[0:05] All right,
[0:06] call this meeting to order. It's
[0:08] planning commission hearing and meeting
[0:09] March 11th, 2026. It's currently 6 p.m.
[0:12] and we'll start with the pledge of
[0:13] >> allegiance.
[0:16] I aliance to the flag of the United
[0:20] States of America and to the republic
[0:22] for which it stands, one nation under
[0:25] God, indivisible, with liberty and
[0:28] justice for all.
[0:32] Roll callish
[0:34] here harsh here. Bradley F here
[0:38] running here.
[0:39] >> Any conflicts of interest disclose?
[0:42] >> No. All right.
[0:43] >> Then I will open up the hanging item
[0:45] number one ordinance 0202608
[0:48] amend title 10.02.050
[0:50] building permit required 10.10.02
[0:54] agricultural zone and 10.10.050 050 RV
[0:58] rule state zone uh to allow water meters
[1:01] and service without a building permit
[1:03] and allow animal enclosures in the front
[1:04] and side yard of people's property.
[1:07] Rich, would you like to make any
[1:08] comments?
[1:10] >> Matter of fact,
[1:11] >> I figured
[1:13] >> a little comment here. I wrote this out
[1:17] in a little bit of a hurry, but it may
[1:20] not kind of fit in some partic.
[1:26] Okay. Richard Osaski 1024 West Little
[1:29] Pennyway, Apple Valley, Utah.
[1:32] This is about the animal enclosure
[1:34] amendment resing only that allows the
[1:37] placement of animal enclosures from the
[1:40] rear of the yard to the side and front.
[1:43] I met with a prominent local realtor,
[1:45] Porter team. Ron was his name. They he
[1:48] says this was this will affect your
[1:53] property values and not in a good way.
[1:55] But who cares about property values when
[1:58] the PC chair and the mayor live on a
[2:00] gated complex with 5 acre plus lots on
[2:03] 280 acres? They don't have to worry
[2:06] about what is next door to them. Now all
[2:10] we have in our area is smelly air and
[2:12] dust. Gone is the fresh air. It wasn't
[2:15] that way when I moved here in 2009. No
[2:19] wonder it is hard to sell property here.
[2:21] There isn't any incentive to improve
[2:24] one's property.
[2:25] Why waste good money on something that
[2:27] will not bring back a return? Our mayor
[2:31] put into a resolution of a code of 300
[2:34] ft for a nuisance complaint. That
[2:36] doesn't help me when I have to roll up
[2:38] my windows as I drive by a front yard
[2:42] animal enclosure that is overloaded with
[2:44] horses, cows, and chickens
[2:47] or close my windows when the wind is
[2:50] blowing 25 miles in my direction. So why
[2:53] is the 300 ft resolution enforced but
[2:57] not the code violations? In my
[3:00] neighborhood, there have been a
[3:01] violation of front animal
[3:04] enclosures with chickens and goats since
[3:07] August 525.
[3:09] The first of three nuisance complaints,
[3:11] the last one dated February 2nd, 2026
[3:15] without any response until now with this
[3:17] code change. There were other complaints
[3:21] but they were over the 300 foot allowed
[3:24] allowance according to the code
[3:26] enforcer. As a matter of fact in our
[3:28] area the animal point system of cleaning
[3:31] and of horses and cow pins are not being
[3:34] enforced. So, one So, when a complaint
[3:38] comes in about a smell or not cleaning
[3:41] up after the animal in the front side
[3:43] yard, are you going to amend the section
[3:46] of the code to eliminate my violation?
[3:50] I don't come here without a solution.
[3:54] I have one. It is so simple,
[3:58] something myself and the majority would
[4:00] agree to. Let's have the mayor do one of
[4:03] his official Facebook surveys. And the
[4:06] question will be, should the town of
[4:09] Apple Valley do away with all nuisance
[4:12] complaints? No one likes nuisance
[4:15] complaints. Residents would rather
[4:17] ignore the violation or think it will
[4:20] never be next to them or even sell their
[4:23] house. To prove my point, let's show a
[4:26] show of hands of anyone in the room.
[4:29] Nope. anyone in the room or online that
[4:32] has ever turned in a nuisance complaint
[4:34] or have you verbally complain and was
[4:36] told to turn one in. They are not
[4:39] enforcing the why bother.
[4:43] I looked up several small towns around
[4:45] the area, couldn't find one that allowed
[4:48] animal enclosures in the front yard.
