Um, on behalf of the applicant

and and really how you would like the
waivers approached this evening is it
[7:42]
boards vary the way that they would like
to do it. I can go through them one by
[7:45]
one or if the board had specific
questions about certain ones. So, let me
[7:51]

explanation of the authority pursuant to
[8:35]
40B that allows us to seek the waiverss
from local requirements and regulations.

And and just to pause here for a second
and clarify, pursuant to the board's
[8:45]
authority and power under chapter 40B,
there's no waiver given to any state or
[8:50]
federal requirements. So obviously,
these are only related to local
[8:55]
requirements and and those local
requirements that were in effect as of
[8:59]
the date that the 40B application was
submitted.

Um [clears throat] likewise within kind
of the introductory there you may see
[9:08]
note one that's highlighted or bolded
rather. Um, basically that just
[9:13]
highlights the provision of the uh 40B
regulations at 56057
[9:19]
that when seeking waiverss, if there are
uh zoning bylaws that are um or or uh
[9:26]
provisions within the zoning ordinance
that are
[9:31]
by special permit, a waiver is
technically not sought. So within the
[9:35]
waiver list, sometimes you'll see us
asking for something that requires a
[9:38]
waiver because it's a special permit.
That's technically not required, but we
[9:43]
just highlight that because within your
zoning ordinance, sometimes there's
[9:46]
special permits that are granted by this
board and sometimes there are special
[9:50]
permits that are granted by the planning
board.

So, with that said, I'll launch in if
you want to turn to the next page. So,
[9:58]
it's page two of the waiver list.
And what we're seeking um from the first
[10:05]
the first requested waiver is under
article four, the street opening. um
[10:10]
sections 191 uh 12 through 15.
And basically that provision just
[10:17]
provides out a street street opening
permit um is to be issued by the DPW
[10:23]
director to authorize extensions,
driveway access, utility connections
[10:28]
subject to the standards and and
pavement moratoria um unless that's
[10:33]
otherwise been waved. And this because
this is a 40B, this is more of an
[10:37]
administrative waiver because this is a
comprehensive permit and the board, the
[10:42]
zoning board issues all local approvals,
including those by the DPW. We've asked
[10:46]
for that to be procedurally waved, the
comprehensive permit. It subsumes all
[10:51]
your local permitting. Um, but just to
clarify, we're not seeking to um to wave
[10:57]
the DPW standards. It's just that
process that there's a separate permit
[11:02]
that's issued by the DPW director, him
or herself.
[11:07]
So, if you have no questions on that,
I'll move on to our next waiver request.

protection bylaw. That waiver request
[11:25]
has been withdrawn. So, since we were
last before the board, the uh the

applicant has submitted a notice of
intent to the conservation commission um
[11:34]
for jurisdictional work both under the
act and the bylaw. So, we're withdrawing
[11:39]
that. So, that makes your job a little
easier on that one. And then on starting
[11:44]
on page three,
we've requested a waiver under sections
[11:51]
242 and three. And basically that's the
provision that says that the building
[11:57]
inspector
um has to certify that any buildings
[12:02]
that are that are uh created um that
they comply with the applicable zoning.
[12:09]
Obviously because this is a 40B it's
it's by nature it's in conflict with
[12:14]
that because we're seeking waiverss and
we're and we're seeking to develop
[12:18]
pursuant to chapter 40b. So the waiver
request is just that it um the inspector
[12:25]
of buildings is to enforce the zoning
bylaws with the caveat that it's as
[12:30]
modified by the waiverss approved by the
comprehens by the um by the board under
[12:35]
the comprehensive permit. So it just
clarifies that
[12:41]
um the following or the next waiver
request is under 240
[12:48]
15 uh 24022 and through 24027
and as I had previously suggested in the
[12:58]
introductories there's that note that
under chapter 40B
[13:03]
you don't need to seek a waiver or
something that's permitted by special
[13:06]
permit. So this this waiver request is
really more of just a clarification
[13:11]
that 40B waivers are not required for
uses or developments that's permitted
[13:16]
subject to a special permit review
process. Essentially, it's because the
[13:19]
zoning board of appeals is conducting
all review within the comprehensive
[13:23]
permit review process itself.
From there we go on to the waiver
[13:30]
request under 240 uh16 through 2421
uh development plan approval.
[13:39]
Similarly, this is basically a
procedural waiver that uh
[13:45]
under under those provisions of the
bylaw development proposal that are
[13:49]
subject to a development plan approval
by the planning board. Um and again this
[13:54]
is chapter 40B. It's a comprehensive
review conducted by the zoning board
[13:59]
appeal. So more of a procedural waiver
there.
[14:03]
Um from there it gets into the use
regulations
[14:09]
within the uh within the zone by article
5 if you will and specifically 24031
[14:18]
that's your uh use regulation schedule
for both principal and accessory uses.
[14:24]
So the project is within the residential
district and within that per the bylaw
[14:30]
there are only single family and two
family residential use is allowed other
[14:34]
multif family is not allowed. So project
here is a multif family. It's 58 aid
[14:41]
restricted rental units um together with
um one community building as an
[14:48]
accessory structure. And then for
accessory uses to to the project we have
[14:53]
surface parking, earth removal, the
common septic system related to
[14:58]
pertinances, water, storm water,
landscaping, uh lighting and screening,
[15:02]
signage. And so for that we requested a
waiver from 24031
[15:09]
for the um principal and accessory uses
that are otherwise allowed within the
[15:14]
residential district.
[15:19]
Um
from there
[15:23]
um moving from uh the intensity of use
regulations. So under article 7 of the
[15:32]
ordinance, all buildings uh erected in
any district be located in a lot that
[15:37]
has the minimum requirements under
24040.
[15:41]
So if I this is somewhat of a two-step
here. So under 24040,
[15:46]
that's your intensity.
The project does meet minimum lot size.
[15:52]
um it does meet the minimum frontage,
the front yard setback, the rear yard
[15:58]
setback, um and the sideyard setbacks as
it's currently designed. And we've we've
[16:03]
provided you this red line so you can
see the adjustments that um were um have
[16:08]
been made on the most relevant plans.

