
[1:29:46] budget amendment approved by budget
[1:29:47] committee. And like for example tonight,
[1:29:49] the the one we were talking about the
[1:29:51] district attorney, it's a it's an
[1:29:52] amendment tonight to put in this year's
[1:29:54] budget. So we do not put any grant in
[1:29:58] the budget unless it um is amended
[1:30:01] increasing revenue and expenditure
[1:30:03] codes.
[1:30:04] >> And so if a million comes into a
[1:30:05] department, you slide it into that
[1:30:08] department's code, but we don't make any
[1:30:10] adjustment to the overall budget on the
[1:30:12] front end of the year. The
[1:30:15] >> No, it would be an amendment to that
[1:30:16] budget. So it would just increase the
[1:30:18] revenue for that department. But we
[1:30:21] don't make any adjustments to the
[1:30:22] overall budget as a whole. Correct.
[1:30:24] >> We make adjustments to the if you're
[1:30:26] increasing revenue, you have to have
[1:30:27] offsetting expenditure codes. So most of
[1:30:31] these grants are reimbursement grants.
[1:30:32] We're not getting the money up front. We
[1:30:34] are getting reimbursed once.
[1:30:36] >> Okay.
[1:30:36] >> The department spends the money and then
[1:30:38] we recede it into that revenue code.
[1:30:40] >> Thank you. Thank you, Chair.
[1:30:44] >> ahead. Okay.
[1:30:46] Moving on to purchasing contracts. Um we
[1:30:48] have 10 contracts that all were approved
[1:30:51] by um with legal review and by the
[1:30:54] budget committee as well.
[1:30:57] Have a motion by Mr. Foster, second by
[1:31:00] McNab to take as a group.
[1:31:03] >> Yeah. [snorts] Any discussion on the
[1:31:06] contracts?
[1:31:08] >> Not all in favor of the motion saying I.
[1:31:12] >> Any oppose? Motion carried.
[1:31:15] Okay, thank you. And we have one surplus
[1:31:18] vehicle, a 2011 Crown Victoria. Um, that
[1:31:22] also needs approval.
[1:31:27] Have a motion and second.
[1:31:30] Any discussion?
[1:31:33] Not. All in favor of the motion saying
[1:31:36] >> Any opposed? Motion carried.
[1:31:39] Hey, Commissioner Isabel.
[1:31:40] >> Mr. Chairman, I I do have a question on
[1:31:43] one of the contracts. Spyglass IT
[1:31:46] contract number 27-0015.
[1:31:49] One year device services auditing
[1:31:51] contract vendor will receive part of
[1:31:53] savings realized. What is that?
[1:31:58] » Am I reading that correctly?
[1:32:00] >> That yes. So that is one um
[1:32:04] Robbie I think you and I were on that uh
[1:32:07] webinar. Were you not on that webinar
[1:32:09] with me? Okay. uh somebody from finance
[1:32:11] was and then uh Brian was as well. this
[1:32:14] company, what they do, they know all of
[1:32:17] your
[1:32:19] they know the process for telephone
[1:32:22] bills, any kind of communication
[1:32:26] um billing that you receive is very
[1:32:30] difficult to understand and actually
[1:32:33] work with these with these firms because
[1:32:36] we're on we're in a position of really
[1:32:38] not understanding. And so what this
[1:32:41] company does is they audit. We will once
[1:32:45] authorized they get all of Brian will be
[1:32:48] sending them all of our bills or
[1:32:50] invoicing or contracts and then they
[1:32:53] will review it for savings. So, for
[1:32:56] instance, a um
[1:33:00] let's say we've got a contract with a
[1:33:02] company where the technology change,
[1:33:05] pricing changes, and they're not going
[1:33:08] to be quick to volunteer that they've
[1:33:10] lowered prices or that something's more
[1:33:12] efficient. They're just, you know, happy
[1:33:15] that you're humming along writing the
[1:33:17] checks. And so, that's what they're
[1:33:19] going to do is look at all of that. And
[1:33:22] then um it's based on a cost share. So
[1:33:26] we don't pay for anything unless we get
[1:33:29] savings and then it's a percentage but
[1:33:31] then obviously we realize the savings on
[1:33:34] our contracts.
[1:33:35] >> Okay. Thank you.
[1:33:39] » Have a motion second.
[1:33:41] Any discussion?
[1:33:43] >> Not all in favor. The motion say I.
[1:33:46] >> Any oppose? Motion carried.
[1:33:50] >> Thank you. So, group three, the consent
[1:33:52] agenda transfers. Um, it's no action
[1:33:54] from commission is necessary um after
[1:33:57] approved from budget committee. Group
[1:33:59] four, appropriations. There are six of
[1:34:00] those, three through eight from the
[1:34:02] school department,
[1:34:10] seeking approval as a group or
[1:34:12] individual. I can answer any questions.
[1:34:16] » Have a motion and a second. Do you say
[1:34:18] this is an appropriation? These are
[1:34:20] appropriations from the school
[1:34:21] department.
[1:34:22] >> From the school department.
[1:34:23] >> Yes.
[1:34:24] >> We need a board vote.
[1:34:25] >> We have to have a board vote. Yes.
[1:34:26] >> Okay.
[1:34:33] » Commissioner Palmer,
[1:34:35] >> I just have a question. Um Robbie, that
[1:34:39] one no 220.
[1:34:42] It's on uh number seven. That's from the
[1:34:45] school. That's going to be it says to
[1:34:47] other funds, but it's for the sheriff.
[1:34:50] Is that as of today, as it's written
[1:34:53] here, that's a one-time
[1:34:55] transfer, correct?
[1:34:58] >> For this year. Yes, sir. For this year,
[1:35:00] >> but it's if it's going towards salaries,
[1:35:03] the budget committee needs to be looking
[1:35:06] at a reoccurring.
[1:35:08] >> Yes. And Dr. Perro said it would be and
[1:35:10] >> he said it would be. Thank you.
[1:35:14] Just the board vote.
[1:35:15] >> Yes.
[1:35:31] Okay. Motions pass. 14. Yes.
[1:35:35] >> Okay. Group five transfers from the
[1:35:37] school department. There are two of
[1:35:38] those. Number one and nine.
[1:35:41] seeking approval as a group.
[1:35:47] » Have a motion and a second to approve as
[1:35:49] a group.
[1:35:51] >> This transfer you say
[1:35:54] >> it is transfers from the school
[1:35:55] department. Major line item transfer. So
[1:35:58] they require full commission approval.
[1:36:00] >> Does it need a board vote?
[1:36:01] >> All all the budget amendments will need
[1:36:04] a board.
[1:36:04] >> Okay.
[1:36:06] >> Need a board vote.
[1:36:08] >> Question.
[1:36:09] >> Oh, I'm sorry, Commissioner Palmer.
[1:36:11] Thank you, Mr. Chair. Same question for
[1:36:13] the 55,000. Yes, it's going to be a
[1:36:15] reoccurring.
[1:36:17] Okay.
[1:36:18] >> Up to two for 250,000 is 250. Yes. Okay.
[1:36:24] » He already had the 55,000 in a budget
[1:36:26] code. We're just moving it to a transfer
[1:36:28] out code.
[1:36:30] >> Okay. So, it's going to be reoccurring.
[1:36:32] That part is all right. Thank you. Okay.
[1:36:35] Board vote.
[1:36:43] 14. Yes. [snorts] Motion carried.
[1:36:45] >> Thank you.
[1:36:47] Group six appropriations non-school.
[1:36:50] Three are from the general fund and one
[1:36:52] from the highway department. Also the
[1:36:53] district attorney grant that we spoke
[1:36:55] about earlier is um in this group of
[1:36:59] appropriations for $265,1343.
[1:37:05] Have a motion and a second to approve
[1:37:07] the group.
[1:37:10] Any discussion?
[1:37:13] If not, board vote.
[1:37:21] » Motion carries. 14. Yes.
[1:37:23] >> Thank you. And group eight, there is one
[1:37:26] transfer from the mayor senior center uh
[1:37:28] for $26,500
[1:37:30] that um affects payroll.
[1:37:35] Have a motion and a second. Any
[1:37:38] discussion?
[1:37:40] If not, board vote.
[1:37:43] >> Yes.
[1:37:58] » Motion carried. 14. Yes.
[1:38:00] >> Thank you. Um section A in miscellaneous
[1:38:03] the grant application from EMS for
[1:38:05] $7,840
[1:38:07] with no match. It's a Tennessee risk
[1:38:10] management grant um to purchase two
[1:38:13] powered main oxygen cylinder loading
[1:38:16] equipment. This is for application only.
[1:38:20] Have a motion and a second. Any
[1:38:23] discussion?
[1:38:26] If not, I'll in favor of the motion
[1:38:28] saying I. I. Any opposed? Motion
[1:38:31] carried.
