[0:01] like she doesn't want to go for a master, but
[0:06] she has to
[0:37] » [snorts]
[0:50] » I didn't realize
[0:58] Did you say you got [clears throat]
[1:03] the 20 24
[1:17] [clears throat]
[1:26] » [laughter]
[1:44] » Looks like everybody's in place. We're going to call the meeting to order. And
[1:47] the first item on today's agenda is the pledge of allegiance.
[1:55] » Pledge to the flag of the United States of America and to the republic for which
[2:00] it stands. One nation under God, indivisible, liberty and justice for
[2:06] all.
[2:10] » Okay. So, first item is public comments. Is there any public comments this
[2:17] evening?
[2:40] Dave, you have something? >> Um,
[2:46] I was um at Williams Grove for the 9-day deal that they had. Uh, I was over there
[2:54] seeing a lot of people coming in complaining about the Route 15 traffic.
[3:00] And the route route 15 traffic is ridiculous I think. And um
[3:08] a lot of the people were furious and u I know that a lot of residents are fed
[3:14] [clears throat] up. Uh when we have new developments come
[3:19] in, they get upset uh even more. And I I understand where
[3:24] they're coming from. Uh I've been trying to come up with some
[3:29] way to sort of solve this. Uh but we have developments on the way and there's
[3:36] future coming and I thought maybe there'd be some way
[3:40] to get a a moratorum to stop the future stuff
[3:45] uh on the basis of like u uh if the city water system isn't big
[3:52] enough to accommodate the new development that maybe they would hold
[3:57] it off something to that effect. Uh but uh I was talking with uh Dave Jones
[4:04] there, our our solicitor today, and he explained a little bit more to me uh
[4:11] regarding uh [snorts] our rights as far as
[4:15] township on what we can do to try and stop some
[4:20] of this so we can lighten things up. When you look at the fact that a
[4:24] development goes in with uh say 100 homes, that's 200 more cars that go on
[4:31] this road out here. And when you look out there at 11:00 in the morning and
[4:37] see gridlock both directions, you know there's something wrong. And but we're
[4:42] dealing with that. It's going to get worse.
[4:45] Um I don't know, Dave, u do you have any comments on this as far as explain how
[4:51] we stand on this? Well, it's it's under the Pennsylvania Municipal Planning
[4:55] Code. If a if a developer comes in with a plan that meets the requirements of
[4:58] the zoning ordinance and the subdivision land development ordinance, they are in
[5:03] fact entitled legally to an approval. I'm not speaking sight to a a a
[5:10] ordinance requirement that has not been met. So, that is part of the issue.
[5:14] Pennsylvania's long long been a property rights states that if you own a piece of
[5:18] property, you're allowed to do what you're permitted to do with it
[5:21] reasonably. Um there's a lot of case law about municipalities trying to put
[5:26] moratoriums on development and they've all been turned they've all been
[5:30] reversed and said you can't do that. So um unfortunately I I just have to tell
[5:35] you what the law is. It's not my position necessarily, but um I drive
[5:39] through this this traffic sometimes, too. But at the same time, we can't
[5:42] control 11:15 or Route 15 and and that's a state road. And that's not just
[5:48] because of the development here. [clears throat] That's because
[5:49] development south of us, development north of us, west and east of us, and
[5:53] it's just more and more people on the road. So,
[5:55] » thank you. [clears throat] >> One one little bit. Yeah. Um the we had
[6:02] a thing about month or so ago uh where Pendot came in and and uh gave us a talk
[6:10] at the [clears throat] uh BFW in Billsburg uh regarding
[6:15] upgrades on 15th and that stuff. [clears throat]
[6:20] Um, there's a going to be a 2-year break where I think they're going to get water
[6:26] pipes and things under Route 15 taken care of, get them upgraded,
[6:31] and uh after that they said it would take 3 years to uh do the changes that
[6:39] they want to make. Now, the changes they want to make are more like acceleration
[6:43] ramps and de acceleration ramps for uh roads that um
[6:50] uh come out and say have a stop sign or something like that at Route 15 plus to
[6:56] help it for the businesses to get on and off which I think would help things but
[7:01] uh that's 5 years away and uh I the biggest problem that I see
[7:09] is the fact that we're we had in our comp comp plan, we had uh interchanges
[7:17] that we thought should go in um and uh different locations and some
[7:23] roads that would uh back up these interchanges
[7:27] and uh 5 years from now they're going to be gone.
[7:31] » That means no interchanges unless they start ripping things down. I don't know
[7:37] » how they can possibly do it, but >> yeah, there's Thank you, Dave. I
[7:41] appreciate [clears throat] it. >> That's it.
[7:42] » Yeah. Um and then of note, uh we did have an executive session before the
[7:46] meeting. I forgot to um say it before, so I'll do it under public comments um
[7:51] for ongoing legal matters that we had to discuss. So, we did hold an executive
[7:55] session beforehand. Um now, we have the final subdivision in land development
[8:00] plan for 941 York Road Warehouse.
[8:05] And it's the deadline is September 24th. >> Are you able to put it up?
[8:12] » Thank you. >> Good evening. Conor Serge with Highland
[8:15] Engineering here representing the owner. Um so this plan is a subdivision land
[8:20] development final plan. It is one lot existing right now. We're planning to
[8:24] subdivide into two lots. One will be developed about 30 acres or so and then
[8:28] a residual lot of about 24 acres. that lot one. Um I can wait till it gets
[8:34] pulled up. Um but we did come through with pulary plan uh in 2024. We had two
[8:40] waiverss associated with that that were approved as well. Um it's a 252,000
[8:45] ft industrial facility with associated loading docks with 33 loading docks, 41
[8:53] trailer spaces, and 88 employee spaces.
[9:00] I apologize. I have a connection issue. >> Okay.
[9:03] » No problem.
[9:09] » Uh the building provides fire access 360 around the building and there's a fire
[9:13] water tank um solely for the facility located on the property. We have storm
[9:19] water management, a large basin downstream as well as an infiltration
[9:22] trench um just outside the employee parking. We've gone through multiple
[9:27] permits with PADP. We have NPDES approval as well as uh chapter 105
[9:34] permit approval for a roadway that crosses a stream that we are providing a
[9:38] culprit access through. Now, um traffic is expected to be approved by PENDOT
[9:45] here in the next couple weeks. [clears throat] Very hard to know down
[9:47] the time frame as I'm sure you know. Um but all the major things have been
[9:52] ironed out. Our sewer and water are tying into the extensions already
[9:56] provided by the TCU project uh directly above us this south. Um and we also have
[10:03] electric on site. Um there are some minor improvements to
[10:10] your road coming mainly widening your shoulders um and repaving lanes. Um kind
[10:16] of matching what TC did just continuing that down further. There you go. So that
[10:22] is the um lot one to the bottom of the screen is route 15
[10:29] and then on the right hand side is your road. Um up above to the north is your
[10:34] residual lot too which is pretty much just open field going to remain that
[10:38] way. Um up here
[10:43] that's where our storm basin will be going. Um majority of the runoff reaches
[10:47] that [clears throat] and then it discharges further to the left hand side
[10:51] down to dogwood run. Um again we all permits with D for that already.
[10:57] Um here is the fire access. I talked about
[11:02] fire that was discussed with fire chief um and ultimately approved as well the
[11:07] gold marana plants. Uh any questions I would be happy to
[11:12] answer if you have any. Yeah, I do. When this pro uh project got started, I did
[11:20] some research on on what needed to be done
[11:25] uh with certain things as far as oil separators. Okay. The oil separator deal
[11:31] was I checked on what the new road tractor's maximum fuel capacity was and
[11:39] the maximum fuel capacity was like uh uh I think it was like 730 gallons
[11:47] and the possibility of a fuel tank rupture in a parking lot even if it's
[11:52] just a fender bender or just a failure of a a fuel [snorts] line or something
[11:58] like that where you can start having a spill. You should be able to contain
[12:04] the maximum gallons so it doesn't get into the screen and actually get it
[12:09] before it goes into your basement. And it's a simple thing to do and I find out
[12:16] I was trying to get from your people the information as we went along and along
[12:21] and along what was going on and they kept saying,
[12:25] "Well, we'll get back to you. will get back in. Never did it. I finally find
[12:30] out you're putting in standard fuel station like service station where
[12:37] you get gas uh drain systems and that's it. There's
[12:42] one every one of them is going to catch I think it's 30 gallons or 40 gallons of
[12:48] fuel and from there on it's going to go in the stream there. If you have another
[12:55] uh storm drain 30 ft away and some of it goes in there
[13:00] and it captures 40 40 gallons and start sending it into the stream, that's what
[13:06] you're going to have. You're supposed to have a system right before the the basin
[13:14] where all the all the water or whatever from the parking lot comes down into one
[13:20] pipe and right before it goes in there have an oil separator
[13:26] and they changed it all around and come up with this storm drain deal which
[13:31] ain't going to do it. So there if you know it's already passed, it's already
[13:37] in place. But if there is a problem and it gets into the spring and it goes down
[13:43] into yellow, somebody's going to have a big clean up.
[13:47] » I mean, >> yeah.
[13:48] » And right, just for your information, since your basin is your basin built
[13:53] yet? >> No, nothing is under control.
[13:55] » You might want to think about it. [snorts] So as the whole thing, the
[13:59] whole idea and a knew it was to run it into one pipe
[14:04] through the separator into the basin and had the base had the separator also with
[14:10] an alarm system, if it was loaded with fuel because any truck driver that goes
[14:15] in and dumps a load of fuel by accident and he gets some way to fix it, he's
[14:21] going to get out of there because he doesn't want to pay for the cleanup of
[14:25] the screen. So, it was a big mistake on it. The the
[14:30] next warehouse behind you guys is in doing the same thing and they're not
[14:35] fully approved. They're coming for the final. And there again, it's the little
[14:40] storm drain deal. >> Thanks, Steve.
[14:42] » So, I just want to point that out. >> Okay. Thanks. Anyone have any other
[14:47] questions?
[14:50] » Manny, do you have any questions on this? Um I don't have any question but I
[14:56] did we did um point out a couple other comments. Um
[14:59] » okay >> in item number five so we have talked
[15:03] about that mostly is the plan clean up at this point. Um so my main concern
[15:10] will be the panda stone crate under the the um panda row. So make sure that you
[15:16] provide the proper >> site plan one and the storm water um
[15:23] calculation for my review. >> Yep. We will get that with you.
[15:27] » Can you let us know when when that comes in?
[15:29] » Yes. >> What was the change um in the end of the
[15:33] proposed retaining wall north of the driveway entrance?
[15:37] So it originally followed the curve line.
[15:40] » Oh, essentially closer to York Road
[15:46] didn't like that. So they cut it off and buried it into the site more. So there's
[15:50] more grading provided kind of sloping [clears throat] pended.
[15:54] » Yeah. >> Okay.
