[0:08] Bonsoir. Good evening!
Welcome to our regular meeting of the Municipal Council Tuesday, may
[0:22] nineteen twenty twenty six.
WE don't have the
[1:06] commandant from the SPVM. Commandant Gosselin with us tonight. I can't make it, but
[1:13] I'm happy to announce that the city of Beaconsfield will be hosting the SPVM. Le 3 juin
And at that
[1:30] meeting the SPVM commandant Gosselin and his team will be able to provide more detailed
[1:38] reports of their activities here in Beaconsfield. They'll be presenting their programs
[1:45] and there will also be a period of I guess exchanged questions and answers with residence. So
[1:54] it's gonna be here at City hall. Le 3 juin de 19 h à 20 h 30. Et des du café et des desserts
[2:03] peut être des beignes seront alors offerts. And I would also like to briefly. C'est a few
[2:14] words on a feel that was discussed for some of us during the last campaign and I know
[2:23] that we had a few residence in the first couple of months of this mandate asking questions
[2:30] as to where it is at and I am speaking specifically of the sound was dossier I undertaken
[2:41] in answer to those questions to conduct a review of the file specifically regarding the
[2:50] issues of noise barriers along highway, twenty I know that in the past.
So I'd like to
[3:12] tell you what I found and where I believe we are at in this and this feel so I as I've
[3:22] mentioned its it's something that I needed to look into because there were a lot of
[3:28] exchange some of them that predicted. Obviously my mandate as mayor or my previous terms
[3:34] and counselor so just keep in mind that it's something that it's been going on and discuss
[3:40] for over more than fifteen years, and it has been the discussion that has involved
[3:50] almost exclusively the Quebec government when we also have to recognize that for the north
[3:57] side of the twenty. There is obviously other players that play the federal government is
[4:04] definitely one of those players as are the train company. So.
For the
[4:39] record to to go back, some of you will recall in twenty twenty two following a
[4:45] correspondence by Dr David Kaiser Medical chief of the urban environment and
[4:52] population health division of the Montreal branch of the Quebec public Health
[4:58] Directorate at caractérise the situation along highway, twenty as a public health issues and
[5:06] at that point mayor bourrelle with the support of the council, then the council member sought
[5:13] to obtain from the Quebec government and commitment to cover a hundred per 100 of the
[5:18] cost of the eventual sound oil on the ground that the government, the Quebec
[5:25] government is responsible for public health measures and so in the letter dated well the
[5:35] spring of twenty twenty for the Ministry of transportation and the Quebec public health.
[5:43] Directorate causing the letters in which they said the following and I côte. En appui
[5:50] à votre demande. Referring to Meyer Bourel.
Fin
[7:02] de la citation. So in that letter the Quebec government there for written that the
[7:08] offer negotiated on the basis of a seventy-five twenty-five five twenty five cost sharing
[7:15] arrangements under which, of course twenty five first of the cost must be born by the city
[7:22] of Beaconsfield, Furthermore in the course of recent discussions. I had with
[7:30] different members of the Quebec administration. It was made explicitly clear to me that the
[7:37] government of Quebec does not have the wheel or the financial capacity to commit whether in
[7:44] Beaconsfield or elsewhere in the province to building such infrastructure at its own
[7:50] expenses for one hundred pour 100 of the cost.
As responsible Stewards of public funds. I believe we have a duty
[8:35] to assess our residence capacity to pay all the more so because we remained convinced
[8:41] that the noise pollution that issues is not beaconsfield responsibility, even though it
[8:47] effects and its effects, rather are felt here in Beaconsfield by our residences if we must
[8:58] act as responsible manager of public funds, we must also act with fairness. Whether they
[9:05] live North or south of the highway, twenty our residences all of them are entitled to the
[9:11] same measures, especially on the matter of public health. WE can not allow ourselves to show
[9:19] favoritisme and partial interventions only on the south side for example would create
[9:24] in equity that we could not credible defend.
The railway lines
[9:48] in question for under federal jurisdiction and they are operated by Private company
[9:55] Canadian National Canine Pacific, Kansas City Railway Highway twenty for its part is
[10:03] of course under the responsibility of the Quebec government and these are the
[10:07] actors you must assume in our opinion full responsibility for the noise pollution, that is
[10:12] being generated.