[1:38:32] >> Okay. Section B, the UT extension
[1:38:34] office. This will require twothirds vote
[1:38:36] and it will need to be a board vote
[1:38:38] because it does affect unassigned fund
[1:38:39] balance. Um,
[1:38:44] Seth White House requests an increase of
[1:38:45] $11,613.75
[1:38:48] for the UT extension budget. The
[1:38:50] additional funding will be appropriated
[1:38:52] for unassigned fund balance. Require
[1:38:53] two-thirds vote from commission.
[1:38:55] Commissioner Mckame made the motion
[1:38:57] second by Commissioner Mag McNab to
[1:38:59] increase the extension office budget
[1:39:01] 11,61375.
[1:39:04] Voting no. Commissioner Cook Wells and
[1:39:06] Bow and the motion passed.
[1:39:09] >> Have a motion and a second. Any
[1:39:11] discussion?
[1:39:13] If not, board vote. Oh, Commissioner
[1:39:16] Wales, I'm sorry.
[1:39:18] I would say um I was a no vote in that
[1:39:19] budget meeting based on uh the previous
[1:39:22] commissioners that served in this last
[1:39:23] term just the month before voted this
[1:39:26] down in their budget approval. So for
[1:39:28] them to come back just less than 30 days
[1:39:30] later asking for this money I thought
[1:39:32] was a little inappropriate and also a
[1:39:34] little hasty when this should be planned
[1:39:35] out in accordingly with next year's
[1:39:36] fiscal budget. Thank you.
[1:39:41] » It's a board vote.
[1:39:52] » That motion failed. Only eight votes.
[1:40:01] Okay. Section C, Claxton Elementary, the
[1:40:03] task force renewal. Um there was a
[1:40:07] referral from the um Glaxon Elementary
[1:40:10] task force to
[1:40:12] for the general fund to loan the
[1:40:13] school's $4 million until the sale of
[1:40:16] the um school then the old school and
[1:40:20] then [clears throat] repay the general
[1:40:21] fund back. Um that motion was discussed
[1:40:23] at at I mean that ideal was discussed at
[1:40:27] length in the budget committee meeting
[1:40:28] but no action was taken. Um
[1:40:32] of course with the fund balance of
[1:40:33] general fund being 7.2 2 million. It's
[1:40:36] doesn't look as good for us now to loan
[1:40:38] the money as it did in the schools with
[1:40:40] a $16 million fund balance. So, um
[1:40:43] Dr. Parrot seem to think they could
[1:40:45] handle the um the cost within their own
[1:40:49] budget.
[1:40:53] » Any questions?
[1:40:54] Okay.
[1:40:56] Section D, pay structure from the
[1:40:58] sheriff's department. Um
[1:41:01] the sheriff came with a proposal for an
[1:41:04] additional two and 9% increase. Um the
[1:41:09] proposed increases will be supported by
[1:41:10] $250,000 in funding from the school
[1:41:12] department along with savings from
[1:41:14] leaving six sheriff department operation
[1:41:16] positions unfilled. Following
[1:41:19] discussion, the final agreement provided
[1:41:21] for an additional 2% increase for
[1:41:22] employees in grades 2 through five and
[1:41:25] an additional 7% increase for employees
[1:41:27] in grades 6 through 13. effective the
[1:41:29] October 8th payroll and will not be
[1:41:31] compound will not be compounded on the
[1:41:34] already approved 3%. Commissioner McNab
[1:41:37] made the motion commission seconded by
[1:41:39] Commissioner Vandergri to approve the
[1:41:41] additional 2% and 7% increases um to
[1:41:45] that budget. This won't require
[1:41:48] two-thirds vote because with the um
[1:41:51] added funding from the school department
[1:41:52] of 250,000 in the um along with the
[1:41:55] savings, we counted the six positions at
[1:41:58] $75,000 each, which is or 500,000. Um
[1:42:02] the cost for these um salaries increases
[1:42:07] with but with um
[1:42:09] benefits is um 700 right around
[1:42:12] $730,000.
[1:42:14] So, um, it doesn't affect fun unassigned
[1:42:17] fund balance.
[1:42:19] >> Okay,
[1:42:23] » Commissioner Palmer.
[1:42:24] >> Thank you, Mr. Chair. Um, Robbie, I
[1:42:27] just, um, I'm all for this. Um, but I
[1:42:30] I'm not real sure what to do here. So,
[1:42:34] um, we discussed this for months and
[1:42:35] months during the budget, uh, committee
[1:42:38] last time and, uh, we always talked
[1:42:41] about this as a public safety issue and
[1:42:46] we included EMS every time that we spoke
[1:42:49] of it. Um, so, and I and I was an
[1:42:52] advocate because this is a public safety
[1:42:55] issue. we've got um two positions in EMS
[1:42:59] that we are having trouble retaining and recruiting. And so uh that w that
[1:43:06] request was brought to us and we said we don't have a reoccurring funding and
[1:43:13] uh revenue source. So we'll give
[1:43:15] everyone a 3% and we will get this bad
[1:43:18] budget passed by the deadline but then
[1:43:20] we will take this up. So, uh, when this
[1:43:23] came before budget, um, EMS was not
[1:43:26] included and I did not catch it that
[1:43:28] night. And so, I would like to I I don't
[1:43:32] know how this needs to go, but EMS needs
[1:43:36] to have
[1:43:38] the same consideration for the positions
[1:43:42] that they are having trouble filling as
[1:43:44] well. And it is my understanding, you
[1:43:46] correct me on these numbers if I'm
[1:43:47] wrong, Robbie, um, but they need $78,000
[1:43:52] to for this year and it would start at
[1:43:56] the same time that the sheriff raises
[1:43:59] start. And I would suggest that we take
[1:44:03] that from the past remediation um, fund
[1:44:06] of the opioid funds. That will it it
[1:44:09] would be the same thing as getting it
[1:44:10] from the schools. it'll be a one time
[1:44:13] and that'll get us through this year. Um
[1:44:16] and then budget would need to look at
[1:44:19] trying to fund EMS as well um for for
[1:44:23] the you know reoccurring expense of the
[1:44:26] salaries but we do need to include EMS
[1:44:29] in that public safety um overall
[1:44:34] you know retention and recruiting. So,
[1:44:38] just to clarify what Commissioner
[1:44:40] Palmer, um a 3% a $78,000 would be a 3%
[1:44:45] additional 3% increase for um paramedics
[1:44:50] and
[1:44:53] » advanced CMT, I believe.
[1:44:55] >> And advanced CMT, sorry. Um the opioid
[1:44:57] [clears throat] fund balance, there's
[1:44:58] restricted funds, has a $256,296
[1:45:02] fund balance and we've already collected
[1:45:04] $89,181
[1:45:06] this fiscal year in revenue for the
[1:45:07] opioid funds. So um it is a usable
[1:45:10] expense for opioids and um
[1:45:16] it would require twothirds vote from
[1:45:17] this from commission to add to approve
[1:45:20] that.
[1:45:20] >> And just one more comment please Mr.
[1:45:22] chair. Um, this is
[1:45:24] >> First off, did you amend the motion?
[1:45:26] >> I I can if Yes, I I make that amendment.
[1:45:30] >> Okay.
[1:45:32] >> And we have a second to the amendment.
[1:45:35] >> Go ahead.
[1:45:36] >> EMS [clears throat]
[1:45:37] touches all 82,000 of our citizens. Yes.
[1:45:41] >> And um it is one of the things that our
[1:45:43] citizens expect when they pick up the
[1:45:46] phone for EMS and the police, the
[1:45:49] sheriff's office to respond. And so I
[1:45:52] would just I just think we need to look
[1:45:53] at both of these. I think it's that
[1:45:55] important.
[1:45:56] >> Okay.
[1:45:57] >> And and Nathan has come to budget
[1:46:00] several times and made that request
[1:46:01] known.
[1:46:02] >> I agree. Commissioner,
[1:46:05] >> thank you. I'm in agreement with
[1:46:06] Commissioner Palmer on this and I just
[1:46:08] want uh our finance director's opinion
[1:46:13] >> about this raises.
[1:46:15] >> Yes, I honestly support this as well.
[1:46:18] >> I think um that it would help honest all
[1:46:21] I mean the sheriff came to the budget
[1:46:23] committee several times with asking for
[1:46:26] raises because he's having issues
[1:46:28] keeping
[1:46:30] billing retention keeping positions
[1:46:32] filled I mean honestly EMS is too it's every department in the county is
[1:46:37] having trouble with I mean we lose
[1:46:39] employees a lot retention's a an issue
[1:46:41] in the county but I also think it's some
[1:46:44] of the the younger employees
[1:46:48] they job hunt look for more pay. They
[1:46:51] don't care. They're the lawyer, you
[1:46:52] know, retirement and things like that
[1:46:54] don't mean as much to them as as pay
[1:46:56] does. So, we're all having that issue.
[1:46:58] Um, but I definitely would recommend
[1:47:01] this for EMS. I think it would help them
[1:47:03] tremendously with
[1:47:04] >> private dentistry has that same issue.
[1:47:06] >> Yeah,
[1:47:07] >> it's just around everywhere.