[4:51] There isn't any incentive to prove one's
[4:53] property. Why waste good money on
[4:55] something that will not bring back a
[4:57] return? This amendment is contradicting
[5:02] other code and I think it should be
[5:05] tabled. For instance, section F states
[5:09] 30 ft from the property line. Then the
[5:11] amendment G says 10 ft from the property
[5:14] line and then 10-02-051
[5:18] of the billing permit says 50 ft from
[5:21] the property line. You can't have it
[5:24] both ways. Let's be honest, Apple Valley
[5:27] code enforcer is not going to enforce
[5:29] setbacks anyway. Final thoughts of the
[5:32] town.
[5:34] Let's go back to the beginning and be
[5:37] the laughing stock of Washington County
[5:41] or just plain go backwards.
[5:44] Thanks.
[5:46] >> Thank you, Re. Any other comments?
[5:49] Anyone online?
[5:52] >> Want to make a comment?
[5:53] >> Yeah, sure.
[5:54] I've uh filed a complaint, a verbal
[5:56] complaint that was immediately addressed
[5:58] twice.
[5:59] >> But you're you and I'm I me it's
[6:02] different.
[6:02] >> You ask if anybody filed complaint and
[6:05] had it helped.
[6:06] >> Yes.
[6:09] >> Nobody in our neighborhood has.
[6:12] >> All right. There's no online then I will
[6:15] close the hearing. Item number one,
[6:17] ordinance 0202608, amend title
[6:19] 10.02.050,
[6:21] building permit required 10.10 10.02A
[6:25] agricultural zone and 10.10.050
[6:28] RE state zone and we'll move into
[6:31] discussion possible action. Item number
[6:33] two, ordinance 0202608 amend title
[6:36] 10.02.050
[6:38] building permit required 10.10.02
[6:41] agricultural zone and 10.10.050
[6:44] rule state zone. You want to say
[6:46] anything about it, mayor?
[6:47] >> Yes, sir.
[6:49] I do agree with Rich on something and I
[6:51] would like to request that you guys when
[6:54] you consider your recommendation or your
[6:57] proposal on this on page number four in
[7:00] green you have letter oh my gosh it
[7:03] looks like G my glasses on item one and
[7:07] two I would like those eliminated from
[7:08] the recommendation if if you guys agree
[7:11] with that um I will approach that to
[7:13] council al also as I agree with Rich it
[7:15] is contradictive um I think having 50 ft
[7:18] away from the house and 30 ft from the
[7:20] property line is already in the
[7:21] ordinance up there and um I didn't catch
[7:24] it when I proof read it. Me and Bradley
[7:25] had talked about it earlier today and we
[7:27] were already planning that. So um that
[7:29] would be up to you guys. It's in the
[7:30] proposal, but I think when we get to
[7:32] council, that's going to be my
[7:33] recommendation to council is we just
[7:34] eliminate number one or number two and
[7:36] number G. That's it. Um I did do a poll
[7:40] on Facebook.
[7:42] >> Good.
[7:42] >> And uh I think there was only two people
[7:44] that didn't want animals in front yards.
[7:47] Um, and so that would put the everybody
[7:50] majority of people that voted on
[7:51] Facebook didn't care. If you drive
[7:53] around town, they're already doing it.
[7:55] Um, there's many other problems. Um,
[7:57] what people don't understand about
[7:59] property values is, sure, if you want to
[8:01] sell your property, um, property values,
[8:05] of course, you're worried about property
[8:07] values, but most people are here to stay
[8:08] longterm. If you're leaving, how much do
[8:11] I have to worry about you? You're not a
[8:12] registered voter. You're not going to
[8:13] live here anymore. But if you're
[8:14] staying, I worry about you. And if
[8:16] property values go up, you know what
[8:18] else goes up with that? Your taxes. So
[8:20] remember that. Every time property
[8:22] values go up around here, you long-term
[8:23] people, your taxes are assessed every
[8:26] year. And your property taxes go up. So
[8:28] yeah, you may make when you go to sell
[8:29] it 20 years from now, you may make
[8:31] another 10 20,000. I have a friend that
[8:34] bought a house uh 20 years ago and 30
[8:37] years ago in Compton and paid a little
[8:39] less than 100,000 for it and now it's
[8:41] valued at almost a million dollars.
[8:43] 920,000. Never no improvements, nothing.
[8:45] just kept it up. So, don't talk about
[8:47] property values and animals and some
[8:50] junk piles over here. It doesn't really
[8:52] affect property values like people think
[8:53] it does. So, but if it does, you don't
[8:55] want your taxes to go up anyways.
