[0:02] [laughter] All right. Um
[0:06] 8:30. Uh this is a meeting for the burn distance review board. We have a quorum
[0:12] this morning and uh order the business meeting. Our first item is approval of
[0:18] minutes from our July 15 meeting. >> Mayor.
[0:21] » Yeah. If if I could [clears throat] before we go into the order of business
[0:26] meeting and go through the approval of minutes and property review and new
[0:31] properties, [laughter] there's enough new people here in the
[0:35] audience. I guess if it's okay, I'd just like to make a couple [clears throat]
[0:40] editorial comments before we get started. So, appreciate everyone being
[0:44] here. Um, just to make sure that we're all on the same page as we start our
[0:49] discussions. The nuisance review board was established two years ago and this
[0:56] group that meets once a month is responsible
[1:02] for reviewing complaint forms that have been submitted to the city for
[1:09] consideration and to be addressed. So that's what this board every member has
[1:16] been established to do. So our job as individuals on the nuisance review board
[1:21] is to sit in a meeting [clears throat] kind of be the I guess mediators of
[1:28] neighborhood concerns and issues and to review those you know complaint forms
[1:35] that have been submitted. So that's what we've all been requested to do this
[1:41] board and that's what we're going to do this morning. We have, I would say, a
[1:47] record number of properties to review today. So, this meeting is going to take
[1:52] a little bit of time. It's going to take a little bit of patience. And what I
[1:56] hope we will do is that I hope we'll methodically and compassionately
[2:02] go through each of these properties, discuss them, and with deser discernment
[2:08] come up with what the right recommendation as a nuisance review
[2:12] board would be. So, that's kind of what I want to just
[2:18] throw out there to set the stage for the meeting even before we get into any of
[2:23] the property reviews. Um so so mayor one one question I would have an addition
[2:30] before we get started you know as we go through the properties I think in the
[2:36] past you know as we've gone through property by property
[2:42] you know if there's anyone in attendance that has input on that property
[2:48] I think it's fair for them to provide their input at that point in
[2:53] [clears throat] time while we're discussing
[2:56] not not after we've made a decision, while we're making the discussion, while
[3:01] we're having the dialogue. So, that that would be a suggestion I would have. I
[3:06] know with the last meeting, we did that with one of the properties and I thought
[3:10] it worked effectively. So, anyways, that's my soap box and my two cents
[3:16] before we get going. So, thank you for listening. Okay. Um, [laughter]
[3:26] so are we I [clears throat] think we I
[3:29] don't think we approved the minutes. >> No, I I jumped in before that. I would
[3:33] make a motion we approve the July 15th burn nations review board meeting
[3:37] minutes as presented. >> Okay. So, there's a motion on the floor.
[3:40] Is there a second? >> I'll second it.
[3:42] » Second by Cal. All in favor signify by saying I.
[3:46] » I post same sign. Okay. Um the next item on the agenda is
[3:52] property review. Um that is previous properties that that have had complaints
[3:58] filed against them. Um and our first property is u
[4:07] 753 North Carolina Street. Um [clears throat]
[4:13] there are photos there from July and August.
[4:18] Um, so going back to the last meeting,
[4:23] [clears throat] I believe, which was on July the 15th,
[4:27] we just approved meeting minutes limits. So at that meeting, we were going to
[4:32] send a grass and weed letter. Um, and I believe we we say in the review of
[4:40] properties documentation we have in front of us that that was sent via
[4:44] certified mail on July the 16th. So my question, no one's currently
[4:51] living in that property. So where do we send it? Did we send the water bill to a
[4:58] another address that >> it goes to where their um property taxes
[5:03] go? They're outside Decator in the country.
[5:06] » Okay. So that's where they get their water built also then I'm assuming.
[5:11] » Yeah. >> Okay. And that's where we would have
[5:13] sent the certified letter. >> Mhm. [clears throat]
[5:16] » So do we do we know that they received it? Did we have
[5:20] » Yeah. The receipt. >> Okay. So they received it. Um, and for
[5:25] the grass and and weed letter, they were given the normal 10 days to remediate.
[5:35] And I don't know, in my opinion, it doesn't
[5:38] look like they've remediated. [laughter] >> Well, if that was sent mid July, we're
[5:43] in mid August now. And it's rained a lot.
[5:47] And I would say this looks pretty normal for being cut. And then we've received a
[5:54] lot of rain and my yard grew a lot in this past week. So
[5:59] I don't know if you can say this is a month's worth of growth or did they mow
[6:04] it and this is a couple weeks worth of growth.
[6:09] » Okay. >> Hard for me to tell.
[6:11] » Yeah. Then from a I guess from a process
[6:16] perspective, I mean would we have checked them 10
[6:20] days after they would have received the letter so
[6:24] that we know what it was on July the 26th?
[6:33] » Ron, is this the is the owner Vicky Ellis?
[6:37] » Yeah, >> I think you talked with her. You
[6:40] mentioned you talked with her a number a number of weeks ago.
[6:45] » She was at one of our meetings >> twice.
[6:49] » So she owns she owns this letter.
[6:54] » So So to Chief Taylor's, you know, point.
[6:59] » I don't know whether it was in good shape 10 days after the certified letter
[7:05] arrived in [clears throat] July or not. So, I guess we can't really say yes or
[7:10] no on that for sure. >> I would think that I would bet on it
[7:17] that it was weeks before.
[7:22] » So, what >> you handle it the way you think is best,
[7:25] but this is not just happened in the last two weeks.
[7:29] What what I would recommend since we've been down this road with them before
[7:34] that we send another grass and weed letter certified
[7:39] and that we >> follow up at 10 days and if it has not
[7:45] been remediated then we take steps to remediate like we would normally do. And
[7:53] I guess the other thing I would recommend when we add some sort of cover
[7:58] letter to these letters that we mail out, we seem to get better response
[8:03] because we tell them specifically what the issue is and the concern is in the
[8:09] case of this one. They're not from burn. They're not
[8:14] living in the property. So they need to make sure they're mowing when they're
[8:22] working on the property. When they come down to do their construction work, they
[8:28] need to mow, you know, just like they were living in it. So that that would be
[8:33] my motion. And I think we need to need need to send them another grass and weed
[8:37] letter and we need to also include some sort of cover letter that hey
[8:44] you need to take care of your property not living.
[8:48] » What would be the time [clears throat] >> on a on a grass and weed letter? It's
[8:53] always they got 10 days to remediate. So, we send out mowing letters that are
[9:00] five days, >> which I'm fine with five days.
[9:04] » So, >> I mean, because
[9:05] » if I would say if it's just mowing, if it's over the 8 in, normally we have
[9:10] police go out and measure. If it's over the 8 in, we send a mowing letter
[9:14] » and then we follow up in five. If they haven't mowed it, the city can either
[9:18] mow it or we can pay someone to >> and maybe the reason why it wasn't
[9:23] checked up was it wasn't a mowing letter. It was a business letter.
[9:26] » Yeah. those we stay on top of and check up with and then we invoice them for if
[9:31] we would do that. >> I think that would be a better solution
[9:35] for this because it's a shorter time period. There's better followup for more
[9:40] followup. [laughter] So, I would alter my motion to sending a mowing letter by
[9:47] certified mail to the owner um and then follow up on it and if it's not
[9:54] remediate. the other things that we've talked to them about as far as keeping
[9:59] the yard and stuff cleaned up while they're working on the property in the
[10:04] backyard. They're doing that. It's the front yard that is on Jefferson Street.
[10:09] It just doesn't look very good and it needs to be tended to better and they
[10:16] don't live there. So, they need to be more responsible on making it happen on
[10:21] a regular basis. At the bottom of the pictures that went with the letter last
[10:25] time, we put grass seeds mowed weeds on the entire property. Both front yard,
[10:30] sidey yards, backyard, and behind the garage all need trimmed. This was sent
[10:34] with the letter, too. >> Okay.
[10:36] » So, with the pictures >> and I'm okay sending the pictures with
[10:42] the pictures that we have with the letter.
[10:46] » I'll make that motion. >> Excuse me. So, we're saying within 10
[10:51] days this has to be mowed. Five days. >> Perfect.
[10:56] » Because we're doing a mowing letter, >> not a nuisance,
[11:00] » versus a letter from the nuisance ordinance.
[11:03] » Okay. >> Where we've always used 10 days as the
[11:07] norm. >> Okay.
[11:09] » So, it's actually a shorter time frame than we did last time.
[11:15] » Okay. So, we have we have a motion and a second. All in favor signify by saying
[11:20] I. >> I oppose. Same sign.
[11:28] » Okay. The next um property is 306 Winridge.
[11:33] Um he was issued a
[11:38] [cough and clears throat] $100 fine on July the 20th
[11:43] and he stopped in and
[11:50] said that he couldn't pay the fine.
[11:55] So, um I said, "Well," I said, "It's up to
[11:59] you whether you paid it or not." Um he said, "Well, if I don't pay it, they'll
[12:06] issue a warrant for my arrest." Um, [clears throat] and I said, "Well, I
[12:12] don't know if that exactly happens, but anyway, he just said he couldn't pay it.
[12:17] He's dealing with a lot of a lot of issues. His dad's sick. Um,
[12:24] he's had multiple reasons for not being able to pay it." Um, so I I
[12:33] said, "Well, it's it's a fine that is due and you owe the fine." and um and he
[12:39] walked out. So, >> and when was this, Greg?
[12:44] » It was um >> when he came in.
