[0:00] or something. >> Well, the online system's down right
[0:03] now, so I just got to record it. >> All stand for the pledge allegiance
[0:13] to the flag of the United States of America and to the republic for it
[0:18] standy
[0:23] and justice for all. [clears throat]
[0:29] And we need a roll call. >> Lumpy
[0:32] » here. >> Nestrom
[0:34] » here. >> Walton
[0:35] » here. >> Nikki
[0:36] » here. Galler >> here.
[0:37] » Okay. >> And next approval of the July 23rd
[0:44] minutes. [snorts] >> Move to approve the minutes.
[0:48] » I second. >> All in favor?
[0:51] » I >> I
[0:53] » Okay.
[0:57] Next on this agenda is public comments not related to items of the agenda.
[1:04] This is only one thing on the agenda so far.
[1:08] Anything not related. Moving ahead,
[1:13] we'll now have a public hearing for 318 Ives Avenue. The Panda Bear Properties
[1:20] Jennifer Joel and Payton Scarda. Thank you. Varian request to allow up to
[1:26] four unrelated people to reside on the property. Property is own RP which is
[1:32] residential professional and
[1:39] start. >> You can start. Yes. M.
[1:49] Uh the property as you stated um is zoned
[1:54] RP at 318 Ives and the applicant is asking to allow the property to use for
[2:01] four unrelated people and the RP zoning district. Uh 318 Ives is located in RP
[2:09] and the RP district only allows for single family residential plus one
[2:15] additional occupant as the if the property is owner occupied the
[2:20] surrounding properties majority nonconformity in regards to the
[2:24] multifamily rental status staff is aware that there's a high number of non
[2:29] non-conforming properties in the area of the RP district and there's a map in
[2:34] your packet that was provided. There's actually two maps. Uh the first map
[2:40] shows the area and the rental properties that are in that area and how many units
[2:49] are in that rental by color. [snorts] And then the other map is a little bit
[2:56] confusing. Um, but it shows where the R what the like what properties are zoned
[3:04] RP in the city and then if those properties
[3:09] have the P exemption, which means that they're a primary resident for um
[3:17] the occupant, which usually if something is a primary
[3:21] residence for an occupant, I'm actually if a if it's a primary residence for an
[3:26] occupant. It's not a rental. That's usually how we catch them like or can
[3:32] kind of figure it out because if you're primary residence, you're not renting
[3:36] unless you have a single occupant rental.
[3:40] So um and then it shows like which one are active rentals, which one were um
[3:49] primary residences um in 2007, which is when the RP
[3:56] district was established and which ones have always been primary residents.
[4:03] So that's what that map means or [snorts] shows. Uh the RP zoning, it's
[4:10] relatively new. As I said, it was only in 2007, which sounds not new, but in
[4:16] zoning world, that's new. Um resulting in a high number of legal non-conforming
[4:22] properties, which means they existed prior to that RP's district being
[4:27] established. since the establishment of RP 318ISE had
[4:32] been used as a single family residence. So, it was conforming to the ordinance.
[4:38] Um, since it was conforming, the variance would be required to allow the
[4:44] non-conforming use to exist on the property.
[4:49] The house itself is situated on par. It gives a partial number and it has four
[4:54] bedrooms and the applicant plans to prepare a surface in the rear yard
[4:59] adjacent to the alley for parking.
[5:04] Uh the case of the zoning board of appeals arises from the fact that the
[5:08] majority of the surrounding properties are legal non-conforming multifamily
[5:12] rentals. When purchasing the property, the applicant was under the impression
[5:16] that there are area allowed for multifamily rentals due to the high
[5:21] number in the area. During the renovation and rental inspection
[5:25] process, the applicant was informed that they could not rent out the unit to
[5:30] unrelated occupants because it would classify as a multifamily rental, which
[5:34] is not permitted in the RP district.
[5:39] Um, the next section of your staff report goes through the standards for
[5:45] variances and staff's analysis of those standards. Uh, due to the uses of the
[5:51] surrounding property and the proposed use of this house standing in contrast
[5:55] with the intention of the ordinance, staff cannot recommend outright approval
[6:01] of this ordinance as there is very limited hardship that wasn't
[6:05] self-created.
[6:10] And then the rest of the staff report is just your motions or sample motions that
[6:16] are available for the board to use. >> Question.
[6:21] » Yeah. >> In relation to this map.
[6:24] » Yes. >> Right.
[6:26] » As opposed to this map. Ives is in this area or I think
[6:32] there's no street. I when I looked online I looked, okay, where's Locus?
[6:37] hives and all that kind of stuff. And >> oh, there's no labels.
[6:42] » I'm making an assumption. [snorts] Well, actually, I'm not making an
[6:45] assumption. I did that right. >> Um, on the one with all the nice pink
[6:49] and everything. >> Locust is that first street on this map.
[6:55] » I can't see. I got to come up. >> All right.
[7:02] » The only reason I say that is Okay. This right here, right?
[7:07] » Yeah. Here's here's here's I This is on this picture.
[7:11] There's this. This is Locust. >> I believe this is locus. So I So the 31
[7:17] would be right down here. >> I mean, this is just moved up a little
[7:21] bit. >> Yeah. This is a zoomed in version
[7:24] » of this area. >> Yes.
[7:26] » Gotcha. >> All right. [clears throat]
[7:30] » This one I wanted to confirm. >> Okay. Yeah, we're good.
[7:38] Now, there's an opportunity for the applicant to make a presentation.
[7:45] » Yep. Up there. State your name, Mary. Liv, and uh try to
[7:53] This is a smaller group, >> so about 10 minutes or so, whatever you
[7:58] need. >> Okay. Um my name is Jennifer Scarta and
[8:02] that's my husband Joel Scarta. Um we're the parents of Payton Scarta and he is
[8:07] part owner of Ives as well as a student at Ferris.
[8:11] Um as parents of three children all within two years of age of each other.
[8:16] We have tried to find ways to make school affordable
[8:20] um not just for us but for um the people that also will live with him. Um, one of
[8:26] the ways for us was to purchase a home and allow our child to live there with
[8:31] roommates that help share the costs of living. Um, we are asking for a variance
[8:37] to be able to use this property as an open owner occupied student rental for a
[8:41] total of three renters. Um, when looking for a home in the
[8:47] rental district, we did so in good faith um with good intentions, thinking it was
[8:52] an appropriate rental district. um as this is what we were told. Um we
[8:59] were shocked to learn um otherwise near completion uh of the renovations.
