office. Uh we've gone over the legal
description. And this is described as
[8:19]
BCAP property ID 358171.

So, we're going to have three different
variances that are going to be requested
[8:34]
here. The first one's going to be
150.28B
[8:38]
commercial businesses. Um, this has to
do with the quantity of cargo containers
[8:43]
located at the property. So currently as
ordinance reads um the you may store
[8:53]

may store maintain otherwise keep a
maximum of two cargo containers on a lot

or property within a non-residential
zoning district. The cargo container

its location. So, as you can see that
underlined section there, maximum two
[9:17]
cargo containers is the requested
variance area where they're requesting
[9:21]
um a relief to five cargo containers on
property. Uh the second requested
[9:26]
variance is 153.4.2.
This is going to be off to the right
[9:31]
hand side of that page. Um FNG, this is
going to be your setback table. Uh
[9:36]
currently that setback table is set at
five feet from the rear and from the
[9:40]
side. Um this just has to do with um you
know where these cargo containers can be
[9:45]
placed in relation to that back fence
and that um sorry the rear of the fence
[9:49]
and then the side of the fence. Uh five
feet is already you know well within
[9:53]
distance but you know whenever you go
place they're not out there measuring
[9:58]
you know so this is you know I believe
within four four and a half feet. So

it's not really much change uh to what
that tabular form already is. Next

commercial businesses and the tabular

So, just to go over this ordinance
intent. Um, this allows commercial
[10:25]
property owners the ability to utilize
cargo and shipping containers as
[10:28]
additional storage options for their
businesses without the financial
[10:32]
investment of expanding or renovating
the permanent structure. Um, cargo and
[10:36]
shipping containers should not adversely
affect the character of the
[10:39]
neighborhood. Uh, this is pulled
directly from our municipal code of
[10:42]
ordinances um from the u city plan 2040.
That's the intent of adopting this
[10:48]
ordinance and the requested variances do
not affect the intent of it.
[10:55]
This next slide you're going to see the
current placement of the shipping cargo
[10:58]
containers. We have three uh directly
right behind the building that is not
[11:03]
viewable from the rideway and then two
that are viewable from the rideway only
[11:07]
if the gate is open which I believe most
of the business operating now that gate
[11:11]
is closed. So um most if not all the
time all cargo shipping containers are
[11:16]
not viewable from the rideway um or from
neighboring properties. They are um yes
[11:22]
a little bit encroaching on that 5 foot
setback but you know by six inches max.
[11:26]
we're not, you know, too close where
it's causing any fire hazards or
[11:29]

The third variance that is being
requested has to do with wall signs.

This is going to be your ordinance
153.12.10,
[11:44]
which oversees wall signs. Um, Hillrest
Drive is classified as a minor min minor
[11:49]
arterial, excuse me. Uh, but any 01
zoned uh office on Hillrest Drive is
[11:56]
considered the Hillrest District where
there is no authorized signage allowed
[11:59]
there. As you can see, if this was just
the minor arterial that we're looking
[12:04]
at, um, it's allowable up to 80 square
feet. Next slide, please.

The proposed sign that they're wanting
is only 36 square feet. Nowhere near
[12:13]
what would be um encroaching on the 80
square feet. That's maximum allowable on
[12:17]
Hillrest Drive. Um anywhere else that is
not 01 zoned area
[12:24]
before you go. There you go. Off to the
right there. That is the proposed sign
[12:27]
that they're going to be using um on the
wall there just to identify their
[12:31]
business and proponent will promote a
little bit more visibility there and
[12:35]
establish them as a sense of place
because there's not really much signage
[12:39]

There's going to be a loose placement of
the sign. Um I believe the sign has been
[12:47]
with their business for many years now.
I think that they brought it from the
[12:51]
previous location before they relocated
to Bakoney Heights.

So ordinance intent for uh signage here.

So city recognizes the safety,
commercial, emergency and information
[13:04]
needs for signs. This article has been
adopted to protect the health, safety
[13:07]
and welfare of the citizens by
regulating the location, construction,
[13:10]
duration, size, height, installation and
maintenance of all signs within the
[13:14]
jurisdiction of the city in accordance
with LGC article 216. Additionally, this
[13:20]
article is intended to enhance property
values, maintain aesthetic
[13:23]
attractiveness, and promote commercial
opportunity in the city, and support and
[13:27]
further the objectives of the city's
comprehensive master land plan. I
[13:31]
underlined that last section there
because the requested variances for this
[13:35]
wall sign is clearly aligning with the
intent of why this ordinance was
[13:39]
adopted. It's not straying away from and
it's not causing any harm to
[13:43]
neighborhood characteristics or anything
like that. There's no issues with
[13:47]
safety. um emergency uh needs and this
just promotes the commercial needs for
[13:52]
this business.

