[2:53] Peoples, and the Unash Navik of the William Streeties. This

[3:04] indigenous heritage and the long - lasting history of the

[14:42] the stop sign. They just wanted to ensure that the
[14:46] residents were aware that the stop line cannot be blocked.
[14:50] Um, it needs to remain visible for oncoming traffic. And
[14:53] will not be removed in the future. Uh, so the
[14:56] residents have been afforded this. Regarding the tree removal, um,
[15:00] our municipal law enforcement has completed investigation. And they determined
[15:04] that the trees were removed prior to the implementation of
[15:07] the tree bylaw. And therefore, no further action can be
[15:10] taken. Um, which landscape has no further concerns. Um, so
[15:16] repeat that they're, they're in the middle of dealing with
[15:18] the infraction of taking those movement, those trees. Just. The
[15:25] entire. The investigation has
[15:35] already been completed and they determined no further action can
[15:38] be taken. No further acts. Okay. Memorable. Sorry. What I
[15:42] read in the landscape comments and correct me if I'm
[15:44] wrong that they did construction within the tree protection zone
[15:49] and may have damaged a red oak tree. That's what
[15:53] I was reading. And so, uh, they, and I think
[15:58] it's, they should be responsible of that tree. Is damaged
[16:03] if it looks like there's damage after they've constructed. Um,
[16:07] so what's, you know, you say the further action. But
[16:10] if they've damaged a tree because they built without a
[16:14] permit or a tree protection zone, how do you use,
[16:19] let's say they should be planting another tree because they've
[16:21] damaged a tree. How do we enforce that? Where's the
[16:26] consequence. It sounds like there was enforcement. Was there enforcement.
[16:35] Through the chair there was enforcement in terms of looking
[16:39] into it? Um, and going through that route. Because it
[16:44] was done prior to the bylaw, there aren't necessarily consequences
[16:48] that could be taken afterwards with respect to this application.
[16:52] So if they can replant a tree, that would be
[16:54] nice of them to do. However, it's not a requirement
[16:57] from an enforcement perspective and enforcement was handled. This matter
[17:01] is unrelated to the minor variants application though. So I
[17:07] would just like to flag that. No, but if we
[17:09] want, if we were concerned about the tree, we could
[17:12] make them plant a new tree as a condition of
[17:16] this variant that this committee decided to grant it. I
[17:20] don't know. And do you know, is the red oak
[17:27] tree damaged? Is it a live dead? Do we know.
[17:37] Through the chair, I'm not entirely sure. I believe, um,
[17:42] landscape may have mentioned it was, it was removed. Um,
[17:45] but no further action can be taken. Landscape doesn't have

[18:00] they asked for a permit. They took the tree down

[18:57] the chair, um, what seems to have been built today

[19:07] metres. Okay. And this was verified by you or just
[19:11] the client or I'm sorry, the homeowner. How was this

[27:16] that's all that, uh, this application is seeking to, um,
[27:20] to address is the relief for that. Uh, we can't
[27:23] speak to the proposed hardscaping or truck parking or the
[27:31] sprinklers. Those would be private matters. Um, that can be
[27:34] dealt with specifically with, with the, the, your neighbour. I
[27:39] don't know where he went. Um, with the neighbouring resident,
[27:43] um, and if there's any further concerns or complaints, it
[27:47] can go through by law enforcement if he sees fit.

[30:26] landscaped area. I believe heartscape is, I believe it is.
[30:33] You can have asphalt and concrete. But I know what
[30:38] you're trying to do. Landscaping area means that portion of
[30:41] the lot area of a lot required for the growth
[30:44] and maintenance of grass flowers, bushes, trees, and other landscaping.
[30:48] This definition may include any surfaced walk, surface patio, stormwater
[30:52] management pod and swimming pool play facility deck not more
[30:55] than 0. 6 metres above grade or similar, but shall
[31:00] not include any driveway or ramp. Whether surface or not.
[31:04] Because my question is, if that is asphalt beside the
[31:07] house, you could consider it to be a driveway. And
[31:12] then they've got a lot lighter driveway. If it is
[31:16] asphalt and they can drive cars on it. So that's

[33:20] artificial putting green. And beside that is the pool. The
[33:25] pool is not where it is shown on this drawing.