[12:46] » It was the day the fine was due. He came in. It was right after Swiss stays that
[12:50] Monday. >> Yeah.
[12:51] » After Swiss, >> right? It was right after Yeah, it was
[12:54] right after Swiss stays. >> So, what [clears throat] what follows
[12:59] this situation? Um what what I would like to interject
[13:06] this property even from our last meeting if you look
[13:11] at the two pictures um Greg I think you mentioned to him at
[13:16] one point in time maybe getting just a little better
[13:21] organized with what you have on your front porch
[13:25] and he definitely has attempted to do that. It's all kind of up by the front
[13:32] door where it used to be kind of all over the place in the backyard. Um, they
[13:38] have worked on some of the vegetation. I mean, you know, hauling away some of the
[13:44] stuff that they've cut down would be helpful, but they've cut some stuff
[13:48] down. And if you remember right, they had several vehicles that it took a
[13:53] while for them to get removed. They did get removed. Um they had an unsafe
[14:00] vehicle um sitting in front that was up on jacks that we asked them to make safe
[14:07] and get remediated. They did that. Um so from where this was six months ago, they
[14:16] have made strides. >> So what are you suggesting, Ron? Yeah,
[14:21] [clears throat] >> I'm suggesting at this point I'm not
[14:25] sure what more we want to push for.
[14:32] I mean, I drove by this property last night and it's it's not half as bad as
[14:38] it was six months ago. So, I'm not I guess would I like to see more
[14:47] progress? Yeah. But under the circumstances,
[14:52] I'm not sure what what the next step would be.
[14:58] [clears throat] >> How does the
[14:59] » fine the fine is still there, >> right? The fine is still a record. We
[15:03] can turn that into the state, >> which means if there's a tax refund, we
[15:07] can attach that. But I think what you're saying is other than that still hanging
[15:13] out there, um there's been progress. So if there's no progress, then what's
[15:20] your next step? >> I if there isn't any progress, you can
[15:25] keep assessing fines that you may not collect right away.
[15:30] » But yeah, >> at what point do we put a lean on the
[15:32] home? >> We don't have that capability,
[15:38] » but we do have a capability of attaching, like I said, through the
[15:41] state. We can attach tax refunds, those kind of things.
[15:45] I mean, I think there's two options. You could either find them again
[15:54] or we could monitor the pro monitor the progress to make sure it doesn't go the
[15:59] other direction. So, un those are my two options, but maybe someone else has
[16:06] another option. We can find him again. But I my thoughts
[16:12] are if he says he can't afford to pay the $100, he won't be able to afford to
[16:16] pay the $200. So, but if he doesn't make progress, we can find him again.
[16:24] » If it gets worse, >> if it gets worse or if it gets worse,
[16:27] » starts again. >> Go ahead, Dwight. You were going to say
[16:31] something. So, we've been living at this for six months.
[16:37] » But you have to you have to remember what it looked like six months ago. I
[16:40] mean, there was a car dug in the back of the
[16:44] » truck >> or a truck in the back of the yard.
[16:47] There was cars without tires on jacks in the front. I mean,
[16:51] » a car without an engine. >> This home is trying.
[16:55] » You have to remember also that that place looked like that 20 years ago.
[17:02] Does he own the property? >> His dad does.
[17:06] His father owns the property. [clears throat]
[17:08] » We know this individual. >> I I just know the guy that comes in.
[17:13] It's his son. But >> had him several times.
[17:15] » Yeah. Until we had until we had nuisance
[17:19] board. There wasn't any complaint filed to the
[17:24] nuisance board, but that property looked those vehicles that we asked him to
[17:29] remove that were removed. Those vehicles were there 15 or 20 years ago because I
[17:34] remember driving past the property. >> Would wouldn't wouldn't this violation
[17:39] have some effect on the owner of that home?
[17:44] » Well, the owner is his dad is living in there.
[17:47] » That's what I'm asking. Where does his dad come in? He owns the property.
[17:52] » His dad is sick with cancer. So, the boy is taking care of him.
[18:00] » I mean, who who was the fine levied against? The homeowner.
[18:04] » Yeah. >> The homeowner who the dad was who the
[18:08] fine was levied against. The son comes in and reports
[18:15] what they've done and what they can or can't do. So,
[18:20] » so I guess my question is if we let this slide now, we're going to let it slide
[18:26] again next month. >> If this picture looks just
[18:30] » I think we need to determine that if is this something we can live with or is
[18:37] this something we need to keep pressing? Are we happy with the progress we've
[18:41] made already, which is huge in my opinion
[18:45] » and Can the board take a vote
[18:50] on what to go what to pursue with it or to leave it as is
[18:55] » and just monitor it? >> What is your suggestion?
[18:59] » My suggestion? >> Yeah.
[19:01] » Personally, I could live with this. They've done a great job working with
[19:07] us. >> Tim, if this was your next door
[19:11] neighbor, would you agree to let this slide? If this was right,
[19:16] » say I probably would. Yeah. >> Really?
[19:20] » See, I can't do that. >> Yeah.
[19:22] » If you look at the pictures, if you [clears throat] look from 714 to 8:18
[19:28] and take a close look at the front porch,
[19:32] to me, it looks the same. Probably they're
[19:37] using that for storage. [cough and clears throat]
[19:40] They said their garage is full, so they're storing their
[19:44] belongings out there underneath the front porch.
[19:48] [clears throat] >> You know, if all the residents of Burn
[19:51] did this, [laughter]
[19:55] I don't know that we can that we can just turn a blind eye and say, "This is
[20:03] okay. We'll let this one go." How many more are we going to let go?
[20:08] Yeah. I don't think we can do it. I really don't.
[20:12] » If you let one go, then you're gonna let somebody else go.
[20:16] » Is this rubbish or is this stuff that they belong that they own and
[20:22] cherish or need or >> need the mower?
[20:28] » Need the mower. Yeah. >> Mower could be in the backyard.
[20:35] We complain that it's in the backyard. Then
[20:37] » I think it looks like he just mowed though.
[20:45] » I think we just continue to monitor this property.
[20:51] » If we're going to do something, we need to look in the nuisance ordinance and
[20:56] find specifically what they're in um conflict with.
[21:08] I suggest we decide what we're going to do and let's move on.
[21:13] [clears throat] >> Well, I guess I'll make just just so we
[21:19] all know how the motion process works. Dave, keep us straight.
[21:24] » I do have a suggestion. Um, I'm working with Kelly Amstead, so I'm putting
[21:28] together a spreadsheet of local community members that are willing to
[21:34] possibly help with a situation like this. Can we monitor at this time and
[21:39] then when I get the list, maybe put him in contact with somebody like a church
[21:42] group or youth group that would be willing to go over there and possibly
[21:46] work on these vines in the backyard um to clean up the backyard a little bit
[21:50] more. The rubbish in the in the front, I don't know what we can do about that. He
[21:54] obviously can't afford a storage unit if you can't afford to pay the fine.
[21:59] » I think that's a good suggestion. >> And I will be more than happy to put him
[22:04] in contact with somebody that would be willing to help him, especially if his
[22:08] dad's ill and he's taking him to to appointments. He probably doesn't have
[22:12] the time >> or he might not even have a saw.
[22:14] » And I think there might be some groups in town that would come in that
[22:19] situation. >> Yeah. And we're working on getting a
[22:20] group and Kelly on on that idea. I think it's a a great idea. I think that
[22:29] information probably needs to be reviewed with the nuisance review board
[22:35] that this is [snorts] information that we're going to include in future
[22:39] letters. Um, so that was the one recommendation I was going to have on
[22:43] that. Um, I think it's a great idea. We've talked about Neighborlink before.
[22:48] Neighborlink would be a great organization to get reinvived. Um, it
[22:55] was great when it started. Um, but it could use a little uh, you know,
[23:00] transfusion of energy. Um, so [clears throat]
[23:04] I I would be fine based on what you're saying. I'll make a motion, John, to
[23:10] your point and then we can see if we can move forward. So, so my motion is
[23:16] I would like to see us monitor the property at 306 Moon Ridge Trail for
[23:22] another month, make sure that it doesn't go
[23:27] backwards, and at the next meeting, if we have
[23:32] groups that are identified that could help this
[23:37] owner, that we would include that information in a communication to them.
[23:42] So that's my motion. >> Could we include
[23:46] getting some help [clears throat] at this point?
[23:50] » Not at this point because there is >> Let's Let's consider that.
[23:54] » Well, I can send them the neighbor link brochure that we have in our lobby
[23:57] » and send that to them and just put a a handote in there telling them that we're
[24:01] working with >> other council members to come up with a
[24:04] list. [clears throat] >> We've done that before on a couple other
[24:07] properties. We've sent them the neighbor link.
[24:10] » [clears throat] >> Now,
[24:11] » you know what I have in common? >> If they have a lot of stuff on the
[24:16] porch, it's been sitting there for a year, they haven't been using it. So,
[24:22] why wouldn't you just get rid of it if you're not using it? Um, sell some of
[24:28] it. That give them a little money or just just get rid of their junk. Um, if
[24:36] they're not using it. that that's just the common sense thing that they could
[24:41] do. Wouldn't cost them anything. >> Ron, let's kind of just leave things
[24:47] look terrible. >> Let's move on with
[24:52] » interjecting her her suggestion. >> So, I will add your that point to my
[24:58] motion. >> Okay.
[24:59] » And that's my motion >> and I'm a second.