[15:55] » So that way they need to be cleaned up a little bit as well. Um because you know
[15:59] it's very hard right now. Um after you make the wall curve to the
[16:06] north that you need to clean up the building
[16:09] right there. >> Yeah. I don't know the thoughts will be
[16:12] on a little bit but is there a determination already made
[16:17] you on the financial contribution agreed upon was for the realigning of R 74 to
[16:22] the north. >> I believe the client has been in touch
[16:26] with Brandon and your team on that. I know
[16:28] » I I know we've I see what we for the donation for the green space, but
[16:33] » I don't think anything's been signed. >> Yeah, it was part of the conditional use
[16:37] approval. I believe it's $400,000. Uh there was a
[16:42] that score in lie of uh which was
[16:52] » yeah that was there's there's a rack fee in L correct
[16:55] » and then a lump sum contribution which is separate 400,000
[17:00] that goes to emergency services and for the relocation of 74 in the future. So
[17:06] that was decided upon the conditional use hearing.
[17:14] So that part four section 4 [clears throat]
[17:17] um part five that is the route 74
[17:24] realignment of route 74 to the north contribution [clears throat]
[17:27] or is that for the green space park? >> The fee in L of there's two things
[17:33] there. The fee loop is her direct direct fee.
[17:36] » Yeah. But I only see one number on that report.
[17:39] » Yeah. She don't have a specific number. Um
[17:44] » I think it's directly um copy from what the P plan comments letter.
[17:50] » Yeah. So it goes by the disturbed area. Um I believe it's $1,000 per disturbed
[17:54] acre. Um and then we take the limited disturbance. I have that number on the
[18:00] screen share so I can't pull that back up.
[18:02] » Okay. because said in a report that that 400,000 is the wreck fee. It's not the
[18:07] donation for Route 74 realignment. >> Two items here
[18:13] and >> so there's two. There's a rec.
[18:17] » Yes. >> Okay. [clears throat]
[18:19] » So the lum contribution is $1,000 but the fee is separate number but I can get
[18:24] the number to you. >> So they will have to be paid prior to
[18:27] recording. >> Right.
[18:29] » Yeah. Okay. There's any questions I had. >> Thank you.
[18:35] » That's it. >> Thank you guys.
[18:39] » Okay. TN TCNE SH reduction. We have
[18:49] uh so for the [clears throat] reduction uh we will use the most
[18:55] current site plan and we also did the site visit and just confirm everything
[18:59] were installed properly and construct as planned. uh at this point we are
[19:05] recommending retaining 50% of to ensure the survival of the tree during the 18
[19:11] months guarantee period and 25% of the post schedule lighting infection. Uh the
[19:17] amount that we would recommend to retain is $151,000
[19:24] $151 $800. So that's the release amount >> 151
[19:37] recommend um $4 million a little bit more $4 million to be reduced and
[19:44] » least
[19:49] okay
[19:52] next is the minor minor financials or that minor final subject collision plan
[19:57] of 235 Campground Road for Jeffrey Stump and Angela Clemens. There's a deadline
[20:02] on December or September 23rd. We do need a time extension on that.
[20:06] » Correct. Yeah, this is still at the planning commission level
[20:09] here tonight. Um, if you guys have any questions on that, they did provide us
[20:13] with signed time extension uh to November 30th, 2026.
[20:19] » Yes, I saw that. I didn't have any questions. And how do you think it's
[20:22] going to go between you think be done by November 30th?
[20:27] » Yeah, I mean the biggest thing in these types of subdivision plans in this
[20:32] particular case are going to be pendot which is in its final throws of being
[20:36] reviewed by PDP and [clears throat] uh a pendot permit for the new lot. Um that
[20:43] permit [clears throat] has been submitted. that's in the review process.
[20:46] But um though it's a minor minimum use permit, it still could take 6 to 8 weeks
[20:51] to be issued. So we would expect to have that before that time frame.
[20:55] » Sure. >> Um one of the issues I know that came up
[20:59] with the planning commission. I was hoping we could discuss it at Florida
[21:02] level tonight, but my client unfortunately is out of town due to the
[21:05] holiday. um was a recommendation of the of the planning commission to consider
[21:11] um instead of taking a fee in lie of u recreation to uh require or request an
[21:18] easement for the rail trail that I think is projected to go through this
[21:22] property. Um, as I said, my I was hoping my client would be here to do the
[21:27] discussion instead of me, but uh they they do plan on being here next week.
[21:33] So, we certainly can have that discussion with the board. Um, obviously
[21:37] they do have concerns regarding liability and and those types of
[21:41] factors. Um, but they are willing to talk. So,
[21:47] um, relative to the plan itself, it's as you may know, it's a it's a relatively
[21:51] minor plan. It's a 10acre lot that we're cutting off the existing farmhouse
[21:55] that's located on this property in order to create a new lot that the owner
[22:00] intends to build a home for his wife and uh family.
[22:05] We did work with the township and that home is currently under construction. Um
[22:10] so we're kind of catching the subdivision up with what he intends to
[22:13] do. We do have some minor comments relative to Manny's review and we have
[22:18] no problem in getting those cleaned up. So, I'll answer any questions you may
[22:22] have or I'll see you next week. [clears throat]
[22:27] » Thank you.
[22:40] Process Mandy. >> Yes. Thank you.
[22:44] Uh going on as usual. Um the good thing is um open room has been open uh since
[22:50] August 12th. Um things as of now uh going pretty good. Um we didn't get any
[22:56] call as far as I know. Uh [laughter] so everything is going well for that one
[23:03] in so that next item is all bank statement roundabout.
[23:10] Um, so the public meeting is actually scheduled on September 5th, 15 from 6 to
[23:16] 8 at the concert building, which is next Tuesday.
[23:21] » Um, not
[23:30] we can ask Chelsea to put it on the D. It is
[23:34] [clears throat]
[23:37] » okay. I didn't see this a couple weeks ago.
[23:41] » The email. Okay. Okay. I think I just got the email last week, I think.
[23:45] » Okay. >> They created a flyer for it. So, we got
[23:50] it out to everybody. I put it on my Facebook just try to get it out.
[23:56] Okay. [clears throat] >> So, as far as the
[24:00] comments, can we actually address the comment already and resubmit
[24:06] the revision? Uh, at this point, they are still coordinating with the area
[24:12] authority. Uh as far as the water and sewer aspect of it, um
[24:18] from what I know for further discussion will need to be um going on and
[24:24] happening with their engineer GTH. But um exciting news, you know, the next
[24:29] public meeting so we can provide the education um opportunity for the general
[24:35] public. >> Any questions for me at this point?
[24:40] » Will you be at the public meeting? I move it. Yeah. So the next item is high
[24:46] grow. Um they actually submit the final plan for the township and engineer
[24:51] signature already. At this point um we're waiting for their update and once
[24:58] the plan is reported. So no scrolling on this one just you know hitting the final
[25:04] finish line. Next one is just my go uh I have been
[25:08] coordinating with the development contractor. Um, everything's going
[25:16] pretty smoothly. Um, they actually submit [clears throat] the f final
[25:20] cleanup plan last week, which is really good. Um,
[25:26] as of this morning, I do have another conversation with them. Um, they're
[25:30] expecting to submit, they still have a little bit clean up to do, but it's just
[25:35] nothing major. Uh it's just for presentation purposes, nothing related
[25:39] to engineering. Uh they they will plan to provide me another copy uh later
[25:46] later this week. [laughter] Okay. Construction is still going on. Um they
[25:51] are planning to install the sewer line September 13. Uh we will have the
[25:58] inspection people out there to make sure that they do their back field and uh uh
[26:05] compact material properly.
[26:11] The next item is 235 campground row. So Mr. was here
[26:18] already. Next item is 941 local warehouse. Uh
[26:24] this one is also on the on the agenda earlier. So nothing more to add at this
[26:29] point. Uh J also on the agenda. Nothing more to
[26:35] add. Going really fast, huh? That's great. So the next one is for North
[26:41] County School District Middle School. Um as of now um I have not received the
[26:47] plan or application but they're planning to submit to um to the country for
[26:53] review and comment shortly. They would like I from what I understanding they
[26:57] want to move the project fast.
[27:01] Um the next one is the solen uh I'm sorry. So the next one next one is
[27:09] the solar p 454. Uh they actually rescheduled their goal
[27:14] widening schedule. Uh it was supposed to be August 31st. Uh right now their their
[27:19] schedule uh push to uh September 15 which is next week.
[27:27] Um that's all I have. Um other than that
[27:33] project is not much more money. Thank you. Yeah, many of or Brandon. Um,
[27:42] thought there was talk about a is there going to be any kind of reconstruction
[27:46] of the intersection of Orbank and 15 where Giant from Giant down to 15 or was
[27:52] it only just the section of providing a turn lane coming off of Orb Bank on 15?
[27:58] » No, the full reconstruction is involved with the Pendot project. But yeah, all
[28:03] the improvements that were done that you see out there now were part of the
[28:08] approved plan for it. So it's basically >> there won't be anything done from our
[28:12] plan right now until P end up comes in correct
[28:14] » for that from giant 215. Okay. >> All right. That's my question. Thank
[28:19] you. >> See next we have the SPC of your
[28:23] accounting animal care and housing agreements 2027 animal care and housing.
[28:28] On August 25th, uh we received from the SPCA the 2027 annual care and housing
[28:34] agreement uh our municipalities invoice for the 2027 fee and the service summary
[28:39] to support communications with stakeholders and taxpayers. Uh you
[28:42] should all be a copy of that um for your review uh and for your signature to
[28:48] approve the agreement as a local governing body. And then I have the
[28:53] invoice attached here for $6,235 for me to submit for pay for payment.
[29:01] [clears throat] Yeah, I do read the agreement. I didn't see I didn't see any
[29:04] issues from my perspective. The only thing I would note it is a 7% increase
[29:09] um as we're seeing increases hitting the township for 2027 coming up.
[29:15] » Mhm. Yeah, I know. >> Okay.
[29:16] » Yeah. But it's one of the Yeah. We have to have
[29:18] » Yeah. Yeah. You know, I disagree with just noted that I think every I think
[29:25] everything's >> We're lucky it's only seven.
[29:28] » Yeah, cuz that's we're getting ready to go into budgeting. [laughter]
[29:31] » Yeah. >> All right. Uh include animal control
[29:35] services contract for 2027. >> Uh you should we also receive for uh the
[29:40] animal control service contract include now. She will actually come to if we
[29:45] have an animal, she actually won't call her. She'll come and actually physically
[29:47] take the animal. Um, were they given last year's contract review?
[29:53] » Yeah. >> Yeah. Okay. So, you you should have the
[29:57] new one for 207 and cont the last one. So, you can review side by side to see
[30:03] » roughly how many times we use them in various year to year. It could be it
[30:08] could it depends. It could be a very light year. It could be a heavy year.