[10:41] suspens. So the city will not undertake any new steps. On laisse significant new facts
[10:49] emerge or unless higher levels of government make firm concrete and binding commitment
[10:54] to assume the full extend of their responsibility both financial and in terms of
[11:00] project delivery. So I want to be clear to everyone that is leaving either south or north
[11:09] of the highway or the train track and that is being or has been affected by the noise.
[11:16] We're not giving up the fight. It's not it's not that we are abandoning the notion. But it's
[11:27] difficult to clear and decisions grounded and honest and rigorous analysis one that
[11:34] is taking into account our capacity to pay and and are limited roles and being able to
[11:42] push forward the project and which we're not decisional, so that will now be up to the
[11:51] different levels of government to act and should condition change. I want everyone to know
[11:56] that we will be ready to respond and to participate in further talks. Merci. Thank you
[12:03] and so now we can start with questions period. WE have thirty minutes. It is not take
[12:11] a look at this now. Seven for the two and if you have a question, please make your way
[12:21] to the microphone state your name and street and bref. Intro and questions. My name is
[12:31] Chantal Parry and I have questions about the history. I know long time ago. WE had the
[12:41] l'argile Dufresne.
[15:46] beaucoup. Merci. À West Craft Road. I'm going to go back to community from the city on the
[16:01] twenty first of all this year about branches that are not accepted by the green or not to
[16:12] put it in our green, I've been having a bit of back and forth with my counselor. Mister Rossi
[16:18] and quite a few of my neighbors are concerned about this because what it means is our
[16:24] regular branch. They go out several times a year were used to that prior to the green pick
[16:33] up we used to put anything else in with our great with our regular garbage now that no
[16:40] longer applied. So I would like to have some clarity on what we do with the branch loop and
[16:47] twig that fall during the year, you have to remember that West Croft. And the the three in
[16:59] Beaconsfield, our areas one of the older areas and were very proud of our canopy, but that
[17:06] means that we also have a lot of small branch and twig that regularly fall to the ground.
[17:14] So I just would like some clarity on what we do with them. I don't want heap of that that
[17:21] is in my garden for a year, you know and tell somebody decided what I can do with it. Yes,
[17:28] well, you know you mentioned Twig and branches and and one of the difficulty is to
[17:34] determine that what points does the twig turn into the branch and and whether or not, you
[17:39] know you can take twig and and actually put it with the green residue. And and also there's a
[17:47] limits as to the size of a branch that can be put to the curb for our public work.
[17:54] Employs to to pick up. You know what we have. WE have I think to pick up twice a year that.
[18:04] Patrice.
[18:09] l'automne. Deux fois à l'automne. We're going to look into trying to provide more
[18:18] clarity because I'm in the same boat as you are right. I have trees and and branch or twig or
[18:26] whatever you. They break the following to the ground and I'd like to I'd like to know what
[18:30] to do if I need to keep them in my yard to put them out in the fall or or not so, but at this
[18:38] point, we're just sort of really reacting to Montreal. Well, it was always a no go,
[18:46] but it was I guess tolerated. And now what we're being told is that the cost of repair of
[18:52] the equipment that breaks as a result of perhaps not twig, but branches, you know getting into
[18:58] the machinery and and causing damage. This is increasing and so what was tolerated is no
[19:08] longer tolerated So unfortunately right now, I can't I can't give you specific,
[19:12] but will try and get back in and spread the information. You are different channels as as
[19:19] quickly as possible. I I read here something that the council Rossi and it looks like
[19:29] anything less than others, which is about to each right. I gotta go back to school. Is it
[19:38] can be dealt with with the regular branch pickup, but anything less than that well,
[19:45] you know my trees dropped twigg and branch that are smaller than two and all year. So
[19:53] anyway that just I think it's it's a valid point, but there is unfortunately at this point
[19:59] no clarity. Thank you. You're welcome. Hmm.
Puis je me dis
D'accord.