[25:02] » Okay. >> Okay. We have a motion and a second. All
[25:05] in favor signify by saying I. >> I post same sign.
[25:18] Okay. The next um property is 465 North Broner Street. [clears throat]
[25:30] Um it's been going on for two years.
[25:36] two years that property um has um
[25:44] we had had we had had a talk with the owner and the owner said he was going to
[25:49] have a fence installed as of August 18th.
[25:54] And I've that fence is not up because the fence company hasn't been down to
[25:59] put it up because I think they're busy. they can't they just haven't been able
[26:03] to get here from what I understand unless somebody else has something. Um
[26:08] so we're still waiting on that fence um to be put up on that property. Um
[26:16] and [clears throat]
[26:19] the um he had he had stopped in and had a talk with me
[26:26] after he got a warning letter and I think I mentioned this last at the
[26:36] last meeting. He um he is on disability. His wife
[26:44] was sick or had been hurt um and was off of work for several months and she's
[26:51] back to work now. And so I told him at that point in time if he could just
[26:57] [clears throat] make his things um more orderly looking that that would go
[27:03] a long way with with our committee just to have it look a little nicer. I don't
[27:10] know if he has done um done that totally, but um
[27:18] [clears throat]
[27:21] that that was his comments to me when he stopped in and I told him I think the
[27:25] committee would just appreciate um
[27:30] seeing an effort on your part to make things look a little more orderly and
[27:36] not not like a mini junkyard. So
[27:43] he um I thought he understood what that meant.
[27:49] He sounded like he did. So, but I know the trailer
[27:54] um that this is his way of trying to make money since he's on disability is
[27:59] to um gather these items on a trailer and
[28:04] then take them someplace and sell them. And um
[28:09] so that's why we see the trailer empty sometimes and then the next week it's
[28:13] full again. >> Shouldn't be a trailer on the property
[28:16] like that.
[28:20] » Half the time it's almost in the front yard.
[28:23] » I don't know. We You know, we kicked this thing down the street for two
[28:28] years. This came up in August of 24. Here we are in August of 26 and nothing
[28:35] is changing. >> Okay. So, let me interject.
[28:38] [clears throat] >> I'm ready.
[28:39] » We had this discussion at the last meeting when the owner was here. They've
[28:46] not been on the nuisance review board list for two years. There was a window
[28:52] six, [laughter] seven months where they addressed their first list of issues we
[28:58] had with them and they were off. So, we can't say that they've been on for a
[29:05] continuous period. They've been on for two periods.
[29:09] » At the beginning, it was it was the front yard and we they addressed what we
[29:13] said, >> right? So, that got addressed and then
[29:16] the second time it came up, it is the scrap. It is the trailer. It is the
[29:22] backyard. And at the last meeting when the owner was here,
[29:28] he said he told us, you can read your meeting minutes, that the owner is
[29:33] buying or the renter is buying the property [laughter] off of them on a
[29:38] land contract. and he the owner had come up with an
[29:43] agreement with them that the owner would the property owner would pay for a fence
[29:50] and then he would add that to the amount that they owe on the house and both
[29:56] sides were agreeable to that. And what we left the last meeting with is if they
[30:03] can get the fence up and like the mayor said, make things a little more orderly,
[30:10] then they would address the things that are in front of us. So here we are now
[30:14] at this meeting. The fence isn't done. So, so my thought
[30:21] reviewing this and getting ready for this meeting is I think the owner
[30:27] and renter need to be requested to come to the next meeting and give us an
[30:33] update where they are one month from now because I don't I don't know that we can
[30:40] take any other steps other than that today.
[30:43] » Good suggestion. >> Okay. Uh
[30:47] September the 20th of 2024, newspaper clipping 465 Sprunger Street
[30:55] is addressed. >> Proof is in the pudding.
[30:59] » Right. >> So, aren't we a little tired of keep
[31:02] talking about 465 Sprunger Street? I'm tired of it. [snorts]
[31:07] that how much longer are we going to talk about this property and not really
[31:13] get to the issue?
[31:18] Are we just going to keep pushing this thing down the road? [clears throat] I I
[31:21] I can't agree with this. >> So to Ron's point though, it was on
[31:28] September 24, right? That's what you just said.
[31:31] » September the 20th of 2024. Okay. It was in the burn track week. Okay. Then it
[31:37] went but then that nuisance thing was taken care of and they were were not on
[31:43] our list for a period of time until he started scrapping and we had issues with
[31:50] the items that were back there by his uh >> carport
[31:56] » uh carport. Right. >> You told him put it in a fence.
[32:00] » Yeah. Okay. Right. >> Okay.
[32:04] » So what's your suggestion, mayor? Excuse me, John. So,
[32:08] » this came up. >> Go ahead.
[32:10] » This came up on December 20 of 24. We talked about it February the 14th of
[32:18] 25. This is ongoing. >> So,
[32:21] » and again, and again on March the 21st of 25 and here we are again with this
[32:28] property. >> So, what what came up in February and
[32:31] March? >> We've talked about this many times. What
[32:34] came up about the property in 25 the the scrapping or
[32:40] was it the stuff that was in the front yard?
[32:42] » Probably all the above. >> I can't I would have to go through here.
[32:47] I've got it in here. >> Well, I think I think the property first
[32:52] came up because of the stuff that was parked in the front yard that he had
[32:55] garden tractors and stuff parked in his front yard. They took care of that and
[33:00] then they were off our radar, so to speak, because they took care of that
[33:04] complaint form and then there was another complaint form filed
[33:07] [clears throat] on behalf of that property with the stuff that was in the
[33:13] carport when he started scrapping. >> I think there were several rounds,
[33:16] » but I don't know what the time frame. >> I think there were several rounds about
[33:19] the front yard. Yeah. >> And each time they they took care of it,
[33:23] then it happened again. And so, but but in the end, but now there's it's not the
[33:29] front yard, it's the backyard. And so, and I think what the what the board had
[33:33] told him is that if you build a fence and put everything inside there, you're
[33:37] going to probably be okay. The fence hasn't gotten built.
[33:41] So can we come to some sort of [laughter] statement or conclusion at
[33:46] this point [clears throat] to get
[33:48] » again back to making motions and seeing whether there's a majority that wants to
[33:55] go with the motion. I hear what you're saying, Dwight. I do.
[34:01] That's this is this property has been discussed for a while. But
[34:07] » what do you what do you suggest, Dwight? What do I suggest? I what I would
[34:13] suggest absolutely you got to go to the pocketbook.
[34:18] » Money talks and all that other stuff walks. You know, you get we've talked to
[34:23] the owner of the property and that owner is just
[34:28] we all know it. So, if this place was beside my property,
[34:39] I'd invite the man over over a cup of coffee and let's talk about this. And
[34:43] what are we going to do? You have to clean it up.
[34:48] Dave, if this place was beside your place, you would absolutely have a fit.
[34:52] » I'd be talking to my neighbor. >> Absolutely.
[34:55] » See what I could help do. But we've talked to the owner,
[34:58] » but the city's not in that position. Yeah.
[35:01] » You know, and the fence isn't that's a band-aid. That's all it is is a
[35:07] band-aid.
[35:11] I I don't I don't know what the answer is here, but we got to do something as a
[35:15] board. We got to put some teeth in it. I guess I guess I'm still going to go
[35:21] back to our last meeting when the owner was here and we gave them in our meeting
[35:28] minutes the agreement that they could proceed with the fence and then
[35:35] hopefully that would resolve the situation. The fence isn't there yet. So
[35:41] the owner's not here. I don't know why the fence isn't here yet. Um, but I
[35:47] guess I'm just going to go ahead and make a motion.
[35:49] » [clears throat] >> My motion is that we send a letter to
[35:54] the owner and to the renter and request them to attend the September
[36:04] um nuisance review board meeting with an updated plan on when the fence is going
[36:11] to be in place and what they are going to do to
[36:16] just address any issues we would have as a board on their property. So
[36:23] » second. >> That's my motion.
[36:24] » Let's let's move on it with a second. >> Okay, we have a motion and a second. All
[36:30] in favor signify by saying I. >> I post same sign.
[36:38] Okay. 866 West Van Beurren. Um
[36:45] shed has been relocated to the backyard. Um, letter was delivered on July 16th.
[36:52] Owner was to have the rubbish cleaned up by 8:17.
[36:56] Um, and they've made progress on that
[37:01] [clears throat and laughter] property. From what the pictures I see, all the
[37:07] tires and the trash cans have been moved away from that fence.
[37:13] Um, Anybody
[37:19] else have any comments on this property? We continue to monitor the property.
[37:23] » I I think [clears throat] getting the shed moved was huge. I know that wasn't
[37:28] a nuisance review board matter. So, Shannon, thanks for coordinating that
[37:33] effort. Um the tires and rubbish that are there in the 714 picture that we
[37:41] specifically sent them the letter on last time um are gone. It's hard to see
[37:46] in the picture, but they're not there. The one thing I did want to ask about um
[37:53] and looking at this property in a little more detail than last night um the
[37:58] trailer that's there um at one point they had a trailer with no tires and
[38:04] stuff on it. I think this is it, right? >> No, I I think you describing that maybe.
[38:09] » Okay, so this this trailer to me and maybe I couldn't see it. It's not
[38:16] plated. It would need to be plated, right, [laughter]
[38:19] » to be legal. >> Yeah.
[38:21] » So, >> I would like to send them a letter like
[38:26] we've done to some of the other properties and thank them for their
[38:29] progress, but I would also like to still send a I think junk vehicle is what we
[38:36] would consider it because it's not licensed.