[30:13] I think last year last year when you budget like,100
[30:21] they're almost not a lot of money but it's still 20% increase.
[30:26] » Yeah. >> I'm just trying to determine that we use
[30:28] them like 50 times. >> You don't have to accept that. You can
[30:32] always ask to enter into negotiations with her.
[30:35] » Yeah.
[30:38] » Okay. >> Unfortunately, she's the only game in
[30:41] town. No, for the most part. Yes, he kind of has
[30:44] » there's supposedly a new one starting down on red lines. I don't know if
[30:47] that's true or not, but >> yeah,
[30:50] » get some competition.
[30:53] » It'll be welcome. >> So, there seems to be a lot of times
[30:58] that they are closed. What do you do with dogs
[31:01] » during the time that they are not taking?
[31:03] » Um, we'll try to get the state dog board if they're available. If they're not,
[31:06] we'll ask the homeowner to the dog.
[31:11] in the mail. >> How often does how often do they pick up
[31:16] when when you need them and how often are you having to come up with
[31:19] alternative? Um >> rarely. I will admit it's rarely
[31:24] » Okay. And what's the cost for each time that
[31:28] they actually take up a dog? >> That can vary. I I don't know that
[31:32] number. >> Okay. So, it's not the same proof. I I
[31:37] didn't I may have read too fast, but I didn't notice that on the contract.
[31:41] » Yeah, I I have to review it myself. >> Okay.
[31:47] » Okay. Next we have DOG grants resolution
[31:53] number 26-23 a resolution of board of supervisors
[31:57] Carol Township authorizing the signing of the fiscal year 26 bridging
[32:01] immigration related deficits experience Biden program round three grant
[32:06] » Sergeant Terry Williams is on Zoom to discuss that if you have any questions
[32:10] » I don't have any questions is this the same the same things that we applied for
[32:16] in phase two >> we never ended up imported under phase
[32:20] two. Well, we ran out of time. Now we're waiting on phase three hasn't opened up
[32:23] yet. We're anticipating it soon. >> Okay.
[32:26] » Uh the Sergeant Williams I know they're waiting for phase three to open up.
[32:31] » Well, yeah, it it seems like it was the same thing. So,
[32:34] » it is it is. Yeah. >> So, is it required um to be part of the
[32:39] 287g program in order to apply and receive that grant?
[32:43] » I believe that it does. Arms, you want that?
[32:47] » Yes, it does. Okay, good. Thanks.
[32:52] » I have a question about that.
[32:57] » Did you have more questions for >> I didn't want to interrupt you if you
[33:02] were still asking
[33:06] question. >> Um Szo, I'm a Carol Township resident on
[33:09] Creek Road. Um, and I was just curious about this. Um, reading through um, the
[33:15] online documentation about it. Um, under the eligibility section, it says
[33:21] applicants must be fully participating in either HSTF operations or other major
[33:27] DOJ enforcement efforts or commit to entering into and fully participating in
[33:32] these efforts. And I was curious if the language here um pulls us into a bigger
[33:40] requirement for responsibility um and less discretionary power than the
[33:45] 287G itself does. I understand under the 287G officers
[33:52] have the discretion of whether or not they want to um cooperate with a request
[33:57] that they get from homeland security um or ICE and they have the discretion to
[34:04] say no we don't want to go doortodoor no we don't want to go into the schools um
[34:09] I've stopped someone I don't want to separate this family even though there's
[34:14] um the driver is undocumented and we currently have that discretion
[34:19] And I'm curious um in the language of this contract, the way it says that we
[34:24] must be fully participating whether that gives us the discretion to
[34:28] say no. >> Sergeant Williams, do you have an answer
[34:32] to that? >> Uh I I don't understand really what your
[34:38] basis of your question was. Um so can you maybe elaborate a little bit?
[34:43] Yeah. Um and I'm just reading from I don't know OM number 1121
[34:50] 0329 is the online um overview information
[34:55] for the uh Biden program. And section two um shows eligibility
[35:04] for the grants. And the second paragraph explains that we have to either
[35:10] participate in the 287G or commit to participating in one. But
[35:15] in addition to that, we must um make a commitment to be fully
[35:23] participating in Homeland Security Task Force
[35:27] operations and fully participating in other major DOJ enforcement efforts. So
[35:34] that's what I'm questioning whether this gives us less discretion going forward
[35:39] if we um participate with this grant. >> I don't believe so. Um most of all of
[35:45] the other 287G departments in your county have already applied for this
[35:50] grant. Um it's just specific as to whether or not we participate in the
[35:55] program or not. Um I I don't I'm not looking into it the way I think you are.
[36:00] um it's just meant me necessarily that you have to be certified under that
[36:06] program in order to apply for this grant. That's that's about it.
[36:12] » Is that something that we could get legal advice for? Sure.
[36:17] » I guess what I would say is this. If the requirement is that you lose all
[36:21] discretion, they would need the 287g participation because it is
[36:24] discretionary. Correct. >> Correct.
[36:28] » Right. So on a 22 287G we have the discretion to to say no [snorts]
[36:32] we're not doing that. So for them to add if if the second requirement were well
[36:38] you don't have a choice you don't need 287g it would just say you have to
[36:41] commit to participating in all those activities that you you imagine all the
[36:47] major task force activities and so on and so forth. We certain I'll certainly
[36:51] look into it by next week. who's trying to look into that. But from a logical
[36:54] standpoint, they wouldn't bootstrap it to 287G
[36:58] if it's not discretionary on they wouldn't need 287G at all.
[37:03] » Right. And I think that, you know, the part
[37:06] there allows departments that don't participate in 287G to have a pathway as
[37:11] well. Um, but I I would appreciate if you'd look into and make sure that we're
[37:16] not digging ourselves into a deeper hole.
[37:19] We still, if I recall, Sergeant Well, you can clarify for me. Um, in the
[37:24] agreement, there were three different options to choose from in that
[37:28] agreement. And the one we chose, um, was not to do the, you know,
[37:33] doortodoor knocking on the door and pulling people out. Um it was to
[37:39] basically support what our officers were doing in this in the field when they
[37:43] would come across a situation when someone auto accident traffic stop you
[37:48] know ticket speeding what have you um and the person is undocumented then you
[37:53] can't vet them then we would use a 287g. >> Well I do understand that um some of the
[38:00] arrests um have been in response to um ICE contacting us. [clears throat] um in
[38:08] addition to just the traffic stops. Yeah.
[38:10] » That that we run as well. So there is some kind of um an agreement there where
[38:17] ICE is initiating the efforts. [clears throat]
[38:22] » So if I can interject um as of the time since we joined this program, not one
[38:27] time have we gone to a school, have we gone into the neighborhoods or done
[38:32] anything that you described. um these incidents that you're talking about um
[38:37] if it is happening it's done on their own and not by us. Um I think I told you
[38:42] that when I spoke in March that that was not our intent. So we have no intentions
[38:50] on doing that. >> Yeah. And I I appreciate and I I believe
[38:54] that there's good intentions. I'm just hoping that the legal ease follows those
[38:58] intentions and that that um continues to be true. Any other questions?
[39:06] Thank you. Okay.
[39:10] Next, we have, let's see, the permission to start the hiring process to have two
[39:15] full-time police officers to start January 27th.
[39:18] » So, it's in the going to be in the proposed budget. We have one retirement
[39:23] uh the beginning of January. We have another one that could happen uh halfway
[39:27] through the year and we're asking for an additional uh we would like to start the
[39:31] process. It's not going to cost the township anything other than just our
[39:35] time to to do the interviews. Uh so that if it does get approved, we're ready to
[39:41] move for the meeting of the year. And if it doesn't get approved, it's the
[39:46] only time that we're out is our time to do the interview.
[39:49] » What's the second one? >> Yeah. [clears throat] Uh so we have one
[39:52] we have a sergeant that is uh going to be retiring the end of January.
[39:56] » We [clears throat] have another officer who is potentially going to leave
[40:00] halfway through the year. Uh and we're asking to add on to the department. We
[40:05] want to balance that up. The 12 hour shifts happen to balance out the shifts.
[40:09] Uh we actually need two. We're asking for one for next year.
[40:13] It'll be in the proposed budget.
[40:22] just because it takes time just to start the process.
[40:25] » Yeah. Next, [snorts and cough] we have advis
[40:29] the board supervisors of the conference room table donation from Frank.
[40:38] » We were we were we were in need. It was something that we wanted. We wanted to
[40:41] have a conference table out of the tables that we had. um supervisor Seth
[40:46] Black was was able to reach out to his uh former employer and they had one
[40:50] thing I'm using and they donated to us. Uh it's a very nice table. It really is.
[40:57] Um and we send a nice thank you letter to Mr. Tim Tate Timothy Tate uh from the
[41:02] company. Uh >> and I have that in your actual packet
[41:05] for next week and send your packet a copy of the thank you letter. Yeah, I
[41:08] appreciate I mean Tim Tate has always um and the Tay family has always been um
[41:13] pretty generous with their time and and supporting um [clears throat]
[41:17] different municipalities or um government um agencies and or um uh
[41:24] nonprofit organizations so on so forth. So I knew I knew what they had um
[41:30] discussed a need within the police department and I gave Tim that call and
[41:34] uh he was more than happy to uh to donate the table to the township to be
[41:38] used for the police department multi a multi-purpose room. So
[41:43] » awesome. >> It's really nice. It is really nice that
[41:46] they >> awesome. [laughter]
[41:50] » Okay. Chief Wargo has completed his four years of service on the executive board
[41:54] of the York County Chiefs of Police Association.
[41:56] » So yeah, you're all aware I was a member of the York County Chiefs of Police
[41:59] Association. Um four years ago I was asked to be on the executive board and
[42:03] every year you call me Sergeant the the secretary then treasurer vice president.
[42:08] So this all this last year I served as the president of the association. Uh the
[42:12] last meeting of August by our bylaws is the last meeting and then starting
[42:16] September everybody moves up to the next chair. So I am now the immediate past
[42:20] president um for the new year. [laughter] I have completed my 4-year
[42:24] term as the on the executive [clears throat] on that. Just letting
[42:31] chief at Carol Township ever be asked executive
[42:35] » and then um update on the K9. >> I don't think they have I don't think we
[42:41] have >> I don't have anything as far as I know
[42:44] that all the >> M [clears throat]
[42:46] actually you >> Yes.
[42:48] So [cough] must steer differently. That was my understanding.
[42:51] » So go on next week's meeting to hope to execute.
[42:56] » All right. Cool. [snorts]
[43:00] » Uh next we have update on Robert Gay, the 283 K Road. [clears throat] Do we
[43:05] have any updates on that? I know Dave, did you have something?
[43:09] » Yeah.
[43:13] » Yeah, we have something. His father. Yeah, there it is.
[43:20] [clears throat]
[43:28] Am
[43:37] I supposed to make a statement or are you going to ask me questions?