The um this somewhat plays in however
under our the following waiver request
[16:20]
that we have under 24037
and that's that regulation pertains to
[16:25]
the number of buildings that are
permitted on a lot. And so subp part A
[16:29]
of 37 provides that not more than one
one single family or two family shall be
[16:35]
erected on a lot. So, we've asked for a
waiver under 24037A
[16:39]
to allow for the 10 multif family
buildings and the one accessory building
[16:43]
all on the 5.2 acre lot. And then
secondly, subp part 37B
[16:51]
provides that more than one principal
building um or use other than a single
[16:57]
family or two family may be erected
provided that. And then it goes on to
[17:01]
provide that um the lot and yard area
requirements are met for each building
[17:08]
um and used without counting them
anytime twice. Um but there's no um
[17:15]
increase in lots. So we've asked for a
waiver of that because what the proposal
[17:20]
is to have the 10 buildings, 58 units,
and the one community building as
[17:25]
located on the approved site plan. So if
one were to strictly seek compliance
[17:30]
under 24037B,
you would have to go back to the um
[17:37]
24037A
with those setbacks for each to look at
[17:41]
each of the buildings. So that's why
here we've requested waiverss for both
[17:45]
of them. So when under
24040
[17:51]
when you look at the setbacks from all
the buildings as a whole, no waiver is
[17:55]
sought. However, if one interprets 240
37B to say that you have to look at each
[18:01]
of the individual 10 buildings and the
community building, um it's not clear
[18:07]
that we would meet each one of those
sideyard and front yard setbacks if you
[18:12]
can't count them twice. Um does does
that make sense to the board?

subp parts 113 through 118.

Um which which um subp part 114 speaks
to that there's a permit that's issued
[21:32]
by the board of appeals and that it's
subject to a bond. And what we're
[21:37]
requesting here is that the
comprehensive permit include a waiver of
[21:42]
that and that the the specifics for the
earth removal. Um it within the subp
[21:48]
parts there it talks about the plans
that would be submitted which I think
[21:51]
that we've through the engineering
engineering plans have been submitted
[21:56]
today and then obviously the final um
plans that will be part of the building
[22:01]
permit application. It's going to have
you know that level of detail. Um what
[22:05]
we've requested is that the earth
removal be um addressed through the
[22:12]
detail that's going to be on the
building permit level plans um together
[22:16]
with the submission of a construction
management plan. That typically happens
[22:20]
prior to or as the applicant's preparing
to submit its building permit
[22:24]
application. And then it'll be um you
know, I'm not quite certain how
[22:27]
Bellingham likes to do this. If they
have a meeting with the building um
[22:32]
inspector and then certain other people,
like a a pre-construction meeting, if
[22:36]
you will, and they and the applicant
would submit a construction management
[22:40]
plan, which would detail the earth
removal, um how much is going to be
[22:44]
removed, the schedule for doing that,
and and and that level of detail. So,
[22:48]
it's not it's not seeking to not provide
the information. What it's seeking is to
[22:55]
um wave the separate permit um special
permit approval process and to provide
[23:02]
um the detail as to the earth removal
within a construction management plan
[23:07]
and to have that obviously be a
condition of the comprehensive permit.
[23:12]
And um aside from that though, the
applicant is also seeking to have a
[23:17]
waiver of the earth removal bond. Um

through us.