So, with all these public hearings,
we're required to send a 200 foot um
[14:02]
public hearing notice to any uh
residents, commercial, businesses that
[14:08]
are within that range. Uh we received
one response that was not including your
[14:12]
packet because it was received after the
the packet was due here. Uh we received
[14:17]
one in favor of the change. U this is
from the property owner of 2922
[14:22]
Hookrest. Rest of the properties that
these were sent out to were
[14:25]
non-responsive. Um they do not oppose or
in favor of the change. So we have one
[14:30]
in favor of this change. Uh
recommendation is shipping containers.
[14:34]
Um well one to approve the variance for
shipping containers, but they do not
[14:37]
adversely affect the character of the
neighborhood and do not pose a fire
[14:41]
hazard or risk or anything like that.
aligns with the intent of the ordinance
[14:44]
and helps support this business. Same
thing with the wall sign is my
[14:48]
recommendation is to approve this
variance clearly aligns with enhancing
[14:52]
the character of the neighborhood helps
promote this business falls in line with
[14:56]
the full intent.

fully meets the criteria and and that is
why I'm providing the recommendation

that we should be approving this
variance for the wall sign. That is less

than half of what they would be
allowable um in any other minor arterial
[26:38]
section of the city.

Gentleman Road. That's going to be the
[31:58]
the one vacant lot that you see when you
drive down off to the left behind
[32:02]
Chick-fil-A there. Uh the request of
variance renews uh renewals would allow
[32:06]
the proposed residential development to
proceed without modifying the existing
[32:10]
utility configuration which Mr. Espanar
has spent quite a bit of money making
[32:14]
sure those utilities were put there. Uh
and as reducing it will also uh let me
[32:21]
back up here
proceed without modifying the existing
[32:25]
utility configuration or reducing the
number of proposed dwelling units with
[32:28]
the current configuration for the
platting of that property. Uh the
[32:32]
application the applicant has also
requested a waiver of a variance renewal
[32:35]
fee for the board's uh consideration
here. Um you can request a waiver of
[32:40]
fees if it is a renewal. Um that is the
the only criteria there if it's renewal.
[32:47]
So again these were granted back in
2021. Um he's looking for renewal of
[32:51]
those two variances. Variances do expire
after one year if there is no movement
[32:56]
on that variance that was granted. Can

I don't have an exact timeline of how
long that's been vacant. Um Lewis can
[34:16]
give a better answer here later on when
y'all call them up for questions. Scroll

So, the variance variances requested
[34:25]
here. Um the first one's going to be
153.3.15
[34:30]
3C site requirements. And again, my the
the outlining is going to be the
[34:34]
important information that we're looking
at here, what they're requesting
[34:37]
variances uh from within that ordinance.
So, first one is C. All parking lots,
[34:43]
stalls, or garage entrances for town um
townhouse units shall be accessible from
[34:47]
the rear of the property by alleys or
internal drive aisle accessing the rear
[34:52]
of the unit. In so far as practable
practable
[34:58]
practable, I can't get it. Exterior off-
streetet parking facility shall be
[35:04]
grounded in bays at the interior blocks.
No off- streetet parking space shall be
[35:08]
more than 100 feet by the most direct
pedestrian route from a door to the
[35:12]
duelan unit it is intended to serve. So
the requested area variance is rear
[35:17]
access uh for parking there. Uh the next
request is 153.3.153E
[35:25]
design requirements and this is garages
and parking areas shall not be
[35:30]
emphasized along street frontages. Uh
attached detach garages in the rear yard
[35:35]
with access to midblock streets or
private shared driveways along the rear
[35:38]
of the property are preferred. And that
underlying area is the area that we're
[35:43]
going to be looking at. uh the way that
he has his layout right now is going to
[35:47]
be um front access for the vehicles, not
rear access. Uh given the size of this
[35:53]
property, there's just no feasible way
for us to to force him to have any rear
[35:57]
access for these vehicles. If so, then
you're limiting the amount of units that
[36:01]
he's able to put on that property in
addition to um
[36:06]
changing up the utility designs right
now where there's existing water, uh
[36:11]
sewer, and electric for all six of those
properties configured for this internal
[36:16]
front access for vehicles. Scroll down

Um, so those six um squares, the blue
[36:28]
and the red squares on the left are
going to be how those houses, not to
[36:32]
scale. Please note that's not to scale,
but how they will be aligned. Um, you're

That's going to be your driving access
aisle where the vehicles would drive
[36:45]
through that little alleyway and be able
to access their garage through the front
[36:49]
of their home, not the rear of their
home. on the right again is going to be
[36:52]
that uh aerial view of the property.