[43:40] » If you have an update for us. >> Okay. So, um [clears throat]
[43:44] uh I haven't addressed you guys. I
[43:48] mentioned in the um correspondence of Brandon um as as [clears throat] a
[43:55] memorandum of understanding um I'm supposed to be reporting to him
[44:01] every 3 weeks with pictures and updates. Um
[44:05] when I left when the last time I I was before you guys I was you guys had
[44:11] suspended um the uh engineer >> and um uh
[44:19] and then I had gotten I had gone forward um with um uh acquiring a building
[44:25] permit. Um when I when uh my personal drawings weren't detailed enough, I went
[44:33] and uh and got my own engineer to draw plans um which were submitted with the
[44:40] voting uh permit. Um and then at that point in time uh
[44:46] um I uh had gone to Asia. Um the uh property
[44:55] um you know a lot of people haven't been there uh think that I should have been
[45:01] able to get equipment down there. Um but it's a 20x40. I don't have too many um
[45:08] uh too much equipment that can get down in
[45:12] there to get that done. So I dug it up by hand. Um it was a lengthy process. Um
[45:18] and then um uh and it was quite surgical as well since I was doing it. Um and um
[45:26] if I would have gotten [laughter] equipment down there, I would have never
[45:28] been able to get the dirt on the other side of the prop other side of the
[45:32] building in the basement out the way I was able to get them out as as I did it.
[45:37] Um so uh [clears throat] so that took a long time. Um and with with the
[45:44] buildings from as I went before I got the um uh drawings from my uh engineer
[45:52] and then submitted that like the memorandum of understanding was wrecked
[45:58] right from the beginning that timeline and as I submitted that timeline before
[46:02] you guys in a written letter that I wrote to you guys that was like like off
[46:09] the top of my head. Um, and then I had no idea at the time, my own ignorance, I
[46:15] had no idea what the solicitor was. Brandon had told me that um, that I had
[46:20] some papers to sign from the solicitor. And so I waited um, and then it took
[46:26] took off to get the paper. I got the I got them two days before I went to Asia.
[46:30] I actually mailed them to Brandon in San Francisco as I was heading out of the
[46:34] country. I signed them because I don't know what you guys are. you guys
[46:39] were good enough to suspend um being uh
[46:44] the engineer, pure engineer, and and so um I I just signed them to get to get
[46:50] them signed and get me going. Um but that that that timeline's been wrecked
[46:55] since the beginning. Um but I I got I got um uh Dave's [clears throat] been
[47:00] out to the site. Um uh he's seen it. Um uh at this point in time, I've been
[47:06] laying block today. Um, I got I I keep looking at my phone. Um, where I got the
[47:12] instruction I think was a Monday, a week ago. [clears throat] Um, and um uh and
[47:17] then uh I poured I actually for Friday. Um, and I had to get I I I launched a
[47:26] cement mixer down in there and then I had 80 bags of uh concrete that I mixed
[47:32] in a cement mixer. took me about well I got done at 8:00 at night and I started
[47:36] at like 11:00 so I was poured and then I I went I went
[47:42] on Saturday morning to get block of coal
[47:48] um cement and then they were closed uh so I couldn't I couldn't start playing
[47:54] well I couldn't start with a newer block I had some block that I was able to lay
[47:58] my first course with um and then I I went this morning and got uh how the 90
[48:05] 90 block um uh and been laying I made a sec part of the second course today and
[48:12] um and then uh had to offload my truck and that's why I was late um because I
[48:17] just got done offloading 90 block and every one of those bags was carried from
[48:24] the road down and then down to the basement. Uh, two labors actually helped
[48:30] me with doing the cement bags. The block I did I did I just carried down to once
[48:35] this one [clears throat] just down to the top of the the basement
[48:39] because um uh it I don't [clears throat] know if they shared any picture but um
[48:46] or Brandon um I I I have to pump the water once I get rains um because it's
[48:52] fills up down there. So, I have a I bought a small utility pump to pump the
[48:56] water out on the windows and um so that's been an ongoing issue with the
[49:02] the [clears throat] digging with the heat and the and the water and the rain
[49:06] that we've had. Um um but I'm I mean I'm not on the timeline, but I'm I'm there
[49:13] every day. Um so, m Mr. and you're, you know, by the end of August, you're to be
[49:20] finish the roof and clean up all the debris and then close in the structure
[49:23] throughout the month of September. So, [clears throat] um, and within that
[49:28] memorandum of understanding, it it it says default by owner. If the event the
[49:32] owner fails to meet one or more of the repair milestones above, township shall
[49:36] immediately renew enforcement action on the dangerous building provisions.
[49:39] » I understand that, sir. >> We don't have a choice. I mean, is
[49:42] that's an agreement that you you agreed to based on the timeline you submitted
[49:46] to the board. We're [clears throat] following the timeline you created.
[49:54] » Yeah, we do. I mean, we have residents that have filed complaints based on the
[49:58] concern of that being a dangerous a dangerous house, a dangerous building,
[50:04] right? [clears throat] >> And this has been going on for a long
[50:08] time. So um
[50:13] based on the agreement
[50:16] the enforcement should happen.
[50:23] Um I went out and saw where he's working.
[50:27] It's it's a tough place to work. He's doing a lot of it by himself.
[50:32] » That's that's not the conscious problem. I understand
[50:35] » it is the responsibility of the homeowner. It's the homeowner who was
[50:38] came up with the schedule, not the township.
[50:42] » Um signed an agreement saying, "Okay, I'll
[50:45] do that." And we said, "If you don't do these milestones, then the default
[50:50] [clears throat] by owner in the memorandum of understanding is to
[50:54] immediately renew the enforcement action on the dangerous buildings provision. We
[50:58] are responsible to make sure that we follow our ordinances." Is it is there
[51:02] anything in this uh memorandum of understanding
[51:06] that uh recognizes heavy rain or severe heat for this guy
[51:13] to be working >> and uh there should that should be
[51:17] played in. I know he lost a lot of work time because of the rain and also with
[51:23] the heat it reduced his ability to to produce as much as he was normally
[51:31] doing. >> That's disruption. [clears throat]
[51:33] » Well, the other thing we do is uh time extensions. And I don't see why
[51:40] he can't get one. He's he's out there working and he's trying to do the job.
[51:45] They just had a time extension for how many years?
[51:49] » I don't have the exact number of years, but the house has been in this condition
[51:53] for >> more than long enough for time
[51:56] extension. >> I gave it an inspection for soundness. I
[52:00] had a big walnut tree blew down about 2 months ago and that house is still
[52:04] there. So, I don't think it's that bad a shape. And the other thing too is
[52:09] » that's a part of that's that's why there's a provision or ordinance in
[52:13] order to have a a township engineer to determine [clears throat] based on the
[52:19] structure if it fits the dangerous building provision. With this job as a
[52:25] supervisor, you should all remember one thing. You got to think about compassion
[52:31] for the individuals. This guy's working hard. He works 60 hours a week and he's
[52:37] lives in Perry County and comes down to work on this house.
[52:41] » David, I I understand that and and believe me, I have compassion for that.
[52:46] Um [clears throat] this has been going on for a very very
[52:49] long time. We also have the responsibility as supervisors to
[52:53] residents who file complaint about that structure being a potential dangerous
[52:57] hazard to residents that are in and around that area. Okay. So, we have that
[53:04] we have that responsibility as well. >> Well, we have a responsibility. I I
[53:09] agree. The only thing is the only way anybody's going to get hurt there is if
[53:13] they're trespassing on this property if something were to happen. But with all
[53:18] that wind and everything, it wasn't one shingle or piece of wood blew off the
[53:23] place. And like I said, I had a big wall blew down. I had to cut that thing up.
[53:29] And you know, I've been over there. He's He's not
[53:33] uh [clears throat] staying at home or partying with his buddies. He's down
[53:37] there working all the time. >> That's good. You [clears throat] should
[53:39] be. I understand that. >> Yeah. And it it's a tough job. He just
[53:44] give me an example. He's down in the basement boarding footers. He carried
[53:49] his cement mixer down there somehow. I don't know how he got it down.
[53:53] » [clears throat] >> and all the dirt that had to be shoveled
[53:55] out and everything. He had the wheelbarrow up at the top of the the
[54:00] normal surface throwing the dirt up. >> Dave, you're going to come up with a
[54:03] schedule. Wouldn't you consider all the work you have to do?
[54:06] » Well, I know. >> Okay. I mean, you have to I mean, that's
[54:09] like estimating construction 101. If I know
[54:12] I'm going to be doing XYZ to a home, then I got to look at the plan and say,
[54:17] "Okay, what do I have to do and come up with?" Right?
[54:22] So, I mean, Mr. Okay. When are you going to have
[54:26] [clears throat] at least a August milestone completed where the the the
[54:30] roof is up? >> I intend to get that winterized by
[54:34] winter. That [clears throat] >> I have I have I have to get that back
[54:38] filled because of the because of the I I can't have the ground precinct falling
[54:43] um without it being backfilled or else I'm going to get collapsed. So,
[54:48] » okay. So, what date? I I can't go by butcher. [clears throat]
[54:50] Okay. And what what date are you going to have it on the roof? And then what
[54:54] date are you going to have it weather?
[54:58] » Right. Wind, rain, snow, whatever may happen from mother nature. Um when when
[55:06] will you have this completed? >> I I know you had said that.
[55:12] » This is a question for Mr. Gay. >> Okay. Go ahead.
[55:17] » I'm not gone. I have no idea. >> And and I don't want to call you out
[55:19] guard. But why don't you have that answer? My suggestion would be as a
[55:23] supervisor of this board, and I'm only one [clears throat] of five, would be to
[55:26] come to next week's meeting and and provide us with a new schedule
[55:33] of when you're going to have the [clears throat]
[55:35] August and September milestones in the memorandum of agreement completed.
[55:43] » Could you repeat that, please? I'm sorry.
[55:46] » Could you repeat that? Come. I would suggest that you come back into next
[55:51] week's meeting to provide in writing to the township board of supervisors when
[55:56] you're going to have this uh roof on and when the structure will be made
[56:02] weathertight.
[56:10] I I personally think he should get a time extension
[56:15] and I I was thinking and I don't even know if this is enough.
[56:19] » Basically, what I'm asking him to do is to come to the board of supervisors
[56:23] meeting next week and to provide us with a date of when he's going to have the
[56:29] roof completed and when he's going to have the structure made weather tight.
[56:34] Well, that's something to me that uh is uh something you can't write in stone. I
[56:42] mean, there there's too many variables on this.
[56:44] » Well, then >> but the thing is is we have we have a a
[56:48] duty to follow our ordinances. The ordinances aren't going to happen and we
[56:52] have to enforce those. >> Yeah.