Évidemment, on va
Excusez moi. Madame
[24:33] Giguère Oui. My name is macray, I leave it through one, I live right across from the tennis
[24:43] court and these are the tennis. Corps en elle-même that maybe some of you know about. My
[24:52] question is when does the company that we went from plan to build the building on the
[25:00] tennis court do they have a permit yet is there anything as residence can do so that this
[25:09] building doesn't happen because and also to wear the city of Beaconsfield by putting it not
[25:15] in our mailbox because most of the people who leave in the complex don't know anything
[25:22] about this possible building being built and I can't be an army of one. I don't want it.
[25:30] My name is don't want it. Yes, they're not sending emails there afraid to their renter.
[25:38] OK, WE just want to know what we can do I want to know what you guys are doing to help us.
[25:45] I understand miss the well, the permis is not been issued because the bylaws that are
[25:54] required are up for. Decisions on the agenda tonight at idem for the points for and for the
[26:04] point five one of the IDM is regarding the register to be held because opposition from
[26:18] some members of the local area have requested it and and suffisant signatures so untel
[26:29] untel that process of adopting the biology and going through the registry process is
[26:35] underway. There's no, there's no permit that can be issued, of course. So that's where we
[26:41] are at tonight. What about going forward if this thing passe, if this thing, if if it
[26:50] pass the owner will have the right to build the project that they have presented and if it
[26:59] doesn't they can still build something that property that is or would be conforming to the
[27:07] current biology that exist it. I mean what if it's ugly and you don't like it like well, I
[27:14] mean do that. That's a good point. I don't know if ugly is necessary the technical terms,
[27:24] but but so it's a two step process. So there are asking you to change the zoning to
[27:32] build something, but if they were not and they had a plan to build a building. It would go
[27:39] through a different process which is the architectural integration and implantation,
[27:47] implantation process and that would be reviewed by the committee of the city on which
[27:55] residency they make recommendations, we have we have a number of items that go
[28:00] through that process, they are at forty-five forty-five one two forty-five sixteen as
[28:07] example and so yes, we we have the counselor or council. WE have we have a say in two,
[28:15] whether or not we find that the specific building fee or not in the neighborhood in which it's
[28:22] going to be built, so there's another process after the process, so I don't have to
[28:28] start yet well what you do with your bag is really. It is really up to you. I understand
[28:36] it. OK? Thank you have a good evening. Bonsoir, Monsieur le maire. Bonsoir les membres du
[28:43] conseil. Daniel Dupont 30. Gabriel Score.
Merci beaucoup. Parfait. Merci. Bonne
[31:16] soirée. Good evening. My name is Julien Cabana. My question is I'd like to just get a
[31:24] really clear understanding of what happens with the formal petition that was submitted
[31:29] with the hundred signatures regarding the two eleven X roads. WE provided the written
[31:39] documentation of the petition along with all the signatures three hundred of the hundred
[31:43] are confirmed Beaconsfield residences and others are made by people who have divorced and
[31:51] still have children living in the area and so forth anyhow, there's at least three hundred
[31:54] beaconsfield residents. I'd like to understand. What do you do with these petitions and
[31:59] what kind of impact is there for you to support us? Well for my part. I first want to thank
[32:06] you for formulation. Formerly presenting the petition to to council and now that it had
[32:12] been talked about and mentioned before. Residents expressing themselves through the petition
[32:21] much like contacting, you know myself and I. I guess other members of council either by
[32:28] email phone calls meetings. This is a form of expression that is considered important in
[32:37] this particular case I noticed that from the documentation that you are provided along
[32:44] with the list of names a copy was to be sent to the STM, and I hope that you did that
[32:52] because what you are looking to see in terms of impact or change really comes from them.