[9:04] Um and solely the result of misinformation, misunderstanding from
[9:10] the realer that we um had on the other side of the transaction and we apologize
[9:16] that we have to be here for this now. Um, however, throughout the process of
[9:20] transforming this property, we pulled all of the proper permits. Um, we went
[9:25] above and beyond on the renovations. The property was truly an eyesore on the
[9:31] street. It was very overgrown. Um, the wind there were no windows on
[9:37] the um exterior or the porch on the side of the house. Um, it was overgrown with
[9:43] vines. There were animal feces in there. Um floors needed leveling. The kitchen
[9:49] was very dilapidated. In place of the kitchen sink was a washer and dryer um
[9:55] that was hooked up there. The um there was a stove plugged into the middle of
[10:02] the floor of the kitchen. So made the kitchen basically um
[10:08] nonfunctional to the average person. Um, bathrooms
[10:14] um were also very outdated, 50 plus years
[10:19] um for the age of the vanities. Um older plumbing, unsafe electrical. Um and
[10:26] those are all things that we took care of. Um, and we're very proud that it is
[10:31] now not an eyesore and it not only um looks beautiful, but it also helps to
[10:37] raise the property value um for the Big Rapid School District as a whole. Um,
[10:44] but especially on that street and for the neighboring properties.
[10:48] Um,
[10:51] let's see. Um, we um invested in it, substantially
[10:58] improved it, and brought it back to a condition that contributes positively to
[11:03] the neighborhood while increasing surrounding property values. The
[11:07] proposed use is consistent with the established residential renter character
[11:13] and actual use of this particular street or block. Um we are are asking for a
[11:21] sight specific variance because of the unique circumstances of this property
[11:25] and this particular block. There are in fact students living next door that have
[11:30] moved in in this past week um there now. [clears throat]
[11:34] Um the property is already a rental district or in a rental district. The
[11:38] surrounding properties are overwhelmingly
[11:42] rentals. Um, student rentals already exist immediately around it. Our son is
[11:48] now an owner of the property, so it will be owner occupied and maintained. And
[11:52] the physical property has been renovated to accommodate residential
[11:57] uh rental use. The home um was well is well prepared to support student
[12:03] housing. It has four parking spots, not on the street. The permit was pulled and
[12:08] approved for that. There are house rules to keep things in order. Um, Payton will
[12:14] be maintaining the home and the yard um and overseeing the management of the
[12:19] property. Our proposed is not [sighs] our proposed use is not materially
[12:27] different than the use of the surrounding properties. Um, I will also
[12:31] be stopping by uh periodically. I'm we're we pass this town on our way more
[12:37] north of here a lot. Um the rental division has inspected it and
[12:43] approved the home and the other things that were approved there were um the
[12:49] plumbing and electric which we pulled permits for. That's all new throughout
[12:52] the home. Um we aren't asking the city to to change the character of this
[12:57] neighborhood. We're asking the city to recognize the character that already
[13:00] exists. Um, we have demonstrated our commitment to this property and this
[13:05] neighborhood through our substantial investment and rehabilitation.
[13:09] Again, it would be owner occupied and we understand that some properties have
[13:14] established or grandfathered rights. We aren't asking the city to disregard its
[13:18] regulations. We are asking the city to recognize that our proper property is
[13:22] similarly situated in terms of the neighborhood character and that an owner
[13:27] occupied rental with a total of four occupants is re is a reasonable and
[13:32] limited accommodation. Thank you. >> Thank you.
[13:36] » Thank you. >> Questions anybody right now?
[13:40] » We may have questions later. >> Okay.
[13:43] [clears throat and cough]
[13:47] Now we have an opportunity for those in opposition to this to speak
[13:59] » hearing none. Um anything reported? >> Uh you have you forgot those in support.
[14:09] » I'm just making sure you remember them. And then the other is you had two emails
[14:15] in your packet that I got before I created packets and emailed them out. So
[14:19] you have two emails in there and then you have another email that was sitting
[14:24] to the side of your packet that I got um since the packets.
[14:29] » Okay. >> Right.
[14:41] And then I did not receive any phone calls.
[14:45] » No phone calls. Is this on? Okay. Sorry.
[14:52] I don't have to read this. And we got the two. There is two in favor. That's
[14:56] in the packet. >> Yes.
[14:57] » Read that. >> Okay.
[15:03] Well, >> you have to ask if there's anybody
[15:06] supporting it. >> You didn't give people Sorry.
[15:08] » You forgot about people who are supporting it.
[15:12] » I forgot about people who are supporting it.
[15:14] » Give them the opportunity to speak. >> Yeah.
[15:20] » Yeah. Anybody? Yeah. Anybody in favor to speak? Yeah. Go ahead. Sorry. [laughter]
[15:25] It's been a long day for me. >> I feel you. Really long week.
[15:30] » Yes.
[15:33] I assume that I'm supposed to come up here.
[15:35] » Yeah. State [laughter] name. >> Okay. Okay. So, my name is Jody Steves.
[15:38] I live at 510 Winter, but my husband Mark and I own right across the street
[15:44] from 318 Ives. So, we own two properties, 321 Ives and 325 Ives. So,
[15:50] um I'm here tonight in support of granting the variance for 318 Ives to
[15:55] allow four unrelated individuals to live in the home. Um, I just said Mark and I
[16:01] own across the street and we've owned those about 15 years. And in my opinion,
[16:06] 318 Ives um has long been the most rundown property on that block. And uh
[16:13] we've watched it deteriorate year after year. Um that's why we're so glad to see
[16:20] the new owners step in and completely renovate it this summer. They've shown a
[16:24] real commitment to upgrading the home so that four individuals can live
[16:29] comfortably there. There's four bedrooms, as you stated, a bath and a
[16:32] half. Um, we've toured it. It's beautiful. Um, they've also upgraded the
[16:38] off streetet parking, which is nice um to easily handle four cars. So, um,
[16:45] based on the significant investment they've made, I have full confidence
[16:49] that they will continue to maintain the property to a high standard. So, I ask
[16:54] that you grant this request. Thank you.
[17:01] » Yes. Go ahead.
[17:05] » Good evening. First [snorts] of all, thanks for being
[17:08] here. I've sat on the ZBA for 15 years in my township. So, I appreciate what
[17:13] you guys put into this. But my name is Paul Leinger. I own the rental right
[17:17] behind them at 318 Hives. I purchased that or no? Yeah, they're at 318 Hives.
[17:23] I'm at 319 Stewart. So, I'm right behind them.
[17:26] » Right. >> So, I bought that the fall of 2017 when
[17:29] my daughter came up here first year at Ferris. I went to look for her for the
[17:32] next year when she got out of the dorms and the places were nasty. And luckily I
[17:36] was in a position to buy one and I did and kind of like these folks did that
[17:40] the next summer I gutted it, redid it all and I've held on to it and I've I've
[17:45] held on to for the fact that uh I've been landing grad students. I just love
[17:50] staying in touch with these kids and giving them a nice place. I also went
[17:54] down the rabbit hole of how hard is it to figure out what that area would look
[17:58] like in zoning. We I'm realtor uh so I kind of got in like to the city site. It
[18:04] was very hard for me to distinguish, okay, why was mine approved? And I
[18:08] understand the city's responsibility to itself to monitor where these homes, you
[18:13] know, what's going on with these homes. That being said, like mine's a rental. I
[18:17] believe the three to the left of me are, the ones behind are. So, I could
[18:22] certainly see there was no malicious intent that if I looked at that, too.