[1:47:10] Commissioner WH,
[1:47:11] >> I guess I could put Commissioner
[1:47:12] Capshaw's parliamentarian on the spot,
[1:47:14] but does this muddy the water know when
[1:47:16] the sheriff's vote does not need two/3s
[1:47:18] >> and this this amendment to the motion
[1:47:20] will require two/3s? Would it not be
[1:47:22] better to separate those?
[1:47:24] >> Um, Mr. Broke, anybody that's got an
[1:47:26] opinion, I just
[1:47:27] >> That's a good point.
[1:47:29] >> Yes, I think.
[1:47:30] >> Yeah, it's a good point. Okay, I'll
[1:47:33] withdraw my amendment and I'll make a
[1:47:34] different amendment afterwards or a
[1:47:36] different motion afterwards.
[1:47:38] >> Okay. Second. Let's go back then to the
[1:47:41] first motion
[1:47:43] and that's on the sheriff's department.
[1:47:45] >> You got it.
[1:47:49] » Oh, Mr. V.
[1:47:50] >> Thank you, Mr. Chairman. I'll be
[1:47:52] abstaining for calls on this vote and to
[1:47:55] be honest with you, I don't know what
[1:47:56] that mean.
[1:47:58] >> It does.
[1:47:59] >> I'll let you all figure that out. Thank
[1:48:00] you, Mr. Chair.
[1:48:06] » Okay. All in favor the motion let by
[1:48:09] saying I
[1:48:10] >> board vote in board. That's right. Board
[1:48:12] vote. I'm sorry. Board vote.
[1:48:14] >> This is just majority.
[1:48:16] >> Yes.
[1:48:23] » Okay. We [snorts] have 13. Yes. One
[1:48:25] extension. Motion passes.
[1:48:29] >> Commissioner Palmer. I'm make a motion
[1:48:34] that we um take $78,000 from the past
[1:48:37] remediation
[1:48:40] uh opioid fund and uh send that to that
[1:48:44] doesn't require because I I have a
[1:48:46] funding source back to AMS for the races
[1:48:50] uh for his advanced EMTs and paramedics.
[1:48:54] >> Have a motion and a second. Any
[1:48:55] discussion?
[1:48:56] >> And the only reason I say it required
[1:48:57] two/3s is because it wasn't on the
[1:48:58] budget.
[1:48:59] >> It didn't go through budget. Correct.
[1:49:02] Shouldn't we add it to the agenda?
[1:49:05] Clarification on the parliamentarian.
[1:49:07] Does it need to be added agenda since
[1:49:08] this is a new item?
[1:49:10] >> Yes.
[1:49:11] >> Then take a motion up on it.
[1:49:15] » Yes.
[1:49:15] >> Okay. I make a motion that we add it to
[1:49:17] the agenda.
[1:49:20] >> You second that. Okay. All favor the
[1:49:22] motion.
[1:49:23] >> I'd like to make a motion to amend if I
[1:49:25] could, Mr. Chairman. It's not letting me
[1:49:26] hit the button. I apologize. Make a
[1:49:28] motion that we amend this to go to
[1:49:30] budget committee to discuss and then
[1:49:31] bring it back before full commission.
[1:49:40] » Have a motion to amend it. Second,
[1:49:42] Commissioner Wando.
[1:49:45] >> That's to refer this to the budget
[1:49:48] committee.
[1:49:48] >> Yes.
[1:49:51] >> Okay.
[1:49:55] Commissioner Palmer,
[1:49:56] >> I'm going to vote no on that at this
[1:49:58] time just because we've exhaustively
[1:50:01] discussed it in the previous [snorts]
[1:50:03] budget meetings, but I understand that
[1:50:06] we do have uh new commissioners with us
[1:50:08] now. So, but I wanted to explain why I'm
[1:50:11] voting no on this.
[1:50:12] >> Okay,
[1:50:15] >> back to this, but I think for
[1:50:18] transparency, it should go back to the
[1:50:19] budget like the sheriff did to be honest
[1:50:23] with you.
[1:50:31] Okay,
[1:50:39] we have a motion on the floor and a
[1:50:42] second.
[1:50:45] You're amending the motion, but
[1:50:47] basically it should not be an an
[1:50:50] amendment to her motion. It should be a
[1:50:53] motion to refer
[1:50:56] to the budget committee which would take
[1:50:58] precedent over her original motion
[1:51:01] and then the second. So
[1:51:04] >> are you?
[1:51:04] >> Yes, sir.
[1:51:05] >> Okay with that. You
[1:51:07] >> Okay. So, we need to vote on this
[1:51:08] whether or not to refer it back to the
[1:51:10] budget committee.
[1:51:12] All in favor of that motion.
[1:51:14] >> You're going to need to clear the board
[1:51:16] though because this says much to amend
[1:51:17] and really it is a referral motion.
[1:51:21] >> All right. Uh, it's it's a motion, not a
[1:51:23] motion to amend.
[1:51:39] Okay, now we're on there. This is a
[1:51:42] motion to refer to the budget committee.
[1:51:45] All in favor of that motion late saying
[1:51:48] >> Any oppose? No.
[1:51:52] Motion carried.
[1:51:59] » Okay. Under new business, we had one
[1:52:01] item um
[1:52:03] when when the county approved or
[1:52:05] commissioner approved the retention
[1:52:06] payments. We had one employee that was
[1:52:09] currently working for clerk and master
[1:52:10] and then he went to the sheriffs, he
[1:52:12] missed both retention payments. So, the
[1:52:14] motion was just to approve the retention
[1:52:15] payment um for this employee. And that
[1:52:18] did pass in budget committee. And I just
[1:52:20] need a vote here to pass. I mean to
[1:52:23] approve that motion or not approve.
[1:52:26] >> I have a motion and a second to
[1:52:30] approve the motion.
[1:52:33] » Yep. Sorry.
[1:52:34] >> Okay.
[1:52:35] >> Motion. I didn't catch it.
[1:52:40] [clears throat]
[1:52:40] >> We had one employee that was when the
[1:52:44] sheriff's retention payments. They had
[1:52:46] to be there so long. he had just
[1:52:48] transferred to the sheriff's department.
[1:52:49] And when we gave the um general fund
[1:52:53] employee or all the retention payments
[1:52:55] for the rest of the employees, he missed
[1:52:57] out on that because he was working for
[1:52:59] the sheriff's department then, which
[1:53:00] they weren't included. So, he was not
[1:53:01] included in the any either retention
[1:53:03] payment. And the motion was to give him
[1:53:06] the $2,000 from the general fund.
[1:53:09] Thank you.
[1:53:11] [snorts]
[1:53:12] >> Any further discussion?
[1:53:15] Is this a board vote?
[1:53:18] Yes, since it involves.
[1:53:20] >> Yeah. Okay. Board vote.
[1:53:30] Motion carried.
[1:53:31] >> Thank you. It's all I have unless you
[1:53:32] have any questions for me.
[1:53:34] >> Okay.
[1:53:36] See if they need a break before we get
[1:53:39] into the rest of this agenda. Let's take
[1:53:41] about 10 15 minutes break. We'll come
[1:53:44] back.
[1:53:54] I have it
[1:54:14] trying to be a little slowly.
[1:54:18] The issues. Just
[1:54:47] » Yeah.
[1:54:54] Oh yeah.
[1:55:17] » Yes. It's not
[1:55:23] » they
[1:55:26] didn't really
[1:55:44] ask but they didn't
[1:55:53] Yeah, it was a long meeting.
[1:56:17] Yeah.
[1:56:19] >> Yeah. At the end they said that they
[1:56:20] partnered or they shared information
[1:56:23] with 1600.
[1:56:29] » So um also in that meeting they stated
[1:56:33] that um Anderson County as a whole only
[1:56:37] has four. Okay. And each
[1:56:42] >> each city within Anderson County has
[1:56:45] their own campus. So, um
[1:56:50] you would probably
[1:56:52] have to have forums in each different
[1:56:55] city to get within Anderson County to
[1:56:59] get those cameras pulled also.
[1:57:03] >> Yeah. Yeah. I'm just letting you know
[1:57:05] that
[1:57:06] county as a whole that those cameras
[1:57:09] that come before the commissions,
[1:57:11] there's only four.
[1:57:16] » Yeah. So, there's only three working.
[1:57:21] » Still three.
[1:57:24] >> Yeah, I did.
[1:57:29] » Yeah.
[1:57:44] two weeks.
[1:57:45] >> Yeah. And it's just um
[1:57:48] >> these cameras have been up like five
[1:57:51] years.
[1:57:57] » Apparently, it didn't come before the
[1:57:59] commission for approval either when they
[1:58:01] put I just
[1:58:06] did that also.
[1:58:43] Yeah, there is a gray outside that uh
[1:58:47] that form. So, um
[1:58:51] it doesn't doesn't look good for the
[1:58:53] cameras.
[1:59:02] Oh, wow.
[1:59:24] You're welcome.
[1:59:35] » That's it.