[33:48] it any better than that because I haven't gone on
[33:51] to the property. I'm not allowed to do that, obviously.
[33:56] But from my perspective, it looks like there may have
[34:01] been a permit issued. There may have been plans presented.
[34:06] But the homeowner did whatever they wanted to do. The
[34:12] driveway part, everything around the main house and the garage.

[39:10] fence, some landscape feature to block that area to avoid

[1:01:38] availability to build a garage or a cardboard. If they

[1:01:48] also can accommodate multiple cars. She also included a picture
[1:01:53] of number two George Street, where there's no parking, no
[1:01:59] garage. But there is an old barn that's been on
[1:02:01] the property for over 100 years. That if they chose
[1:02:05] to, they can park in. But that property's driveway is
[1:02:10] very much to the east of the house, and they
[1:02:12] can accommodate multiple cars. I would. Like to have this

[1:14:19] knowing you have had the opportunity to review the submitted
[1:14:22] opposition statement in advance of the herring. Which in our
[1:14:25] opinion, identify that the minor variants did not comply to
[1:14:28] all the four tests. If I may quickly summarize the
[1:14:32] proposed carport is asking to be a mayor one metre
[1:14:35] from Linda's property rather than the bylaw setback required of
[1:14:39] three metres, though a couple of metres on paper reads
[1:14:42] to be minor and insignificant in reality, each metre counts,
[1:14:47] especially if you consider beyond beyond the property line that
[1:14:51] the current neighbouring house is a mayor one metre from
[1:14:53] the driveway. In addition, we believe the one metre does
[1:14:57] not take into consideration the overhang, which we just confirmed
[1:15:00] today. Which will further negatively affect the natural light coming
[1:15:04] into your windows, where she currently works from home 90
[1:15:08] percent of the time at our dining room table. The
[1:15:11] slope group would become an eyesore in obstructing the view
[1:15:14] from her windows, her bottom window is seven foot high.
[1:15:18] And now she would have to be looking at a
[1:15:20] carport roof line, an overhang and a whole carport roof
[1:15:24] rather than the current open space that she has. With
[1:15:26] the water running off the slope roof directly onto her
[1:15:29] property during heavy rainfalls, which we all know have become
[1:15:32] extreme these days. This could easily flood her basement, which
[1:15:35] she uses as added living space when her children and
[1:15:39] grandchildren visit. Linda has shared that the applicant, Michelle. Uh,
[1:15:44] purchased her home approximately four years ago. And I understand
[1:15:47] that the relationship between Lyndon Michelle, thus far has been
[1:15:51] good and respectful. You know, the carport, for example, six
[1:15:54] foot, Linda's window is seven and it's the peak that
[1:15:56] was eight. So Linda had shared that the applicant, Michelle.
[1:16:00] Purchased her home approximately four years ago. And I understand,
[1:16:05] I think I'm repeating myself that they've had a good,
[1:16:06] good relationship. Linda has lived in her modest home for
[1:16:10] 20 years where she was a sole provider in raising
[1:16:12] her two children. And since become a grandmother, Linda continues
[1:16:16] to work hard to the stay and continues to work
[1:16:18] long hours at her dining room table in hopes of
[1:16:21] looking forward to retirement one day. Over the 20 years
[1:16:25] that Linda has lived there. Prior homeowners approached Linda with
[1:16:28] considering adding a garage or car porch next to her
[1:16:31] home in which she shared her concerns with them. And
[1:16:34] no minor variants application had been submitted until today. Today
[1:16:39] at the new homeowner Michelle in being a respectful neighbour,
[1:16:43] she is. Uh, did text Linda prior to applying to
[1:16:45] the minor variants. Michelle Ascalinda, if she would be opposed
[1:16:49] to the minor variants, explaining that she did not want
[1:16:52] to incur a cost to apply for the minor variants
[1:16:54] and if it was a problem with Linda. She had
[1:16:58] communicated to her prior neighbours share that she was not
[1:17:02] in agreement with building a structure being so close to
[1:17:04] her home. Today, Lind is here before the Committee of
[1:17:08] Adjustments in opposition of the minor variants is noted in
[1:17:11] her submission. And though Linda empathizes why Michelle would like
[1:17:15] a carport, Michelle knowingly purchased a home without a carport.
[1:17:20] Linda will be 65 years old this year. And as
[1:17:22] we all know, a homeowner's large assassin - free retirement
[1:17:26] is their house. In addition to the concerns expressed already,
[1:17:29] the true potential of Linda's resale value of her home
[1:17:33] may not truly be realised. In fact, it could neglectly
[1:17:37] impact her resale value should this variance be approved, in
[1:17:40] that the home's main dining room and bedroom windows would
[1:17:43] have an unsightly obstructed view of a car pour affecting
[1:17:46] the natural light coming into the main living areas. Most
[1:17:50] concerning is the stormwater runoff directly on to Linda's property,
[1:17:54] increasing the risk of the basement flooding, requiring cost of
[1:17:58] remediation, and who's going to pay for this. Today, Linda
[1:18:02] is asking the Committee of Adjustments to please consider all
[1:18:05] the information provided. Please kindly take into consideration the negative
[1:18:10] impact this will have on Linda's quality of life that
[1:18:13] she's enjoyed for the past 20 years. The negative impact
[1:18:16] of Linda's future resale value as she is entering into
[1:18:19] her retirement years. And to respect, remember that Michelle, knowingly
[1:18:23] purchased a home for years ago, that did not have
[1:18:25] a carport. Perhaps a solution today. I'm going to repeat
[1:18:30] what some of you said, in which we ask both
[1:18:32] Michelle and the town of Caledon to consider would be
[1:18:36] an extending the driveway further back into Michelle's yard to
[1:18:40] allow the carport to be built immediately behind Linda and
[1:18:43] Michelle's house. The trees are industries on Linda's property. She
[1:18:47] just mentioned that to me. In addition, the roof slope
[1:18:51] should be reconfigured to ensure water runoff does not come
[1:18:54] directly onto lendus property. This solution would provide to Michelle
[1:18:59] her desired carport and in turn address Linda's concern that
[1:19:03] could actually satisfy both parties and better suit the character
[1:19:06] of the neighbourhood with all the cars and garages being
[1:19:10] set back. Today, Linda's asking the committee to either reject
[1:19:14] the minor variants as submitted for the reasons explained today
[1:19:18] based on the Nugget Impact of the Carport being built
[1:19:21] in such close proximity to her house or to defer
[1:19:25] the decision of the minor variants to allow Michelle in
[1:19:28] her contractor time to redesign the carport and move in
[1:19:32] it back away from between the houses. I would also
[1:19:35] ask if this is an option to move the carport
[1:19:38] back, the Michelle and her contractor consider including Linda prior
[1:19:43] to coming back to the Committee of Adjustments to reassure
[1:19:45] Linda that the stormwater runoff from the roof is being
[1:19:49] addressed. The suggestion could actually address both Michelle's needs and
[1:19:54] Linda's serious concerns in which they both could continue to
[1:19:58] have a good, respectful relationship. And it would maintain the
[1:20:01] character of the neighbourhood. We just want to know if
[1:20:04] this is possible. And we thank you for consideration and