So, just going back to the ordinance
purpose, right? Um this is 153.3.15
[37:07]
R5 town houses. I've highlighted those
green areas because this is where we're
[37:12]
kind of aligning where this variance is
and how it falls in line with the
[37:15]
current ordinance. So the intent aligns
with ensuring location and design
[37:19]
standards are compatible with the
surrounding property which this does
[37:22]
satisfy the need. Uh make efficient,
economical, comfortable and convenient
[37:27]
use of scarce land and open space uh
resources. This does it is an infill
[37:32]
property that we're trying to make sure
is redeveloped. Um there has to be
[37:36]
unique creative ideas to uh be able to
place housing here which Mr. Espanar has
[37:41]
uh been able to do. um and then serve
the public purpose of increasing density
[37:46]
by providing an alternative uh to
conventional arrangements of yards and
[37:50]
building areas which this needs to. Uh
this property is uh well below an acre.
[37:56]
Um it is fitting the need for density
right it is fitting six uh houses there.
[38:02]
Uh there's no change on um lot minimum
size which it is going to meet the need
[38:08]
for. It is just changing up the um
access for those cars there. Next slide
[38:14]

Excuse me. Once we start looking at our
[38:18]
city plan uh 2040 here uh permitting
these variances addresses issues
[38:23]
identified um and all these issues are
identified by residents, right? Uh that
[38:28]
um
table on the right that you see, these
[38:32]
are all answers that were provided by
residents back in 2022, 2023, addressing
[38:36]
the strengths, the weaknesses, the
threats that this community is facing.
[38:40]
Um it's addressing aging housing stock.
We're able to get six new homes in this
[38:44]
community. Uh population decline, right?
We're making sure that it is a a dense
[38:48]
area or a denser area. um where we're
making sure more uh residents move into
[38:54]
the area and it's satisfying the the
need of there being a lack of inventory.
[38:59]
Right? Uh there are two different areas
that are zoned R5 town home, but there's
[39:04]
no town home places here in the city,
right? So, we're making sure we're
[39:08]
satisfying all these needs that were um
identified by our residents.
[39:13]

just want to say this is another
[39:19]
property where we send 200 foot notices
to. I received no written uh notice of
[39:25]
in favor or opposed. I did receive one
phone call that um they are not opposed

property owner of Chick-fil-A. Um this
[39:34]
is the one uh directly behind this
property. They have no issues with
[39:38]
whatever variances are being requested
here. Um again the recommendation here
[39:42]
is going to be approve the renewal of
both variances. Right? The board has
[39:45]
already made a decision before to
approve this in the past. Uh the request
[39:49]
of variances do not adversely affect the
neighborhood character or the intent of
[39:52]
the ordinance which is very important
here. Uh the approval of variance will
[39:56]
also strengthen and address goals that
have been outlined by the community
[39:59]
input in the city plan 2040.

to improve navigation throughout the

property for visitors and emergency
vehicles while enhancing the facil's

visibility and identification.

a lot of directional um overview to
anybody that's uh either visiting and or
[59:43]
um emergency vehicles that need to uh
find what area they're trying to
[59:47]
navigate to. Right. Um I did speak to
Methodist Texan earlier today. Uh they
[59:51]
did note that this is one of the only
hospitals in the San Antonio Bear County
[59:56]
area that has the emergency department
at the rear of the building and not the
[1:00:00]
front of the building. Um so this uh
signage, the ER signage and a lot of
[1:00:04]
this monument signage, I'm sorry,
directional signage is important for
[1:00:07]
them to be able to navigate, provide
anybody that's uh there an ability to
[1:00:11]
find it when most people are used to
just driving to the front of the
[1:00:14]
hospital and being able to to find it
there. So we're kind of in a unique
[1:00:18]

freshen up the the signage, but they
have a very common issue with people
[1:01:29]
driving into this sign, right? It is not
easily viewable. There's only one ground
[1:01:34]
light that's facing this. So, it is a a
common issue that he has to deal with
[1:01:38]
getting replaced. And if you're not
familiar with monument signs, they're
[1:01:42]
they go from between 10,000 and probably
50 100,000. They're very expensive signs
[1:01:47]
to to constantly keep maintaining. Hold

to be the proposed new monument sign.