[56:56] » But you have to remember
[57:00] and and we vote on those. I mean, we have a lot. We have to uphold what
[57:04] [clears throat] we have here. And I don't think, unfortunately,
[57:08] » we're in a situation where it may not be the right thing. It may not be the nice
[57:12] thing to do, but we have to do equally with every single citizen in the
[57:17] township. So, >> so you got to treat the person making
[57:20] the complaint in the same way. >> Well, first of all, you cannot because
[57:27] this home hasn't been lived in a bit. Everything is growing up and you know
[57:32] how when a senior citizen has a home and it grows up.
[57:35] » Yeah. But the thing is is you have >> they can't even see it.
[57:39] » Okay. But but we have every single citizen that has to we have to think
[57:44] about every single citizen not just one. If we do one for one then we have to do
[57:48] one for the other. Then we have to you know we can't be doing out specific
[57:51] favors for specific people. >> What's wrong with time extensions? We we
[57:55] just gave one >> because it has to go comes within our
[57:57] ordinances. Well, I think that would be within our
[58:00] » What do you What do you think, Dave? >> Well, first [clears throat] of all, the
[58:04] developer has to give us a time extension or we can't tell him.
[58:08] » So, that's a little different circumstance. Second, um, Mr. Gay, maybe
[58:13] you could come back and let it let the board know. Also, if you're doing this
[58:16] all by yourself or you're going to hire someone help you out with the framing
[58:19] and the roofing because taking it off by yourself is is a big job. I understand
[58:24] that. But I think if you came back with a plan of the date and how you're going
[58:29] to accomplish that, >> it sounds to me like the board may
[58:32] consider a time extension. I don't think the time they're saying no. I think they
[58:36] want to know what you reasonably believe is an appropriate schedule. But my plan
[58:40] my planned was was to get this wall that fourth that fourth wall up and get a
[58:48] sheath cuz I can't back fill a sheath and then then I have something to work
[58:52] with to to get the rest to build up from there and get the rest of the of the um
[58:58] thing >> and that sounds great but we do have to
[59:00] have a time and there's nothing we can do about that.
[59:03] » Okay. [clears throat] >> Yeah.
[59:06] we have to uphold that. >> So I mean my what my suggestion is gives
[59:09] you a full week well since we're have a holiday on Monday. It's a little bit
[59:14] less than a full week right six days to um to come up with that plan and and to
[59:20] come up with that date to pre present to the board.
[59:26] » Now you want let me get it straight. You want him to make up a new schedule.
[59:31] » What I propose as a supervisor is for Mr. Gay to come to our meeting next week
[59:36] and provide a date of when he's going to finish the roof complete and when he
[59:42] will have the structure made weather type which are
[59:46] » [clears throat] >> um points seven and points eight in the
[59:50] memorandum of understanding.
[59:54] [clears throat] Okay. >> Okay.
[59:57] » That makes sense. >> I think so. You said seven and eight
[1:00:02] » roof and weathertight structure. >> What date?
[1:00:07] » Okay, >> you'll have each of those accomplished.
[1:00:10] So, you've got um just a day less than a week to go and create that plan and as
[1:00:14] our solicitor said, which is a good suggestion, is here's the date and how
[1:00:18] am I going to do that? I'm going to do it all myself and I know through my time
[1:00:21] I have I can get that done or I'm going to hire someone to help me or I'm going
[1:00:24] to hire a roof contractor, whatever you plan to do. But what is that? Right.
[1:00:33] » Okay. >> Um, can there have anything due to
[1:00:36] weather as far as adjustments? >> He has to consider that in his schedule
[1:00:41] like any other contractor, any other homeowner that does does scheduling for
[1:00:46] building a home or repairing a home or doing remodeling.
[1:00:49] » No different. [clears throat]
[1:00:54] » Okay. [clears throat] >> Okay. Thank you. Mhm. Okay. Thank you,
[1:00:58] Mr. >> Next, we have Carol Township Police
[1:01:01] Pension 2027 minimum of municipal obligation MMA
[1:01:06] worksheet.
[1:01:11] » I have a copy. >> No,
[1:01:15] I did. >> This is for 2027.
[1:01:18] » That's correct. >> Yeah.
[1:01:22] » 2027.
[1:01:25] » Okay.
[1:01:29] They have to prove it and I have to ask
[1:01:35] you
[1:01:39] » uh nonuniform pension and then >> the same thing the yearly worksheet that
[1:01:46] » and then we have to start our dates then too.
[1:01:48] » Yeah, I don't have any questions on it. Next, we have a request from Billsburg's
[1:01:53] area soccer club to use the portable lighting um from 5 to 8 Monday through
[1:01:58] Friday, Friday starting September 14th through November 30th. Um this is a
[1:02:03] yearly request and I don't think we've ever had any issues with it. We'll just
[1:02:07] put on the agenda next week and someone has questions. Go ahead.
[1:02:09] » Yeah. So, this is kind of twofold. Um this year would be for the lights. So,
[1:02:13] they're still looking at that, but they also approached the township at doing um
[1:02:18] permanent lighting there. So that's why the gentlemen are here tonight to
[1:02:22] describe a little bit of that. Um, and you know, I'd let them go, but they're
[1:02:27] working on a proposal uh for some more permanent lights. So they're not pulling
[1:02:31] these in. >> Um, and that would be, you know, in my
[1:02:33] opinion, a benefit for the township, but there's some things they would have to
[1:02:37] go along with that if they're taking on that project. So my name is Shane
[1:02:43] Macintosh. I'm president of Billsburg Area Soccer Club. uh Daryl Stlair who is
[1:02:48] our fields director. And on top of the um the remote lighting fixtures that we
[1:02:56] use annually to help facilitate soccer practices for kids in our community, um
[1:03:01] we've come across an opportunity to implement a capital improvement to
[1:03:05] Chestnut. Um, this would include a series of lights that would be
[1:03:10] permanently fixed to the ground and provide a more permanent um, ability for
[1:03:16] us to provide that soccer to kids in the evenings. Um, the capital to make this
[1:03:23] improvement is rather significant. Um, the maintenance of said lights we would
[1:03:29] be looking to take responsibility of. Um, and in return for that investment in
[1:03:35] the community, we were hoping to have some guarantees of of use of the fields
[1:03:38] for our kids that play soccer. Um, and so we were looking for
[1:03:44] both the some advice from the solicitor um, and any sort of guidance that you
[1:03:50] would have as a board of supervisors to our organization to implement this in
[1:03:55] such a way that is agreeable to you. um a huge benefit to the community but also
[1:04:00] an important resource to build soccer club to implement our soccer programs.
[1:04:06] » Yeah. So Mr. Solicer in this case is there a type of like possible lease
[1:04:11] agreement or how would we handle it? I just want to ensure that you know next
[1:04:15] year we say oh it's all lacrosse and there's soccer next year you know the
[1:04:18] year after they put these lines. >> Yeah. Um well first of all we have to
[1:04:22] look at your policy. I mean, I don't know what your is your park policy first
[1:04:26] come first serve. >> Mhm.
[1:04:28] » Or how does that work or how's that and and who schedules it?
[1:04:32] » Yeah, it's scheduled through Jessica here. They put in requests every year.
[1:04:36] Um so yeah, it's kind of a first come first serve. Now, um other organizations
[1:04:41] come in later and you use it, they coordinate with the primary user of the
[1:04:46] field. Yeah, I mean I think we could do a donation agreement and it would have
[1:04:49] to have some language too that you know if you're doing the work you're going to
[1:04:52] have a contractor licensed contractor who's doing it they're bonded because
[1:04:56] they start the work and walk off the site
[1:04:58] » and we're stuck with it and we got to finish it because you don't want to have
[1:05:02] half done project. So there are ways to do that and it may be over a period of
[1:05:06] time or kind of amvertises out the price of the you know improvements because we
[1:05:13] don't want to give it to you forever either or if you go away you know things
[1:05:17] like that. So um there are certainly things we can talk about and get in
[1:05:20] place. I've done that and >> I usually do it more for schools and
[1:05:24] municipalities. you see that more with where people putting lights on fields
[1:05:28] and turf stadiums and things like that, but you know, it's for usually the the
[1:05:33] program at the schools. So, certainly something we can work through.
[1:05:37] » Um, if you guys have some ideas and your you know, what your spend your spend is
[1:05:41] and so on and so forth. >> Brandon, who who reserves the field?
[1:05:45] » Reserves as in >> who who says, "Okay, hey, we want to use
[1:05:48] a field >> organizations." So, they'll submit
[1:05:51] letters to us um you know, for the next year's use.
[1:05:55] Um, and I think, you know, the main question here is, is the board number
[1:06:00] one receptive of the idea? We can iron out all the legal agreements and the
[1:06:05] details later on. So, if everyone was, you know, yay or nay, I think that's
[1:06:09] what they're looking for from the board a feeling as to whether or how they're
[1:06:14] going to proceed with their project. >> Did anybody checking the the insurance
[1:06:20] liability as far as having lights up there? Right now, it's shown that
[1:06:24] there's no light. So, >> it would probably increase our insurance
[1:06:27] cost because it could be occupied a lot much longer. But, I don't I wouldn't
[1:06:32] expect that that's a huge deal. [clears throat] Um,
[1:06:35] most of school districts I work with who have school have lights don't I mean,
[1:06:40] » they just add lights and they're insured. So, it's not a horrible
[1:06:43] expense. On top of that, >> yeah, I'm an insurance agent. I
[1:06:47] [laughter] don't think the time frame in which uh you'd be increasing the
[1:06:50] exposure of use of the fields would really uh create a significant cost to
[1:06:56] the community or to the board I should say. Um for that matter we drafted a
[1:07:03] very rough lease to just try to start the process of what we were thinking
[1:07:07] about. And in that draft, we included a sort of um you know, hold harmless for
[1:07:15] the community. So that whatever maintenance requirements and
[1:07:19] responsibilities we had, whatever uh responsibility we had for allowing folks
[1:07:25] to use those lights would be on the club and we would incur the cost of whatever
[1:07:29] that insurance increase would be. And in the building like the I mean I don't
[1:07:34] know how much electric they're going to use but I'm pretty sure they're going to
[1:07:36] use a lot of electric >> that I don't know. I don't have a type
[1:07:41] of lights you put in LED.
[1:07:46] » Okay. And then are you doing both fields? The upper and the lower.
[1:07:50] » Just the upper. >> Just one field to begin with. Okay.
[1:07:54] » The lower. >> Okay. So the one the one down on the
[1:07:58] bottom level. >> Correct.
[1:08:00] » Okay. Okay. What is you don't have to share that if you don't want to but what
[1:08:03] is the cost but the to do lights have you already received a quote
[1:08:06] » yeah so we received a quote from J Ka licensed contractor who's willing to
[1:08:11] partner with the organization we've received three different quotes for
[1:08:15] different levels of lighting uh they start they range anywhere from 40 grand
[1:08:20] to 110 grand >> okay for the one [clears throat] field
[1:08:24] » for the one field >> right okay
[1:08:26] » and with that if the tenure could go with that we would amend our part rules
[1:08:29] by where We have an ordinance for the parks that would dictate that the
[1:08:33] lights, >> right?