[1:59:48] Well, thank you. I hope
[1:59:59] » I almost did one of my
[2:00:03] citizen comments.
[2:00:12] Good.
[2:00:23] » No, sir.
[2:00:40] » Yes, you can.
[2:00:55] Hey James, how are you doing?
[2:01:09] » Yeah, my husband
[2:01:11] I'm gonna make them look dressed up.
[2:01:25] You do have very thoughtful
[2:01:28] representatives.
[2:01:43] You need to come get those.
[2:02:00] » Yeah.
[2:02:02] >> I got turned it a little this way.
[2:02:25] Oh yeah.
[2:03:05] by you. Take it out.
[2:03:18] My mouth gets so dry though.
[2:03:56] sharing your page.
[2:03:58] >> This is great. Great.
[2:04:01] >> Thank you.
[2:04:03] [laughter]
[2:04:13] Okay.
[2:04:31] Aaron's back.
[2:04:38] Where's my
[2:04:58] » Are you here for Tim?
[2:05:18] Aaron
[2:05:27] see well
[2:05:28] tell Michael Foster.
[2:05:44] » There he comes.
[2:06:02] Okay, the next item on the agenda is the
[2:06:05] uh director of schools has a written
[2:06:08] report.
[2:06:10] He's got a replacement here today. Dr.
[2:06:12] Parrot has to answer any questions.
[2:06:16] >> 10 shooters. [laughter]
[2:06:19] >> Hey, thanks for having me. Dr. parents
[2:06:21] at the state superintendence conference.
[2:06:23] So, I'm here to fill in. I'm Ben DS. Um,
[2:06:26] he sent you the de director's report.
[2:06:29] I'm just here to answer any question you
[2:06:30] have any questions. I will say that he
[2:06:32] and I walked the new Claxton school on
[2:06:35] Friday. Uh, and it's super impressive.
[2:06:37] Uh, looks really, really good. Uh, we're
[2:06:39] excited about that. Um, also another
[2:06:41] update. If you drive by our baseball
[2:06:43] fields at Clinton High School at the
[2:06:45] fairgrounds or at County High School,
[2:06:47] you'll notice that there's no lights.
[2:06:49] Um, so if you get any questions about
[2:06:51] that, uh, no fear. They're going back up
[2:06:54] really quick. Uh, but they're getting
[2:06:55] replaced. So, uh, new LED lights are
[2:06:57] going up at both high school baseball
[2:06:59] fields. We're super excited about that,
[2:07:01] too. But I'll answer any questions you
[2:07:02] have. Thanks for having me. Okay,
[2:07:06] >> Commissioner Wale.
[2:07:07] >> Thank you, Mr. Chair and Ben. Thank you
[2:07:08] for being here. Um, just it's probably
[2:07:11] in the report, and I'll be honest, I may
[2:07:13] have looked over it, but for the flu
[2:07:15] shots, is that going to be in process
[2:07:17] again this year?
[2:07:18] >> Yes. Okay. actually starting up very
[2:07:20] soon. Good.
[2:07:20] >> I think uh I think they're starting this
[2:07:22] week as a matter of fact.
[2:07:24] >> Thank you. Appreciate it.
[2:07:25] >> Yep. At all the schools and then central
[2:07:27] office and everybody. Yep.
[2:07:28] >> Awesome. Thank you,
[2:07:33] » Jeff.
[2:07:35] >> No, I was just going to say I appreciate
[2:07:38] you're doing a good job.
[2:07:39] >> Thank you.
[2:07:39] >> You know, it you're not one of these
[2:07:41] that go out and try to catch the
[2:07:42] limelight and everybody wants you to
[2:07:43] slap you on the back. You don't do that
[2:07:45] and I appreciate that. you just get the
[2:07:47] job done and I see that. Thank you.
[2:07:51] >> Thank you, sir.
[2:07:51] >> Thank you.
[2:07:53] >> Okay. The next item is law director's
[2:07:55] report
[2:08:04] items require no explanation. It
[2:08:07] contracts contracts contract zoning. Um
[2:08:12] there are five pending lawsuits that our
[2:08:14] office is handling.
[2:08:16] Uh we're in the process of negotiating a
[2:08:19] settlement hopefully with on the
[2:08:21] provision case. No activity with respect
[2:08:24] to Harbor versus Anderson County. The
[2:08:27] Williams Manor is coming up in November
[2:08:30] Library Association. I will tell tell
[2:08:33] you guys of course that Anderson County
[2:08:35] is out of that case that you've been
[2:08:37] dismissed. It's just the library board.
[2:08:39] And then the Smith versus Anderson
[2:08:41] County which was a mandamus claim by
[2:08:46] Brian Smith and his wife was dismissed.
[2:08:48] They have appealed it but there is a
[2:08:51] companion
[2:08:53] action going in front of the board of
[2:08:55] zoning appeals that may resolve it and
[2:08:57] I've talked briefly with their attorney
[2:08:59] Dino Cole about it. Information items,
[2:09:03] you know, there's a lot on there.
[2:09:05] Suppose the ones I would point to would
[2:09:06] be six indigent cremation. How many of
[2:09:10] you knew that we've got 17 cremated
[2:09:12] remains in our office? Uh we do. So
[2:09:17] we're working on some kind of uh
[2:09:21] standard operating procedure for the
[2:09:23] next person that comes down the road.
[2:09:25] and as far as accounting for the bodies
[2:09:27] and how long to keep them and things
[2:09:29] like that. Um
[2:09:32] uh the u general sessions 2ou there was
[2:09:37] a copy of our proposedou attached to my
[2:09:41] report. Uh since that came in I have
[2:09:44] received uh a redlined uh reply from uh
[2:09:49] Oakidge city attorney. Essentially uh
[2:09:53] they have rejected what we proposed to
[2:09:56] them as far as uh reviewing a change in
[2:10:01] the month the yearly amount each year.
[2:10:04] Um I think initially we said at 40,000
[2:10:08] um for four years with an option to
[2:10:12] renew. uh we wanted to revisit that each
[2:10:16] year that they have uh come back with
[2:10:19] 50,000 a year and then some minor issues
[2:10:24] with the uh notices and things of that
[2:10:27] nature, but that's the big that's the
[2:10:29] big difference right now.
[2:10:33] the u we are working on items 13 and 14.
[2:10:39] We are working on um
[2:10:42] revising the private act for the legal
[2:10:45] services advisory committee. We've also
[2:10:48] been uh or our office has been
[2:10:50] conducting a salary survey to get some
[2:10:53] idea of the parameters of what county
[2:10:55] attorneys or law directors are paid
[2:10:56] throughout the state to give the
[2:10:58] committee something to work off of. And
[2:11:01] let me let me take this opportunity
[2:11:03] guys. We're open all day every day and
[2:11:06] uh I know a lot of you are new. You are
[2:11:09] welcome to come by anytime. We do ask
[2:11:11] that you call first so that you'll know
[2:11:14] we're there. We probably should only
[2:11:16] have one commissioner at a time because
[2:11:18] of Toma, but uh we'd be happy to sit
[2:11:20] down and go with go over with you any
[2:11:24] report, anything in our office. Um
[2:11:27] that's why we're there. Um, and then
[2:11:31] finally, um, I guess those were the
[2:11:34] three big things. And I don't, you guys
[2:11:37] may have questions about any part of
[2:11:39] this, and I'll be happy to to answer if
[2:11:41] I can.
[2:11:46] » Any questions? Commission.
[2:11:48] >> Yeah, Mr. Chairman, if if you would, I'd
[2:11:51] like to read part of the status of
[2:11:53] cases, fending deadlines. It's real
[2:11:55] important to the people on Old Lake City
[2:11:56] Highway in that community. And in one of
[2:11:59] these, we just had an a fire there
[2:12:02] that's being investigated by personal uh
[2:12:04] for arson. And this is 301 through 347
[2:12:08] Old Lake City Highway. Case was heard in
[2:12:10] Chantry Court on July 22nd, 2026 and by
[2:12:14] parties agreement. An order has been
[2:12:16] submitted requiring the demolition and
[2:12:19] removal of all mobile homes, salvage
[2:12:22] material, cars, and tractor trailers
[2:12:24] located on the property. Pending entry
[2:12:27] by chancellor.5
[2:12:29] stick built structures located on the
[2:12:31] properties are reserved for an
[2:12:33] additional hearing to be termed subject
[2:12:34] to the entry of the courts order and
[2:12:37] 3708 Lake City Highway. case was heard
[2:12:40] in central court on July 22nd, 2026 by
[2:12:43] agreement of parties agreed order
[2:12:45] requiring the mobile home to be
[2:12:47] demolished and removed within 60 days of
[2:12:49] the entry of the court's order has been
[2:12:50] submitted. Thank you.
[2:12:57] » Okay, Jamie, we added under your the uh
[2:13:00] addition of the language to
[2:13:03] satisfy the flood map thing.
[2:13:05] >> Correct. And and simply what that is the
[2:13:08] way we commission approved it and we
[2:13:11] submitted it with an exhibit that had
[2:13:13] what's called panel numbers on it. Well,
[2:13:16] they didn't like that and that's okay.