[38:40] send them a junk vehicle letter and circle the the trailer. And Chief
[38:48] Taylor, if if you want to check that before we mail it to make sure my eyes
[38:54] aren't deceiving me, that would that would be the only thing I would see that
[39:00] they still need to do. and and we're going to be we're going to be talking
[39:03] about other vehicles coming up in the meeting with not valid plates and things
[39:09] like that. So, this can just be the first one on the docket.
[39:14] So, I would make that as a motion.
[39:19] » Okay, [clears throat] we have a motion and a second.
[39:22] » All in favor signify by saying I post same sign.
[39:30] » Okay. Um,
[39:33] next property is 75 High Street. A, um, rubbish and junk letter was
[39:40] delivered on 716. Property owner staff items removed by
[39:46] 7:26. Um,
[39:50] and looks like most of those items are still there. So,
[39:55] um, do we send another letter with a fine attached to it if it's not remedi
[40:01] remediated in 10 days? Well, I I think on this one, back to kind of the process
[40:09] that we had talked about a few meetings ago and that I reailed to everyone
[40:14] yesterday or the day before. Um the first meeting we discussed the the
[40:21] complaint form and then we send a letter which that's happened. We're now at the
[40:28] second meeting. What I would suggest doing is we send a
[40:33] another letter set, the same letter set, and this one being the second iteration,
[40:41] that an official warning citation be added to it so that they know that the
[40:48] next step is occurring because I mean in looking looking at
[40:54] these items and looking at the ordinance this morning, the vehicle that's on the
[41:01] ground, doesn't have an engine, and it's just sitting there. That is definitely
[41:07] right spelled out in the ordinance, a jump vehicle. The white vehicle, I don't
[41:13] know if it's got a valid license plate or not. If it doesn't have a valid
[41:17] license plate, then it also comes under the junk vehicle ordinance. The red
[41:23] truck is I believe what the gentleman drives because it was not there last
[41:29] night. Um so it comes and goes. So the other two are really what I think are in
[41:36] question. So since they've made no progress, they've not followed up to
[41:41] tell us anything. Um we can also invite them to the next meeting if they would
[41:46] like to attend. >> We need to [clears throat]
[41:49] send a weed letter to along with it. It looks like there's
[41:54] leads along the cars that are sitting there.
[41:59] That's that's fine, mayor. >> Or a kind combination letter of sorts.
[42:07] So to keep John happy, that's I'll be willing to make a motion to keep
[42:13] [clears throat] us moving forward. Make a motion that we send a junk
[42:18] vehicle, a junk and rubbish letter, and a grass and weed letter with a warning
[42:26] citation to the 705 High Street property.
[42:31] » That's my motion. [cough] >> You need a second?
[42:34] » Yeah, >> you heard it.
[42:35] » Okay, >> we'll move on. We got a vote yet, John.
[42:39] » We got today, John. >> We got We got a vote yet, John. We have
[42:43] a motion.
[42:46] [laughter] >> For goodness sake.
[42:49] » We have a mot. We have a motion in a second. All in favor signify by saying
[42:53] I. I. >> Okay.
[42:59] Next item on the agenda is >> Mayor. Can I ask a real quick question?
[43:03] So, like on 705 High Street, when we send these letters, we know
[43:10] that we're sending them [clears throat] to the owner that that they own the
[43:14] property. I mean, if it would be a rental situation, we would send them
[43:19] both. >> Okay.
[43:21] Thanks.
[43:24] That would be if the if the utilities are going to a render and the property
[43:29] unit is something right and it goes above. [clears throat]
[43:33] Okay. >> Okay. The next um item on our agenda is
[43:39] our new properties or new complaint forms
[43:43] that have um been sent in or dropped off.
[43:50] And the first one in on the property on the new property review. The first
[43:56] picture that we have is from two it's either 256 or 266 Baltimore Street. And
[44:05] the initial complaint was for a um
[44:11] vehicle in the alley. Um and the
[44:18] » truck vehicle has been removed. Um
[44:25] cuz it was a the complaint form talked about a fire truck in the alley. That
[44:30] that vehicle has been removed. However, there are two other vehicles still in
[44:35] the alley that need to be uh removed um from the alley. And
[44:43] » I think there's a trailer, too. Trailer. Yeah.
[44:46] » The car [clears throat] to the west of the fire truck. The license plate was
[44:52] 20,023. And as I went by yesterday, the fire
[44:57] truck is in the yard, >> right?
[45:00] » In the front. >> Yeah.
[45:04] Well, on on this property, [clears throat]
[45:07] so we're we're talking about basically alley rightway stuff, right,
[45:13] Dave? >> Yeah. Yeah. You can't block a public
[45:16] way. >> So So page four in the nuisance
[45:20] ordinance talks about campers [clears throat] and trailers and things
[45:24] like that not being allowed to be parked in a public way for more than 24 hours
[45:30] in a 30-day period. So the trailer's definitely
[45:35] Well, the trailer's attached to the truck. So
[45:38] » what you're citing though is is like if if it's parked on the side of the road,
[45:42] but people can still get through when you completely block an alley, then
[45:49] operational fire trucks can't get through as well as utility workers.
[45:55] That's what that's what >> and it's been that way. I
[45:58] » think you can only park in an alley like that for like 15 years. It's just
[46:01] onloading and offloading. >> Here are being blocked. That's the
[46:04] thing. >> It's been that way for months. And I'm a
[46:08] little surprised that the neighbors
[46:12] haven't complained. And you know some of the neighbors very
[46:18] well, Mayor. >> We haven't had a complaint form filed.
[46:23] John, >> that's cuz he's an elected official.
[46:27] » I suggest sending a letter.
[46:32] so much time. And >> so, so this this property, we're talking
[46:37] about it at the nuisance review board, >> but is not nuisance ordinance specific.
[46:44] » Yeah. >> So, this isn't even honestly, this isn't
[46:47] something that had to come to this board.
[46:50] » Yeah. It's it's really something that the police department should just take
[46:54] care of. >> So, I think out of this, what do we want
[46:59] to say? We're gonna do >> I can just
[47:12] with that police department will address this.
[47:27] Okay. >> [laughter]
[47:28] » The next next property is uh 466 Baltimore Street,
[47:35] which um has been on our radar before for
[47:41] um >> other other
[47:44] » other issues that they addressed by putting up a fence. And now this is a
[47:49] new complaint form addressing
[47:54] some of the other things that have shown up around the property that are of a
[47:58] concerning nature. So um [clears throat]
[48:04] we had um I believe um
[48:11] three three complaint forms filed on behalf of
[48:15] this property. Anybody
[48:19] [clears throat]
[48:38] here? Anybody here that wants to provide any comments on this property?
[48:43] The less on that property are as tall as the cars.
[48:48] [clears throat] >> I mean, are they
[48:50] » I walk I walk the streets and it's just unbelievable.
[48:56] [clears throat] >> Okay. I mean,
[48:58] » so they have two cars that obviously haven't been moved in months because the
[49:04] weeds have grown up all around them. >> Okay. And I guess this is a little bit
[49:09] personal for us is we once lived in this house back in the 80s,
[49:14] but I hope you guys don't think the fence solved the problem
[49:19] because you still see the junk on the other side of the fence. There was even
[49:22] a temporary shack behind the fence where it looked like somebody might be living.
[49:28] I mean, this place of all the properties in burn, this was
[49:33] to me one that's just been sitting there for
[49:36] several years. I can't even walk by it without getting sick. I just
[49:42] » Okay, I need to say a couple years ago Tammy was here and she said she said,
[49:47] "My goodness, that property looks horrible in Colorado. If you would have
[49:54] a property like that, they would find you right away." Well, you
[49:59] [clears throat] guys made them have a bigger fence. They have
[50:06] a lot of times seven cars. The whole front's full of cars
[50:11] » plus they have to park in the yard. They have a trailer full of junk in the
[50:17] yard. But what what kind of bothered me was
[50:24] [clears throat] two or three of the cars sitting on
[50:28] outside of the sidewalk have license plates that has has been expired for
[50:35] four months and you know and have weeds up three feet
[50:43] around the cars. Now, [clears throat] we complained over the years, but
[50:51] [clears throat] um and they did clean up a little bit,
[50:55] but so so what do you do? You still go past and check or do you have to have a
[51:01] complaint every time otherwise you won't do anything about it? I mean, this is
[51:06] like two years now. that's been looking pretty bad.
[51:11] And uh so every time they do something
[51:16] different, we need to complain or nothing will be done. And it it kind of
[51:21] bothered me
[51:26] the the cars that have license plates that are over overdue.
[51:32] Um
[51:35] there's a couple of couple of people I know really well. I have five kids. They
[51:41] moved to burn from Fort Wayne [clears throat]
[51:46] and uh
[51:49] she went to the grocery store and came home and drove in the driveway
[51:55] and the burn please came behind her and said, "Hey, your sticker is over
[52:00] overdue." And so
[52:06] they it was in their driveway.
[52:11] They brought a record, move the car away, and so you can have your car back
[52:17] when you get a sticker. [clears throat] Well, there's people
[52:22] in my joining block. There's at least three or four cars sent out there with
[52:29] expired stickers and nothing is said about it.