Uh, if I can see it is 10 foot six high
and 8 foot wide. This is not only

providing more visibility from the

passing by, but it it's also internally
[1:02:12]
lit, which is going to provide more
visibility at night. uh hopefully and uh
[1:02:17]
probably prevent more people from
keeping running into the sign. Right.

So, there's two different proposed
locations for this sign. One that you
[1:02:25]
just saw that's going to replace the
existing and then one that's going to be
[1:02:28]
at a different area that doesn't have a
current sign, a monument sign in place.

signs, there's a maximum height of three
[1:04:36]
feet that is set by the ordinance.
They're requesting that their
[1:04:41]
directional signs be changed to six foot
in height. The maximum area uh currently
[1:04:48]
allowed is 12 square feet. They're
requesting it to be 24 square feet. And
[1:04:54]
the maximum number of signs is one for
every 10,000 square feet of space. So
[1:04:59]
it's it's based on calculation. Um I
don't know the square footage area of
[1:05:04]
the hospital. Um, but I'm sure it's not
150,000 square feet. We're requesting 15
[1:05:10]
signs on property there. Um, again, this
is just to provide uh, you know,
[1:05:15]
directional enhancements to visitors
and, uh, emergency vehicles, KDN, EMS
[1:05:21]
services that need to be able to locate
services very quickly at the hospital.

The requested variances for monument
signs. Um, what's currently allowed is
[1:05:29]
going to be 5 foot six. They're
requesting that their signs be 10 foot
[1:05:34]
eight. Um the maximum area is that's
allowed currently is 50 square feet.
[1:05:39]
They're requesting it to be 80 square
feet and there is a limitation of one
[1:05:44]
sign per frontage. Um so as you saw
there they're requesting two signs along
[1:05:50]
IH10 the frontage road there. One is a
pre-existing and then one is a vacant
[1:05:55]
area that serves as their secondary
entrance to the hospital campus. Please,
[1:06:03]

the two kind of main design layouts for
[1:06:06]
them. One is just a general navigation
sign and then one is very specific to
[1:06:11]
the ER for them.
Here's your your monument signage one
[1:06:16]
more time with um with
height and width, right? 108 and then
[1:06:22]
six foot wide. Um it is a much larger
sign, right? So, we're making sure that
[1:06:26]
we're allowing them the visibility for
people that need to locate the the
[1:06:31]
emergency services that Methodist
provides with ease. Right. And if you
[1:06:35]
missed this one, you want to be able to
access the second one. And there's
[1:06:38]
currently not assignment. Scroll down,
please. So, ordinance intent, it's going
[1:06:43]
to be the same as what we uh viewed
earlier for Dila's wall sign. Um, you
[1:06:48]
know, the we're recognizing the safety,
commercial, and emergency and
[1:06:51]
informationational needs, right, for the
signs. This is clearly falling within
[1:06:54]
that within that intent that you know we
need to make sure emergency
[1:06:58]
andformational needs are satisfied right
and that's what they're requesting that
[1:07:03]
variance for. Um it's intended to
enhance properties uh property values
[1:07:08]
which this will right Methodist has a
very strategic plan to make sure that
[1:07:12]
they keep continually enhancing their
property and signage is just part of
[1:07:15]
that plan. Uh maintains the aesthetic
attractiveness which this does. It's a
[1:07:20]
very modern update. Um and it promotes
commercial opportunity not necessarily
[1:07:25]
commercial opportunity but you know um
enhancing to make sure those people come
[1:07:28]
and and view the hospital uh with ease
right it supports the objectives of what
[1:07:33]
our master plan has on
so I did not have any responsive
[1:07:40]
requests to this property right we sent
it to two 200 foot notice to everybody
[1:07:44]
within that area uh no phone calls no
responsive letters mailed back to me but
[1:07:51]
you This is something where there's
undue hardship to
[1:07:55]
a property that serves a more purpose
than most of our commercial properties,
[1:08:00]
right? It is a emergency service that is
provided to the city. It is an undue
[1:08:04]
hardship that's placed on them. Uh,
Methodist is explaining that this is a
[1:08:09]
compliance issue as well that emergency
vehicles need a certain limit, certain
[1:08:14]
requirement for their signage. So, these
emergency vehicles, EMS, fire, police,
[1:08:18]
whatever it is can access their property
and navigate with ease and it just helps
[1:08:23]
the visitors as they need to go there as
well. Um, so recommendation from staff
[1:08:28]
is to approve this variance for both
directional and monument signs. I think
[1:08:33]