[2:13:18] They've just asked us to take those
[2:13:20] panel numbers and incorporate them into
[2:13:22] the document that the mayor filed with
[2:13:25] you tonight instead and drop the
[2:13:27] exhibit. It changes nothing. It adds
[2:13:30] nothing. It doesn't take away anything.
[2:13:32] It just transfers the location of those
[2:13:34] panel numbers.
[2:13:35] >> Okay. You need a motion to approve that.
[2:13:38] Okay. Is there a motion to approve
[2:13:41] language changes? Have a motion and a
[2:13:44] second. Any discussion?
[2:13:46] >> What's the motion again? Now
[2:13:48] >> to remove the exhibit from the previous
[2:13:52] motion that commission approved
[2:13:55] and insert it manually inside the
[2:13:59] agreement. We It was just an attachment.
[2:14:02] Uh I passed down.
[2:14:05] >> Yeah. Commissioner Wandelle, when the
[2:14:08] [clears throat]
[2:14:08] >> I'm sorry.
[2:14:09] >> When the
[2:14:09] >> I got you.
[2:14:10] >> When it was passed,
[2:14:11] >> we uh we did it one way. They didn't
[2:14:14] like it and I understand why they would
[2:14:15] want it incorporated into the document
[2:14:17] and we
[2:14:18] >> I'm good.
[2:14:18] >> This is a FEMA thing. I swear I was
[2:14:21] unclear. Thank you.
[2:14:22] >> Okay. Any further discussion? If not,
[2:14:24] all in favor of the motion, let me
[2:14:26] saying I. [clears throat]
[2:14:27] >> Any opposed? Motion carried.
[2:14:29] >> Was flock camera. Was that moved to my
[2:14:32] report?
[2:14:32] >> Okay.
[2:14:33] >> Yeah,
[2:14:33] >> it was mentioned in your report. I think
[2:14:35] we put it under operations. Uh but we
[2:14:38] probably need some explanation from you
[2:14:40] >> Sure.
[2:14:40] >> on that.
[2:14:41] >> Well, I don't want you to get hung up on
[2:14:43] the phrase flock camera. It's a contract
[2:14:47] and the contract did not meet the
[2:14:49] requirements.
[2:14:51] Uh and
[2:14:54] at this point uh it's really
[2:14:57] commission's call. You can take it up
[2:15:02] and ratify it. There there is a
[2:15:04] provision in the law that permits the uh
[2:15:07] commission to ratify it. I would caution
[2:15:10] against that without having a a public
[2:15:12] debate about it because of TOMA. You can
[2:15:15] do nothing or you can refer and I think
[2:15:18] it would be back to the budget
[2:15:19] committee. And the reason I say that is
[2:15:22] it is uh monetary spending and um or or
[2:15:30] the sheriff can rebid it.
[2:15:33] I think those are the four options. But
[2:15:35] it has nothing to do with it just has to
[2:15:38] do with the parameters of the contract.
[2:15:40] It could be a contract for the uh
[2:15:42] service of widgets for you know it
[2:15:45] doesn't matter. It's just it's the um
[2:15:49] the way the contract was went forward
[2:15:52] and nothing to do with the contents of
[2:15:54] it.
[2:15:56] >> Okay. Mr. Wells, you have a motion.
[2:15:58] >> I would make a motion that we push this
[2:16:00] item to the budget agenda for October.
[2:16:02] Mr. Chairman
[2:16:05] have a motion and a second. Any
[2:16:07] discussion?
[2:16:10] Commissioner Wandell.
[2:16:12] >> Thank you, Mr. Chairman. I I'm going to
[2:16:14] vote against this. I think we have a
[2:16:16] contract that's not valid. I think we
[2:16:19] should terminate the contract. I
[2:16:21] understand the need to send it back to
[2:16:23] budget committee. I think we did the
[2:16:25] right thing as operations committee. We
[2:16:26] allowed the public to come speak. Uh
[2:16:29] every person that came spoke against it.
[2:16:32] I think as elected uh officials, our job
[2:16:35] is to represent the people of this
[2:16:37] county. And I think uh trying to pass
[2:16:39] this through again when it wasn't put
[2:16:42] through properly the first the second
[2:16:44] time. Let me rephrase that. And uh we
[2:16:46] don't have a valid contract. That's what
[2:16:49] the law director says. So I don't know
[2:16:51] why we'd push it back through the budget
[2:16:53] committee and try to make it right. I
[2:16:55] think we should move on. And but I'll
[2:16:57] just vote no on this motion. I just
[2:16:58] wanted to give my opinion. Thank you.
[2:17:03] » Commission.
[2:17:04] >> Thank you, Mr. Chair. from
[2:17:06] [clears throat] that uh special call
[2:17:08] meeting that we had. There was some
[2:17:10] questions asked to the flock safety
[2:17:13] representative and I haven't got those
[2:17:15] answers yet. So, I'll be voting no on
[2:17:17] this as well.
[2:17:21] » Okay.
[2:17:25] » Mayor,
[2:17:26] >> just a question. Um,
[2:17:29] so if it's sent to budget committee and
[2:17:33] I mean we've been told it's not valid,
[2:17:36] does the law director need to write a
[2:17:38] letter? Is it paused? What's the effect
[2:17:43] of being void and we're now aware that
[2:17:47] it's void? Do we need to for 30 days
[2:17:50] write them that we're pausing the
[2:17:53] program or that we're not paying or
[2:17:59] there would be a pause in the program.
[2:18:01] uh especially if it's
[2:18:04] I mean I don't know I don't know what
[2:18:06] commission's thinking is if if there's
[2:18:10] some uh if it's going back to the budget
[2:18:13] committee to be perhaps reconsidered for
[2:18:16] uh being ratified I think we we we
[2:18:20] notify flock and let them know that but
[2:18:22] if it's uh and you know we'll know after
[2:18:27] we'll kind of know where you're at after
[2:18:28] the October budget meeting it's coming.
[2:18:31] If it gets through there, it's coming
[2:18:34] ultimately to come back to commission to
[2:18:35] vote up or down on.
[2:18:38] >> I
[2:18:41] I've got a question.
[2:18:44] Uh Robbie, is this a monthly thing? Do
[2:18:47] we pay monthly or?
[2:18:49] >> It's annual.
[2:18:51] >> Annual.
[2:18:54] >> And have we paid?
[2:18:56] Currently, we have paid um in April of
[2:19:00] and the contract runs from or the PO was
[2:19:03] from de December to December. So, um
[2:19:06] we're paid through December of 26.
[2:19:15] » Okay.
[2:19:16] >> Is $11,000.
[2:19:18] Commissioner Pack,
[2:19:19] >> my concern with this, I know under the
[2:19:21] contract they're limited to the license
[2:19:23] plate reader only in the back of the
[2:19:25] car, but if that contract is out of
[2:19:28] date, can they do more since they're not
[2:19:32] contractually held just to do that
[2:19:34] license plate reader? Does that make
[2:19:36] sense? The contract
[2:19:39] is a two-sided thing. If that contract's
[2:19:42] out, if it said they just read the
[2:19:44] license plate, but that contract is
[2:19:46] expired, do they have the capabilities
[2:19:48] of doing more? Because they're not
[2:19:50] contractually held to do less, if that
[2:19:53] makes any sense.
[2:19:56] I don't even know capable of doing more,
[2:19:59] but
[2:19:59] >> no, they're they're not going to do
[2:20:01] that, guys. We don't do gunshot
[2:20:04] detection. We don't do we don't grab
[2:20:05] Bluetooth signals. We don't do facial
[2:20:09] recognition. We have LPRs. That's it.
[2:20:12] That's what we do. Um, from from that
[2:20:15] standpoint, I can promise you, for
[2:20:17] example, you have a pest control
[2:20:19] business, right? If I pay you just to
[2:20:22] come spray for roaches and I and our
[2:20:25] contracts up, are you just going to come
[2:20:26] treat my house for termites, too? Right.
[2:20:29] Just because you can. No. So, they're
[2:20:31] not going to throw in anything extra.
[2:20:34] Listen, the the original contract this
[2:20:37] body approved with flying colors.
[2:20:41] The new mobile camera came out something
[2:20:43] that we could physically move ourselves
[2:20:46] to uh to move to high crime areas or is
[2:20:50] needed, right? Whether it be mounted on
[2:20:52] our speed trailer or whatever the case
[2:20:54] is. We did that
[2:20:57] and the price they gave us we didn't
[2:21:00] agree with. We said, "We will pay what
[2:21:01] we pay for the first three cameras we
[2:21:03] have."
[2:21:05] They said, "You do that. We'll give you
[2:21:07] that price, but we want the extension."
[2:21:10] We took it to Jay downstairs, the
[2:21:12] contract they sent over. Jay Jagger
[2:21:14] looked at it. He blessed it. Said, "Sign
[2:21:17] it." Said, "It's just an amendment. You
[2:21:18] don't have to go back commission." So,
[2:21:20] in good faith, we did what the law
[2:21:22] director told us to. I understand
[2:21:24] standing here today, Jay got it wrong.