[52:35] So what's the difference between 11 years ago and now? We just don't
[52:42] » back them up anymore or you know. >> So Norville, I had I had a question I
[52:46] want to interject here so we can get your question answered. So
[52:53] chief on a expired license plate if it's mobile and a police person sees them
[53:02] county city state whatever they [clears throat] would pull them over and
[53:06] ticket them for an expired play driving with
[53:12] » operating >> if something is parked we've had this
[53:17] discussion before and I I think I just want to re refresh refresh my memory
[53:23] is it if it's parked, you don't know whether they got the the
[53:29] registration renewed and it's inside and they just haven't put the sticker on. If
[53:33] it's just sitting there, they're not breaking the law from a state motor
[53:39] vehicle perspective. Right. >> Correct.
[53:42] » But it's in a public >> but what they but what they are they're
[53:47] in conflict with the nuisance ordinance. >> Yeah. So, now that this property has
[53:52] come up, like we've done in other properties, we're going to need to send
[53:57] them a junk vehicle notice that you have to have current license plates on their
[54:05] cars. So, that'll that'll be the step one of the steps we take out of this
[54:09] property here. >> What I'm kind of thinking is
[54:14] if you make them get a license plate, of course, you got to have insurance. Well,
[54:18] that's going to cost them a little money. So, if it's sitting there and
[54:22] they're paying that money for a license plate, not
[54:26] using the car, maybe they'll get rid of it. Uh, that that's my thinking.
[54:32] » And and on this >> But if you don't do anything about it,
[54:35] they'll just leave it sitting there forever.
[54:38] And on this property, Norval would I'll interject since we've had interactions
[54:44] with the property owner before when the fence was going up. [clears throat] Um
[54:49] what we were told back then is that all his vehicles are plated. He has
[54:55] registrations. Um so that's what was said back then.
[54:59] » Well, they they were until March. Yeah. Five months.
[55:03] » So I >> as far as we know, excuse me, we have
[55:07] there only three people that live in that house and most a lot of days
[55:11] there's seven to nine cars all around that house and in your yard. Do they
[55:16] need that many vehicles and one doesn't even drive. So
[55:21] » I don't think there's any law as far as number of vehicles person.
[55:26] » I agree. I agree. still >> but it does need to be plated if it's
[55:32] » make them keep up on their license plates. They might get rid of a few
[55:37] » is my thoughts. >> So So on the
[55:41] » and the the other thing that I remember was that any kind of junk or anything
[55:47] needed to be within inside the fence. Anything he collects needs to be inside
[55:52] the fence. >> There's a trailer outside.
[55:57] There is, you know, they have a lot of stuff.
[56:01] It's right on the property line. And I was talking to
[56:04] » Does the owner actually live there? >> One of the neighbors and they said,
[56:07] » "Yeah, >> you know, we we live there 25 years and
[56:12] never have had a mouse problem. Now all of a sudden we do." all that junk and
[56:18] now, you know, they can't prove it, but
[56:23] there may be >> and and and I'd say from the from the
[56:27] nuisance ordinance [snorts] uh standpoint, one of the main purposes
[56:32] of it is for public safety, dealing with rodents, dealing with that that's what
[56:38] the the collection of junk, the the rodent issue is is a big part of
[56:45] why >> one of the bracketers your intention.
[56:47] » Yeah. >> I just see the town of Burn becoming a
[56:51] salvage place for these junk viewers. Okay. Make you put a fence up. You still
[56:58] have the property is crap. You know, I just don't understand why we can't do
[57:04] something about that. I mean, if it was in other areas of burn like was
[57:09] mentioned, they wouldn't allow it. So, I I I just don't like to see our
[57:15] town go downhill. >> And and another thing, we got a small
[57:21] community and we drive around. It's not Fort Lane. We're not talking
[57:27] about Slair 15 miles away. But
[57:33] line of vision. Well, it's line of vision to everybody that lives here. All
[57:38] you got to do is walk go down the street. You can look. Oh man, that's a
[57:42] junk place. That's a junk place. Now, we were we were thinking about getting a
[57:49] smaller house because she wouldn't have to go up
[57:54] steps. Well, that first house we're talking about,
[57:59] there's a bunch of junk. Uh, now, am I going to buy a house right beside a
[58:05] junkyard? Probably not. So it makes it it
[58:10] » makes our >> the line of vision
[58:13] » means nothing and burn it because it's in a
[58:18] line of vision of everybody is what I'm saying.
[58:22] » But can I just say like if you are going to resell and you're a neighbor and it's
[58:26] in your line of vision then file the complaint. I think this is a great
[58:30] committee and I think it's important that we have it.
[58:33] » That's what we do right. That's our thing. You guys are doing it right and I
[58:36] appreciate that. I think I think when we do it for our own neighborhood and we
[58:40] take care of our own neighborhood, it's not going to be a big problem. But so I
[58:43] think you guys are doing it right and I think you're right to file a complaint.
[58:46] I don't think that everyone in the world should. We don't burn is not an HOA.
[58:53] And so preferences versus safety. I think that's why this board is
[58:57] important. We we've lived there since 1974 and I've never seen it as bad as
[59:03] what it is now. >> Well, it's pervasive. I'm just gonna
[59:05] tell you it's pervasive in my opinion. We live here back in the 80s and it was
[59:10] striking at least on the north part the north side of Water Street in these
[59:16] areas. Um there there other places I agree but
[59:22] it is definitely different. I'll just say that if everybody's happy with that
[59:25] that's your that's what you guys have to decide.
[59:28] » What do you mean on the north side of Water Street? I'm just saying up on that
[59:31] area, the north side of water in that neighborhood,
[59:34] » that there are a number of homes that are that are are not kept up. That's
[59:39] what I'm saying. >> So on on 466 Baltimore Street,
[59:45] » I think we've had some good discussion. We've had input from neighbors. Um we've
[59:51] talked about some of the things that we know probably need a a letter sent on.
[59:58] I think we definitely need to send a junk vehicle letter which will address
[1:00:05] any vehicles that are not plated. We need to send a junk rubbish letter
[1:00:15] which I think from the pictures you can circle the trailer in the front yard and
[1:00:21] consider that. You can also consider the stuff along the west side of the garage
[1:00:28] to be junk and rubbish. That's on the next page with your picture.
[1:00:33] And we can send him a Weeden's Education letter [clears throat]
[1:00:38] um with what's there by the garage and back and address anything on the
[1:00:43] property with with that letter. So, I think those three letters
[1:00:48] [clears throat] were appropriate to >> I need to also These [laughter] people
[1:00:52] need to be fine. I mean, we've addressed this problem before and they just
[1:00:57] continue and continue >> these
[1:01:00] » to leave their house in just a >> so to these instances for the whole
[1:01:06] city. >> For these instances, this is the first
[1:01:10] time these items are in front of the nuisance review board. So what we talked
[1:01:16] about earlier is a complaint form is filed the first time they get a letter
[1:01:22] saying that this is what you need to address. I think Dave brought it up at
[1:01:27] the last meeting. Due process was the term that I believe Dave used. So the
[1:01:33] due process is they get time to address their issue. If they don't have it
[1:01:38] addressed at the next meeting, they're going to get a warning and eventually
[1:01:43] they're going to get fined. So, but unfortunately that's the process
[1:01:48] flow that the nuisance review board has discussed and has agreed to. So, that's
[1:01:54] that's that's the practice that we're adhering to right now.
[1:01:57] » And one of these times, maybe we could invite the owner join us here at the
[1:02:02] meeting. >> He's down here.
[1:02:05] » I put the I put the time and date of our next meeting at the top of the letter.
[1:02:11] The last time he was here, John, he >> wanted you to go to coffee with him.
[1:02:15] [laughter] >> That's right.
[1:02:17] » Is that right? >> Is that right where Trace is?
[1:02:20] » That's right. >> He's been here.
[1:02:22] » Yeah. In the evening. >> Yeah.
[1:02:28] » And And if we get to the point after the next meeting, if he's not addressed his
[1:02:33] things and for the next meeting we need to do it at night, I'm okay with that.
[1:02:38] We talked about having these once in a while in the evening. So I'm okay with
[1:02:42] that. >> So what do we need?
[1:02:44] » So that's my motion. >> I'll second it. Let's move on.
[1:02:49] » We got a vote. >> Okay. All in favor signify by saying I.
[1:02:53] » I. Same sign.
[1:03:01] » Okay. The next property on the list is 1335 Hendrick Street.
[1:03:10] Um,
[1:03:18] » please deliver
[1:03:33] » 133500.
[1:03:36] » It's the last page. >> Last page.
[1:03:49] But [laughter] going forward, these are in different
[1:03:50] » I think Kelly's Kelly's g
[1:03:56] » it is in the back. I'm just saying maybe if we go through the properties in the
[1:04:01] order the pictures are since we just got these point forms this morning it's
[1:04:07] easier just to follow the picture. Let's go back to industry street.
[1:04:15] Who owns this residence? Anybody know? >> Not sure. Android
[1:04:24] couple different people. >> Anybody have a neighbor that we could
[1:04:30] that would help us focus where this is? Anybody know who lives nearby?
[1:04:35] » Well, 1335 Henrik Street. If you want to know where it is in town, you go down
[1:04:40] past the girls softball diamond. Keep going [clears throat] south. Go past the
[1:04:45] road. It that culdeac all the way at the end. It's about one or two houses back
[1:04:52] from the culdeac east in the east side.
[1:04:59] So this we sent them a grass and weed, right?
[1:05:05] police delivered that and a copy of the junk vehicle ordinance on July 16th, but
[1:05:13] we didn't talk about this property at the last meeting. So that this this is
[1:05:17] the first time. So, >> right,
[1:05:21] » they need to officially get a junk vehicle letter because
[1:05:27] several of their vehicles are not plated. You can see that.