[33:02] WE are not, You know. I've mentioned two to you and perhaps here, but we've
[33:08] communicated elsewhere emails among other things. WE are not decisions. All that it's not
[33:15] our. It's not our route to to implement or to disband. So so then I understand correctly if
[33:30] so I am in discussion with the STM with the CEO as well as some of the director and they
[33:35] are proposing or looking at the alternate route in Beaconsfield, that would have access to other
[33:42] residences that don't have access currently to the room. So you're saying that that
[33:47] that's how I should work is with them to look at alternate routing other possibilities for
[33:53] the segment of Montrose something I'm not aware that there are discussions for
[33:59] different growing. Directly. So there is responsible for the establishment of bus roots and
[34:08] if they decide that one doesn't work and another one would be better it. It would be, it
[34:16] would be there decisions. OK, so that's what I wanted to understand and see what
[34:21] happened with the petition? So now formerly the petition has been submitted and it just kind
[34:26] of lives there because you're saying The city has no involvement whatsoever in and
[34:30] the determination of the bus routes. No I mean, there are things that we're jurisdiction
[34:35] jurisdiction on, but that's not one of them. What are you? Well traffic issues through the
[34:42] traffic committee If you know. Recess offline parking regulation and in other
[34:53] instances speed bumps the addition of a stop the withdrawal of the stop so on
[34:58] and so forth. OK, perfect. Thank you, you're welcome. Nora Graham and creswell. I just
[35:10] want to back up. Madame Giguère, Comment is the same thing happened to my many many years
[35:17] ago. He was not seven years old, he was older than that he saw the break. It wasn't the point.
[35:23] I want. It was just a regular thing. I don't have them because I think child health is
[35:29] more important than somebody's grâce he saw it, but he was so I hit it had own when over the
[35:38] handlebars broken arm same thing. With my question. Actually was twenty twenty five.
[35:45] What's the difference? They're both camera both inspecting sour pipes her sanitary pipes.
[35:55] And twenty five years the world of contracts. Is it just different areas? Maybe that's
[36:05] the only thing I could so yes, it's two different types of sewers. So when the sanitary so
[36:11] essentially what we flushed down the toilet and the other one is the storm sour system,
[36:17] so water from you know. Rain and and what have you really really support? Madame Giguère
[36:25] because understood, it's not the first time, it's happened. I don't know how many other
[36:31] time it happened, but I know what happened with my sun. Martha I live in Pierrefonds
[36:44] does the urban plant and existing zoning permit the three stories multiplex
[36:50] dwelling On a tennis square in the two story rows complex. On m in zone Code H336. So when
[37:04] did the Beaconsfield Council change the ministry of age for I have to admit. I didn't
[37:12] understand what your question Is what? What are you? Rosie? Yes or yes, there is no
[37:21] construction that is the three are for in three three six and why are those used in in that
[37:32] zone and if they are I did see the the specification when did the council and those us the
[37:44] bylaws that are on the agenda or for the. Cause. There's a modification you going through
[37:50] the night. OK, ok. So the specification stable which was the only construction in that
[38:00] zone are each one and yet that somehow has two other permitted us three and four. I can't give
[38:12] you that technical answers. It's just of this information. Maybe in the table saying that
[38:17] there was the draft by law when it would have been it's been changed. No, it wouldn't be on
[38:23] the map, but what I would ask is that you leave your coordinate with the city clerk
[38:29] at the end of the table and we will get someone from the urban planning team to get in touch
[38:37] with you to provide the information. What is the number of water required to sign the
[38:44] register for draft Bylaw seven twenty one, two one two which the council is holding one week
[38:51] from today and thus they may twenty six according to the point of five three of today's
[38:59] agenda, so I will turn to the city to provide the information the public notice will be
[39:04] published tomorrow if the bilan is adopted this evening, but as well as the authority prepared
[39:10] its three hundred eleven signatures that would be required in the agenda with the
[39:20] public notice will also be posted Yes, but only if it's adopted this evening and but it
[39:25] should be. It will be tomorrow during the day usually around the clock, usually but not okay.
[39:36] You. Requested about the. Change in three six, I will look into it. Thank you.
[39:49] Carolyn Malcom Montrose drive this today I got a nice little pamphlet about the rams. So is
[39:57] happy to get that but one of my questions or comments would be as you know we've been working
[40:03] on when the platform showed up in June of twenty twenty five for nine nine roads. So I have
[40:11] here two presentations that were provided to certain Beaconsfield residents in on
[40:17] October for twenty twenty five and in January, twenty twenty twenty twenty six and I would
[40:24] like to deposit them because I believe there's good information for the public that
[40:30] leave in Beaconsfield to know. Okay, including you know that the technical teams from
[40:36] Beaconsfield. WE are working with the STM from twenty twenty two and that the Beaconsfield
[40:43] Council approved the best route in June or in the fall of twenty twenty four. Yes, ok.