[18:26] Unless I really came in and probably spoke to the zoning director, I would
[18:30] have complete expectation that was going to be a student rental available. And
[18:35] what's already been said, they've done a phenomenal job of it. I haven't been in
[18:39] it. I drove by yesterday cuz I actually had my certificate renewed yesterday.
[18:44] And uh I just know I don't know them personally, but when you own it, you
[18:50] take care of it. And these guys, I don't think are looking to be slumlords and
[18:53] buying 10 of them or nothing. And I hope it works for them. That has tremendously
[18:59] helped my situation with my daughter. She went on to grad school in Indiana
[19:04] and that has helped her substantially. So kudos for you guys for helping your
[19:09] kids because it's a long road when they get into college. So I just like to
[19:13] offer my support for the request. >> Thank you.
[19:15] » Thank you. >> Thank you. Anybody
[19:19] else in favor to speak?
[19:27] » Please don't look at me as a closer. I probably should have [laughter]
[19:32] » jumped up first. >> Um, my name is Mark Spece and as you
[19:36] know, I'm married to Jodie and we operate under Park Hill Properties and
[19:40] we actually have four houses in the RP district. So, we kind of know the ins
[19:45] and out of RP and we still screw up. [laughter]
[19:49] Um, the reason that I want you to give the
[19:52] variance is that house was going nowhere. It was in such it was in such
[20:00] horrible condition. It wouldn't have been possible for a new a starter
[20:05] family, you know, home wouldn't have taken on that project. It was just too
[20:09] monumental. And the reason, even though I don't know
[20:14] these folks, the reason that I'm very confident they're going to do a
[20:19] good job long before they got flagged, so to speak, on the very, you know, on
[20:26] the zoning difficulty, they did something that
[20:31] a lot of landlords don't do in this city. They actually brought up the level
[20:36] of the windows and like on the the sun porch, they spent a lot of money redoing
[20:42] those windows. And I've seen a lot of folks that make a lot of money in
[20:46] rentals in this town simply cover windows up. Have you all seen that where
[20:51] they just make a whole wall of windows disappear because it's drafty or
[20:57] whatever? And they did that on their own. They have a good eye and I think
[21:02] they'll be an asset. And no offense to you, sir. I hope they do buy 10
[21:06] properties here. [laughter] >> That's what they buy.
[21:11] » Um because uh we even though they would be potential competitors, we we think it
[21:18] brings up it just brings up the level of housings, you get better people, you get
[21:23] a better feel of community, and you get more activity downtown in the walkable
[21:29] area. It's a great neighborhood and if any of you ever want to discuss RP with
[21:34] me, I'm not going to do it here. Your time's limited. I would love to give my
[21:38] opinion. You probably don't want to hear it. [snorts]
[21:41] [laughter] Thank you so much for being here and we
[21:44] know it's a lot of work and it's a volunteer thing. Thanks so much for
[21:47] being here for the community. >> Thank you.
[21:50] » Thank you. >> Well, soon as I put this out of order, I
[21:54] guess you don't have to rebut the opp the the favor. [clears throat]
[22:00] or whatever. Um,
[22:04] got that, got that, got that. Is there anything else? Anybody else have to
[22:07] speak in favor? >> Maybe just one other thing I'd add in my
[22:09] comment is it was listed on the MLS. It was available out there and a single
[22:14] owner could have purchased it for a single family. So, to me, it's almost
[22:18] market tested that it almost seemed to find its own path to what it is and what
[22:23] I think it should be. >> Okay. All right. Thank you.
[22:28] I want to add one more thing too. So, for creating affordable housing, um,
[22:33] [clears throat]
[22:35] » it really would help if we could because we
[22:38] » you get this recorded. Sorry. >> Didn't you show up on camera?
[22:41] » Yeah. Um just regarding affordable housing,
[22:45] Payton did live in um the College Town Apartments last year and um while
[22:53] they're great to offer students housing, we did not find that very affordable
[22:58] with all of their surprise fees and things of that nature. A 12-month lease
[23:04] when the kids are here for 9 months. And um so we're
[23:10] we're trying to be better and offer some different options for the kids. So, a
[23:16] shorter lease, um lower monthly fees, more um of the uh utilities included,
[23:23] and um just some options if instead of having to move stuff out, if they wanted
[23:28] to stay there again, um they could have a reduced rent over the summer to leave
[23:32] their items there and not have to move them out of sto.
[23:36] Um so, that was another um goal of ours was not just to have housing for Payton,
[23:42] but to help other kids as well. Okay.
[23:46] » Very good. [snorts] >> I have one quick comment.
[23:55] » And your name is again? >> So, my name is Joel. Okay. Husband and
[23:58] Jen. Um, I just want to say I have never met this gentleman. I've never seen him.
[24:02] I did not know that he was going to come today. Um, I did meet Jod and Mark um
[24:07] the first week we started the renovation and I was very um forthcoming just of
[24:13] what we're doing. There was no hidden agenda or anything like we're going to
[24:17] sneak some kids in here because it's in the wrong district. We truly did not
[24:20] know. Um and we found out a week before the renovation was done and that was
[24:25] certainly our fault for not doing the complete follow through. But as everyone
[24:28] has spoken, the whole district, the whole area is all rentals to my left, to
[24:32] my right, across the street, it's all we're the only single family home. And
[24:37] the renovation was substantial, six digits. Um, no single family home or
[24:43] single family buyer in my opinion, I have a sore throat, I'm sorry, could
[24:48] purchase that home without construction background to be able to fix it up to
[24:52] what it was. So, that's why it sat there stagnant. You can't rent it because it
[24:56] won't pass code and you couldn't fix up as a single a first-time home buyer
[25:00] because it's far too much of a renovation. So, having said that, thank
[25:04] you for your time and um I did know they were going to speak, but I certainly
[25:08] didn't beg or plead for Jody Martin either. And we don't know that anybody.
[25:13] [laughter] >> Thank you.
[25:14] » Thank you. >> All right. Nobody else
[25:20] portion is closed and now we get to go into fact finding.
[25:25] » Yep. So, as I said, so they have So, there's
[25:31] three with the So, there's three across the street to them. Three bedroom, three
[25:37] rentals around them and behind them. >> Mhm.
[25:43] » Well, when I look at this map, >> those aren't bedrooms.
[25:46] » Yeah. >> This one
[25:48] » Yeah. >> that you're looking at, those are units.