[1:05:32] [clears throat] And then there's tires and other things
[1:05:35] which I would consider junk rubbish. So I think we need to send them
[1:05:42] » Well, we need to send them the letters. >> We didn't we did already. Oh, this is
[1:05:46] new. >> This is new. The police the police was
[1:05:50] taking I think a grass weed letter. >> That's right.
[1:05:52] » But at the time they just handed them say, "Hey, this this is also something."
[1:05:58] » But our board never considered it. This is our first. So I think we need to send
[1:06:04] those two letters. That would be >> that would be my motion.
[1:06:11] » The cross letter again too. >> Does it need it?
[1:06:16] » There's weeds around the vehicles. >> Yeah. Then send all three of them.
[1:06:20] » So a junk vehicle letter, junk and leverage letter, and grass and
[1:06:26] » Yeah. Grass and weed letter. Okay. [clears throat]
[1:06:29] » So that's that's my motion. >> Is there a second?
[1:06:34] » Second. >> All in favor signify by saying I
[1:06:39] » I post same sign.
[1:06:51] [laughter] >> Okay. Um, I think we're at
[1:06:55] I'll go back to the pictures and we'll try to find a complaint form later. 355
[1:07:00] Columbia Street.
[1:07:04] There was a complaint filed for a trailer parked on the sidewalk with no
[1:07:09] [clears throat] license plate. So, my guess is that's a police
[1:07:17] » junk vehicle. >> A junk vehicle.
[1:07:21] I'll make that motion. I'll make that motion. Send them a junk vehicle.
[1:07:25] » Okay, [clears throat] >> I'll second it.
[1:07:26] » Okay, we have a motion and a second to send 355 Columbia a junk vehicle letter.
[1:07:33] All in favor signify by saying I. >> I. Both same sign.
[1:07:42] Next address is 424 compromise which may also be
[1:07:49] um 500 North Harrison Street.
[1:07:56] I think the complaint the complaint form was listed as 500 block of Harrison.
[1:08:02] » Yeah. >> But this is the actual address is on
[1:08:06] compromise their mailing addresses. And I think this is the same thing. There's
[1:08:12] there's a there's an RV >> and RV and the trailer
[1:08:16] » doesn't have license plates. So, I think >> Well,
[1:08:19] » it has a license plate. It's expired. >> It says the license plates are current.
[1:08:24] So, >> I went by there last night. It's got a
[1:08:26] 2027 license plate on it >> on the camper.
[1:08:30] » That would make this a non-issue. >> Yeah.
[1:08:33] » Make a motion to move on. >> The trailer. Are we doing anything with
[1:08:38] the trailer though? It did. It says camper trailer on city property.
[1:08:47] » Okay. >> And the trailer itself
[1:08:51] » is a trailer. >> The trailer itself is a non-expiring
[1:08:57] plate too. >> Okay.
[1:08:58] » Okay. So then Yeah. So then this is no action needed.
[1:09:03] » Yeah. Unless it's unless next month it hasn't approved. But you can see the you
[1:09:09] can see the plate >> in the picture. It's just hard to see
[1:09:12] because it's on the left side under the table
[1:09:15] in that square. >> I was like,
[1:09:19] » that's what I would like. >> Yeah, there is.
[1:09:21] » Oh, it's over there. Yeah, [laughter] >> there.
[1:09:30] Okay. Um, [clears throat]
[1:09:33] next property is 505 North Broner Street.
[1:09:39] So qu question on this one. So it says in our package a towing
[1:09:46] warning letter and hedge letter were both delivered on July 16th.
[1:09:50] So that must have come from some other city entity. Where where did those come
[1:09:55] from? Like the water department or
[1:10:00] » so that was Yeah.
[1:10:05] water utility department. >> So is the
[1:10:09] » what the issue what the issue is is they're parked over at the shut off
[1:10:13] valve is >> and they were being put on the shut off
[1:10:17] list and they've been asked to move the vehicle multiple times and they haven't
[1:10:22] [clears throat] >> this this is this is that's not a
[1:10:26] nuisance ordinance issue, is it? >> No, it's it's police
[1:10:31] » water utility >> water. Yeah, it's not even ours.
[1:10:35] I mean, as far [laughter] as how they get the car moved, how do they get the
[1:10:39] car? That would be up to the city on that.
[1:10:43] » I think that's why we brought it to the new center [clears throat] because they
[1:10:46] haven't communicated us communicated to us that it's inoperable.
[1:10:50] » So, which would be a junk vehicle, >> right? and the the the um hedge right
[1:10:56] there along the alleyway. When I go to take the pictures, the mirror on the
[1:11:01] Explorer rubs the hedges cuz they're encroaching on the alleyway.
[1:11:07] So that's why I had a picture of the hedges.
[1:11:09] » I'm trying to think the hedge probably in right away.
[1:11:12] » Yeah, >> but I'm saying whose hedge is that to
[1:11:15] trim? >> Probably the cities.
[1:11:17] » It might be ours if it's in our rightway.
[1:11:22] » [clears throat] >> I'd have to look at.
[1:11:25] » So you're you're saying they said they can't move it because it's in an inco.
[1:11:31] » It might be plated, but it's they said it's in a
[1:11:33] » Yeah. >> So that's why they brought it.
[1:11:35] » Yeah. >> And this has happened numerous times
[1:11:42] because I think the police have had to go there a few times
[1:11:45] » just >> to address this issue. Not to address
[1:11:48] the park card, but while they talked to the homeowner that they just wanted me
[1:11:53] to be there, someone wanted to get out of control.
[1:11:56] » Yeah,
[1:12:02] » I think I think you could give a junk vehicle
[1:12:05] letter based on their statement that [clears throat] it's inoperable.
[1:12:12] » The bottom right picture, is that a motor home? back end of a motor home.
[1:12:19] » You know who that is? [clears throat]
[1:12:24] Here we go again.
[1:12:28] » Back back back to the car. [laughter] So, are they needing are they needing
[1:12:34] the water shut off or we just know that it's there and we know that it can't be
[1:12:41] inhibited? So numerous incidents they've been delinquent on their water bill
[1:12:46] which has caused us to have to because we can't shut off the water because the
[1:12:50] vehicle is on top of it. So we've had to send the water department along with a
[1:12:54] police officer to their home saying we need payment.
[1:13:01] We have sent a letter telling them it needs move.
[1:13:05] Um they've come in and paid. Um, so we've dropped needing to tow the
[1:13:11] vehicle. Um, but it was addressed to us last time we went that it was inoperable
[1:13:17] and they cannot move the vehicle and it's been there. I think we had a
[1:13:20] picture from November of 25. >> Yeah.
[1:13:26] » Might that be Larry Springer? >> No, it would be the home to
[1:13:30] » the neighbor. Okay. I mean, we can send them a junk vehicle
[1:13:38] notice from this board if we want to. >> Yeah.
[1:13:41] » Because it's inoperable. >> I'm I'll make that motion.
[1:13:45] » I'll second it. >> Okay. We have a motion in a second to
[1:13:49] send a junk vehicle letter um to5
[1:13:56] North Brunner Street.
[1:14:00] All in favor signify by saying I >> I post same sign.
[1:14:07] Um okay 506er
[1:14:12] street complaint was filed for rubbish and junk
[1:14:17] in the yard and trailer. This is the first
[1:14:20] uh complaint form we've received on this property.
[1:14:29] And I I might add, if you drove [clears throat] by, you would see the
[1:14:32] grass around the home would be probably 8, 10, 12 inches high, too.
[1:14:40] » It's recently mowed. >> Grass was mowed [clears throat] last
[1:14:43] night. >> I drove by.
[1:14:46] » Okay. >> It's been wet. [laughter]
[1:14:50] Okay. >> I guess my question on the rubbish and
[1:14:56] junk, what are we what are we considering junk and rubbish?
[1:15:02] I know the trailer is a trailer that I believe the the renter it's a renter in
[1:15:11] a landowner is my understanding on this property uses that for pressure washing
[1:15:18] jobs when he gets them. [clears throat] Um there's a car and a trailer
[1:15:25] [clears throat] but trailers aren't rubbish.
[1:15:45] Sounds like a business. Is it zoned for a business
[1:15:49] or is this a a residential plan?
[1:15:57] I'll let Shannon [clears throat] and Dave answer that. I think I know the
[1:16:01] answer.
[1:16:05] » It's a It's a rented property. >> Um I don't have the zoning map in front
[1:16:09] of me, but I would say it's residential. >> Me, too.
[1:16:13] » I mean, I'm sure it's either an R1 or an R2. Just
[1:16:17] » pretend this property is right beside your doororker
[1:16:22] to the south, you know. >> [snorts]
[1:16:37] » Is that a washing machine or what is that? What is that [laughter]
[1:16:40] » on the on the trailer that it's a pressure washing?
[1:16:44] » No, you see in the dump >> right there. What's that?
[1:16:47] » Oh, >> that's empty now. Is that correct?
[1:16:51] » Yeah, that's empty now. >> That's empty now. that trailer is.
[1:16:55] » Yeah, I went by last night just to look at everything that Kelly went so I could
[1:16:59] look and that's 8:15 last night and it's empty.