[1:08:37] » Yeah. >> There would have [clears throat] to be
[1:08:38] some provision on the ownership of the lights should the association dissolve.
[1:08:44] » You know, so on to the
[1:08:48] » parking lot's not light. Will the lights be bright enough to provide safety from
[1:08:54] the field to the parking lot? >> That's a great question. I think our
[1:08:58] main focus has been to reduce or limit the amount of light pollution so as not
[1:09:03] to harm the experience of folks who live nearby. But um if there was some sort of
[1:09:10] » But isn't there a call there from that field to be pretty good and get to the
[1:09:15] parking lot? >> There is a call right there. Correct.
[1:09:19] » We are playing in the dark now with temporary lights.
[1:09:23] » Yeah. >> Yeah. And I do believe that that
[1:09:26] depending on where the light's at that will open up the light to that parking
[1:09:29] lot.
[1:09:33] » So are you is Kuba are they working with with some of the light guys who like
[1:09:40] have it directed and so it's shielded so it's just on the field and not spilling
[1:09:44] out. I assume you're doing that because that's what all the schools do. Yeah.
[1:09:47] Yeah. He's uh Jay Ka is working with his lighting engineers who provide the
[1:09:54] service to school system. >> Yeah. And there would still and I I
[1:09:58] spoke with these gentlemen about it. I mean there still be a zoning permit and
[1:10:02] we'd review the photoometric plan to make sure there's no trespassing light
[1:10:05] on the you know adjacent properties. >> Yeah. Because whether there is or not
[1:10:10] someone will say there is. >> Oh yeah.
[1:10:13] That's what I'm wondering because if you're on the lower level, you're
[1:10:16] actually closer >> right
[1:10:17] » to I mean those houses are a little bit right there, but if you're in the upper,
[1:10:20] it's kind there's that little bit of a >> there are houses back there, but there's
[1:10:24] a tree line that kind of >> Yeah.
[1:10:26] » Yeah. >> So, you're looking at next week
[1:10:29] basically an approval to use the temporary lights and then the permit
[1:10:35] structure just a different it'll be a different topic at different time once
[1:10:38] the review. >> Correct. Okay. And and that would
[1:10:41] include the conduit running the lines and everything for electric.
[1:10:45] » Uh yeah, that would include full sight fit.
[1:10:50] » Yeah. >> Um we I guess the only other question we
[1:10:55] would have is is what what all would you need from us to bring uh bring us to the
[1:11:01] board for a formal vote? Presuming we need to work with you, David, in some
[1:11:06] capacity. Yeah, I I think you just put together kind of a bar like what you
[1:11:11] want like what your terms are so to speak and we can work through that. It's
[1:11:14] not yet and then the pricing and whatever you need. Um yeah, I just want
[1:11:19] to make sure that we're covered on the back end in case something happens or
[1:11:24] they're very reputable contractor. I'm familiar with them and you know I guess
[1:11:28] you have the money raised or you have pledges for the money or what what's
[1:11:34] » yeah we we have the money in our reserves to handle our portion of the
[1:11:38] contribution in this case Jeff call that is providing his own
[1:11:44] » um
[1:11:47] » contribution [clears throat]
[1:11:49] » yeah so our sol goes through that and he would then provide um advisory to the
[1:11:55] forward on on that then it would go up to a vote.
[1:11:59] » Yeah. So the whatever agreement you put the terms on and a photo plan we have
[1:12:04] something that tie the agreement too. >> Right.
[1:12:07] » Okay.
[1:12:10] You said
[1:12:14] anything to me and I can get it and the permit from the contractor would follow.
[1:12:19] » Yeah. after board approval and then get a permit into the township for the
[1:12:23] actual electrical purpose. >> And were you looking to have this done
[1:12:26] for this year or is this a 2027? >> Um, we wouldn't be interested in
[1:12:31] breaking ground on a project like this until after our annual tournament. So
[1:12:36] that would put us into late October. And I'm not even so sure the
[1:12:43] » comfortable starting the project then. So I don't know exactly.
[1:12:49] But um >> yeah talking about an ex.
[1:12:56] So >> yeah in the meantime you have the
[1:12:59] temporary >> you've been great. Thank you so much.
[1:13:03] Congratulations on your achievements. Thank you for your service.
[1:13:08] » Good. Yep. >> Thank you.
[1:13:12] Okay. >> Update on the proposed northern New York
[1:13:15] County Fire Rescue agreements.
[1:13:19] There still needs to be work done on that. Okay. All right. Um and then
[1:13:24] resolution number 202619 of the board of supervisors Carol Town of York County,
[1:13:28] Pennsylvania providing for the supplemental appropriations
[1:13:32] on the budget to add 64,000 on light item
[1:13:36] 500. Oh, you're still working on that as well?
[1:13:40] » Yeah, I think we tabled that pending. >> Okay. table accepting of the table.
[1:13:48] » Okay. And then the Logan Park, I know that you did send an email out for us to
[1:13:54] be able to meet with them. I know we haven't heard back from them yet. I just
[1:13:57] checked. >> Yeah, I I haven't heard anything back on
[1:14:00] that yet. >> Okay. So, hopefully that's coming up
[1:14:03] soon. >> Yeah. Okay. And then let's see. The 457
[1:14:08] plan, Langen Group Financial needs an agreement signed because they changed
[1:14:11] their name. So, it's just a name name change on that.
[1:14:15] » Correct. >> Okay.
[1:14:18] » On both of those, um, Libby and Brandon, if they look at the difference in the
[1:14:25] agreement, I saw the agreement, but >> you know, they're saying it's just a
[1:14:28] name change, but I've been there before with contract name changes that they
[1:14:33] [clears throat] give you the agreement. They say, "Well, it's just a name
[1:14:35] change." and they actually did change something in agreements. I would highly
[1:14:38] recommend >> take a look at that
[1:14:39] » both agreements. I mean, you could run it through AI.
[1:14:42] » Okay. >> And u if you want help, I can do that
[1:14:45] for you. Um just to see what the difference is between the agreement with
[1:14:49] the old name and the agreement with the new name to see if there's anything in
[1:14:52] there just to protect us.
[1:14:57] » That was on there twice. Oh, that's for both the uniform and unifor. Okay,
[1:15:01] perfect.
[1:15:04] So 12 and 13 actually or 20 22 and 23 actually have go [clears throat] hand in
[1:15:10] hand. Okay. Um let's see and then we have to set our budget work session
[1:15:14] meetings for October. So um Brandon and Fay had given us some possibilities
[1:15:21] here. Um we usually need two but don't we usually schedule three just in case?
[1:15:27] » We should put three in. If we don't need three then at least
[1:15:30] » take it out. Okay. So try and figure out get some availability from Frank
[1:15:36] um and in availability. So I'd be looking at the 6th or 7th of October for
[1:15:43] the first one. >> Is there any reason that this has to be
[1:15:45] done in October? Is there any reason we can't start working on it in September?
[1:15:50] » Well, I don't have all the figures. I don't have the insurance figures yet.
[1:15:54] the insurance is going to cost and we don't have the unemployment
[1:16:00] um PAX unemployment rate if it's going to stay the way it is or if that's going
[1:16:04] to go higher usually by the the middle to the end of September when we have all
[1:16:11] that information >> because I'm I'm going to be out of town
[1:16:17] the second half of October. So, what date you what day are you starting?
[1:16:23] 17th. What date are you leaving? 13th. 13th.
[1:16:30] » And are you going to be back in October? No. Okay. We only need what? Two people,
[1:16:36] right? We only need two supervisors. >> Three.
[1:16:40] » Okay. >> Three, right?
[1:16:42] I mean, [clears throat] I would suggest, you know, if um Libby um Dave and Brent,
[1:16:48] if you could email Brandon the dates you're not available.
[1:16:52] » Mhm. >> I mean, I figure that's why I emailed to
[1:16:55] Brandon. That way, he can kind of look at all of it and then he can come up.
[1:16:58] Okay, here are the dates, guys, that we've got at least three or more. I can
[1:17:02] make the budget meeting. >> Okay. Yeah. So, if everybody gets their
[1:17:07] availility to me, I'll just compile them and we can set the date next week, too,
[1:17:12] because Brad will be back. >> And while I'm out of town, I I still can
[1:17:18] I could participate via Zoom or phone. That's correct.
[1:17:22] » Yeah. >> Um because I would like to to stay in
[1:17:26] touch with this process. >> So, as of right now, I think the seventh
[1:17:32] is good. the the first one. That's right.
[1:17:42] » So, so yeah, maybe the 7th. Uh, everyone here, I would see. So, maybe that would
[1:17:48] be the first day we can lock in here. >> Um,
[1:17:50] » yeah. And then what else do we have? 13th or the 15th? You're leaving on the
[1:17:55] 13th?
[1:17:59] So the 14th we have a meeting here a mining history meeting. So the 14th
[1:18:03] south it would be the 15th would be the only other [snorts] open date in that
[1:18:09] week
[1:18:16] » and being hopeful if we do some fairly long u
[1:18:23] we can talk about you know some certain things beforehand if there's questions
[1:18:26] we can iron some stuff out before these meetings and then when we get in here if
[1:18:30] we have two long nights I hopeful we can get it done in two.
[1:18:33] » Yeah. >> Um but we should plan on three. But um
[1:18:39] I'll get with a friend and we'll we'll see what the other dates are.
[1:18:42] » Okay.
[1:18:45] » I should be good for
[1:18:52] » Okay.
[1:18:56] Stony Stony Run Village subdivision plan set agreement.
[1:19:03] Um, so this was sort of discussed in
[1:19:06] executive session. Um, we have a draft settlement agreement to settle settle
[1:19:10] the uh the commonwealth court and that would revol revi require a revised land
[1:19:16] development plan to be submitted. Excuse me for one second. Chief, you hold up
[1:19:21] before you left. I didn't know he was going to leave. Um, I did want to at
[1:19:25] least publicly um thank uh the chief uh the police
[1:19:30] department um nor the York Fire and Rescue for all the time, effort that you
[1:19:35] guys put into that accident on 15. Um [clears throat] that was a pretty
[1:19:39] horrific accident. Um 14 people injured, critically injured, uh being
[1:19:44] lifellighted. Um five different hospitals. Um, you know, I commend your
[1:19:50] team, your staff, you know, the um dedication that they [clears throat] had
[1:19:54] in that accident and the continued investigation as well as uh York Fire
[1:19:58] and Rescue for all their time that they spent on that accident and trying to get
[1:20:03] it safety done first, you know, clean up done second, and getting the road back
[1:20:07] open. So, thank you to you and your crew and Northern Regional The on uh Northern
[1:20:13] York. Um, I really do appreciate what you guys did for for our residents and
[1:20:18] the people on Route 15 that involved in that accident. Thank you.