[2:21:26] Okay, I understand that. But Mr. Brooks
[2:21:29] is telling us that there is there's a
[2:21:32] remedy to this. It can be ratified uh
[2:21:35] starting in budget. Now, I get that that
[2:21:38] it's controversial and it's polarizing,
[2:21:40] but we're talking about LPRs, the same
[2:21:43] thing that THP has on the tops of their
[2:21:46] cars when they cruise through your
[2:21:47] jurisdictions, through your districts.
[2:21:50] We're talking about four. And we
[2:21:51] actually only have two operational
[2:21:53] because two have been vandalized.
[2:21:55] And for the commissioners that represent
[2:21:57] these municipalities,
[2:21:59] only thing you're doing is handicapping
[2:22:01] the sheriff's office. You're taking ours
[2:22:03] away. Oakidge Police Department, the
[2:22:05] Clinton Police Department, Oliver
[2:22:06] Springs, they're going to still have
[2:22:08] theirs.
[2:22:10] So th this is not
[2:22:13] I I'm and and to to the point of 75
[2:22:16] people and 31 speaking, that's not a big
[2:22:19] enough sample size of a county of 80,000
[2:22:21] people for me to make that decision on.
[2:22:24] I'm telling you, this is an incredible
[2:22:25] tool for us and it's simply we're simply
[2:22:28] it it is just generates leads. We're not
[2:22:30] getting warrants. We cannot pull it up
[2:22:33] by race, gender. It is a picture, not a
[2:22:38] video. It is the picture of the back of
[2:22:39] a literally no different than what the
[2:22:42] deputy does when he's going down the
[2:22:44] road and he calls an attack.
[2:22:48] ABC123 display on a white Dodge Astro
[2:22:52] van.
[2:22:54] It's the same information, guys. There's
[2:22:56] nothing cryptic to it.
[2:22:59] I ask that you send this to budget and
[2:23:01] let's see if we can get this ratified.
[2:23:03] Uh because I think I think that at the
[2:23:06] end of the day, if if if we concede to
[2:23:10] the to the what I believe is going to be
[2:23:11] the minority, I think if you could get
[2:23:13] this on a ballot, they'll let the voters
[2:23:15] vote, I think I think you would see that
[2:23:17] the bulk of Anderson County would be for
[2:23:19] it. Um and and if we're going to really
[2:23:22] take the position that we're going to
[2:23:25] ban technology or items because the
[2:23:29] potential for abuse, like I said at the
[2:23:32] town hall, then get ready just to give
[2:23:34] your guns up and while we're at it,
[2:23:36] let's get rid of pain medicine because
[2:23:39] my mom might be on hospice, but she may
[2:23:41] have a grandson that may misuse that and
[2:23:43] abuse that those opioids. So, I mean, we
[2:23:47] cannot live like that and operate like
[2:23:49] that. And and I think
[2:23:53] what we're all for in law enforcement at
[2:23:55] least is we're looking for for stronger
[2:23:58] guidelines. And if if we have an
[2:24:00] officer, particularly an Anderson County
[2:24:02] deputy who's misusing this, they
[2:24:04] absolutely ought to be terminated. And I
[2:24:05] have zero qualms with them being charged
[2:24:07] criminally. They should be if they're
[2:24:10] misusing it. But we got zero evidence of
[2:24:14] that. And you're talking about
[2:24:15] approximately 40 cameras between
[2:24:17] municipalities and the sheriff's office.
[2:24:19] We have four.
[2:24:21] And at the end of the day, if there's a
[2:24:23] critical incident, a case we can't solve
[2:24:25] or we can't get to somebody in time,
[2:24:28] I will bring the victim and the family
[2:24:30] here to this body and let you guys tell
[2:24:32] them why we didn't have that tool. I
[2:24:34] won't make that phone call because the
[2:24:37] hysteria that's been drumed up over
[2:24:40] flock.
[2:24:42] So much of it just simply isn't true. It
[2:24:45] just isn't.
[2:24:48] >> There's a remedy here. You send it back
[2:24:50] to budget.
[2:24:53] Commissioner Vil. [clears throat]
[2:24:55] >> Thank you, Mr. Chairman. Uh
[2:24:58] since the motion was made by
[2:25:00] Commissioner Wells and thank you for
[2:25:02] that, sir. And it was seconded.
[2:25:04] The motion on the floor was send it back
[2:25:06] to budget.
[2:25:07] >> The reason we were going to send it back
[2:25:09] to budget was because the law director
[2:25:10] brought to us a concern that dealt with
[2:25:12] the contract of the cameras.
[2:25:14] >> Yes,
[2:25:15] >> that's what the topic of the
[2:25:16] conversation was. We did exactly what
[2:25:19] the law director warned us not to do. We
[2:25:22] started talking about the actual cameras
[2:25:25] themselves. Okay? And I get that hot
[2:25:28] button issue. Okay. But please, can we
[2:25:32] send this issue to the budget committee?
[2:25:35] Let's talk about the issue with this
[2:25:36] contract. Let's decide whether or not
[2:25:39] we're what we're going to do about this
[2:25:42] contract. There will be a time for this
[2:25:45] continuing conversation about are the
[2:25:48] cameras good or are the cameras bad. We
[2:25:50] can have that conversation at some
[2:25:51] point.
[2:25:53] That's not what this is about. I think
[2:25:54] we're trying to marry two issues that
[2:25:56] need to be divorced. give you a common
[2:25:58] question.
[2:26:00] >> No, I'm not going to do that.
[2:26:01] >> Commissioner Val, I agree 100% with you,
[2:26:03] but the the fact of the matter is they
[2:26:05] can't be separated because if not for
[2:26:11] the the media coverage and all the
[2:26:14] chatter on social media,
[2:26:16] you guys would send this back to fix it.
[2:26:19] No questions asked.
[2:26:22] If it were anything else other than
[2:26:24] LPRs, it would simply be sent down and
[2:26:26] we'd already been gone tonight.
[2:26:29] So, I appreciate the law director. I
[2:26:31] appreciate your words, but at the end of
[2:26:32] the day, they are married together.
[2:26:34] They're more than married together.
[2:26:36] They're Siamese twins. You can't have
[2:26:38] one without the other.
[2:26:40] >> Commissioner is Bill.
[2:26:41] >> Thank you, Mr. Chairman, for actually
[2:26:44] allowing me to speak on this twice,
[2:26:45] maybe, and I'll do it quick. uh what
[2:26:47] comes into play in what we took up was
[2:26:51] the constitutionality
[2:26:53] and I think there is an a opinion from
[2:26:57] the state attorney general. Is that
[2:26:59] correct? Have you seen that?
[2:27:00] >> I've not seen that.
[2:27:01] >> Okay. AG I know he did a interview and
[2:27:04] gave his opinion there and I'm not quite
[2:27:07] sure you know I don't know if the mayor
[2:27:09] has that opinion yet or not or but
[2:27:11] anyway he gave his opinion and but he
[2:27:14] thinks it should go to the state
[2:27:16] legislature
[2:27:18] you know for them to make a decision on
[2:27:20] as well but the uh
[2:27:25] like I said and and the sheriff is right
[2:27:28] and we got a great sheriff's department
[2:27:30] we got some of the best inst
[2:27:31] investigators in the country. I
[2:27:33] [clears throat] can tell you because I
[2:27:33] know firsthand. But we're sworn to
[2:27:36] uphold the Constitution and and that's
[2:27:38] where I'm coming from. Thank you.
[2:27:41] >> Commissioner E Caps.
[2:27:43] >> My questions again about the policy that
[2:27:46] you have in place for how if an officer
[2:27:50] does access the data, what are the what
[2:27:54] are the punish what's the punishment?
[2:27:56] >> So I if we were
[2:27:58] >> Mr. Chairman, I have to call point of
[2:27:59] order. motion on the floor is referred
[2:28:01] to budget and I with all due respect
[2:28:03] commissioner part of this referring it
[2:28:05] to budget is so we can deal with the
[2:28:06] actual contract at hand. If I'm out of
[2:28:09] line for saying this I assume operations
[2:28:10] can bring up the constitutionality at
[2:28:12] your next operations meeting and we can
[2:28:14] discuss both at the full commission. I
[2:28:15] just feel there's going to be redundancy
[2:28:16] next month on the same the same thing.
[2:28:20] >> yeah,
[2:28:21] >> I'll get with you.
[2:28:22] >> Well, that that's going to influence how
[2:28:24] I vote
[2:28:27] >> to to to your point. Um, I offered that
[2:28:30] night at the town hall,
[2:28:33] um, anyone who wanted it, our policy on
[2:28:38] flock, right? I had zero takers. I got
[2:28:41] my first request for our policy
[2:28:46] two hours before this meeting started by
[2:28:47] someone who wasn't in attendance. They
[2:28:51] just got curious on their own. So that's
[2:28:54] why part of my part of me believes that
[2:28:57] it's it's not the issue that everybody
[2:28:59] says it is because nobody's really doing
[2:29:01] homework. They're they're just both
[2:29:04] sides are hitting talking points. So but I'll be more than happy to send it
[2:29:09] to you. I'll send it tonight.