[1:21:41] duck adjacent to the hot tub. The trees and foliage
[1:21:47] I mentioned earlier are on my property. I have the
[1:21:51] people prior to me put in electrical lighting systems through
[1:21:55] the ground to light up portions of the backyard. I
[1:21:59] have a lilac tree. I have two other trees beside
[1:22:02] the lilac. Missile Grady has two very big maple trees
[1:22:08] that are close to our property line. That would take
[1:22:11] down trees if needed to be moving things back. There's
[1:22:17] really no option to move a carport backwards. Into the
[1:22:22] property behind her house and my hips. Considering my house
[1:22:30] goes much further back into my property than her property.
[1:22:36] If mistal grady had asked me, I would have told
[1:22:40] her from the beginning, I have every intention of having
[1:22:44] eave troughs and a downspout into my property so that
[1:22:49] my foliage and property will have water for the trees
[1:22:52] and the shrubs. Also in the text message conversation that
[1:23:00] I sent to Ms. O'Grady on Wednesday, May 13th in
[1:23:04] the afternoon. Stating that I, this is what I intended
[1:23:09] to do. And that I would like to have the
[1:23:12] minor variant applied for. And if she had any problems,
[1:23:17] I said it's an open carport, not closed like a
[1:23:20] garage. Please let me know your response right away as
[1:23:24] I need to submit for the variance. And if you're
[1:23:26] going to have a problem with it for any reason,
[1:23:29] I do not want to waste 2, 700 dollars on