[40:50] You want you want the deposits that you send it could be you can leave it with the city
[40:59] clerk and that will be logged in that way. Thank you and then the question is the follow up
[41:04] to your answer about the costs so about the cost of the public transportation, the seven point
[41:12] two millions. Yes, so what I've understood that is part of the agglomeration costs. So that
[41:17] means it would be tied up with the legal fight with the city of Montreal is that correct?
[41:22] Well indirectly I guess yes. So I will address. If you if you consider our legal arguments,
[41:35] well part of that seven point 3 millions that has been contributed to the STM budget
[41:41] for twenty twenty six parts of it is an over payment understood that because based
[41:49] on your answer. Basically it's part of the formula. However, they were still in testing the
[41:55] formula and it has nothing to do with residence or use or anything like that correct. OK,
[42:01] fine, then my next question is on the intersection of arms and montrose, the the intersection
[42:09] elle-même roseau big one in five, so that I've noticed has gone down to five hundred
[42:16] thousand so in the so we have an idem on the agenda. Let me find it. For the point one.
[42:27] Thank you so for the point. One is actually different types of bylaw. Thank you for your
[42:36] question, Miss Malcolm a few months ago. Yes, we give notice for a long bylaw. If I remember
[42:45] correctly either another twenty hundred thousand dollars and we are not going ahead with that
[42:56] long bella what we've decided to do as a group. If we go ahead with what for the point
[43:03] one is to amalgame that the different project that requires professional services and two
[43:13] one loan by law and eventually one tender process instead of going project by project. One
[43:21] out of time. The idea and the hope is that by combining all of those different capital work
[43:29] project that we have on our pts are our plan triennal d'immobilisations de capital
[43:35] works program is that we're going to have a tender process that will bring in better price
[43:42] for the city, and so if we go that way, that's the first step, eventually, we'll have heard a
[43:50] form of engineering and all likelihood. And then we'll go to that firm with the project
[43:55] that we have to determine needs and budget, and then we will adapt loan Bilou specific to
[44:05] the project that will be considered to complete in fine, and I'm not understanding. The
[44:13] scope of work is like are they looking at all of Beaconsfield or are you now for the time
[44:19] being if you were to look at our capital work programs. For example in it. You see that
[44:25] will there was the amount roses intersection. There was the potential bike path on mount
[44:34] rose at mount rose, some professional services were required for the woodland
[44:42] intersection. WE are also considering redoing saint Charles So some professional
[44:49] services would have been required for that so all of those all of those little well
[44:54] little or not so little projects that require professional services while the
[45:00] professional service components is put together to to to have a better more competitive prices
[45:10] on the market. OK, understand what you're saying? It's just that you know what is behind
[45:15] the scene, but me at the residents. I don't know what's going on right? And it's I give
[45:21] you in experts at getting access to information. So, of course when the eight hundred
[45:27] thousand showed up I went to the STM, and now have it to the clock to ask what? What
[45:34] beaconsfield knows about the eight hundred thousand now You're saying that it's that
[45:38] gone. So now it were doing this. It's going in the form that it was presented originally back
[45:45] in march. I believe you and so now we're coming with a different tac. But you know I
[45:53] understand what you're saying. But I just give you a list of projects that have. It on the
[46:01] website it on the website and you ask me questions about the capital works program budget
[46:06] that we adopted in January. You were requesting that each item be specifically custodes and we
[46:13] expresses that we want it to just keep the total for each section, so that eventually
[46:18] when we go to tender the market doesn't already have an idea of what are estimate is so that
[46:27] well if we could get a better price, if we should our hand perhaps we won't get that that
[46:33] better price research. Thank you, you're welcome. I will leave the document. Thank you
[46:40] soft copy a appreciate that this will be published on the Beaconsfield website because
[46:47] people don't know you know what happened in the last year? I would say it's almost a year
[46:53] and adversary. I don't know if it will be put on the website, but I'd like to I'd like to