[25:52] » They're not bedrooms. So like a one unit is just one apartment. So a lot of
[25:58] houses have been divided up. So they might like there are houses that are
[26:06] four units but each unit could have different amount of bedrooms.
[26:10] » Sure. >> Gotcha. Okay. Okay. Okay.
[26:15] Um, but looking at this, if this is the house where it's located, everything
[26:20] that's all x out are active rentals. [snorts]
[26:24] » Is that that's correct? Except the >> Well, [clears throat]
[26:28] » anything with crosshatch is a rental. So, it we didn't separate out whether
[26:33] it's a rental for single family. That's more what this map does. Like a one unit
[26:39] » could be a single family rental. It could also be for unrelated. We didn't
[26:44] » Okay. It gets too complicated to map like all of the different use.
[26:49] » Okay. So, remind me of the single family is how many people unrelated?
[26:53] » Single. So, if it's >> So, the RP district allows single
[26:58] family, which doesn't it only allows for [clears throat]
[27:02] » a mom and dad and a kid or something, right?
[27:04] » Yeah. There's not occupancy limits on family.
[27:07] » Okay. And so in the RP district, it allows for single family and if it's a
[27:12] homeowner property or a PR property, they can also
[27:17] have one additional occupant. >> So they're asking for
[27:20] » not related. >> That's not related.
[27:22] » So they're asking for two more non-related people. We're looking at
[27:26] looking at this aspect of like a R2 or something where they get to have one if
[27:33] they owner occupied one plus >> three others for four unrelated. That's
[27:39] basically what we're >> basically what doing
[27:42] » they want. Yeah. Three other people now unrelated.
[27:44] » That's why we want the variance to do that.
[27:46] » Yes. Um, couple questions I have and
[27:52] if probably be good to get up there. Um, and you answer it partly,
[28:03] I think. Of course, I can't get to where I want
[28:06] to get to, but >> we'll see. [clears throat]
[28:12] Bear with me. So side note for Michelle. So everything
[28:18] around them is unrelated people as rentals.
[28:22] » No. Anything on >> like the people who are here right now,
[28:26] they have rental homes. >> Yes.
[28:29] » They are not. They are having nonrelated people in those homes.
[28:32] » Some of them. >> So anything on this map that is green
[28:38] » Yeah. >> or red, okay,
[28:42] » are single family homes. So on that street there's really
[28:46] » bright red. >> Anything that's bright green, light
[28:49] green, or bright red are single family homes.
[28:51] » Okay. >> Right.
[28:52] » And everything else in the pink with the hashtag is
[28:56] » anything with the hash anything with the hashtag is a rental. So we don't we in
[29:02] our system we classify rentals whether they're a single family rental or a
[29:06] multifamily rental, but it's too much to map
[29:12] » all around them. And you're saying all the pink around them is RP also.
[29:17] » All of that that Yes. Everything shown on the map that has a color is RP.
[29:23] [snorts] >> So they have in those house in the pink
[29:26] if it's RP, the owner is in one of the owners is in that and then they have
[29:31] other No. Okay. >> No.
[29:34] » So because because the RP district was new
[29:39] in 2007, >> right? A lot of the properties in that
[29:44] area are multifamily or for unrelated people,
[29:49] » okay, >> are in those rentals. I just can't
[29:53] distinguish, >> okay,
[29:55] » which ones are single family rentals and which ones are not. We didn't
[30:00] » But the unit one, this map that showed you the [clears throat] units,
[30:04] » right? I mean, if you have two, three, and four units, they could still be
[30:10] single family units. Like, one of them could be a single occupant or a two
[30:14] occupant that are family, but they're likely more geared towards
[30:19] » Okay, >> the four unrelated.
[30:22] » Okay, >> but they're all rental.
[30:25] » But I didn't map bedrooms because it gets confusing to map units and
[30:30] bedrooms. >> Okay.
[30:32] » All right. I found it. Thanks for filling some there. [laughter] I
[30:35] appreciate that. Um,
[30:40] when it says the property could not be reasonably used for the purpose
[30:43] permitted in the zone, can you elaborate that because your answer was all homes
[30:48] on the street are college rentals andor rentals?
[30:52] » Um, >> could you say why?
[30:56] » It's sub. So, the home was in such a deteriorated condition.
[31:02] It was I mean I know there was people that were staying there periodically as
[31:06] they passed through town for their jobs or at least that's what we were told but
[31:10] to live there it was really gross. There was rodent droppings everywhere. Um
[31:17] » let me speak. >> Excuse. So I did a lot of the work
[31:20] there. Um and of course hired out licensed professionals.
[31:23] » I'm sorry. We still like to have you up at the mic. It just makes it easier.
[31:30] So, as I stated, the home was in such disrepair that in my opinion, I think a
[31:37] reasonable opinion would be it would be very, very difficult for anyone to buy
[31:40] that home and first of all see all the rentals around them and say, "I'm going
[31:44] to buy this and move my family of three into here and fix it up because it
[31:49] needed a massive amount." There was $15,000 worth of electric work done. Um,
[31:53] and that was pulled with the county on the permits done the right way. um all
[31:58] new plumbing. So that was another permit. It was not functional. It could
[32:02] not have no conventional loan would have approved that um let alone a FHA loan
[32:08] because it was in such disrepair. So that was when I made that statement that
[32:12] that's why it was just bringing the whole neighborhood down. Um and never in
[32:16] a million years did we we would have never bought it if we knew we couldn't
[32:19] rent. We were given misinformation. Not that that's an excuse for us not doing
[32:23] our homework. No, I just wanted to know why a single family would have, in your
[32:29] opinion, it would be difficult. >> They wouldn't have the means to know how
[32:32] to fix up a house. I mean, it needed everything. All new plumbing, all new
[32:35] electrical, all new flooring, all new kitchen, bathrooms. Um, the average
[32:39] single family person wouldn't see the equity they could build. Got
[32:44] » to do it. And because I swing a hammer every day, I was able to make it make
[32:47] sense. And certainly since my my son's going to live there, it made a little
[32:51] bit more sense. Um, and no, we don't plan on buying any more rentals in Big
[32:54] Rapids. Okay. >> For no other reason. We're just trying
[32:57] to make it affordable for our son. >> Gotcha.
[33:00] » Um, also in regards to what he hit on with the with the loans, so when a
[33:06] buyer, an average family wants to buy a home, it's more than likely going to be
[33:10] a loan. Um, a conventional loan, an FHA loan, um, probably would have been or a
[33:17] VA loan would have been the top three types of, um, loans to purchase the
[33:21] property. All of those are going to have an appraisal and the appraiser that
[33:25] comes through is also going to do a health and safety inspection which would
[33:28] not have passed. Um the conventional loan is the least strict on that but
[33:34] they still there was a handful of so many things there. They would have
[33:36] requested the seller to repair them in order to underwrite the home. So it
[33:40] would have needed to be a cash sale. >> So this thing basically could have sat
[33:45] there >> yes
[33:46] » forever. It did. It sat there for 15 years [laughter]
[33:50] » and it would continue in my opinion it would continue to sit there to infinity.