[2:29:11] >> Commissioner Palmer.
[2:29:12] >> Um so will you take this as a second
[2:29:15] request or do I need to send you an
[2:29:17] email because I would like to have those
[2:29:19] policies.
[2:29:19] >> No. Yeah, I'll take it a second request.
[2:29:20] You'll have it. And um the what I wanted
[2:29:23] to point out is when that first contract
[2:29:25] was voted upon 12 of us or I guess 11 of
[2:29:28] us were not did not see the contract. So
[2:29:31] I am for sending this to budget because
[2:29:33] I want to see the contract and see uh
[2:29:36] what he is that everything that he is
[2:29:39] saying is true. Not that I don't believe
[2:29:41] you. It's just I want to see it in
[2:29:44] writing and [cough] I will do
[2:29:45] [clears throat] my homework. Thank you.
[2:29:47] >> Okay.
[2:29:50] Okay, I have a motion and a second
[2:29:52] to refer to the budget committee the
[2:29:55] flock camera
[2:29:58] contract.
[2:30:01] Any further discussion? If not, all in
[2:30:04] favor of the motion
[2:30:05] >> vote, please.
[2:30:06] >> Uh board vote requested.
[2:30:10] [clears throat]
[2:30:28] Motion pass. [clears throat]
[2:30:41] » Next items the operation committee.
[2:30:42] Commissioner Iswell. Mr. Chair,
[2:30:45] >> first under the mayor's report,
[2:30:47] Commissioner Barry made a motion to
[2:30:48] support the TNCP
[2:30:50] participation. Second by Commissioner
[2:30:52] Pack. Motion passed uh to forward the
[2:30:55] full commission for approval.
[2:31:01] Is there a motion?
[2:31:04] Have a motion and a second. Any
[2:31:06] discussion?
[2:31:08] If not, I'll in favor of the motion
[2:31:10] saying I.
[2:31:11] >> I.
[2:31:12] >> Any oppose? Motion carried.
[2:31:15] >> Under strategic planning, Commissioner
[2:31:18] Mo Commissioner Palmer made a motion to
[2:31:20] have a workshop on October 30th from
[2:31:22] 8:30 to 4:00 at the Anders County
[2:31:24] Chamber of Commerce. Motion passes
[2:31:27] forward full commission for approval.
[2:31:31] >> Have a motion and second.
[2:31:33] Any discussion?
[2:31:35] If not, all in favor of the motion, let
[2:31:37] me know saying I.
[2:31:39] >> Any opposed? Motion carried. Anders
[2:31:42] County 2027 holiday schedule.
[2:31:44] Commissioner Vin made a motion to
[2:31:46] approve the 2027 holiday schedule.
[2:31:48] Seconded by Commissioner E. Capshaw.
[2:31:50] Motion passed forward to full commission
[2:31:52] for approval.
[2:31:57] » Have a motion and second. Any
[2:31:59] discussion?
[2:32:01] If not, all in favor of the motion
[2:32:03] saying I. I.
[2:32:04] >> Any opposed? Motion carry.
[2:32:08] >> That concludes all the action items of
[2:32:09] the operations committee report.
[2:32:14] Okay, next item is the road committee.
[2:32:16] Commissioner Evony Capsaw.
[2:32:19] >> Ro committee was called to order. Um at
[2:32:21] 407.
[2:32:23] Um we did have a I did want to highlight
[2:32:25] we did have a citizen uh Miss Jordan who
[2:32:28] wanted to thank the road superintendent
[2:32:30] and highway department for their good
[2:32:32] work performed on Bank and Spring Bacon
[2:32:34] Springs Road and Key Springs Road. Um
[2:32:37] Commissioner action items. Commissioner
[2:32:39] Wandell made a motion to pass speed
[2:32:40] limits for Philips Frill Frills Road 20
[2:32:44] mph, Strawberry Lane 25 miles per hour,
[2:32:47] Mike Miller Lane 20 miles hour.
[2:32:49] Commissioner Ispel seconded motion. Um,
[2:32:52] make a motion to approve. It's the only
[2:32:55] action item.
[2:32:57] >> Have a motion and a second. Any
[2:32:59] discussion? Commissioner Palmer. Um just
[2:33:02] a clarification, do we approve the
[2:33:05] minutes of committees
[2:33:07] or do we just approve the action items
[2:33:10] that are
[2:33:10] >> just the action items?
[2:33:11] >> Okay, so the motion would be just to
[2:33:13] approve the uh speed limits for
[2:33:16] Strawberry Lane, Mike Miller, and the
[2:33:19] other ones. Correct.
[2:33:20] >> Yes.
[2:33:21] >> Okay. So, can is that the motion on the
[2:33:24] floor?
[2:33:25] >> Yes. Okay.
[2:33:28] >> Thank you, Chad. That second. Okay. Any
[2:33:31] discussion? If not, all in favor of the
[2:33:34] motion by saying I.
[2:33:35] >> I.
[2:33:36] >> Any oppose? Motion carry.
[2:33:41] Next item. Fire commission. Commissioner
[2:33:43] Wandelle.
[2:33:44] >> Mr. Chairman. Uh, we didn't meet last
[2:33:45] month, but I have the minutes here
[2:33:47] before me for July. I believe it is, or
[2:33:50] maybe it's August, it looks like. Uh,
[2:33:52] the only action item I guess that was on
[2:33:53] there was a motion to make Josh Lane
[2:33:55] primary representative and Tim Roach
[2:33:58] secondary representative for E911
[2:34:00] Advisory Group. Made by Dusty Sharp,
[2:34:03] seconded by Tyler Kick.
[2:34:10] » Is we need to take action on that?
[2:34:13] >> I don't know.
[2:34:13] >> I don't think so.
[2:34:14] It's just committee.
[2:34:17] >> It's just
[2:34:18] >> But that's all I have. We will be
[2:34:19] meeting uh coming up this month. Uh I
[2:34:22] don't have the date in front of me.
[2:34:23] Usually first Tuesday I believe it is.
[2:34:27] >> Okay. Was the fire fire commission was
[2:34:29] there any vacancies on that committee?
[2:34:32] >> Yeah. Tim took it.
[2:34:35] >> Okay. Okay.
[2:34:38] >> Okay. Next item.
[2:34:39] >> Served on it for years and then came
[2:34:41] away.
[2:34:43] >> Next item is any unfinished business.
[2:34:46] >> Yep. Under new business. We have the
[2:34:50] finance committee.
[2:34:52] >> Yeah.
[2:34:54] >> No unfinished business.
[2:34:55] >> Yeah.
[2:34:57] >> Oh, that's what I was.
[2:34:58] >> Okay. Okay. Under new business, finance
[2:35:01] committee appointment of
[2:35:06] >> in front of us, whoever who's on there
[2:35:07] now. And and my question would be, is
[2:35:10] there another sitting commissioner that
[2:35:12] would like to have that spot?
[2:35:15] >> Mr.
[2:35:17] I know Denise and I had spoken earlier
[2:35:19] about um that would not be on this
[2:35:23] agenda. There's a public notice going
[2:35:25] out running the courier on the 30th
[2:35:27] since Bill Jagger did put his name in.
[2:35:30] The deadline for applications is October
[2:35:32] the 9th. So that'll be on next month.
[2:35:39] » We didn't lose anybody offer
[2:35:50] So will this be an addition?
[2:35:51] >> It will be an addition. So I guess if
[2:35:53] you any other citizens
[2:35:54] >> chairman
[2:36:00] » there are four openings because all
[2:36:02] commissioner seats are open.
[2:36:03] >> Okay.
[2:36:04] >> So the the only ones that are statute is
[2:36:06] the mayor, the director of schools and
[2:36:10] the highway the other four positions. We
[2:36:13] had it on the agenda for September 1st.
[2:36:14] We didn't take action on them because we
[2:36:16] were going to do it tonight and then so
[2:36:18] all four positions are open. I don't
[2:36:21] remember who all applied but then we did
[2:36:23] not take action on it because we had a
[2:36:24] member from the community that wanted to
[2:36:26] apply.
[2:36:37] Guess I've got the floor. I was going to
[2:36:38] make a motion that we um nominate Phil
[2:36:42] Jagger to the finance committee. I'm
[2:36:44] happy to take reference from Mr. Brooks
[2:36:45] or Mr. Chairman on if we should delay
[2:36:48] this a month, allow the the public input
[2:36:52] you were going to second. So, I'll defer
[2:36:54] Mr. Commissioner Wandelle.
[2:36:56] >> Well, well, I think based on if it's out
[2:36:59] been put out in the paper, we have to
[2:37:01] wait till October. We can't just appoint
[2:37:03] him.
[2:37:04] >> So, I'll I'll remove my
[2:37:05] >> Yeah.