[1:20:22] » Thank you. I appreciate that. It really was it was bad. It was horrific. So,
[1:20:25] » yeah, >> appreciate that.
[1:20:27] » Okay. [clears throat] Sorry, Dave. >> Okay, no problem.
[1:20:29] » Want to get that. >> So, so again, a proposed settlement
[1:20:32] agreement for the Commonwealth Court appeal on the Stony Run Village
[1:20:35] subdivision plan uh project. Um, it require it requires a revised land
[1:20:41] development plan to come in. in general remove the um the emergency access onto
[1:20:47] Hartman Lane. So Hartman Lane would no longer be accessed from this development
[1:20:51] in any way. Um it would have uh the streets of this proposed development
[1:20:56] being offered for dedication as pri as as public streets and the developer
[1:21:01] would essentially wave any and all claims with regard to the denial of the
[1:21:04] plan in the first place which there's some some potential risks and
[1:21:09] liabilities uh in the decision when the decision is drafted um in their favor
[1:21:15] and it would really have minimum uh cost implications to the township.
[1:21:21] So, um, we discussed that. There's a red line that the the, uh, developers put in
[1:21:26] front of us. We discussed that this evening, executive session. I'm going to
[1:21:29] run that back by them and and make sure that that's okay. Um, Brandon's reviewed
[1:21:34] the revised land development plan. Got back to them with comments as well. So,
[1:21:37] that will be on the agenda for next month's meeting or next week's meeting.
[1:21:42] » See? Okay. So, uh, the next is set public hearing for proposed ordinance
[1:21:46] number 2026 258. >> Yes. So, this is the one that
[1:21:51] » the ordinance for the overall ordinance changes.
[1:21:54] » So, um I would propose we would set that for October 12th prior to our meeting at
[1:22:00] 5:30. >> So, October 12th.
[1:22:04] » Um are we off that day? That's deciduous people's day.
[1:22:11] » We're here. We don't have problems.
[1:22:14] » Yeah, we're we're here.
[1:22:19] » Trying to be politically correct. >> So, we said that then we would advertise
[1:22:24] » 5:30. >> Yeah. 5:30.
[1:22:26] » Okay. >> So, you said October 12th
[1:22:29] » at 5:30. >> Yes.
[1:22:32] » That's the public hearing. >> Y
[1:22:38] made the motion. >> Correct. Yeah. Just want to make sure
[1:22:41] they preemptively get it in the calendar.
[1:22:45] » Determined if we can switch the next I think we have uh our last two folks in
[1:22:49] here from 291. >> Which one? What? 20
[1:22:52] » 291 Campground Road. >> Okay. Yep. Okay. Yep. The 291 campground
[1:22:56] roading tank. >> Correct.
[1:22:58] » That's doing the fee, right? That Oh, there's the check.
[1:23:04] » Uh so I had sent everyone an email. I just wanted to thank you for giving that
[1:23:08] to me and helping me >> push the green button and then say your
[1:23:11] address. >> Oh. Uh 291 Campground Road in Gillsburg.
[1:23:15] Um I wanted to thank you guys for helping me figure out this process. Uh
[1:23:19] it's been a little frustrating with the SEO not understanding what we needed to
[1:23:23] get done. Um but Brandon especially has been very helpful.
[1:23:27] » Oh, Brandon. Awesome. >> So, so a little background. Um this lot
[1:23:32] is very small. Um it's part of you know the mountainside colony. uh they're very
[1:23:36] small. There's not enough room for a conventional system or any kind of
[1:23:39] sandbank. So, uh in talking with the SEO, there's no other option other than
[1:23:43] a holding tank. We do have an ordinance that kind of prohibits them. Uh but if
[1:23:48] there's circumstances that would, you know, be conducive to this and they the
[1:23:53] applicant would provide us with all the stuff which the check here completes
[1:23:57] everything. I did receive everything from these folks regarding this. I was
[1:24:02] wondering why it was on the agenda and I was wondering if it was for that reason
[1:24:05] because we don't have the ordinance for we won't allow holding tanks. Correct.
[1:24:08] But I mean have have we had instances like this before? We have a holding tank
[1:24:12] within township granted. >> We did. The most recent one was for
[1:24:15] Wickcom. I think it was like 2018. He had a temporary one for an office
[1:24:19] building there and he followed the same procedure.
[1:24:22] » Do we escrow any money to ensure that it does get moved or pumped?
[1:24:26] » $4,000. Uh there's an escrow and that guarantees us 9 months of pumping. Okay.
[1:24:31] Do a legal process if you know that was in the process. Okay.
[1:24:36] » If he would sell um a transfer would post that that money.
[1:24:41] » Got it. Okay. Thank you. [clears throat] >> Thank you. Thank you very much.
[1:24:45] » Thank you. >> And then 187 Stony Road. That's same
[1:24:49] thing. That's the same. >> Yeah. So
[1:24:52] » I just wish >> they're not here today. It's the same
[1:24:54] thing. There's still a couple items outstanding. Hopefully I get by next
[1:24:58] week. Um or we can talk about a conditional approval. They don't have
[1:25:03] everything to me by that point. That's the same same thing. A small lot.
[1:25:07] There's a lot of wetlands on the lot, so it's unable to park correctly. It's a
[1:25:11] little larger lot than this, but it's still not to the size to get a system in
[1:25:15] there. >> They pay monthly.
[1:25:18] » Yeah, this would be well monthly or as needed. You know, once it reaches
[1:25:22] certain level, then it would I think there's in the design there's a bring in
[1:25:27] our alarm light and stuff that triggers the fire.
[1:25:33] I think it's at 75% capacity. >> Okay. Um, one other thing on the on this
[1:25:38] situation on both of them and I both of them are on small lots. Is that correct?
[1:25:44] » Yes. >> And they can't put a system on that. But
[1:25:48] um I I [clears throat] know in the past
[1:25:52] there there's been situations like that and there were u
[1:25:58] uh I mean I'd say adjustments and let them put on some kind of training field.
[1:26:04] It may not be up to snuff but as long as it's working but there is not up to
[1:26:09] snuff when it involves these and D. you can't do something that you either do
[1:26:15] meet the requirements of B and we're in or act 537 or you do not. So in talking
[1:26:21] with the SEO, there's no repairs that can be done to these systems to make
[1:26:25] them make compliance. >> Okay. I I was just looking for another
[1:26:31] way to make this work because these guys aren't fighting this. Um you know,
[1:26:36] they're going through the procedures. So >> do you know anybody who's got a holding
[1:26:39] tank? Betty Lau.
[1:26:42] » No, that's an experimental and it's a small floating treatment.
[1:26:45] » No, not Betty Lard up in the mountain. >> Oh, the cow was there. Yeah. So, there
[1:26:50] is another one adjacent to the one the cost to maintain one of those
[1:26:56] things. You could put in a sand mount with no problem. I mean, it's very
[1:27:01] expensive. >> Yes, it's a concrete pack, but there's
[1:27:06] no maintenance really. >> Well, no, I'm talking about getting
[1:27:09] pumped The the problem is is there's no requirements that they can be met for
[1:27:14] the sand mount on the pro property is what they're said what's being said.
[1:27:20] » Yeah. There's no system feasibly that can go into these lots and and work.
[1:27:27] » Uh you know I know I knew that years back they made
[1:27:32] adjustments to try to get something in and I know some of these systems are
[1:27:37] still working. That's why, you know, Steve, the problem is is that every
[1:27:42] every that goes on, storm water and sanitary requirements get harder and
[1:27:46] harder to meet and stricter and stricter. So, D said at one time may
[1:27:50] have said yes, but they no longer say yes to those sort of situations.
[1:27:54] » And we do have an SEO who's listener. It's one of our professionals that we
[1:27:58] entrust to he's stating that there is no other
[1:28:03] option in his opinion for these laws. Uh, It's a shame.
[1:28:10] » Um, [clears throat] so we have the next we have is basic EOP, the emergency
[1:28:13] operations plan. We just have to do the re reapproval for that.
[1:28:16] » Yeah, that's every uh two years I believe.
[1:28:18] » Yes. >> It's just the same plan, just a
[1:28:21] reapproval. >> That is correct. Okay. Okay.
[1:28:23] [clears throat] Next we have resolution number 202624
[1:28:28] for the board of supervisors authorizing sign of local share account category for
[1:28:32] facilities program in the amount of $156,69
[1:28:35] from the commonwealth financial authority to be used to purchase the
[1:28:40] Massie Ferguson mowing tractor. >> Yeah. So so I became aware that the LSA
[1:28:46] they can potentially fund equipment uh through the LSA category 4. Um, so the
[1:28:53] deadline's the end of September here. I got this ready to go borrowing
[1:28:57] signature. The only thing with this I was going to put in for the small
[1:29:01] tractor in the regular budget next year. In the meantime, uh, I figured we'd
[1:29:05] throw a grant application at this and see what happens.
[1:29:10] The only weird thing with this is the award is generally September the
[1:29:15] following year. >> Okay.
[1:29:16] » So, you might may not know until then. I spoke with the coast of DC
[1:29:22] for more complex projects that's pushed out to September. They want to give me a
[1:29:27] date basically. We can go maybe mid year around mid year for something simple as
[1:29:31] a oneoff one buy. Um so either way I would still budget this as a expenditure
[1:29:40] not as anything getting as a revenue for this. So it is a grant that you're
[1:29:44] applying for through >> yeah it's a no match grant so it would
[1:29:49] be fully funded if it is awarded. >> So budget the expense because you need
[1:29:53] it anyway but it's not a grant. Okay [clears throat]
[1:29:59] » it it's still here. Um we're putting a lot of money into it most of our budget
[1:30:03] for our whole fleet. Uh we've had transmission problems. Uh the mower the
[1:30:09] side mount mowers uh we had to get a whole new frame for it because just the
[1:30:14] stress of that thing over six 18 years uh you know up and down it gets we have
[1:30:20] a lot of stretch fractures in in the metal. We've had it repaired numerous
[1:30:25] times. So it's just starting to nickle and
[1:30:28] they'll go for auction. >> Yeah, we put it out on municip I
[1:30:32] believe. >> Um we do have a loader for it. So, um I
[1:30:36] talked with the guy uh from Stevenson or from Stevenson Equipment. They said
[1:30:41] 35,000 uh is what they probably give for it that they get back. So, I'm thinking
[1:30:46] this we would get even more than that for it. It is in decent looking shape.
[1:30:51] Uh now if somebody's using it as a roadside mower, it's, you know, it's
[1:30:55] it's going to be um need maintenance, but if somebody's using it occasionally,
[1:31:00] a homeowner or somebody might be a perfect.
[1:31:06] » Okay. Uh then we have 31 August 3rd for
[1:31:13] supervisor event minutes. Then we have August 10th order supervisor minutes.
[1:31:18] And then our zoning report. Brandon, there's no report.
[1:31:22] » Any addition items to be discussed? >> You knew?