[8:59] » All right. Yeah. So, this the amendment
[9:01] does two things. Allows for allows for
[9:03] water meters before a building permit to
[9:07] um and then it allows for animals in the
[9:09] front and backyards. But I agree with
[9:12] the mayor. If you look at item number G,
[9:14] it does say setbacks are 10 and 15 ft.
[9:16] And then right above in in item F, it
[9:19] says uh 30 ft and 50 ft. So if we do
[9:23] recommend approval, we'd want to
[9:26] >> get rid of that.
[9:27] >> Can you motion it since you understand
[9:28] it better?
[9:30] >> If you guys have any other comments,
[9:31] now's the time.
[9:33] >> Um, no. I'm just hoping it doesn't turn
[9:35] into a nuisance complaint factory. But
[9:37] >> yeah,
[9:38] >> maybe there aren't that many people that
[9:40] want to do this. Well, and the the
[9:42] nuisance will be the view of it, I
[9:44] think, because they're going to smell
[9:46] the same whether they're in the front or
[9:47] back,
[9:48] >> and they have to be, you know, 50 feet
[9:50] away from the house, whether it's in the
[9:52] front or the back, that doesn't, you
[9:53] know, it doesn't change. Still have to
[9:54] be x amount of feet with away from the
[9:56] house.
[9:56] >> Yeah. Now, I mean, if somebody builds
[9:58] some ratty pens in their front yard, I I
[10:02] get it then. And it's possible, but you
[10:05] know, you can't
[10:08] make rules for every last little thing,
[10:10] I don't think.
[10:10] >> Yeah. And I think there's a lot of
[10:12] people that have already have things set
[10:14] up, so they'd be grandfathered in
[10:16] anyway. And I know there's people around
[10:17] my neighborhood that have it in their
[10:19] front yard and it's great. I don't have
[10:21] any any issues with how they've got it
[10:24] or anything else. It's it's maintained.
[10:26] It looks good. It's taken care of.
[10:28] >> Yeah. If you maintain it properly,
[10:30] location doesn't really matter, right?
[10:32] >> Yeah.
[10:33] >> There's some properties that they can't
[10:35] locate it in the backyard. the way the
[10:37] property is.
[10:38] >> Mhm.
[10:39] >> Up against the hill. That's the issue.
[10:42] >> Go ahead. Sorry again.
[10:43] >> Okay. The one thing that I I would like
[10:45] to address is I think we all got an
[10:48] email
[10:50] uh concerning this whole topic here. And
[10:55] every time we get an email like that,
[10:57] it's constantly negative.
[11:00] Always. you didn't do this, you didn't
[11:02] do this, you changed this because you
[11:04] don't want to do this, you know,
[11:06] whatever the case may be.
[11:09] I mean, look at the whole situation and
[11:12] not just this. Look at the improvements
[11:15] that have happened in this town and not
[11:18] one person is saying, "Hey, good job."
[11:21] Not one person
[11:23] that is in this email that that we got.
[11:28] They don't recognize that. They just
[11:29] want to sit there and complain about
[11:31] things that like this. But if you're
[11:34] going to complain, fantastic. Go ahead
[11:37] and complain. But in the same respect,
[11:40] if you do something or you see something
[11:42] positive and ne positive for the town,
[11:44] applaud that. Don't just complain
[11:47] because it's
[11:50] it takes the morale out of everything
[11:52] when it's a constant complaint.
[11:56] So that's all I have to say. If
[11:59] everyone's good, then I'll I'll make a
[12:00] motion.
[12:02] I make a motion that we recommend
[12:04] approval on ordinance 0202608
[12:06] amend title 10.02.050
[12:09] building permit required, 10.10.02
[12:12] a agricultural zone and 10.10.050
[12:16] RE rule states and on 10.10.050
[12:21] RE rule states under item G, we remove
[12:24] the two setbacks of 10 and 15 ft. I
[12:27] second that.
[12:28] >> Motion second. Let's take a vote.
[12:30] >> I I
[12:31] >> I
[12:32] >> All right.
[12:32] >> Motion carries. All right. On to the
[12:34] minutes. I looked at them. They look
[12:36] good. You guys see any issues?
[12:38] >> No.
[12:39] >> All right. Anyone want a motion?
[12:42] >> I'll move that we approve the minutes of
[12:44] the planning commission meeting uh
[12:47] 2.1126.
[12:49] >> I'll second.
[12:49] >> Motion second. Let's take a vote.
[12:51] >> I I
[12:51] >> I motion carries.
[12:54] >> Make the motion we adjourn. Second.
[12:57] >> All in favor?