[2:37:06] >> my motion from the floor.
[2:37:07] >> And I'll I didn't know that, but I I'll
[2:37:09] remove mine, too, Mr. Chairman.
[2:37:12] >> Chairman Mckame. Um, if I could add to
[2:37:14] the the finance committee is made up of,
[2:37:16] like you, Commissioner Foster said, the
[2:37:18] mayor, the road superintendent, and the
[2:37:19] school superintendent are three
[2:37:20] permanent members. The other four
[2:37:23] members do not have to be from the
[2:37:24] commission body. They can be citizens.
[2:37:26] We've never had one
[2:37:30] want to serve, but since Commissioner J,
[2:37:33] former Commissioner Joerger asked to
[2:37:35] serve, then I feel like we they should
[2:37:37] public notice and off, you know, so
[2:37:39] other citizens can have the opportunity
[2:37:42] as well. If um they would like
[2:37:44] >> I'm on I'm on it, aren't I?
[2:37:46] >> Yeah,
[2:37:46] >> you are. Yes.
[2:37:49] >> Currently, it's Commissioner Wandelle,
[2:37:51] Commissioner Isabel, Commissioner
[2:37:52] Foster, and Commissioner Palmer, and the
[2:37:54] three permanent members. So that's why I
[2:37:57] none of the commissioners that were on
[2:37:59] the finance committee lost the election.
[2:38:01] So that's why I said there was no
[2:38:02] openings. But I understand that each
[2:38:04] year, but we do have a citizen now that
[2:38:07] wants to be on the committee and that is
[2:38:08] an allowable under the 81 law
[2:38:11] >> that is allowed.
[2:38:12] >> It is all four positions could be
[2:38:13] citizens. Doesn't have to be commission.
[2:38:16] >> So I just wanted to clarify that.
[2:38:18] >> Okay. Were the previous members
[2:38:21] have a term or was their term up or
[2:38:24] >> Well, I think we took this up a year
[2:38:26] ago. So, we are we doing this each year,
[2:38:28] Mike?
[2:38:28] >> Every position on committees are a
[2:38:31] one-year term. There are no terms.
[2:38:32] They're just every September 1st, we
[2:38:35] have to pick new committees.
[2:38:37] That's what our rules say.
[2:38:41] » And that's what we did on September 1st
[2:38:44] except for finance. And then I think
[2:38:46] there was one other one that we didn't
[2:38:47] have enough but I think we end up
[2:38:49] filling it.
[2:38:51] >> Okay. So what you're saying now then is
[2:38:53] that we have four opens on finance
[2:38:57] committee.
[2:38:58] >> There are four positions that are
[2:39:01] available to be picked from.
[2:39:04] >> Okay. Three are statutory that cannot
[2:39:06] they have to be a certain position. the
[2:39:07] other four. You know, traditionally,
[2:39:09] like I said, it's been four
[2:39:10] commissioners since we, you know, since
[2:39:12] the committee was put together, but it
[2:39:13] doesn't have to be. And we've never had
[2:39:14] somebody from the public be interested.
[2:39:17] >> So, it's being advertised
[2:39:21] 9:30.
[2:39:22] Deadline for applications is October the
[2:39:25] 9th.
[2:39:26] >> Okay.
[2:39:28] So, there's no action to be taken.
[2:39:30] >> Mr. Mr. Chair, I just say that the
[2:39:32] finance [clears throat] committee wasn't
[2:39:34] meeting until October anyway. So, there
[2:39:36] was plenty of time to put them put this
[2:39:40] committee in place before
[2:39:42] um before they met. [clears throat]
[2:39:44] >> So, Commissioner Wells, I we've got it
[2:39:47] on the agenda, so we need somebody you
[2:39:48] want to defer it October. I'll
[2:39:51] >> make a move. I'll second
[2:39:58] » have. Excuse me. Motion to defer.
[2:40:05] Any discussion?
[2:40:08] All in favor say I.
[2:40:10] >> I.
[2:40:10] >> Any opposed?
[2:40:12] [clears throat] Motion carried.
[2:40:15] Any announcements,
[2:40:17] Mr.
[2:40:18] >> Chairman.
[2:40:21] I got two and I got a question
[2:40:24] about the minutes and
[2:40:27] like say fire commission minutes instead
[2:40:30] of waiting till 30 days from then if we
[2:40:34] took the minutes of the meeting,
[2:40:36] somebody took the minutes of the
[2:40:37] meeting, could those be voted on at the
[2:40:39] end of the meeting so they could be go
[2:40:41] ahead and submitted for our next full
[2:40:43] county commission meeting or do we
[2:40:45] always have to wait 30 days? Because to
[2:40:48] me, if you're doing the minutes and all
[2:40:50] those people are present, it's going to
[2:40:52] be fresh on their mind and they can
[2:40:54] either accept or decline. But I was just
[2:40:57] wondering if we could do that.
[2:41:03] » I just Sorry. I don't think and I I'll
[2:41:06] lead to law director. I don't think
[2:41:08] they're not written meetings you're
[2:41:09] approving. like unless somebody's
[2:41:11] writing them then like I just don't know
[2:41:15] that that [clears throat]
[2:41:17] word for word checking them that kind of
[2:41:18] thing no time to review then it's like
[2:41:21] do that to be added to the agenda to be
[2:41:23] approved that's would be my question I
[2:41:25] just
[2:41:25] >> yeah well where I'm coming from
[2:41:27] >> I was going to get one of those AI
[2:41:29] >> because everybody's doing it I'm going
[2:41:31] to learn how to use it
[2:41:32] >> uh anyway they do the minutes
[2:41:35] >> for you and you could read them and you
[2:41:37] could approve them because what happens
[2:41:39] is sometimes if you wait 30 days those
[2:41:42] same people are not at the meeting
[2:41:44] >> and then some people was there and and
[2:41:46] you know I feel like if I'm not at the
[2:41:47] meeting I have to abstain because I
[2:41:49] don't know what was talked about but I
[2:41:51] was just asking a question if we could
[2:41:52] do that
[2:41:54] >> law director you got an opinion on this
[2:41:56] >> not tonight but I mean I don't I mean
[2:41:59] just just the accuracy would be the
[2:42:01] concern. Um
[2:42:02] >> I I think it'd be more accurate if you
[2:42:04] do it right then because everybody said,
[2:42:05] "Yeah, you're right. That's what we
[2:42:07] said." Then waiting 30 days. But that's
[2:42:09] just my opinion.
[2:42:14] » I I think Mr. Chairman like if you look
[2:42:16] at operations committee for instance,
[2:42:18] that is a subcommittee of commission
[2:42:21] then
[2:42:23] you know that's an action that's coming
[2:42:25] before you. But for instance,
[2:42:28] let's take our animal advisory group
[2:42:30] that has citizens on there, other
[2:42:33] members and that committee is required
[2:42:37] to approve its own minutes and that's
[2:42:40] why you have to wait why you wait till
[2:42:43] they approve it and then it comes and appears. So I probably I mean there
[2:42:49] might be a way just to we'd have to
[2:42:50] break it down by committee to to see
[2:42:53] exactly which ones that we're talking
[2:42:55] about.
[2:42:56] >> Yeah. I I know sometimes that you know
[2:42:58] it just delays things by having to wait
[2:43:00] 30 days or whatever. But it was just a
[2:43:03] thought and then I wanted to say that I
[2:43:05] support my fellow commissioner bow on
[2:43:07] the library board. I mean he tries hard.
[2:43:11] uh he he takes a lot of grief from
[2:43:14] people but he's doing the best that he
[2:43:17] can.
[2:43:20] I I was just going to add that's what I
[2:43:22] was going to say about the minutes as
[2:43:23] well plus it also you know they have to
[2:43:27] approve it at the beginning the minutes
[2:43:29] from last time if there's action items
[2:43:32] the action items would come to the
[2:43:34] regular agenda immediately but the
[2:43:37] minutes would be would would I mean we
[2:43:41] would be approving it as a body before
[2:43:43] the committee itself approved their
[2:43:45] minutes if we did it that Okay.
[2:43:59] » I have one. Okay.
[2:44:00] >> We have the um [clears throat]
[2:44:02] the antique festival, Michael.
[2:44:04] >> The first weekend in October, it's
[2:44:07] downtown Clinton, the second and the
[2:44:09] third, and it is a really big a big
[2:44:12] deal. We've got lots of good
[2:44:14] entertainment, lots of good shopping.
[2:44:16] So, come on down to Clinton on October
[2:44:18] the 2nd and 3rd. And also wanted to let
[2:44:21] you guys know that on that Saturday um
[2:44:24] the 3 at 8:30 that morning before the
[2:44:28] festival, there will be we will be
[2:44:30] having our fifth annual prayer walk for
[2:44:33] Anderson County. Every year it grows and
[2:44:36] so um come on down even a little earlier
[2:44:39] for the prayer walk. Thank you. Anything
[2:44:43] else?
[2:44:46] Clarice speak adjourned.