[1:31:27] » Yes, I did. >> Okay. I'm glad you're sitting down.
[1:31:32] We're in record time here. 30 33 items. >> We're doing good.
[1:31:38] I won't run it too long. >> I'm glad you're sitting down, Brand.
[1:31:46] um these [clears throat] uh flowering pear trees that we got in
[1:31:52] the township. Um the there's a a good bit of stony or
[1:32:00] not stony. Um um
[1:32:05] [clears throat] >> are you talking about the Bradford
[1:32:07] pairs? >> I I thought they were called flowering
[1:32:10] pairs. >> Bradford
[1:32:12] Bradford. Okay. The ones that are out. Yeah, the invasive ones. Yeah.
[1:32:17] » Um I I was over at Sandra. She had uh her trees cut down and u I
[1:32:26] was [clears throat] uh looking at what they did
[1:32:31] and where the the flowering or the pear tree where the pear tree is and I can
[1:32:39] see why they outlot them and that is the the tan bark around the tree.
[1:32:46] There's things coming out about like my finger about this high
[1:32:52] » and they got leaves on it. >> It looks like a hedge coming
[1:32:57] [clears throat] >> and it looks like it would grow a hedge
[1:33:00] clean around the tree. tree was cut down and all the other trees cut down. And I
[1:33:07] happened to look at that one along with the other ones and there's something
[1:33:12] like sap coming out of the trunk of the tree sealing off the top. This thing's
[1:33:19] trying to trying to keep living and running these stems up.
[1:33:22] And then when I left, I I went up the hill past Sanders
[1:33:29] and turned to the right and came around to to loop around to go home. And up
[1:33:35] there, I see them this high coming out of the can.
[1:33:39] » Mhm. >> These things got to go. These things are
[1:33:41] like bamboo. You everyone in the township should be
[1:33:46] torn out right away as fast as they can get it cuz this is going to be a
[1:33:50] [clears throat] mess. Those are called suckers, Dave.
[1:33:53] » Well, I know they're suckers, but they're going to be trees.
[1:33:55] » I had I had to pull mine out with a tractor.
[1:33:57] » Yeah, we we cut them down regularly. >> Yeah.
[1:34:00] » Yeah. I I think we should get on it somehow.
[1:34:03] » I did replace it with another tree. >> What do you What do you mean by get on
[1:34:07] it?
[1:34:11] » We can't Mandy that people remove those trees. Well, I don't know how to
[1:34:18] homeowner, you know, to do anything about this.
[1:34:23] » Replace mine. >> The next thing they'll say is you're
[1:34:27] going to pay to replace mine. >> Mhm.
[1:34:30] » Well, I I don't know what to say that they're out of hand and it's going to
[1:34:34] [clears throat] be a big problem down the road depending on
[1:34:37] » it. All Bradford cars as far as I can see. You got a couple
[1:34:43] there's there's other other specimens that do that as well.
[1:34:47] » We have them out from here and every year we had the suckers and we put some
[1:34:50] spray on the ground and it ends up for a year. I mean it's it's just part of
[1:34:54] having those trees. I mean it's it's amazing. If you don't maintain it it's
[1:34:58] going to look like that, Dave. I mean that's just the way those trees are.
[1:35:02] » So they should have come off of the preferred tree list before they did if
[1:35:06] they've been taken off yet. But >> but they were part of the preferred
[1:35:11] trees that were listed in the ordinance >> for too.
[1:35:15] » Yeah. >> Well, but they were on the but they were
[1:35:17] on the ordinance as a they were in the preferred tree
[1:35:20] » at that time. They they weren't by the state, you know, the extension. They
[1:35:24] weren't all in any invasive list. Well, they were on the invasive list before
[1:35:30] they came off the ordinance, but >> it's
[1:35:38] Yeah, I mean, >> they're there. So, I mean,
[1:35:41] » these these things are going to, you know, the mile a minute stuff.
[1:35:47] » These are worse than that by >> It comes down to to maintenance. We have
[1:35:51] them here. We maintain them. It's not a problem. I mean, if they do that every
[1:35:54] year, you maintain them now. people under control. That's, you know, it's
[1:35:58] » Can [clears throat] I get a motion to adjourn?
[1:36:01] » You might get I get something else. >> Okay.
[1:36:04] » You think you're getting it all easy? >> Yes. [laughter]
[1:36:08] » Uh I uh like I said before, I was over at
[1:36:13] Woods Road for 9 days. I ran into a girl that I know that did the ice cream and
[1:36:21] I' I'm a member there for 30 years, so I've known her a long time. and didn't
[1:36:26] really know her name or anything. I just >> No, her name's Haley.
[1:36:33] » Um I I was talking to her and I said, "How
[1:36:37] come you're here at the ice cream stand at 5:00?" She said, "I got two jobs I go
[1:36:41] to and plus this." And I said, "Why?" She said, "Because of paying her college
[1:36:46] tuition." >> Okay. So, I got to talk to her and I
[1:36:51] found out that she went to college to be an engineer
[1:36:55] and she's the kind of engineer um uh like you have in a township.
[1:37:02] And I got talking with her a little bit, but she says she doesn't do that kind of
[1:37:06] work. She works for Penoni. And um what she does is she works
[1:37:13] uh for them, but she gets paid by Pendot and she's paid to uh do research on
[1:37:22] roads in townships. It doesn't cost the township anything.
[1:37:28] She she does stuff like uh [clears throat] checking how much
[1:37:31] traffic there is and and uh whether the road is needed or whatever and if it if
[1:37:38] it's a road that isn't there uh she can recommend to pend on to put
[1:37:45] you know to put it on the list to put a road there. So these roads that we need
[1:37:50] for interchanges, which are going to go up in smoke here within the next 5
[1:37:55] years, if we can get them to come in for free and lay out these roads that we
[1:38:02] need so that nobody builds on them, so we got them when we need them in, you
[1:38:09] know, 5 years. We need interchanges. >> No offense, D. Didn't we just do a
[1:38:13] comprehensive plan? >> Yeah, but guess what? This this puts
[1:38:17] clout in it. >> Can she come in and give us a
[1:38:20] presentation on what she can offer the township?
[1:38:23] » I Yes, I could get her in. I was just, you know, one other thing with u uh me
[1:38:31] and ye blue. Uh you know, because her outfit is very
[1:38:37] similar to this to the Benoni. [clears throat]
[1:38:39] Maybe we should have one of her people. I don't know.
[1:38:44] Um, I know that um that uh this girl's name is Haley Chavik
[1:38:49] and uh she that's what she does and I can find out but I don't know if uh uh
[1:38:57] and you have to see the scope of what what that is because yes there's
[1:39:00] companies that do traffic studies as far as traffic counts and stuff. It's not
[1:39:05] designing roads and and doing studies. >> [clears throat]
[1:39:10] » I'd like to, you know, see what the specifics are because I don't think
[1:39:14] they'd come in and design a route 15 bypass and look at it. They're not doing
[1:39:19] traffic counts, you know, intersection, uh, crash data reports, stuff like that.
[1:39:23] I know, you know, that type of stuff. Well, the like for um the drawings that
[1:39:28] we have in our comp plan, she she could look at this stuff, look where the roads
[1:39:34] go, figure that's the best way or another know the roots better or
[1:39:38] whatever it is and then recommend hear from her if that's what she can do
[1:39:44] because we don't really know what she can do.
[1:39:47] We met with PennDOT right after they had the whole presentation about Route 15
[1:39:51] resurfacing and and redoing in the next couple coming up the next couple years.
[1:39:55] And all three of those interchanges that are in the comp plan are have been and
[1:39:59] are in front of not only the PENDOT but your county uh planning commission.
[1:40:04] Okay. And uh that's been vetted and not really approved, quasi approved, but um
[1:40:10] it's already been down the pipe long enough to where the York County Planning
[1:40:14] Commission representative basically is telling us that you we are so far ahead
[1:40:18] of having those projects in the pipeline to be able to get uh approved by PENDOT.
[1:40:24] Okay. >> So um this might get us the approval.
[1:40:29] That wouldn't it would it would have to if it if she did came up with some other
[1:40:33] idea it would be at the very bottom of the list of projects which would be
[1:40:37] probably 20 plus years out >> and they're not going to require the
[1:40:41] rightway until they're ready to fund the project which
[1:40:44] » that doesn't help us on >> no matter what is going to say what's
[1:40:49] going to happen with the interchange nobody else no consultant not even our
[1:40:54] county planning commission it'll be pendot that makes the final approval
[1:40:59] present to present something. [clears throat]
[1:41:01] » I see the way I understand it, the roads we got now, there's going to be a
[1:41:06] development going across one of them. >> When those roads are gone in 5 years,
[1:41:12] we're done. >> There there is not going to be anything
[1:41:16] but these [clears throat] new entrance deel deceleration grants and
[1:41:22] acceleration ramps. And we're going to be looking, if they were put in right
[1:41:26] now, it would help a little bit, but we're looking at a disaster. And this is
[1:41:32] a disaster for this town. The Route 15 in Carol Township is super important
[1:41:39] because of the businesses on it. And we get a lot of revenue off of that. That's
[1:41:44] going to all be destroyed. And Pendot's having a ball doing it. If we don't do
[1:41:49] something to stop it and get this fixed, we're going to be in big trouble. We're
[1:41:54] already in big trouble because it should have had a bypass drawn up for nothing
[1:41:59] back in the '90s. That would have been land that was bought. They start buying
[1:42:03] land to do the bypass when it was necessary. Well, guess what? We don't
[1:42:08] got nothing. There's no plan. It's it's nothing but a band-aid to hold us for 5
[1:42:14] years. And at the end of the 5 years, we might as well not even have it. We we,
[1:42:19] you know, in a way, you know, if you're talking to Dave and that, we might as
[1:42:23] well go out and encourage all the building we can get. Eventually,
[1:42:27] somebody important from the state might live in this area that can't get to work
[1:42:33] and maybe we'll get something, but the only way we're going to get it is start
[1:42:37] tearing homes down. And that's where we're at. And I don't like that. as
[1:42:41] residents homes. I, you know, something should be done. I
[1:42:47] mean, we can't let this go. >> Yeah.
[1:42:49] » Thank you. >> I And I I've already, you know, backing
[1:42:53] up here a little bit, already checked with Donkeeper's office. Uh I got some
[1:42:58] names uh of people from Harrisburg in um uh [clears throat] the state government
[1:43:07] to try and get some help. I haven't gotten anywhere with it yet, but if I
[1:43:12] get something, I can let everybody know and then we can decide to go on it. But,
[1:43:17] uh, we got to get something moving. There's just absolutely nothing here to
[1:43:22] look forward to. >> Okay. Uh, let's see. Can I have a motion
[1:43:26] to adjurnn? >> I'll make a motion to
[1:43:29] » make a second. >> Second.
[1:43:31] » Any discussion? >> Ajourned.