[33:56] » Okay. I was just looking at that question there.
[33:58] » Yeah. >> Anybody have other questions? Anything
[34:02] else before? >> Um, no. Not yet. No.
[34:05] » Yeah. >> You use a lot about, you know, you're
[34:08] talking about beautifying the area. Obviously, you're talking about the
[34:12] outside, fixing it up, doing that kind of stuff.
[34:15] » Every We did everything. Yeah. And we had on a cute side, Payton was doing
[34:22] things at this home that he doesn't even do at our house for us. So, I know he's
[34:27] going to take care of it. Like he went when we went to Lowe's, he picked out
[34:31] the plants. I showed him how to, you know, the landscaping rules, do it in
[34:36] odd numbers, do it this way, you know, and he he did all the edging. He did the
[34:40] wood chips. He was he's he's so proud to have that place that I know he's going
[34:44] to continue to take good care of it. Yeah.
[34:46] » All right. Thanks.
[34:54] » Okay. >> Um,
[34:56] » no, that's all right. >> I just want to get the idea of why a
[35:00] single family would have a difficult time doing that or even someone with a
[35:05] business or something like that since it was RP.
[35:09] » Looks like the the the listing was removed in 2012.
[35:13] So when they talk about 15 years, it's about right. Uh
[35:17] » yeah, >> it was in bad shape. I live in the
[35:21] neighborhood. >> I can
[35:25] tell. >> Well, that's that helps me out a little
[35:28] bit. >> I was just going to say if you'd like
[35:31] before and afters and but you already addressed it. I had no
[35:34] » It was in terrible shape. >> Okay.
[35:36] » Like >> All right. Thank you.
[35:39] » I know we're a small group. We still got to go a little protocol here.
[35:47] Um, all the other places are basically
[35:52] rentals in terms whether they're single family or whatever, renting, that kind
[35:56] of stuff. >> Well, they're according to Michelle's
[35:58] thing. I mean, they're pretty much rentals if they're one or three units
[36:03] all around them, >> right?
[36:06] » The only place that's not a rental is the United Way.
[36:11] » I mean, it's like it goes back other ones where you have the bedroom and the
[36:14] closet like making sure >> the eyes are dotted for our you know our
[36:18] pink spot for a bedroom and as we go through that checklist
[36:24] » and as long as you know >> is anybody anybody living there now I
[36:30] mean >> son does the others are moving in the
[36:33] next day or two >> so staff
[36:37] in trying to be cooperative I mean we gave them a conditional certificate of
[36:43] occupancy based on or not certificate of occupancy. We don't issue those. We gave
[36:49] them a conditional rental certificate based on this meeting with the
[36:54] understanding that if this was voted down, they have to be out in 30 days
[36:59] because they had already had kids ready to move in and we didn't
[37:04] want to >> didn't want people on the street.
[37:09] » Right. We were trying [clears throat] to be cooperative.
[37:12] » Legally, we don't have to give them that certificate
[37:16] » until this was approved or denied. >> Has um their rental person walk through
[37:21] the house. >> A rental person has walked through the
[37:24] house. Yes. >> Is this
[37:27] » sound like that was a positive? >> Yeah.
[37:29] » Thing that one unit. >> It is one unit. Yes.
[37:34] » Basically a single family home with four bedrooms.
[37:36] » Yes.
[37:43] What do you think, Jeff? What's your opinion?
[37:47] » Well, I'm thinking if I'm wrong, all variances
[37:53] stay with the property, not the person. in reading when I was reading through
[38:01] the zoning board documents
[38:05] if we approved this if I understand from what they say we
[38:10] allow we can put a stipulation that it cannot be broken up into multi-units in
[38:15] the future >> it can't be broken up to multi-units in
[38:18] the future because zoning doesn't allow it so you can add that stipulation but
[38:22] » I'm my concern is it's like it's wonderful that they did a great job But
[38:28] if we approve this to be unrelated, they sell it. The next guy might not be
[38:34] [laughter] as nice about it. You know, I just want to make sure that it like they
[38:38] can't be like because my biggest problem with the multi-units, I don't really
[38:41] have one with the number of people is when they have like outside staircases
[38:45] and they start putting 13 mailboxes up. >> So, this isn't
[38:50] » so my fear would be that someone would buy it and do like what they've done to
[38:53] other houses where they chop it up. This variance isn't asking for
[38:58] multi-unit. It's asking for four unrelated people.
[39:02] » Yeah. Yeah. That's I mean it's that that alone will be
[39:06] » pretty much say this house has to stay the way it is. You could just have two
[39:10] buddies, three buddies, four people living in your house with you, but it's
[39:14] still a single family home with four. >> It would be limited to four.
[39:18] » And if it's fixed up and they decide to sell it, maybe at that point a family
[39:22] might buy it and want to live there. You never know.
[39:25] And that's still okay in that area. >> Yeah.
[39:28] » Yeah. Whether it's rental. >> Yeah. Because you're worried about like
[39:30] putting extra kitchens in and chopping it up and things like that.
[39:33] » Yeah. >> I did go over and look at it and that
[39:38] you did an outstanding job out of the house.
[39:40] » I did too. >> And there is enough room for parking in
[39:43] the back. I went and drove in the alley. I was really pleased because I know how
[39:49] it looked before and how long the whole time I lived here. It's been like that.
[39:53] That's what the other question I was going to have. Is there enough room for
[39:56] four? >> I pulled the permit with them and they
[39:59] approved it. I widened the driveway and absolutely.
[40:03] » Okay. >> There is.
[40:04] » So, that's already done. >> Yes.
[40:07] [snorts] >> Okay. Because I know when here it says
[40:11] your plan was to increase it. So, >> it's already been done.
[40:13] » That's already been done. >> My my worry is that we keep doing this
[40:19] and it's all kid and grandfa like we're always making exceptions.
[40:23] to the rules all the time is with RB. >> But
[40:26] » down down the road, I hate going back this and I I want to
[40:32] say this in the in the best way.
[40:38] Trying to figure out how to say this and not say it out on term. There's a
[40:43] there's going to be a new master plan. >> Yeah.