[1:17:04] » I don't know if he got rid of stuff. I don't know. Could be in the garage. You
[1:17:10] know, >> the the vehicles north of the garage
[1:17:13] door. Is that something we can deal with or
[1:17:20] » the vehicle on the trailer? That's up the
[1:17:24] » Is that PL? >> The one that's on the trailer. I have no
[1:17:28] idea. >> Yeah, that's a car. You know, the
[1:17:30] trailer went down the alley. >> I mean, I I think that would be the
[1:17:35] question. So, that's whether it's on a trailer or on the ground that's not
[1:17:39] plated. That's an issue. I mean, like we've done on the others,
[1:17:44] if if if we want to make a a motion to send a junk vehicle notice based on that
[1:17:51] card, we can, but maybe the chief can check it
[1:17:57] out before we actually mail the letter and make sure that
[1:18:00] » he can make a motion that if it's not if he checks it out and it's not plated to
[1:18:04] send a jump vehicle. I'll I'll make a motion that we send a
[1:18:08] jump vehicle letter to the uh property owner and renter at 506 Sprunger Street
[1:18:16] uh based on Chief Taylor's assessment of the license plate situation. I'll second
[1:18:22] that. >> Okay, we have a motion and a second. All
[1:18:26] in favor signify by saying I oppose. Same sign.
[1:18:32] [laughter]
[1:18:36] Okay, next property is a complaint on 365 North Jefferson filed for a truck
[1:18:43] parked along Jefferson's three without dated 2025
[1:18:47] plates. >> So that truck's no longer there.
[1:18:50] » Okay.
[1:18:55] I [laughter] looked last night and this morning it
[1:18:58] was not there after pictures were taken. So I guess in
[1:19:06] in in this situation >> he's operating normal. He could be
[1:19:09] caught. [laughter]
[1:19:13] » You have to speak up. Yeah. [laughter]
[1:19:16] » He's not parked. He's on the run.
[1:19:21] » So on so on this since we're not going to meet since we're not going to meet
[1:19:26] for a month, what can we do if the vehicle
[1:19:32] coming back. >> I believe Lieutenant Amstrads has talked
[1:19:36] to this gentleman and told him we can't park it on the street with the expired
[1:19:41] license plate. >> So, he took care of it.
[1:19:45] » So, you think it's been addressed? >> Yeah. Okay. So, then no action at this
[1:19:50] time. If it comes up again at the next meeting, so be it.
[1:20:00] » Okay. Um, [laughter] next one is 766 North Jefferson Street.
[1:20:07] Believe this is the first time a complaint has been filed on this
[1:20:11] property for weeds and junk vehicles. >> First time currently it's been once
[1:20:18] before quite a while ago.
[1:20:22] » He mowed last night. >> He mowed last night.
[1:20:27] Again, some of these people haven't been able to mow because of how wet
[1:20:31] everything's been. Um, but >> and the plates are current.
[1:20:36] » Plates are current. Okay. >> I do [clears throat] see tires.
[1:20:39] » Yeah, I was >> with the whole West Nile. I mean, I feel
[1:20:43] like that should definitely be addressed.
[1:20:45] » That can be that can definitely >> You want to make a motion, Cal, that we
[1:20:50] send him a junk rubbish letter? >> Unless you want to. [laughter]
[1:20:53] [gasps] I'll make a motion to send a junk rubbish letter.
[1:20:58] » And you have a second. >> Thank you.
[1:21:02] » Okay, we have a motion and a second recording so [laughter] you can use it
[1:21:06] when you need it. >> We have a motion and a second to send
[1:21:09] the junk rubbish letter to 766 Jefferson. All in favor signify by
[1:21:14] saying I. >> I same sign.
[1:21:21] Um, next one is 806 North Street.
[1:21:31] » This vehicle doesn't have a plate. Um, and there are
[1:21:35] um I guess the complaint is only about the
[1:21:39] car and the fact that it's facing the wrong direction.
[1:21:44] So, Kim, is this something you can check out
[1:21:48] or >> Yeah.
[1:21:49] » Okay.
[1:21:54] » I guess my question is, >> shouldn't we still send a junk vehicle
[1:22:01] letter? It'll be good. [laughter] >> I'll make a motion that we send a junk
[1:22:06] vehicle letter to 806 North Jefferson Street uh along with the photograph of
[1:22:12] this silver or gray car. [clears throat] >> Is that the correct address of where
[1:22:18] this car belongs to? Because it's >> it's sitting in front of the bear lot.
[1:22:24] » It is sitting in front of lot. So, it wasn't
[1:22:26] » I believe there is. >> Okay.
[1:22:29] » We'll let you know.
[1:22:33] » [laughter]
[1:22:36] » Okay, that's that's that's my motion. >> Is there a second?
[1:22:42] » Yes. >> All in favor signify by A9. I
[1:22:46] » That was a motion by Ron and a second by Tim,
[1:22:50] I believe. >> I do have a question though. Would that
[1:22:54] be parked in the wrong direction? Wouldn't that be illegal
[1:22:59] in a warrant a a ticket? Cuz this [clears throat] isn't the only
[1:23:04] vehicle that is parked >> the wrong way.
[1:23:06] » No, we've given out warnings for that before. And typically people don't park
[1:23:11] the right way. >> Okay.
[1:23:23] » Okay. Um Next one is um 517 East Main Street. [clears throat]
[1:23:33] Have you heard anything from >> I'm not in contact with him.
[1:23:40] » Who lives at that residence? >> This This is the property on East Main
[1:23:46] Street we've been tracking for a while. They're the ones with the building
[1:23:49] permit right across from AMS Construction. Oh,
[1:23:52] » they were gonna >> they were supposed to build a garage.
[1:23:56] » They came to us a while back with an inter with an interpreter and they were
[1:24:00] going to have a garage built by what? October.
[1:24:04] » Yep. >> So on on this property, my question,
[1:24:09] Shane, you haven't heard from them. So
[1:24:14] would would you like to reach out to them or do we want to request them to
[1:24:18] come to the September meeting for a tax? >> Have a report.
[1:24:22] We sent a letter in June, >> right,
[1:24:25] » that just reminds them of what they're to do,
[1:24:28] » right? >> And if you look at the east end of the
[1:24:32] home, you'll find they they're continually adding items on the east
[1:24:37] side of their home. So, I have I have a feeling that I'm not
[1:24:43] sure the garage can handle everything that is on that property, but any we'll
[1:24:48] take it from there. And so my opinion is is that they would have it built by the
[1:24:55] fall. We're not going to meet again until September, middle of September.
[1:25:01] I mean, if they're not started by then, it's not going to be done in fall. So I
[1:25:09] I think we need to send them a letter and ask them to come to the September
[1:25:12] meeting and give us an update. >> That's my motion.
[1:25:17] » You got it. >> Second. Yeah,
[1:25:19] » Dwight. This is Dwight. >> Dwight got a second on this motion by
[1:25:23] going along. >> Motion by Ron and a second by Dwight.
[1:25:27] All in favor signify by saying I. >> I. Same assignment.
[1:25:34] Okay. Next one is 1046 Mil Pond Road. Complaint was filed by
[1:25:41] uh in reference to a trailer parked in the [clears throat] driveway.
[1:25:47] um too close to a fire hider
[1:25:52] which I believe was measured and
[1:25:57] is far enough away according to state guidelines.
[1:26:00] » Yeah. The law is 15 ft, isn't it? Go ahead, Greg.
[1:26:04] » Yeah. Yeah. >> Okay. At at the time of the complaint,
[1:26:09] the trailer was about 18 [snorts] in from the fire hydrant. So now he's Yeah.
[1:26:15] So, it was parked it was parked on the south side of the driveway then.
[1:26:19] » Okay. >> And and we haven't been able to
[1:26:23] determine whether >> the fire hydrant
[1:26:27] um that ruling pertains to if you're parked on the street, blocking
[1:26:33] the fire hydrant or or what. There's no definitive
[1:26:38] law that says [clears throat] it's parked on the street or in a
[1:26:42] driveway, but they they've moved it and it's not
[1:26:47] » I would think for future reference purposes,
[1:26:52] it would be good to know. The way I understand it, looking at this picture,
[1:26:56] you can't park on the street in front of the fire hydrant,
[1:27:01] » right? the driveway. I don't think the driveway has anything to do with the
[1:27:04] fire act. I mean, I'm not chief of the fire
[1:27:09] department, but that's the way I would think that the state ordinance is set up
[1:27:15] curbage because the fire department can pull up and attach even if the driveway
[1:27:21] is completely full. But again, I'm just speculating. Didn't the complaint form
[1:27:27] also mention uh line of sight backing out of his
[1:27:33] driveway? He can't see the street. >> I went down and pulled into his
[1:27:37] driveway. >> Yeah.
[1:27:38] » And I could see down the old Colonial Drive.
[1:27:42] So he has plenty of sight. And And I maybe
[1:27:48] that was when [clears throat] it was closer on the other side.
[1:27:52] » It was Tim. Okay. I think when >> I can see that
[1:27:56] » when the moved it now, you can see >> when the RV would have been on the left
[1:28:01] side of the driveway, [cough] that would have been more of an issue.
[1:28:04] And that's that's where it was at one point. So, I think the neighbor has
[1:28:09] listened to their neighbor >> and has tried to satisfy the on the
[1:28:14] north side of the driveway. >> So, there's no action in this forward on
[1:28:21] this move. Okay. Then we have um I think the last one is
[1:28:28] 166 Brian Street. I don't know if we have a an form for
[1:28:34] that, but we had a neighbor that came into lobby
[1:28:39] and this property was still kind of a
[1:28:42] monitor property is kind of keep an eye on it. the last time it was discussed
[1:28:46] about the camper. He still is thinking that there's someone living in that
[1:28:52] camper and he's also concerned with um I believe it's the blue vehicle. When I
[1:28:58] went and took pictures yesterday, it was parked correctly, but at times it's
[1:29:02] facing to the south on the wrong side of the street and he was concerned about
[1:29:05] that as well.