in a bond that the town would hold until
[27:06]
the project was completed or as it
progressed um moving forward. Um but if
[27:11]
the question is is it normal to wave the
bond for a comprehensive permit?

you know just in case you know we're up

against time up against the elements the
time of year you know I think at that

point when we apply to the state that
means like everyone's kind of ready

we're putting in money to the state
we're getting our approvals and we'd be

a you know max a month or two out from
like BGO kind of construction there

» if we hold true to what we've done in
the past. No. And again, I'm just one

person in the board members, but um when
Suna was in front of us, we we had the
[39:46]
same thing. And it was one something
with state kicked it back and

they never broke ground.

that's a condition what we've done

outstanding items from peer review be
wrapped up. um which again there was
[42:12]
maybe less than a handful of those um
items. Um and then once you get that and
[42:19]
you submit it to EOHLC, how long is like
what's that timeline anyway?

» My experience it's
>> for them to get back to you

know about I believe it's about two
[42:30]
months.
So it it it varies and and I'm not quite
[42:35]
certain what the standard is right now
um only because the um the woman who had
[42:40]
been kind of the head of the LIP program
at EOHLC,

she left about two months ago. Um and my
last final approval I did for a lip
[42:50]
project took a little longer than
expected. Um but you know it used to be
[42:56]
sometimes you could almost get a
turnaround in three weeks. Um, so I
[43:00]
think that, you know, two months
probably if if if everything is there
[43:06]
for them and you keep kind of like
following up saying, "Do you have any
[43:09]
questions? Is there anything we can do?"
You know, just kind of the attorneys
[43:12]
being an annoyance. Um, you know, I
think a two-month is isn't a reasonable
[43:17]
time frame.
Um and and just for the board's
[43:20]
edification, you you probably know this,
but as the applicant is preparing its
[43:24]
application, there would be notice to
the town because the applicant's going
[43:31]
to go back to the select board and ask
for um their letter of support that they
[43:35]
need as part of that final approval
application.

Um and and pretty much once that is
requested, the the applicant's pretty
[43:45]
much on the heels of making the
submission of to the state for final
[43:48]
approval.

» That I do not know. It depends on
construction timelines, financing, um

you know, may apply for some possible
grants. So that I don't know, but we

wouldn't clear it if there's a a you
know four, five, six months gap in

between us applying to state and the end
of these hearings. So

» how do I feel about the staging?
>> If I could even propose an interim um
[44:32]
time frame um when the as part of the
final approval application process, the
[44:37]
applicant has to prepare an affirmative
fair housing and marketing plan that
[44:41]
gets submitted to EOHLC as well. um kind
of different parts of ELA, EOA, EO LHC,
[44:48]
review those um the the final approval
application and then the U marketing
[44:53]
plan. But it's it's it's a good
indicator that the applicant is getting
[44:59]
close to doing final approval if they've
already submitted um the uh the fair
[45:05]
housing and marketing plan to get that
um because that that's a big that that's
[45:09]
kind of a a time suck um at HLC.

of like an escrow for this like where
it's if we don't you know we apply and

we don't you know pull a building permit

projects have their um hydrarology run

they'll have to you know pay to upgrades

um to it. warehouses um and historically
just don't draw that much water and so
[51:51]
DPW actually at least again in my past
experience they liked it because it
[51:56]
didn't draw a lot of water warehouse
properties but
[51:59]
» so it's something that they have to deal
with DPW

meeting so they're aware of of kind of

the project and and you know the amount
of units we're proposing so and they you

know I think every department came up
with concerns you know water usage

say uh 126 is a state uh state road is

way way I'm looking at it. Although
routes are all while they're not like
[52:27]
the the highways uh and I apologize I
use the term highway the routes those

routes are owned by the state and under
mascots's uh jurisdiction

rating plan was picked with great care,

mind too, these are one story, you know,

units. It's it's most multif family and
and probably the most cost effective way
[57:05]
is one building three or four stories
tall. So even next door on depot court
[57:12]
those are twotory uh buildings. So will
be shorter than those.

of a little bit wider there because

it's, you know, where the backyard is
flat and it's basically the same

elevation as the unit and we're trying
to get it around that unit right there.

18 is probably the widest buffer
throughout that whole back area there. I