[40:47] replaces >> there's going to be a new zoning
[40:49] » organiz new okay
[40:52] » there is a new master plan >> I'm sorry
[40:55] » there is a new master plan >> there is a new plan but it it still says
[40:58] on the TBD [clears throat] to be determined when it's going to be
[41:01] implemented >> oh yes I see what you're saying I
[41:05] thought you were saying we're getting a new ordinance and like
[41:08] » no did the master plan >> and they talk about mixed uses in
[41:14] properties and areas >> [snorts]
[41:16] » And there has been discussion in the past that down the road I mean are
[41:20] everybody that we're given variances to or they just come in too early and they
[41:23] decide oh let's just make this a mixed use don't know that and I want to say
[41:28] that I can't predict the future I don't know how that's going to work out but
[41:31] you never >> and I guess I just wish the real estate
[41:34] people would do more due diligence to tell you know potential buyers that this
[41:40] is what this zone is that's not fair to any you know to anybody you know then
[41:45] now they're trying to catch my due, >> right?
[41:47] » So, I wish that the I wish the realtor people would get with the program
[41:53] » to help out buyers like this is what this is. This is what you can and can't
[41:57] do. this is a pro process you go to the city you know and that's I feel bad that
[42:02] that happened to them that their their seller didn't you know their
[42:06] » the criteria that people can >> do that and and granted it's still and
[42:12] they've amended it's still up to the owners
[42:14] » right >> to to uh figure out is this feasible
[42:20] » feasible but when you again look around and you find out you know 90% of this
[42:26] » or 95% % of this >> is already rentals of some form or
[42:30] another. >> Yeah. Why can't Yeah. Why can't I do it
[42:32] kind of thing. >> Yeah. So that's the balancing act.
[42:35] » Are we changing? I don't No, we're not changing anything. The city changes the
[42:40] commission changes it, >> right?
[42:41] » That's what we do. We if if this is reasonable for variance,
[42:46] that's what we do, >> right? As long as like Jeff said, it
[42:50] stays with that. You know, the property doesn't change later on,
[42:53] » right? Well, I mean, it does change. I I've seen that. I've been here, you
[42:58] know, we've all been here for a long time.
[42:59] » Yeah. >> That when
[43:02] And we're we're a university town. Parents buy homes. They in whatever
[43:09] part. >> I know. I did. I [clears throat] bought
[43:10] a house for my son to go to Ferris >> and then it and it changed.
[43:14] » But I had no rentals though. I just stayed here.
[43:16] » I stayed here. Yeah. [laughter] I graduated. I stayed. So, yeah.
[43:18] » But I've seen people come and go. >> Yeah. you know, that's what they do. And
[43:22] it's still up to us. You know, if this happens again and they leave,
[43:27] » someone else comes in, they're going to ask for something,
[43:32] » right? >> And
[43:34] it may be, you know, whoever's on the board when
[43:38] that happens make this decision. >> What do you think, Deb?
[43:43] I don't personally see any reason why they shouldn't be able to.
[43:47] » No one can hear. I I don't have any problem with with
[43:52] them doing that. My neighbor um they did the same thing there. Bought the house
[43:57] and then rented it to their child and a few of his buddies so that they could
[44:01] split the cost and and make it more affordable for everybody to go to
[44:04] college and get their degree and when they were done they sold the house. Um
[44:10] you know and uh we have a nice family that lives there now and so I don't I
[44:15] don't have problem with it. If this was changed and the variance was granted and
[44:19] they sell another owner could come in and say now we can rent it to four other
[44:24] people or three other people or whatever.
[44:27] » Four. >> You can have four unrelated,
[44:30] » right? I mean, usually a son or a daughter lives there and then three
[44:34] other people or is it does that make it five?
[44:39] » Be still four. It's four no matter whether four.
[44:42] » Yeah. >> Okay. Whether the I got you. I
[44:45] understand that. Um,
[44:48] but they could sell it and then a family buys it and wants to live there. That's
[44:54] still reasonable. >> I mean, that's still a doable thing in
[44:57] that location. >> So,
[45:00] » yeah, >> at that point. Mhm.
[45:06] » And if you look at the long term, if you look at the long-term master plan and
[45:11] read through it, which I have,
[45:15] these are some of the areas where we're trying to have a relationship with
[45:19] Ferris where students have not that we're saying we limit it
[45:24] to students. Anybody can live there. We can't we can't say who can live in
[45:28] [clears throat] the house. >> Oh, understood. But but as long as
[45:32] students are in that area, they're closer to campus, they're downtown. This
[45:36] is kind of what the talk was when we were going through this master plan. And
[45:41] it just seems like trying to look forward.
[45:45] » We're trying [snorts] to make it look like that. I'm not saying RP is
[45:50] archaic, but it if I understand some of the history of that, there's not too
[45:57] many cities that have an RP type thing
[46:02] or RP zone. Am I correct in saying that [snorts] or incorrect?
[46:06] » Um, I mean,
[46:12] » I don't know. It's such it it is a unique type of district um to allow the
[46:18] residential and professional. So to allow
[46:23] minor businesses and residential uses um most zoning districts would be
[46:31] classified more as a a like a neighborhood mixed use like a small
[46:37] scale mixeduse type district but >> like a medium density or something like
[46:42] that. Yeah. Um, [clears throat] but as far as like how
[46:48] many other places have RP district, like something similar to ours,
[46:55] » it's very detailed. >> Yeah. [snorts]
[46:57] » On what you can do like >> in the RP district. It was definitely
[47:02] written for purpose when they did it. >> Yeah.
[47:09] » Okay. I mean, that's that's that's been my
[47:12] thinking the last few years of what we're trying to do in the future and how
[47:17] things are happening. And, you know, I think the city's going to look at that
[47:21] probably in my opinion. I could be wrong and I don't want to speak for anybody
[47:25] else except for myself. Um, so
[47:32] [snorts] going through the standards,
[47:37] the property could not be reasonably used for the purpose permitted in that
[47:41] zone. There wasn't anything in here for us.
[47:46] Um, now listening to him, I could see why.
[47:50] The place was pretty well run down against the property was previously
[47:56] conforming. I didn't quite understand this property was previously conforming
[48:00] and can continue to be used as a single family home either as a rental or owner
[48:06] occupied rental with one person >> or a single family
[48:10] » single family. Okay, I get it.
[48:17] So I can understand, you know, like I say, if that was
[48:22] in really bad shape. Number two, that the appeal results from
[48:26] the unique circumstances peculiar to the property and not from general
[48:30] neighborhood conditions. When looking at nearby property uses, it's
[48:34] understandable that one would think that they could use it. I look at the map, it
[48:38] says there's a lot of rental going on in that area.
[48:43] » It does. Zoning applies to all properties in the neighborhood and it is
[48:46] the buyer's responsibility to check the zoning.
[48:50] That's true.
[48:54] But they were also given some information
[48:58] that might have been that they thought was okay until it wasn't
[49:01] » right. Yeah. You'd think with your realtor that they would know what
[49:04] they're talking about in their area. >> Well, that's what I kind of feel about
[49:08] these real estate people are just >> Yeah.