[1:29:09] and the weeds and stuff around the fence area.
[1:29:14] [laughter] The camper does have the bump out on it
[1:29:19] out still, but you can't tell if there's you couldn't tell if there's lights on
[1:29:24] in the evening or not. And just a background, this camper was communicated
[1:29:30] to us that someone was living in it at one time and then when we had reached
[1:29:34] out again, they had said that they were not living in it anymore but remodeling
[1:29:39] it and that's why the bump was out. So I don't know, maybe the police can monitor
[1:29:47] activity to I don't know. I don't know what we do to
[1:29:53] see if living in it. window. Of course, it's so
[1:30:03] [clears throat] on the camper. >> We don't have any clue whether it's
[1:30:08] plated, right? So, I mean, we could send a jump vehicle notice and say,
[1:30:16] "Show your registration." It it needs to have a valid license plate. Even if it's
[1:30:22] parked on priv private property, it needs to be plated,
[1:30:27] » right? >> Yeah.
[1:30:29] » So, as a starting point, I would like to at least send them a junk vehicle notice
[1:30:37] saying that it needs to be plated >> or proof of. Yeah.
[1:30:42] » Proof of registration. >> Yeah.
[1:30:45] So, that's that's my motion. There a second. [clears throat]
[1:30:51] » I'll second that. >> Okay.
[1:30:54] All in favor signify by saying I. >> The same sign.
[1:31:04] Okay. The next item on the agenda is a request to change the October
[1:31:11] meeting date from October 21st to October 14th.
[1:31:17] due to some conflicts during the regular scheduled week.
[1:31:24] So, we're moving it up a week um in October
[1:31:28] from October 21 to October 14th. So, with with that in mind, if we change
[1:31:37] that date, then the letters all need to say that the properties need to be
[1:31:41] resolved before that date >> be the 13th
[1:31:45] » next month. Oh yeah, I'm sorry. Never mind. We're
[1:31:48] talking further out. [clears throat] Yeah, we got September to get [laughter]
[1:31:53] ahead of myself.
[1:31:59] » I'll make that motion. >> Okay. Is there a second?
[1:32:03] » I'll second it. >> Okay. We have a motion and a second to
[1:32:06] move October's meeting from October 21st to October 14th. All in favor signify by
[1:32:12] saying I. >> I. Oppose. same sign
[1:32:16] » on that October meeting. I mean, we can decide at the next [clears throat]
[1:32:21] meeting, but that might be one we might end up needing to do at night
[1:32:28] for a few of these individuals. So, just keep that in mind. I would not be
[1:32:34] opposed to it. >> Okay.
[1:32:39] » Other issues? >> Yes.
[1:32:44] 805 West Main Street. The pickup truck is parked on the
[1:32:49] sidewalk every day. Every
[1:32:54] corner of Portland and Yeah. corner of Portland and Maine,
[1:32:58] » but not all day. Sometimes >> not all day. But
[1:33:02] » I I know what you're saying, Dwight. I've seen it there on the sidewalk, but
[1:33:05] I've also seen it in the driveway. >> There's not sidewalk
[1:33:09] » over a lot of what parking. >> There is not a sidewalk. It's over some
[1:33:14] of what he's parking. Literally not a sidewalk.
[1:33:18] » Well, that's not his fault. >> He started parking there. His kids were
[1:33:22] falling. >> Yeah, there is a The concrete is
[1:33:25] » I think it's >> it's up.
[1:33:28] » He didn't like dump mud. I mean, he >> Yeah, I think there's sidewalk there.
[1:33:32] It's just been covered for years. So, I say I've lived in that neighbor my whole
[1:33:36] life and I don't and that was my aunt's house. So, I was there all the time and
[1:33:42] when I was a kid that was a mud spot. So, I'm not saying there's not sidewalk,
[1:33:48] but I know that where he's parking there's not visible sidewalk that's even
[1:33:51] being utilized. So, I'm not sure if it like there are no kids trying to ride
[1:33:56] their bikes over there or walk over there or
[1:33:59] » Well, they can't because of the trim. >> They can't because there's no sidewalk
[1:34:02] » and just for kicks. Just for kids, I grew up in that house.
[1:34:07] » That's That's amazing. You both have good memories there.
[1:34:09] » Yeah, I have great memories there. And I was there till I was a senior in high
[1:34:13] school, which was years ago. But there is a sidewalk there.
[1:34:18] » Well, and I think on that from a decorum perspective, we want to discuss it.
[1:34:23] » We should have a complaint form. We should officially discuss it at the next
[1:34:27] meeting. >> I turned one in with a picture.
[1:34:31] » I had a picture of the truck. >> Yeah. So it'll be on the next agenda.
[1:34:36] » No, it's been on a few months ago. >> Oh, we
[1:34:40] » Yeah, >> we discussed it. We have a complaint
[1:34:42] form on the sidewalk issue or the trucking park is
[1:34:45] » we want to resurrect that complaint form, then resurrect that complaint form
[1:34:50] and we'll take pictures and we'll discuss it at the next meeting and
[1:34:54] research, you know, what Trish is saying and what what options there are.
[1:35:00] [clears throat] But for this board to take action, I
[1:35:04] wasn't prepared. So, yeah, I can't talk speak to it
[1:35:08] » like I could the other properties. >> And another item I have, I got a call
[1:35:13] Monday night 9:30 from a very prominent businessman
[1:35:20] in burn. He said, "What's being done with the antique mall?"
[1:35:26] He said, "It is deplorable." Excuse
[1:35:31] me. >> So, last meeting
[1:35:34] somebody was going to contact the lady that owns it in Bluffton.
[1:35:40] Did that contact been made? Has that been made?
[1:35:43] » I haven't called her, but I have I have her number. I can call her.
[1:35:48] » Yeah. Someone told me that she was selling all of the or get trying to get
[1:35:52] rid of all the things that were inside and she was selling it and she was going
[1:35:58] to sell it. So I don't know. >> I'll call her report back at the next
[1:36:02] meeting. >> Great.
[1:36:05] » Yeah. A number of people have mentioned to me
[1:36:09] the condition of that building.
[1:36:14] » I think it's a beautiful historical building. I wish there would be a
[1:36:18] complaint form. >> Refurbish it.
[1:36:21] » Buy it and refurbish it and make it a >> museum.
[1:36:26] » Well, a complaint form on that building. Everybody in Burnham will send it in.
[1:36:31] » That's the main section. [clears throat] Yeah.
[1:36:33] » Yeah. We'd be interested in knowing her thoughts on the future of that building.
[1:36:40] » Well, [clears throat] the mayor can reach out. I I still think back to what
[1:36:46] I stated at the beginning of the meeting. Our review board's job at these
[1:36:52] meetings are to review complaint forms that have been submitted and do what we
[1:36:57] did on many cases this morning, come up with a action plan of what we're going
[1:37:02] to do. So that's what this review board's job is. So
[1:37:07] » do we really need a complaint form on that? I
[1:37:10] » that's the process. >> It is. I mean, what else have we talked
[1:37:15] about today that there wasn't a complaint form?
[1:37:20] That's that's the official way and it's not I'm not trying to be difficult but
[1:37:26] that's the right way to do it. >> The mayor will report next month.
[1:37:31] » You can report but then what are we going to do?
[1:37:33] » Well, have to see what what the plans are.
[1:37:36] » Are we are we waiting for a motion to retire this meeting?
[1:37:42] » [laughter] >> I haven't asked for one, John, because
[1:37:46] we still have another item on the agenda.
[1:37:50] » Board comments. >> It says board comments. If you look at
[1:37:53] your paper, >> it's not line.
[1:37:57] » Are there any board comments? >> You can you can file a complaint with
[1:38:01] the city or there's forms in the entryway. I'll get you one if you would
[1:38:04] like one. line of sight. >> What I'm saying is
[1:38:09] » that line of sight thing that >> that has not
[1:38:12] » somebody was talking about >> that has not been
[1:38:15] » it's a line of sight to everybody that drives fast. So that
[1:38:20] » to me that's a very silly thing to
[1:38:25] » Are there any board comments >> in writing? Okay.
[1:38:29] » Hearing none, I'll entertain a motion. Okay. The one board comment I did want
[1:38:35] to make and I think everything's everyone's aware of it. The updates to
[1:38:40] the nuisance ordinance that have been discussed at city council were discussed
[1:38:45] on August the 10th. Several of you were in attendance. Uh those that ordinance
[1:38:52] was introduced at that meeting and it will be discussed again [clears throat]
[1:38:56] on Monday night the 24th. Um and with potential action being taken to adopt
[1:39:04] it. So just be aware of that and nuisance for board members. We've shared
[1:39:10] the whole ordinance with everybody as we said we would. So once it was
[1:39:15] introduced. >> Yeah. Once it was introduced. So that
[1:39:18] was the one board comment I wanted to make.
[1:39:22] » Okay. I entertain a motion to adjourn. >> You have it.
[1:39:26] » Is [laughter] there a second? Second. >> All in favor signify by saying I. I.
[1:39:32] » Oppos same sign.