[47:00] just bring I think an important fact. This is a document generated by a third party the
[47:07] STM, we didn't write it and so. OK, well, well well, consider your request are supposed to be
[47:18] and I'll see what the the STM. I mean, I think you all have to understand how frustrated we
[47:25] are as citizens that there was no communication. I'm very aware Malcolm that you're
[47:31] frustrated. Don't don't don't do it for a moment and me. There our city. Our miss Cork
[47:40] at the end. Madame Giguère Oui, rapidement. Une dernière question. Rapidement,
Alors madame Dupont,
[48:24] j'ai répondu à votre question I have. I'm going to read what? Miss Corrado wrote US from
[48:35] saint Andrew, I am very disappointed with moving, the two eleven bus. The bus system
[48:42] is very inconvenience since I now have to transfer bus to get into the rest of the West
[48:47] Island. The bus don't line up there is casual well and there is no bus connection to gare
[48:54] Beaurepaire. I'm also concerned with the demolition, especially the historical building on lake
[48:59] shore and the perfectly good building on one eleven Saint Andrew. I do like that the city
[49:07] wants to protect three and mandate more three replaced cut ones. I'm also happy the nuque
[49:16] homeschoolers at Christ Church Beaurepaire will be recognized by the city. Thank you for your
[49:21] comments and one last question from miss Candice New on Gabel Scott I spoke to Tom Fontaine
[49:30] requesting the current version of pilot Bic oninit without the proposed. Excuse me the
[49:37] proposed amendements I replied they can be consulting online consulting online. However as
[49:44] explained to monsieur Fontaine the version available on the municipal website already
[49:50] contains the change being proposed. What is the current status and the proved version
[49:55] of byla by zéro nine at what is the original version of big zéro Nine prior to the
[50:03] amendements being proposed today? What are the impact of the amendement that are
[50:08] detailed in the document. Bylaw Amending byla by zéro. Huit on SPIP in order to modify the
[50:15] scope of application modify the terminology and to add objective and criteria for
[50:21] héritage immovable How do the amendement affect the character area of score if amendement
[50:28] impact the character area of score are requested the passing of the amendment to be zéro
[50:34] mean it be postponed to allow review so missing you below zero nine at the six is not
[50:45] currently approved. It is on the tonight agenda for adoption. The inclusion of the amendment
[50:53] in the consolidated version that is currently online was a cléricale error the amendment
[51:00] that are proposed do not impact the character area of score. So it doesn't change the area
[51:09] where the amendment only affect inventory héritage buildings and caractère areas the only
[51:17] inventory of the building on gables score is twenty-eight gables scores and I have ask
[51:23] the city clark's office to provide a copy of the bylaw as it was before the current
[51:31] modified version was put online and so someone from the city clark's office should be in
[51:37] touch with you to provide that for you. Merci, and this concludes our question period.
[51:44] Il est 20 h 21. Merci. Je perds mon micro, alors on retourne à l'agenda. Item numéro dix. 10.1

[52:20] Beaconsfield Regular council meeting of April I I propose.

[54:04] residence occasionally you find the situation where the water could stay in the bottom of the
[54:11] beach and it could be and convenience and sometimes some of those problems are more
[54:16] important than expected or not that important even if there could be annoying, so there is
[54:21] a list residents of public works the report this situation will go and take measures and
[54:29] depending of the story of the condition of the side while those interventions could take
[54:36] place or we'll take place within a certain time. So it could be between one year to
[54:41] three years depending of the situation and some occasionally that the battery is very
[54:46] minimal and we will not address it are sometimes it's very important and that it requires
[54:51] more study and the longer more important work and more important investment could take
[54:56] longer as well as we make those study. So it's more like a on demand requests from residence,
[55:03] so mostly they get addressed the following years, they make that request and or the second
[55:09] year after they make that request depending the time if you call in september for short
[55:13] won't be done in the following year because we have to go and take measures were completing
[55:17] the current year, we're going to take measures probably in the spring or in the for the
[55:22] summer to be prepared in plants and speaks for the following summer, So let's say somewhere
[55:27] report the situation in September twenty twenty six, if it's every if it needs a