[49:10] » want a quick buck. I hate to say it that way. And they're not informing all these
[49:14] buyers coming to the city saying, "Hey, this is in XYZ zone. You better check it
[49:19] out. What is your intentions?" >> Right.
[49:21] » Yeah. Yeah, >> you know that kind of thing.
[49:22] » Well, I was a landlord for a year and a half when I sold my house and we rented
[49:27] it out and there are really nice landlords around here.
[49:32] » No, I understand. I mean, I just felt bad that the seller
[49:35] [clears throat and snorts] >> was informed them
[49:41] here. [clears throat] They were been reported from represent.
[49:45] » Well, that's what I'm saying. Yeah, exactly.
[49:48] » So, anyway, that's that's sidear >> our issue. Um the use requested by the
[49:53] variance would not alter the basic character of the area. Uh many of the
[49:57] surrounding surrounding properties are already un unrelated occupant rentals.
[50:05] Um wouldn't all Yeah, I don't think it would also basically it sounds like they
[50:08] fix it. I drove by it. It looks really good. I'd live there.
[50:13] » I mean I went in the front and the back and it was in really good shape. It may
[50:20] be available in a few years. [laughter] >> Likely will be.
[50:24] » Son's always looking for a place. >> Otherwise, [clears throat] it would have
[50:28] been condemned in the future. It was >> okay. Well, against the attempt for
[50:33] creation of the RP zone when created was limited unrelated document dwellings in
[50:38] the area and encouraged the shift to single family dwellings. if that was
[50:43] essentially the intent. Has time gone by and enough things change that sometimes
[50:50] change is good?
[50:54] » I mean, it could have been zoned R1 to begin with one, but it wasn't.
[51:01] » And the alleged hardship had not been created by any persons presently having
[51:07] interest in the property. Well, I guess they should have been
[51:12] consulted or or looked into a little deeper.
[51:19] Um, but again, given other information,
[51:26] any questions on that or anything like No questions on this.
[51:34] And then the recommendation from the staff was, which I kind of circled up,
[51:39] staff cannot recommend outright approval.
[51:43] Words mean something. So if you read anything into it, they couldn't
[51:46] recommend outright approval. They didn't say no approval.
[51:49] » They just said outright approval, >> right?
[51:52] » Um, which gives us three things. We can approve it. We can approve it with
[51:56] conditions. And we can deny it. My thought was if we
[52:02] approve with conditions before I heard that the parking lot was already fixed
[52:08] up that we had to make sure that the parking lot
[52:12] had four spots. >> Right. Well, my other thing too would be
[52:17] that make sure it was rental inspected that it was conforming to the city's
[52:23] rental.
[52:29] That was my question. That was >> you know that it was everything passed
[52:32] » and everything passed. Yes. Yeah. >> So, it's like
[52:36] one through 10 checks off but then Oh, man. Just forgot to really dig deeper.
[52:43] » It's like nine out of 10. >> Yeah.
[52:48] Y we're ready for [snorts] a motion. >> We have to read the American what what
[52:53] we want to do. >> Um
[52:57] » so when you go back and look at the other thing uh these these four bullet
[53:01] points ensure that the public services and facilities affect is if we had any
[53:07] kind of uh um conditions are put to it. We have to
[53:11] ensure that the public services facil facilities affected by the proposal land
[53:16] use or activity will be capable of accommodating increased service and
[53:20] facility loads caused by the land use or activity. They're asking for four people
[53:25] to be there. It looks like they did that by increasing the parking or making sure
[53:32] that four people can park there. Says protect the natural environment and
[53:37] conserve natural resources and energy. Sounds like they upgraded everything and
[53:43] did the property and made that look really good. So, it's protecting the
[53:49] natural environment,
[53:53] ensure cap uh compatibility with adjacent use of the land.
[53:59] They're all rentals and some of them look pretty good, too.
[54:03] I mean, actually, a lot of them look pretty good in that area. So, it sounds
[54:06] like that area is trying to keep things Yeah.
[54:10] » Shape
[54:14] promote the use of land in a socially and economically desirable manner.
[54:19] Well, income to the city. People are walking.
[54:25] People are in that area. We're going to get four people that are going to walk
[54:27] downtown and buy stuff. That's got to help the economics a
[54:32] little bit. You say it's only three people or four people. Multiply that by
[54:37] how many other people there are >> that's going to be doing the same thing
[54:42] [clears throat and cough] especially this time of year. [snorts]
[54:46] » So I can't you know you were mentioning you were mentioning approval with
[54:52] conditions of not jing it up. >> Well I just want to that my only concern
[54:58] » want to open the door for somebody to come and just butcher it.
[55:01] » Somebody else would have to come in and >> I'm fine with it. for that.
[55:08] » Let's make a motion. >> Do I Jeff?
[55:11] » I motion pass it for four unrelated people the way it is.
[55:17] » I'll second. I'll second it. >> Okay. So, this is where this is where it
[55:20] is. The motion approves the application. I move that the use variance application
[55:24] for 318 Ives Avenue 7-14-132-013 be approved to allow four unrelated
[55:31] tenants. The application meets the standards set section 13.5
[55:35] and 13.7 of the zoning ordinance. That's the motion.
[55:42] » Yes. >> Yes.
[55:44] » There was a motion. There was a second. >> Yes.
[55:48] » Lumpy. >> Yes.
[55:49] » Einstrom. >> Yes.
[55:50] » Walton. >> Yes.
[55:52] » Nicholas. [cough] >> Yes. [clears throat]
[55:54] » Yes. >> Passes.
[55:56] » Passes. >> Good. Thank you.
[55:58] » Thank you. Thank you.
[56:02] » So, I'll have Craig probably it won't be tomorrow, but um probably get in touch
[56:07] with you guys next week. >> I know we're not done yet.
[56:10] » Thank you, Michelle. >> You're welcome.
[56:17] » Michelle, >> is there any other thing going on that
[56:19] anybody >> funny backtory to this
[56:21] » only if you guys have question >> is there Mark to stay and teach about
[56:27] [laughter] >> Yeah. I'd really love.
[56:31] » Is there going to be like a informative >> card too cuz we're going to be neighbors
[56:34] master plan or >> sure your boy could take care.
[56:37] [laughter] >> Well, all your rentals look great.
[56:40] » Oh, your rentals look great. You've updated me so nicely.
[56:44] » I'm still trying to do some business. So, if you want to talk that way,
[56:47] » appreciate it. Thank you very much. >> Thank you very much. You're welcome. So,
[56:50] I can kind of give you a rundown on some of the stuff in we've been talking about
[56:56] in the new zoning ordinance or like where we're at in the process. Um, if we
[57:02] don't have a case next month, I might bring the section to the of from the for
[57:07] the ZBA, like the section of the ordinance for the ZBA for you guys to
[57:11] review. Our planning commission has already reviewed it. Um, and that was
[57:15] one of their suggestions and I kind of forgot about it until tonight's meeting.
[57:20] So, um, we I can do that if you guys want to have a meeting next month and I
[57:24] can I'll email you out what we have as a final draft right now for the section on
[57:29] the ZBA for you guys. >> So, like a working review type thing.
[57:33] There's nothing on the dock in terms of >> not that I have filed yet. So, and they
[57:38] still have there's like two weeks left before someone has to file. So,
[57:43] » and nothing we would vote on. >> Not right now. on
[57:48] » if you to review the zoning ordinance or to review the section on the ZVA. It's
[57:53] nothing you have to vote on. It's just, you know, this is going to be the
[57:57] section that applies to how this board operates and what it's looking at and
[58:03] what it's reviewing. >> I think it's good to do that.
[58:06] » So, >> well, I'd like to do that. I'd like to
[58:07] know. I mean, >> yeah, it's it's going to affect you. So,
[58:10] that would be a good spot to give. You're saying you just want to do a
[58:14] meeting next month regardless of if it the next two weeks somebody comes in
[58:17] there might be something to do but we're going to have the meeting regardless so
[58:20] we can go over that. >> Y
[58:23] um otherwise >> a month
[58:25] » can we push well >> that's going to work for me to be here
[58:29] » make it a different day. I can make it a different day because it's we don't get
[58:33] another filing, which I don't >> I don't know of anything coming down the
[58:38] pike. And usually I have a decent idea of what's coming, but I don't know of
[58:42] anything right now. Um so if we get if we don't get another filing, I can pick
[58:49] like we can work on a different day um or a different week because it's just a
[58:55] work session for you guys. It's not a public hearing.
[58:58] » That's what I'm looking at. So otherwise for our zoning ordinance, we
[59:04] » much better >> are cruising [clears throat]
[59:06] through starting to gain some really good momentum. Um and how we're doing it
[59:13] is the steering committee for the zoning ordinance is meeting once a month and
[59:20] going through a couple sections or a section depending on how big they are
[59:24] every month. And then we have started taking the sections the steering
[59:30] committee has completed and taking them piece by piece to the planning
[59:33] commission so that the planning commission isn't going to get a 300page
[59:37] document and have to review it all at once. So
[59:41] » we're probably about halfway to 3/4 of the way through with the planning
[59:47] commission. Um, our goal is to have it wrapped up by December and hopefully
[59:54] adopted in December, maybe January. It's going to get kind of just depends how
[1:00:00] things go. >> There doesn't have to be any more
[1:00:02] public. >> There doesn't have to be any more public
[1:00:05] input sessions, but we do have to have a public hearing on it.
[1:00:09] » Got. >> So, the planning commission will hold a
[1:00:12] public hearing. Um, I haven't decided yet or we haven't decided yet if we want
[1:00:18] to do like an openhouse to give people an opportunity to look at some of the
[1:00:24] language that, you know, everyone's interested in how it affects them. Um,
[1:00:30] and so to look at, you know, some of that language or if we just do it at a
[1:00:35] public hearing, I'll probably lean on my planning
[1:00:39] commission on how they want to handle that and city commission. Um, so that's
[1:00:44] where we're at. We're hoping to have a new ordinance next year.
[1:00:48] » That's good. That's good because I'm I don't want to keep on saying, "Hey,
[1:00:53] there's this coming. There's this coming." [laughter]
[1:00:56] I'm trying not to I'm trying >> It's a It's a long process. They put in
[1:01:00] a lot of meetings and it's very tedious >> meetings. When I looked at when we did
[1:01:06] it, that was all that was like three years ago.
[1:01:08] » Yeah. um >> the committee.
[1:01:10] » They've made a lot of changes that one bring our ordinance more up to date with
[1:01:16] new kind of things that are going on >> and also made some changes to um make
[1:01:23] sure we're following adopted laws. Um cuz a lot of our ordinance was
[1:01:29] peacemealed over the years, which is not like a dig. All ordinances are that way.
[1:01:35] It just happens, >> you know, 100 years. Yeah. And so, you
[1:01:39] know, getting all that cleaned up into, you know, new processes that are
[1:01:44] following the w the more modern ways of doing it is going to be helpful.
[1:01:50] » Okay. >> Right.
[1:01:51] » Um, due to Wendy's schedule, um, do you have
[1:01:54] » just next month? Yeah, >> just next month, September 23rd open,
[1:01:58] Michelle, >> let me look. It's a Wednesday.
[1:02:01] » Better double check here. >> Can I help you? Do you have it open? too
[1:02:06] much. She has somewhere else to be on Thursday. So she
[1:02:08] » on that day >> on that day on the 24th.
[1:02:12] » So to be included Yeah. to be included in it.
[1:02:15] » Wednesday, September 23rd will not work for me.
[1:02:18] » Would not work for you. >> Wednesdays aren't good for me in
[1:02:20] September. >> What about um
[1:02:23] » Sorry. >> Okay. That's why we're
[1:02:27] » um Do you have October 1st? Is that too late, Michelle? October. the next
[1:02:32] Thursday after. >> No, as long as it's early October.
[1:02:35] » Everything is pink. >> Or do you would you rather do the 17th?
[1:02:37] » That's a Thursday. Do you have that open Wendy?
[1:02:42] » The 17th. >> Um,
[1:02:44] » the week before September. >> What time? Um,
[1:02:51] » are we talking in the evening? >> So, I've been holding my planning
[1:02:54] commission work sessions at 5:30. >> So, it would be in the evening. Yeah.
[1:03:01] You okay that day? >> I'm retired. I'm good for
[1:03:04] » Yeah, I'm good, too. I just I was making sure Wendy can attend.
[1:03:06] » Does the 5:30 work for everyone? It just then you get in and out. It will only
[1:03:12] » Are you good, Jeff, with that? >> I can't imagine it's going to take
[1:03:14] forever. >> No, I think and I'll send it to you
[1:03:17] beforehand, so it's not like you won't have you'll have won't have it blind. Um
[1:03:22] » I think it's like >> Thursday the 17th at 5:30.
[1:03:26] » Okay, how that works. Um, >> no.
[1:03:29] » It takes it will take us maybe a half an hour if that.
[1:03:33] » Okay. >> Say October 17th.
[1:03:35] » No, September. >> September. Okay.
[1:03:38] » I might meant September. >> Thank you.
[1:03:42] » Thank you all for working around. It's
[1:03:48] » November's here. It be a lot easier. >> I can't think of anything else. Is that
[1:03:52] it? >> That's all I've got.
[1:03:54] » Okay. >> Okay.
[1:03:56] » Ajourn. >> All right. Thank you. [clears throat]
[1:03:59] » Y
